Asliye Hukuk Mahkemesi<\/p>\n<p>\u0130T\u0130RAZIN KONUSU: 3\/11\/1980 tarihli ve 2330 say\u0131l\u0131 Nakdi Tazminat ve Ayl\u0131k Ba\u011flanmas\u0131 Hakk\u0131nda Kanun\u2019un 3. maddesinin Anayasa\u2019n\u0131n 5., 17., 35., 36. ve 40. maddelerine ayk\u0131r\u0131l\u0131\u011f\u0131 ileri s\u00fcr\u00fclerek iptaline karar verilmesi talebidir.<\/p>\n<p>OLAY: 2330 say\u0131l\u0131 Kanun h\u00fck\u00fcmlerince \u00f6denen nakd\u00ee tazminat\u0131n sorumlular\u0131ndan r\u00fccuen tahsili i\u00e7in a\u00e7\u0131lan davada itiraz konusu kural\u0131n Anayasa\u2019ya ayk\u0131r\u0131 oldu\u011fu kan\u0131s\u0131na varan Mahkeme, iptali i\u00e7in ba\u015fvurmu\u015ftur.<\/p>\n<p>I. \u0130PTAL\u0130 \u0130STENEN VE \u0130LG\u0130L\u0130 G\u00d6R\u00dcLEN KANUN H\u00dcK\u00dcMLER\u0130<\/p>\n<p>A. \u0130ptali \u0130stenen Kanun H\u00fckm\u00fc<\/p>\n<p>Kanun\u2019un itiraz konusu 3. maddesi \u015f\u00f6yledir:<\/p>\n<p> \u201cNakdi tazminat<\/p>\n<p>Madde 3 \u2013 Bu kanun kapsam\u0131na girenlerden;<\/p>\n<p>a) (De\u011fi\u015fik: 1\/4\/1998 &#8211; 4356\/1 Md.) \u00d6lenlerin kanuni miras\u00e7\u0131lar\u0131na, en y\u00fcksek Devlet Memuru br\u00fct ayl\u0131\u011f\u0131n\u0131n (Ek g\u00f6sterge dahil) 100 kat\u0131 tutar\u0131nda,<\/p>\n<p>b) (De\u011fi\u015fik: 1\/4\/1998 &#8211; 4356\/1 md.) Ya\u015famak i\u00e7in gerekli hareketleri yapmaktan aciz ve hayat\u0131n\u0131 ba\u015fkas\u0131n\u0131n yard\u0131m ve deste\u011fi ile s\u00fcrd\u00fcrebilecek \u015fekilde mal\u00fcl olanlara 200 kat\u0131, di\u011fer engelli h\u00e2le gelenlere (a) bendinde belirtilen tutar\u0131n % 25&#8217;inden % 75&#8217;ine kadar, yaralananlara ise % 20&#8217;sini ge\u00e7memek \u00fczere engellilik ve yaralanma derecesine g\u00f6re,<\/p>\n<p>Nakdi tazminat \u00f6denir.<\/p>\n<p>Bu nakdi tazminat\u0131n tespitine esas tutulacak ayl\u0131k; tazminat verilmesine dair karar tarihindeki en y\u00fcksek Devlet memuru ayl\u0131\u011f\u0131n\u0131n (Ek g\u00f6sterge dahil) br\u00fct tutar\u0131d\u0131r.<\/p>\n<p>c) (a) bendi esaslar\u0131na g\u00f6re tespit edilen nakdi tazminat\u0131n kanuni miras\u00e7\u0131lara intikalinde; \u00f6lenin e\u015f ve f\u00fcruu veya yaln\u0131zca f\u00fcruu ile i\u00e7tima eden ve \u00f6l\u00fcm tarihinde sa\u011f olan ana ve babas\u0131n\u0131n her birine ayr\u0131 ayr\u0131 olmak \u00fczere % 15 tutar\u0131ndaki k\u0131sm\u0131 verildikten sonra kalan\u0131 i\u00e7tima eden di\u011fer miras\u00e7\u0131lara \u00f6denir. Di\u011fer hallerde miras h\u00fck\u00fcmleri uygulan\u0131r. Ancak ana veya babaya verilen tazminat \u00e7ocuklar\u0131n her birine \u00f6denen tazminattan fazla olamaz.<\/p>\n<p>d) (Ek: 7\/6\/1990 &#8211; 3658\/2 md.) Kesin raporun al\u0131nmas\u0131n\u0131n uzayaca\u011f\u0131n\u0131n anla\u015f\u0131lmas\u0131 halinde tazminat\u0131n \u00f6denme us\u00fcllerine g\u00f6re, olay tarihi itibariyle, (b) bendine g\u00f6re hesaplanacak miktar\u0131n asgari oran\u0131 \u00fczerinden avans \u00f6denir.<\/p>\n<p>Ola\u011fan\u00fcst\u00fc halin devam etti\u011fi s\u00fcre i\u00e7inde, bu maddede yer alan nakdi tazminat miktarlar\u0131n\u0131n yar\u0131ya kadar indirilmesine veya nakdi tazminata ili\u015fkin h\u00fck\u00fcmlerin uygulanmamas\u0131na Cumhurba\u015fkan\u0131 yetkilidir.\u201d<\/p>\n<p>B. \u0130lgili G\u00f6r\u00fclen Kanun H\u00fck\u00fcmleri<\/p>\n<p>11\/1\/2011 tarihli ve 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu\u2019nun;<\/p>\n<p>1. 73. maddesi \u015f\u00f6yledir:<\/p>\n<p> \u201cII. R\u00fccu isteminde<\/p>\n<p>MADDE 73- R\u00fccu istemi, tazminat\u0131n tamam\u0131n\u0131n \u00f6dendi\u011fi ve birlikte sorumlu ki\u015finin \u00f6\u011frenildi\u011fi tarihten ba\u015flayarak iki y\u0131l\u0131n ve her h\u00e2lde tazminat\u0131n tamam\u0131n\u0131n \u00f6dendi\u011fi tarihten ba\u015flayarak on y\u0131l\u0131n ge\u00e7mesiyle zamana\u015f\u0131m\u0131na u\u011frar.