Ba\u015fvuru, ki\u015finin kendisi hakk\u0131ndaki verilere eri\u015fim talebinin reddedilmesi nedeniyle \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131ndaki ki\u015fisel verilerin korunmas\u0131n\u0131 isteme hakk\u0131n\u0131n ihlal edildi\u011fi iddias\u0131na ili\u015fkindir.<\/p>\n<p>2. 1961 do\u011fumlu olan ba\u015fvurucu, ba\u015fvuru tarihinde D\u0131\u015fi\u015fleri Bakanl\u0131\u011f\u0131nda (\u0130dare) daire ba\u015fkan\u0131 olarak g\u00f6rev yapmaktad\u0131r. Ba\u015fvurucu, D\u0131\u015fi\u015fleri Bakanl\u0131\u011f\u0131 b\u00fcnyesinde \u00e7e\u015fitli g\u00f6revlerde bulunduktan sonra 2018 y\u0131l\u0131nda T\u00fcrkiye Cumhuriyeti Buenos Aires B\u00fcy\u00fckel\u00e7ili\u011fi Birinci M\u00fcste\u015farl\u0131\u011f\u0131nda g\u00f6revlendirilmi\u015ftir.<\/p>\n<p>3. Ba\u015fvurucu; yurt d\u0131\u015f\u0131 harc\u0131rah\u0131n\u0131n eksik \u00f6denmesi, Buenos Aires B\u00fcy\u00fckel\u00e7ili\u011findeki g\u00f6revine d\u00f6rt y\u0131ll\u0131\u011f\u0131na atanm\u0131\u015fken birinci y\u0131l\u0131n sonunda g\u00f6revlendirmesinin sona erdirilmesi gibi olaylar\u0131n arka plan\u0131nda \u00f6zl\u00fck dosyas\u0131nda yer alan sicil ve bilgilendirme notlar\u0131n\u0131n etkili oldu\u011funu iddia etmi\u015ftir. Bu sebeple ba\u015fvurucu 2017 ve 2018 tarihlerinde birden \u00e7ok kez D\u0131\u015fi\u015fleri Bakanl\u0131\u011f\u0131ndan bilgi edinme talebinde bulunmu\u015f, iddias\u0131na g\u00f6re bir k\u0131s\u0131m talebine cevap verilmemi\u015f, di\u011fer bir k\u0131s\u0131m talebi ise hukuka ayk\u0131r\u0131 bir \u015fekilde reddedilmi\u015ftir.<\/p>\n<p>4. Ba\u015fvurucu, 11\/10\/2018 tarihli dilek\u00e7esi ile D\u0131\u015fi\u015fleri Bakanl\u0131\u011f\u0131ndan &#8220;\u00f6zl\u00fck dosyas\u0131nda yer alan sicil, not, de\u011ferlendirme ve bilgi notlar\u0131n\u0131n avukat\u0131 arac\u0131l\u0131\u011f\u0131yla kendisine verilmesi&#8221; talebinde bulunmu\u015ftur. D\u0131\u015fi\u015fleri Bakanl\u0131\u011f\u0131 25\/10\/2018 tarihli cevap dilek\u00e7esinde &#8220;Kurumlar\u0131n, avukat\u0131n gerek duydu\u011fu bilgi ve belgeleri kurum d\u0131\u015f\u0131na g\u00f6ndermek suretiyle temin etme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bulunmamaktad\u0131r. Bu itibarla talep etmi\u015f oldu\u011funuz bilgi ve belgelerin taraf\u0131n\u0131za g\u00f6nderilmesi m\u00fcmk\u00fcn g\u00f6r\u00fcnmemektedir.&#8221; gerek\u00e7esiyle ba\u015fvurucunun talebini reddetmi\u015ftir.<\/p>\n<p>5. Ba\u015fvurucu, \u0130darenin bilgi edinme talebini reddetmesi \u00fczerine idari i\u015flemin iptali istemiyle dava a\u00e7m\u0131\u015ft\u0131r. Davan\u0131n g\u00f6r\u00fcld\u00fc\u011f\u00fc Ankara 4. \u0130dare Mahkemesi (\u0130dare Mahkemesi) 19\/6\/2019 tarihinde davan\u0131n reddine karar vermi\u015ftir. Gerek\u00e7eli karar\u0131n ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Dosyan\u0131n incelenmesinden, Arjantin \u00fclkesi T.C. Buenos Aires B\u00fcy\u00fckel\u00e7ili\u011fi nezdinde m\u00fcste\u015far olarak g\u00f6rev yapan davac\u0131n\u0131n, vekili arac\u0131l\u0131\u011f\u0131yla, &#8216;1- 1997,2001, 2004, 2005 y\u0131llar\u0131na ait sicillerin ve bilgi\/belge de\u011ferlendirme notlar\u0131, sicil notlar\u0131n\u0131n asl\u0131 gibi tasdikli birer suretleri ile bu y\u0131llarda verilmi\u015f disiplin cezalar\u0131na ait belgelerin tasdikli suretlerini, 2- 2017 Y\u0131l\u0131nda disiplin cezalar\u0131na dayal\u0131 olarak dosyada yer almamas\u0131 gereken sicillerin ve 1997, 2001, 2004, 2005 y\u0131llar\u0131na ait disiplin cezalar\u0131n\u0131n kimin talimat\u0131 ile dosyadan \u00e7\u0131kart\u0131lmad\u0131\u011f\u0131na dair Fatma \u00c7i\u011fdem Tenker K\u00f6ksal dilek\u00e7esinin tasdikli bir suretini, 3- 2018 Y\u0131l\u0131 Haziran\/Temmuz ay\u0131nda m\u00fcvekkil taraf\u0131ndan talep olunan atamalara dair komisyon karar\u0131 tasdikli bir suretini, 4- 2018 Y\u0131l\u0131 Arjantin Buenos Aires Temsilcili\u011fine atanmas\u0131na dair eksik \u00f6dendi\u011fine ve \u00f6demeye dair belgeleri talep etti\u011fi dilek\u00e7esinin tasdikli suretini, 5- Yurt