Maddesinin On D\u00f6rd\u00fcnc\u00fc F\u0131kras\u0131n\u0131n \u0130ncelenmesi<\/p>\n<p>\u0130tiraz Konusu Kural<\/p>\n<p>\u0130tiraz konusu kuralda, idare mahkemesinde g\u00f6r\u00fclen iptal davas\u0131nda y\u00fcr\u00fctmenin durdurulmas\u0131 karar\u0131 verilmesi h\u00e2linde s\u00f6z konusu davan\u0131n hukuk mahkemesinde g\u00f6r\u00fclen kamula\u015ft\u0131rma bedelinin tespiti ve ta\u015f\u0131nmaz\u0131n idare ad\u0131na tesciline ili\u015fkin davada bekletici mesele yap\u0131lmas\u0131 zorunlu k\u0131l\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>Ba\u015fvuru Gerek\u00e7esi<\/p>\n<p>Ba\u015fvuru karar\u0131nda \u00f6zetle; itiraz konusu kuralla hukuk mahkemesinde g\u00f6r\u00fclen davan\u0131n idari yarg\u0131da g\u00f6r\u00fclen davadan \u00f6nce sonu\u00e7lanmas\u0131 h\u00e2linde hak kay\u0131plar\u0131n\u0131n ortaya \u00e7\u0131kabilece\u011fi zira bedel tespiti ve tescil davas\u0131nda tescile ili\u015fkin karar\u0131n kesin nitelikte oldu\u011fu, ki\u015filerin kamula\u015ft\u0131rma i\u015fleminin iptali h\u00e2linde kamula\u015ft\u0131r\u0131lan ta\u015f\u0131nmazla ilgili yolsuz tescil davas\u0131 a\u00e7ma imk\u00e2nlar\u0131 olsa dahi bu durumun ki\u015filer a\u00e7\u0131s\u0131ndan a\u015f\u0131r\u0131 bir k\u00fclfete neden olaca\u011f\u0131 belirtilerek kural\u0131n Anayasa\u2019ya ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>Mahkemenin De\u011ferlendirmesi<\/p>\n<p>Kurala g\u00f6re, kamula\u015ft\u0131rma i\u015fleminin iptaline ili\u015fkin davada y\u00fcr\u00fctmenin durdurulmas\u0131 karar\u0131n\u0131n verilmemesi h\u00e2linde hukuk mahkemesinin yarg\u0131lamaya devam ederek kamula\u015ft\u0131rma bedelinin tespitine ve ta\u015f\u0131nmaz\u0131n idare ad\u0131na tesciline karar vermesi s\u00f6z konusu olabilmektedir.<\/p>\n<p>Bu bak\u0131mdan kamula\u015ft\u0131rma i\u015fleminin iptali talebiyle a\u00e7\u0131lan davada y\u00fcr\u00fctmeyi durdurma karar\u0131 verilmesi h\u00e2linde an\u0131lan davan\u0131n adli yarg\u0131 mercilerince bekletici mesele yap\u0131lmas\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015f ise de y\u00fcr\u00fctmeyi durdurma karar\u0131n\u0131n makul bir s\u00fcre i\u00e7inde verilmemesi veya y\u00fcr\u00fctmeyi durdurma talebinin reddedilmesi h\u00e2linde davan\u0131n esastan kabul edilmek suretiyle kamula\u015ft\u0131rma i\u015fleminin iptal edilmesi de m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>Bu durumda kamula\u015ft\u0131rma i\u015fleminin hukuka uygunlu\u011funun denetimi ile kamula\u015ft\u0131rma bedelinin tespitinin farkl\u0131 yarg\u0131 kollar\u0131nda ger\u00e7ekle\u015ftirilmesi an\u0131lan i\u015flemin hukuka uygunlu\u011funa ili\u015fkin denetimin etkilili\u011fini zedeleyebilir. Dolay\u0131s\u0131yla kamula\u015ft\u0131rma ba\u011flam\u0131ndaki uyu\u015fmazl\u0131klar\u0131n farkl\u0131 yarg\u0131 kollar\u0131nda karara ba\u011flanmas\u0131 ve idari yarg\u0131da g\u00f6r\u00fclen davan\u0131n adli yarg\u0131 mercilerince bekletici mesele yap\u0131lmas\u0131n\u0131n y\u00fcr\u00fctmeyi durdurma karar\u0131 verilmesi durumuna \u00f6zg\u00fclenmesi nedeniyle m\u00fclkiyet hakk\u0131n\u0131 g\u00fcvence alt\u0131na alan etkili bir y\u00f6ntemin geli\u015ftirilemedi\u011fi ve yap\u0131sal bir sorunun bulundu\u011fu anla\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Kamula\u015ft\u0131rma i\u015flemine kar\u015f\u0131 iptal davas\u0131n\u0131n a\u00e7\u0131lmas\u0131 kamula\u015ft\u0131rmaya konu ta\u015f\u0131nmaz\u0131n m\u00fclkiyetinin korunmas\u0131 amac\u0131n\u0131 ta\u015f\u0131maktad\u0131r. Kamula\u015ft\u0131rma i\u015flemiyle m\u00fclkiyet hakk\u0131na y\u00f6nelik olarak meydana gelen m\u00fcdahaleye ili\u015fkin ihlal iddialar\u0131n\u0131n etkili bir \u015fekilde ileri s\u00fcr\u00fclebilmesi de ancak kamula\u015ft\u0131rma s\u00fcrecinin kesinle\u015fmesinden \u00f6nce bu karar\u0131n hukuka uygunlu\u011funun idari yarg\u0131 mercilerince denetlenmesiyle m\u00fcmk\u00fcn olabilecektir.<\/p>\n<p>Kuralda y\u00fcr\u00fctmeyi durdurma karar\u0131 verilmesi h\u00e2li d\u0131\u015f\u0131nda kamula\u015ft\u0131rma s\u00fcrecinin kesinle\u015fmesinden \u00f6nce kamula\u015ft\u0131rma karar\u0131n\u0131n hukuka uygunlu\u011funun idari yarg\u0131 mercilerince denetlenmesine y\u00f6nelik olarak herhangi bir g\u00fcvence \u00f6ng\u00f6r\u00fclmemi\u015ftir. Dolay\u0131s\u0131yla kamula\u015ft\u0131rma karar\u0131na kar\u015f\u0131 etkili bir yarg\u0131sal denetim yap\u0131lmas\u0131 imk\u00e2n\u0131n\u0131 tan\u0131mayan kural, devletin m\u00fclkiyet hakk\u0131na y\u00f6nelik ihlal iddialar\u0131n\u0131n dile getirilmesinde gerekli ve yeterli mekanizmalar\u0131 olu\u015fturma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcyle ba\u011fda\u015fmamaktad\u0131r.<\/p>\n<p>Anayasa Mahkemesi a\u00e7\u0131klanan gerek\u00e7elerle kural\u0131n Anayasa\u2019ya ayk\u0131r\u0131 oldu\u011funa ve iptaline karar vermi\u015ftir.