Ba\u015fvuru, ta\u015f\u0131nmazlar\u0131n I. derece arkeolojik sit alan\u0131 olarak tesciline ili\u015fkin karar\u0131n iptal edilmesi nedeniyle \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ihlal edildi\u011fi iddias\u0131na ili\u015fkindir.<\/p>\n<p>II. BA\u015eVURU S\u00dcREC\u0130<\/p>\n<p>2. Ba\u015fvuru 27\/1\/2021 tarihinde yap\u0131lm\u0131\u015ft\u0131r. Komisyon, ba\u015fvurunun kabul edilebilirlik incelemesinin B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na karar vermi\u015ftir.<\/p>\n<p>3. Ba\u015fvuru belgelerinin bir \u00f6rne\u011fi bilgi i\u00e7in Adalet Bakanl\u0131\u011f\u0131na (Bakanl\u0131k) g\u00f6nderilmi\u015ftir. Bakanl\u0131k, g\u00f6r\u00fc\u015f\u00fcn\u00fc bildirmi\u015ftir. Ba\u015fvurucu, Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 beyanda bulunmam\u0131\u015ft\u0131r.<\/p>\n<p>III. OLAY VE OLGULAR<\/p>\n<p>4. Ba\u015fvuru formu ve eklerinde ifade edildi\u011fi \u015fekliyle ve Ulusal Yarg\u0131 A\u011f\u0131 Bili\u015fim Sistemi (UYAP) arac\u0131l\u0131\u011f\u0131yla eri\u015filen bilgi ve belgeler \u00e7er\u00e7evesinde olaylar \u015f\u00f6yledir:<\/p>\n<p>5. Ordu ili, Fatsa il\u00e7esi, Bah\u00e7eler K\u00f6y\u00fc, Kayatepe mevkiinde bulunan 1773 ve 1829 parsel say\u0131l\u0131 ta\u015f\u0131nmazlar\u0131n I. derece arkeolojik sit alan\u0131 olarak tesciline ili\u015fkin 22\/11\/2012 tarihli Samsun K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma B\u00f6lge Kurulu (Kurul) karar\u0131, A. Madencilik isimli \u015firket (\u015eirket) taraf\u0131ndan dava konusu edilmi\u015ftir.<\/p>\n<p>6. \u015eirket; dava dilek\u00e7esinde an\u0131lan ta\u015f\u0131nmazlar\u0131n ruhsat sahibi oldu\u011fu yere denk geldi\u011fini, sahan\u0131n arkeolojik sit \u00f6zelli\u011fi ta\u015f\u0131mad\u0131\u011f\u0131n\u0131 ve tescilini gerektirecek bilimsel gerekliliklerin ger\u00e7ekle\u015fmedi\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr. An\u0131lan davada K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131 (\u0130dare) daval\u0131 olarak yer almakta iken ba\u015fvurucunun da aralar\u0131nda bulundu\u011fu baz\u0131 ki\u015filer \u0130dare yan\u0131nda davaya m\u00fcdahil olarak kat\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>7. Ordu \u0130dare Mahkemesi (\u0130dare Mahkemesi) 20\/11\/2013 tarihli ara karar\u0131yla an\u0131lan ta\u015f\u0131nmazlar\u0131n \u00e7evresiyle bir b\u00fct\u00fcn olarak ele al\u0131narak incelenmesi suretiyle I. derece arkeolojik sit alan\u0131 \u00f6zelliklerini ta\u015f\u0131y\u0131p ta\u015f\u0131mad\u0131\u011f\u0131n\u0131n, bu kapsamdan \u00e7\u0131kar\u0131lmas\u0131 h\u00e2linde \u00e7evresinin ne \u015fekilde etkilenece\u011finin belirlenebilmesi amac\u0131yla mahallinde ke\u015fif ve bilirki\u015fi incelemesi yapt\u0131r\u0131lmas\u0131na karar vermi\u015ftir. Haz\u0131rlanan bilirki\u015fi raporu; s\u00f6z konusu ta\u015f\u0131nmazlar \u00fczerinde korunmas\u0131 gereken ta\u015f\u0131nmaz k\u00fclt\u00fcr varl\u0131\u011f\u0131na rastlanmazken hafriyat ve yol a\u00e7ma amac\u0131yla a\u00e7\u0131lm\u0131\u015f alanlarda erken tun\u00e7 \u00e7a\u011fa ait \u00e7ok say\u0131da seramik par\u00e7alar\u0131na rastland\u0131\u011f\u0131n\u0131, bulgu ve de\u011ferlendirmeler \u0131\u015f\u0131\u011f\u0131nda an\u0131lan ta\u015f\u0131nmazlar kapsam\u0131ndaki Kale Tepe&#8217;nin prehistorik bir h\u00f6y\u00fck oldu\u011funu ifade ederek dava konusu i\u015flemin hakl\u0131 ve kamu yarar\u0131na uygun oldu\u011fu y\u00f6n\u00fcnde g\u00f6r\u00fc\u015f ve kanaat bildirmi\u015ftir.