Dava dilek\u00e7esi ve ekleri, Raport\u00f6r Murat \u00d6ZDEN taraf\u0131ndan haz\u0131rlanan i\u015fin esas\u0131na ili\u015fkin rapor, iptali istenen CBK kurallar\u0131, dayan\u0131lan Anayasa kurallar\u0131 ve bunlar\u0131n gerek\u00e7eleri okunup incelendikten sonra gere\u011fi g\u00f6r\u00fc\u015f\u00fcl\u00fcp d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnamelerinin Anayasal \u00c7er\u00e7evesi ve Yarg\u0131sal Denetimi<\/p>\n<p>3. Anayasa Mahkemesi CBK\u2019lar\u0131n anayasal \u00e7er\u00e7evesini ve yarg\u0131sal denetimine ili\u015fkin ilkeleri daha \u00f6nceki kararlar\u0131nda belirlemi\u015ftir. Buna g\u00f6re CBK\u2019lar\u0131n yarg\u0131sal denetiminde \u00f6ncelikle Anayasa\u2019n\u0131n 104. maddesinin on yedinci f\u0131kras\u0131n\u0131n birinci ila d\u00f6rd\u00fcnc\u00fc c\u00fcmlelerinde belirtilen konu bak\u0131m\u0131ndan yetki kurallar\u0131na uygunlu\u011funun ele al\u0131nmas\u0131 gerekmekte olup bu kapsamda d\u00fczenlemenin; y\u00fcr\u00fctme yetkisine ili\u015fkin olmas\u0131, Anayasa\u2019n\u0131n \u0130kinci K\u0131sm\u0131\u2019n\u0131n Birinci ve \u0130kinci B\u00f6l\u00fcmlerinde yer alan temel haklar, ki\u015fi haklar\u0131 ve \u00f6devleriyle D\u00f6rd\u00fcnc\u00fc B\u00f6l\u00fcm\u00fc\u2019nde yer alan siyasi haklar ve \u00f6devlerle ilgili olmamas\u0131, Anayasa\u2019da m\u00fcnhas\u0131ran kanunla d\u00fczenlenmesi \u00f6ng\u00f6r\u00fclen ya da kanunda a\u00e7\u0131k\u00e7a d\u00fczenlenen konulara ili\u015fkin olmamas\u0131 gerekir. Dolay\u0131s\u0131yla kural y\u00fcr\u00fctme yetkisine ili\u015fkin bir konuyu d\u00fczenlemektedir.<\/p>\n<p>9. Kuralda haf\u0131zl\u0131k e\u011fitiminin niteli\u011fine ya da e\u011fitimden yararlanabileceklere ili\u015fkin bir d\u00fczenleme yer almamaktad\u0131r. Kuralla s\u00f6z konusu okullarda haf\u0131zl\u0131k e\u011fitimine ili\u015fkin \u00e7al\u0131\u015fmalar y\u00fcr\u00fctme konusunda Mill\u00ee E\u011fitim Bakanl\u0131\u011f\u0131 Din \u00d6\u011fretimi Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn g\u00f6revli oldu\u011fu \u00f6ng\u00f6r\u00fclmektedir. Dolay\u0131s\u0131yla kural Anayasa\u2019n\u0131n CBK ile d\u00fczenlenmesi yasaklanan \u0130kinci K\u0131sm\u0131\u2019n\u0131n Birinci ve \u0130kinci B\u00f6l\u00fcmlerinde yer alan temel haklar, ki\u015fi haklar\u0131 ve \u00f6devleriyle D\u00f6rd\u00fcnc\u00fc B\u00f6l\u00fcm\u00fc\u2019nde yer alan siyasi haklar ve \u00f6devler ile ilgili herhangi bir d\u00fczenleme i\u00e7ermemektedir.<\/p>\n<p>10. Anayasa\u2019n\u0131n 123. maddesinin birinci f\u0131kras\u0131na g\u00f6re \u201c\u0130dare, kurulu\u015f ve g\u00f6revleriyle bir b\u00fct\u00fcnd\u00fcr ve kanunla d\u00fczenlenir.\u201d Ancak Anayasa\u2019n\u0131n 106. maddesinin on birinci f\u0131kras\u0131nda \u201cBakanl\u0131klar\u0131n kurulmas\u0131, kald\u0131r\u0131lmas\u0131, g\u00f6revleri ve yetkileri, te\u015fkilat yap\u0131s\u0131 ile merkez ve ta\u015fra te\u015fkilatlar\u0131n\u0131n kurulmas\u0131 Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesiyle d\u00fczenlenir.\u201d denilmek suretiyle bakanl\u0131klar\u0131n kurulmas\u0131, kald\u0131r\u0131lmas\u0131, g\u00f6revleri ve yetkileri, te\u015fkilat yap\u0131s\u0131 ile merkez ve ta\u015fra te\u015fkilatlar\u0131n\u0131n kurulmas\u0131 y\u00f6n\u00fcnden CBK\u2019larla d\u00fczenleme yap\u0131lmas\u0131na a\u00e7\u0131k\u00e7a izin verilmi\u015ftir.