Ba\u015fvuru; bir banka \u00e7al\u0131\u015fan\u0131n\u0131n sosyal medya hesab\u0131ndan yapt\u0131\u011f\u0131 payla\u015f\u0131mlardan \u00f6t\u00fcr\u00fc i\u015f s\u00f6zle\u015fmesinin feshedilmesi nedeniyle ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc ile \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n, i\u015fe iade davas\u0131n\u0131n uzun s\u00fcrmesi nedeniyle de makul s\u00fcrede yarg\u0131lanma hakk\u0131n\u0131n ihlal edildi\u011fi iddialar\u0131na ili\u015fkindir.<\/p>\n<p>II. BA\u015eVURU S\u00dcREC\u0130<\/p>\n<p>2. Ba\u015fvuru 26\/12\/2019 tarihinde yap\u0131lm\u0131\u015ft\u0131r. Komisyon, ba\u015fvurunun kabul edilebilirlik ve esas incelemesinin B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na karar vermi\u015ftir.<\/p>\n<p>3. Ba\u015fvuru belgelerinin bir \u00f6rne\u011fi bilgi i\u00e7in Adalet Bakanl\u0131\u011f\u0131na (Bakanl\u0131k) g\u00f6nderilmi\u015ftir. Bakanl\u0131k, g\u00f6r\u00fc\u015f\u00fcn\u00fc bildirmi\u015ftir. Ba\u015fvurucu, Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 beyanda bulunmu\u015ftur.<\/p>\n<p>4. Birinci B\u00f6l\u00fcm ba\u015fvurunun Genel Kurul taraf\u0131ndan incelenmesine karar vermi\u015ftir.<\/p>\n<p>III. OLAY VE OLGULAR <\/p>\n<p>5. Ba\u015fvuru formu ve eklerinde ifade edildi\u011fi \u015fekliyle ilgili olaylar \u015f\u00f6yledir:<\/p>\n<p>6. Ba\u015fvurucu 1982 do\u011fumlu olup 2009 y\u0131l\u0131ndan i\u015f s\u00f6zle\u015fmesinin feshedildi\u011fi tarihe kadar T\u00fcrkiye Cumhuriyeti Ziraat Bankas\u0131 Anonim \u015eirketinde (Banka\/i\u015fveren) belirsiz s\u00fcreli i\u015f s\u00f6zle\u015fmesiyle \u00e7al\u0131\u015fm\u0131\u015ft\u0131r. Ba\u015fvurucu, i\u015f s\u00f6zle\u015fmesinin feshedildi\u011fi s\u0131rada Bankan\u0131n bir \u015fubesinde y\u00f6netmen yard\u0131mc\u0131s\u0131\/proje y\u00f6netim asistan\u0131 olarak g\u00f6rev yapmaktad\u0131r.<\/p>\n<p>7. Banka 25\/7\/2016 tarihinde &#8220;Sosyal medya \u00fczerinde yapt\u0131\u011f\u0131n\u0131z payla\u015f\u0131mlar\u0131n\/be\u011fenilerin Bankam\u0131z\u0131n sayg\u0131nl\u0131\u011f\u0131n\u0131 ve imaj\u0131n\u0131 zedeledi\u011fi gibi itibar kayb\u0131na neden oldu\u011fu tespit edilmi\u015ftir. Bu fiiliniz insan kaynaklar\u0131 y\u00f6netmeli\u011finin &#8216;..&#8217; ba\u015fl\u0131\u011f\u0131 ile d\u00fczenlenen 2.3 &#8216;&#8230;. &#8216; maddelerine ayk\u0131r\u0131l\u0131k te\u015fkil etmektedir. Bu itibarla &#8230; 4857 say\u0131l\u0131 \u0130\u015f Kanunu&#8217;nun i\u015f akdinin ge\u00e7erli nedenle feshini d\u00fczenleyen 18. maddesi gere\u011fince i\u015f s\u00f6zle\u015fmeniz feshedilmi\u015ftir.&#8221; gerek\u00e7esiyle ba\u015fvurucunun i\u015f s\u00f6zle\u015fmesini feshetmi\u015ftir.<\/p>\n<p>8. Ba\u015fvurucu, fesih i\u015fleminin haks\u0131z ve ge\u00e7ersiz oldu\u011funu belirterek Banka aleyhine i\u015fe iade talepli tespit davas\u0131 a\u00e7m\u0131\u015ft\u0131r. Davan\u0131n g\u00f6r\u00fcld\u00fc\u011f\u00fc Ankara 28. \u0130\u015f Mahkemesi (\u0130\u015f Mahkemesi) 14\/3\/2017 tarihinde davan\u0131n reddine karar vermi\u015ftir. Gerek\u00e7eli karar\u0131n ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Dosya aras\u0131nda bulunan sosyal medya payla\u015f\u0131mlar\u0131 incelendi\u011finde, 17\/07\/2016 g\u00fcn\u00fc al\u0131nan ve on d\u00f6rt saatten \u00f6nce payla\u015f\u0131ld\u0131\u011f\u0131 anla\u015f\u0131lan \u00e7\u0131kt\u0131 i\u00e7eriklerinde &#8216;d\u00fcn gece oynanan oyun sonras\u0131, k\u00f6kl\u00fc g\u00f6revden almalar kime yarad\u0131, kimin ekme\u011fine ya\u011f s\u00fcr\u00fcld\u00fc, darbe yap\u0131nca k\u00f6pr\u00fclerin bir y\u00f6n\u00fcn\u00fc kesmek yeterliymi\u015f, \u00f6\u011frendik ki 20-30 subay darbe yaparken di\u011fer binlercesi pokemon oynuyorlarm\u0131\u015f &#8216; vb ifadelerin yer ald\u0131\u011f\u0131, ya\u015fanan ola\u011fan\u00fcst\u00fc durum \u00fczerine halk\u0131n birlik ve beraberlik g\u00f6sterdi\u011fi b\u00f6ylesi bir zamanda gerek birlik beraberli\u011fi zedeleyici gerekse haberdar olan daval\u0131 i\u015fverende \u015f\u00fcpheye yol a\u00e7abilecek nitelikteki s\u00f6zlerin davac\u0131 taraf\u00e7a internet ortam\u0131na y\u00fcklendi\u011fi de inkar edilmedi\u011fine g\u00f6re, daval\u0131 bankan\u0131n \u00e7al\u0131\u015fanlar\u0131na ola\u011fan\u00fcst\u00fc d\u00f6nemlerde daha \u00f6zenli ve sorumlu davranmalar\u0131n\u0131 beklemesi ve aksi durumda i\u015f aktinin feshine karar vermesi do\u011fald\u0131r. <\/p>\n<p>Yukar\u0131daki a\u00e7\u0131klamalar \u0131\u015f\u0131\u011f\u0131nda feshin ge\u00e7erli nedene dayand\u0131\u011f\u0131n\u0131n tespiti ile davan\u0131n reddine&#8230;&#8221;<\/p>\n<p>9. Karara kar\u015f\u0131 istinaf kanun yoluna ba\u015fvurulmas\u0131 \u00fczerine dosyay\u0131 inceleyen Ankara B\u00f6lge Adliye Mahkemesi 8. Hukuk Dairesi (B\u00f6lge Adliye Mahkemesi) 10\/7\/2017 tarihinde \u0130\u015f Mahkemesi karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131na ve karar verilmesine yer olmad\u0131\u011f\u0131na karar vermi\u015ftir. Gerek\u00e7eli karar\u0131nda B\u00f6lge Adliye Mahkemesi i\u015f s\u00f6zle\u015fmesinin feshinin 23\/1\/2017 tarihli ve 29957 say\u0131l\u0131 Resm\u00ee Gazete&#8217;de yay\u0131mlanan 685 say\u0131l\u0131 Ola\u011fan\u00fcst\u00fc Hal \u0130\u015flemleri \u0130nceleme Komisyonu Kurulmas\u0131 Hakk\u0131nda Kanun H\u00fckm\u00fcnde Kararname (685 say\u0131l\u0131 KHK) kapsam\u0131na girdi\u011fini ve bu nedenle dosyan\u0131n Ola\u011fan\u00fcst\u00fc H\u00e2l \u0130\u015flemleri \u0130nceleme Komisyonuna (OHAL Komisyonu) g\u00f6nderilmesi gerekti\u011fini belirtmi\u015ftir.<\/p>\n<p>10. B\u00f6lge Adliye Mahkemesinin karar\u0131 \u00fczerine dosya, OHAL Komisyonuna g\u00f6nderilmi\u015ftir. OHAL Komisyonunca yap\u0131lan inceleme sonucunda 12\/10\/2017 tarihli karar ile i\u015fveren taraf\u0131ndan i\u015f s\u00f6zle\u015fmesinin 25\/7\/2016 tarihinde feshedildi\u011fi, OHAL kapsam\u0131nda do\u011frudan (ekli listede davac\u0131n\u0131n ismine yer verilmek suretiyle) kanun h\u00fckm\u00fcnde kararname (KHK) ile tesis edilen bir tedbirin uygulanmad\u0131\u011f\u0131 belirtilerek bu kapsamda Komisyonun inceleme g\u00f6revi olmayan dosyan\u0131n tekrar mahkemesine iade edilmesine karar verilmi\u015f ve \u0130\u015f Mahkemesince dosya yeniden de\u011ferlendirilmesi i\u00e7in B\u00f6lge Adliye Mahkemesine g\u00f6nderilmi\u015ftir.<\/p>\n<p>11. Dosyay\u0131 inceleyen B\u00f6lge Adliye Mahkemesi 19\/2\/2018 tarihinde, \u0130\u015f Mahkemesinin karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131na ve davan\u0131n yeniden g\u00f6r\u00fclmesi i\u00e7in dosyan\u0131n mahkemesine iadesine karar vermi\u015ftir. Gerek\u00e7eli karar\u0131n ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Dairemizce dosya \u00fczerinde yap\u0131lan yeniden inceleme sonucunda; her ne kadar davac\u0131n\u0131n sosyal medya hesab\u0131ndan payla\u015ft\u0131\u011f\u0131 i\u00e7erikler nedeniyle i\u015f akdi feshedilmi\u015f ise de; davac\u0131n\u0131n sosyal medya hesab\u0131ndan payla\u015ft\u0131\u011f\u0131 i\u00e7eriklerin tekrar incelenip davac\u0131n\u0131n savunmas\u0131nda 15 Temmuz 2016 tarihinde ya\u015fanan darbe giri\u015fimi ile ilgili FET\u00d6\/PDY ter\u00f6r \u00f6rg\u00fct\u00fc aleyhine de payla\u015f\u0131mlar yapt\u0131\u011f\u0131 hususunu belirtmi\u015f olmas\u0131 kar\u015f\u0131s\u0131nda bununla ilgili delil ve payla\u015f\u0131mlar\u0131n toplanmad\u0131\u011f\u0131 anla\u015f\u0131lmakla davac\u0131 taraf\u0131n g\u00f6sterdi\u011fi delillerin toplanmas\u0131 ayr\u0131ca Yarg\u0131tay 22. Hukuk Dairesinin 22.11.2017 g\u00fcn, 2017\/42856-25621 K. say\u0131l\u0131 ilam\u0131ndaki &#8216;.. davac\u0131n\u0131n i\u015f akdinin feshine neden olan bilgi ve belgeler i\u015fverence ibraz edilememi\u015ftir. Davac\u0131n\u0131n i\u015f akdinin feshine dayanak objektif de\u011ferlendirmelerin neler oldu\u011fu, hangi bilgi ve belgelerin feshe gerek\u00e7e yap\u0131ld\u0131\u011f\u0131 daval\u0131 Kurumdan ara\u015ft\u0131r\u0131lmal\u0131; ayr\u0131ca davac\u0131 hakk\u0131nda mevcut ise adli ya da idari soru\u015fturma evraklar\u0131, Emniyet Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc ve Jandarma Genel Komutanl\u0131\u011f\u0131&#8217;n\u0131n Ter\u00f6rle M\u00fccadele, Ka\u00e7ak\u00e7\u0131l\u0131k, Organize Su\u00e7lar ve \u0130stihbarat ile ilgili birimlerinden ve Bilgi Teknolojileri Kurumundan varsa davac\u0131 ile ilgili bilgi ve belgeler ile yine Bankasya&#8217;ya a\u00e7\u0131lm\u0131\u015f mevduat hesaplar\u0131, hesap hareketleri ve bankac\u0131l\u0131\u011fa ili\u015fkin i\u015flemler olup olmad\u0131\u011f\u0131 sorulmal\u0131, t\u00fcm bilgi ve belgeler de\u011ferlendirilerek sonucuna g\u00f6re h\u00fck\u00fcm kurulmal\u0131d\u0131r. Eksik incelemeyle yaz\u0131l\u0131 gerek\u00e7e ile sadece fesihte \u015fekli y\u00f6nden inceleme yap\u0131larak davan\u0131n kabul\u00fc hatal\u0131 olup bozmay\u0131 gerektirmi\u015ftir&#8230;&#8217; \u015feklindeki tespitler de dikkate al\u0131nd\u0131\u011f\u0131nda ilk derece mahkemesince emsal bozma ilam\u0131nda belirtilen hususlar ile ilgili gerekli inceleme ve ara\u015ft\u0131rmalar\u0131n yap\u0131l\u0131p taraflar\u0131n g\u00f6sterdi\u011fi deliller toplan\u0131p sonucuna g\u00f6re karar verilmesi gerekti\u011finden ilk derece mahkemesi karar\u0131n\u0131n 353-(1) a-6 maddesi gere\u011fince kald\u0131r\u0131lmas\u0131na, dosyan\u0131n davan\u0131n yeniden g\u00f6r\u00fclmesi i\u00e7in mahkemesine iadesine&#8230;&#8221;<\/p>\n<p>12. Yeniden yarg\u0131lama sonucunda \u0130\u015f Mahkemesi 6\/12\/2018 tarihinde davan\u0131n reddine karar vermi\u015ftir. Gerek\u00e7eli karar\u0131n ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;&#8230; Daval\u0131 Bankan\u0131n, B\u00f6lge Adliye Mahkemesi karar\u0131ndan sonra ibraz etti\u011fi dilek\u00e7e ve ekindeki sosyal medya \u00e7\u0131kt\u0131lar\u0131n\u0131n incelenmesinden davac\u0131n\u0131n 15 Temmuz silahl\u0131 ter\u00f6r \u00f6rg\u00fct\u00fc FET\u00d6 darbe giri\u015fimi ile ilgili olarak &#8216;D\u00fcn gece oynanan oyun sonras\u0131 hangi g\u00f6r\u00fc\u015ften olursan\u0131z olun, bu sorular\u0131 kendinize sorun, b\u00fct\u00fcn darbeler h\u00fck\u00fcmete yap\u0131l\u0131yorsa neden bir tane h\u00fck\u00fcmet eleman\u0131 vali, kaymakam&#8217;a bir \u015fey olmad\u0131, darbeden haberi olmayanlar bir ka\u00e7 saat sonra nas\u0131l darbeci diye 2.745 hakimi g\u00f6revden ald\u0131. Bu kadar k\u0131sa zamanda nas\u0131l darbeci olduklar\u0131 tespit edildi. \u00dclkede sadece 3-5 sava\u015f u\u00e7a\u011f\u0131 m\u0131 var? Di\u011ferleri tamirde mi?&#8230; Darbecilerin cumhurba\u015fkan\u0131 otelden ayr\u0131ld\u0131ktan sonra oteli basma\u0131na ne demeli?&#8230; Olay\u0131n kazanan\u0131 kimse yapan da odur&#8230;&#8217; gibi bir\u00e7ok payla\u015f\u0131mlarda bulundu\u011fu, davac\u0131n\u0131n da ikrar\u0131 ile ayn\u0131 g\u00fcn payla\u015f\u0131m\u0131 sildi\u011fi sabittir.<\/p>\n<p>\u00dclkemizin son derece talihsiz bir \u015fekilde 15 Temmuz&#8217;u ya\u015famas\u0131 kar\u015f\u0131s\u0131nda davac\u0131n\u0131n silahl\u0131 darbe giri\u015fimini oyun olarak nitelendirmesi i\u015fveren taraf\u0131ndan kabul edilebilir bir davran\u0131\u015f de\u011fildir. Yaz\u0131l\u0131 fesih bildiriminde fesih gerek\u00e7esi de a\u00e7\u0131k ve net olarak belirtilmi\u015ftir. Sosyal medya hesab\u0131ndan davac\u0131 taraf\u0131ndan yap\u0131lan bu payla\u015f\u0131mlar bankan\u0131n kurumsal imaj\u0131n\u0131 zedeler niteliktedir. Daval\u0131 banka davac\u0131n\u0131n i\u015f akdini ge\u00e7erli nedenle fesih etti\u011finden davan\u0131n reddine karar verilerek a\u015fa\u011f\u0131daki \u015fekilde h\u00fck\u00fcm tesis edilmi\u015ftir.&#8221;<\/p>\n<p>13. Karara kar\u015f\u0131 istinaf kanun yoluna ba\u015fvurulmas\u0131 \u00fczerine dosyay\u0131 inceleyen B\u00f6lge Adliye Mahkemesi 8\/11\/2019 tarihinde kesin olmak \u00fczere davan\u0131n reddine karar vermi\u015ftir. Gerek\u00e7eli karar\u0131n ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8221; &#8230; \u015e\u00fcphe feshi, i\u015fverenin i\u015f\u00e7isinin su\u00e7 i\u015fledi\u011fi veya i\u015f s\u00f6zle\u015fmesine esasl\u0131 \u015fekilde ayk\u0131r\u0131 davrand\u0131\u011f\u0131n\u0131 ispatlayamad\u0131\u011f\u0131 veya hen\u00fcz ispatlayacak durumda olmad\u0131\u011f\u0131 hallere \u00f6zg\u00fc istisnai nitelikte bir fesih t\u00fcr\u00fcd\u00fcr.