Bunlar be\u015fer olman\u0131n do\u011fal neticeleridir. Ancak insan olmak yani be\u015fer\u00ee ar\u0131zalar\u0131 a\u015farak \u2013ki bunlar a\u2019razd\u0131r, cevher de\u011fildir- hukukun ahlak-etik kar\u015f\u0131s\u0131ndaki durumunu tahlil edebilmeyi gerektirir. Jijek vb d\u00fc\u015f\u00fcn\u00fcrler gibi bir \u015feyleri \u201cbo\u015f g\u00f6steren\u201d olarak kabul edip kendi zihnimde bir d\u00fcnya tasarlayarak protest tak\u0131lmak ve oradan oraya savrulmak benim yap\u0131ma hi\u00e7bir zaman uygun d\u00fc\u015fmedi. Ancak bir \u015fey if\u015fa edilecekse o da ahlak ile olan en gerilimli ili\u015fkiyi hukukun ya\u015fad\u0131\u011f\u0131 ve bu konuda da temellerinin sars\u0131ld\u0131\u011f\u0131 ger\u00e7e\u011fidir.[iv] Elbette hukukun ya\u015fad\u0131\u011f\u0131 gerilim sadece ahlak ile ilgili de\u011fildir ve bir\u00e7ok reel problemi her g\u00fcn teorik ve pratik planda deneyimliyor, \u00e7\u00f6z\u00fcml\u00fcyor ve \u00e7\u00f6zmeye \u00e7al\u0131\u015f\u0131yoruz. Fakat esas meselemiz teorinin de prati\u011fin de hem arkas\u0131nda hem de yan\u0131 ba\u015f\u0131nda duran insan y\u00fcz\u00fcd\u00fcr.<\/p>\n<p>Biz ahlak\u0131 da ve buradan hareketle hukuku da g\u00fczelli\u011fin-cemalin aynas\u0131 insan y\u00fcz\u00fcnden yola \u00e7\u0131karak in\u015fa ederiz ve bunu bilmeyenlerin b\u00ee-basar yani g\u00f6rmekten yoksun oldu\u011funu s\u00f6ylemekle i\u015fe ba\u015flar\u0131z.<\/p>\n<p>Vech-i \u00e2demde cem\u00e2l-i y\u00e2ri seyr\u00e2n itmeyen <\/p>\n<p>Bi-basard\u0131r halik\u00fc&#8217;l-insan\u0131 bilmez kandedir<\/p>\n<p>Ba\u011fdatl\u0131 R\u00fbh\u00ee[v]<\/p>\n<p>Hukuku, yaln\u0131zca kanun maddelerinde, mahkeme salonlar\u0131nda ya da b\u00fcy\u00fck binalar\u0131n mermer duvarlar\u0131nda aramak kolayd\u0131r. Ama hukuk, belki de en sahici haliyle, bir insan\u0131n y\u00fcz\u00fcnde ba\u015flar. Levinas\u2019a g\u00f6re \u201cba\u015fkas\u0131n\u0131n y\u00fcz\u00fc\u201d bizden bir talep i\u00e7erir; bu talep, herhangi bir kanunun, herhangi bir y\u00f6netmeli\u011fin \u00fcst\u00fcnde ve \u00f6tesindedir. Yasa \u00f6n\u00fcnde e\u015fitlik, bir metin maddesi de\u011fil; ba\u015fkas\u0131n\u0131n g\u00f6z\u00fcndeki bu savunmas\u0131zl\u0131\u011f\u0131 kabul etme iradesidir.<\/p>\n<p>Bug\u00fcn hukuk, \u00e7o\u011fu zaman anonimle\u015ftirir; bizi kategorilere, soyut ki\u015filiklere, \u201cdavac\u0131\u201d, \u201csan\u0131k\u201d, \u201cm\u00fc\u015fteki\u201d, \u201c\u015f\u00fcpheli\u201d gibi teknik s\u0131fatlara indirger. Oysa hukuk, tam da bu soyutlu\u011fu a\u015fabilirse anlaml\u0131 olur.