Davac\u0131 vekili dava dilek\u00e7esinde; &#8230; ili, Merkez il\u00e7esi, Kavgaz Mahallesi 2484 ada 1 parsel say\u0131l\u0131 ta\u015f\u0131nmazda bulunan apartman\u0131n zemin kat\u0131ndaki daval\u0131 &#8230;&#8217;a ait 13 nolu i\u015fyeri niteli\u011findeki ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn tapu kayd\u0131nda eklenti olarak g\u00f6r\u00fcnen bir k\u0131sm\u0131n\u0131n, ad\u0131 ge\u00e7en daval\u0131 taraf\u0131ndan, di\u011fer kat maliklerinin r\u0131zalar\u0131 al\u0131nmaks\u0131z\u0131n Kat M\u00fclkiyeti Kanunu h\u00fck\u00fcmlerine ayk\u0131r\u0131 olarak dernek ad\u0131 alt\u0131nda bir tak\u0131m ki\u015filere kulland\u0131r\u0131ld\u0131\u011f\u0131n\u0131, an\u0131lan ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn market olarak kullan\u0131lan di\u011fer k\u0131sm\u0131n\u0131n \u00f6n\u00fcnden ana ta\u015f\u0131nmaz\u0131n ortak kullan\u0131m alan\u0131 olan bah\u00e7e duvar\u0131na do\u011fru sundurma yap\u0131ld\u0131\u011f\u0131n\u0131, yine dernek olarak kullan\u0131lan b\u00f6l\u00fcm\u00fcn kap\u0131s\u0131n\u0131n \u00f6n\u00fcne pergola yap\u0131ld\u0131\u011f\u0131n\u0131, ayr\u0131ca ortak alanlara masa sandalye konuldu\u011funu, bu \u015fekilde hem sundurma ve pergola yaparak ayr\u0131ca masa sandalye koyarak ortak alanlar\u0131n i\u015fgal edildi\u011fini, hem de ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn eklentisinin yasaya ayk\u0131r\u0131 olarak kullan\u0131ld\u0131\u011f\u0131n\u0131 ileri s\u00fcrerek s\u00f6z konusu ortak alanlara el atman\u0131n ve ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn yasaya ayk\u0131r\u0131 kullan\u0131m\u0131n\u0131n \u00f6nlenmesine ve bu yerlerin eski h\u00e2line getirilmesine karar verilmesini talep etmi\u015ftir.<\/p>\n<p>Daval\u0131 Cevab\u0131:<\/p>\n<p>5. Dahili daval\u0131 &#8230; temsilcisi duru\u015fmadaki beyan\u0131nda; derne\u011fin bulundu\u011fu yerde kirac\u0131 olmad\u0131klar\u0131n\u0131, sadece yan taraftaki marketin izni ile oray\u0131 kulland\u0131klar\u0131n\u0131 ve ortak alanlara herhangi bir m\u00fcdahalelerinin olmad\u0131\u011f\u0131n\u0131, ayr\u0131ca derne\u011fin ald\u0131\u011f\u0131 karara istinaden 06.01.2015 tarihinde oray\u0131 bo\u015faltt\u0131klar\u0131n\u0131 belirterek davan\u0131n reddini savunmu\u015ftur.<\/p>\n<p>7. Dahili daval\u0131 Be\u011fendi Market\u00e7ilik Tur. Ta\u015f. Hiz. Hay. \u0130n\u015f. San. Tic. Ltd. \u015eti. temsilcisi duru\u015fmadaki beyan\u0131nda; sahibi oldu\u011fu Be\u011fendi Marketin giri\u015f kap\u0131s\u0131n\u0131n yan taraf\u0131nda bulunan fayans kapl\u0131 alan\u0131n \u00fcst\u00fcne mal sahibinin r\u0131zas\u0131 ile bir sundurma yapt\u0131klar\u0131n\u0131, oraya marketin baz\u0131 malzemelerini koyduklar\u0131n\u0131, ancak daha sonra apartmandan itiraz gelince bu sundurmay\u0131 kald\u0131rd\u0131klar\u0131n\u0131 beyan ederek davan\u0131n reddini savunmu\u015ftur.<br \/>\nMahkeme Karar\u0131:<\/p>\n<p>8. &#8230; 2. Sulh Hukuk Mahkemesinin 04.03.2015 tarihli ve 2014\/342 E. 2015\/142 K. say\u0131l\u0131 karar\u0131 ile; Be\u011fendi S\u00fcpermarket olarak kullan\u0131lan k\u0131s\u0131mda yap\u0131lan sundurma ile ilgili olarak, an\u0131lan ortak alan\u0131n ba\u015flang\u0131\u00e7ta i\u015fgal edildi\u011fi, bu i\u015fgale daha sonra son verildi\u011fi ve bu k\u0131s\u0131m ile ilgili davadaki iste\u011fin konusuz kald\u0131\u011f\u0131, anata\u015f\u0131nmaz\u0131n 13 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn\u00fcn &#8220;&#8230;&#8221; taraf\u0131ndan kullan\u0131lan depo b\u00f6l\u00fcm\u00fcn\u00fcn kap\u0131s\u0131n\u0131n \u00fcst\u00fcndeki sundurman\u0131n kald\u0131r\u0131lmas\u0131 iddia ve iste\u011fini i\u00e7eren dava k\u0131sm\u0131 ile ilgili olarak; s\u00f6z konusu sundurman\u0131n ana ta\u015f\u0131nmaz\u0131n ortak alan\u0131n\u0131 i\u015fgal etti\u011fi, sabit olarak yap\u0131lan bu olu\u015fumdan