T\u00fcrkiye\u2019nin yabanc\u0131larla ilgili ba\u015fvurdu\u011fu en \u00f6nemli tedbirlerden biri, 6458 say\u0131l\u0131 Yabanc\u0131lar ve Uluslararas\u0131 Koruma Kanunu\u2019nun (YUKK) 57. maddesi uyar\u0131nca uygulanan idari g\u00f6zetim karar\u0131d\u0131r. \u0130dari g\u00f6zetim kararlar\u0131, yabanc\u0131lar\u0131n s\u0131n\u0131r d\u0131\u015f\u0131 edilme s\u00fcre\u00e7lerinde kamu g\u00fcvenli\u011fi ve d\u00fczenini sa\u011flamak amac\u0131yla verilen, ki\u015fi h\u00fcrriyetini s\u0131n\u0131rlayan \u00f6nemli idari i\u015flemlerdir. Ancak \u0130dari g\u00f6zetim tedbirin uygulanmas\u0131, Anayasa, Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi (A\u0130HS) ve uluslararas\u0131 hukuk taraf\u0131ndan \u00e7izilen s\u0131n\u0131rlar i\u00e7inde ger\u00e7ekle\u015fmelidir. Bunlar, demokratik hukuk devleti ilkelerine ve insan haklar\u0131na sayg\u0131l\u0131 devletlerin dikkat etmesi gereken \u00f6nemli hususlard\u0131r.<\/p>\n<p>Bu \u00e7al\u0131\u015fmada, T\u00fcrkiye&#8217;deki idari g\u00f6zetim sisteminin hukuki \u00e7er\u00e7evesi, uygulamalar\u0131 ve insan haklar\u0131 boyutu incelenecektir.<\/p>\n<p>1.\u0130dari G\u00f6zetim Nedir?<\/p>\n<p>6458 say\u0131l\u0131 Yasa\u2019n\u0131n 57. maddesi, s\u0131n\u0131r d\u0131\u015f\u0131 edilmesine karar verilen yabanc\u0131lar\u0131n geri g\u00f6nderme merkezlerinde tutulmas\u0131na imk\u00e2n tan\u0131r. Bu tedbir, bir anlamda idari nitelikli \u00f6zg\u00fcrl\u00fckten yoksun b\u0131rakmad\u0131r.<\/p>\n<p>YUKK m.57\/1\u2019e g\u00f6re, idari g\u00f6zetim karar\u0131 a\u015fa\u011f\u0131daki durumlarda al\u0131nabilir:<\/p>\n<p>&#8211; Yabanc\u0131n\u0131n ka\u00e7ma veya kaybolma riski varsa,<\/p>\n<p>&#8211; T\u00fcrkiye\u2019den \u00e7\u0131kma konusunda uyum g\u00f6stermemi\u015fse,<\/p>\n<p>&#8211; Sahte veya ge\u00e7ersiz belge kullanm\u0131\u015fsa,<\/p>\n<p>&#8211; Kamu d\u00fczeni, kamu g\u00fcvenli\u011fi veya kamu sa\u011fl\u0131\u011f\u0131 a\u00e7\u0131s\u0131ndan tehdit olu\u015fturuyorsa.<\/p>\n<p>&#8211; Giri\u015f yasa\u011f\u0131na ra\u011fmen T\u00fcrkiye\u2019de bulunuyorsa,<\/p>\n<p>&#8211; \u0130ltica\/koruma ba\u015fvurusunun k\u00f6t\u00fc niyetli oldu\u011fu anla\u015f\u0131lm\u0131\u015fsa.<\/p>\n<p>\u0130dari G\u00f6zetim Karar\u0131 Valilik taraf\u0131ndan verilir ve 48 saat i\u00e7inde gerek\u00e7esiyle birlikte yabanc\u0131ya bildirilir. Her 30 g\u00fcnde bir g\u00f6zetimin devam\u0131 incelenir ve maksimum 6 ay (zorunlu hallerde 6 ay daha) uygulanabilir. \u0130dari G\u00f6zetim Karar\u0131n\u0131n al\u0131nd\u0131\u011f\u0131 ayn\u0131 g\u00fcn yabanc\u0131 hakk\u0131nda s\u0131n\u0131r d\u0131\u015f\u0131 karar\u0131 da al\u0131n\u0131r ve kendisine tebli\u011f edilir. Karar yabanc\u0131n\u0131n dosyas\u0131nda yer al\u0131r. \u0130dari g\u00f6zetimin devam\u0131nda zaruret olup olmad\u0131\u011f\u0131, valilik taraf\u0131ndan her ay d\u00fczenli olarak de\u011ferlendirilir. Bu de\u011ferlendirme sonucunda zaruret olmad\u0131\u011f\u0131 tespit edilenler derhal \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131&#8217;na bildirilir ve uygun g\u00f6r\u00fclmesi halinde idari g\u00f6zetim karar\u0131 kald\u0131r\u0131l\u0131r.<\/p>\n<p>YUKK 57.maddenin 4.f\u0131kras\u0131nda da belirtildi\u011fi \u00fczere \u2018\u2019 \u0130dari g\u00f6zetimin devam\u0131nda zaruret g\u00f6r\u00fclmeyen yabanc\u0131lar i\u00e7in idari g\u00f6zetim derh\u00e2l sonland\u0131r\u0131l\u0131r. Bu yabanc\u0131lara, belli bir adreste ikamet etme, belirlenecek \u015fekil ve s\u00fcrelerde bildirimde bulunma gibi idari y\u00fck\u00fcml\u00fcl\u00fckler getirilebilir \u2018\u2019<\/p>\n<p> 2. Anayasa ve \u0130nsan Haklar\u0131 A\u00e7\u0131s\u0131ndan De\u011ferlendirme<\/p>\n<p>T\u00fcrkiye Cumhuriyeti Anayasas\u0131\u2019n\u0131n 19. maddesi, \u201cki\u015finin h\u00fcrriyeti ve g\u00fcvenli\u011fi\u201d hakk\u0131n\u0131 g\u00fcvence alt\u0131na al\u0131r. Bu maddeye g\u00f6re:<\/p>\n<p>\u201cKimse h\u00fcrriyetinden yoksun b\u0131rak\u0131lamaz; kanunla yetkili k\u0131l\u0131nm\u0131\u015f mercilerin karar\u0131 olmad\u0131k\u00e7a ki\u015fi h\u00fcrriyetinden yoksun b\u0131rak\u0131lamaz.\u201d<\/p>\n<p>Ayn\u0131 \u015fekilde, Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi\u2019nin 5. maddesi de \u201c\u00f6zg\u00fcrl\u00fck ve g\u00fcvenlik hakk\u0131\u201dn\u0131 tan\u0131r. S\u00f6z konusu maddenin 1\/f bendinde, bir yabanc\u0131n\u0131n s\u0131n\u0131r d\u0131\u015f\u0131 edilmesi veya iade edilmesi amac\u0131yla tutulmas\u0131 \u00f6ng\u00f6r\u00fclmektedir. Ancak:<\/p>\n<p>&#8211; Tutma karar\u0131 \u00f6l\u00e7\u00fcl\u00fc olmal\u0131,<\/p>\n<p>&#8211; \u0130hlal iddias\u0131 yarg\u0131 denetimine a\u00e7\u0131k olmal\u0131,<\/p>\n<p>&#8211; Alternatif \u00f6nlemler de\u011ferlendirilmi\u015f olmal\u0131d\u0131r.<\/p>\n<p>A\u0130HM&#8217;in Chahal v. Birle\u015fik Krall\u0131k davas\u0131nda a\u00e7\u0131k\u00e7a vurguland\u0131\u011f\u0131 \u00fczere, bir devletin ulusal g\u00fcvenlik gerek\u00e7esiyle ki\u015fiyi g\u00f6zlem alt\u0131na almas\u0131 dahi keyfi olamaz.