Komisyon, ba\u015fvurunun kabul edilebilirlik incelemesinin B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na karar vermi\u015ftir.<\/p>\n<p>3. Ba\u015fvuru belgelerinin bir \u00f6rne\u011fi bilgi i\u00e7in Adalet Bakanl\u0131\u011f\u0131na (Bakanl\u0131k) g\u00f6nderilmi\u015ftir. Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcn\u00fc bildirmi\u015ftir. Ba\u015fvurucu, Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 beyanda bulunmu\u015ftur.<\/p>\n<p>III. OLAY VE OLGULAR <\/p>\n<p>4. Ba\u015fvuru formlar\u0131 ve eklerinde ifade edildi\u011fi \u015fekliyle ve Ulusal Yarg\u0131 A\u011f\u0131 Bili\u015fim Sistemi (UYAP) arac\u0131l\u0131\u011f\u0131yla eri\u015filen bilgi ve belgeler \u00e7er\u00e7evesinde ilgili olaylar \u00f6zetle \u015f\u00f6yledir:<\/p>\n<p>A. 6-7 Ekim Olaylar\u0131na \u0130li\u015fkin Genel Bilgiler <\/p>\n<p>5. Suriye&#8217;nin T\u00fcrkiye s\u0131n\u0131r\u0131nda bulunan Ayn el-Arap (Kobani) kentinde -PKK&#8217;n\u0131n Suriye kolu oldu\u011fu kabul edilen- PYD ile DAE\u015e aras\u0131ndaki \u00e7at\u0131\u015fmalar, 2014 y\u0131l\u0131n\u0131n Eyl\u00fcl ay\u0131 sonunda ve Ekim ay\u0131 ba\u015f\u0131nda yo\u011funla\u015fm\u0131\u015ft\u0131r. Bu s\u0131rada PKK&#8217;n\u0131n \u00fcst d\u00fczey y\u00f6neticilerinden Murat Karay\u0131lan&#8217;\u0131n sosyal medya hesab\u0131ndan 5\/10\/2014 tarihinde saat 00.07&#8217;de &#8220;Gen\u00e7leri kad\u0131nlar\u0131 7 den 70 e herkesi Kobane&#8217;ye sahip \u00e7\u0131kmaya onurumuzu namusumuzu korumaya metropolleri i\u015fgal etmeye \u00e7a\u011f\u0131r\u0131yoruz.&#8221; \u015feklinde bir a\u00e7\u0131klamada bulunulmu\u015ftur.<\/p>\n<p>6. PKK g\u00fcd\u00fcm\u00fcnde yay\u0131n yapt\u0131\u011f\u0131 belirtilen bir internet haber sitesinde 6\/10\/2014 tarihinde &#8220;Komalen Ciwan Koordinasyonu&#8221; (PKK&#8217;n\u0131n gen\u00e7lik yap\u0131lanmas\u0131) ad\u0131na bir a\u00e7\u0131klama yay\u0131mlanm\u0131\u015ft\u0131r. A\u00e7\u0131klamada &#8220;Bilindi\u011fi \u00fczere 23 g\u00fcnd\u00fcr Kobani merkezli DA\u0130\u015e (DAE\u015e) fa\u015fizmi son barbarl\u0131\u011f\u0131yla devam etmektedir. &#8230; t\u00fcm k\u00fcrt gen\u00e7li\u011fi \u015fehit Jiyan, \u015fehit Gerilla ve \u015fehit Militan yolda\u015flar\u0131n ruhuyla zafere kadar Arin Mirkan (Kobani&#8217;deki \u00e7at\u0131\u015fmalar s\u0131ras\u0131nda d\u00fczenledi\u011fi intihar sald\u0131r\u0131s\u0131nda \u00f6len YPG mensubu) \u00e7izgisinde y\u00fcr\u00fcmeye \u00e7a\u011f\u0131r\u0131yoruz. Kobani ile ba\u015flayan devrim dalgas\u0131 t\u00fcm K\u00fcrdistan&#8217;a yay\u0131lmal\u0131 ve bu temelde K\u00fcrdistan gen\u00e7li\u011fini ayaklanmas\u0131 \u00e7a\u011fr\u0131s\u0131nda bulunuyoruz.&#8221; ifadelerine yer verilmi\u015ftir. Ayn\u0131 sitede ayr\u0131ca &#8220;K\u00fcrdistan Kurumlar&#8221; ad\u0131na yap\u0131ld\u0131\u011f\u0131 belirtilen benzer i\u00e7erikteki farkl\u0131 bir a\u00e7\u0131klamaya da yer verilmi\u015ftir.<\/p>\n<p>7. 6\/10\/2014 tarihinde Halklar\u0131n Demokratik Partisi (HDP) Merkez Y\u00fcr\u00fctme Kurulu (MYK) da ayn\u0131 olaylara ili\u015fkin bir toplant\u0131 yapm\u0131\u015ft\u0131r. Toplant\u0131 s\u0131ras\u0131nda HDP&#8217;nin sosyal medya hesab\u0131ndan &#8220;HALKLARIMIZA AC\u0130L \u00c7A\u011eRI! \u015eUANDA TOPLANTI HAL\u0130NDE OLAN HDP MYK\u2019DAN HALKLARIMIZA AC\u0130L \u00c7A\u011eRI! Koban\u00e9\u2019de durum son derece kritiktir. I\u015e\u0130D (DAE\u015e) sald\u0131r\u0131lar\u0131n\u0131 ve AKP iktidar\u0131n\u0131n Koban\u00e9\u2019ye ambargo tutumunu protesto etmek \u00fczere halklar\u0131m\u0131z\u0131 soka\u011fa \u00e7\u0131kmaya ve soka\u011fa \u00e7\u0131km\u0131\u015f olanlara destek vermeye \u00e7a\u011f\u0131r\u0131yoruz&#8221;, &#8220;Koban\u00e9\u2019de ya\u015fanan katliam giri\u015fimine kar\u015f\u0131 7 den 70 e b\u00fct\u00fcn halklar\u0131m\u0131z\u0131 soka\u011fa, alan tutmaya ve harekete ge\u00e7meye \u00e7a\u011f\u0131r\u0131yoruz&#8221; ve &#8220;Bundan b\u00f6yle her yer Kobane&#8217;dir. Kobane&#8217;deki ku\u015fatma ve vah\u015fi sald\u0131rganl\u0131k son bulana kadar S\u00dcRES\u0130Z D\u0130REN\u0130\u015eE \u00e7a\u011f\u0131r\u0131yoruz.&#8221; \u015feklinde a\u00e7\u0131klama ve \u00e7a\u011fr\u0131lar yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>8. Yukar\u0131da belirtilen internet haber sitesinin 7\/10\/2014 ve 8\/10\/2014 tarihli yay\u0131nlar\u0131nda PKK\/KCK taraf\u0131ndan yap\u0131lan ba\u015fkald\u0131r\u0131 \u00e7a\u011fr\u0131lar\u0131na ili\u015fkin a\u00e7\u0131klamalara yer verilmi\u015ftir.<\/p>\n<p>9. Bu \u00e7a\u011fr\u0131lar \u00fczerine Suriye&#8217;deki \u00e7at\u0131\u015fmalar dolay\u0131s\u0131yla tepkilerini dile getirdi\u011fini ileri s\u00fcren gruplar 6\/10\/2014 tarihinden itibaren T\u00fcrkiye&#8217;nin bir\u00e7ok yerinde g\u00fcnlerce devam eden ve kamuoyunda &#8220;6-7 Ekim olaylar\u0131&#8221; olarak adland\u0131r\u0131lan \u015fiddet eylemlerini ger\u00e7ekle\u015ftirmi\u015ftir. Bu eylemler s\u0131ras\u0131nda \u00fclkenin pek \u00e7ok yerinde kamu binalar\u0131na, banka \u015fubelerine, i\u015fyerlerine, ara\u00e7lara, g\u00fcvenlik g\u00fc\u00e7lerine ve sivillere ta\u015f, sopa, molotofkokteyli ve silahlarla sald\u0131r\u0131da bulunulmu\u015ftur. Bu s\u0131rada kamu makamlar\u0131nca g\u00fcvenli\u011fin sa\u011flanmas\u0131 i\u00e7in bir\u00e7ok \u015fehirde e\u011fitime ara verilmi\u015f ve soka\u011fa \u00e7\u0131kma yasa\u011f\u0131 ilan edilmi\u015ftir.<\/p>\n<p>10. Kamu makamlar\u0131n\u0131n ve soru\u015fturma mercilerinin tespitlerine g\u00f6re -aralar\u0131nda \u0130stanbul, Ankara, \u0130zmir, Adana, Mersin, \u015eanl\u0131urfa, Van, Erzurum, Diyarbak\u0131r ve Gaziantep gibi b\u00fcy\u00fck kentlerin de oldu\u011fu- otuz alt\u0131 ayr\u0131 ilde ger\u00e7ekle\u015ftirilen \u015fiddet eylemleri sonucunda (2&#8217;si g\u00fcvenlik g\u00f6revlisi) 45 ki\u015fi hayat\u0131n\u0131 kaybederken (331&#8217;i g\u00fcvenlik g\u00f6revlisi) 769 ki\u015fi yaralanm\u0131\u015ft\u0131r. Ayr\u0131ca \u00e7at\u0131\u015fmalar s\u0131ras\u0131nda 5 \u00f6rg\u00fct mensubunun hayat\u0131n\u0131 kaybetti\u011fi, 3 \u00f6rg\u00fct mensubunun ise yaraland\u0131\u011f\u0131 belirtilmi\u015ftir. \u00d6te yandan \u00fclke genelinde ger\u00e7ekle\u015ftirilen 2.389 \u015fiddet eylemine 121.899 ki\u015finin kat\u0131ld\u0131\u011f\u0131, olaylarda (737&#8217;si g\u00fcvenlik g\u00fc\u00e7lerine ait olmak \u00fczere) 1.881 arac\u0131n zarar g\u00f6rd\u00fc\u011f\u00fc, (27&#8217;si kaymakaml\u0131k, 52&#8217;si emniyet, 283&#8217;\u00fc okul, 73&#8217;\u00fc siyasi parti, 12&#8217;si belediye binas\u0131 olmak \u00fczere) 2.558 binaya sald\u0131r\u0131da bulunuldu\u011fu ve zarar verildi\u011fi tespit edilmi\u015ftir. Olaylara ili\u015fkin olarak 4.291 \u015f\u00fcpheli g\u00f6zalt\u0131na al\u0131nm\u0131\u015f, bunlardan 1.105&#8217;i hakk\u0131nda tutuklama tedbiri uygulanm\u0131\u015ft\u0131r (6-7 Ekim olaylar\u0131na ili\u015fkin ayr\u0131nt\u0131l\u0131 a\u00e7\u0131klamalar i\u00e7in bkz. Zeynep \u00d6lbeci, B. No: 2021\/10825, 13\/12\/2023, \u00a7\u00a7 5-13).<\/p>\n<p>B. Ba\u015fvurucunun Tutuklanmas\u0131na \u0130li\u015fkin S\u00fcre\u00e7<\/p>\n<p>11. Ba\u015fvurucu 2014-2015 y\u0131llar\u0131 aras\u0131nda HDP MYK \u00fcyeli\u011fi yapm\u0131\u015ft\u0131r.<\/p>\n<p>12. Ankara Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131 (Ba\u015fsavc\u0131l\u0131k) taraf\u0131ndan 6\/10\/2014-7\/10\/2014 tarihlerinde ba\u015flay\u0131p sonraki g\u00fcnlerde bir\u00e7ok \u015fehre yay\u0131lan ve \u00e7ok say\u0131da ki\u015finin hayat\u0131n\u0131 kaybetti\u011fi veya yaraland\u0131\u011f\u0131 \u015fiddet olaylar\u0131 (bkz. \u00a7\u00a7 9, 10) dolay\u0131s\u0131yla 9\/10\/2014 tarihinde bir (2014\/146757 say\u0131l\u0131) soru\u015fturma ba\u015flat\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>13. Soru\u015fturma s\u00fcrecine ili\u015fkin a\u015famalar -soru\u015fturma evrak\u0131 \u00fczerinden tespit edildi\u011fi \u00f6l\u00e7\u00fcde- temel olarak \u015f\u00f6yle ger\u00e7ekle\u015fmi\u015ftir:<\/p>\n<p>-Ba\u015fsavc\u0131l\u0131k 15\/4\/2015 tarihinde Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131ndan 10\/10\/2014 tarihi itibar\u0131yla HDP MYK \u00fcyesi olan ki\u015filerin a\u00e7\u0131k kimlik ve adres bilgilerini talep etmi\u015ftir.