Ba\u015fvuru, idari merci taraf\u0131ndan tesis edilmi\u015f bir i\u015flem bulunmad\u0131\u011f\u0131 gerek\u00e7esiyle davan\u0131n incelenmeksizin reddine karar verilmesi nedeniyle mahkemeye eri\u015fim hakk\u0131n\u0131n ihlal edildi\u011fi iddias\u0131na ili\u015fkindir.<\/p>\n<p>II. BA\u015eVURU S\u00dcREC\u0130<\/p>\n<p>2. Ba\u015fvuru, ba\u015fvuru formu ve eklerinin idari y\u00f6nden yap\u0131lan \u00f6n incelemesinden sonra Komisyona sunulmu\u015ftur. Komisyon ba\u015fvurunun kabul edilebilirlik incelemesinin B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na karar vermi\u015ftir. B\u00f6l\u00fcm Ba\u015fkan\u0131 taraf\u0131ndan ba\u015fvurunun kabul edilebilirlik ve esas incelemesinin birlikte yap\u0131lmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>3. Ba\u015fvuru belgelerinin bir \u00f6rne\u011fi bilgi i\u00e7in Adalet Bakanl\u0131\u011f\u0131na (Bakanl\u0131k) g\u00f6nderilmi\u015ftir. Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcn\u00fc bildirmi\u015ftir. Ba\u015fvurucu, Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 s\u00fcresinde beyanda bulunmam\u0131\u015ft\u0131r.<\/p>\n<p>III. OLAY VE OLGULAR<\/p>\n<p>4. Ba\u015fvuru formu ve eklerinde ifade edildi\u011fi \u015fekliyle ilgili olaylar \u00f6zetle \u015f\u00f6yledir:<\/p>\n<p>5. Ba\u015fvurucunun rekt\u00f6r yard\u0131mc\u0131s\u0131 olarak g\u00f6rev yapt\u0131\u011f\u0131 \u0130zmir \u00dcniversitesi (\u00dcniversite) 23\/7\/2016 tarihli ve 29779 say\u0131l\u0131 Resm\u00ee Gazete&#8217;de yay\u0131mlanan 667 say\u0131l\u0131 Ola\u011fan\u00fcst\u00fc Hal Kapsam\u0131nda Al\u0131nan Tedbirlere \u0130li\u015fkin Kanun H\u00fckm\u00fcnde Kararname&#8217;nin (667 say\u0131l\u0131 KHK) 2. maddesiyle kapat\u0131lm\u0131\u015f ve ba\u015fvurucunun i\u015f s\u00f6zle\u015fmesi herhangi bir i\u015flem yap\u0131lmadan kendili\u011finden sona ermi\u015ftir.<\/p>\n<p>6. Ba\u015fvurucu; \u00dcniversitenin kapat\u0131lmas\u0131 sonucunda i\u015f akdinin sona ermesi i\u015fleminin hukuka ayk\u0131r\u0131 oldu\u011fu, 667 say\u0131l\u0131 KHK&#8217;n\u0131n Anayasa&#8217;ya ayk\u0131r\u0131 oldu\u011fu iddias\u0131yla Anayasa Mahkemesine g\u00f6nderilmesi gerekti\u011fi iddialar\u0131yla \u0130zmir 5. \u0130dare Mahkemesinde (Mahkeme) 7\/11\/2016 tarihinde iptal davas\u0131 a\u00e7m\u0131\u015ft\u0131r. Mahkeme 24\/11\/2016 tarihinde davan\u0131n incelenmeksizin reddine karar vermi\u015ftir. Karar\u0131n gerek\u00e7esinde ba\u015fvurucunun \u00e7al\u0131\u015ft\u0131\u011f\u0131 \u00fcniversitenin kanun h\u00fckm\u00fcnde kararname (KHK) ile kapat\u0131ld\u0131\u011f\u0131, 31\/12\/2005 tarihli ve 26040 say\u0131l\u0131 Resm\u00ee Gazete&#8217;de yay\u0131mlanan Vak\u0131f Y\u00fcksek\u00f6\u011fretim Kurumlar\u0131 Y\u00f6netmeli\u011fi&#8217;nin (Y\u00f6netmelik) 27. maddesi uyar\u0131nca faaliyetine son verilen vak\u0131f \u00fcniversitesinde \u00e7al\u0131\u015fan personelin i\u015f s\u00f6zle\u015fmesinin kendili\u011finden sona ermi\u015f say\u0131laca\u011f\u0131 ifade edilmi\u015ftir. Ba\u015fvurucunun da i\u015f s\u00f6zle\u015fmesinin ve rekt\u00f6r yard\u0131mc\u0131l\u0131\u011f\u0131 g\u00f6revinin kendili\u011finden sona erdi\u011fi vurgulanan kararda KHK h\u00fck\u00fcmlerinin iptali i\u00e7in a\u00e7\u0131lm\u0131\u015f bir davan\u0131n hukuken olanaks\u0131z oldu\u011fu, somut olayda idari davaya konu olacak bir i\u015flem bulunmad\u0131\u011f\u0131 belirtilmi\u015ftir.<\/p>\n<p>7. Ba\u015fvurucunun istinaf talebi \u0130zmir B\u00f6lge \u0130dare Mahkemesi 5. \u0130dare Dava Dairesi (B\u00f6lge \u0130dare Mahkemesi) taraf\u0131ndan 27\/2\/2017 tarihinde reddedilmi\u015ftir. Ba\u015fvurucunun temyiz talebini inceleyen Dan\u0131\u015ftay 5. Daire (Daire) 30\/10\/2018 tarihinde B\u00f6lge \u0130dare Mahkemesi karar\u0131n\u0131n onanmas\u0131na kesin olarak karar vermi\u015ftir.