Ba\u015fvuru, tahliye davas\u0131n\u0131n temerr\u00fct ihtarlar\u0131n\u0131n usul\u00fcne uygun \u015fekilde tebli\u011f edilmedi\u011fi gerek\u00e7esiyle reddedilmesi nedeniyle m\u00fclkiyet hakk\u0131n\u0131n ihlal edildi\u011fi iddias\u0131na ili\u015fkindir.<\/p>\n<p>II. Ba\u015fvuru, ba\u015fvuru formu ve eklerinin idari y\u00f6nden yap\u0131lan \u00f6n incelemesinden sonra Komisyona sunulmu\u015ftur.<\/p>\n<p>4. Komisyonca ba\u015fvurunun kabul edilebilirlik incelemesinin B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>5. B\u00f6l\u00fcm Ba\u015fkan\u0131 taraf\u0131ndan, ba\u015fvurunun kabul edilebilirlik ve esas incelemesinin birlikte yap\u0131lmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>6. Ba\u015fvuru belgelerinin bir \u00f6rne\u011fi bilgi i\u00e7in Adalet Bakanl\u0131\u011f\u0131na (Bakanl\u0131k) g\u00f6nderilmi\u015ftir. Bakanl\u0131k, g\u00f6r\u00fc\u015f\u00fcn\u00fc bildirmi\u015ftir.<\/p>\n<p>7. Ba\u015fvurucu, Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 s\u00fcresinde beyanda bulunmu\u015ftur.<\/p>\n<p>III. OLAY VE OLGULAR <\/p>\n<p>8. Ba\u015fvuru formu ve eklerinde ifade edildi\u011fi \u015fekliyle ilgili olaylar \u00f6zetle \u015f\u00f6yledir:<\/p>\n<p>A. T\u00fcrk Hava Kurumu Genel Ba\u015fkanl\u0131\u011f\u0131&#8217;n\u0131n Stat\u00fcs\u00fc<\/p>\n<p>9. T\u00fcrk Tayyare Cemiyeti, havac\u0131l\u0131k sanayisinin temellerini atmak ve geli\u015ftirmek, havac\u0131l\u0131\u011f\u0131n asker\u00ee, ekonomik, sosyal ve siyasal \u00f6nemini anlatmak, askeri, sivil ve turistik havac\u0131l\u0131\u011f\u0131n geli\u015fmesini sa\u011flamak, gerekli ara\u00e7 ve gereci haz\u0131rlamak, personel yeti\u015ftirmek ve u\u00e7an bir T\u00fcrk gen\u00e7li\u011fi meydana getirmek amac\u0131yla 1925 y\u0131l\u0131nda kurulmu\u015ftur. T\u00fcrk Teyyare Cemiyetinin ad\u0131 1935 y\u0131l\u0131nda T\u00fcrk Hava Kurumu (THK) olarak de\u011fi\u015ftirilmi\u015ftir.<\/p>\n<p>10. THK T\u00fcz\u00fc\u011f\u00fc (Dernek T\u00fcz\u00fc\u011f\u00fc) Bakanlar Kurulunun 20\/10\/2008 tarihli ve 2008\/14307 say\u0131l\u0131 karar\u0131yla onaylanm\u0131\u015f, 4\/12\/2008 tarihli ve 27074 say\u0131l\u0131 Resm\u00ee Gazete&#8217;de yay\u0131mlanm\u0131\u015ft\u0131r.<\/p>\n<p>11. Dernek T\u00fcz\u00fc\u011f\u00fc&#8217;n\u00fcn 3. maddesinde 16\/2\/1925 tarihinde T\u00fcrk Tayyare Cemiyeti ad\u0131 alt\u0131nda kurulan THK&#8217;n\u0131n amac\u0131n\u0131n b\u00fcy\u00fck T\u00fcrk milletinin maddi ve manevi deste\u011finde, Cumhurba\u015fkan\u0131 ve h\u00fck\u00fbmetin y\u00fcksek himayelerinde havac\u0131l\u0131\u011f\u0131 T\u00fcrk milletine benimsetmek ve sevdirmek \u00fczere ilm\u00ee, teknik, turistik ve sportif alanda faaliyet g\u00f6stermek oldu\u011fu a\u00e7\u0131klanm\u0131\u015ft\u0131r. Dernek t\u00fcz\u00fc\u011f\u00fcne g\u00f6re Cumhurba\u015fkan\u0131, THK&#8217;n\u0131n onursal genel ba\u015fkan\u0131 olup gerekli g\u00f6rd\u00fc\u011f\u00fc takdirde THK&#8217;n\u0131n ola\u011fan Genel Kurulu toplant\u0131s\u0131na kat\u0131larak Genel Kurulda a\u00e7\u0131\u015f konu\u015fmas\u0131 yapar. THK 4\/11\/2004 tarihli ve 5253 say\u0131l\u0131 Dernekler Kanunu&#8217;na tabi \u00f6zel hukuk t\u00fczel ki\u015fisidir.<\/p>\n<p>12. Dernek T\u00fcz\u00fc\u011f\u00fc&#8217;n\u00fcn 5. maddesine g\u00f6re THK&#8217;n\u0131n onursal ve asil olmak \u00fczere iki t\u00fcr \u00fcyesi vard\u0131r: Onursal \u00fcyeler, Kuruma maddi ve manevi yard\u0131mlar\u0131 bulunan ger\u00e7ek ve t\u00fczel ki\u015filer ile yabanc\u0131 \u015fah\u0131slardan Genel Y\u00f6netim Kurulu karar\u0131 ile onursal \u00fcyelik s\u0131fat\u0131 verilenler, asil \u00fcyeler ise dernek kurma hakk\u0131na sahip ger\u00e7ek ve t\u00fczel ki\u015filerden THK \u015fubelerinden birine ba\u015fvurarak usul\u00fcne uygun olarak \u00fcyeli\u011fe kabul edilen ki\u015filerdir. Gazi Mustafa Kemal Atat\u00fcrk Kurumun ilk onursal \u00fcyesidir. T\u00fcrkiye Cumhuriyeti Cumhurba\u015fkan\u0131 da THK&#8217;n\u0131n onursal \u00fcyesidir.