dolay\u0131, bu ortak alan\u0131 di\u011fer kat maliklerinin kullanamad\u0131klar\u0131 ve ke\u015fif an\u0131nda da sundurman\u0131n mevcut oldu\u011fu, davac\u0131 taraf\u0131n ortak alanlar\u0131n masa ve sandalye konulmak suretiyle i\u015fgal edildi\u011fi y\u00f6n\u00fcndeki iddias\u0131 ile ilgili olarak, bu t\u00fcr bir davran\u0131\u015f\u0131n, sabit yap\u0131 niteli\u011finde ferdi tahsis niteli\u011fi ta\u015f\u0131mad\u0131\u011f\u0131, ortak alan\u0131 i\u015fgal olarak de\u011ferlendirilemeyece\u011fi, derne\u011fin kulland\u0131\u011f\u0131 b\u00f6l\u00fcm\u00fcn, kat maliklerinin r\u0131zalar\u0131 d\u0131\u015f\u0131nda ve yasaya ayk\u0131r\u0131 olarak kullan\u0131ld\u0131\u011f\u0131 y\u00f6n\u00fcndeki iddia ile ilgili olarak, yasa h\u00fckm\u00fcnde ve y\u00f6netim plan\u0131n\u0131n ilgili h\u00fckm\u00fcnde, kat maliklerinin oy birli\u011fi ko\u015fulunun meskenler bak\u0131m\u0131ndan getirilmi\u015f olmas\u0131 ve bu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn mesken niteli\u011finde olmamas\u0131 kar\u015f\u0131s\u0131nda, yine KMK&#8217;n\u0131n 15. maddesi gere\u011fince, kat malikinin haklar\u0131 \u00e7er\u00e7evesinde bir kullan\u0131m oldu\u011fu ve buradaki kullan\u0131m\u0131n, an\u0131lan 24. madde i\u00e7eri\u011fine, y\u00f6netim plan\u0131na ve kat m\u00fclkiyeti mevzuat\u0131na ayk\u0131r\u0131 bir y\u00f6n\u00fcn\u00fcn bulunmad\u0131\u011f\u0131 gerek\u00e7esiyle; davan\u0131n k\u0131smen kabul\u00fc ile 2484 ada 1 parsel say\u0131l\u0131 arsa \u00fczerinde kurulu &#8220;Serhat 2 Apartman\u0131&#8221; ile ilgili olarak; 1-Ana ta\u015f\u0131nmaz\u0131n 13 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn\u00fcn &#8220;Be\u011fendi S\u00fcpermarket&#8221; ad\u0131 alt\u0131nda dahili daval\u0131 &#8220;Be\u011fendi Market\u00e7ilik Tur. Ta\u015f. Hiz. Hay. \u0130n\u015f. San. Tic. Ltd. \u015eti.&#8221; taraf\u0131ndan i\u015fletilen d\u00fckkan\u0131n giri\u015finde (\u00f6n cephesinde) bulunan 12 m2 b\u00fcy\u00fckl\u00fc\u011f\u00fcndeki, zemini seramik kapl\u0131 alan\u0131n, \u00fczerini kapatt\u0131\u011f\u0131 ve ortak alan\u0131 i\u015fgal etti\u011fi iddia olunan ve kald\u0131r\u0131lmas\u0131 istenen sundurma ile ilgili olarak; s\u00f6z\u00fc edilen ve dava tarihinde ana ta\u015f\u0131nmaz\u0131n ortak alan\u0131n\u0131 i\u015fgal etti\u011fi belirlenen, ancak yarg\u0131lama s\u0131ras\u0131nda kald\u0131r\u0131ld\u0131\u011f\u0131 anla\u015f\u0131lan bu sundurma ile ilgili iste\u011fin konusuz kalmas\u0131 nedeniyle karar verilmesine yer olmad\u0131\u011f\u0131na, 2- a) Ana ta\u015f\u0131nmaz\u0131n 13 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn\u00fcn &#8220;&#8230;&#8221; taraf\u0131ndan kullan\u0131lan depo b\u00f6l\u00fcm\u00fcn\u00fcn kap\u0131s\u0131n\u0131n \u00fcst\u00fcndeki sundurman\u0131n kald\u0131r\u0131lmas\u0131 iddia ve iste\u011fini i\u00e7eren dava k\u0131sm\u0131 ile ilgili olarak; dernek kap\u0131s\u0131n\u0131n \u00fcst\u00fcnde bulunan 5,50 m boyunda, a\u00e7\u0131ld\u0131\u011f\u0131nda 1,70 m geni\u015fli\u011finde ve 11 m2 alan\u0131 kaplayan, ortak alan\u0131 i\u015fgal etti\u011fi belirlenen tente (sundurma)&#8217;nin bulundu\u011fu yerden s\u00f6k\u00fclerek kald\u0131r\u0131lmas\u0131na, bu konudaki; daval\u0131lar &#8230; ve Serhat Karde\u015flik K\u00fclt\u00fcr E\u011fitim ve Yard\u0131mla\u015fma Derne\u011finin ortak alana el atmalar\u0131n\u0131n \u00f6nlenmesine, b) Bu konuda ad\u0131 ge\u00e7en daval\u0131lara karar gere\u011finin yerine getirilmesi i\u00e7in Kat M\u00fclkiyeti Kanunu\u2019nun 33\/2. maddesi gere\u011fince takdiren 7 g\u00fcn s\u00fcre verilmesine, 3- Anata\u015f\u0131nmaz\u0131n 13 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn\u00fcn dahili daval\u0131 &#8230; taraf\u0131ndan kullan\u0131lan depo k\u0131sm\u0131n\u0131n, amac\u0131 d\u0131\u015f\u0131nda, kat maliklerinin r\u0131zas\u0131 olmaks\u0131z\u0131n Kat M\u00fclkiyeti Kanununa ayk\u0131r\u0131 olarak kullan\u0131ld\u0131\u011f\u0131 ve bunun \u00f6nlenmesi iddia ve iste\u011fi ile ilgili davan\u0131n reddine, 4- Anata\u015f\u0131nmaz\u0131n 13 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn\u00fcn dahili daval\u0131 &#8230;&#8217;nin kulland\u0131\u011f\u0131 deponun \u00f6n\u00fcndeki ortak alana masa sandalye konularak ortak alan\u0131n i\u015fgal edildi\u011fi ve bunun \u00f6nlenmesi iddia ve iste\u011fini i\u00e7eren davan\u0131n reddine karar verilmi\u015ftir.