2024\/70 karar say\u0131l\u0131 karar\u0131"},"content":{"rendered":"<p>ANAYASA MAHKEMES\u0130 KARARI <\/p>\n<p>\u00a0<\/p>\n<p>Esas Say\u0131s\u0131 : 2023\/148<\/p>\n<p>Karar Say\u0131s\u0131 : 2024\/70<\/p>\n<p>Karar Tarihi : 7\/3\/2024<\/p>\n<p>R.G.Tarih-Say\u0131 : 19\/4\/2024-32522<\/p>\n<p>\u00a0<\/p>\n<p>\u0130T\u0130RAZ YOLUNA BA\u015eVURAN: Sinop \u0130nfaz H\u00e2kimli\u011fi<\/p>\n<p>\u0130T\u0130RAZIN KONUSU: 13\/12\/2004 tarihli ve 5275 say\u0131l\u0131 Ceza ve G\u00fcvenlik Tedbirlerinin \u0130nfaz\u0131 Hakk\u0131nda Kanun\u2019a 14\/7\/2023 tarihli ve 7456 say\u0131l\u0131 Kanun\u2019un 15. maddesiyle eklenen ge\u00e7ici 10. maddenin (6) numaral\u0131 f\u0131kras\u0131n\u0131n birinci c\u00fcmlesinde yer alan \u201c&#8230;31\/7\/2023 tarihi itibar\u0131yla kapal\u0131 ceza infaz kurumlar\u0131nda bulunan h\u00fck\u00fcml\u00fclerden,&#8230;\u201d ibaresinin Anayasa\u2019n\u0131n 2. ve 10. maddelerine ayk\u0131r\u0131l\u0131\u011f\u0131 ileri s\u00fcr\u00fclerek iptaline karar verilmesi talebidir.<\/p>\n<p>OLAY: A\u00e7\u0131k ceza infaz kurumuna ayr\u0131lma talebinin reddine y\u00f6nelik karara kar\u015f\u0131 \u015fik\u00e2yet yoluyla yap\u0131lan ba\u015fvuruda itiraz konusu kural\u0131n Anayasa\u2019ya ayk\u0131r\u0131 oldu\u011fu kan\u0131s\u0131na varan Mahkeme, iptali i\u00e7in ba\u015fvurmu\u015ftur.<\/p>\n<p>I. \u0130PTAL\u0130 \u0130STENEN KANUN H\u00dcKM\u00dc<\/p>\n<p>Kanun\u2019un itiraz konusu kural\u0131n da yer ald\u0131\u011f\u0131 ge\u00e7ici 10. maddesi \u015f\u00f6yledir:<\/p>\n<p>\u00a0\u201cGe\u00e7ici Madde 10- (Ek: 14\/7\/2023-7456\/15 md.)<\/p>\n<p>\u00a0(1) 31\/7\/2023 tarihi itibar\u0131yla ge\u00e7ici 9 uncu maddenin be\u015finci f\u0131kras\u0131 uyar\u0131nca Covid-19 salg\u0131n hastal\u0131\u011f\u0131 nedeniyle izinde bulunan h\u00fck\u00fcml\u00fcler, izin bitimini takip eden onbe\u015f g\u00fcn i\u00e7inde infaz i\u015flemlerinin devam etti\u011fi kurumlara d\u00f6nmek zorundad\u0131r.<\/p>\n<p>\u00a0(2) 31\/7\/2023 tarihi itibar\u0131yla ge\u00e7ici 9 uncu maddenin be\u015finci f\u0131kras\u0131 uyar\u0131nca Covid-19 salg\u0131n hastal\u0131\u011f\u0131 nedeniyle izinde bulunan ve ilgili mevzuat uyar\u0131nca cezalar\u0131n\u0131n denetimli serbestlik tedbiri uygulanmak suretiyle infaz\u0131na be\u015f y\u0131l ve daha az s\u00fcre kalan h\u00fck\u00fcml\u00fclerin talebi aranmaks\u0131z\u0131n, cezalar\u0131n\u0131n ko\u015fullu sal\u0131verilme tarihine kadar olan k\u0131sm\u0131n\u0131n denetimli serbestlik tedbiri uygulanmak suretiyle infaz\u0131na infaz hakimi taraf\u0131ndan karar verilebilir.<\/p>\n<p>\u00a0(3) Yukar\u0131daki f\u0131kralar uyar\u0131nca, izinden d\u00f6necek h\u00fck\u00fcml\u00fcler ile hakk\u0131nda denetimli serbestlik karar\u0131 verilecek h\u00fck\u00fcml\u00fclere ili\u015fkin hususlar, Adalet Bakanl\u0131\u011f\u0131n\u0131n resm\u00ee internet sitesinde duyurulur.<\/p>\n<p>\u00a0(4) 105\/A maddesi kapsam\u0131nda denetimli serbestlik tedbiri uygulanmak suretiyle cezas\u0131 infaz edilip ge\u00e7ici 9 uncu maddenin be\u015finci f\u0131kras\u0131 uyar\u0131nca Covid-19 salg\u0131n hastal\u0131\u011f\u0131 nedeniyle 31\/7\/2023 tarihi itibar\u0131yla izinde bulunan h\u00fck\u00fcml\u00fcler, ko\u015fullu sal\u0131verilme tarihine kadar olan s\u00fcreleri 105\/A maddesinin be\u015finci f\u0131kras\u0131nda belirtilen y\u00fck\u00fcml\u00fcl\u00fcklere tabi olmadan ge\u00e7irirler.<\/p>\n<p>\u00a0(5) Ge\u00e7ici 9 uncu maddenin alt\u0131nc\u0131 f\u0131kras\u0131 uyar\u0131nca a\u00e7\u0131k ceza infaz kurumuna g\u00f6nderilen h\u00fck\u00fcml\u00fcler, 31\/7\/2023 tarihi itibar\u0131yla a\u00e7\u0131k ceza infaz kurumuna ayr\u0131lm\u0131\u015f say\u0131l\u0131r.