Davac\u0131 vekili dava dilek\u00e7esinde; Kayseri ili Melikgazi il\u00e7esi K\u00f6\u015fk Mahallesi 3 parsel \u00fczerinde bulunan binada kat maliki oldu\u011funu, binan\u0131n toplant\u0131 salonunun ama\u00e7 d\u0131\u015f\u0131 kullan\u0131larak sigara i\u00e7ildi\u011fini, okey oynand\u0131\u011f\u0131n\u0131, ma\u00e7 izlendi\u011fini ayr\u0131ca \u0131s\u0131nma ve s\u0131cak su sisteminin ortak olup 5627 say\u0131l\u0131 Kanuna g\u00f6re \u0131s\u0131 \u00f6l\u00e7er ve ekipmanlar\u0131n\u0131n yap\u0131lmas\u0131 zorunlu oldu\u011fu h\u00e2lde yap\u0131lmad\u0131\u011f\u0131n\u0131, kendisi gibi kat maliki olan ger\u00e7ek ki\u015fi daval\u0131lar\u0131n ise ortak yerlerden olan balkonlar\u0131n duvarlar\u0131n\u0131 y\u0131karak mutfa\u011fa katt\u0131klar\u0131n\u0131 ileri s\u00fcrerek toplant\u0131 odas\u0131n\u0131n ama\u00e7 d\u0131\u015f\u0131 kullan\u0131lmamas\u0131, \u0131s\u0131 pay \u00f6l\u00e7er veya kalorimetre sistemi kurularak \u0131s\u0131 payla\u015f\u0131m\u0131n\u0131n yap\u0131lmas\u0131 ve balkonlar\u0131n eski h\u00e2le getirilmesine karar verilmesini talep etmi\u015ftir.<\/p>\n<p>Daval\u0131 Cevab\u0131:<\/p>\n<p>5. Daval\u0131lar vekili cevap dilek\u00e7esinde; siteye ait toplant\u0131 odas\u0131n\u0131n bina sakinlerinin bayramla\u015fma, genel kurul toplant\u0131lar\u0131 yapma vb. ama\u00e7larla bir araya gelerek kulland\u0131klar\u0131 yer oldu\u011funu, 25.12.2009 tarihli genel kurulda bina i\u00e7erisinde ve toplant\u0131 salonunda sigara i\u00e7ilmemesi, toplant\u0131 odas\u0131n\u0131n sohbet ve okuma salonu olarak kullan\u0131lmas\u0131 y\u00f6n\u00fcnde karar al\u0131nd\u0131\u011f\u0131n\u0131 ve bina sakinlerinin bu do\u011frultuda salonu kulland\u0131klar\u0131n\u0131, \u0131s\u0131 pay \u00f6l\u00e7er veya kalorimetre tak\u0131larak \u0131s\u0131 payla\u015f\u0131m\u0131 yap\u0131lmas\u0131 y\u00f6n\u00fcnde al\u0131nm\u0131\u015f bir karar\u0131n bulunmad\u0131\u011f\u0131n\u0131 ayr\u0131ca balkonlar\u0131n eski h\u00e2le getirilmesi talep edilmi\u015f ise de kat maliklerinin 4\/5 \u00e7o\u011funlu\u011funun yaz\u0131l\u0131 r\u0131zas\u0131 ile balkonlarda de\u011fi\u015fiklik yapman\u0131n m\u00fcmk\u00fcn ve yasal oldu\u011funu, bu \u00e7o\u011funlu\u011fa uygun yaz\u0131l\u0131 muvafakatin al\u0131nd\u0131\u011f\u0131n\u0131 belirterek davan\u0131n reddini savunmu\u015ftur.<\/p>\n<p>Mahkeme Karar\u0131:<\/p>\n<p>6. Kayseri 4. Sulh Hukuk Mahkemesinin 30.12.2013 tarihli ve 2013\/254 E. 2013\/1878 K. say\u0131l\u0131 karar\u0131 ile; davac\u0131n\u0131n toplant\u0131 odas\u0131n\u0131n kullan\u0131m\u0131na ili\u015fkin talebi y\u00f6n\u00fcnden yap\u0131lan incelemede, 25.12.2009 tarihli kat malikleri genel kurul toplant\u0131s\u0131nda toplant\u0131 salonunda sigara i\u00e7ilmemesi, sohbet ve okuma salonu olarak kullan\u0131lmas\u0131 y\u00f6n\u00fcnde karar al\u0131narak salonun kullan\u0131m \u015fekil ve amac\u0131n\u0131n belirlendi\u011fi a\u00e7\u0131k olup mahkemece bu hususta yap\u0131lacak bir i\u015flem olmay\u0131p e\u011fer sigara i\u00e7iliyorsa idari makamlara m\u00fcracaat edilerek gerekli yapt\u0131r\u0131mlar\u0131n uygulanabilece\u011fi, balkonlar\u0131n kapat\u0131lmas\u0131 y\u00f6n\u00fcnden 634 say\u0131l\u0131 Kat M\u00fclkiyeti Kanunu\u2019nun (KMK) 19. maddesine g\u00f6re bu t\u00fcr ortak yerlerde kat maliklerinden be\u015fte d\u00f6rd\u00fcn\u00fcn yaz\u0131l\u0131 r\u0131zas\u0131 ile in\u015faat, onar\u0131m ve de\u011fi\u015fiklik yap\u0131lmas\u0131 m\u00fcmk\u00fcn olup 28 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmden olu\u015fan davaya konu