<\/p>\n<p>\u00d6zel Daire Bozma Karar\u0131:<\/p>\n<p>9. Mahkemenin yukar\u0131da belirtilen karar\u0131na kar\u015f\u0131 s\u00fcresi i\u00e7inde davac\u0131 vekili temyiz isteminde bulunmu\u015ftur.<\/p>\n<p>10. Yarg\u0131tay (Kapat\u0131lan) 18. Hukuk Dairesince 30.05.2016 tarihli ve 2015\/11916 E. 2016\/8583 K. say\u0131l\u0131 karar\u0131 ile; \u201c\u2026Dosyadaki yaz\u0131lara, karar\u0131n dayand\u0131\u011f\u0131 kan\u0131tlarla yasal gerektirici nedenlere ve \u00f6zellikle kan\u0131tlar\u0131n takdirinde bir isabetsizlik g\u00f6r\u00fclmemesine g\u00f6re sair temyiz itirazlar\u0131 yerinde de\u011fildir.<\/p>\n<p>Ancak;<\/p>\n<p>1-Dernek olarak kullan\u0131lan b\u00f6l\u00fcm\u00fcn daval\u0131 &#8230;&#8217;a ait 13 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn eklentisi niteli\u011finde depo oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Kat M\u00fclkiyeti Kanunu&#8217;nun 6. maddesi gere\u011fince ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm eklentisi niteli\u011findeki depolar ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn b\u00fct\u00fcnleyici par\u00e7as\u0131 niteli\u011finde olup o ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn malikinden ayr\u0131 olarak kullan\u0131lamaz. Bu husus nazara al\u0131narak 13 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn eklentisi niteli\u011finde olan deponun dernek olarak kullan\u0131lmas\u0131na son verilmesi suretiyle eski hale iadesi gerekirken bu talebin reddine karar verilmesi,<\/p>\n<p>2-Davac\u0131 ortak alana masa ve sandalye koymak suretiyle daval\u0131lar\u0131n m\u00fcdahele etti\u011fini belirterek eski hale iadesini istemi\u015f, mahkemece bu talep hakk\u0131nda ke\u015fif g\u00fcn\u00fcnde dava konusu yerde masa sandalye olmad\u0131\u011f\u0131 gerek\u00e7esiyle reddedilmi\u015ftir. Ke\u015fif g\u00fcn\u00fc masa ve sandalye olmamas\u0131 bu \u015fekilde kullan\u0131m olmad\u0131\u011f\u0131 anlam\u0131na gelmez. Taraflar\u0131n g\u00f6sterdikleri deliller toplanarak karar verilmesi gerekirken yaz\u0131l\u0131 \u015fekilde eksik ara\u015ft\u0131rma ile karar verilmesi,<br \/>\nDo\u011fru g\u00f6r\u00fclmemi\u015ftir\u2026\u201d gerek\u00e7esiyle karar\u0131n bozulmas\u0131na karar verilmi\u015ftir.<br \/>\nDirenme Karar\u0131:<\/p>\n<p>11. &#8230; 2. Sulh Hukuk Mahkemesinin 05.10.2016 tarihli ve 2016\/712 E. 2016\/933 K. say\u0131l\u0131 karar\u0131 ile \u00f6nceki gerek\u00e7eye ek olarak; ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn maliki olan ki\u015finin, eklentinin de maliki olaca\u011f\u0131na g\u00f6re, di\u011fer kat maliklerinin haklar\u0131n\u0131 ihlal etmemek ve onlara zarar vermemek ko\u015fuluyla, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn\u00fcn eklentisini fiilen ayr\u0131 bir kullan\u0131m olarak tahsis etmesine yasal bir engel bulunmad\u0131\u011f\u0131, masa ve sandalye konulmas\u0131 eyleminin; baz\u0131 zamanlarda ger\u00e7ekle\u015ftirilen, s\u00fcreklilik arz etmeyen, kullan\u0131lan alan\u0131 sahiplenme niteli\u011finde bulunmayan, gerekti\u011finde s\u00f6z konusu e\u015fyan\u0131n bulundu\u011fu yerden kald\u0131r\u0131lmas\u0131n\u0131 sa\u011flayan ge\u00e7ici bir eylem oldu\u011fu, bu t\u00fcr bir davran\u0131\u015f\u0131n, sabit yap\u0131 niteli\u011finde ferdi tahsis niteli\u011fi de ta\u015f\u0131mad\u0131\u011f\u0131, ortak alan\u0131 i\u015fgal olarak de\u011ferlendirilemeyece\u011fi gerek\u00e7esiyle direnme karar\u0131 verilmi\u015ftir.