<\/p>\n<p>13. Dernek T\u00fcz\u00fc\u011f\u00fc&#8217;n\u00fcn 11. maddesine g\u00f6re THK B\u00fcy\u00fck Genel Kurulu;<\/p>\n<p>i. TBMM ba\u015fkan\u0131, ba\u015fbakan, genelkurmay ba\u015fkan\u0131, kara kuvvetleri komutan\u0131, deniz kuvvetleri komutan\u0131, hava kuvvetleri komutan\u0131, jandarma genel komutan\u0131, Ankara valisi, Ankara b\u00fcy\u00fck\u015fehir belediye ba\u015fkan\u0131 ve THK genel ba\u015fkanl\u0131\u011f\u0131 yapanlardan,<\/p>\n<p>ii. Ba\u015fbakanl\u0131ktan daire ba\u015fkan\u0131 veya daha \u00fcst d\u00fczeyde bir delege, Savunma Sanayii M\u00fcste\u015farl\u0131\u011f\u0131ndan daire ba\u015fkan\u0131 veya daha \u00fcst d\u00fczeyde bir delege, Hava Kuvvetleri Komutanl\u0131\u011f\u0131 kurmay ba\u015fkan\u0131, Genelkurmay Harek\u00e2t Ba\u015fkanl\u0131\u011f\u0131ndan iki delege, KKK Havac\u0131l\u0131k Daire Ba\u015fkanl\u0131\u011f\u0131ndan iki general veya \u015fube m\u00fcd\u00fcr\u00fc d\u00fczeyinde delege, Dz.K.K. ve J.Gn.K.l\u0131\u011f\u0131ndan birer delege, Hv.K.K.l\u0131\u011f\u0131ndan muvazzaf veya emekli general ile \u015fube m\u00fcd\u00fcr\u00fc d\u00fczeyinde toplam be\u015f delege, sosyal yard\u0131mla\u015fma ve dayan\u0131\u015fma genel m\u00fcd\u00fcr\u00fc, Diyanet \u0130\u015fleri Ba\u015fkanl\u0131\u011f\u0131ndan, T\u00fcrkiye K\u0131z\u0131lay Derne\u011finden, Sosyal Hizmetler ve \u00c7ocuk Esirgeme Kurumundan birer delege, Mill\u00ee Savunma, \u0130\u00e7i\u015fleri, D\u0131\u015fi\u015fleri, Mill\u00ee E\u011fitim, Tar\u0131m ve K\u00f6yi\u015fleri, K\u00fclt\u00fcr ve Turizm ile \u00c7evre ve Orman Bakanl\u0131klar\u0131ndan daire ba\u015fkan\u0131 veya daha \u00fcst d\u00fczeyde birer delege, TRT, DHM\u0130, Sivil Havac\u0131l\u0131k, Posta ve Telgraf Te\u015fkilat\u0131 ile Gen\u00e7lik ve Spor Genel M\u00fcd\u00fcrl\u00fcklerinden birer delege, mesleki ve teknik y\u00f6nden havac\u0131l\u0131k e\u011fitimi veren \u00fcniversitelerden birer delege, Muhtarlar Federasyonundan bir delege, Ankara\u2019daki her \u00fcniversiteden ve G\u00fclhane Asker\u00ee T\u0131p Akademisinde (GATA) \u00f6\u011fretim \u00fcyesi olmak kayd\u0131yla birer delegeden,<\/p>\n<p>iii. THK genel ba\u015fkan\u0131, Genel Y\u00f6netim, Merkez Denetleme ve Merkez Disiplin Kurulu as\u0131l \u00fcyelerinden,<\/p>\n<p>iv. THK \u015fube ba\u015fkanlar\u0131 ve 12. maddede belirtilen esaslara g\u00f6re \u015fube ba\u015fkanlar\u0131 da d\u00e2hil olmak \u00fczere azami 600 ki\u015fiden olu\u015fan ve \u015fube genel kurullar\u0131nca se\u00e7ilecek delegelerden meydana gelir.<\/p>\n<p>14. Dernek T\u00fcz\u00fc\u011f\u00fc&#8217;n\u00fcn 18. maddesine g\u00f6re Genel Y\u00f6netim Kurulu;B\u00fcy\u00fck Genel Kurulunca se\u00e7ilmi\u015f genel ba\u015fkan ile 11 as\u0131l ve 11 yedek \u00fcyeden olu\u015fur. Genel ba\u015fkan, Genel Y\u00f6netim Kurulunun ba\u015fkan\u0131 olarak Kurul \u00fcyeleri aras\u0131ndan bir genel ba\u015fkan yard\u0131mc\u0131s\u0131 ve tutanaklar\u0131 yazmak \u00fczere bir sekreter \u00fcye se\u00e7er.