apartmanda 24 kat malikinin bu duruma muvafakat ettiklerine dair muvafakatnamelerin dosyaya sunuldu\u011fu, yasan\u0131n arad\u0131\u011f\u0131 \u00e7o\u011funluk taraf\u0131ndan bu duruma m\u00fcsaade edilmi\u015f oldu\u011fu, \u0131s\u0131 pay \u00f6l\u00e7er veya kalorimetre tak\u0131larak \u0131s\u0131nma giderlerinin buna g\u00f6re payla\u015ft\u0131r\u0131lmas\u0131 talebi y\u00f6n\u00fcnden ise apartman y\u00f6netim kurulu taraf\u0131ndan 07.07.2006 tarihinde binada merkezi sistem do\u011falgaz kullan\u0131m\u0131 y\u00f6n\u00fcnde karar al\u0131nd\u0131\u011f\u0131, sonras\u0131nda bir daha bu hususa ili\u015fkin bir g\u00f6r\u00fc\u015fmenin bulunmad\u0131\u011f\u0131, fakat \u00e7e\u015fitli tarihlerde yap\u0131lan y\u00f6netim ve genel kurul toplant\u0131lar\u0131nda her daireden e\u015fit olarak al\u0131nmak \u00fczere ortak gider aidat miktarlar\u0131n\u0131n belirlendi\u011fi ve bu duruma hi\u00e7bir itiraz\u0131n bulunmad\u0131\u011f\u0131 gerek\u00e7esiyle davan\u0131n reddine karar verilmi\u015ftir.<\/p>\n<p>\u00d6zel Daire Bozma Karar\u0131:<\/p>\n<p>7. Mahkemenin yukar\u0131da belirtilen karar\u0131na kar\u015f\u0131 s\u00fcresi i\u00e7inde davac\u0131 vekili temyiz isteminde bulunmu\u015ftur.<\/p>\n<p>8. Yarg\u0131tay (Kapat\u0131lan) 18. Hukuk Dairesince 15.04.2014 tarihli ve 2014\/3038 E. 2014\/7039 K. say\u0131l\u0131 karar\u0131 ile; \u201c\u2026Dosyadaki yaz\u0131lara, karar\u0131n dayand\u0131\u011f\u0131 kan\u0131tlarla yasal gerektirici nedenlere ve \u00f6zellikle kan\u0131tlar\u0131n takdirinde bir isabetsizlik g\u00f6r\u00fclmemesine g\u00f6re sair temyiz itirazlar\u0131 yerinde de\u011fildir.<\/p>\n<p>Ancak;<\/p>\n<p>Dosya i\u00e7indeki bilgi ve belgeler ile \u00f6zellikle bilirki\u015fi raporunun incelenmesinden; davaya konu 6-9-10 ve 22-28 numaral\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerde tadilat yap\u0131larak balkonun mutfa\u011fa eklendi\u011fi ve pvc ile kaplat\u0131ld\u0131\u011f\u0131, yakla\u015f\u0131k 6-7 m\u00b2 balkon alan\u0131n\u0131n mutfa\u011fa dahil edildi\u011fi, geri kalan balkon k\u0131sm\u0131na yine bu eklenen k\u0131s\u0131mdan kap\u0131 a\u00e7\u0131ld\u0131\u011f\u0131, yap\u0131lan tadilatlar\u0131n projeye ay\u0131r\u0131 oldu\u011fu anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>634 say\u0131l\u0131 Kat M\u00fclkiyeti Yasas\u0131n\u0131n 19. maddesinin 1. f\u0131kras\u0131na g\u00f6re, kat malikleri anata\u015f\u0131nmaz\u0131n bak\u0131m\u0131n\u0131, mimari durumu ile g\u00fczelli\u011fini ve sa\u011flaml\u0131\u011f\u0131n\u0131 titizlikle korumaya mecburdurlar. Ayn\u0131 Yasan\u0131n 2. f\u0131kras\u0131nda ise kat maliklerinden biri, t\u00fcm kat maliklerinin yaz\u0131l\u0131 r\u0131zas\u0131 olmad\u0131k\u00e7a anata\u015f\u0131nmaz\u0131n ortak yerlerinde in\u015faat, onar\u0131m, tesis ve de\u011fi\u015fiklik yapt\u0131ramayaca\u011f\u0131ndan, projeye ayk\u0131r\u0131 olarak ortak alanda yap\u0131lan tadilatlar y\u00f6n\u00fcnden m\u00fcdahalenin \u00f6nlenmesi ile projeye ayk\u0131r\u0131l\u0131klar\u0131n giderilerek eski hale getirilmesine karar verilmesi gerekirken mahkemece s\u00f6z\u00fc edilen tadilatlar\u0131n kat maliklerinden 24&#8217;\u00fcn\u00fcn yaz\u0131l\u0131 muvafakat\u0131 bulundu\u011fu gerek\u00e7esiyle davan\u0131n reddi do\u011fru g\u00f6r\u00fclmemi\u015ftir\u2026\u201d gerek\u00e7esiyle karar\u0131n bozulmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>Direnme Karar\u0131:<\/p>\n<p>9. Kayseri 4. Sulh Hukuk Mahkemesinin 15.09.2014 tarihli ve 2014\/694 E. 2014\/1099 K. say\u0131l\u0131 karar\u0131 ile \u00f6nceki