<\/p>\n<p>8. \u0130dare Mahkemesince 26\/12\/2014 tarihinde davan\u0131n reddine karar verilmi\u015ftir. Kararda, bilirki\u015fi raporundaki tespitlere de\u011finilmi\u015ftir. Bununla birlikte hafriyat yap\u0131lan alanlarda tarih \u00f6ncesi d\u00f6neme ait yo\u011fun seramik par\u00e7alara rastlan\u0131lmas\u0131 ile bu alanlar\u0131n topo\u011frafik konumu itibar\u0131yla b\u00f6lgedeki h\u00f6y\u00fck tipi prehistorik yerle\u015fmelere uygunluk g\u00f6stermesi hususuna vurgu yap\u0131larak 1773 ve 1829 parsel say\u0131l\u0131 ta\u015f\u0131nmazlar\u0131n I. derece arkeolojik sit alan\u0131 olarak tesciline ili\u015fkin dava konusu i\u015flemin hukuka ayk\u0131r\u0131l\u0131k ta\u015f\u0131mad\u0131\u011f\u0131 sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>9. \u015eirket taraf\u0131ndan bu karara kar\u015f\u0131 temyiz ba\u015fvurusunda bulunulmu\u015ftur. Dan\u0131\u015ftay Ond\u00f6rd\u00fcnc\u00fc Dairesince (Daire) 28\/1\/2016 tarihinde \u0130dare Mahkemesi karar\u0131n\u0131n bozulmas\u0131na karar verilmi\u015ftir. Kararda \u015eirketin maden i\u015fletme ruhsat\u0131na sahip oldu\u011fu belirtilerek bahse konu 1773 ve 1829 parselleri de kapsayan saha i\u00e7in yap\u0131lan \u00c7evresel Etki De\u011ferlendirmesi (\u00c7ED) ba\u015fvurusu \u00fczerine haz\u0131rlanan 12\/10\/2012 tarihli rapora de\u011finilmi\u015ftir. Arkeolog, mimar ve harita m\u00fchendisi olan \u00fc\u00e7 ki\u015fi taraf\u0131ndan haz\u0131rlanan raporda yer alan, maden \u00f6l\u00e7\u00fcmleri i\u00e7in hafredilmi\u015f olan kesitlerde ge\u00e7 d\u00f6nem seramik par\u00e7alar\u0131n yayg\u0131n olarak g\u00f6zlendi\u011fine, maden arama kapsam\u0131nda yap\u0131lan sondajlar\u0131n alanda k\u0131smen tahribata yol a\u00e7makla birlikte s\u0131k orman \u00f6rt\u00fcs\u00fc nedeniyle y\u00fczeyde k\u00fclt\u00fcr varl\u0131\u011f\u0131 tespiti yap\u0131lamad\u0131\u011f\u0131na ili\u015fkin tespit hat\u0131rlat\u0131lm\u0131\u015ft\u0131r. Bunun yan\u0131nda alandaki k\u00fclt\u00fcr varl\u0131\u011f\u0131 izlerinin de bu kesitler sayesinde g\u00f6r\u00fclebildi\u011fi vurgusuyla birlikte seramik bulgular\u0131n varl\u0131\u011f\u0131 ve kesitlerdeki da\u011f\u0131l\u0131m\u0131 \u0131\u015f\u0131\u011f\u0131nda bu alanda Ge\u00e7 Roma d\u00f6nemine ait oldu\u011fu de\u011ferlendirilen k\u00fc\u00e7\u00fck bir antik yerle\u015fimin bulundu\u011funun anla\u015f\u0131ld\u0131\u011f\u0131 \u015feklindeki tespitlerden hareketle dava konusu i\u015flemin tesis edildi\u011fi belirtilmi\u015ftir. Somut uyu\u015fmazl\u0131kta da tescil karar\u0131na esas al\u0131nan 12\/10\/2012 tarihli raporda, maden \u00f6l\u00e7\u00fcmleri i\u00e7in hafredilmi\u015f olan kesitlerden yararlan\u0131ld\u0131\u011f\u0131 ve s\u0131k orman \u00f6rt\u00fcs\u00fc nedeniyle y\u00fczeyde k\u00fclt\u00fcr varl\u0131\u011f\u0131 tespiti yap\u0131lamad\u0131\u011f\u0131ndan alandaki k\u00fclt\u00fcr varl\u0131\u011f\u0131 izlerinin de bu kesitler sayesinde g\u00f6r\u00fclebildi\u011finin belirtildi\u011fi g\u00f6z\u00f6n\u00fcnde bulunduruldu\u011funda sit s\u0131n\u0131rlar\u0131n\u0131n yeterli ve detayl\u0131 bir topo\u011frafik inceleme yap\u0131lmadan belirlenmesi suretiyle tesis edildi\u011fi sonucuna var\u0131lm\u0131\u015ft\u0131r. Bu nedenle dava konusu i\u015flemde hukuka uyarl\u0131k bulunmad\u0131\u011f\u0131 anla\u015f\u0131ld\u0131\u011f\u0131ndan davan\u0131n reddine ili\u015fkin \u0130dare Mahkemesi karar\u0131nda hukuki isabet g\u00f6r\u00fclmemi\u015ftir. Bu karara kar\u015f\u0131 yap\u0131lan karar d\u00fczeltme ba\u015fvurusu, Dairenin 17\/10\/2017 tarihli karar\u0131yla reddedilmi\u015ftir.