Ba\u015fvuru, s\u00fcrekli i\u015f\u00e7i kadrosunda \u00e7al\u0131\u015ft\u0131r\u0131lma talebinin reddedilmesi nedeniyle \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ihlal edildi\u011fi iddias\u0131na ili\u015fkindir.<\/p>\n<p>II. BA\u015eVURU S\u00dcREC\u0130<\/p>\n<p>2. Ba\u015fvuru 2\/2\/2021 tarihinde yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>3. Komisyon, ba\u015fvurunun kabul edilebilirlik incelemesinin B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na karar vermi\u015ftir.<\/p>\n<p>4. Ba\u015fvuru belgelerinin bir \u00f6rne\u011fi, bilgi i\u00e7in Adalet Bakanl\u0131\u011f\u0131na (Bakanl\u0131k) g\u00f6nderilmi\u015ftir. Bakanl\u0131k, g\u00f6r\u00fc\u015f\u00fcn\u00fc sunmu\u015ftur. Ba\u015fvurucu, Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 s\u00fcresinde beyanda bulunmam\u0131\u015ft\u0131r.<\/p>\n<p>III. OLAY VE OLGULAR <\/p>\n<p>5. Ba\u015fvuru formu ve eklerinde ifade edildi\u011fi \u015fekliyle ilgili olaylar \u015f\u00f6yledir:<\/p>\n<p>6. Ba\u015fvurucu, Diyarbak\u0131r \u0130l Emniyet M\u00fcd\u00fcrl\u00fc\u011f\u00fcnde (\u0130dare) alt i\u015fverene ba\u011fl\u0131 olarak temizlik i\u015f\u00e7isi olarak g\u00f6rev yaparken 20\/11\/2017 tarihli ve 696 say\u0131l\u0131 Ola\u011fan\u00fcst\u00fc Hal Kapsam\u0131nda Baz\u0131 D\u00fczenlemeler Yap\u0131lmas\u0131 Hakk\u0131nda Kanun H\u00fckm\u00fcnde Kararname&#8217;nin (696 say\u0131l\u0131 KHK) 127. maddesiyle 27\/6\/1989 tarihli ve 375 say\u0131l\u0131 Kanun H\u00fckm\u00fcnde Kararname&#8217;ye (375 say\u0131l\u0131 KHK) eklenen ge\u00e7ici 23. madde kapsam\u0131nda s\u00fcrekli i\u015f\u00e7i kadrosunda \u00e7al\u0131\u015ft\u0131r\u0131lmak \u00fczere ba\u015fvurmu\u015ftur.<\/p>\n<p>7. \u0130dare, an\u0131lan talebi ba\u015fvurucunun daha \u00f6nce kasten i\u015fledi\u011fi bir su\u00e7tan dolay\u0131 bir y\u0131ldan fazla hapis cezas\u0131 alm\u0131\u015f olmas\u0131 nedeniyle 375 say\u0131l\u0131 KHK&#8217;n\u0131n ge\u00e7ici 23. maddesinin birinci f\u0131kras\u0131n\u0131n (a) bendinde yer alan 14\/7\/1965 tarihli ve 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanunu\u2019nun 48. maddesinin birinci f\u0131kras\u0131n\u0131n (A) bendinin (5) numaral\u0131 alt bendinde belirtilen devlet memurlu\u011funa al\u0131nacaklarda aranan \u015fartlar\u0131 ta\u015f\u0131mad\u0131\u011f\u0131ndan bahisle reddederek ba\u015fvurucunun i\u015f akdini feshetmi\u015ftir. An\u0131lan karara kar\u015f\u0131 yap\u0131lan itiraz ba\u015fvurusu da ayn\u0131 gerek\u00e7eyle reddedilmi\u015ftir.<\/p>\n<p>8. \u00d6te yandan 31\/3\/2018 tarihli ve 30377 say\u0131l\u0131 Resm\u00ee Gazete&#8217;de yay\u0131mlanan d\u00fczenlemeyle 19\/9\/2009 tarihli ve 27354 say\u0131l\u0131 Resmi Gazetede yay\u0131mlanan Kamu Kurum ve Kurulu\u015flar\u0131na Eski H\u00fck\u00fcml\u00fc veya Ter\u00f6rle M\u00fccadelede Malul Say\u0131lmayacak \u015eekilde Yaralananlar\u0131n \u0130\u015f\u00e7i Olarak Al\u0131nmas\u0131nda Uygulanacak Usul ve Esaslar Hakk\u0131nda Y\u00f6netmelik&#8217;e ge\u00e7ici 1. madde eklenmi\u015ftir. An\u0131lan maddeyle 375 say\u0131l\u0131 KHK&#8217;n\u0131n ge\u00e7ici 23. maddesinde aranan di\u011fer t\u00fcm \u015fartlar\u0131 ta\u015f\u0131makla birlikte yaln\u0131zca 657 say\u0131l\u0131 Kanun&#8217;un 48. maddesinin (A) bendinin (5) numaral\u0131 alt bendinde belirtilen \u015fart\u0131 ta\u015f\u0131mayan ba\u015fvurucular\u0131n bu Y\u00f6netmelik kapsam\u0131nda eski h\u00fck\u00fcml\u00fc oldu\u011funu belgelendirmeleri h\u00e2linde s\u00fcrekli i\u015f\u00e7i kadrosuna ge\u00e7i\u015f yapamad\u0131\u011f\u0131 ilgili kamu kurum ve kurulu\u015funca kurumdan talepte bulunmaks\u0131z\u0131n eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131rma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc kapsam\u0131nda i\u015fe al\u0131nabilmelerine olanak sa\u011flanm\u0131\u015ft\u0131r. Ba\u015fvurusu bunun \u00fczerine \u0130dareye yeniden s\u00fcrekli i\u015f\u00e7i kadrosuna ge\u00e7i\u015f ba\u015fvurusunda bulunmu\u015ftur.<\/p>\n<p>9. \u0130dare, s\u00f6z konusu talebi 11\/5\/2018 tarihli ve 3555 say\u0131l\u0131 i\u015flemiyle reddetmi\u015ftir. Karar\u0131n gerek\u00e7esinde; \u00f6ncelikle 22\/5\/2003 tarihli ve 4857 say\u0131l\u0131 \u0130\u015f Kanunu&#8217;nun 30. maddesi kapsam\u0131nda haz\u0131rlanan 25\/4\/2009 tarihli ve 27210 say\u0131l\u0131 Yurti\u00e7inde \u0130\u015fe Yerle\u015ftirme Hizmetleri Hakk\u0131nda Y\u00f6netmelik&#8217;in 20. maddesinde, kamu g\u00fcvenli\u011fi ile ilgili hizmet \u00fcreten i\u015fyerlerinde eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131r\u0131lamayaca\u011f\u0131n\u0131n belirtildi\u011fine ve bu i\u015fyerlerinin ilgili bakanl\u0131klar\u0131n g\u00f6r\u00fc\u015fleri al\u0131narak \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131 (\u00c7SGB) taraf\u0131ndan tespit edilece\u011fine ili\u015fkin mevzuat yer verildikten sonra \u00c7SGB&#8217;nin 4\/11\/2011 tarihli ve 17580 say\u0131l\u0131 yaz\u0131s\u0131 uyar\u0131nca Emniyet Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn merkez ve ta\u015fra te\u015fkilat\u0131n\u0131n eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131rmaktan muaf tutuldu\u011fu ifade edilmi\u015ftir.