TCK m.216\/1\u2019de Tan\u0131mlanan Su\u00e7<\/p>\n<p>Halk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa tahrik veya a\u015fa\u011f\u0131lama su\u00e7u; 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun 216. maddesinde d\u00fczenlenmi\u015f olup, \u00fc\u00e7 f\u0131kradan olu\u015fan bu h\u00fckm\u00fcn her f\u0131kras\u0131n\u0131n uygulama alan\u0131 farkl\u0131l\u0131k g\u00f6stermektedir. Maddenin ilk f\u0131kras\u0131nda tahrik, di\u011fer iki f\u0131kras\u0131nda a\u015fa\u011f\u0131lama fiillerine yer verilmi\u015ftir.<\/p>\n<p>\u201cHalk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa tahrik veya a\u015fa\u011f\u0131lama\u201d ba\u015fl\u0131kl\u0131 216. maddenin 1. f\u0131kras\u0131na g\u00f6re;\u00a0\u201cHalk\u0131n sosyal s\u0131n\u0131f, \u0131rk, din, mezhep veya b\u00f6lge bak\u0131m\u0131ndan farkl\u0131 \u00f6zelliklere sahip bir kesimini, di\u011fer bir kesimi aleyhine kin\u00a0ve\u00a0d\u00fc\u015fmanl\u0131\u011fa alenen tahrik eden kimse,\u00a0bu nedenle kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan a\u00e7\u0131k ve yak\u0131n bir tehlikenin ortaya \u00e7\u0131kmas\u0131 halinde, bir y\u0131ldan \u00fc\u00e7 y\u0131la kadar hapis cezas\u0131 ile cezaland\u0131r\u0131l\u0131r\u201d.<\/p>\n<p>\u0130lk f\u0131krada tan\u0131mlanan su\u00e7; halk\u0131n sosyal s\u0131n\u0131f, \u0131rk, din, mezhep veya b\u00f6lge bak\u0131m\u0131ndan farkl\u0131 \u00f6zelliklere sahip bir kesimini, di\u011fer bir kesimi aleyhine kin ve d\u00fc\u015fmanl\u0131\u011fa alenen tahrik etme olarak d\u00fczenlenmi\u015f, ancak s\u0131rf bu fiilin varl\u0131\u011f\u0131 failin cezaland\u0131r\u0131lmas\u0131 i\u00e7in yeterli g\u00f6r\u00fclmemi\u015f, icra edilen fiil nedeniyle kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan a\u00e7\u0131k ve yak\u0131n bir tehlikenin ortaya \u00e7\u0131kmas\u0131, hareket ile sonu\u00e7 aras\u0131nda illiyet ba\u011f\u0131n\u0131n kurulmas\u0131 aranm\u0131\u015ft\u0131r. Birinci f\u0131krada su\u00e7; \u201csomut tehlike\u201d su\u00e7u olarak tan\u0131mlanm\u0131\u015f ve somut tehlike,\u00a0\u201ckamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan a\u00e7\u0131k ve yak\u0131n bir tehlikenin ortaya \u00e7\u0131kmas\u0131\u201d\u00a0olarak g\u00f6sterilmi\u015ftir, yani somut olayda bu tehlike tespit edilmedik\u00e7e esasen su\u00e7un maddi unsurunun varl\u0131\u011f\u0131ndan bahsedilemez. Bununla birlikte, somut tehlike i\u00e7in aranan \u015fart\u0131n bir objektif cezaland\u0131r\u0131labilme \u015fart\u0131 oldu\u011fu kabul edilmektedir.<\/p>\n<p>Fail; halk\u0131n sosyal s\u0131n\u0131f, \u0131rk, din, mezhep veya b\u00f6lge bak\u0131m\u0131ndan farkl\u0131 \u00f6zelliklere sahip bir kesimini (bir b\u00f6l\u00fcm\u00fc, bir b\u00f6lgeyi veya ortak \u00f6zellikleri ta\u015f\u0131yan T\u00fcrk Toplumunu olu\u015fturan bir toplulu\u011fu), di\u011fer bir kesimi (bir b\u00f6l\u00fcm\u00fc, bir b\u00f6lgeyi veya ortak \u00f6zellikleri ta\u015f\u0131yan T\u00fcrk Toplumunu olu\u015fturan bir toplulu\u011fu) aleyhine kin ve d\u00fc\u015fmanl\u0131\u011fa alenen tahrik ederken, bu farkl\u0131 \u00f6zellikleri bilmeli ve isteyerek tahrik etmelidir[1].<\/p>\n<p>D\u00fczenlendi\u011fi b\u00f6l\u00fcm itibariyle kamu bar\u0131\u015f\u0131n\u0131 korumay\u0131 hedefleyen bu ceza normu, a\u00e7\u0131k ve yak\u0131n bir tehlikenin ortaya \u00e7\u0131kmas\u0131 halini arad\u0131\u011f\u0131 i\u00e7in bir somut tehlike su\u00e7u olarak kabul edilir. Soyut tehlikede olan belirsizlik, somut tehlikede hen\u00fcz zarara d\u00f6n\u00fc\u015fmemi\u015f, ancak\u00a0belirginle\u015fmi\u015f\u00a0ve\u00a0fark edilebilir\u00a0tehlikenin varl\u0131\u011f\u0131na i\u015faret eder. Dolay\u0131s\u0131yla, kamu g\u00fcvenli\u011finin bozulmas\u0131 tehlikesinin somut olgularla tespit edilmesi gerekir. Kamu g\u00fcvenli\u011fi; toplumun ve toplumu olu\u015fturan bireylerin can ve mal g\u00fcvenli\u011finin korunmas\u0131, en \u00f6nemlisi de bu g\u00fcvenli\u011fin kamu hizmeti olarak Devlet taraf\u0131ndan sa\u011flanmas\u0131n\u0131 ifade eder[2].<\/p>\n<p>Burada tahrikin, kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan a\u00e7\u0131k ve yak\u0131n tehlike ortaya \u00e7\u0131karmas\u0131 arand\u0131\u011f\u0131ndan, tahrik ile kamu g\u00fcvenli\u011finin ger\u00e7ekten bozulmas\u0131 \u015fart de\u011fildir, kamu g\u00fcvenli\u011finin bozulmas\u0131 konusunda a\u00e7\u0131k ve yak\u0131n bir tehlikenin ortaya \u00e7\u0131kmas\u0131 yeterlidir[3]. 216. madde, bir zarar su\u00e7u olarak d\u00fczenlenmemi\u015ftir. H\u00fck\u00fcmde ge\u00e7en \u201ca\u00e7\u0131kl\u0131k\u201d kavram\u0131ndan, tehlikenin \u015f\u00fcpheye yer b\u0131rakmayacak \u00f6l\u00e7\u00fcde ortaya \u00e7\u0131kmas\u0131, \u201cyak\u0131nl\u0131k\u201d kavram\u0131ndan ise, d\u00fc\u015f\u00fcnce a\u00e7\u0131klamas\u0131nda kullan\u0131lan kelimelerin, bir zarara sebebiyet verme olas\u0131l\u0131\u011f\u0131na yak\u0131n olma anla\u015f\u0131lmal\u0131d\u0131r[4].<\/p>\n<p>Her ne kadar 216. maddede yer alan su\u00e7 bir zarar su\u00e7u olarak d\u00fczenlenmemi\u015f olsa da, somut tehlike su\u00e7udur ve somut tehlikenin her somut olayda mutlaka ortaya koyulmas\u0131 gerekir. Bu a\u00e7\u0131dan, tahrik amac\u0131yla s\u00f6ylenen s\u00f6zler ile ortaya \u00e7\u0131kan tehlikelilik hali aras\u0131nda illiyet ba\u011f\u0131n\u0131n kurulmas\u0131, bu s\u00f6zlerin tahrik ama\u00e7l\u0131 oldu\u011funun tespit edilmesi ve objektif olarak tehlikelilik halinin olu\u015fmas\u0131na elveri\u015fli olmas\u0131 gerekmektedir. Yine maddenin gerek\u00e7esinde belirtildi\u011fi \u00fczere;\u00a0\u201cSu\u00e7u olu\u015fturan \u2018tahrik\u2019, soyut sayg\u0131s\u0131zl\u0131k ve reddin \u00f6tesinde, bir halk kesimine kar\u015f\u0131 d\u00fc\u015fmanca tav\u0131rlar g\u00f6sterilmesini sa\u011flamaya veya bu t\u00fcr tav\u0131rlar\u0131 peki\u015ftirmeye objektif olarak elveri\u015fli olmal\u0131d\u0131r. Fail s\u00fcbjektif olarak da bu amac\u0131 g\u00fctmeli, halk kesimini kin ve nefrete tahrik etmelidir. Bu kapsamda salt y\u00fcz \u00e7evirme, soyut bir red veya sayg\u0131s\u0131zl\u0131k ifade eden bir davran\u0131\u015fta bulunma veya bu y\u00f6nde s\u00f6zler sarf etme, su\u00e7un ger\u00e7ekle\u015fmesi bak\u0131m\u0131ndan yeterli de\u011fildir. Fiilin su\u00e7 te\u015fkil etmesi i\u00e7in bunlar\u0131n \u00f6tesinde, a\u011f\u0131r ve yo\u011fun bir tarzda kin ve d\u00fc\u015fmanl\u0131\u011fa tahrikin var olmas\u0131 gerekir\u201d.