<\/p>\n<p>\u00a0(6) T\u00fcrk Ceza Kanununun \u0130kinci Kitap D\u00f6rd\u00fcnc\u00fc K\u0131s\u0131m D\u00f6rd\u00fcnc\u00fc, Be\u015finci, Alt\u0131nc\u0131 ve Yedinci B\u00f6l\u00fcm\u00fcnde tan\u0131mlanan su\u00e7lar, Ter\u00f6rle M\u00fccadele Kanunu kapsam\u0131na giren su\u00e7lar ve \u00f6rg\u00fct faaliyeti kapsam\u0131nda i\u015flenen su\u00e7lar hari\u00e7 olmak \u00fczere, 31\/7\/2023 tarihi itibar\u0131yla kapal\u0131 ceza infaz kurumlar\u0131nda bulunan h\u00fck\u00fcml\u00fclerden, toplam hapis cezas\u0131 on y\u0131ldan az ise bir ay\u0131n\u0131, on y\u0131l ve daha fazla ise \u00fc\u00e7 ay\u0131n\u0131 bu kurumlarda ge\u00e7irip ilgili mevzuat uyar\u0131nca a\u00e7\u0131k ceza infaz kurumlar\u0131na ayr\u0131lmas\u0131na \u00fc\u00e7 y\u0131l veya daha az s\u00fcre kalanlar, bu \u015fartlar\u0131n olu\u015ftu\u011fu tarih itibar\u0131yla a\u00e7\u0131k ceza infaz kurumlar\u0131na ayr\u0131labilir. Bu h\u00fck\u00fcml\u00fcler ile 31\/7\/2023 tarihinde ge\u00e7ici 9 uncu maddenin alt\u0131nc\u0131 f\u0131kras\u0131 kapsam\u0131nda a\u00e7\u0131k ceza infaz kurumunda bulunan h\u00fck\u00fcml\u00fcler, talepleri h\u00e2linde en az \u00fc\u00e7 ay a\u00e7\u0131k ceza infaz kurumunda kalm\u0131\u015f olmak \u015fart\u0131yla ilgili mevzuat uyar\u0131nca cezalar\u0131n denetimli serbestlik tedbiri alt\u0131nda infaz\u0131 uygulamas\u0131ndan \u00fc\u00e7 y\u0131l erken yararland\u0131r\u0131l\u0131r.<\/p>\n<p>\u00a0(7) Alt\u0131nc\u0131 f\u0131kra h\u00fck\u00fcmleri 31\/7\/2023 tarihi itibar\u0131yla;<\/p>\n<p>a) Hapis cezas\u0131n\u0131n infaz\u0131 16, 16\/A ve 17 nci maddeleri kapsam\u0131nda ertelenmi\u015f olan,<\/p>\n<p>b) Hapis cezas\u0131n\u0131n infaz\u0131 durdurulmu\u015f olan,<\/p>\n<p>h\u00fck\u00fcml\u00fcler hakk\u0131nda da uygulan\u0131r.<\/p>\n<p>\u00a0(8) Ko\u015fullu sal\u0131verilmenin geri al\u0131nmas\u0131 nedeniyle 31\/7\/2023 tarihi itibar\u0131yla cezas\u0131 aynen infaz edilen veya ikinci defa m\u00fckerrir olup 31\/7\/2023 tarihi itibar\u0131yla bu cezan\u0131n infaz\u0131 i\u00e7in ceza infaz kurumunda bulunan h\u00fck\u00fcml\u00fclerin bu cezalar\u0131n\u0131n infaz\u0131 bak\u0131m\u0131ndan alt\u0131nc\u0131 f\u0131kra h\u00fck\u00fcmleri uygulanmaz. Bu h\u00fck\u00fcml\u00fclerin 31\/7\/2023 tarihi itibar\u0131yla kesinle\u015fmi\u015f ancak infaz edilmemi\u015f di\u011fer hapis cezalar\u0131 bak\u0131m\u0131ndan alt\u0131nc\u0131 f\u0131kra h\u00fck\u00fcmleri uygulan\u0131r.\u201d<\/p>\n<p>II. \u0130LK \u0130NCELEME<\/p>\n<p>1. Anayasa Mahkemesi \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc h\u00fck\u00fcmleri uyar\u0131nca Z\u00fcht\u00fc ARSLAN, Hasan Tahsin G\u00d6KCAN, Kadir \u00d6ZKAYA, Engin YILDIRIM, Muammer TOPAL, R\u0131dvan G\u00dcLE\u00c7, Recai AKYEL, Yusuf \u015eevki HAKYEMEZ, Selahaddin MENTE\u015e, Basri BA\u011eCI, \u0130rfan F\u0130DAN, Kenan YA\u015eAR ve Muhterem \u0130NCE\u2019nin kat\u0131l\u0131mlar\u0131yla 13\/9\/2023 tarihinde yap\u0131lan ilk inceleme toplant\u0131s\u0131nda dosyada eksiklik bulunmad\u0131\u011f\u0131ndan i\u015fin esas\u0131n\u0131n incelenmesine OYB\u0130RL\u0130\u011e\u0130YLE karar verilmi\u015ftir.<\/p>\n<p>III. ESASIN \u0130NCELENMES\u0130<\/p>\n<p>2. Ba\u015fvuru karar\u0131 ve ekleri, Raport\u00f6r Abdullah ATAY taraf\u0131ndan haz\u0131rlanan i\u015fin esas\u0131na ili\u015fkin rapor, itiraz konusu kanun h\u00fckm\u00fc, dayan\u0131lan Anayasa kurallar\u0131 ve bunlar\u0131n gerek\u00e7eleri ile di\u011fer yasama belgeleri okunup incelendikten sonra gere\u011fi g\u00f6r\u00fc\u015f\u00fcl\u00fcp d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. Anlam ve Kapsam<\/p>\n<p>3. Mevzuat\u0131m\u0131zda infaz s\u00fcresi; ilke olarak kapal\u0131 ceza infaz kurumunda ge\u00e7irilen s\u00fcre, a\u00e7\u0131k ceza infaz kurumunda ge\u00e7irilen s\u00fcre ve ko\u015fullu sal\u0131verilme tarihi ile bihakk\u0131n tahliye tarihi aras\u0131ndaki s\u00fcre olmak \u00fczere \u00fc\u00e7 a\u015famadan olu\u015fmaktad\u0131r. Bunun yan\u0131 s\u0131ra 5275 say\u0131l\u0131 Kanun\u2019a 5\/4\/2012 tarihli ve 6291 say\u0131l\u0131 Kanun\u2019la eklenen 105\/A maddesiyle denetimli serbestlik tedbiri uygulanarak cezan\u0131n infaz\u0131na ili\u015fkin a\u015fama getirilmi\u015ftir (AYM, E.2017\/170, K.2018\/77, 5\/7\/2018, \u00a7 14; E.2020\/53, K.2021\/55, 14\/7\/2021, \u00a7 48).