BA\u015eVURU<\/p>\n<p>Avukat &#8230;\u2019\u00fcn 13.01.2015 tarihli ba\u015fvurusunda; Bursa B\u00f6lge Adliye Mahkemesi 4. Hukuk Dairesi ile \u0130stanbul B\u00f6lge Adliye Mahkemesi 55. Hukuk Dairesinin kararlar\u0131 aras\u0131nda, 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun (6098 say\u0131l\u0131 Kanun) 350. maddesine g\u00f6re; belirli s\u00fcreli kira s\u00f6zle\u015fmelerinden kaynaklanan ihtiya\u00e7 nedeniyle tahliye davalar\u0131nda, dava \u015fart\u0131 olan zorunlu arabuluculuk ba\u015fvurusunun dava a\u00e7ma s\u00fcresinden \u00f6nce yap\u0131l\u0131p yap\u0131lamayaca\u011f\u0131na ili\u015fkin uyu\u015fmazl\u0131k bulundu\u011funu belirterek, s\u00f6z konusu uyu\u015fmazl\u0131\u011f\u0131n giderilmesini talep etmi\u015ftir.<\/p>\n<p>II. B\u00d6LGE ADL\u0130YE MAHKEMES\u0130 HUKUK DA\u0130RELER\u0130 BA\u015eKANLAR KURULU KARARI<\/p>\n<p>Bursa B\u00f6lge Adliye Mahkemesi Hukuk Daireleri Ba\u015fkanlar Kurulunun 24.02.2025 tarihli ve 2025\/3 E., 2025\/8 K. say\u0131l\u0131 karar\u0131yla; \u201cArabuluculuk, \u00f6zel hukuk uyu\u015fmazl\u0131klar\u0131n\u0131 \u00e7\u00f6z\u00fcm\u00fcnde taraflar\u0131n iradesiyle i\u015fleyen alternatif bir \u00e7\u00f6z\u00fcm y\u00f6ntemidir. Bu s\u00fcre\u00e7, dava a\u00e7madan \u00f6nce veya dava a\u00e7\u0131ld\u0131ktan sonra ba\u015fvurulabilecek bir yol olarak kullan\u0131labilir. Arabuluculu\u011fun temel i\u015flevi, mahkemelerin i\u015f y\u00fck\u00fcn\u00fc hafifletmektir. Ayr\u0131ca uyu\u015fmazl\u0131klar\u0131n bar\u0131\u015f\u00e7\u0131l, h\u0131zl\u0131 ve kesin bir \u015fekilde \u00e7\u00f6z\u00fcmlenmesini ama\u00e7lar.<\/p>\n<p>Arabuluculuk zorunlu ve ihtiyari olmak \u00fczere iki kategoriye ayr\u0131lm\u0131\u015ft\u0131r. Zorunlu arabuluculuk, bir dava \u015fart\u0131d\u0131r ve dava a\u00e7\u0131lmadan \u00f6nce arabuluculuk s\u00fcrecinin tamamlanmas\u0131 gereklidir. Aksi takdirde dava usulden reddedilir. Ticari davalar, i\u015fe iade davalar\u0131 ve kira ili\u015fkisinden kaynaklanan davalar zorunlu arabuluculuk \u015fart\u0131n\u0131n arand\u0131\u011f\u0131 davalard\u0131r.<\/p>\n<p>5 Nisan 2023 tarihli Resmi Gazete\u2019de yay\u0131mlanan 7445 say\u0131l\u0131 \u0130cra \u0130flas Kanunu ile Baz\u0131 Kanunlarda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun&#8217;un 37. maddesi ile kira tespit ve tahliye davalar\u0131 i\u00e7in zorunlu arabuluculuk \u015fart\u0131 getirilmi\u015ftir.<\/p>\n<p>Bu d\u00fczenleme ile birlikte 1 Eyl\u00fcl 2023 tarihinden sonra a\u00e7\u0131lacak olan kira tespit ve tahliye davalar\u0131nda, \u00f6ncelikle arabuluculuk ba\u015fvurusu yap\u0131lmas\u0131 zorunlu hale getirilmi\u015ftir. Ancak, uygulaman\u0131n y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi 1 Eyl\u00fcl 2023 tarihinden \u00f6nce a\u00e7\u0131lan kira tespit ve tahliye istemli davalarda, arabuluculuk yoluna ba\u015fvurma zorunlulu\u011fu bulunmamaktad\u0131r.<\/p>\n<p>Uyu\u015fmazl\u0131\u011fa konu BAM Daire kararlar\u0131nda uyu\u015fmazl\u0131k, kira davalar\u0131nda dava \u015fart\u0131 olan zorunlu arabuluculuk ba\u015fvurusunun, dava a\u00e7ma s\u00fcresi gelmeden \u00f6nce yap\u0131l\u0131p yap\u0131lamayaca\u011f\u0131, dava a\u00e7ma hakk\u0131 do\u011fduktan sonra arabuluculuk ba\u015fvurusunun yap\u0131lmas\u0131n\u0131n zorunlu olup olmad\u0131\u011f\u0131 noktas\u0131ndad\u0131r.<\/p>\n<p>Bursa B\u00f6lge Adliye Mahkemesi 4. Hukuk Dairesinin 2024\/3188-2024\/3486 E-K. say\u0131l\u0131 karar\u0131nda; ihtiya\u00e7 nedeniyle tahliye davas\u0131 a\u00e7mak isteyen kiraya verenin yeni d\u00f6nem ba\u015flad\u0131ktan sonra bir ay i\u00e7erisinde arabuluculuk b\u00fcrosuna ba\u015fvurmas\u0131 ve son tutana\u011f\u0131n d\u00fczenlenmesinden itibaren arabuluculuk b\u00fcrosuna ba\u015fvuru ile durmu\u015f olan dava s\u00fcresi kald\u0131\u011f\u0131 yerden devam edece\u011finden, bir ayl\u0131k dava s\u00fcresinden kalan s\u00fcre i\u00e7erisinde davas\u0131n\u0131 a\u00e7mas\u0131 gerekti\u011fi, somut olayda ise kira s\u00f6zle\u015fmesinin tarihi 01.01.2020 tarihi oldu\u011funa g\u00f6re, yeni d\u00f6nemin 01.01.2024 tarihinde ba\u015flayaca\u011f\u0131, davac\u0131n\u0131n arabuluculuk b\u00fcrosuna ba\u015fvuru tarihinin 10.12.2023 tarihi oldu\u011fu ve anla\u015famama tutana\u011f\u0131n\u0131n