<\/p>\n<p>10. \u0130dare Mahkemesi 27\/12\/2017 tarihinde Dairenin bozma karar\u0131na uyarak dava konusu i\u015flemin iptaline karar vermi\u015ftir. Karar\u0131n gerek\u00e7esinde; dava konusu ta\u015f\u0131nmazlar \u00fczerinde yer alan antik yerle\u015fim yerinin I. derece arkeolojik sit alan\u0131 olarak tesciline ili\u015fkin davac\u0131 \u015eirketin s\u00f6z konusu sahay\u0131 da kapsayan maden i\u015fletme ruhsat\u0131na sahip oldu\u011fu, bu nedenle sit s\u0131n\u0131rlar\u0131n\u0131n somut ve net olarak tespit edilmesinin \u00f6nem arz etti\u011fi belirtilmi\u015ftir. Bu tespit yap\u0131l\u0131rken y\u00fczeysel kal\u0131nt\u0131lar\u0131n varl\u0131\u011f\u0131 ile iktifa edilmesi yeterli olamayaca\u011f\u0131ndan ilgili mevzuat uyar\u0131nca topo\u011frafik yap\u0131 y\u00f6n\u00fcnden detayl\u0131 bir inceleme, sondaj ve benzeri \u00e7al\u0131\u015fmalar da yap\u0131lmak suretiyle sit s\u0131n\u0131rlar\u0131n\u0131n bunun sonucuna g\u00f6re tespit ve tescil edilmesinin gerekti\u011fi sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>11. Bu karara kar\u015f\u0131 \u0130dare ve ba\u015fvurucunun da i\u00e7inde bulundu\u011fu m\u00fcdahil ki\u015filer taraf\u0131ndan yap\u0131lan temyiz ba\u015fvurusu Dan\u0131\u015ftay Alt\u0131nc\u0131 Dairesi taraf\u0131ndan 3\/11\/2020 tarihinde, \u0130dare Mahkemesi karar\u0131n\u0131n hukuka ve usule uygun oldu\u011fu ve bozulmas\u0131n\u0131 gerektirecek bir sebep bulunmad\u0131\u011f\u0131 gerek\u00e7esiyle reddedilmi\u015ftir. Bu karara kar\u015f\u0131 karar d\u00fczeltme ba\u015fvurusunda bulunulmamas\u0131 nedeniyle an\u0131lan karar 21\/1\/2021 tarihinde kesinle\u015fmi\u015ftir.<\/p>\n<p>12. Nihai karar 28\/12\/2020 tarihinde ba\u015fvurucu taraf\u0131ndan \u00f6\u011frenilmi\u015ftir.<\/p>\n<p>13. Di\u011fer taraftan \u0130dare Mahkemesi ayn\u0131 tarihli (26\/12\/2014) di\u011fer bir karar\u0131nda \u015eirket taraf\u0131ndan an\u0131lan alanda madencilik faaliyetine ba\u015flayabilmek i\u00e7in yap\u0131lan izin ba\u015fvurusunun Kurul taraf\u0131ndan reddine ili\u015fkin i\u015flemi incelemi\u015ftir. Dava konusu edilen bu i\u015flem \u00f6neri sit alan\u0131 s\u0131n\u0131rlar\u0131n\u0131n alt \u00f6l\u00e7ekli kadastral haritalarda belirlenmesine y\u00f6nelik \u00e7al\u0131\u015fmalar\u0131n Kurula sunulmas\u0131ndan sonra konunun de\u011ferlendirilece\u011fi belirtilerek bu s\u00fcre\u00e7 i\u00e7inde s\u00f6z konusu alana herhangi bir m\u00fcdahalede bulunulmamas\u0131na y\u00f6neliktir. \u0130dare Mahkemesi bu i\u015fleme ili\u015fkin yapt\u0131\u011f\u0131 yarg\u0131lamada hafriyat yap\u0131lan alanlarda tarih \u00f6ncesi d\u00f6neme ait yo\u011fun seramik par\u00e7alara rastlan\u0131lmas\u0131 ile topo\u011frafik konumu itibar\u0131yla b\u00f6lgedeki h\u00f6y\u00fck tipi prehistorik yerle\u015fmelere uygunluk g\u00f6steren 1773 ve 1829 parsellerde \u00f6nemli bir arkeolojik sit potansiyeli bulunmas\u0131na vurgu yapm\u0131\u015ft\u0131r. Netice itibar\u0131yla \u00f6neri sit alan\u0131 s\u0131n\u0131rlar\u0131n\u0131n alt \u00f6l\u00e7ekli kadastral haritalarda belirlenmesine y\u00f6nelik \u00e7al\u0131\u015fmalar\u0131n Kurula sunulmas\u0131ndan sonra konunun de\u011ferlendirilebilece\u011fine ve bu s\u00fcre\u00e7 i\u00e7inde s\u00f6z konusu alana herhangi bir m\u00fcdahalede bulunulmamas\u0131na y\u00f6nelik dava konusu i\u015flemin hukuka ayk\u0131r\u0131l\u0131k ta\u015f\u0131mad\u0131\u011f\u0131 sonucuna var\u0131lm\u0131\u015ft\u0131r. Yine bu karara kar\u015f\u0131 yap\u0131lan temyiz ba\u015fvurusu Dairenin 28\/1\/2016, karar d\u00fczeltme ba\u015fvurusu 17\/10\/2017 tarihli kararlar\u0131yla reddedilmi\u015ftir.