<\/p>\n<p>4. 5275 say\u0131l\u0131 Kanun\u2019un 14. maddesinin (3) numaral\u0131 f\u0131kras\u0131nda h\u00fck\u00fcml\u00fclerin kapal\u0131 ceza infaz kurumundan a\u00e7\u0131k ceza infaz kurumuna ayr\u0131lmalar\u0131na an\u0131lan Kanun\u2019un 89. maddesi uyar\u0131nca yap\u0131lan de\u011ferlendirme sonucunda karar verilece\u011fi belirtilmi\u015ftir. Kanun\u2019un 89. maddesinde de h\u00fck\u00fcml\u00fclerin de\u011ferlendirilmesi ve iyi h\u00e2lin belirlenmesine ili\u015fkin usul ve y\u00f6ntemler ayr\u0131nt\u0131l\u0131 olarak d\u00fczenlenmi\u015f olup h\u00fck\u00fcml\u00fcn\u00fcn kapal\u0131 ceza infaz kurumundan a\u00e7\u0131k ceza infaz kurumuna ayr\u0131labilmesi i\u00e7in idare ve g\u00f6zlem kurulu taraf\u0131ndan iyi h\u00e2linin belirlenmesi gerekmektedir.<\/p>\n<p>5. 14. maddenin (4) numaral\u0131 f\u0131kras\u0131nda toplam on y\u0131l ve daha fazla hapis cezas\u0131na mahk\u00fbm olanlar ile ter\u00f6r su\u00e7lar\u0131, \u00f6rg\u00fct kurmak, y\u00f6netmek veya \u00f6rg\u00fcte \u00fcye olmak su\u00e7lar\u0131, \u00f6rg\u00fct faaliyeti kapsam\u0131nda i\u015flenen su\u00e7lar, kasten \u00f6ld\u00fcrme su\u00e7lar\u0131, cinsel dokunulmazl\u0131\u011fa kar\u015f\u0131 i\u015flenen su\u00e7lar ve uyu\u015fturucu veya uyar\u0131c\u0131 madde imal ve ticareti su\u00e7lar\u0131ndan mahk\u00fbm olanlar\u0131n kapal\u0131 ceza infaz kurumundan a\u00e7\u0131k ceza infaz kurumuna ayr\u0131lmalar\u0131na ili\u015fkin idare ve g\u00f6zlem kurulu kararlar\u0131n\u0131n infaz h\u00e2kiminin onay\u0131ndan sonra uygulanaca\u011f\u0131 h\u00fckme ba\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>6. Ge\u00e7ici 10. maddenin (6) numaral\u0131 f\u0131kras\u0131n\u0131n birinci c\u00fcmlesinde 31\/7\/2023 tarihi itibar\u0131yla kapal\u0131 ceza infaz kurumlar\u0131nda bulunan h\u00fck\u00fcml\u00fclerin belirli \u015fartlar\u0131 ta\u015f\u0131malar\u0131 h\u00e2linde a\u00e7\u0131k ceza infaz kurumlar\u0131na ayr\u0131labilmeleri \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. An\u0131lan c\u00fcmleye g\u00f6re a\u00e7\u0131k ceza infaz kurumuna ayr\u0131labilmek i\u00e7in \u00f6ncelikle toplam hapis cezas\u0131 on y\u0131ldan az olan h\u00fck\u00fcml\u00fclerin cezalar\u0131n\u0131n bir ay\u0131n\u0131, on y\u0131l ve daha fazla olan h\u00fck\u00fcml\u00fclerin ise cezalar\u0131n\u0131n \u00fc\u00e7 ay\u0131n\u0131 kapal\u0131 ceza infaz kurumlar\u0131nda ge\u00e7irmeleri ve ilgili mevzuat uyar\u0131nca a\u00e7\u0131k ceza infaz kurumlar\u0131na ayr\u0131lmalar\u0131na \u00fc\u00e7 y\u0131l veya daha az s\u00fcre kalm\u0131\u015f olmas\u0131 gerekmektedir. Ayr\u0131ca s\u00f6z konusu c\u00fcmlede belirli su\u00e7lar y\u00f6n\u00fcnden istisna \u00f6ng\u00f6r\u00fclmek suretiyle 26\/9\/2004 tarihli ve 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun \u0130kinci Kitap D\u00f6rd\u00fcnc\u00fc K\u0131s\u0131m D\u00f6rd\u00fcnc\u00fc, Be\u015finci, Alt\u0131nc\u0131 ve Yedinci B\u00f6l\u00fcm\u00fc\u2019nde tan\u0131mlanan su\u00e7lar, 12\/4\/1991 tarihli ve 3713 say\u0131l\u0131 Ter\u00f6rle M\u00fccadele Kanunu kapsam\u0131na giren su\u00e7lar ve \u00f6rg\u00fct faaliyeti kapsam\u0131nda i\u015flenen su\u00e7lardan h\u00fck\u00fcm giyenler bu d\u00fczenlemenin kapsam\u0131 d\u0131\u015f\u0131nda b\u0131rak\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>7. C\u00fcmlede yer alan \u201c&#8230;31\/7\/2023 tarihi itibar\u0131yla kapal\u0131 ceza infaz kurumlar\u0131nda bulunan h\u00fck\u00fcml\u00fclerden,&#8230;\u201d ibaresi itiraz konusu kural\u0131 olu\u015fturmaktad\u0131r. Bu itibarla a\u00e7\u0131k ceza infaz kurumuna ayr\u0131lmaya ili\u015fkin s\u00f6z konusu d\u00fczenlemeden 31\/7\/2023 tarihi itibar\u0131yla kapal\u0131 ceza infaz kurumlar\u0131nda bulunan h\u00fck\u00fcml\u00fcler yararlanabilecektir. Ba\u015fka bir deyi\u015fle 31\/7\/2023 tarihinden sonra kapal\u0131 ceza infaz kurumuna al\u0131nan h\u00fck\u00fcml\u00fcler s\u00f6z konusu c\u00fcmlede yer alan di\u011fer \u015fartlar\u0131 sa\u011flasa dahi bu h\u00fck\u00fcm kapsam\u0131nda a\u00e7\u0131k ceza infaz kurumuna ayr\u0131lamayacakt\u0131r.