da 27.12.2023 tarihinde d\u00fczenlendi\u011fi, bu durumda arabuluculuk b\u00fcrosuna ba\u015fvuru tarihinin dava a\u00e7ma s\u00fcresinin ba\u015flad\u0131\u011f\u0131 01.01.2024 tarihinden \u00f6nce oldu\u011fu, dava a\u00e7ma s\u00fcresi ba\u015flamadan \u00f6nce arabuluculuk b\u00fcrosuna ba\u015fvurulmas\u0131 halinde usul\u00fcne uygun bir \u015fekilde arabuluculuk s\u00fcrecinin i\u015fleyece\u011finden ve zorunlu arabuluculuk dava \u015fart\u0131n\u0131n yerine geldi\u011finden bahsedilemeyece\u011fi gerek\u00e7esiyle, mahkemece usul\u00fcne uygun zorunlu arabuluculuk dava \u015fart\u0131 yerine gelmedi\u011finden davan\u0131n usulden reddine karar verilmesi gerekti\u011finden, istinaf ba\u015fvurusu kabul edilerek \u0130lk Derece Mahkemesi karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131na karar verilirken,<\/p>\n<p>\u0130stanbul B\u00f6lge Adliye Mahkemesi 55. Hukuk Dairesinin 2024\/1098 E-2024\/847 say\u0131l\u0131 karar\u0131nda; \u0130lk Derece Mahkemesinin &#8220;davac\u0131n\u0131n dava a\u00e7ma hakk\u0131n\u0131n 16.09.2023 tarihinde do\u011fmu\u015f olaca\u011f\u0131, dava \u015fart\u0131 olan arabuluculu\u011fa da (do\u011fmam\u0131\u015f bir hakk\u0131n kullan\u0131lmas\u0131 s\u00f6z konusu olamayaca\u011f\u0131ndan) en erken bu tarihte ba\u015fvurabilece\u011fi anla\u015f\u0131lmakla, hen\u00fcz dava a\u00e7ma s\u00fcresi ba\u015flamadan (16.09.2023 tarihinden) \u00f6nce s\u00fcresinde olmayacak \u015fekilde 05.09.2023 tarihinde s\u00fcresi y\u00f6n\u00fcnden usuls\u00fcz yap\u0131lan arabuluculuk ba\u015fvurusunun, 6325 say\u0131l\u0131 Arabuluculuk Kanunun 18-B\/1 maddesi anlam\u0131nda arabuluculuk dava \u015fart\u0131n\u0131 ger\u00e7ekle\u015ftirdi\u011finin kabul\u00fc m\u00fcmk\u00fcn g\u00f6r\u00fclmeyerek,&#8230;.&#8221; \u015feklindeki gerek\u00e7e ile verdi\u011fi karar\u0131n, kanunda dava a\u00e7ma hakk\u0131 do\u011fduktan sonra ve dava a\u00e7ma s\u00fcresi i\u00e7erisinde arabuluculu\u011fa ba\u015fvurulaca\u011f\u0131na ili\u015fkin herhangi bir ibarenin bulunmad\u0131\u011f\u0131, Mahkemece i\u015fin esas\u0131na girilerek bir karar verilmesi gerekirken, yaz\u0131l\u0131 oldu\u011fu \u015fekilde davan\u0131n usulden reddine karar verilmesinin hatal\u0131 oldu\u011fu gerek\u00e7esiyle kald\u0131r\u0131lmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>Dava \u015fart\u0131 arabuluculuk s\u00fcreci i\u015flemlerinden \u00f6nce ba\u015flat\u0131lan arabuluculuk i\u015flemlerinin ihtiyari arabuluculuk i\u015flemleri olabilece\u011fi, bu arabuluculu\u011fun ise dava \u015fart\u0131 arabuluculu\u011fa ikame edilip edilmeyece\u011fi noktas\u0131nda g\u00f6r\u00fc\u015f ayr\u0131l\u0131\u011f\u0131 meydana gelmi\u015ftir. Bu haliyle her iki BAM karar\u0131 aras\u0131nda arabuluculu\u011fa ba\u015fvuru yap\u0131lmas\u0131 i\u00e7in dava a\u00e7ma hakk\u0131n\u0131n do\u011fmas\u0131n\u0131n gerekip gerekmedi\u011fi y\u00f6n\u00fcnde uyu\u015fmazl\u0131k bulundu\u011fu anla\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Nitekim kiralanan\u0131n tahliyesi istemiyle a\u00e7\u0131lan davalar\u0131n 6325 say\u0131l\u0131 Hukuk Uyu\u015fmazl\u0131klar\u0131nda Arabuluculuk Kanunu&#8217;na g\u00f6re, dava a\u00e7\u0131lmadan \u00f6nce arabulucuya ba\u015fvurulmu\u015f olmas\u0131n\u0131n dava \u015fart\u0131 haline getirildi\u011fi, ancak kanunda dava a\u00e7ma hakk\u0131 do\u011fduktan sonra ve dava a\u00e7ma s\u00fcresi i\u00e7erisinde arabuluculu\u011fa ba\u015fvurulaca\u011f\u0131na ili\u015fkin herhangi bir ibarenin bulunmad\u0131\u011f\u0131, bu nedenle kararlar aras\u0131ndaki uyu\u015fmazl\u0131\u011f\u0131n \u0130stanbul BAM 55. Hukuk Dairesinin karar\u0131 do\u011frultusunda giderilmesi y\u00f6n\u00fcnde \u00e7o\u011funluk g\u00f6r\u00fc\u015f\u00fc hakim olmu\u015ftur. \u201d denilerek, Bursa B\u00f6lge Adliye Mahkemesi 4. Hukuk Dairesi ile \u0130stanbul B\u00f6lge Adliye Mahkemesi 55. Hukuk Dairesi aras\u0131ndaki uyu\u015fmazl\u0131\u011f\u0131n \u0130stanbul B\u00f6lge Adliye Mahkemesi 55. Hukuk Dairesi karar\u0131 do\u011frultusunda giderilmesi y\u00f6n\u00fcndeki g\u00f6r\u00fc\u015f\u00fcyle, 5235 say\u0131l\u0131 Adli Yarg\u0131 \u0130lk Derece Mahkemeleri ile B\u00f6lge Adliye Mahkemelerinin Kurulu\u015f G\u00f6rev ve Yetkileri Hakk\u0131nda Kanun&#8217;un 35. maddesi uyar\u0131nca uyu\u015fmazl\u0131\u011f\u0131n giderilmesi talep edilmi\u015ftir.