S\u00f6z konusu d\u00fczenleme ile taraflar\u0131n uyu\u015fmazl\u0131klar\u0131n\u0131 yarg\u0131lamaya ba\u015fvurmadan \u00f6nce arabulucu huzurunda \u00e7\u00f6zmeleri te\u015fvik edilmekte; fakat bu te\u015fvik, taraflar\u0131n serbest iradelerine dayanmamakta, aksine yasal bir y\u00fck\u00fcml\u00fcl\u00fck olarak kendilerine zorunlu k\u0131l\u0131nmaktad\u0131r. Dolay\u0131s\u0131yla, arabuluculuk s\u00fcreci, taraflar\u0131n kendi tercihleriyle ba\u015fvurduklar\u0131 bir alternatif \u00e7\u00f6z\u00fcm y\u00f6ntemi olmay\u0131p, devletin yarg\u0131sal sisteme ili\u015fkin politika tercihi do\u011frultusunda bireylerin y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne d\u00f6n\u00fc\u015ft\u00fcr\u00fclm\u00fc\u015f bir \u00f6n a\u015famad\u0131r.<\/p>\n<p>Bu \u00e7er\u00e7evede zorunlu arabuluculuk s\u00fcreci, \u00f6z\u00fc itibar\u0131yla yarg\u0131lama s\u00fcrecine d\u00e2hil bir a\u015fama de\u011fildir. Yarg\u0131sal faaliyet ba\u015flamadan \u00f6nce i\u015fletilen, dava d\u0131\u015f\u0131 ve mahkeme d\u0131\u015f\u0131 bir s\u00fcre\u00e7tir. Arabuluculuk s\u00fcreci mahkeme taraf\u0131ndan de\u011fil, Adalet Bakanl\u0131\u011f\u0131 taraf\u0131ndan yetkilendirilmi\u015f arabulucular marifetiyle y\u00fcr\u00fct\u00fclmekte olup; delil de\u011ferlendirmesi, h\u00fck\u00fcm kurma yetkisi ve yarg\u0131lama hukuku teknikleriyle hi\u00e7bir ilgisi bulunmayan, tamamen g\u00f6n\u00fcll\u00fcl\u00fc\u011fe dayal\u0131 g\u00f6r\u00fc\u015fmelerden ibarettir. Ancak zorunlu olmas\u0131 nedeniyle bu g\u00f6n\u00fcll\u00fcl\u00fck ilkesi fiilen zay\u0131flam\u0131\u015f; taraflar, anla\u015famasalar bile bu s\u00fcrece kat\u0131lmak zorunda b\u0131rak\u0131lm\u0131\u015flard\u0131r.<\/p>\n<p>\u00d6zellikle uyu\u015fmazl\u0131\u011f\u0131n \u00e7\u00f6z\u00fcm\u00fcnde anla\u015fma sa\u011flanamayan dosyalarda, arabuluculuk faaliyeti sonunda olu\u015fan \u00fccretin, dava a\u00e7\u0131ld\u0131ktan sonra yarg\u0131lamada haks\u0131z \u00e7\u0131kan tarafa y\u00fckletilmesi uygulamas\u0131 ise, bu zorunlu s\u00fcrecin mant\u0131\u011f\u0131yla ve hukuki niteli\u011fiyle a\u00e7\u0131k\u00e7a \u00e7eli\u015fmektedir. Bu uygulama, hem 6100 say\u0131l\u0131 Hukuk Muhakemeleri Kanunu\u2019nun (HMK) 323. maddesinin lafz\u0131na hem de Anayasa\u2019da g\u00fcvence alt\u0131na al\u0131nan temel hak ve \u00f6zg\u00fcrl\u00fcklere a\u00e7\u0131k bir \u015fekilde ayk\u0131r\u0131d\u0131r.<\/p>\n<p>HMK m. 323 yarg\u0131lama giderlerini s\u0131n\u0131rl\u0131 olarak saymakta ve sadece yarg\u0131lama faaliyeti s\u0131ras\u0131nda do\u011fan, mahkemece y\u00f6netilen ve do\u011frudan yarg\u0131lamaya ili\u015fkin i\u015flemler kapsam\u0131nda olu\u015fan giderleri yarg\u0131lama gideri olarak kabul etmektedir. Bu kapsamda ba\u015fvurma harc\u0131, karar ve ilam harc\u0131, bilirki\u015fi ve tan\u0131k \u00fccretleri, ke\u015fif ve tebligat giderleri gibi kalemler yer almaktad\u0131r. Ancak, arabuluculuk s\u00fcreci dava \u00f6ncesinde ve mahkeme d\u0131\u015f\u0131nda y\u00fcr\u00fct\u00fcld\u00fc\u011f\u00fcnden, bu s\u00fcrece ili\u015fkin \u00fccret ve giderlerin HMK m. 323 kapsam\u0131nda de\u011ferlendirilmesi ve yarg\u0131lama gideri olarak h\u00fck\u00fcm alt\u0131na al\u0131nmas\u0131 hukuken m\u00fcmk\u00fcn de\u011fildir. Kanunda a\u00e7\u0131k\u00e7a say\u0131lmayan bir unsurun, yorum yoluyla geni\u015fletilerek yarg\u0131lama gideri kapsam\u0131na sokulmas\u0131 hukuki belirlilik ve \u00f6ng\u00f6r\u00fclebilirlik ilkeleriyle ba\u011fda\u015fmaz.