<\/p>\n<p>15. Dernek T\u00fcz\u00fc\u011f\u00fc&#8217;n\u00fcn 21. maddesine g\u00f6re genel ba\u015fkan, T\u00fcrk Hava Kurumunu temsil eder ve Genel Y\u00f6netim Kurulunun ba\u015fkan\u0131d\u0131r. Genel ba\u015fkan, Genel Y\u00f6netim Kurulu toplant\u0131lar\u0131n\u0131n g\u00fcndemini haz\u0131rlar, Kurumun hizmet ve faaliyetlerini, kanun, t\u00fcz\u00fck, y\u00f6netmelik ve y\u00f6nerge h\u00fck\u00fcmlerine, B\u00fcy\u00fck Genel Kurul ve Genel Y\u00f6netim Kurulunun kararlar\u0131na uygun olarak y\u00fcr\u00fct\u00fcr. Genel ba\u015fkan, Genel Y\u00f6netim Kurulundan ald\u0131\u011f\u0131 yetkiye dayanarak ta\u015f\u0131n\u0131r ve ta\u015f\u0131nmaz mallar\u0131n al\u0131m\u0131, sat\u0131m\u0131, ipotek al\u0131nmas\u0131 ve verilmesi i\u015flemini yapar, ayn\u0131 yolla kiraya verir ve Kurum i\u00e7in ta\u015f\u0131nmaz kiralar.<\/p>\n<p>16. Dernek T\u00fcz\u00fc\u011f\u00fc&#8217;n\u00fcn 41. maddesine g\u00f6re THK&#8217;n\u0131n gelirleri \u00fcye aidatlar\u0131, kurban derisi, ba\u011f\u0131rsak ile fitre ve zek\u00e2t toplama faaliyetlerinden elde edilen gelirler, her t\u00fcrl\u00fc ba\u011f\u0131\u015f, ticari faaliyetlerden elde edilen gelirler, kira gelirleri ve di\u011fer gelirlerdir.<\/p>\n<p>17. THK 5\/8\/1925 tarihli Bakanlar Kurulu karar\u0131yla kamuya yararl\u0131 dernek stat\u00fcs\u00fcne al\u0131nm\u0131\u015ft\u0131r. Kamuya yararl\u0131 dernek stat\u00fcs\u00fcn\u00fcn bir sonucu olarak THK, baz\u0131 vergisel y\u00fck\u00fcml\u00fcl\u00fcklerden muaf h\u00e2le gelmi\u015ftir. Buna g\u00f6re THK 25\/10\/1984 tarihli ve 3065 say\u0131l\u0131 Katma De\u011fer Vergisi Kanunu, 8\/6\/1959 tarihli ve 7338 say\u0131l\u0131 Veraset ve \u0130ntikal Vergisi Kanunu, 2\/7\/1964 tarihli ve 492 say\u0131l\u0131 Har\u00e7lar Kanunu ile 29\/7\/1970 tarihli ve 1319 say\u0131l\u0131 Emlak Vergisi Kanunu&#8217;nda yer alan baz\u0131 vergiler y\u00f6n\u00fcnden muafiyet h\u00fck\u00fcmlerinden yararlanmaktad\u0131r.<\/p>\n<p>B. Uyu\u015fmazl\u0131\u011f\u0131n Arka Plan\u0131<\/p>\n<p>18. THK, m\u00fclkiyetinde bulunan \u0130stanbul&#8217;un Fatih il\u00e7esi, Balabana\u011fa Mah., 663 Ada, 1 parselde yer alan ta\u015f\u0131nmaz\u0131 kiralamak amac\u0131yla ihale d\u00fczenlemi\u015ftir. \u0130hale sonucu 1\/7\/2005 tarihinde THK ile N.G. San. Tic. Ltd. \u015eti. (N. Giyim \u015eirketi) aras\u0131nda 20 y\u0131ll\u0131k kira s\u00f6zle\u015fmesi imzalanm\u0131\u015ft\u0131r. Kira s\u00f6zle\u015fmesinin amac\u0131 ta\u015f\u0131nmaz\u0131n 4 y\u0131ld\u0131zl\u0131 otel olarak kullan\u0131lmas\u0131 ve i\u015fletilmesi olarak belirlenmi\u015f, kira bedeli y\u0131ll\u0131k 2.600.000 Amerikan dolar\u0131 olarak kararla\u015ft\u0131r\u0131lm\u0131\u015ft\u0131r. Kira s\u00f6zle\u015fmesinin s\u00fcresi 26\/6\/2009 ve 9\/10\/2012 tarihli protokollerle uzat\u0131lm\u0131\u015f ve kira s\u00f6zle\u015fmesinin bitim tarihi 30\/6\/2055 olarak belirlenmi\u015ftir.<\/p>\n<p>19. 18\/3\/2013 tarihli yeni bir protokolle kira s\u00f6zle\u015fmesi t\u00fcm protokol ve ekleriyle birlikte A. Gayrimenkul Turizm Yat\u0131r\u0131m San ve Tic. A.\u015e.ye(sonraki \u00fcnvan\u0131 K. Holding A.\u015e.)devredilmi\u015ftir. Akabinde kira s\u00f6zle\u015fmesi tapuya \u015ferh edilmi\u015ftir. Bu arada THK, an\u0131lan kira s\u00f6zle\u015fmesinden kaynaklanan kira alacaklar\u0131n\u0131 25\/6\/2014 tarihli alaca\u011f\u0131n temliki s\u00f6zle\u015fmesiyle O. Bankas\u0131na temlik etmi\u015ftir.<\/p>\n<p>20. THK 5\/12\/2016 tarihinde K. Holding A.\u015e. ve N. Giyim \u015eirketine ihtarname g\u00f6ndermi\u015ftir. \u0130htarnamede kira s\u00f6zle\u015fmesinin uzat\u0131lmas\u0131na y\u00f6nelik protokollerin THK T\u00fcz\u00fc\u011f\u00fc&#8217;ne, 5253 say\u0131l\u0131 Kanun&#8217;a ve Dernekler Y\u00f6netmeli\u011fi&#8217;ne ayk\u0131r\u0131 \u015fekilde d\u00fczenlendi\u011fini, THK Genel Y\u00f6netim Kurulunun 25\/11\/2016 tarihli karar\u0131 gere\u011fince ge\u00e7ersiz kirac\u0131l\u0131k ili\u015fkisine dayan\u0131larak ta\u015f\u0131nmazdaki mevcut m\u00fcdahalenin yasa d\u0131\u015f\u0131 oldu\u011funu belirtmi\u015ftir. THK 9\/10\/2012 tarihli protokolde THK Y\u00f6netim Kurulu karar\u0131 olmaks\u0131z\u0131n do\u011frudan tek ba\u015f\u0131na genel ba\u015fkan\u0131n imzas\u0131n\u0131n bulundu\u011funu, bunun usuls\u00fcz ve ge\u00e7ersiz oldu\u011funu iddia etmi\u015ftir.