d\u0131\u015f\u0131 g\u00f6rev yollu\u011fu tahakkuk, \u00f6deme, tebligat belgelerinin tasdikli suretini&#8217; Bilgi Edinme Hakk\u0131 Kanunu kapsam\u0131nda 11.10.2018 tarihli dilek\u00e7e ile talep etti\u011fi, an\u0131lan ba\u015fvuruya, &#8230; denilmek suretiyle D\u0131\u015fi\u015fleri Bakanl\u0131\u011f\u0131 Personel Dairesi Ba\u015fkanl\u0131\u011f\u0131&#8217;n\u0131n 25.10.2018 tarih ve 2018\/14468936 say\u0131l\u0131 i\u015flemi ile reddedilmesi \u00fczerine bak\u0131lan davan\u0131n a\u00e7\u0131ld\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>Olayda, davac\u0131n\u0131n, &#8216;2017 ve 2018 y\u0131llar\u0131nda bir\u00e7ok kez bilgi edinme ba\u015fvurusu yapt\u0131\u011f\u0131, bu ba\u015fvurular\u0131n z\u0131mnen ya da subjektif ve hukuka uyar olmayan gerek\u00e7elerle reddedildi\u011fi&#8217; \u00fczerine mahkememizce daval\u0131 idareye 30.01.2019 tarihinde ara karar yap\u0131lm\u0131\u015f olup; Mahkememiz kay\u0131tlar\u0131na 26.02.2019 tarihinde giren ara karar cevab\u0131 ve eklerinin incelenmesinden; davac\u0131n\u0131n 23.01.2012 (2 ayr\u0131 ba\u015fvuru), 14.01.2015, 24.11.2014 ve 30.11.2015 tarihlerinde kendi ad\u0131na 5 ayr\u0131 ba\u015fvuru yapt\u0131\u011f\u0131, an\u0131lan ba\u015fvurulara daval\u0131 idarece 27.01.2012, 04.05.2012, 13.04.2015, 02.12.2015 ve 08.12.2015 tarihlerinde taleplere uygun \u015fekilde cevap verildi\u011fi; davac\u0131n\u0131n bu defa avukat arac\u0131l\u0131\u011f\u0131yla 15.10.2018 tarihinde &#8216;taraf\u0131na mevzuat gere\u011fi hakk\u0131 olarak yurt d\u0131\u015f\u0131 g\u00f6rev yollu\u011fu ve sair mevzuat gere\u011fi \u00f6denmesi gereken ve \u00f6denmeyen 4.000-ABD Dolar\u0131 veya T\u00fcrk Liras\u0131 kar\u015f\u0131l\u0131\u011f\u0131n\u0131n yasal faiziyle ivedi olarak \u00f6denmesi&#8217; talebiyle ba\u015fvuru yapt\u0131\u011f\u0131, an\u0131lan ba\u015fvurunun, &#8216;Say\u0131n Tenker&#8217;e yurt d\u0131\u015f\u0131 g\u00f6rev yollu\u011fu T\u00fcrk Liras\u0131 cinsinden \u00f6denmi\u015f olup, ad\u0131 ge\u00e7enin s\u00f6z konusu \u00f6demeye ili\u015fkin evrak\u0131n\u0131 eksiksiz olarak teslim etti\u011fi tarihteki Merkez Bankas\u0131 D\u00f6viz Sat\u0131\u015f Kuru \u00fczerinden hesaplama yap\u0131lm\u0131\u015ft\u0131r. Ad\u0131 ge\u00e7ene ait \u00f6deme bilgilerinin incelenmesinden hesaplama usul\u00fcne ili\u015fkin maddi hataya rastlanmam\u0131\u015ft\u0131r. Bu bilgiler \u0131\u015f\u0131\u011f\u0131nda Say\u0131n Tenker&#8217;e ilave bir \u00f6deme yap\u0131lmas\u0131 m\u00fcmk\u00fcn olmayacakt\u0131r.&#8217; denilmek suretiyle 24.10.2018 tarih ve 14465669 say\u0131l\u0131 i\u015flem ile reddedildi\u011fi, yine davac\u0131 vekili taraf\u0131ndan, yukar\u0131da aktar\u0131lan 5 kalem bilgi ve belgenin 11.10.2018 tarihli dilek\u00e7e ile Bilgi Edinme Hakk\u0131 Kanunu kapsam\u0131nda talep edildi\u011fi, an\u0131lan ba\u015fvurunun &#8230; reddedildi\u011fi, davac\u0131 vekilinin, ald\u0131\u011f\u0131 bu cevap \u00fczerine son olarak 11.12.2018 tarihinde ba\u015fvuru yapt\u0131\u011f\u0131, bu ba\u015fvuruda, &#8216;Kuruma personel d\u0131\u015f\u0131nda avukatlar dahil d\u0131\u015far\u0131dan kimsenin al\u0131nmad\u0131\u011f\u0131, Kuruma al\u0131n\u0131r ise talep etti\u011fi bilgileri incelemek istedi\u011fini, bu konu hakk\u0131nda taraf\u0131na bilgi verilmesini; e\u011fer Kuruma al\u0131nmayacaksa bir \u00f6nceki ba\u015fvuruda talep etti\u011fi bilgi ve belgelerin taraf\u0131na g\u00f6nderilmesini&#8217; talep etti\u011fi, D\u0131\u015fi\u015fleri Bakanl\u0131\u011f\u0131 Personel Dairesi Ba\u015fkanl\u0131\u011f\u0131 taraf\u0131ndan ise an\u0131lan ba\u015fvuruya, &#8216;Avukatl\u0131k Kanunu&#8217;nun 2. maddesi uyar\u0131nca, dilek\u00e7enizde talep etmi\u015f oldu\u011funuz belgeleri Kuruma gelerek incelemeniz m\u00fcmk\u00fcnd\u00fcr.