TBK.\u2019nun 353. maddesi uyar\u0131nca kiraya veren, daha \u00f6nce veya en ge\u00e7 davan\u0131n a\u00e7\u0131lmas\u0131 i\u00e7in \u00f6ng\u00f6r\u00fclen s\u00fcrede dava a\u00e7aca\u011f\u0131n\u0131 kirac\u0131ya yaz\u0131l\u0131 olarak bildirmi\u015fse dava, bildirimi takip eden uzayan bir kira y\u0131l\u0131 sonuna kadar a\u00e7\u0131labilir. Dava a\u00e7ma s\u00fcresi kamu d\u00fczenine ili\u015fkin olup, daval\u0131 ileri s\u00fcrmese bile mahkemece kendili\u011finden g\u00f6z \u00f6n\u00fcnde bulundurulmas\u0131 gerekir.<\/p>\n<p>Davan\u0131n s\u00fcresinde a\u00e7\u0131l\u0131p a\u00e7\u0131lmad\u0131\u011f\u0131n\u0131n belirlenebilmesi i\u00e7in \u00f6ncelikle kira s\u00f6zle\u015fmesinin ba\u015flang\u0131\u00e7 tarihinin ve s\u00fcresinin bilinmesi zorunludur. Davac\u0131n\u0131n bildirdi\u011fi bu tarihlere daval\u0131 kar\u015f\u0131 \u00e7\u0131karsa uyu\u015fmazl\u0131\u011f\u0131n taraflar\u0131n g\u00f6sterecekleri tan\u0131k dahil b\u00fct\u00fcn deliller toplanarak bir hadise olarak \u00e7\u00f6z\u00fcme kavu\u015fturulmas\u0131 gerekir.<\/p>\n<p>Olay\u0131m\u0131za gelince; davaya dayanak olup h\u00fckme esas al\u0131nan ve taraflar aras\u0131nda bir uyu\u015fmazl\u0131k bulunmayan 15.02.2010 ba\u015flang\u0131\u00e7 tarihli 1 y\u0131l s\u00fcreli kira s\u00f6zle\u015fmesinin \u00f6zel \u015fartlar 8. maddesinde &#8221;kirac\u0131 veya mal sahibi kira s\u00f6zle\u015fmesinin sona erdirilmesi hususundaki irade beyanlar\u0131n\u0131 kontrat s\u00fcresinin bitiminden 2 ay \u00f6nce kar\u015f\u0131 tarafa bildirmek zorundad\u0131r. Aksi takdirde kira s\u00fcresi 1 y\u0131l daha uzam\u0131\u015f say\u0131l\u0131r.&#8221; d\u00fczenlemesi mevcuttur. An\u0131lan s\u00f6zle\u015fme h\u00fckm\u00fc gere\u011fince davac\u0131 taraf\u0131ndan s\u00f6zle\u015fme bitim tarihinden 2 ay \u00f6nce daval\u0131ya g\u00f6nderilen bir ihtar bulunmad\u0131\u011f\u0131ndan kira s\u00f6zle\u015fmesi ayn\u0131 ko\u015fullarla bir y\u0131l uzam\u0131\u015f olup 11.09.2015 tarihinde a\u00e7\u0131lan dava s\u00fcresinde de\u011fildir. Aksi taktirde kira d\u00f6nemi sonuna kadar olan kiray\u0131 \u00f6der. Mal sahibi de kirac\u0131n\u0131n gayrimenkul\u00fc tahliye etmesini istedi\u011finde ayn\u0131 \u015fekilde 2 ay \u00f6ncesinden bildirimde bulunacakt\u0131r.&#8221; d\u00fczenlemesi h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.