<\/p>\n<p>Di\u011fer taraftan s\u0131n\u0131r d\u0131\u015f\u0131 karar\u0131 ile ilgili bir hususu vurgulamakta fayda var. \u015e\u00f6yle ki; 6458 say\u0131l\u0131 YUKK\u2019un 55. maddesi, s\u0131n\u0131r d\u0131\u015f\u0131 edilemeyecek ki\u015fileri d\u00fczenlemektedir. \u00d6zellikle, i\u015fkence veya insanl\u0131k d\u0131\u015f\u0131 muameleye u\u011frama riski bulunan ki\u015filerin s\u0131n\u0131r d\u0131\u015f\u0131 edilemeyece\u011fi h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi&#8217;nin 5. maddesine g\u00f6re ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fi hakk\u0131 temel bir insan hakk\u0131d\u0131r. \u0130dari g\u00f6zetim bu hakk\u0131 s\u0131n\u0131rland\u0131rd\u0131\u011f\u0131ndan, uygulaman\u0131n orant\u0131l\u0131, gerekli ve hukuka uygun olmas\u0131 zorunludur.<\/p>\n<p>3. Avukat ve Terc\u00fcman Hakk\u0131<\/p>\n<p>\u0130dari g\u00f6zetim alt\u0131ndaki yabanc\u0131lar\u0131n avukat tutma ve hukuki yard\u0131m alma haklar\u0131 bulunmaktad\u0131r. Bu kapsamda idari g\u00f6zetim kararlar\u0131na kar\u015f\u0131 adli yarg\u0131da itiraz edilebilmektedir.<\/p>\n<p>YUKK m.57\u2019ye g\u00f6re, g\u00f6zetim alt\u0131ndaki yabanc\u0131ya:<\/p>\n<p>&#8211; Karar anadilinde bildirilmelidir,<\/p>\n<p>&#8211; Avukatla g\u00f6r\u00fc\u015fme,<\/p>\n<p>&#8211; Terc\u00fcman deste\u011fi,<\/p>\n<p>&#8211; Yarg\u0131 yoluna ba\u015fvurma hakk\u0131 tan\u0131nmal\u0131d\u0131r.<\/p>\n<p>\u0130dari Yarg\u0131ya Ba\u015fvuru Hakk\u0131<\/p>\n<p>\u0130dari g\u00f6zetim karar\u0131 bir idari i\u015flem niteli\u011finde oldu\u011fundan, bu karara kar\u015f\u0131 idare mahkemesinde iptal davas\u0131 a\u00e7\u0131labilir. Ayr\u0131ca y\u00fcr\u00fctmenin durdurulmas\u0131 talebinde bulunulabilir.<\/p>\n<p>Adli Yarg\u0131ya Ba\u015fvuru Hakk\u0131<\/p>\n<p>Ki\u015fi h\u00fcrriyetinin s\u0131n\u0131rland\u0131r\u0131lmas\u0131 s\u00f6z konusu oldu\u011fundan, idari g\u00f6zetim kararlar\u0131na kar\u015f\u0131 sulh ceza hakimli\u011fine ba\u015fvuruda bulunulabilir. Hakim, g\u00f6zetim karar\u0131n\u0131n hukuka uygunlu\u011funu de\u011ferlendirerek karar verir.<\/p>\n<p>Avrupa \u0130nsan Haklar\u0131 Mahkemesi&#8217;ne Ba\u015fvuru hakk\u0131<\/p>\n<p>Ulusal hukuk yollar\u0131 t\u00fcketildikten sonra Avrupa \u0130nsan Haklar\u0131 Mahkemesi&#8217;ne bireysel ba\u015fvuru yap\u0131labilir.<\/p>\n<p>Ancak uygulamada bir\u00e7ok g\u00f6\u00e7men dil bariyeri nedeniyle karar\u0131 anlamadan imza atmakta, hukuki destek alamamakta ve idari g\u00f6zetim s\u00fcresi keyfi \u015fekilde uzayabilmektedir. Di\u011fer taraftan yabanc\u0131 avukat deste\u011fi alamad\u0131\u011f\u0131 i\u00e7in hakk\u0131nda al\u0131nan s\u0131n\u0131r d\u0131\u015f\u0131 karar\u0131na kar\u015f\u0131 dava a\u00e7ma hakk\u0131ndan da habersiz oldu\u011fundan k\u0131sa bir s\u00fcre i\u00e7inde s\u0131n\u0131r d\u0131\u015f\u0131 edilmektedir. Bu nedenle g\u00f6\u00e7menin h\u0131zl\u0131 hareket edip yabanc\u0131lar hukuku alan\u0131nda uzman bir Avukattan hukuki destek almas\u0131 \u00f6nem ta\u015f\u0131maktad\u0131r.<\/p>\n<p>4.\u0130dari G\u00f6zetime Alternatif Y\u00fck\u00fcml\u00fcl\u00fckler Uygulanmal\u0131<\/p>\n<p>A\u0130HM i\u00e7tihatlar\u0131 ve BM M\u00fclteciler Y\u00fcksek Komiserli\u011fi&#8217;ne g\u00f6re, idari g\u00f6zetim son \u00e7are olmal\u0131d\u0131r.<\/p>\n<p>\u0130dari G\u00f6zetime Alternatif Y\u00fck\u00fcml\u00fcl\u00fcklere \u0130li\u015fkin Y\u00f6netmeli\u011fin \u00fc\u00e7\u00fcnc\u00fc b\u00f6l\u00fcmde  detayll\u0131 \u015fekilde say\u0131lm\u0131\u015ft\u0131r;<\/p>\n<p>Belirli adreste ikamet etme, Bildirimde bulunma, Aile temelli geri d\u00f6n\u00fc\u015f, Geri d\u00f6n\u00fc\u015f dan\u0131\u015fmanl\u0131\u011f\u0131, Kamu yarar\u0131na hizmetlerde g\u00f6n\u00fcll\u00fcl\u00fck esas\u0131yla g\u00f6rev alma, Teminat, Elektronik izleme.<\/p>\n<p>Bu tedbirlerin uygulanmamas\u0131, orant\u0131l\u0131l\u0131k ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesi a\u00e7\u0131s\u0131ndan a\u00e7\u0131k bir ihlal te\u015fkil eder.<\/p>\n<p>Sonu\u00e7 <\/p>\n<p>\u0130dari g\u00f6zetim karar\u0131 yaln\u0131zca g\u00f6\u00e7menleri de\u011fil, hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fcn\u00fc de ilgilendirdi\u011fini unutmayal\u0131m Karar\u0131n \u00f6l\u00e7\u00fcl\u00fc, gerek\u00e7eli, ge\u00e7ici ve yarg\u0131sal denetime tabi olmas\u0131 elzemdir. Ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fi hakk\u0131, i\u015fkence yasa\u011f\u0131 ve aile ya\u015fam\u0131na sayg\u0131 hakk\u0131 gibi temel insan haklar\u0131 a\u00e7\u0131s\u0131ndan uygulaman\u0131n s\u00fcrekli g\u00f6zden ge\u00e7irilmesi gerekmektedir.<\/p>\n<p>Hi\u00e7 kimsenin keyfi ve somut gerek\u00e7e sunulmadan, \u00f6zg\u00fcrl\u00fc\u011f\u00fc k\u0131s\u0131tlanamaz. \u0130nsan haklar\u0131na sayg\u0131l\u0131 devletler, temel bireysel hak ve \u00f6zg\u00fcrl\u00fckleri derinden etkileyen idari g\u00f6zetim karar\u0131 ve s\u0131n\u0131r d\u0131\u015f\u0131 etme kararlar\u0131n\u0131 al\u0131rken ve bunlar\u0131 uygularken uluslararas\u0131 hukuka ve uluslararas\u0131 hukukun dayana\u011f\u0131 olan evrensel standartlara uygun hareket ettikleri unutmamak gerekir. Unutulmamas\u0131 gereken di\u011fer bir husus ise idari g\u00f6zetim kararlar\u0131n\u0131n hukuka uygunlu\u011fu, orant\u0131l\u0131l\u0131\u011f\u0131 ve gereklili\u011fi her somut olayda ayr\u0131 ayr\u0131 de\u011ferlendirilmesi gerekti\u011fidir. Ulusal ve uluslararas\u0131 denetim mekanizmalar\u0131n\u0131n da etkin \u00e7al\u0131\u015fmas\u0131, sistem i\u00e7indeki aksakl\u0131klar\u0131n giderilmesi a\u00e7\u0131s\u0131ndan kritik \u00f6nem ta\u015f\u0131maktad\u0131r.