<\/p>\n<p>III. UYU\u015eMAZLI\u011eIN G\u0130DER\u0130LMES\u0130 \u0130STEM\u0130NE KONU KARARLAR<\/p>\n<p>A. Bursa B\u00f6lge Adliye Mahkemesi 4. Hukuk Dairesinin 26.12.2024 tarihli ve 2024\/3188 E., 2024\/3486 K. say\u0131l\u0131 karar\u0131<\/p>\n<p>Bursa 6. Sulh Hukuk Mahkemesinin 25.06.2024 tarihli ve 2024\/37 E., 2024\/956 K. say\u0131l\u0131 dosyas\u0131nda; davac\u0131 kiraya verenin, daval\u0131n\u0131n 01.01.2024 ba\u015flang\u0131\u00e7 tarihli ve 1 y\u0131l s\u00fcreli kirac\u0131 oldu\u011funu, annesinin konut ihtiyac\u0131 nedeniyle kiralanan\u0131n tahliye edilmesinin daval\u0131ya bildirildi\u011fini, daval\u0131n\u0131n olumsuz cevap vermesi \u00fczerine 10.12.2013 tarihinde arabuluculuk b\u00fcrosuna ba\u015fvuruldu\u011funu, anla\u015fma sa\u011flanamad\u0131\u011f\u0131n\u0131 ve 27.12.2023 tarihinde arabuluculuk son tutana\u011f\u0131 d\u00fczenlendi\u011fini ileri s\u00fcrerek; ihtiya\u00e7 nedeniyle kiralanan\u0131n tahliyesine karar verilmesinin talep edildi\u011fi, \u0130lk Derece Mahkemesince, davac\u0131n\u0131n \u00fcst soyu olan annesi i\u00e7in konutu kullanma zorunlulu\u011funun samimi ve ger\u00e7ek oldu\u011fu gerek\u00e7esiyle davan\u0131n kabul\u00fc ile kiralanan\u0131n tahliyesine karar verildi\u011fi, daval\u0131n\u0131n istinaf yoluna ba\u015fvurmas\u0131 \u00fczerine Bursa B\u00f6lge Adliye Mahkemesi 4. Hukuk Dairesinin yukar\u0131da tarih ve say\u0131l\u0131 belirtilen karar\u0131yla; \u201c&#8230; taraflar aras\u0131ndaki kira akdinin 01.01.2020 ba\u015flang\u0131\u00e7 tarihli ve 1 y\u0131ll\u0131k oldu\u011fu g\u00f6r\u00fclmektedir. Buna g\u00f6re ihtiya\u00e7 nedeniyle tahliye davas\u0131n\u0131n yeni d\u00f6nem ba\u015flang\u0131c\u0131 olan 01.01.2024 tarihinden itibaren bir ay i\u00e7erisinde a\u00e7\u0131lmas\u0131 gerekir.<\/p>\n<p>Ancak, \u00fcstte a\u00e7\u0131kland\u0131\u011f\u0131 \u00fczere kira s\u00f6zle\u015fmesinden kaynaklanan uyu\u015fmazl\u0131klar 6325 Say\u0131l\u0131 Hukuk Uyu\u015fmazl\u0131klar\u0131nda Arabuluculuk Kanunu&#8217;na 7445 say\u0131l\u0131 Kanunla eklenen 18\/B maddesi uyar\u0131nca zorunlu arabuluculuk kapsam\u0131na al\u0131nm\u0131\u015f ve arabuluculu\u011fun dava \u015fart\u0131 oldu\u011fu d\u00fczenlenmi\u015ftir.<\/p>\n<p>O halde, arabuluculu\u011fun dava \u015fart\u0131 oldu\u011fu durumlarda dava \u015fart\u0131n\u0131n yerine geldi\u011finin kabul\u00fc i\u00e7in arabuluculu\u011fa hangi tarihte ba\u015fvurulmas\u0131 gerekti\u011fi de\u011ferlendirilmelidir.<\/p>\n<p>\u015e\u00f6yle ki;<\/p>\n<p>T\u00fcrk Bor\u00e7lar Kanunu&#8217;nun 350. maddesi uyar\u0131nca ihtiya\u00e7 nedeniyle tahliye davas\u0131n\u0131n belirli s\u00fcreli s\u00f6zle\u015fmelerde s\u00fcrenin sonunda bir ay i\u00e7inde a\u00e7\u0131lmas\u0131 gerekir. Dava a\u00e7ma s\u00fcresi kamu d\u00fczenindendir. Nitekim Yarg\u0131tay 6. Hukuk Dairesinin 2015\/8286 Esas, 2016\/3259 Karar say\u0131l\u0131 karar\u0131nda bu husus &#8220;Davan\u0131n y\u0131ldan y\u0131la uzayan kira s\u00f6zle\u015fmesinin s\u00fcre sonu olan (&#8230;) tarihinden sonra dava a\u00e7\u0131lmas\u0131 gerekirken s\u00fcre sonu beklenmeden erken dava a\u00e7\u0131lm\u0131\u015ft\u0131r. Dava a\u00e7ma s\u00fcresi kamu d\u00fczenine ili\u015fkin olup, daval\u0131 taraf\u0131ndan ileri s\u00fcr\u00fclmese bile mahkemece kendili\u011finden g\u00f6z \u00f6n\u00fcnde bulundurulmal\u0131d\u0131r. A\u00e7\u0131lan davan\u0131n s\u00fcresinden \u00f6nce a\u00e7\u0131lm\u0131\u015f olmas\u0131 nedeniyle davan\u0131n reddine karar verilmesi gerekirken mahkemece i\u015fin esas\u0131n\u0131n incelenerek kiralanan\u0131n tahliyesine karar verilmi\u015f olmas\u0131 do\u011fru de\u011fildir.&#8221; \u015feklinde a\u00e7\u0131klanm\u0131\u015ft\u0131r.<\/p>\n<p>\u00d6te yandan, 6325 say\u0131l\u0131 Hukuk Uyu\u015fmazl\u0131klar\u0131nda Arabuluculuk Kanunu&#8217;nun 18\/A maddesinin 15. bendinde &#8220;Arabuluculuk b\u00fcrosuna ba\u015fvurulmas\u0131ndan son tutana\u011f\u0131n d\u00fczenlendi\u011fi tarihe kadar ge\u00e7en s\u00fcrede zamana\u015f\u0131m\u0131 durur ve hak d\u00fc\u015f\u00fcr\u00fcc\u00fc s\u00fcre i\u015flemez.&#8221; d\u00fczenlemesine yer verilmi\u015ftir.