<\/p>\n<p>Ciddi, \u00f6nemli ve somut olaylar\u0131n hakl\u0131 k\u0131ld\u0131\u011f\u0131 giderilemeyen \u015f\u00fcphe, g\u00fcvenin yo\u011fun oldu\u011fu i\u015f ili\u015fkisinde, i\u015fverenin o i\u015f\u00e7iden bekledi\u011fi i\u015fg\u00f6rme ediminin ifas\u0131n\u0131 anlams\u0131z hale getirir. \u0130\u015f\u00e7inin ki\u015fili\u011finin \u00f6nemli bir yer tuttu\u011fu i\u015f s\u00f6zle\u015fmesinde, i\u015fverenin duydu\u011fu g\u00fc\u00e7l\u00fc \u015f\u00fcphe i\u015f\u00e7inin o i\u015f i\u00e7in uygunlu\u011funu da ortadan kald\u0131r\u0131r&#8230; Bu y\u00f6n\u00fcyle \u015f\u00fcphe feshi, i\u015f\u00e7iye verilen bir ceza olmamakla birlikte, i\u015fverenin kendisinin ve i\u015fletmesinin menfaatlerini korumak i\u00e7in s\u00f6zle\u015fmesel bir ara\u00e7t\u0131r&#8230;<\/p>\n<p>\u015e\u00fcphe feshi i\u00e7in, bu \u015f\u00fcpheyi hakl\u0131 k\u0131lan ciddi, \u00f6nemli ve somut vak\u0131alar\u0131n varl\u0131\u011f\u0131n\u0131n ispat\u0131 gerekmektedir. Ancak burada ispat\u0131 gereken \u015fey vak\u0131an\u0131n kendisi de\u011fil, \u015f\u00fcpheyi hakl\u0131 k\u0131lan vak\u0131ad\u0131r. Nitekim, i\u015f\u00e7inin davran\u0131\u015f\u0131n\u0131n \u0130\u015f Kanununda d\u00fczenlenen hakl\u0131 veya ge\u00e7erli sebeplerden birisi kapsam\u0131nda oldu\u011fu a\u00e7\u0131k\u00e7a anla\u015f\u0131lmakta ise, b\u00f6yle bir durumda zaten \u015f\u00fcphe feshi yap\u0131lamaz. \u015e\u00fcphe feshinin tayininde, s\u0131rf i\u015fverenin s\u00fcbjektif de\u011ferlendirmesi yeterli de\u011fildir. Buna g\u00f6re, \u015f\u00fcpheye ait unsurlar\u0131n mevcut olup olmad\u0131\u011f\u0131, s\u00f6z konusu \u015f\u00fcphenin i\u015fverenin i\u015f\u00e7iye duydu\u011fu g\u00fcveni a\u011f\u0131r bi\u00e7imde zedeleyip zedelemedi\u011fi ve son olarak bu \u015f\u00fcphe sebebiyle i\u015fverenin i\u015f\u00e7iyi \u00e7al\u0131\u015ft\u0131rmaya devam edip edemeyece\u011fi her somut olay\u0131n \u00f6zelli\u011fine g\u00f6re, hakim taraf\u0131ndan resen de\u011ferlendirilmelidir. <\/p>\n<p>Dosya kapsam\u0131nda mevcut CD i\u00e7eri\u011fine g\u00f6re davac\u0131n\u0131n Bank Asya da hesab\u0131 bulunmas\u0131 ve sosyal medya \u00fczerinden yap\u0131lan payla\u015f\u0131mlar\u0131n i\u00e7eri\u011fi dikkate al\u0131nd\u0131\u011f\u0131nda daval\u0131 i\u015fverenin i\u015f s\u00f6zle\u015fmesini fesih nedeni dikkate al\u0131nd\u0131\u011f\u0131nda feshin \u015f\u00fcphe feshi niteli\u011finde oldu\u011fu, i\u015fverenden i\u015f ili\u015fkisini s\u00fcrd\u00fcrmesinin beklenemeyece\u011fi, feshin ge\u00e7erli nedene dayand\u0131\u011f\u0131n\u0131 anla\u015f\u0131lm\u0131\u015f, taraflar\u0131n kar\u015f\u0131l\u0131kl\u0131 iddia ve savunmalar\u0131na, dayand\u0131klar\u0131 belgelere, hukuki ili\u015fkinin nitelendirilmesine, vak\u0131a mahkemesi hakiminin objektif, dosyadaki verilerle \u00e7eli\u015fmeyen tespitlerine ve uyu\u015fmazl\u0131\u011fa uygulanmas\u0131 gereken hukuk kurallar\u0131na g\u00f6re, HMK\u2019n\u0131n 355. maddesi uyar\u0131nca istinaf sebepleriyle s\u0131n\u0131rl\u0131 olarak ve resen kamu d\u00fczeni y\u00f6n\u00fcnden yap\u0131lan inceleme sonucu; ilk derece mahkemesinin vak\u0131a ve hukuki de\u011ferlendirmesinde usul ve esas y\u00f6n\u00fcnden yasaya ayk\u0131r\u0131l\u0131k bulunmad\u0131\u011f\u0131 kanaatine var\u0131larak, davac\u0131 taraf\u0131n istinaf ba\u015fvurusunun esas y\u00f6n\u00fcnden reddine&#8230;&#8221;<\/p>\n<p>14. Ba\u015fvurucu, nihai karar\u0131 27\/11\/2019 tarihinde \u00f6\u011frendikten sonra s\u00fcresinde bireysel ba\u015fvuruda bulunmu\u015ftur.<\/p>\n<p>IV. \u0130LG\u0130L\u0130 HUKUK<\/p>\n<p>A. Ulusal Hukuk<\/p>\n<p>15. 22\/5\/2003 tarihli ve 4857 say\u0131l\u0131 \u0130\u015f Kanunu&#8217;nun &#8220;Feshin ge\u00e7erli sebebe dayand\u0131r\u0131lmas\u0131&#8221; ba\u015fl\u0131kl\u0131 18. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8221;Otuz veya daha fazla i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fyerlerinde en az alt\u0131 ayl\u0131k k\u0131demi olan i\u015f\u00e7inin belirsiz s\u00fcreli i\u015f s\u00f6zle\u015fmesini fesheden i\u015fveren, i\u015f\u00e7inin yeterlili\u011finden veya davran\u0131\u015flar\u0131ndan ya da i\u015fletmenin, i\u015fyerinin veya i\u015fin gereklerinden kaynaklanan ge\u00e7erli bir sebebe dayanmak zorundad\u0131r.&#8217;<\/p>\n<p>Alt\u0131 ayl\u0131k k\u0131dem hesab\u0131nda bu Kanunun 66 nc\u0131 maddesindeki s\u00fcreler dikkate al\u0131n\u0131r.<\/p>\n<p>\u00d6zellikle a\u015fa\u011f\u0131daki hususlar fesih i\u00e7in ge\u00e7erli bir sebep olu\u015fturmaz:<\/p>\n<p>a) Sendika \u00fcyeli\u011fi veya \u00e7al\u0131\u015fma saatleri d\u0131\u015f\u0131nda veya i\u015fverenin r\u0131zas\u0131 ile \u00e7al\u0131\u015fma saatleri i\u00e7inde sendikal faaliyetlere kat\u0131lmak.<\/p>\n<p>b) \u0130\u015fyeri sendika temsilcili\u011fi yapmak.<\/p>\n<p>c) Mevzuattan veya s\u00f6zle\u015fmeden do\u011fan haklar\u0131n\u0131 takip veya y\u00fck\u00fcml\u00fcl\u00fcklerini yerine getirmek i\u00e7in i\u015fveren aleyhine idari veya adli makamlara ba\u015fvurmak veya bu hususta ba\u015flat\u0131lm\u0131\u015f s\u00fcrece kat\u0131lmak.<\/p>\n<p>d) Irk, renk, cinsiyet, medeni hal, aile y\u00fck\u00fcml\u00fcl\u00fckleri, hamilelik, do\u011fum, din, siyasi g\u00f6r\u00fc\u015f ve benzeri nedenler.<\/p>\n<p>e) 74 \u00fcnc\u00fc maddede \u00f6ng\u00f6r\u00fclen ve kad\u0131n i\u015f\u00e7ilerin \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131n\u0131n yasak oldu\u011fu s\u00fcrelerde i\u015fe gelmemek.<\/p>\n<p>f) Hastal\u0131k veya kaza nedeniyle 25 inci maddenin (I) numaral\u0131 bendinin (b) alt bendinde \u00f6ng\u00f6r\u00fclen bekleme s\u00fcresinde i\u015fe ge\u00e7ici devams\u0131zl\u0131k.<\/p>\n<p>\u0130\u015f\u00e7inin alt\u0131 ayl\u0131k k\u0131demi, ayn\u0131 i\u015fverenin bir veya de\u011fi\u015fik i\u015fyerlerinde ge\u00e7en s\u00fcreler birle\u015ftirilerek hesap edilir. \u0130\u015fverenin ayn\u0131 i\u015fkolunda birden fazla i\u015fyerinin bulunmas\u0131 halinde, i\u015fyerinde \u00e7al\u0131\u015fan i\u015f\u00e7i say\u0131s\u0131, bu i\u015fyerlerinde \u00e7al\u0131\u015fan toplam i\u015f\u00e7i say\u0131s\u0131na g\u00f6re belirlenir.<\/p>\n<p>&#8230;&#8221;<\/p>\n<p>16. 4857 say\u0131l\u0131 Kanun&#8217;un &#8220;S\u00f6zle\u015fmenin feshinde usul&#8221; ba\u015fl\u0131kl\u0131 19. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;\u0130\u015fveren fesih bildirimini yaz\u0131l\u0131 olarak yapmak ve fesih sebebini a\u00e7\u0131k ve kesin bir \u015fekilde belirtmek zorundad\u0131r.<\/p>\n<p>Hakk\u0131ndaki iddialara kar\u015f\u0131 savunmas\u0131n\u0131 almadan bir i\u015f\u00e7inin belirsiz s\u00fcreli i\u015f s\u00f6zle\u015fmesi, o i\u015f\u00e7inin davran\u0131\u015f\u0131 veya verimi ile ilgili nedenlerle feshedilemez. Ancak, i\u015fverenin 25 inci maddenin (II) numaral\u0131 bendi \u015fartlar\u0131na uygun fesih hakk\u0131 sakl\u0131d\u0131r.&#8221;<\/p>\n<p>17. 4857 say\u0131l\u0131 Kanun&#8217;un &#8221;\u0130\u015fverenin hakl\u0131 nedenle derhal fesih hakk\u0131&#8221; ba\u015fl\u0131kl\u0131 25. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>II- Ahlak ve iyi niyet kurallar\u0131na uymayan haller ve benzerleri:<\/p>\n<p>&#8230;<\/p>\n<p>e) \u0130\u015f\u00e7inin, i\u015fverenin g\u00fcvenini k\u00f6t\u00fcye kullanmak, h\u0131rs\u0131zl\u0131k yapmak, i\u015fverenin meslek s\u0131rlar\u0131n\u0131 ortaya atmak gibi do\u011fruluk ve ba\u011fl\u0131l\u0131\u011fa uymayan davran\u0131\u015flarda bulunmas\u0131&#8230;&#8221;<\/p>\n<p>B. Uluslararas\u0131 Hukuk<\/p>\n<p>1. \u0130fade \u00d6zg\u00fcrl\u00fc\u011f\u00fc Y\u00f6n\u00fcnden<\/p>\n<p>18. Avrupa \u0130nsan Haklar\u0131 Mahkemesi (A\u0130HM) Melike\/T\u00fcrkiye (B. No: 35786\/19, 15\/06\/2021) karar\u0131nda ba\u015fvurucunun sosyal medya be\u011fenileri nedeniyle g\u00f6revine son verilmesini ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlali olarak g\u00f6rm\u00fc\u015ft\u00fcr. Somut olayda bir mill\u00ee e\u011fitim kurumunun temizlik hizmetlerinde s\u00f6zle\u015fmeli i\u015f\u00e7i stat\u00fcs\u00fcnde g\u00f6revli olan ba\u015fvurucu, sosyal medyada \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin payla\u015f\u0131mlar\u0131n\u0131 be\u011fenmesi nedeniyle tazminat \u00f6denmeksizin, toplu i\u015f s\u00f6zle\u015fmesine istinaden yetkili disiplin kurulunun verdi\u011fi bir kararla i\u015ften \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r. Ba\u015fvurucu, hakk\u0131ndaki karara kar\u015f\u0131 i\u015f mahkemesinde dava a\u00e7m\u0131\u015ft\u0131r. \u0130\u015f mahkemesi, ba\u015fvurucunun be\u011fendi\u011fi sosyal medya i\u00e7eriklerinin ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc kapsam\u0131nda de\u011ferlendirilemeyece\u011fini ve ba\u015fvurucunun \u00e7al\u0131\u015ft\u0131\u011f\u0131 okulda huzuru ve bar\u0131\u015f\u0131 etkileyebilecek nitelikte oldu\u011funu, dolay\u0131s\u0131yla sald\u0131r\u0131 mahiyetindeki i\u00e7eriklerin ebeveynlerde ve \u00e7ocuklarda kayg\u0131 olu\u015fturabilece\u011fini belirtmi\u015f; di\u011fer baz\u0131 i\u00e7eriklerin de siyasi nitelikli oldu\u011funa h\u00fckmederek ba\u015fvurucunun davas\u0131n\u0131 reddetmi\u015ftir.<\/p>\n<p>19. A\u0130HM s\u00f6z konusu kararda ulusal mahkemelerin ilgili i\u00e7erikleri, yay\u0131mland\u0131klar\u0131 ba\u011flamdan kopard\u0131klar\u0131n\u0131 ve bir b\u00fct\u00fcn olarak de\u011ferlendirmediklerini tespit etmi\u015ftir. A\u0130HM\u2019in tespitlerine g\u00f6re be\u011fenilen payla\u015f\u0131mlar; makamlar\u0131n bask\u0131c\u0131 uygulamalar\u0131 hakk\u0131nda a\u011f\u0131r ele\u015ftiriler, bu uygulamalara kar\u015f\u0131 g\u00f6steri d\u00fczenleme \u00e7a\u011fr\u0131lar\u0131, bir baro ba\u015fkan\u0131n\u0131n \u00f6ld\u00fcr\u00fclmesine kar\u015f\u0131 g\u00f6sterilen \u00f6fke, idari makamlar\u0131n denetledi\u011fi kurumlarda yetim \u00e7ocuklar\u0131n taciz edildi\u011fine ili\u015fkin iddialar ve tan\u0131nm\u0131\u015f bir din\u00ee fig\u00fcr\u00fcn cinsiyet\u00e7i olarak alg\u0131lanan bir ifadesine y\u00f6nelik tepkiler gibi konular\u0131 i\u00e7ermektedir. A\u0130HM; ba\u015fvurucunun g\u00f6revine nazaran temsil g\u00f6revinin \u00e7ok k\u0131s\u0131tl\u0131 oldu\u011funu, sosyal medyadaki be\u011fenilerinin \u00e7ocuklar, ebeveynler, di\u011fer \u00f6\u011fretmenler veya \u00e7al\u0131\u015fanlar \u00fczerindeki etkisinin ciddi olmayaca\u011f\u0131n\u0131 de\u011ferlendirmi\u015ftir. A\u0130HM bu nedenle disiplin kurulunun ve mahkemelerin ba\u015fvurucunun eylemlerinin i\u015fyerindeki huzuru ve d\u00fczeni bozdu\u011funa karar verirken somut olaydaki t\u00fcm ko\u015fullar\u0131 dikkate almad\u0131\u011f\u0131n\u0131 de\u011ferlendirmi\u015f, ba\u015fvurucunun i\u015ften \u00e7\u0131kar\u0131lmas\u0131 hakk\u0131nda verilen gerek\u00e7elerin yeterli olmad\u0131\u011f\u0131na h\u00fckmetmi\u015ftir. Son olarak disiplin kurulunun verdi\u011fi kararda, toplu i\u015f s\u00f6zle\u015fmesinde \u00f6ng\u00f6r\u00fclen en a\u011f\u0131r ceza olan tazminats\u0131z i\u015ften \u00e7\u0131karma cezas\u0131n\u0131n bilhassa ba\u015fvurucunun k\u0131demi ve ya\u015f\u0131 de\u011ferlendirilmeksizin uygulanmas\u0131 nedeniyle ba\u015fvurucunun ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne yap\u0131lan m\u00fcdahale ile izlenen me\u015fru ama\u00e7 aras\u0131nda makul bir denge olmad\u0131\u011f\u0131n\u0131 tespit etmi\u015ftir (Melike \/T\u00fcrkiye, \u00a7\u00a7 38-56). <\/p>\n<p>2. \u00d6zel Hayata Sayg\u0131 Hakk\u0131 Y\u00f6n\u00fcnden<\/p>\n<p>20. A\u0130HM i\u00e7tihatlar\u0131nda, \u00f6zel hayat\u0131n eksiksiz bir tan\u0131m\u0131 bulunmayan geni\u015f bir kavram oldu\u011fu belirtilmektedir. \u00d6zel hayata sayg\u0131 hakk\u0131 alt kategorisinde ge\u00e7en \u00f6zel hayat kavram\u0131 A\u0130HM taraf\u0131ndan olduk\u00e7a geni\u015f yorumlanmakta ve bu kavrama ili\u015fkin t\u00fcketici bir tan\u0131m yap\u0131lmaktan \u00f6zellikle