<\/p>\n<p>\u0130dari g\u00f6zetim alt\u0131na al\u0131nan ki\u015filerin aile birli\u011fi ve aile ya\u015fam\u0131na sayg\u0131 haklar\u0131 g\u00f6zetilmelidir. \u00d6zellikle \u00e7ocuklu aileler s\u00f6z konusu oldu\u011funda \u00e7ocu\u011fun y\u00fcksek yarar\u0131 ilkesi \u00f6ncelik ta\u015f\u0131mal\u0131d\u0131r. \u0130dari g\u00f6zetim karar\u0131 alan idare de yabanc\u0131y\u0131 savunan avukatlar da bu hususlar\u0131 unutmamal\u0131d\u0131r.<\/p>\n<p>Frans\u0131zca Makale:<\/p>\n<p>Dans Quelles Circonstances les \u00c9trangers Sont-ils Plac\u00e9s Sous Surveillance Administrative ?<\/p>\n<p>Conditions d&#8217;Application selon l&#8217;Article 57 de la Loi n\u00b0 6458, \u00c9valuation dans le Cadre de la Constitution et de la CEDH<\/p>\n<p>PAR MA\u00ceTRE AYKUT YAVUZ<\/p>\n<p>\u0130ntroduction<\/p>\n<p>Avec l&#8217;augmentation des mouvements migratoires mondiaux, les \u00c9tats recourent \u00e0 certaines mesures administratives pour assurer la s\u00e9curit\u00e9 des fronti\u00e8res et lutter contre la migration irr\u00e9guli\u00e8re. L&#8217;une des mesures les plus importantes que la Turquie applique concernant les \u00e9trangers est la d\u00e9cision de surveillance administrative mise en \u0153uvre en vertu de l&#8217;article 57 de la Loi n\u00b0 6458 sur les \u00c9trangers et la Protection Internationale (YUKK). Les d\u00e9cisions de surveillance administrative sont des actes administratifs importants qui restreignent la libert\u00e9 personnelle, \u00e9mises pour assurer la s\u00e9curit\u00e9 et l&#8217;ordre publics pendant les processus d&#8217;expulsion des \u00e9trangers. Cependant, la mise en \u0153uvre des mesures de surveillance administrative doit \u00eatre r\u00e9alis\u00e9e dans les limites trac\u00e9es par la Constitution, la Convention Europ\u00e9enne des Droits de l&#8217;Homme (CEDH) et le droit international. Ce sont des questions importantes auxquelles les \u00c9tats respectueux des principes de l&#8217;\u00c9tat de droit d\u00e9mocratique et des droits de l&#8217;homme doivent pr\u00eater attention.<\/p>\n<p>Cette \u00e9tude examinera le cadre juridique, les applications et la dimension des droits de l&#8217;homme du syst\u00e8me de surveillance administrative de la Turquie.<\/p>\n<p>1. Qu&#8217;est-ce que la Surveillance Administrative ?<\/p>\n<p>L&#8217;article 57 de la Loi n\u00b0 6458 sur les \u00c9trangers et la Protection Internationale permet la d\u00e9tention des \u00e9trangers qui ont fait l&#8217;objet d&#8217;une d\u00e9cision d&#8217;expulsion dans des centres de renvoi. Cette mesure est, en quelque sorte, une privation administrative de libert\u00e9.<\/p>\n<p>Selon l&#8217;article 57\/1 de la YUKK, une d\u00e9cision de surveillance administrative peut \u00eatre prise dans les situations suivantes :<\/p>\n<p>\u00b7         S&#8217;il y a un risque que l&#8217;\u00e9tranger s&#8217;enfuie ou disparaisse,<\/p>\n<p>\u00b7         S&#8217;il ne se conforme pas \u00e0 l&#8217;obligation de quitter la Turquie,<\/p>\n<p>\u00b7         S&#8217;il a utilis\u00e9 des documents faux ou invalides,<\/p>\n<p>\u00b7         S&#8217;il constitue une menace en termes d&#8217;ordre public, de s\u00e9curit\u00e9 publique ou de sant\u00e9 publique,<\/p>\n<p>\u00b7         S&#8217;il se trouve en Turquie malgr\u00e9 une interdiction d&#8217;entr\u00e9e,<\/p>\n<p>\u00b7         Si sa demande d&#8217;asile\/protection s&#8217;av\u00e8re \u00eatre de mauvaise foi.<\/p>\n<p>La D\u00e9cision de Surveillance Administrative est \u00e9mise par le Gouvernorat et doit \u00eatre notifi\u00e9e \u00e0 l&#8217;\u00e9tranger dans les 48 heures avec sa justification. La continuation de la surveillance est r\u00e9vis\u00e9e tous les 30 jours et peut \u00eatre appliqu\u00e9e pour un maximum de 6 mois (6 mois suppl\u00e9mentaires dans les cas obligatoires). Le m\u00eame jour o\u00f9 la D\u00e9cision de Surveillance Administrative est prise, une d\u00e9cision d&#8217;expulsion est \u00e9galement prise concernant l&#8217;\u00e9tranger et lui est signifi\u00e9e. La d\u00e9cision est incluse dans le dossier de l&#8217;\u00e9tranger. La n\u00e9cessit\u00e9 de la continuation de la surveillance administrative est r\u00e9guli\u00e8rement \u00e9valu\u00e9e par le gouvernorat chaque mois. Ceux pour lesquels aucune n\u00e9cessit\u00e9 n&#8217;est d\u00e9termin\u00e9e \u00e0 la suite de cette \u00e9valuation sont imm\u00e9diatement signal\u00e9s au Minist\u00e8re de l&#8217;Int\u00e9rieur, et si jug\u00e9 appropri\u00e9, la d\u00e9cision de surveillance administrative est lev\u00e9e.<\/p>\n<p>Comme stipul\u00e9 au paragraphe 4 de l&#8217;article 57 de la YUKK (  Loi sur les \u00c9trangers et la Protection Internationale) : &#8220;La surveillance administrative est imm\u00e9diatement termin\u00e9e pour les \u00e9trangers pour lesquels aucune n\u00e9cessit\u00e9 n&#8217;est vue pour la continuation de la surveillance administrative. Ces \u00e9trangers peuvent \u00eatre soumis \u00e0 des obligations administratives telles que r\u00e9sider \u00e0 une adresse sp\u00e9cifique et faire des rapports sous des formes et p\u00e9riodes d\u00e9termin\u00e9es.