<\/p>\n<p>&#8211; 6-7 Ekim olaylar\u0131 ile ilgili olarak baz\u0131 HDP&#8217;li milletvekillerinin beyanlar\u0131n\u0131 ve HDP\u2019nin resm\u00ee sosyal medya hesab\u0131ndan yap\u0131lan a\u00e7\u0131klamalar\u0131 i\u00e7eren 20\/9\/2014 tarihli tutanak soru\u015fturma dosyas\u0131na 1\/10\/2015 tarihinde eklenmi\u015ftir.<\/p>\n<p>&#8211; Ba\u015fsavc\u0131l\u0131k dosya kapsam\u0131nda \u015f\u00fcpheli olarak bulunan ki\u015filerin ifadelerinin temin edilmesi amac\u0131yla 2015-2017 y\u0131llar\u0131 aras\u0131ndaki s\u00fcre\u00e7te ilgili kurumlarla \u00e7e\u015fitli yaz\u0131\u015fmalar yapm\u0131\u015ft\u0131r.<\/p>\n<p>&#8211; 6-7 Ekim olaylar\u0131 s\u0131ras\u0131nda meydana gelen \u00f6l\u00fcm ve yaralanma vakalar\u0131na ili\u015fkin otopsi raporlar\u0131, adli muayene raporlar\u0131, mala zarar verme eylemleriyle ilgili olay yeri krokileri ve g\u00f6rg\u00fc tespit tutanaklar\u0131 ile t\u00fcm bu olaylara y\u00f6nelik yap\u0131lan soru\u015fturmalar kapsam\u0131nda elde edilen delillerin listeleri, adli kolluk fezlekeleri, iddianameler ve karar \u00f6rnekleri Ba\u015fsavc\u0131l\u0131\u011f\u0131n talebi \u00fczerine olaylar\u0131n ger\u00e7ekle\u015fti\u011fi illerdeki Cumhuriyet ba\u015fsavc\u0131l\u0131klar\u0131 taraf\u0131ndan g\u00f6nderilmi\u015f ve soru\u015fturma dosyas\u0131na girmi\u015ftir.<\/p>\n<p>&#8211; PKK\/KCK ter\u00f6r \u00f6rg\u00fct\u00fc ve ba\u011fl\u0131 yap\u0131lanmalar\u0131 ile HDP&#8217;nin 6\/10\/2014-7\/10\/2014 tarihinde ger\u00e7ekle\u015fen olaylardaki sorumlulu\u011funa y\u00f6nelik Ara\u015ft\u0131rma Tutana\u011f\u0131 ve ba\u015fvurucunun da aralar\u0131nda bulundu\u011fu ki\u015filerin PKK\/KCK ter\u00f6r \u00f6rg\u00fct\u00fcyle ba\u011flant\u0131lar\u0131na dair inceleme tutana\u011f\u0131, ayr\u0131ca bu ki\u015filerin olay tarihinde kulland\u0131klar\u0131 mobil telefonlar\u0131n HTS kay\u0131tlar\u0131 Ba\u015fsavc\u0131l\u0131\u011f\u0131n talebi \u00fczerine Ankara Emniyet M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan g\u00f6nderilmi\u015f ve soru\u015fturma dosyas\u0131na girmi\u015ftir.<\/p>\n<p>&#8211; Ba\u015fsavc\u0131l\u0131k 19\/7\/2018 tarihinde T\u00fcrkiye B\u00fcy\u00fck Millet Meclisinden (TBMM) 25 \u015f\u00fcphelinin milletvekili olup olmad\u0131\u011f\u0131, milletvekili olanlar\u0131n hangi tarihte milletvekili se\u00e7ildikleri ve haklar\u0131nda yasama dokunulmazl\u0131klar\u0131n\u0131n kald\u0131r\u0131lmas\u0131na ili\u015fkin d\u00fczenlenmi\u015f fezleke bulunup bulunmad\u0131\u011f\u0131 hususlar\u0131na y\u00f6nelik bilgi talebinde bulunmu\u015ftur.<\/p>\n<p>&#8211; Ba\u015fsavc\u0131l\u0131k 13\/12\/2018 tarihinde baz\u0131 Cumhuriyet ba\u015fsavc\u0131l\u0131klar\u0131ndan 6-7 Ekim olaylar\u0131 s\u0131ras\u0131nda meydana gelen \u00f6l\u00fcm, yaralama, mala zarar verme, ya\u011fma ve di\u011fer su\u00e7lara ili\u015fkin m\u00fc\u015fteki ve ma\u011fdur ifadelerinin, bilirki\u015fi raporlar\u0131n\u0131n, g\u00f6rg\u00fc tespit tutanaklar\u0131n\u0131n, olay yeri krokilerinin, adli muayene raporlar\u0131n\u0131n, otopsi raporlar\u0131n\u0131n ve tan\u0131k ifadeleri ba\u015fta olmak \u00fczere di\u011fer t\u00fcm delillerin fezleke \u015feklinde haz\u0131rlanarak g\u00f6nderilmesini talep etmi\u015ftir. Y.E., R.D., N.Y.nin ba\u015fka soru\u015fturma kapsam\u0131nda daha \u00f6nceden al\u0131nan ifadeleri ise 27\/2\/2019 tarihinde soru\u015fturma dosyas\u0131na d\u00e2hil edilmi\u015ftir.<\/p>\n<p>14. Soru\u015fturman\u0131n devam\u0131nda 25\/9\/2020 tarihinde g\u00f6zalt\u0131na al\u0131nan ba\u015fvurucu, Ba\u015fsavc\u0131l\u0131kta verdi\u011fi ifadesinde \u00f6zetle 6\/10\/2014-8\/10\/2014 tarihinde HDP MYK \u00fcyesi oldu\u011funu, bu s\u00fcre\u00e7te ayaklanma ve \u015fiddet i\u00e7eren \u00e7a\u011fr\u0131 yap\u0131lmas\u0131 y\u00f6n\u00fcnde herhangi bir karar al\u0131nmad\u0131\u011f\u0131n\u0131, MYK taraf\u0131ndan Kobani kentinde PYD ile DAE\u015e aras\u0131ndaki \u00e7at\u0131\u015fmalara ili\u015fkin bir \u00e7a\u011fr\u0131 yap\u0131lmas\u0131na karar verildi\u011fini belirterek bu \u00e7a\u011fr\u0131n\u0131n \u015fiddete te\u015fvik amac\u0131 ta\u015f\u0131mad\u0131\u011f\u0131n\u0131 ileri s\u00fcrm\u00fc\u015ft\u00fcr.<\/p>\n<p>15. Ba\u015fsavc\u0131l\u0131k 1\/10\/2020 tarihinde ba\u015fvurucuyu devletin birli\u011fini ve \u00fclke b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc bozma, bir su\u00e7u gizlemek veya ba\u015fka bir su\u00e7un delillerini gizlemek ya da yakalanmamak amac\u0131yla \u00f6ld\u00fcrmeye azmettirme, bir su\u00e7u gizlemek veya ba\u015fka bir su\u00e7un delillerini gizlemek ya da yakalanmamak amac\u0131yla \u00f6ld\u00fcrmeye te\u015febb\u00fcse azmettirme, var olan veya var say\u0131lan su\u00e7 \u00f6rg\u00fctlerinin olu\u015fturduklar\u0131 korkutucu g\u00fc\u00e7ten yararlanarak yol kesmek suretiyle su\u00e7 \u00f6rg\u00fct\u00fcne yarar sa\u011flamak maksad\u0131yla gece vakti silahla birden fazla ki\u015fi ile ya\u011fmaya azmettirme ve cebir, tehdit veya hile kullanarak ki\u015fiyi h\u00fcrriyetinden yoksun k\u0131lmaya azmettirme su\u00e7lar\u0131ndan tutuklanmas\u0131 istemiyle Ankara Sulh Ceza H\u00e2kimli\u011fine sevk etmi\u015ftir.<\/p>\n<p>16. Tutuklama talep yaz\u0131s\u0131nda ba\u015fvurucunun at\u0131l\u0131 su\u00e7lar\u0131 i\u015fledi\u011fine dair kuvvetli su\u00e7 \u015f\u00fcphesinin varl\u0131\u011f\u0131n\u0131 g\u00f6steren somut delillerin bulundu\u011fu, m\u00fcsnet su\u00e7lar\u0131n katalog su\u00e7lardan oldu\u011fu, dolay\u0131s\u0131yla ba\u015fvurucu y\u00f6n\u00fcnden tutuklama nedenlerinin bulundu\u011fu belirtilmi\u015ftir.<\/p>\n<p>17. Ba\u015fvurucunun sorgusu 2\/10\/2020 tarihinde Ankara 4. Sulh Ceza H\u00e2kimli\u011fi taraf\u0131ndan yap\u0131lm\u0131\u015ft\u0131r. Sorgu s\u0131ras\u0131nda ba\u015fvurucunun m\u00fcdafileri de sorgunun yap\u0131ld\u0131\u011f\u0131 H\u00e2kimlik salonunda haz\u0131r bulunmu\u015ftur. Ba\u015fvurucu sorgusunda Ba\u015fsavc\u0131l\u0131kta verdi\u011fi ifadenin ge\u00e7erli oldu\u011funu ve ek bir ifade vermeyece\u011fini belirtmi\u015ftir.<\/p>\n<p>18. Ba\u015fvurucu tutuklama karar\u0131na itiraz etmi\u015f, Ankara 5. Sulh Ceza H\u00e2kimli\u011fince 16\/10\/2020 tarihinde itiraz\u0131n kesin olarak reddine karar verilmi\u015ftir. Sulh Ceza Hakimli\u011fi&#8217;nin 02\/10\/2020 g\u00fcn ve 2020\/1032 sorgu say\u0131l\u0131 karar\u0131 usul ve yasaya uygun bulundu\u011fundan, itirazlar\u0131n AYRI AYRI REDD\u0130NE&#8230; [karar verildi.]&#8221;<\/p>\n<p>20. Ba\u015fsavc\u0131l\u0131\u011f\u0131n -ba\u015fvurucuyla birlikte 108 \u015f\u00fcpheli ve 2.676 m\u00fc\u015fteki\/ma\u011fdurun yer ald\u0131\u011f\u0131- 30\/12\/2020 tarihli iddianamesi ile ba\u015fvurucunun devletin birli\u011fini ve \u00fclke b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc bozma, bir su\u00e7u gizlemek veya ba\u015fka bir su\u00e7un delillerini gizlemek ya da yakalanmamak amac\u0131yla \u00f6ld\u00fcrme ve \u00f6ld\u00fcrmeye te\u015febb\u00fcs etme, kasten yaralama, kamu mal\u0131na zarar verme, h\u0131rs\u0131zl\u0131k, birden fazla ki\u015fi ile birlikte gece vaktinde su\u00e7 \u00f6rg\u00fct\u00fcne yarar sa\u011flamak maksad\u0131yla ya\u011fma, devletin egemenlik alametlerini a\u015fa\u011f\u0131lama, \u00e7al\u0131\u015fma h\u00fcrriyetini ihlal etme ve ki\u015fiyi h\u00fcrriyetinden yoksun k\u0131lma su\u00e7lar\u0131n\u0131 i\u015fledi\u011finden bahisle cezaland\u0131r\u0131lmas\u0131 istemiyle ayn\u0131 yer a\u011f\u0131r ceza mahkemesinde kamu davas\u0131 a\u00e7\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>21. \u0130lk olarak PKK\/KCK&#8217;ya ili\u015fkin genel a\u00e7\u0131klamalar\u0131n yap\u0131ld\u0131\u011f\u0131 iddianamede 6-7 Ekim olaylar\u0131na giden s\u00fcre\u00e7 ve belirtilen tarihlerde ger\u00e7ekle\u015fen olaylar kronolojik olarak anlat\u0131lm\u0131\u015f, \u00f6rg\u00fct liderlerinin bu s\u00fcre\u00e7teki talimat ve \u00e7a\u011fr\u0131lar\u0131na de\u011finilmi\u015f ve son olarak \u015f\u00fcphelilerin eylemlerine yer verilmi\u015ftir (an\u0131lan iddianame i\u00e7eri\u011fine ili\u015fkin ayr\u0131nt\u0131l\u0131 a\u00e7\u0131klamalar i\u00e7in bkz. Mahkeme 21\/5\/2021, 25\/6\/2021, 6\/9\/2021 ve 11\/11\/2021 tarihlerinde 2\/4\/2021 tarihli karar\u0131nda a\u00e7\u0131klad\u0131\u011f\u0131 gerek\u00e7eleri tekrarlayarak ba\u015fvurucunun tutuklulu\u011funun devam\u0131na karar vermi\u015ftir.