<\/p>\n<p>14. \u00d6te yandan bahse konu alanda \u015eirket taraf\u0131ndan yap\u0131lmas\u0131 planlanan alt\u0131n madeni projesi ile ilgili olarak verilen \u00c7ED olumlu karar\u0131 daha \u00f6nce dava konusu edilmi\u015f, \u0130dare Mahkemesince 11\/11\/2015 tarihinde davan\u0131n reddine karar verilmi\u015ftir. Karar\u0131n gerek\u00e7esinde; bilirki\u015fi raporundaki tespitlere de de\u011finilerek alt\u0131n madeni projesinin \u00e7evreye olabilecek olumsuz etkilerinin kapsaml\u0131 bir \u015fekilde incelendi\u011fi, bu etkilerin giderilmesi i\u00e7in gerekli ve yeterli \u00f6nlemlerin al\u0131nd\u0131\u011f\u0131 belirtilmi\u015ftir. S\u00f6z konusu alt\u0131n madeni in\u015fas\u0131n\u0131n ve tamamland\u0131ktan sonra da i\u015fletilmesinin \u00e7evre \u00fczerindeki olumsuz etkilerinin \u00c7ED raporunda al\u0131nmas\u0131 \u00f6ng\u00f6r\u00fclen \u00f6nlemlerle birlikte ilgili mevzuat ve bilimsel esaslara g\u00f6re kabul edilebilir d\u00fczeyde oldu\u011fu sonucuna var\u0131larak dava konusu \u00c7ED olumlu karar\u0131n\u0131n hukuka uygun oldu\u011fu ifade edilmi\u015ftir. Bu karara kar\u015f\u0131 yap\u0131lan temyiz ba\u015fvurusu ise Dairenin 14\/12\/2016 tarihli karar\u0131yla dava ehliyeti olan davac\u0131lar y\u00f6n\u00fcnden reddedilerek \u0130dare Mahkemesi karar\u0131n\u0131n onanmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>15. Bu yarg\u0131lama sonucunda ba\u015fvurucular \u00c7ED olumlu karar\u0131 nedeniyle konut dokunulmazl\u0131\u011f\u0131 ile \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ihlal edildi\u011finden bahisle bireysel ba\u015fvuruda bulunmu\u015ftur. Anayasa Mahkemesi; Ali G\u00fcney ve di\u011ferleri karar\u0131nda (B. No: 2017\/24659, 16\/11\/2021) kamusal makamlar\u0131n olaya gereken \u00f6zenle yakla\u015fmad\u0131klar\u0131n\u0131n, olayda s\u00f6z konusu olan kamusal ve bireysel menfaatleri gerekti\u011fi \u015fekilde de\u011ferlendirmediklerinin ve kamusal makamlar\u0131n pozitif y\u00fck\u00fcml\u00fcl\u00fcklerini yerine getirmedi\u011finin s\u00f6ylenemeyece\u011fi gerek\u00e7esiyle an\u0131lan haklar\u0131n ihlal edilmedi\u011fi sonucuna varm\u0131\u015ft\u0131r.<\/p>\n<p>16. Di\u011fer taraftan 1773 ve 1829 parsel say\u0131l\u0131 ta\u015f\u0131nmazlar\u0131n I. derece arkeolojik sit alan\u0131 olarak tesciline ili\u015fkin 22\/11\/2012 tarihli karar\u0131n iptali sonras\u0131nda (bkz. \u00a7 10), \u0130dare Mahkemesinin karar\u0131nda belirtilen alanda topo\u011frafik yap\u0131 y\u00f6n\u00fcnden detayl\u0131 bir inceleme, sondaj ve benzeri \u00e7al\u0131\u015fmalar da yap\u0131lmak suretiyle, sit s\u0131n\u0131rlar\u0131n\u0131n bunun sonucuna g\u00f6re tespit ve tescil edilmesinin gerekti\u011fine y\u00f6nelik gerek\u00e7eden hareketle sondaj kaz\u0131s\u0131 yap\u0131lm\u0131\u015ft\u0131r. Bundan sonra Kurul 26\/7\/2018 tarihinde an\u0131lan parsellerin sit d\u0131\u015f\u0131 kalmas\u0131na karar vermi\u015ftir. An\u0131lan kararda bahse konu