&#8221;<\/p>\n<p>2. \u00c9valuation en Termes de Constitution et de Droits de l&#8217;Homme<\/p>\n<p>L&#8217;article 19 de la Constitution de la R\u00e9publique de Turquie garantit le droit \u00e0 la &#8220;libert\u00e9 et s\u00e9curit\u00e9 personnelles &#8220;. Selon cet article :<\/p>\n<p>&#8220;Personne ne peut \u00eatre priv\u00e9 de sa libert\u00e9 ; une personne ne peut \u00eatre priv\u00e9e de sa libert\u00e9 sans une d\u00e9cision des autorit\u00e9s autoris\u00e9es par la loi. &#8220;<\/p>\n<p>De m\u00eame, l&#8217;article 5 de la Convention Europ\u00e9enne des Droits de l&#8217;Homme reconna\u00eet le &#8220;droit \u00e0 la libert\u00e9 et \u00e0 la s\u00e9curit\u00e9&#8221;. Le paragraphe 1\/f dudit article pr\u00e9voit la d\u00e9tention d&#8217;un \u00e9tranger dans le but d&#8217;expulsion ou d&#8217;extradition. Cependant :<\/p>\n<p>\u00b7         La d\u00e9cision de d\u00e9tention doit \u00eatre proportionn\u00e9e,<\/p>\n<p>\u00b7         Les all\u00e9gations de violation doivent \u00eatre ouvertes au contr\u00f4le judiciaire,<\/p>\n<p>\u00b7         Les mesures alternatives doivent avoir \u00e9t\u00e9 consid\u00e9r\u00e9es.<\/p>\n<p>Comme clairement soulign\u00e9 par la CEDH dans l&#8217;affaire Chahal c. Royaume-Uni, m\u00eame le fait qu&#8217;un \u00c9tat place une personne sous surveillance pour des raisons de s\u00e9curit\u00e9 nationale ne peut \u00eatre arbitraire.<\/p>\n<p>D&#8217;autre part, il est utile de souligner un point concernant la d\u00e9cision d&#8217;expulsion. \u00c0 savoir, l&#8217;article 55 de la Loi n\u00b0 6458 YUKK r\u00e9glemente les personnes qui ne peuvent pas \u00eatre expuls\u00e9es. En particulier, il a \u00e9t\u00e9 stipul\u00e9 que les personnes \u00e0 risque de torture ou de traitement inhumain ne peuvent pas \u00eatre expuls\u00e9es.<\/p>\n<p>Selon l&#8217;article 5 de la Convention Europ\u00e9enne des Droits de l&#8217;Homme, le droit \u00e0 la libert\u00e9 et \u00e0 la s\u00e9curit\u00e9 personnelles est un droit humain fondamental. Puisque la surveillance administrative restreint ce droit, l&#8217;application doit \u00eatre proportionn\u00e9e, n\u00e9cessaire et l\u00e9gale.<\/p>\n<p>3. Droit \u00e0 l&#8217;Avocat et \u00e0 l&#8217;Interpr\u00e8te<\/p>\n<p>Les \u00e9trangers sous surveillance administrative ont le droit d&#8217;engager un avocat et de recevoir une assistance juridique. Dans ce contexte, les d\u00e9cisions de surveillance administrative peuvent faire l&#8217;objet d&#8217;un recours devant les tribunaux judiciaires.<\/p>\n<p>Selon l&#8217;article 57 de la YUKK, l&#8217;\u00e9tranger sous surveillance doit se voir accorder :<\/p>\n<p>\u00b7         La d\u00e9cision doit \u00eatre notifi\u00e9e dans sa langue maternelle,<\/p>\n<p>\u00b7         Rencontre avec un avocat,<\/p>\n<p>\u00b7         Soutien d&#8217;interpr\u00e8te,<\/p>\n<p>\u00b7         Le droit d&#8217;appliquer aux voies de recours judiciaires.<\/p>\n<p>Droit de Recours \u00e0 la Justice Administrative<\/p>\n<p>Puisque la d\u00e9cision de surveillance administrative est un acte administratif, un recours en annulation peut \u00eatre d\u00e9pos\u00e9 contre cette d\u00e9cision devant le tribunal administratif. De plus, une demande de suspension d&#8217;ex\u00e9cution peut \u00eatre faite.<\/p>\n<p>Droit de Recours \u00e0 la Justice P\u00e9nale<\/p>\n<p>Puisque la restriction de la libert\u00e9 personnelle est impliqu\u00e9e, des demandes peuvent \u00eatre faites au tribunal de paix p\u00e9nal contre les d\u00e9cisions de surveillance administrative. Le juge \u00e9value la l\u00e9galit\u00e9 de la d\u00e9cision de surveillance et prend une d\u00e9cision.<\/p>\n<p>Droit de Recours \u00e0 la Cour Europ\u00e9enne des Droits de l&#8217;Homme<\/p>\n<p>Apr\u00e8s \u00e9puisement des voies de recours internes, des requ\u00eates individuelles peuvent \u00eatre faites \u00e0 la Cour Europ\u00e9enne des Droits de l&#8217;Homme.<\/p>\n<p>Cependant, en pratique, de nombreux migrants signent sans comprendre la d\u00e9cision \u00e0 cause des barri\u00e8res linguistiques, ne peuvent pas recevoir de soutien juridique, et la p\u00e9riode de surveillance administrative peut \u00eatre arbitrairement prolong\u00e9e. D&#8217;autre part, puisque l&#8217;\u00e9tranger ne peut pas obtenir de soutien d&#8217;avocat, il n&#8217;est pas au courant de son droit de d\u00e9poser une plainte contre la d\u00e9cision d&#8217;expulsion prise \u00e0 son encontre, il est donc expuls\u00e9 dans un court d\u00e9lai. Des Obligations Alternatives \u00e0 la Surveillance Administrative Devraient \u00catre Appliqu\u00e9es<\/p>\n<p>Selon la jurisprudence de la CEDH et le Haut-Commissariat des Nations Unies pour les R\u00e9fugi\u00e9s, la surveillance administrative devrait \u00eatre un dernier recours.<\/p>\n<p>Les Obligations Alternatives \u00e0 la Surveillance Administrative sont d\u00e9taill\u00e9es dans la troisi\u00e8me section du R\u00e8glement pertinent :<\/p>\n<p>R\u00e9sider \u00e0 une adresse sp\u00e9cifique, Faire des rapports, Retour bas\u00e9 sur la famille, Conseil de retour, Participation volontaire aux services d&#8217;utilit\u00e9 publique, Garantie, Surveillance \u00e9lectronique.