ka\u00e7\u0131n\u0131lmaktad\u0131r (Koch\/Almanya, B. No: 497\/09, 19\/7\/2012, \u00a7 51). Bununla birlikte Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi&#8217;nin (S\u00f6zle\u015fme) denetim organlar\u0131n\u0131n i\u00e7tihatlar\u0131nda bireyin ki\u015fili\u011fini serbest\u00e7e geli\u015ftirmesi ve ger\u00e7ekle\u015ftirmesi ile ki\u015fisel ba\u011f\u0131ms\u0131zl\u0131k kavramlar\u0131n\u0131n \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n kapsam\u0131n\u0131n belirlenmesinde temel al\u0131nd\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r (Sidabras ve D\u017eiautas\/Litvanya, B. A\u0130HM&#8217;e g\u00f6re mesleki hayat \u00f6zel hayat kavram\u0131 d\u0131\u015f\u0131nda tutulamaz. \u00d6zel hayat unsurlar\u0131 gerek\u00e7e g\u00f6sterilerek mesleki hayata getirilen s\u0131n\u0131rlamalar, bireyin sosyal kimli\u011fini etkiledi\u011fi \u00f6l\u00e7\u00fcde S\u00f6zle\u015fme\u2019nin 8. maddesi kapsam\u0131na girebilmektedir. A\u0130HM bireylerin genellikle i\u015f ya\u015fam\u0131nda d\u0131\u015f d\u00fcnyayla ili\u015fkiler kurdu\u011funu hat\u0131rlatarak bireyin kimli\u011fini olu\u015fturmas\u0131n\u0131n ve sosyalle\u015fmesinin \u00f6nemli bir arac\u0131 olan d\u0131\u015f d\u00fcnyayla ili\u015fki kurma hakk\u0131n\u0131n bireyin i\u015f \u00e7evresini de kapsad\u0131\u011f\u0131n\u0131, bu durumun serbest meslek ba\u011flam\u0131nda \u00f6zellikle ge\u00e7erli oldu\u011funu ifade etmi\u015ftir (Niemitz\/Almanya, B. Ba\u015fvurucu;<\/p>\n<p>-Sosyal medya hesab\u0131ndaki payla\u015f\u0131mlar\u0131n i\u015fveren taraf\u0131ndan hukuka ayk\u0131r\u0131 olarak ele ge\u00e7irildi\u011fini, i\u015f s\u00f6zle\u015fmesinin feshinden \u00f6nce savunmas\u0131n\u0131n al\u0131nmad\u0131\u011f\u0131n\u0131, lehine olan delillerin toplanmad\u0131\u011f\u0131n\u0131, i\u015f s\u00f6zle\u015fmesinin feshinin kanuna uygun olmad\u0131\u011f\u0131n\u0131 ve ge\u00e7erli fesih kapsam\u0131nda kalmad\u0131\u011f\u0131n\u0131,<\/p>\n<p>-Siyasi g\u00f6r\u00fc\u015fleri sebebiyle i\u015f s\u00f6zle\u015fmesinin feshedildi\u011fini, sosyal medya payla\u015f\u0131mlar\u0131n\u0131n i\u00e7erik olarak ele\u015ftiri mahiyetinde oldu\u011funu, 15 Temmuz darbe giri\u015fiminden hemen sonras\u0131nda bir\u00e7ok kimsenin olaylara sorgulamac\u0131 bi\u00e7imde yakla\u015ft\u0131\u011f\u0131n\u0131, kendisinin de payla\u015f\u0131mlar\u0131 k\u0131sa bir s\u00fcre sonra sildi\u011fini, darbe giri\u015fimi aleyhine yapt\u0131\u011f\u0131 payla\u015f\u0131mlar\u0131n g\u00f6zard\u0131 edildi\u011fini iddia etmi\u015ftir.<\/p>\n<p>28. Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcnde; mevcut ba\u015fvuruda ba\u015fvurucunun ihlal iddialar\u0131 konusunda Anayasa Mahkemesi taraf\u0131ndan yap\u0131lacak incelemede Anayasa ve ilgili mevzuat h\u00fck\u00fcmlerinin, Anayasa Mahkemesi i\u00e7tihad\u0131n\u0131n ve somut olay\u0131n kendine \u00f6zg\u00fc ko\u015fullar\u0131n\u0131n dikkate al\u0131nmas\u0131 gerekti\u011fi belirtilmi\u015ftir. Ba\u015fvurucu, Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 \u00f6nceki beyanlar\u0131n\u0131 tekrar ederek Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcn\u00fc kabul etmedi\u011fini belirtmi\u015ftir.<\/p>\n<p>2. De\u011ferlendirme<\/p>\n<p>29. Anayasa Mahkemesi, olaylar\u0131n ba\u015fvurucu taraf\u0131ndan yap\u0131lan hukuki nitelendirmesi ile ba\u011fl\u0131 olmay\u0131p olay ve olgular\u0131n hukuki tavsifini kendisi takdir eder. Ba\u015fvurucunun iddialar\u0131n\u0131n sosyal medya hesab\u0131nda bir k\u0131s\u0131m payla\u015f\u0131mda bulunmas\u0131 nedeniyle i\u015f s\u00f6zle\u015fmesinin feshedilmesine y\u00f6nelik i\u015flemler b\u00fct\u00fcn\u00fcne dayand\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. Bu h\u00e2liyle ba\u015fvuru \u00f6ncelikle ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc ilgilendirmektedir. \u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fc ki\u015finin haber ve bilgilere, ba\u015fkalar\u0131n\u0131n fikirlerine serbest\u00e7e ula\u015fabilmesi, d\u00fc\u015f\u00fcnce ve kanaatlerinden dolay\u0131 k\u0131nanmamas\u0131 ve bunlar\u0131 tek ba\u015f\u0131na veya ba\u015fkalar\u0131yla birlikte \u00e7e\u015fitli yollarla serbest\u00e7e ifade edebilmesi, anlatabilmesi, savunabilmesi, ba\u015fkalar\u0131na aktarabilmesi ve yayabilmesi anlam\u0131na gelir. \u00c7o\u011funlu\u011fa muhalif olanlar da d\u00e2hil olmak \u00fczere d\u00fc\u015f\u00fcncelerin her t\u00fcrl\u00fc ara\u00e7la a\u00e7\u0131klanmas\u0131, a\u00e7\u0131klanan d\u00fc\u015f\u00fcnceye payda\u015f sa\u011flanmas\u0131, d\u00fc\u015f\u00fcnceyi ger\u00e7ekle\u015ftirme ve ger\u00e7ekle\u015ftirme konusunda ba\u015fkalar\u0131n\u0131 ikna etme \u00e7abalar\u0131 ile bu \u00e7abalar\u0131n ho\u015fg\u00f6r\u00fcyle kar\u015f\u0131lanmas\u0131 \u00e7o\u011fulcu demokratik d\u00fczenin gereklerindendir. Dolay\u0131s\u0131yla toplumsal ve siyasal \u00e7o\u011fulculu\u011fu sa\u011flamak, her t\u00fcrl\u00fc d\u00fc\u015f\u00fcncenin bar\u0131\u015f\u00e7\u0131l bir \u015fekilde ve serbest\u00e7e ifade edilmesine ba\u011fl\u0131d\u0131r. Bu itibarla d\u00fc\u015f\u00fcnceyi a\u00e7\u0131klama ve yayma \u00f6zg\u00fcrl\u00fc\u011f\u00fc demokrasinin i\u015fleyi\u015fi i\u00e7in ya\u015famsal \u00f6nemdedir (Bekir Co\u015fkun [GK], B. No: 2014\/12151, 4\/6\/2015, \u00a7\u00a7 33-35; Mehmet Ali Ayd\u0131n [GK], B. No: 2013\/9343, 4\/6\/2015, \u00a7\u00a7 42, 43; Tansel \u00c7\u00f6la\u015fan, B. No: 2014\/6128, 7\/7\/2015, \u00a7\u00a7 35-38). Bu y\u00f6n\u00fcyle ba\u015fvurunun Anayasa\u2019n\u0131n 26. maddesinde g\u00fcvence alt\u0131na al\u0131nan ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc kapsam\u0131nda incelenmesi gerekti\u011fi sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>30. Anayasa\u2019n\u0131n &#8220;D\u00fc\u015f\u00fcnceyi a\u00e7\u0131klama ve yayma h\u00fcrriyeti&#8221; ba\u015fl\u0131kl\u0131 26. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Herkes, d\u00fc\u015f\u00fcnce ve kanaatlerini s\u00f6z, yaz\u0131, resim veya ba\u015fka yollarla tek ba\u015f\u0131na veya toplu olarak a\u00e7\u0131klama ve yayma hakk\u0131na sahiptir. Bu h\u00fcrriyet resmi makamlar\u0131n m\u00fcdahalesi olmaks\u0131z\u0131n haber veya fikir almak ya da vermek serbestli\u011fini de kapsar&#8230;<\/p>\n<p>Bu h\u00fcrriyetlerin kullan\u0131lmas\u0131, mill\u00ee g\u00fcvenlik, kamu d\u00fczeni, kamu g\u00fcvenli\u011fi, Cumhuriyetin temel nitelikleri ve Devletin \u00fclkesi ve milleti ile b\u00f6l\u00fcnmez b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fcn korunmas\u0131, su\u00e7lar\u0131n \u00f6nlenmesi,su\u00e7lular\u0131ncezaland\u0131r\u0131lmas\u0131,Devlets\u0131rr\u0131olarakusul\u00fcncebelirtilmi\u015fbilgilerin a\u00e7\u0131klanmamas\u0131, ba\u015fkalar\u0131n\u0131n \u015f\u00f6hret veya haklar\u0131n\u0131n, \u00f6zel ve aile hayatlar\u0131n\u0131n yahut kanunun \u00f6ng\u00f6rd\u00fc\u011f\u00fc meslek s\u0131rlar\u0131n\u0131n korunmas\u0131 veya yarg\u0131lama g\u00f6revinin gere\u011fine uygun olarak yerine getirilmesi ama\u00e7lar\u0131yla s\u0131n\u0131rlanabilir&#8221;<\/p>\n<p>a. Kabul Edilebilirlik Y\u00f6n\u00fcnden<\/p>\n<p>31. A\u00e7\u0131k\u00e7a dayanaktan yoksun olmad\u0131\u011f\u0131 ve kabul edilemezli\u011fine karar verilmesini gerektirecek ba\u015fka bir neden de bulunmad\u0131\u011f\u0131 anla\u015f\u0131lan ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlal edildi\u011fine ili\u015fkin iddian\u0131n kabul edilebilir oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>b. Esas Y\u00f6n\u00fcnden<\/p>\n<p>i. Genel \u0130lkeler<\/p>\n<p>32. Ba\u015fvuru konusu olayda uyu\u015fmazl\u0131k, i\u015f s\u00f6zle\u015fmesinin sosyal medya payla\u015f\u0131mlar\u0131 gerek\u00e7e g\u00f6sterilerek feshedilmesine ili\u015fkindir. Bu kapsamda temel hak ve \u00f6zg\u00fcrl\u00fcklere y\u00f6nelik negatif ve pozitif y\u00fck\u00fcml\u00fcl\u00fckler aras\u0131ndaki s\u0131n\u0131rlar\u0131n kesin bi\u00e7imde tan\u0131mlanmas\u0131 ve birbirinden ayr\u0131lmas\u0131 her durumda m\u00fcmk\u00fcn de\u011fildir. Devlet i\u00e7in \u00f6ng\u00f6r\u00fclen negatif y\u00fck\u00fcml\u00fcl\u00fckler, her durumda temel hak ve \u00f6zg\u00fcrl\u00fcklere keyf\u00ee surette m\u00fcdahaleden ka\u00e7\u0131nmay\u0131 gerekli k\u0131lar. Pozitif y\u00fck\u00fcml\u00fcl\u00fckler de temel hak ve \u00f6zg\u00fcrl\u00fcklerin korunmas\u0131n\u0131 ve bireyler aras\u0131 ili\u015fkiler alan\u0131nda olsa da temel hak ve \u00f6zg\u00fcrl\u00fcklerin g\u00fcvencelerini sa\u011flamaya y\u00f6nelik olarak olaya \u00f6zg\u00fc tedbirlerin al\u0131nmas\u0131n\u0131 zorunlu k\u0131lar (benzer y\u00f6ndeki de\u011ferlendirmeler i\u00e7in bkz. Adnan Oktar (3), B. No: 2013\/1123, 2\/10\/2013, \u00a7 32; \u00d6m\u00fcr Kara ve Onursal \u00d6zbek, B. No: 2013\/4825, 24\/3\/2016, \u00a7 46). Ancak hemen belirtmek gerekir ki devletin ister pozitif isterse de negatif y\u00fck\u00fcml\u00fcl\u00fckleri s\u00f6z konusu olsun uygulanacak ilkeler de \u00e7o\u011funlukla \u00f6nemli \u00f6l\u00e7\u00fcde benze\u015fmektedir (Hesna Funda Baltal\u0131 ve Baltal\u0131 G\u0131da Hayvanc\u0131l\u0131k San. ve Tic. Ltd. \u015eti. [GK], B. No: 2014\/17196, 25\/10\/2018, \u00a7 70).<\/p>\n<p>33. Devletin ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn korunmas\u0131na y\u00f6nelik y\u00fck\u00fcml\u00fcl\u00fckleri \u00e7er\u00e7evesinde uyu\u015fmazl\u0131klar\u0131n \u00e7\u00f6z\u00fcm\u00fcne ili\u015fkin yasal altyap\u0131n\u0131n olu\u015fturulmas\u0131, uyu\u015fmazl\u0131klar\u0131n adil yarg\u0131lama gereklerine uygun ve usul y\u00f6n\u00fcnden g\u00fcvenceleri haiz bir yarg\u0131lama kapsam\u0131nda incelenmesi, bu yarg\u0131lamalarda temel haklara ili\u015fkin anayasal g\u00fcvencelerin g\u00f6zetilip g\u00f6zetilmedi\u011finin denetlenmesi sorumlulu\u011fu bulunmaktad\u0131r. Yine bireylerin temel hak ve \u00f6zg\u00fcrl\u00fcklerine \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin m\u00fcdahalesinin \u00f6nlenmesi i\u00e7in gerekli \u00f6nlemlerin al\u0131nmas\u0131 ve mahkemelerce korunma sa\u011flanmas\u0131 da s\u00f6z konusu y\u00fck\u00fcml\u00fcl\u00fckler kapsam\u0131ndad\u0131r. Kamusal makamlarca gerekli yap\u0131sal \u00f6nlemler al\u0131nm\u0131\u015f olsa da uyu\u015fmazl\u0131k konusu davay\u0131 y\u00fcr\u00fcten mahkemelerce verilen kararlarda \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin m\u00fcdahalelerine kar\u015f\u0131 bireylere korunma imk\u00e2n\u0131 sa\u011flanmad\u0131\u011f\u0131 durumlarda bu y\u00fck\u00fcml\u00fcl\u00fckler gere\u011fi gibi yerine getirilmemi\u015f olacakt\u0131r. Bu, kamusal makam olan mahkemeler arac\u0131l\u0131\u011f\u0131yla bireylerin hak ve \u00f6zg\u00fcrl\u00fcklerinin korunmas\u0131z b\u0131rak\u0131ld\u0131\u011f\u0131 anlam\u0131na gelecektir (benzer y\u00f6ndeki de\u011ferlendirmeler i\u00e7in bkz. \u00d6m\u00fcr Kara ve Onursal \u00d6zbek, \u00a7\u00a7 47-49).<\/p>\n<p>34. Bu do\u011frultuda i\u015f ili\u015fkisi kapsam\u0131nda \u00e7al\u0131\u015fan bireylerin Anayasa ile g\u00fcvence alt\u0131na al\u0131nan haklar\u0131na y\u00f6nelik olarak i\u015fverence ger\u00e7ekle\u015ftirilen m\u00fcdahaleye ili\u015fkin iddias\u0131n\u0131 i\u00e7eren uyu\u015fmazl\u0131klar\u0131n karara ba\u011fland\u0131\u011f\u0131 davalarda yarg\u0131 mercilerince s\u00f6z konusu g\u00fcvenceler g\u00f6zard\u0131 edilmemeli, i\u015fveren ve \u00e7al\u0131\u015fanlar aras\u0131ndaki \u00e7at\u0131\u015fan \u00e7\u0131karlar adil bi\u00e7imde dengelenmeli, ula\u015f\u0131lan sonu\u00e7 hakk\u0131nda h\u00fck\u00fcm kurulurken ilgili ve yeterli gerek\u00e7eler sunulmal\u0131d\u0131r (\u00d6m\u00fcr Kara ve Onursal \u00d6zbek, \u00a7 50; Kas\u0131m \u00c7ift\u00e7i ve di\u011ferleri, B. No: 2019\/33243, 4\/7\/2022, \u00a7 32; Ayhan Deniz ve di\u011ferleri [GK], B. No: 2019\/10975, 14\/6\/2023, \u00a7 37 ).