&#8217; denilmek suretiyle cevap verildi\u011fi g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. <\/p>\n<p>Bu durumda, her ne kadar davac\u0131 taraf\u0131ndan, &#8216;2017 ve 2018 y\u0131llar\u0131nda bir\u00e7ok kez bilgi edinme ba\u015fvurusu yapt\u0131\u011f\u0131, bu ba\u015fvurular\u0131n z\u0131mnen ya da subjektif ve hukuka uyar olmayan gerek\u00e7elerle reddedildi\u011fi&#8217; iddia edilmi\u015fse de, yukar\u0131da aktar\u0131lan bilgilere g\u00f6re davac\u0131 idarenin yap\u0131lan ba\u015fvurulara talep edilene uygun \u015fekilde cevap verdi\u011fi, avukat arac\u0131l\u0131\u011f\u0131yla yap\u0131lan ba\u015fvurular\u0131n ise Avukatl\u0131k Kanunu&#8217;nun 2. maddesi uyar\u0131nca kar\u015f\u0131land\u0131\u011f\u0131, talep edilen baz\u0131 belgelerin (davac\u0131ya ait siciller, de\u011ferlendirme ve bilgi notlar\u0131) ise gizli belge niteli\u011finde oldu\u011fu, bu belgelerin g\u00f6nderilmemesinin gerek\u00e7esinin ise 15.04.2011 tarih ve 27906 say\u0131l\u0131 Resmi Gazete&#8217;de yay\u0131mlanan Kamu Personeli Genel Tebli\u011fi&#8217;nin &#8216;\u00d6zl\u00fck Dosyas\u0131 Tutulmas\u0131na \u0130li\u015fkin Usul ve Esaslar&#8217; ba\u015fl\u0131kl\u0131 (D) bendinin dokuzuncu f\u0131kras\u0131ndaki &#8216;\u00d6zl\u00fck dosyalar\u0131n\u0131n tutulmas\u0131 ve muhafazas\u0131nda \u00f6zel hayat\u0131n gizlili\u011fi ilkesine riayet edilir. \u00d6zl\u00fck dosyas\u0131 i\u00e7eri\u011fi hakk\u0131nda soru\u015fturma ve kovu\u015fturmaya yetkili merciler d\u0131\u015f\u0131ndakilere a\u00e7\u0131klama yap\u0131lamaz, bilgi verilemez.&#8217; h\u00fckm\u00fcne dayand\u0131\u011f\u0131 anla\u015f\u0131ld\u0131\u011f\u0131ndan, yukar\u0131da yer verilen mevzuat h\u00fck\u00fcmleri uyar\u0131nca ve aktar\u0131lan bilgilere g\u00f6re dava konusu i\u015flemde hukuka uyarl\u0131k bulunmad\u0131\u011f\u0131 sonucuna var\u0131lm\u0131\u015ft\u0131r.&#8221;<\/p>\n<p>6. Ba\u015fvurucunun istinaf talebinde bulunmas\u0131 \u00fczerine dosyan\u0131n g\u00f6nderildi\u011fi Ankara B\u00f6lge \u0130dare Mahkemesi 12. \u0130dari Dava Dairesi (B\u00f6lge \u0130dare Mahkemesi) 23\/10\/2019 tarihinde istinaf ba\u015fvurusunun esastan kesin olarak reddine karar vermi\u015ftir.<\/p>\n<p>7. Ba\u015fvurucu, nihai h\u00fckm\u00fc 13\/11\/2019 tarihinde \u00f6\u011frendikten sonra 9\/12\/2019 tarihinde bireysel ba\u015fvuruda bulunmu\u015ftur.<\/p>\n<p>8. Ba\u015fvurunun kabul edilebilirlik ve esas incelemesinin B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>II. DE\u011eERLEND\u0130RME<\/p>\n<p>9. Ba\u015fvurucu; mesle\u011finde ya\u015fad\u0131\u011f\u0131 bir k\u0131s\u0131m olumsuzlu\u011fun \u00f6zl\u00fck dosyas\u0131nda yer alan sicil, de\u011ferlendirme ve bilgi notlar\u0131 nedeniyle ger\u00e7ekle\u015fti\u011fini, \u00f6zl\u00fck dosyas\u0131ndaki bir k\u0131s\u0131m bilgiyi bilgi edinme hakk\u0131 kapsam\u0131nda talep etmesine ra\u011fmen hukuka ayk\u0131r\u0131 gerek\u00e7elerle talebinin reddedildi\u011fini belirtmi\u015ftir. Ayr\u0131ca s\u00f6z konusu bilgilerin verilmemesi nedeniyle daha \u00f6nce a\u00e7t\u0131\u011f\u0131 davalarda savunma hakk\u0131n\u0131 da etkili \u015fekilde kullanamad\u0131\u011f\u0131n\u0131 iddia etmi\u015ftir.<\/p>\n<p>10. Adalet Bakanl\u0131\u011f\u0131 (Bakanl\u0131k) g\u00f6r\u00fc\u015f\u00fcnde; ba\u015fvuruya ili\u015fkin olarak D\u0131\u015fi\u015fleri Bakanl\u0131\u011f\u0131ndan temin edilen g\u00f6r\u00fc\u015f ve ilgili belgelerin ba\u015fvurucunun \u015fik\u00e2yetlerine ili\u015fkin yap\u0131lacak incelemede dikkate al\u0131nmak \u00fczere ekte g\u00f6nderildi\u011fi belirtilmi\u015ftir. D\u0131\u015fi\u015fleri Bakanl\u0131\u011f\u0131ndan temin edilen g\u00f6r\u00fc\u015f yaz\u0131s\u0131nda ise ba\u015fvurucunun \u00f6zl\u00fck dosyas\u0131nda sicil amirleri gibi \u00fc\u00e7\u00fcnc\u00fc ki\u015filere ait ki\u015fisel bilgilerin ve g\u00f6r\u00fc\u015flerin yer ald\u0131\u011f\u0131, bu h\u00e2liyle 9\/10\/2003 tarihli ve 4982 say\u0131l\u0131 Bilgi Edinme Hakk\u0131 Kanunu&#8217;nun 21. maddesinin yaln\u0131zca ba\u015fvurucu y\u00f6n\u00fcnden bir hak sa\u011flamad\u0131\u011f\u0131 ve \u00f6zl\u00fck dosyas\u0131nda yer alan di\u011fer \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin \u00f6zel hayat\u0131n\u0131n gizlili\u011finin korunmas\u0131 ad\u0131na s\u00f6z konusu bilgilerin verilmemesinin hukuka uygun oldu\u011fu belirtilmi\u015ftir. Ba\u015fvurucu, Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 beyan\u0131nda; \u00f6nceki beyanlar\u0131n\u0131 tekrarla D\u0131\u015fi\u015fleri Bakanl\u0131\u011f\u0131ndan gelen g\u00f6r\u00fc\u015f yaz\u0131s\u0131nda yer alan de\u011ferlendirmelerin mevzuata ayk\u0131r\u0131 oldu\u011funu belirtmi\u015ftir.