<\/p>\n<p>Tazminat\u0131n \u00f6denmesi kendisinden istenilen ki\u015fi, durumu birlikte sorumlu oldu\u011fu ki\u015filere bildirmek zorundad\u0131r. Aksi takdirde zamana\u015f\u0131m\u0131, bu bildirimin d\u00fcr\u00fcstl\u00fck kurallar\u0131na g\u00f6re yap\u0131labilece\u011fi tarihte i\u015flemeye ba\u015flar.\u201d<\/p>\n<p>2. 146. maddesi \u015f\u00f6yledir:<\/p>\n<p> \u201cI. On y\u0131ll\u0131k zamana\u015f\u0131m\u0131<\/p>\n<p>MADDE 146- Kanunda aksine bir h\u00fck\u00fcm bulunmad\u0131k\u00e7a, her alacak on y\u0131ll\u0131k zamana\u015f\u0131m\u0131na tabidir.\u201d<\/p>\n<p>II. \u0130LK \u0130NCELEME<\/p>\n<p>1. Anayasa Mahkemesi \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc h\u00fck\u00fcmleri uyar\u0131nca Kadir \u00d6ZKAYA, Hasan Tahsin G\u00d6KCAN, Basri BA\u011eCI, Engin YILDIRIM, R\u0131dvan G\u00dcLE\u00c7, Recai AKYEL, Yusuf \u015eevki HAKYEMEZ, Y\u0131ld\u0131z SEFER\u0130NO\u011eLU, Selahaddin MENTE\u015e, \u0130rfan F\u0130DAN, Kenan YA\u015eAR, Muhterem \u0130NCE, Y\u0131lmaz AK\u00c7\u0130L, \u00d6mer \u00c7INAR ve Metin KIRATLI\u2019n\u0131n kat\u0131l\u0131mlar\u0131yla 16\/1\/2025 tarihinde yap\u0131lan ilk inceleme toplant\u0131s\u0131nda dosyada eksiklik bulunmad\u0131\u011f\u0131ndan i\u015fin esas\u0131n\u0131n incelenmesine OYB\u0130RL\u0130\u011e\u0130YLE karar verilmi\u015ftir.<\/p>\n<p>III. ESASIN \u0130NCELENMES\u0130<\/p>\n<p>2. Ba\u015fvuru karar\u0131 ve ekleri, Raport\u00f6r Muhammed Nuri \u00d6ZG\u00dcR taraf\u0131ndan haz\u0131rlanan i\u015fin esas\u0131na ili\u015fkin rapor, itiraz konusu kanun h\u00fckm\u00fc, dayan\u0131lan Anayasa kurallar\u0131 ve bunlar\u0131n gerek\u00e7eleri ile di\u011fer yasama belgeleri okunup incelendikten sonra gere\u011fi g\u00f6r\u00fc\u015f\u00fcl\u00fcp d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. Uygulanacak Kural Sorunu<\/p>\n<p>3. Anayasa\u2019n\u0131n 152. ile 30\/3\/2011 tarihli ve 6216 say\u0131l\u0131 Anayasa Mahkemesinin Kurulu\u015fu ve Yarg\u0131lama Usulleri Hakk\u0131nda Kanun\u2019un 40. maddelerine g\u00f6re bir davaya bakmakta olan mahkeme, o dava sebebiyle uygulanacak bir kanunun veya Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesinin h\u00fck\u00fcmlerini Anayasa\u2019ya ayk\u0131r\u0131 g\u00f6rmesi veya taraflardan birinin ileri s\u00fcrd\u00fc\u011f\u00fc ayk\u0131r\u0131l\u0131k iddias\u0131n\u0131n ciddi oldu\u011fu kan\u0131s\u0131na varmas\u0131 durumunda bu h\u00fck\u00fcmlerin iptalleri i\u00e7in Anayasa Mahkemesine ba\u015fvurmaya yetkilidir. Ancak an\u0131lan maddeler uyar\u0131nca bir mahkemenin Anayasa Mahkemesine ba\u015fvurabilmesi i\u00e7in elinde y\u00f6ntemince a\u00e7\u0131lm\u0131\u015f ve mahkemenin g\u00f6revine giren bir davan\u0131n bulunmas\u0131, iptali talep edilen kural\u0131n da o davada uygulanacak olmas\u0131 gerekir. Uygulanacak kural ise bak\u0131lmakta olan davan\u0131n de\u011fi\u015fik evrelerinde ortaya \u00e7\u0131kan sorunlar\u0131n \u00e7\u00f6z\u00fcm\u00fcnde veya davay\u0131 sonu\u00e7land\u0131rmada olumlu ya da olumsuz y\u00f6nde etki yapacak nitelikte bulunan kurallard\u0131r.<\/p>\n<p>4. \u0130tiraz yoluna ba\u015fvuran Mahkemece 2330 say\u0131l\u0131 Kanun\u2019un nakd\u00ee tazminat\u0131 d\u00fczenleyen 3. maddesinin iptali talep edilmi\u015ftir. An\u0131lan maddenin birinci f\u0131kras\u0131n\u0131n (a) ve (b) bentlerinde s\u00f6z konusu Kanun kapsam\u0131na girenlerden \u00f6lenlerin kanuni miras\u00e7\u0131lar\u0131na, ya\u015famak i\u00e7in gerekli hareketleri yapmaktan aciz ve hayat\u0131n\u0131 ba\u015fkas\u0131n\u0131n yard\u0131m ve deste\u011fiyle s\u00fcrd\u00fcrebilecek \u015fekilde malul olanlara, engelli h\u00e2le gelenlere ve yaralananlara hangi oranda nakd\u00ee tazminat \u00f6denece\u011fi, (c) bendinde nakd\u00ee tazminat\u0131n kanuni miras\u00e7\u0131lara intikali h\u00e2linde \u00f6deme usul\u00fc, (d) bendinde kesin raporun al\u0131nmas\u0131n\u0131n uzayaca\u011f\u0131n\u0131n anla\u015f\u0131lmas\u0131 h\u00e2linde avans \u00f6denmesine ili\u015fkin hususlar d\u00fczenlenmi\u015f, ikinci f\u0131kras\u0131nda ise ola\u011fan\u00fcst\u00fc h\u00e2l durumunda nakd\u00ee tazminat miktar\u0131n\u0131n indirilmesi ve nakd\u00ee tazminata ili\u015fkin h\u00fck\u00fcmlerin uygulanmamas\u0131 konusunda Cumhurba\u015fkan\u0131n\u0131n yetkili oldu\u011fu belirtilmi\u015ftir.