<\/p>\n<p>11. Din \u00d6\u011fretimi Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn g\u00f6rev ve yetkilerinin Mill\u00ee E\u011fitim Bakanl\u0131\u011f\u0131n\u0131n merkez te\u015fkilat\u0131n\u0131n kurulmas\u0131na ve te\u015fkilat yap\u0131s\u0131n\u0131n d\u00fczenlenmesine, g\u00f6rev ve yetkilerinin belirlenmesine ili\u015fkin oldu\u011fu, dolay\u0131s\u0131yla konunun Anayasa\u2019n\u0131n 106. maddesinin on birinci f\u0131kras\u0131 uyar\u0131nca CBK ile d\u00fczenlenmesi a\u00e7\u0131k\u00e7a h\u00fckme ba\u011flanm\u0131\u015f olan bakanl\u0131klara dair yetki kapsam\u0131nda kald\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Bu itibarla kural\u0131n Anayasa\u2019n\u0131n 106. maddesinin on birinci f\u0131kras\u0131yla ba\u011flant\u0131l\u0131 olarak 104. maddesinin on yedinci f\u0131kras\u0131n\u0131n \u00fc\u00e7\u00fcnc\u00fc c\u00fcmlesine ayk\u0131r\u0131 bir y\u00f6n\u00fc de bulunmamaktad\u0131r.<\/p>\n<p>12. 633 say\u0131l\u0131 Kanun\u2019un 7. maddesinin birinci f\u0131kras\u0131n\u0131n (b) bendinde Diyanet \u0130\u015fleri Ba\u015fkanl\u0131\u011f\u0131 E\u011fitim Hizmetleri Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn Kur\u2019an-\u0131 Kerim\u2019in usul\u00fcne uygun okunmas\u0131na, anla\u015f\u0131lmas\u0131na, \u0130slami ilimlerin \u00f6\u011frenilmesine y\u00f6nelik \u00e7al\u0131\u015fmalar yapmakla, bu alanlarda bilgi ve becerilerini geli\u015ftirmekle, haf\u0131zl\u0131k yapmak isteyenler i\u00e7in Kur\u2019an kurslar\u0131 ile Kur\u2019an e\u011fitim merkezleri a\u00e7makla, din e\u011fitimi almak isteyenler i\u00e7in kurslar d\u00fczenlemekle, bu kurs ve merkezlerle ilgili i\u015f ve i\u015flemleri y\u00fcr\u00fctmekle g\u00f6revli oldu\u011fu belirtilmi\u015ftir. Buna g\u00f6re Diyanet \u0130\u015fleri Ba\u015fkanl\u0131\u011f\u0131 haf\u0131zl\u0131k yapmak isteyenler i\u00e7in Kur\u2019an kurslar\u0131 ve e\u011fitim merkezleri a\u00e7abilecektir.<\/p>\n<p>13. Dava konusu kural ise \u00f6rg\u00fcn e\u011fitim kurumlar\u0131nda verilecek haf\u0131zl\u0131k e\u011fitimine ili\u015fkindir. Bu nedenle dava konusu CBK kural\u0131n\u0131n kanunla a\u00e7\u0131k\u00e7a d\u00fczenlenen bir konuya ili\u015fkin olmad\u0131\u011f\u0131 sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>14. A\u00e7\u0131klanan nedenlerle kural, Anayasa\u2019n\u0131n 104. maddesinin on yedinci f\u0131kras\u0131na ayk\u0131r\u0131 de\u011fildir. \u0130ptal talebinin reddi gerekir.<\/p>\n<p>b. Kural\u0131n \u0130\u00e7erik Y\u00f6n\u00fcnden \u0130ncelenmesi<\/p>\n<p>15. Anayasa\u2019n\u0131n 2. maddesinde belirtilen hukuk devleti eylem ve i\u015flemleri hukuka uygun, insan haklar\u0131na sayg\u0131l\u0131, bu hak ve \u00f6zg\u00fcrl\u00fckleri koruyup g\u00fc\u00e7lendiren, her alanda adil bir hukuk d\u00fczeni kurup bunu geli\u015ftirerek s\u00fcrd\u00fcren, Anayasa\u2019ya ayk\u0131r\u0131 durum ve tutumlardan ka\u00e7\u0131nan, hukuki g\u00fcvenli\u011fi sa\u011flayan, hukuk kurallar\u0131yla kendini ba\u011fl\u0131 sayan ve yarg\u0131 denetimine a\u00e7\u0131k olan devlettir.