<br \/>\nDirenme Karar\u0131n\u0131n Temyizi:<\/p>\n<p>12. Direnme karar\u0131 s\u00fcresi i\u00e7inde davac\u0131 vekili taraf\u0131ndan temyiz edilmi\u015ftir.<\/p>\n<p>II. UYU\u015eMAZLIK<\/p>\n<p>13. Direnme yolu ile Hukuk Genel Kurulu \u00f6n\u00fcne gelen uyu\u015fmazl\u0131k; kat irtifak\u0131 kurulu bulunan ta\u015f\u0131nmazdaki el atman\u0131n \u00f6nlenmesi istemine ili\u015fkin eldeki davada;<\/p>\n<p>1- Daval\u0131 &#8230;&#8217;a ait 13 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn eklentisi niteli\u011finde bulunan deponun, dernek olarak kullan\u0131lmas\u0131n\u0131n m\u00fcmk\u00fcn olup olmad\u0131\u011f\u0131,<\/p>\n<p>2- Davac\u0131n\u0131n, ortak alana masa ve sandalye koymak suretiyle daval\u0131lar\u0131n m\u00fcdahale iddias\u0131 y\u00f6n\u00fcnden, ke\u015fif g\u00fcn\u00fcnde dava konusu yerde masa sandalye olmad\u0131\u011f\u0131, eylemin sabit yap\u0131 niteli\u011finde ferdi tahsis niteli\u011fi de ta\u015f\u0131mad\u0131\u011f\u0131 gerek\u00e7esiyle davan\u0131n reddine karar verilmesinin yerinde olup olmad\u0131\u011f\u0131 noktas\u0131nda toplanmaktad\u0131r.<\/p>\n<p>III. GEREK\u00c7E<\/p>\n<p>A- (1) numaral\u0131 uyu\u015fmazl\u0131k y\u00f6n\u00fcnden yap\u0131lan incelemede;<\/p>\n<p>14. Uyu\u015fmazl\u0131\u011f\u0131n \u00e7\u00f6z\u00fcm\u00fc a\u00e7\u0131s\u0131ndan \u00f6ncelikle konuyla ilgili yasal d\u00fczenlemelerin ve kavramlar\u0131n a\u00e7\u0131klanmas\u0131nda yarar vard\u0131r.<\/p>\n<p>15. 634 say\u0131l\u0131 Kat M\u00fclkiyeti Kanunu\u2019nun (KMK) 2. maddesinin 1. f\u0131kras\u0131 \u201cBu kanuna g\u00f6re:<\/p>\n<p>a) Kat m\u00fclkiyetine konu olan gayrimenkulun b\u00fct\u00fcn\u00fcne (Anagayrimenkul); yaln\u0131z esas yap\u0131 k\u0131sm\u0131na (Anayap\u0131) anagayrimenkulun ayr\u0131 ayr\u0131 ve ba\u015fl\u0131 ba\u015f\u0131na kullan\u0131lmaya elveri\u015fli olup, bu kanun h\u00fck\u00fcmlerine g\u00f6re ba\u011f\u0131ms\u0131z m\u00fclkiyete konu olan b\u00f6l\u00fcmlerine (Ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm); bir ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn d\u0131\u015f\u0131nda olup, do\u011frudan do\u011fruya o b\u00f6l\u00fcme tahsis edilmi\u015f olan yerlere (Eklenti); ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmler \u00fczerinde kurulan m\u00fclkiyet hakk\u0131na (Kat m\u00fclkiyeti) ve bu hakka sahip olanlara (Kat maliki); \u2026. denir\u201d \u015feklinde d\u00fczenlenmi\u015f, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm ile eklentinin tan\u0131m\u0131 yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>16. Ayn\u0131 Kanun\u2019un 6. maddesinde; \u201cBir ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn d\u0131\u015f\u0131nda olup, do\u011frudan do\u011fruya o b\u00f6l\u00fcme tahsis edilmi\u015f olan k\u00f6m\u00fcrl\u00fck, su deposu, garaj, elektrik, havagaz\u0131 veya su saati yuvalar\u0131, tuvalet gibi eklentiler, ait oldu\u011fu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn b\u00fct\u00fcnleyici par\u00e7as\u0131 say\u0131l\u0131r ve o b\u00f6l\u00fcm\u00fcn maliki, eklentilerin de tek ba\u015f\u0131na maliki olur.<\/p>\n<p>Eklentiler kat m\u00fclkiyeti k\u00fct\u00fc\u011f\u00fcn\u00fcn (Beyanlar) hanesine kaydedilir ve bunlardan anayap\u0131n\u0131n oturdu\u011fu zeminin d\u0131\u015f\u0131nda kalanlar kadastro plan\u0131nda veya tapu haritas\u0131nda ayr\u0131ca g\u00f6sterilir.<\/p>\n<p>Ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm \u00fczerinde kat m\u00fclkiyetiyle ve di\u011fer kat maliklerinin haklariyle ba\u011fda\u015fmas\u0131 m\u00fcmk\u00fcn olm\u0131yan irtifaklar kurulamaz.