<\/p>\n<p>10. Ba\u015fvurucu, an\u0131lan i\u015fleme kar\u015f\u0131 30\/1\/2019 tarihinde Diyarbak\u0131r 3. \u0130dare Mahkemesinde (Mahkeme) iptal davas\u0131 a\u00e7m\u0131\u015ft\u0131r. Dava dilek\u00e7esinde; alt i\u015fverene ba\u011fl\u0131 temizlik i\u015f\u00e7isi olarak Diyarbak\u0131r Emniyet M\u00fcd\u00fcrl\u00fc\u011f\u00fcnde 9 y\u0131l g\u00f6rev yapt\u0131\u011f\u0131n\u0131, s\u00fcrekli i\u015f\u00e7i kadrosunda \u00e7al\u0131\u015ft\u0131r\u0131lmak i\u00e7in yapt\u0131\u011f\u0131 ba\u015fvurunun reddedilmesiyle i\u015fsiz kald\u0131\u011f\u0131n\u0131, sonras\u0131nda T\u00fcrkiye \u0130\u015f Kurumuna (\u0130\u015fkur) ba\u015fvurdu\u011funu ve Toplum Yarar\u0131na Program (TYP) kapsam\u0131nda yakla\u015f\u0131k 6 ay s\u00fcresince yine Diyarbak\u0131r Emniyet M\u00fcd\u00fcrl\u00fc\u011f\u00fcnde \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131 belirtmi\u015ftir. Bunun yan\u0131nda \u00e7al\u0131\u015ft\u0131\u011f\u0131 s\u00fcrede defalarca g\u00fcvenlik soru\u015fturmas\u0131ndan ge\u00e7ti\u011fini belirten ba\u015fvurucu, hakk\u0131nda daha \u00f6nce verilen mahk\u00fbmiyet karar\u0131n\u0131n basit yaralamadan ibaret oldu\u011funu ve kurumun i\u015fleyi\u015fine y\u00f6nelik herhangi bir tehdit olu\u015fturmad\u0131\u011f\u0131n\u0131 belirterek tesis edilen i\u015flemin mevzuat\u0131n yanl\u0131\u015f yorumlanmas\u0131ndan kaynakland\u0131\u011f\u0131n\u0131 ileri s\u00fcrm\u00fc\u015ft\u00fcr. Daval\u0131 idare, savunma dilek\u00e7esinde \u0130darenin ret gerek\u00e7esinde belirtti\u011fi hususlar\u0131 yinelemi\u015ftir (bkz. \u00a7 9).<\/p>\n<p>11. Mahkeme 31\/10\/2019 tarihli karar\u0131yla davan\u0131n reddine karar vermi\u015ftir. Karar\u0131n gerek\u00e7esinde; \u00c7SGB&#8217;nin g\u00f6r\u00fc\u015f yaz\u0131s\u0131yla Emniyet Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn merkez ve ta\u015fra te\u015fkilat\u0131n\u0131n eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131rmaktan muaf tutuldu\u011fu, Kamu Kurum ve Kurulu\u015flar\u0131na Eski H\u00fck\u00fcml\u00fc veya Ter\u00f6rle M\u00fccadelede Malul Say\u0131lmayacak \u015eekilde Yaralananlar\u0131n \u0130\u015f\u00e7i Olarak Al\u0131nmas\u0131nda Uygulanacak Usul ve Esaslar Hakk\u0131nda Y\u00f6netmelik&#8217;e eklenen ge\u00e7ici 1. maddeyle 375 say\u0131l\u0131 KHK&#8217;n\u0131n ge\u00e7ici 23. maddesinde belirtilen \u015fartlardan yaln\u0131zca 657 say\u0131l\u0131 Kanun&#8217;un 48. maddesinin (A) bendinin (5) numaral\u0131 alt bendinde belirtilen \u015fart\u0131 ta\u015f\u0131mayan alt i\u015fveren i\u015f\u00e7ilerine eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131rma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc kapsam\u0131nda i\u015fe al\u0131nabilme olana\u011f\u0131 sa\u011flanm\u0131\u015f olsa da bu d\u00fczenlemenin mutlak suretle talepte bulunanlar\u0131n kamu g\u00f6revine al\u0131nmalar\u0131n\u0131 zorunlu k\u0131lmad\u0131\u011f\u0131 ve bu d\u00fczenlemenin idareye takdir yetkisi tan\u0131d\u0131\u011f\u0131 belirtilmi\u015ftir. Nihayetinde i\u015flemin idareye tan\u0131nan takdir yetkisi kapsam\u0131nda kamu yarar\u0131 ve hizmet gerekleri uyar\u0131nca tesis edildi\u011fi sonucuyla dava konusu i\u015flemde hukuka ve mevzuata ayk\u0131r\u0131l\u0131k bulunmad\u0131\u011f\u0131 sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>12. Ba\u015fvurucu, mahkeme karar\u0131na kar\u015f\u0131 Gaziantep B\u00f6lge \u0130dare Mahkemesi 4. \u0130dari Dava Dairesine (Daire) istinaf ba\u015fvurusunda bulunmu\u015ftur. Daire 10\/11\/2020 tarihli karar\u0131yla davan\u0131n kesin olarak reddine karar vermi\u015ftir.<\/p>\n<p>13. Ba\u015fvurucu, nihai karar\u0131 12\/1\/2021 tarihinde \u00f6\u011frendikten sonra 2\/2\/2021 tarihinde bireysel ba\u015fvuruda bulunmu\u015ftur.<\/p>\n<p>IV. \u0130LG\u0130L\u0130 HUKUK<\/p>\n<p>A. \u0130lgili Mevzuat<\/p>\n<p>14. 696 say\u0131l\u0131 KHK&#8217;n\u0131n 127. maddesiyle 375 say\u0131l\u0131 KHK&#8217;ya eklenen ge\u00e7ici 23. maddenin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8221;5018 say\u0131l\u0131 Kanuna ekli (I), (II), (III) ve (IV) say\u0131l\u0131 cetvellerde yer alan kamu idareleri (M\u0130T M\u00fcste\u015farl\u0131\u011f\u0131 hari\u00e7) ile bunlara ba\u011fl\u0131 d\u00f6ner sermayeli kurulu\u015flar, bu Kanun H\u00fckm\u00fcnde Kararnameye ekli (I) say\u0131l\u0131 listede yer alan idarelerin merkez ve ta\u015fra te\u015fkilatlar\u0131nda; \u00f6demeleri merkezi y\u00f6netim, sosyal g\u00fcvenlik kurumu, fon, kefalet sand\u0131\u011f\u0131, yat\u0131r\u0131m izleme ve koordinasyon ba\u015fkanl\u0131\u011f\u0131, gen\u00e7lik hizmetleri ve spor il m\u00fcd\u00fcrl\u00fc\u011f\u00fc b\u00fct\u00e7elerinden veya d\u00f6ner sermaye b\u00fct\u00e7elerinden, an\u0131lan liste kapsam\u0131ndaki di\u011fer idareler i\u00e7in ise kendi b\u00fct\u00e7elerinden kar\u015f\u0131lanan 4734 say\u0131l\u0131 Kanun ve di\u011fer mevzuattaki h\u00fck\u00fcmler uyar\u0131nca personel \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131na dayal\u0131 hizmet al\u0131m s\u00f6zle\u015fmeleri kapsam\u0131nda y\u00fckleniciler taraf\u0131ndan 4\/12\/2017 tarihi itibar\u0131yla \u00e7al\u0131\u015ft\u0131r\u0131lmakta olanlar;<\/p>\n<p>a)657 say\u0131l\u0131 Kanunun 48 inci maddesinin (A) bendinin (1), (4), (5), (6), (7) ve (8) numaral\u0131 alt bentlerinde belirtilen \u015fartlar\u0131 ta\u015f\u0131mak,<\/p>\n<p>&#8230;&#8221;<\/p>\n<p>15. 