gerek\u00e7elere ek olarak; Kat M\u00fclkiyeti Kanunu\u2019nun 19\/2. maddesinde t\u00fcm kat maliklerinin de\u011fil, 4\/5\u2019inin yaz\u0131l\u0131 r\u0131zas\u0131n\u0131n arand\u0131\u011f\u0131, eldeki dava bak\u0131m\u0131ndan da 28 daireli binada 24 kat malikinin bu hususta yaz\u0131l\u0131 r\u0131zas\u0131n\u0131n bulundu\u011fu ve 19\/2. maddede aranan 4\/5 oran\u0131n\u0131n sa\u011fland\u0131\u011f\u0131, dolay\u0131s\u0131yla yap\u0131lan tadilatlar\u0131n kanuna uygun oldu\u011fu gerek\u00e7esi ile direnme karar\u0131 verilmi\u015ftir.<\/p>\n<p>Direnme Karar\u0131n\u0131n Temyizi:<\/p>\n<p>10. Direnme karar\u0131 s\u00fcresi i\u00e7inde davac\u0131 vekili taraf\u0131ndan temyiz edilmi\u015ftir.<\/p>\n<p>II. UYU\u015eMAZLIK<\/p>\n<p>11. Direnme yolu ile Hukuk Genel Kurulu \u00f6n\u00fcne gelen uyu\u015fmazl\u0131k; mimari projeye ayk\u0131r\u0131 yap\u0131lan projeye ayk\u0131r\u0131l\u0131klar\u0131n giderilmesi ve eski h\u00e2le getirilmesi istemine ili\u015fkin eldeki davada, binada yap\u0131lan tadilatlar y\u00f6n\u00fcnden t\u00fcm kat maliklerinin yaz\u0131l\u0131 r\u0131zas\u0131n\u0131n bulunmas\u0131n\u0131n gerekip gerekmedi\u011fi noktas\u0131nda toplanmaktad\u0131r.<\/p>\n<p>III. GEREK\u00c7E<\/p>\n<p>12. Konunun a\u00e7\u0131kl\u0131\u011fa kavu\u015fturulmas\u0131 i\u00e7in \u00f6ncelikle ilgili yasal d\u00fczenlemelerin incelenmesinde yarar bulunmaktad\u0131r.<\/p>\n<p>13. 634 say\u0131l\u0131 Kat M\u00fclkiyeti Kanunu\u2019nun 4. maddesi \u201cOrtak yerlerin konusu s\u00f6zle\u015fme ile belirtilebilir. A\u015fa\u011f\u0131da yaz\u0131l\u0131 yerler ve \u015feyler bu kanun gere\u011fince her halde ortak yer say\u0131l\u0131r.<\/p>\n<p>a) Temeller ve ana duvarlar, (EKLENM\u0130\u015e \u0130BARE RGT: 28.11.2007 RG NO: 26714 KANUN NO: 5711\/2) ta\u015f\u0131y\u0131c\u0131 sistemi olu\u015fturan kiri\u015f, kolon ve perde duvarlar ile ta\u015f\u0131y\u0131c\u0131 sistemin par\u00e7as\u0131 di\u011fer elemanlar, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmleri ay\u0131ran ortak duvarlar, tavan ve tabanlar, avlular, genel giri\u015f kap\u0131lar\u0131, antreler, merdivenler, asans\u00f6rler, sahanl\u0131klar, koridorlar ve buralardaki genel tuvalet ve lavabolar, kap\u0131c\u0131 daire veya odalar\u0131, genel \u00e7ama\u015f\u0131rl\u0131k ve \u00e7ama\u015f\u0131r kurutma yerleri, genel k\u00f6m\u00fcrl\u00fck ve ortak garajlar, elektrik, su ve havagaz\u0131 saatlerinin korunmas\u0131na mahsus olup ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm d\u0131\u015f\u0131nda bulunan yuvalar ve kapal\u0131 k\u0131s\u0131mlar, kalorifer daireleri, kuyu ve sarn\u0131\u00e7lar, yap\u0131n\u0131n genel su depolar\u0131, s\u0131\u011f\u0131naklar,<\/p>\n<p>b) Her kat malikinin kendi b\u00f6l\u00fcm\u00fc d\u0131\u015f\u0131ndaki kanalizasyon tesisleri ve \u00e7\u00f6p kanallar\u0131 ile kalorifer, su, havagaz\u0131 ve elektrik tesisleri, telefon, radyo ve televizyon i\u00e7in ortak \u015febeke ve antenler s\u0131cak ve so\u011fuk hava tesisleri,<\/p>\n<p>c) \u00c7at\u0131lar, bacalar, genel dam teraslar\u0131, ya\u011fmur oluklar\u0131, yang\u0131n emniyet merdivenleri.<\/p>\n<p>Yukar\u0131da say\u0131lanlar\u0131n d\u0131\u015f\u0131nda kal\u0131p da, yine ortakla\u015fa kullanma, korunma veya, faydalanma i\u00e7in zaruri olan di\u011fer yerler ve \u015feyler de (Ortak yer) konusuna girer\u2026\u201d \u015feklinde d\u00fczenlenmi\u015f olup, ayn\u0131 Kanun\u2019un 16. maddesinde \u201cKat malikleri anagayrimenkul\u00fcn b\u00fct\u00fcn ortak yerlerine, arsa paylar\u0131 oran\u0131nda, ortak m\u00fclkiyet h\u00fck\u00fcmlerine g\u00f6re malik olurlar.