<\/p>\n<p>21. Akabinde K. Holding A.\u015e. 20\/12\/2016 tarihinde kirac\u0131l\u0131k s\u0131fat\u0131n\u0131n tespiti istemiyle \u0130stanbul 6. Sulh Hukuk Mahkemesinde tespit davas\u0131 a\u00e7m\u0131\u015ft\u0131r. \u0130stanbul 6. Sulh Hukuk Mahkemesi 27\/2\/2018 tarihinde yetkisizlik karar\u0131 vermi\u015f, sonras\u0131nda dava Ankara 6. Sulh Hukuk Mahkemesinde (Mahkeme) g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Mahkeme 5\/3\/2019 tarihinde davan\u0131n kabul\u00fc ile kirac\u0131l\u0131k s\u0131fat\u0131n\u0131n tespitine karar vermi\u015ftir. Karar, istinaf incelemesinden ge\u00e7erek kesinle\u015fmi\u015ftir.<\/p>\n<p>22. THK 22\/1\/2018 tarihinde kira s\u00f6zle\u015fmesinin A. Gayrimenkul A.\u015e.ye devredilmesi ve s\u00f6zle\u015fme s\u00fcresinin 2055 y\u0131l\u0131na kadar uzat\u0131lmas\u0131na y\u00f6nelik protokollerde Genel Y\u00f6netim Kurulu karar\u0131 olmaks\u0131z\u0131n Genel Ba\u015fkan O.Y.nin tek ba\u015f\u0131na imzas\u0131n\u0131n bulundu\u011funu, bunun usuls\u00fcz ve ge\u00e7ersiz oldu\u011funu iddia etmi\u015ftir. Kira s\u00fcresinin tapuya \u015ferhi i\u00e7in THK T\u00fcz\u00fc\u011f\u00fc&#8217;ne ayk\u0131r\u0131 olarak kirac\u0131ya tapuya \u015ferh etme yetkisi verildi\u011fini belirterek \u015ferh i\u015fleminin ve kira s\u00fcresinin uzat\u0131lmas\u0131na dair yap\u0131lan ek protokollerin iptali istemiyle Ankara 1. Sulh Hukuk Mahkemesinde dava a\u00e7m\u0131\u015ft\u0131r. Ankara 1. Sulh Hukuk Mahkemesi 8\/11\/2018 tarihinde davan\u0131n kabul\u00fc ile kira s\u00f6zle\u015fmesi s\u00fcresinin uzat\u0131lmas\u0131na dair yap\u0131lan ek protokoller sebebi ile tapuya kaydolunan kira \u015ferhinin iptaline karar vermi\u015f; kararda kira s\u00f6zle\u015fmesini imzalayan Genel Ba\u015fkan O.Y aleyhine g\u00f6revi k\u00f6t\u00fcye kullanma su\u00e7undan verilen mahk\u00fbmiyet karar\u0131na vurgu yapm\u0131\u015ft\u0131r. Karar, istinaf incelemesinden ge\u00e7erek kesinle\u015fmi\u015ftir.<\/p>\n<p>C. Bireysel Ba\u015fvuruya Konu Tahliye ve Alacak Davas\u0131<\/p>\n<p>23. Ba\u015fvurucu, 30\/11\/2017 ve 6\/12\/2017 tarihli ihtarnamelerle Genel Y\u00f6netim Kurulu karar\u0131 olmaks\u0131z\u0131n yetkisiz genel ba\u015fkan imzas\u0131yla akdedilen 18\/3\/2013 tarihli protokolle kira s\u00f6zle\u015fmesinin K. Holding A.\u015e.ye devrinin kararla\u015ft\u0131r\u0131ld\u0131\u011f\u0131n\u0131, hukuken ge\u00e7erlili\u011fi bulunmayan devre ra\u011fmen ta\u015f\u0131nmaz\u0131 kullanan K. Holding A.\u015e.nin kira bedellerini \u00f6demeyerek THK&#8217;y\u0131 zarara u\u011fratmakta oldu\u011funu belirterek 1\/7\/2017 tarihinden itibaren \u00f6denmesi gereken kira bedelinin (351.392,40 Amerikan dolar\u0131) O. Holding A.\u015e.nin usul\u00fcne uygun tebli\u011f edilmeyen ihtarlardan haricen haberdar oldu\u011funun kabul edilemeyece\u011fini ifade etmi\u015ftir.<\/p>\n<p>25. Ba\u015fvurucu, karara kar\u015f\u0131 temyize ba\u015fvurmu\u015ftur. Temyiz dilek\u00e7esinde alaca\u011f\u0131n temliki s\u00f6zle\u015fmesinin bor\u00e7 ili\u015fkisinin taraflar\u0131n\u0131 de\u011fi\u015ftirmedi\u011fini, kiraya veren s\u0131fat\u0131yla tahliye isteme hakk\u0131 oldu\u011funu, ihtarnamelerin K. Holding A.