\u00a0<\/p>\n<p>B. Kanun\u2019un 14. Maddesinin Alt\u0131nc\u0131 F\u0131kras\u0131n\u0131n \u0130ncelenmesi<\/p>\n<p>\u0130tiraz Konusu Kural<\/p>\n<p>\u0130tiraz konusu kuralda, i\u015ftirak h\u00e2linde veya m\u00fc\u015fterek m\u00fclkiyette payda\u015flardan biri veya bir k\u0131sm\u0131n\u0131n a\u00e7aca\u011f\u0131 iptal ve maddi hatalar\u0131n d\u00fczeltilmesi davalar\u0131n\u0131n sonu\u00e7lar\u0131n\u0131n dava a\u00e7mayanlar\u0131 etkilemeyece\u011fi \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>Ba\u015fvuru Gerek\u00e7esi<\/p>\n<p>Ba\u015fvuru karar\u0131nda \u00f6zetle; itiraz konusu kurala g\u00f6re idari yarg\u0131 mercilerince verilen ve kesin h\u00fck\u00fcm niteli\u011finde olan kamula\u015ft\u0131rma i\u015fleminin iptaline ili\u015fkin karar\u0131n dava a\u00e7mayanlar y\u00f6n\u00fcnden h\u00fck\u00fcm do\u011furmamas\u0131n\u0131n idari yarg\u0131da dava a\u00e7mayan hissedarlar\u0131n hukuka ayk\u0131r\u0131 oldu\u011funa karar verilen kamula\u015ft\u0131rma i\u015fleminden etkilenmeleri sonucunu do\u011furaca\u011f\u0131, bu durumun ki\u015filerin m\u00fclkiyet ve adil yarg\u0131lanma haklar\u0131n\u0131 \u00f6l\u00e7\u00fcs\u00fcz bir \u015fekilde s\u0131n\u0131rlad\u0131\u011f\u0131 belirtilerek kural\u0131n Anayasa\u2019ya ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>Mahkemenin De\u011ferlendirmesi <\/p>\n<p>2942 say\u0131l\u0131 Kanun\u2019un 14. maddesinin d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131nda i\u015ftirak h\u00e2linde veya m\u00fc\u015fterek m\u00fclkiyette, hak sahiplerinin tek ba\u015f\u0131na dava haklar\u0131n\u0131n bulundu\u011fu h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Fiilen ta\u015f\u0131nmaz\u0131n taksim edilmedi\u011fi h\u00e2llerde her bir hissedar ta\u015f\u0131nmaz\u0131n tamam\u0131 \u00fczerinde tasarruf yetkisine sahiptir.<\/p>\n<p>Bunun yan\u0131nda kamula\u015ft\u0131rma i\u015flemi ta\u015f\u0131nmaz\u0131n tamam\u0131 ya da bir k\u0131sm\u0131 \u00fczerinde ger\u00e7ekle\u015fse de her bir hissedar\u0131n s\u00f6z konusu i\u015flem nedeniyle hakk\u0131 etkilenmektedir. Bu y\u00f6n\u00fcyle kamula\u015ft\u0131rma i\u015fleminin hukuka ayk\u0131r\u0131 oldu\u011fu gerek\u00e7esiyle iptal edilmesiyle birlikte mahkemenin hukuka ayk\u0131r\u0131l\u0131k tespiti dava a\u00e7an ya da a\u00e7mayan kamula\u015ft\u0131rmaya konu ta\u015f\u0131nmaz\u0131n t\u00fcm hissedarlar\u0131 bak\u0131m\u0131ndan ge\u00e7erli olmaktad\u0131r. Nitekim bu husus iptal davas\u0131n\u0131n amac\u0131yla da yak\u0131ndan ilgilidir.\u00a0 Zira iptal davas\u0131yla hukuka ayk\u0131r\u0131 olan idari i\u015flemin do\u011fdu\u011fu anda etki etti\u011fi alan\u0131n tamam\u0131 bak\u0131m\u0131ndan ge\u00e7ersiz k\u0131l\u0131nmas\u0131 sa\u011flan\u0131r.<\/p>\n<p>Esas itibar\u0131yla Kanun\u2019un 14. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda yer verilen \u201c\u0130\u015ftirak halinde veya m\u00fc\u015fterek m\u00fclkiyette, payda\u015flar\u0131n tek ba\u015f\u0131na dava haklar\u0131 vard\u0131r.\u201d h\u00fckm\u00fc de g\u00f6zetildi\u011finde kanun koyucunun belirtilen m\u00fclkiyet bi\u00e7imleri kapsam\u0131nda zorunlu dava arkada\u015fl\u0131\u011f\u0131 m\u00fcessesine kamula\u015ft\u0131rma bak\u0131m\u0131ndan bir istisna getirdi\u011fi g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Nitekim ortada tek bir idari i\u015flem oldu\u011fundan hak sahiplerinden birinin a\u00e7aca\u011f\u0131 davan\u0131n bu i\u015flemin hukuka uygun olup olmad\u0131\u011f\u0131n\u0131n de\u011ferlendirilmesi bak\u0131m\u0131ndan yeterli olaca\u011f\u0131 a\u00e7\u0131kt\u0131r. Bu bak\u0131mdan verilen karar\u0131n dava a\u00e7mayan hissedarlar\u0131n da malik oldu\u011fu kamula\u015ft\u0131r\u0131lan ta\u015f\u0131nmaz \u00fczerinde sonu\u00e7 do\u011furaca\u011f\u0131 hususunda \u015f\u00fcphe bulunmamaktad\u0131r.\u00a0<\/p>\n<p>Ancak kural, yarg\u0131 mercilerinin iptal karar\u0131yla birlikte kamula\u015ft\u0131rma i\u015fleminin kanuni dayanaktan yoksun h\u00e2le geldi\u011fi tespit edilmesine ra\u011fmen maliklerin m\u00fclk\u00fc \u00fczerinde sonu\u00e7 do\u011furmaya devam etmesine neden olmakta, anayasal veya yasal ko\u015fullar\u0131 sa\u011flamad\u0131\u011f\u0131 i\u00e7in iptal edilen kamula\u015ft\u0131rma i\u015flemini dava a\u00e7mayan payda\u015flar y\u00f6n\u00fcnden ge\u00e7erli k\u0131lmaktad\u0131r. Bu bak\u0131mdan anayasal g\u00fcvenceleri kar\u015f\u0131lamad\u0131\u011f\u0131 gerek\u00e7esiyle iptal edilen kamula\u015ft\u0131rma i\u015fleminin sonu\u00e7 do\u011furmas\u0131na imk\u00e2n tan\u0131yan kuralla m\u00fclkiyet hakk\u0131na getirilen s\u0131n\u0131rlaman\u0131n anayasal ba\u011flamda me\u015fru bir amaca dayand\u0131\u011f\u0131 s\u00f6ylenemez.<\/p>\n<p>Anayasa Mahkemesi a\u00e7\u0131klanan gerek\u00e7elerle kural\u0131n Anayasa\u2019ya ayk\u0131r\u0131 oldu\u011funa ve iptaline karar vermi\u015ftir.<\/p>\n<p>&#8212;&#8212;&#8212;&#8211;<\/p>\n<p>ANAYASA MAHKEMES\u0130 KARARI<\/p>\n<p>\u00a0<\/p>\n<p>Esas Say\u0131s\u0131 : 2024\/101<\/p>\n<p>Karar Say\u0131s\u0131 : 2024\/232<\/p>\n<p>Karar Tarihi : 25\/12\/2024<\/p>\n<p>R.G. Asliye Hukuk Mahkemesi<\/p>\n<p>\u0130T\u0130RAZIN KONUSU: 4\/11\/1983 tarihli ve 2942 say\u0131l\u0131 Kamula\u015ft\u0131rma Kanunu\u2019nun 24\/4\/2001 tarihli ve 4650 say\u0131l\u0131 Kanun\u2019un;<\/p>\n<p>A. 5. maddesiyle de\u011fi\u015ftirilen 10. maddesinin on d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131n\u0131n \u201c\u2026kamula\u015ft\u0131rma i\u015flemine kar\u015f\u0131 hak sahipleri taraf\u0131ndan idari yarg\u0131da iptal davas\u0131 a\u00e7\u0131lmas\u0131 ve idari yarg\u0131 mahkemelerince de y\u00fcr\u00fctmenin durdurulmas\u0131 karar\u0131 verilmesi halinde mahkemece, idari yarg\u0131da a\u00e7\u0131lan dava bekletici mesele kabul edilerek bunun sonucuna g\u00f6re i\u015flem yap\u0131l\u0131r.