<\/p>\n<p>35. Yarg\u0131 mercileri taraf\u0131ndan taraflar\u0131n \u00e7\u0131karlar\u0131 dengelenirken i\u015f s\u00f6zle\u015fmelerinde k\u0131s\u0131tlay\u0131c\u0131 ve zorlay\u0131c\u0131 d\u00fczenlemelerin ne \u015fekilde belirlendi\u011fi, \u00e7al\u0131\u015fanlar\u0131n temel haklar\u0131na y\u00f6nelik m\u00fcdahalede bulunulmas\u0131na neden olan \u00e7\u0131kar\u0131n \u00fcst\u00fcn olup olmad\u0131\u011f\u0131, s\u00f6zle\u015fmenin feshinin \u00e7al\u0131\u015fanlar\u0131n eylem ya da eylemsizlikleri kar\u015f\u0131s\u0131nda makul ve orant\u0131l\u0131 bir i\u015flem olup olmad\u0131\u011f\u0131 somut olay\u0131n ko\u015fullar\u0131na g\u00f6re ele al\u0131nmal\u0131d\u0131r. Ayr\u0131ca yarg\u0131lamalar s\u0131ras\u0131nda ger\u00e7ekle\u015ftirilen i\u015flemlerin ve neticede verilen karar\u0131n gerek\u00e7esinin bizatihi temel hak ve \u00f6zg\u00fcrl\u00fcklere ili\u015fkin olarak bir ihlale yol a\u00e7mamas\u0131 i\u00e7in yarg\u0131 mercilerince gereken \u00f6zen g\u00f6sterilmelidir (baz\u0131 farkl\u0131l\u0131klarla birlikte bkz. \u00d6m\u00fcr Kara ve Onursal \u00d6zbek, \u00a7 51; Kas\u0131m \u00c7ift\u00e7i ve di\u011ferleri, \u00a7 33; Ayhan Deniz ve di\u011ferleri, \u00a7 38).<\/p>\n<p>ii. Somut Olay\u0131n De\u011ferlendirilmesi<\/p>\n<p>36. Somut olayda Banka, ba\u015fvurucunun sosyal medya payla\u015f\u0131mlar\u0131n\u0131n Bankan\u0131n itibar ve imaj\u0131n\u0131 zedeledi\u011fini belirterek ba\u015fvurucunun i\u015f s\u00f6zle\u015fmesini feshetmi\u015ftir. \u0130\u015f Mahkemesi de benzer gerek\u00e7eyle ba\u015fvurucunun s\u00f6z konusu payla\u015f\u0131mlar\u0131n\u0131n i\u015fverenin itibar\u0131n\u0131 zedeledi\u011fi ve payla\u015f\u0131mlar\u0131n i\u015fverence kabul edilemez oldu\u011fu kanaatine varm\u0131\u015ft\u0131r. Nihai olarak B\u00f6lge Adliye Mahkemesi ise ba\u015fvurucunun 15 Temmuz darbe te\u015febb\u00fcs\u00fc sonras\u0131 sosyal medya hesab\u0131ndan yapt\u0131\u011f\u0131 payla\u015f\u0131mlar nedeniyle ba\u015fvurucu hakk\u0131nda ter\u00f6r \u00f6rg\u00fctleri ile irtibat ve iltisakl\u0131 oldu\u011funa dair \u015f\u00fcphe has\u0131l oldu\u011funu belirterek feshin \u015f\u00fcphe feshi niteli\u011finde ve ge\u00e7erli fesih kapsam\u0131nda kald\u0131\u011f\u0131n\u0131 belirtmi\u015ftir.<\/p>\n<p>37. Bu nedenle Anayasa Mahkemesi, ba\u015fvurucunun sosyal medya payla\u015f\u0131mlar\u0131 nedeniyle i\u015fveren ile aralar\u0131ndaki g\u00fcven ili\u015fkisinin bozuldu\u011fu ve bu sebeple i\u015f s\u00f6zle\u015fmesinin feshedilmesinin \u015f\u00fcphe feshi kapsam\u0131nda kald\u0131\u011f\u0131 y\u00f6n\u00fcndeki B\u00f6lge Adliye Mahkemesi karar\u0131n\u0131n gerek\u00e7esini de\u011ferlendirmeye tabi tutacakt\u0131r.<\/p>\n<p>38. \u015e\u00fcphe feshinin \u00f6z\u00fcnde i\u015f\u00e7i taraf\u0131ndan i\u015flendi\u011fi ispatlanamayan ancak i\u015f\u00e7inin i\u015fledi\u011fine ili\u015fkin somut olgular bulunan bir su\u00e7 veya borca ayk\u0131r\u0131 a\u011f\u0131r davran\u0131\u015f olmal\u0131d\u0131r. Bu kapsamda \u015f\u00fcphe feshinin s\u00f6z konusu olabilmesi i\u00e7in i\u015f ili\u015fkisinin devam\u0131 ad\u0131na gerekli olan g\u00fcveni y\u0131kmaya elveri\u015fli, objektif olay ve vak\u0131alara dayanan g\u00fc\u00e7l\u00fc bir \u015f\u00fcphenin olmas\u0131 ve ayr\u0131ca olay\u0131n ayd\u0131nlat\u0131lmas\u0131 i\u00e7in i\u015fverenin kendisinden beklenebilecek b\u00fct\u00fcn \u00e7abalar\u0131 g\u00f6stermesine kar\u015f\u0131n eylemin ger\u00e7ekle\u015fti\u011finin kan\u0131tlanamamas\u0131 gerekir. Nihayetinde feshin son \u00e7are olmas\u0131 ilkesinin \u015f\u00fcphe feshi a\u00e7\u0131s\u0131ndan da uygulanmas\u0131 gerekir. \u015e\u00fcphenin a\u011f\u0131rl\u0131\u011f\u0131, i\u015f\u00e7inin ya\u015f\u0131, k\u0131demi ve i\u015fverende olu\u015fan g\u00fcven kayb\u0131 g\u00f6z\u00f6n\u00fcnde bulundurulmak suretiyle taraflar\u0131n menfaatleri tart\u0131larak bir de\u011ferlendirme yap\u0131lmal\u0131 ve b\u00f6ylelikle \u015f\u00fcphe feshinde keyf\u00ee uygulamalar\u0131n \u00f6n\u00fcne ge\u00e7ilmelidir (benzer y\u00f6nde bkz. C.A. (3) \u00a7 47 vd.).<\/p>\n<p>39. Bu kapsamda \u015f\u00fcphe \u00fczerine i\u015f s\u00f6zle\u015fmesi feshedilen i\u015f\u00e7ilerin a\u00e7t\u0131\u011f\u0131 i\u015fe iade davalar\u0131nda i\u015fverenin feshe dayanak yapt\u0131\u011f\u0131 t\u00fcm delillerini sunmas\u0131, yarg\u0131 mercilerince ilgili kurum ve kurulu\u015flardan \u015f\u00fcpheyi do\u011furan olay ve olgulara dair bilgi ve belgelerin sorulmas\u0131, davac\u0131n\u0131n i\u015f s\u00f6zle\u015fmesinin feshinin hakl\u0131 veya ge\u00e7erli nedene dayal\u0131 olup olmad\u0131\u011f\u0131na dair denetime elveri\u015fli t\u00fcm delillerin ara\u015ft\u0131r\u0131larak toplanmas\u0131 ve bu hususun a\u00e7\u0131kl\u0131\u011fa kavu\u015fturulmas\u0131, elde edilen delillere g\u00f6re yap\u0131lacak de\u011ferlendirme sonucu \u015f\u00fcphenin ciddi, g\u00fc\u00e7l\u00fc, objektif oldu\u011funun ve s\u00f6z konusu \u015f\u00fcphenin g\u00fcven ili\u015fkisini ortadan kald\u0131racak d\u00fczeye ula\u015ft\u0131\u011f\u0131n\u0131n somut \u015fekilde ortaya konulmas\u0131 gerekmektedir (benzer y\u00f6nde bkz. C.A. (3) \u00a7 50).<\/p>\n<p>40. Ba\u015fvurucu an\u0131lan payla\u015f\u0131mlar\u0131nda genel olarak darbeye te\u015febb\u00fcs\u00fcn ger\u00e7ek olmad\u0131\u011f\u0131n\u0131, bir mizansen sergilendi\u011fine inand\u0131\u011f\u0131n\u0131 s\u00f6ylemi\u015ftir.<\/p>\n<p>41. \u0130lk derece mahkemesi ba\u015fvurucunun yapt\u0131\u011f\u0131 sosyal payla\u015f\u0131mlarda 15 Temmuz silahl\u0131 darbe giri\u015fimini oyun olarak nitelemesinin i\u015fveren a\u00e7\u0131s\u0131ndan kabul edilebilir bir davran\u0131\u015f olmad\u0131\u011f\u0131n\u0131, i\u015fverenin bunu yaz\u0131l\u0131 fesih bildirimi gerek\u00e7esinde de a\u00e7\u0131k bir \u015fekilde ifade etti\u011fini, payla\u015f\u0131mlar\u0131n i\u015fveren Bankan\u0131n kurumsal imaj\u0131n\u0131 zedeleyici nitelikte oldu\u011funu de\u011ferlendirmi\u015f ve bu nedenle i\u015f s\u00f6zle\u015fmesinin ge\u00e7erli nedenle feshedildi\u011fi sonucuna ula\u015fm\u0131\u015ft\u0131r. B\u00f6lge Adliye Mahkemesi ise ba\u015fvurucunun Bank Asyada hesab\u0131 oldu\u011funu vurgulayarak payla\u015f\u0131mlar\u0131n i\u00e7eri\u011fi kar\u015f\u0131s\u0131nda i\u015fverenin i\u015f s\u00f6zle\u015fmesini sonland\u0131rmas\u0131n\u0131n \u015f\u00fcphe feshi niteli\u011finde oldu\u011fu, bu ko\u015fullarda i\u015fverenden i\u015f ili\u015fkisini s\u00fcrd\u00fcrmesinin beklenemeyece\u011fi gerek\u00e7esiyle ve feshin ge\u00e7erli nedene dayand\u0131\u011f\u0131 de\u011ferlendirmesiyle istinaf ba\u015fvurusunu esastan reddetmi\u015ftir. Bu durumda mahkemelerin ba\u015fvurucunun yapt\u0131\u011f\u0131 payla\u015f\u0131mlar ve bu payla\u015f\u0131mlar nedeniyle i\u015fveren taraf\u0131ndan i\u015f s\u00f6zle\u015fmesinin sonland\u0131r\u0131lmas\u0131 konusundaki de\u011ferlendirmelerinin ilgili ve yeterli gerek\u00e7e ihtiva etmedi\u011fi s\u00f6ylenemeyecektir.<\/p>\n<p>42. \u0130\u015fverenlerin \u00e7al\u0131\u015ft\u0131rd\u0131klar\u0131 i\u015f\u00e7ilerin verimli \u015fekilde i\u015f g\u00f6rmeleri ve \u00f6nceden saptanm\u0131\u015f nesnel kurallara kar\u015f\u0131 sadakat g\u00f6stermeleri konusunda beklenti i\u00e7inde olmalar\u0131n\u0131n hakl\u0131 bir gereklili\u011fe dayand\u0131\u011f\u0131n\u0131 s\u00f6ylemek gerekir. Bu bak\u0131mdan i\u015fverenin ge\u00e7erli fesih i\u00e7in gerekli olan sebepleri ortaya koydu\u011fu, ba\u015fvurucunun mali haklar\u0131n\u0131 gidermek suretiyle ve ma\u011fduriyetine yol a\u00e7mayacak \u015fekilde i\u015f s\u00f6zle\u015fmesini sona erdirdi\u011fi, yarg\u0131 mercilerinin de taraflar\u0131n \u00e7\u0131karlar\u0131n\u0131 adil bir \u015fekilde dengeledi\u011fi ve m\u00fcdahalenin \u00f6l\u00e7\u00fcl\u00fc olup olmad\u0131\u011f\u0131n\u0131 somut olay\u0131n ko\u015fullar\u0131na g\u00f6re ele ald\u0131\u011f\u0131 de\u011ferlendirilmi\u015ftir. Bu kapsamda B\u00f6lge Adliye Mahkemesinin feshe dair de\u011ferlendirmesinin ilgisiz ve yetersiz oldu\u011fu s\u00f6ylenemeyecektir. Nitekim Anayasa Mahkemesi de somut olay ve olgular\u0131 mevcut ba\u015fvuruyla benzer olan Burhan Diktepe (B. No: 2018\/10550, 21\/12\/2022) ba\u015fvurusunda benzer gerek\u00e7elerle ve m\u00fcdahalenin \u00f6l\u00e7\u00fcl\u00fc oldu\u011fu de\u011ferlendirmesiyle ba\u015fvurucunun ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlal edilmedi\u011fine karar vermi\u015ftir.<\/p>\n<p>43. Sonu\u00e7 olarak somut olayda ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne getirilen s\u0131n\u0131rlaman\u0131n an\u0131lan hakk\u0131 anlams\u0131z k\u0131lacak nitelikte olmad\u0131\u011f\u0131, zorunlu bir toplumsal ihtiyac\u0131 kar\u015f\u0131lad\u0131\u011f\u0131 ve orant\u0131l\u0131 oldu\u011fu sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>44. Ba\u015fvurucunun iddialar\u0131n\u0131n sosyal medya hesab\u0131nda bir k\u0131s\u0131m payla\u015f\u0131mda bulunmas\u0131 nedeniyle ter\u00f6r \u00f6rg\u00fctleri ile irtibatl\u0131 oldu\u011fu sonucuna var\u0131larak i\u015f s\u00f6zle\u015fmesinin feshedilmesine ve a\u00e7t\u0131\u011f\u0131 i\u015fe iade davas\u0131n\u0131n reddedilmesine ili\u015fkin i\u015flemler b\u00fct\u00fcn\u00fcne y\u00f6nelik oldu\u011fu g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Anayasa Mahkemesi C.A. Bu ba\u011flamda feshe dayanak olan \u015f\u00fcphenin nedeninin ba\u015fvurucunun ter\u00f6r \u00f6rg\u00fct\u00fcyle irtibatl\u0131 ya da iltisakl\u0131 olmas\u0131 \u015feklinde a\u00e7\u0131kland\u0131\u011f\u0131, ald\u0131\u011f\u0131 \u00fccretlere son verildi\u011fi, mesleki tecr\u00fcbesinin \u00e7ok oldu\u011fu ve mevcut durum itibar\u0131yla duydu\u011fu \u00fcz\u00fcnt\u00fc ile endi\u015fenin i\u00e7 ve d\u0131\u015f d\u00fcnyas\u0131nda meydana getirdi\u011fi etkinin ciddi d\u00fczeye ula\u015ft\u0131\u011f\u0131 konusunda ileri s\u00fcrd\u00fc\u011f\u00fc iddialar\u0131n kabul edilmemesine neden olabilecek bir fakt\u00f6r\u00fcn bulunmad\u0131\u011f\u0131 hususlar\u0131 dikkate al\u0131nmal\u0131d\u0131r. Bu \u00e7er\u00e7evede ba\u015fvurucunun mesleki hayat\u0131na y\u00f6nelik m\u00fcdahalenin ba\u015fkalar\u0131 ile ili\u015fki kurabilme ve geli\u015ftirebilme imk\u00e2n\u0131n\u0131 \u00f6nemli \u00f6l\u00e7\u00fcde zay\u0131flataca\u011f\u0131, sosyal ve mesleki itibar\u0131n\u0131 koruyabilmesi a\u00e7\u0131s\u0131ndan ciddi sonu\u00e7lara yol a\u00e7aca\u011f\u0131, dolay\u0131s\u0131yla \u00f6zel hayat\u0131na \u00f6nemli bir a\u011f\u0131rl\u0131k derecesinde yans\u0131yaca\u011f\u0131n\u0131n ve etki do\u011furaca\u011f\u0131n\u0131n muhtemel oldu\u011fu de\u011ferlendirilmektedir. Bu y\u00f6n\u00fcyle ba\u015fvurunun Anayasa&#8217;n\u0131n 20. maddesinde g\u00fcvence alt\u0131na al\u0131nan \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda da incelenmesi gerekti\u011fi sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>47. Anayasa\u2019n\u0131n \u201c\u00d6zel hayat\u0131n gizlili\u011fi\u201d kenar ba\u015fl\u0131kl\u0131 20. maddesinin birinci f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Herkes, \u00f6zel hayat\u0131na ve aile hayat\u0131na sayg\u0131 g\u00f6sterilmesini isteme hakk\u0131na sahiptir. \u00d6zel hayat\u0131n ve aile hayat\u0131n\u0131n gizlili\u011fine dokunulamaz.&#8221; <\/p>\n<p>a. Kabul Edilebilirlik Y\u00f6n\u00fcnden<\/p>\n<p>48. Ba\u015fvuru konusu olayda uyu\u015fmazl\u0131k, i\u015f s\u00f6zle\u015fmesinin sosyal medya payla\u015f\u0131mlar\u0131 gerek\u00e7e g\u00f6sterilerek ve ter\u00f6r \u00f6rg\u00fctleri ile irtibat ve iltisak iddias\u0131na dayal\u0131 olarak feshedilmesine ili\u015fkindir. Bu kapsamda ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn korunmas\u0131na y\u00f6nelik devletin y\u00fck\u00fcml\u00fcklerine ili\u015fkin ilkeler ayn\u0131 \u015fekilde \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n korunmas\u0131 y\u00f6n\u00fcnden de ge\u00e7erlidir. Bu kapsamda \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n korunmas\u0131na y\u00f6nelik genel ilkeler i\u00e7in bkz.\u00a7\u00a7 31-34.