<\/p>\n<p>Daha da \u00f6nemlisi, zorunlu arabuluculuk s\u00fcreci sonunda anla\u015fma sa\u011flanamamas\u0131 halinde ortaya \u00e7\u0131kan \u00fccretin &#8220;haks\u0131z \u00e7\u0131kan tarafa&#8221; y\u00fckletilmesi uygulamas\u0131, hukuki olmaktan ziyade cezaland\u0131r\u0131c\u0131 bir nitelik ta\u015f\u0131makta; uzla\u015famayan taraf\u0131 ekonomik olarak cezaland\u0131rmakta ve bireylerin hak arama \u00f6zg\u00fcrl\u00fc\u011f\u00fc \u00fczerinde dolayl\u0131 bask\u0131 yaratmaktad\u0131r. Bu uygulama ile ki\u015fi, dava a\u00e7ma hakk\u0131n\u0131 kullanmadan \u00f6nce, devlet taraf\u0131ndan zorunlu k\u0131l\u0131nan bir s\u00fcrece kat\u0131lmakta; ancak bu s\u00fcre\u00e7ten sonu\u00e7 al\u0131namamas\u0131 halinde ayr\u0131ca cezaland\u0131r\u0131lmaktad\u0131r. Bu durum, sadece bireyin dava a\u00e7ma iradesini de\u011fil, ayn\u0131 zamanda yarg\u0131 yoluna ba\u015fvurma hakk\u0131n\u0131 da zedelemektedir.<\/p>\n<p>Anayasa\u2019n\u0131n 36. maddesinde g\u00fcvence alt\u0131na al\u0131nan hak arama h\u00fcrriyeti, bireyin herhangi bir hak ihlali kar\u015f\u0131s\u0131nda yarg\u0131 mercilerine ba\u015fvurma, mahkeme \u00f6n\u00fcnde iddia ve savunma hakk\u0131n\u0131 kullanma ve etkili bir \u015fekilde yarg\u0131sal koruma talep etme hakk\u0131n\u0131 kapsar. Bu hakk\u0131n sadece \u015fekli olarak tan\u0131nmas\u0131 yeterli de\u011fildir; ayn\u0131 zamanda bu hakk\u0131n kullan\u0131labilir ve ula\u015f\u0131labilir olmas\u0131 gerekir. Zorunlu arabuluculuk s\u00fcrecine kat\u0131lmak bir y\u00fck\u00fcml\u00fcl\u00fck oldu\u011funa g\u00f6re, bu s\u00fcre\u00e7ten do\u011fan masraflar\u0131n da bireyler \u00fczerinde orant\u0131s\u0131z bir ekonomik k\u00fclfete d\u00f6n\u00fc\u015fmemesi gerekir. Aksi halde, bu y\u00fck\u00fcml\u00fcl\u00fck hak arama h\u00fcrriyetine dolayl\u0131 bir m\u00fcdahale te\u015fkil eder.<\/p>\n<p>Anayasa\u2019n\u0131n 13. maddesi uyar\u0131nca temel hak ve \u00f6zg\u00fcrl\u00fckler yaln\u0131zca kanunla s\u0131n\u0131rlanabilir ve bu s\u0131n\u0131rlamalar, demokratik toplum d\u00fczeninin gereklerine ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olamaz. \u00d6l\u00e7\u00fcl\u00fcl\u00fck ilkesi ise elveri\u015flilik, gereklilik ve orant\u0131l\u0131l\u0131k alt ilkelerini i\u00e7erir. Zorunlu arabuluculuk \u00fccretinin anla\u015famama halinde sadece davay\u0131 kaybeden tarafa y\u00fckletilmesi uygulamas\u0131, bu \u00e7er\u00e7evede de\u011ferlendirildi\u011finde \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine a\u00e7\u0131k\u00e7a ayk\u0131r\u0131d\u0131r. \u00d6ncelikle, bu uygulaman\u0131n arabuluculu\u011fu te\u015fvik edici y\u00f6n\u00fc yoktur; \u00e7\u00fcnk\u00fc taraflar zaten bu s\u00fcrece girmeye zorunludur. \u0130kinci olarak, uzla\u015famama bir kusur de\u011fil, iki taraf\u0131n kar\u015f\u0131l\u0131kl\u0131 etkile\u015fimden do\u011fan bir sonu\u00e7tur. Dolay\u0131s\u0131yla bunun sorumlulu\u011funu sadece bir tarafa y\u00fcklemek gereklilik kriterini kar\u015f\u0131lamamaktad\u0131r. Son olarak, bu uygulama taraflardan birine a\u015f\u0131r\u0131 bir k\u00fclfet y\u00fcklemekte ve bu y\u00fck, kamu yarar\u0131 amac\u0131n\u0131 ger\u00e7ekle\u015ftirmek i\u00e7in gerekli olan\u0131n \u00f6tesine ge\u00e7mektedir.<\/p>\n<p>Anayasa\u2019n\u0131n 10. maddesiyle g\u00fcvence alt\u0131na al\u0131nan e\u015fitlik ilkesi \u00e7er\u00e7evesinde, benzer durumdaki ki\u015filerin ayn\u0131 hukuk kurallar\u0131na tabi tutulmas\u0131 gerekir. Oysa zorunlu arabuluculuk s\u00fcrecinde, anla\u015famayan taraflardan sadece davay\u0131 kaybeden ki\u015fiye masraf y\u00fckletilmesi, e\u015fit durumdaki bireylerin farkl\u0131 \u015fekilde muamele g\u00f6rmesine yol a\u00e7maktad\u0131r. Uzla\u015fma sa\u011flanamamas\u0131 iki taraf\u0131n ortak fiilidir ve bunda yaln\u0131zca daval\u0131 ya da davac\u0131 taraf\u0131n etkili oldu\u011funu s\u00f6ylemek m\u00fcmk\u00fcn de\u011fildir. Buna ra\u011fmen sadece bir taraf\u0131n ekonomik y\u00fck\u00fcml\u00fcl\u00fc\u011fe tabi tutulmas\u0131, e\u015fitlik ilkesinin \u00f6z\u00fcne ayk\u0131r\u0131d\u0131r.