<\/p>\n<p>8. Ba\u015fvurucu, nihai karar\u0131 11\/1\/2019 tarihinde tebli\u011f ald\u0131ktan sonra 8\/2\/2019 tarihinde bireysel ba\u015fvuruda bulunmu\u015ftur.<\/p>\n<p>IV. \u0130LG\u0130L\u0130 HUKUK<\/p>\n<p>9. 6\/1\/1982 tarihli ve 2577 say\u0131l\u0131 \u0130dari Yarg\u0131lama Usul\u00fc Kanunu&#8217;nun &#8220;\u0130ptal ve tam yarg\u0131 davalar\u0131&#8221; kenar ba\u015fl\u0131kl\u0131 12. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;\u0130lgililer haklar\u0131n\u0131 ihlal eden bir idari i\u015flem dolay\u0131s\u0131yla Dan\u0131\u015ftaya ve idare ve vergi mahkemelerine do\u011frudan do\u011fruya tam yarg\u0131 davas\u0131 veya iptal ve tam yarg\u0131 davalar\u0131n\u0131 birlikte a\u00e7abilecekleri gibi ilk \u00f6nce iptal davas\u0131 a\u00e7arak bu davan\u0131n karara ba\u011flanmas\u0131 \u00fczerine, bu husustaki karar\u0131n veya kanun yollar\u0131na ba\u015fvurulmas\u0131 halinde verilecek karar\u0131n tebli\u011fi veya bir i\u015flemin icras\u0131 sebebiyle do\u011fan zararlardan dolay\u0131 icra tarihinden itibaren dava s\u00fcresi i\u00e7inde tam yarg\u0131 davas\u0131 a\u00e7abilirler. Bu halde de ilgililerin 11 nci madde uyar\u0131nca idareye ba\u015fvurma haklar\u0131 sakl\u0131d\u0131r.&#8221;<\/p>\n<p>10. 667 say\u0131l\u0131 KHK, 18\/10\/2016 tarihli ve 6749 say\u0131l\u0131 Kanun&#8217;un 29\/10\/2016 tarihli ve 29872 say\u0131l\u0131 Resm\u00ee Gazete&#8217;de yay\u0131mlanarak y\u00fcr\u00fcrl\u00fc\u011fe girmesi sonucunda kanunla\u015fm\u0131\u015ft\u0131r. 6749 say\u0131l\u0131 Kanun&#8217;un &#8220;Kapat\u0131lan kurum ve kurulu\u015flara ili\u015fkin tedbirler&#8221; kenar ba\u015fl\u0131kl\u0131 2. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;(1) Milli g\u00fcvenli\u011fe tehdit olu\u015fturdu\u011fu tespit edilen Fethullah\u00e7\u0131 Ter\u00f6r \u00d6rg\u00fct\u00fcne (FET\u00d6\/PDY) aidiyeti, iltisak\u0131 veya irtibat\u0131 belirlenen;<\/p>\n<p>&#8230;<\/p>\n<p>\u00e7) Ekli (IV) say\u0131l\u0131 listede yer alan vak\u0131f y\u00fcksek\u00f6\u011fretim kurumlar\u0131,<\/p>\n<p>kapat\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>&#8230;&#8221;<\/p>\n<p>11. 4\/11\/1981 tarihli ve 2547 say\u0131l\u0131 Y\u00fcksek\u00f6\u011fretim Kanunu&#8217;nun ek 11. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;&#8230; <\/p>\n<p>(Ek f\u0131kra: 20\/8\/2016-6745\/15 md.) Kurucu vak\u0131flar\u0131na kayy\u0131m tayin edilen veya faaliyet izni kald\u0131r\u0131lan vak\u0131f y\u00fcksek\u00f6\u011fretim kurumu m\u00fctevelli heyet ba\u015fkan\u0131 ve \u00fcyeleri ile t\u00fcm y\u00f6neticilerinin g\u00f6revleri kendili\u011finden sona erer. Bu vak\u0131f y\u00fcksek\u00f6\u011fretim kurumunda \u00e7al\u0131\u015fmakta olan akademik ve di\u011fer personelin hizmet s\u00f6zle\u015fmeleri hakk\u0131nda 22\/5\/2003 tarihli ve 4857 say\u0131l\u0131 \u0130\u015f Kanunu h\u00fck\u00fcmleri uygulan\u0131r.<\/p>\n<p>&#8230;<\/p>\n<p>(Ek f\u0131kra: 19\/11\/2014-6569\/31 md.) Vak\u0131f y\u00fcksek\u00f6\u011fretim kurumlar\u0131n\u0131n denetimi ve bu denetim sonucu ilgili y\u00fcksek\u00f6\u011fretim kurumu hakk\u0131nda yol g\u00f6sterici, d\u00fczeltici, k\u0131s\u0131tlay\u0131c\u0131 veya faaliyet iznini kald\u0131r\u0131c\u0131 \u00f6nlemlerin al\u0131nmas\u0131na ili\u015fkin usul ve esaslar, \u00dcniversiteleraras\u0131 Kurulun g\u00f6r\u00fc\u015f\u00fc al\u0131narak Y\u00fcksek\u00f6\u011fretim Kurulu taraf\u0131ndan \u00e7\u0131kar\u0131lan y\u00f6netmelikle d\u00fczenlenir. &#8220;<\/p>\n<p>&#8230;&#8221; <\/p>\n<p>12. Y\u00f6netmeli\u011fin &#8220;\u00d6\u011fretim elemanlar\u0131&#8221; kenar ba\u015fl\u0131kl\u0131 23. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;&#8230; <\/p>\n<p>Vak\u0131f y\u00fcksek\u00f6\u011fretim kurumlar\u0131nda g\u00f6rev alacak olan akademik ve idari personelin \u00e7al\u0131\u015fma esaslar\u0131 2547 say\u0131l\u0131 Kanunda devlet \u00fcniversiteleri i\u00e7in \u00f6ng\u00f6r\u00fclen h\u00fck\u00fcmlere tabidir. Bu personelin ayl\u0131k ve di\u011fer \u00f6zl\u00fck haklar\u0131 bak\u0131m\u0131ndan ise 4857 say\u0131l\u0131 \u0130\u015f Kanunu h\u00fck\u00fcmleri uygulan\u0131r.&#8221;<\/p>\n<p>13. Y\u00f6netmeli\u011fin &#8220;Faaliyet izninin kald\u0131r\u0131lmas\u0131n\u0131n h\u00fck\u00fcm ve sonu\u00e7lar\u0131&#8221; kenar ba\u015fl\u0131kl\u0131 27. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;&#8230; <\/p>\n<p>Faaliyet izninin kald\u0131r\u0131lmas\u0131 karar\u0131 verilen vak\u0131f y\u00fcksek\u00f6\u011fretim kurumunda \u00e7al\u0131\u015fmakta olan akademik ve idari personelin hizmet s\u00f6zle\u015fmeleri vak\u0131f y\u00fcksek\u00f6\u011fretim kurumunun t\u00fczel ki\u015fili\u011finin ortadan kalkt\u0131\u011f\u0131 tarih itibar\u0131yla sona erer.&#8221;<\/p>\n<p>14. Sosyal G\u00fcvenlik Kurumu Ba\u015fkanl\u0131\u011f\u0131 taraf\u0131ndan \u00e7\u0131kart\u0131lan &#8220;FET\u00d6\/PDY kapsam\u0131nda kapat\u0131lan i\u015fyerleri&#8221; konulu 2\/8\/2016 tarihli ve 2016\/16 say\u0131l\u0131 Genelge&#8217;nin (Genelge) ilgili k\u0131s\u0131mlar\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;&#8230;<\/p>\n<p>23\/7\/2016 tarihli ve 29779 say\u0131l\u0131 (2.m\u00fckerrer) Resmi Gazete\u2019de yay\u0131mlanan 667 say\u0131l\u0131 Ola\u011fan\u00fcst\u00fc Hal Kapsam\u0131nda Al\u0131nan Tedbirlere \u0130li\u015fkin Kanun H\u00fckm\u00fcnde Kararnamenin(KHK) 2 nci maddesi ile milli g\u00fcvenli\u011fe tehdit olu\u015fturdu\u011fu tespit edilen Fethullah\u00e7\u0131 Ter\u00f6r\u00d6rg\u00fct\u00fcne (FET\u00d6\/PDY) aidiyeti, iltisak\u0131 veya irtibat\u0131 belirlenen &#8230; 15 vak\u0131f y\u00fcksek\u00f6\u011fretim kurumu, &#8230; olmak \u00fczere toplam 2351 kurum ve kurulu\u015f kapat\u0131lm\u0131\u015ft\u0131r. <\/p>\n<p>. <\/p>\n<p>.. <\/p>\n<p>S\u00f6z konusu KHK\u2019larda belirtilen \u00f6zel sa\u011fl\u0131k kurum ve kurulu\u015fu, \u00f6zel \u00f6\u011fretim kurum ve kurulu\u015flar\u0131 ile \u00f6zel \u00f6\u011frenci yurtlar\u0131 ve pansiyonlar\u0131, vak\u0131f ve dernekler ile bunlar\u0131n iktisadi i\u015fletmeleri, vak\u0131f y\u00fcksek \u00f6\u011fretim kurumu, sendika, federasyon ve konfederasyonlar 23\/7\/2016 tarihi, \u00f6zel radyo ve televizyon kurulu\u015flar\u0131 ile gazete, dergi, yay\u0131nevi ve da\u011f\u0131t\u0131m kanallar\u0131 27\/7\/2016 tarihi itibariyle kapat\u0131lm\u0131\u015f olup bu kurulu\u015flardan 5510 say\u0131l\u0131 Kanun kapsam\u0131nda i\u015fyeri say\u0131lanlar ba\u015fka bir anlat\u0131mla 4 \u00fcnc\u00fc maddenin birinci f\u0131kras\u0131n\u0131n (a) bendi kapsam\u0131nda sigortal\u0131 \u00e7al\u0131\u015ft\u0131ranlar ile bu kurulu\u015flar\u0131n i\u015fverenlerinin 4 \u00fcnc\u00fc maddenin birinci f\u0131kras\u0131n\u0131n (b) bendi kapsam\u0131ndaki sigortal\u0131l\u0131klar\u0131n\u0131n sona erdirilmesi hakk\u0131nda yap\u0131lacak i\u015flemler a\u015fa\u011f\u0131da a\u00e7\u0131klanm\u0131\u015ft\u0131r. <\/p>\n<p>. <\/p>\n<p>.. <\/p>\n<p>2- \u0130\u015ften ayr\u0131l\u0131\u015f bildirgesi i\u015flemleri <\/p>\n<p>2. 1- Kapat\u0131lan i\u015fyerlerinden i\u015ften ayr\u0131l\u0131\u015f\u0131 yap\u0131lacak sigortal\u0131lar <\/p>\n<p>667 say\u0131l\u0131 KHK\u2019da say\u0131lan i\u015fyerlerinde 5510 say\u0131l\u0131 Kanunun 4 \u00fcnc\u00fc maddesinin birinci f\u0131kras\u0131n\u0131n (a) bendine tabi \u00e7al\u0131\u015fan sigortal\u0131lar\u0131n i\u015fyerlerinin kapat\u0131lmas\u0131 nedeniyle i\u015f akitleri 23\/7\/2016 tarihinden itibaren fesh edilmi\u015f say\u0131laca\u011f\u0131ndan i\u015ften ayr\u0131l\u0131\u015f tarihi 23\/7\/2016, 668 say\u0131l\u0131 KHK\u2019da say\u0131lan i\u015fyerlerinde \u00e7al\u0131\u015fan sigortal\u0131lar i\u00e7in i\u015ften ayr\u0131l\u0131\u015f tarihi 27\/7\/2016 olarak