<\/p>\n<p>50. G\u00fcven ili\u015fkisinin bozulmas\u0131na ba\u011fl\u0131 fesihlerde Anayasa&#8217;n\u0131n 20. maddesinde g\u00fcvence alt\u0131na al\u0131nan \u00f6zel hayata sayg\u0131 hakk\u0131, i\u015f ili\u015fkisinin tek tarafl\u0131 bir irade beyan\u0131yla sonland\u0131r\u0131lmas\u0131n\u0131 yasaklamamaktad\u0131r. Ancak i\u015fveren taraf\u0131ndan hayata ge\u00e7irilen i\u015f ili\u015fkisinin sona erdirilmesine ili\u015fkin tedbirin zorunlu ve ba\u015fvurulabilecek en son \u00e7are olarak nitelendirilebilmesi i\u00e7in ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc ba\u015fl\u0131\u011f\u0131 alt\u0131nda yer verilen hususlar\u0131n (bkz. \u00a7\u00a7 39-45) somut olarak ortaya konmas\u0131, bunun sonucunda i\u015f\u00e7inin i\u015fverenin menfaatine ve beklentilerine ayk\u0131r\u0131 davrand\u0131\u011f\u0131n\u0131n belirlenmesi gerekir.<\/p>\n<p>51. Somut olayda ba\u015fvurucunun sosyal medya payla\u015f\u0131mlar\u0131 gerek\u00e7e g\u00f6sterilerek i\u015f s\u00f6zle\u015fmesinin feshedilmesi y\u00f6n\u00fcnden yarg\u0131 mercilerinin, ba\u015fvurucunun s\u00f6z konusu eyleminin \u015f\u00fcphe feshi kapsam\u0131nda kald\u0131\u011f\u0131na y\u00f6nelik de\u011ferlendirilmelerinde taraflar\u0131n \u00e7\u0131karlar\u0131n\u0131 adil bir \u015fekilde dengeledi\u011fi ve m\u00fcdahalenin \u00f6l\u00e7\u00fcl\u00fc olup olmad\u0131\u011f\u0131n\u0131 somut olay\u0131n ko\u015fullar\u0131na g\u00f6re ele ald\u0131\u011f\u0131 g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Bu konularda ciddi \u015f\u00fcpheler elde eden i\u015fverenin akdi fesih yetkisi bulunmaktad\u0131r. \u00d6te yandan i\u015fverenin kan\u0131tlanamayan su\u00e7 i\u015flendi\u011fi veya s\u00f6zle\u015fmeye ayk\u0131r\u0131 davran\u0131\u015fta bulundu\u011fu kan\u0131s\u0131yla yapaca\u011f\u0131 feshin yasal fesih niteli\u011finde mi yoksa yetkinin keyfi nedenlerle mi kullan\u0131ld\u0131\u011f\u0131n\u0131n i\u015f mahkemesince denetlenmesi gerekmektedir. Zira \u0130\u015f Kanunu uyar\u0131nca i\u015f\u00e7inin i\u015f g\u00fcvencesine tabi oldu\u011fu g\u00f6zetilmelidir. Yasal \u015fartlar ger\u00e7ekle\u015fmedi\u011fi halde di\u011fer bir nedenle i\u015f akdinin feshedilmesi, i\u015f g\u00fcvenli\u011fi hakk\u0131n\u0131 ortadan kald\u0131rman\u0131n bir arac\u0131 olarak kullan\u0131labilmektedir. Bu nedenle yasal i\u015f g\u00fcvencesinin ger\u00e7ekten i\u015flev g\u00f6rebilmesi yarg\u0131 denetimiyle do\u011frudan ba\u011flant\u0131l\u0131d\u0131r.<\/p>\n<p>3. Anayasa Mahkemesi bu konudaki kararlar\u0131nda i\u015f akdinin feshinin yasal \u00e7er\u00e7evede kabul edilebilmesi i\u00e7in fesih nedenlerinin, ba\u015fka deyi\u015fle feshe dayanak olan olgular\u0131n ciddi, g\u00fc\u00e7l\u00fc, objektif oldu\u011funun ve \u015f\u00fcphenin g\u00fcven ili\u015fkisini ortadan kald\u0131racak d\u00fczeye ula\u015ft\u0131\u011f\u0131n\u0131n kan\u0131tlanmas\u0131 gerekti\u011fini ifade etmektedir (di\u011ferleri aras\u0131nda bkz. C.A. (3) [GK], B. No: 2018\/10286, 2\/7\/2020, p. 50).<\/p>\n<p>4. \u0130\u015fveren taraf\u0131ndan i\u015f akdi, ba\u015fvuran\u0131n payla\u015f\u0131mlar\u0131 nedeniyle \u201cBankan\u0131n sayg\u0131nl\u0131\u011f\u0131n\u0131n ve imaj\u0131n\u0131n zedelendi\u011fi\u201d gerek\u00e7esine dayand\u0131r\u0131lm\u0131\u015ft\u0131r. \u0130lk derece mahkemesi de yarg\u0131lamay\u0131 bu y\u00f6nde yapm\u0131\u015f ve \u201cpayla\u015f\u0131m\u0131n i\u015fverenin kurumsal imaj\u0131n\u0131 zedeler nitelikte oldu\u011fu\u201d gerek\u00e7esiyle davay\u0131 sonu\u00e7land\u0131rm\u0131\u015ft\u0131r. Buna kar\u015f\u0131n B\u00f6lge Adliye Mahkemesindeki istinaf incelemesi sonunda gerek\u00e7e ikamesi yap\u0131larak konunun \u015f\u00fcphe feshi kapsam\u0131nda ele al\u0131nmas\u0131 gerekti\u011fi belirtilmi\u015f ve bu y\u00f6nde karar verilmi\u015ftir. \u0130\u015f akdinin fesih nedenini g\u00f6stermek \u0130\u015f Kanununun 18. maddesi uyar\u0131nca i\u015fverenin y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc i\u00e7indedir. Mahkeme ise bu nedenin ger\u00e7ekli\u011fini, yasall\u0131\u011f\u0131n\u0131 denetleyecektir. Dolay\u0131s\u0131yla i\u015f g\u00fcvenli\u011fi hakk\u0131n\u0131n da g\u00fcvencesi olmas\u0131 gereken mahkemenin i\u015fverenin yerine ge\u00e7erek farkl\u0131 (ikame) bir gerek\u00e7eyle fesih nedeni olu\u015fturmas\u0131 i\u015f hukukuna da anayasal g\u00fcvencelere de ayk\u0131r\u0131l\u0131k te\u015fkil edebilecektir. Bu olayda da uygulama ne yaz\u0131k ki bu \u015fekilde ger\u00e7ekle\u015fmi\u015ftir.<\/p>\n<p>5. Di\u011fer taraftan i\u015fverenin Kanundaki tabirle ge\u00e7erli fesih nedenine dayand\u0131\u011f\u0131 halde i\u015f\u00e7inin savunmas\u0131 al\u0131nmadan i\u015f akdini feshetti\u011fi g\u00f6zetildi\u011finde, mahkemelerin ve B\u00f6lge Adliye Mahkemesi dairesinin, i\u015f g\u00fcvenli\u011fi hakk\u0131n\u0131n \u00f6nemli bir g\u00fcvencesini olu\u015fturan bu yasal zorunlulu\u011fu (4857 \u2013 m. 19) g\u00f6zard\u0131 etmeleri dikkat \u00e7ekicidir. Ne yaz\u0131k ki bu husus \u00e7o\u011funluk gerek\u00e7esinde de dikkate al\u0131nmam\u0131\u015ft\u0131r.<\/p>\n<p>6. Anayasa mahkemesi \u00f6zel hayata sayg\u0131 hakk\u0131 ve ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc haklar\u0131n\u0131 incelerken mahkemelerin usul g\u00fcvencelerine uygun bir yarg\u0131lama yapmas\u0131n\u0131 da beklemektedir. Gerek ilk derece mahkemesi, gerekse BAM Dairesinin kararlar\u0131nda i\u015f\u00e7inin sosyal medya payla\u015f\u0131m\u0131n\u0131n ne \u015fekilde s\u00f6zle\u015fmeye ayk\u0131r\u0131l\u0131k olu\u015fturdu\u011fu veya su\u00e7 te\u015fkil edebilece\u011fi konusunda bir inceleme yap\u0131lmam\u0131\u015ft\u0131r. \u0130\u015fverenin g\u00f6sterdi\u011fi fesih nedeni a\u00e7\u0131s\u0131ndan inceleme yapan bir mahkeme karar\u0131nda olmas\u0131 beklenen; \u00fclkeyi derinden etkileyen \u00e7ok \u00f6nemli bir olaya dair yanl\u0131\u015f veya sa\u00e7ma da olsa maksatl\u0131 olarak yap\u0131lan payla\u015f\u0131mlar ile, ba\u015fvuran\u0131nkinde oldu\u011fu gibi k\u0131sa s\u00fcre sonra bunun silinmesinin bir anlam ifade edip etmedi\u011fi, payla\u015f\u0131m yap\u0131lan medya ortam\u0131n\u0131n dar veya geni\u015f bir ortam olup olmad\u0131\u011f\u0131, payla\u015f\u0131m\u0131n yay\u0131l\u0131p Banka\u2019n\u0131n itibar\u0131n\u0131 zedeleme olas\u0131l\u0131\u011f\u0131n\u0131n bulunup bulunmad\u0131\u011f\u0131, vb. hususlar\u0131n tart\u0131\u015f\u0131lmas\u0131d\u0131r. Buna kar\u015f\u0131l\u0131k mahkeme gerek\u00e7esinde yaln\u0131zca \u201c\u2026payla\u015f\u0131mlar\u0131n i\u00e7eri\u011fi dikkate al\u0131nd\u0131\u011f\u0131nda daval\u0131 i\u015fverenin i\u015f s\u00f6zle\u015fmesini fesih nedeni dikkate al\u0131nd\u0131\u011f\u0131nda feshin \u015f\u00fcphe feshi niteli\u011finde oldu\u011fu, i\u015fverenden i\u015f ili\u015fkisini s\u00fcrd\u00fcrmesinin beklenemeyece\u011fi\u2026\u201d bi\u00e7iminde, i\u015fverenin gerek\u00e7esini tekrar eden, onun yerine ge\u00e7erek feshin hakl\u0131l\u0131\u011f\u0131n\u0131n anla\u015f\u0131lmas\u0131n\u0131 okuyandan bekleyen bir gerek\u00e7e olu\u015fturulmu\u015ftur. Bu yakla\u015f\u0131m mahkemelerin kararlar\u0131nda maddi ve hukuku sorunlarla ilgili ve yeterli gerek\u00e7e bulunmas\u0131 zorunlulu\u011funu kar\u015f\u0131lamaktad\u0131r.<\/p>\n<p>7. Son olarak B\u00f6lge Adliye Mahkemesi Dairesinin 19.2.2018 tarihli \u00f6nceki karar\u0131nda, \u201cdavac\u0131n\u0131n ter\u00f6r \u00f6rg\u00fct\u00fc aleyhine de payla\u015f\u0131mlar yapt\u0131\u011f\u0131 hususunu belirtmi\u015f olmas\u0131 kar\u015f\u0131s\u0131nda bununla ilgili delil ve payla\u015f\u0131mlar\u0131n toplanmad\u0131\u011f\u0131 anla\u015f\u0131lmakla, davac\u0131 taraf\u0131n g\u00f6sterdi\u011fi delillerin toplanmas\u0131\u2026\u201d ve ayr\u0131ca ilgili kurumlardan ve g\u00fcvenlik birimlerinden davac\u0131 hakk\u0131nda bilgilerin sorulup sonucuna g\u00f6re bir karar verilmesi gerekti\u011fi, gerek\u00e7esiyle karar\u0131n ortadan kald\u0131r\u0131ld\u0131\u011f\u0131 ve dosyan\u0131n mahkemesine g\u00f6nderildi\u011fi anla\u015f\u0131lmaktad\u0131r. Ne var ki ilk derece mahkemesinde yeniden yap\u0131lan yarg\u0131lama sonras\u0131nda verilen kararda bozma karar\u0131 gerek\u00e7esinde s\u00f6z\u00fc edilen ara\u015ft\u0131rmalar\u0131n yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131 anla\u015f\u0131lamamaktad\u0131r. Bu belirsizlik BAM Dairesinin sonraki karar gerek\u00e7esinde de giderilmi\u015f de\u011fildir. \u015eu halde mahkemelerce maddi olguya dair hususlar a\u00e7\u0131kl\u0131\u011fa kavu\u015fturulduktan sonra karar verildi\u011fi s\u00f6ylenememektedir.<\/p>\n<p>8. Yukar\u0131da s\u00f6z\u00fc edildi\u011fi \u00fczere davan\u0131n reddine dair karar da uyu\u015fmazl\u0131\u011f\u0131n temel unsurlar\u0131 hakk\u0131nda ilgili ve yeterli bir gerek\u00e7e i\u00e7ermemektedir. Bu durum kar\u015f\u0131s\u0131nda mahkemelerin yarg\u0131lamada usul g\u00fcvencelerine uymad\u0131\u011f\u0131 sonucuna ula\u015f\u0131lmas\u0131 gerekmektedir. Usul g\u00fcvencelerine ayk\u0131r\u0131l\u0131k ise ilgili maddi haklar\u0131n ihlal edilmesine yol a\u00e7m\u0131\u015ft\u0131r. Ba\u015fvurucu ile ilgili bu dosyaya konu sosyal medya payla\u015f\u0131mlar\u0131 incelendi\u011finde, 17\/07\/2016 g\u00fcn\u00fc al\u0131nan ve on d\u00f6rt saatten \u00f6nce payla\u015f\u0131ld\u0131\u011f\u0131 anla\u015f\u0131lan \u00e7\u0131kt\u0131 i\u00e7eriklerinde ba\u015fvurucunun 15 Temmuz 2016 tarihli silahl\u0131 FET\u00d6 darbe giri\u015fimi ile ilgili olarak \u201cD\u00fcn gece oynanan oyun sonras\u0131 hangi g\u00f6r\u00fc\u015ften olursan\u0131z olun, bu sorular\u0131 kendinize sorun, b\u00fct\u00fcn darbeler h\u00fck\u00fcmete yap\u0131l\u0131yorsa neden bir tane h\u00fck\u00fcmet eleman\u0131 vali, kaymakam&#8217;a bir \u015fey olmad\u0131, darbeden haberi olmayanlar bir ka\u00e7 saat sonra nas\u0131l darbeci diye 2.745 hakimi g\u00f6revden ald\u0131. Bu kadar k\u0131sa zamanda nas\u0131l darbeci olduklar\u0131 tespit edildi. \u00dclkede sadece 3-5 sava\u015f u\u00e7a\u011f\u0131 m\u0131 var? Di\u011ferleri tamirde mi?&#8230; Darbecilerin cumhurba\u015fkan\u0131 otelden ayr\u0131ld\u0131ktan sonra oteli basmas\u0131na ne demeli?&#8230; Olay\u0131n kazanan\u0131 kimse yapan da odur&#8230;.\u201d \u015feklinde payla\u015f\u0131mlarda bulunmu\u015ftur.<\/p>\n<p>3. Ba\u015fvurucunun \u00e7al\u0131\u015ft\u0131\u011f\u0131 Banka 25\/7\/2016 tarihinde sosyal medya \u00fczerinden yap\u0131lan payla\u015f\u0131mlar\u0131n Bankan\u0131n sayg\u0131nl\u0131\u011f\u0131n\u0131 ve imaj\u0131n\u0131 zedeledi\u011fi gibi itibar kayb\u0131na neden oldu\u011funu tespit ederek 4857 say\u0131l\u0131 \u0130\u015f Kanunu&#8217;nun i\u015f akdinin ge\u00e7erli nedenle feshini d\u00fczenleyen 18. maddesi gere\u011fince ba\u015fvurucunun i\u015f s\u00f6zle\u015fmesini feshetmi\u015ftir.<\/p>\n<p>4. A\u00e7\u0131lan i\u015fe iade davas\u0131 ile ilgili olarak \u0130\u015f Mahkemesi daval\u0131 bankan\u0131n ge\u00e7erli nedenle fesihle ba\u015fvurucunun i\u015f akdinin feshedildi\u011fini belirtti\u011fi 6\/12\/2018 tarihli red karar\u0131nda \u015fu gerek\u00e7eye yer vermi\u015ftir:<\/p>\n<p>\u00a0\u201c\u00dclkemizin son derece talihsiz bir \u015fekilde 15 Temmuz&#8217;u ya\u015famas\u0131 kar\u015f\u0131s\u0131nda davac\u0131n\u0131n silahl\u0131 darbe giri\u015fimini oyun olarak nitelendirmesi i\u015fveren taraf\u0131ndan kabul edilebilir bir davran\u0131\u015f de\u011fildir. Yaz\u0131l\u0131 fesih bildiriminde fesih gerek\u00e7esi de a\u00e7\u0131k ve net olarak belirtilmi\u015ftir. Sosyal medya hesab\u0131ndan davac\u0131 taraf\u0131ndan yap\u0131lan bu payla\u015f\u0131mlar bankan\u0131n kurumsal imaj\u0131n\u0131 zedeler niteliktedir.