<br \/>\nBa\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin ba\u015fkas\u0131na devri, kay\u0131tlanmas\u0131 veya kiralanmas\u0131 halinde, eklentiler ve ortak yerler de kendili\u011finden devredilmi\u015f, kay\u0131tlanm\u0131\u015f vaya kiralanm\u0131\u015f olur\u201d h\u00fckm\u00fc \u00f6ng\u00f6r\u00fclm\u00fc\u015f olup, eklentiye ili\u015fkin ayn\u0131 tan\u0131m yinelenmekle birlikte birka\u00e7 \u00f6rnek verilmi\u015ftir.<\/p>\n<p>17. Kat M\u00fclkiyeti Kanunu\u2019nun 6. maddesi uyar\u0131nca eklenti, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn b\u00fct\u00fcnleyici par\u00e7as\u0131 say\u0131l\u0131r. Burada ama\u00e7lanan, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcme kim malikse, o malikin ba\u011f\u0131ms\u0131z b\u00f6l\u00fcme \u00f6zg\u00fclenen eklentinin de maliki olaca\u011f\u0131 ve hukuk\u00ee tasarruflarda eklenti \u00fczerindeki m\u00fclkiyetin ba\u011fl\u0131 oldu\u011fu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn m\u00fclkiyetine tabi olaca\u011f\u0131d\u0131r (O\u011fuzman, Kemal\/ Seli\u00e7i, \u00d6zer\/ Oktay \u00d6zdemir, Saibe: E\u015fya Hukuku, \u0130stanbul 2017 s. 615).<\/p>\n<p>18. Ba\u015fka bir anlat\u0131mla eklentiler, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmden ayr\u0131larak devredilemezler. \u00d6rne\u011fin bir ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn eklentisi niteli\u011findeki garaj, depo vs. ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmden ayr\u0131 olarak kiraya verilemez. Ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm kiraya verilmi\u015fse, o kirac\u0131 d\u0131\u015f\u0131nda \u00fc\u00e7\u00fcnc\u00fc bir ki\u015fiye kiralanamaz (Germe\u00e7, Mahir Ersin: Kat M\u00fclkiyeti Hukuku, Ankara 2020, s. 150-153).<\/p>\n<p>19. Kat M\u00fclkiyeti Kanunu\u2019nun 18. maddesine g\u00f6re de kat malikleri ve kirac\u0131lar, gerek ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerini, gerekse eklentileri ve ortak yerleri kullan\u0131rken do\u011fruluk kurallar\u0131na uymak, \u00f6zellikle birbirini rahats\u0131z etmemek, birbirinin haklar\u0131n\u0131 \u00e7i\u011fnememek ve y\u00f6netim plan\u0131 h\u00fck\u00fcmlerine uymakla y\u00fck\u00fcml\u00fcd\u00fcrler.<\/p>\n<p>20. Somut olayda &#8230; ili Merkez il\u00e7esi Kavgaz Mahallesi 2484 ada 1 parsel say\u0131l\u0131 ta\u015f\u0131nmazda bulunan ve kat irtifak\u0131 tesis edilen binada 13 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn i\u015fyeri niteli\u011fi ile daval\u0131 &#8230; ad\u0131na kay\u0131tl\u0131 oldu\u011fu, tapu kayd\u0131na 27.06.2011 tarihli y\u00f6netim plan\u0131n\u0131n i\u015flendi\u011fi, \u201cbodrumda e-1 depo\u201d \u015feklinde eklenti bilgisinin bulundu\u011fu, ke\u015fifte yap\u0131lan g\u00f6zlemde depo olarak belirtilen b\u00f6l\u00fcm\u00fcn &#8230; taraf\u0131ndan kullan\u0131ld\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>21. Dosya kapsam\u0131 ve t\u00fcm bu nedenlere g\u00f6re, i\u015fyeri niteli\u011findeki 13 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn eklentisi niteli\u011finde bulunan deponun, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn m\u00fclkiyetine tabi olaca\u011f\u0131 anla\u015f\u0131lmakla, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmden ayr\u0131 olarak kullan\u0131lamayaca\u011f\u0131 sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r. Ancak dahili daval\u0131 &#8230; temsilcisi 06.01.2015 tarihinde deponun bo\u015falt\u0131ld\u0131\u011f\u0131n\u0131 beyan etmesi ve yerle\u015fim yeri de\u011fi\u015fikli\u011fine ili\u015fkin sorgu sayfas\u0131n\u0131 sunmas\u0131 kar\u015f\u0131s\u0131nda, bu iddia \u00fczerinde durulmak suretiyle ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn eklentisi niteli\u011finde bulunan deponun bo\u015falt\u0131l\u0131p bo\u015falt\u0131lmad\u0131\u011f\u0131 y\u00f6n\u00fcnden ara\u015ft\u0131rma yap\u0131lmas\u0131 ve sonucuna g\u00f6re karar verilmesi gerekmektedir.