<\/p>\n<p>16. Hukuk devletinin temel ilkelerinden biri belirliliktir. Belirlilik ilkesi yaln\u0131zca yasal belirlili\u011fi de\u011fil daha geni\u015f anlamda hukuki belirlili\u011fi de ifade etmektedir. Hukuki belirlilik ilkesinde as\u0131l olan, bir hukuk normunun uygulanmas\u0131yla ortaya \u00e7\u0131kacak sonu\u00e7lar\u0131n o hukuk d\u00fczeninde \u00f6ng\u00f6r\u00fclebilir olmas\u0131d\u0131r. Yasal d\u00fczenlemeye dayan\u0131larak eri\u015filebilir, bilinebilir ve \u00f6ng\u00f6r\u00fclebilir olmas\u0131 ko\u015fuluyla yarg\u0131sal i\u00e7tihatlar ile de hukuki belirlilik sa\u011flanabilir. As\u0131l olan, muhtemel muhataplar\u0131n\u0131n mevcut \u015fartlar alt\u0131nda belirli bir i\u015flemin ne t\u00fcr sonu\u00e7lar do\u011furabilece\u011fini \u00f6ng\u00f6rmelerini m\u00fcmk\u00fcn k\u0131lacak bir normun varl\u0131\u011f\u0131d\u0131r (AYM, E.2019\/78, K.2020\/6, 23\/1\/2020, \u00a7 24).<\/p>\n<p>17. Anayasa\u2019n\u0131n 2. maddesi kapsam\u0131nda hukuk devleti ilkesinin unsurlar\u0131 aras\u0131nda yer alan hukuki g\u00fcvenlik ilkesi ki\u015filerin hukuki g\u00fcvenli\u011fini sa\u011flamay\u0131 ama\u00e7larken belirlilik ilkesi ise kanunlar gibi CBK\u2019lar\u0131n da hem ki\u015filer hem de idare y\u00f6n\u00fcnden herhangi bir duraksamaya ve ku\u015fkuya yer vermeyecek \u015fekilde a\u00e7\u0131k, net, anla\u015f\u0131l\u0131r ve uygulanabilir olmas\u0131n\u0131, ayr\u0131ca kamu otoritelerinin keyf\u00ee uygulamalar\u0131na kar\u015f\u0131 koruyucu \u00f6nlem i\u00e7ermesini ifade etmektedir (AYM, E.2019\/78, K.2020\/6, 23\/1\/2020, \u00a7 25).<\/p>\n<p>18. Belirlilik ilkesi, d\u00fczenlenen konudan yaln\u0131z kavram, ad ve kurum olarak s\u00f6z edilmesini de\u011fil bunlar\u0131n CBK metninde kuralla\u015ft\u0131r\u0131lmas\u0131n\u0131 gerekli k\u0131lar. Kuralla\u015ft\u0131rma ise d\u00fczenlenen alanda temel ilkelerin konulmas\u0131n\u0131 ve \u00e7er\u00e7evenin \u00e7izilmi\u015f olmas\u0131n\u0131 ifade eder. Buna kar\u015f\u0131l\u0131k s\u00f6z konusu d\u00fczenlemelerin tamam\u0131n\u0131n ayn\u0131 CBK\u2019da yap\u0131lmas\u0131 zorunlu olmay\u0131p incelenen CBK d\u0131\u015f\u0131ndaki CBK\u2019lar ya da kanunlarla yap\u0131lm\u0131\u015f olmas\u0131 da belirlilik ilkesi a\u00e7\u0131s\u0131ndan yeterli bulunmaktad\u0131r (AYM, E.2020\/29, K.2022\/155, 13\/12\/2022, \u00a7 39).<\/p>\n<p>19. Hukuk devleti ilkesi gere\u011fi CBK\u2019lar kamu yarar\u0131 amac\u0131yla \u00e7\u0131kar\u0131l\u0131r. Anayasa Mahkemesinin kararlar\u0131na g\u00f6re kamu yarar\u0131 genel bir ifadeyle bireysel, \u00f6zel \u00e7\u0131karlardan ayr\u0131 ve bunlara \u00fcst\u00fcn olan toplumsal yarar\u0131 ifade eder. CBK kural\u0131n\u0131n ama\u00e7 unsuru bak\u0131m\u0131ndan Anayasa\u2019ya uygun say\u0131labilmesi i\u00e7in \u00e7\u0131kar\u0131lmas\u0131nda kamu yarar\u0131 d\u0131\u015f\u0131nda bir amac\u0131n g\u00f6zetilmemi\u015f olmas\u0131 gerekir. Kural\u0131n kamu yarar\u0131 d\u0131\u015f\u0131nda bir ama\u00e7la \u00e7\u0131kar\u0131lm\u0131\u015f oldu\u011fu a\u00e7\u0131k\u00e7a anla\u015f\u0131labiliyorsa ama\u00e7 unsuru bak\u0131m\u0131ndan Anayasa\u2019ya ayk\u0131r\u0131l\u0131k s\u00f6z konusudur (AYM, E.2020\/46, K.2023\/149, 13\/9\/2023, \u00a7 20).<\/p>\n<p>20. Bununla birlikte Cumhurba\u015fkan\u0131, Anayasa\u2019da CBK\u2019larla d\u00fczenlenece\u011fi \u00f6ng\u00f6r\u00fclen konularda Anayasa\u2019ya ayk\u0131r\u0131 olmamak kayd\u0131yla CBK \u00e7\u0131karma yetkisine sahip olup d\u00fczenlemelerde kamu yarar\u0131n\u0131n bulunup bulunmad\u0131\u011f\u0131n\u0131 takdir etme yetkisi Cumhurba\u015fkan\u0131na aittir. Anayasa\u2019ya uygunluk denetiminde Cumhurba\u015fkan\u0131n\u0131n kamu yarar\u0131 anlay\u0131\u015f\u0131n\u0131n isabetli olup olmad\u0131\u011f\u0131 de\u011fil incelenen kural\u0131n kamu yarar\u0131 d\u0131\u015f\u0131nda belli bireylerin ya da gruplar\u0131n \u00e7\u0131karlar\u0131 g\u00f6zetilerek \u00e7\u0131kar\u0131lm\u0131\u015f olup olmad\u0131\u011f\u0131 incelenebilir. Di\u011fer bir anlat\u0131mla bir kural\u0131n Anayasa\u2019ya ayk\u0131r\u0131l\u0131k sorunu \u00e7\u00f6z\u00fcmlenirken kamu yarar\u0131 konusunda Anayasa Mahkemesinin yapaca\u011f\u0131 inceleme, yaln\u0131zca kural\u0131n kamu yarar\u0131 amac\u0131yla \u00e7\u0131kar\u0131l\u0131p \u00e7\u0131kar\u0131lmad\u0131\u011f\u0131n\u0131n denetimiyle s\u0131n\u0131rl\u0131d\u0131r (kanunlar y\u00f6n\u00fcnden benzer de\u011ferlendirmeler i\u00e7in bkz. AYM, E.2016\/140, K.2017\/92, 12\/4\/2017, \u00a7\u00a7 6, 7; E.2017\/33, K.2019\/20, 10\/4\/2019, \u00a7\u00a7 10, 11).<\/p>\n<p>21. Dava konusu kuralla Mill\u00ee E\u011fitim Bakanl\u0131\u011f\u0131n\u0131n hangi biriminin hangi okullarda hangi konularda \u00e7al\u0131\u015fmalar y\u00fcr\u00fct\u00fclmesi konusunda g\u00f6revli ve yetkili oldu\u011fu hususunun herhangi bir duraksamaya ve ku\u015fkuya yer vermeyecek \u015fekilde a\u00e7\u0131k, net, anla\u015f\u0131l\u0131r, uygulanabilir ve nesnel olarak belirlendi\u011fi g\u00f6zetildi\u011finde kural\u0131n belirsizlik i\u00e7ermedi\u011fi sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>22. 6216 say\u0131l\u0131 Kanun\u2019un 39. maddesinin (4) numaral\u0131 f\u0131kras\u0131nda \u201c\u0130ptal davalar\u0131nda Mahkemece esas\u0131n incelenmesine karar verilmesi h\u00e2linde, dava dilek\u00e7esi ile ekleri T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi Ba\u015fkanl\u0131\u011f\u0131, Cumhurba\u015fkanl\u0131\u011f\u0131 ile iptal davas\u0131 a\u00e7maya yetkili siyasi parti gruplar\u0131na g\u00f6nderilir. Bu makamlar, iptal davas\u0131yla ilgili yaz\u0131l\u0131 g\u00f6r\u00fc\u015flerini de\u011ferlendirilmek \u00fczere Mahkemeye bildirebilirler.\u201d denilmektedir. CBK\u2019lar\u0131n gerek\u00e7elerine herhangi bir ortamda yer verilmemesi kar\u015f\u0131s\u0131nda CBK kurallar\u0131n\u0131n getirili\u015f amac\u0131n\u0131n tespiti bak\u0131m\u0131ndan 6216 say\u0131l\u0131 Kanun\u2019un an\u0131lan h\u00fckm\u00fcne istinaden Cumhurba\u015fkanl\u0131\u011f\u0131nca dosyaya sunulan g\u00f6r\u00fc\u015f yaz\u0131lar\u0131 \u00f6nem arz etmektedir (AYM, E.2019\/31, K.2020\/5, 23\/1\/2020, \u00a7 40).<\/p>\n<p>23. Cumhurba\u015fkanl\u0131\u011f\u0131n\u0131n dava konusu kurallar\u0131n d\u00fczenlenme sebebine yer verilen g\u00f6r\u00fc\u015f yaz\u0131s\u0131nda \u00f6zetle kural\u0131n \u00f6rg\u00fcn e\u011fitime devam eden ve ayn\u0131 zamanda haf\u0131zl\u0131k yapmak isteyen \u00f6\u011frencilerin haf\u0131zl\u0131k e\u011fitimi ile haf\u0131zl\u0131k sonras\u0131 e\u011fitim \u00f6\u011fretim s\u00fcre\u00e7lerinin etkin, verimli ve sistematik bir \u015fekilde ger\u00e7ekle\u015ftirilmesi amac\u0131na y\u00f6nelik oldu\u011fu belirtilmi\u015ftir. Bu nedenle kural\u0131n Cumhurba\u015fkan\u0131n\u0131n takdir yetkisi kapsam\u0131nda kald\u0131\u011f\u0131 ve kamu yarar\u0131 d\u0131\u015f\u0131nda d\u00fczenlendi\u011fi sonucuna ula\u015f\u0131lmas\u0131n\u0131 gerektirecek bir y\u00f6n\u00fcn\u00fcn bulunmad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.<\/p>\n<p>24. A\u00e7\u0131klanan nedenlerle kural, Anayasa\u2019n\u0131n 2. maddesine ayk\u0131r\u0131 de\u011fildir. \u0130ptal talebinin reddi gerekir.