\u015e.nin evrak memuru G.B.ye tebli\u011f edildi\u011fini, bu tebligat\u0131n usul\u00fcne uygun oldu\u011funu iddia etmi\u015ftir. Yarg\u0131tay 3. Hukuk Dairesi (Daire) 18\/11\/2020 tarihinde \u0130stinaf Mahkemesi karar\u0131n\u0131n onanmas\u0131na karar vermi\u015ftir. Yarg\u0131tay onama karar\u0131nda kiraya verenin tahliye davas\u0131 a\u00e7makta hakk\u0131 var ise de tebligatlar\u0131n usuls\u00fczl\u00fc\u011f\u00fc nedeniyle davan\u0131n reddine y\u00f6nelik \u0130stinaf Mahkemesi karar\u0131n\u0131n sonucu itibar\u0131yla do\u011fru oldu\u011funu belirtmi\u015ftir.<\/p>\n<p>26. Nihai karar 19\/12\/2020 tarihinde ba\u015fvurucuya tebli\u011f edilmi\u015f, ba\u015fvurucu 4\/1\/2021 tarihinde bireysel ba\u015fvuruda bulunmu\u015ftur.<\/p>\n<p>IV . \u0130LG\u0130L\u0130 HUKUK<\/p>\n<p>A. Ulusal Hukuk<\/p>\n<p>27. 22\/11\/2001 tarihli ve 4721 say\u0131l\u0131 T\u00fcrk Medeni Kanunu&#8217;nun 56. maddesinin birinci f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Dernekler, ger\u00e7ek veya t\u00fczel en az yedi ki\u015finin kazan\u00e7 payla\u015fma d\u0131\u015f\u0131nda belirli ve ortak bir amac\u0131 ger\u00e7ekle\u015ftirmek \u00fczere, bilgi ve \u00e7al\u0131\u015fmalar\u0131n\u0131 s\u00fcrekli olarak birle\u015ftirmek suretiyle olu\u015fturduklar\u0131, t\u00fczel ki\u015fili\u011fe sahip ki\u015fi topluluklar\u0131d\u0131r.&#8221;<\/p>\n<p>28. 4721 say\u0131l\u0131 Kanun&#8217;un 58. maddesinin birinci f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Her derne\u011fin bir t\u00fcz\u00fc\u011f\u00fc bulunur.<\/p>\n<p>Dernek t\u00fcz\u00fc\u011f\u00fcnde derne\u011fin ad\u0131, amac\u0131, gelir kaynaklar\u0131, \u00fcyelik ko\u015fullar\u0131, organlar\u0131 ve \u00f6rg\u00fct\u00fc ile ge\u00e7ici y\u00f6netim kurulunun g\u00f6sterilmesi zorunludur.<\/p>\n<p>Dernek t\u00fcz\u00fc\u011f\u00fc, kanunun emredici h\u00fck\u00fcmlerine ayk\u0131r\u0131 olamaz.&#8221;<\/p>\n<p>&#8230;<\/p>\n<p>29. 4721 say\u0131l\u0131 Kanun&#8217;un 99. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Dernek gelirleri, \u00fcye \u00f6dentisi, dernek faaliyetleri sonucunda veya dernek malvarl\u0131\u011f\u0131ndan elde edilen gelirler ile ba\u011f\u0131\u015f ve yard\u0131mlardan olu\u015fur.&#8221;<\/p>\n<p>30. 4721 say\u0131l\u0131 Kanun&#8217;un 100. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Kamuya yararl\u0131 dernekler ve \u00f6zel kanunlarla kurulan dernekler hakk\u0131ndaki \u00f6zel h\u00fck\u00fcmler sakl\u0131d\u0131r. &#8220;<\/p>\n<p>31. 28\/6\/1938 tarihli ve 3512 say\u0131l\u0131 m\u00fclga Cemiyetler Kanunu&#8217;nun 37. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Bir cemiyetin umumi menfaatlere hadim cemiyetlerden say\u0131lmas\u0131, Devlet \u015euras\u0131 karar\u0131 ile icra vekilleri heyetince tasdik olunmas\u0131na ba\u011fl\u0131d\u0131r. &#8220;<\/p>\n<p>32. 3512 say\u0131l\u0131 m\u00fclga Kanun&#8217;un 38. maddesinin ikinci f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;T\u00fcrk Hava ve T\u00fcrk \u00e7ocuk esirgeme kurumu, icra vekilleri heyetince tasdikli ana nizamnamelerine ve kanunlar\u0131n kendilerine verdi\u011fi vazife ve selahiyetlerle idare olunurlar.&#8221;<\/p>\n<p>33. 4\/11\/2004 tarihli ve 5253 say\u0131l\u0131 Dernekler Kanunu&#8217;nun 27. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Kamu yarar\u0131na \u00e7al\u0131\u015fan dernekler, Cumhurba\u015fkan\u0131 karar\u0131yla tespit edilir. Bir derne\u011fin kamu yarar\u0131na \u00e7al\u0131\u015fan derneklerden say\u0131labilmesi i\u00e7in, en az bir y\u0131ldan beri faaliyette bulunmas\u0131 ve derne\u011fin amac\u0131 ve bu amac\u0131 ger\u00e7ekle\u015ftirmek \u00fczere giri\u015fti\u011fi faaliyetlerin topluma yararl\u0131 sonu\u00e7lar verecek nitelikte ve \u00f6l\u00e7\u00fcde olmas\u0131 \u015fartt\u0131r.<\/p>\n<p>&#8230;<\/p>\n<p>T\u00fcrkiye K\u0131z\u0131lay Derne\u011fi ve T\u00fcrk Hava Kurumunun t\u00fcz\u00fcklerini onaylamaya Cumhurba\u015fkan\u0131 yetkilidir.