\u201d b\u00f6l\u00fcm\u00fcn\u00fcn,<\/p>\n<p>B. 7. maddesiyle de\u011fi\u015ftirilen 14. maddesinin alt\u0131nc\u0131 f\u0131kras\u0131n\u0131n,<\/p>\n<p>Anayasa\u2019n\u0131n 13., 35. ve 36. maddelerine ayk\u0131r\u0131l\u0131\u011f\u0131 ileri s\u00fcr\u00fclerek iptallerine karar verilmesi talebidir.<\/p>\n<p>OLAY: Kamula\u015ft\u0131rma bedelinin tespiti ile ta\u015f\u0131nmaz\u0131n idare ad\u0131na tescili davas\u0131nda itiraz konusu kurallar\u0131n Anayasa\u2019ya ayk\u0131r\u0131 oldu\u011fu kan\u0131s\u0131na varan Mahkeme, iptalleri i\u00e7in ba\u015fvurmu\u015ftur.<\/p>\n<p>I. \u0130PTAL\u0130 \u0130STENEN KANUN H\u00dcK\u00dcMLER\u0130<\/p>\n<p>Kanun\u2019un itiraz konusu kurallar\u0131n\u0131n da yer ald\u0131\u011f\u0131;<\/p>\n<p>1. 10. maddesinin on d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>\u00a0\u201c14 \u00fcnc\u00fc maddede belirtilen s\u00fcre i\u00e7inde, kamula\u015ft\u0131rma i\u015flemine kar\u015f\u0131 hak sahipleri taraf\u0131ndan idari yarg\u0131da iptal davas\u0131 a\u00e7\u0131lmas\u0131 ve idari yarg\u0131 mahkemelerince de y\u00fcr\u00fctmenin durdurulmas\u0131 karar\u0131 verilmesi halinde mahkemece, idari yarg\u0131da a\u00e7\u0131lan dava bekletici mesele kabul edilerek bunun sonucuna g\u00f6re i\u015flem yap\u0131l\u0131r.\u201d<\/p>\n<p>2. 14. maddesi \u015f\u00f6yledir:<\/p>\n<p>\u00a0\u201cDava hakk\u0131<\/p>\n<p>Madde 14 \u2013 (De\u011fi\u015fik: 24\/4\/2001 &#8211; 4650\/7 md.)<\/p>\n<p>Kamula\u015ft\u0131rmaya konu ta\u015f\u0131nmaz mal\u0131n maliki taraf\u0131ndan 10 uncu madde gere\u011fince mahkemece yap\u0131lan tebligat g\u00fcn\u00fcnden, kendilerine tebligat yap\u0131lamayanlara tebligat yerine ge\u00e7mek \u00fczere mahkemece gazete ile yap\u0131lan ilan tarihinden itibaren otuz g\u00fcn i\u00e7inde, kamula\u015ft\u0131rma i\u015flemine kar\u015f\u0131 idari yarg\u0131da iptal ve maddi hatalara kar\u015f\u0131 da adli yarg\u0131da d\u00fczeltim davas\u0131 a\u00e7\u0131labilir.<\/p>\n<p>\u0130dari yarg\u0131da a\u00e7\u0131lan davalar \u00f6ncelikle g\u00f6r\u00fcl\u00fcr.<\/p>\n<p>\u0130\u015ftirak halinde veya m\u00fc\u015fterek m\u00fclkiyette, payda\u015flar\u0131n tek ba\u015f\u0131na dava haklar\u0131 vard\u0131r.<\/p>\n<p>\u0130dare, kamula\u015ft\u0131rma belgelerinin mahkemeye verildi\u011fi g\u00fcnden itibaren otuz g\u00fcn i\u00e7inde maddi hatalara kar\u015f\u0131 adli yarg\u0131da d\u00fczeltim davas\u0131 a\u00e7abilir.<\/p>\n<p>\u0130dare taraf\u0131ndan, bu Kanun h\u00fck\u00fcmlerine g\u00f6re tespit olunan malike ve zilyede kar\u015f\u0131 a\u00e7\u0131lan davalar\u0131n g\u00f6r\u00fclmesi s\u0131ras\u0131nda, ta\u015f\u0131nmaz mal\u0131n ger\u00e7ek malikinin ba\u015fka bir \u015fah\u0131s oldu\u011fu anla\u015f\u0131ld\u0131\u011f\u0131 takdirde, davaya bu ger\u00e7ek malik, tapu malikinin daha \u00f6nce \u00f6ld\u00fc\u011f\u00fc sabit olursa miras\u00e7\u0131lar\u0131 da dahil edilmek suretiyle devam olunur.<\/p>\n<p>A\u00e7\u0131lan davalar\u0131n sonu\u00e7lar\u0131 dava a\u00e7mayanlar\u0131 etkilemez.\u201d<\/p>\n<p>II. \u0130LK \u0130NCELEME<\/p>\n<p>1. ESASIN \u0130NCELENMES\u0130<\/p>\n<p>2. Ba\u015fvuru karar\u0131 ve ekleri, Raport\u00f6r Hilal YAZICI taraf\u0131ndan haz\u0131rlanan i\u015fin esas\u0131na ili\u015fkin rapor, itiraz konusu kanun h\u00fck\u00fcmleri, dayan\u0131lan Anayasa kurallar\u0131 ve bunlar\u0131n gerek\u00e7eleri ile di\u011fer yasama belgeleri okunup incelendikten sonra gere\u011fi g\u00f6r\u00fc\u015f\u00fcl\u00fcp d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. Maddesinin On D\u00f6rd\u00fcnc\u00fc F\u0131kras\u0131n\u0131n \u201c\u2026kamula\u015ft\u0131rma i\u015flemine kar\u015f\u0131 hak sahipleri taraf\u0131ndan idari yarg\u0131da iptal davas\u0131 a\u00e7\u0131lmas\u0131 ve idari yarg\u0131 mahkemelerince de y\u00fcr\u00fctmenin durdurulmas\u0131 karar\u0131 verilmesi halinde mahkemece, idari yarg\u0131da a\u00e7\u0131lan dava bekletici mesele kabul edilerek bunun sonucuna g\u00f6re i\u015flem yap\u0131l\u0131r.\u201d B\u00f6l\u00fcm\u00fcn\u00fcn \u0130ncelenmesi<\/p>\n<p>1. Anlam ve Kapsam<\/p>\n<p>3. 2942 say\u0131l\u0131 Kanun\u2019un 10. maddesinde kamula\u015ft\u0131rma i\u015fleminin sat\u0131n alma usul\u00fcyle ger\u00e7ekle\u015fmemesi h\u00e2linde mahkemece ta\u015f\u0131nmaz mal\u0131n kamula\u015ft\u0131rma bedelinin tespiti ile idare ad\u0131na tescili d\u00fczenlenmektedir.<\/p>\n<p>4. An\u0131lan maddenin birinci f\u0131kras\u0131na g\u00f6re idare, s\u00f6z konusu Kanun\u2019un 7. maddesinde \u00f6ng\u00f6r\u00fclen usulde toplad\u0131\u011f\u0131 bilgi ve belgelerle Kanun\u2019un 8. maddesi uyar\u0131nca yapt\u0131rm\u0131\u015f oldu\u011fu bedel tespiti ve bu husustaki di\u011fer bilgi ve belgeleri bir dilek\u00e7eye ekleyerek ta\u015f\u0131nmaz mal\u0131n bulundu\u011fu yer asliye hukuk mahkemesine m\u00fcracaat eder ve ta\u015f\u0131nmaz mal\u0131n kamula\u015ft\u0131rma bedelinin tespitiyle bu bedelin pe\u015fin veya 3. maddenin ikinci f\u0131kras\u0131na g\u00f6re yap\u0131lm\u0131\u015f ise taksitle \u00f6denmesi kar\u015f\u0131l\u0131\u011f\u0131nda idare ad\u0131na tesciline karar verilmesini ister.<\/p>\n<p>5. 