<\/p>\n<p>Uygulamada ise k\u0131smen kabul ve k\u0131smet ret hali bamba\u015fka bir tart\u0131\u015fma konusudur.<\/p>\n<p>6325 say\u0131l\u0131 HUAK m.18\/A&#8217;n\u0131n 14. f\u0131kras\u0131nda yaln\u0131zca \u201chaks\u0131z \u00e7\u0131kan taraftan tahsil olunaca\u011f\u0131\u201d h\u00fckm\u00fcne yer verilmi\u015ftir. Ancak somut olayda dava k\u0131smen kabul, k\u0131smen ret \u015feklinde sonu\u00e7lanm\u0131\u015ft\u0131r. Bu haliyle taraflardan hangisinin \u201chaks\u0131z \u00e7\u0131kan taraf\u201d olarak nitelendirilece\u011fi belirsizdir. HUAK m.18\/A&#8217;da bu t\u00fcr k\u0131smi kararlar bak\u0131m\u0131ndan herhangi bir a\u00e7\u0131kl\u0131k da bulunmamaktad\u0131r. Ayr\u0131ca belirtmek gerekir ki, HMK m. 323\u2019te yarg\u0131lama giderleri a\u00e7\u0131k\u00e7a say\u0131lm\u0131\u015f olup; arabuluculuk s\u00fcrecine ili\u015fkin bu t\u00fcr bir masraf, yarg\u0131lama gideri kapsam\u0131nda de\u011ferlendirilmemektedir.<\/p>\n<p>Dolay\u0131s\u0131yla bu masraf\u0131n dava sonunda yarg\u0131lama gideri gibi ele al\u0131narak h\u00fck\u00fcm alt\u0131na al\u0131nmas\u0131, hem kanuni dayanaktan yoksun hem de usul hukuku ilkeleriyle ba\u011fda\u015fmamaktad\u0131r. Bu durumda, daval\u0131n\u0131n s\u00f6z konusu arabuluculuk \u00fccretinin tamam\u0131ndan sorumlu tutulmas\u0131 hukuken m\u00fcmk\u00fcn de\u011fildir. Zira ortada gerek HUAK\u2019ta gerekse HMK\u2019da a\u00e7\u0131k bir d\u00fczenleme bulunmamakta; bu husus bir kanun bo\u015flu\u011fu olu\u015fturmaktad\u0131r. \u00d6te yandan HMK sistemati\u011finde k\u0131yas yasa\u011f\u0131 dikkate al\u0131nd\u0131\u011f\u0131nda, yarg\u0131lama gideri say\u0131lmayan bu masraf\u0131n oransal olarak payla\u015ft\u0131r\u0131lmas\u0131 da m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p>Bununla birlikte k\u0131smet kabul\/k\u0131smet ret kararlar\u0131nda bazen yaln\u0131zca daval\u0131 tarafa y\u00fckletilen arabuluculuk \u00fccreti bazen de kanunda bulunmamakla birlikte kabul\/ret oran\u0131na orant\u0131l\u0131 bir \u015fekilde b\u00f6l\u00fcnmektedir.<\/p>\n<p>Zorunlu arabuluculuk uygulamas\u0131n\u0131n \u00f6z\u00fc kamu yarar\u0131na dayanmaktad\u0131r. Bu sistem, bireylerin lehine de\u011fil; yarg\u0131n\u0131n i\u015f y\u00fck\u00fcn\u00fc azaltmak, mahkemelerin daha etkin \u00e7al\u0131\u015fmas\u0131n\u0131 sa\u011flamak amac\u0131yla getirilmi\u015ftir. Yani bireysel hak ve \u00f6zg\u00fcrl\u00fckleri geli\u015ftirmekten ziyade, kamu hizmetinin verimlili\u011fini art\u0131rma y\u00f6n\u00fcnde idari bir ara\u00e7t\u0131r. Hal b\u00f6yleyken, kamu yarar\u0131n\u0131 hedefleyen ve bireyin tercihine ba\u011fl\u0131 olmayan bir sistemin ekonomik y\u00fck\u00fcn\u00fcn bireye y\u00fcklenmesi, y\u00fcr\u00fctmenin fonksiyonlar\u0131ndan kaynaklanan maliyetlerin vatanda\u015flara y\u00fcklenmesi anlam\u0131na gelir. Bu da klasik kamu hukuku prensiplerinden olan &#8220;idari i\u015flemden do\u011fan k\u00fclfetin kamuca kar\u015f\u0131lanmas\u0131&#8221; ilkesine ayk\u0131r\u0131l\u0131k te\u015fkil eder.<\/p>\n<p>Ekonomik y\u00fcklerin ki\u015filere yarg\u0131sal g\u00fcvence olmadan y\u00fckletilmesi, bireylerin yarg\u0131 \u00f6n\u00fcnde haklar\u0131n\u0131 aramaktan \u00e7ekinmelerine neden olur. Bu durum, hukuk devletinin en temel unsurlar\u0131ndan biri olan etkili ba\u015fvuru hakk\u0131n\u0131 i\u015flevsiz hale getirir. Zorunlu arabuluculuk s\u00fcreci sonunda anla\u015fma sa\u011flanamamas\u0131 halinde arabuluculuk \u00fccretinin tek tarafa y\u00fckletilmesi, bireylerin dava a\u00e7ma karar\u0131 verirken sadece hukuki gerek\u00e7eleri de\u011fil; ekonomik endi\u015feleri de hesaba katmalar\u0131na neden olur. Bu da bireylerin adalete eri\u015fim hakk\u0131 \u00fczerinde cayd\u0131r\u0131c\u0131 bir etki yarat\u0131r.