dikkate al\u0131nacakt\u0131r. <\/p>\n<p>Bu sigortal\u0131lar\u0131n i\u015ften ayr\u0131l\u0131\u015f bildirgesi \u00fcnitelerce re\u2019sen d\u00fczenlenecek olup i\u015ften ayr\u0131l\u0131\u015f nedeni olarak &#8217;36-KHK ile i\u015fyerinin kapat\u0131lmas\u0131&#8217; (De\u011fi\u015fik, 25\/01\/2022 tarihli ve2022\/2 say\u0131l\u0131 Genelge) kodu kullan\u0131lacakt\u0131r. <\/p>\n<p>\u00dcnitelerce sigortal\u0131 i\u015ften ayr\u0131l\u0131\u015f bildirgesinin d\u00fczenlenmesinde, sigortal\u0131n\u0131n i\u015ften ayr\u0131ld\u0131\u011f\u0131 ay ve bir \u00f6nceki aya ait prime esas kazanc\u0131n bildirgede bulunmas\u0131 gerekmekte olup prime esas kazanc\u0131n bulunmad\u0131\u011f\u0131 durumlarda, &#8216;0&#8217; g\u00fcn ve &#8216;0&#8217; kazan\u00e7 girilerek bildirge d\u00fczenlenecek eksik g\u00fcn nedeni olarak &#8217;10- Genel hayat\u0131 etkileyen olaylar&#8217; kodu kullan\u0131lacakt\u0131r. <\/p>\n<p>\u0130\u015fyerinin KHK\u2019lar kapsam\u0131nda kapat\u0131lmas\u0131 nedeniyle sadece bu i\u015fyerlerinden i\u015ften \u00e7\u0131kan sigortal\u0131larla s\u0131n\u0131rl\u0131 olmak \u00fczere re\u2019sen d\u00fczenlenecek i\u015ften ayr\u0131l\u0131\u015f bildirgesi d\u00fczenleme nedeni olarak &#8216;KHK ile i\u015fyerinin kapat\u0131lmas\u0131&#8217; (De\u011fi\u015fik, 25\/01\/2022 tarihli ve 2022\/2 say\u0131l\u0131 Genelge) kodu kullan\u0131lacakt\u0131r. <\/p>\n<p>&#8230;&#8221; <\/p>\n<p>V. \u0130NCELEME VE GEREK\u00c7E <\/p>\n<p>15. Anayasa Mahkemesinin 27\/11\/2024 tarihinde yapm\u0131\u015f oldu\u011fu toplant\u0131da ba\u015fvuru incelenip gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. Ba\u015fvurucunun \u0130ddialar\u0131 ve Bakanl\u0131k G\u00f6r\u00fc\u015f\u00fc <\/p>\n<p>16. Ba\u015fvurucu; i\u015f s\u00f6zle\u015fmesinin idarece resen tek tarafl\u0131 olarak feshedilmekle anayasal haklar\u0131n\u0131n ihlal edildi\u011fini, i\u015f s\u00f6zle\u015fmesinin Genelgeye dayan\u0131larak sonland\u0131r\u0131ld\u0131\u011f\u0131n\u0131, Mahkemece inceleme yap\u0131lmadan karar verildi\u011fini ileri s\u00fcrerek adil yarg\u0131lanma hakk\u0131n\u0131n, hukuki g\u00fcvenlik ilkesinin ve mahkemeye eri\u015fim hakk\u0131n\u0131n ihlal edildi\u011fini iddia etmi\u015ftir. Sosyal g\u00fcvenlik siciline KHK nedeniyle i\u015ften \u00e7\u0131kar\u0131ld\u0131\u011f\u0131 \u015ferhi konuldu\u011funu vurgulayan ba\u015fvurucu \u00f6zel hayata sayg\u0131, \u00e7al\u0131\u015fma ve m\u00fclkiyet haklar\u0131n\u0131n, ayr\u0131ca masumiyet karinesinin ihlal edildi\u011fini ifade etmi\u015ftir.<\/p>\n<p>17. Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcnde ba\u015fvurucu taraf\u0131ndan \u00f6zl\u00fck haklar\u0131na ili\u015fkin i\u015f mahkemeleri \u00f6n\u00fcnde herhangi bir dava a\u00e7t\u0131\u011f\u0131na dair bilgi veya belge sunmad\u0131\u011f\u0131, bu nedenle Anayasa Mahkemesince \u00f6ncelikle ba\u015fvurucunun ola\u011fan ve etkili ba\u015fvuru yollar\u0131n\u0131 t\u00fcketip t\u00fcketmedi\u011finin de\u011ferlendirilmesi gerekti\u011fi ifade edilmi\u015ftir. G\u00f6r\u00fc\u015fte ayr\u0131ca ba\u015fvurucunun g\u00f6rev yapt\u0131\u011f\u0131 \u00fcniversitenin kapat\u0131lmas\u0131 nedeniyle i\u015f akdinin son bulmas\u0131n\u0131n ba\u015fvurucunun \u00f6zel hayat\u0131na sayg\u0131 hakk\u0131n\u0131 ihlal etti\u011fi iddias\u0131n\u0131n savunulabilir nitelikte olup olmad\u0131\u011f\u0131n\u0131n de\u011ferlendirilmesi gerekti\u011fi belirtilmi\u015ftir. Son olarak yap\u0131lacak incelemede Anayasa&#8217;n\u0131n 15. maddesinin dikkate al\u0131nmas\u0131n\u0131n \u00f6nerildi\u011fi g\u00f6r\u00fc\u015fte ba\u015fvurucunun \u00f6zel hayata sayg\u0131 hakk\u0131 ba\u011flam\u0131nda etkili ba\u015fvuru hakk\u0131n\u0131n ihlal edilip edilmedi\u011fi konusunda Anayasa Mahkemesi taraf\u0131ndan yap\u0131lacak incelemede, yukar\u0131da mevzuat ve i\u00e7tihatlar\u0131n yan\u0131 s\u0131ra somut olay\u0131n kendine \u00f6zg\u00fc ko\u015fullar\u0131n\u0131n dikkate al\u0131nmas\u0131 gerekti\u011fi ifadelerine yer verilmi\u015ftir.