<\/p>\n<p>11. Ba\u015fvurucunun \u015fik\u00e2yetinin \u00f6zl\u00fck dosyas\u0131nda yer alan sicil ve bilgilendirme notlar\u0131n\u0131n kendisine verilmemesine dair i\u015flemler b\u00fct\u00fcn\u00fcne y\u00f6nelik oldu\u011fu g\u00f6r\u00fclmektedir. Bu kapsamda ba\u015fvurucunun \u015fik\u00e2yetlerinin \u00f6zel hayata sayg\u0131 hakk\u0131 ile ba\u011flant\u0131l\u0131 oldu\u011fu anla\u015f\u0131lmaktad\u0131r. \u00d6zel hayata sayg\u0131 hakk\u0131 Anayasa&#8217;n\u0131n 20. maddesinde koruma alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Devlet, ki\u015filerin \u00f6zel ve aile hayat\u0131na keyf\u00ee olarak m\u00fcdahale etmemek ve \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin haks\u0131z sald\u0131r\u0131lar\u0131n\u0131 \u00f6nlemekle y\u00fck\u00fcml\u00fcd\u00fcr. \u00d6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda korunan hukuksal \u00e7\u0131karlardan biri de bireyin mahremiyet hakk\u0131d\u0131r. Ancak mahremiyet hakk\u0131 sadece yaln\u0131z kalma hakk\u0131ndan ibaret olmay\u0131p bu hak, bireyin kendisiyle ilgili bilgileri kontrol edebilme hukuksal \u00e7\u0131kar\u0131n\u0131 da kapsamaktad\u0131r. Bireyin kendisine ili\u015fkin herhangi bir bilginin kendi r\u0131zas\u0131 olmaks\u0131z\u0131n a\u00e7\u0131klanmamas\u0131, yay\u0131lmamas\u0131, bu bilgilere ba\u015fkalar\u0131 taraf\u0131ndan ula\u015f\u0131lamamas\u0131 ve r\u0131zas\u0131 hilaf\u0131na kullan\u0131lamamas\u0131, k\u0131saca bu bilgilerin mahrem kalmas\u0131 konusunda menfaati bulunmaktad\u0131r. Bu husus, bireyin kendisiyle ilgili bilgilerin gelece\u011fini belirleme hakk\u0131na i\u015faret etmektedir (Serap Tortuk, B. No: 2016\/4060, 17\/9\/2020, \u00a7 61). \u00d6zel hayata sayg\u0131 hakk\u0131n\u0131n kapsam\u0131nda olan bireylerin ki\u015fisel verilerinin korunmas\u0131 hakk\u0131, Anayasa&#8217;n\u0131n 20. maddesinde a\u00e7\u0131k olarak d\u00fczenlenmi\u015ftir (Nurcan Belin, B. No: 2014\/14187, 10\/1\/2018, \u00a7 38). Anayasa&#8217;n\u0131n 20. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda ise herkesin kendisiyle ilgili ki\u015fisel verilerin korunmas\u0131n\u0131 isteme hakk\u0131na sahip oldu\u011fu, bu hakk\u0131n ki\u015finin kendisiyle ilgili ki\u015fisel veriler hakk\u0131nda bilgilendirilme, bu verilere eri\u015fme, bunlar\u0131n d\u00fczeltilmesini veya silinmesini talep etme ve ama\u00e7lar\u0131 do\u011frultusunda kullan\u0131l\u0131p kullan\u0131lmad\u0131\u011f\u0131n\u0131 \u00f6\u011frenmeyi de kapsad\u0131\u011f\u0131 ifade edilmi\u015ftir (Arif Ali Cang\u0131, \u00a7 62).<\/p>\n<p>12. Anayasa Mahkemesi kararlar\u0131nda da belirtildi\u011fi \u00fczere ki\u015fisel veriler, belirli veya kimli\u011fi belirlenebilir olmak \u015fart\u0131yla bir ki\u015fiye ili\u015fkin b\u00fct\u00fcn bilgiler yani ad, soyad\u0131, do\u011fum tarihi ve do\u011fum yeri gibi bireyin sadece kimli\u011fini ortaya koyan bilgilerin de\u011fil telefon numaras\u0131, motorlu ta\u015f\u0131t plakas\u0131, sosyal g\u00fcvenlik numaras\u0131, pasaport numaras\u0131, \u00f6z ge\u00e7mi\u015f, resim, g\u00f6r\u00fcnt\u00fc ve ses kay\u0131tlar\u0131, parmak izleri, sa\u011fl\u0131k bilgileri, genetik bilgiler, IP adresi, e-posta adresi, al\u0131\u015fveri\u015f al\u0131\u015fkanl\u0131klar\u0131, hobiler, tercihler, etkile\u015fimde bulunulan ki\u015filer, grup \u00fcyelikleri, aile bilgileri gibi ki\u015fiyi do\u011frudan veya dolayl\u0131 olarak belirlenebilir k\u0131lan t\u00fcm verilerdir (AYM, E.2014\/74, K.2014\/201, 25\/12\/2014; E.2014\/180, K.2015\/30, 19\/3\/2015; E.2017\/180, K.2018\/109, 6\/12\/2018, \u00a7 54; Arif Ali Cang\u0131, \u00a7 63).<\/p>\n<p>13. \u00d6te yandan Anayasa\u2019n\u0131n 20. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda g\u00fcvence alt\u0131na al\u0131nan ki\u015fisel verilerin korunmas\u0131n\u0131 isteme hakk\u0131 y\u00f6n\u00fcnden inceleme yap\u0131labilmesi i\u00e7in \u00f6ncelikle an\u0131lan hak kapsam\u0131nda korunmas\u0131 gerekli bir ki\u015fisel verinin olup olmad\u0131\u011f\u0131 belirlenmelidir. Anayasa h\u00fckm\u00fcn\u00fcn lafz\u0131, konuya ili\u015fkin uluslararas\u0131 belgeler ve kar\u015f\u0131la\u015ft\u0131rmal\u0131 hukuk dikkate al\u0131nd\u0131\u011f\u0131nda belirli veya belirlenebilir bir ger\u00e7ek veya t\u00fczel ki\u015fi hakk\u0131ndaki her t\u00fcrl\u00fc bilgi ki\u015fisel veri olarak de\u011ferlendirilir. Ancak her dava ya da ba\u015fvuruda Anayasa\u2019n\u0131n 20. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131 anlam\u0131nda bir ki\u015fisel veri bulunup bulunmad\u0131\u011f\u0131 davan\u0131n ve ba\u015fvurunun kendine \u00f6zg\u00fc ko\u015fullar\u0131 dikkate al\u0131narak otonom olarak tespit edilir. Bir ki\u015fisel verinin bulundu\u011fu tespit edildi\u011finde bu veriye y\u00f6nelik her t\u00fcrl\u00fc s\u0131n\u0131rlama ve m\u00fcdahale Anayasa\u2019n\u0131n an\u0131lan h\u00fckm\u00fc kapsam\u0131ndaki g\u00fcvenceleri harekete ge\u00e7irir (Arif Ali Cang\u0131, \u00a7 64).<\/p>\n<p>14. Somut olayda D\u0131\u015fi\u015fleri Bakanl\u0131\u011f\u0131nda g\u00f6rev yapan ba\u015fvurucu hakk\u0131nda \u00f6zl\u00fck dosyas\u0131nda yer alan ve sicil amirleri taraf\u0131ndan d\u00fczenlenen sicil ve de\u011ferlendirme notlar\u0131n\u0131n ba\u015fvurucunun mesleki faaliyetlerine ili\u015fkin oldu\u011fu ku\u015fkusuzdur. Dan\u0131\u015ftay; sicil raporlar\u0131n\u0131n devlet memurlar\u0131n\u0131n o y\u0131l i\u00e7indeki genel durum ve davran\u0131\u015flar\u0131 bak\u0131m\u0131ndan olumlu ve olumsuz niteliklerini, kusur ve eksikliklerini, liyakat durumunu g\u00f6steren ve sicil amirlerince not esas\u0131na g\u00f6re d\u00fczenlenen belgeler oldu\u011funu tespit etmi\u015ftir. Buna g\u00f6re sicil raporlar\u0131nda; devlet memurunun d\u00f6nem i\u00e7inde disipline riayeti, sorumluluk duygusu, verimlilik ve \u00e7al\u0131\u015fkanl\u0131\u011f\u0131, g\u00f6revine ba\u011fl\u0131l\u0131\u011f\u0131, i\u015f heyecan\u0131, mesleki bilgisi, tarafs\u0131zl\u0131\u011f\u0131, i\u015f arkada\u015flar\u0131na, amirlerine ve i\u015f sahiplerine kar\u015f\u0131 tutumu gibi konular yer almaktad\u0131r. Nitekim Anayasa Mahkemesi Nurcan Belin karar\u0131nda ba\u015fvurucunun mesleki faaliyetlerinin de\u011ferlendirildi\u011fi sicil raporlar\u0131n\u0131n belirtilen \u00f6nemi, ta\u015f\u0131d\u0131\u011f\u0131 mahiyet ve i\u00e7eri\u011fi sebebiyle ki\u015fisel veri niteli\u011finde oldu\u011funda teredd\u00fct bulunmad\u0131\u011f\u0131n\u0131 ifade etmi\u015ftir. Bu sebeple ki\u015fisel verilerin tutulmas\u0131n\u0131n, saklanmas\u0131n\u0131n veya aktar\u0131lmas\u0131n\u0131n Anayasa\u2019n\u0131n 20. maddesi ba\u011flam\u0131nda ki\u015filerin \u00f6zel hayat\u0131na sayg\u0131 hakk\u0131 kapsam\u0131nda korundu\u011fu ku\u015fkusuzdur. Bu durumda ki\u015fisel veri niteli\u011findeki bu bilgilerin ba\u015fvurucunun kendisine verilmemesi \u015feklinde ger\u00e7ekle\u015fen olayda, Anayasa&#8217;n\u0131n ki\u015fisel verilerin korunmas\u0131n\u0131 isteme hakk\u0131na ili\u015fkin 20. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131n\u0131n uygulanabilir oldu\u011fu sonucuna var\u0131lm\u0131\u015f ve mevcut ba\u015fvuru ki\u015fisel verilerin korunmas\u0131n\u0131 isteme hakk\u0131 kapsam\u0131nda incelenmi\u015ftir (benzer y\u00f6ndeki de\u011ferlendirmeler i\u00e7in bkz. Nurcan Belin \u00a7\u00a7 40, 41).<\/p>\n<p>15. A\u00e7\u0131k\u00e7a dayanaktan yoksun olmad\u0131\u011f\u0131 ve kabul edilemezli\u011fine karar verilmesini gerektirecek ba\u015fka bir neden de bulunmad\u0131\u011f\u0131 anla\u015f\u0131lan \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131ndaki ki\u015fisel verilerin korunmas\u0131n\u0131 isteme hakk\u0131n\u0131n ihlal edildi\u011fine ili\u015fkin iddian\u0131n kabul edilebilir oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>16. Somut olayda ba\u015fvurucunun \u00f6zl\u00fck dosyas\u0131ndaki bilgilerin kendisine verilmemesiyle Anayasa\u2019n\u0131n 20. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda g\u00fcvence alt\u0131na al\u0131nan \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131ndaki ki\u015fisel verilerin korunmas\u0131n\u0131 isteme hakk\u0131na bir m\u00fcdahalede bulunulmu\u015ftur. S\u00f6z konusu m\u00fcdahale Anayasa\u2019n\u0131n 13. maddesinde belirtilen ko\u015fullara uygun olmad\u0131\u011f\u0131 m\u00fcddet\u00e7e Anayasa\u2019n\u0131n 20. maddesini ihlal edecektir. Bu ba\u011flamda mevcut ba\u015fvuruda \u00f6ncelikle m\u00fcdahalenin kanuni dayana\u011f\u0131n\u0131n bulunup bulunmad\u0131\u011f\u0131 incelenmelidir.<\/p>\n<p>17. Anayasa&#8217;n\u0131n temel hak ve \u00f6zg\u00fcrl\u00fcklerin s\u0131n\u0131rland\u0131r\u0131lmas\u0131 rejimini d\u00fczenleyen 13. maddesinde hak ve \u00f6zg\u00fcrl\u00fcklerin ancak kanunla s\u0131n\u0131rlanabilece\u011fi temel bir ilke olarak benimsenmi\u015ftir. Bunun yan\u0131nda Anayasa\u2019n\u0131n 20. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131n\u0131n \u00fc\u00e7\u00fcnc\u00fc c\u00fcmlesinde ki\u015fisel verilerin \u201cancak kanunda \u00f6ng\u00f6r\u00fclen hallerde veya ki\u015finin a\u00e7\u0131k r\u0131zas\u0131yla\u201d i\u015flenebilece\u011fi belirtilmi\u015f, ayn\u0131 f\u0131kran\u0131n d\u00f6rd\u00fcnc\u00fc c\u00fcmlesinde ise ki\u015fisel verilerin korunmas\u0131na ili\u015fkin esas ve usullerin kanunla d\u00fczenlenece\u011fi h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Buna g\u00f6re ki\u015fisel verilerin korunmas\u0131n\u0131 isteme hakk\u0131na yap\u0131lan m\u00fcdahalelerde dikkate al\u0131nacak \u00f6ncelikli \u00f6l\u00e7\u00fct, m\u00fcdahalenin kanuna dayal\u0131 olmas\u0131d\u0131r (Arif Ali Cang\u0131, \u00a7 72).<\/p>\n<p>18. Anayasa&#8217;n\u0131n 13. maddesinde yer alan kanunilik \u00f6l\u00e7\u00fct\u00fc s\u0131n\u0131rlamaya ili\u015fkin kural\u0131n eri\u015filebilirli\u011fi ve \u00f6ng\u00f6r\u00fclebilirli\u011fi ile kesinli\u011fini ifade eden belirlili\u011fini garanti alt\u0131na al\u0131r (E\u011fitim ve Bilim Emek\u00e7ileri Sendikas\u0131 ve di\u011ferleri [GK], B. No: 2014\/920, 25\/5\/2017, \u00a7 55). M\u00fcdahalenin kanuna dayal\u0131 olmas\u0131, i\u00e7 hukukta m\u00fcdahaleye ili\u015fkin yeterince ula\u015f\u0131labilir ve \u00f6ng\u00f6r\u00fclebilir kurallar\u0131n bulunmas\u0131n\u0131 gerektirmektedir (T\u00fcrkiye \u0130\u015f Bankas\u0131 A.\u015e. [GK], B. No: 2014\/6192, 12\/11\/2014, \u00a7 44). Kanunilik unsuru y\u00f6n\u00fcnden de\u011ferlendirme yap\u0131l\u0131rken derece mahkemelerince m\u00fcdahaleye imk\u00e2n tan\u0131yan kanun h\u00fck\u00fcmlerinin yorumu ve bu h\u00fck\u00fcmlerin olaya uygulanmas\u0131 bariz takdir hatas\u0131 ya da a\u00e7\u0131k keyf\u00eelik i\u00e7ermedi\u011fi s\u00fcrece bu alanda bir inceleme yap\u0131lmas\u0131 bireysel ba\u015fvurunun amac\u0131yla ba\u011fda\u015fmaz. Ancak derece mahkemelerinin m\u00fcdahaleye imk\u00e2n tan\u0131yan kanun h\u00fckm\u00fcn\u00fc a\u00e7\u0131k bi\u00e7imde hatal\u0131 yorumlad\u0131\u011f\u0131n\u0131n ve uygulad\u0131\u011f\u0131n\u0131n tespiti h\u00e2linde m\u00fcdahalenin kanunilik temelinden yoksun oldu\u011fu sonucuna ula\u015f\u0131labilir (Ramazan Atay, B. No: 2017\/26048, 29\/1\/2020, \u00a7 29). \u00d6te yandan derece mahkemelerince yap\u0131lan yorum ve uygulama da bir kural\u0131n belirlili\u011fini do\u011frudan do\u011fruya etkilemektedir. Kanunun varl\u0131\u011f\u0131 kadar kanunun hem metninin hem de uygulanmas\u0131n\u0131n bireylerin davran\u0131\u015flar\u0131n\u0131n sonucunu \u00f6ng\u00f6rebilece\u011fi kadar hukuki belirlilik ta\u015f\u0131mas\u0131 \u00f6nemlidir (Necmiye \u00c7ift\u00e7i ve di\u011ferleri, B. No: 2013\/1301, 30\/12\/2014, \u00a7 55). \u00d6yleyse Anayasa Mahkemesince yap\u0131lmas\u0131 gereken, incelemeye konu ba\u015fvuru konusu normun yarg\u0131 organlar\u0131nca yap\u0131lan yorumlar\u0131n\u0131n ki\u015filerce \u00f6ng\u00f6rebilmelerini sa\u011flayacak belirlilikte olup olmad\u0131\u011f\u0131n\u0131n tespit edilmesidir (benzer de\u011ferlendirmeler i\u00e7in bkz. Hanifi Yali\u00e7li [GK], B. No: 2014\/5224, 10\/6\/2021, \u00a7 95).