<\/p>\n<p>Kat malikleri ortak yerlerde kullanma hakk\u0131na sahiptirler; bu hakk\u0131n genel k\u00f6m\u00fcrl\u00fck, garaj, teras, \u00e7ama\u015f\u0131rhane ve \u00e7ama\u015f\u0131r kurutma alanlar\u0131 gibi yerlerdeki \u00f6l\u00e7\u00fcs\u00fc, aksine s\u00f6zle\u015fme olmad\u0131k\u00e7a, her kat malikine ait arsa pay\u0131 ile oranl\u0131d\u0131r\u201d h\u00fckm\u00fc \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Kat m\u00fclkiyeti kurulu olan ta\u015f\u0131nmazlarda ortak yerlerin neler oldu\u011fu KMK\u2019n\u0131n 4. maddesinde g\u00f6sterilmi\u015ftir. Kat M\u00fclkiyeti Kanunu\u2019nun 16. maddesinin 1. f\u0131kras\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm malikinin m\u00fclkiyet hakk\u0131n\u0131n ortak yerlerle olan ba\u011flant\u0131s\u0131n\u0131 h\u00fckme ba\u011flamakta olup, 2. f\u0131kras\u0131nda da maliklerin ortak yerlerdeki m\u00fclkiyet haklar\u0131na dayal\u0131 kullan\u0131m haklar\u0131n\u0131n varl\u0131\u011f\u0131 belirlenmi\u015f ve bu hakk\u0131n s\u0131n\u0131r\u0131 \u00e7izilmi\u015ftir. Yukar\u0131da a\u00e7\u0131klanan kanun h\u00fck\u00fcmleri uyar\u0131nca anata\u015f\u0131nmaz\u0131n d\u0131\u015f duvar\u0131 ortak yerlerden say\u0131l\u0131r.<\/p>\n<p>14. 634 say\u0131l\u0131 KMK\u2019n\u0131n 19. maddesi; \u201cKat malikleri, anagayrimenkul\u00fcn bak\u0131m\u0131na ve mimar\u0131 durumu ile g\u00fczelli\u011fini ve sa\u011flaml\u0131\u011f\u0131n\u0131 titizlikle korumaya mecburdurlar.<\/p>\n<p>(De\u011fi\u015fik ikinci f\u0131kra: 14\/11\/2007-5711\/8 md.) Kat maliklerinden biri, b\u00fct\u00fcn kat maliklerinin be\u015fte d\u00f6rd\u00fcn\u00fcn yaz\u0131l\u0131 r\u0131zas\u0131 olmad\u0131k\u00e7a anagayrimenkul\u00fcn ortak yerlerinde in\u015faat, onar\u0131m ve tesisler, de\u011fi\u015fik renkte d\u0131\u015f badana veya boya yapt\u0131ramaz. Ancak, ortak yer ve tesislerdeki bir bozuklu\u011fun anayap\u0131ya veya ba\u011f\u0131ms\u0131z bir b\u00f6l\u00fcme veya b\u00f6l\u00fcmlere zarar verdi\u011finin ve acilen onar\u0131lmas\u0131 gerekti\u011finin veya anayap\u0131n\u0131n g\u00fc\u00e7lendirilmesinin zorunlu oldu\u011funun mahkemece tespit edilmi\u015f olmas\u0131 halinde, bu onar\u0131m ve g\u00fc\u00e7lendirmenin projesine ve tekni\u011fine uygun bi\u00e7imde yap\u0131lmas\u0131 konusunda kat maliklerinin r\u0131zas\u0131 aranmaz. Kat maliki kendi ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcnde anayap\u0131ya zarar verecek nitelikte onar\u0131m, tesis ve de\u011fi\u015fiklik yapamaz. Tavan, taban veya duvar ile birbirine ba\u011flant\u0131l\u0131 bulunan ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin ba\u011flant\u0131l\u0131 yerlerinde, bu b\u00f6l\u00fcm maliklerinin ortak r\u0131zas\u0131 ile anayap\u0131ya zarar vermeyecek onar\u0131m, tesis ve de\u011fi\u015fiklik yap\u0131labilir.<\/p>\n<p>Her kat maliki ana gayrimenkule ve di\u011fer ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlere, kusuru ile verdi\u011fi zarardan dolay\u0131 di\u011fer kat maliklerine kar\u015f\u0131 sorumludur.\u201d \u015feklinde d\u00fczenlenmi\u015ftir.<\/p>\n<p>15. Kat M\u00fclkiyeti Kanunu\u2019nun 19. maddesinin 1. f\u0131kras\u0131nda anata\u015f\u0131nmaz\u0131n bak\u0131m\u0131 ve koruma borcu kat maliklerine y\u00fcklenmi\u015ftir. Buna g\u00f6re her kat maliki ana yap\u0131n\u0131n mimari durumunu bozacak, g\u00fczelli\u011fini etkileyecek ve sa\u011flaml\u0131\u011f\u0131n\u0131 tehlikeye sokacak eylemlerden ka\u00e7\u0131nmal\u0131 ve ana ta\u015f\u0131nmaz\u0131n bak\u0131m\u0131na \u00f6zen g\u00f6stermelidir. Maddede yer alan koruma borcu ana ta\u015f\u0131nmaz\u0131n \u201cmimari durumunu\u201d, \u201cg\u00fczelli\u011fini\u201d ve \u201csa\u011flaml\u0131\u011f\u0131n\u0131\u201d koruma olmak \u00fczere \u00fc\u00e7 noktada toplanm\u0131\u015ft\u0131r.