657 say\u0131l\u0131 Kanun&#8217;un 48. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir.<\/p>\n<p>&#8221; Devlet memurlu\u011funa al\u0131nacaklarda a\u015fa\u011f\u0131daki genel ve \u00f6zel \u015fartlar aran\u0131r.<\/p>\n<p>A) Genel \u015fartlar:<\/p>\n<p>&#8230;<\/p>\n<p>5. (De\u011fi\u015fik altbent: 23\/01\/2008-5728 S.K.\/317.mad) T\u00fcrk Ceza Kanununun 53 \u00fcnc\u00fc maddesinde belirtilen s\u00fcreler ge\u00e7mi\u015f olsa bile; kasten i\u015flenen bir su\u00e7tan dolay\u0131 bir y\u0131l veya daha fazla s\u00fcreyle hapis cezas\u0131na ya da affa u\u011fram\u0131\u015f olsa bile devletin g\u00fcvenli\u011fine kar\u015f\u0131 su\u00e7lar, Anayasal d\u00fczene ve bu d\u00fczenin i\u015fleyi\u015fine kar\u015f\u0131 su\u00e7lar, zimmet, irtik\u00e2p, r\u00fc\u015fvet, h\u0131rs\u0131zl\u0131k, doland\u0131r\u0131c\u0131l\u0131k, sahtecilik, g\u00fcveni k\u00f6t\u00fcye kullanma, hileli iflas, ihaleye fesat kar\u0131\u015ft\u0131rma, edimin ifas\u0131na fesat kar\u0131\u015ft\u0131rma, su\u00e7tan kaynaklanan malvarl\u0131\u011f\u0131 de\u011ferlerini aklama veya ka\u00e7ak\u00e7\u0131l\u0131k su\u00e7lar\u0131ndan mahk\u00fbm olmamak.<\/p>\n<p>&#8230;&#8221;<\/p>\n<p>16. Kamu Kurum ve Kurulu\u015flar\u0131na Eski H\u00fck\u00fcml\u00fc veya Ter\u00f6rle M\u00fccadelede Malul Say\u0131lmayacak \u015eekilde Yaralananlar\u0131n \u0130\u015f\u00e7i Olarak Al\u0131nmas\u0131nda Uygulanacak Usul ve Esaslar Hakk\u0131nda Y\u00f6netmelik&#8217;in ge\u00e7ici 1. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;(1) 27\/6\/1989 tarihli ve 375 say\u0131l\u0131 Kanun H\u00fckm\u00fcnde Kararnamenin ge\u00e7ici 23 \u00fcnc\u00fc maddesi kapsam\u0131nda aranan di\u011fer t\u00fcm \u015fartlar\u0131 ta\u015f\u0131makla birlikte yaln\u0131zca 657 say\u0131l\u0131 Kanunun 48 inci maddesinin (A) bendinin (5) numaral\u0131 alt bendinde belirtilen \u015fart\u0131 ta\u015f\u0131mamas\u0131 nedeniyle s\u00fcrekli i\u015f\u00e7i kadrosuna\/ge\u00e7ici i\u015f\u00e7i pozisyonuna ge\u00e7irilemeyen alt i\u015fveren i\u015f\u00e7ilerinden; bu Y\u00f6netmelik kapsam\u0131nda eski h\u00fck\u00fcml\u00fc oldu\u011funu belgelendirenler, s\u00fcrekli i\u015f\u00e7i kadrosuna\/ge\u00e7ici i\u015f\u00e7i pozisyonuna ge\u00e7i\u015f yapamad\u0131\u011f\u0131 ilgili kamu kurum ve kurulu\u015funca Kurumdan talepte bulunmaks\u0131z\u0131n 375 say\u0131l\u0131 Kanun H\u00fckm\u00fcnde Kararnamenin ge\u00e7ici 23 \u00fcnc\u00fc maddesi h\u00fck\u00fcmlerine tabi olmak kayd\u0131yla eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131rma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc kapsam\u0131nda i\u015fe al\u0131nabilir.&#8221;<\/p>\n<p>17. 22\/5\/2003 tarihli ve 4857 say\u0131l\u0131 \u0130\u015f Kanunu&#8217;nun 30. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;&#8230;Eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131nda, kanunlardaki kamu g\u00fcvenli\u011fi ile ilgili hizmetlere ili\u015fkin \u00f6zel h\u00fck\u00fcmler sakl\u0131d\u0131r.&#8221;<\/p>\n<p>18. Yurti\u00e7inde \u0130\u015fe Yerle\u015ftirme Hizmetleri Hakk\u0131nda Y\u00f6netmelik&#8217;in 20. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Eski h\u00fck\u00fcml\u00fclerin, herhangi bir s\u0131n\u0131rlama olmaks\u0131z\u0131n kamuya ait i\u015fyerlerinde \u00e7al\u0131\u015ft\u0131r\u0131lmalar\u0131 esast\u0131r. Ancak, kamu g\u00fcvenli\u011fi ile ilgili hizmet \u00fcreten i\u015fyerlerinde eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131r\u0131lamaz. Anayasa Mahkemesi Karar\u0131<\/p>\n<p>20. Anayasa Mahkemesi 696 say\u0131l\u0131 KHK&#8217;n\u0131n 127. maddesiyle 375 say\u0131l\u0131 KHK&#8217;ya eklenen ve 7079 say\u0131l\u0131 Kanun\u2019un 118. maddesiyle aynen kabul edilen ge\u00e7ici 23. maddenin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (a) bendinde yer alan &#8220;657 say\u0131l\u0131 Kanunun 48 inci maddesinin (A) bendinin (1), (4), (5), (6), (7) ve (8) numaral\u0131 alt bentlerinde belirtilen \u015fartlar\u0131 ta\u015f\u0131mak&#8221; h\u00fckm\u00fcn &#8220;(4), (5), (6), (7) ve (8)&#8221; ibaresinin iptali talebini incelemi\u015f; 27\/12\/2023 tarihli ve E.2018\/96, K.2023\/222 say\u0131l\u0131 karar\u0131 ile an\u0131lan ibarenin iptal talebini reddetmi\u015ftir. Karar\u0131n ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;343. Kuralla 657 say\u0131l\u0131 Kanun\u2019un 48. maddesinin (A) beninde yer alan baz\u0131 alt bentlere at\u0131fla \u015fartlar\u0131n belirlendi\u011fi g\u00f6r\u00fclmektedir. S\u00f6z konusu alt bentlerin a\u00e7\u0131k ve net bir \u015fekilde d\u00fczenlendi\u011fi anla\u015f\u0131ld\u0131\u011f\u0131ndan kural\u0131n belirsiz oldu\u011fundan s\u00f6z edilemez.