<\/p>\n<p>Bu durumda ihtiya\u00e7 nedeniyle tahliye davas\u0131 a\u00e7mak isteyen kiraya verenin yeni d\u00f6nem ba\u015flad\u0131ktan sonra bir ay i\u00e7erisinde arabuluculuk b\u00fcrosuna ba\u015fvurmas\u0131 ve son tutana\u011f\u0131n d\u00fczenlenmesinden itibaren arabuluculuk b\u00fcrosuna ba\u015fvuru ile durmu\u015f olan dava s\u00fcresi kald\u0131\u011f\u0131 yerden devam edece\u011finden, bir ayl\u0131k dava s\u00fcresinden kalan s\u00fcre i\u00e7erisinde davas\u0131n\u0131 a\u00e7mas\u0131 gerekti\u011fi anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>Somut olayda ise kira s\u00f6zle\u015fmesinin tarihi 01.01.2020 tarihi oldu\u011funa g\u00f6re, yeni d\u00f6nem 01.01.2024 tarihinde ba\u015flayacakt\u0131r. Davac\u0131n\u0131n arabuluculuk b\u00fcrosuna ba\u015fvuru tarihinin 10.12.2023 tarihi oldu\u011fu ve anla\u015famama tutana\u011f\u0131n\u0131n da 27.12.2023 tarihinde d\u00fczenlendi\u011fi g\u00f6r\u00fclmektedir. Bu durumda arabuluculuk b\u00fcrosuna ba\u015fvuru tarihi dava a\u00e7ma s\u00fcresinin ba\u015flad\u0131\u011f\u0131 01.01.2024 tarihinden \u00f6ncedir.<\/p>\n<p>Dava a\u00e7ma s\u00fcresinin emredici hukuk kurallar\u0131na g\u00f6re d\u00fczenlendi\u011fi ve kamu d\u00fczeninden oldu\u011fu durumda dava a\u00e7ma s\u00fcresi ba\u015flamadan \u00f6nce arabuluculuk b\u00fcrosuna ba\u015fvurulmas\u0131 halinde usul\u00fcne uygun bir \u015fekilde arabuluculuk s\u00fcrecinin i\u015fletildi\u011fi ve zorunlu arabuluculuk dava \u015fart\u0131n\u0131n yerine geldi\u011fi s\u00f6ylenemez.<\/p>\n<p>Somut olayda; dava 08.01.2024 tarihinde a\u00e7\u0131lm\u0131\u015f olup, dava tarihi yeni d\u00f6nem ba\u015flang\u0131c\u0131ndan itibaren bir ay i\u00e7inde ise de, dava a\u00e7ma s\u00fcresi ba\u015flamadan arabuluculuk b\u00fcrosuna ba\u015fvuruldu\u011fundan, hen\u00fcz dava a\u00e7ma s\u00fcresi ba\u015flamadan yap\u0131lan ba\u015fvurunun dava \u015fart\u0131n\u0131 kar\u015f\u0131lamad\u0131\u011f\u0131 kabul edilmelidir.<\/p>\n<p>Buna g\u00f6re mahkemece usul\u00fcne uygun zorunlu arabuluculuk dava \u015fart\u0131 yerine gelmedi\u011finden davan\u0131n usulden reddine karar verilmesi gerekirken kabul\u00fcne karar verilmesi hatal\u0131 olmu\u015ftur. \u201d gerek\u00e7esiyle; ba\u015fvurunun kabul\u00fcne, \u0130lk Derece Mahkemesi Karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131na, yeniden davan\u0131n usulden reddine kesin olarak karar verilmi\u015ftir.<\/p>\n<p>B. \u0130stanbul B\u00f6lge Adliye Mahkemesi 55. Hukuk Dairesinin 27.03.2024 tarihli ve 2024\/1098 E., 2024\/847 K. say\u0131l\u0131 Karar\u0131<\/p>\n<p>\u0130stanbul Anadolu 26. Sulh Hukuk Mahkemesinin 31.01.2024 tarihli ve 2023\/1311 E., 2024\/219 K. say\u0131l\u0131 dosyas\u0131nda; davac\u0131 kiraya verenin, daval\u0131n\u0131n 15.09.2016 ba\u015flang\u0131\u00e7 tarihli ve 1 y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesi ile kirac\u0131 oldu\u011funu, 2020 y\u0131l\u0131nda kira s\u00f6zle\u015fmesinin yenilendi\u011fini, kiralanana k\u0131z\u0131n\u0131n evlenecek olmas\u0131 nedeniyle ihtiyac\u0131 nedeniyle oldu\u011funu, daval\u0131ya 17.07.2023 tarihli ihtarname ile konut ihtiyac\u0131 nedeniyle kiralanan\u0131n tahliye edilmesinin ihtar edildi\u011fini, arabuluculuk b\u00fcrosuna ba\u015fvurdu\u011fu halde uzla\u015fma sa\u011flanamad\u0131\u011f\u0131n\u0131 ileri s\u00fcrerek, ihtiya\u00e7 nedeniyle kiralanan\u0131n tahliyesine karar verilmesinin talep edildi\u011fi, \u0130lk Derece Mahkemesince; \u201cDavac\u0131n\u0131n ihtiya\u00e7 nedenine dayal\u0131 olarak, 15.09.2020 ba\u015flang\u0131\u00e7 tarihli bir y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesi ile dava konusu ta\u015f\u0131nmazda ikamet eden daval\u0131n\u0131n tahliyesi amac\u0131 ile 05.09.2023 tarihinde arabulucuya ba\u015fvurdu\u011fu, arabuluculuk s\u00fcrecinin 15.09.2023 tarihinde sona erdi\u011fi ve 25.09.2023 tarihinde tahliye davas\u0131 a\u00e7t\u0131\u011f\u0131 anla\u015f\u0131lsa da;<\/p>\n<p>Taraflar aras\u0131ndaki kira s\u00f6zle\u015fmesinin ba\u015flang\u0131\u00e7 tarihinin 15.09.2020 oldu\u011fu, TBK&#8217;n\u0131n 350. maddesine g\u00f6re ihtiya\u00e7 nedenli tahliye davalar\u0131n\u0131n kira d\u00f6nemi sonunu takip eden bir ay i\u00e7erisinde, yeni kira d\u00f6neminin ba\u015flang\u0131c\u0131n\u0131n en az bir ay \u00f6ncesinde ihtar edilmi\u015f olmas\u0131 halinde kira d\u00f6neminin sonuna kadar a\u00e7\u0131labilece\u011fi y\u00f6n\u00fcndeki d\u00fczenlemesi ve kira uyu\u015fmazl\u0131klar\u0131nda arabulucuya ba\u015fvurmay\u0131 dava \u015fart\u0131 olarak d\u00fczenleyen 6325 Say\u0131l\u0131 Kanunun &#8221;A\u015fa\u011f\u0131daki uyu\u015fmazl\u0131klarda, dava a\u00e7\u0131lmadan \u00f6nce arabulucuya ba\u015fvurulmu\u015f olmas\u0131 dava \u015fart\u0131d\u0131r..