<\/p>\n<p>16. Kat M\u00fclkiyeti Kanunu anata\u015f\u0131nmazda onayl\u0131 mimari projeye uymayan hi\u00e7bir durum ve de\u011fi\u015fikli\u011fe kural olarak izin vermemi\u015ftir. Ana yap\u0131 onayl\u0131 mimari projeye uygun olmakla birlikte zamanla anata\u015f\u0131nmaz\u0131n ortak yerlerinde proje de\u011fi\u015fikli\u011fini gerektiren baz\u0131 ilave ve yeniliklerin yap\u0131lmas\u0131na gereksinim duyulabilir. B\u00f6yle bir de\u011fi\u015fikli\u011fin yap\u0131labilmesi ve hukuken ge\u00e7erli olabilmesi i\u00e7in, \u00f6ncelikle anata\u015f\u0131nmazdaki t\u00fcm kat maliklerinin muvafakatini ta\u015f\u0131yan bir de\u011fi\u015fiklik projesinin bulunmas\u0131 gerekir (Germe\u00e7, Mahir Ersin; Kat M\u00fclkiyeti Hukuku, G\u00fcncellenmi\u015f 9. Bask\u0131, Ankara 2020, s. 309-310).<\/p>\n<p>17. Bu ba\u011flamda onayl\u0131 mimari projeye ayk\u0131r\u0131l\u0131k olu\u015fturacak de\u011fi\u015fiklikler ancak t\u00fcm kat maliklerinin r\u0131zas\u0131 al\u0131nd\u0131ktan sonra ger\u00e7ekle\u015ftirilebilir.<\/p>\n<p>18. Kat M\u00fclkiyeti Kanunu\u2019nun 19. maddesinin 14.11.2007 tarihli ve 5711 say\u0131l\u0131 Kanunla de\u011fi\u015fik 2. f\u0131kras\u0131, anata\u015f\u0131nmazdaki esasl\u0131 proje de\u011fi\u015fikli\u011fini gerektirmeyen basit tamirat ve tadilatlar i\u00e7in \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Yarg\u0131tay uygulamalar\u0131nda ise onayl\u0131 projede yap\u0131lacak esasl\u0131 tadilatlar i\u00e7in ise kat maliklerinin oy birli\u011fi aranmaktad\u0131r. Zira kanun koyucunun be\u015fte d\u00f6rt de\u011fi\u015fikli\u011findeki amac\u0131n\u0131n kamu d\u00fczeni ile do\u011frudan ilgili olan mimari projeye ayk\u0131r\u0131l\u0131k olu\u015fturacak i\u015f ve i\u015flemler i\u00e7in kat maliklerinin \u00e7o\u011funlu\u011funun r\u0131zas\u0131n\u0131n al\u0131nmas\u0131n\u0131n yeterli oldu\u011fu s\u00f6ylenemez.<\/p>\n<p>19. Dosya i\u00e7erisinde bulunan 14.11.2013 tarihli bilirki\u015fi raporunda; 6, 9, 10, 22 ve 28 numaral\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerde yap\u0131lan tadilat ile balkonlar\u0131n mutfa\u011fa eklenmesi suretiyle pvc ile kapat\u0131ld\u0131\u011f\u0131, yakla\u015f\u0131k 6-7 m2 balkon alan\u0131n\u0131n mutfa\u011fa dahil edildi\u011fi, dahil edilen alandan kap\u0131 yapt\u0131r\u0131lmak suretiyle balkonun kalan k\u0131sm\u0131na \u00e7\u0131k\u0131labildi\u011fi, davaya konu 6, 9, 10, 22 ve 28 numaral\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin ilgili belediyenin imar y\u00f6netmeli\u011fine g\u00f6re tadilat projesi olmadan binan\u0131n \u015feklinin de\u011fi\u015ftirilemeyece\u011fi, balkonlar\u0131n mutfaktaki kullan\u0131m alan\u0131na dahil edilemeyece\u011fi, mevcut onayl\u0131 mimari projenin d\u0131\u015f\u0131na \u00e7\u0131k\u0131lamayaca\u011f\u0131 belirtilmi\u015ftir.