<\/p>\n<p>5. Bak\u0131lmakta olan davan\u0131n konusu kamu g\u00f6revlisine 2330 say\u0131l\u0131 Kanun uyar\u0131nca \u00f6denen tazminat\u0131n idare taraf\u0131ndan ilgililerden r\u00fccuen tahsiline ili\u015fkindir. Bu itibarla maddenin birinci f\u0131kras\u0131n\u0131n (c) ve (d) bentleri ile ikinci f\u0131kras\u0131n\u0131n bak\u0131lmakta olan davada uygulanma imk\u00e2n\u0131 bulunmamaktad\u0131r. Dolay\u0131s\u0131yla bu f\u0131kra ve bentlere ili\u015fkin ba\u015fvurunun Mahkemenin yetkisizli\u011fi nedeniyle reddi gerekir.<\/p>\n<p>B. Genel A\u00e7\u0131klama<\/p>\n<p>6. Haks\u0131z fiillerden do\u011fan zararlar\u0131n tazminine ili\u015fkin usul ve esaslar 6098 say\u0131l\u0131 Kanun\u2019da d\u00fczenlenmi\u015ftir. An\u0131lan Kanun\u2019un 49. maddesinde kusurlu ve hukuka ayk\u0131r\u0131 bir fiille ba\u015fkas\u0131na zarar verenin bu zarar\u0131 gidermekle y\u00fck\u00fcml\u00fc oldu\u011fu h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015f, 51. ve devam\u0131 maddelerinde tazminat\u0131n belirlenmesine ili\u015fkin hususlar d\u00fczenlenmi\u015ftir. Buna g\u00f6re haks\u0131z fiilden kaynaklanan \u00f6l\u00fcm veya bedensel zarar durumunda \u00f6lenin yak\u0131nlar\u0131 ve bedensel zarara u\u011frayan ki\u015fi, zarar\u0131n tazmin edilmesini bu Kanun\u2019un an\u0131lan h\u00fck\u00fcmlerine g\u00f6re haks\u0131z fiilde bulunan ki\u015fiden talep edebilecektir.<\/p>\n<p>7. R\u00fccu davas\u0131 ba\u015fkas\u0131na ait bir borcu y\u00fcklenerek yerine getiren ki\u015finin malvarl\u0131\u011f\u0131nda olu\u015fan kayb\u0131 zarara neden olan ki\u015fiden talep etti\u011fi bir dava t\u00fcr\u00fcd\u00fcr. Haks\u0131z fiil nedeniyle u\u011fran\u0131lan zarar\u0131 \u00f6deyen ki\u015fi de \u00f6dedi\u011fi bedelin haks\u0131z fiilde bulunan ki\u015fiden tahsil edilmesi i\u00e7in r\u00fccu davas\u0131 a\u00e7abilir. Bu ba\u011flamda haks\u0131z fiil nedeniyle meydana gelen zarar\u0131 kar\u015f\u0131layan idarenin haks\u0131z fiilde bulunan ki\u015fiye kar\u015f\u0131 r\u00fccu davas\u0131 a\u00e7mas\u0131 m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>8. Zamana\u015f\u0131m\u0131, kanunlarda belirtilen s\u00fcre i\u00e7inde hakk\u0131n\u0131 talep etmeyen alacakl\u0131n\u0131n dava a\u00e7mak suretiyle alaca\u011f\u0131n\u0131 elde etme imk\u00e2n\u0131n\u0131 kaybetmesidir. Zamana\u015f\u0131m\u0131 s\u00fcresi ge\u00e7tikten sonra bor\u00e7lu, borcu ifa ederse bu ge\u00e7erli bir ifa olmakla birlikte bor\u00e7lunun bu borcu ifa etmeme imk\u00e2n\u0131 da bulunmaktad\u0131r. Bir ba\u015fka deyi\u015fle zamana\u015f\u0131m\u0131na u\u011fram\u0131\u015f bir borcun ifas\u0131 alacakl\u0131 i\u00e7in sebepsiz zenginle\u015fme te\u015fkil etmeyece\u011fi gibi bir ba\u011f\u0131\u015flama olarak da kabul edilmez ve zamana\u015f\u0131m\u0131na u\u011fram\u0131\u015f bir borcu ifa eden bor\u00e7lu alacakl\u0131ya istirdat davas\u0131 a\u00e7amaz (AYM, E.2020\/90, K.2023\/88, 4\/5\/2023, \u00a7\u00a7 11, 12).<\/p>\n<p>9. Kanun\u2019un 73. maddesinde r\u00fccu isteminin tazminat\u0131n tamam\u0131n\u0131n \u00f6dendi\u011fi ve birlikte sorumlu ki\u015finin \u00f6\u011frenildi\u011fi tarihten ba\u015flayarak iki y\u0131l\u0131n ve her h\u00e2lde tazminat\u0131n tamam\u0131n\u0131n \u00f6dendi\u011fi tarihten ba\u015flayarak on y\u0131l\u0131n ge\u00e7mesiyle zamana\u015f\u0131m\u0131na u\u011frayaca\u011f\u0131 h\u00fckme ba\u011flanm\u0131\u015ft\u0131r. Ayr\u0131ca 146. maddede kanunda aksine bir h\u00fck\u00fcm bulunmad\u0131k\u00e7a, her alaca\u011f\u0131n on y\u0131ll\u0131k zamana\u015f\u0131m\u0131na tabi oldu\u011fu belirtilmi\u015f olup bu s\u00fcre genel zamana\u015f\u0131m\u0131 s\u00fcresi olarak kabul edilmektedir.