10. maddenin ikinci f\u0131kras\u0131nda, mahkemenin idarenin ba\u015fvuru tarihinden itibaren en ge\u00e7 otuz g\u00fcn sonras\u0131 i\u00e7in belirlenen duru\u015fma g\u00fcn\u00fcn\u00fc dava dilek\u00e7esi ve idare taraf\u0131ndan verilen belgelerin birer \u00f6rne\u011fini de ekleyerek ta\u015f\u0131nmaz mal\u0131n malikine me\u015fruhatl\u0131 davetiyeyle veya adresleri bulunamayanlara ilan yoluyla tebligat suretiyle bildirerek duru\u015fmaya kat\u0131lmaya \u00e7a\u011f\u0131raca\u011f\u0131 belirtilmi\u015ftir. An\u0131lan maddenin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131n\u0131n (f) bendinde ise me\u015fruhatl\u0131 davetiye ile 14. maddede \u00f6ng\u00f6r\u00fclen s\u00fcre i\u00e7erisinde kamula\u015ft\u0131rma i\u015flemine kar\u015f\u0131 idari yarg\u0131da iptal davas\u0131 a\u00e7anlar\u0131n dava a\u00e7t\u0131klar\u0131n\u0131 ve y\u00fcr\u00fctmenin durdurulmas\u0131 karar\u0131 ald\u0131klar\u0131n\u0131 belgelendirmedikleri takdirde kamula\u015ft\u0131rma i\u015fleminin kesinle\u015fece\u011fi ve mahkemece tespit edilen kamula\u015ft\u0131rma bedeli \u00fczerinden ta\u015f\u0131nmaz mal\u0131n kamula\u015ft\u0131rma yapan idare ad\u0131na tescil edilece\u011finin hak sahiplerine bildirilece\u011fi d\u00fczenlenmi\u015ftir.<\/p>\n<p>6. 10. maddenin be\u015finci f\u0131kras\u0131nda ise mahkemece belirlenen g\u00fcnde yap\u0131lacak duru\u015fmada h\u00e2kimin ta\u015f\u0131nmaz mal\u0131n bedeli konusunda taraflar\u0131 anla\u015fmaya davet edece\u011fi, anla\u015fman\u0131n sa\u011flanamamas\u0131 h\u00e2linde an\u0131lan maddenin sekizinci f\u0131kras\u0131n\u0131n ikinci ve devam\u0131 c\u00fcmleleri uyar\u0131nca i\u015flem yapaca\u011f\u0131 belirtilmi\u015ftir.<\/p>\n<p>7. Sekizinci f\u0131kraya g\u00f6re idarece, kamula\u015ft\u0131rma bedelinin hak sahibi ad\u0131na yat\u0131r\u0131ld\u0131\u011f\u0131na, h\u00e2kim taraf\u0131ndan kamula\u015ft\u0131rma bedeli olarak tespit edilen bedelin veya hak sahibinin tespit edilemedi\u011fi durumlarda ise ileride ortaya \u00e7\u0131kacak hak sahibine verilmek \u00fczere bloke edildi\u011fine dair makbuzun ibraz\u0131 h\u00e2linde mahkemece, ta\u015f\u0131nmaz mal\u0131n idare ad\u0131na tesciline ve kamula\u015ft\u0131rma bedelinin hak sahibine \u00f6denmesine karar verilecek ve bu karar, tapu dairesine ve paran\u0131n yat\u0131r\u0131ld\u0131\u011f\u0131 bankaya bildirilecektir. An\u0131lan f\u0131kraya g\u00f6re ayr\u0131ca tescil h\u00fckm\u00fc kesin olup taraflar\u0131n bedele ili\u015fkin istinaf veya temyiz haklar\u0131 sakl\u0131d\u0131r.<\/p>\n<p>8. 25. maddenin birinci f\u0131kras\u0131nda kamula\u015ft\u0131r\u0131lan ta\u015f\u0131nmaz\u0131n m\u00fclkiyetinin idareye ge\u00e7mesinin mahkemece verilen tescil karar\u0131yla olaca\u011f\u0131 belirtilmi\u015ftir.<\/p>\n<p>9. 14. maddede kamula\u015ft\u0131rma i\u015flemine ili\u015fkin dava hakk\u0131 d\u00fczenlenmi\u015ftir. An\u0131lan maddenin birinci f\u0131kras\u0131nda kamula\u015ft\u0131rmaya konu ta\u015f\u0131nmaz mal\u0131n maliki taraf\u0131ndan 10. madde gere\u011fince mahkemece yap\u0131lan tebligat g\u00fcn\u00fcnden, kendilerine tebligat yap\u0131lamayanlara tebligat yerine ge\u00e7mek \u00fczere mahkemece gazeteyle yap\u0131lan ilan tarihinden itibaren otuz g\u00fcn i\u00e7inde kamula\u015ft\u0131rma i\u015flemine kar\u015f\u0131 idari yarg\u0131da iptal davas\u0131 ve maddi hatalara kar\u015f\u0131 da adli yarg\u0131da d\u00fczeltim davas\u0131 a\u00e7\u0131labilece\u011fi; ikinci f\u0131kras\u0131nda idari yarg\u0131da a\u00e7\u0131lan davalar\u0131n \u00f6ncelikle g\u00f6r\u00fclece\u011fi h\u00fckme ba\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>10. 10. maddenin on d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131nda ise 14. maddede belirtilen s\u00fcrede, kamula\u015ft\u0131rma i\u015flemine kar\u015f\u0131 hak sahipleri taraf\u0131ndan idari yarg\u0131da iptal davas\u0131 a\u00e7\u0131lmas\u0131 ve idari yarg\u0131 mahkemelerince de y\u00fcr\u00fctmenin durdurulmas\u0131 karar\u0131 verilmesi h\u00e2linde mahkemece, idari yarg\u0131da a\u00e7\u0131lan davan\u0131n bekletici mesele kabul edilerek bunun sonucuna g\u00f6re i\u015flem yap\u0131laca\u011f\u0131 belirtilmi\u015ftir. Ba\u015fvuru karar\u0131nda \u00f6zetle; itiraz konusu kuralla kamula\u015ft\u0131rma i\u015flemine kar\u015f\u0131 idari yarg\u0131da a\u00e7\u0131lan davada y\u00fcr\u00fctmenin durdurulmas\u0131 karar\u0131 verilmemesi h\u00e2linde bu davan\u0131n kamula\u015ft\u0131rma bedelinin tespiti ve tescil davas\u0131nda bekletici mesele yap\u0131lamayaca\u011f\u0131n\u0131n d\u00fczenlendi\u011fi, dolay\u0131s\u0131yla hukuk mahkemesinde g\u00f6r\u00fclen davan\u0131n idari yarg\u0131da g\u00f6r\u00fclen davadan \u00f6nce sonu\u00e7lanmas\u0131 h\u00e2linde hak kay\u0131plar\u0131n\u0131n ortaya \u00e7\u0131kabilece\u011fi, zira bedel tespiti ve tescil davas\u0131nda tescile ili\u015fkin karar\u0131n kesin nitelikte oldu\u011fu, ki\u015filerin kamula\u015ft\u0131rma i\u015fleminin iptali h\u00e2linde kamula\u015ft\u0131r\u0131lan ta\u015f\u0131nmazla ilgili yolsuz tescil davas\u0131 a\u00e7ma imk\u00e2nlar\u0131 olsa dahi bu durumun ki\u015filer a\u00e7\u0131s\u0131ndan a\u015f\u0131r\u0131 bir k\u00fclfete neden olaca\u011f\u0131 belirtilerek kural\u0131n Anayasa\u2019n\u0131n 13., 35. ve 36. maddelerine ayk\u0131r\u0131 oldu\u011funu ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>3. Anayasa\u2019ya Ayk\u0131r\u0131l\u0131k Sorunu<\/p>\n<p>12. 