<\/p>\n<p>20. Dosya kapsam\u0131 ve t\u00fcm bu nedenlere g\u00f6re; davaya konu 6, 9, 10, 22 ve 28 numaral\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerde balkonlar\u0131n pvc ile kapat\u0131lmas\u0131 kat maliklerinin 4\/5\u2019inin yaz\u0131l\u0131 r\u0131zas\u0131 ile m\u00fcmk\u00fcn ise de, ortak alanlardan olan binan\u0131n d\u0131\u015f duvar\u0131n\u0131n y\u0131k\u0131larak balkonun mutfa\u011fa eklenmesi, geri kalan balkon k\u0131sm\u0131na eklenen k\u0131s\u0131mdan kap\u0131 a\u00e7\u0131lmas\u0131 \u015feklinde yap\u0131lan imalatlar\u0131n, bilirki\u015fi raporu ile belirlendi\u011fi \u00fczere onayl\u0131 mimari projesine ayk\u0131r\u0131l\u0131\u011f\u0131 sabit ve esasl\u0131 tadilat oldu\u011fu anla\u015f\u0131lm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla Kat M\u00fclkiyeti Kanunu\u2019nun 18 ve 19. maddesinin birinci f\u0131kras\u0131 h\u00fckm\u00fcne g\u00f6re anayap\u0131n\u0131n onayl\u0131 projesini de\u011fi\u015ftirecek \u015fekilde bir tesis ve b\u00f6l\u00fcm yap\u0131lmas\u0131n\u0131n t\u00fcm kat maliklerinin oy birli\u011fi ile verecekleri bir karar ile m\u00fcmk\u00fcn oldu\u011fu kanaatine var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>21. Hukuk Genel Kurulunda yap\u0131lan g\u00f6r\u00fc\u015fmeler s\u0131ras\u0131nda davaya konu edilen balkonda yap\u0131lan de\u011fi\u015fikliklerle ilgili olarak de\u011fi\u015fikli\u011fin yap\u0131ld\u0131\u011f\u0131 balkonun g\u00f6mme balkon olup olmad\u0131\u011f\u0131, ayr\u0131ca yap\u0131lan de\u011fi\u015fikli\u011fin bina alan\u0131nda y\u00fcz\u00f6l\u00e7\u00fcm\u00fc art\u0131\u015f\u0131 meydana getirip getirmedi\u011fi hususunun \u00fczerinde durulmas\u0131, gerek bu y\u00f6nden gerekse de di\u011fer hususlar y\u00f6n\u00fcnden yap\u0131lan de\u011fi\u015fikli\u011fin imar mevzuat\u0131na ayk\u0131r\u0131 olup olmad\u0131\u011f\u0131n\u0131n belirlenmesi gerekti\u011fi gerek\u00e7esiyle direnme karar\u0131n\u0131n farkl\u0131 de\u011fi\u015fik gerek\u00e7e ile bozulmas\u0131 g\u00f6r\u00fc\u015f\u00fc ileri s\u00fcr\u00fclm\u00fc\u015f ise de, bu g\u00f6r\u00fc\u015f Kurul \u00e7o\u011funlu\u011fu taraf\u0131ndan benimsenmemi\u015ftir.<\/p>\n<p>22. H\u00e2l b\u00f6yle olunca direnme karar\u0131n\u0131n, yukar\u0131da a\u00e7\u0131klanan bu de\u011fi\u015fik gerek\u00e7e ve nedenler ile bozulmas\u0131 gerekmi\u015ftir.<\/p>\n<p>IV. SONU\u00c7:<\/p>\n<p>A\u00e7\u0131klanan nedenlerle;<\/p>\n<p>Davac\u0131 vekilinin temyiz itirazlar\u0131n\u0131n kabul\u00fc ile direnme karar\u0131n\u0131n yukar\u0131da a\u00e7\u0131klanan de\u011fi\u015fik gerek\u00e7e ve nedenlerden dolay\u0131 6100 say\u0131l\u0131 Hukuk Muhakemeleri Kanunu&#8217;nun ge\u00e7ici 3. maddesine g\u00f6re uygulanmakta olan 1086 say\u0131l\u0131 Hukuk Usul\u00fc Muhakemeleri Kanunu&#8217;nun 429. maddesi gere\u011fince BOZULMASINA,<\/p>\n<p>\u0130stek h\u00e2linde temyiz pe\u015fin harc\u0131n\u0131n yat\u0131rana geri verilmesine,<\/p>\n<p>Ayn\u0131 Kanun\u2019un 440. maddesi uyar\u0131nca karar\u0131n tebli\u011f tarihinden itibaren on be\u015f g\u00fcn i\u00e7erisinde karar d\u00fczeltme yolu a\u00e7\u0131k olmak \u00fczere 18.01.2022 tarihinde oy \u00e7oklu\u011fu ile karar verildi.<\/p>\n<p>KAR\u015eI OY<\/p>\n<p>Mahkeme ile \u00f6zel daire aras\u0131ndaki uyu\u015fmazl\u0131k balkonlar\u0131n kapat\u0131lmas\u0131 talebiyle ilgili olup di\u011fer talepler y\u00f6n\u00fcnden verilen karar \u00f6zel dairece verilen sair red kapsam\u0131nda kalm\u0131\u015ft\u0131r.<\/p>\n<p>Mahkemece balkonlar\u0131n kapat\u0131lmas\u0131 talebi y\u00f6n\u00fcnden; KMK\u2019n\u0131n 19. maddesine g\u00f6re bu t\u00fcr ortak yerlerde kat maliklerinden be\u015fte d\u00f6rd\u00fcn\u00fcn yaz\u0131l\u0131 r\u0131zas\u0131 ile in\u015faat, onar\u0131m ve de\u011fi\u015fiklik yap\u0131lmas\u0131 m\u00fcmk\u00fcn olup 28 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmden olu\u015fan davaya konu apartmanda kat maliklerinden 24 tanesinin bu duruma muvafakat ettiklerine dair muvafakatnamelerin dosyaya sunuldu\u011fu, yasan\u0131n arad\u0131\u011f\u0131 \u00e7o\u011funluk taraf\u0131ndan bu duruma m\u00fcsaade edilmi\u015f oldu\u011fu gerek\u00e7esiyle davan\u0131n reddi y\u00f6n\u00fcnde verilen karar \u00f6zel daire taraf\u0131ndan bozulmu\u015ftur.