<\/p>\n<p>22. Hukuk Genel Kurulunda yap\u0131lan g\u00f6r\u00fc\u015fmeler s\u0131ras\u0131nda dernek taraf\u0131ndan kullan\u0131lan deponun bo\u015falt\u0131l\u0131p bo\u015falt\u0131lmad\u0131\u011f\u0131 konusunda ara\u015ft\u0131rma yap\u0131lmas\u0131na gerek olmad\u0131\u011f\u0131, 13 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn eklentisi niteli\u011finde olan deponun dernek olarak kullan\u0131lmas\u0131na son verilmesi suretiyle eski h\u00e2le getirilmesine karar verilmesi gerekti\u011fine y\u00f6nelik \u00d6zel Daire bozma karar\u0131nda yer verilen a\u00e7\u0131klamalar do\u011frultusunda h\u00fckm\u00fcn bozulmas\u0131 gerekti\u011fi g\u00f6r\u00fc\u015f\u00fc ileri s\u00fcr\u00fclm\u00fc\u015f ise de, bu g\u00f6r\u00fc\u015f Kurul \u00e7o\u011funlu\u011fu taraf\u0131ndan benimsenmemi\u015ftir.<\/p>\n<p>23. H\u00e2l b\u00f6yle olunca (1) numaral\u0131 uyu\u015fmazl\u0131k y\u00f6n\u00fcnden direnme karar\u0131, yukar\u0131da a\u00e7\u0131klanan ilave gerek\u00e7e ve nedenler ile bozulmal\u0131d\u0131r.<br \/>\nB- (2) numaral\u0131 uyu\u015fmazl\u0131k y\u00f6n\u00fcnden yap\u0131lan incelemede;<\/p>\n<p>24. Konunun a\u00e7\u0131kl\u0131\u011fa kavu\u015fturulmas\u0131 i\u00e7in \u00f6ncelikle ilgili yasal d\u00fczenlemelerin incelenmesinde yarar bulunmaktad\u0131r.<\/p>\n<p>25. 634 say\u0131l\u0131 Kat M\u00fclkiyeti Kanunu\u2019na g\u00f6re, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmler \u00fczerinde kurulan m\u00fclkiyet hakk\u0131na kat m\u00fclkiyeti, bu hakka sahip olanlara kat maliki, anagayrimenkul\u00fcn ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmleri d\u0131\u015f\u0131nda kal\u0131p, korunma ve ortakla\u015fa kullanma veya faydalanmaya yarayan yerlerine ortak yerler, kat maliklerinin ortak malik s\u0131fat\u0131yla payda\u015f\u0131 bulunduklar\u0131 bu yerler \u00fczerindeki faydalanma haklar\u0131na kullanma hakk\u0131 denir (KMK m. 2).<\/p>\n<p>26. Kat M\u00fclkiyeti Kanunu\u2019nun 3. maddesinde, \u201cKat m\u00fclkiyeti, arsa pay\u0131 ve ana gayrimenkuldeki ortak yerlerle ba\u011flant\u0131l\u0131 \u00f6zel bir m\u00fclkiyettir\u201d h\u00fckm\u00fc yer almaktad\u0131r. Bu h\u00fck\u00fcmden de anla\u015f\u0131laca\u011f\u0131 \u00fczere kat m\u00fclkiyeti, ortak m\u00fclkiyet esas\u0131na dayal\u0131 \u00f6zel bir m\u00fclkiyet \u015feklidir. Ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmler \u00fczerinde kurulan bireysel m\u00fclkiyet hakk\u0131, arsa pay\u0131 ve ana ta\u015f\u0131nmazdaki ortak yerlere kadar uzanmaktad\u0131r. Kat m\u00fclkiyetinin her bir ba\u011f\u0131ms\u0131z b\u00f6l\u00fcme \u00f6zg\u00fclenen arsa pay\u0131 ve ortak yerlerle ba\u011flant\u0131s\u0131, ona di\u011fer ortak m\u00fclkiyet t\u00fcrlerinden farkl\u0131 bir m\u00fclkiyet \u00f6zelli\u011fi vermektedir (Germe\u00e7, s. 77).<\/p>\n<p>27. Ayn\u0131 Kanunun 4. maddesi \u201cOrtak yerlerin konusu s\u00f6zle\u015fme ile belirtilebilir. A\u015fa\u011f\u0131da yaz\u0131l\u0131 yerler ve \u015feyler bu kanun gere\u011fince her halde ortak yer say\u0131l\u0131r.<\/p>\n<p>a) Temeller ve ana duvarlar, (Eklenmi\u015f ibare RGT: 28.11.2007 RG No: 26714 Kanun No: 5711\/2) ta\u015f\u0131y\u0131c\u0131 sistemi olu\u015fturan kiri\u015f, kolon ve perde duvarlar ile ta\u015f\u0131y\u0131c\u0131 sistemin par\u00e7as\u0131 di\u011fer elemanlar, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmleri ay\u0131ran ortak duvarlar, tavan ve tabanlar, avlular, genel giri\u015f kap\u0131lar\u0131, antreler, merdivenler, asans\u00f6rler, sahanl\u0131klar, koridorlar ve buralardaki genel tuvalet ve lavabolar, kap\u0131c\u0131 daire veya odalar\u0131, genel \u00e7ama\u015f\u0131rl\u0131k ve \u00e7ama\u015f\u0131r kurutma yerleri, genel k\u00f6m\u00fcrl\u00fck ve ortak garajlar, elektrik, su ve havagaz\u0131 saatlerinin korunmas\u0131na mahsus olup ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm d\u0131\u015f\u0131nda bulunan yuvalar ve kapal\u0131 k\u0131s\u0131mlar, kalorifer daireleri, kuyu ve sarn\u0131\u00e7lar, yap\u0131n\u0131n genel su depolar\u0131, s\u0131\u011f\u0131naklar,<\/p>\n<p>b) Her kat malikinin kendi b\u00f6l\u00fcm\u00fc d\u0131\u015f\u0131ndaki kanalizasyon tesisleri ve \u00e7\u00f6p kanallar\u0131 ile kalorifer, su, havagaz\u0131 ve elektrik tesisleri, telefon, radyo ve televizyon i\u00e7in ortak \u015febeke ve antenler s\u0131cak ve so\u011fuk hava tesisleri,<\/p>\n<p>c) \u00c7at\u0131lar, bacalar, genel dam teraslar\u0131, ya\u011fmur oluklar\u0131, yang\u0131n emniyet merdivenleri.