<\/p>\n<p>B. De\u011ferlendirme <\/p>\n<p>18. Anayasa\u2019n\u0131n iddian\u0131n de\u011ferlendirilmesinde dayanak al\u0131nacak \u201cHak arama h\u00fcrriyeti\u201d kenar ba\u015fl\u0131kl\u0131 36. maddesinin birinci f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Herkes, me\u015fru vas\u0131ta ve yollardan faydalanmak suretiyle yarg\u0131 mercileri \u00f6n\u00fcnde davac\u0131 veya daval\u0131 olarak iddia ve savunma ile adil yarg\u0131lanma hakk\u0131na sahiptir.\u201d <\/p>\n<p>19. Anayasa Mahkemesi, olaylar\u0131n ba\u015fvurucu taraf\u0131ndan yap\u0131lan hukuki nitelendirmesi ile ba\u011fl\u0131 olmay\u0131p olay ve olgular\u0131n hukuki tavsifini kendisi takdir eder (Tahir Canan, B. No: 2012\/969, 18\/9\/2013, \u00a7 16). Ba\u015fvurucu sosyal g\u00fcvenlik kayd\u0131na \u015ferh konularak i\u015fine son verilmesi ile ailesinin ge\u00e7imini sa\u011flayamayaca\u011f\u0131n\u0131 ileri s\u00fcrerek \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n da ihlal edildi\u011fini ileri s\u00fcrm\u00fc\u015fse de, i\u015f s\u00f6zle\u015fmesinin feshedilmesinin sebebinin veya sonu\u00e7lar\u0131n\u0131n \u00f6zel hayat\u0131na nas\u0131l etki etti\u011fine dair somut a\u00e7\u0131klamalarda bulunmam\u0131\u015ft\u0131r. Bu nedenle ba\u015fvurucunun esas \u015fik\u00e2yeti \u00e7al\u0131\u015fmakta oldu\u011fu vak\u0131f \u00fcniversitesinin kapat\u0131lmas\u0131 sonucunda i\u015f s\u00f6zle\u015fmesinin feshedilmesi \u00fczerine a\u00e7\u0131lan davan\u0131n esas\u0131n\u0131n incelenmemesine y\u00f6nelik oldu\u011fu de\u011ferlendirildi\u011finde ba\u015fvurunun mahkemeye eri\u015fim hakk\u0131 kapsam\u0131nda incelenmesi gerekti\u011fini de\u011ferlendirmi\u015ftir.<\/p>\n<p>1. Kabul Edilebilirlik Y\u00f6n\u00fcnden <\/p>\n<p>20. A\u00e7\u0131k\u00e7a dayanaktan yoksun olmad\u0131\u011f\u0131 ve kabul edilemezli\u011fine karar verilmesini gerektirecek ba\u015fka bir neden de bulunmad\u0131\u011f\u0131 anla\u015f\u0131lan mahkemeye eri\u015fim hakk\u0131n\u0131n ihlal edildi\u011fine ili\u015fkin ba\u015fvurunun kabul edilebilir oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>2. Esas Y\u00f6n\u00fcnden<\/p>\n<p>a. M\u00fcdahalenin Varl\u0131\u011f\u0131 ve Hakk\u0131n Kapsam\u0131<\/p>\n<p>21. Anayasa&#8217;n\u0131n 36. maddesinin birinci f\u0131kras\u0131nda herkesin yarg\u0131 mercileri \u00f6n\u00fcnde davac\u0131 veya daval\u0131 olarak iddiada bulunma ve savunma hakk\u0131na sahip oldu\u011fu belirtilmi\u015ftir. Dolay\u0131s\u0131yla mahkemeye eri\u015fim hakk\u0131, Anayasa\u2019n\u0131n 36. maddesinde g\u00fcvence alt\u0131na al\u0131nan hak arama \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn bir unsurudur. Di\u011fer yandan Anayasa&#8217;n\u0131n 36. maddesine adil yarg\u0131lanma ibaresinin eklenmesine ili\u015fkin gerek\u00e7ede, T\u00fcrkiye&#8217;nin taraf oldu\u011fu uluslararas\u0131 s\u00f6zle\u015fmelerce de g\u00fcvence alt\u0131na al\u0131nan adil yarg\u0131lanma hakk\u0131n\u0131n madde metnine d\u00e2hil edildi\u011fi vurgulanm\u0131\u015ft\u0131r. Avrupa \u0130nsan Haklar\u0131 Mahkemesi, Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi&#8217;nin 6. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n mahkemeye eri\u015fim hakk\u0131n\u0131 i\u00e7erdi\u011fini belirtmektedir (\u00d6zbak\u0131m \u00d6zel Sa\u011fl\u0131k Hiz. \u0130n\u015f. Tur. San. ve Tic. Ltd. \u015eti., B. No:2014\/13156, 20\/4\/2017, \u00a7 34).