<\/p>\n<p>La non-application de ces mesures constitue une violation claire en termes du principe de proportionnalit\u00e9 et de mesure.<\/p>\n<p>Conclusion<\/p>\n<p>N&#8217;oublions pas que la d\u00e9cision de surveillance administrative concerne non seulement les migrants mais aussi l&#8217;\u00c9tat de droit. Il est essentiel que la d\u00e9cision soit proportionn\u00e9e, justifi\u00e9e, temporaire et soumise au contr\u00f4le judiciaire. L&#8217;application doit \u00eatre continuellement r\u00e9vis\u00e9e en termes de droits humains fondamentaux tels que le droit \u00e0 la libert\u00e9 et \u00e0 la s\u00e9curit\u00e9 personnelles, l&#8217;interdiction de la torture et le droit au respect de la vie familiale.<\/p>\n<p>La libert\u00e9 de personne ne peut \u00eatre restreinte arbitrairement et sans pr\u00e9senter de justification concr\u00e8te. Les \u00c9tats respectueux des droits de l&#8217;homme ne doivent pas oublier que lorsqu&#8217;ils prennent et mettent en \u0153uvre des d\u00e9cisions de surveillance administrative et des d\u00e9cisions d&#8217;expulsion qui affectent profond\u00e9ment les droits et libert\u00e9s individuels fondamentaux, ils agissent conform\u00e9ment au droit international et aux normes universelles qui sont le fondement du droit international. Un autre point qui ne doit pas \u00eatre oubli\u00e9 est que la l\u00e9galit\u00e9, la proportionnalit\u00e9 et la n\u00e9cessit\u00e9 des d\u00e9cisions de surveillance administrative doivent \u00eatre \u00e9valu\u00e9es s\u00e9par\u00e9ment dans chaque cas concret. Tant l&#8217;administration prenant la d\u00e9cision de surveillance administrative que les avocats d\u00e9fendant l&#8217;\u00e9tranger ne doivent pas oublier ces questions.<\/p>\n<p>\u200b6458 Say\u0131l\u0131 Yasa m.57\u2019ye G\u00f6re Uygulama \u015eartlar\u0131, Anayasa ve A\u0130HS Kapsam\u0131nda De\u011ferlendirme<\/p>\n<p>Entrance<\/p>\n<p>K\u00fcresel g\u00f6\u00e7 hareketlerinin artmas\u0131yla birlikte, devletler s\u0131n\u0131r g\u00fcvenli\u011fini sa\u011flamak ve d\u00fczensiz g\u00f6\u00e7le m\u00fccadele etmek ad\u0131na baz\u0131 idari tedbirlere ba\u015fvurmaktad\u0131r.  T\u00fcrkiye\u2019nin yabanc\u0131larla ilgili ba\u015fvurdu\u011fu en \u00f6nemli tedbirlerden biri, 6458 say\u0131l\u0131 Yabanc\u0131lar ve Uluslararas\u0131 Koruma Kanunu\u2019nun (YUKK) 57. maddesi uyar\u0131nca uygulanan idari g\u00f6zetim karar\u0131d\u0131r. \u0130dari g\u00f6zetim kararlar\u0131, yabanc\u0131lar\u0131n s\u0131n\u0131r d\u0131\u015f\u0131 edilme s\u00fcre\u00e7lerinde kamu g\u00fcvenli\u011fi ve d\u00fczenini sa\u011flamak amac\u0131yla verilen, ki\u015fi h\u00fcrriyetini s\u0131n\u0131rlayan \u00f6nemli idari i\u015flemlerdir. Ancak \u0130dari g\u00f6zetim tedbirin uygulanmas\u0131, Anayasa, Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi (A\u0130HS) ve uluslararas\u0131 hukuk taraf\u0131ndan \u00e7izilen s\u0131n\u0131rlar i\u00e7inde ger\u00e7ekle\u015fmelidir. Bunlar, demokratik hukuk devleti ilkelerine ve insan haklar\u0131na sayg\u0131l\u0131 devletlerin dikkat etmesi gereken \u00f6nemli hususlard\u0131r.<\/p>\n<p>Bu \u00e7al\u0131\u015fmada, T\u00fcrkiye&#8217;deki idari g\u00f6zetim sisteminin hukuki \u00e7er\u00e7evesi, uygulamalar\u0131 ve insan haklar\u0131 boyutu incelenecektir.<\/p>\n<p>1.\u0130dari G\u00f6zetim Nedir?<\/p>\n<p>6458 say\u0131l\u0131 Yasa\u2019n\u0131n 57. maddesi, s\u0131n\u0131r d\u0131\u015f\u0131 edilmesine karar verilen yabanc\u0131lar\u0131n geri g\u00f6nderme merkezlerinde tutulmas\u0131na imk\u00e2n tan\u0131r. Bu tedbir, bir anlamda idari nitelikli \u00f6zg\u00fcrl\u00fckten yoksun b\u0131rakmad\u0131r.<\/p>\n<p>YUKK m.57\/1\u2019e g\u00f6re, idari g\u00f6zetim karar\u0131 a\u015fa\u011f\u0131daki durumlarda al\u0131nabilir:<\/p>\n<p>&#8211; Yabanc\u0131n\u0131n ka\u00e7ma veya kaybolma riski varsa,<\/p>\n<p>&#8211; T\u00fcrkiye\u2019den \u00e7\u0131kma konusunda uyum g\u00f6stermemi\u015fse,<\/p>\n<p>&#8211; Sahte veya ge\u00e7ersiz belge kullanm\u0131\u015fsa,<\/p>\n<p>&#8211; Kamu d\u00fczeni, kamu g\u00fcvenli\u011fi veya kamu sa\u011fl\u0131\u011f\u0131 a\u00e7\u0131s\u0131ndan tehdit olu\u015fturuyorsa.<\/p>\n<p>&#8211; Giri\u015f yasa\u011f\u0131na ra\u011fmen T\u00fcrkiye\u2019de bulunuyorsa,<\/p>\n<p>&#8211; \u0130ltica\/koruma ba\u015fvurusunun k\u00f6t\u00fc niyetli oldu\u011fu anla\u015f\u0131lm\u0131\u015fsa.<\/p>\n<p>\u0130dari G\u00f6zetim Karar\u0131 Valilik taraf\u0131ndan verilir ve 48 saat i\u00e7inde gerek\u00e7esiyle birlikte yabanc\u0131ya bildirilir. Her 30 g\u00fcnde bir g\u00f6zetimin devam\u0131 incelenir ve maksimum 6 ay (zorunlu hallerde 6 ay daha) uygulanabilir. \u0130dari G\u00f6zetim Karar\u0131n\u0131n al\u0131nd\u0131\u011f\u0131 ayn\u0131 g\u00fcn yabanc\u0131 hakk\u0131nda s\u0131n\u0131r d\u0131\u015f\u0131 karar\u0131 da al\u0131n\u0131r ve kendisine tebli\u011f edilir. Karar yabanc\u0131n\u0131n dosyas\u0131nda yer al\u0131r. \u0130dari g\u00f6zetimin devam\u0131nda zaruret olup olmad\u0131\u011f\u0131, valilik taraf\u0131ndan her ay d\u00fczenli olarak de\u011ferlendirilir. Bu de\u011ferlendirme sonucunda zaruret olmad\u0131\u011f\u0131 tespit edilenler derhal \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131&#8217;na bildirilir ve uygun g\u00f6r\u00fclmesi halinde idari g\u00f6zetim karar\u0131 kald\u0131r\u0131l\u0131r.