alanda seramik gibi k\u00fc\u00e7\u00fck buluntular elde edilmi\u015f olmakla birlikte bu alan\u0131n bir yerle\u015fim yeri oldu\u011funa y\u00f6nelik kesin veri olabilecek herhangi bir mimari kal\u0131nt\u0131ya rastlanmad\u0131\u011f\u0131, k\u00fc\u00e7\u00fck buluntular\u0131n da olduk\u00e7a d\u00fc\u015f\u00fck yo\u011funlukta oldu\u011fu belirtilmi\u015ftir. Anayasa Mahkemesi, olaylar\u0131n ba\u015fvurucu taraf\u0131ndan yap\u0131lan hukuki nitelendirmesi ile ba\u011fl\u0131 olmay\u0131p olay ve olgular\u0131n hukuki tavsifini kendisi takdir eder. Ba\u015fvurucunun ihlal iddialar\u0131n\u0131n mahiyeti gere\u011fi \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda incelenmesi uygun g\u00f6r\u00fclm\u00fc\u015ft\u00fcr (benzer y\u00f6ndeki de\u011ferlendirmeler i\u00e7in bkz. Binali \u00d6zkaradeniz ve di\u011ferleri, \u00a7 46; Ahmet Bilgin ve di\u011ferleri, \u00a7 51).<\/p>\n<p>1. Kabul Edilebilirlik Y\u00f6n\u00fcnden<\/p>\n<p>28. Ba\u015fvurucunun bu ba\u011flamdaki iddialar\u0131 g\u00f6z\u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda \u00f6zel hayata sayg\u0131 hakk\u0131 y\u00f6n\u00fcnden inceleme i\u00e7in gerekli olan ba\u011f\u0131n ortaya konuldu\u011fu g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Dolay\u0131s\u0131yla bahse konu ta\u015f\u0131nmazlar\u0131n I. derece arkeolojik sit alan\u0131 olarak tesciline ili\u015fkin karar\u0131n iptal edilmesiyle ortaya \u00e7\u0131kan ba\u015fvurucunun \u00f6zel hayata sayg\u0131 hakk\u0131na y\u00f6nelik etkinin Anayasa\u2019n\u0131n 20. maddesi kapsam\u0131nda de\u011ferlendirilmesi gerekir.<\/p>\n<p>30. A\u00e7\u0131k\u00e7a dayanaktan yoksun olmad\u0131\u011f\u0131 ve kabul edilemezli\u011fine karar verilmesini gerektirecek ba\u015fka bir neden de bulunmad\u0131\u011f\u0131 anla\u015f\u0131ld\u0131\u011f\u0131ndan ba\u015fvurunun kabul edilebilir oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>2. Esas Y\u00f6n\u00fcnden<\/p>\n<p>31. Devletin \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131 etkili olarak koruma ve bu hakka sayg\u0131 g\u00f6sterme \u015feklinde pozitif y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bulunmaktad\u0131r. Pozitif y\u00fck\u00fcml\u00fcl\u00fck ilgililerin \u00e7evresel mesele ile ilgili karar alma s\u00fcrecine kat\u0131l\u0131m\u0131 ile etkili idari ve yarg\u0131sal yollara ba\u015fvuru imk\u00e2n\u0131 tan\u0131nmas\u0131n\u0131 i\u00e7eren usule ili\u015fkin y\u00fck\u00fcml\u00fcl\u00fcklerin yan\u0131 s\u0131ra anayasal haklar\u0131n korunmas\u0131na y\u00f6nelik maddi y\u00fck\u00fcml\u00fcl\u00fckleri ihtiva etmektedir.<\/p>\n<p>a. Genel \u0130lkeler<\/p>\n<p>32. Bu t\u00fcr ba\u015fvurularda devletin negatif veya pozitif y\u00fck\u00fcml\u00fcl\u00fcklerinin birbirinden ayr\u0131labilmesi ise olduk\u00e7a g\u00fc\u00e7t\u00fcr. Kald\u0131 ki s\u00f6z konusu ba\u015fvurularda devletin negatif ve pozitif y\u00fck\u00fcml\u00fcl\u00fckleri y\u00f6n\u00fcnden uygulanacak ilkeler \u00e7o\u011funlukla ayn\u0131d\u0131r (benzer y\u00f6ndeki karar i\u00e7in bkz. H\u00fcseyin Tun\u00e7 Karl\u0131k ve Zahide \u015eadan Karluk, \u00a7 59; Binali \u00d6zkaradeniz ve di\u011ferleri, \u00a7 54).