<\/p>\n<p>22. Anayasa&#8217;n\u0131n 36. maddesinde g\u00fcvence alt\u0131na al\u0131nan hak arama \u00f6zg\u00fcrl\u00fc\u011f\u00fc, bir temel hak olman\u0131n yan\u0131nda di\u011fer temel hak ve \u00f6zg\u00fcrl\u00fcklerden gereken \u015fekilde yararlan\u0131lmas\u0131n\u0131 ve bunlar\u0131n korunmas\u0131n\u0131 sa\u011flayan en etkili g\u00fcvencelerden biridir. Bu bak\u0131mdan davan\u0131n bir mahkeme taraf\u0131ndan g\u00f6r\u00fclebilmesi ve ki\u015finin adil yarg\u0131lanma hakk\u0131 kapsam\u0131na giren g\u00fcvencelerden faydalanabilmesi i\u00e7in ilk olarak ki\u015fiye iddialar\u0131n\u0131 ortaya koyma imk\u00e2n\u0131n\u0131n tan\u0131nmas\u0131 gerekir. Di\u011fer bir ifadeyle dava yoksa adil yarg\u0131lanma hakk\u0131n\u0131n sa\u011flad\u0131\u011f\u0131 g\u00fcvencelerden yararlanmak m\u00fcmk\u00fcn olamaz (Mohammed Aynosah, B. No: 2013\/8896, 23\/2\/2016, \u00a7 33).<\/p>\n<p>23. Anayasa Mahkemesi, bireysel ba\u015fvuru kapsam\u0131nda yapt\u0131\u011f\u0131 de\u011ferlendirmelerde mahkemeye eri\u015fim hakk\u0131n\u0131n bir uyu\u015fmazl\u0131\u011f\u0131 mahkeme \u00f6n\u00fcne ta\u015f\u0131yabilmek ve uyu\u015fmazl\u0131\u011f\u0131n etkili bir \u015fekilde karara ba\u011flanmas\u0131n\u0131 isteyebilmek anlam\u0131na geldi\u011fini ifade etmi\u015ftir (\u00d6zkan \u015een, B. No: 2012\/791, 7\/11\/2013, \u00a7 52).<\/p>\n<p>24. \u00d6te yandan Anayasa&#8217;n\u0131n 36. maddesinin ikinci f\u0131kras\u0131nda hi\u00e7bir mahkemenin g\u00f6rev ve yetkisi i\u00e7indeki davaya bakmaktan ka\u00e7\u0131namayaca\u011f\u0131 belirtilmi\u015ftir. Bu ba\u011flamda adil yarg\u0131lanma hakk\u0131, ko\u015fullar\u0131 bulundu\u011fu takdirde ki\u015filere davan\u0131n g\u00f6r\u00fcld\u00fc\u011f\u00fc mahkemeden uyu\u015fmazl\u0131\u011f\u0131n esas\u0131n\u0131n incelenmesini isteme g\u00fcvencesini de sa\u011flar (Ahmet \u00d6zdo\u011fan, B. No: 2017\/26326, 9\/1\/2019, \u00a7 35).<\/p>\n<p>25. Somut ba\u015fvuruya konu davada Mahkemece idari davaya konu bir i\u015flem bulunmad\u0131\u011f\u0131 gerek\u00e7esiyle davan\u0131n incelenmeksizin reddine karar verilmi\u015ftir. Dolay\u0131s\u0131yla ba\u015fvurucunun i\u015f akdinin feshedilmesi i\u015fleminin iptali istemli a\u00e7t\u0131\u011f\u0131 davan\u0131n esas\u0131 hakk\u0131nda bir inceleme yap\u0131lmad\u0131\u011f\u0131ndan mahkemeye eri\u015fim hakk\u0131na y\u00f6nelik bir m\u00fcdahalenin bulundu\u011fu g\u00f6r\u00fclmektedir.<\/p>\n<p>b. M\u00fcdahalenin \u0130hlal Olu\u015fturup Olu\u015fturmad\u0131\u011f\u0131<\/p>\n<p>26. Adil yarg\u0131lanma hakk\u0131n\u0131n g\u00f6r\u00fcn\u00fcmlerinden biri olan mahkemeye eri\u015fim hakk\u0131, mutlak bir hak olmay\u0131p bu hakk\u0131n s\u0131n\u0131rland\u0131r\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr. Ancak mahkemeye eri\u015fim hakk\u0131na m\u00fcdahalede bulunulurken temel hak ve \u00f6zg\u00fcrl\u00fcklerin s\u0131n\u0131rland\u0131r\u0131lmas\u0131na ili\u015fkin genel ilkeleri d\u00fczenleyen Anayasa&#8217;n\u0131n 13. maddesinin g\u00f6z\u00f6n\u00fcnde bulundurulmas\u0131 gerekmektedir.<\/p>\n<p>27. Anayasa&#8217;n\u0131n 13. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Temel hak ve h\u00fcrriyetler, \u00f6zlerine dokunulmaks\u0131z\u0131n yaln\u0131zca Anayasan\u0131n ilgili maddelerinde belirtilen sebeplere ba\u011fl\u0131 olarak ve ancak kanunla s\u0131n\u0131rlanabilir. Bu s\u0131n\u0131rlamalar, Anayasan\u0131n s\u00f6z\u00fcne ve ruhuna, demokratik toplum d\u00fczeninin ve l\u00e2ik Cumhuriyetin gereklerine ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olamaz.&#8221;<\/p>\n<p>28. An\u0131lan madde uyar\u0131nca temel hak ve \u00f6zg\u00fcrl\u00fckler, demokratik toplum d\u00fczeninin gereklerine ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olmaks\u0131z\u0131n Anayasa&#8217;n\u0131n ilgili maddelerinde belirtilen sebeplere ba\u011fl\u0131 olarak ve ancak kanunla s\u0131n\u0131rlanabilir. Bu nedenle \u00f6ncelikle ba\u015fvurucunun mahkemeye eri\u015fim hakk\u0131na yap\u0131lan m\u00fcdahalenin kanuni dayana\u011f\u0131n\u0131n bulunup bulunmad\u0131\u011f\u0131n\u0131n incelenmesi gerekir.