30\/3\/2011 tarihli ve 6216 say\u0131l\u0131 Anayasa Mahkemesinin Kurulu\u015fu ve Yarg\u0131lama Usulleri Hakk\u0131nda Kanun\u2019un 43. maddesi uyar\u0131nca kural, ilgisi nedeniyle Anayasa\u2019n\u0131n 40. maddesi y\u00f6n\u00fcnden de incelenmi\u015ftir.<\/p>\n<p>13. Anayasa\u2019n\u0131n 35. maddesinde \u201cHerkes, m\u00fclkiyet ve miras haklar\u0131na sahiptir.\/ Bu haklar, ancak kamu yarar\u0131 amac\u0131yla, kanunla s\u0131n\u0131rlanabilir.\/ M\u00fclkiyet hakk\u0131n\u0131n kullan\u0131lmas\u0131 toplum yarar\u0131na ayk\u0131r\u0131 olamaz.\u201d denilmek suretiyle m\u00fclkiyet hakk\u0131 g\u00fcvenceye ba\u011flanm\u0131\u015ft\u0131r. M\u00fclkiyet hakk\u0131 ekonomik de\u011fer ifade eden ve de\u011feri parayla \u00f6l\u00e7\u00fclebilen her t\u00fcrl\u00fc mal varl\u0131\u011f\u0131 hakk\u0131n\u0131 kapsamaktad\u0131r. M\u00fclkiyet hakk\u0131; ki\u015fiye ba\u015fkas\u0131n\u0131n hakk\u0131na zarar vermemek ve kanunlar\u0131n koydu\u011fu s\u0131n\u0131rlamalara uymak ko\u015fuluyla sahibi oldu\u011fu \u015feyi diledi\u011fi gibi kullanma, semerelerinden yararlanma ve tasarruf etme imk\u00e2n\u0131 veren bir hakt\u0131r (AYM, E.2021\/128, K.2022\/68, 1\/6\/2022, \u00a7\u00a7 17, 18).<\/p>\n<p>14. Anayasa\u2019n\u0131n 40. maddesinin birinci f\u0131kras\u0131nda \u201cAnayasa ile tan\u0131nm\u0131\u015f hak ve h\u00fcrriyetleri ihl\u00e2l edilen herkes, yetkili makama geciktirilmeden ba\u015fvurma imk\u00e2n\u0131n\u0131n sa\u011flanmas\u0131n\u0131 isteme hakk\u0131na sahiptir.\u201d denilmi\u015ftir. An\u0131lan h\u00fckme g\u00f6re ki\u015filerin yarg\u0131 makamlar\u0131 ile idari makamlar \u00f6n\u00fcnde haklar\u0131n\u0131 arayabilmelerine kolayl\u0131k ve imk\u00e2n sa\u011flanmas\u0131 anayasal bir zorunluluktur. Bu zorunluluk, temel hak ve \u00f6zg\u00fcrl\u00fc\u011f\u00fc ihlal edilen ya da ihlal edildi\u011fini iddia eden ki\u015filerin ilgili yarg\u0131 veya idari merciler nezdinde \u015fik\u00e2yetlerini dile getirmesi hususunda devlete gerekli ve yeterli mekanizmalar\u0131 olu\u015fturarak uygun ko\u015fullar\u0131 sa\u011flama y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc getirmektedir (AYM, E.2019\/102, K.2019\/99, 25\/12\/2019, \u00a7 16).<\/p>\n<p>15. Bu \u00e7er\u00e7evede Anayasa\u2019n\u0131n an\u0131lan maddesinde g\u00fcvence alt\u0131na al\u0131nan etkili ba\u015fvuru hakk\u0131; anayasal bir hakk\u0131n\u0131n ihlal edildi\u011fini ileri s\u00fcren herkese hakk\u0131n niteli\u011fine uygun olarak iddialar\u0131n\u0131 inceletebilece\u011fi makul, eri\u015filebilir, etkili, ihlalin ger\u00e7ekle\u015fmesini veya s\u00fcrmesini engellemeye ya da sonu\u00e7lar\u0131n\u0131 ortadan kald\u0131rmaya elveri\u015fli idari ve yarg\u0131sal yollara ba\u015fvuruda bulunabilme imk\u00e2n\u0131n\u0131n sa\u011flanmas\u0131n\u0131 g\u00fcvence alt\u0131na almaktad\u0131r (AYM, E.2023\/167, K.2024\/115, 30\/5\/2024, \u00a7 32; E.2020\/30, K.2023\/12, 25\/1\/2023, \u00a7 186; E.2018\/74, K.2019\/92, 24\/12\/2019, \u00a7 31).<\/p>\n<p>16. Kural idare mahkemesinde g\u00f6r\u00fclen iptal davas\u0131nda y\u00fcr\u00fctmenin durdurulmas\u0131 karar\u0131 verilmesi h\u00e2linde s\u00f6z konusu davan\u0131n hukuk mahkemesinde g\u00f6r\u00fclen kamula\u015ft\u0131rma bedelinin tespiti ve ta\u015f\u0131nmaz\u0131n idare ad\u0131na tesciline ili\u015fkin davada bekletici mesele yap\u0131lmas\u0131n\u0131 zorunlu k\u0131lmaktad\u0131r.<\/p>\n<p>17. Dolay\u0131s\u0131yla kurala g\u00f6re kamula\u015ft\u0131rma i\u015fleminin iptaline ili\u015fkin davada y\u00fcr\u00fctmenin durdurulmas\u0131 karar\u0131n\u0131n verilmemesi h\u00e2linde hukuk mahkemesinin yarg\u0131lamaya devam ederek kamula\u015ft\u0131rma bedelinin tespitine ve ta\u015f\u0131nmaz\u0131n idare ad\u0131na tesciline karar vermesi s\u00f6z konusu olabilmektedir.<\/p>\n<p>18. \u00d6te yandan iptal davas\u0131n\u0131n bekletici mesele yap\u0131lmas\u0131 hususunda 12\/1\/2011 tarihli ve 6100 say\u0131l\u0131 Hukuk Muhakemeleri Kanunu\u2019nun 165. maddesinde d\u00fczenlenen \u201cBekletici sorun\u201d m\u00fcessesesinin hukuk mahkemesince uygulanma imk\u00e2n\u0131n\u0131n bulundu\u011fu d\u00fc\u015f\u00fcn\u00fclse dahi bu h\u00fckm\u00fcn zorlay\u0131c\u0131 nitelikte olmad\u0131\u011f\u0131, bu bak\u0131mdan g\u00fcvence te\u015fkil etmedi\u011fi a\u00e7\u0131kt\u0131r.<\/p>\n<p>19. Ayr\u0131ca 2942 say\u0131l\u0131 Kanun\u2019un \u201cDava hakk\u0131\u201d ba\u015fl\u0131kl\u0131 14. maddesinin \u201c\u0130dari yarg\u0131da a\u00e7\u0131lan davalar \u00f6ncelikle g\u00f6r\u00fcl\u00fcr.\u201d \u015feklindeki ikinci f\u0131kras\u0131 h\u00fckm\u00fc de idari yarg\u0131daki iptal davas\u0131n\u0131n adli yarg\u0131da g\u00f6r\u00fclen bedel tespiti ve tescil davas\u0131ndan \u00f6nce karara ba\u011flanmas\u0131n\u0131 garanti etmemektedir.