<\/p>\n<p>\u00c7. CBK\u2019n\u0131n 8. Anlam ve Kapsam<\/p>\n<p>25. Ak\u0131ll\u0131 ula\u015f\u0131m sistemleri kavram\u0131 22\/10\/2021 tarihli ve 31636 say\u0131l\u0131 Resm\u00ee Gazete\u2019de yay\u0131mlanan Karayollar\u0131 Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc G\u00f6rev, Yetki ve Sorumluluk Y\u00f6netmeli\u011fi\u2019nin 4. maddesinde tan\u0131mlanm\u0131\u015ft\u0131r. An\u0131lan maddeye g\u00f6re ak\u0131ll\u0131 ula\u015f\u0131m sistemleri kavram\u0131 \u201cula\u015f\u0131m sistemlerinin s\u00fcrd\u00fcr\u00fclebilirli\u011fini daha g\u00fcvenli, daha ak\u0131ll\u0131 ve \u00e7evreye duyarl\u0131 bir \u015fekilde geli\u015ftirilen \u00e7e\u015fitli teknolojilerin bir araya getirilmesini\u201d ifade etmektedir.<\/p>\n<p>26. 25\/10\/2014 tarihli ve 29156 say\u0131l\u0131 Resm\u00ee Gazete\u2019de yay\u0131mlanan Ulusal Ak\u0131ll\u0131 Ula\u015f\u0131m Sistemleri Strateji Belgesi\u2019nde (2014-2023) ak\u0131ll\u0131 ula\u015f\u0131m sistemleri uygulamalar\u0131nda genel olarak yolcu, yol ve ara\u00e7 aras\u0131nda gerekli haberle\u015fmeyi sa\u011flayan teknolojilerin kullan\u0131ld\u0131\u011f\u0131, bu teknolojilerin k\u00fcresel konum belirleme sistemleri, kablosuz\/mobil\/k\u0131z\u0131l\u00f6tesi ileti\u015fim teknolojileri, kapal\u0131 devre televizyon, \u00e7e\u015fitli yak\u0131n mesafe ileti\u015fim teknolojileri ve s\u00fcr\u00fcc\u00fclere g\u00fcvenli seyir i\u00e7in destek sa\u011flayan alg\u0131lama teknolojileri ba\u015fl\u0131klar\u0131 alt\u0131nda toplanabilece\u011fi belirtilmi\u015ftir.<\/p>\n<p>27. Bu kapsamda ak\u0131ll\u0131 ula\u015f\u0131m sistemlerinin trafik \u0131\u015f\u0131klar\u0131, elektronik denetleme sistemleri, toplu ta\u015f\u0131ma bilgilendirme sistemleri, otopark ve otoyollarda \u00fccretin tahsilini sa\u011flayan sistemler gibi kamu kurum ve kurulu\u015flar\u0131n\u0131n sundu\u011fu hizmetler yan\u0131nda yol g\u00fczerg\u00e2h\u0131 bilgilerini, ara\u00e7 payla\u015f\u0131m\u0131n\u0131, k\u0131sa s\u00fcreli ara\u00e7 kiralamay\u0131 sa\u011flayan uygulamalar\u0131 da i\u00e7eren, bu konuda s\u00fcrekli geli\u015fen bilgi altyap\u0131s\u0131n\u0131 verimli ve etkin bir \u015fekilde kullanmay\u0131 sa\u011flayacak bir sistemler b\u00fct\u00fcn\u00fc oldu\u011fu s\u00f6ylenebilir.<\/p>\n<p>28. \u00a0(1) numaral\u0131 CBK\u2019n\u0131n 474. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (a) bendinde ak\u0131ll\u0131 ula\u015f\u0131m sistemleri projelerinin geli\u015ftirilmesi, kurulmas\u0131, kurdurulmas\u0131, i\u015fletilmesi ve i\u015flettirilmesi hususlar\u0131nda, ilgili kurum ve kurulu\u015flarla koordinasyon i\u00e7inde mill\u00ee politika, strateji ve hedeflerin belirlenmesi amac\u0131yla \u00e7al\u0131\u015fmalar yapmak ve belirlenen hedefleri uygulamak Ula\u015ft\u0131rma ve Altyap\u0131 Bakanl\u0131\u011f\u0131n\u0131n (Bakanl\u0131k) g\u00f6revleri aras\u0131nda say\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>29. An\u0131lan CBK\u2019n\u0131n 483. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (k) bendinde de ak\u0131ll\u0131 ula\u015f\u0131m sistemlerine y\u00f6nelik ulusal stratejileri, hedefleri, mimarileri, ulusal \u00f6l\u00e7ekte uyulmas\u0131 gereken teknik \u00f6l\u00e7\u00fctleri belirlemek, eylem planlar\u0131n\u0131 haz\u0131rlamak ve izlemek, yenilik\u00e7i ak\u0131ll\u0131 ula\u015f\u0131m sistemleri projeleri geli\u015ftirmek, kamu kurum ve kurulu\u015flar\u0131, belediyeler, il \u00f6zel idareleri, ger\u00e7ek ve t\u00fczel ki\u015filerce ak\u0131ll\u0131 ula\u015f\u0131m sistemleri kapsam\u0131nda \u00fcretilen