<\/p>\n<p>8. An\u0131lan f\u0131kran\u0131n ikinci c\u00fcmlesinde ise bu f\u0131kra kapsam\u0131nda a\u00e7\u0131k ceza infaz kurumuna ayr\u0131lan h\u00fck\u00fcml\u00fcler ile 31\/7\/2023 tarihinde 5275 say\u0131l\u0131 Kanun\u2019un ge\u00e7ici 9. maddesinin (6) numaral\u0131 f\u0131kras\u0131 kapsam\u0131nda a\u00e7\u0131k ceza infaz kurumunda bulunan h\u00fck\u00fcml\u00fclerin, en az \u00fc\u00e7 ay a\u00e7\u0131k ceza infaz kurumunda kalm\u0131\u015f olmalar\u0131 ve taleplerinin bulunmas\u0131 \u015fart\u0131yla denetimli serbestlik uygulamas\u0131ndan \u00fc\u00e7 y\u0131l erken yararlanmalar\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>9. Ayn\u0131 maddenin (7) numaral\u0131 f\u0131kras\u0131 uyar\u0131nca (6) numaral\u0131 f\u0131krada yer alan a\u00e7\u0131k ceza infaz kurumuna ayr\u0131lmaya ili\u015fkin d\u00fczenleme 31\/7\/2023 tarihi itibar\u0131yla hapis cezas\u0131n\u0131n infaz\u0131 5275 say\u0131l\u0131 Kanun\u2019un 16., 16\/A ve 17. maddeleri kapsam\u0131nda ertelenmi\u015f olanlar ile ayn\u0131 tarih itibar\u0131yla hapis cezas\u0131n\u0131n infaz\u0131 durdurulmu\u015f olan h\u00fck\u00fcml\u00fcler hakk\u0131nda da uygulanacakt\u0131r.<\/p>\n<p>10. (8) numaral\u0131 f\u0131krada ise ko\u015fullu sal\u0131verilmenin geri al\u0131nmas\u0131 nedeniyle 31\/7\/2023 tarihi itibar\u0131yla cezas\u0131 aynen infaz edilen veya ikinci defa m\u00fckerrir olup 31\/7\/2023 tarihi itibar\u0131yla bu cezan\u0131n infaz\u0131 i\u00e7in ceza infaz kurumunda bulunan h\u00fck\u00fcml\u00fclerin bu cezalar\u0131n\u0131n infaz\u0131 bak\u0131m\u0131ndan (6) numaral\u0131 f\u0131kran\u0131n uygulanmayaca\u011f\u0131, ancak bu h\u00fck\u00fcml\u00fclerin 31\/7\/2023 tarihi itibar\u0131yla kesinle\u015fmi\u015f ancak infaz edilmemi\u015f di\u011fer hapis cezalar\u0131n\u0131n bulunmas\u0131 h\u00e2linde bu cezalar bak\u0131m\u0131ndan (6) numaral\u0131 f\u0131kran\u0131n uygulanaca\u011f\u0131 h\u00fckme ba\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>B. \u0130tiraz\u0131n Gerek\u00e7esi<\/p>\n<p>11. Ba\u015fvuru karar\u0131nda \u00f6zetle; a\u00e7\u0131k ceza infaz kurumuna ayr\u0131lma hakk\u0131 i\u00e7in su\u00e7 tarihi yerine h\u00fck\u00fcml\u00fc olma tarihinin esas al\u0131nmas\u0131n\u0131n infaz h\u00fck\u00fcmlerinin uygulanmas\u0131nda adil olmayan sonu\u00e7lara neden olaca\u011f\u0131 belirtilerek kural\u0131n Anayasa\u2019n\u0131n 2. ve 10. maddelerine ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>C. Anayasa\u2019ya Ayk\u0131r\u0131l\u0131k Sorunu<\/p>\n<p>12. Anayasa\u2019n\u0131n 2. maddesinde belirtilen hukuk devleti; eylem ve i\u015flemleri hukuka uygun, insan haklar\u0131na sayg\u0131l\u0131, bu hak ve \u00f6zg\u00fcrl\u00fckleri koruyup g\u00fc\u00e7lendiren, her alanda adil bir hukuk d\u00fczeni kurup bunu geli\u015ftirerek s\u00fcrd\u00fcren, Anayasa\u2019ya ayk\u0131r\u0131 durum ve tutumlardan ka\u00e7\u0131nan, hukuki g\u00fcvenli\u011fi sa\u011flayan, hukuk kurallar\u0131yla kendini ba\u011fl\u0131 sayan ve yarg\u0131 denetimine a\u00e7\u0131k olan devlettir.<\/p>\n<p>13. Hukuk devletinin temel unsurlar\u0131ndan biri de belirlilik ilkesidir. Bu ilkeye g\u00f6re yasal d\u00fczenlemelerin hem ki\u015filer hem de idare y\u00f6n\u00fcnden herhangi bir duraksamaya ve ku\u015fkuya yer vermeyecek \u015fekilde a\u00e7\u0131k, net, anla\u015f\u0131l\u0131r, uygulanabilir ve nesnel olmas\u0131, ayr\u0131ca kamu otoritelerinin keyf\u00ee uygulamalar\u0131na kar\u015f\u0131 koruyucu \u00f6nlem i\u00e7ermesi gerekir. Belirlilik ilkesi, hukuksal g\u00fcvenlikle ba\u011flant\u0131l\u0131 olup ki\u015finin kanundan belirli bir kesinlik i\u00e7inde hangi somut eylem ve olguya hangi hukuksal yapt\u0131r\u0131m\u0131n veya sonucun ba\u011fland\u0131\u011f\u0131n\u0131, bunlar\u0131n idareye hangi m\u00fcdahale yetkisini verdi\u011fini bilmesini zorunlu k\u0131lmaktad\u0131r. Ki\u015fi ancak bu durumda kendisine d\u00fc\u015fen y\u00fck\u00fcml\u00fcl\u00fckleri \u00f6ng\u00f6rebilir ve davran\u0131\u015flar\u0131n\u0131 ayarlayabilir. Hukuki g\u00fcvenlik ilkesi bireylerin t\u00fcm eylem ve i\u015flemlerinde devlete g\u00fcven duyabilmesini, devletin de yasal d\u00fczenlemelerinde bu g\u00fcven duygusunu zedeleyici y\u00f6ntemlerden ka\u00e7\u0131nmas\u0131n\u0131 gerekli k\u0131lar (AYM, E.2020\/80, K.2021\/34, 29\/4\/2021, \u00a7 25; E.2022\/9, K.2022\/80, 21\/6\/2022, \u00a7 11).