<\/p>\n<p>C. Anlam ve Kapsam<\/p>\n<p>10. 2330 say\u0131l\u0131 Kanun\u2019da; bu Kanun kapsam\u0131nda belli faaliyetlerde g\u00f6revlendirilenlerin bu g\u00f6revlerinden dolay\u0131 ya da g\u00f6revleri sona ermi\u015f olsa bile yapt\u0131klar\u0131 hizmet nedeniyle derh\u00e2l veya bu y\u00fczden maruz kald\u0131klar\u0131 yaralanma ya da hastal\u0131k sonucu \u00f6lmeleri veya engelli duruma gelmeleri h\u00e2linde \u00f6denecek nakd\u00ee tazminat ile birlikte ba\u011flanacak ayl\u0131\u011f\u0131n ve say\u0131lan nedenlerle yaralanmalar\u0131 durumunda \u00f6denecek nakd\u00ee tazminat\u0131n esas ve y\u00f6ntemleri d\u00fczenlenmi\u015ftir.<\/p>\n<p>11. An\u0131lan Kanun\u2019un 2. maddesinde Kanun kapsam\u0131na giren kamu g\u00f6revlileri ve di\u011fer ki\u015filer belirlenmi\u015f, 3. maddesinde ise bu kapsama girenlere \u00f6denecek nakd\u00ee tazminata ili\u015fkin usul ve esaslar belirtilmi\u015ftir.<\/p>\n<p>12. Kanun\u2019un 3. maddesinde nakd\u00ee tazminat\u0131n hesaplanma usul\u00fc d\u00fczenlenmi\u015ftir. An\u0131lan maddenin birinci f\u0131kras\u0131n\u0131n itiraz konusu (a) bendinde Kanun kapsam\u0131na girenlerden; \u00f6lenlerin kanuni miras\u00e7\u0131lar\u0131na, en y\u00fcksek devlet memuru br\u00fct ayl\u0131\u011f\u0131n\u0131n (ek g\u00f6sterge dahil) 100 kat\u0131 tutar\u0131nda, (b) bendinde ise ya\u015famak i\u00e7in gerekli hareketleri yapmaktan aciz ve hayat\u0131n\u0131 ba\u015fkas\u0131n\u0131n yard\u0131m ve deste\u011fi ile s\u00fcrd\u00fcrebilecek \u015fekilde malul olanlara 200 kat\u0131, di\u011fer engelli h\u00e2le gelenlere (a) bendinde belirtilen tutar\u0131n % 25&#8217;inden % 75&#8217;ine kadar yaralananlara ise % 20&#8217;sini ge\u00e7memek \u00fczere engellilik ve yaralanma derecesine g\u00f6re nakd\u00ee tazminat \u00f6denece\u011fi belirtilmi\u015f, s\u00f6z konusu bentleri ba\u011flayan h\u00fck\u00fcmde ise bu nakd\u00ee tazminat\u0131n tespitine esas tutulacak ayl\u0131\u011f\u0131n tazminat verilmesine dair karar tarihindeki en y\u00fcksek devlet memuru ayl\u0131\u011f\u0131n\u0131n (ek g\u00f6sterge d\u00e2hil) br\u00fct tutar\u0131 oldu\u011fu belirtilmi\u015ftir.<\/p>\n<p>13. Bu kapsamda Kanun\u2019la, ba\u015fvurular\u0131 aranmaks\u0131z\u0131n, idare taraf\u0131ndan resen harekete ge\u00e7ilerek Kanun kapsam\u0131ndaki ki\u015filere itiraz konusu kural uyar\u0131nca belirtilen tutarda nakd\u00ee tazminat \u00f6denmesinin \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>\u00c7. \u0130tiraz\u0131n Gerek\u00e7esi<\/p>\n<p>14. Ba\u015fvuru karar\u0131nda \u00f6zetle; itiraz konusu kuralda nakd\u00ee tazminat\u0131n hesaplanmas\u0131nda esas al\u0131nacak tarihin belirlenmesine ra\u011fmen tazminata karar verecek olan komisyona ba\u015fvuru ve komisyonun karar verme s\u00fcresine ili\u015fkin bir d\u00fczenlemenin bulunmad\u0131\u011f\u0131, tazminat miktar\u0131 karar tarihine g\u00f6re de\u011fi\u015fkenlik g\u00f6sterece\u011finden ba\u015fvuru ve karar s\u00fcresine ili\u015fkin belirsizli\u011fin nakd\u00ee tazminat\u0131n r\u00fccu edilece\u011fi \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin sorumlu olaca\u011f\u0131 miktar\u0131 \u00f6ng\u00f6rememelerine neden oldu\u011fu, kural\u0131n bu y\u00f6n\u00fcyle belirli ve \u00f6ng\u00f6r\u00fclebilir olmad\u0131\u011f\u0131 belirtilerek Anayasa\u2019n\u0131n 5., 17., 35., 36. ve 40. maddelerine ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>D. Anayasa\u2019ya Ayk\u0131r\u0131l\u0131k Sorunu<\/p>\n<p>15. Anayasa\u2019n\u0131n 17. maddesinde \u201cHerkes, ya\u015fama, madd\u00ee ve manev\u00ee varl\u0131\u011f\u0131n\u0131 koruma ve geli\u015ftirme hakk\u0131na sahiptir\u201d h\u00fckm\u00fcne yer verilmi\u015ftir. Ki\u015finin ya\u015fam hakk\u0131 ile maddi ve manevi varl\u0131\u011f\u0131n\u0131 koruma ve geli\u015ftirme hakk\u0131, birbirleriyle s\u0131k\u0131 ba\u011flant\u0131lar\u0131 olan, devredilmez ve vazge\u00e7ilmez haklar\u0131ndand\u0131r.