<\/p>\n<p>Bu nedenle, dava \u015fart\u0131 olarak d\u00fczenlenen zorunlu arabuluculuk s\u00fcreci sonucunda ortaya \u00e7\u0131kan \u00fccretin anla\u015fma sa\u011flanamamas\u0131 halinde yaln\u0131zca davay\u0131 kaybeden tarafa y\u00fckletilmesi uygulamas\u0131ndan vazge\u00e7ilmesi, bu masraflar\u0131n ya taraflar aras\u0131nda e\u015fit olarak payla\u015ft\u0131r\u0131lmas\u0131 ya da kamu taraf\u0131ndan kar\u015f\u0131lanmas\u0131, anayasal ilkeler ve hukuki sistemin dengesi a\u00e7\u0131s\u0131ndan zorunludur. Aksi halde, bireyler devletin kamu yarar\u0131n\u0131 g\u00f6zeten bir d\u00fczenlemesi nedeniyle ekonomik olarak cezaland\u0131r\u0131lmakta; bu da Anayasa ve hukuk devleti ilkesi ile ba\u011fda\u015fmamaktad\u0131r.<\/p>\n<p>T\u00fcrk hukuk sistemi i\u00e7erisinde, \u00f6zellikle son on y\u0131ll\u0131k d\u00f6nemde mahkemelerin i\u015f y\u00fck\u00fcn\u00fc azaltma amac\u0131yla sistematik bi\u00e7imde geni\u015fletilen arabuluculuk kurumu, giderek neredeyse kutsal bir \u00f6ge h\u00e2line getirilmi\u015f, ele\u015ftiriler kar\u015f\u0131s\u0131nda adeta dokunulmazl\u0131k kazanm\u0131\u015f bir yap\u0131ya b\u00fcr\u00fcnd\u00fcr\u00fclm\u00fc\u015ft\u00fcr. \u00d6zellikle \u00f6deme y\u00fck\u00fcml\u00fcs\u00fc taraf\u0131n \u00fclkedeki y\u00fcksek enflasyon ve uzun yarg\u0131lama s\u00fcre\u00e7leri \u00e7er\u00e7evesinde giri\u015fti\u011fi haks\u0131z pazarl\u0131klar\u0131n odak noktas\u0131 olmas\u0131 kar\u015f\u0131s\u0131nda hi\u00e7 kimse bu kurumu ele\u015ftirememektedir. Oysa hukukta hi\u00e7bir m\u00fcessese mutlakla\u015ft\u0131r\u0131lamaz; her d\u00fczenleme kamu yarar\u0131, bireysel haklar ve temel ilkeler bak\u0131m\u0131ndan s\u00fcrekli olarak tart\u0131\u015fmaya, g\u00f6zden ge\u00e7irilmeye ve geli\u015ftirmeye a\u00e7\u0131k olmal\u0131d\u0131r.<\/p>\n<p>Ne var ki arabuluculuk, uygulamada \u201cuzla\u015fmaz olan haks\u0131zd\u0131r\u201d \u015feklinde bir alg\u0131 yaratmakta, bu alg\u0131 ise hem hak arama \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc hem de yarg\u0131 erkinin varl\u0131k nedenini g\u00f6lgede b\u0131rakmaktad\u0131r. \u00d6zellikle zorunlu arabuluculuk kapsam\u0131na al\u0131nan alanlarda, arabuluculu\u011fa ba\u015fvurmayan\u0131n davas\u0131 usulden reddedilmekte; ba\u015fvuran ama uzla\u015fmayan taraf ise \u00e7o\u011fu zaman, sadece davay\u0131 kaybetti\u011fi gerek\u00e7esiyle arabuluculuk \u00fccretinin tamam\u0131ndan sorumlu tutulmaktad\u0131r. Bu durum, hukuk sisteminin temel ta\u015f\u0131 olan \u201ce\u015fitlik\u201d, \u201cadalet\u201d, \u201c\u00f6l\u00e7\u00fcl\u00fcl\u00fck\u201d ve \u201ctarafs\u0131zl\u0131k\u201d ilkelerini a\u00e7\u0131k\u00e7a zedelemektedir.<\/p>\n<p>Sonu\u00e7 olarak, 6325 say\u0131l\u0131 Hukuk Uyu\u015fmazl\u0131klar\u0131nda Arabuluculuk Kanunu\u2019nun 18\/A maddesinin 14. f\u0131kras\u0131nda yer alan, \u201canla\u015fma sa\u011flanamayan hallerde arabuluculuk \u00fccretinin tamam\u0131n\u0131n dava sonunda haks\u0131z \u00e7\u0131kan tarafa y\u00fckletilece\u011fi\u201d y\u00f6n\u00fcndeki d\u00fczenleme; 6100 say\u0131l\u0131 Hukuk Muhakemeleri Kanunu\u2019nun 323. maddesinde tahdidi olarak say\u0131lm\u0131\u015f olan yarg\u0131lama giderleri aras\u0131nda a\u00e7\u0131k\u00e7a yer almayan bir kalemin, geni\u015fletici yorum yoluyla yarg\u0131lama gideri say\u0131lmas\u0131na yol a\u00e7makta; bu da hem kanunilik, hukuki g\u00fcvenlik ve belirlilik ilkeleri hem de anayasal temel haklar a\u00e7\u0131s\u0131ndan ciddi sorunlara neden olmaktad\u0131r.