<\/p>\n<p>20. Bu itibarla hak sahibinin an\u0131lan Kanun\u2019un 14. maddesinde belirtilen \u015fekilde kamula\u015ft\u0131rma i\u015flemine kar\u015f\u0131 a\u00e7t\u0131\u011f\u0131 iptal davas\u0131nda y\u00fcr\u00fctmenin durdurulmas\u0131 karar\u0131 verilmemesi h\u00e2linde bu davan\u0131n kamula\u015ft\u0131rma bedelinin tespiti ve tescil davas\u0131nda bekletici mesele yap\u0131lmamas\u0131 ve hukuk mahkemesince de davan\u0131n iptal davas\u0131ndan \u00f6nce karara ba\u011flanmas\u0131 m\u00fcmk\u00fcnd\u00fcr. Bu durumda bedel tespitine ve ta\u015f\u0131nmaz\u0131n idare ad\u0131na tesciline h\u00fckmedilmesi nedeniyle kamula\u015ft\u0131rma i\u015flemine kar\u015f\u0131 sonradan verilen bir iptal karar\u0131n\u0131n bedel tespiti ve tescil karar\u0131 \u00fczerinde herhangi bir etkisinin olmayaca\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>21. Kanun\u2019un 10. maddesinin sekizinci f\u0131kras\u0131nda ise hukuk mahkemesince verilen tescil h\u00fckm\u00fcn\u00fcn kesin oldu\u011fu, 25. maddesinin birinci f\u0131kras\u0131nda da m\u00fclkiyetin mahkemece verilen tescil karar\u0131 ile idareye ge\u00e7ece\u011fi h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Bu bak\u0131mdan, kamula\u015ft\u0131rma i\u015fleminin hukuka ayk\u0131r\u0131 bulunarak iptal edilmesi h\u00e2linde tespit ve tescil karar\u0131n\u0131n hukuki dayana\u011f\u0131n\u0131n ortadan kalkmas\u0131na ra\u011fmen ta\u015f\u0131nmaz\u0131n m\u00fclkiyetinin idareye ge\u00e7mesi s\u00f6z konusu olabilecektir.<\/p>\n<p>22. Anayasa Mahkemesinin bireysel ba\u015fvuru kapsam\u0131nda verdi\u011fi kararlar\u0131nda da belirtildi\u011fi \u00fczere Kanun\u2019un 10. maddesinin on d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131 uyar\u0131nca kamula\u015ft\u0131rma i\u015fleminin iptali talebiyle a\u00e7\u0131lan davada y\u00fcr\u00fctmeyi durdurma karar\u0131 verilmesi h\u00e2linde an\u0131lan davan\u0131n adli yarg\u0131 mercilerince bekletici mesele yap\u0131lmas\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015f ise de y\u00fcr\u00fctmeyi durdurma karar\u0131n\u0131n makul bir s\u00fcre i\u00e7inde verilmemesi veya y\u00fcr\u00fctmeyi durdurma talebinin reddedilmesi h\u00e2linde davan\u0131n esastan kabul edilmek suretiyle kamula\u015ft\u0131rma i\u015fleminin iptal edilmesi de m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>23. Bu ba\u011flamda adli yarg\u0131da a\u00e7\u0131lan kamula\u015ft\u0131rma bedelinin tespiti ile tescil davas\u0131n\u0131n kamula\u015ft\u0131rma i\u015fleminin iptali talebiyle idari yarg\u0131da a\u00e7\u0131lan davan\u0131n sonucu beklenmeksizin neticelenmesi durumunda idari yarg\u0131 mercilerince verilen iptal karar\u0131n\u0131n sonu\u00e7 do\u011furmas\u0131 i\u00e7in malik belli k\u00fclfetlere katlanmak zorunda kalabilmektedir. Ba\u015fka bir ifadeyle kamula\u015ft\u0131rma i\u015fleminin hukuka uygunlu\u011funun denetimi ile kamula\u015ft\u0131rma bedelinin tespitinin farkl\u0131 yarg\u0131 kollar\u0131nda ger\u00e7ekle\u015ftirilmesi an\u0131lan i\u015flemin hukuka uygunlu\u011funa ili\u015fkin denetimin etkilili\u011fini zedeleyebilmektedir. Dolay\u0131s\u0131yla kamula\u015ft\u0131rma ba\u011flam\u0131ndaki uyu\u015fmazl\u0131klar\u0131n farkl\u0131 yarg\u0131 kollar\u0131nda karara ba\u011flanmas\u0131, idari yarg\u0131da g\u00f6r\u00fclen davan\u0131n adli yarg\u0131 mercilerince bekletici mesele yap\u0131lmas\u0131n\u0131n ise y\u00fcr\u00fctmeyi durdurma karar\u0131 verilmesi durumuna \u00f6zg\u00fclenmesi nedeniyle m\u00fclkiyet hakk\u0131n\u0131 g\u00fcvence alt\u0131na alan etkili bir y\u00f6ntemin geli\u015ftirilemedi\u011fi ve yap\u0131sal bir sorunun bulundu\u011fu anla\u015f\u0131lmaktad\u0131r (bu y\u00f6ndeki de\u011ferlendirmeler i\u00e7in bkz. Kamula\u015ft\u0131rma i\u015flemine kar\u015f\u0131 iptal davas\u0131n\u0131n a\u00e7\u0131lmas\u0131 kamula\u015ft\u0131rmaya konu ta\u015f\u0131nmaz\u0131n m\u00fclkiyetinin korunmas\u0131 amac\u0131n\u0131 ta\u015f\u0131maktad\u0131r. Bu kapsamda kamula\u015ft\u0131rma i\u015flemiyle m\u00fclkiyet hakk\u0131na y\u00f6nelik olarak meydana gelen m\u00fcdahaleye ili\u015fkin ihlal iddialar\u0131n\u0131n etkili bir \u015fekilde ileri s\u00fcr\u00fclebilmesi de ancak kamula\u015ft\u0131rma s\u00fcrecinin kesinle\u015fmesinden \u00f6nce bu karar\u0131n hukuka uygunlu\u011funun idari yarg\u0131 mercilerince denetlenmesiyle m\u00fcmk\u00fcn olabilecektir.<\/p>\n<p>25. Anayasa\u2019ya Ayk\u0131r\u0131l\u0131k Sorunu<\/p>\n<p>31. 6216 say\u0131l\u0131 Kanun\u2019un 43. maddesi uyar\u0131nca kural, ilgisi nedeniyle Anayasa\u2019n\u0131n 46. maddesi y\u00f6n\u00fcnden de incelenmi\u015ftir.<\/p>\n<p>32. Kurala g\u00f6re payl\u0131 veya elbirli\u011fi \u015feklinde m\u00fclkiyete konu olan ta\u015f\u0131nmazlarda kamula\u015ft\u0131rma i\u015flemi yap\u0131ld\u0131\u011f\u0131 takdirde, hissedarlar\u0131n i\u015fleme kar\u015f\u0131 a\u00e7t\u0131klar\u0131 kamula\u015ft\u0131rman\u0131n iptali veya maddi hatalara ili\u015fkin d\u00fczeltim davalar\u0131nda verilen kararlar dava a\u00e7mayan hissedarlar bak\u0131m\u0131ndan herhangi bir sonu\u00e7 do\u011furmayacakt\u0131r. B\u00f6ylece dava a\u00e7mayan hissedarlar\u0131n m\u00fclkiyetinde olan ta\u015f\u0131nmaz \u00fczerinde kamula\u015ft\u0131rma i\u015flemi sonu\u00e7lar\u0131n\u0131 do\u011furabilmektedir. Buna g\u00f6re kuralla, belirtilen m\u00fclkiyet t\u00fcrlerinde hissedarlardan birinin veya bir k\u0131sm\u0131n\u0131n a\u00e7t\u0131\u011f\u0131 davalarda \u00f6zellikle lehe karar verilmesi h\u00e2linde karar\u0131n dava a\u00e7mayan hissedarlar y\u00f6n\u00fcnden sonu\u00e7 do\u011furmamas\u0131 \u00f6ng\u00f6r\u00fclmek suretiyle bu ki\u015filerin m\u00fclkiyet hakk\u0131na y\u00f6nelik s\u0131n\u0131rlama getirilmektedir.