<\/p>\n<p>14. 5275 say\u0131l\u0131 Kanun\u2019un ge\u00e7ici 10. maddesinin itiraz konusu kural\u0131n da yer ald\u0131\u011f\u0131 (6) numaral\u0131 f\u0131kras\u0131nda 31\/7\/2023 tarihi itibar\u0131yla kapal\u0131 ceza infaz kurumlar\u0131nda bulunan h\u00fck\u00fcml\u00fclerin a\u00e7\u0131k ceza infaz kurumlar\u0131na ayr\u0131labilmelerine ili\u015fkin \u015fartlar y\u00f6n\u00fcnden \u00f6zel bir d\u00fczenleme yap\u0131lm\u0131\u015ft\u0131r. Buna g\u00f6re an\u0131lan \u00f6zel d\u00fczenleme kapsam\u0131nda a\u00e7\u0131k ceza infaz kurumlar\u0131na ayr\u0131labilecek olanlar; 31\/7\/2023 tarihi itibar\u0131yla kapal\u0131 ceza kurumlar\u0131nda bulunan, cezas\u0131 5237 say\u0131l\u0131 Kanun\u2019un \u0130kinci Kitap D\u00f6rd\u00fcnc\u00fc K\u0131s\u0131m D\u00f6rd\u00fcnc\u00fc, Be\u015finci, Alt\u0131nc\u0131 ve Yedinci B\u00f6l\u00fcm\u00fc\u2019nde tan\u0131mlanan su\u00e7lardan, 3713 say\u0131l\u0131 Kanun kapsam\u0131na giren su\u00e7lardan ve \u00f6rg\u00fct faaliyeti kapsam\u0131nda i\u015flenen su\u00e7lardan kaynaklanmayan, toplam hapis cezas\u0131 on y\u0131ldan az ise bir ay\u0131n\u0131, on y\u0131l ve daha fazla ise \u00fc\u00e7 ay\u0131n\u0131 kapal\u0131 ceza infaz kurumlar\u0131nda ge\u00e7irip a\u00e7\u0131k ceza infaz kurumlar\u0131na ayr\u0131lmas\u0131na \u00fc\u00e7 y\u0131l veya daha az s\u00fcre kalan h\u00fck\u00fcml\u00fclerdir.<\/p>\n<p>15. Dolay\u0131s\u0131yla bu f\u0131kra kapsam\u0131nda kapal\u0131 ceza infaz kurumlar\u0131ndan a\u00e7\u0131k ceza infaz kurumlar\u0131na ayr\u0131labilecek h\u00fck\u00fcml\u00fcler bak\u0131m\u0131ndan aranan \u015fartlar\u0131n herhangi bir duraksamaya ve ku\u015fkuya yer vermeyecek \u015fekilde a\u00e7\u0131k, net ve anla\u015f\u0131l\u0131r bir \u015fekilde d\u00fczenlendi\u011fi anla\u015f\u0131ld\u0131\u011f\u0131ndan kuralda belirlilik ilkesine ayk\u0131r\u0131 bir y\u00f6n bulunmamaktad\u0131r.<\/p>\n<p>16. Ceza ve ceza yerine ge\u00e7en g\u00fcvenlik tedbirleriyle bunlar\u0131n infaz\u0131na ili\u015fkin kurallar, Anayasa\u2019n\u0131n konuya ili\u015fkin h\u00fck\u00fcmleri ba\u015fta olmak \u00fczere \u00fclkenin sosyal, k\u00fclt\u00fcrel yap\u0131s\u0131, etik de\u011ferleri ve ekonomik hayat\u0131n ihtiya\u00e7lar\u0131 g\u00f6z\u00f6n\u00fcne al\u0131narak saptanacak ceza siyasetine g\u00f6re belirlenir. Buna g\u00f6re hangi fiilin su\u00e7 say\u0131laca\u011f\u0131, cezan\u0131n t\u00fcr\u00fc ve miktar\u0131 ile infaza ili\u015fkin yasal d\u00fczenlemeler temelde devletin su\u00e7 ve ceza politikas\u0131na ba\u011fl\u0131 bir konudur. Su\u00e7 ve ceza y\u00f6n\u00fcnden s\u0131n\u0131rlar\u0131 belirtilen bu takdir alan\u0131, ceza sisteminin tamamlay\u0131c\u0131 b\u00f6l\u00fcm\u00fcn\u00fc olu\u015fturan infaz hukuku i\u00e7in de ge\u00e7erlidir (AYM, 2020\/53, 2021\/55, 14\/7\/2021, \u00a7\u00a7 186-187; E.2022\/9, K.2022\/80, 21\/6\/2022, \u00a7 17). Kanun koyucunun bu konudaki tercih ve takdirinin yerindeli\u011finin incelenmesi, anayasal denetimin kapsam\u0131 d\u0131\u015f\u0131nda kalmaktad\u0131r (AYM, E.2017\/170, K.2018\/77, 5\/7\/2018, \u00a7 12).