<\/p>\n<p>16. Anayasa\u2019n\u0131n 5. maddesi insan\u0131n maddi ve manevi varl\u0131\u011f\u0131n\u0131n geli\u015fmesi i\u00e7in gerekli \u015fartlar\u0131 haz\u0131rlamay\u0131 devletin temel ama\u00e7 ve g\u00f6revleri aras\u0131nda saym\u0131\u015ft\u0131r. Anayasa\u2019n\u0131n 17. maddesinde temel haklar olarak g\u00fcvence alt\u0131na al\u0131nm\u0131\u015f olan ya\u015fam hakk\u0131 ile maddi ve manevi varl\u0131\u011f\u0131n\u0131 koruma ve geli\u015ftirme hakk\u0131n\u0131n etkili bir \u015fekilde korunabilmesi yaln\u0131zca devletin bu haklara m\u00fcdahaleden ka\u00e7\u0131nmas\u0131na ba\u011fl\u0131 de\u011fildir. Anayasa\u2019n\u0131n 5. ve 17. maddeleri uyar\u0131nca devletin pozitif y\u00fck\u00fcml\u00fcl\u00fckleri de bulunmaktad\u0131r. Bu pozitif y\u00fck\u00fcml\u00fcl\u00fckler baz\u0131 durumlarda s\u00f6z konusu temel haklar\u0131n korunmas\u0131 i\u00e7in belirli tedbirlerin al\u0131nmas\u0131n\u0131 gerektirmektedir (benzer y\u00f6nde bkz. AYM, E.2019\/11, K.2019\/86, 14\/11\/2019, \u00a7 13).<\/p>\n<p>17. Devletin s\u00f6z konusu pozitif y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc, ki\u015finin ya\u015fama hakk\u0131 ile maddi ve manevi varl\u0131\u011f\u0131na y\u00f6nelen m\u00fcdahaleleri \u00f6nlemek, \u00f6nlenememi\u015f olan m\u00fcdahalelere y\u00f6nelik olarak da bu m\u00fcdahalelerden do\u011fan zarar\u0131 tespit ve tazmin edecek etkili mekanizmalar kurmak, bu kapsamda gerekli usule ili\u015fkin g\u00fcvenceleri sunan yarg\u0131sal prosed\u00fcrleri sa\u011flamak, bu suretle yarg\u0131sal ve idari makamlar\u0131n ki\u015filerin idare ve \u00f6zel ki\u015filerle olan uyu\u015fmazl\u0131klar\u0131nda etkili ve adil bir karar vermelerini temin etmek sorumlulu\u011funu da i\u00e7ermektedir (AYM, E.2021\/82, K.2022\/167, 29\/12\/2022, \u00a7 49).<\/p>\n<p>18. \u00d6l\u00fcm veya cismani zarara u\u011frayan ki\u015fi bu ve benzeri zararlar\u0131n\u0131n giderilmesini zarara neden olan ger\u00e7ek veya t\u00fczel ki\u015fiden talep edebilir. Ancak kanun koyucu kamusal nitelikteki baz\u0131 hizmetlerin ifas\u0131ndaki tehlike nedeniyle bu hizmetlerde \u00f6lenlerin yak\u0131nlar\u0131n\u0131n veya yaralananlar\u0131n zarar\u0131n\u0131n devlet taraf\u0131ndan kar\u015f\u0131lanmas\u0131na ili\u015fkin d\u00fczenlemeler yapabilir. Nitekim baz\u0131 g\u00f6revlerin yerine getirilmesindeki tehlike g\u00f6zetilerek 2330 say\u0131l\u0131 Kanun kabul edilmi\u015f ve itiraz konusu kural kapsam\u0131nda tazminat\u0131n hesaplanmas\u0131na ili\u015fkin d\u00fczenlemelere yer verilmi\u015ftir.<\/p>\n<p>19. Haks\u0131z fiilden kaynaklanan bedensel zarar\u0131n tazminine ili\u015fkin sistemin belirlenmesi kanun koyucunun takdir yetkisi kapsam\u0131nda olup bu konuda anayasal s\u0131n\u0131rlar i\u00e7inde tazmin mekanizmas\u0131n\u0131n d\u00fczenlenmesi m\u00fcmk\u00fcnd\u00fcr. Kural\u0131n da yer ald\u0131\u011f\u0131 s\u00f6z konusu Kanun, belli kamusal nitelikteki g\u00f6revleri \u00fcstlenen ki\u015filerin g\u00f6revleri nedeniyle u\u011frad\u0131klar\u0131 bedensel zarar\u0131n h\u0131zl\u0131 ve etkin bi\u00e7imde tazmin edilmesini ama\u00e7lamaktad\u0131r.