<\/p>\n<p>19. Somut olayda \u0130darenin ba\u015fvurucunun \u00f6zl\u00fck dosyas\u0131ndaki bilgilere eri\u015fim talebinin reddine y\u00f6nelik verdi\u011fi cevabi yaz\u0131da herhangi bir mevzuat h\u00fckm\u00fcne dayanmad\u0131\u011f\u0131 g\u00f6r\u00fclm\u00fc\u015ft\u00fcr (bkz. \u00a7 4). \u0130dare Mahkemesi ise gerek\u00e7eli karar\u0131nda 15\/4\/2011 tarihli ve 27906 say\u0131l\u0131 Resm\u00ee Gazete&#8217;de yay\u0131mlanan Kamu Personel Tebli\u011fi&#8217;nin (D) bendinin &#8220;\u00d6zl\u00fck dosyalar\u0131n\u0131n tutulmas\u0131 ve muhafazas\u0131nda \u00f6zel hayat\u0131n gizlili\u011fi ilkesine riayet edilir. \u00d6zl\u00fck dosyas\u0131 i\u00e7eri\u011fi hakk\u0131nda soru\u015fturma ve kovu\u015fturmaya yetkili merciler d\u0131\u015f\u0131ndakilere a\u00e7\u0131klama yap\u0131lamaz, bilgi verilemez. Ayr\u0131ca ki\u015finin r\u0131zas\u0131 olmaks\u0131z\u0131n \u00f6zl\u00fck dosyas\u0131ndaki bilgiler ve kay\u0131tlar esas al\u0131narak ki\u015fi hakk\u0131nda yay\u0131nda bulunulamaz&#8221; bi\u00e7imindeki dokuzuncu f\u0131kras\u0131na dayanarak davan\u0131n reddine karar vermi\u015ftir. \u0130darenin ve Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f yaz\u0131s\u0131ndan; mevcut ba\u015fvuruda s\u00f6z konusu Tebli\u011f&#8217;in ilgili h\u00fckm\u00fcn\u00fcn 4982 say\u0131l\u0131 Kanun&#8217;un 21. maddesinin &#8220;Ki\u015finin izin verdi\u011fi h\u00e2ller sakl\u0131 kalmak \u00fczere, \u00f6zel hayat\u0131n gizlili\u011fi kapsam\u0131nda, a\u00e7\u0131klanmas\u0131 h\u00e2linde ki\u015finin sa\u011fl\u0131k bilgileri ile \u00f6zel ve aile hayat\u0131na, \u015feref ve haysiyetine, meslek\u00ee ve ekonomik de\u011ferlerine haks\u0131z m\u00fcdahale olu\u015fturacak bilgi veya belgeler, bilgi edinme hakk\u0131 kapsam\u0131 d\u0131\u015f\u0131ndad\u0131r.&#8221; bi\u00e7imindeki (1) numaral\u0131 f\u0131kras\u0131 ile ba\u011flant\u0131l\u0131 olarak ele al\u0131nd\u0131\u011f\u0131 anla\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>20. Kamu hizmetlerinin etkin bir \u015fekilde g\u00f6r\u00fclebilmesi i\u00e7in kamu personelinin faaliyetlerinin de\u011ferlendirildi\u011fi sicil raporlar\u0131n\u0131n d\u00fczenlenmesi, tutulmas\u0131 ve muhafaza edilmesi kamu yarar\u0131 bak\u0131m\u0131ndan gerekli g\u00f6r\u00fclebilir. Bununla birlikte kamu makamlar\u0131ndan \u00e7al\u0131\u015fanlar\u0131n mesleki faaliyetlerine ili\u015fkin s\u00f6z konusu bilgilerin tutulmas\u0131 ve saklanmas\u0131 s\u0131ras\u0131nda Anayasa&#8217;n\u0131n 20. maddesinde g\u00fcvence alt\u0131na al\u0131nan \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n korunmas\u0131na ili\u015fkin gerekliliklere uygun hareket etmeleri beklenir. Bu ba\u011flamda kamu g\u00f6revlilerinin haklar\u0131nda d\u00fczenlenen mesleki sicil raporlar\u0131n\u0131n tutulmas\u0131 ve saklanmas\u0131 s\u0131ras\u0131nda gizlili\u011fe riayet edilmesi, bu verilere ilgisiz ki\u015filerin eri\u015fiminin engellenmesi gerekmektedir. Kamu Personel Tebli\u011fi&#8217;nin (D) bendinin dokuzuncu f\u0131kras\u0131n\u0131n da esas olarak bu amaca hizmet etti\u011fi g\u00f6r\u00fclmektedir (Nurcan Belin, \u00a7 50).<\/p>\n<p>21. Yine ki\u015fisel verilerin korunmas\u0131 hususunda Anayasa&#8217;n\u0131n 20. maddesindeki gereklilikleri sa\u011flamaya y\u00f6nelik baz\u0131 d\u00fczenlemelerin mevcut oldu\u011fu g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Bu kapsamda 4982 say\u0131l\u0131 Kanun&#8217;un ilgili h\u00fck\u00fcmleri uyar\u0131nca bilgi edinme hakk\u0131 \u00e7er\u00e7evesinde ki\u015fisel verilere eri\u015fimin kolayla\u015ft\u0131r\u0131lmas\u0131 sa\u011flanm\u0131\u015ft\u0131r (Nurcan Belin, \u00a7 51). Bununla birlikte 4982 say\u0131l\u0131 Kanun&#8217;un 21. maddesi ile \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda \u00fc\u00e7\u00fcnc\u00fc ki\u015filer y\u00f6n\u00fcnden bilgi edinme hakk\u0131 s\u0131n\u0131rland\u0131r\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>22. G\u00f6r\u00fclece\u011fi \u00fczere