<\/p>\n<p>Dolay\u0131s\u0131yla, HUAK m. 18\/A f.14 h\u00fckm\u00fcn\u00fcn mevcut \u015fekliyle uygulanmas\u0131, hem HMK sistemati\u011fiyle hem de Anayasa\u2019n\u0131n 10., 13. ve 36. maddeleriyle ba\u011fda\u015fmamaktad\u0131r. Bu durumun giderilmesi, yaln\u0131zca uygulama i\u00e7tihatlar\u0131yla de\u011fil, mevzuatta a\u00e7\u0131k ve d\u00fczenleyici bir de\u011fi\u015fiklik yap\u0131lmas\u0131yla m\u00fcmk\u00fcnd\u00fcr. Arabuluculuk \u00fccretinin yarg\u0131lama gideri say\u0131labilmesi i\u00e7in, HMK m. 323\u2019te a\u00e7\u0131k\u00e7a d\u00fczenlenmesi gerekir; aksi halde bu \u00fccretin ilamlarla taraflara y\u00fckletilmesi, yetki a\u015f\u0131m\u0131, kanunsuzluk ve anayasal ihlal do\u011furmaya devam edecektir.<\/p>\n<p>Bu nedenle, ilgili normlar aras\u0131nda uyum sa\u011flanmas\u0131 ve hak ihlallerinin \u00f6nlenmesi amac\u0131yla, HUAK m.18\/A f.14 h\u00fckm\u00fcn\u00fcn yeniden ele al\u0131nmas\u0131 ve yarg\u0131lama giderlerine ili\u015fkin d\u00fczenlemelerle uyumlu hale getirilmesi y\u00f6n\u00fcnde yasa koyucu taraf\u0131ndan ivedi bir mevzuat de\u011fi\u015fikli\u011fine gidilmesi zorunluluk arz etmektedir.<\/p>\n<p>\u200bZorunlu arabuluculuk s\u00fcreci, 6325 say\u0131l\u0131 Hukuk Uyu\u015fmazl\u0131klar\u0131nda Arabuluculuk Kanunu&#8217;nun 18\/A maddesi uyar\u0131nca baz\u0131 hukuk uyu\u015fmazl\u0131klar\u0131nda dava \u015fart\u0131 olarak d\u00fczenlenmi\u015f ve bu haliyle taraflar i\u00e7in yarg\u0131lamaya eri\u015fmeden \u00f6nce tamamlanmas\u0131 gereken zorunlu bir prosed\u00fcr haline getirilmi\u015ftir. S\u00f6z konusu d\u00fczenleme ile taraflar\u0131n uyu\u015fmazl\u0131klar\u0131n\u0131 yarg\u0131lamaya ba\u015fvurmadan \u00f6nce arabulucu huzurunda \u00e7\u00f6zmeleri te\u015fvik edilmekte; fakat bu te\u015fvik, taraflar\u0131n serbest iradelerine dayanmamakta, aksine yasal bir y\u00fck\u00fcml\u00fcl\u00fck olarak kendilerine zorunlu k\u0131l\u0131nmaktad\u0131r. Dolay\u0131s\u0131yla, arabuluculuk s\u00fcreci, taraflar\u0131n kendi tercihleriyle ba\u015fvurduklar\u0131 bir alternatif \u00e7\u00f6z\u00fcm y\u00f6ntemi olmay\u0131p, devletin yarg\u0131sal sisteme ili\u015fkin politika tercihi do\u011frultusunda bireylerin y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne d\u00f6n\u00fc\u015ft\u00fcr\u00fclm\u00fc\u015f bir \u00f6n a\u015famad\u0131r.<\/p>\n<p>Bu \u00e7er\u00e7evede zorunlu arabuluculuk s\u00fcreci, \u00f6z\u00fc itibar\u0131yla yarg\u0131lama s\u00fcrecine d\u00e2hil bir a\u015fama de\u011fildir. Yarg\u0131sal faaliyet ba\u015flamadan \u00f6nce i\u015fletilen, dava d\u0131\u015f\u0131 ve mahkeme d\u0131\u015f\u0131 bir s\u00fcre\u00e7tir. Arabuluculuk s\u00fcreci mahkeme taraf\u0131ndan de\u011fil, Adalet Bakanl\u0131\u011f\u0131 taraf\u0131ndan yetkilendirilmi\u015f arabulucular marifetiyle y\u00fcr\u00fct\u00fclmekte olup; delil de\u011ferlendirmesi, h\u00fck\u00fcm kurma yetkisi ve yarg\u0131lama hukuku teknikleriyle hi\u00e7bir ilgisi bulunmayan, tamamen g\u00f6n\u00fcll\u00fcl\u00fc\u011fe dayal\u0131 g\u00f6r\u00fc\u015fmelerden ibarettir. Ancak zorunlu olmas\u0131 nedeniyle bu g\u00f6n\u00fcll\u00fcl\u00fck ilkesi fiilen zay\u0131flam\u0131\u015f; taraflar, anla\u015famasalar bile bu s\u00fcrece kat\u0131lmak zorunda b\u0131rak\u0131lm\u0131\u015flard\u0131r.<\/p>\n<p>\u00d6zellikle uyu\u015fmazl\u0131\u011f\u0131n \u00e7\u00f6z\u00fcm\u00fcnde anla\u015fma sa\u011flanamayan dosyalarda, arabuluculuk faaliyeti sonunda olu\u015fan \u00fccretin, dava a\u00e7\u0131ld\u0131ktan sonra yarg\u0131lamada haks\u0131z \u00e7\u0131kan tarafa y\u00fckletilmesi uygulamas\u0131 ise, bu zorunlu s\u00fcrecin mant\u0131\u011f\u0131yla ve hukuki niteli\u011fiyle a\u00e7\u0131k\u00e7a \u00e7eli\u015fmektedir. Bu uygulama, hem 6100 say\u0131l\u0131 Hukuk Muhakemeleri Kanunu\u2019nun (HMK) 323. maddesinin lafz\u0131na hem de Anayasa\u2019da g\u00fcvence alt\u0131na al\u0131nan temel hak ve \u00f6zg\u00fcrl\u00fcklere a\u00e7\u0131k bir \u015fekilde ayk\u0131r\u0131d\u0131r.