<\/p>\n<p>344. Anayasa\u2019n\u0131n 49. maddesinde \u00e7al\u0131\u015fma hakk\u0131 i\u00e7in herhangi bir s\u0131n\u0131rlama nedeni \u00f6ng\u00f6r\u00fclmemi\u015f olmakla birlikte \u00f6zel s\u0131n\u0131rlama nedeni \u00f6ng\u00f6r\u00fclmemi\u015f haklar\u0131n da o hakk\u0131n do\u011fas\u0131ndan kaynaklanan baz\u0131 s\u0131n\u0131rlar\u0131n\u0131n bulundu\u011fu kabul edilmektedir. \u00d6te yandan Anayasa&#8217;n\u0131n ba\u015fka maddelerinde yer alan hak ve \u00f6zg\u00fcrl\u00fckler ile devlete y\u00fcklenen \u00f6devler, \u00f6zel s\u0131n\u0131rlama sebebi g\u00f6sterilmemi\u015f hak ve \u00f6zg\u00fcrl\u00fcklere s\u0131n\u0131r te\u015fkil edebilir.<\/p>\n<p>345. Kamuya y\u00f6nelik hizmetlerde istihdam edilecek ki\u015filerde devlet memurlu\u011funa al\u0131nacaklarda aranan genel \u015fartlardan,&#8230;, Kanun\u2019da belirtilen su\u00e7lardan mahk\u00fbm olmam\u0131\u015f olmas\u0131,&#8230;, \u015fartlar\u0131n\u0131n aranmas\u0131n\u0131n hizmetin sa\u011fl\u0131kl\u0131 bir \u015fekilde y\u00fcr\u00fct\u00fclebilmesi bak\u0131m\u0131ndan ta\u015f\u0131d\u0131\u011f\u0131 \u00f6nem a\u00e7\u0131kt\u0131r. Bu itibarla kural\u0131n verilecek hizmetlerin sa\u011fl\u0131kl\u0131 ve etkin bir \u015fekilde y\u00fcr\u00fct\u00fclmesine y\u00f6nelik me\u015fru bir amac\u0131n\u0131n oldu\u011fu anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>346. \u00d6te yandan alt bentlerde belirtilen ve dava konusu edilen \u015fartlar\u0131n devlet memurlar\u0131nda aranacak genel \u015fartlar oldu\u011fu, nitelikleri itibar\u0131yla de asgari d\u00fczeyde bir belirleme i\u00e7erdikleri a\u00e7\u0131kt\u0131r. Bu itibarla s\u00f6z konusu \u015fartlar\u0131n hizmetin etkin ve sa\u011fl\u0131kl\u0131 bir \u015fekilde y\u00fcr\u00fct\u00fclmesi amac\u0131na ula\u015fma bak\u0131m\u0131ndan elveri\u015fli ve gerekli olmad\u0131\u011f\u0131 s\u00f6ylenemez.<\/p>\n<p>347. Kamu kurum ve kurulu\u015flar\u0131nda y\u00fckleniciler taraf\u0131ndan \u00e7al\u0131\u015ft\u0131r\u0131lan ki\u015filere tan\u0131nan s\u00fcrekli i\u015f\u00e7i olarak istihdam edilme imk\u00e2n\u0131na ili\u015fkin \u015fartlar\u0131n belirlenmesi noktas\u0131ndaki takdir yetkisinin devlet memurlu\u011fu i\u00e7in belirlenen genel \u015fartlardan baz\u0131lar\u0131n\u0131n aranmas\u0131 \u015feklinde kullan\u0131lmas\u0131 her \u015feyden \u00f6nce g\u00f6r\u00fclen hizmetin ve istihdam edilen yerin niteli\u011finden kaynaklanmaktad\u0131r. S\u00f6z konusu genel \u015fartlardan (2) ve (3) numaral\u0131 alt bentlerde yer verilen ya\u015f ve \u00f6\u011frenim \u015fartlar\u0131n\u0131n d\u0131\u015f\u0131nda kalan asgari d\u00fczeydeki \u015fartlar\u0131n bu ki\u015filerde aran\u0131yor olmas\u0131 dikkate al\u0131nd\u0131\u011f\u0131nda kuralla ula\u015f\u0131lmak istenen amaca ili\u015fkin kamu yarar\u0131 ile \u00e7al\u0131\u015fma hakk\u0131 aras\u0131nda bulunmas\u0131 gereken makul dengenin g\u00f6zetildi\u011fi anla\u015f\u0131lmaktad\u0131r. Bu itibarla s\u00f6z konusu s\u0131n\u0131rlaman\u0131n orant\u0131s\u0131z oldu\u011fu s\u00f6ylenemez.<\/p>\n<p>348. Anayasa\u2019n\u0131n 10. maddesinde belirtilen kanun \u00f6n\u00fcnde e\u015fitlik ilkesi hukuksal durumlar\u0131 ayn\u0131 olanlar i\u00e7in s\u00f6z konusudur. Bu ilke ile eylemli de\u011fil hukuksal e\u015fitlik \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. E\u015fitlik ilkesinin amac\u0131 ayn\u0131 durumda bulunan ki\u015filerin kanunlar kar\u015f\u0131s\u0131nda ayn\u0131 i\u015fleme ba\u011fl\u0131 tutulmalar\u0131n\u0131 sa\u011flamak, ayr\u0131m yap\u0131lmas\u0131n\u0131 ve ayr\u0131cal\u0131k tan\u0131nmas\u0131n\u0131 \u00f6nlemektir. Bu ilkeyle, ayn\u0131 durumda bulunan kimi ki\u015fi ve topluluklara ayr\u0131 kurallar uygulanarak kanun kar\u015f\u0131s\u0131nda e\u015fitli\u011fin ihlali yasaklanm\u0131\u015ft\u0131r. Kanun \u00f6n\u00fcnde e\u015fitlik, herkesin her y\u00f6nden ayn\u0131 kurallara ba\u011fl\u0131 tutulaca\u011f\u0131 anlam\u0131na gelmez. Durumlar\u0131ndaki \u00f6zellikler, kimi ki\u015filer ya da topluluklar i\u00e7in de\u011fi\u015fik kurallar\u0131 ve uygulamalar\u0131 gerektirebilir. Ayn\u0131 hukuksal durumlar ayn\u0131, ayr\u0131 hukuksal durumlar farkl\u0131 kurallara ba\u011fl\u0131 tutulursa Anayasa\u2019da \u00f6ng\u00f6r\u00fclen e\u015fitlik ilkesi zedelenmez.<\/p>\n<p>&#8230;<\/p>\n<p>350. ,&#8230;, s\u00f6z konusu Y\u00f6netmelik gere\u011fi i\u015f\u00e7i al\u0131m\u0131 i\u00e7in ilk kriter kamu kurum ve kurulu\u015fu taraf\u0131ndan i\u015f\u00e7i ihtiyac\u0131 olu\u015fmas\u0131d\u0131r. Bu i\u015f\u00e7i ihtiyac\u0131 s\u00fcrekli veya ge\u00e7ici i\u015f s\u00f6zle\u015fmesi imzalanmak suretiyle giderilebilecektir. Dava konusu kural gere\u011fi s\u00fcrekli i\u015f\u00e7i kadrosunda istihdam\u0131 \u00f6ng\u00f6r\u00fclen ki\u015filer ise kamu kurum ve kurulu\u015funun hizmet al\u0131m\u0131 ile alt i\u015fverence \u00e7al\u0131\u015ft\u0131r\u0131lan ki\u015filerdir. Kural bu ki\u015filerin s\u00fcrekli i\u015f s\u00f6zle\u015fmesi ile istihdam edilmesini \u00f6ng\u00f6rmekle birlikte istihdam gerek\u00e7esinin ihtiyaca dayanmad\u0131\u011f\u0131 ve sadece madde kapsam\u0131nda alt i\u015fveren taraf\u0131ndan \u00e7al\u0131\u015ft\u0131r\u0131lan ki\u015filere s\u00f6z konusu imk\u00e2n\u0131n tan\u0131nd\u0131\u011f\u0131 dikkate al\u0131nd\u0131\u011f\u0131nda, bu ki\u015filerin e\u015fitlik ilkesinin gere\u011fi olarak kar\u015f\u0131la\u015ft\u0131rma yap\u0131lmaya m\u00fcsait olacak \u015fekilde benzer durumda olmad\u0131klar\u0131 anla\u015f\u0131lmaktad\u0131r. Dolay\u0131s\u0131yla s\u00f6z konusu ki\u015filerin Y\u00f6netmelik\u2019te belirlenen \u015fartlar yerine ba\u015fka \u015fartlara tabi k\u0131l\u0131nmas\u0131n\u0131n e\u015fitlik ilkesini zedeleyen bir y\u00f6n\u00fc bulunmamaktad\u0131r.