<\/p>\n<p>26. Ba\u015fvurucunun 11\/11\/2021 tarihli karara yapt\u0131\u011f\u0131 18\/11\/2021 tarihli itiraz Ankara 23. A\u011f\u0131r Ceza Mahkemesi taraf\u0131ndan 24\/11\/2021 tarihinde reddedilmi\u015ftir.<\/p>\n<p>27. Ba\u015fvurucu itiraz\u0131n reddine dair karar\u0131 27\/11\/2021 tarihinde \u00f6\u011frendikten sonra 15\/12\/2021 tarihinde bireysel ba\u015fvuruda bulunmu\u015ftur.<\/p>\n<p>28. Bireysel ba\u015fvurunun yap\u0131ld\u0131\u011f\u0131 tarihten sonraki s\u00fcre\u00e7te Mahkeme, 2\/4\/2021 tarihli karar\u0131ndaki gerek\u00e7elerle ba\u015fvurucunun tutuklulu\u011funun devam\u0131na muhtelif oturumlarda karar vermi\u015ftir.<\/p>\n<p>29. Duru\u015fman\u0131n 6\/11\/2023 tarihli 70. oturumunda Mahkeme, ba\u015fvurucunun tutukluluk h\u00e2linin devam\u0131na karar vermi\u015ftir. An\u0131lan karar\u0131n ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Gizli tan\u0131k Mahir&#8217;in 02\/07\/2022 tarihinde mahkememiz huzurunda vermi\u015f oldu\u011fu ve \u00f6nceki beyan\u0131n\u0131 kapsar \u015fekilde devam ettirdi\u011fi ifadesi, tan\u0131k [M.R.O.nun] beyanlar\u0131 tan\u0131k [K.G.nin] mahkeme beyan\u0131 yine Avrupa \u0130nsan Haklar\u0131 Mahkemesinin incelemesine girmedi\u011fi anla\u015f\u0131lan ve \u00f6rg\u00fct\u00fcn eyleme zorlamak amac\u0131yla s\u00f6z konusu MYK taraf\u0131ndan yap\u0131lan \u00e7a\u011fr\u0131lar\u0131 gerek\u00e7e g\u00f6stererek hareket etti\u011fi y\u00f6n\u00fcndeki bir tak\u0131m tan\u0131k beyanlar\u0131 (\u00f6rne\u011fin tan\u0131k [Z.\u00d6.] haz\u0131rl\u0131k beyan\u0131, m\u00fc\u015fteki [K.B.] beyan\u0131) ve san\u0131k [A.T.nin] soru\u015fturma beyanlar\u0131 ile \u00f6zellikle \u00e7\u0131kan olaylar\u0131n, \u00e7a\u011fr\u0131lar sonras\u0131 PKK taraf\u0131ndan organize edilen ba\u015fkald\u0131r\u0131 -serhildan- eylemleri oldu\u011funu belirten san\u0131k [\u0130.B.nin] m\u00fcdafi huzurunda verdi\u011fi soru\u015fturma beyan\u0131 itibariyle san\u0131k \u0130smail \u015eENG\u00dcL&#8217;\u00fcn kuvvetli su\u00e7 \u015f\u00fcphesi alt\u0131nda bulundu\u011fu de\u011ferlendirilmektedir.<\/p>\n<p>A\u00e7\u0131lm\u0131\u015f olan soru\u015fturmaya ra\u011fmen ka\u00e7mayan \u015f\u00fcphelilerin uzun bir s\u00fcre sonra ba\u015flat\u0131lan kovu\u015fturma a\u015famas\u0131nda ka\u00e7ma \u015f\u00fcphesinin bulunmayaca\u011f\u0131 savunmalar\u0131 yer yer dile getirilmektedir. \u0130\u00e7 y\u00f6n\u00fc belli olmayan eylem nedeniyle kendisini ceza tehdidi alt\u0131nda g\u00f6rmeyen \u015f\u00fcphelinin ka\u00e7may\u0131 motive edici durumunun ilk anda bulunmayaca\u011f\u0131 a\u00e7\u0131kt\u0131r. Yeni deliller itibariyle eylemin cezaland\u0131r\u0131labilir bir eyleme d\u00f6n\u00fc\u015febilece\u011fi ihtimali kar\u015f\u0131s\u0131nda ka\u00e7ma e\u011filimi de ortaya \u00e7\u0131kacakt\u0131r. Nitekim yakalamal\u0131 \u015fah\u0131slar\u0131n bu ka\u00e7ma durumu da hemen eylem sonras\u0131nda ortaya \u00e7\u0131km\u0131\u015f bir durum de\u011fildir. Bu ba\u011flamda, yukar\u0131da belirtildi\u011fi \u00fczere HDP MYK (Merkez Y\u00fcr\u00fctme Kurulu) \u00fcyeleri ve milletvekili bir k\u0131s\u0131m san\u0131klar\u0131n ka\u00e7ak konumunda olduklar\u0131 yan\u0131 s\u0131ra tahliyesine karar verilen san\u0131k [Z.\u00c7.], [C.E.],[N.\u00c7.] ve san\u0131k [B.\u00d6.K.nin] adli kontrol tedbirlerini ihlal ederek firari konumda bulundu\u011fu ortadad\u0131r. T\u00fcm bu de\u011ferlendirmeler \u0131\u015f\u0131\u011f\u0131nda kuvvetli su\u00e7 \u015f\u00fcphesinin varl\u0131\u011f\u0131n\u0131 g\u00f6steren somut delillerin varl\u0131\u011f\u0131 isnat edilen su\u00e7 ile \u00f6l\u00e7\u00fcl\u00fc olmas\u0131, san\u0131\u011f\u0131n somut olarak ka\u00e7aca\u011f\u0131 \u015f\u00fcphesini uyand\u0131ran olgular itibariyle adli kontrol h\u00fck\u00fcmlerinin bu nedenle san\u0131k hakk\u0131nda yetersiz kalaca\u011f\u0131 d\u00fc\u015f\u00fcn\u00fcld\u00fc\u011f\u00fcnden tutukluluk tedbirinin gerekli oldu\u011fu anla\u015f\u0131lmakla san\u0131k \u0130smail \u015eENG\u00dcL&#8217;\u00fcn tutukluluk halinin DEVAMINA &#8230; [karar verildi.]&#8221;<\/p>\n<p>30. Mahkeme 16\/5\/2024 tarihli oturumda ba\u015fvurucunun devletin birli\u011fini ve b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc bozma su\u00e7una yard\u0131mdan 16 y\u0131l, su\u00e7 i\u015flemeye tahrik etme su\u00e7undan 4 y\u0131l 6 ay hapis cezas\u0131na mahk\u00fbmiyetine karar vermi\u015ftir. Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcnde; tutuklulu\u011fun hukuka ayk\u0131r\u0131 oldu\u011fu \u015fik\u00e2yetiyle ilgili olarak 5271 say\u0131l\u0131 Kanun&#8217;un 141. ve 142. maddelerinde \u00f6ng\u00f6r\u00fclen tazminat yolunun t\u00fcketilmedi\u011fi, bu durumda s\u00f6z konusu iddia bak\u0131m\u0131ndan ola\u011fan ba\u015fvuru yollar\u0131 t\u00fcketilmeden bireysel ba\u015fvuru yap\u0131ld\u0131\u011f\u0131 ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>35. Bakanl\u0131k taraf\u0131ndan an\u0131lan iddian\u0131n esas\u0131na ili\u015fkin yap\u0131lan de\u011ferlendirmede ise ba\u015fvurucunun tutuklanmas\u0131n\u0131n kanuni dayana\u011f\u0131n\u0131n bulundu\u011funu, tutuklama karar\u0131nda at\u0131f yap\u0131lan delillerin kuvvetli su\u00e7 \u015f\u00fcphesi olu\u015fturdu\u011funu, ba\u015fvurucu hakk\u0131nda uygulanan tutuklama tedbirinin me\u015fru bir amac\u0131 i\u00e7erdi\u011fini ve tutuklaman\u0131n \u00f6l\u00e7\u00fcl\u00fc oldu\u011funu belirtmi\u015ftir.<\/p>\n<p>36. Ba\u015fvurucu, Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 beyan\u0131nda hukuka ayk\u0131r\u0131 tutuklama tedbirinden kaynaklanan hak ihlalinin tazminat davas\u0131 yoluyla giderilemeyece\u011fini ve bu nedenle 5271 say\u0131l\u0131 Kanun&#8217;un 141. maddesinde \u00f6ng\u00f6r\u00fclen ba\u015fvuru yolunun t\u00fcketilmesinin gerekli olmad\u0131\u011f\u0131n\u0131 ileri s\u00fcrm\u00fc\u015ft\u00fcr. Ba\u015fvurucu ayr\u0131ca ba\u015fvuru formundakine benzer beyanlarda bulunmu\u015ftur.<\/p>\n<p>2. De\u011ferlendirme<\/p>\n<p>37. Anayasa&#8217;n\u0131n &#8220;Ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fi&#8221; kenar ba\u015fl\u0131kl\u0131 19. maddesinin birinci f\u0131kras\u0131 ile \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131n\u0131n birinci c\u00fcmlesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Herkes, ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fine sahiptir.<\/p>\n<p>&#8230;<\/p>\n<p>Su\u00e7lulu\u011fu hakk\u0131nda kuvvetli belirti bulunan ki\u015filer, ancak ka\u00e7malar\u0131n\u0131, delillerin yokedilmesini veya de\u011fi\u015ftirilmesini \u00f6nlemek maksad\u0131yla veya bunlar gibi tutuklamay\u0131 zorunlu k\u0131lan ve kanunda g\u00f6sterilen di\u011fer hallerde h\u00e2kim karar\u0131yla tutuklanabilir.