<\/p>\n<p>17. Kanun koyucunun takdir yetkisi kapsam\u0131ndaki d\u00fczenlemeleri yaparken de hukuk devleti ilkesi gere\u011fince kamu yarar\u0131n\u0131 ger\u00e7ekle\u015ftirmek amac\u0131yla hareket etmesi gerekir. Anayasa Mahkemesince kamu yarar\u0131 konusunda yap\u0131lacak inceleme, kanunun kamu yarar\u0131 amac\u0131yla yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131n\u0131n ara\u015ft\u0131r\u0131lmas\u0131yla s\u0131n\u0131rl\u0131d\u0131r. Anayasa\u2019n\u0131n \u00e7e\u015fitli h\u00fck\u00fcmlerinde yer alan kamu yarar\u0131 kavram\u0131n\u0131n Anayasa\u2019da bir tan\u0131m\u0131 yap\u0131lmam\u0131\u015ft\u0131r. Ancak Anayasa Mahkemesinin kararlar\u0131nda da belirtildi\u011fi gibi kamu yarar\u0131; bireysel, \u00f6zel \u00e7\u0131karlardan ayr\u0131 ve bunlara \u00fcst\u00fcn olan toplumsal yarard\u0131r. Kamu yarar\u0131 d\u00fc\u015f\u00fcncesi olmaks\u0131z\u0131n yaln\u0131z \u00f6zel \u00e7\u0131karlar i\u00e7in veya sadece belli ki\u015filerin yarar\u0131na kanun h\u00fckm\u00fc konulamaz. B\u00f6yle bir durumun a\u00e7\u0131k bir bi\u00e7imde ve kesin olarak saptanmas\u0131 h\u00e2linde s\u00f6z konusu kanun h\u00fckm\u00fc Anayasa\u2019n\u0131n 2. maddesine ayk\u0131r\u0131 d\u00fc\u015fer. A\u00e7\u0131klanan istisnai h\u00e2l d\u0131\u015f\u0131nda bir kanun h\u00fckm\u00fcn\u00fcn gereksinimlere uygun olup olmad\u0131\u011f\u0131, hangi ara\u00e7 ve y\u00f6ntemlerle kamu yarar\u0131n\u0131n sa\u011flanabilece\u011fi kanun koyucunun takdirinde oldu\u011fundan bu kapsamda kamu yarar\u0131 de\u011ferlendirmesi yapmak anayasa yarg\u0131s\u0131yla ba\u011fda\u015fmaz (AYM, E.2020\/53, K.2021\/55, 14\/7\/2021, \u00a7 23; E.2022\/9, K.2022\/80, 21\/6\/2022, \u00a7 15).<\/p>\n<p>18. 5275 say\u0131l\u0131 Kanun\u2019un 14. maddesinde tan\u0131mlanan a\u00e7\u0131k ceza infaz kurumlar\u0131, h\u00fck\u00fcml\u00fclerin iyile\u015ftirilmelerine, \u00e7al\u0131\u015ft\u0131r\u0131lmalar\u0131 ve meslek edindirilmelerine \u00f6ncelik verilen, firara kar\u015f\u0131 engelleri ve d\u0131\u015f g\u00fcvenlik g\u00f6revlisi bulunmayan, g\u00fcvenlik bak\u0131m\u0131ndan kurum g\u00f6revlilerinin g\u00f6zetim ve denetimi ile yetinilen kurumlard\u0131r. Bu kurumlar, \u00e7a\u011fda\u015f ceza infaz sistemlerine uygun olarak, hapis cezas\u0131n\u0131n infaz\u0131 bak\u0131m\u0131ndan, h\u00fck\u00fcml\u00fcn\u00fcn su\u00e7luluk nedeni, su\u00e7 sicili, fizik ve ruhsal yetene\u011fi ve s\u0131n\u0131rlar\u0131, ki\u015fisel do\u011fas\u0131, arz edebilece\u011fi tehlike h\u00e2li ve hapis cezas\u0131n\u0131n s\u00fcresi de dikkate al\u0131narak, i\u015f ve \u00e7al\u0131\u015fma esas\u0131na dayal\u0131 olarak kurulmu\u015f olup, bu suretle, h\u00fck\u00fcml\u00fclerin \u00e7al\u0131\u015fmalar\u0131 suretiyle iyile\u015ftirilmelerini ve meslek edinmelerini sa\u011flayarak topluma yeniden kazand\u0131r\u0131lmalar\u0131 ama\u00e7lanm\u0131\u015ft\u0131r (AYM, E.2014\/26, K.2014\/78, 9\/4\/2014).<\/p>\n<p>19. Kuralla, hem 31\/7\/2023 tarihinden sonraki d\u00f6nemde kapal\u0131 ceza infaz kurumlar\u0131nda olu\u015facak yo\u011funluklar\u0131n \u00f6nlenmesinin hem de a\u00e7\u0131k ceza infaz rejiminin genel amac\u0131yla ba\u011flant\u0131l\u0131 olarak h\u00fck\u00fcml\u00fclerin iyile\u015ftirilmelerinin ve meslek edinmelerinin sa\u011flanarak topluma yeniden kazand\u0131r\u0131lmalar\u0131n\u0131n hedeflendi\u011fi anla\u015f\u0131lmaktad\u0131r. Bu itibarla kural\u0131n kamu yarar\u0131 d\u0131\u015f\u0131nda bir amac\u0131 ger\u00e7ekle\u015ftirmeye y\u00f6nelik oldu\u011fu s\u00f6ylenemez.<\/p>\n<p>20. \u00d6te yandan kuralla 31\/7\/2023 tarihi itibar\u0131yla kapal\u0131 ceza infaz kurumlar\u0131nda bulunan t\u00fcm h\u00fck\u00fcml\u00fclerin do\u011frudan a\u00e7\u0131k ceza infaz kurumlar\u0131na ayr\u0131labilmeleri \u00f6ng\u00f6r\u00fclmemi\u015f; hem belirli su\u00e7 t\u00fcrlerinden kaynaklanan cezalar\u0131n infaz\u0131 kapsam d\u0131\u015f\u0131nda b\u0131rak\u0131lm\u0131\u015f hem de toplam ceza miktar\u0131na g\u00f6re hapis cezas\u0131n\u0131n bir k\u0131sm\u0131n\u0131n kapal\u0131 ceza infaz kurumlar\u0131nda ge\u00e7irilmesi aranm\u0131\u015ft\u0131r. Ayr\u0131ca, h\u00fck\u00fcml\u00fcn\u00fcn 31\/7\/2023 tarihi itibar\u0131yla kapal\u0131 ceza infaz kurumlar\u0131nda bulunma sebebinin ko\u015fullu sal\u0131verilmenin geri al\u0131nmas\u0131 nedeniyle cezan\u0131n aynen infaz\u0131 veya ikinci defa m\u00fckerrir olunan cezan\u0131n infaz\u0131 oldu\u011fu h\u00e2ller de kural\u0131n kapsam\u0131 d\u0131\u015f\u0131ndad\u0131r. Bu itibarla 31\/7\/2023 tarihi itibar\u0131yla kapal\u0131 ceza infaz kurumlar\u0131nda bulunan h\u00fck\u00fcml\u00fcler bak\u0131m\u0131ndan a\u00e7\u0131k ceza infaz kurumuna ayr\u0131labilme y\u00f6n\u00fcnden farkl\u0131 \u015fartlar\u0131n belirlenmesi kanun koyucunun takdir yetkisi kapsam\u0131nda olup kuralda hukuk devleti ilkesiyle ba\u011fda\u015fmayan bir y\u00f6n bulunmamaktad\u0131r.