<\/p>\n<p>20. Zarara u\u011frayan ki\u015filere ba\u015fvuru \u015fart\u0131 aranmaks\u0131z\u0131n Kanun kapsam\u0131nda nakd\u00ee tazminat\u0131n \u00f6denmesi \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Ancak idarenin resen harekete ge\u00e7memesi durumunda nakd\u00ee tazminat talep eden ki\u015finin tazminat\u0131n \u00f6denmesi i\u00e7in idareye ba\u015fvurmas\u0131, idarenin bu talebi reddetmesi veya talebe cevap vermemesi h\u00e2linde de 2577 say\u0131l\u0131 Kanun h\u00fck\u00fcmlerine g\u00f6re s\u00fcresi i\u00e7inde dava a\u00e7mas\u0131 m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>21. Kuralda nakd\u00ee tazminat\u0131n hesaplanmas\u0131na ili\u015fkin usul ve esaslar d\u00fczenlenmi\u015f, nakd\u00ee tazminat\u0131n tespitine esas tutulacak ayl\u0131\u011f\u0131n tazminat verilmesine dair karar tarihindeki ek g\u00f6sterge d\u00e2hil en y\u00fcksek devlet memuru ayl\u0131\u011f\u0131n\u0131n br\u00fct tutar\u0131 oldu\u011fu belirlenmek suretiyle nakd\u00ee tazminat komisyonuna ba\u015fvurunun gecikmesi veya komisyonun karar alma s\u00fcrecinin uzamas\u0131 h\u00e2linde paran\u0131n sat\u0131n alma g\u00fcc\u00fcnde de\u011fer kayb\u0131na u\u011framas\u0131 \u00f6nlenerek ki\u015finin zarar\u0131n\u0131n etkin \u015fekilde tazmin edilmesi ama\u00e7lanm\u0131\u015ft\u0131r. Kald\u0131 ki Kanun kapsam\u0131nda kar\u015f\u0131lanmad\u0131\u011f\u0131 d\u00fc\u015f\u00fcn\u00fclen zararlar\u0131n do\u011frudan haks\u0131z fiilde bulunan ki\u015filerden tazmin edilmesine de herhangi bir engel bulunmamaktad\u0131r.<\/p>\n<p>22. Bu itibarla kamusal nitelikte belli hizmetleri yerine getiren ki\u015filerin zararlar\u0131n\u0131n etkin \u015fekilde tazmin edilmesine ili\u015fkin d\u00fczenlemeler i\u00e7eren kural\u0131n Anayasa\u2019n\u0131n 5. ve 17. maddelerine ayk\u0131r\u0131 bir y\u00f6n\u00fc bulunmamaktad\u0131r.<\/p>\n<p>23. \u00d6te yandan nakd\u00ee tazminat\u0131n \u00f6denmesine eylemleriyle neden olan ki\u015filere r\u00fccu edilmesine ili\u015fkin bir d\u00fczenlemeye 2330 say\u0131l\u0131 Kanun\u2019da yer verilmemi\u015ftir. Bununla birlikte idarenin \u00f6dedi\u011fi tazminat\u0131, tazminat \u00f6denmesine eylemleriyle neden olan ki\u015filere genel h\u00fck\u00fcmlere g\u00f6re r\u00fccu etmesi m\u00fcmk\u00fcnd\u00fcr. Ba\u015fvuru karar\u0131nda kuralda tazminat\u0131n hangi tarihte \u00f6denece\u011fine ili\u015fkin olarak bir s\u00fcre s\u0131n\u0131r\u0131 bulunmamas\u0131 nedeniyle kural\u0131n r\u00fccu davas\u0131na muhatap olan \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin s\u00fcrekli olarak dava tehdidi alt\u0131nda b\u0131rak\u0131lmalar\u0131na sebebiyet verdi\u011fi ileri s\u00fcr\u00fcld\u00fc\u011f\u00fcnden kural\u0131n r\u00fccuen tazminat davalar\u0131 y\u00f6n\u00fcyle de incelenmesi gerekir.<\/p>\n<p>24. Anayasa\u2019n\u0131n 35. maddesinde \u201cHerkes, m\u00fclkiyet ve miras haklar\u0131na sahiptir.\/ Bu haklar, ancak kamu yarar\u0131 amac\u0131yla, kanunla s\u0131n\u0131rlanabilir.\/ M\u00fclkiyet hakk\u0131n\u0131n kullan\u0131lmas\u0131 toplum yarar\u0131na ayk\u0131r\u0131 olamaz.\u201d denilmek suretiyle m\u00fclkiyet hakk\u0131 g\u00fcvenceye ba\u011flanm\u0131\u015ft\u0131r. Anayasa\u2019n\u0131n 35. maddesinde bir temel hak olarak g\u00fcvence alt\u0131na al\u0131nm\u0131\u015f olan m\u00fclkiyet hakk\u0131n\u0131n etkili bir \u015fekilde korunabilmesi yaln\u0131zca devletin bu hakka m\u00fcdahaleden ka\u00e7\u0131nmas\u0131yla sa\u011flanamaz. Anayasa\u2019n\u0131n 5. ve 35. maddeleri uyar\u0131nca devletin m\u00fclkiyet hakk\u0131n\u0131n korunmas\u0131na ili\u015fkin pozitif y\u00fck\u00fcml\u00fcl\u00fckleri de bulunmaktad\u0131r.<\/p>\n<p>25. Devletin pozitif y\u00fck\u00fcml\u00fcl\u00fckleri \u00e7er\u00e7evesinde -\u00f6zel ki\u015filer aras\u0131 uyu\u015fmazl\u0131klar ile ilgili olsun ya da olmas\u0131n- alacaklar\u0131n tahsilinin d\u00fczenlenmesi ve ki\u015filerin alacaklar\u0131na kavu\u015fmas\u0131 bak\u0131m\u0131ndan etkili bir sistem kurma sorumlulu\u011fu bulunmaktad\u0131r. Devlet, ki\u015filerin m\u00fclkiyet hakk\u0131ndan tam anlam\u0131yla yararlanabilmeleri ve etkili bir \u015fekilde m\u00fclkiyet hakk\u0131n\u0131n korunmas\u0131 amac\u0131yla yasal, idari, mali, yarg\u0131sal ve di\u011fer \u00f6nlemleri almak zorundad\u0131r. Buna g\u00f6re bir yandan alacakl\u0131n\u0131n m\u00fclkiyet hakk\u0131 kapsam\u0131nda bulunan alaca\u011f\u0131na kavu\u015fmas\u0131 i\u00e7in etkin bir dava ve icra