verilerin kullan\u0131lmas\u0131n\u0131 ve de\u011ferlendirilmesini sa\u011flamak amac\u0131yla veri y\u00f6netim merkezi kurmak, kurdurmak, i\u015fletmek, i\u015flettirmek, bu g\u00f6revlerle ilgili uygulama usul ve esaslar\u0131n\u0131 belirlemek Haberle\u015fme Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn (Genel M\u00fcd\u00fcrl\u00fck) g\u00f6rev ve yetkileri aras\u0131nda say\u0131lm\u0131\u015ft\u0131r. Buna g\u00f6re Genel M\u00fcd\u00fcrl\u00fck ula\u015f\u0131mda g\u00fcvenli\u011fin sa\u011flanmas\u0131, ula\u015f\u0131m\u0131n kolayla\u015ft\u0131r\u0131lmas\u0131 ve ula\u015f\u0131m\u0131n \u00e7evreye olumsuz etkilerinin azalt\u0131lmas\u0131 hususlar\u0131nda politika olu\u015fturulmas\u0131, ula\u015f\u0131ma ili\u015fkin sorunlar\u0131n tespiti ve bu sorunlara ili\u015fkin \u00e7\u00f6z\u00fcm sunulmas\u0131 amac\u0131yla veri y\u00f6netim merkezi kurma, kurdurma, i\u015fletme veya i\u015flettirmekle g\u00f6revlidir. Veri de\u011ferlendirme merkezinde kamu kurum ve kurulu\u015flar\u0131, belediyeler, il \u00f6zel idareleri, ger\u00e7ek ve t\u00fczel ki\u015filerce ak\u0131ll\u0131 ula\u015f\u0131m sistemleri kapsam\u0131nda \u00fcretilen veriler kullan\u0131lacak ve de\u011ferlendirilecektir.<\/p>\n<p>2. \u0130ptal Talebinin Gerek\u00e7esi<\/p>\n<p>31. Dava dilek\u00e7esinde \u00f6zetle; dava konusu kural uyar\u0131nca bireysel ara\u00e7lara ve ara\u00e7 sahiplerine ili\u015fkin ki\u015fisel verilerin toplanmas\u0131n\u0131n gerekebilece\u011fi, ki\u015fisel verilere y\u00f6nelik h\u00fck\u00fcmler \u00f6ng\u00f6ren kural\u0131n CBK ile d\u00fczenlenmesi yasak alana ili\u015fkin oldu\u011fu, kamu kurum ve kurulu\u015flar\u0131n\u0131n \u00e7e\u015fitli kanunlar gere\u011fince toplad\u0131\u011f\u0131 verilerin Bakanl\u0131k te\u015fkilat\u0131nda yer almayan bir birime aktar\u0131lmas\u0131na y\u00f6nelik hususlar\u0131n m\u00fcnhas\u0131ran kanunla d\u00fczenlenmesi gerekti\u011fi, ki\u015fisel verilen i\u015flenmesine ili\u015fkin hususlar 24\/3\/2016 tarihli ve 6698 say\u0131l\u0131 Ki\u015fisel Verilerin Korunmas\u0131 Kanunu\u2019nun 4. ve 6. maddelerinde a\u00e7\u0131k\u00e7a d\u00fczenlendi\u011finden bu konuda CBK ile d\u00fczenleme yap\u0131lmas\u0131n\u0131n m\u00fcmk\u00fcn olmad\u0131\u011f\u0131, kuralda hangi verilerin ne \u015fekilde toplanaca\u011f\u0131, i\u015flenece\u011fi, kullan\u0131laca\u011f\u0131 ve payla\u015f\u0131laca\u011f\u0131n\u0131n belirsiz oldu\u011fu, bu i\u015flemlerin ancak ilgilinin a\u00e7\u0131k r\u0131zas\u0131yla yap\u0131labilece\u011fi, kural\u0131n ki\u015fisel verilerin korunmas\u0131n\u0131 isteme hakk\u0131na \u00f6l\u00e7\u00fcs\u00fcz bir m\u00fcdahale olu\u015fturdu\u011fu belirtilerek kural\u0131n Anayasa\u2019n\u0131n 2., 7., 8., 13., 20., 104., 123. ve 127. maddelerine ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>3. Anayasa\u2019ya Ayk\u0131r\u0131l\u0131k Sorunu<\/p>\n<p>32. Dava dilek\u00e7esinde konu bak\u0131m\u0131ndan yetki y\u00f6n\u00fcnden kural\u0131n Anayasa\u2019n\u0131n 7., 8., 13., 20., 123. ve 127. maddelerine de ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015f ise de CBK\u2019ya ili\u015fkin konu bak\u0131m\u0131ndan yetki kurallar\u0131 Anayasa\u2019n\u0131n 104. maddesinin on yedinci f\u0131kras\u0131nda d\u00fczenlendi\u011finden bu husustaki inceleme an\u0131lan f\u0131kra kapsam\u0131nda yap\u0131lacakt\u0131r.