<\/p>\n<p>33. \u00c7evresel meseleler ba\u011flam\u0131nda devletin usule ili\u015fkin y\u00fck\u00fcml\u00fcl\u00fckleri daha \u00f6nce Anayasa Mahkemesinin \u00e7e\u015fitli kararlar\u0131nda ortaya konulmu\u015ftur. Buna g\u00f6re muhtemel olumsuz \u00e7evresel etkilerin \u00f6nlenmesi veya en aza indirilmesi amac\u0131n\u0131n ger\u00e7ekle\u015ftirilebilmesi i\u00e7in s\u00fcrece d\u00e2hil olan s\u00f6z konusu taraflar\u0131n menfaatlerinin titizlikle de\u011ferlendirilmesi, bu de\u011ferlendirmenin sa\u011fl\u0131kl\u0131 \u015fekilde yap\u0131labilmesi i\u00e7in de ilgili taraflar\u0131n s\u00fcrece etkin kat\u0131l\u0131m\u0131n\u0131n sa\u011flanmas\u0131 gerekti\u011fi tart\u0131\u015fmas\u0131zd\u0131r (Mehmet Kurt, \u00a7\u00a7 61-66; H\u00fcseyin Tun\u00e7 Karl\u0131k ve Zahide \u015eadan Karluk, \u00a7\u00a7 64, 65; Ahmet \u0130smail Onat, \u00a7\u00a7 79-81; Ahmet Bilgin ve di\u011ferleri, \u00a7 56).<\/p>\n<p>34. Anayasa&#8217;n\u0131n 48. maddesi gere\u011fince \u00f6zel te\u015febb\u00fcslerin mill\u00ee ekonominin gereklerine uygun y\u00fcr\u00fcmesinin sa\u011flanmas\u0131 konusunda devlete d\u00fc\u015fen baz\u0131 y\u00fck\u00fcml\u00fcl\u00fckler vard\u0131r (Ahmet \u0130smail Onat, \u00a7 99). Ayr\u0131ca devletin Anayasa&#8217;n\u0131n 20. maddesi kapsam\u0131nda koruyucu bir mevzuat olu\u015fturma \u00f6devi yan\u0131nda denetleme yapma ve koruyucu fiil\u00ee tedbir ve faaliyetlerde bulunma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc de bulunmakta olup bu kapsamda devletin gereken tedbirleri almas\u0131 gerekir. Bununla birlikte hangi tedbirlerin al\u0131nmas\u0131 gerekti\u011fi ve bu tedbirlerin nas\u0131l uygulanaca\u011f\u0131 hususlar\u0131nda kamu otoritelerinin geni\u015f bir takdir yetkisi mevcuttur (Binali \u00d6zkaradeniz ve di\u011ferleri, \u00a7 57).<\/p>\n<p>35. Bu ba\u011flamda s\u00f6z konusu \u00e7evresel etki kapsam\u0131nda kar\u015f\u0131 kar\u015f\u0131ya gelen menfaatler aras\u0131nda adil bir dengenin tesis edilip edilmedi\u011finin tespit edilmesi gerekir. Bu alanda kamusal makamlar\u0131n sahip oldu\u011fu geni\u015f takdir yetkisi dikkate al\u0131nd\u0131\u011f\u0131nda \u00e7evresel meseleler ba\u011flam\u0131nda Anayasa Mahkemesinin g\u00f6revi, s\u00f6z konusu \u00e7evresel rahats\u0131zl\u0131\u011f\u0131n nas\u0131l sonland\u0131r\u0131laca\u011f\u0131 veya etkilerinin nas\u0131l azalt\u0131laca\u011f\u0131n\u0131n bizzat belirlenmesi de\u011fildir. Karma\u015f\u0131k \u00e7evresel sorunlar\u0131n ele al\u0131n\u0131p \u00e7\u00f6z\u00fcmlenmesi a\u015famas\u0131nda karar s\u00fcreci, \u00e7evreye ve ki\u015fi haklar\u0131na zarar verebilecek faaliyetlerin etkilerini \u00f6nceden de\u011ferlendirecek ve \u00f6nleyecek \u015fekilde tesis edilmelidir. B\u00f6ylece bireysel ve kamusal menfaatler aras\u0131nda adil bir denge tesis edilerek kar\u015f\u0131t g\u00f6r\u00fc\u015flerin dile getirilmesine olanak tan\u0131yacak gerekli et\u00fct ve de\u011ferlendirmelerin ger\u00e7ekle\u015ftirilmesi sa\u011flanacakt\u0131r. Bu ba\u011flamda s\u00f6z konusu s\u00fcrece ili\u015fkin bilgilere eri\u015fim ve karar alma s\u00fcrecine aktif kat\u0131l\u0131m\u0131n yan\u0131 s\u0131ra karardan etkilenebilecek olan bireylerin karar alma s\u00fcrecinde g\u00f6r\u00fc\u015f ve menfaatlerinin yeterince dikkate al\u0131nmad\u0131\u011f\u0131n\u0131 dile getirebilmek i\u00e7in konuyla ilgili her t\u00fcrl\u00fc tasarrufa kar\u015f\u0131 yarg\u0131sal ba\u015fvuru hakk\u0131na sahip olmalar\u0131 ve iddialar\u0131n\u0131n yarg\u0131sal makamlarca \u00f6zenli bir \u015fekilde de\u011ferlendirilmesi son derece \u00f6nemlidir (H\u00fcseyin Tun\u00e7 Karl\u0131k ve Zahide \u015eadan Karluk, \u00a7 75; Ahmet \u0130smail Onat, \u00a7 94;Ahmet Bilgin ve di\u011ferleri, \u00a7 62). Bu anlamda an\u0131lan anayasal g\u00fcvenceleri g\u00f6zeten bir yarg\u0131lama s\u00fcreci y\u00fcr\u00fct\u00fclmesi ve neticede ula\u015f\u0131lan sonucun konuyla ilgili ve yeterli gerek\u00e7elerle a\u00e7\u0131klanmas\u0131 gerekir.