<\/p>\n<p>HMK m. 323 yarg\u0131lama giderlerini s\u0131n\u0131rl\u0131 olarak saymakta ve sadece yarg\u0131lama faaliyeti s\u0131ras\u0131nda do\u011fan, mahkemece y\u00f6netilen ve do\u011frudan yarg\u0131lamaya ili\u015fkin i\u015flemler kapsam\u0131nda olu\u015fan giderleri yarg\u0131lama gideri olarak kabul etmektedir. Bu kapsamda ba\u015fvurma harc\u0131, karar ve ilam harc\u0131, bilirki\u015fi ve tan\u0131k \u00fccretleri, ke\u015fif ve tebligat giderleri gibi kalemler yer almaktad\u0131r. Ancak, arabuluculuk s\u00fcreci dava \u00f6ncesinde ve mahkeme d\u0131\u015f\u0131nda y\u00fcr\u00fct\u00fcld\u00fc\u011f\u00fcnden, bu s\u00fcrece ili\u015fkin \u00fccret ve giderlerin HMK m. 323 kapsam\u0131nda de\u011ferlendirilmesi ve yarg\u0131lama gideri olarak h\u00fck\u00fcm alt\u0131na al\u0131nmas\u0131 hukuken m\u00fcmk\u00fcn de\u011fildir. Kanunda a\u00e7\u0131k\u00e7a say\u0131lmayan bir unsurun, yorum yoluyla geni\u015fletilerek yarg\u0131lama gideri kapsam\u0131na sokulmas\u0131 hukuki belirlilik ve \u00f6ng\u00f6r\u00fclebilirlik ilkeleriyle ba\u011fda\u015fmaz.<\/p>\n<p>Daha da \u00f6nemlisi, zorunlu arabuluculuk s\u00fcreci sonunda anla\u015fma sa\u011flanamamas\u0131 halinde ortaya \u00e7\u0131kan \u00fccretin &#8220;haks\u0131z \u00e7\u0131kan tarafa&#8221; y\u00fckletilmesi uygulamas\u0131, hukuki olmaktan ziyade cezaland\u0131r\u0131c\u0131 bir nitelik ta\u015f\u0131makta; uzla\u015famayan taraf\u0131 ekonomik olarak cezaland\u0131rmakta ve bireylerin hak arama \u00f6zg\u00fcrl\u00fc\u011f\u00fc \u00fczerinde dolayl\u0131 bask\u0131 yaratmaktad\u0131r. Bu uygulama ile ki\u015fi, dava a\u00e7ma hakk\u0131n\u0131 kullanmadan \u00f6nce, devlet taraf\u0131ndan zorunlu k\u0131l\u0131nan bir s\u00fcrece kat\u0131lmakta; ancak bu s\u00fcre\u00e7ten sonu\u00e7 al\u0131namamas\u0131 halinde ayr\u0131ca cezaland\u0131r\u0131lmaktad\u0131r. Bu durum, sadece bireyin dava a\u00e7ma iradesini de\u011fil, ayn\u0131 zamanda yarg\u0131 yoluna ba\u015fvurma hakk\u0131n\u0131 da zedelemektedir.<\/p>\n<p>Anayasa\u2019n\u0131n 36. maddesinde g\u00fcvence alt\u0131na al\u0131nan hak arama h\u00fcrriyeti, bireyin herhangi bir hak ihlali kar\u015f\u0131s\u0131nda yarg\u0131 mercilerine ba\u015fvurma, mahkeme \u00f6n\u00fcnde iddia ve savunma hakk\u0131n\u0131 kullanma ve etkili bir \u015fekilde yarg\u0131sal koruma talep etme hakk\u0131n\u0131 kapsar. Bu hakk\u0131n sadece \u015fekli olarak tan\u0131nmas\u0131 yeterli de\u011fildir; ayn\u0131 zamanda bu hakk\u0131n kullan\u0131labilir ve ula\u015f\u0131labilir olmas\u0131 gerekir. Zorunlu arabuluculuk s\u00fcrecine kat\u0131lmak bir y\u00fck\u00fcml\u00fcl\u00fck oldu\u011funa g\u00f6re, bu s\u00fcre\u00e7ten do\u011fan masraflar\u0131n da bireyler \u00fczerinde orant\u0131s\u0131z bir ekonomik k\u00fclfete d\u00f6n\u00fc\u015fmemesi gerekir. Aksi halde, bu y\u00fck\u00fcml\u00fcl\u00fck hak arama h\u00fcrriyetine dolayl\u0131 bir m\u00fcdahale te\u015fkil eder.<\/p>\n<p>Anayasa\u2019n\u0131n 13. maddesi uyar\u0131nca temel hak ve \u00f6zg\u00fcrl\u00fckler yaln\u0131zca kanunla s\u0131n\u0131rlanabilir ve bu s\u0131n\u0131rlamalar, demokratik toplum d\u00fczeninin gereklerine ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olamaz. \u00d6l\u00e7\u00fcl\u00fcl\u00fck ilkesi ise elveri\u015flilik, gereklilik ve orant\u0131l\u0131l\u0131k alt ilkelerini i\u00e7erir. Zorunlu arabuluculuk \u00fccretinin anla\u015famama halinde sadece davay\u0131 kaybeden tarafa y\u00fckletilmesi uygulamas\u0131, bu \u00e7er\u00e7evede de\u011ferlendirildi\u011finde \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine a\u00e7\u0131k\u00e7a ayk\u0131r\u0131d\u0131r. \u00d6ncelikle, bu uygulaman\u0131n arabuluculu\u011fu te\u015fvik edici y\u00f6n\u00fc yoktur; \u00e7\u00fcnk\u00fc taraflar zaten bu s\u00fcrece girmeye zorunludur. \u0130kinci olarak, uzla\u015famama bir kusur de\u011fil, iki taraf\u0131n kar\u015f\u0131l\u0131kl\u0131 etkile\u015fimden do\u011fan bir sonu\u00e7tur. Dolay\u0131s\u0131yla bunun sorumlulu\u011funu sadece bir tarafa y\u00fcklemek gereklilik kriterini kar\u015f\u0131lamamaktad\u0131r. Son olarak, bu uygulama taraflardan birine a\u015f\u0131r\u0131 bir k\u00fclfet y\u00fcklemekte ve bu y\u00fck, kamu yarar\u0131 amac\u0131n\u0131 ger\u00e7ekle\u015ftirmek i\u00e7in gerekli olan\u0131n \u00f6tesine ge\u00e7mektedir.