<\/p>\n<p>\u201cKamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan a\u00e7\u0131k ve yak\u0131n bir tehlikenin ortaya \u00e7\u0131kmas\u0131\u201d\u00a0hali, TCK m.216\u2019n\u0131n uygulanmas\u0131 bak\u0131m\u0131ndan objektif cezaland\u0131r\u0131lma \u015fart\u0131 te\u015fkil etmektedir. Dolay\u0131s\u0131yla failin; halk\u0131n bir kesimini di\u011fer kesimine kar\u015f\u0131 TCK m.216\/1\u2019de belirtilen konulardan en az birisinden hareketle alenen tahrik etti\u011fi, fakat kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan bu tahrikin a\u00e7\u0131k ve yak\u0131n bir tehlikeye yol a\u00e7mad\u0131\u011f\u0131 olmad\u0131\u011f\u0131 durumda su\u00e7 olu\u015fmayacakt\u0131r. Halk kin ve d\u00fc\u015fmanl\u0131\u011fa tahrik su\u00e7unun yaln\u0131zca\u00a0tahrik\u00a0fiili ile ger\u00e7ekle\u015fece\u011fi kabul edilse idi, yap\u0131lan tahrikle bir tehlikenin ortaya \u00e7\u0131kmamas\u0131 halinde fiilin te\u015febb\u00fcs a\u015famas\u0131nda kalaca\u011f\u0131 s\u00f6ylenebilirdi, ancak tehlikelilik hali ortaya \u00e7\u0131kmad\u0131\u011f\u0131 s\u00fcrece ceza sorumlulu\u011funa gidilemedi\u011finden, TCK m.216\/1\u2019de d\u00fczenlenen su\u00e7 te\u015febb\u00fcse elveri\u015fli de\u011fildir.<\/p>\n<p>Netice olarak halk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa tahrik su\u00e7unda \u00fc\u00e7 husus \u00f6nemlidir;\u00a0ilki, halk\u0131n bir kesimini di\u011fer bir kesim aleyhine kin ve d\u00fc\u015fmanl\u0131\u011fa alenen tahrik etmek gerekir ki, burada hangi kesimin hangi kesim aleyhine tahrik edildi\u011fini tespit etmek l\u00fczumu vard\u0131r.\u00a0\u0130kincisi, failde kin ve d\u00fc\u015fmanl\u0131\u011fa alenen tahrik \u015feklinde tezah\u00fcr eden bir genel su\u00e7 i\u015fleme kast\u0131n\u0131n olmas\u0131 ve \u00fc\u00e7\u00fcnc\u00fc olarak da objektif cezaland\u0131r\u0131labilme \u015fart\u0131n\u0131n olmas\u0131, yani kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan a\u00e7\u0131k ve yak\u0131n bir tehlikenin ortaya \u00e7\u0131kmas\u0131 gerekir. Bu unsurlar birlikte ger\u00e7ekle\u015fmedik\u00e7e, T\u00fcrk Ceza Kanunu m.216\/1\u2019de tan\u0131mlanan halk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa tahrik su\u00e7u olu\u015fmayacakt\u0131r[5].<\/p>\n<p>2. TCK m.216\/1\u2019de Ge\u00e7en \u201cHalk\u0131n Bir Kesimi\u201d Ne Demektir?<\/p>\n<p>TCK m.216\/1\u2019de halk\u0131n sosyal s\u0131n\u0131f, \u0131rk, din, mezhep veya b\u00f6lge bak\u0131m\u0131ndan farkl\u0131 \u00f6zelliklere sahip bir kesimini, di\u011fer bir kesimi aleyhine ibaresine yer verildi\u011fi, bu nedenle su\u00e7un maddi ve manevi unsurlar\u0131n\u0131n olu\u015fmas\u0131nda \u00f6ncelikle ortada \u201ckanunilik\u201d ilkesine uygun d\u00fc\u015fecek halk\u0131n h\u00fck\u00fcmde belirtilen niteliklerinden en az birisine sahip bir kesimi ile di\u011fer bir kesiminin kar\u015f\u0131 kar\u015f\u0131ya getirilmesinin gerekti\u011fi, bu nedenle ortada yasal tan\u0131ma uygun en az iki kesimin bulunmas\u0131n\u0131n gerekti\u011fi, failde de icra etti\u011fi fiili ve kast\u0131 itibariyle kanuni tan\u0131ma uygun iki farkl\u0131 kesimi kin ve d\u00fc\u015fmanl\u0131\u011fa tahrik etme kast\u0131n\u0131n bulunmas\u0131 gerekti\u011fi, h\u00fck\u00fcmde ge\u00e7en aleniyetin maddi unsur i\u00e7inde de\u011ferlendirilip, f\u0131kran\u0131n sonunda g\u00f6sterilen sebebin de bir objektif cezaland\u0131r\u0131labilme \u015fart\u0131 olarak kabul\u00fcn\u00fcn uygun olaca\u011f\u0131 ifade edilmelidir.<\/p>\n<p>Buna g\u00f6re; halk\u0131n h\u00fck\u00fcmde belirtilen bir kesiminin ne oldu\u011funun belirlenmesi gerekti\u011fi, bunun emeklilerden veya i\u015f\u00e7ilerden olu\u015fan sosyal bir s\u0131n\u0131f olabilece\u011fi gibi, \u0131rk, buna ba\u011fl\u0131 olarak etnik k\u00f6ken, din, mezhep veya b\u00f6lgesel \u00f6zelliklerin \u00f6ne \u00e7\u0131kar\u0131ld\u0131\u011f\u0131 co\u011frafi b\u00f6lgeler veya bir co\u011frafi b\u00f6lgeden gelenlerin halk\u0131n bir kesimini olu\u015fturaca\u011f\u0131, bir siyasi partiye veya sivil toplum \u00f6rg\u00fct\u00fcne mensubiyetin do\u011frudan halk\u0131n bir kesimi olarak adland\u0131r\u0131lamayaca\u011f\u0131, fakat ki\u015filerin \u00fcye olarak bulunduklar\u0131 siyasi parti veya sivil toplum \u00f6rg\u00fct\u00fcnde yer alman\u0131n sosyal s\u0131n\u0131f veya h\u00fck\u00fcmde belirtilen di\u011fer \u00f6zelliklerden birisine ili\u015fkin oldu\u011fu durumda yine halk\u0131n bir kesiminden bahsedilece\u011fi, bu kapsamda \u00fclkede bulunan yabanc\u0131 k\u00f6kenlilerin veya yabanc\u0131lar\u0131n veya g\u00f6\u00e7menlerin, bu kapsamda ge\u00e7ici koruma stat\u00fcs\u00fcnde bulunanlar\u0131n, \u201csu\u00e7ta ve cezada kanunilik\u201d prensibi \u00e7er\u00e7evesinde TCK m.216\/1\u2019de yer alan tan\u0131ma uygun halk\u0131n bir kesimini olu\u015fturup olu\u015fturmayaca\u011f\u0131n\u0131n da, bu \u015fah\u0131slar\u0131n sosyal s\u0131n\u0131f, \u0131rk ve buna ba\u011fl\u0131 etnik k\u00f6ken, din, mezhep veya b\u00f6lgesel ortak \u00f6zelliklere sahip ki\u015filerden olup olmamas\u0131yla netle\u015ftirilmesinin gerekti\u011fi, bu kapsamda \u00fclkede yasal izinle veya izinsiz bulunan, ancak bulunma \u015fartlar\u0131 ve sebepleri toplumda tart\u0131\u015f\u0131lan yabanc\u0131lar \u00fczerinden yap\u0131lan ele\u015ftirilerin, bu insanlarla ilgili olumsuz de\u011ferlendirmelerin, konu bu \u015fah\u0131slara kar\u015f\u0131 su\u00e7 olu\u015fturabilecek fiillere, bu fiillere azmettirmeye veya yard\u0131ma d\u00f6n\u00fc\u015fmedik\u00e7e, TCK m216\/1\u2019de tan\u0131mlanan halk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa alenen tahrik su\u00e7u olu\u015fmayacakt\u0131r.<\/p>\n<p>\u00d6rne\u011fin; \u00fclkede bulunan ka\u00e7ak yabanc\u0131lar\u0131n, ge\u00e7ici koruma alt\u0131nda olanlar\u0131n veya ikamet etmek veya \u00e7al\u0131\u015fmak i\u00e7in gelenlerin, \u00fclke ve millet bak\u0131m\u0131ndan iktisadi, sosyal, hukuki, demografik yap\u0131 ve g\u00fcvenlik a\u00e7\u0131s\u0131ndan sorunlara sebebiyet verildi\u011finin s\u00f6ylenmesi, bu y\u00f6nde ele\u015ftiriler yap\u0131lmas\u0131, bu t\u00fcr ele\u015ftirilere ba\u011fl\u0131 olsun veya olmas\u0131n \u00fclke i\u00e7inde \u00e7\u0131kabilecek birtak\u0131m hadiselere ili\u015fkin halk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa alenen tahrik olarak nitelendirilemez, \u00e7\u00fcnk\u00fc g\u00fcndeme getirilen ele\u015ftiriler hukukilikten ve me\u015fruluktan uzak olmayan toplumda ya\u015fanan huzursuzluklar\u0131n ve dile getirilen itirazlar\u0131n bir yans\u0131mas\u0131d\u0131r. Ceza Hukuku a\u00e7\u0131s\u0131ndan konuya bakt\u0131\u011f\u0131m\u0131zda ise; yine de \u00fclkemizde ka\u00e7ak veya izinsiz veya ge\u00e7ici koruma alt\u0131nda veya bir ba\u015fka stat\u00fc ile kalanlara d\u00f6n\u00fck ele\u015ftiriler, \u00f6ne \u00e7\u0131kar\u0131lan itirazlar, halk\u0131n sosyal s\u0131n\u0131f, \u0131rk ve buna ba\u011fl\u0131 olarak etnik k\u00f6ken, din, mezhep veya b\u00f6lge bak\u0131m\u0131ndan farkl\u0131 \u00f6zelliklerine sahip bir kesiminin di\u011fer bir kesim aleyhine kin ve d\u00fc\u015fmanl\u0131\u011fa alenen tahrik edilmesi olarak yorumlanamaz, \u00e7\u00fcnk\u00fc burada kesimler aras\u0131nda kar\u015f\u0131 kar\u015f\u0131ya getirme de\u011fil, \u00fclkenin bir sorununun tart\u0131\u015fmaya a\u00e7\u0131lmas\u0131 ve h\u00fck\u00fcmde belirtilen nitelikler \u00fczerinden konunun tart\u0131\u015f\u0131lmay\u0131p, bir b\u00fct\u00fcnde \u00fclkeye d\u00fczensiz olarak g\u00f6\u00e7 edenlerin veya \u00fclkede ka\u00e7ak olarak bulunanlar\u0131n yol a\u00e7t\u0131\u011f\u0131 sorunlara ba\u011fl\u0131 hususlar\u0131n ortaya koyulmas\u0131 vard\u0131r. Demokratik hukuk toplumlar\u0131nda bu t\u00fcr itirazlar\u0131n dile getirilmesi, halk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa alenen tahrik su\u00e7unun maddi ve manevi unsurlar\u0131n\u0131n olu\u015ftu\u011funu g\u00f6stermez.