<\/p>\n<p>351. A\u00e7\u0131klanan nedenlerle kural, Anayasa\u2019n\u0131n 10., 13. ve 49. maddelerine ayk\u0131r\u0131 de\u011fildir. \u0130ptal talebinin reddi gerekir.&#8221;<\/p>\n<p>V. \u0130NCELEME VE GEREK\u00c7E<\/p>\n<p>21. Anayasa Mahkemesinin 29\/4\/2025 tarihinde yapm\u0131\u015f oldu\u011fu toplant\u0131da ba\u015fvuru incelenip gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. Ba\u015fvurucunun \u0130ddialar\u0131 ve Bakanl\u0131k G\u00f6r\u00fc\u015f\u00fc<\/p>\n<p>22. Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcnde; ba\u015fvurucunun temel hak ve h\u00fcrriyetlerinin ihlal edildi\u011fine y\u00f6nelik \u015fik\u00e2yetleri hakk\u0131nda Anayasa Mahkemesi taraf\u0131ndan yap\u0131lacak incelemede Anayasa ve ilgili mevzuat h\u00fck\u00fcmleri, Anayasa Mahkemesi i\u00e7tihad\u0131 ve somut olay\u0131n kendine \u00f6zg\u00fc \u015fartlar\u0131n\u0131n dikkate al\u0131nmas\u0131 gerekti\u011fi ifade edilmi\u015ftir. Ba\u015fvurucu, Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcne cevap vermemi\u015ftir.<\/p>\n<p>B. De\u011ferlendirme<\/p>\n<p>1. Uygulanabilirlik Y\u00f6n\u00fcnden <\/p>\n<p>24. Anayasa\u2019n\u0131n &#8220;\u00d6zel hayat\u0131n gizlili\u011fi&#8221; kenar ba\u015fl\u0131kl\u0131 20. maddesinin birinci f\u0131kras\u0131n\u0131n ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p> \u201cHerkes, \u00f6zel hayat\u0131na &#8230; sayg\u0131 g\u00f6sterilmesini isteme hakk\u0131na sahiptir. \u00d6zel hayat\u0131n &#8230; gizlili\u011fine dokunulamaz.&#8221;<\/p>\n<p>25. Somut olayda alt i\u015fverene ba\u011fl\u0131 olarak uzun bir s\u00fcre Diyarbak\u0131r Emniyet M\u00fcd\u00fcrl\u00fc\u011f\u00fcnde g\u00f6rev yapan eski h\u00fck\u00fcml\u00fc ba\u015fvurucu, bu g\u00f6revini s\u00fcrd\u00fcr\u00fcrken s\u00fcrekli i\u015f\u00e7i kadrosuna ge\u00e7i\u015f talebinde bulunmu\u015ftur. Ancak \u0130dare eski h\u00fck\u00fcml\u00fclerin kamu g\u00fcvenli\u011fi ile ilgili hizmet \u00fcreten i\u015fyerlerinde \u00e7al\u0131\u015ft\u0131r\u0131lamayaca\u011f\u0131ndan bahisle bu talebi reddetmi\u015ftir. Buna g\u00f6re ba\u015fvurucunun mesleki hayat\u0131na y\u00f6nelen m\u00fcdahalenin \u00f6zel hayata dayanan bir nedenden -eski h\u00fck\u00fcml\u00fc olma- kaynakland\u0131\u011f\u0131 a\u00e7\u0131k oldu\u011fundan ba\u015fvuru konusu iddialar\u0131n bir b\u00fct\u00fcn olarak \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda incelenebilir nitelikte oldu\u011fu de\u011ferlendirilmi\u015ftir (benzer de\u011ferlendirmeler i\u00e7in C.A. (3) [GK], B. No: 2018\/10286, 2\/7\/2020, \u00a7\u00a7 97-101; Ayla Demir \u0130\u015fat [GK], B. No: 2018\/24245, 8\/10\/2020, \u00a7\u00a7 106-110; Enis Aras [GK], B. A\u00e7\u0131k\u00e7a dayanaktan yoksun olmad\u0131\u011f\u0131 ve kabul edilemezli\u011fine karar verilmesini gerektirecek ba\u015fka bir neden de bulunmad\u0131\u011f\u0131 anla\u015f\u0131lan \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ihlal edildi\u011fine ili\u015fkin iddian\u0131n kabul edilebilir oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>3. Esas Y\u00f6n\u00fcnden<\/p>\n<p>a. M\u00fcdahalenin Varl\u0131\u011f\u0131<\/p>\n<p>27. Ba\u015fvurucunun s\u00fcrekli i\u015f\u00e7i kadrosuna ge\u00e7i\u015f talebinin \u0130dare taraf\u0131ndan reddedilmesi nedeniyle \u00f6zel hayata sayg\u0131 hakk\u0131na m\u00fcdahalede bulunuldu\u011fu sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>b. Anayasa\u2019n\u0131n 13. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Temel hak ve h\u00fcrriyetler, \u00f6zlerine dokunulmaks\u0131z\u0131n yaln\u0131zca Anayasan\u0131n ilgili maddelerinde belirtilen sebeplere ba\u011fl\u0131 olarak ve ancak kanunla s\u0131n\u0131rlanabilir. Bu s\u0131n\u0131rlamalar, Anayasan\u0131n s\u00f6z\u00fcne ve ruhuna, demokratik toplum d\u00fczeninin ve l\u00e2ik Cumhuriyetin gereklerine ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olamaz.