<\/p>\n<p>Bu talep y\u00f6n\u00fcnden bozma karar\u0131; \u201cDosya i\u00e7indeki bilgi ve belgeler ile \u00f6zellikle bilirki\u015fi raporunun incelenmesinden; davaya konu 6-9-10 ve 22-28 numaral\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerde tadilat yap\u0131larak balkonun mutfa\u011fa eklendi\u011fi ve pvc ile kaplat\u0131ld\u0131\u011f\u0131, yakla\u015f\u0131k 6-7 m\u00b2 balkon alan\u0131n\u0131n mutfa\u011fa dahil edildi\u011fi, geri kalan balkon k\u0131sm\u0131na yine bu eklenen k\u0131s\u0131mdan kap\u0131 a\u00e7\u0131ld\u0131\u011f\u0131, yap\u0131lan tadilatlar\u0131n projeye ay\u0131r\u0131 oldu\u011fu anla\u015f\u0131lmaktad\u0131r.<br \/>\n634 say\u0131l\u0131 Kat M\u00fclkiyeti Yasas\u0131n\u0131n 19. maddesinin 1. f\u0131kras\u0131na g\u00f6re, kat malikleri anata\u015f\u0131nmaz\u0131n bak\u0131m\u0131n\u0131, mimari durumu ile g\u00fczelli\u011fini ve sa\u011flaml\u0131\u011f\u0131n\u0131 titizlikle korumaya mecburdurlar. Ayn\u0131 Yasan\u0131n 2. f\u0131kras\u0131nda ise kat maliklerinden biri, t\u00fcm kat maliklerinin yaz\u0131l\u0131 r\u0131zas\u0131 olmad\u0131k\u00e7a anata\u015f\u0131nmaz\u0131n ortak yerlerinde in\u015faat, onar\u0131m, tesis ve de\u011fi\u015fiklik yapt\u0131ramayaca\u011f\u0131ndan, projeye ayk\u0131r\u0131 olarak ortak alanda yap\u0131lan tadilatlar y\u00f6n\u00fcnden m\u00fcdahalenin \u00f6nlenmesi ile projeye ayk\u0131r\u0131l\u0131klar\u0131n giderilerek eski hale getirilmesine karar verilmesi gerekirken mahkemece s\u00f6z\u00fc edilen tadilatlar\u0131n kat maliklerinden 24&#8217;\u00fcn\u00fcn yaz\u0131l\u0131 muvafakat\u0131 bulundu\u011fu gerek\u00e7esiyle davan\u0131n reddi do\u011fru g\u00f6r\u00fclmemi\u015ftir.\u201d Gerek\u00e7e ve sonucunu i\u00e7ermektedir.<\/p>\n<p>Mahkemece KMK\u2019n\u0131n 19\/2. maddesinde t\u00fcm kat maliklerinin de\u011fil, 4\/5 inin yaz\u0131l\u0131 r\u0131zas\u0131n\u0131n arand\u0131\u011f\u0131, eldeki dava bak\u0131m\u0131ndan da 28 daireli binada 24 kat malikinin bu hususta yaz\u0131l\u0131 r\u0131zas\u0131n\u0131n bulundu\u011fu ve 19\/2. maddede aranan 4\/5 oran\u0131n\u0131n sa\u011fland\u0131\u011f\u0131, dolay\u0131s\u0131yla yap\u0131lan tadilatlar\u0131n kanuna uygun oldu\u011fu gerek\u00e7esi ile direnme karar\u0131 verilmi\u015ftir.<\/p>\n<p>Bozma karar\u0131nda 19\/2. maddeden s\u00f6z edildi\u011fi h\u00e2lde t\u00fcm kat maliklerinin yaz\u0131l\u0131 r\u0131zas\u0131 olmad\u0131k\u00e7a ibaresine yer verilmi\u015f ise de 5711 say\u0131l\u0131 Kanunla 2007 tarihinde yap\u0131lan de\u011fi\u015fiklik h\u00fckm\u00fcne g\u00f6re maddede belirtilen oran oybirli\u011fi olmay\u0131p 4\/5 oldu\u011fundan bozma karar\u0131ndaki bu ibare Kanun h\u00fckm\u00fcne uygun de\u011fildir. \u00d6zel dairenin bunu 19\/1 madde kapsam\u0131nda belirtti\u011fi d\u00fc\u015f\u00fcn\u00fclebilir ise de a\u00e7\u0131k\u00e7a f\u0131kradan s\u00f6z edip yer verilen di\u011fer ifadeler de 19\/2 h\u00fckm\u00fc oldu\u011fundan bozma karar\u0131ndaki bu ifadelerin 19\/2 kapsam\u0131nda yap\u0131lan a\u00e7\u0131klamalar oldu\u011fu a\u00e7\u0131k\u00e7a anla\u015f\u0131lmaktad\u0131r. Bu durumda bozma karar\u0131n\u0131n bu y\u00f6nden Kanun h\u00fckm\u00fcne (KMK 19\/2) ayk\u0131r\u0131 oldu\u011fu a\u00e7\u0131k\u00e7a anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>Mahkemenin bu hususa de\u011finen direnme gerek\u00e7esi bu y\u00f6n\u00fcyle yerinde ise de kat maliklerinin 4\/5 inin oyu ile balkon kapatman\u0131n m\u00fcmk\u00fcn olup olmad\u0131\u011f\u0131 mahkemenin buna de\u011finen gerek\u00e7esinin yerinde olup olmad\u0131\u011f\u0131n\u0131n ise ayr\u0131ca de\u011ferlendirilmesi gerekir.