<\/p>\n<p>Ancak bu t\u00fcr bir sorunun dile getirilmesi yerine, \u0131rk, din, mezhep, buna ba\u011fl\u0131 etnik k\u00f6ken ve milliyet bak\u0131m\u0131ndan ortaya koyulacak ve ele\u015ftiri s\u0131n\u0131rlar\u0131n\u0131 a\u015fan, cebir ve \u015fiddet \u00e7a\u011fr\u0131s\u0131 i\u00e7eren, tehdit niteli\u011fi ta\u015f\u0131yan a\u00e7\u0131klamalar\u0131n ifade ve bas\u0131n h\u00fcrriyetlerinin hukuka uygunluk k\u0131sm\u0131nda kalmayaca\u011f\u0131n\u0131, kamu bar\u0131\u015f\u0131na kar\u015f\u0131 su\u00e7lar kapsam\u0131nda de\u011ferlendirilebilece\u011fini, bu \u00e7er\u00e7evede halk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa tahrik su\u00e7unun g\u00fcndeme gelebilece\u011fini belirtmek isteriz. Ge\u00e7ici koruma stat\u00fcs\u00fcn\u00fcn kanunilik ve me\u015fruiyet i\u00e7erdi\u011fi, her ne kadar bu stat\u00fc TCK m.216\/1 anlam\u0131nda halk\u0131n bir kesimi anlam\u0131na gelmese de, stat\u00fc kapsam\u0131na girenlerin stat\u00fc gere\u011fi ta\u015f\u0131d\u0131\u011f\u0131 \u00f6zelliklerden dolay\u0131 h\u00fck\u00fcm kapsam\u0131nda de\u011ferlendirilmeleri m\u00fcmk\u00fcnd\u00fcr. Kanun koyucu da; m.216\/1 ile kamu bar\u0131\u015f\u0131n\u0131 korumay\u0131 hedeflemi\u015f olup, kin ve d\u00fc\u015fmanl\u0131\u011fa alenen tahrikte h\u00fck\u00fcmde ge\u00e7en s\u0131n\u0131flar\u0131 ve kesimleri, cebir ve \u015fiddet diliyle kar\u015f\u0131 kar\u015f\u0131ya getirmenin su\u00e7 oldu\u011funu ifade etmektedir.<\/p>\n<p>3. TCK m.218\u2019de Yer Alan Nitelikli Hal<\/p>\n<p>T\u00fcrk Ceza Kanunu\u2019nun 218. maddesine g\u00f6re, dini de\u011ferleri a\u015fa\u011f\u0131lama su\u00e7unun bas\u0131n ve yay\u0131n yoluyla ve dolay\u0131s\u0131yla T\u00fcrk Ceza Kanunu m.6\/1,(g) uyar\u0131nca internet vas\u0131tas\u0131yla i\u015flenmesi halinde, fail hakk\u0131nda tayin edilecek ceza yar\u0131 oran\u0131nda art\u0131r\u0131lacakt\u0131r. Bunun i\u00e7in, haber verme s\u0131n\u0131rlar\u0131n\u0131n a\u015f\u0131lmas\u0131 ve ele\u015ftiri amac\u0131yla yap\u0131lan d\u00fc\u015f\u00fcnce a\u00e7\u0131klamas\u0131n\u0131n d\u0131\u015f\u0131na \u00e7\u0131k\u0131lmas\u0131 gerekir. Aksi halde, bas\u0131n ve yay\u0131n yoluyla a\u015fa\u011f\u0131lama su\u00e7unun olu\u015fmad\u0131\u011f\u0131 kabul edilecektir.<\/p>\n<p>Gerek Anayasan\u0131n \u201cD\u00fc\u015f\u00fcnceyi a\u00e7\u0131klama ve yayma h\u00fcrriyeti\u201d ba\u015fl\u0131kl\u0131 26. maddesi ve gerekse 5187 say\u0131l\u0131 Bas\u0131n Kanunu\u2019nun \u201cBas\u0131n \u00f6zg\u00fcrl\u00fc\u011f\u00fc\u201d ba\u015fl\u0131kl\u0131 3. maddesi ile koruma alt\u0131na al\u0131nan haber verme hakk\u0131n\u0131n kapsam\u0131n\u0131 a\u015fmayan ve ele\u015ftiri amac\u0131 ta\u015f\u0131yan ifadeler, TCK m.216\u2019da d\u00fczenlenen su\u00e7u olu\u015fturmayacakt\u0131r. Bu hallerde \u00f6zellikle ikinci ve \u00fc\u00e7\u00fcnc\u00fc su\u00e7 tipleri bak\u0131m\u0131ndan a\u015fa\u011f\u0131lama kast\u0131 bulunmayaca\u011f\u0131ndan, yaln\u0131zca haber verme kast\u0131 bulundu\u011fundan veya bilimsel bir \u00e7al\u0131\u015fmada yer verilen ifadeler, manevi unsur kar\u015f\u0131lanmad\u0131\u011f\u0131ndan su\u00e7 olarak nitelendirilemeyebilecektir[6].<\/p>\n<p>4. Su\u00e7a \u0130li\u015fkin Yarg\u0131tay, Anayasa Mahkemesi ve \u0130nsan Haklar\u0131 Avrupa Mahkemesi \u0130\u00e7tihad\u0131 ile \u0130fade \u00d6zg\u00fcrl\u00fc\u011f\u00fc ile Su\u00e7un \u0130li\u015fkisi<\/p>\n<p>AYM;\u00a0Hakan Ayg\u00fcn\u00a0karar\u0131nda[7],\u00a0toplumun baz\u0131 kesimlerini \u00f6tekile\u015ftiren hatta a\u015fa\u011f\u0131layan\u00a0\u00fcslup ve ifadelerin,\u00a0tek ba\u015flar\u0131na, yani nefret i\u00e7eren s\u00f6zler veya \u015fiddet \u00e7a\u011fr\u0131s\u0131 \u015feklinde bir olgu s\u00f6zkonusu olmaks\u0131z\u0131n, TCK m.216\/1\u2019de d\u00fczenlenen su\u00e7un i\u015flendi\u011fi y\u00f6n\u00fcnde kuvvetli \u015f\u00fcphe olu\u015fturmayaca\u011f\u0131n\u0131 belirtmi\u015ftir. Ayr\u0131ca; AYM\u2019ye g\u00f6re, ihtilafl\u0131 ifadelerin sosyal medyada \u00e7ok say\u0131da be\u011feni almas\u0131 ve pop\u00fcler hale gelmesi bu tespiti etkilemeyecektir.<\/p>\n<p>TCK m.216\/1\u2019in \u015fiddet \u00e7a\u011fr\u0131s\u0131 veya k\u0131\u015fk\u0131rtmas\u0131 i\u00e7ermeyen ifadelere de uygulanmas\u0131 maddenin lafz\u0131na, amac\u0131na ve Yarg\u0131tay\u2019\u0131n belirlemelerine ayk\u0131r\u0131d\u0131r. Su\u00e7un kapsam\u0131n\u0131n bu \u015fekilde geni\u015fletilmesi, su\u00e7un \u00f6ng\u00f6r\u00fclebilirli\u011fini ortadan kald\u0131rmakta, dolay\u0131s\u0131yla \u201csu\u00e7ta ve cezada kanunilik\u201d ilkesine ayk\u0131r\u0131 sonu\u00e7lar do\u011furmaktad\u0131r.<\/p>\n<p>Yarg\u0131tay 18. Ceza Dairesi\u00a008.01.2019 tarihli ve 2018\/3616 E., 2019\/598\u00a0K. say\u0131l\u0131 karar\u0131nda,\u00a0halk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa tahrik su\u00e7u ile ilgili a\u015fa\u011f\u0131daki de\u011ferlendirmelerde bulunmu\u015ftur:<\/p>\n<p>&#8211; Objektif ve tarafs\u0131zl\u0131ktan uzak, incitici, sayg\u0131nl\u0131\u011f\u0131 zedeleyici, rahats\u0131z edici,\u00a0fakat \u015fiddet i\u00e7ermeyen ve \u015fiddet k\u0131\u015fk\u0131rt\u0131c\u0131l\u0131\u011f\u0131 bulunmayan, yak\u0131n tehlikeye neden olmayan beyanlar bu su\u00e7un konusunu olu\u015fturmamaktad\u0131r.<\/p>\n<p>&#8211; Kin ve d\u00fc\u015fmanl\u0131k; husumet beslenen konuya kar\u015f\u0131 tasarlayarak zarar vermeye, \u00f6\u00e7 almay\u0131 gerektirecek \u015fiddette nefret duymaya y\u00f6nelik hareketlerin zeminini olu\u015fturan psikolojik bir hal olarak a\u00e7\u0131klanabilir.\u00a0Kin ve d\u00fc\u015fmanl\u0131k ibaresinin anlam\u0131 da dikkate al\u0131nd\u0131\u011f\u0131nda, sadece \u015fiddet i\u00e7eren ya da \u015fiddet tavsiye eden tahrikler madde kapsam\u0131nda de\u011ferlendirilebilecektir.<\/p>\n<p>&#8211; Yasal s\u0131n\u0131rl\u0131l\u0131kla belirlenen farkl\u0131l\u0131klar\u0131 tahrike y\u00f6nelmeyen,\u00a0\u015fiddet \u00e7a\u011fr\u0131s\u0131 ve nefret i\u00e7erikli s\u00f6zler i\u00e7ermeyen, somut ve yak\u0131n tehlike d\u00fczeyine de ula\u015fmam\u0131\u015f k\u0131\u015fk\u0131rtmalar\u0131n su\u00e7a konu edilmesi su\u00e7un kanunili\u011fi ilkesiyle ba\u011fda\u015fmaz.<\/p>\n<p>\u0130nsan Haklar\u0131 Avrupa Mahkemesi\u2019nin; \u0130nsan Haklar\u0131 Avrupa S\u00f6zle\u015fmesi\u2019nin 10. maddesi kapsam\u0131nda d\u00fc\u015f\u00fcncenin a\u00e7\u0131klanmas\u0131 \u00f6zg\u00fcrl\u00fc\u011f\u00fc ile ilgili kararlar\u0131nda, d\u00fc\u015f\u00fcncenin a\u00e7\u0131klanmas\u0131 \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn s\u0131n\u0131rlanmas\u0131nda arad\u0131\u011f\u0131 ko\u015fullar;<\/p>\n<p>&#8211; Yasal bir d\u00fczenleme bulunmas\u0131,<\/p>\n<p>&#8211; S\u0131n\u0131rlaman\u0131n me\u015fru bir ama\u00e7la yap\u0131lmas\u0131<\/p>\n<p>&#8211; S\u0131n\u0131rlaman\u0131n demokratik bir toplum i\u00e7in gerekli olmas\u0131,<\/p>\n<p>&#8211; Yasall\u0131k ilkesine uygun verilen cezan\u0131n, g\u00fcd\u00fclen me\u015fru ama\u00e7la orant\u0131l\u0131 olmas\u0131,<\/p>\n<p>\u015eeklindedir[8].