&#8221;<\/p>\n<p>29. Yukar\u0131da belirlenen m\u00fcdahale, Anayasa\u2019n\u0131n 13. maddesinde belirtilen ko\u015fullara uygun olmad\u0131\u011f\u0131 takdirde Anayasa\u2019n\u0131n 20. maddesini ihlal edecektir. Bu sebeple s\u0131n\u0131rlaman\u0131n Anayasa\u2019n\u0131n 13. maddesinde \u00f6ng\u00f6r\u00fclen ve somut ba\u015fvuruya uygun d\u00fc\u015fen, kanun taraf\u0131ndan \u00f6ng\u00f6r\u00fclme, me\u015fru ama\u00e7 ta\u015f\u0131ma, demokratik toplum d\u00fczeninin gereklerine ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olmama kriterlerine uygun olup olmad\u0131\u011f\u0131n\u0131n belirlenmesi gerekir (Halil Berk[1. Somut olayda, s\u00fcrekli i\u015f\u00e7i kadrosuna ba\u015fvurabilmek i\u00e7in \u00f6ng\u00f6r\u00fclen kas\u0131tl\u0131 bir su\u00e7tan belirli bir s\u00fcre mahk\u00fbm olmama \u015fart\u0131n\u0131n yap\u0131lan y\u00f6netmelik de\u011fi\u015fikli\u011fiyle ba\u015fvurucu gibi bu \u015fart\u0131 ta\u015f\u0131mayan di\u011fer alt i\u015fveren i\u015f\u00e7ileri y\u00f6n\u00fcnden eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131rma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc kapsam\u0131nda a\u015f\u0131ld\u0131\u011f\u0131 ve ba\u015fvurunun olumlu sonu\u00e7land\u0131r\u0131lmas\u0131n\u0131n ilgili kamu kurumunun takdirine b\u0131rak\u0131ld\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. \u0130dare ise mevcut ba\u015fvuruda takdiri bir de\u011ferlendirmeden ziyade Yurti\u00e7inde \u0130\u015fe Yerle\u015ftirme Hizmetleri Hakk\u0131nda Y\u00f6netmelik&#8217;in 20. maddesi kapsam\u0131nda haz\u0131rlanan \u00c7SGB&#8217;nin 4\/11\/2011 tarihli ve 17580 say\u0131l\u0131 yaz\u0131s\u0131nda yer alan &#8220;emniyet m\u00fcd\u00fcrl\u00fcklerinin eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131rmaktan muaf oldu\u011funa&#8221; ili\u015fkin g\u00f6r\u00fc\u015f\u00fc gerek\u00e7e g\u00f6stererek ba\u015fvurucunun talebini reddetmi\u015ftir (bkz. \u00a7 9).<\/p>\n<p>32. Bahse konu Y\u00f6netmelik&#8217;in dayana\u011f\u0131 olan 4857 say\u0131l\u0131 \u0130\u015f Kanunu&#8217;nun 30. maddesine bak\u0131ld\u0131\u011f\u0131nda ise eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131nda, kanunlardaki kamu g\u00fcvenli\u011fi ile ilgili hizmetlere ili\u015fkin \u00f6zel h\u00fck\u00fcmlerin sakl\u0131 oldu\u011funun belirtilmesi haricinde herhangi bir belirlemeye yer verilmedi\u011fi g\u00f6r\u00fclmektedir (bkz. \u00a7 17). Dolay\u0131s\u0131yla somut olaya konu m\u00fcdahalenin salt kamu g\u00fcvenli\u011fi ile ilgili hizmet \u00fcreten i\u015fyerlerinde eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131r\u0131lamayaca\u011f\u0131na ili\u015fkin verilen bir g\u00f6r\u00fc\u015f yaz\u0131s\u0131 \u00fczerinden yap\u0131ld\u0131\u011f\u0131 ve bir kanuni d\u00fczenlemeye dayanmad\u0131\u011f\u0131 anla\u015f\u0131ld\u0131\u011f\u0131ndan kanunilik \u015fart\u0131n\u0131 kar\u015f\u0131lamad\u0131\u011f\u0131 kanaatine ula\u015f\u0131lm\u0131\u015ft\u0131r. Bununla birlikte somut olay\u0131n ko\u015fullar\u0131 dikkate al\u0131nd\u0131\u011f\u0131nda ba\u015fvuruda sadece kanunilik \u00f6l\u00e7\u00fct\u00fcn\u00fcn de\u011ferlendirilmesi ile yetinilmesi, \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n kapsam\u0131na ili\u015fkin uygulamada ya\u015fanan anayasal sorunlar\u0131n \u00e7\u00f6z\u00fcm\u00fc i\u00e7in tek ba\u015f\u0131na yeterli olmayacakt\u0131r. Bu nedenle m\u00fcdahalenin me\u015fru amac\u0131n\u0131n olup olmad\u0131\u011f\u0131 ve demokratik toplum d\u00fczeninin gereklerine uygun olup olmad\u0131\u011f\u0131n\u0131n da belirlenmesine ihtiya\u00e7 oldu\u011fu de\u011ferlendirilmi\u015ftir.<\/p>\n<p>ii. Me\u015fru Ama\u00e7<\/p>\n<p>33. Ba\u015fvurucunun eski h\u00fck\u00fcml\u00fc olmas\u0131 nedeniyle kamu g\u00fcvenli\u011fi ile ilgili hizmet \u00fcreten i\u015fyerinde \u00e7al\u0131\u015ft\u0131r\u0131lmamas\u0131 \u015feklindeki m\u00fcdahalenin kamu hizmetinin gere\u011fi gibi yerine getirilmesine y\u00f6nelik \u00f6nlemlerin bir par\u00e7as\u0131 oldu\u011fu ve kamu d\u00fczeninin korunmas\u0131 me\u015fru amac\u0131n\u0131 ta\u015f\u0131d\u0131\u011f\u0131 sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>iii. Demokratik Toplum D\u00fczeninin Gereklerine Uygunluk<\/p>\n<p>34. \u00d6zel hayata sayg\u0131 hakk\u0131na y\u00f6nelik bir m\u00fcdahalenin demokratik toplum d\u00fczeninin gereklerine uygun kabul edilebilmesi i\u00e7in zorunlu bir toplumsal ihtiyac\u0131 kar\u015f\u0131lamas\u0131 ve \u00f6l\u00e7\u00fcl\u00fc olmas\u0131 gerekir. An\u0131lan \u00f6l\u00e7\u00fctlere uygun bir s\u0131n\u0131rland\u0131rma yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131n\u0131n tespiti i\u00e7in m\u00fcdahale te\u015fkil eden \u00f6nlemin temelini olu\u015fturan me\u015fru ama\u00e7 kar\u015f\u0131s\u0131nda, bireye d\u00fc\u015fen fedak\u00e2rl\u0131\u011f\u0131n a\u011f\u0131rl\u0131\u011f\u0131n\u0131n g\u00f6z\u00f6n\u00fcnde bulundurulmas\u0131 ve g\u00f6zetilen genel yarar\u0131n gerekleri ile bireyin temel hakk\u0131n\u0131n korunmas\u0131 aras\u0131nda adil bir dengenin kurulup kurulmad\u0131\u011f\u0131n\u0131n belirlenmesi zorunludur. Ayr\u0131ca yarg\u0131sal makamlar\u0131n bahse konu dengelemede olu\u015fturduklar\u0131 gerek\u00e7elerin ikna edici nitelikte ilgili ve yeterli olmas\u0131 da gerekir (Ata T\u00fcrkeri [1. B.], B. No: 2013\/6057, 16\/12\/2015, \u00a7\u00a7 43-48; B\u00fclent Polat, \u00a7\u00a7 105-111; Haluk \u00d6ktem [GK], B. No: 2014\/13433, 13\/10\/2016, \u00a7\u00a7 47-54; Erhun \u00d6ks\u00fcz [GK], B. No: 2014\/12777, 13\/10\/2016 \u00a7\u00a7 52-58; C.A. (3), \u00a7\u00a7 114-118 ).