&#8221;<\/p>\n<p>38. Anayasa Mahkemesi olaylar\u0131n ba\u015fvurucu taraf\u0131ndan yap\u0131lan hukuki nitelendirmesi ile ba\u011fl\u0131 olmay\u0131p olay ve olgular\u0131n hukuki tavsifini kendisi takdir eder (Tahir Canan, B. No: 2012\/969, 18\/9\/2013, \u00a7 16). Ba\u015fvurucu, somut ba\u015fvuruya konu 2\/10\/2020 tarihli tutuklama tedbirinin hukuka ayk\u0131r\u0131 olmas\u0131 nedeniyle ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fi hakk\u0131n\u0131n ihlal edildi\u011fini belirterek bu tedbirin siyasi saiklerle uyguland\u0131\u011f\u0131n\u0131 ifade etmi\u015ftir. Bu durumda ba\u015fvurucunun an\u0131lan \u015fik\u00e2yetlerinin 2\/10\/2020 tarihli tutuklama tedbirinin hukukili\u011fiyle ba\u011flant\u0131l\u0131 olarak Anayasa&#8217;n\u0131n 19. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131 kapsam\u0131nda incelenmesi gerekir.<\/p>\n<p>a. Genel \u0130lkeler<\/p>\n<p>39. Anayasa&#8217;n\u0131n 19. maddesinin birinci f\u0131kras\u0131nda, herkesin ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fi hakk\u0131na sahip oldu\u011fu ilke olarak ortaya konduktan sonra ikinci ve \u00fc\u00e7\u00fcnc\u00fc f\u0131kralar\u0131nda, \u015fekil ve \u015fartlar\u0131 kanunda g\u00f6sterilmek ko\u015fuluyla ki\u015filerin \u00f6zg\u00fcrl\u00fc\u011f\u00fcnden mahrum b\u0131rak\u0131labilece\u011fi durumlar s\u0131n\u0131rl\u0131 olarak say\u0131lm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fi hakk\u0131n\u0131n k\u0131s\u0131tlanmas\u0131 ancak Anayasa&#8217;n\u0131n an\u0131lan maddesi kapsam\u0131nda belirlenen durumlardan herhangi birinin varl\u0131\u011f\u0131 h\u00e2linde s\u00f6z konusu olabilir (Murat Narman, B. No: 2012\/1137, 2\/7\/2013, \u00a7 42).<\/p>\n<p>40. Ayr\u0131ca ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fi hakk\u0131na y\u00f6nelik bir m\u00fcdahale, temel hak ve \u00f6zg\u00fcrl\u00fcklerin s\u0131n\u0131rland\u0131r\u0131lmas\u0131na ili\u015fkin \u00f6l\u00e7\u00fctlerin belirlendi\u011fi Anayasa&#8217;n\u0131n 13. maddesinde belirtilen ko\u015fullara uygun olmad\u0131\u011f\u0131 m\u00fcddet\u00e7e Anayasa&#8217;n\u0131n 19. maddesinin ihlalini te\u015fkil edecektir. Bu sebeple s\u0131n\u0131rlaman\u0131n Anayasa&#8217;n\u0131n 13. maddesinde \u00f6ng\u00f6r\u00fclen ve tutuklama tedbirinin niteli\u011fine uygun d\u00fc\u015fen kanun taraf\u0131ndan \u00f6ng\u00f6r\u00fclme, Anayasa&#8217;n\u0131n ilgili maddelerinde belirtilen hakl\u0131 sebeplerden bir veya daha fazlas\u0131na dayanma ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olmama ko\u015fullar\u0131na uygun olup olmad\u0131\u011f\u0131n\u0131n belirlenmesi gerekir (Halas Aslan, B. No: 2014\/4994, 16\/2\/2017, \u00a7\u00a7 53, 54).<\/p>\n<p>41. Anayasa&#8217;n\u0131n 13. maddesinde temel hak ve \u00f6zg\u00fcrl\u00fcklerin ancak kanunla s\u0131n\u0131rlanabilece\u011fi h\u00fckme ba\u011flanm\u0131\u015ft\u0131r. \u00d6te yandan Anayasa&#8217;n\u0131n 19. maddesinde ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fi hakk\u0131n\u0131n s\u0131n\u0131rlanabilece\u011fi durumlar\u0131n \u015fekil ve \u015fartlar\u0131n\u0131n kanunda g\u00f6sterilmesi gerekti\u011fi belirtilmi\u015ftir. Dolay\u0131s\u0131yla Anayasa&#8217;n\u0131n 13. ve 19. maddeleri uyar\u0131nca ki\u015fi h\u00fcrriyetine ili\u015fkin m\u00fcdahale olarak tutuklaman\u0131n kanuni bir dayana\u011f\u0131n\u0131n bulunmas\u0131 zorunludur (Murat Narman, \u00a7 43; Halas Aslan, \u00a7 55).<\/p>\n<p>42. Anayasa&#8217;n\u0131n 19. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda, su\u00e7lulu\u011fu hakk\u0131nda kuvvetli belirti bulunan ki\u015filerin ancak ka\u00e7malar\u0131n\u0131, delilleri yok etmelerini veya de\u011fi\u015ftirmelerini \u00f6nlemek maksad\u0131yla veya bunlar gibi tutuklamay\u0131 zorunlu k\u0131lan ve kanunda g\u00f6sterilen di\u011fer h\u00e2llerde h\u00e2kim karar\u0131yla tutuklanabilecekleri belirtilmi\u015ftir (Halas Aslan, \u00a7 57).<\/p>\n<p>43. Buna g\u00f6re tutuklama ancak su\u00e7lulu\u011fu hakk\u0131nda kuvvetli belirti bulunan ki\u015filer bak\u0131m\u0131ndan m\u00fcmk\u00fcnd\u00fcr. Bir ba\u015fka anlat\u0131mla tutuklaman\u0131n \u00f6n ko\u015fulu, ki\u015finin su\u00e7lulu\u011fu hakk\u0131nda kuvvetli belirtinin bulunmas\u0131d\u0131r. Bunun i\u00e7in su\u00e7laman\u0131n kuvvetli say\u0131labilecek inand\u0131r\u0131c\u0131 delillerle desteklenmesi gerekir. \u0130nand\u0131r\u0131c\u0131 delil say\u0131labilecek olgular\u0131n niteli\u011fi b\u00fcy\u00fck \u00f6l\u00e7\u00fcde somut olay\u0131n kendine \u00f6zg\u00fc \u015fartlar\u0131na ba\u011fl\u0131d\u0131r (Mustafa Ali Balbay, B. No: 2012\/1272, 4\/12\/2013, \u00a7 72).<\/p>\n<p>44. Ba\u015flang\u0131\u00e7taki bir tutuklama i\u00e7in kuvvetli su\u00e7 \u015f\u00fcphesinin bulundu\u011funun t\u00fcm delilleriyle birlikte ortaya konmas\u0131 her zaman m\u00fcmk\u00fcn olmayabilir. Zira tutman\u0131n bir amac\u0131 da ki\u015fi hakk\u0131ndaki \u015f\u00fcpheleri teyit etmek veya \u00e7\u00fcr\u00fctmek suretiyle ceza soru\u015fturmas\u0131n\u0131 ve\/veya kovu\u015fturmas\u0131n\u0131 ilerletmektir (Dursun \u00c7i\u00e7ek, B. No: 2012\/1108, 16\/7\/2014, \u00a7 87; Halas Aslan, \u00a7 76). Bu nedenle yakalama veya tutuklama an\u0131nda delillerin yeterli d\u00fczeyde toplanm\u0131\u015f olmas\u0131 mutlaka gerekli de\u011fildir. Bu bak\u0131mdan su\u00e7 isnad\u0131na ve dolay\u0131s\u0131yla tutuklamaya esas te\u015fkil edecek \u015f\u00fcphelere dayanak olu\u015fturan olgular ile ceza yarg\u0131lamas\u0131n\u0131n sonraki a\u015famalar\u0131nda tart\u0131\u015f\u0131lacak ve mahk\u00fbmiyete gerek\u00e7e olu\u015fturacak olgular\u0131n ayn\u0131 d\u00fczeyde de\u011ferlendirilmemesi gerekir (Mustafa Ali Balbay, \u00a7 73).<\/p>\n<p>45. Bununla birlikte \u015f\u00fcpheli veya san\u0131\u011fa isnat edilen eylemlerin ifade, bas\u0131n ve sendika \u00f6zg\u00fcrl\u00fckleri ile siyasi faaliyette bulunma hakk\u0131 gibi demokratik toplum d\u00fczeni bak\u0131m\u0131ndan vazge\u00e7ilmez temel hak ve \u00f6zg\u00fcrl\u00fckler kapsam\u0131nda oldu\u011fu hususunda ciddi iddialar\u0131n bulundu\u011fu veya bu durumun somut olay\u0131n ko\u015fullar\u0131ndan anla\u015f\u0131labildi\u011fi h\u00e2llerde tutuklamaya karar veren yarg\u0131 mercilerinin kuvvetli su\u00e7 \u015f\u00fcphesini belirlerken daha \u00f6zenli davranmalar\u0131 gerekir. Buradaki \u00f6zen y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne riayet edilip edilmedi\u011fi Anayasa Mahkemesinin denetimine tabidir (bu y\u00f6ndeki denetim sonucunda verilen ihlal karar\u0131 i\u00e7in bkz. Erdem G\u00fcl ve Can D\u00fcndar [GK], B. No: 2015\/18567, 25\/2\/2016, \u00a7\u00a7 72-78; kabul edilemezlik kararlar\u0131 i\u00e7in bkz. Mustafa Ali Balbay, \u00a7 73; \u0130zzettin Alpergin [GK], B. No: 2013\/385, 14\/7\/2015, \u00a7 46; Mehmet Baransu (2), B. No: 2015\/7231, 17\/5\/2016, \u00a7\u00a7 124, 133, 142).<\/p>\n<p>46. \u00d6te yandan Anayasa&#8217;n\u0131n 19. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda, tutuklama karar\u0131n\u0131n ka\u00e7ma ya da delillerin yok edilmesini veya de\u011fi\u015ftirilmesini \u00f6nlemek amac\u0131yla verilebilece\u011fi belirtilmi\u015ftir. Bununla birlikte Anayasa koyucu, tutuklama nedenlerine ili\u015fkin olarak &#8220;bunlar gibi tutuklamay\u0131 zorunlu k\u0131lan ve kanunda g\u00f6sterilen di\u011fer h\u00e2llerde&#8221; ibaresine yer vermek suretiyle hem tutuklama nedenlerinin Anayasa&#8217;da ifade edilenlerle s\u0131n\u0131rl\u0131 olmad\u0131\u011f\u0131n\u0131 belirtmi\u015f hem de bunlar\u0131n d\u0131\u015f\u0131nda bir tutuklama nedeninin ancak kanunla d\u00fczenlenmesini m\u00fcmk\u00fcn k\u0131lm\u0131\u015ft\u0131r (Halas Aslan, \u00a7 58).