<\/p>\n<p>29. Hak ve \u00f6zg\u00fcrl\u00fcklerin, bunlara yap\u0131lacak m\u00fcdahalelerin ve s\u0131n\u0131rland\u0131rmalar\u0131n kanunla d\u00fczenlenmesi bu haklara ve \u00f6zg\u00fcrl\u00fcklere keyf\u00ee m\u00fcdahaleyi engelleyen, hukuk g\u00fcvenli\u011fini sa\u011flayan demokratik hukuk devletinin en \u00f6nemli unsurlar\u0131ndan biridir (Tahsin Erdo\u011fan, B. No: 2012\/1246, 6\/2\/2014, \u00a7 60).<\/p>\n<p>30. M\u00fcdahalenin kanuna dayal\u0131 olmas\u0131 \u00f6ncelikle \u015fekl\u00ee manada bir kanunun varl\u0131\u011f\u0131n\u0131 zorunlu k\u0131lar. \u015eekl\u00ee manada kanun, T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi (TBMM) taraf\u0131ndan Anayasa&#8217;da belirtilen usule uygun olarak kanun ad\u0131 alt\u0131nda \u00e7\u0131kar\u0131lan d\u00fczenleyici yasama i\u015flemidir. Hak ve \u00f6zg\u00fcrl\u00fcklere m\u00fcdahale edilmesi ancak yasama organ\u0131nca kanun ad\u0131 alt\u0131nda \u00e7\u0131kar\u0131lan d\u00fczenleyici i\u015flemlerde m\u00fcdahaleye imk\u00e2n tan\u0131yan bir h\u00fckm\u00fcn bulunmas\u0131 \u015fart\u0131na ba\u011fl\u0131d\u0131r. TBMM taraf\u0131ndan \u00e7\u0131kar\u0131lan \u015fekl\u00ee anlamda bir kanun h\u00fckm\u00fcn\u00fcn bulunmamas\u0131 hakka yap\u0131lan m\u00fcdahaleyi anayasal temelden yoksun b\u0131rak\u0131r (Ali H\u0131d\u0131r Akyol ve di\u011ferleri [GK], B. No: 2015\/17510, 18\/10\/2017, \u00a7 56).<\/p>\n<p>31. Mahkemeye eri\u015fim hakk\u0131na yap\u0131lan m\u00fcdahalenin kanuni dayana\u011f\u0131 ba\u011flam\u0131nda Anayasa Mahkemesinin yapaca\u011f\u0131 denetim \u00f6ncelikle m\u00fcdahaleye imk\u00e2n tan\u0131yan \u015fekl\u00ee manada bir kanunun bulunup bulunmad\u0131\u011f\u0131n\u0131n tespitini gerektirmektedir. Anayasa Mahkemesi kural olarak bu kanunun do\u011fru uygulan\u0131p uygulanmayaca\u011f\u0131yla kanunilik denetimi ba\u011flam\u0131nda ilgilenmemektedir ancak kanunun a\u00e7\u0131k lafz\u0131na ayk\u0131r\u0131 bir uygulaman\u0131n bulundu\u011funun tespiti h\u00e2linde m\u00fcdahalenin kanuni dayana\u011f\u0131n\u0131n bulunmad\u0131\u011f\u0131 sonucuna ula\u015fabilecektir.<\/p>\n<p>32. \u00d6te yandan kanunun varl\u0131\u011f\u0131 kadar kanun metninin ve uygulamas\u0131n\u0131n da bireylerin davran\u0131\u015flar\u0131n\u0131n sonucunu \u00f6ng\u00f6rebilece\u011fi kadar hukuki belirlilik ta\u015f\u0131mas\u0131 gerekir. Bir di\u011fer ifadeyle kanunun kalitesi de kanunilik ko\u015fulunun sa\u011flan\u0131p sa\u011flanmad\u0131\u011f\u0131n\u0131n tespitinde \u00f6nem arz etmektedir (Necmiye \u00c7ift\u00e7i ve di\u011ferleri, B. No: 2013\/1301, 30\/12\/2014, \u00a7 55). M\u00fcdahalenin kanuna dayal\u0131 olmas\u0131, i\u00e7 hukukta m\u00fcdahaleye ili\u015fkin yeterince ula\u015f\u0131labilir ve \u00f6ng\u00f6r\u00fclebilir kurallar\u0131n bulunmas\u0131n\u0131 gerektirmektedir (T\u00fcrkiye \u0130\u015f Bankas\u0131 A.\u015e. [GK], B. No: 2014\/6192, 12\/11\/2014, \u00a7 44).<\/p>\n<p>33. Ba\u015fvuru konusu uyu\u015fmazl\u0131k ele al\u0131nd\u0131\u011f\u0131nda davan\u0131n, dava \u015fart\u0131n\u0131n sa\u011flanmamas\u0131 sebebiyle usulden reddedildi\u011fi g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Mahkeme, ba\u015fvurucunun \u00e7al\u0131\u015ft\u0131\u011f\u0131 \u00fcniversitenin 667 say\u0131l\u0131 KHK ile kapat\u0131lmas\u0131 sonucunda i\u015f s\u00f6zle\u015fmesinin hi\u00e7bir i\u015fleme gerek kalmaks\u0131z\u0131n sona erdi\u011fi, idare taraf\u0131ndan hi\u00e7bir i\u015flem tesis edilmedi\u011fi ve KHK h\u00fckm\u00fcn\u00fcn idari yarg\u0131da dava konusu edilmesinin de m\u00fcmk\u00fcn bulunmad\u0131\u011f\u0131 gerek\u00e7elerine dayanm\u0131\u015ft\u0131r.