<\/p>\n<p>35. Bir kamu kurumunda alt i\u015fveren b\u00fcnyesinde \u00e7al\u0131\u015fan ba\u015fvurucu, 375 say\u0131l\u0131 KHK&#8217;n\u0131n ge\u00e7ici 23. maddesi uyar\u0131nca bu stat\u00fcdeki ki\u015filere \u00e7al\u0131\u015ft\u0131klar\u0131 kurumlardaki s\u00fcrekli i\u015f\u00e7i kadrolar\u0131na ge\u00e7i\u015f hakk\u0131 tan\u0131nmas\u0131 \u00fczerine g\u00f6rev yapt\u0131\u011f\u0131 emniyet m\u00fcd\u00fcrl\u00fc\u011f\u00fcne ba\u015fvuruda bulunmu\u015ftur. Ba\u015fvurucunun talebi, ilgili d\u00fczenlemede \u00f6ng\u00f6r\u00fclen \u201ckas\u0131tl\u0131 bir su\u00e7tan bir y\u0131l veya daha uzun s\u00fcreyle hapis cezas\u0131na mahk\u00fbm edilmemi\u015f olma\u201d \u015fart\u0131n\u0131 sa\u011flamad\u0131\u011f\u0131 gerek\u00e7esiyle reddedilmi\u015ftir (bkz. \u00a7\u00a7 6, 7). Bununla birlikte 19\/9\/2009 tarihli ve 27354 say\u0131l\u0131 Resmi Gazetede yay\u0131mlanan Y\u00f6netmelik&#8217;e sonradan eklenen ge\u00e7ici bir h\u00fck\u00fcmle di\u011fer t\u00fcm \u015fartlar\u0131 ta\u015f\u0131mas\u0131na ra\u011fmen yaln\u0131zca mahk\u00fbmiyete ili\u015fkin \u015fart\u0131 sa\u011flayamayan alt i\u015fveren i\u015f\u00e7ilerinin eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131rma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc kapsam\u0131nda i\u015fe al\u0131nmas\u0131 m\u00fcmk\u00fcn h\u00e2le getirilmi\u015ftir (bkz. \u00a7 8). Ba\u015fvurucu bu do\u011frultuda \u0130dareye yeniden ba\u015fvurmu\u015fsa da emniyet m\u00fcd\u00fcrl\u00fcklerinin kamu g\u00fcvenli\u011fi ile ilgili hizmet \u00fcreten i\u015fyerlerinden olmas\u0131 nedeniyle eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131rmaktan muaf oldu\u011funu belirten \u00c7SGB g\u00f6r\u00fc\u015f\u00fc uyar\u0131nca talebi reddedilmi\u015ftir (bkz. \u00a7\u00a7 9-12).<\/p>\n<p>36. Somut olaya konu s\u00fcrekli i\u015f\u00e7i kadrosuna ba\u015fvurabilmek i\u00e7in \u00f6ng\u00f6r\u00fclen kas\u0131tl\u0131 bir su\u00e7tan belirli bir s\u00fcre mahk\u00fbm olmama \u015fart\u0131n\u0131n yap\u0131lan y\u00f6netmelik de\u011fi\u015fikli\u011fiyle ba\u015fvurucu gibi bu \u015fart\u0131 ta\u015f\u0131mayan di\u011fer alt i\u015fveren i\u015f\u00e7ileri y\u00f6n\u00fcnden eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131rma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc kapsam\u0131nda a\u015f\u0131ld\u0131\u011f\u0131 ve ba\u015fvurunun olumlu sonu\u00e7land\u0131r\u0131lmas\u0131n\u0131n ilgili kamu kurumunun takdirine b\u0131rak\u0131ld\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Dolay\u0131s\u0131yla ba\u015fvurucunun eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131rma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc kapsam\u0131nda bu kadroya ba\u015fvurmas\u0131n\u0131n \u00f6n\u00fcnde ilkesel olarak herhangi bir engel bulundu\u011fu s\u00f6ylenemez. Nitekim an\u0131lan \u015fart\u0131 ta\u015f\u0131mad\u0131\u011f\u0131 gerek\u00e7esiyle ba\u015fvurucunun ilk m\u00fcracaat\u0131n\u0131 reddeden \u0130dare de y\u00f6netmelik de\u011fi\u015fikli\u011fi \u00e7er\u00e7evesinde yap\u0131lan ikinci ba\u015fvuruyu de\u011ferlendirmeye alarak emniyet m\u00fcd\u00fcrl\u00fcklerinin eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131rmaktan muaf oldu\u011funa ili\u015fkin farkl\u0131 bir gerek\u00e7eyle ba\u015fvuruyu reddetmi\u015ftir. Bu ba\u011flamda eldeki mesele, alt i\u015fverene ba\u011fl\u0131 olarak emniyet m\u00fcd\u00fcrl\u00fc\u011f\u00fcnde g\u00f6rev yapan ba\u015fvurucunun eski h\u00fck\u00fcml\u00fc olmas\u0131 nedeniyle bu kamu kurumunun s\u00fcrekli i\u015f\u00e7i kadrosunda istihdam edilmemesinin \u00f6zel hayata sayg\u0131 hakk\u0131 \u00e7er\u00e7evesinde de\u011ferlendirilmesidir.<\/p>\n<p>37. \u0130dare ret gerek\u00e7esinde, s\u00fcrekli i\u015f\u00e7i kadrosuna ge\u00e7i\u015fe ili\u015fkin mevzuat d\u00fczenlemesinden yakla\u015f\u0131k alt\u0131 y\u0131l \u00f6nce -2011 y\u0131l\u0131nda- \u00c7SGB taraf\u0131ndan verilen ve emniyet m\u00fcd\u00fcrl\u00fcklerinin eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131rmaktan muaf oldu\u011funu belirten g\u00f6r\u00fc\u015f yaz\u0131s\u0131na dayanm\u0131\u015ft\u0131r. Bu noktada \u0130darenin ilgili g\u00f6r\u00fc\u015f\u00fc ba\u011flay\u0131c\u0131 nitelikte g\u00f6rd\u00fc\u011f\u00fc ve bu g\u00f6r\u00fc\u015f\u00fcn verildi\u011fi tarih itibar\u0131yla i\u015fyerinde eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131r\u0131lamayaca\u011f\u0131n\u0131 kabul etti\u011fi s\u00f6ylenebilir. Ancak somut olayda ba\u015fvurucuya verilen hapis cezas\u0131, 2014 y\u0131l\u0131nda kesinle\u015ferek infaz edilmesine ra\u011fmen ba\u015fvurucu emniyet m\u00fcd\u00fcrl\u00fc\u011f\u00fcndeki g\u00f6revine s\u00fcrekli i\u015f\u00e7i kadrosuna ge\u00e7i\u015f ba\u015fvurusunun \u0130darece reddedildi\u011fi 2018 y\u0131l\u0131na kadar devam etmi\u015ftir. Bunun yan\u0131 s\u0131ra ba\u015fvurucunun i\u015fsiz kalmas\u0131n\u0131n ard\u0131ndan \u0130\u015fkura m\u00fcracaat etti\u011fi ve TYP kapsam\u0131nda yine ayn\u0131 emniyet m\u00fcd\u00fcrl\u00fc\u011f\u00fcnde alt\u0131 ay s\u00fcreyle \u00e7al\u0131\u015ft\u0131r\u0131ld\u0131\u011f\u0131 g\u00f6r\u00fclmektedir (bkz. \u00a7 10).