<\/p>\n<p>47. Tutuklama nedenlerinin d\u00fczenlendi\u011fi 5271 say\u0131l\u0131 Kanun&#8217;un 100. maddesinde tutuklama nedenleri say\u0131lm\u0131\u015ft\u0131r. Buna g\u00f6re \u015f\u00fcpheli veya san\u0131\u011f\u0131n ka\u00e7mas\u0131, saklanmas\u0131 veya ka\u00e7aca\u011f\u0131 \u015f\u00fcphesini uyand\u0131ran somut olgular\u0131n bulunmas\u0131, \u015f\u00fcpheli veya san\u0131\u011f\u0131n davran\u0131\u015flar\u0131n\u0131n delilleri yok etme, gizleme veya de\u011fi\u015ftirme, tan\u0131k, ma\u011fdur veya ba\u015fkalar\u0131 \u00fczerinde bask\u0131 yap\u0131lmas\u0131 giri\u015fiminde bulunma hususlar\u0131nda kuvvetli \u015f\u00fcphe olu\u015fturmas\u0131 h\u00e2llerinde tutuklama karar\u0131 verilebilecektir. Maddede ayr\u0131ca i\u015flendi\u011fi konusunda kuvvetli \u015f\u00fcphe bulunmas\u0131 \u015fart\u0131yla tutuklama nedeninin varsay\u0131labilece\u011fi su\u00e7lara ili\u015fkin bir listeye yer verilmi\u015ftir (Halas Aslan, \u00a7 59). Bununla birlikte ba\u015flang\u0131\u00e7taki bir tutuklama i\u00e7in Anayasa ve kanunda \u00f6ng\u00f6r\u00fclen tutuklama nedenlerinin dayand\u0131\u011f\u0131 t\u00fcm olgular\u0131n somut olarak belirtilmesi -i\u015fin do\u011fas\u0131 gere\u011fi- her zaman m\u00fcmk\u00fcn olmayabilir (Sel\u00e7uk \u00d6zdemir [GK], B. No: 2016\/49158, 26\/7\/2017, \u00a7 68).<\/p>\n<p>48. Di\u011fer taraftan Anayasa&#8217;n\u0131n 13. maddesinde temel hak ve \u00f6zg\u00fcrl\u00fcklere y\u00f6nelik s\u0131n\u0131rlamalar\u0131n \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olamayaca\u011f\u0131 belirtilmi\u015ftir. Anayasa&#8217;n\u0131n 19. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda yer alan &#8220;tutuklamay\u0131 zorunlu k\u0131lan&#8221; ibaresiyle de tutuklaman\u0131n \u00f6l\u00e7\u00fcl\u00fc olmas\u0131 gerekti\u011fine i\u015faret edilmektedir (Halas Aslan, \u00a7 72). \u00d6l\u00e7\u00fcl\u00fcl\u00fck ilkesi elveri\u015flilik, gereklilik ve orant\u0131l\u0131l\u0131k olmak \u00fczere \u00fc\u00e7 alt ilkeden olu\u015fmaktad\u0131r. Elveri\u015flilik \u00f6ng\u00f6r\u00fclen m\u00fcdahalenin ula\u015f\u0131lmak istenen amac\u0131 ger\u00e7ekle\u015ftirmeye elveri\u015fli olmas\u0131n\u0131, gereklilik ula\u015f\u0131lmak istenen ama\u00e7 bak\u0131m\u0131ndan m\u00fcdahalenin zorunlu olmas\u0131n\u0131 yani ayn\u0131 amaca daha hafif bir m\u00fcdahale ile ula\u015f\u0131lmas\u0131n\u0131n m\u00fcmk\u00fcn olmamas\u0131n\u0131, orant\u0131l\u0131l\u0131k ise bireyin hakk\u0131na yap\u0131lan m\u00fcdahale ile ula\u015f\u0131lmak istenen ama\u00e7 aras\u0131nda makul bir dengenin g\u00f6zetilmesi gereklili\u011fini ifade etmektedir (AYM, E.2016\/13, K.2016\/127, 22\/6\/2016, \u00a7 18; Mehmet Akdo\u011fan ve di\u011ferleri, B. No: 2013\/817, 19\/12\/2013, \u00a7 38).<\/p>\n<p>49. Bu ba\u011flamda dikkate al\u0131nacak hususlardan biri tutuklama tedbirinin isnat edilen su\u00e7un \u00f6nemi ve uygulanacak olan yapt\u0131r\u0131m\u0131n a\u011f\u0131rl\u0131\u011f\u0131 kar\u015f\u0131s\u0131nda \u00f6l\u00e7\u00fcl\u00fc olmas\u0131d\u0131r. Nitekim 5271 say\u0131l\u0131 Kanun&#8217;un 100. maddesinde i\u015fin \u00f6nemi, verilmesi beklenen ceza veya g\u00fcvenlik tedbiri ile \u00f6l\u00e7\u00fcl\u00fc olmamas\u0131 h\u00e2linde tutuklama karar\u0131 verilemeyece\u011fi ifade edilmi\u015ftir (Halas Aslan, \u00a7 72).<\/p>\n<p>50. Ayr\u0131ca tutuklama tedbirinin \u00f6l\u00e7\u00fcl\u00fc oldu\u011funun s\u00f6ylenebilmesi i\u00e7in tutuklamaya alternatif di\u011fer koruma tedbirlerinin yeterli olmamas\u0131 gerekir. Bu \u00e7er\u00e7evede -tutuklamaya g\u00f6re temel hak ve \u00f6zg\u00fcrl\u00fcklere daha hafif etkide bulunan- adli kontrol y\u00fck\u00fcml\u00fcl\u00fcklerinin ula\u015f\u0131lmak istenen me\u015fru ama\u00e7 bak\u0131m\u0131ndan yeterli olmas\u0131 h\u00e2linde tutuklama tedbirine ba\u015fvurulmamal\u0131d\u0131r. Nitekim bu hususa 5271 say\u0131l\u0131 Kanun&#8217;un 101. maddesinin (1) numaral\u0131 f\u0131kras\u0131nda i\u015faret edilmi\u015ftir (Halas Aslan, \u00a7 79).<\/p>\n<p>51. Her somut olayda tutuklaman\u0131n \u00f6n ko\u015fulu olan su\u00e7un i\u015flendi\u011fine dair kuvvetli belirtinin olup olmad\u0131\u011f\u0131n\u0131n, tutuklama nedenlerinin bulunup bulunmad\u0131\u011f\u0131n\u0131n ve tutuklama tedbirinin \u00f6l\u00e7\u00fcl\u00fcl\u00fc\u011f\u00fcn\u00fcn takdiri \u00f6ncelikle an\u0131lan tedbiri uygulayan yarg\u0131 mercilerine aittir. Zira bu konuda taraflarla ve delillerle do\u011frudan temas h\u00e2linde olan yarg\u0131 mercileri Anayasa Mahkemesine k\u0131yasla daha iyi konumdad\u0131r.<\/p>\n<p>52. Bununla birlikte yarg\u0131 mercilerinin belirtilen hususlardaki takdir aral\u0131\u011f\u0131n\u0131 a\u015f\u0131p a\u015fmad\u0131\u011f\u0131 Anayasa Mahkemesinin denetimine tabidir. Anayasa Mahkemesinin bu husustaki denetimi, somut olay\u0131n ko\u015fullar\u0131 dikkate al\u0131narak \u00f6zellikle tutuklamaya ili\u015fkin s\u00fcre\u00e7 ve tutuklama karar\u0131n\u0131n gerek\u00e7eleri \u00fczerinden yap\u0131lmal\u0131d\u0131r (Erdem G\u00fcl ve Can D\u00fcndar, \u00a7 79; Sel\u00e7uk \u00d6zdemir, \u00a7 76). Nitekim 5271 say\u0131l\u0131 Kanun&#8217;un 101. maddesinin (2) numaral\u0131 f\u0131kras\u0131nda; tutuklamaya ili\u015fkin kararlarda kuvvetli su\u00e7 \u015f\u00fcphesini, tutuklama nedenlerinin varl\u0131\u011f\u0131n\u0131 ve tutuklama tedbirinin \u00f6l\u00e7\u00fcl\u00fc oldu\u011funu g\u00f6steren delillerin somut olgularla gerek\u00e7elendirilerek a\u00e7\u0131k\u00e7a g\u00f6sterilece\u011fi belirtilmi\u015ftir (Halas Aslan, \u00a7 75; Sel\u00e7uk \u00d6zdemir, \u00a7 67).<\/p>\n<p>b. \u0130lkelerin Olaya Uygulanmas\u0131<\/p>\n<p>53. Somut olayda \u00f6ncelikle ba\u015fvurucunun tutuklanmas\u0131n\u0131n kanuni dayana\u011f\u0131n\u0131n olup olmad\u0131\u011f\u0131n\u0131n belirlenmesi gerekir. Ba\u015fvurucu, devletin birli\u011fini ve \u00fclke b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc bozma su\u00e7u ile 6-7 Ekim olaylar\u0131 s\u0131ras\u0131nda i\u015flenen farkl\u0131 su\u00e7lara azmettirme su\u00e7lar\u0131ndan 5271 say\u0131l\u0131 Kanun&#8217;un 100. maddesi uyar\u0131nca tutuklanm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla ba\u015fvurucu hakk\u0131nda uygulanan tutuklama tedbirinin kanuni dayana\u011f\u0131 bulunmaktad\u0131r.<\/p>\n<p>54. Kanuni dayana\u011f\u0131 bulundu\u011fu anla\u015f\u0131lan tutuklama tedbirinin me\u015fru bir amac\u0131n\u0131n olup olmad\u0131\u011f\u0131 ve \u00f6l\u00e7\u00fcl\u00fcl\u00fc\u011f\u00fc incelenmeden \u00f6nce tutuklaman\u0131n \u00f6n ko\u015fulu olan su\u00e7un i\u015flendi\u011fine dair kuvvetli belirti bulunup bulunmad\u0131\u011f\u0131n\u0131n de\u011ferlendirilmesi gerekir.<\/p>\n<p>55. Ba\u015fvurucunun tutuklanmas\u0131na karar veren Ankara 4. Sulh Ceza H\u00e2kimli\u011finin 6-7 Ekim olaylar\u0131na ili\u015fkin m\u00fc\u015fteki, tan\u0131k ve \u015f\u00fcpheli beyanlar\u0131, Ara\u015ft\u0131rma\/Tespit Tutanaklar\u0131 ve di\u011fer bilgi ve belgelere dayanarak devletin birli\u011fini ve \u00fclke b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc bozma su\u00e7u ile olaylar s\u0131ras\u0131nda i\u015flenen farkl\u0131 su\u00e7lara azmettirme su\u00e7lar\u0131 y\u00f6n\u00fcnden ba\u015fvurucu hakk\u0131nda kuvvetli su\u00e7 \u015f\u00fcphesinin bulundu\u011fu sonucuna vard\u0131\u011f\u0131 g\u00f6r\u00fclmektedir (bkz. \u00a7 18).