Ge\u00e7mi\u015f d\u00f6nemde 12601 ada 3 parseldeki Muratpa\u015fa Belediye Hizmet Binas\u0131 (BHA), Ticaret Alan\u0131 (AVM) kar\u015f\u0131l\u0131\u011f\u0131nda yapt\u0131r\u0131lm\u0131\u015ft\u0131r. Ancak \u0130mar Kanunu ve ilgili mevzuat uyar\u0131nca arsa pay\u0131 devri kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi ile uzunca bir s\u00fcrede in\u015fa edilebilen belediye binas\u0131n\u0131n, depreme dayan\u0131kl\u0131 olup olmad\u0131\u011f\u0131 konusunda performans analizi yapt\u0131r\u0131lmadan belediyesince teslim al\u0131nd\u0131\u011f\u0131 tespit edilmi\u015f olup bundan dolay\u0131 G\u00fcn\u00fcm\u00fczde depreme dayan\u0131kl\u0131 bir yap\u0131 olmad\u0131\u011f\u0131 ve kamu hizmetinin aksamamas\u0131 i\u00e7in yap\u0131n\u0131n yenilenmesi hususlar\u0131 plan a\u00e7\u0131klama raporunda bildirilmektedir. \u015eu an i\u00e7in, Belediye Hizmet Binas\u0131 ile ilgili yap\u0131lan de\u011ferlendirmede yap\u0131 performans\u0131n\u0131n yetersiz oldu\u011fu ortaya \u00e7\u0131km\u0131\u015f ve bu da kamu zarar\u0131na neden olmu\u015ftur. Kar\u015f\u0131la\u015f\u0131lan bu kamu zarar\u0131 neticesinde yap\u0131y\u0131 yapan ilgilisine r\u00fccu ettirilerek mevzuat uyar\u0131nca yap\u0131n\u0131n yeniden yapt\u0131r\u0131lmas\u0131 ve\/veya g\u00fc\u00e7lendirilmesi gerekirken, yeni par\u00e7ac\u0131l bir imar plan\u0131 de\u011fi\u015fikli\u011fi yap\u0131larak kamusal alanlar\u0131n azalt\u0131ld\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.\u201d<\/p>\n<p>GE\u00c7M\u0130\u015eTEN GELEN ZARAR DEVAM ED\u0130YOR<\/p>\n<p>\u201cSon olarak yap\u0131lan plan de\u011fi\u015fikli\u011fi neticesinde de bahse konu b\u00f6lgedeki, ge\u00e7mi\u015ften g\u00fcn\u00fcm\u00fcze s\u00fcregelen, kamusal zarar artarak devam etmektedir. S\u00f6z konusu alan, mevcut 1\/5000 \u00d6l\u00e7ekli Naz\u0131m ve 1\/1000 \u00d6l\u00e7ekli Uygulama \u0130mar Plan\u0131nda \u201cBelediye Hizmet Alan\u0131\u201d (BHA) olarak tan\u0131mlanm\u0131\u015f ve kamu hizmetine y\u00f6nelik tesislerin yap\u0131lmas\u0131 amac\u0131yla ayr\u0131lm\u0131\u015ft\u0131r. Ancak yap\u0131lmak istenen imar plan\u0131 de\u011fi\u015fikli\u011fi ile:<\/p>\n<p> \u00a01-Toplam in\u015faat alan\u0131 art\u0131r\u0131lmaktad\u0131r: Mevcut yap\u0131la\u015fma ko\u015fullar\u0131 incelendi\u011finde; Toplam \u0130n\u015faat Alan\u0131n\u0131n 9200 m2oldu\u011fu g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. \u00d6nerilen plan de\u011fi\u015fikli\u011fi ile ise T\u0130A:20.000 m2 olup plan notuyla 14.000 m2 si Belediye Hizmet Alan\u0131 (BHA), 6000 m2 ise Ticaret ve konuk evi olarak ayr\u0131laca\u011f\u0131 belirtilmektedir. Yap\u0131lan plan de\u011fi\u015fikli\u011fi ile parseldeki mevcut yap\u0131la\u015fma yo\u011funlu\u011fu artt\u0131r\u0131larak ilave ticari faaliyet eklenmekte, b\u00f6ylece mevcutta zaten yap\u0131 yo\u011funlu\u011fu ve insan sirk\u00fclasyonunun yo\u011funlu\u011funa bir de ticari faaliyetle ilgili yo\u011funluk getirilmektedir.\u00a0 3194 Say\u0131l\u0131 \u0130mar Kanunu\u2019nun 8\/b maddesi uyar\u0131nca, imar planlar\u0131n\u0131n \u015fehircilik ilkeleri ve planlama esaslar\u0131na uygun olmas\u0131 gereklidir. Ancak burada bu ilkeler a\u00e7\u0131k\u00e7a ihlal edilmektedir.