<\/p>\n<p>a. B\u00f6l\u00fcmde Yer Alan \u201c\u2026kurdurmak,\u2026\u201d ve \u201c\u2026i\u015flettirmek,\u2026\u201d \u0130bareleri<\/p>\n<p>33. Kurallarda ilgili kurum, kurulu\u015f veya ki\u015filerce ak\u0131ll\u0131 ula\u015f\u0131m sistemleri kapsam\u0131nda \u00fcretilen verilerin kullan\u0131lmas\u0131n\u0131 ve de\u011ferlendirilmesini sa\u011flamak amac\u0131yla veri y\u00f6netim merkezi kurdurmak ve i\u015flettirmek hususunda Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn g\u00f6revli ve yetkili oldu\u011fu h\u00fck\u00fcm alt\u0131na al\u0131nmaktad\u0131r.<\/p>\n<p>34. Bu itibarla kurallar uyar\u0131nca Genel M\u00fcd\u00fcrl\u00fck veri y\u00f6netim merkezini \u00fc\u00e7\u00fcnc\u00fc bir ki\u015fiye kurdurabilecek ve i\u015flettirebilecektir.<\/p>\n<p>35. Anayasa\u2019n\u0131n 47. maddesinin d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131nda \u201cDevlet, kamu iktisad\u00ee te\u015febb\u00fcsleri ve di\u011fer kamu t\u00fczelki\u015fileri taraf\u0131ndan y\u00fcr\u00fct\u00fclen yat\u0131r\u0131m ve hizmetlerden hangilerinin \u00f6zel hukuk s\u00f6zle\u015fmeleri ile ger\u00e7ek veya t\u00fczelki\u015filere yapt\u0131r\u0131labilece\u011fi veya devredilebilece\u011fi kanunla belirlenir.\u201d denilerek \u00f6zel hukuk s\u00f6zle\u015fmeleri arac\u0131l\u0131\u011f\u0131yla ger\u00e7ek veya t\u00fczel ki\u015filerin kamu hizmetlerinin sunumuna d\u00e2hil edilmelerine imk\u00e2n tan\u0131nm\u0131\u015ft\u0131r (AYM, E.2018\/104, K.2020\/39, 16\/7\/2020, \u00a7 78). Bununla birlikte hangi kamu hizmetlerinin ne t\u00fcr \u00f6zel hukuk s\u00f6zle\u015fmeleriyle ger\u00e7ek ki\u015filere veya \u00f6zel hukuk t\u00fczel ki\u015filerine g\u00f6rd\u00fcr\u00fclece\u011finin kanunla belirlenmesi gerekmektedir.<\/p>\n<p>36. Kamu hizmetlerinden hangilerinin \u00f6zel hukuk s\u00f6zle\u015fmeleri ile ger\u00e7ek veya t\u00fczelki\u015filere yapt\u0131r\u0131labilece\u011finin veya devredilebilece\u011finin Anayasa\u2019n\u0131n an\u0131lan maddesi uyar\u0131nca m\u00fcnhas\u0131ran kanunla d\u00fczenlenmesi gerekti\u011finden ilgili kurum, kurulu\u015f ve ki\u015filerce ak\u0131ll\u0131 ula\u015f\u0131m sistemleri kapsam\u0131nda \u00fcretilen verilerin -ula\u015f\u0131m g\u00fcvenli\u011finin art\u0131r\u0131lmas\u0131, ula\u015f\u0131m\u0131n kolayla\u015ft\u0131r\u0131lmas\u0131 ile ula\u015f\u0131ma ili\u015fkin sorunlar\u0131n tespiti ve \u00e7\u00f6z\u00fcm sunulmas\u0131 amac\u0131yla- kullan\u0131lmas\u0131 ve de\u011ferlendirilmesi i\u00e7in veri y\u00f6netim merkezinin kurdurulmas\u0131na ve i\u015flettirilmesine imk\u00e2n tan\u0131yan d\u00fczenlemenin Anayasa\u2019n\u0131n 104. maddesinin on yedinci f\u0131kras\u0131n\u0131n \u00fc\u00e7\u00fcnc\u00fc c\u00fcmlesine g\u00f6re CBK ile d\u00fczenlenmesi m\u00fcmk\u00fcn de\u011fildir (benzer y\u00f6ndeki de\u011ferlendirmeler i\u00e7in bkz. AYM, E.2020\/52, K.2023\/223, 27\/12\/2023, \u00a7\u00a7 24-28, \u00a7\u00a7 39-41).<\/p>\n<p>37. Kural, kamu kurum ve kurulu\u015flar\u0131, belediyeler, il \u00f6zel idareleri, ger\u00e7ek ve t\u00fczel ki\u015filerce ak\u0131ll\u0131 ula\u015f\u0131m sistemleri kapsam\u0131nda \u00fcretilen verilerin kullan\u0131lmas\u0131n\u0131 ve de\u011ferlendirilmesini sa\u011flamak amac\u0131yla veri y\u00f6netim merkezi kurmak ve i\u015fletmek, bu g\u00f6revlerle ilgili uygulama usul ve esaslar\u0131n\u0131 belirlemek konusunda Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn g\u00f6revli ve yetkili oldu\u011funu d\u00fczenlemektedir.