<\/p>\n<p>21. A\u00e7\u0131klanan nedenlerle kural Anayasa\u2019n\u0131n 2. maddesine ayk\u0131r\u0131 de\u011fildir. \u0130tiraz\u0131n reddi gerekir.<\/p>\n<p>Engin YILDIRIM, Selahaddin MENTE\u015e ve Basri BA\u011eCI bu g\u00f6r\u00fc\u015fe kat\u0131lmam\u0131\u015flard\u0131r.<\/p>\n<p>Kural\u0131n Anayasa\u2019n\u0131n 10. maddesine de ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015f ise de bu ba\u011flamda belirtilen hususlar\u0131n Anayasa\u2019n\u0131n 2. maddesi y\u00f6n\u00fcnden yap\u0131lan de\u011ferlendirmeler kapsam\u0131nda ele al\u0131nm\u0131\u015f olmas\u0131 nedeniyle Anayasa\u2019n\u0131n 10. maddesi y\u00f6n\u00fcnden ayr\u0131ca bir inceleme yap\u0131lmas\u0131na gerek g\u00f6r\u00fclmemi\u015ftir.<\/p>\n<p>IV. Mevcut d\u00fczenlemeye g\u00f6re bu imk\u00e2ndan faydalanman\u0131n iki ko\u015fulu bulunmaktad\u0131r. Bunlardan ilk 31\/7\/2013 tarihinde kapal\u0131 ceza infaz kurumlar\u0131nda bulunmak, ikinci \u015fart ise s\u00f6z konusu tarih itibariyle h\u00fck\u00fcml\u00fc stat\u00fcs\u00fcnde olmakt\u0131r. Bu iki ko\u015fuldan birinin eksik olmas\u0131 durumunda ki\u015fi belirlenen avantajlardan yararlanamayacakt\u0131r.<\/p>\n<p>4. Belirlenen bu iki \u015fart\u0131n ikisinin ayn\u0131 anda bir arada bulunmas\u0131 genel olarak ki\u015filerin kendi inisiyatifinde olan konulardan de\u011fildir.<\/p>\n<p>5. Ayn\u0131 su\u00e7 nedeniyle yarg\u0131lamas\u0131 devam ederken kovu\u015fturma a\u015famas\u0131nda tutuklanan iki san\u0131ktan bir tanesinin yarg\u0131lamas\u0131n\u0131n daha erken kesinle\u015fmesi ve belirlenen tarihte h\u00fck\u00fcml\u00fc stat\u00fcs\u00fcne kavu\u015fmas\u0131 durumunda bu ki\u015fi s\u00f6z konusu kural\u0131n sa\u011flad\u0131\u011f\u0131 kolayl\u0131klardan yararlanacakt\u0131r.<\/p>\n<p>6. Ayn\u0131 su\u00e7tan yarg\u0131lanan di\u011fer ki\u015fi ise Cumhuriyet savc\u0131s\u0131 taraf\u0131ndan hakk\u0131nda verilen karar\u0131n temyiz edilmesi nedeniyle h\u00fckm\u00fcn 31\/7\/2023 tarihinden sonra kesinle\u015fmesi durumunda belirlenen bu tarih itibariyle h\u00fck\u00fcml\u00fc stat\u00fcs\u00fcnde olmamas\u0131 nedeniyle sa\u011flanan avantajlardan yararlanamayacakt\u0131r.<\/p>\n<p>7. Bu durum ayn\u0131 tarihte ayn\u0131 su\u00e7u i\u015fleyen ve belirlenen tarihte her ikisi de ceza infaz kurumunda bulunan ki\u015filer a\u00e7\u0131s\u0131ndan farkl\u0131 uygulamalara sebebiyet vermektedir.<\/p>\n<p>8. Bu konuda e\u015fitsizli\u011fe sebebiyet verecek \u00f6rneklerin art\u0131r\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr. Bu e\u015fitsizli\u011fe neden olan en \u00f6nemli unsur ise d\u00fczenlemenin belirli bir tarihte ceza infaz kurumunda h\u00fck\u00fcml\u00fc s\u0131fat\u0131yla bulunma \u015fart\u0131n\u0131n aran\u0131yor olmas\u0131d\u0131r.<\/p>\n<p>9. Halbuki infaz rejimine dair yap\u0131lan d\u00fczenlemelerde genellikle belirli bir tarihten \u00f6nce i\u015flenmi\u015f su\u00e7lar baz al\u0131nmaktad\u0131r. \u00d6rne\u011fin infaz indirimi olarak kaleme al\u0131nan 21.12.2000 g\u00fcnl\u00fc 4616 say\u0131l\u0131 Yasada 23 Nisan 1999 tarihine kadar i\u015flenen su\u00e7lardan dolay\u0131 \u015fartla sal\u0131verilmeyi, dava ve cezalar\u0131n ertelenmesi d\u00fczenlenmi\u015f olup, Anayasa Mahkemesi Kanun\u2019un belirlenen tarihten \u00f6nce i\u015flenen su\u00e7lara uygulanmas\u0131n\u0131 Anayasa\u2019ya ayk\u0131r\u0131 bulmam\u0131\u015ft\u0131r (AYM, E.2001\/4, K.2001\/332, 18\/07\/2001, sh. 17).