<\/p>\n<p>b. \u0130lkelerin Olaya Uygulanmas\u0131<\/p>\n<p>37. Eski uygarl\u0131klar\u0131n yer alt\u0131nda, yer \u00fcst\u00fcnde ve su alt\u0131ndaki \u00fcr\u00fcnlerini, ya\u015fad\u0131klar\u0131 devirlerin sosyal, ekonomik ve k\u00fclt\u00fcrel \u00f6zelliklerini yans\u0131tan her t\u00fcrl\u00fc k\u00fclt\u00fcr varl\u0131\u011f\u0131n\u0131n bulundu\u011fu yerler olarak tan\u0131mlanan arkeolojik sit alanlar\u0131n\u0131n tespitinde yaz\u0131l\u0131 bilgilere, sathi kal\u0131nt\u0131lara veya bilimsel ara\u015ft\u0131rmalara dayan\u0131lmas\u0131; \u00e7evresel g\u00f6zlemler ile bilimsel varsay\u0131mlar veya topo\u011frafik a\u00e7\u0131lardan yeterli niteliklere sahip olmas\u0131 hususlar\u0131n\u0131n dikkate al\u0131naca\u011f\u0131 d\u00fczenlenmi\u015ftir (bkz. \u00a7\u00a7 18, 19).<\/p>\n<p>38. Somut ba\u015fvuruda I. derece arkeolojik sit alan\u0131 olarak tescil edilmi\u015f olan 1773 ve 1829 parsel say\u0131l\u0131 ta\u015f\u0131nmazlar\u0131n bu niteli\u011finin iptali talebiyle a\u00e7\u0131lan dava \u0130dare Mahkemesince ilk olarak reddedilmi\u015ftir. Temyiz ba\u015fvurusu sonucunda ise Daire 28\/1\/2016 tarihinde sit s\u0131n\u0131rlar\u0131n\u0131n yeterli ve detayl\u0131 bir topo\u011frafik inceleme yap\u0131lmadan belirlenmesi suretiyle tesis edildi\u011fi gerek\u00e7esiyle \u0130dare Mahkemesi karar\u0131n\u0131n bozulmas\u0131na karar vermi\u015ftir. \u0130dare Mahkemesi taraf\u0131ndan da bu karara uyularak bahse konu i\u015flemin iptaline karar verilmi\u015ftir. Nitekim yarg\u0131sal makamlar\u0131n iptal gerek\u00e7elerinden hareketle \u0130darenin gerekli ara\u015ft\u0131rmalar\u0131 ve sondaj kaz\u0131s\u0131n\u0131 yapmak suretiyle son tahlilde bahse konu alan\u0131n arkeolojik sit alan\u0131 olarak tescile de\u011fer potansiyelde olmad\u0131\u011f\u0131 sonucuna vard\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.<\/p>\n<p>39. Bu ba\u011flamda yarg\u0131sal makamlar arkeolojik sit alan\u0131 tespiti konusundaki uyu\u015fmazl\u0131\u011f\u0131 incelerken i\u015flemin iptaline ili\u015fkin nihai karar\u0131n\u0131 bu alanla ilgili topo\u011frafik incelemenin yetersizli\u011fine dayand\u0131rm\u0131\u015ft\u0131r. Nitekim \u0130darenin yarg\u0131sal safahat sonucunda bu eksikli\u011fi ikmal etmek amac\u0131yla yapm\u0131\u015f oldu\u011fu sondaj \u00e7al\u0131\u015fmas\u0131 ve incelemelerle bahse konu alan\u0131n bir yerle\u015fim yeri oldu\u011funa y\u00f6nelik kesin veri olabilecek herhangi bir mimari kal\u0131nt\u0131ya rastlanmad\u0131\u011f\u0131n\u0131, k\u00fc\u00e7\u00fck buluntular\u0131n da olduk\u00e7a d\u00fc\u015f\u00fck yo\u011funlukta oldu\u011funu belirtti\u011fi vurgulanmal\u0131d\u0131r.