<\/p>\n<p>\u0130HAM kararlar\u0131nda; bu ko\u015fullar \u0131\u015f\u0131\u011f\u0131nda olaysal de\u011ferlendirme yap\u0131lmakta, d\u00fc\u015f\u00fcnceyi a\u00e7\u0131klama \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn as\u0131l, k\u0131s\u0131tlaman\u0131n istisna oldu\u011fu ortaya koyularak, \u201c\u015fiddet i\u00e7ermeyen ya da \u015fiddeti tavsiye etmeyen\u201d a\u00e7\u0131klamalar\u0131n hukukun koruma alan\u0131nda oldu\u011funa i\u015faret olunmakta, hatta bu koruman\u0131n ayn\u0131 zamanda k\u0131r\u0131c\u0131, \u015fok edici veya rahats\u0131z edici kar\u015f\u0131 g\u00f6r\u00fc\u015flere bile tahamm\u00fcl\u00fc gerektirdi\u011fi vurgulanmaktad\u0131r.<\/p>\n<p>Bu hususlar; \u0130HAM\u2019\u0131n Ba\u015fkaya ve Ok\u00e7uo\u011flu\/T\u00fcrkiye karar\u0131nda ortaya koyulmu\u015f, keskin ifadelerin dahi \u015fiddeti te\u015fvik etti\u011finin s\u00f6ylenemedi\u011fi durumda, ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc kapsam\u0131nda de\u011ferlendirilmesi gerekti\u011fi ortaya koyulmu\u015ftur[9].<\/p>\n<p>5. Su\u00e7un Objektif Cezaland\u0131r\u0131labilirlik \u015eart\u0131 A\u00e7\u0131s\u0131ndan Yararlan\u0131labilecek \u0130nternet Verileri<\/p>\n<p>Halk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa tahrik etme su\u00e7unun olu\u015fabilmesi i\u00e7in, halk\u0131n bir kesiminin di\u011fer kesimine kar\u015f\u0131 kin ve d\u00fc\u015fmanl\u0131k duymas\u0131 i\u00e7in alenen tahrik edilmesi zorunlu ise de, yeterli olmay\u0131p, failin eylemi sonucunda kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan a\u00e7\u0131k ve yak\u0131n bir tehlikenin de do\u011fmu\u015f olmas\u0131 gerekmektedir[10]. Bu, su\u00e7 a\u00e7\u0131s\u0131ndan bir objektif cezaland\u0131r\u0131labilirlik \u015fart\u0131d\u0131r ve bu \u015fart ger\u00e7ekle\u015fmeden failin TCK m.216\/1\u2019den cezaland\u0131r\u0131labilmesi m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p>Dolay\u0131s\u0131yla; TCK m.216\/1\u2019den cezaland\u0131rma i\u00e7in, failin eylemi sonucunda, bir toplum i\u00e7erisinde kolluk hizmetleri yoluyla sa\u011flanan can ve mal g\u00fcvenli\u011fi anlam\u0131na gelen, kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan, a\u00e7\u0131k ve yak\u0131n bir tehlikenin ortaya \u00e7\u0131kmas\u0131 aranacakt\u0131r[11]. Sonu\u00e7 itibariyle; failin s\u00f6z ve davran\u0131\u015flar\u0131n\u0131n, halk\u0131n bir kesimi \u00fczerinde tahrik konusu fiillerin i\u015flenece\u011fi hususunda duyulan endi\u015feyi hakl\u0131 k\u0131lacak bir etki olu\u015fturmas\u0131 ve bu do\u011frultuda zarar neticesi do\u011furmayan bir hareketlenmenin meydana getirmesi aran\u0131r. \u00d6rne\u011fin, i\u015flenen fiil neticesinde \u00e7e\u015fitli halk kesimlerinin bir yerlerde toplanmas\u0131 veya bu halk kesimleri aras\u0131nda infialin meydana gelmesi \u015feklinde[12].<\/p>\n<p>Yukar\u0131dan anla\u015f\u0131ld\u0131\u011f\u0131 \u00fczere; halk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa tahrik etme su\u00e7unda, fail taraf\u0131ndan yap\u0131lan hareketlerin bir objektif cezaland\u0131rma \u015fart\u0131 olan kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan, a\u00e7\u0131k ve yak\u0131n bir tehlike olu\u015fturmas\u0131 gerekti\u011fi ve failin kesin bir \u015fekilde cezaland\u0131r\u0131labilmesi i\u00e7in bu \u015fart\u0131n ger\u00e7ekle\u015fti\u011finin hi\u00e7bir \u015f\u00fcpheye mahal b\u0131rakmayacak bi\u00e7imde ortaya koyulmas\u0131 \u015fartt\u0131r. \u0130\u015fte burada kanaatimizce, g\u00fcn\u00fcm\u00fcz \u015fartlar\u0131na uygun olarak internet verilerinden yararlan\u0131labilir.<\/p>\n<p>Bir ki\u015finin T\u00fcrkiye genelinde ne kadar, hangi konuda arand\u0131\u011f\u0131, ne etkide g\u00f6z\u00fckt\u00fc\u011f\u00fc g\u00fcn\u00fcm\u00fcz \u015fartlar\u0131nda a\u00e7\u0131k kaynaktan dahi eri\u015filebilir bilgilerdir. Dolay\u0131s\u0131yla; su\u00e7un cezaland\u0131r\u0131labilmesi i\u00e7in en \u00f6nemli \u015fartlardan birisi olan objektif cezaland\u0131r\u0131labilme \u015fartlar\u0131n\u0131n ger\u00e7ekle\u015fip ger\u00e7ekle\u015fmedi\u011fi bak\u0131m\u0131ndan, g\u00fcn\u00fcm\u00fcz imkanlar\u0131 \u00e7er\u00e7evesinde internet ve di\u011fer a\u00e7\u0131k kaynak verilerinden faydalan\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>\u00d6rne\u011fin; bir ilde kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan, a\u00e7\u0131k ve yak\u0131n bir tehlikenin ortaya \u00e7\u0131kt\u0131\u011f\u0131 ve bundan bir ki\u015finin internet \u00fczerinden payla\u015ft\u0131\u011f\u0131 s\u00f6zleri dolay\u0131s\u0131yla sorumlu oldu\u011fu iddia edildi\u011finde, o ilde kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan, a\u00e7\u0131k ve yak\u0131n bir tehlikenin olu\u015ftu\u011fu tarih veya tarihler aras\u0131nda failin o ilde internet \u00fczerinden ne kadar arand\u0131\u011f\u0131 ve etkile\u015fiminin, etkisinin ne kadar oldu\u011fu g\u00f6z\u00f6n\u00fcnde bulundurulabilir. Bu veriler, b\u00f6yle bir \u00f6rnek \u00fczerinde su\u00e7un objektif cezaland\u0131r\u0131labilirlik \u015fart\u0131n\u0131n ger\u00e7ekle\u015fip ger\u00e7ekle\u015fmedi\u011finin tespitinde \u00f6nem arz etmektedir.<\/p>\n<p>5. Sonu\u00e7<\/p>\n<p>G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere; TCK m.216\u2019n\u0131n tatbiki olduk\u00e7a s\u0131k\u0131 \u015fartlara ba\u011flanm\u0131\u015f, bir\u00e7ok su\u00e7ta nitelikli hal olarak kabul edilen aleniyet unsurunun burada su\u00e7un maddi unsuru olarak aranmas\u0131n\u0131n yan\u0131 s\u0131ra, kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan somut bir tehlikenin varl\u0131\u011f\u0131 olmaks\u0131z\u0131n da icra edilen fiillerin cezaland\u0131r\u0131lamayaca\u011f\u0131 belirtilmi\u015ftir.<\/p>\n<p>TCK m.216\/1\u2019de ge\u00e7en halk\u0131n bir kesimi ibaresinin ne anlama geldi\u011fi yukar\u0131da a\u00e7\u0131klanm\u0131\u015ft\u0131r. Bu kavramla ilgili \u201csu\u00e7ta ve cezada kanunilik\u201d prensibine ba\u011fl\u0131 kalmak gerekir. Kar\u015f\u0131 kar\u015f\u0131ya getirilen iki kesimde; h\u00fck\u00fcmde ge\u00e7en sosyal s\u0131n\u0131f, \u0131rk, buna ba\u011fl\u0131 olarak etnik k\u00f6ken, din, mezhep veya b\u00f6lge bak\u0131m\u0131ndan farkl\u0131 \u00f6zelliklere sahip olma hususlar\u0131n\u0131n aranmas\u0131 gerekti\u011fi, burada ge\u00e7en s\u0131n\u0131f ve \u00f6zelliklerin ne anlama geldi\u011finin her somut olay\u0131n \u00f6zelliklerine g\u00f6re ayr\u0131ca de\u011ferlendirilebilece\u011fi, fakat h\u00fck\u00fcmde ge\u00e7en sosyal s\u0131n\u0131f ve di\u011fer \u00f6zelliklerden ba\u015fka bir \u00f6zelli\u011fe ba\u011fl\u0131 olarak yeni bir kesim ihdas\u0131 yoluna gidilemeyece\u011fi, \u00e7\u00fcnk\u00fc kanun koyucunun \u201ckanunilik\u201d ilkesini koruyarak, gibi, ve benzeri, buna benzer \u015fekilde t\u00fcr\u00fcnde ibarelere h\u00fck\u00fcmde yer vermedi\u011fi izahtan varestedir.