<\/p>\n<p>34. \u00d6ncelikle Mahkemece dayanak al\u0131nan 667 say\u0131l\u0131 KHK&#8217;ya g\u00f6re kapat\u0131lan vak\u0131f \u00fcniversitelerinde \u00e7al\u0131\u015fan personelin i\u015f s\u00f6zle\u015fmesinin sona erece\u011fine dair bir d\u00fczenleme mevcut de\u011fildir. \u00d6te yandan 2547 say\u0131l\u0131 Kanun&#8217;da faaliyeti sonland\u0131r\u0131lan vak\u0131f y\u00fcksek\u00f6\u011fretim kurumlar\u0131nda \u00e7al\u0131\u015fan akademik ve di\u011fer personelin hizmet s\u00f6zle\u015fmeleri hakk\u0131nda 22\/5\/2003 tarihli ve 4857 say\u0131l\u0131 \u0130\u015f Kanunu&#8217;nun uygulanaca\u011f\u0131 belirtilmi\u015ftir (bkz. \u00a7 11). Bununla birlikte Mahkeme karar\u0131nda da de\u011finilen Y\u00f6netmelik&#8217;te faaliyeti sonland\u0131r\u0131lan vak\u0131f \u00fcniversitelerinde \u00e7al\u0131\u015fanlar\u0131n i\u015f s\u00f6zle\u015fmelerinin kendili\u011finden sona erece\u011fine dair bir d\u00fczenleme bulunmaktad\u0131r (bkz. \u00a7 13). Bunun yan\u0131nda Genelgede de 667 say\u0131l\u0131 KHK gere\u011fince kapat\u0131lan kurum \u00e7al\u0131\u015fanlar\u0131n\u0131n i\u015f s\u00f6zle\u015fmelerinin hangi tarihte sona ermi\u015f say\u0131laca\u011f\u0131na ve bu ki\u015filerin sosyal g\u00fcvenlik kay\u0131tlar\u0131na y\u00f6nelik bilgilere yer verilmi\u015ftir (bkz. \u00a7 14). T\u00fcm bunlara ra\u011fmen Mahkemece 667 say\u0131l\u0131 KHK gere\u011fince i\u015f s\u00f6zle\u015fmesinin sona erdi\u011fi ve ba\u015fvurucu hakk\u0131nda idari bir i\u015flemin bulunmad\u0131\u011f\u0131 kabul\u00fc yap\u0131larak Y\u00f6netmelik ve Genelge h\u00fck\u00fcmleri g\u00f6zard\u0131 edilmi\u015ftir.<\/p>\n<p>35. \u00d6te yandan bireysel ba\u015fvuru yolunun ikincillik niteli\u011fi gere\u011fi ilgili mevzuat\u0131 yorumlamak yarg\u0131 mercilerinin g\u00f6revi olup Anayasa Mahkemesinin bireysel ba\u015fvuruda inceledi\u011fi husus, yarg\u0131 mercilerinin gerek\u00e7elerine esas yorumun \u00f6l\u00e7\u00fcl\u00fc olup olmad\u0131\u011f\u0131 ve buna g\u00f6re Anayasa&#8217;da g\u00fcvence alt\u0131na temel hak ve \u00f6zg\u00fcrl\u00fcklerinin ihlal edilip edilmedi\u011fidir (\u015eeyma Kayao\u011flu, B. No: 2014\/5491, 5\/7\/2017, \u00a7 53). \u00d6zellikle mahkemeye eri\u015fim hakk\u0131 olmak \u00fczere hak ve \u00f6zg\u00fcrl\u00fcklere getirilen s\u0131n\u0131rlay\u0131c\u0131 h\u00fck\u00fcmlerin geni\u015f yoruma tabi tutularak kanun koyucu taraf\u0131ndan ama\u00e7lanan\u0131n \u00f6tesinde s\u0131n\u0131rland\u0131r\u0131lmamas\u0131 gerekir. Eldeki uyu\u015fmazl\u0131kta da bu ilke \u00e7er\u00e7evesinde hareket edilecektir.<\/p>\n<p>36. Somut olayda ba\u015fvurucu, \u00fcniversitenin kapat\u0131lmas\u0131na y\u00f6nelik de\u011fil, s\u00f6zle\u015fmesinin feshedilmesinin hukuka ayk\u0131r\u0131 oldu\u011funu ileri s\u00fcrerek dava a\u00e7m\u0131\u015ft\u0131r. Bununla birlikte Mahkeme ba\u015fvurucunun s\u00f6zle\u015fmesinin KHK ile sona erdi\u011fini, ba\u015fvurucu hakk\u0131nda tesis edilen bir i\u015flem bulunmad\u0131\u011f\u0131n\u0131 kabul ederek, mahkemeye eri\u015fim hakk\u0131 y\u00f6n\u00fcnden s\u0131n\u0131rland\u0131r\u0131c\u0131 bir yorum geli\u015ftirerek davan\u0131n usulden reddine karar vermi\u015ftir.<\/p>\n<p>37. Yukar\u0131daki bilgiler dikkate al\u0131nd\u0131\u011f\u0131nda 667 say\u0131l\u0131 KHK&#8217;da ba\u015fvurucunun i\u015f s\u00f6zle\u015fmesinin sonlanaca\u011f\u0131na y\u00f6nelik bir d\u00fczenleme mevcut olmamas\u0131na ra\u011fmen Mahkemece ba\u015fvurucunun i\u015f s\u00f6zle\u015fmesinin KHK ile sonland\u0131\u011f\u0131 kabul edilerek davan\u0131n esas\u0131 incelenmemi\u015ftir. \u00d6te yandan Mahkemenin, ba\u015fvurucunun somut durumu ile do\u011frudan ilgili bulunan Genelge h\u00fck\u00fcmlerini dikkate almadan, ba\u015fvurucunun durumu hakk\u0131nda d\u00fczenleme bulunmayan 667 say\u0131l\u0131 KHK&#8217;y\u0131 yarg\u0131lamaya tatbiki ba\u015fvurucunun mahkemeye eri\u015fim hakk\u0131na kanuni dayana\u011f\u0131 bulunmayan bir m\u00fcdahale yaratm\u0131\u015ft\u0131r.<\/p>\n<p>38.