<\/p>\n<p>Anayasa\u2019n\u0131n 10. maddesiyle g\u00fcvence alt\u0131na al\u0131nan e\u015fitlik ilkesi \u00e7er\u00e7evesinde, benzer durumdaki ki\u015filerin ayn\u0131 hukuk kurallar\u0131na tabi tutulmas\u0131 gerekir. Oysa zorunlu arabuluculuk s\u00fcrecinde, anla\u015famayan taraflardan sadece davay\u0131 kaybeden ki\u015fiye masraf y\u00fckletilmesi, e\u015fit durumdaki bireylerin farkl\u0131 \u015fekilde muamele g\u00f6rmesine yol a\u00e7maktad\u0131r. Uzla\u015fma sa\u011flanamamas\u0131 iki taraf\u0131n ortak fiilidir ve bunda yaln\u0131zca daval\u0131 ya da davac\u0131 taraf\u0131n etkili oldu\u011funu s\u00f6ylemek m\u00fcmk\u00fcn de\u011fildir. Buna ra\u011fmen sadece bir taraf\u0131n ekonomik y\u00fck\u00fcml\u00fcl\u00fc\u011fe tabi tutulmas\u0131, e\u015fitlik ilkesinin \u00f6z\u00fcne ayk\u0131r\u0131d\u0131r.<\/p>\n<p>Uygulamada ise k\u0131smen kabul ve k\u0131smet ret hali bamba\u015fka bir tart\u0131\u015fma konusudur.<\/p>\n<p>6325 say\u0131l\u0131 HUAK m.18\/A&#8217;n\u0131n 14. f\u0131kras\u0131nda yaln\u0131zca \u201chaks\u0131z \u00e7\u0131kan taraftan tahsil olunaca\u011f\u0131\u201d h\u00fckm\u00fcne yer verilmi\u015ftir. Ancak somut olayda dava k\u0131smen kabul, k\u0131smen ret \u015feklinde sonu\u00e7lanm\u0131\u015ft\u0131r. Bu haliyle taraflardan hangisinin \u201chaks\u0131z \u00e7\u0131kan taraf\u201d olarak nitelendirilece\u011fi belirsizdir. HUAK m.18\/A&#8217;da bu t\u00fcr k\u0131smi kararlar bak\u0131m\u0131ndan herhangi bir a\u00e7\u0131kl\u0131k da bulunmamaktad\u0131r. Ayr\u0131ca belirtmek gerekir ki, HMK m. 323\u2019te yarg\u0131lama giderleri a\u00e7\u0131k\u00e7a say\u0131lm\u0131\u015f olup; arabuluculuk s\u00fcrecine ili\u015fkin bu t\u00fcr bir masraf, yarg\u0131lama gideri kapsam\u0131nda de\u011ferlendirilmemektedir.<\/p>\n<p>Dolay\u0131s\u0131yla bu masraf\u0131n dava sonunda yarg\u0131lama gideri gibi ele al\u0131narak h\u00fck\u00fcm alt\u0131na al\u0131nmas\u0131, hem kanuni dayanaktan yoksun hem de usul hukuku ilkeleriyle ba\u011fda\u015fmamaktad\u0131r. Bu durumda, daval\u0131n\u0131n s\u00f6z konusu arabuluculuk \u00fccretinin tamam\u0131ndan sorumlu tutulmas\u0131 hukuken m\u00fcmk\u00fcn de\u011fildir. Zira ortada gerek HUAK\u2019ta gerekse HMK\u2019da a\u00e7\u0131k bir d\u00fczenleme bulunmamakta; bu husus bir kanun bo\u015flu\u011fu olu\u015fturmaktad\u0131r. \u00d6te yandan HMK sistemati\u011finde k\u0131yas yasa\u011f\u0131 dikkate al\u0131nd\u0131\u011f\u0131nda, yarg\u0131lama gideri say\u0131lmayan bu masraf\u0131n oransal olarak payla\u015ft\u0131r\u0131lmas\u0131 da m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p>Bununla birlikte k\u0131smet kabul\/k\u0131smet ret kararlar\u0131nda bazen yaln\u0131zca daval\u0131 tarafa y\u00fckletilen arabuluculuk \u00fccreti bazen de kanunda bulunmamakla birlikte kabul\/ret oran\u0131na orant\u0131l\u0131 bir \u015fekilde b\u00f6l\u00fcnmektedir.<\/p>\n<p>Zorunlu arabuluculuk uygulamas\u0131n\u0131n \u00f6z\u00fc kamu yarar\u0131na dayanmaktad\u0131r. Bu sistem, bireylerin lehine de\u011fil; yarg\u0131n\u0131n i\u015f y\u00fck\u00fcn\u00fc azaltmak, mahkemelerin daha etkin \u00e7al\u0131\u015fmas\u0131n\u0131 sa\u011flamak amac\u0131yla getirilmi\u015ftir. Yani bireysel hak ve \u00f6zg\u00fcrl\u00fckleri geli\u015ftirmekten ziyade, kamu hizmetinin verimlili\u011fini art\u0131rma y\u00f6n\u00fcnde idari bir ara\u00e7t\u0131r. Hal b\u00f6yleyken, kamu yarar\u0131n\u0131 hedefleyen ve bireyin tercihine ba\u011fl\u0131 olmayan bir sistemin ekonomik y\u00fck\u00fcn\u00fcn bireye y\u00fcklenmesi, y\u00fcr\u00fctmenin fonksiyonlar\u0131ndan kaynaklanan maliyetlerin vatanda\u015flara y\u00fcklenmesi anlam\u0131na gelir. Bu da klasik kamu hukuku prensiplerinden olan &#8220;idari i\u015flemden do\u011fan k\u00fclfetin kamuca kar\u015f\u0131lanmas\u0131&#8221; ilkesine ayk\u0131r\u0131l\u0131k te\u015fkil eder.