yolunun olu\u015fturulmas\u0131, \u00f6te yandan da dava ve icradan etkilenen bor\u00e7lu ve ilgili di\u011fer ki\u015filere, m\u00fclkiyet haklar\u0131na yap\u0131lan m\u00fcdahalelerin keyf\u00ee veya hukuka ayk\u0131r\u0131 oldu\u011funu ileri s\u00fcrebilmeleri i\u00e7in etkin bi\u00e7imde itiraz edebilme imk\u00e2n\u0131n\u0131n tan\u0131nmas\u0131 gerekmektedir (AYM, E.2019\/11, K.2019\/86, 14\/11\/2019, \u00a7 15; Hesna Funda Baltal\u0131 ve Baltal\u0131 G\u0131da Hayvanc\u0131l\u0131k San. ve Tic. Ltd. \u015eti., [GK], B. No: 2014\/17196, 25\/10\/2018, \u00a7 72; Nihal Soydan [2. B.], B. No: 2015\/3112, 23\/1\/2019, \u00a7 35).<\/p>\n<p>26. Alaca\u011f\u0131n s\u00fcresinde \u00f6denmemesi nedeniyle a\u00e7\u0131lan dava veya ba\u015flat\u0131lan icra takiplerinde alacakl\u0131 ve bor\u00e7lunun m\u00fclkiyet haklar\u0131 \u00e7at\u0131\u015fmaktad\u0131r. Bu nedenle dava ve icra takip s\u00fcre\u00e7lerinin alacakl\u0131 ve bor\u00e7lu taraf\u0131n menfaatlerini dengeleyecek yollar\u0131 \u00f6ng\u00f6rmesi gerekmektedir. Bununla birlikte kanun koyucunun \u00f6ng\u00f6rd\u00fc\u011f\u00fc d\u00fczenlemelerin menfaatler dengesinin kurulmas\u0131nda taraflardan biri aleyhine \u00f6l\u00e7\u00fcs\u00fczl\u00fc\u011fe neden olmas\u0131 m\u00fclkiyet hakk\u0131 y\u00f6n\u00fcnden pozitif y\u00fck\u00fcml\u00fcl\u00fcklerle de ba\u011fda\u015fmayabilir. Bu ba\u011flamda her iki taraf\u0131n menfaatlerinin m\u00fcmk\u00fcn oldu\u011funca dengelenmesi ve s\u00fcrecin taraflardan biri aleyhine \u00f6l\u00e7\u00fcs\u00fcz bir netice do\u011furacak \u015fekilde sonu\u00e7land\u0131r\u0131lmamas\u0131 gerekir. Menfaat dengesinin adil bir \u015fekilde kurulup kurulmad\u0131\u011f\u0131n\u0131n de\u011ferlendirilmesinde ise taraflara tan\u0131nan t\u00fcm imk\u00e2nlar\u0131n g\u00f6z\u00f6n\u00fcnde bulundurulmas\u0131 zorunludur (AYM, E.2020\/90, K.2023\/88, 4\/5\/2023, \u00a7 26).<\/p>\n<p>27. Uzun y\u0131llar \u00f6ncesine dayanan bir borcun \u00f6dendi\u011finin ya da sona erdi\u011finin ispat edilmesi, \u00f6deme ya da borcun sona ermesine ili\u015fkin hukuki i\u015flemlere ait belgelerin saklanmas\u0131 ve eski olgular\u0131n mahkemelerce de\u011ferlendirilmesindeki g\u00fc\u00e7l\u00fckler g\u00f6zetilerek alacak hakk\u0131n\u0131n talep edilmesi belirli s\u00fcrelerle s\u0131n\u0131rlanabilir. Mevzuatta \u00f6ng\u00f6r\u00fclen benzer itiraz ve dava a\u00e7ma s\u00fcreleri ayn\u0131 zamanda hukuk devletinin gereklerinden olan hukuki g\u00fcvenlik ve hukuki istikrar ilkeleriyle do\u011frudan ilgili olup d\u00fczenlemelerle an\u0131lan ilkelerin ger\u00e7ekle\u015fmesi sa\u011flanmaktad\u0131r. Zamana\u015f\u0131m\u0131, alacakl\u0131y\u0131 hakk\u0131n\u0131 aramak konusunda hareketsiz kalmas\u0131 nedeniyle alaca\u011f\u0131n\u0131n tahsili i\u00e7in gerekli hukuki himayeden mahrum b\u0131rakmaktad\u0131r. Bu \u015fekilde bor\u00e7lunun olduk\u00e7a uzak ge\u00e7mi\u015fte kalan bir bor\u00e7tan do\u011fabilecek uyu\u015fmazl\u0131klara kar\u015f\u0131 korunmas\u0131 ve s\u00fcrekli dava ve icra tehdidi alt\u0131nda kalmas\u0131n\u0131n \u00f6nlenmesi ama\u00e7lanmaktad\u0131r (AYM, E.2020\/90, K.2023\/88, 4\/5\/2023, \u00a7\u00a7 27, 28).<\/p>\n<p>28. 6098 say\u0131l\u0131 Kanun\u2019un 146. maddesine g\u00f6re kanunda aksine bir h\u00fck\u00fcm bulunmad\u0131k\u00e7a her alacak on y\u0131ll\u0131k zamana\u015f\u0131m\u0131na tabidir. 2330 say\u0131l\u0131 Kanun\u2019da nakd\u00ee tazminata hak kazanan ki\u015finin ne kadar s\u00fcrede idareye ba\u015fvurabilece\u011fine ili\u015fkin bir d\u00fczenleme bulunmamakla birlikte genel zamana\u015f\u0131m\u0131 s\u00fcresinin bu alacak bak\u0131m\u0131ndan da ge\u00e7erli oldu\u011fu a\u00e7\u0131kt\u0131r. Nitekim Dan\u0131\u015ftay i\u00e7tihad\u0131nda da nakd\u00ee tazminat talebiyle yap\u0131lacak ba\u015fvurunun 6098 say\u0131l\u0131 Kanun\u2019da yer alan on y\u0131ll\u0131k genel zamana\u015f\u0131m\u0131 s\u00fcresi i\u00e7erisinde yap\u0131lmas\u0131 gerekti\u011fi kabul edilmektedir (di\u011ferleri aras\u0131ndan bkz. Dan\u0131\u015ftay 12. Dairesi, E.2019\/7790, K.2021\/4075, 17\/6\/2021; E.2019\/7714, K.2020\/944, 5\/2\/2020; Dan\u0131\u015ftay 11. Dairesi, E.2016\/435, K.2018\/971, 20\/2\/2018; Dan\u0131\u015ftay 15. Dairesi, E.2013\/2340, K.2015\/1242, 3\/3\/2015).