<\/p>\n<p>10. Ayn\u0131 \u015fekilde 14\/4\/2020 tarihli ve 7242 say\u0131l\u0131 Ceza ve G\u00fcvenlik Tedbirlerinin \u0130nfaz\u0131 Hakk\u0131nda Kanun ile Baz\u0131 Kanunlarda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun ile 13\/12\/2004 tarihli ve 5275 say\u0131l\u0131 Ceza ve G\u00fcvenlik Tedbirlerinin \u0130nfaz\u0131 Hakk\u0131nda Kanun\u2019un de\u011fi\u015ftirilen Ge\u00e7ici 6. maddesinde 30\/3\/2020 tarihinden \u00f6nce i\u015flenen su\u00e7lar\u0131n infaz edilmesinde denetimli serbestlik uygulanmas\u0131nda lehe d\u00fczenlemeler yap\u0131larak h\u00fck\u00fcml\u00fclerin daha erken kapal\u0131 ceza infaz kurumlar\u0131ndan \u00e7\u0131kmalar\u0131na olanak sa\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>11. Her iki \u00f6rnekte uygulanan ve Anayasal olarak sorun olu\u015fturmad\u0131\u011f\u0131 kabul edilen, infaz ko\u015fullar\u0131nda lehe de\u011fi\u015fiklik i\u00e7eren kanunun belirli bir tarihten \u00f6nce i\u015flenmi\u015f olan su\u00e7lara tatbik edilmesine dair d\u00fczenleme, itiraz talebine konu edilen kuralda farkl\u0131 bir \u015fekle b\u00fcr\u00fcnd\u00fcr\u00fclerek belirli bir tarihte h\u00fck\u00fcml\u00fc s\u0131fat\u0131 ile kapal\u0131 ceza infaz kurumunda bulunma \u015fart\u0131na d\u00f6n\u00fc\u015ft\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>12. Bu d\u00fczenleme yukar\u0131da verilen \u00f6rnekte a\u00e7\u0131kland\u0131\u011f\u0131 gibi ayn\u0131 su\u00e7u i\u015flemi\u015f ki\u015filer a\u00e7\u0131s\u0131ndan ayn\u0131 anda infaz kurumunda bulunsalar bile haklar\u0131ndaki cezan\u0131n kesinle\u015fme durumuna g\u00f6re farkl\u0131 sonu\u00e7lar\u0131n ortaya \u00e7\u0131kmas\u0131na sebebiyet verecek mahiyettedir.<\/p>\n<p>13. Halbuki su\u00e7 tarihinin esas al\u0131nmas\u0131 durumunda s\u00f6z konusu farkl\u0131l\u0131k ortaya \u00e7\u0131kmayacakt\u0131r.<\/p>\n<p>14. Belirtilen tarihte infaz kurumunda h\u00fck\u00fcml\u00fc olma kriteri objektif verilere dayanmamakta, an\u0131lan tarihte bu iki \u015fart\u0131n ger\u00e7ekle\u015fmesi ya\u015fanan s\u00fcre\u00e7lerin etkisiyle bir nevi tesad\u00fcflere kalmaktad\u0131r.<\/p>\n<p>15. \u0130tiraz talebine konu edilen kural ayn\u0131 konumda bulunan ki\u015filer a\u00e7\u0131s\u0131ndan farkl\u0131 uygulamalar yap\u0131lmas\u0131na kaynakl\u0131k te\u015fkil etti\u011finden Anayasa\u2019n\u0131n 10. maddesinde d\u00fczenlenen Kanun \u00d6n\u00fcnde E\u015fitlik ilkesine ayk\u0131r\u0131l\u0131k te\u015fkil etmektedir.<\/p>\n<p>16. Di\u011fer taraftan kural belirlenen tarih itibariyle h\u00fck\u00fcml\u00fc stat\u00fcs\u00fc bulunmas\u0131na ra\u011fmen \u00e7e\u015fitli sebeplerle infaz kurumunda bulunmayan veya lehe sebeplerle stat\u00fcs\u00fc h\u00fck\u00fcml\u00fcden h\u00fckmen tutukluya d\u00f6n\u00fc\u015fen ki\u015filer a\u00e7\u0131s\u0131nda belirsizlikler ihtiva etmektedir.<\/p>\n<p>Misalen:<\/p>\n<p>17. H\u00fck\u00fcml\u00fc stat\u00fcs\u00fcnde iken 5271 say\u0131l\u0131 Kanunun 280\/3 veya 306. maddelerindeki lehe bozman\u0131n kendilerine sirayet etmesi nedeniyle hukuki konumlar\u0131 h\u00fck\u00fcml\u00fcden h\u00fckmen tutuklu durumuna d\u00f6n\u00fc\u015fen ki\u015filerin kanunun uygulama kapsam\u0131na girip girmeyece\u011fi tart\u0131\u015fmal\u0131d\u0131r.<\/p>\n<p>18. Kapal\u0131 ceza infaz kurumunda bulunmas\u0131na ve hakk\u0131ndaki h\u00fck\u00fcm infaz edilmekte iken 5275 say\u0131l\u0131 Yasa\u2019n\u0131n 16 veya 16\/A maddesinde yaz\u0131l\u0131 sebeplerle cezalar\u0131n\u0131n infaz\u0131 ertelenen ve 31\/7\/2023 tarihinde infaz kurumunda fiilen bulunamayan h\u00fck\u00fcml\u00fclerin durumu da belirsizdir.<\/p>\n<p>19. Benzer \u015fekilde de\u011fi\u015fen mevzuat h\u00fck\u00fcmleri \u00e7er\u00e7evesinde uyarlama yarg\u0131lamas\u0131 yap\u0131lmak \u00fczere hakk\u0131ndaki infaz durdurulan bir ki\u015finin durumunun ne olaca\u011f\u0131 da belirsizlikler i\u00e7ermektedir.<\/p>\n<p>20. Say\u0131lan bu nedenlerle kural, Anayasa\u2019n\u0131n 2. maddesine de ayk\u0131r\u0131l\u0131klar ihtiva etmektedir.<\/p>\n<p>21.