<\/p>\n<p>Kanuni d\u00fczenlemede bu ko\u015fullar\u0131n varl\u0131\u011f\u0131ndan a\u00e7\u0131k\u00e7a bahsedilse de, uygulamada soru\u015fturma veya kovu\u015fturma ba\u015flat\u0131lmas\u0131 hedeflenen s\u00f6zlerin, kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan somut bir tehlikeye neden olup olamayaca\u011f\u0131 incelenmeksizin bu madde kapsam\u0131nda de\u011ferlendirildi\u011fi, bireyler hakk\u0131nda keyfi soru\u015fturmalar ba\u015flat\u0131ld\u0131\u011f\u0131, TCK m.115\/3\u2019de tan\u0131mlanan ya\u015fam tarz\u0131na hukuka ayk\u0131r\u0131 m\u00fcdahale ile TCK m.122\u2019de \u00f6ng\u00f6r\u00fclen nefret ve ay\u0131r\u0131mc\u0131l\u0131k su\u00e7lar\u0131n\u0131n tatbik edilemedi\u011fi hallerde\u00a0torba h\u00fck\u00fcm\u00a0olarak 216. maddeye ba\u015fvuruldu\u011fu, oysa objektif cezaland\u0131rma ko\u015fulu ger\u00e7ekle\u015fmeden soru\u015fturma dahi ba\u015flat\u0131lamayaca\u011f\u0131, ihbar ve \u015fikayete konusu fiilin su\u00e7 olu\u015fturmad\u0131\u011f\u0131n\u0131n herhangi bir ara\u015ft\u0131rma yap\u0131lmas\u0131n\u0131 gerektirmeksizin a\u00e7\u0131k\u00e7a anla\u015f\u0131lmas\u0131 veya ihbar\u0131n ve \u015fikayetin soyut ve genel nitelikte olmas\u0131 durumunda CMK m.158\/6 uyar\u0131nca soru\u015fturmaya yer olmad\u0131\u011f\u0131 karar\u0131 verilmesi gerekti\u011fi, aksi takdirde bireyin ifade h\u00fcrriyeti, TCK m.2, Anayasa m.38 ve \u0130HAS m.7 ile g\u00fcvence alt\u0131na al\u0131nan \u201ckanunilik\u201d ilkesine, ayn\u0131 \u015fekilde temel hak ve h\u00fcrriyetlerin nas\u0131l s\u0131n\u0131rlanaca\u011f\u0131n\u0131 d\u00fczenleyen Anayasan\u0131n 13. maddesine ayk\u0131r\u0131 olarak s\u0131n\u0131rlanaca\u011f\u0131, \u00e7\u00fcnk\u00fc bu s\u0131n\u0131rlaman\u0131n kanunilik, \u00f6l\u00e7\u00fcl\u00fcl\u00fck ve me\u015fruluk \u015fartlar\u0131n\u0131 ta\u015f\u0131mas\u0131 gerekti\u011fi, kanuni d\u00fczenlemenin bu \u015fartlar\u0131 ta\u015f\u0131d\u0131\u011f\u0131 halde ise, maddenin uygulama alan\u0131n\u0131n k\u0131yas veya k\u0131yasa varan geni\u015fletici yorum yap\u0131larak geni\u015fletilemeyece\u011fi, aksi halde hukuki \u00f6ng\u00f6r\u00fclebilirli\u011fin ve bilinirli\u011fin ortadan kalkaca\u011f\u0131, bunun kamuoyunda cayd\u0131r\u0131c\u0131 etkiye neden olaca\u011f\u0131, insanlar\u0131n fikirlerini dile getirmekten imtina edece\u011fi, her ne kadar kovu\u015fturma evresi sonucunda beraat karar\u0131 verilecek olsa dahi, bireylerin esas\u0131nda adli s\u00fcrece dahil edilerek cezaland\u0131r\u0131laca\u011f\u0131 ve \u00fczerlerinde ciddi bask\u0131 olu\u015faca\u011f\u0131, bununda demokratik hukuk toplumu anlay\u0131\u015f\u0131na zarar verece\u011fi tart\u0131\u015fmas\u0131zd\u0131r.<\/p>\n<p>6. Birinci f\u0131krada su\u00e7; \u201csomut tehlike\u201d su\u00e7u olarak tan\u0131mlanm\u0131\u015f ve somut tehlike,\u00a0\u201ckamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan a\u00e7\u0131k ve yak\u0131n bir tehlikenin ortaya \u00e7\u0131kmas\u0131\u201d\u00a0olarak g\u00f6sterilmi\u015ftir, yani somut olayda bu tehlike tespit edilmedik\u00e7e esasen su\u00e7un maddi unsurunun varl\u0131\u011f\u0131ndan bahsedilemez. Bununla birlikte, somut tehlike i\u00e7in aranan \u015fart\u0131n bir objektif cezaland\u0131r\u0131labilme \u015fart\u0131 oldu\u011fu kabul edilmektedir.<\/p>\n<p>Fail; halk\u0131n sosyal s\u0131n\u0131f, \u0131rk, din, mezhep veya b\u00f6lge bak\u0131m\u0131ndan farkl\u0131 \u00f6zelliklere sahip bir kesimini (bir b\u00f6l\u00fcm\u00fc, bir b\u00f6lgeyi veya ortak \u00f6zellikleri ta\u015f\u0131yan T\u00fcrk Toplumunu olu\u015fturan bir toplulu\u011fu), di\u011fer bir kesimi (bir b\u00f6l\u00fcm\u00fc, bir b\u00f6lgeyi veya ortak \u00f6zellikleri ta\u015f\u0131yan T\u00fcrk Toplumunu olu\u015fturan bir toplulu\u011fu) aleyhine kin ve d\u00fc\u015fmanl\u0131\u011fa alenen tahrik ederken, bu farkl\u0131 \u00f6zellikleri bilmeli ve isteyerek tahrik etmelidir[1].<\/p>\n<p>D\u00fczenlendi\u011fi b\u00f6l\u00fcm itibariyle kamu bar\u0131\u015f\u0131n\u0131 korumay\u0131 hedefleyen bu ceza normu, a\u00e7\u0131k ve yak\u0131n bir tehlikenin ortaya \u00e7\u0131kmas\u0131 halini arad\u0131\u011f\u0131 i\u00e7in bir somut tehlike su\u00e7u olarak kabul edilir. Soyut tehlikede olan belirsizlik, somut tehlikede hen\u00fcz zarara d\u00f6n\u00fc\u015fmemi\u015f, ancak\u00a0belirginle\u015fmi\u015f\u00a0ve\u00a0fark edilebilir\u00a0tehlikenin varl\u0131\u011f\u0131na i\u015faret eder. Dolay\u0131s\u0131yla, kamu g\u00fcvenli\u011finin bozulmas\u0131 tehlikesinin somut olgularla tespit edilmesi gerekir. Kamu g\u00fcvenli\u011fi; toplumun ve toplumu olu\u015fturan bireylerin can ve mal g\u00fcvenli\u011finin korunmas\u0131, en \u00f6nemlisi de bu g\u00fcvenli\u011fin kamu hizmeti olarak Devlet taraf\u0131ndan sa\u011flanmas\u0131n\u0131 ifade eder[2].<\/p>\n<p>Burada tahrikin, kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan a\u00e7\u0131k ve yak\u0131n tehlike ortaya \u00e7\u0131karmas\u0131 arand\u0131\u011f\u0131ndan, tahrik ile kamu g\u00fcvenli\u011finin ger\u00e7ekten bozulmas\u0131 \u015fart de\u011fildir, kamu g\u00fcvenli\u011finin bozulmas\u0131 konusunda a\u00e7\u0131k ve yak\u0131n bir tehlikenin ortaya \u00e7\u0131kmas\u0131 yeterlidir[3]. 216. madde, bir zarar su\u00e7u olarak d\u00fczenlenmemi\u015ftir. H\u00fck\u00fcmde ge\u00e7en \u201ca\u00e7\u0131kl\u0131k\u201d kavram\u0131ndan, tehlikenin \u015f\u00fcpheye yer b\u0131rakmayacak \u00f6l\u00e7\u00fcde ortaya \u00e7\u0131kmas\u0131, \u201cyak\u0131nl\u0131k\u201d kavram\u0131ndan ise, d\u00fc\u015f\u00fcnce a\u00e7\u0131klamas\u0131nda kullan\u0131lan kelimelerin, bir zarara sebebiyet verme olas\u0131l\u0131\u011f\u0131na yak\u0131n olma anla\u015f\u0131lmal\u0131d\u0131r[4].<\/p>\n<p>Her ne kadar 216. maddede yer alan su\u00e7 bir zarar su\u00e7u olarak d\u00fczenlenmemi\u015f olsa da, somut tehlike su\u00e7udur ve somut tehlikenin her somut olayda mutlaka ortaya koyulmas\u0131 gerekir. Bu a\u00e7\u0131dan, tahrik amac\u0131yla s\u00f6ylenen s\u00f6zler ile ortaya \u00e7\u0131kan tehlikelilik hali aras\u0131nda illiyet ba\u011f\u0131n\u0131n kurulmas\u0131, bu s\u00f6zlerin tahrik ama\u00e7l\u0131 oldu\u011funun tespit edilmesi ve objektif olarak tehlikelilik halinin olu\u015fmas\u0131na elveri\u015fli olmas\u0131 gerekmektedir. Yine maddenin gerek\u00e7esinde belirtildi\u011fi \u00fczere;\u00a0\u201cSu\u00e7u olu\u015fturan \u2018tahrik\u2019, soyut sayg\u0131s\u0131zl\u0131k ve reddin \u00f6tesinde, bir halk kesimine kar\u015f\u0131 d\u00fc\u015fmanca tav\u0131rlar g\u00f6sterilmesini sa\u011flamaya veya bu t\u00fcr tav\u0131rlar\u0131 peki\u015ftirmeye objektif olarak elveri\u015fli olmal\u0131d\u0131r. Fail s\u00fcbjektif olarak da bu amac\u0131 g\u00fctmeli, halk kesimini kin ve nefrete tahrik etmelidir. Bu kapsamda salt y\u00fcz \u00e7evirme, soyut bir red veya sayg\u0131s\u0131zl\u0131k ifade eden bir davran\u0131\u015fta bulunma veya bu y\u00f6nde s\u00f6zler sarf etme, su\u00e7un ger\u00e7ekle\u015fmesi bak\u0131m\u0131ndan yeterli de\u011fildir. Fiilin su\u00e7 te\u015fkil etmesi i\u00e7in bunlar\u0131n \u00f6tesinde, a\u011f\u0131r ve yo\u011fun bir tarzda kin ve d\u00fc\u015fmanl\u0131\u011fa tahrikin var olmas\u0131 gerekir\u201d.