<\/p>\n<p>Ekonomik y\u00fcklerin ki\u015filere yarg\u0131sal g\u00fcvence olmadan y\u00fckletilmesi, bireylerin yarg\u0131 \u00f6n\u00fcnde haklar\u0131n\u0131 aramaktan \u00e7ekinmelerine neden olur. Bu durum, hukuk devletinin en temel unsurlar\u0131ndan biri olan etkili ba\u015fvuru hakk\u0131n\u0131 i\u015flevsiz hale getirir. Zorunlu arabuluculuk s\u00fcreci sonunda anla\u015fma sa\u011flanamamas\u0131 halinde arabuluculuk \u00fccretinin tek tarafa y\u00fckletilmesi, bireylerin dava a\u00e7ma karar\u0131 verirken sadece hukuki gerek\u00e7eleri de\u011fil; ekonomik endi\u015feleri de hesaba katmalar\u0131na neden olur. Bu da bireylerin adalete eri\u015fim hakk\u0131 \u00fczerinde cayd\u0131r\u0131c\u0131 bir etki yarat\u0131r.<\/p>\n<p>Bu nedenle, dava \u015fart\u0131 olarak d\u00fczenlenen zorunlu arabuluculuk s\u00fcreci sonucunda ortaya \u00e7\u0131kan \u00fccretin anla\u015fma sa\u011flanamamas\u0131 halinde yaln\u0131zca davay\u0131 kaybeden tarafa y\u00fckletilmesi uygulamas\u0131ndan vazge\u00e7ilmesi, bu masraflar\u0131n ya taraflar aras\u0131nda e\u015fit olarak payla\u015ft\u0131r\u0131lmas\u0131 ya da kamu taraf\u0131ndan kar\u015f\u0131lanmas\u0131, anayasal ilkeler ve hukuki sistemin dengesi a\u00e7\u0131s\u0131ndan zorunludur. Aksi halde, bireyler devletin kamu yarar\u0131n\u0131 g\u00f6zeten bir d\u00fczenlemesi nedeniyle ekonomik olarak cezaland\u0131r\u0131lmakta; bu da Anayasa ve hukuk devleti ilkesi ile ba\u011fda\u015fmamaktad\u0131r.<\/p>\n<p>T\u00fcrk hukuk sistemi i\u00e7erisinde, \u00f6zellikle son on y\u0131ll\u0131k d\u00f6nemde mahkemelerin i\u015f y\u00fck\u00fcn\u00fc azaltma amac\u0131yla sistematik bi\u00e7imde geni\u015fletilen arabuluculuk kurumu, giderek neredeyse kutsal bir \u00f6ge h\u00e2line getirilmi\u015f, ele\u015ftiriler kar\u015f\u0131s\u0131nda adeta dokunulmazl\u0131k kazanm\u0131\u015f bir yap\u0131ya b\u00fcr\u00fcnd\u00fcr\u00fclm\u00fc\u015ft\u00fcr. \u00d6zellikle \u00f6deme y\u00fck\u00fcml\u00fcs\u00fc taraf\u0131n \u00fclkedeki y\u00fcksek enflasyon ve uzun yarg\u0131lama s\u00fcre\u00e7leri \u00e7er\u00e7evesinde giri\u015fti\u011fi haks\u0131z pazarl\u0131klar\u0131n odak noktas\u0131 olmas\u0131 kar\u015f\u0131s\u0131nda hi\u00e7 kimse bu kurumu ele\u015ftirememektedir. Oysa hukukta hi\u00e7bir m\u00fcessese mutlakla\u015ft\u0131r\u0131lamaz; her d\u00fczenleme kamu yarar\u0131, bireysel haklar ve temel ilkeler bak\u0131m\u0131ndan s\u00fcrekli olarak tart\u0131\u015fmaya, g\u00f6zden ge\u00e7irilmeye ve geli\u015ftirmeye a\u00e7\u0131k olmal\u0131d\u0131r.<\/p>\n<p>Ne var ki arabuluculuk, uygulamada \u201cuzla\u015fmaz olan haks\u0131zd\u0131r\u201d \u015feklinde bir alg\u0131 yaratmakta, bu alg\u0131 ise hem hak arama \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc hem de yarg\u0131 erkinin varl\u0131k nedenini g\u00f6lgede b\u0131rakmaktad\u0131r. \u00d6zellikle zorunlu arabuluculuk kapsam\u0131na al\u0131nan alanlarda, arabuluculu\u011fa ba\u015fvurmayan\u0131n davas\u0131 usulden reddedilmekte; ba\u015fvuran ama uzla\u015fmayan taraf ise \u00e7o\u011fu zaman, sadece davay\u0131 kaybetti\u011fi gerek\u00e7esiyle arabuluculuk \u00fccretinin tamam\u0131ndan sorumlu tutulmaktad\u0131r. Bu durumun giderilmesi, yaln\u0131zca uygulama i\u00e7tihatlar\u0131yla de\u011fil, mevzuatta a\u00e7\u0131k ve d\u00fczenleyici bir de\u011fi\u015fiklik yap\u0131lmas\u0131yla m\u00fcmk\u00fcnd\u00fcr.