gerek Kamu Personel Tebli\u011fi gerekse de 4982 say\u0131l\u0131 Kanun&#8217;un 21. maddesinde yer alan ve \u00f6zel hayat\u0131n gizlili\u011fi ilkesine g\u00f6nderme yapan d\u00fczenlemeleri ki\u015filerin kendileri y\u00f6n\u00fcnden de\u011fil ancak kendileri ile ilgili bilgilerin \u00fc\u00e7\u00fcnc\u00fc ki\u015filere verilmesi y\u00f6n\u00fcnden s\u0131n\u0131rlama getirmektedir. Nitekim ki\u015filerin kendileri hakk\u0131ndaki bilgilerin \u00fc\u00e7\u00fcnc\u00fc ki\u015filerle payla\u015f\u0131lmas\u0131 h\u00e2linde \u00f6zel hayat\u0131n gizlili\u011fi ilkesinin ihlali s\u00f6z konusu olabilmekte ve an\u0131lan ilkenin korunmas\u0131 kapsam\u0131nda s\u00f6z konusu bilgilere eri\u015fim talepleri s\u0131n\u0131rland\u0131r\u0131lmaktad\u0131r. Bununla birlikte somut olayda ba\u015fvurucunun \u00f6zl\u00fck dosyas\u0131ndaki sicil ve de\u011ferlendirme notlar\u0131na y\u00f6nelik eri\u015fim talebi ba\u015fvurucunun bizzat kendisi hakk\u0131ndaki ki\u015fisel verilere eri\u015fimi kapsam\u0131ndad\u0131r ve Anayasa&#8217;n\u0131n 20. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda \u00f6zel olarak d\u00fczenlenmi\u015ftir. Yine 24\/3\/2016 tarihli ve 6698 say\u0131l\u0131 Ki\u015fisel Verilerin Korunmas\u0131 Kanunu&#8217;nun 11. maddesi de Anayasa&#8217;n\u0131n 20. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131 ile ba\u011flant\u0131l\u0131 olarak ki\u015fisel verilere eri\u015fimi d\u00fczenleme alt\u0131na alm\u0131\u015ft\u0131r. Bu kapsamda ki\u015filerin kendileri hakk\u0131ndaki ki\u015fisel verilere eri\u015fimi Anayasa&#8217;n\u0131n ilgili h\u00fckm\u00fc ve bu h\u00fckme dayanan kanuni d\u00fczenlemeler \u0131\u015f\u0131\u011f\u0131nda de\u011ferlendirilmelidir. O h\u00e2lde Anayasa&#8217;n\u0131n 20. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131 g\u00f6z\u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda Kamu Personel Tebli\u011fi&#8217;nin ilgili h\u00fckm\u00fcn\u00fcn ve 4982 say\u0131l\u0131 Kanun&#8217;un 21. maddesinin mevcut ba\u015fvuru y\u00f6n\u00fcnden kanuni bir dayanak olu\u015fturmad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.<\/p>\n<p>23. Buna kar\u015f\u0131n yarg\u0131 mercileri Tebli\u011f&#8217;in ilgili f\u0131kras\u0131n\u0131, ki\u015filerin kendileri hakk\u0131ndaki bilgilere eri\u015fim talepleri y\u00f6n\u00fcnden de s\u0131n\u0131rlama getirdi\u011fi \u015feklinde yorumlam\u0131\u015f ve ba\u015fvurucunun ki\u015fisel verilere eri\u015fim talebini ba\u015fkaca herhangi bir de\u011ferlendirme yapmadan reddetmi\u015ftir. Anayasa&#8217;n\u0131n 13. maddesinde \u00f6ng\u00f6r\u00fclen kanunilik \u00f6l\u00e7\u00fct\u00fcne ili\u015fkin yukar\u0131daki ilkeler dikkate al\u0131nd\u0131\u011f\u0131nda kanunda \u00f6ng\u00f6r\u00fclen normun kapsam\u0131na girmedi\u011fi anla\u015f\u0131lan bir i\u015flem ve eylemi hatal\u0131 olarak o normun kapsam\u0131nda g\u00f6ren bir yarg\u0131sal yorumun \u00f6ng\u00f6r\u00fclebilirlik \u015fart\u0131n\u0131 sa\u011flad\u0131\u011f\u0131 s\u00f6ylenemez (benzer y\u00f6ndeki de\u011ferlendirmeler i\u00e7in bkz. Sercan Av\u015far, B. No: 2016\/63088, 9\/6\/2021, \u00a7 52). Dolay\u0131s\u0131yla ba\u015fvuru konusu m\u00fcdahalenin Anayasa&#8217;n\u0131n 13. maddesinde \u00f6ng\u00f6r\u00fclen kanunilik \u015fart\u0131n\u0131 kar\u015f\u0131lamad\u0131\u011f\u0131 sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>24. A\u00e7\u0131klanan gerek\u00e7elerle ba\u015fvurucunun Anayasa\u2019n\u0131n 20. maddesinde g\u00fcvence alt\u0131na al\u0131nan \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131ndaki ki\u015fisel verilerin korunmas\u0131n\u0131 isteme hakk\u0131n\u0131n ihlal edildi\u011fine karar verilmesi gerekir.<\/p>\n<p>III. G\u0130DER\u0130M<\/p>\n<p>25. Ba\u015fvurucu, ihlalin tespiti ve yarg\u0131laman\u0131n yenilenmesi ile 50.000 TL manevi tazminat talebinde bulunmu\u015ftur.<\/p>\n<p>26. Ba\u015fvuruda tespit edilen hak ihlalinin sonu\u00e7lar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131 i\u00e7in yeniden yarg\u0131lama yap\u0131lmas\u0131nda hukuki yarar bulunmaktad\u0131r.