<\/p>\n<p>34. 7201 say\u0131l\u0131 Kanun&#8217;un &#8220;H\u00fckmi \u015fah\u0131slar\u0131n memur ve m\u00fcstahdemlerine tebligat&#8221; ba\u015fl\u0131kl\u0131 13. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;H\u00fckmi \u015fah\u0131slar nam\u0131na kendilerine tebli\u011f yap\u0131lacak kimseler her hangi bir sebeple m\u00fctat i\u015f saatlerinde i\u015f yerinde bulunmad\u0131klar\u0131 veya o s\u0131rada evrak\u0131 bizzat alam\u0131yacak bir halde olduklar\u0131 takdirde tebli\u011f, orada haz\u0131r bulunan memur veya m\u00fcstahdemlerinden birine yap\u0131l\u0131r. &#8220;<\/p>\n<p>35. 7201 say\u0131l\u0131 Kanun&#8217;un 32. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Tebli\u011f usul\u00fcne ayk\u0131r\u0131 yap\u0131lm\u0131\u015f olsa bile, muhatab\u0131 tebli\u011fe muttali olmu\u015f ise muteber say\u0131l\u0131r.<\/p>\n<p>Muhatab\u0131n beyan etti\u011fi tarih, tebli\u011f tarihi addolunur.&#8221;<\/p>\n<p>36. 25\/1\/2012 tarihli ve 28184 say\u0131l\u0131 Resm\u00ee Gazete&#8217;de yay\u0131mlanarak y\u00fcr\u00fcrl\u00fc\u011fe giren Tebligat Kanununun Uygulanmas\u0131na Dair Y\u00f6netmelik&#8217;in (Y\u00f6netmelik) &#8220;T\u00fczel ki\u015filerin memur ve m\u00fcstahdemlerine tebligat&#8221; ba\u015fl\u0131kl\u0131 21. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;(1) T\u00fczel ki\u015filer ad\u0131na tebligat\u0131 almaya yetkili ki\u015filer, herhangi bir sebeple mutat i\u015f saatlerinde i\u015fyerinde bulunmamalar\u0131 veya o s\u0131rada evrak\u0131 bizzat alamayacak bir halde olmalar\u0131 durumunda tebli\u011f, t\u00fczel ki\u015finin o yerdeki s\u00fcrekli \u00e7al\u0131\u015fan memur veya m\u00fcstahdemlerinden birine yap\u0131l\u0131r.<\/p>\n<p> (2) Ancak, kendisine tebli\u011f yap\u0131lacak memur veya m\u00fcstahdemin, t\u00fczel ki\u015finin o yerdeki te\u015fkilat\u0131 veya personeli i\u00e7inde g\u00f6rev itibariyle tebligat\u0131n muhatab\u0131 olan t\u00fczel ki\u015finin temsilcisinden sonra gelen bir kimse veya evrak m\u00fcd\u00fcr\u00fc gibi esasen bu t\u00fcr i\u015flerle g\u00f6revlendirilmi\u015f bir ki\u015fi olmas\u0131 gereklidir.<\/p>\n<p> (3) Bu ki\u015filerin de bulunmamas\u0131 halinde, bu husus tebli\u011f mazbatas\u0131nda belirtilir ve tebli\u011f, o yerdeki di\u011fer bir memur veya m\u00fcstahdeme yap\u0131l\u0131r.&#8221;<\/p>\n<p>37. Y\u00f6netmelik&#8217;in 53. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;(1) Tebli\u011f, usul\u00fcne ayk\u0131r\u0131 yap\u0131lm\u0131\u015f olsa bile, muhatab\u0131 tebli\u011fi \u00f6\u011frenmi\u015f ise ge\u00e7erlidir. Aksi takdirde tebligat yap\u0131lmam\u0131\u015f say\u0131l\u0131r. Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcnde; kamu t\u00fczel ki\u015filerinin bireysel ba\u015fvuru yapamayacaklar\u0131 belirtildikten sonra \u0130\u00e7i\u015fleri Bakanl\u0131\u011f\u0131 Hukuk Hizmetleri Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn 25\/11\/2023 tarihli yaz\u0131s\u0131nda, THK Genel Ba\u015fkanl\u0131\u011f\u0131n\u0131n 5253 say\u0131l\u0131 Kanun&#8217;a tabi \u00f6zel hukuk t\u00fczel ki\u015fisi oldu\u011funun bildirildi\u011fi, bu kapsamda THK Genel Ba\u015fkanl\u0131\u011f\u0131 taraf\u0131ndan yap\u0131lan mevcut ba\u015fvurunun kabul edilebilirli\u011fine dair yap\u0131lacak incelemede ba\u015fvurucunun bireysel ba\u015fvuruda bulunma ehliyeti olup olmad\u0131\u011f\u0131 hususunun dikkate al\u0131nmas\u0131 gerekti\u011fi bildirilmi\u015ftir. Ba\u015fvurucu, Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 THK&#8217;n\u0131n \u00f6zel hukuk h\u00fck\u00fcmlerine tabi olan kamu yarar\u0131na bir dernek oldu\u011funu vurgulam\u0131\u015ft\u0131r. Ba\u015fvurucu