&#8221; \u015feklindeki 18\/B-(1) maddesi birlikte de\u011ferlendirildi\u011finde, davac\u0131n\u0131n dava a\u00e7ma hakk\u0131n\u0131n 16.09.2023 tarihinde do\u011fmu\u015f olaca\u011f\u0131, dava \u015fart\u0131 olan arabuluculu\u011fa da (do\u011fmam\u0131\u015f bir hakk\u0131n kullan\u0131lmas\u0131 s\u00f6z konusu olamayaca\u011f\u0131ndan) en erken bu tarihte ba\u015fvurabilece\u011fi anla\u015f\u0131lmakla, hen\u00fcz dava a\u00e7ma s\u00fcresi ba\u015flamadan (16.09.2023 tarihinden) \u00f6nce s\u00fcresinde olmayacak \u015fekilde 05.09.2023 tarihinde s\u00fcresi y\u00f6n\u00fcnden usuls\u00fcz yap\u0131lan arabuluculuk ba\u015fvurusunun, 6325 say\u0131l\u0131 Arabuluculuk Kanunun 18-B\/1 maddesi anlam\u0131nda arabuluculuk dava \u015fart\u0131n\u0131 ger\u00e7ekle\u015ftirdi\u011finin kabul\u00fc m\u00fcmk\u00fcn g\u00f6r\u00fclmeyerek\u201d gerek\u00e7esiyle davan\u0131n usulden reddine karar verildi\u011fi, davac\u0131n\u0131n istinaf yoluna ba\u015fvurmas\u0131 \u00fczerine \u0130stanbul B\u00f6lge Adliye Mahkemesi 55. Hukuk Dairesinin yukar\u0131da tarih ve say\u0131l\u0131 belirtilen karar\u0131yla; \u201cdavac\u0131n\u0131n, kiralan\u0131n tahliyesi istemiyle a\u00e7m\u0131\u015f oldu\u011fu davan\u0131n 6325 Say\u0131l\u0131 Hukuk Uyu\u015fmazl\u0131klar\u0131nda Arabuluculuk Kanunu&#8217;na 7445 say\u0131l\u0131 Kanunla eklenen 18\/B maddesine g\u00f6re zorunlu arabuluculu\u011fa tabi davalardan oldu\u011fu, davan\u0131n kanunun y\u00fcr\u00fcrl\u00fck tarihi olan 01.09.2023&#8217;den sonra a\u00e7\u0131lmas\u0131 nedeniyle anla\u015fmaya var\u0131lamad\u0131\u011f\u0131na ili\u015fkin son tutana\u011f\u0131n asl\u0131n\u0131n veya arabulucu taraf\u0131ndan onaylanm\u0131\u015f bir \u00f6rne\u011finin dava dilek\u00e7esine eklenmesi gerekti\u011fi, davac\u0131n\u0131n dava dilek\u00e7esine anla\u015fmaya var\u0131lamad\u0131\u011f\u0131na ili\u015fkin son tutana\u011f\u0131 dava a\u00e7arken ekledi\u011fi, 6325 Say\u0131l\u0131 Hukuk Uyu\u015fmazl\u0131klar\u0131nda Arabuluculuk Kanunu&#8217;na g\u00f6re, dava a\u00e7\u0131lmadan \u00f6nce arabulucuya ba\u015fvurulmu\u015f olmas\u0131n\u0131n dava \u015fart\u0131 haline getirildi\u011fi, kanunda, dava a\u00e7ma hakk\u0131 do\u011fduktan sonra ve dava a\u00e7ma s\u00fcresi i\u00e7erisinde arabuluculu\u011fa ba\u015fvurulaca\u011f\u0131na ili\u015fkin herhangi bir ibarenin bulunmad\u0131\u011f\u0131, mahkemece i\u015fin esas\u0131na girilerek bir karar verilmesi gerekirken, yaz\u0131l\u0131 oldu\u011fu \u015fekilde davan\u0131n usulden reddine karar verilmesinin hatal\u0131 oldu\u011fu, istinaf sebeplerinin yerinde oldu\u011fu&#8217;\u201d gerek\u00e7esiyle; ba\u015fvurunun kabul\u00fcne, \u0130lk Derece Mahkemesi karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131na, yarg\u0131laman\u0131n eksikler tamamlanarak devam\u0131 i\u00e7in dosyan\u0131n \u0130lk Derece Mahkemesine iadesine, kesin olarak karar verilmi\u015ftir.<\/p>\n<p>IV. DE\u011eERLEND\u0130RME VE GEREK\u00c7E<\/p>\n<p>B\u00f6lge Adliye Mahkemesi Hukuk Dairelerinin yukar\u0131da a\u00e7\u0131klanan kesin nitelikteki kararlar\u0131 aras\u0131ndaki uyu\u015fmazl\u0131k; 6098 say\u0131l\u0131 Kanunun 350. maddesi uyar\u0131nca a\u00e7\u0131lan tahliye davalar\u0131nda, dava \u015fart\u0131 olan arabuluculuk ba\u015fvurusunun, davan\u0131n a\u00e7\u0131lmas\u0131 i\u00e7in kanunda \u00f6ng\u00f6r\u00fclen s\u00fcreden \u00f6nce yap\u0131l\u0131p yap\u0131lamayaca\u011f\u0131 noktas\u0131nda toplanmaktad\u0131r.