<\/p>\n<p>33. Anayasa\u2019n\u0131n 35. maddesinde m\u00fclkiyet hakk\u0131n\u0131n kamu yarar\u0131 amac\u0131yla ve kanunla s\u0131n\u0131rlanabilece\u011fi \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. M\u00fclkiyet hakk\u0131na m\u00fcdahalede bulunulurken temel hak ve \u00f6zg\u00fcrl\u00fcklerin s\u0131n\u0131rlanmas\u0131na ili\u015fkin ilkeleri d\u00fczenleyen Anayasa\u2019n\u0131n 13. maddesinin de g\u00f6z\u00f6n\u00fcnde bulundurulmas\u0131 gerekmektedir.<\/p>\n<p>34. Anayasa\u2019n\u0131n an\u0131lan maddesinde \u201cTemel hak ve h\u00fcrriyetler, \u00f6zlerine dokunulmaks\u0131z\u0131n yaln\u0131zca Anayasan\u0131n ilgili maddelerinde belirtilen sebeplere ba\u011fl\u0131 olarak ve ancak kanunla s\u0131n\u0131rlanabilir. Bu s\u0131n\u0131rlamalar, Anayasan\u0131n s\u00f6z\u00fcne ve ruhuna, demokratik toplum d\u00fczeninin ve l\u00e2ik Cumhuriyetin gereklerine ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olamaz.\u201d denilmektedir.<\/p>\n<p>35. Anayasa\u2019n\u0131n an\u0131lan maddesi uyar\u0131nca m\u00fclkiyet hakk\u0131, Anayasa\u2019da \u00f6ng\u00f6r\u00fclen nedenlere ba\u011fl\u0131 olarak ancak kanunla s\u0131n\u0131rlanabilir.<\/p>\n<p>36. Anayasa Mahkemesinin s\u0131k\u00e7a vurgulad\u0131\u011f\u0131 gibi temel haklar\u0131 s\u0131n\u0131rlayan kanunun \u015feklen var olmas\u0131 yeterli olmay\u0131p yasal kurallar\u0131n keyf\u00eeli\u011fe izin vermeyecek \u015fekilde belirli, ula\u015f\u0131labilir ve \u00f6ng\u00f6r\u00fclebilir d\u00fczenlemeler niteli\u011finde olmas\u0131 gerekir.<\/p>\n<p>37. Esasen temel haklar\u0131 s\u0131n\u0131rlayan kanunun bu niteliklere sahip olmas\u0131, Anayasa\u2019n\u0131n 2. maddesinde g\u00fcvenceye al\u0131nan hukuk devleti ilkesinin de bir gere\u011fidir. Hukuk devletinin temel unsurlar\u0131ndan olan hukuki belirlilik ilkesi uyar\u0131nca kanuni d\u00fczenlemelerin hem ki\u015filer hem de idare y\u00f6n\u00fcnden herhangi bir duraksamaya ve ku\u015fkuya yer vermeyecek \u015fekilde a\u00e7\u0131k, net, anla\u015f\u0131l\u0131r, uygulanabilir ve nesnel olmas\u0131, ayr\u0131ca kamu otoritelerinin keyf\u00ee uygulamalar\u0131na kar\u015f\u0131 koruyucu \u00f6nlem i\u00e7ermesi gerekir. Kanunda bulunmas\u0131 gereken bu nitelikler hukuki g\u00fcvenli\u011fin sa\u011flanmas\u0131 bak\u0131m\u0131ndan da zorunludur. Zira bu ilke hukuk normlar\u0131n\u0131n \u00f6ng\u00f6r\u00fclebilir olmas\u0131n\u0131, bireylerin t\u00fcm eylem ve i\u015flemlerinde devlete g\u00fcven duyabilmesini, devletin de yasal d\u00fczenlemelerinde bu g\u00fcven duygusunu zedeleyici y\u00f6ntemlerden ka\u00e7\u0131nmas\u0131n\u0131 gerekli k\u0131lar (AYM, E.2015\/41, K.2017\/98, 4\/5\/2017, \u00a7\u00a7 153, 154). Dolay\u0131s\u0131yla Anayasa\u2019n\u0131n 13. ve 35. maddelerinde s\u0131n\u0131rlama \u00f6l\u00e7\u00fct\u00fc olarak belirtilen kanunilik, Anayasa\u2019n\u0131n 2. maddesinde g\u00fcvenceye al\u0131nan hukuk devleti ilkesi \u0131\u015f\u0131\u011f\u0131nda yorumlanmal\u0131d\u0131r.<\/p>\n<p>38. Kural, a\u00e7\u0131lan davalar\u0131n sonu\u00e7lar\u0131n\u0131n dava a\u00e7mayanlar\u0131 etkilemeyece\u011fini d\u00fczenlemektedir. Kural\u0131n yer ald\u0131\u011f\u0131 14. maddede maliklerin ve idarenin a\u00e7aca\u011f\u0131 davalar\u0131n hangileri oldu\u011fu belirtilmi\u015ftir. An\u0131lan maddenin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda ise i\u015ftirak h\u00e2linde veya m\u00fc\u015fterek m\u00fclkiyette payda\u015flar\u0131n tek ba\u015f\u0131na dava haklar\u0131n\u0131n oldu\u011fu d\u00fczenlenmi\u015ftir. Dolay\u0131s\u0131yla payda\u015flar\u0131n a\u00e7aca\u011f\u0131 iptal veya maddi hatalar\u0131n d\u00fczeltilmesi davalar\u0131n\u0131n sonu\u00e7lar\u0131n\u0131n dava a\u00e7mayan payda\u015flar y\u00f6n\u00fcnden sonu\u00e7 do\u011furmayaca\u011f\u0131 hususunda teredd\u00fct bulunmad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Bu kapsamda kural\u0131n herhangi bir belirsizlik i\u00e7ermedi\u011fi, ula\u015f\u0131labilir ve \u00f6ng\u00f6r\u00fclebilir nitelikte oldu\u011fu a\u00e7\u0131kt\u0131r.<\/p>\n<p>39. Anayasa\u2019n\u0131n 35. maddesi uyar\u0131nca m\u00fclkiyet hakk\u0131 kamu yarar\u0131 amac\u0131yla s\u0131n\u0131rland\u0131r\u0131labilmektedir. \u00d6te yandan ta\u015f\u0131nmazdan yoksun b\u0131rakma \u015feklindeki m\u00fclkiyet hakk\u0131na y\u00f6nelik a\u011f\u0131r bir s\u0131n\u0131rlama say\u0131labilecek kamula\u015ft\u0131rma i\u015flemi Anayasa\u2019n\u0131n 46. maddesinde \u00f6zel birtak\u0131m g\u00fcvenceler \u00f6ng\u00f6r\u00fclerek d\u00fczenlenmi\u015ftir. An\u0131lan maddenin birinci f\u0131kras\u0131nda \u201cDevlet ve kamu t\u00fczelki\u015fileri, kamu yarar\u0131n\u0131n gerektirdi\u011fi hallerde, kar\u015f\u0131l\u0131klar\u0131n\u0131 pe\u015fin \u00f6demek \u015fart\u0131yla, \u00f6zel m\u00fclkiyette bulunan ta\u015f\u0131nmaz mallar\u0131n tamam\u0131n\u0131 veya bir k\u0131sm\u0131n\u0131, kanunla g\u00f6sterilen esas ve usullere g\u00f6re, kamula\u015ft\u0131rmaya ve bunlar \u00fczerinde idari irtifaklar kurmaya yetkilidir\u201d denilmektedir. Buna g\u00f6re kamula\u015ft\u0131rma ancak kamu yarar\u0131n\u0131n gerektirdi\u011fi h\u00e2llerde kanunla g\u00f6sterilen usul ve esaslara uygun olarak ve kar\u015f\u0131l\u0131\u011f\u0131 pe\u015fin \u00f6denmek \u015fart\u0131yla devlet veya kamu t\u00fczel ki\u015filiklerince yap\u0131labilir.