kamu t\u00fczel ki\u015filerinin sahip oldu\u011fu kamu g\u00fcc\u00fc ayr\u0131cal\u0131klar\u0131ndan olan tek tarafl\u0131 i\u015flemler yapma, i\u015flemlerin icrai nitelikte olmas\u0131, kamula\u015ft\u0131rma, istimval, devletle\u015ftirme gibi yetkilerinin olmad\u0131\u011f\u0131n\u0131, personelin yar\u0131\u015fma usul\u00fc ile g\u00f6reve al\u0131nmas\u0131 s\u00f6z konusu olmad\u0131\u011f\u0131 gibi mallar\u0131na haciz uygulanabildi\u011fini belirtmi\u015f ve bireysel ba\u015fvuru yapma ehliyeti oldu\u011funu a\u00e7\u0131klam\u0131\u015ft\u0131r.<\/p>\n<p>B. De\u011ferlendirme<\/p>\n<p>42. Anayasa&#8217;n\u0131n iddian\u0131n de\u011ferlendirilmesinde dayanak al\u0131nacak &#8220;M\u00fclkiyet hakk\u0131&#8221; kenar ba\u015fl\u0131kl\u0131 35. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Herkes, m\u00fclkiyet ve miras haklar\u0131na sahiptir.<\/p>\n<p>Bu haklar, ancak kamu yarar\u0131 amac\u0131yla, kanunla s\u0131n\u0131rlanabilir.<\/p>\n<p>M\u00fclkiyet hakk\u0131n\u0131n kullan\u0131lmas\u0131 toplum yarar\u0131na ayk\u0131r\u0131 olamaz.&#8221;<\/p>\n<p>1. Kabul Edilebilirlik Y\u00f6n\u00fcnden<\/p>\n<p>43. 30\/3\/2011 tarihli ve 6216 say\u0131l\u0131 Anayasa Mahkemesinin Kurulu\u015fu ve Yarg\u0131lama Usulleri Hakk\u0131nda Kanun\u2019un 46. maddesinin (2) numaral\u0131 f\u0131kras\u0131n\u0131n birinci c\u00fcmlesi \u015f\u00f6yledir:<\/p>\n<p> \u201c(2) Kamu t\u00fczel ki\u015fileri bireysel ba\u015fvuru yapamaz.\u201d<\/p>\n<p>44. 6216 say\u0131l\u0131 Kanun\u2019un 46. maddesinin (2) numaral\u0131 f\u0131kras\u0131n\u0131n birinci c\u00fcmlesinde kamu t\u00fczel ki\u015filerinin bireysel ba\u015fvuruda bulunamayacaklar\u0131 d\u00fczenlenmi\u015f olup an\u0131lan h\u00fck\u00fcmde, ba\u015fvuruya konu olay\u0131n \u00f6zel hukuk ili\u015fkisinden ya da kamu g\u00fcc\u00fc kullan\u0131lmas\u0131ndan kaynaklanan bir durum olup olmad\u0131\u011f\u0131 ayr\u0131m\u0131 yap\u0131lmam\u0131\u015ft\u0131r (\u0130hsan Do\u011framac\u0131 Bilkent \u00dcniversitesi [1. B.], No: 2013\/1430, 21\/11\/2013, \u00a7 26). Bireysel ba\u015fvuru, kamu g\u00fcc\u00fcn\u00fcn kullan\u0131lmas\u0131ndan kaynaklanan hak ihlallerine kar\u015f\u0131 tan\u0131nan bir yol oldu\u011fundan kamu t\u00fczel ki\u015filerine bireysel ba\u015fvuru hakk\u0131 tan\u0131nmas\u0131 bu anayasal kurumun hukuki niteli\u011fi ile ba\u011fda\u015fmamaktad\u0131r. Kamu t\u00fczel ki\u015filerinin kamu g\u00fcc\u00fc kavram\u0131 kapsam\u0131na girdi\u011fi ve ba\u015fvuru ehliyetlerinin bulunmad\u0131\u011f\u0131, Anayasa Mahkemesi denetiminden ge\u00e7en ve Anayasa\u2019ya ayk\u0131r\u0131 bulunmayan a\u00e7\u0131k kanun h\u00fckm\u00fcyle sabittir.<\/p>\n<p>45. 6216 say\u0131l\u0131 Kanun\u2019un 46. maddesinin (2) numaral\u0131 f\u0131kras\u0131nda yer alan kural\u0131n Anayasa\u2019ya ayk\u0131r\u0131l\u0131\u011f\u0131 daha \u00f6nce Anayasa Mahkemesi taraf\u0131ndan incelemi\u015ftir. Anayasa Mahkemesi, Anayasa&#8217;n\u0131n 148. maddesinde yer alan &#8220;herkes&#8221; ibaresinin kamu g\u00fcc\u00fc kullanan kamu t\u00fczel ki\u015filerini de kapsad\u0131\u011f\u0131 \u015fekilde anla\u015f\u0131lmaya elveri\u015fli olmad\u0131\u011f\u0131n\u0131, bu konuda kanun koyucunun bireysel ba\u015fvuruda bulunma ile ilgili hak sahipleri y\u00f6n\u00fcnden takdir hakk\u0131n\u0131n bulundu\u011funun da kabul\u00fc gerekti\u011fini, bu nedenle 36. maddede yer alan &#8220;herkes&#8221; ibaresi ile 148. maddede yer alan &#8220;herkes&#8221; ibaresinin her iki maddede d\u00fczenlenen hak arama yollar\u0131n\u0131n niteli\u011fine uygun olarak yorumlanmas\u0131 gerekti\u011fine karar vermi\u015ftir (AYM, E.2011\/59, K.2012\/34, 1\/3\/2012 say\u0131l\u0131 karar).