<\/p>\n<p>40. \u00c7evresel karar alma s\u00fcre\u00e7lerinin karma\u015f\u0131k yap\u0131s\u0131 nedeniyle kamusal makamlar\u0131n geni\u015f bir takdir yetkisi oldu\u011fu a\u00e7\u0131kt\u0131r. Bu ba\u011flamda \u00e7evresel bir meseleyle ilgili kamusal makamlarca verilen karar\u0131n yerindeli\u011finin denetlenmesi Anayasa Mahkemesinin g\u00f6revi de\u011fildir. Bununla birlikte s\u00fcre\u00e7te, bireyin temel haklar\u0131 ile s\u00f6z konusu kamusal menfaat aras\u0131nda gerekli dengenin tesisine hizmet edecek g\u00fcvencelerin yer al\u0131p almad\u0131\u011f\u0131n\u0131n tespiti \u00f6nemli olup belirtilen y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn yerine getirilip getirilmedi\u011finin tespitinde ise \u00e7evresel meseleler ba\u011flam\u0131nda s\u00f6z konusu olan usul g\u00fcvencelerinin g\u00f6zetilip g\u00f6zetilmedi\u011fi belirlenmelidir (Mehmet Kurt, \u00a7 75; Yasemin Pelenk ve di\u011ferleri, \u00a7 64).<\/p>\n<p>41. Ba\u015fvurucu, yarg\u0131sal makamlar\u0131n kararlar\u0131n\u0131n yetersiz ve hatal\u0131 gerek\u00e7eye dayand\u0131\u011f\u0131n\u0131 ve bozma karar\u0131 sonras\u0131nda yeni bir bilirki\u015fi raporu al\u0131nmaks\u0131z\u0131n dava konusu i\u015flemin iptaline karar verildi\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr. Buna kar\u015f\u0131n Dairenin bozma karar\u0131nda ve bu karara uyan \u0130dare Mahkemesinin karar\u0131nda daha \u00f6nce \u00c7ED ba\u015fvurusu \u00fczerine haz\u0131rlanan 12\/10\/2012 tarihli rapora dayan\u0131larak sit s\u0131n\u0131rlar\u0131n\u0131n yeterli ve detayl\u0131 bir topo\u011frafik inceleme yap\u0131lmadan belirlendi\u011fi sonucuna ula\u015f\u0131ld\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r (ayr\u0131ca \u00c7ED olumlu karar\u0131 ile ilgili yarg\u0131lamaya ili\u015fkin bilgiler i\u00e7in bkz. \u00a7\u00a7 14, 15).<\/p>\n<p>42. Yine ba\u015fvurucunun \u0130dare Mahkemesinin ayn\u0131 tarihli iki karar\u0131 aras\u0131nda \u00e7eli\u015fki oldu\u011funa y\u00f6nelik iddias\u0131na kar\u015f\u0131n bahsedilen di\u011fer uyu\u015fmazl\u0131\u011f\u0131n, sit alan\u0131 s\u0131n\u0131rlar\u0131n\u0131n alt \u00f6l\u00e7ekli kadastral haritalarda belirlenmesine y\u00f6nelik \u00e7al\u0131\u015fmalar\u0131n Kurula sunulmas\u0131ndan sonra konunun de\u011ferlendirilece\u011finden bahisle s\u00f6z konusu alana herhangi bir m\u00fcdahalede bulunulmamas\u0131na ili\u015fkin oldu\u011fu belirtilmelidir. Bu i\u015fleme ili\u015fkin yarg\u0131sal incelemede 1773 ve 1829 parsel say\u0131l\u0131 ta\u015f\u0131nmazlarda \u00f6nemli bir arkeolojik sit potansiyeli bulundu\u011fu ifade edilmi\u015f, an\u0131lan parsellerin bu potansiyel niteli\u011fiyle ilgili herhangi bir sonuca var\u0131lmam\u0131\u015ft\u0131r.<\/p>\n<p>43. Sonu\u00e7 olarak ba\u015fvurucunun ve kamunun somut ba\u015fvuru \u00f6zelinde kar\u015f\u0131 kar\u015f\u0131ya gelen menfaatleri aras\u0131nda yarg\u0131sal makamlar taraf\u0131ndan adil bir denge kurulmad\u0131\u011f\u0131 ve takdir hakk\u0131n\u0131n s\u0131n\u0131rlar\u0131n\u0131n a\u015f\u0131ld\u0131\u011f\u0131 sonucuna ula\u015fmak m\u00fcmk\u00fcn de\u011fildir. Bu noktada Anayasa Mahkemesinin kendi takdirini, bilimsel veriler ile bu teknik ve karma\u015f\u0131k alana ili\u015fkin olarak ola\u011fan yarg\u0131 mercilerinin takdiri yerine ikame etmesi d\u00fc\u015f\u00fcn\u00fclemez.<\/p>\n<p>44. Yukar\u0131da yer verilen tespitler \u0131\u015f\u0131\u011f\u0131nda kamusal makamlar\u0131n olaya gereken \u00f6zenle yakla\u015fmad\u0131klar\u0131, olayda s\u00f6z konusu olan kamusal ve bireysel menfaatleri gerekti\u011fi \u015fekilde de\u011ferlendirmedikleri, ba\u015fvurucular\u0131n \u00f6zel hayata sayg\u0131 hakk\u0131 ba\u011flam\u0131nda kamusal makamlar\u0131n pozitif y\u00fck\u00fcml\u00fcl\u00fcklerini yerine getirmedi\u011fi sonucuna var\u0131lmas\u0131 m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p>45.