<\/p>\n<p>YUKK 57.maddenin 4.f\u0131kras\u0131nda da belirtildi\u011fi \u00fczere \u2018\u2019 \u0130dari g\u00f6zetimin devam\u0131nda zaruret g\u00f6r\u00fclmeyen yabanc\u0131lar i\u00e7in idari g\u00f6zetim derh\u00e2l sonland\u0131r\u0131l\u0131r. Bu yabanc\u0131lara, belli bir adreste ikamet etme, belirlenecek \u015fekil ve s\u00fcrelerde bildirimde bulunma gibi idari y\u00fck\u00fcml\u00fcl\u00fckler getirilebilir \u2018\u2019<\/p>\n<p> 2. Anayasa ve \u0130nsan Haklar\u0131 A\u00e7\u0131s\u0131ndan De\u011ferlendirme<\/p>\n<p>T\u00fcrkiye Cumhuriyeti Anayasas\u0131\u2019n\u0131n 19. maddesi, \u201cki\u015finin h\u00fcrriyeti ve g\u00fcvenli\u011fi\u201d hakk\u0131n\u0131 g\u00fcvence alt\u0131na al\u0131r. Bu maddeye g\u00f6re:<\/p>\n<p>\u201cKimse h\u00fcrriyetinden yoksun b\u0131rak\u0131lamaz; kanunla yetkili k\u0131l\u0131nm\u0131\u015f mercilerin karar\u0131 olmad\u0131k\u00e7a ki\u015fi h\u00fcrriyetinden yoksun b\u0131rak\u0131lamaz.\u201d<\/p>\n<p>Ayn\u0131 \u015fekilde, Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi\u2019nin 5. maddesi de \u201c\u00f6zg\u00fcrl\u00fck ve g\u00fcvenlik hakk\u0131\u201dn\u0131 tan\u0131r. S\u00f6z konusu maddenin 1\/f bendinde, bir yabanc\u0131n\u0131n s\u0131n\u0131r d\u0131\u015f\u0131 edilmesi veya iade edilmesi amac\u0131yla tutulmas\u0131 \u00f6ng\u00f6r\u00fclmektedir. Ancak:<\/p>\n<p>&#8211; Tutma karar\u0131 \u00f6l\u00e7\u00fcl\u00fc olmal\u0131,<\/p>\n<p>&#8211; \u0130hlal iddias\u0131 yarg\u0131 denetimine a\u00e7\u0131k olmal\u0131,<\/p>\n<p>&#8211; Alternatif \u00f6nlemler de\u011ferlendirilmi\u015f olmal\u0131d\u0131r.<\/p>\n<p>A\u0130HM&#8217;in Chahal v. Birle\u015fik Krall\u0131k davas\u0131nda a\u00e7\u0131k\u00e7a vurguland\u0131\u011f\u0131 \u00fczere, bir devletin ulusal g\u00fcvenlik gerek\u00e7esiyle ki\u015fiyi g\u00f6zlem alt\u0131na almas\u0131 dahi keyfi olamaz.<\/p>\n<p>Di\u011fer taraftan s\u0131n\u0131r d\u0131\u015f\u0131 karar\u0131 ile ilgili bir hususu vurgulamakta fayda var. \u015e\u00f6yle ki; 6458 say\u0131l\u0131 YUKK\u2019un 55. maddesi, s\u0131n\u0131r d\u0131\u015f\u0131 edilemeyecek ki\u015fileri d\u00fczenlemektedir. \u00d6zellikle, i\u015fkence veya insanl\u0131k d\u0131\u015f\u0131 muameleye u\u011frama riski bulunan ki\u015filerin s\u0131n\u0131r d\u0131\u015f\u0131 edilemeyece\u011fi h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi&#8217;nin 5. maddesine g\u00f6re ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fi hakk\u0131 temel bir insan hakk\u0131d\u0131r. \u0130dari g\u00f6zetim bu hakk\u0131 s\u0131n\u0131rland\u0131rd\u0131\u011f\u0131ndan, uygulaman\u0131n orant\u0131l\u0131, gerekli ve hukuka uygun olmas\u0131 zorunludur.<\/p>\n<p>3. Avukat ve Terc\u00fcman Hakk\u0131<\/p>\n<p>\u0130dari g\u00f6zetim alt\u0131ndaki yabanc\u0131lar\u0131n avukat tutma ve hukuki yard\u0131m alma haklar\u0131 bulunmaktad\u0131r. Bu kapsamda idari g\u00f6zetim kararlar\u0131na kar\u015f\u0131 adli yarg\u0131da itiraz edilebilmektedir.<\/p>\n<p>YUKK m.57\u2019ye g\u00f6re, g\u00f6zetim alt\u0131ndaki yabanc\u0131ya:<\/p>\n<p>&#8211; Karar anadilinde bildirilmelidir,<\/p>\n<p>&#8211; Avukatla g\u00f6r\u00fc\u015fme,<\/p>\n<p>&#8211; Terc\u00fcman deste\u011fi,<\/p>\n<p>&#8211; Yarg\u0131 yoluna ba\u015fvurma hakk\u0131 tan\u0131nmal\u0131d\u0131r.<\/p>\n<p>\u0130dari Yarg\u0131ya Ba\u015fvuru Hakk\u0131<\/p>\n<p>\u0130dari g\u00f6zetim karar\u0131 bir idari i\u015flem niteli\u011finde oldu\u011fundan, bu karara kar\u015f\u0131 idare mahkemesinde iptal davas\u0131 a\u00e7\u0131labilir. Ayr\u0131ca y\u00fcr\u00fctmenin durdurulmas\u0131 talebinde bulunulabilir.<\/p>\n<p>Adli Yarg\u0131ya Ba\u015fvuru Hakk\u0131<\/p>\n<p>Ki\u015fi h\u00fcrriyetinin s\u0131n\u0131rland\u0131r\u0131lmas\u0131 s\u00f6z konusu oldu\u011fundan, idari g\u00f6zetim kararlar\u0131na kar\u015f\u0131 sulh ceza hakimli\u011fine ba\u015fvuruda bulunulabilir. Hakim, g\u00f6zetim karar\u0131n\u0131n hukuka uygunlu\u011funu de\u011ferlendirerek karar verir.<\/p>\n<p>Avrupa \u0130nsan Haklar\u0131 Mahkemesi&#8217;ne Ba\u015fvuru hakk\u0131<\/p>\n<p>Ulusal hukuk yollar\u0131 t\u00fcketildikten sonra Avrupa \u0130nsan Haklar\u0131 Mahkemesi&#8217;ne bireysel ba\u015fvuru yap\u0131labilir.<\/p>\n<p>Ancak uygulamada bir\u00e7ok g\u00f6\u00e7men dil bariyeri nedeniyle karar\u0131 anlamadan imza atmakta, hukuki destek alamamakta ve idari g\u00f6zetim s\u00fcresi keyfi \u015fekilde uzayabilmektedir. Di\u011fer taraftan yabanc\u0131 avukat deste\u011fi alamad\u0131\u011f\u0131 i\u00e7in hakk\u0131nda al\u0131nan s\u0131n\u0131r d\u0131\u015f\u0131 karar\u0131na kar\u015f\u0131 dava a\u00e7ma hakk\u0131ndan da habersiz oldu\u011fundan k\u0131sa bir s\u00fcre i\u00e7inde s\u0131n\u0131r d\u0131\u015f\u0131 edilmektedir. L&#8217;une des mesures les plus importantes que la Turquie applique concernant les \u00e9trangers est la d\u00e9cision de surveillance administrative mise en \u0153uvre en vertu de l&#8217;article 57 de la Loi n\u00b0 6458 sur les \u00c9trangers et la Protection Internationale (YUKK). Les d\u00e9cisions de surveillance administrative sont des actes administratifs importants qui restreignent la libert\u00e9 personnelle, \u00e9mises pour assurer la s\u00e9curit\u00e9 et l&#8217;ordre publics pendant les processus d&#8217;expulsion des \u00e9trangers. Cependant, la mise en \u0153uvre des mesures de surveillance administrative doit \u00eatre r\u00e9alis\u00e9e dans les limites trac\u00e9es par la Constitution, la Convention Europ\u00e9enne des Droits de l&#8217;Homme (CEDH) et le droit international. Ce sont des questions importantes auxquelles les \u00c9tats respectueux des principes de l&#8217;\u00c9tat de droit d\u00e9mocratique et des droits de l&#8217;homme doivent pr\u00eater attention.