<\/p>\n<p>Bir Y\u00fczle\u015fme ve Bir Ayna Olarak Hukuk<\/p>\n<p>Modern hukuk sistemleri, \u00e7o\u011funlukla kurallara odaklan\u0131r: Kim ne yapm\u0131\u015f, hangi h\u00fck\u00fcm uygulanmal\u0131, hangi yapt\u0131r\u0131m \u00f6ng\u00f6r\u00fclmeli\u2026 Bu d\u00fczenin elbette k\u0131ymeti b\u00fcy\u00fck. \u00c7\u00fcnk\u00fc toplum d\u00fczeni, \u00f6ng\u00f6r\u00fclebilirlik ve g\u00fcven olmadan ayakta duramaz.<\/p>\n<p>Ancak, Levinas\u2019\u0131n \u201cba\u015fkas\u0131\u201d kavram\u0131yla birlikte d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fcm\u00fczde, hukukun sadece bir normlar b\u00fct\u00fcn\u00fc olmad\u0131\u011f\u0131n\u0131, ayn\u0131 zamanda bir y\u00fczle\u015fme prati\u011fi oldu\u011funu fark ederiz. Bir annenin g\u00f6zya\u015f\u0131nda, bir \u00e7ocu\u011fun korkulu bak\u0131\u015f\u0131nda, bir i\u015f\u00e7inin nas\u0131rl\u0131 ellerinde hukukun esas y\u00fcz\u00fc yatar.<\/p>\n<p>Ba\u015fkas\u0131n\u0131n y\u00fcz\u00fcyle kar\u015f\u0131la\u015fmak, ayn\u0131 zamanda insan olman\u0131n en temel y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc kabul etmektir: Sorumluluk. Hukuk, bu y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc d\u00fczenler, toplumsalla\u015ft\u0131r\u0131r ve korur.<\/p>\n<p>Levinas der ki: \u201cBa\u015fkas\u0131yla y\u00fcz y\u00fcze geldi\u011fimde, ona kar\u015f\u0131 sonsuz bir sorumluluk ta\u015f\u0131r\u0131m.\u201dBir hukuk\u00e7u, bir yarg\u0131\u00e7, bir savc\u0131, bir avukat\u2026 Hepsi bu sorumlulu\u011fun kurumsal temsilcileridir. Devletin kudreti, kanunlar\u0131n sa\u011flaml\u0131\u011f\u0131 kadar, o kanunlar\u0131n insan y\u00fcz\u00fcne nas\u0131l bakt\u0131\u011f\u0131yla da \u00f6l\u00e7\u00fcl\u00fcr. Bir hukuk devleti, yaln\u0131zca kanunlar b\u00fct\u00fcn\u00fc de\u011fildir. O, ayn\u0131 zamanda insan onuruna g\u00f6sterilen sayg\u0131n\u0131n, toplumsal bar\u0131\u015f\u0131n, bireysel haklar\u0131n ve ba\u015fkalar\u0131n\u0131n y\u00fcz\u00fcne duyulan derin sayg\u0131n\u0131n somut ifadesidir.<\/p>\n<p>Hukuku ya\u015fatmak, \u201cadalet vard\u0131r\u201d diyebilmek i\u00e7in kanunlar kadar vicdana da ihtiya\u00e7 vard\u0131r. Levinas\u2019\u0131n ifadesiyle: \u201cEtik, hukukun ba\u015flang\u0131\u00e7 noktas\u0131d\u0131r.\u201d Yani adaletin in\u015fas\u0131, \u00f6nce bir insan\u0131n g\u00f6zlerine bakmay\u0131 \u00f6\u011frenmekle ba\u015flar.<\/p>\n<p>Kutlamak m\u0131? Yoksa Hat\u0131rlamak m\u0131?<\/p>\n<p>Bug\u00fcn D\u00fcnya Hukuk G\u00fcn\u00fc. \u00c7o\u011fu zaman kutlamalar, t\u00f6renler, mesajlar\u2026<\/p>\n<p>Fakat belki de as\u0131l yapmam\u0131z gereken, hukuku hat\u0131rlamak; onun ne i\u00e7in var oldu\u011funu, kimi korudu\u011funu, kimi y\u00fcceltti\u011fini ve kimi susturdu\u011funu d\u00fc\u015f\u00fcnmek.<\/p>\n<p>Hukuk, bazen bir kalkan, bazen bir ayna, bazen bir hesap sorma arac\u0131d\u0131r.