<\/p>\n<p>56. Soru\u015fturma mercileri de 6-7 Ekim olaylar\u0131na kat\u0131lan ve olaylar s\u0131ras\u0131nda i\u015fledikleri iddia olunan farkl\u0131 su\u00e7lara ba\u011fl\u0131 olarak haklar\u0131nda soru\u015fturma\/kovu\u015fturma y\u00fcr\u00fct\u00fclen ki\u015filerin ifadelerine ve olaylar\u0131n ayaklanma niteli\u011finde oldu\u011funa ili\u015fkin tan\u0131k beyanlar\u0131na dayanm\u0131\u015f, HDP MYK \u00e7a\u011fr\u0131s\u0131n\u0131n veHDP yetkililerinin di\u011fer a\u00e7\u0131klamalar\u0131n\u0131n kitlelerin kat\u0131l\u0131m\u0131yla olaylar\u0131n ba\u015flamas\u0131na, dolay\u0131s\u0131yla su\u00e7 niteli\u011findeki eylemlerin ger\u00e7ekle\u015fmesine neden oldu\u011funu ileri s\u00fcrm\u00fc\u015ft\u00fcr. An\u0131lan ifadelerde HDP MYK \u00e7a\u011fr\u0131s\u0131 ve Parti yetkililerinin a\u00e7\u0131klamalar\u0131 ile Parti yetkililerinden gelen telefon ve yaz\u0131l\u0131 mesajlar \u00fczerine olaylara d\u00e2hil olundu\u011fu belirtilmektedir. \u0130fadesi al\u0131nan ki\u015filerden baz\u0131lar\u0131 ise olaylara PKK\/KCK ter\u00f6r \u00f6rg\u00fct\u00fcn\u00fcn bask\u0131lar\u0131 nedeniyle kat\u0131ld\u0131klar\u0131n\u0131 s\u00f6ylemi\u015ftir (bkz. \u00a7 21). Tan\u0131k beyanlar\u0131nda ise serhildan niteli\u011findeki \u00e7a\u011fr\u0131lar\u0131n normal bir protesto\/y\u00fcr\u00fcy\u00fc\u015f yap\u0131lmas\u0131n\u0131 de\u011fil \u015fiddet i\u00e7eren eylemleri ama\u00e7lad\u0131\u011f\u0131n\u0131n ter\u00f6r \u00f6rg\u00fct\u00fcyle iltisakl\u0131 ki\u015filer ile HDP yetkililerince bilindi\u011fi ifade edilmi\u015ftir. Bu kapsamda;<\/p>\n<p>&#8211; 4\/12\/2019 tarihinde ifadesi al\u0131nan gizli tan\u0131k Mahir, olaylar\u0131n ba\u015flang\u0131c\u0131 \u00f6ncesi HDP taraf\u0131ndan yap\u0131lan \u00e7a\u011fr\u0131n\u0131n kararla\u015ft\u0131r\u0131ld\u0131\u011f\u0131 6\/10\/2014 tarihli HDP MYK toplant\u0131s\u0131na ter\u00f6r \u00f6rg\u00fct\u00fc \u00fcyelerinin de kat\u0131ld\u0131\u011f\u0131n\u0131 ve serhildan niteli\u011findeki \u00e7a\u011fr\u0131ya ili\u015fkin karar\u0131n bu ki\u015filerin talimat\u0131yla al\u0131nd\u0131\u011f\u0131n\u0131, bu nevi \u00e7a\u011fr\u0131lar\u0131n normal bir protesto\/y\u00fcr\u00fcy\u00fc\u015f yap\u0131lmas\u0131n\u0131 de\u011fil \u015fiddet i\u00e7eren eylemleri ama\u00e7lad\u0131\u011f\u0131n\u0131n ter\u00f6r \u00f6rg\u00fct\u00fcyle iltisakl\u0131 ki\u015filer ile HDP yetkililerince bilindi\u011fini ve 6-7 Ekim olaylar\u0131 s\u0131ras\u0131nda \u015fiddet eylemlerine \u00f6nc\u00fcl\u00fck eden gen\u00e7lik yap\u0131lanmas\u0131n\u0131n \u00f6rg\u00fct taraf\u0131ndan ilan edilmesi d\u00fc\u015f\u00fcn\u00fclen \u00f6z y\u00f6netim-\u00f6zerklik plan\u0131 kapsam\u0131nda \u00f6rg\u00fct y\u00f6neticisi Duran Kalkan taraf\u0131ndan kuruldu\u011funu belirtmi\u015ftir.<\/p>\n<p>-7\/1\/2020 tarihinde ifadesi al\u0131nan tan\u0131k K.G., serhildan olarak adland\u0131r\u0131lan ayaklanma eylemlerine ili\u015fkin genel bilgi verdikten sonra 6-7 Ekim olaylar\u0131n\u0131n da bir serhildan oldu\u011funu ve ba\u015fta Duran Kalkan adl\u0131 \u00f6rg\u00fct y\u00f6neticisi olmak \u00fczere \u00f6rg\u00fct\u00fcn \u00fcst y\u00f6netimince planland\u0131\u011f\u0131n\u0131, \u00f6rg\u00fct\u00fcn an\u0131lan plan d\u00e2hilinde Kobani ve Suriye&#8217;deki \u00e7at\u0131\u015fmalar\u0131 T\u00fcrkiye&#8217;ye yayarak \u00fclkenin bir b\u00f6lgesinde fiil\u00ee h\u00e2kimiyet kurmay\u0131 ama\u00e7lad\u0131\u011f\u0131n\u0131 ifade etmi\u015ftir. Tan\u0131k K.G. -gizli tan\u0131k Mahir&#8217;in beyanlar\u0131na benzer \u015fekilde- bu t\u00fcr \u00e7a\u011fr\u0131larla normal bir protesto\/y\u00fcr\u00fcy\u00fc\u015f yap\u0131lmas\u0131 de\u011fil \u015fiddet i\u00e7eren eylemlerin ama\u00e7land\u0131\u011f\u0131n\u0131n ter\u00f6r \u00f6rg\u00fct\u00fcyle iltisakl\u0131 ki\u015filer ile HDP yetkililerince bilindi\u011fini belirtmi\u015f, ayr\u0131ca HDP&#8217;nin ve HDP yetkililerinin s\u00fcre\u00e7teki a\u00e7\u0131klamalar\u0131\/\u00e7a\u011fr\u0131lar\u0131 nedeniyle ter\u00f6r \u00f6rg\u00fct\u00fcne y\u00fcksek d\u00fczeyde kat\u0131l\u0131m sa\u011fland\u0131\u011f\u0131n\u0131 ve bu a\u00e7\u0131klamalar\/\u00e7a\u011fr\u0131lar olmasayd\u0131 6-7 Ekim olaylar\u0131nda yo\u011fun ve geni\u015f \u00e7apl\u0131 \u015fiddet eylemlerinin ve \u00f6l\u00fcmlerin ger\u00e7ekle\u015fmeyebilece\u011fini beyan etmi\u015ftir.<\/p>\n<p>&#8211; 3\/11\/2020 tarihinde ifadesi al\u0131nan tan\u0131k \u0130.B. ise olaylar\u0131n ya\u015fand\u0131\u011f\u0131 d\u00f6nemde HDP milletvekili oldu\u011funu, 6-7 Ekim olaylar\u0131n\u0131n \u00f6zerklik ilan edebilme amac\u0131yla PKK\/KCK taraf\u0131ndan planland\u0131\u011f\u0131n\u0131 ifade etmi\u015ftir.<\/p>\n<p>57. HDP&#8217;nin sosyal medya hesab\u0131ndan halk\u0131n soka\u011fa \u00e7\u0131kmas\u0131 ve direni\u015fe kat\u0131lmas\u0131 y\u00f6n\u00fcnde MYK ad\u0131na \u00e7a\u011fr\u0131 yap\u0131ld\u0131\u011f\u0131 ve ba\u015fvurucunun \u00e7a\u011fr\u0131n\u0131n kararla\u015ft\u0131r\u0131ld\u0131\u011f\u0131 toplant\u0131ya kat\u0131ld\u0131\u011f\u0131 hususlar\u0131nda ku\u015fku bulunmamaktad\u0131r. Ba\u015fvurucunun Ba\u015fsavc\u0131l\u0131kta verdi\u011fi ifadesinde de s\u00f6z konusu \u00e7a\u011fr\u0131y\u0131 sahiplendi\u011fi g\u00f6r\u00fclmektedir (bkz. \u00a7 14).<\/p>\n<p>58. HDP MYK ad\u0131na ger\u00e7ekle\u015ftirilen \u00e7a\u011fr\u0131, Suriye&#8217;de ya\u015fanan i\u00e7 sava\u015f\u0131n T\u00fcrkiye&#8217;nin ulusal g\u00fcvenli\u011fi \u00fczerinde tehdit olu\u015fturacak boyuta geldi\u011fi bir d\u00f6nemde ve -PKK&#8217;n\u0131n Suriye&#8217;deki uzant\u0131s\u0131 olan- PYD ile DAE\u015e aras\u0131nda Kobani&#8217;de \u00e7\u0131kan \u00e7at\u0131\u015fmalar \u00fczerine yap\u0131lm\u0131\u015ft\u0131r. Ayr\u0131ca bu \u00e7a\u011fr\u0131n\u0131n \u00e7at\u0131\u015fmalar\u0131n taraf\u0131 olan PKK ter\u00f6r \u00f6rg\u00fct\u00fcn\u00fcn liderlerinden birinin Kobani&#8217;de ya\u015fanan olaylar\u0131 bahane ederek T\u00fcrkiye&#8217;deki metropolleri i\u015fgal etmeye y\u00f6nelik \u00e7a\u011fr\u0131s\u0131n\u0131n hemen ertesi g\u00fcn\u00fcnde yap\u0131ld\u0131\u011f\u0131 vurgulanmal\u0131d\u0131r. S\u00f6z konusu \u00e7a\u011fr\u0131n\u0131n yap\u0131ld\u0131\u011f\u0131 g\u00fcnde PKK g\u00fcd\u00fcm\u00fcnde yay\u0131n yapt\u0131\u011f\u0131 belirtilen bir internet haber sitesinde yer alan duyuruda da ayr\u0131mc\u0131 ifadeler kullan\u0131larak ve bir siyasi parti hedef g\u00f6sterilerek &#8220;ya\u015fam \u015fans\u0131 tan\u0131mama&#8221; ibaresine yer verilmek suretiyle ayaklanman\u0131n en \u00fcst d\u00fczeyde geni\u015fletilmesi \u00e7a\u011fr\u0131s\u0131nda bulunulmu\u015ftur (Selahattin Demirta\u015f, \u00a7 27).<\/p>\n<p>59. Ba\u015fvurucu; Suriye&#8217;de ya\u015fanan i\u00e7 sava\u015f\u0131n T\u00fcrkiye&#8217;nin ulusal g\u00fcvenli\u011fi \u00fczerinde tehdit olu\u015fturdu\u011funu, \u00f6zellikle Kobani&#8217;de -iki ter\u00f6r \u00f6rg\u00fct\u00fc aras\u0131nda- ya\u015fanan \u00e7at\u0131\u015fmalar gerek\u00e7e g\u00f6sterilerek bu \u00f6rg\u00fctlerden biri ad\u0131na yap\u0131lan ayaklanma \u00e7a\u011fr\u0131s\u0131n\u0131n T\u00fcrkiye&#8217;de yayg\u0131n \u015fiddet eylemlerine neden olabilece\u011fini ve kamu d\u00fczenini bozabilece\u011fini konumu itibar\u0131yla \u00f6ng\u00f6rebilecek durumdad\u0131r. Ayr\u0131ca s\u00f6z konusu \u00e7a\u011fr\u0131, HDP&#8217;nin kurumsal sosyal medya hesab\u0131ndan Partinin y\u00fcr\u00fctme organ\u0131 olan MYK ad\u0131na yap\u0131lm\u0131\u015f olup bu nitelikteki bir \u00e7a\u011fr\u0131n\u0131n b\u00f6lgedeki kitle \u00fczerinde ciddi \u00f6l\u00e7\u00fcde etkili olaca\u011f\u0131 yads\u0131namaz. Nitekim \u015fiddet eylemleri, bu \u00e7a\u011fr\u0131lar\u0131n yap\u0131ld\u0131\u011f\u0131 g\u00fcn ba\u015flam\u0131\u015f ve giderek yayg\u0131nla\u015fm\u0131\u015f, \u00e7ok say\u0131da ki\u015finin hayat\u0131n\u0131 kaybetmesi ve yaralanmas\u0131yla sonu\u00e7lanacak \u015fekilde a\u011f\u0131rla\u015fm\u0131\u015f, kamu d\u00fczeni bozulmu\u015ftur. 6-7 Ekim olaylar\u0131na kat\u0131lan ve olaylar s\u0131ras\u0131nda i\u015fledikleri iddia olunan farkl\u0131 su\u00e7lara ba\u011fl\u0131 olarak haklar\u0131nda soru\u015fturma\/kovu\u015fturma y\u00fcr\u00fct\u00fclen ki\u015filerin ve di\u011fer tan\u0131klar\u0131n da -gizli tan\u0131k Mahir, tan\u0131k K.G, ve \u0130.B.