<\/p>\n<p>40. 2942 say\u0131l\u0131 Kanun\u2019un 14. maddesinin d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131nda i\u015ftirak h\u00e2linde veya m\u00fc\u015fterek m\u00fclkiyette, hak sahiplerinin tek ba\u015f\u0131na dava haklar\u0131n\u0131n bulundu\u011fu h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Esasen s\u00f6z konusu m\u00fclkiyet bi\u00e7imlerinde -fiil\u00ee bir payla\u015f\u0131m yap\u0131lmam\u0131\u015fsa- kamula\u015ft\u0131r\u0131lan ta\u015f\u0131nmazda hissedar\u0131n zeminde fiilen hak sahibi oldu\u011fu yerin hangi k\u0131sm\u0131na kar\u015f\u0131l\u0131k geldi\u011fi belli de\u011fildir. Ba\u015fka bir ifadeye fiilen ta\u015f\u0131nmaz\u0131n taksim edilmedi\u011fi h\u00e2llerde her bir hissedar ta\u015f\u0131nmaz\u0131n tamam\u0131 \u00fczerinde tasarruf yetkisine sahiptir.<\/p>\n<p>41. Bunun yan\u0131nda kamula\u015ft\u0131rma i\u015flemi ta\u015f\u0131nmaz\u0131n tamam\u0131 ya da bir k\u0131sm\u0131 \u00fczerinde ger\u00e7ekle\u015fse de her bir hissedar\u0131n s\u00f6z konusu i\u015flem nedeniyle hakk\u0131 etkilenmektedir. Bu y\u00f6n\u00fcyle kamula\u015ft\u0131rma i\u015fleminin hukuka ayk\u0131r\u0131 oldu\u011fu gerek\u00e7esiyle iptal edilmesiyle birlikte mahkemenin hukuka ayk\u0131r\u0131l\u0131k tespiti dava a\u00e7an ya da a\u00e7mayan kamula\u015ft\u0131rmaya konu ta\u015f\u0131nmaz\u0131n t\u00fcm hissedarlar\u0131 bak\u0131m\u0131ndan ge\u00e7erli olmaktad\u0131r. Nitekim bu husus iptal davas\u0131n\u0131n amac\u0131yla da yak\u0131ndan ilgilidir. Zira iptal davas\u0131yla hukuka ayk\u0131r\u0131 olan idari i\u015flemin do\u011fdu\u011fu anda etki etti\u011fi alan\u0131n tamam\u0131 bak\u0131m\u0131ndan ge\u00e7ersiz k\u0131l\u0131nmas\u0131 sa\u011flan\u0131r.<\/p>\n<p>42. Esas itibar\u0131yla Kanun\u2019un 14. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda yer verilen \u201c\u0130\u015ftirak halinde veya m\u00fc\u015fterek m\u00fclkiyette, payda\u015flar\u0131n tek ba\u015f\u0131na dava haklar\u0131 vard\u0131r.\u201d h\u00fckm\u00fc de g\u00f6zetildi\u011finde, kanun koyucunun, belirtilen m\u00fclkiyet bi\u00e7imleri kapsam\u0131nda zorunlu dava arkada\u015fl\u0131\u011f\u0131 m\u00fcessesine kamula\u015ft\u0131rma bak\u0131m\u0131ndan bir istisna getirdi\u011fi g\u00f6r\u00fclmektedir. Nitekim ortada tek bir idari i\u015flem oldu\u011fundan hak sahiplerinden birinin a\u00e7aca\u011f\u0131 davan\u0131n bu i\u015flemin hukuka uygun olup olmad\u0131\u011f\u0131n\u0131n de\u011ferlendirilmesi bak\u0131m\u0131ndan yeterli olaca\u011f\u0131 a\u00e7\u0131kt\u0131r. Bu bak\u0131mdan verilen karar\u0131n dava a\u00e7mayan hissedarlar\u0131n da malik oldu\u011fu kamula\u015ft\u0131r\u0131lan ta\u015f\u0131nmaz \u00fczerinde sonu\u00e7 do\u011furaca\u011f\u0131 hususunda \u015f\u00fcphe bulunmamaktad\u0131r.<\/p>\n<p>43. Ancak kural, yarg\u0131 mercilerinin iptal karar\u0131yla birlikte kamula\u015ft\u0131rma i\u015fleminin kanuni dayanaktan yoksun h\u00e2le geldi\u011fi tespit edilmesine ra\u011fmen maliklerin m\u00fclk\u00fc \u00fczerinde sonu\u00e7 do\u011furmaya devam etmesine neden olmakta, anayasal veya yasal ko\u015fullar\u0131 sa\u011flamad\u0131\u011f\u0131 i\u00e7in iptal edilen kamula\u015ft\u0131rma i\u015flemini dava a\u00e7mayan payda\u015flar y\u00f6n\u00fcnden ge\u00e7erli k\u0131lmaktad\u0131r. Bu bak\u0131mdan anayasal g\u00fcvenceleri kar\u015f\u0131lamad\u0131\u011f\u0131 gerek\u00e7esiyle iptal edilen kamula\u015ft\u0131rma i\u015fleminin sonu\u00e7 do\u011furmas\u0131na imk\u00e2n tan\u0131yan kuralla m\u00fclkiyet hakk\u0131na getirilen s\u0131n\u0131rlaman\u0131n anayasal ba\u011flamda me\u015fru bir amaca dayand\u0131\u011f\u0131 s\u00f6ylenemez.<\/p>\n<p>44. A\u00e7\u0131klanan nedenle kural, Anayasa\u2019n\u0131n 13., 35. ve 46. maddelerine ayk\u0131r\u0131d\u0131r. \u0130ptali gerekir.<\/p>\n<p>Kural\u0131n, Anayasa\u2019n\u0131n 36. maddesiyle ilgisi g\u00f6r\u00fclmemi\u015ftir.<\/p>\n<p>IV. \u0130PTAL\u0130N D\u0130\u011eER KURALLARA ETK\u0130S\u0130 <\/p>\n<p>45. 6216 say\u0131l\u0131 Kanun\u2019un 43. maddesinin (4) numaral\u0131 f\u0131kras\u0131nda kanunun, Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesinin veya T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc\u2019n\u00fcn belirli kurallar\u0131n\u0131n iptali, di\u011fer kurallar\u0131n\u0131n veya t\u00fcm\u00fcn\u00fcn uygulanmamas\u0131 sonucunu do\u011furuyorsa bunlar\u0131n da Anayasa Mahkemesince iptaline karar verilebilece\u011fi \u00f6ng\u00f6r\u00fclmektedir.<\/p>\n<p>46. 4650 say\u0131l\u0131 Kanun\u2019un 5. maddesiyle de\u011fi\u015ftirilen 2942 Kanun\u2019un 10. maddesinin on d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131n\u0131n \u201c\u2026kamula\u015ft\u0131rma i\u015flemine kar\u015f\u0131 hak sahipleri taraf\u0131ndan idari yarg\u0131da iptal davas\u0131 a\u00e7\u0131lmas\u0131 ve idari yarg\u0131 mahkemelerince de y\u00fcr\u00fctmenin durdurulmas\u0131 karar\u0131 verilmesi halinde mahkemece, idari yarg\u0131da a\u00e7\u0131lan dava bekletici mesele kabul edilerek bunun sonucuna g\u00f6re i\u015flem yap\u0131l\u0131r.\u201d b\u00f6l\u00fcm\u00fcn\u00fcn iptali nedeniyle an\u0131lan f\u0131kran\u0131n kalan k\u0131sm\u0131n\u0131n 6216 say\u0131l\u0131 Kanun\u2019un 43. maddesinin (4) numaral\u0131 f\u0131kras\u0131 gere\u011fince iptali gerekir.<\/p>\n<p>V.