<\/p>\n<p>39. Ula\u015f\u0131mda g\u00fcvenli\u011fin sa\u011flanmas\u0131 ve ula\u015f\u0131m\u0131n kolayla\u015ft\u0131r\u0131lmas\u0131 amac\u0131yla veri y\u00f6netim merkezi kurma ve i\u015fletme, buna ili\u015fkin usul ve esaslar\u0131 belirleme konusunda an\u0131lan Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn g\u00f6revli ve yetkili k\u0131l\u0131nmas\u0131n\u0131 d\u00fczenleyen kural\u0131n y\u00fcr\u00fctme yetkisine ili\u015fkin konulardan oldu\u011fu a\u00e7\u0131kt\u0131r.<\/p>\n<p>40. Ki\u015fisel verilerin korunmas\u0131n\u0131 isteme hakk\u0131 Anayasa\u2019n\u0131n 20. maddesi kapsam\u0131nda anayasal g\u00fcvenceye ba\u011flanm\u0131\u015ft\u0131r. An\u0131lan maddenin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda herkesin kendisiyle ilgili ki\u015fisel verilerin korunmas\u0131n\u0131 isteme hakk\u0131na sahip oldu\u011fu ifade edilmi\u015f; ki\u015fisel verilerin ancak kanunda \u00f6ng\u00f6r\u00fclen h\u00e2llerde veya ki\u015finin a\u00e7\u0131k r\u0131zas\u0131yla i\u015flenebilece\u011fi, ki\u015fisel verilerin korunmas\u0131na ili\u015fkin esas ve usullerin kanunla d\u00fczenlenece\u011fi belirtilmi\u015ftir. Buna g\u00f6re Anayasa\u2019n\u0131n an\u0131lan maddesinde d\u00fczenlenen ve \u201cKi\u015finin Haklar\u0131 ve \u00d6devleri\u201d ba\u015fl\u0131kl\u0131 \u0130kinci B\u00f6l\u00fcm\u00fc\u2019nde yer alan ki\u015fisel verilerin korunmas\u0131 hakk\u0131na ili\u015fkin olarak CBK ile d\u00fczenleme yap\u0131lmas\u0131 m\u00fcmk\u00fcn de\u011fildir (AYM, E.2019\/96, K.2022\/17, 24\/2\/2022, \u00a7 74).<\/p>\n<p>41. Anayasa Mahkemesinin yerle\u015fik kararlar\u0131nda belirtildi\u011fi \u00fczere \u201c&#8230;ad\u0131, soyad\u0131, do\u011fum tarihi ve do\u011fum yeri gibi bireyin sadece kimli\u011fini ortaya koyan bilgiler de\u011fil; telefon numaras\u0131, motorlu ta\u015f\u0131t plakas\u0131, sosyal g\u00fcvenlik numaras\u0131, pasaport numaras\u0131, \u00f6zge\u00e7mi\u015f, resim, g\u00f6r\u00fcnt\u00fc ve ses kay\u0131tlar\u0131, parmak izleri, IP adresi, e-posta adresi, hobiler, tercihler, etkile\u015fimde bulunulan ki\u015filer, grup \u00fcyelikleri, aile bilgileri, sa\u011fl\u0131k bilgileri gibi ki\u015fiyi do\u011frudan veya dolayl\u0131 olarak belirlenebilir k\u0131lan t\u00fcm veriler\u2026\u201d ki\u015fisel veri olarak kabul edilmektedir (AYM, E.2013\/122, K.2014\/74, 9\/4\/2014; E.2014\/149, K.2014\/151, 2\/10\/2014; E.2014\/74, K.2014\/201, 25\/12\/2014; E.2014\/180, K.2015\/30, 19\/3\/2015; E.2015\/32, K.2015\/102, 12\/11\/2015).<\/p>\n<p>42. 6698 say\u0131l\u0131 Kanun\u2019un 3. maddesinde; ki\u015fisel verinin kimli\u011fi belirli veya belirlenebilir ger\u00e7ek ki\u015fiye ili\u015fkin her t\u00fcrl\u00fc bilgiyi, anonim h\u00e2le getirmenin ise ki\u015fisel verilerin ba\u015fka verilerle e\u015fle\u015ftirilerek dahi hi\u00e7bir surette kimli\u011fi belirli veya belirlenebilir bir ger\u00e7ek ki\u015fiyle ili\u015fkilendirilemeyecek h\u00e2le getirilmesini ifade etti\u011fi belirtilmi\u015ftir.<\/p>\n<p>43. Kural; kamu kurum ve kurulu\u015flar\u0131, belediyeler, il \u00f6zel idareleri, ger\u00e7ek ve t\u00fczel ki\u015filerce ak\u0131ll\u0131 ula\u015f\u0131m sistemleri kapsam\u0131nda \u00fcretilen verilere ili\u015fkin olarak 6698 say\u0131l\u0131 Kanun\u2019a bir istisna getirmemektedir. Bu veriler ilgili kanunlarla verilen yetki veya ilgilinin a\u00e7\u0131k r\u0131zas\u0131na dayal\u0131 olarak saklanacak ve i\u015flenecektir.