<br \/>\nYukar\u0131da say\u0131lanlar\u0131n d\u0131\u015f\u0131nda kal\u0131p da, yine ortakla\u015fa kullanma, korunma veya, faydalanma i\u00e7in zaruri olan di\u011fer yerler ve \u015feyler de (Ortak yer) konusuna girer\u201d \u015feklinde d\u00fczenlenmi\u015f, 16. maddede, \u201cKat maliklerinin ana ta\u015f\u0131nmaz\u0131n b\u00fct\u00fcn ortak yerlerine arsa paylar\u0131 oran\u0131nda ve ortak m\u00fclkiyet h\u00fck\u00fcmlerine g\u00f6re malik olacaklar\u0131 ve o \u015fekilde kullanma haklar\u0131 bulundu\u011fu\u201d belirtilmi\u015ftir.<\/p>\n<p>28. T\u00fcm bu a\u00e7\u0131klamalar \u0131\u015f\u0131\u011f\u0131nda somut olay de\u011ferlendirildi\u011finde, mahkemenin, ortak yerlere masa-sandalye konulmas\u0131 eyleminin s\u00fcreklilik arzetmeyen, ge\u00e7ici bir eylem oldu\u011fu, bu t\u00fcr davran\u0131\u015f\u0131n sabit yap\u0131 niteli\u011finde ferdi tahsis \u00f6zelli\u011fi ta\u015f\u0131mad\u0131\u011f\u0131 gerek\u00e7esi ile bu talep y\u00f6n\u00fcnden davan\u0131n reddine dair karar\u0131 \u00fczerine \u00d6zel Daire bozma karar\u0131nda, ke\u015fif g\u00fcn\u00fc masa-sandalye olmamas\u0131n\u0131n kullan\u0131m olmad\u0131\u011f\u0131 anlam\u0131na gelmeyece\u011fi olgusuna dayan\u0131lm\u0131\u015ft\u0131r. Bu h\u00e2liyle \u00d6zel Daire bozma karar\u0131nda ge\u00e7ici olarak kullanmaya y\u00f6nelik bir a\u00e7\u0131klamada bulunulmam\u0131\u015ft\u0131r.<\/p>\n<p>29. Dolay\u0131s\u0131yla ortak yerler \u00fczerinde b\u00fct\u00fcn ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm maliklerinin arsa pay\u0131 oran\u0131nda ve ortak m\u00fclkiyet h\u00fck\u00fcmlerine g\u00f6re malik olmas\u0131 nedeniyle, masa-sandalye konulmas\u0131na y\u00f6nelik eylemin ge\u00e7ici nitelikte olmas\u0131 h\u00e2linde dahi di\u011fer kat maliklerinin kullan\u0131m\u0131 da engellenmi\u015f olaca\u011f\u0131ndan ortak alana el atma niteli\u011finde bulundu\u011fu kabul edilmi\u015ftir. Bu nedenle taraflar\u0131n g\u00f6sterdi\u011fi deliller de toplanmak suretiyle sonucuna g\u00f6re karar verilmesi gerekmektedir.<\/p>\n<p>30. Hukuk Genel Kurulunda yap\u0131lan g\u00f6r\u00fc\u015fmeler s\u0131ras\u0131nda ortak yerlere masa-sandalye konulmak suretiyle daval\u0131lar\u0131n m\u00fcdahalesine y\u00f6nelik talep hakk\u0131nda \u00d6zel Daire bozma karar\u0131nda yer verilen a\u00e7\u0131klamalar do\u011frultusunda h\u00fckm\u00fcn bozulmas\u0131 gerekti\u011fi g\u00f6r\u00fc\u015f\u00fc ileri s\u00fcr\u00fclm\u00fc\u015f ise de, bu g\u00f6r\u00fc\u015f Kurul \u00e7o\u011funlu\u011fu taraf\u0131ndan benimsenmemi\u015ftir.<\/p>\n<p>31. H\u00e2l b\u00f6yle olunca (2) numaral\u0131 uyu\u015fmazl\u0131k y\u00f6n\u00fcnden direnme karar\u0131, yukar\u0131da a\u00e7\u0131klanan geni\u015fletilmi\u015f gerek\u00e7e ve nedenler ile bozulmal\u0131d\u0131r.<\/p>\n<p>IV. Hukuk Dairesi <\/p>\n<p>2020\/7917 E., 2021\/478 K.