<\/p>\n<p>Cette \u00e9tude examinera le cadre juridique, les applications et la dimension des droits de l&#8217;homme du syst\u00e8me de surveillance administrative de la Turquie.<\/p>\n<p>1. Qu&#8217;est-ce que la Surveillance Administrative ?<\/p>\n<p>L&#8217;article 57 de la Loi n\u00b0 6458 sur les \u00c9trangers et la Protection Internationale permet la d\u00e9tention des \u00e9trangers qui ont fait l&#8217;objet d&#8217;une d\u00e9cision d&#8217;expulsion dans des centres de renvoi. Cette mesure est, en quelque sorte, une privation administrative de libert\u00e9.<\/p>\n<p>Selon l&#8217;article 57\/1 de la YUKK, une d\u00e9cision de surveillance administrative peut \u00eatre prise dans les situations suivantes :<\/p>\n<p>\u00b7         S&#8217;il y a un risque que l&#8217;\u00e9tranger s&#8217;enfuie ou disparaisse,<\/p>\n<p>\u00b7         S&#8217;il ne se conforme pas \u00e0 l&#8217;obligation de quitter la Turquie,<\/p>\n<p>\u00b7         S&#8217;il a utilis\u00e9 des documents faux ou invalides,<\/p>\n<p>\u00b7         S&#8217;il constitue une menace en termes d&#8217;ordre public, de s\u00e9curit\u00e9 publique ou de sant\u00e9 publique,<\/p>\n<p>\u00b7         S&#8217;il se trouve en Turquie malgr\u00e9 une interdiction d&#8217;entr\u00e9e,<\/p>\n<p>\u00b7         Si sa demande d&#8217;asile\/protection s&#8217;av\u00e8re \u00eatre de mauvaise foi.<\/p>\n<p>La D\u00e9cision de Surveillance Administrative est \u00e9mise par le Gouvernorat et doit \u00eatre notifi\u00e9e \u00e0 l&#8217;\u00e9tranger dans les 48 heures avec sa justification. La continuation de la surveillance est r\u00e9vis\u00e9e tous les 30 jours et peut \u00eatre appliqu\u00e9e pour un maximum de 6 mois (6 mois suppl\u00e9mentaires dans les cas obligatoires). Le m\u00eame jour o\u00f9 la D\u00e9cision de Surveillance Administrative est prise, une d\u00e9cision d&#8217;expulsion est \u00e9galement prise concernant l&#8217;\u00e9tranger et lui est signifi\u00e9e. La d\u00e9cision est incluse dans le dossier de l&#8217;\u00e9tranger. La n\u00e9cessit\u00e9 de la continuation de la surveillance administrative est r\u00e9guli\u00e8rement \u00e9valu\u00e9e par le gouvernorat chaque mois. Ceux pour lesquels aucune n\u00e9cessit\u00e9 n&#8217;est d\u00e9termin\u00e9e \u00e0 la suite de cette \u00e9valuation sont imm\u00e9diatement signal\u00e9s au Minist\u00e8re de l&#8217;Int\u00e9rieur, et si jug\u00e9 appropri\u00e9, la d\u00e9cision de surveillance administrative est lev\u00e9e.<\/p>\n<p>Comme stipul\u00e9 au paragraphe 4 de l&#8217;article 57 de la YUKK (  Loi sur les \u00c9trangers et la Protection Internationale) : &#8220;La surveillance administrative est imm\u00e9diatement termin\u00e9e pour les \u00e9trangers pour lesquels aucune n\u00e9cessit\u00e9 n&#8217;est vue pour la continuation de la surveillance administrative. Ces \u00e9trangers peuvent \u00eatre soumis \u00e0 des obligations administratives telles que r\u00e9sider \u00e0 une adresse sp\u00e9cifique et faire des rapports sous des formes et p\u00e9riodes d\u00e9termin\u00e9es.&#8221;<\/p>\n<p>2. \u00c9valuation en Termes de Constitution et de Droits de l&#8217;Homme<\/p>\n<p>L&#8217;article 19 de la Constitution de la R\u00e9publique de Turquie garantit le droit \u00e0 la &#8220;libert\u00e9 et s\u00e9curit\u00e9 personnelles &#8220;. Selon cet article :<\/p>\n<p>&#8220;Personne ne peut \u00eatre priv\u00e9 de sa libert\u00e9 ; une personne ne peut \u00eatre priv\u00e9e de sa libert\u00e9 sans une d\u00e9cision des autorit\u00e9s autoris\u00e9es par la loi. &#8220;<\/p>\n<p>De m\u00eame, l&#8217;article 5 de la Convention Europ\u00e9enne des Droits de l&#8217;Homme reconna\u00eet le &#8220;droit \u00e0 la libert\u00e9 et \u00e0 la s\u00e9curit\u00e9&#8221;. Le paragraphe 1\/f dudit article pr\u00e9voit la d\u00e9tention d&#8217;un \u00e9tranger dans le but d&#8217;expulsion ou d&#8217;extradition. Cependant :<\/p>\n<p>\u00b7         La d\u00e9cision de d\u00e9tention doit \u00eatre proportionn\u00e9e,<\/p>\n<p>\u00b7         Les all\u00e9gations de violation doivent \u00eatre ouvertes au contr\u00f4le judiciaire,<\/p>\n<p>\u00b7         Les mesures alternatives doivent avoir \u00e9t\u00e9 consid\u00e9r\u00e9es.<\/p>\n<p>Comme clairement soulign\u00e9 par la CEDH dans l&#8217;affaire Chahal c. Royaume-Uni, m\u00eame le fait qu&#8217;un \u00c9tat place une personne sous surveillance pour des raisons de s\u00e9curit\u00e9 nationale ne peut \u00eatre arbitraire.