&#8221;<\/p>\n<p>5. Karar\u0131n istinaf edilmesi \u00fczerine ise B\u00f6lge Adliye Mahkemesi 8\/11\/2019 tarihinde kesin olmak \u00fczere davan\u0131n reddine \u201cDosya kapsam\u0131nda mevcut CD i\u00e7eri\u011fine g\u00f6re davac\u0131n\u0131n Bank Asya\u2019da hesab\u0131 bulunmas\u0131 ve sosyal medya \u00fczerinden yap\u0131lan payla\u015f\u0131mlar\u0131n i\u00e7eri\u011fi dikkate al\u0131nd\u0131\u011f\u0131nda daval\u0131 i\u015fverenin i\u015f s\u00f6zle\u015fmesini fesih nedeni dikkate al\u0131nd\u0131\u011f\u0131nda feshin \u015f\u00fcphe feshi niteli\u011finde oldu\u011fu, i\u015fverenden i\u015f ili\u015fkisini s\u00fcrd\u00fcrmesinin beklenemeyece\u011fi, feshin ge\u00e7erli nedene dayand\u0131\u011f\u0131n\u0131 anla\u015f\u0131lm\u0131\u015f, taraflar\u0131n kar\u015f\u0131l\u0131kl\u0131 iddia ve savunmalar\u0131na, dayand\u0131klar\u0131 belgelere, hukuki ili\u015fkinin nitelendirilmesine, vak\u0131a mahkemesi hakiminin objektif, dosyadaki verilerle \u00e7eli\u015fmeyen tespitlerine ve uyu\u015fmazl\u0131\u011fa uygulanmas\u0131 gereken hukuk kurallar\u0131na g\u00f6re, HMK\u2019n\u0131n 355. maddesi uyar\u0131nca istinaf sebepleriyle s\u0131n\u0131rl\u0131 olarak ve resen kamu d\u00fczeni y\u00f6n\u00fcnden yap\u0131lan inceleme sonucu; ilk derece mahkemesinin vak\u0131a ve hukuki de\u011ferlendirmesinde usul ve esas y\u00f6n\u00fcnden yasaya ayk\u0131r\u0131l\u0131k bulunmad\u0131\u011f\u0131\u201d \u015feklindeki gerek\u00e7eyle karar vermi\u015ftir. Ba\u015fvurucunun sosyal medya hesab\u0131ndan yapm\u0131\u015f oldu\u011fu payla\u015f\u0131mlardan \u00f6t\u00fcr\u00fc i\u015f akdinin feshedilmesi nedeniyle \u00f6zel hayata sayg\u0131 hakk\u0131 ile ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlal edildi\u011fi iddias\u0131yla yapt\u0131\u011f\u0131 ba\u015fvuruda Mahkememiz \u00e7o\u011funlu\u011fu, ba\u015fvurucunun Anayasa\u2019n\u0131n 20. maddesinde g\u00fcvence alt\u0131na al\u0131nan \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ve 26. maddesinde g\u00fcvence alt\u0131na al\u0131nan ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlal edilmedi\u011fine karar verirken derece mahkemelerinin ba\u015fvurucunun yapt\u0131\u011f\u0131 payla\u015f\u0131mlar ve bu payla\u015f\u0131mlar nedeniyle i\u015fveren taraf\u0131ndan i\u015f akdinin sonland\u0131r\u0131lmas\u0131 konusundaki niteleme ve de\u011ferlendirmelerinin ilgili ve yeterli gerek\u00e7e ihtiva etmedi\u011finin s\u00f6ylenemeyece\u011fi (bkz.: \u00a7\u00a7 41, 51)gerek\u00e7esine dayanm\u0131\u015ft\u0131r.<\/p>\n<p>7. Elbette ki s\u0131ca\u011f\u0131 s\u0131ca\u011f\u0131na 15 Temmuz 2016 tarihli FET\u00d6\u2019c\u00fc darbe giri\u015fiminin ya\u015fanmakta oldu\u011fu bir zaman diliminde darbe te\u015febb\u00fcs\u00fcne y\u00f6nelik bu bi\u00e7imdeki a\u00e7\u0131klamalar\u0131 ger\u00e7ekle\u015ftirenlerle ilgili hukuki veya cezai yollar\u0131n devreye sokulmas\u0131 ve i\u015fveren bankan\u0131n darbeyi \u00f6ven bir ki\u015fi ile \u00e7al\u0131\u015fmay\u0131 sonland\u0131rmas\u0131 m\u00fcmk\u00fcn ve gerekli olabilir.<\/p>\n<p>8. Bununla birlikte y\u00fcr\u00fct\u00fclen bu hukuki s\u00fcre\u00e7lerin sonras\u0131nda ki\u015filerin bireysel ba\u015fvuru yapmas\u0131 durumunda Anayasa Mahkemesinin bu s\u00fcre\u00e7teki incelemesinin baz\u0131 y\u00f6nleri ile teknik ve hukuken s\u0131n\u0131rl\u0131 bir niteli\u011fi haiz oldu\u011funu dikkate almak gerekmektedir. Zira Anayasa Mahkemesinin bireysel ba\u015fvurularla ilgili yapaca\u011f\u0131 inceleme derece mahkemelerinin ger\u00e7ekle\u015ftirdi\u011fi incelemeden baz\u0131 y\u00f6nleri ile farkl\u0131l\u0131k arz etmektedir.<\/p>\n<p>9. Bireysel ba\u015fvuru inceleme y\u00f6ntemi ba\u011flam\u0131nda teknik ve s\u0131n\u0131rl\u0131 inceleme yapmas\u0131 gerekti\u011fi i\u00e7indir ki Mahkememiz \u00e7o\u011funluk karar\u0131n\u0131n bu boyutlar\u0131 ile sorunlu oldu\u011funu ifade etmek gerekir. Zira Anayasa Mahkemesi bu konuda ilk elden inceleme ve de\u011ferlendirme yapmak yerine bankan\u0131n i\u015f akdini feshederken kulland\u0131\u011f\u0131 gerek\u00e7eleri de\u011ferlendiren derece mahkemelerinin kararlar\u0131ndan hareketle inceleme yaparak ba\u015fvuruyu sonu\u00e7land\u0131rmak durumundad\u0131r.<\/p>\n<p>10. Nitekim Anayasa Mahkemesinin bu konuda nas\u0131l bir inceleme y\u00f6ntemi ile bireysel ba\u015fvuruyu ele alaca\u011f\u0131 noktas\u0131nda yak\u0131n tarihli Ayhan Deniz ve di\u011ferleri ([GK], B. No: 2019\/10975, 14\/6\/2023) karar\u0131 bu standard\u0131 ortaya koymaktad\u0131r. Bu kararda da yine a\u011f\u0131rl\u0131kl\u0131 olarak aralar\u0131nda 15 Temmuz 2016 darbe te\u015febb\u00fcs\u00fc d\u00f6nemindeki payla\u015f\u0131mlar\u0131 da kapsayan bi\u00e7imde FET\u00d6 lehine a\u00e7\u0131klamalar yapan ba\u015fvurucu i\u015f\u00e7ilerin i\u015f akitlerinin feshi \u00fczerine mahkemelerin verdi\u011fi i\u015fe iade kararlar\u0131n\u0131n reddi \u015feklindeki karar gerek\u00e7eleri \u00fczerine Anayasa Mahkemesi \u00f6zel hayata sayg\u0131 hakk\u0131 ile ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlal edildi\u011fi sonucuna ula\u015f\u0131rken \u015fu de\u011ferlendirmeyi yapm\u0131\u015ft\u0131r:<\/p>\n<p>\u00a0\u201c(\u2026) Yarg\u0131tay taraf\u0131ndan da onanan B\u00f6lge Adliye Mahkemesi karar\u0131n\u0131n gerek\u00e7esinde benzer davalara ili\u015fkin g\u00f6zetilmesi gereken ilkeler s\u0131ralanm\u0131\u015f, soyut olarak a\u00e7\u0131k\u00e7a ifade edildi\u011fi h\u00e2lde ba\u015fvurucular\u0131n s\u00f6z konusu a\u00e7\u0131klamalar\u0131n\u0131n somut olarak i\u015fyerinde i\u015fin g\u00f6r\u00fclmesini \u00f6nemli \u00f6l\u00e7\u00fcde olumsuz olarak etkiledi\u011fine ili\u015fkin bir de\u011ferlendirmeye yer verilmemi\u015f; i\u015f\u00e7iye somut olarak hangi s\u00f6zle\u015fme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn y\u00fcklendi\u011fi ve i\u015f\u00e7inin, hangi davran\u0131\u015f\u0131 ile hangi somut s\u00f6zle\u015fme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc ihlal etti\u011fi eksiksiz olarak tespit edilmemi\u015f; i\u015fverenin zarar g\u00f6ren i\u015fletme menfaatlerinin neler oldu\u011fu a\u00e7\u0131klanmam\u0131\u015ft\u0131r. Ba\u015fvurucular\u0131n yapt\u0131klar\u0131 payla\u015f\u0131mlar ile i\u015fverenleri olan \u015eirketin \u015fahs\u0131na, m\u00fclkiyetine ve hukuken korunan di\u011fer varl\u0131klar\u0131na verdikleri zararlar g\u00f6sterilmedi\u011fi gibi payla\u015f\u0131mlar\u0131n hangi surette i\u015f s\u00f6zle\u015fmesi ile g\u00fcd\u00fclen amac\u0131 tehlikeye sokacak \u00f6zellikleri oldu\u011fu ve kar\u015f\u0131l\u0131kl\u0131 duyulan g\u00fcveni sarsacak bir davran\u0131\u015f olarak nitelendirildi\u011fi ortaya konulamam\u0131\u015ft\u0131r (\u0130stanbul B\u00f6lge Adliye Mahkemesinin gerek\u00e7esi i\u00e7in bkz. \u00a7 10).<\/p>\n<p>T\u00fcm bu hususlar birlikte de\u011ferlendirildi\u011finde Anayasa Mahkemesi; ba\u015fvuranlar\u0131n s\u00f6z konusu eylemlerinin 4857 say\u0131l\u0131 Kanun&#8217;un 18. maddesinde yer alan i\u015f\u00e7inin davran\u0131\u015flar\u0131ndan kaynakl\u0131 ge\u00e7erli sebepler kapsam\u0131nda de\u011ferlendirilmesine y\u00f6nelik olarak s\u00f6z konusu mahkemelerin ihtilafa konu i\u00e7eriklerin niteliklerini ve kullan\u0131ld\u0131klar\u0131 ba\u011flam\u0131, ayn\u0131 zamanda s\u00f6z konusu payla\u015f\u0131mlar\u0131n muhtemel etkilerini yeterli derecede ve detayl\u0131 bir \u015fekilde incelemediklerini tespit etmi\u015ftir. G\u00fcncel konularda ve s\u00fcrmekte olan toplumsal tart\u0131\u015fmalar\u0131 ilgilendiren payla\u015f\u0131mlar\u0131n i\u015f s\u00f6zle\u015fmesinin feshine gerek\u00e7e yap\u0131lmas\u0131 kar\u015f\u0131s\u0131nda mahkemeler, ba\u015fvurucular ile i\u015fveren aras\u0131ndaki g\u00fcven ili\u015fkisinin koptu\u011fu ve payla\u015f\u0131mlar\u0131n i\u015f yerinde olumsuzlu\u011fa yol a\u00e7t\u0131\u011f\u0131 kabul\u00fcne dair ilgili ve yeterli gerek\u00e7eler sunamam\u0131\u015ft\u0131r. Ba\u015fvurucular\u0131n payla\u015f\u0131mlar\u0131n\u0131n i\u015fveren ile aralar\u0131ndaki g\u00fcven ili\u015fkisinin kopmas\u0131na neden oldu\u011fu y\u00f6n\u00fcndeki kabul\u00fcn i\u015fverenin tek tarafl\u0131 beyan\u0131na dayand\u0131\u011f\u0131 ancak payla\u015f\u0131mlar\u0131n sonu\u00e7lar\u0131 itibar\u0131yla i\u015f s\u00f6zle\u015fmesinin s\u00fcrd\u00fcr\u00fclmesinin i\u015fverenden beklenemeyece\u011fi hususunun i\u015fveren ve mahkemeler taraf\u0131ndan ortaya konulamad\u0131\u011f\u0131 anla\u015f\u0131lm\u0131\u015ft\u0131r.\u201d (Ayhan Deniz ve di\u011ferleri [GK], B. No: 2019\/10975, 14\/6\/2023, \u00a7\u00a7 46-47).<\/p>\n<p>11. Oysa somut ba\u015fvuruya konu olayda ne ilk derece mahkemesi ne de istinaf mahkemesi bahse konu payla\u015f\u0131mlar\u0131n ba\u015fvurucunun i\u015f akdinin Banka taraf\u0131ndan feshedilmesini neden zorunlu k\u0131ld\u0131\u011f\u0131n\u0131 ilgili ve yeterli gerek\u00e7e ile ortaya koymu\u015ftur. Buna ra\u011fmen ba\u015fvurucunun yapt\u0131\u011f\u0131 payla\u015f\u0131mlar ve bu payla\u015f\u0131mlar nedeniyle i\u015fveren taraf\u0131ndan i\u015f akdinin sonland\u0131r\u0131lmas\u0131 konusunda derece mahkemelerinin yapt\u0131\u011f\u0131 niteleme ve de\u011ferlendirmelerin ilgili ve yeterli gerek\u00e7e ihtiva etmedi\u011finin s\u00f6ylenemeyece\u011fi bi\u00e7imindeki \u00e7o\u011funluk karar\u0131nda yer verilen tespitin (bkz.: \u00a7 41) derece mahkemelerinin karar gerek\u00e7elerine bak\u0131ld\u0131\u011f\u0131nda olgusal ger\u00e7eklikle ba\u011fda\u015fmad\u0131\u011f\u0131n\u0131 ifade etmek gerekir. Zira derece mahkemelerinin kararlar\u0131nda bu kar\u015f\u0131oyda yukar\u0131da aynen al\u0131nt\u0131lanan k\u0131s\u0131mlar d\u0131\u015f\u0131nda (bkz.: yukar\u0131da \u00a7\u00a7 4, 5) ba\u015fvurucunun bahse konu payla\u015f\u0131m\u0131n\u0131n ba\u015fvurucu ile Banka aras\u0131ndaki ili\u015fkiyi ne \u015fekilde olumsuz y\u00f6nde etkiledi\u011fi ve i\u015f yerinde nas\u0131l olumsuzlu\u011fa yol a\u00e7t\u0131\u011f\u0131 konusunda yap\u0131lm\u0131\u015f bir de\u011ferlendirme yer almamaktad\u0131r. Bu y\u00f6n\u00fc ile Mahkememiz \u00e7o\u011funluk karar\u0131ndaki tespit do\u011fru de\u011fildir.<\/p>\n<p>12. Dolay\u0131s\u0131yla derece mahkemeleri bu konuda Anayasa Mahkemesinin Ayhan Deniz ve di\u011ferleri karar\u0131nda ifade etti\u011fi anlamda bir gerek\u00e7e ortaya koyabilmi\u015f de\u011fildir. Bu nedenle bu eksiklik Anayasa Mahkemesinin i\u00e7tihad\u0131n\u0131n devam\u0131 ad\u0131na bu bireysel ba\u015fvuruda da ihlal sonucuna ula\u015f\u0131lmas\u0131n\u0131 gerektirmektedir.<\/p>\n<p>13. Esas\u0131nda buradaki ihlal karar\u0131 usul temelli bir ihlal olup, bu bi\u00e7imdeki bir ihlal, derece mahkemelerinin bu konuyu yeniden de\u011ferlendirmesini ve ilgili ve yeterli gerek\u00e7e ile ba\u015fvurucunun payla\u015f\u0131m\u0131n\u0131n neden hizmet akdinin sonland\u0131r\u0131lmas\u0131 \u015feklindeki bir m\u00fcdahale noktas\u0131nda Anayasa\u2019n\u0131n 13. maddesindeki demokratik toplum d\u00fczeninin gerekleri y\u00f6n\u00fcnden zorunlu bir toplumsal ihtiyaca kar\u015f\u0131l\u0131k geldi\u011fini ve ba\u015fvurucunun bahse konu payla\u015f\u0131mlar\u0131n\u0131n i\u015fverenle aras\u0131ndaki g\u00fcven ili\u015fkisini ne \u015fekilde olumsuz y\u00f6nde etkiledi\u011fini ikna edici, ilgili ve yeterli bir gerek\u00e7e ile ortaya koymas\u0131n\u0131 gerekli k\u0131lmaktad\u0131r. Yine ayn\u0131 \u015fekilde ba\u015fvurucunun iddialar\u0131n\u0131 kar\u015f\u0131lay\u0131p bunlara y\u00f6nelik de\u011ferlendirmelerde bulunulmas\u0131 da derece mahkemelerinin kararlar\u0131nda yer almal\u0131d\u0131r.<\/p>\n<p>14. Bununla birlikte derece mahkemeleri kararlar\u0131nda bahse konu payla\u015f\u0131mlar\u0131n neden ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc kapsam\u0131nda say\u0131lamayaca\u011f\u0131, bu payla\u015f\u0131m\u0131 yapan\u0131n ter\u00f6r \u00f6rg\u00fct\u00fc ile irtibat ve iltisak\u0131 nedeniyle Bankada \u00e7al\u0131\u015fmas\u0131n\u0131n art\u0131k m\u00fcmk\u00fcn olamayaca\u011f\u0131 ve ba\u015fvurucunun payla\u015f\u0131mlar\u0131n\u0131n ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc kapsam\u0131ndan \u00f6te FET\u00d6-PDY ile irtibat ve iltisak noktas\u0131nda nas\u0131l bir ba\u011flant\u0131s\u0131 oldu\u011fu hususlar\u0131nda de\u011ferlendirmede bulunmam\u0131\u015flard\u0131r. \u0130\u015fte bu bi\u00e7imdeki gerek\u00e7e eksiklikleri bu bireysel ba\u015fvuruda usul temelli bir ihlal karar\u0131 verilmesini zorunlu k\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>15. Oysa derece mahkemelerinin karalar\u0131ndaki bu eksikliklere ra\u011fmen Mahkememiz \u00e7o\u011funlu\u011fu ba\u015fvurucunun yapt\u0131\u011f\u0131 payla\u015f\u0131mlar ve bu payla\u015f\u0131mlar nedeniyle i\u015fveren taraf\u0131ndan i\u015f akdinin sonland\u0131r\u0131lmas\u0131 konusunda ilk elden de\u011ferlendirme yaparak sonuca ula\u015fan bir y\u00f6ntemle hareket etmi\u015ftir. Bu bi\u00e7imdeki bir inceleme y\u00f6ntemi bireysel ba\u015fvuru inceleme usul\u00fc ile ba\u011fda\u015fmamaktad\u0131r. \u00c7o\u011funluk karar\u0131nda yap\u0131ld\u0131\u011f\u0131 bi\u00e7imde bireysel ba\u015fvuru incelemelerinde olay ve olgular\u0131n ilk elden incelenip de\u011ferlendirilmesi esas\u0131nda derece mahkemelerinin yapmas\u0131 gereken i\u015fi Anayasa Mahkemesinin yapmas\u0131 anlam\u0131na gelir ki bu durum bireysel ba\u015fvuru sistemi a\u00e7\u0131s\u0131ndan fevkalade ciddi sorunlara yol a\u00e7acakt\u0131r.