<\/p>\n<p>38. Buna g\u00f6re ilgili g\u00f6r\u00fc\u015f\u00fcn varl\u0131\u011f\u0131na ra\u011fmen \u0130darenin hem infazdan sonra ba\u015fvurucunun i\u015fyerinde \u00e7al\u0131\u015fmas\u0131na yakla\u015f\u0131k d\u00f6rt y\u0131l boyunca izin vermesi hem de s\u00fcrekli i\u015f\u00e7i kadrosuna ge\u00e7i\u015f talebini reddettikten sonra TYP kapsam\u0131nda i\u015fyerinde tekrar \u00e7al\u0131\u015fmas\u0131na m\u00fcsaade etmesi g\u00f6z\u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda ret gerek\u00e7esine esas al\u0131nan g\u00f6r\u00fc\u015f yaz\u0131s\u0131n\u0131n somut olay\u0131n ko\u015fullar\u0131nda ba\u011flay\u0131c\u0131 oldu\u011funu s\u00f6ylemek m\u00fcmk\u00fcn de\u011fildir. Ayr\u0131ca an\u0131lan a\u00e7\u0131klamalar \u0131\u015f\u0131\u011f\u0131nda \u0130darenin ba\u015fvurucunun emniyet m\u00fcd\u00fcrl\u00fc\u011f\u00fcnde \u00e7al\u0131\u015fmas\u0131n\u0131 g\u00fcvenlik hizmetlerinin gere\u011fi gibi -s\u00fcrekli ve d\u00fczenli- y\u00fcr\u00fct\u00fclmesine bir tehdit olarak alg\u0131lad\u0131\u011f\u0131n\u0131 da kabul etmek m\u00fcmk\u00fcn olmam\u0131\u015ft\u0131r.<\/p>\n<p>39. \u00d6te yandan daha \u00f6nce a\u00e7\u0131kland\u0131\u011f\u0131 \u00fczere y\u00f6netmelikte yap\u0131lan de\u011fi\u015fiklik, eski h\u00fck\u00fcml\u00fclerin s\u00fcrekli i\u015f\u00e7i olarak istihdam edilmesini zorunlu k\u0131lmaks\u0131z\u0131n ba\u015fvurular\u0131n de\u011ferlendirilmesini ilgili kamu kurumunun takdirine b\u0131rakmaktad\u0131r. Ancak mevcut olayda \u0130dare, \u00c7SGB&#8217;nin ba\u011flay\u0131c\u0131 olmayan g\u00f6r\u00fc\u015f\u00fcn\u00fc gerek\u00e7e g\u00f6stermenin \u00f6tesinde ba\u015fvurucunun ge\u00e7mi\u015f \u00e7al\u0131\u015fmalar\u0131ndaki tutum ve davran\u0131\u015flar\u0131, infaz edilen mahk\u00fbmiyet karar\u0131n\u0131n \u00f6zellikleri ve bunlar\u0131n kamu hizmetinin s\u00fcrekli ve d\u00fczenli y\u00fcr\u00fct\u00fclmesine etkileri gibi hususlara hi\u00e7 de\u011finmeden ba\u015fvurucunun talebini reddetmi\u015ftir. Di\u011fer bir ifadeyle \u0130dare, somut olay\u0131n ko\u015fullar\u0131nda bireyselle\u015ftirilmi\u015f bir gerek\u00e7e sunmaks\u0131z\u0131n takdir yetkisini olumsuz y\u00f6nde kullanm\u0131\u015ft\u0131r. Yarg\u0131 mercileri ise \u00c7SGB&#8217;nin g\u00f6r\u00fc\u015f yaz\u0131s\u0131na yer verdikleri kararlar\u0131nda i\u015flemin idarenin takdir yetkisi kapsam\u0131nda hukuka uygun olarak tesis edildi\u011fini belirtmenin haricinde ba\u015fkaca bir a\u00e7\u0131klamada bulunmam\u0131\u015ft\u0131r (bkz. \u00a7\u00a7 11, 12).<\/p>\n<p>40. Nihayetinde yukar\u0131da yap\u0131lan tespit ve a\u00e7\u0131klamalar bir b\u00fct\u00fcn h\u00e2linde de\u011ferlendirildi\u011finde somut olayda \u0130dare ve yarg\u0131 mercilerinin m\u00fcdahalenin zorunlu toplumsal bir ihtiyaca kar\u015f\u0131l\u0131k geldi\u011fini ilgili ve yeterli bir gerek\u00e7e ile ortaya koyamad\u0131\u011f\u0131 kanaatine var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>41. Son olarak mevcut ba\u015fvuruda ula\u015f\u0131lan sonucun eski h\u00fck\u00fcml\u00fclerin s\u00fcrekli i\u015f\u00e7i olmak i\u00e7in yapt\u0131klar\u0131 ba\u015fvurular\u0131n do\u011frudan kabul edilmesi anlam\u0131na gelmedi\u011fini, bu gibi ba\u015fvurular\u0131n de\u011ferlendirilmesinin yukar\u0131da a\u00e7\u0131klanan ba\u011flamlarda ilgili kamu kurumunun takdirine b\u0131rak\u0131ld\u0131\u011f\u0131n\u0131 ve an\u0131lan takdir yetkisinin hukuka uygun kulland\u0131\u011f\u0131n\u0131n ilgili ve yeterli gerek\u00e7eyle ortaya konulmas\u0131n\u0131n bariz takdir hatas\u0131 ve keyf\u00eeli\u011fi \u00f6nlemek ad\u0131na elzem oldu\u011funu tekrar vurgulamak gerekir (bkz. \u00a7\u00a7 31, 36, 39).<\/p>\n<p>42. A\u00e7\u0131klanan gerek\u00e7elerle \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ihlal edildi\u011fine karar verilmesi gerekir.<\/p>\n<p>VI. G\u0130DER\u0130M<\/p>\n<p>43. Ba\u015fvurucu; ihlalin tespitine, yeniden yarg\u0131lama yap\u0131lmas\u0131na ve 100.000 TL manevi tazminata karar verilmesini talep etmi\u015ftir.<\/p>\n<p>44. Ba\u015fvuruda tespit edilen hak ihlalinin sonu\u00e7lar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131 i\u00e7in yeniden yarg\u0131lama yap\u0131lmas\u0131nda hukuki yarar bulunmaktad\u0131r. Bu kapsamda karar\u0131n g\u00f6nderildi\u011fiyarg\u0131 mercilerince yap\u0131lmas\u0131 gereken i\u015f, yeniden yarg\u0131lama i\u015flemlerini ba\u015flatmak ve Anayasa Mahkemesini ihlal sonucuna ula\u015ft\u0131ran nedenleri gideren, ihlal karar\u0131nda belirtilen ilkelere uygun yeni bir karar vermektir (30\/3\/2011 tarihli ve 6216 say\u0131l\u0131 Anayasa Mahkemesinin Kurulu\u015fu ve Yarg\u0131lama Usulleri Hakk\u0131nda Kanun&#8217;un 50. maddesinin (2) numaral\u0131 f\u0131kras\u0131nda d\u00fczenlenen bireysel ba\u015fvuruya \u00f6zg\u00fc yeniden yarg\u0131lama kurumunun \u00f6zelliklerine ili\u015fkin kapsaml\u0131 a\u00e7\u0131klamalar i\u00e7in bkz. H\u00dcK\u00dcM<\/p>\n<p>A\u00e7\u0131klanan gerek\u00e7elerle;<\/p>\n<p>A.