<\/p>\n<p>D&#8217;autre part, il est utile de souligner un point concernant la d\u00e9cision d&#8217;expulsion. \u00c0 savoir, l&#8217;article 55 de la Loi n\u00b0 6458 YUKK r\u00e9glemente les personnes qui ne peuvent pas \u00eatre expuls\u00e9es. En particulier, il a \u00e9t\u00e9 stipul\u00e9 que les personnes \u00e0 risque de torture ou de traitement inhumain ne peuvent pas \u00eatre expuls\u00e9es.<\/p>\n<p>Selon l&#8217;article 5 de la Convention Europ\u00e9enne des Droits de l&#8217;Homme, le droit \u00e0 la libert\u00e9 et \u00e0 la s\u00e9curit\u00e9 personnelles est un droit humain fondamental. Puisque la surveillance administrative restreint ce droit, l&#8217;application doit \u00eatre proportionn\u00e9e, n\u00e9cessaire et l\u00e9gale.<\/p>\n<p>3. Droit \u00e0 l&#8217;Avocat et \u00e0 l&#8217;Interpr\u00e8te<\/p>\n<p>Les \u00e9trangers sous surveillance administrative ont le droit d&#8217;engager un avocat et de recevoir une assistance juridique. Dans ce contexte, les d\u00e9cisions de surveillance administrative peuvent faire l&#8217;objet d&#8217;un recours devant les tribunaux judiciaires.<\/p>\n<p>Selon l&#8217;article 57 de la YUKK, l&#8217;\u00e9tranger sous surveillance doit se voir accorder :<\/p>\n<p>\u00b7         La d\u00e9cision doit \u00eatre notifi\u00e9e dans sa langue maternelle,<\/p>\n<p>\u00b7         Rencontre avec un avocat,<\/p>\n<p>\u00b7         Soutien d&#8217;interpr\u00e8te,<\/p>\n<p>\u00b7         Le droit d&#8217;appliquer aux voies de recours judiciaires.<\/p>\n<p>Droit de Recours \u00e0 la Justice Administrative<\/p>\n<p>Puisque la d\u00e9cision de surveillance administrative est un acte administratif, un recours en annulation peut \u00eatre d\u00e9pos\u00e9 contre cette d\u00e9cision devant le tribunal administratif. De plus, une demande de suspension d&#8217;ex\u00e9cution peut \u00eatre faite.<\/p>\n<p>Droit de Recours \u00e0 la Justice P\u00e9nale<\/p>\n<p>Puisque la restriction de la libert\u00e9 personnelle est impliqu\u00e9e, des demandes peuvent \u00eatre faites au tribunal de paix p\u00e9nal contre les d\u00e9cisions de surveillance administrative. Le juge \u00e9value la l\u00e9galit\u00e9 de la d\u00e9cision de surveillance et prend une d\u00e9cision.<\/p>\n<p>Droit de Recours \u00e0 la Cour Europ\u00e9enne des Droits de l&#8217;Homme<\/p>\n<p>Apr\u00e8s \u00e9puisement des voies de recours internes, des requ\u00eates individuelles peuvent \u00eatre faites \u00e0 la Cour Europ\u00e9enne des Droits de l&#8217;Homme.<\/p>\n<p>Cependant, en pratique, de nombreux migrants signent sans comprendre la d\u00e9cision \u00e0 cause des barri\u00e8res linguistiques, ne peuvent pas recevoir de soutien juridique, et la p\u00e9riode de surveillance administrative peut \u00eatre arbitrairement prolong\u00e9e. Des Obligations Alternatives \u00e0 la Surveillance Administrative Devraient \u00catre Appliqu\u00e9es<\/p>\n<p>Selon la jurisprudence de la CEDH et le Haut-Commissariat des Nations Unies pour les R\u00e9fugi\u00e9s, la surveillance administrative devrait \u00eatre un dernier recours.<\/p>\n<p>Les Obligations Alternatives \u00e0 la Surveillance Administrative sont d\u00e9taill\u00e9es dans la troisi\u00e8me section du R\u00e8glement pertinent :<\/p>\n<p>R\u00e9sider \u00e0 une adresse sp\u00e9cifique, Faire des rapports, Retour bas\u00e9 sur la famille, Conseil de retour, Participation volontaire aux services d&#8217;utilit\u00e9 publique, Garantie, Surveillance \u00e9lectronique.<\/p>\n<p>La non-application de ces mesures constitue une violation claire en termes du principe de proportionnalit\u00e9 et de mesure.<\/p>\n<p>Conclusion<\/p>\n<p>N&#8217;oublions pas que la d\u00e9cision de surveillance administrative concerne non seulement les migrants mais aussi l&#8217;\u00c9tat de droit. Il est essentiel que la d\u00e9cision soit proportionn\u00e9e, justifi\u00e9e, temporaire et soumise au contr\u00f4le judiciaire. L&#8217;application doit \u00eatre continuellement r\u00e9vis\u00e9e en termes de droits humains fondamentaux tels que le droit \u00e0 la libert\u00e9 et \u00e0 la s\u00e9curit\u00e9 personnelles, l&#8217;interdiction de la torture et le droit au respect de la vie familiale.<\/p>\n<p>La libert\u00e9 de personne ne peut \u00eatre restreinte arbitrairement et sans pr\u00e9senter de justification concr\u00e8te. Les \u00c9tats respectueux des droits de l&#8217;homme ne doivent pas oublier que lorsqu&#8217;ils prennent et mettent en \u0153uvre des d\u00e9cisions de surveillance administrative et des d\u00e9cisions d&#8217;expulsion qui affectent profond\u00e9ment les droits et libert\u00e9s individuels fondamentaux, ils agissent conform\u00e9ment au droit international et aux normes universelles qui sont le fondement du droit international. Un autre point qui ne doit pas \u00eatre oubli\u00e9 est que la l\u00e9galit\u00e9, la proportionnalit\u00e9 et la n\u00e9cessit\u00e9 des d\u00e9cisions de surveillance administrative doivent \u00eatre \u00e9valu\u00e9es s\u00e9par\u00e9ment dans chaque cas concret. Le fonctionnement efficace des m\u00e9canismes de surveillance nationaux et internationaux est \u00e9galement d&#8217;une importance critique pour \u00e9liminer les d\u00e9ficiences au sein du syst\u00e8me.<\/p>\n<p>Les droits \u00e0 l&#8217;unit\u00e9 familiale et au respect de la vie familiale des personnes plac\u00e9es sous surveillance administrative doivent \u00eatre observ\u00e9s.