<\/p>\n<p>\u201cKamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan a\u00e7\u0131k ve yak\u0131n bir tehlikenin ortaya \u00e7\u0131kmas\u0131\u201d\u00a0hali, TCK m.216\u2019n\u0131n uygulanmas\u0131 bak\u0131m\u0131ndan objektif cezaland\u0131r\u0131lma \u015fart\u0131 te\u015fkil etmektedir. Dolay\u0131s\u0131yla failin; halk\u0131n bir kesimini di\u011fer kesimine kar\u015f\u0131 TCK m.216\/1\u2019de belirtilen konulardan en az birisinden hareketle alenen tahrik etti\u011fi, fakat kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan bu tahrikin a\u00e7\u0131k ve yak\u0131n bir tehlikeye yol a\u00e7mad\u0131\u011f\u0131 olmad\u0131\u011f\u0131 durumda su\u00e7 olu\u015fmayacakt\u0131r. Halk kin ve d\u00fc\u015fmanl\u0131\u011fa tahrik su\u00e7unun yaln\u0131zca\u00a0tahrik\u00a0fiili ile ger\u00e7ekle\u015fece\u011fi kabul edilse idi, yap\u0131lan tahrikle bir tehlikenin ortaya \u00e7\u0131kmamas\u0131 halinde fiilin te\u015febb\u00fcs a\u015famas\u0131nda kalaca\u011f\u0131 s\u00f6ylenebilirdi, ancak tehlikelilik hali ortaya \u00e7\u0131kmad\u0131\u011f\u0131 s\u00fcrece ceza sorumlulu\u011funa gidilemedi\u011finden, TCK m.216\/1\u2019de d\u00fczenlenen su\u00e7 te\u015febb\u00fcse elveri\u015fli de\u011fildir.<\/p>\n<p>Netice olarak halk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa tahrik su\u00e7unda \u00fc\u00e7 husus \u00f6nemlidir;\u00a0ilki, halk\u0131n bir kesimini di\u011fer bir kesim aleyhine kin ve d\u00fc\u015fmanl\u0131\u011fa alenen tahrik etmek gerekir ki, burada hangi kesimin hangi kesim aleyhine tahrik edildi\u011fini tespit etmek l\u00fczumu vard\u0131r.\u00a0\u0130kincisi, failde kin ve d\u00fc\u015fmanl\u0131\u011fa alenen tahrik \u015feklinde tezah\u00fcr eden bir genel su\u00e7 i\u015fleme kast\u0131n\u0131n olmas\u0131 ve \u00fc\u00e7\u00fcnc\u00fc olarak da objektif cezaland\u0131r\u0131labilme \u015fart\u0131n\u0131n olmas\u0131, yani kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan a\u00e7\u0131k ve yak\u0131n bir tehlikenin ortaya \u00e7\u0131kmas\u0131 gerekir. Bu unsurlar birlikte ger\u00e7ekle\u015fmedik\u00e7e, T\u00fcrk Ceza Kanunu m.216\/1\u2019de tan\u0131mlanan halk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa tahrik su\u00e7u olu\u015fmayacakt\u0131r[5].<\/p>\n<p>2. TCK m.216\/1\u2019de Ge\u00e7en \u201cHalk\u0131n Bir Kesimi\u201d Ne Demektir?<\/p>\n<p>TCK m.216\/1\u2019de halk\u0131n sosyal s\u0131n\u0131f, \u0131rk, din, mezhep veya b\u00f6lge bak\u0131m\u0131ndan farkl\u0131 \u00f6zelliklere sahip bir kesimini, di\u011fer bir kesimi aleyhine ibaresine yer verildi\u011fi, bu nedenle su\u00e7un maddi ve manevi unsurlar\u0131n\u0131n olu\u015fmas\u0131nda \u00f6ncelikle ortada \u201ckanunilik\u201d ilkesine uygun d\u00fc\u015fecek halk\u0131n h\u00fck\u00fcmde belirtilen niteliklerinden en az birisine sahip bir kesimi ile di\u011fer bir kesiminin kar\u015f\u0131 kar\u015f\u0131ya getirilmesinin gerekti\u011fi, bu nedenle ortada yasal tan\u0131ma uygun en az iki kesimin bulunmas\u0131n\u0131n gerekti\u011fi, failde de icra etti\u011fi fiili ve kast\u0131 itibariyle kanuni tan\u0131ma uygun iki farkl\u0131 kesimi kin ve d\u00fc\u015fmanl\u0131\u011fa tahrik etme kast\u0131n\u0131n bulunmas\u0131 gerekti\u011fi, h\u00fck\u00fcmde ge\u00e7en aleniyetin maddi unsur i\u00e7inde de\u011ferlendirilip, f\u0131kran\u0131n sonunda g\u00f6sterilen sebebin de bir objektif cezaland\u0131r\u0131labilme \u015fart\u0131 olarak kabul\u00fcn\u00fcn uygun olaca\u011f\u0131 ifade edilmelidir.<\/p>\n<p>Buna g\u00f6re; halk\u0131n h\u00fck\u00fcmde belirtilen bir kesiminin ne oldu\u011funun belirlenmesi gerekti\u011fi, bunun emeklilerden veya i\u015f\u00e7ilerden olu\u015fan sosyal bir s\u0131n\u0131f olabilece\u011fi gibi, \u0131rk, buna ba\u011fl\u0131 olarak etnik k\u00f6ken, din, mezhep veya b\u00f6lgesel \u00f6zelliklerin \u00f6ne \u00e7\u0131kar\u0131ld\u0131\u011f\u0131 co\u011frafi b\u00f6lgeler veya bir co\u011frafi b\u00f6lgeden gelenlerin halk\u0131n bir kesimini olu\u015fturaca\u011f\u0131, bir siyasi partiye veya sivil toplum \u00f6rg\u00fct\u00fcne mensubiyetin do\u011frudan halk\u0131n bir kesimi olarak adland\u0131r\u0131lamayaca\u011f\u0131, fakat ki\u015filerin \u00fcye olarak bulunduklar\u0131 siyasi parti veya sivil toplum \u00f6rg\u00fct\u00fcnde yer alman\u0131n sosyal s\u0131n\u0131f veya h\u00fck\u00fcmde belirtilen di\u011fer \u00f6zelliklerden birisine ili\u015fkin oldu\u011fu durumda yine halk\u0131n bir kesiminden bahsedilece\u011fi, bu kapsamda \u00fclkede bulunan yabanc\u0131 k\u00f6kenlilerin veya yabanc\u0131lar\u0131n veya g\u00f6\u00e7menlerin, bu kapsamda ge\u00e7ici koruma stat\u00fcs\u00fcnde bulunanlar\u0131n, \u201csu\u00e7ta ve cezada kanunilik\u201d prensibi \u00e7er\u00e7evesinde TCK m.216\/1\u2019de yer alan tan\u0131ma uygun halk\u0131n bir kesimini olu\u015fturup olu\u015fturmayaca\u011f\u0131n\u0131n da, bu \u015fah\u0131slar\u0131n sosyal s\u0131n\u0131f, \u0131rk ve buna ba\u011fl\u0131 etnik k\u00f6ken, din, mezhep veya b\u00f6lgesel ortak \u00f6zelliklere sahip ki\u015filerden olup olmamas\u0131yla netle\u015ftirilmesinin gerekti\u011fi, bu kapsamda \u00fclkede yasal izinle veya izinsiz bulunan, ancak bulunma \u015fartlar\u0131 ve sebepleri toplumda tart\u0131\u015f\u0131lan yabanc\u0131lar \u00fczerinden yap\u0131lan ele\u015ftirilerin, bu insanlarla ilgili olumsuz de\u011ferlendirmelerin, konu bu \u015fah\u0131slara kar\u015f\u0131 su\u00e7 olu\u015fturabilecek fiillere, bu fiillere azmettirmeye veya yard\u0131ma d\u00f6n\u00fc\u015fmedik\u00e7e, TCK m216\/1\u2019de tan\u0131mlanan halk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa alenen tahrik su\u00e7u olu\u015fmayacakt\u0131r.<\/p>\n<p>\u00d6rne\u011fin; \u00fclkede bulunan ka\u00e7ak yabanc\u0131lar\u0131n, ge\u00e7ici koruma alt\u0131nda olanlar\u0131n veya ikamet etmek veya \u00e7al\u0131\u015fmak i\u00e7in gelenlerin, \u00fclke ve millet bak\u0131m\u0131ndan iktisadi, sosyal, hukuki, demografik yap\u0131 ve g\u00fcvenlik a\u00e7\u0131s\u0131ndan sorunlara sebebiyet verildi\u011finin s\u00f6ylenmesi, bu y\u00f6nde ele\u015ftiriler yap\u0131lmas\u0131, bu t\u00fcr ele\u015ftirilere ba\u011fl\u0131 olsun veya olmas\u0131n \u00fclke i\u00e7inde \u00e7\u0131kabilecek birtak\u0131m hadiselere ili\u015fkin halk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa alenen tahrik olarak nitelendirilemez, \u00e7\u00fcnk\u00fc g\u00fcndeme getirilen ele\u015ftiriler hukukilikten ve me\u015fruluktan uzak olmayan toplumda ya\u015fanan huzursuzluklar\u0131n ve dile getirilen itirazlar\u0131n bir yans\u0131mas\u0131d\u0131r. Ceza Hukuku a\u00e7\u0131s\u0131ndan konuya bakt\u0131\u011f\u0131m\u0131zda ise; yine de \u00fclkemizde ka\u00e7ak veya izinsiz veya ge\u00e7ici koruma alt\u0131nda veya bir ba\u015fka stat\u00fc ile kalanlara d\u00f6n\u00fck ele\u015ftiriler, \u00f6ne \u00e7\u0131kar\u0131lan itirazlar, halk\u0131n sosyal s\u0131n\u0131f, \u0131rk ve buna ba\u011fl\u0131 olarak etnik k\u00f6ken, din, mezhep veya b\u00f6lge bak\u0131m\u0131ndan farkl\u0131 \u00f6zelliklerine sahip bir kesiminin di\u011fer bir kesim aleyhine kin ve d\u00fc\u015fmanl\u0131\u011fa alenen tahrik edilmesi olarak yorumlanamaz, \u00e7\u00fcnk\u00fc burada kesimler aras\u0131nda kar\u015f\u0131 kar\u015f\u0131ya getirme de\u011fil, \u00fclkenin bir sorununun tart\u0131\u015fmaya a\u00e7\u0131lmas\u0131 ve h\u00fck\u00fcmde belirtilen nitelikler \u00fczerinden konunun tart\u0131\u015f\u0131lmay\u0131p, bir b\u00fct\u00fcnde \u00fclkeye d\u00fczensiz olarak g\u00f6\u00e7 edenlerin veya \u00fclkede ka\u00e7ak olarak bulunanlar\u0131n yol a\u00e7t\u0131\u011f\u0131 sorunlara ba\u011fl\u0131 hususlar\u0131n ortaya koyulmas\u0131 vard\u0131r. Demokratik hukuk toplumlar\u0131nda bu t\u00fcr itirazlar\u0131n dile getirilmesi, halk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa alenen tahrik su\u00e7unun maddi ve manevi unsurlar\u0131n\u0131n olu\u015ftu\u011funu g\u00f6stermez.<\/p>\n<p>Ancak bu t\u00fcr bir sorunun dile getirilmesi yerine, \u0131rk, din, mezhep, buna ba\u011fl\u0131 etnik k\u00f6ken ve milliyet bak\u0131m\u0131ndan ortaya koyulacak ve ele\u015ftiri s\u0131n\u0131rlar\u0131n\u0131 a\u015fan, cebir ve \u015fiddet \u00e7a\u011fr\u0131s\u0131 i\u00e7eren, tehdit niteli\u011fi ta\u015f\u0131yan a\u00e7\u0131klamalar\u0131n ifade ve bas\u0131n h\u00fcrriyetlerinin hukuka uygunluk k\u0131sm\u0131nda kalmayaca\u011f\u0131n\u0131, kamu bar\u0131\u015f\u0131na kar\u015f\u0131 su\u00e7lar kapsam\u0131nda de\u011ferlendirilebilece\u011fini, bu \u00e7er\u00e7evede halk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa tahrik su\u00e7unun g\u00fcndeme gelebilece\u011fini belirtmek isteriz. Ge\u00e7ici koruma stat\u00fcs\u00fcn\u00fcn kanunilik ve me\u015fruiyet i\u00e7erdi\u011fi, her ne kadar bu stat\u00fc TCK m.216\/1 anlam\u0131nda halk\u0131n bir kesimi anlam\u0131na gelmese de, stat\u00fc kapsam\u0131na girenlerin stat\u00fc gere\u011fi ta\u015f\u0131d\u0131\u011f\u0131 \u00f6zelliklerden dolay\u0131 h\u00fck\u00fcm kapsam\u0131nda de\u011ferlendirilmeleri m\u00fcmk\u00fcnd\u00fcr. Kanun koyucu da; m.216\/1 ile kamu bar\u0131\u015f\u0131n\u0131 korumay\u0131 hedeflemi\u015f olup, kin ve d\u00fc\u015fmanl\u0131\u011fa alenen tahrikte h\u00fck\u00fcmde ge\u00e7en s\u0131n\u0131flar\u0131 ve kesimleri, cebir ve \u015fiddet diliyle kar\u015f\u0131 kar\u015f\u0131ya getirmenin su\u00e7 oldu\u011funu ifade etmektedir.<\/p>\n<p>3. TCK m.218\u2019de Yer Alan Nitelikli Hal<\/p>\n<p>T\u00fcrk Ceza Kanunu\u2019nun 218. maddesine g\u00f6re, dini de\u011ferleri a\u015fa\u011f\u0131lama su\u00e7unun bas\u0131n ve yay\u0131n yoluyla ve dolay\u0131s\u0131yla T\u00fcrk Ceza Kanunu m.6\/1,(g) uyar\u0131nca internet vas\u0131tas\u0131yla i\u015flenmesi halinde, fail hakk\u0131nda tayin edilecek ceza yar\u0131 oran\u0131nda art\u0131r\u0131lacakt\u0131r. Bunun i\u00e7in, haber verme s\u0131n\u0131rlar\u0131n\u0131n a\u015f\u0131lmas\u0131 ve ele\u015ftiri amac\u0131yla yap\u0131lan d\u00fc\u015f\u00fcnce a\u00e7\u0131klamas\u0131n\u0131n d\u0131\u015f\u0131na \u00e7\u0131k\u0131lmas\u0131 gerekir. Aksi halde, bas\u0131n ve yay\u0131n yoluyla a\u015fa\u011f\u0131lama su\u00e7unun olu\u015fmad\u0131\u011f\u0131 kabul edilecektir.<\/p>\n<p>Gerek Anayasan\u0131n \u201cD\u00fc\u015f\u00fcnceyi a\u00e7\u0131klama ve yayma h\u00fcrriyeti\u201d ba\u015fl\u0131kl\u0131 26. maddesi ve gerekse 5187 say\u0131l\u0131 Bas\u0131n Kanunu\u2019nun \u201cBas\u0131n \u00f6zg\u00fcrl\u00fc\u011f\u00fc\u201d ba\u015fl\u0131kl\u0131 3. maddesi ile koruma alt\u0131na al\u0131nan haber verme hakk\u0131n\u0131n kapsam\u0131n\u0131 a\u015fmayan ve ele\u015ftiri amac\u0131 ta\u015f\u0131yan ifadeler, TCK m.216\u2019da d\u00fczenlenen su\u00e7u olu\u015fturmayacakt\u0131r. Bu hallerde \u00f6zellikle ikinci ve \u00fc\u00e7\u00fcnc\u00fc su\u00e7 tipleri bak\u0131m\u0131ndan a\u015fa\u011f\u0131lama kast\u0131 bulunmayaca\u011f\u0131ndan, yaln\u0131zca haber verme kast\u0131 bulundu\u011fundan veya bilimsel bir \u00e7al\u0131\u015fmada yer verilen ifadeler, manevi unsur kar\u015f\u0131lanmad\u0131\u011f\u0131ndan su\u00e7 olarak nitelendirilemeyebilecektir[6].<\/p>\n<p>4. Su\u00e7a \u0130li\u015fkin Yarg\u0131tay, Anayasa Mahkemesi ve \u0130nsan Haklar\u0131 Avrupa Mahkemesi \u0130\u00e7tihad\u0131 ile \u0130fade \u00d6zg\u00fcrl\u00fc\u011f\u00fc ile Su\u00e7un \u0130li\u015fkisi<\/p>\n<p>AYM;\u00a0Hakan Ayg\u00fcn\u00a0karar\u0131nda[7],\u00a0toplumun baz\u0131 kesimlerini \u00f6tekile\u015ftiren hatta a\u015fa\u011f\u0131layan\u00a0\u00fcslup ve ifadelerin,\u00a0tek ba\u015flar\u0131na, yani nefret i\u00e7eren s\u00f6zler veya \u015fiddet \u00e7a\u011fr\u0131s\u0131 \u015feklinde bir olgu s\u00f6zkonusu olmaks\u0131z\u0131n, TCK m.216\/1\u2019de d\u00fczenlenen su\u00e7un i\u015flendi\u011fi y\u00f6n\u00fcnde kuvvetli \u015f\u00fcphe olu\u015fturmayaca\u011f\u0131n\u0131 belirtmi\u015ftir. Ayr\u0131ca; AYM\u2019ye g\u00f6re, ihtilafl\u0131 ifadelerin sosyal medyada \u00e7ok say\u0131da be\u011feni almas\u0131 ve pop\u00fcler hale gelmesi bu tespiti etkilemeyecektir.<\/p>\n<p>TCK m.216\/1\u2019in \u015fiddet \u00e7a\u011fr\u0131s\u0131 veya k\u0131\u015fk\u0131rtmas\u0131 i\u00e7ermeyen ifadelere de uygulanmas\u0131 maddenin lafz\u0131na, amac\u0131na ve Yarg\u0131tay\u2019\u0131n belirlemelerine ayk\u0131r\u0131d\u0131r. Su\u00e7un kapsam\u0131n\u0131n bu \u015fekilde geni\u015fletilmesi, su\u00e7un \u00f6ng\u00f6r\u00fclebilirli\u011fini ortadan kald\u0131rmakta, dolay\u0131s\u0131yla \u201csu\u00e7ta ve cezada kanunilik\u201d ilkesine ayk\u0131r\u0131 sonu\u00e7lar do\u011furmaktad\u0131r.<\/p>\n<p>Yarg\u0131tay 18. Ceza Dairesi\u00a008.01.2019 tarihli ve 2018\/3616 E., 2019\/598\u00a0K. say\u0131l\u0131 karar\u0131nda,\u00a0halk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa tahrik su\u00e7u ile ilgili a\u015fa\u011f\u0131daki de\u011ferlendirmelerde bulunmu\u015ftur:<\/p>\n<p>&#8211; Objektif ve tarafs\u0131zl\u0131ktan uzak, incitici, sayg\u0131nl\u0131\u011f\u0131 zedeleyici, rahats\u0131z edici,\u00a0fakat \u015fiddet i\u00e7ermeyen ve \u015fiddet k\u0131\u015fk\u0131rt\u0131c\u0131l\u0131\u011f\u0131 bulunmayan, yak\u0131n tehlikeye neden olmayan beyanlar bu su\u00e7un konusunu olu\u015fturmamaktad\u0131r.<\/p>\n<p>&#8211; Kin ve d\u00fc\u015fmanl\u0131k; husumet beslenen konuya kar\u015f\u0131 tasarlayarak zarar vermeye, \u00f6\u00e7 almay\u0131 gerektirecek \u015fiddette nefret duymaya y\u00f6nelik hareketlerin zeminini olu\u015fturan psikolojik bir hal olarak a\u00e7\u0131klanabilir.\u00a0Kin ve d\u00fc\u015fmanl\u0131k ibaresinin anlam\u0131 da dikkate al\u0131nd\u0131\u011f\u0131nda, sadece \u015fiddet i\u00e7eren ya da \u015fiddet tavsiye eden tahrikler madde kapsam\u0131nda de\u011ferlendirilebilecektir.