<\/p>\n<p>29. An\u0131lan Kanun\u2019un 73. maddesine g\u00f6re r\u00fccu istemi, tazminat\u0131n tamam\u0131n\u0131n \u00f6dendi\u011fi ve birlikte sorumlu ki\u015finin \u00f6\u011frenildi\u011fi tarihten ba\u015flayarak iki y\u0131l\u0131n ve her h\u00e2lde tazminat\u0131n tamam\u0131n\u0131n \u00f6dendi\u011fi tarihten ba\u015flayarak on y\u0131l\u0131n ge\u00e7mesiyle zamana\u015f\u0131m\u0131na u\u011frar. Ki\u015finin yerine getirdi\u011fi g\u00f6rev nedeniyle \u00f6l\u00fcm veya bedensel zarar\u0131n idarece do\u011frudan giderilmesini ama\u00e7layan 2330 say\u0131l\u0131 Kanun gere\u011fince \u00f6demeyi yapan idarenin bu tazminat\u0131n \u00f6denmesine neden olan ki\u015fiye kar\u015f\u0131 a\u00e7aca\u011f\u0131 r\u00fccu davas\u0131nda da an\u0131lan zamana\u015f\u0131m\u0131 s\u00fcresinin uygulanaca\u011f\u0131 a\u00e7\u0131kt\u0131r. Bu itibarla kural\u0131n zarara neden olan ki\u015filere kar\u015f\u0131 r\u00fccu talebinin ileri s\u00fcr\u00fclebilece\u011fi s\u00fcre y\u00f6n\u00fcnden hukuki g\u00fcvenlik ve hukuki istikrar ilkelerine ayk\u0131r\u0131 bir y\u00f6n\u00fc bulunmamaktad\u0131r.<\/p>\n<p>30. Di\u011fer yandan haks\u0131z fiilden kaynaklanan tazminat davalar\u0131nda zarar her bir olay\u0131n somut \u00f6zelliklerine g\u00f6re tazminat hukukunun genel ilkeleri \u00e7er\u00e7evesinde belirlenmekte olup haks\u0131z fiili nedeniyle tazminat \u00f6denmesine neden olan ki\u015finin sorumlulu\u011fu ve bu ki\u015fiye r\u00fccu edilecek bedel ki\u015finin neden oldu\u011fu zararla s\u0131n\u0131rl\u0131d\u0131r. Dolay\u0131s\u0131yla r\u00fccu edilecek ki\u015finin haks\u0131z eylemi nedeniyle sorumlu oldu\u011fu miktar\u0131 \u00f6ng\u00f6remeyece\u011fi de s\u00f6ylenemez.<\/p>\n<p>31. Bu itibarla haks\u0131z fiiliyle tazminat \u00f6denmesine neden olan ki\u015fiye y\u00f6neltilebilecek r\u00fccu davas\u0131 bak\u0131m\u0131ndan, zarara u\u011frayan ki\u015finin on y\u0131ll\u0131k genel zamana\u015f\u0131m\u0131 s\u00fcresi i\u00e7inde idareye ba\u015fvurmas\u0131 gerekti\u011fi, idarenin tazminat\u0131n \u00f6denmesine neden olan ki\u015fiye sorumlu oldu\u011fu miktarda r\u00fccu edebilece\u011fi ve bu alacak bak\u0131m\u0131ndan da 6098 say\u0131l\u0131 Kanun\u2019un 73. maddesinde \u00f6ng\u00f6r\u00fclen zamana\u015f\u0131m\u0131 s\u00fcresinin ge\u00e7erli oldu\u011fu g\u00f6zetildi\u011finde kural\u0131n r\u00fccu davas\u0131na muhatap olan ki\u015fileri belirsiz bir s\u00fcre \u00f6deme bask\u0131s\u0131 alt\u0131nda b\u0131rakt\u0131\u011f\u0131 s\u00f6ylenemeyece\u011fi, bu y\u00f6n\u00fcyle ki\u015filere \u00f6l\u00e7\u00fcs\u00fcz bir k\u00fclfet y\u00fcklemedi\u011fi sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>32. A\u00e7\u0131klanan nedenlerle kural, Anayasa\u2019n\u0131n 5., 17. ve 35. maddelerine ayk\u0131r\u0131 de\u011fildir. \u0130tiraz\u0131n reddi gerekir.<\/p>\n<p>Kural\u0131n Anayasa\u2019n\u0131n 36. ve 40. maddelerine ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015f ise de bu ba\u011flamda belirtilen hususlar\u0131n Anayasa\u2019n\u0131n 5., 17. ve 35. maddeleri y\u00f6n\u00fcnden yap\u0131lan de\u011ferlendirmeler kapsam\u0131nda ele al\u0131nm\u0131\u015f olmas\u0131 nedeniyle Anayasa\u2019n\u0131n 36. ve 40. maddeleri y\u00f6n\u00fcnden ayr\u0131ca bir inceleme yap\u0131lmas\u0131na gerek g\u00f6r\u00fclmemi\u015ftir.<\/p>\n<p>IV. H\u00dcK\u00dcM<\/p>\n<p>3\/11\/1980 tarihli ve 2330 say\u0131l\u0131 Nakdi Tazminat ve Ayl\u0131k Ba\u011flanmas\u0131 Hakk\u0131nda Kanun\u2019un 3. maddesinin;<\/p>\n<p>A.
