Yarg\u0131tay kararlar\u0131 da bunu a\u00e7\u0131k\u00e7a ortaya koymaktad\u0131r. Bu yaz\u0131da, hangi durumlarda izin gerekmedi\u011fini, hangi tadilatlara y\u00f6netim plan\u0131 ile izin verilip, yasaklanabilece\u011fi ve hangi s\u0131n\u0131rlar i\u00e7inde hareket edilebilece\u011fini \u00f6rnek i\u00e7tihatlarla ele alaca\u011f\u0131z.<\/p>\n<p>\u201cS\u0131rf ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00a0i\u00e7erisinde kalan (su, elektrik, \u0131s\u0131nma gibi ortak tesisler ile kolon, kiri\u015f,\u00a0tavan vb. ortak yerlere m\u00fcdahale niteli\u011fi ta\u015f\u0131mayan) ve yap\u0131n\u0131n stati\u011fine zarar\u00a0vermeyen de\u011fi\u015fiklikler i\u00e7in muvafakat al\u0131nmas\u0131na gerek yoktur.\u201d (Yarg\u0131tay 20. E.\u00a02018\/2913 K. 2019\/2489 T. 09.04.2019)<\/p>\n<p>\u201cBa\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00a0i\u00e7erisinde kalan ve ortak tesis niteli\u011fi kazanamayan kanalizasyon ve su\u00a0tesislerinin o ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm maliki taraf\u0131ndan onar\u0131lmas\u0131 gerekir.\u201d (Yarg\u0131tay\u00a05. HD. 1983\/1646 E., 1983\/1719 K. 28.02.1983)<\/p>\n<p>\u201cBodrum ve zemin katlarda\u00a0bulunan ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin balkonlar\u0131ndaki kap\u0131larla pencerelerin d\u0131\u015f y\u00fczeylerine, di\u011fer daireler i\u00e7in tehlike olu\u015fturmamak ko\u015fuluyla, yatay\u00a0ba\u011flant\u0131s\u0131 ve bombesi olmayan d\u00fcz ve dikey demir parmakl\u0131k tak\u0131lmas\u0131nda\u00a0g\u00fcvenlik a\u00e7\u0131s\u0131ndan zorunluluk bulundu\u011fundan kat maliklerince karar al\u0131nmas\u0131na\u00a0gerek yoktur.\u201d (Yarg\u0131tay HGK 14.01.2015 E.2013\/18-1466 K. 2015\/42)<\/p>\n<p>\u201cOrtak yer ve\u00a0tesislerdeki bozuklu\u011fun ana yap\u0131ya veya ba\u011f\u0131ms\u0131z bir b\u00f6l\u00fcme veya b\u00f6l\u00fcmlere zarar\u00a0verdi\u011finin ve acilen onar\u0131lmas\u0131 gerekti\u011finin mahkemece tespit edilmi\u015f olmas\u0131\u00a0halinde, bu onar\u0131m ve g\u00fc\u00e7lendirmenin projesine ve tekni\u011fine uygun bi\u00e7imde\u00a0yap\u0131lmas\u0131 konusunda kat maliklerinin r\u0131zas\u0131 aranmaz. Dava projede \u00f6ng\u00f6r\u00fclen asans\u00f6r\u00fcn in\u015fas\u0131n\u0131n sa\u011flanmas\u0131na\u00a0y\u00f6nelik oldu\u011fu i\u00e7in Kat M\u00fclkiyeti Kanununun 42. maddesinin \u00f6ng\u00f6rd\u00fc\u011f\u00fc ko\u015fullar\u0131n\u00a0ger\u00e7ekle\u015fmesine gerek yoktur. \u00c7\u00fcnk\u00fc an\u0131lan madde, ana gayrimenkul\u00fcn ortak\u00a0yerlerinde, fakat projede \u00f6ng\u00f6r\u00fclmeyen hususlardaki ek ve ilaveleri\u00a0kapsamaktad\u0131r.\u201d (Yarg\u0131tay 18. HD. 1996\/3352 E. 1996\/3992 K. 16.04.1996)<\/p>\n<p>Y\u00d6NET\u0130M PLANININ TAD\u0130LATLARLA \u0130L\u0130\u015eK\u0130S\u0130<\/p>\n<p>Y\u00f6netim plan\u0131nda yasaklanmayan ve mimari projede de\u011fi\u015fiklik gerektirmeyen tadilatlar izin al\u0131nmadan yap\u0131labilir:<\/p>\n<p>\u201cY\u00f6netim plan\u0131nda yasaklanmayan Bah\u00e7e bitkisi, \u015fim\u015fir a\u011fa\u00e7lar\u0131 ve camlar ile s\u0131n\u0131r uygulanmas\u0131na ili\u015fkin taleplerin, bu hususlar\u0131n mimari projede g\u00f6sterilebilecek