<br \/>\n 2-Belediye Hizmet Alan\u0131na plan notu ile \u201cTicaret Alan\u0131\u201d fonksiyonu eklenmi\u015ftir: Kamu yarar\u0131na tahsisli bir alan\u0131n ticaret alan\u0131na d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi, hem Mekansal Planlar Yap\u0131m Y\u00f6netmeli\u011fi\u2019nin 8. maddesine, hem de Dan\u0131\u015ftay 6. Dairesi\u2019nin E.2006\/4974, K.2008\/1974 say\u0131l\u0131 karar\u0131nda vurgulanan, \u201ckamusal alanlar\u0131n daralt\u0131lamayaca\u011f\u0131 ve kamu yarar\u0131na ayk\u0131r\u0131 kullan\u0131lamayaca\u011f\u0131\u201d ilkesine ayk\u0131r\u0131d\u0131r. 3194 Say\u0131l\u0131 \u0130mar Kanunu\u2019nun 8. maddesi, imar planlar\u0131n\u0131n kamu yarar\u0131na, \u015fehircilik ilkelerine ve planlama esaslar\u0131na uygun olarak haz\u0131rlanmas\u0131n\u0131 \u015fart ko\u015far. Ticaret fonksiyonu eklenerek kamu hizmeti yap\u0131lmas\u0131 gereken bir alana kamu hizmeti d\u0131\u015f\u0131nda fonksiyon y\u00fcklenmi\u015f ve \u00e7evresel dokuyla uyumsuz yap\u0131la\u015fma karar\u0131 al\u0131nmas\u0131na sebep olmu\u015ftur. Yap\u0131lan plan de\u011fi\u015fikli\u011fi 3194 say\u0131l\u0131 \u0130mar kanununda belirtilen kamu yarar\u0131na, \u015fehircilik ilkelerine ve planlama esaslar\u0131na ayk\u0131r\u0131d\u0131r. Kanunun 18. maddesi, kamu yarar\u0131na ayk\u0131r\u0131 plan de\u011fi\u015fikliklerinin iptal edilece\u011fini h\u00fckme ba\u011flamaktad\u0131r.<br \/>\n 3-Planl\u0131 Alanlar \u0130mar Y\u00f6netmeli\u011fi\u2019nin 19. ve 23. maddelerine g\u00f6re: Yap\u0131 yakla\u015fma mesafelerinin korunmas\u0131 zorunludur. Ancak bu plan de\u011fi\u015fikli\u011fiyle, yakla\u015fma mesafelerinin 3-5 metreye d\u00fc\u015f\u00fcr\u00fclmesi, \u00e7evresel ili\u015fkilerin ve g\u00fcvenli yap\u0131la\u015fma ilkelerinin ihlaline neden olmaktad\u0131r. Y\u00f6netmeli\u011fin \u00e7evresel s\u00fcrd\u00fcr\u00fclebilirlik ilkelerine y\u00f6nelik d\u00fczenlemelerine ra\u011fmen, plan de\u011fi\u015fikli\u011fi \u00e7evre dokusuna zarar verecek kararlar i\u00e7ermektedir.<br \/>\n 4-Planlama karar\u0131nda yap\u0131 taban alan\u0131 s\u0131n\u0131rlamas\u0131 kald\u0131r\u0131lmaktad\u0131r: Bu de\u011fi\u015fiklikle ticari fonksiyonlar\u0131n alan \u00fczerinde yayg\u0131nla\u015fmas\u0131na zemin haz\u0131rlanmakta, yo\u011funluk art\u0131\u015f\u0131yla kamu g\u00fcvenli\u011fi ve ula\u015f\u0131m altyap\u0131s\u0131 risk alt\u0131na sokulmaktad\u0131r. Ayr\u0131ca yap\u0131 bah\u00e7e alan\u0131n\u0131 da azaltaca\u011f\u0131 i\u00e7in \u00e7evresel sorunlara da sebep olaca\u011f\u0131 a\u015fikard\u0131r. Anayasa\u2019n\u0131n 5. ve 56. maddelerinde g\u00fcvence alt\u0131na al\u0131nan kamu yarar\u0131 ve \u00e7evre hakk\u0131na a\u00e7\u0131k bir tecav\u00fcz s\u00f6z konusudur.