<\/p>\n<p>6098 say\u0131l\u0131 Kanun\u2019un 350. maddesinde; \u201c Kiraya veren, kira s\u00f6zle\u015fmesini;<\/p>\n<p>1. Kiralanan\u0131 kendisi, e\u015fi, altsoyu, \u00fcstsoyu veya kanun gere\u011fi bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu di\u011fer ki\u015filer i\u00e7in konut ya da i\u015fyeri gereksinimi sebebiyle kullanma zorunlulu\u011fu varsa,<\/p>\n<p>2. Kiralanan\u0131n yeniden in\u015fas\u0131 veya imar\u0131 amac\u0131yla esasl\u0131 onar\u0131m\u0131, geni\u015fletilmesi ya da de\u011fi\u015ftirilmesi gerekli ve bu i\u015fler s\u0131ras\u0131nda kiralanan\u0131n kullan\u0131m\u0131 imk\u00e2ns\u0131z ise, belirli s\u00fcreli s\u00f6zle\u015fmelerde s\u00fcrenin sonunda, belirsiz s\u00fcreli s\u00f6zle\u015fmelerde kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine ve fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten ba\u015flayarak bir ay i\u00e7inde a\u00e7aca\u011f\u0131 dava ile sona erdirebilir.\u201d ;<br \/>\n353. maddesinde; \u201cKiraya veren, en ge\u00e7 davan\u0131n a\u00e7\u0131lmas\u0131 i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrede dava a\u00e7aca\u011f\u0131n\u0131 kirac\u0131ya yaz\u0131l\u0131 olarak bildirmi\u015fse, dava a\u00e7ma s\u00fcresi bir kira y\u0131l\u0131 i\u00e7in uzam\u0131\u015f say\u0131l\u0131r.\u201d;<\/p>\n<p>6235 say\u0131l\u0131 Hukuk Uyu\u015fmazl\u0131klar\u0131nda Arabuluculuk Kanunu\u2019nun (6235 say\u0131l\u0131 Kanun) \u201cdava \u015fart\u0131 olarak arabulucuk\u201d ba\u015fl\u0131kl\u0131 18\/A maddesinin 2. bendinde; \u201cDavac\u0131, arabuluculuk faaliyeti sonunda anla\u015fmaya var\u0131lamad\u0131\u011f\u0131na ili\u015fkin son tutana\u011f\u0131n asl\u0131n\u0131 veya arabulucu taraf\u0131ndan onaylanm\u0131\u015f bir \u00f6rne\u011fini dava dilek\u00e7esine eklemek zorundad\u0131r. Bu zorunlulu\u011fa uyulmamas\u0131 h\u00e2linde mahkemece davac\u0131ya, son tutana\u011f\u0131n bir haftal\u0131k kesin s\u00fcre i\u00e7inde mahkemeye sunulmas\u0131 gerekti\u011fi, aksi takdirde davan\u0131n usulden reddedilece\u011fi ihtar\u0131n\u0131 i\u00e7eren davetiye g\u00f6nderilir. \u0130htar\u0131n gere\u011fi yerine getirilmez ise dava dilek\u00e7esi kar\u015f\u0131 tarafa tebli\u011fe \u00e7\u0131kar\u0131lmaks\u0131z\u0131n davan\u0131n usulden reddine karar verilir. Arabulucuya ba\u015fvurulmadan dava a\u00e7\u0131ld\u0131\u011f\u0131n\u0131n anla\u015f\u0131lmas\u0131 h\u00e2linde herhangi bir i\u015flem yap\u0131lmaks\u0131z\u0131n davan\u0131n, dava \u015fart\u0131 yoklu\u011fu sebebiyle usulden reddine karar verilir. \u201d;<br \/>\n01.09.2023 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe giren ayn\u0131 Kanunun 18\/B maddesinde; \u201c(1) A\u015fa\u011f\u0131daki uyu\u015fmazl\u0131klarda, dava a\u00e7\u0131lmadan \u00f6nce arabulucuya ba\u015fvurulmu\u015f olmas\u0131 dava \u015fart\u0131d\u0131r:<\/p>\n<p>a) Kiralanan ta\u015f\u0131nmazlar\u0131n 2004 say\u0131l\u0131 Kanuna g\u00f6re ilams\u0131z icra yoluyla tahliyesine ili\u015fkin h\u00fck\u00fcmler hari\u00e7 olmak \u00fczere, kira ili\u015fkisinden kaynaklanan uyu\u015fmazl\u0131klar. \u201d d\u00fczenlemeleri yer almaktad\u0131r.<\/p>\n<p>Kira s\u00f6zle\u015fmesi, kiraya verenin bir \u015feyin kullan\u0131lmas\u0131n\u0131 veya kullan\u0131lmas\u0131yla birlikte ondan yararlan\u0131lmas\u0131n\u0131 kirac\u0131ya b\u0131rakmay\u0131, kirac\u0131n\u0131n da buna kar\u015f\u0131l\u0131k kararla\u015ft\u0131r\u0131lan kira bedelini \u00f6demeyi \u00fcstlendi\u011fi s\u00f6zle\u015fmedir. Kira s\u00f6zle\u015fmeleri s\u00fcrekli bor\u00e7 do\u011furan s\u00f6zle\u015fmelerden olup, 6098 say\u0131l\u0131 Kanunda; adi kira, konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131 ve \u00fcr\u00fcn kiras\u0131 olarak \u00fc\u00e7 b\u00f6l\u00fcm halinde d\u00fczenlemi\u015ftir. Genel olarak kanuni d\u00fczenlemelerde, kira t\u00fcrlerine g\u00f6re farkl\u0131l\u0131k g\u00f6stermekle beraber kirac\u0131 zay\u0131f taraf kabul edilerek kiraya veren kar\u015f\u0131s\u0131nda korunmu\u015ftur. Kirac\u0131n\u0131n en \u00e7ok korundu\u011fu (\u00f6zellikle kira bedelindeki art\u0131\u015f\u0131n kat\u0131 kurallara ba\u011flan\u0131p tahliyenin g\u00fc\u00e7le\u015ftirildi\u011fi) kira t\u00fcr\u00fc, konut ve \u00e7at\u0131l\u0131 i\u015f yeri kiralar\u0131d\u0131r.