hususlardan olmamas\u0131, bu nedenle de mimari projeye ayk\u0131r\u0131l\u0131k te\u015fkil etmemesi nedeniyle as\u0131l dava ve kar\u015f\u0131 dava y\u00f6n\u00fcnden \u015fim\u015fir a\u011fa\u00e7lar\u0131, \u00e7it ve bah\u00e7e bitkisi i\u00e7in a\u00e7\u0131lan davalar\u0131n reddine\u201d\u00a0(Yarg\u0131tay 20. HD., E. 2017\/4855 K. 2017\/8118 T. 23.10.2017)<\/p>\n<p>Y\u00f6netim plan\u0131nda yap\u0131m\u0131na izin verilen, ruhsat gerektirmeyen, mimari projede de\u011fi\u015fiklik gerektirmeyen ve cepheyi de\u011fi\u015ftirmeyen tadilatlar onay al\u0131nmadan yap\u0131labilir:<\/p>\n<p>\u201cPergola, bah\u00e7ede, bina cephelerini de\u011fi\u015ftirmemek kayd\u0131yla terasta, hafif yap\u0131 malzemelerinden dikme ve s\u0131k kiri\u015fleme ile yap\u0131lan ve \u00fczerine ye\u015fil bitki \u00f6rt\u00fcs\u00fc sard\u0131r\u0131lan, etraf\u0131 a\u00e7\u0131k, g\u00f6lgelik ama\u00e7l\u0131, \u00fcst taraf\u0131 ya\u011f\u0131\u015ftan korunma amac\u0131yla kapal\u0131 ve her iki yan\u0131 a\u00e7\u0131k \u015fekilde in\u015fa edilen giri\u015f sa\u00e7a\u011f\u0131n\u0131n &#8220;sabit nitelikte olmad\u0131\u011f\u0131, ta\u015f\u0131y\u0131c\u0131 sistemi etkilemedi\u011fi, yap\u0131n\u0131n br\u00fct alan\u0131n\u0131 artt\u0131rmad\u0131\u011f\u0131 ve kapal\u0131 alan olu\u015fturmad\u0131\u011f\u0131&#8221; (\u0130stanbul B\u0130M, 5. \u0130DD, E. 2017\/2015 K. 2019\/3434 T. 26.11.2019)<\/p>\n<p>Y\u00f6netim plan\u0131 ile ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn kullan\u0131m\u0131na tahsis edilen bir alan ortak alan niteli\u011finde oldu\u011fu i\u00e7in ilave in\u015fa faaliyet kat maliklerinin be\u015fte d\u00f6rd\u00fcn\u00fcn yaz\u0131l\u0131 onay\u0131n\u0131 gerektirir:<\/p>\n<p>\u201cDosya i\u00e7indeki bilgi ve belgelerin ve bilirki\u015fi raporunun incelenmesinde daval\u0131n\u0131n zemin kat dairesinin arka bah\u00e7esinin 15.30 m\u00b2&#8217;lik k\u0131sm\u0131nda tik a\u011fac\u0131ndan platform yapt\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Kat M\u00fclkiyeti Kanununun 19. maddesinin ikinci bendi gere\u011fince kat maliklerinden biri b\u00fct\u00fcn kat maliklerinin be\u015fte d\u00f6rd\u00fcn\u00fcn yaz\u0131l\u0131 r\u0131zas\u0131 olmad\u0131k\u00e7a anata\u015f\u0131nmaz\u0131n ortak yerlerinde in\u015faat, onar\u0131m ve tesisler yapt\u0131ramaz. Ortak yerin kullan\u0131m\u0131n\u0131n y\u00f6netim plan\u0131 veya projesi ile bir veya bir ka\u00e7 kat malikine b\u0131rak\u0131lmas\u0131 m\u00fcmk\u00fcn ise de, bu kullan\u0131m hakk\u0131 o kat malikine ortak yeri oldu\u011fu gibi kullanma hakk\u0131 verece\u011finden bu yerde yeni tesis ve de\u011fi\u015fiklikler yapma hakk\u0131 vermez. Kald\u0131 ki, y\u00f6netim plan\u0131n\u0131n 18. maddesinde kat maliklerinin kullan\u0131m hakk\u0131 m\u00fcnhas\u0131ran kendi ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcne tahsis edilmi\u015f alanlarda mevcut rengi, karakteri g\u00f6r\u00fcn\u00fcm\u00fc de\u011fi\u015ftirecek ve etkileyecek nitelikte tesis yapamayacaklar\u0131 da d\u00fczenlenmi\u015ftir. Buna g\u00f6re mahkemece davan\u0131n kabul\u00fc gerekirken yaz\u0131l gerek\u00e7e ile reddi do\u011fru g\u00f6r\u00fclmemi\u015ftir.\u201d (Yarg\u0131tay 18.