<\/p>\n<p>&#8220;\u0130\u00e7tihat Metni&#8221;<\/p>\n<p>MAHKEMES\u0130 :Sulh Hukuk Mahkemesi<\/p>\n<p>Taraflar aras\u0131ndaki davan\u0131n yap\u0131lan duru\u015fmas\u0131 sonunda kurulan h\u00fckm\u00fcn Yarg\u0131tay&#8217;ca incelenmesi, daval\u0131 &#8230; vekili taraf\u0131ndan istenilmekle, s\u00fcresinde oldu\u011fu anla\u015f\u0131lan temyiz dilek\u00e7esinin kabul\u00fcne karar verildikten sonra dosya incelendi, gere\u011fi g\u00f6r\u00fc\u015f\u00fcl\u00fcp d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>&#8211; K A R A R \u2013<\/p>\n<p>Dava dilek\u00e7esinde, daval\u0131lar taraf\u0131ndan 1 nolu meskende projede g\u00f6r\u00fclen eklenti giri\u015f kap\u0131s\u0131n\u0131n iptal edilerek duvar \u00f6r\u00fclm\u00fc\u015f oldu\u011funu, \u00f6n cepheye bakan perde betonun komple y\u0131k\u0131ld\u0131\u011f\u0131n\u0131, mimari projede belirtilen balkon iz d\u00fc\u015f\u00fcm\u00fc yaz\u0131s\u0131 ile ortak alanda yer alan bah\u00e7enin eklentiye dahil edilip bu k\u0131sm\u0131n kenarlar\u0131na duvar \u00f6r\u00fclerek pvc pencereler yap\u0131lm\u0131\u015f oldu\u011funu, 6 nolu meskende ise \u00f6n cepheye bakan perde beton komple y\u0131k\u0131ld\u0131\u011f\u0131n\u0131, mimari projede belirtilen iz d\u00fc\u015f\u00fcm\u00fc yaz\u0131s\u0131 ile ortak alanda yer olan bah\u00e7enin eklentiye dahil edildi\u011fini ve bu k\u0131sm\u0131n kenarlar\u0131na duvar \u00f6r\u00fclerek pvc pencereler yap\u0131lm\u0131\u015f oldu\u011funu, bu eklentilerin kiraya verilerek konut olarak kullan\u0131ld\u0131\u011f\u0131n\u0131, 1 ve 6 nolu meskenin eklentisinde yap\u0131lan projeye ayk\u0131r\u0131l\u0131klar\u0131n ve ortak alana m\u00fcdahalenin giderilerek eski hale iadesini, her iki eklentinin de konut ama\u00e7l\u0131 kullan\u0131lmaktan men edilmesi istenilmi\u015ftir.<\/p>\n<p>Mahkemece DAVANIN KISMEN KABUL\u00dc ile, Dava konusu &#8230; ada &#8230; parselde kain B blok 1 ve 6 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm eklentilerinin perde betonlar\u0131na m\u00fcdahale edilmedi\u011fi dosya kapsam\u0131nda anla\u015f\u0131lmakla davac\u0131 taraf\u0131n bu y\u00f6ndeki davas\u0131n\u0131n reddine, Dava konusu ta\u015f\u0131nmaz eklentilerinin arka balkon izd\u00fc\u015f\u00fcmlerinin alan\u0131n\u0131 tu\u011fla duvar ve do\u011framalarla kapat\u0131larak olu\u015fturulan 15.75&#8242; er m2 lik kapal\u0131 alan\u0131n KMK ve mimari projesine ayk\u0131r\u0131 oldu\u011fu anla\u015f\u0131lmakla kal&#8217; i ile mimari projesine uygun eski hale getirilmesine, Dava konusu ta\u015f\u0131nmaz eklentilerinin kiraya verilmesi ve konut olarak kullan\u0131lmas\u0131n\u0131n \u00f6nlenmesi y\u00f6n\u00fcndeki davan\u0131n reddine, Daval\u0131 tarafa belirtilen hususlar i\u00e7in 30 g\u00fcnl\u00fck s\u00fcre verilmesine, karar verilmi\u015f, h\u00fck\u00fcm davac\u0131lar vekili ve daval\u0131 &#8230; vekili taraf\u0131ndan temyiz edilmi\u015ftir.<\/p>\n<p>Kat M\u00fclkiyeti Kanunu&#8217;nun 6. maddesi gere\u011fince ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm eklentisi niteli\u011findeki depolar ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn b\u00fct\u00fcnleyici par\u00e7as\u0131 niteli\u011finde olup o ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmden ayr\u0131 olarak kullan\u0131lamaz.Yasan\u0131n bu h\u00fckm\u00fc gere\u011fi ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn k\u00f6m\u00fcrl\u00fck niteli\u011findeki eklentilerinin amac\u0131 d\u0131\u015f\u0131na \u00e7\u0131kar\u0131larak konut olarak kiraya verilmesi m\u00fcmk\u00fcn de\u011fildir. Bu nedenle mahkemece davac\u0131lar\u0131n eklentilere ili\u015fkin talebinin reddine karar verilmesi do\u011fru g\u00f6r\u00fclmemi\u015ftir.<\/p>\n<p>Ayr\u0131ca kabule g\u00f6re de, HMK&#8217;nun 297. maddesine g\u00f6re mahkemece verilen karar\u0131n h\u00fck\u00fcm sonucu k\u0131sm\u0131nda, gerek\u00e7eye ait herhangi bir s\u00f6z tekrar edilmeksizin, istek sonu\u00e7lar\u0131ndan herbiri hakk\u0131nda verilen h\u00fck\u00fcmle, taraflara y\u00fcklenen bor\u00e7 ve tan\u0131nan haklar\u0131n m\u00fcmk\u00fcnse s\u0131ra numaras\u0131 alt\u0131nda birer birer, a\u00e7\u0131k, \u015f\u00fcphe ve teredd\u00fct uyand\u0131rmayacak \u015fekilde g\u00f6sterilmesi ve verilen karar ile iki taraf\u0131n leh ve aleyhine h\u00fckmedilen g\u00f6rev ve haklar\u0131n gayet a\u00e7\u0131k ve anla\u015f\u0131l\u0131r bi\u00e7imde yaz\u0131lmas\u0131 gerekmektedir.