<\/p>\n<p>Belirli s\u00fcreli kira s\u00f6zle\u015fmelerinden kaynaklanan ihtiya\u00e7 nedeniyle tahliye davalar\u0131nda, 6098 say\u0131l\u0131 Kanunun 350. maddesi uyar\u0131nca, kira s\u00f6zle\u015fmesinin sona ermesinden itibaren bir ay i\u00e7inde dava a\u00e7\u0131lmas\u0131 gerekir. Kanunun 353. maddesi uyar\u0131nca; kiraya veren, daha \u00f6nce veya en ge\u00e7 davan\u0131n a\u00e7\u0131lmas\u0131 i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrede dava a\u00e7aca\u011f\u0131n\u0131 kirac\u0131ya yaz\u0131l\u0131 olarak bildirmi\u015fse, davan\u0131n bildirimi takip eden uzayan bir kira y\u0131l\u0131 sonuna kadar a\u00e7\u0131lmas\u0131 gerekir. Dava a\u00e7ma s\u00fcresi kamu d\u00fczenine ili\u015fkin olup, daval\u0131 ileri s\u00fcrmese bile mahkemece kendili\u011finden g\u00f6z \u00f6n\u00fcnde bulundurulur. S\u00fcresinden \u00f6nce dava a\u00e7\u0131ld\u0131\u011f\u0131nda, a\u00e7\u0131lan davan\u0131n s\u00fcresinden \u00f6nce a\u00e7\u0131lm\u0131\u015f olmas\u0131 nedeniyle zamans\u0131z a\u00e7\u0131lan davan\u0131n reddine karar verilmesi gerekir.<\/p>\n<p>Kira ili\u015fkisinden kaynaklanan uyu\u015fmazl\u0131klarda, 01.09.2023 tarihinden itibaren zorunlu (dava \u015fart\u0131) arabuluculuk y\u00f6ntemi ge\u00e7erlidir. 6325 say\u0131l\u0131 kanun 18\/A maddesine g\u00f6re zorunlu arabuluculu\u011fa ba\u015fvuru, uyu\u015fmazl\u0131k ortaya \u00e7\u0131kt\u0131ktan sonra mahkemeler nezdinde dava a\u00e7\u0131lmadan \u00f6nce kanuni bir \u00f6n ko\u015ful olarak aranan dava \u015fart\u0131d\u0131r. Tahliye davalar\u0131 da kira ili\u015fkisinden do\u011fmakla, arabuluculu\u011fa ba\u015fvuru dava \u015fart\u0131 olup, dava a\u00e7\u0131lmazdan \u00f6nce zorunlu arabuluculuk yoluna ba\u015fvurulmad\u0131\u011f\u0131nda dava \u015fart\u0131n\u0131n mevcut olmamas\u0131 nedeniyle davan\u0131n usulden reddine karar verilmelidir.<\/p>\n<p>6325 say\u0131l\u0131 Kanunun 1. maddesinde, arabuluculu\u011fun hukuk uyu\u015fmazl\u0131klar\u0131n\u0131n \u00e7\u00f6z\u00fcm\u00fcnde uygulanacak bir \u00e7\u00f6z\u00fcm yolu oldu\u011fu h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Bu nedenle arabuluculu\u011fa ba\u015fvuru i\u00e7in \u00f6ncelikle taraflar aras\u0131nda bir hukuk uyu\u015fmazl\u0131\u011f\u0131n\u0131n varl\u0131\u011f\u0131, arabuluculu\u011fun bir \u00f6n ko\u015fuludur. Burada s\u00f6z\u00fc edilen uyu\u015fmazl\u0131ktan anla\u015f\u0131lmas\u0131 gereken, 6325 say\u0131l\u0131 Kanunun 1.maddesinin ikinci f\u0131kras\u0131nda da ifade edildi\u011fi \u00fczere, taraflar\u0131n \u00fczerinde serbest\u00e7e tasarruf edebilecekleri i\u015f veya i\u015flemlerden do\u011fan \u00f6zel hukuk uyu\u015fmazl\u0131klar\u0131d\u0131r.<\/p>\n<p>Taraflar aras\u0131nda uyu\u015fmazl\u0131k \u00e7\u0131kt\u0131\u011f\u0131ndan s\u00f6z edilebilmesi i\u00e7in; taraflardan birinin di\u011fer tarafa kar\u015f\u0131 bir hak iddias\u0131nda bulunmas\u0131, bunu ileri s\u00fcrmesi; ancak kar\u015f\u0131 taraf\u0131n bu iddia ve talebi kabul etmemesi sonucunda kendi aralar\u0131nda anla\u015famam\u0131\u015f olmalar\u0131 gerekir. Taraflar aras\u0131nda hen\u00fcz bir uyu\u015fmazl\u0131k bulunmad\u0131\u011f\u0131 veya uyu\u015fmazl\u0131k \u00e7\u0131kar\u0131lamayacak olan bir d\u00f6nemde sanki taraflar\u0131n aras\u0131nda uyu\u015fmazl\u0131k varm\u0131\u015f gibi dava \u015fart\u0131 arabuluculu\u011fa ba\u015fvuru yap\u0131larak anla\u015fmamaya ili\u015fkin son tutanak d\u00fczenletilmesi bu arabuluculuk ba\u015fvurusunu \u00fc\u00e7\u00fcnc\u00fc ki\u015filer nezdinde m\u00fcracaat edilmesi gereken formalite niteli\u011finde olan bir davran\u0131\u015f haline getirir. G\u00fcn\u00fcm\u00fczde dava \u015fart\u0131 arabuluculuk masraflar\u0131n\u0131n Adalet Bakanl\u0131\u011f\u0131 B\u00fct\u00e7esinden kar\u015f\u0131lan\u0131yor olmas\u0131 kar\u015f\u0131s\u0131nda hen\u00fcz uyu\u015fmazl\u0131\u011f\u0131n \u00e7\u0131kmad\u0131\u011f\u0131 bir d\u00f6nemde formaliteden yap\u0131lacak bir dava \u015fart\u0131 arabuluculu\u011fa ba\u015fvuru devlet b\u00fct\u00e7esine y\u00fcklenen haks\u0131z bir harcama kalemini olu\u015fturacakt\u0131r.