<br \/>\n 5-Muratpa\u015fa \u0130l\u00e7esi Demircikara Mahallesi 12601 Ada 3 Parselde bulunan alan\u0131n \u201cBelediye Hizmet Alan\u0131\u201d n\u0131n \u201cTicaret Alan\u0131\u201d olarak planlanmas\u0131na y\u00f6nelik Muratpa\u015fa Belediye Meclisinin 06.06.2024 tarih ve 128 say\u0131l\u0131 karar\u0131yla onaylanan 1\/1000 \u00f6l\u00e7ekli Uygulama \u0130mar Plan\u0131 De\u011fi\u015fikli\u011fi onaylanmak \u00fczere Antalya B\u00fcy\u00fck\u015fehir Belediyesi Meclisine g\u00f6nderilmi\u015ftir. Ancak s\u00f6z konusu plan de\u011fi\u015fikli\u011fi Antalya B\u00fcy\u00fck\u015fehir Belediyesi Meclisince bir karara ba\u011flanmadan 5216 Say\u0131l\u0131 B\u00fcy\u00fck\u015fehir Belediyesi Kanunu\u2019nun 14.Maddesi esas al\u0131narak \u00fc\u00e7 ay i\u00e7erisinde onanmayan Plan\u0131 De\u011fi\u015fikli\u011fini Muratpa\u015fa Belediyesi yaz\u0131 ile iade isteyip 10.10.2024- 08.11.2024 tarihleri aras\u0131nda ask\u0131da ilan etmi\u015ftir. Ancak Belediye Hizmet Alan\u0131n\u0131n konumu a\u00e7\u0131s\u0131ndan bak\u0131ld\u0131\u011f\u0131nda \u00f6nemli ve stratejik bir kamusal alanda oldu\u011fu halk\u0131n ula\u015f\u0131m\u0131n\u0131n ve eri\u015febilirli\u011finin y\u00fcksek oldu\u011fu bu kamusal alan\u0131n Antalya B\u00fcy\u00fck\u015fehir Belediyesi Meclisinin karar\u0131 beklenmeden aceleye getirilmesinin sebebiyeti anla\u015f\u0131lamam\u0131\u015f olup bu durum kamuoyunun sa\u011fl\u0131kl\u0131 s\u00fcre\u00e7 y\u00fcr\u00fctmesine engel te\u015fkil edece\u011fi i\u00e7in kamu faydas\u0131 ta\u015f\u0131mad\u0131\u011f\u0131 kan\u0131s\u0131nday\u0131z.<br \/>\n S\u00f6z konusu imar plan\u0131 de\u011fi\u015fikli\u011finde Belediye Hizmet Alan\u0131(BHA) n\u0131n niteli\u011fi sosyal ve teknik altyap\u0131 donat\u0131 alan\u0131 yani kamu kapsam\u0131nda iken yap\u0131lan plan de\u011fi\u015fikli\u011fi sosyal donat\u0131 alan\u0131 niteli\u011fi ticari \u00f6zellik kazanmakta olup kamusal alan\u0131n azalmas\u0131na neden olmaktad\u0131r. Bu durumda \u00f6ncelikle, imar mevzuat\u0131 gere\u011fi yap\u0131lacak plan de\u011fi\u015fikliklerinde kald\u0131r\u0131lan Belediye Hizmet Alan\u0131 i\u00e7erisine yap\u0131lmas\u0131 d\u00fc\u015f\u00fcn\u00fclen ticaret alan miktar\u0131 kadar bir alan\u0131n\u0131n ayn\u0131 b\u00f6lge i\u00e7erisinde e\u015fde\u011ferinin ayr\u0131lmas\u0131 gerekti\u011fi a\u00e7\u0131kt\u0131r. Bu de\u011fi\u015fiklikte, Belediye Hizmet Alan\u0131 kullan\u0131m\u0131 ticari nitelikli bir kullan\u0131ma \u00e7evrilmekte olup Mekansal Planlar Yap\u0131m Y\u00f6netmeli\u011finin \u0130mar Plan\u0131 De\u011fi\u015fiklikleri ba\u015fl\u0131kl\u0131 26. Maddesine g\u00f6re e\u015fde\u011ferlik niteli\u011fini ta\u015f\u0131yan yeni bir kamusal alan olu\u015fturulmam\u0131\u015ft\u0131r. \u0130mar planlar\u0131nda yap\u0131lacak de\u011fi\u015fiklikler, y\u00f6netmelikte de h\u00fckme ba\u011fland\u0131\u011f\u0131 \u00fczere, plan haz\u0131rlan\u0131rken \u00f6ng\u00f6r\u00fclen ana kullan\u0131m kararlar\u0131n\u0131, plan\u0131n b\u00fct\u00fcnselli\u011fini ve sosyal donat\u0131 dengesini bozucu nitelikte olamaz. E\u011fer \u0130mar plan\u0131nda bir de\u011fi\u015fiklik yap\u0131lmas\u0131 gerekiyorsa, bu de\u011fi\u015fikli\u011fin \u015fehircilik ilkeleri ve kamu yarar\u0131 a\u00e7\u0131s\u0131ndan zorunlu oldu\u011funun bilimsel olarak ortaya konmas\u0131 gerekmektedir.