- bu y\u00f6nde ifadeleri mevcuttur. Dolay\u0131s\u0131yla soru\u015fturma makamlar\u0131n\u0131n HDP MYK ad\u0131na yap\u0131lan \u00e7a\u011fr\u0131 ile PKK taraf\u0131ndan yap\u0131lan \u00e7a\u011fr\u0131lar aras\u0131nda, yine bu \u00e7a\u011fr\u0131lar ile s\u00f6z konusu \u015fiddet olaylar\u0131 aras\u0131nda illiyet ba\u011f\u0131 kurmas\u0131n\u0131n olgusal ve hukuki temellerinin oldu\u011fu s\u00f6ylenebilir (benzer y\u00f6ndeki de\u011ferlendirmeler i\u00e7in bkz. Ceza Dairesinin Diyarbak\u0131r&#8217;da 6-7 Ekim olaylar\u0131 s\u0131ras\u0131nda ger\u00e7ekle\u015fen \u015fiddet eylemlerine y\u00f6nelik olarak HDP MYK ad\u0131na yap\u0131lan \u00e7a\u011fr\u0131n\u0131n haklar\u0131nda devletin birli\u011fini ve \u00fclke b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc bozma, kasten \u00f6ld\u00fcrme ve sair su\u00e7lardan mahk\u00fbmiyet h\u00fckm\u00fc verilen san\u0131klar \u00fczerinde isnat edilen su\u00e7lar\u0131 i\u015flemeleri a\u00e7\u0131s\u0131ndan etkili oldu\u011funa ve devletin birli\u011fini ve \u00fclke b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc bozma su\u00e7unun olu\u015ftu\u011funa ili\u015fkin 3\/2\/2020 tarihli ve E.2019\/5464 say\u0131l\u0131 karar\u0131). Sonu\u00e7 olarak belirtilen t\u00fcm bu hususlar\u0131n tutuklama tedbirinin uygulanmas\u0131nda su\u00e7un i\u015flendi\u011fine dair kuvvetli belirti olarak kabul edilmesinin temelsiz ve keyf\u00ee oldu\u011fu s\u00f6ylenemeyecektir.<\/p>\n<p>60. Di\u011fer taraftan ba\u015fvurucu hakk\u0131nda uygulanan ve kuvvetli su\u00e7 \u015f\u00fcphesinin bulunmas\u0131 \u015feklindeki \u00f6n ko\u015fulu yerine gelmi\u015f olan tutuklama tedbirinin me\u015fru bir amac\u0131n\u0131n olup olmad\u0131\u011f\u0131n\u0131n de\u011ferlendirilmesi gerekir.<\/p>\n<p>61. Ankara 4. Sulh Ceza H\u00e2kimli\u011fince ba\u015fvurucunun tutuklanmas\u0131na karar verilirken, i\u015flendi\u011fi iddia olunan devletin birli\u011fini ve \u00fclke b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc bozma su\u00e7u ile 6-7 Ekim olaylar\u0131 s\u0131ras\u0131nda i\u015flenen kasten \u00f6ld\u00fcrme, ya\u011fma gibi farkl\u0131 bir k\u0131s\u0131m su\u00e7a azmettirme su\u00e7lar\u0131na-5237 say\u0131l\u0131 Kanun&#8217;un 38. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n yollamas\u0131yla-ili\u015fkin olarak 5237 say\u0131l\u0131 Kanun&#8217;da \u00f6ng\u00f6r\u00fclen yapt\u0131r\u0131m\u0131n a\u011f\u0131rl\u0131\u011f\u0131na de\u011finilerek su\u00e7lar\u0131n bir k\u0131sm\u0131n\u0131n 5271 say\u0131l\u0131 Kanun&#8217;un 100. maddesinin (3) numaral\u0131 f\u0131kras\u0131nda yer alan katalog su\u00e7lar aras\u0131nda olmas\u0131na dayan\u0131ld\u0131\u011f\u0131 g\u00f6r\u00fclmektedir (bkz. \u00a7 18).<\/p>\n<p>62. Ba\u015fvurucunun tutukland\u0131\u011f\u0131 su\u00e7lar aras\u0131nda bulunan devletin birli\u011fini ve \u00fclke b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc bozma su\u00e7u ile kasten \u00f6ld\u00fcrme ve ya\u011fma su\u00e7lar\u0131na azmettirme su\u00e7lar\u0131 -5237 say\u0131l\u0131 Kanun&#8217;un 38. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n yollamas\u0131yla- T\u00fcrk hukuk sistemi i\u00e7inde a\u011f\u0131r cezai yapt\u0131r\u0131mlar \u00f6ng\u00f6r\u00fclen su\u00e7 tipleridir. \u0130snat edilen su\u00e7a ili\u015fkin olarak kanunda \u00f6ng\u00f6r\u00fclen cezan\u0131n a\u011f\u0131rl\u0131\u011f\u0131 ka\u00e7ma \u015f\u00fcphesine i\u015faret eden durumlardan biridir (H\u00fcseyin Bur\u00e7ak, B. No: 2014\/474, 3\/2\/2016, \u00a7 61). Ayr\u0131ca mezk\u00fbr su\u00e7lar, 5271 say\u0131l\u0131 Kanun&#8217;un 100. maddesinin (3) numaral\u0131 f\u0131kras\u0131nda yer alan ve kanun gere\u011fi tutuklama nedeni varsay\u0131labilen su\u00e7lar aras\u0131ndad\u0131r.<\/p>\n<p>63. Dolay\u0131s\u0131yla somut olay\u0131n \u00f6zel ko\u015fullar\u0131 ile Ankara 4. Sulh Ceza H\u00e2kimli\u011fi taraf\u0131ndan verilen karar\u0131n i\u00e7eri\u011fi birlikte de\u011ferlendirildi\u011finde ba\u015fvurucu y\u00f6n\u00fcnden dayan\u0131lan tutuklama nedenlerinin olgusal temellerinin bulundu\u011fu anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>64. Son olarak ba\u015fvurucunun tutuklama karar\u0131nda isnat edilen olgular\u0131n ger\u00e7ekle\u015fti\u011fi tarihten \u00e7ok uzun s\u00fcre sonra tutukland\u0131\u011f\u0131 iddias\u0131yla ba\u011flant\u0131l\u0131 olarak tutuklama tedbirinin \u00f6l\u00e7\u00fcl\u00fc olup olmad\u0131\u011f\u0131n\u0131n da belirlenmesi gerekir. Bir tutuklama tedbirinin Anayasa&#8217;n\u0131n 13. ve 19. maddeleri kapsam\u0131nda \u00f6l\u00e7\u00fcl\u00fcl\u00fc\u011f\u00fcn\u00fcn belirlenmesinde somut olay\u0131n t\u00fcm \u00f6zellikleri dikkate al\u0131nmal\u0131d\u0131r (G\u00fclser Y\u0131ld\u0131r\u0131m (2) [GK], B. No: 2016\/40170, 16\/11\/2017, \u00a7 151).<\/p>\n<p>65. Anayasa Mahkemesi benzer durumdaki (su\u00e7 tarihi ile tutuklama tarihi aras\u0131nda \u00f6nemli zaman diliminin bulundu\u011fu) baz\u0131 olaylara ili\u015fkin ba\u015fvurularda tutuklaman\u0131n gereklili\u011fine dair incelemede bulunmu\u015ftur. Anayasa Mahkemesi Erdem G\u00fcl ve Can D\u00fcndar (ayn\u0131 kararda bkz. \u00a7\u00a7 79-81) karar\u0131nda, ba\u015fvurucular hakk\u0131nda soru\u015fturma ba\u015flat\u0131ld\u0131\u011f\u0131n\u0131n kamuoyuna duyurulmas\u0131ndan sonra tutuklama tedbirinin uyguland\u0131\u011f\u0131 tarihe kadar ge\u00e7en yakla\u015f\u0131k alt\u0131 ayl\u0131k s\u00fcrede soru\u015fturma makamlar\u0131n\u0131n su\u00e7a konu edilen haberler d\u0131\u015f\u0131nda hangi delile ula\u015ft\u0131klar\u0131n\u0131n ve dolay\u0131s\u0131yla tutuklama tedbirinin uygulanmas\u0131n\u0131n neden gerekli oldu\u011funun somut olay\u0131n \u00f6zelliklerinden ve tutuklama karar\u0131n\u0131n gerek\u00e7elerinden anla\u015f\u0131lmamas\u0131 nedeniyle ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fi hakk\u0131n\u0131n ihlal edildi\u011fi sonucuna varm\u0131\u015ft\u0131r. Anayasa Mahkemesi buna kar\u015f\u0131l\u0131k Mehmet Baransu (2) (ayn\u0131 kararda bkz. \u00a7\u00a7 141-143) ve S\u00fcleyman Ba\u011fr\u0131yan\u0131k ve di\u011ferleri (B. No: 2015\/9756, 16\/11\/2016, \u00a7\u00a7 228-232) kararlar\u0131nda su\u00e7un i\u015flendi\u011fi tarih ile tutuklama tedbirinin uyguland\u0131\u011f\u0131 tarih aras\u0131nda uzun bir s\u00fcre ge\u00e7mi\u015f olmas\u0131na ra\u011fmen bu s\u00fcre i\u00e7inde soru\u015fturma i\u015flemlerinin devam etti\u011fini ve soru\u015fturma makamlar\u0131n\u0131n hareketsiz kalmad\u0131\u011f\u0131n\u0131 dikkate alarak uygulanan tutuklama tedbirlerinin \u00f6l\u00e7\u00fcl\u00fc oldu\u011funu tespit etmi\u015ftir. <\/p>\n<p>66. Anayasa Mahkemesi Anayasa de\u011fi\u015fikli\u011fiyle yasama dokunulmazl\u0131\u011f\u0131na istisna getirilen baz\u0131 davalarda milletvekilleri hakk\u0131nda uygulanan tutuklama tedbirleri bak\u0131m\u0131ndan da ayn\u0131 y\u00f6nde incelemede bulunmu\u015ftur. Bu kapsamda yap\u0131lan incelemelerde Anayasa de\u011fi\u015fikli\u011finin y\u00fcr\u00fcrl\u00fc\u011fe girmesi \u00fczerine fezlekelerin Cumhuriyet ba\u015fsavc\u0131l\u0131klar\u0131na iade edilmesi sonras\u0131nda soru\u015fturma mercilerince yap\u0131lan i\u015flemlere de\u011finilerek s\u00fcre\u00e7 bak\u0131m\u0131ndan tutuklama tedbirinin gerekli olmad\u0131\u011f\u0131n\u0131n s\u00f6ylenemeyece\u011fi sonucuna varm\u0131\u015ft\u0131r. Bu ba\u011flamda genel olarak Anayasa de\u011fi\u015fikli\u011finin y\u00fcr\u00fcrl\u00fc\u011fe girmesinden yakla\u015f\u0131k be\u015f ay sonra tutuklanan ba\u015fvurucular hakk\u0131ndaki soru\u015fturma dosyalar\u0131nda bu s\u00fcre\u00e7 i\u00e7inde farkl\u0131 Cumhuriyet ba\u015fsavc\u0131l\u0131klar\u0131na g\u00f6nderilen dosyalarla ilgili fezleke d\u00fczenlenmesi, dosyalar\u0131n yetkili Cumhuriyet ba\u015fsavc\u0131l\u0131\u011f\u0131na g\u00f6nderilmesi, birle\u015ftirilmesi ve ba\u015fvurucular\u0131n ifadelerinin al\u0131nmas\u0131 i\u00e7in talimat yaz\u0131lmas\u0131 veya \u00e7a\u011fr\u0131 k\u00e2\u011f\u0131d\u0131 \u00e7\u0131kar\u0131lmas\u0131 gibi usule ili\u015fkin i\u015flemlerin yap\u0131ld\u0131\u011f\u0131na ve soru\u015fturma mercilerinin hareketsiz kalmad\u0131\u011f\u0131na vurgu yapm\u0131\u015ft\u0131r (di\u011ferleri aras\u0131ndan bkz. G\u00fclser Y\u0131ld\u0131r\u0131m (2), \u00a7\u00a7 160, 161; Selahattin Demirta\u015f, \u00a7\u00a7 173, 174). Burada \u00f6nemli olan temel nokta soru\u015fturma mercilerinin s\u00fcre\u00e7 i\u00e7inde tutuklamay\u0131 gerekli hatta zorunlu k\u0131lan yeni olgulara ula\u015f\u0131p ula\u015fmad\u0131klar\u0131 ve soru\u015fturma s\u00fcrecinde hareketsiz kal\u0131n\u0131p kal\u0131nmad\u0131\u011f\u0131d\u0131r.