<\/p>\n<p>Konut ve \u00e7at\u0131l\u0131 i\u015f yeri kiralar\u0131 bak\u0131m\u0131ndan kirac\u0131 korunarak TBK &#8216;nun 354. maddesinde dava yolu ile kira s\u00f6zle\u015fmesinin sona erdirilmesine ili\u015fkin h\u00fck\u00fcmlerin kirac\u0131 aleyhine de\u011fi\u015ftirilemeyece\u011fi belirtilmi\u015ftir. Kiraya verenin kirac\u0131s\u0131ndan ihtiya\u00e7 (gereksinim) sebebiyle kiralanan\u0131 ne zaman tahliyesini isteyebilece\u011fi ilgili h\u00fck\u00fcmde belirtildi\u011fi halde bu s\u00fcrelere riayet edilmeksizin \u00e7ok \u00f6ncesinde s\u0131rf ileride kira s\u00fcresinin bitiminden sonra kirac\u0131n\u0131n kiralanan\u0131 tahliye etmeme ihtimaline binaen, bu talebin kabul edilmeyece\u011fi pe\u015fin fikriyle tahliye konusunda uyu\u015fmazl\u0131k varm\u0131\u015f gibi hareket edilip zaman\u0131ndan \u00f6nce ba\u015flat\u0131lan zorunlu arabuluculuk faaliyeti sonunda d\u00fczenlenen anla\u015fmamaya ili\u015fkin son tutanak ve anla\u015fmama belgesi ilgili kanun kapsam\u0131nda olan ge\u00e7erli bir dava \u015fart\u0131 arabuluculuk faaliyeti sonunda d\u00fczenlendi\u011fi kabul edilemez.<\/p>\n<p>\u00d6te yandan, 6098 say\u0131l\u0131 Kanun 350\/son maddesine g\u00f6re belirli s\u00fcreli konut ve \u00e7at\u0131l\u0131 i\u015f yeri kira s\u00f6zle\u015fmelerinde ihtiya\u00e7 (gereksinim) sebebiyle tahliye davalar\u0131n\u0131n, s\u00f6zle\u015fme s\u00fcresinin sonunda, belirsiz s\u00fcreli s\u00f6zle\u015fmelerde ise kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine ve fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten ba\u015flayarak a\u00e7\u0131labilece\u011fi emredici \u015fekilde d\u00fczenlenmi\u015f olup, bu husus kamu d\u00fczenine ili\u015fkindir. Belirli s\u00fcreli kira s\u00f6zle\u015fmelerinde, s\u00f6zle\u015fme s\u00fcresi sona ermeden, belirsiz s\u00fcreli s\u00f6zle\u015fmelerde ise kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine ve fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten \u00f6nce kiraya veren kirac\u0131dan dava yolu ile ihtiya\u00e7 nedeniyle tahliye isteminde bulunulamayaca\u011f\u0131 halde bu s\u00fcreler \u00f6ncesinde a\u00e7\u0131lacak bir dava, s\u00fcresinde a\u00e7\u0131lm\u0131\u015f bir dava olarak kabul edilmeyece\u011fine g\u00f6re, dava \u015fart\u0131 olarak arabuluculu\u011fa ba\u015fvuruda bulunabilmek i\u00e7in de \u00f6ncelikle uyu\u015fmazl\u0131\u011f\u0131n do\u011fmas\u0131, yani kira s\u00f6zle\u015fmesinin s\u00fcresinin sona ermesi ve kiraya verenin tahliye davas\u0131 yolu ile tahliye isteminde bulunma hakk\u0131n\u0131n do\u011fmas\u0131 gerekir. Aksi takdirde hen\u00fcz tahliye davas\u0131 a\u00e7ma hakk\u0131 bulunmayan kiraya verenin kira s\u00fcresinin sona ermesinden \u00e7ok \u00f6ncesinde dava \u015fart\u0131 arabuluculuk ba\u015fvurusunda bulundu\u011fu durumda bu ba\u015fvuru tarihi itibariyle \u015fartlar\u0131na g\u00f6re tahliye etmeyi kabul etmeyen kirac\u0131n\u0131n anla\u015fmamaya ili\u015fkin son tutana\u011f\u0131n d\u00fczenlenmesi sonras\u0131nda s\u00fcrenin sona ermesine kadar aradan ge\u00e7en s\u00fcrede \u015fartlar\u0131n\u0131n de\u011fi\u015fmesiyle s\u00fcre bitimi itibariyle tahliyeyi ger\u00e7ekle\u015ftirdi\u011finde dava a\u00e7ma hakk\u0131 do\u011fmadan erken yap\u0131lan ve olumsuz olarak neticelenen dava \u015fart\u0131 arabuluculuk faaliyeti i\u015flevsiz hale gelecektir. Kiraya verenin tahliye davas\u0131 a\u00e7ma hakk\u0131n\u0131n do\u011fdu\u011fu andan itibaren arabuluculu\u011fa ba\u015fvurusu ile arabuluculukta ge\u00e7en s\u00fcre bak\u0131m\u0131ndan dava a\u00e7ma hakk\u0131n\u0131n kullan\u0131m s\u00fcresi bak\u0131m\u0131ndan bir kayb\u0131 olmayacakt\u0131r zira dava \u015fart\u0131 arabuluculu\u011fa ba\u015fvuru ile son anla\u015fmama tutana\u011f\u0131n\u0131n d\u00fczenlenmesine kadarki ge\u00e7en s\u00fcre 6325 say\u0131l\u0131 kanunun 16\/2 maddesi uyar\u0131nca zamana\u015f\u0131m\u0131 ve hak d\u00fc\u015f\u00fcr\u00fcc\u00fc s\u00fcrelerin hesaplanmas\u0131nda dikkate al\u0131nmaz.<\/p>\n<p>Bu durumda, 6098 say\u0131l\u0131 Kanunun 350. maddesi uyar\u0131nca a\u00e7\u0131lacak olan ihtiya\u00e7 nedeniyle tahliye davalar\u0131n\u0131n belirli s\u00fcreli kira s\u00f6zle\u015fmelerinde s\u00fcrenin sonunda , belirsiz s\u00fcreli s\u00f6zle\u015fmelerde ise kiraya ili\u015fkin genel h\u00fck\u00fcmlere g\u00f6re fesih d\u00f6nemine ve fesih bildirimi i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrelere uyularak belirlenecek tarihten ba\u015flayarak a\u00e7\u0131labilece\u011fine g\u00f6re; dava \u015fart\u0131 olan zorunlu arabuluculuk ba\u015fvurusunda, tahliye davas\u0131 a\u00e7ma hakk\u0131n\u0131n do\u011fumundan sonra yap\u0131lmas\u0131 gerekir.