<\/p>\n<p>&#8211; Yasal s\u0131n\u0131rl\u0131l\u0131kla belirlenen farkl\u0131l\u0131klar\u0131 tahrike y\u00f6nelmeyen,\u00a0\u015fiddet \u00e7a\u011fr\u0131s\u0131 ve nefret i\u00e7erikli s\u00f6zler i\u00e7ermeyen, somut ve yak\u0131n tehlike d\u00fczeyine de ula\u015fmam\u0131\u015f k\u0131\u015fk\u0131rtmalar\u0131n su\u00e7a konu edilmesi su\u00e7un kanunili\u011fi ilkesiyle ba\u011fda\u015fmaz.<\/p>\n<p>\u0130nsan Haklar\u0131 Avrupa Mahkemesi\u2019nin; \u0130nsan Haklar\u0131 Avrupa S\u00f6zle\u015fmesi\u2019nin 10. maddesi kapsam\u0131nda d\u00fc\u015f\u00fcncenin a\u00e7\u0131klanmas\u0131 \u00f6zg\u00fcrl\u00fc\u011f\u00fc ile ilgili kararlar\u0131nda, d\u00fc\u015f\u00fcncenin a\u00e7\u0131klanmas\u0131 \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn s\u0131n\u0131rlanmas\u0131nda arad\u0131\u011f\u0131 ko\u015fullar;<\/p>\n<p>&#8211; Yasal bir d\u00fczenleme bulunmas\u0131,<\/p>\n<p>&#8211; S\u0131n\u0131rlaman\u0131n me\u015fru bir ama\u00e7la yap\u0131lmas\u0131<\/p>\n<p>&#8211; S\u0131n\u0131rlaman\u0131n demokratik bir toplum i\u00e7in gerekli olmas\u0131,<\/p>\n<p>&#8211; Yasall\u0131k ilkesine uygun verilen cezan\u0131n, g\u00fcd\u00fclen me\u015fru ama\u00e7la orant\u0131l\u0131 olmas\u0131,<\/p>\n<p>\u015eeklindedir[8].<\/p>\n<p>\u0130HAM kararlar\u0131nda; bu ko\u015fullar \u0131\u015f\u0131\u011f\u0131nda olaysal de\u011ferlendirme yap\u0131lmakta, d\u00fc\u015f\u00fcnceyi a\u00e7\u0131klama \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn as\u0131l, k\u0131s\u0131tlaman\u0131n istisna oldu\u011fu ortaya koyularak, \u201c\u015fiddet i\u00e7ermeyen ya da \u015fiddeti tavsiye etmeyen\u201d a\u00e7\u0131klamalar\u0131n hukukun koruma alan\u0131nda oldu\u011funa i\u015faret olunmakta, hatta bu koruman\u0131n ayn\u0131 zamanda k\u0131r\u0131c\u0131, \u015fok edici veya rahats\u0131z edici kar\u015f\u0131 g\u00f6r\u00fc\u015flere bile tahamm\u00fcl\u00fc gerektirdi\u011fi vurgulanmaktad\u0131r.<\/p>\n<p>Bu hususlar; \u0130HAM\u2019\u0131n Ba\u015fkaya ve Ok\u00e7uo\u011flu\/T\u00fcrkiye karar\u0131nda ortaya koyulmu\u015f, keskin ifadelerin dahi \u015fiddeti te\u015fvik etti\u011finin s\u00f6ylenemedi\u011fi durumda, ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc kapsam\u0131nda de\u011ferlendirilmesi gerekti\u011fi ortaya koyulmu\u015ftur[9].<\/p>\n<p>5. Su\u00e7un Objektif Cezaland\u0131r\u0131labilirlik \u015eart\u0131 A\u00e7\u0131s\u0131ndan Yararlan\u0131labilecek \u0130nternet Verileri<\/p>\n<p>Halk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa tahrik etme su\u00e7unun olu\u015fabilmesi i\u00e7in, halk\u0131n bir kesiminin di\u011fer kesimine kar\u015f\u0131 kin ve d\u00fc\u015fmanl\u0131k duymas\u0131 i\u00e7in alenen tahrik edilmesi zorunlu ise de, yeterli olmay\u0131p, failin eylemi sonucunda kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan a\u00e7\u0131k ve yak\u0131n bir tehlikenin de do\u011fmu\u015f olmas\u0131 gerekmektedir[10]. Bu, su\u00e7 a\u00e7\u0131s\u0131ndan bir objektif cezaland\u0131r\u0131labilirlik \u015fart\u0131d\u0131r ve bu \u015fart ger\u00e7ekle\u015fmeden failin TCK m.216\/1\u2019den cezaland\u0131r\u0131labilmesi m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p>Dolay\u0131s\u0131yla; TCK m.216\/1\u2019den cezaland\u0131rma i\u00e7in, failin eylemi sonucunda, bir toplum i\u00e7erisinde kolluk hizmetleri yoluyla sa\u011flanan can ve mal g\u00fcvenli\u011fi anlam\u0131na gelen, kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan, a\u00e7\u0131k ve yak\u0131n bir tehlikenin ortaya \u00e7\u0131kmas\u0131 aranacakt\u0131r[11]. Sonu\u00e7 itibariyle; failin s\u00f6z ve davran\u0131\u015flar\u0131n\u0131n, halk\u0131n bir kesimi \u00fczerinde tahrik konusu fiillerin i\u015flenece\u011fi hususunda duyulan endi\u015feyi hakl\u0131 k\u0131lacak bir etki olu\u015fturmas\u0131 ve bu do\u011frultuda zarar neticesi do\u011furmayan bir hareketlenmenin meydana getirmesi aran\u0131r. \u00d6rne\u011fin, i\u015flenen fiil neticesinde \u00e7e\u015fitli halk kesimlerinin bir yerlerde toplanmas\u0131 veya bu halk kesimleri aras\u0131nda infialin meydana gelmesi \u015feklinde[12].<\/p>\n<p>Yukar\u0131dan anla\u015f\u0131ld\u0131\u011f\u0131 \u00fczere; halk\u0131 kin ve d\u00fc\u015fmanl\u0131\u011fa tahrik etme su\u00e7unda, fail taraf\u0131ndan yap\u0131lan hareketlerin bir objektif cezaland\u0131rma \u015fart\u0131 olan kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan, a\u00e7\u0131k ve yak\u0131n bir tehlike olu\u015fturmas\u0131 gerekti\u011fi ve failin kesin bir \u015fekilde cezaland\u0131r\u0131labilmesi i\u00e7in bu \u015fart\u0131n ger\u00e7ekle\u015fti\u011finin hi\u00e7bir \u015f\u00fcpheye mahal b\u0131rakmayacak bi\u00e7imde ortaya koyulmas\u0131 \u015fartt\u0131r. \u0130\u015fte burada kanaatimizce, g\u00fcn\u00fcm\u00fcz \u015fartlar\u0131na uygun olarak internet verilerinden yararlan\u0131labilir.<\/p>\n<p>Bir ki\u015finin T\u00fcrkiye genelinde ne kadar, hangi konuda arand\u0131\u011f\u0131, ne etkide g\u00f6z\u00fckt\u00fc\u011f\u00fc g\u00fcn\u00fcm\u00fcz \u015fartlar\u0131nda a\u00e7\u0131k kaynaktan dahi eri\u015filebilir bilgilerdir. Dolay\u0131s\u0131yla; su\u00e7un cezaland\u0131r\u0131labilmesi i\u00e7in en \u00f6nemli \u015fartlardan birisi olan objektif cezaland\u0131r\u0131labilme \u015fartlar\u0131n\u0131n ger\u00e7ekle\u015fip ger\u00e7ekle\u015fmedi\u011fi bak\u0131m\u0131ndan, g\u00fcn\u00fcm\u00fcz imkanlar\u0131 \u00e7er\u00e7evesinde internet ve di\u011fer a\u00e7\u0131k kaynak verilerinden faydalan\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>\u00d6rne\u011fin; bir ilde kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan, a\u00e7\u0131k ve yak\u0131n bir tehlikenin ortaya \u00e7\u0131kt\u0131\u011f\u0131 ve bundan bir ki\u015finin internet \u00fczerinden payla\u015ft\u0131\u011f\u0131 s\u00f6zleri dolay\u0131s\u0131yla sorumlu oldu\u011fu iddia edildi\u011finde, o ilde kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan, a\u00e7\u0131k ve yak\u0131n bir tehlikenin olu\u015ftu\u011fu tarih veya tarihler aras\u0131nda failin o ilde internet \u00fczerinden ne kadar arand\u0131\u011f\u0131 ve etkile\u015fiminin, etkisinin ne kadar oldu\u011fu g\u00f6z\u00f6n\u00fcnde bulundurulabilir. Bu veriler, b\u00f6yle bir \u00f6rnek \u00fczerinde su\u00e7un objektif cezaland\u0131r\u0131labilirlik \u015fart\u0131n\u0131n ger\u00e7ekle\u015fip ger\u00e7ekle\u015fmedi\u011finin tespitinde \u00f6nem arz etmektedir.<\/p>\n<p>5. Sonu\u00e7<\/p>\n<p>G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere; TCK m.216\u2019n\u0131n tatbiki olduk\u00e7a s\u0131k\u0131 \u015fartlara ba\u011flanm\u0131\u015f, bir\u00e7ok su\u00e7ta nitelikli hal olarak kabul edilen aleniyet unsurunun burada su\u00e7un maddi unsuru olarak aranmas\u0131n\u0131n yan\u0131 s\u0131ra, kamu g\u00fcvenli\u011fi a\u00e7\u0131s\u0131ndan somut bir tehlikenin varl\u0131\u011f\u0131 olmaks\u0131z\u0131n da icra edilen fiillerin cezaland\u0131r\u0131lamayaca\u011f\u0131 belirtilmi\u015ftir.<\/p>\n<p>TCK m.216\/1\u2019de ge\u00e7en halk\u0131n bir kesimi ibaresinin ne anlama geldi\u011fi yukar\u0131da a\u00e7\u0131klanm\u0131\u015ft\u0131r. Bu kavramla ilgili \u201csu\u00e7ta ve cezada kanunilik\u201d prensibine ba\u011fl\u0131 kalmak gerekir.