<\/p>\n<p>67. Somut olayda Ankara Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131 9\/10\/2014 tarihinde ba\u015flatt\u0131\u011f\u0131 soru\u015fturma kapsam\u0131nda farkl\u0131 tarihlerde Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131ndan, TBMM&#8217;den, 6-7 Ekim olaylar\u0131n\u0131n ger\u00e7ekle\u015fti\u011fi illerdeki Cumhuriyet Ba\u015fsavc\u0131l\u0131klar\u0131ndan ve di\u011fer resm\u00ee kurumlardan bilgi\/belge talebinde bulunmu\u015ftur. Bu \u015fekilde 6-7 Ekim olaylar\u0131 s\u0131ras\u0131nda meydana gelen \u00f6l\u00fcm ve yaralanma vakalar\u0131na ili\u015fkin otopsi raporlar\u0131, m\u00fc\u015fteki ve ma\u011fdur ifadeleri, bilirki\u015fi raporlar\u0131, adli muayene raporlar\u0131, mala zarar verme eylemlerine ili\u015fkin olay yeri krokileri ve g\u00f6rg\u00fc tespit tutanaklar\u0131 ile t\u00fcm bu olaylara y\u00f6nelik yap\u0131lan soru\u015fturmalar kapsam\u0131nda elde edilen delillerin listeleri, adli kolluk fezlekeleri, iddianameler ve karar \u00f6rnekleri soru\u015fturma dosyas\u0131na d\u00e2hil edilmi\u015ftir (bkz. \u00a7 13). Ba\u015fvurucuya isnat edilen ve tutuklamaya konu olan su\u00e7lar\u0131n soru\u015fturulmas\u0131n\u0131n kamu makamlar\u0131n\u0131 ciddi zorluklarla kar\u015f\u0131 kar\u015f\u0131ya b\u0131rakan bir niteli\u011fe sahip oldu\u011funu da vurgulamak gerekir. Zira su\u00e7lamalar\u0131n dayana\u011f\u0131 olan 6-7 Ekim olaylar\u0131 36 ayr\u0131 ilde ger\u00e7ekle\u015fmi\u015f, 121.899 ki\u015finin kat\u0131ld\u0131\u011f\u0131 bu olaylarda 2.389 \u015fiddet eylemi vuku bulmu\u015f, 45 ki\u015fi hayat\u0131n\u0131 kaybederken 769 ki\u015fi yaralanm\u0131\u015ft\u0131r. Olaylara ili\u015fkin olarak 4.291 \u015f\u00fcpheli g\u00f6zalt\u0131na al\u0131nm\u0131\u015f, bunlardan 1.105&#8217;i hakk\u0131nda ise tutuklama tedbiri uygulanm\u0131\u015ft\u0131r (bkz. \u00a7 10). Buna g\u00f6re Ankara Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131n\u0131n ba\u015fvurucu d\u00e2hil \u00e7ok say\u0131da \u015f\u00fcpheli ile eylemlerini i\u00e7eren ve soru\u015fturulmas\u0131 kamu makamlar\u0131n\u0131 ciddi zorluklarla kar\u015f\u0131 kar\u015f\u0131ya b\u0131rakacak nitelikteki su\u00e7lamalar\u0131 konu alan bu soru\u015fturma s\u00fcrecinde usule ili\u015fkin bir\u00e7ok i\u015flem yapt\u0131\u011f\u0131, yakla\u015f\u0131k alt\u0131 y\u0131ll\u0131k s\u00fcre\u00e7te hareketsiz kalmad\u0131\u011f\u0131 de\u011ferlendirilmektedir. Ankara Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131 di\u011fer bilgi\/belgelerle 6-7 Ekim olaylar\u0131na kat\u0131ld\u0131klar\u0131n\u0131 belirten ve olaylar s\u0131ras\u0131nda i\u015fledikleri iddia olunan farkl\u0131 su\u00e7lara ba\u011fl\u0131 olarak haklar\u0131nda soru\u015fturma\/kovu\u015fturma y\u00fcr\u00fct\u00fclen ki\u015filerin ifadelerini 7\/1\/2019, 27\/2\/2019 ve 27\/2\/2019 tarihlerinde soru\u015fturma dosyas\u0131na d\u00e2hil etmi\u015f ve -iddianame \u00f6ncesi son a\u015famaya gelindi\u011fi g\u00f6r\u00fclen soru\u015fturmada- yeni delil durumuna dayanarak ba\u015fvurucunun da tutuklanmas\u0131n\u0131 talep etmi\u015ftir. B\u00f6ylelikle ba\u015fvurucu, Ankara 4. Sulh Ceza H\u00e2kimli\u011finin 2\/10\/2020 tarihli karar\u0131yla tutuklanm\u0131\u015ft\u0131r. Sonu\u00e7 olarak ba\u015fvurucuya isnat edilen su\u00e7lamalar\u0131n ger\u00e7ekle\u015fti\u011fi tarih ile tutuklama tedbirinin uyguland\u0131\u011f\u0131 tarih aras\u0131nda uzun bir s\u00fcre ge\u00e7mi\u015f olmas\u0131na ra\u011fmen belirtilen t\u00fcm bu hususlar ile somut olay\u0131n \u00f6zellikleri, isnat edilen su\u00e7lar i\u00e7in \u00f6ng\u00f6r\u00fclen yapt\u0131r\u0131m\u0131n a\u011f\u0131rl\u0131\u011f\u0131 ve i\u015fin niteli\u011fi g\u00f6zetildi\u011finde uygulanan tutuklama tedbirinin \u00f6l\u00e7\u00fcl\u00fc oldu\u011fu g\u00f6r\u00fclmektedir.<\/p>\n<p>70. A\u00e7\u0131klanan gerek\u00e7elerle ba\u015fvurucunun tutuklaman\u0131n hukuki olmad\u0131\u011f\u0131 iddias\u0131na ili\u015fkin olarak bir ihlalin bulunmad\u0131\u011f\u0131 a\u00e7\u0131k oldu\u011fundan ba\u015fvurunun bu k\u0131sm\u0131n\u0131n a\u00e7\u0131k\u00e7a dayanaktan yoksun olmas\u0131 nedeniyle kabul edilemez oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>B. Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcnde; tutuklulu\u011fun makul s\u00fcreyi a\u015ft\u0131\u011f\u0131 \u015fik\u00e2yetiyle ilgili olarak 5271 say\u0131l\u0131 Kanun&#8217;un 141. ve 142. maddelerinde \u00f6ng\u00f6r\u00fclen tazminat yolunun t\u00fcketilmedi\u011fi, bu durumda s\u00f6z konusu iddia bak\u0131m\u0131ndan ola\u011fan ba\u015fvuru yollar\u0131 t\u00fcketilmeden bireysel ba\u015fvuru yap\u0131ld\u0131\u011f\u0131 ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>73. Bakanl\u0131k taraf\u0131ndan an\u0131lan iddian\u0131n esas\u0131na ili\u015fkin yap\u0131lan de\u011ferlendirmede ise ba\u015fvurucu hakk\u0131ndaki tutuklulu\u011fun devam\u0131na dair kararlarda ka\u00e7ma ve delilleri karartma \u015f\u00fcphesinin bulundu\u011fu, isnat edilen su\u00e7un katalog su\u00e7lar aras\u0131nda yer ald\u0131\u011f\u0131, kanunda su\u00e7a ili\u015fkin \u00f6ng\u00f6r\u00fclen cezan\u0131n y\u00fcksek oldu\u011fu, tutuklama tedbiri yerine adli kontrol tedbiri uygulanmas\u0131n\u0131n yetersiz kalaca\u011f\u0131 gerek\u00e7elerine yer verildi\u011fi belirtilmi\u015ftir. Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcnde ayr\u0131ca -ba\u015fvuru tarihi itibar\u0131yla- 1 y\u0131l 6 ayl\u0131k tutukluluk s\u00fcresinin makul olup olmad\u0131\u011f\u0131na ili\u015fkin de\u011ferlendirmenin Anayasa Mahkemesi ve Avrupa \u0130nsan Haklar\u0131 Mahkemesinin benzer i\u00e7tihatlar\u0131 g\u00f6z\u00f6n\u00fcne al\u0131narak yap\u0131lmas\u0131 gerekti\u011fi ifade edilmi\u015ftir.<\/p>\n<p>74. Ba\u015fvurucu, Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 beyan\u0131nda, devam etmekte olan hukuka ayk\u0131r\u0131 tutuklama tedbirinden kaynaklanan hak ihlalinin tazminat davas\u0131 yoluyla giderilemeyece\u011fini ve bu nedenle 5271 say\u0131l\u0131 Kanun&#8217;un 141. maddesinde \u00f6ng\u00f6r\u00fclen ba\u015fvuru yolunun t\u00fcketilmesinin gerekli olmad\u0131\u011f\u0131n\u0131 ileri s\u00fcrm\u00fc\u015ft\u00fcr. Ba\u015fvurucu ayr\u0131ca ba\u015fvuru formundakine benzer beyanlarda bulunmu\u015ftur.<\/p>\n<p>2. De\u011ferlendirme<\/p>\n<p>75. Ba\u015fvurucunun \u015fik\u00e2yetinin \u00f6z\u00fc, tutuklulu\u011fun makul s\u00fcreyi a\u015ft\u0131\u011f\u0131na ili\u015fkindir. Dolay\u0131s\u0131yla ba\u015fvurucunun iddias\u0131n\u0131n Anayasa&#8217;n\u0131n 19. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131 ba\u011flam\u0131ndaki ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fi hakk\u0131 kapsam\u0131nda incelenmesi gerekir.<\/p>\n<p>76. Anayasa Mahkemesi, tutuklulu\u011fun kanunda \u00f6ng\u00f6r\u00fclen azami s\u00fcreyi veya makul s\u00fcreyi a\u015ft\u0131\u011f\u0131 iddias\u0131yla yap\u0131lan bireysel ba\u015fvurular bak\u0131m\u0131ndan bireysel ba\u015fvurunun incelendi\u011fi tarih itibar\u0131yla ba\u015fvurucu tahliye edilmi\u015f veya h\u00fck\u00fcml\u00fc h\u00e2le gelmi\u015f ise as\u0131l dava sonu\u00e7lanmam\u0131\u015f da olsa -ilgili Yarg\u0131tay i\u00e7tihatlar\u0131na at\u0131f yaparak- 5271 say\u0131l\u0131 Kanun&#8217;un 141. maddesinde \u00f6ng\u00f6r\u00fclen tazminat davas\u0131 a\u00e7ma imk\u00e2n\u0131n\u0131n t\u00fcketilmesi gereken etkili bir hukuk yolu oldu\u011fu sonucuna varm\u0131\u015ft\u0131r (Erkam Abdurrahman Ak, B.