<\/p>\n<p>16. Zira bireysel ba\u015fvuru sistemi \u201cikincillik\u201d esas\u0131na dayal\u0131 bi\u00e7imde \u00e7al\u0131\u015fmaktad\u0131r. Bu sistemde ihlal iddialar\u0131 ilk olarak derece mahkemeleri taraf\u0131ndan incelenip somut olarak mahkemeler taraf\u0131ndan kar\u015f\u0131lanmal\u0131d\u0131r. Anayasa Mahkemesi ise ancak derece mahkemelerinin kararlar\u0131ndaki gerek\u00e7elerden hareketle inceleme yaparak bu karar gerek\u00e7elerindeki hukuki yakla\u015f\u0131mlar\u0131n hak ihlaline sebebiyet verip vermedi\u011fini de\u011ferlendirme yetkisine sahiptir. Bu y\u00f6n\u00fc ile Anayasa Mahkemesinin ilk elden de\u011ferlendirme yapmas\u0131, derece mahkemelerinin s\u00f6ylemedi\u011fini kendisinin s\u00f6ylemesi bireysel ba\u015fvuru sistemindeki ikincillik ilkesinin tersy\u00fcz edilmesi sonucunu do\u011furur.<\/p>\n<p>17. Nitekim Anayasa Mahkemesi kararlar\u0131nda da bireysel ba\u015fvuru yolunun \u201cikincil niteli\u011fi belirgin\u201d bir hak arama yolu oldu\u011fu vurgulanmaktad\u0131r. Temel hak ve \u00f6zg\u00fcrl\u00fcklerin ihlal edildi\u011fi iddialar\u0131n\u0131n \u00f6ncelikle genel yarg\u0131 mercilerinde, ola\u011fan kanun yollar\u0131 ile \u00e7\u00f6z\u00fcme kavu\u015fturulmas\u0131 esast\u0131r. Bireysel ba\u015fvuru yoluna, iddia edilen hak ihlallerinin bu ola\u011fan denetim mekanizmas\u0131 i\u00e7inde giderilememesi durumunda ba\u015fvurulabilir (Bayram G\u00f6k, B. No: 2012\/946, 26\/3\/2013, \u00a7 18). Bireysel ba\u015fvuruya konu somut olaylar\u0131n olu\u015fumuna ili\u015fkin delillerin de\u011ferlendirilmesi idari ve yarg\u0131sal makamlar\u0131n \u00f6devidir (R\u0131fat Bak\u0131r ve di\u011ferleri, B. No: 2013\/2782, 11\/3\/2015, \u00a7 68). Anayasa Mahkemesinin ilgili bu makamlar\u0131n yerine do\u011frudan ge\u00e7ecek \u015fekilde delillerin de\u011ferlendirmesini yapmas\u0131n\u0131n veya y\u00fcr\u00fct\u00fclmesi gerekli olan soru\u015fturma i\u015flemlerini belirlemesinin s\u00f6z konusu olamayaca\u011f\u0131 \u00f6zellikle vurgulanmal\u0131d\u0131r. Bu ba\u011flamda Anayasa Mahkemesinin g\u00f6revi, bu makamlar\u0131n maddi olaylara ili\u015fkin yapt\u0131klar\u0131 de\u011ferlendirmenin yerine kendi de\u011ferlendirmesini koymak de\u011fildir (H\u0131d\u0131r \u00d6zt\u00fcrk ve Dilif \u00d6zt\u00fcrk, B. No: 2013\/7832, 21\/4\/2016, \u00a7 185).<\/p>\n<p>18. Bireysel ba\u015fvuru incelemelerinde benimsenmesi gereken bu a\u00e7\u0131k standarda ra\u011fmen somut ba\u015fvuruda ba\u015fvurucunun ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlal edilmedi\u011fi sonucuna ula\u015f\u0131rken Mahkememiz \u00e7o\u011funlu\u011fu bireysel ba\u015fvuruya ili\u015fkin olay ve olgular\u0131 ilk elden de\u011ferlendirerek hareket ederken somut olay ve olgular\u0131 mevcut ba\u015fvuruya benzer oldu\u011funu ifade ederek Burhan Diktepe karar\u0131n\u0131 (B. No: 2018\/10550, 21\/12\/2022) emsal olarak g\u00f6stermi\u015ftir (bkz.: \u00a7 44).<\/p>\n<p>19. Oysa bu konuda hem bireysel ba\u015fvuru inceleme y\u00f6ntemi boyutu ile hem de bu bireysel ba\u015fvuruda ula\u015f\u0131lan sonu\u00e7 itibar\u0131 ile emsal al\u0131nacak karar Ayhan Deniz ve di\u011ferleri karar\u0131d\u0131r. Burhan Diktepe karar\u0131 hem daha eski tarihli hem de B\u00f6l\u00fcm taraf\u0131ndan verilmi\u015f bir karard\u0131r. Ayhan Deniz ve di\u011ferleri karar\u0131 ise esas\u0131nda Burhan Diktepe karar\u0131ndaki inceleme y\u00f6nteminin bireysel ba\u015fvuru incelemesi ba\u011flam\u0131nda sorunlu oldu\u011fu gerek\u00e7esiyle terkedildi\u011fi ve Genel Kurul\u2019dan \u00e7\u0131kan bir ihlal karar\u0131d\u0131r. Hal b\u00f6yle iken sonraki tarihli olan Genel Kurul karar\u0131 mevcut iken bireysel ba\u015fvuruya konu olay ve olgular\u0131 inceleme y\u00f6ntemi boyutu ile sorunlu bi\u00e7imde ele alan B\u00f6l\u00fcm karar\u0131 emsal g\u00f6sterilerek somut ba\u015fvuruda sonuca ula\u015f\u0131lmas\u0131 i\u00e7tihadi a\u00e7\u0131dan da \u00f6ng\u00f6r\u00fclemez bir durum ortaya \u00e7\u0131karmaktad\u0131r. Kald\u0131 ki Ayhan Deniz ve di\u011ferleri karar\u0131n\u0131n somut olay ve olgular\u0131n\u0131n da mevcut ba\u015fvuruya benzer nitelik arz etmekte oldu\u011fu burada belirtilmelidir.<\/p>\n<p>20. \u00d6te yandan Banka 25\/7\/2016 tarihinde ba\u015fvurucunun sosyal medya \u00fczerinde yapt\u0131\u011f\u0131 payla\u015f\u0131mlar\u0131n Bankan\u0131n \u201csayg\u0131nl\u0131\u011f\u0131n\u0131 ve imaj\u0131n\u0131 zedeledi\u011fi gibi itibar kayb\u0131na neden oldu\u011fu\u201dnu tespit ederek 4857 say\u0131l\u0131 \u0130\u015f Kanunu&#8217;nun i\u015f akdinin ge\u00e7erli nedenle feshini d\u00fczenleyen 18. maddesi gere\u011fince i\u015f akdini feshetmesine ve a\u00e7\u0131lan i\u015fe iade davas\u0131nda ilk derece mahkemesi davay\u0131 ayn\u0131 gerek\u00e7eyle feshetmede sorun g\u00f6rmemesine ra\u011fmen istinaf mahkemesi h\u00fckm\u00fc kesinle\u015ftirirken i\u015f akdinin sonland\u0131r\u0131lmas\u0131n\u0131 bu konuya ili\u015fkin bir gerek\u00e7e ortaya koyamadan \u015f\u00fcphe feshine \u00e7evirmi\u015ftir. Mahkememiz \u00e7o\u011funlu\u011fu da istinaf mahkemesinin karar\u0131nda bir sorun g\u00f6rmemi\u015ftir.<\/p>\n<p>21. Bu y\u00f6n\u00fc ile bak\u0131ld\u0131\u011f\u0131nda Bankan\u0131n itibar kayb\u0131 gerek\u00e7esiyle i\u015f akdini feshetmesine ra\u011fmen istinaf mahkemesi ve Mahkememiz \u00e7o\u011funlu\u011funun \u015f\u00fcphe feshine dayal\u0131 bir gerek\u00e7eyi kullanmas\u0131 bir anlamda \u201cgerek\u00e7e ikamesi\u201d niteli\u011finde olup bu y\u00f6n\u00fc ile de bu nitelikteki bir yakla\u015f\u0131m\u0131n hukuken sorunlu oldu\u011funu, bu t\u00fcr bir gerek\u00e7e olu\u015fturma gayretinde bulunman\u0131n bireysel ba\u015fvuru incelemelerinde Anayasa Mahkemesinin yetkisi kapsam\u0131nda olmad\u0131\u011f\u0131n\u0131 ifade etmek gerekmektedir.<\/p>\n<p>22. Sonu\u00e7 olarak yukar\u0131da s\u0131ralanan gerek\u00e7elerle sosyal medya hesab\u0131ndan yapm\u0131\u015f oldu\u011fu payla\u015f\u0131mlardan \u00f6t\u00fcr\u00fc i\u015f akdinin feshedilmesi nedeniyle ba\u015fvurucunun Anayasa\u2019n\u0131n 20. maddesinde g\u00fcvence alt\u0131na al\u0131nan \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ve 26. maddesinde g\u00fcvence alt\u0131na al\u0131nan ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlal edildi\u011fi kanaatinde oldu\u011fumdan Mahkememiz \u00e7o\u011funlu\u011funun aksi y\u00f6ndeki karar\u0131na kat\u0131lmamaktay\u0131m.<\/p>\n<p>   \u00dcye<\/p>\n<p>   \u00a0Yusuf \u015eevki HAKYEMEZ<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>KAR\u015eIOY GEREK\u00c7ES\u0130<\/p>\n<p>1. Ba\u015fvurucu T\u00fcrkiye Cumhuriyeti Ziraat Bankas\u0131 Anonim \u015eirketinde belirsiz s\u00fcreli i\u015f s\u00f6zle\u015fmesiyle \u00e7al\u0131\u015fmakta iken sosyal medya hesab\u0131ndan yapm\u0131\u015f oldu\u011fu payla\u015f\u0131mlar nedeniyle i\u015f s\u00f6zle\u015fmesi feshedilmi\u015ftir.<\/p>\n<p>2. Ba\u015fvurucu, fesih i\u015fleminin haks\u0131z ve ge\u00e7ersiz oldu\u011funu belirterek Banka aleyhine i\u015fe iade talepli tespit davas\u0131 a\u00e7m\u0131\u015f, dava reddedilerek istinaf kanun yolunda kesinle\u015fmi\u015ftir.<\/p>\n<p>3. Ba\u015fvurucu, makul s\u00fcrede yarg\u0131lanma hakk\u0131, \u00f6zel hayata sayg\u0131 hakk\u0131 ve ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc hakk\u0131n\u0131n ihlal edildi\u011fi iddias\u0131 ile s\u00fcresinde bireysel ba\u015fvuruda bulunmu\u015ftur.<\/p>\n<p>4. Mahkememiz ba\u015fvuruda, makul s\u00fcrede yarg\u0131lanma hakk\u0131n\u0131n kabul edilemez oldu\u011funa, \u00f6zel hayata sayg\u0131 hakk\u0131 ve ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc hakk\u0131n\u0131n ise kabul edilebilirli\u011fine bizimde i\u015ftirak etti\u011fimiz \u00fczere oybirli\u011fi ile karar vermi\u015ftir. Mahkememiz ba\u015fvurucunun, \u00f6zel hayata sayg\u0131 ve ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc haklar\u0131n\u0131n ise ihlal edilmedi\u011fine oy \u00e7oklu\u011fu ile karar vermi\u015ftir. A\u015fa\u011f\u0131da belirtilen sebeplerle Mahkeme \u00e7o\u011funlu\u011funun bu karar\u0131na i\u015ftirak edilmemi\u015ftir.<\/p>\n<p>A. \u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn \u0130hlal Edildi\u011fine \u0130li\u015fkin \u0130ddia<\/p>\n<p>5. Somut olayda, bir banka, ba\u015fvurucunun sosyal medya payla\u015f\u0131mlar\u0131n\u0131n banka itibar\u0131n\u0131 zedeledi\u011fi gerek\u00e7esiyle i\u015f s\u00f6zle\u015fmesini feshetmi\u015ftir. A\u00e7\u0131lan i\u015fe iade davas\u0131nda \u0130\u015f Mahkemesi de bu payla\u015f\u0131mlar\u0131n i\u015fveren a\u00e7\u0131s\u0131ndan kabul edilemez oldu\u011funu belirterek feshi hakl\u0131 bulmu\u015ftur. B\u00f6lge Adliye Mahkemesi ise ba\u015fvurucunun 15 Temmuz darbe giri\u015fimi sonras\u0131 yapt\u0131\u011f\u0131 payla\u015f\u0131mlar nedeniyle ter\u00f6r \u00f6rg\u00fctleriyle ili\u015fkisinden \u015f\u00fcphe duyuldu\u011funu ve feshin ge\u00e7erli oldu\u011funu de\u011ferlendirmi\u015ftir.<\/p>\n<p>6. \u015e\u00fcphe feshinin uygulanabilmesi i\u00e7in, i\u015f\u00e7inin i\u015fledi\u011fi ispatlanamayan ancak somut olgulara dayal\u0131 bir su\u00e7 veya borca ayk\u0131r\u0131 a\u011f\u0131r bir davran\u0131\u015fa ili\u015fkin g\u00fc\u00e7l\u00fc bir \u015f\u00fcphenin bulunmas\u0131 gerekir. Bu \u015f\u00fcphe, i\u015f ili\u015fkisini devam ettirmek i\u00e7in gerekli g\u00fcveni zedelemelidir. Ayr\u0131ca, i\u015fverenin olay\u0131 ayd\u0131nlatmak i\u00e7in elinden geleni yapmas\u0131na ra\u011fmen eylemin kan\u0131tlanamamas\u0131 ve i\u015f\u00e7inin savunmas\u0131n\u0131n al\u0131nmas\u0131 \u015fartt\u0131r. Feshin son \u00e7are olarak g\u00f6r\u00fclmesi ve \u015f\u00fcphenin a\u011f\u0131rl\u0131\u011f\u0131, i\u015f\u00e7inin durumu ile i\u015fverende olu\u015fan g\u00fcven kayb\u0131 dikkate al\u0131narak taraflar\u0131n menfaatlerinin dengelenmesi gereklidir.<\/p>\n<p>7. \u015e\u00fcphe nedeniyle i\u015f s\u00f6zle\u015fmesi feshedilen i\u015f\u00e7ilerin a\u00e7t\u0131\u011f\u0131 i\u015fe iade davalar\u0131nda, i\u015fverenin t\u00fcm delilleri sunmas\u0131, mahkemelerin ilgili bilgi ve belgeleri ara\u015ft\u0131rmas\u0131 ve \u015f\u00fcphenin ciddi, g\u00fc\u00e7l\u00fc ve objektif oldu\u011funun, g\u00fcven ili\u015fkisini zedeledi\u011finin somut olarak kan\u0131tlanmas\u0131 gerekmektedir.<\/p>\n<p>8. Mevcut ba\u015fvurudaki feshin nihai gerek\u00e7esi; ba\u015fvurucunun 15 Temmuz darbe giri\u015fimi sonras\u0131 sosyal medya payla\u015f\u0131mlar\u0131 nedeniyle hakk\u0131nda ter\u00f6r \u00f6rg\u00fctleriyle ba\u011flant\u0131l\u0131 oldu\u011funa dair \u015f\u00fcphe olu\u015fmas\u0131 ve bu \u015f\u00fcphenin i\u015fverenle aras\u0131ndaki g\u00fcveni zedelemesidir. Ba\u015fvurucunun, darbe giri\u015fiminin ger\u00e7ek olmad\u0131\u011f\u0131n\u0131 d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fcn\u00fc ifade etti\u011fi payla\u015f\u0131mlar, s\u00fcbjektif g\u00f6r\u00fc\u015flerini yans\u0131tmaktad\u0131r. Ancak, bu payla\u015f\u0131mlar\u0131n kamu tart\u0131\u015fmalar\u0131 \u00e7er\u00e7evesinde yap\u0131ld\u0131\u011f\u0131 g\u00f6z ard\u0131 edilmemelidir. Kamu menfaatini ilgilendiren konularda temel hak ve \u00f6zg\u00fcrl\u00fckler korunmal\u0131 ve yetkililerin takdir marj\u0131 daralt\u0131lmal\u0131d\u0131r. Kamu menfaatini ilgilendiren bir husus oldu\u011fu dikkate al\u0131nd\u0131\u011f\u0131nda, kullan\u0131lan ifadelerin belirli bir husumet i\u00e7ermesi ve baz\u0131 s\u00f6zlerin belli bir a\u011f\u0131rl\u0131\u011fa sahip olma ihtimalinin bulunmas\u0131 bu gereklili\u011fi ortadan kald\u0131rmaz (benzer de\u011ferlendirmeler i\u00e7in bkz. Melike\/T\u00fcrkiye, B. No: 35786\/19,15\/06\/2021, \u00a7\u00a7 47, 48; (Ayhan Deniz ve di\u011ferleri [GK], B. No: 2019\/10975, 14\/6\/2023, \u00a7 45).