<\/p>\n<p>S\u00f6z\u00fc edilen 19\/2. maddede kat maliklerinin be\u015fte d\u00f6rd\u00fcn\u00fcn r\u0131zas\u0131yla yap\u0131labilecek i\u015fler maddede say\u0131lan h\u00e2llerle s\u0131n\u0131rl\u0131 olup bunlar\u0131n yap\u0131lmas\u0131n\u0131 yasaklay\u0131c\u0131 Kanun h\u00fck\u00fcmlerinin bulundu\u011fu h\u00e2llerde kat mliklerinin 4\/5 oran\u0131nda anla\u015fmas\u0131yla dahi Kanuna ayk\u0131r\u0131 i\u015flemlerin yap\u0131lmas\u0131 m\u00fcmk\u00fcn de\u011fildir. Hatta t\u00fcm kat malikleri bu konuda anla\u015fm\u0131\u015f olsa bile Kanunla yasaklanm\u0131\u015f i\u015flerin 19\/2 h\u00fckm\u00fcne dayan\u0131larak yap\u0131labilmesi m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p>Bu konuda somut uyu\u015fmazl\u0131k bak\u0131m\u0131ndan \u00fczerinde durulmas\u0131 gereken en \u00f6nemli husus imar mevzuat\u0131ndan do\u011fan yasaklamalard\u0131r. \u0130mar mevzuat\u0131na ili\u015fkin h\u00fck\u00fcmler kamu d\u00fczeninden olup bu d\u00fczenlemelerin aksine olarak taraflar\u0131n anla\u015fma yapabilece\u011fi ve bu anla\u015fman\u0131n ge\u00e7erli olaca\u011f\u0131 d\u00fc\u015f\u00fcn\u00fclemez. \u0130mar Kanunu h\u00fck\u00fcmlerine g\u00f6re ruhsats\u0131z projeye ayk\u0131r\u0131 bina yap\u0131lamayaca\u011f\u0131 gibi tadilat ruhsat\u0131 al\u0131nmaks\u0131z\u0131n bir bina projes\u011fne ayk\u0131r\u0131 h\u00e2le getirilemez.<\/p>\n<p>Ruhsats\u0131z projeye ayk\u0131r\u0131 bina yap\u0131lmas\u0131 veya binan\u0131n projeye ayk\u0131r\u0131 h\u00e2le getirilmesi Kanunlarda yasaklanm\u0131\u015f ve \u00fcstelik gerek idari yapt\u0131r\u0131m olsun gerek ceza h\u00fck\u00fcmleri olsun baz\u0131 m\u00fceyyidelere ba\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>Bu durumda talebe konu edilen balkon kapatma y\u00f6n\u00fcndeki de\u011fi\u015fiklik proje de\u011fi\u015fikli\u011fi yap\u0131lmas\u0131 ve ruhsat al\u0131nmas\u0131n\u0131 gerektiriyorsa t\u00fcm kat malikleri bu konuda anla\u015fm\u0131\u015f olsa bile bu anla\u015fman\u0131n ge\u00e7erli olmayaca\u011f\u0131 ve yap\u0131lan Kanuna ayk\u0131r\u0131 de\u011fi\u015fiklikleri me\u015fru h\u00e2le getirmeyece\u011fi kabul edilmelidir. A\u00e7\u0131klanan nedenlerle \u00f6zellikle davaya konu edilen balkonda yap\u0131lan de\u011fi\u015fikliklerle ilgili olarak de\u011fi\u015fikli\u011fin yap\u0131ld\u0131\u011f\u0131 balkonun g\u00f6mme balkon olup olmad\u0131\u011f\u0131 ayr\u0131ca yap\u0131lan de\u011fi\u015fikli\u011fin bina alan\u0131nda y\u00fcz\u00f6l\u00e7\u00fcm\u00fc art\u0131\u015f\u0131 meydana getirip getirmedi\u011fi \u00fczerinde durulmas\u0131 gerek bu y\u00f6nden gerekse di\u011fer hususlar y\u00f6n\u00fcnden yap\u0131lan de\u011fi\u015fikli\u011fin imar mevzuat\u0131na ayk\u0131r\u0131 olup olmad\u0131\u011f\u0131n\u0131n belirlenmesi ve sonucuna g\u00f6re karar verilmesi gerekirken Kanunda aranan oranda kat malikinin r\u0131zas\u0131 bulundu\u011fu gerek\u00e7esiyle talebin reddine karar verilmesi do\u011fru olmam\u0131\u015ft\u0131r.<br \/>\nA\u00e7\u0131klanan nedenlere dayal\u0131 olarak direnme karar\u0131n\u0131n bozulmas\u0131 gerekti\u011fi g\u00f6r\u00fc\u015f\u00fcnde oldu\u011fumuzdan de\u011fi\u015fik bozma y\u00f6n\u00fcnde olu\u015fan de\u011ferli \u00e7o\u011funluk g\u00f6r\u00fc\u015f\u00fcne kat\u0131lam\u0131yoruz.<\/p>\n<p>&#8212;<\/p>\n<p>T.C.<\/p>\n<p>Yarg\u0131tay <\/p>\n<p>18.