<\/p>\n<p>9. \u0130\u015f s\u00f6zle\u015fmesinin feshine sebep sosyal medya payla\u015f\u0131m\u0131n\u0131n niteli\u011fi, hangi ortamda nas\u0131l yap\u0131ld\u0131\u011f\u0131 ve yayg\u0131n olup olmad\u0131\u011f\u0131 gibi unsurlar\u0131n incelenerek m\u00fcdahalenin demokratik toplum d\u00fczeninin gereklerine uygunluk \u00f6l\u00e7\u00fct\u00fc y\u00f6n\u00fcnden zorunlu bir toplumsal ihtiyac\u0131 kar\u015f\u0131lad\u0131\u011f\u0131n\u0131n ilgili ve yeterli bir gerek\u00e7eyle ortaya konulmas\u0131 gerekir.<\/p>\n<p>10. A\u0130HM, Melike\/T\u00fcrkiye (B. No: 35786\/19, 15\/6\/2021) karar\u0131nda -di\u011fer unsurlar yan\u0131nda- s\u00f6z konusu i\u00e7eriklerin ilgili sosyal a\u011f \u00fczerinde \u00e7ok geni\u015f bir kitleye ula\u015ft\u0131\u011f\u0131n\u0131n makamlar taraf\u0131ndan iddia edilmedi\u011fi, ba\u015fvurucunun i\u015f yerinde s\u0131n\u0131rl\u0131 bir temsil g\u00fcc\u00fcne sahip oldu\u011fu ve payla\u015f\u0131m\u0131n okuldaki \u00f6\u011frenci, \u00f6\u011fretmen ve di\u011fer \u00e7al\u0131\u015fanlar \u00fczerinde bir etkisinin oldu\u011funun g\u00f6sterilemedi\u011fine vurgu yapm\u0131\u015ft\u0131r (Melike\/T\u00fcrkiye, \u00a7\u00a7 51-53). A\u0130HM&#8217;e g\u00f6re bu be\u011fenilerin \u00f6\u011frenciler, \u00f6\u011frenci velileri, \u00f6\u011fretmenler veya ayn\u0131 i\u015f yerindeki di\u011fer \u00e7al\u0131\u015fanlar taraf\u0131ndan fark edilip edilmedi\u011fi veya bildirilip bildirilmedi\u011fi ve bu ifadelerin i\u015f yerinin d\u00fczenini ve huzurunu tehlikeye atacak nitelikte olaylara neden olup olmad\u0131\u011f\u0131 verilen kararlarda dikkate al\u0131nmam\u0131\u015ft\u0131r (Melike\/T\u00fcrkiye, \u00a7 52).<\/p>\n<p>11. Somut olayda ba\u015fvurucu, i\u015f s\u00f6zle\u015fmesinin feshine neden olan sosyal medya payla\u015f\u0131mlar\u0131n\u0131 kapal\u0131 bir grupta yapt\u0131\u011f\u0131n\u0131 ve bu payla\u015f\u0131mlar\u0131 ayn\u0131 g\u00fcn sildi\u011fini, ayr\u0131ca darbe kar\u015f\u0131t\u0131 i\u00e7erikler de payla\u015ft\u0131\u011f\u0131n\u0131 belirtmektedir.<\/p>\n<p>12. Bu kapsamda ba\u015fvurucu hakk\u0131ndaki davada sosyal medya payla\u015f\u0131m\u0131n\u0131n niteli\u011fini, hangi ortamda nas\u0131l yap\u0131ld\u0131\u011f\u0131 ve yayg\u0131n olup olmad\u0131\u011f\u0131 gibi unsurlar\u0131n yarg\u0131sal denetim kapsam\u0131nda incelenerek m\u00fcdahalenin demokratik toplum d\u00fczeninin gereklerine uygunluk \u00f6l\u00e7\u00fct\u00fc y\u00f6n\u00fcnden zorunlu bir toplumsal ihtiyac\u0131 kar\u015f\u0131lad\u0131\u011f\u0131n\u0131n ilgili ve yeterli bir gerek\u00e7eyle ortaya konulmas\u0131 gerekirken somut olayda yarg\u0131 mercilerinin an\u0131lan hususlara y\u00f6nelik herhangi bir de\u011ferlendirme yapmad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.<\/p>\n<p>13. Yine s\u00f6z konusu i\u00e7eri\u011fin ilgili sosyal medya platformlar\u0131nda \u00e7ok geni\u015f bir kitleye ula\u015ft\u0131\u011f\u0131 y\u00f6n\u00fcnde de bir iddia bulunmamaktad\u0131r. Dahas\u0131, g\u00f6revinin niteli\u011fi dikkate al\u0131nd\u0131\u011f\u0131nda, ba\u015fvuran\u0131n \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015f yerindeki bilinirli\u011fi ve temsil edebilirli\u011finin k\u0131s\u0131tl\u0131 olup olmad\u0131\u011f\u0131 ve sosyal medya platformu \u00fczerindeki eylemlerinin di\u011fer \u00e7al\u0131\u015fanlar \u00fczerinde \u00f6nemli bir etkisinin olup olmayaca\u011f\u0131 y\u00f6n\u00fcnde de bir de\u011ferlendirme yap\u0131lmam\u0131\u015ft\u0131r.<\/p>\n<p>14. \u00d6te yandan i\u015fveren Banka itibar\u0131n\u0131n zedelendi\u011fi i\u00e7in i\u015f akdini feshetmi\u015fse de yarg\u0131 mercileri ba\u015fvurucunun ter\u00f6r \u00f6rg\u00fct\u00fcyle irtibat\u0131 ve iltisak\u0131 oldu\u011funu ara\u015ft\u0131rm\u0131\u015f, Bank Asya&#8217;daki hesab\u0131 d\u0131\u015f\u0131nda Bylock, tan\u0131k vb. herhangi bir delil de elde edememi\u015ftir. Mahkemelerce bu payla\u015f\u0131mlar\u0131n i\u00e7eri\u011fi yan\u0131nda yayg\u0131n nitelikte olup olmad\u0131\u011f\u0131, i\u015fyerindeki \u00e7al\u0131\u015fanlarca fark edilip edilmedi\u011fi, i\u015fyerindeki \u00e7al\u0131\u015fmalara etkisi, kamuoyunda olay\u0131n s\u0131cakl\u0131\u011f\u0131yla tart\u0131\u015f\u0131lan bir mesele ile ilgili olarak ba\u015fvurucunun sonraki davran\u0131\u015flar\u0131 \u00fczerinde durulmam\u0131\u015ft\u0131r.<\/p>\n<p>15. Ayr\u0131ca ba\u015fvurucu hakk\u0131nda s\u00f6z konusu payla\u015f\u0131mlar\u0131 nedeniyle a\u00e7\u0131lan herhangi bir soru\u015fturma ya da kovu\u015fturma bulunmad\u0131\u011f\u0131n\u0131n da alt\u0131 \u00e7izilmelidir. B\u00f6lge Adliye Mahkemesi karar\u0131nda yaln\u0131zca sosyal medya payla\u015f\u0131mlar\u0131na dair tespite yer vermi\u015f ve akabinde ba\u015fvurucunun payla\u015f\u0131mlar\u0131n\u0131n i\u015fveren nezdinde \u015f\u00fcpheye neden oldu\u011funu soyut olarak belirtmekle yetinmi\u015ftir.<\/p>\n<p>16. Son olarak ba\u015fvurucunun sosyal medya payla\u015f\u0131mlar\u0131 sebebiyle ve g\u00fcven ili\u015fkisinin bozuldu\u011fu gerek\u00e7esiyle i\u015f s\u00f6zle\u015fmesini fesheden i\u015fverenin; kendi nezdinde olu\u015fan \u015f\u00fcpheyi gidermeye y\u00f6nelik her t\u00fcrl\u00fc \u00e7abay\u0131 g\u00f6sterdi\u011fine dair bir bilgi de somut olayda mevcut de\u011fildir. Nitekim s\u00f6z konusu payla\u015f\u0131mlara dair ba\u015fvurucunun savunmas\u0131n\u0131n dahi al\u0131nmad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. Derece mahkemelerinin kararlar\u0131nda da bu hususa y\u00f6nelik herhangi bir de\u011ferlendirme yer almamaktad\u0131r. Dolay\u0131s\u0131yla derece mahkemeleri taraf\u0131ndan ba\u015fvurucunun payla\u015f\u0131mlar\u0131 sebebiyle i\u015fverenle aralar\u0131ndaki g\u00fcven ili\u015fkisinin bozuldu\u011funu g\u00f6steren ilgili ve yeterli gerek\u00e7elerin ortaya konulamad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>17. Kald\u0131 ki ba\u015fvurucu sosyal medya payla\u015f\u0131m\u0131ndan dolay\u0131 olduk\u00e7a a\u011f\u0131r bir sonu\u00e7la kar\u015f\u0131la\u015fm\u0131\u015f ve i\u015fini kaybetmi\u015ftir. Kar\u015f\u0131la\u015f\u0131lan a\u011f\u0131r sonu\u00e7 nedeniyle Yarg\u0131tay\u2019\u0131n geli\u015ftirdi\u011fi \u00f6l\u00e7\u00fctlere g\u00f6re feshin son \u00e7are olmas\u0131 prensibinin bu t\u00fcr davalarda uygulanmas\u0131n\u0131n temel hak ve \u00f6zg\u00fcrl\u00fcklerin korunmas\u0131 i\u00e7in hayati \u00f6nemde oldu\u011fu a\u00e7\u0131kt\u0131r. Zira son \u00e7are oldu\u011fu g\u00f6sterilmeden temel hak ve \u00f6zg\u00fcrl\u00fcklerini kullanan i\u015f\u00e7ilerin i\u015f s\u00f6zle\u015fmelerinin feshedilmesi s\u00f6z konusu i\u015f\u00e7iler ve di\u011ferleri \u00fczerinde cayd\u0131r\u0131c\u0131 bir etkiye neden olacakt\u0131r. O h\u00e2lde bir i\u015f s\u00f6zle\u015fmesinin feshinin temel hak ve \u00f6zg\u00fcrl\u00fcklerin ihlaline neden olmamas\u0131 i\u00e7in i\u015f ili\u015fkisinin devam ettirilmesini imk\u00e2ns\u0131z k\u0131ld\u0131\u011f\u0131 de\u011ferlendirilen ve do\u011frudan en a\u011f\u0131r yapt\u0131r\u0131ma ba\u011flanm\u0131\u015f olan bu sebeplerin i\u015fverence ve daha sonra denetleme yapan derece mahkemelerince hi\u00e7bir \u015f\u00fcpheye yer b\u0131rakmayacak \u015fekilde ortaya konulmu\u015f olmas\u0131 gerekir (benzer de\u011ferlendirmeler i\u00e7in bkz. Kardelen Yo\u011fungan ve Sonay Tezcan, B. No: 2018\/24097, 2\/5\/2023, \u00a7 63; Ayhan Aky\u00fcz ve di\u011ferleri, B. No: 2018\/6851, 10\/5\/2023, \u00a7 45). Buna kar\u015f\u0131n ba\u015fvurucunun i\u015f s\u00f6zle\u015fmesinin sonland\u0131r\u0131lmas\u0131nda feshin son \u00e7are olmas\u0131 prensibinin de\u011ferlendirilmedi\u011fi g\u00f6r\u00fclmektedir.<\/p>\n<p>18. A\u00e7\u0131klanan gerek\u00e7elerle i\u015f ili\u015fkisinden do\u011fan uyu\u015fmazl\u0131klar\u0131 karara ba\u011flayan derece mahkemelerince ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne ili\u015fkin Anayasa&#8217;n\u0131n 26. maddesindeki g\u00fcvencelerin g\u00f6zetildi\u011fi bir yarg\u0131lama yap\u0131lmad\u0131\u011f\u0131, dolay\u0131s\u0131yla anayasal g\u00fcvencelerin korunmas\u0131 a\u00e7\u0131s\u0131ndan devletin y\u00fck\u00fcml\u00fcl\u00fcklerini yerine getirmedi\u011fi anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>B. \u00d6zel Hayata Sayg\u0131 Hakk\u0131n\u0131n \u0130hlal Edildi\u011fine \u0130li\u015fkin \u0130ddia<\/p>\n<p>19. Ba\u015fvurucunun sosyal medya payla\u015f\u0131mlar\u0131 nedeniyle ter\u00f6r \u00f6rg\u00fctleri ile irtibatl\u0131 oldu\u011fu sonucuna var\u0131larak i\u015f s\u00f6zle\u015fmesi feshedilmi\u015f ve i\u015fe iade davas\u0131 reddedilmi\u015ftir. Anayasa Mahkemesi C.A. (3) karar\u0131nda i\u015f s\u00f6zle\u015fmelerinin feshine ili\u015fkin meselelerin \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda ele al\u0131nmas\u0131 i\u00e7in meselenin \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131 gerekli k\u0131lacak \u00f6l\u00e7\u00fcde ciddi ve asgari bir a\u011f\u0131rl\u0131k d\u00fczeyinde oldu\u011funun ortaya konulmas\u0131 gerekti\u011fini ifade etmi\u015f ve baz\u0131 \u00f6l\u00e7\u00fctler belirlemi\u015ftir (\u00f6l\u00e7\u00fctler i\u00e7in bkz. (C.A. (3) [GK], B. No: 2018\/10286, 2\/7\/2020, \u00a7\u00a7 93-95). Ba\u015fvuruya konu olayda feshe dayanak olan \u015f\u00fcphenin dayana\u011f\u0131n\u0131 ba\u015fvurucunun ter\u00f6r \u00f6rg\u00fct\u00fcyle irtibatl\u0131 ya da iltisakl\u0131 oldu\u011fu iddias\u0131 olu\u015fturmaktad\u0131r. Bir kimsenin ter\u00f6r \u00f6rg\u00fct\u00fc ile irtibatl\u0131 veya iltisakl\u0131 oldu\u011funun iddia edilmesinin, tek ba\u015f\u0131na, onun ba\u015fkalar\u0131 ile ili\u015fki kurabilme ve geli\u015ftirebilme imk\u00e2n\u0131n\u0131n \u00f6nemli \u00f6l\u00e7\u00fcde zay\u0131flamas\u0131na, sosyal ve mesleki itibar\u0131n\u0131 koruyabilmesi a\u00e7\u0131s\u0131ndan ciddi sonu\u00e7lar do\u011furmas\u0131na yol a\u00e7aca\u011f\u0131, dolay\u0131s\u0131yla da \u00f6zel hayat\u0131na \u00f6nemli bir a\u011f\u0131rl\u0131k derecesinde yans\u0131yaca\u011f\u0131 ve etki do\u011furaca\u011f\u0131 muhakkakt\u0131r. Mevcut durum itibar\u0131yla ba\u015fvurucunun duydu\u011fu \u00fcz\u00fcnt\u00fc ile endi\u015fenin i\u00e7 ve d\u0131\u015f d\u00fcnyas\u0131nda meydana getirdi\u011fi etkinin ciddi ve asgari a\u011f\u0131rl\u0131k d\u00fczeyine ula\u015ft\u0131\u011f\u0131 konusunda teredd\u00fct bulunmamaktad\u0131r. (benzer y\u00f6nde de\u011ferlendirmeler i\u00e7in bkz. Yener Kaya ve di\u011ferleri, B. No: 2021\/52529, 9\/1\/2024, \u00a7 13). Bu y\u00f6n\u00fcyle ba\u015fvurunun Anayasa&#8217;n\u0131n 20. maddesinde g\u00fcvence alt\u0131na al\u0131nan \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda da incelenmesi gerekir.<\/p>\n<p>20. Ba\u015fvuru konusu olayda uyu\u015fmazl\u0131k, i\u015f s\u00f6zle\u015fmesinin sosyal medya payla\u015f\u0131mlar\u0131 gerek\u00e7e g\u00f6sterilerek ve ter\u00f6r \u00f6rg\u00fctleri ile irtibat ve iltisak iddias\u0131na dayal\u0131 olarak feshedilmesine ili\u015fkindir. Bu kapsamda ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn korunmas\u0131na y\u00f6nelik devletin y\u00fck\u00fcml\u00fcklerine ili\u015fkin ilkeler ayn\u0131 \u015fekilde \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n korunmas\u0131 y\u00f6n\u00fcnden de ge\u00e7erlidir.<\/p>\n<p>21. Somut olayda feshin nihai gerek\u00e7esi ba\u015fvurucunun ter\u00f6r \u00f6rg\u00fctleri ile irtibatl\u0131 ve iltisakl\u0131 oldu\u011funa dair i\u015fverende olu\u015fan \u015f\u00fcphedir. Bu t\u00fcr durumlarda ba\u015fvurulabilecek tedbirlerden olan i\u015f s\u00f6zle\u015fmesinin feshedilmesi konusunda Anayasa&#8217;n\u0131n 20. maddesinde g\u00fcvence alt\u0131na al\u0131nan \u00f6zel hayata sayg\u0131 hakk\u0131, i\u015f ili\u015fkisinin tek tarafl\u0131 bir irade beyan\u0131yla sonland\u0131r\u0131lmas\u0131n\u0131 yasaklamamaktad\u0131r.