<\/p>\n<p>46. Anayasa&#8217;da veya Anayasa&#8217;yla yetkili k\u0131l\u0131nan organlarca \u00e7\u0131kar\u0131lan d\u00fczenlemelerde (kanun\/Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesi) a\u00e7\u0131k\u00e7a kamu t\u00fczel ki\u015fisi olarak nitelenen kurulu\u015flar\u0131n kamu g\u00fcc\u00fcn\u00fcn par\u00e7as\u0131 oldu\u011funda tart\u0131\u015fma yoktur. Bununla birlikte sadece ilgili mevzuatta kamu t\u00fczel ki\u015fisi oldu\u011fu a\u00e7\u0131k\u00e7a belirtilen kurulu\u015flar de\u011fil Anayasa&#8217;da ya da Anayasa&#8217;yla yetkili k\u0131l\u0131nan organlarca \u00e7\u0131kar\u0131lan d\u00fczenlemelerde kamu t\u00fczel ki\u015fisi oldu\u011fu a\u00e7\u0131k\u00e7a belirtilmeyen hatta \u00f6zel hukuk t\u00fczel ki\u015fisi olarak tan\u0131mlanan ancak kamuyla ba\u011flant\u0131l\u0131 bulunan t\u00fczel ki\u015filer de kamu g\u00fcc\u00fcn\u00fcn bir par\u00e7as\u0131 olarak kabul edilmektedir (kamuyla ba\u011flant\u0131l\u0131 \u015firketlerin ba\u015fvuru ehliyeti konusundaki ilkeler y\u00f6n\u00fcnden bkz. Turkcell \u0130leti\u015fim Hizmetleri A.\u015e. (4), \u00a7\u00a7 56-61).<\/p>\n<p>47. Anayasa Mahkemesinin norm denetimi kapsam\u0131nda verdi\u011fi kararlar\u0131nda vurgulad\u0131\u011f\u0131 \u00fczere bir t\u00fczel ki\u015fili\u011fin \u00f6zel hukuk h\u00fck\u00fcmlerine tabi olmas\u0131 tek ba\u015f\u0131na onun kamu g\u00fcc\u00fcn\u00fcn bir par\u00e7as\u0131, dolay\u0131s\u0131yla kamuyla ba\u011flant\u0131l\u0131 olup olmad\u0131\u011f\u0131 noktas\u0131nda belirleyici olmaz (AYM, E.2013\/49, K.2013\/125, 31\/10\/2013; E.2014\/177, K.2015\/49, 11\/6\/2015; ayr\u0131ca bireysel ba\u015fvuru kapsam\u0131nda verilen karar i\u00e7in bkz. Kamu g\u00fcc\u00fcyle donat\u0131lan, dolay\u0131s\u0131yla kamuyla ba\u011flant\u0131l\u0131 \u00f6zel hukuk t\u00fczel ki\u015fileri de kamu g\u00fcc\u00fcn\u00fcn bir par\u00e7as\u0131d\u0131r (Ayd\u0131n \u0130mar Sanayi ve Ticaret Anonim \u015eirketi [GK], B. No: 2018\/10972, 29\/7\/2022, \u00a7 35).<\/p>\n<p>48. Bir t\u00fczel ki\u015fili\u011fin kamuyla ba\u011flant\u0131l\u0131 olup olmad\u0131\u011f\u0131 de\u011ferlendirilirken sadece ilgili kanundaki tan\u0131mlamaya bak\u0131lmamal\u0131; y\u00fcr\u00fctt\u00fc\u011f\u00fc hizmetin niteli\u011fi, kamu g\u00fcc\u00fc ayr\u0131cal\u0131klar\u0131yla donat\u0131l\u0131p donat\u0131lmad\u0131\u011f\u0131 (kamu g\u00fcc\u00fcn\u00fcn kullan\u0131m\u0131na kat\u0131l\u0131p kat\u0131lmad\u0131\u011f\u0131), idari ve fiil\u00ee y\u00f6nden kamu otoritelerinden ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131n derecesi g\u00f6z\u00f6n\u00fcnde bulundurulmal\u0131d\u0131r (Ayd\u0131n \u0130mar Sanayi ve Ticaret Anonim \u015eirketi, \u00a7 36). T\u00fczel ki\u015fili\u011fin y\u00fcr\u00fctt\u00fc\u011f\u00fc hizmetin kamusal y\u00f6n\u00fcn\u00fcn bulunup bulunmad\u0131\u011f\u0131 ve tekel bi\u00e7iminde, rekabete kapal\u0131 olarak icra edilip edilmedi\u011fi \u00f6nemlidir. Ayr\u0131ca t\u00fczel ki\u015fili\u011fin kazan\u00e7 g\u00fctme amac\u0131n\u0131 ta\u015f\u0131y\u0131p ta\u015f\u0131mad\u0131\u011f\u0131 da irdelenecek kriterlerden biridir (Ayd\u0131n \u0130mar Sanayi ve Ticaret Anonim \u015eirketi, \u00a7 37).<\/p>\n<p>49. T\u00fczel ki\u015fili\u011fin kamu g\u00fcc\u00fc ayr\u0131cal\u0131klar\u0131yla donat\u0131l\u0131p donat\u0131lmad\u0131\u011f\u0131 tespit edilirken \u015fu unsurlar dikkate al\u0131n\u0131r: tek yanl\u0131 i\u015flemler yapma yetkisi, resen icra yetkisi, i\u015flemlerinin hukuka uygunluk karinesinden yararlan\u0131p yararlanmad\u0131\u011f\u0131, mallar\u0131n\u0131n stat\u00fcs\u00fc ve haczedilebilirli\u011fi, alacaklar\u0131 i\u00e7in \u00f6zel bir stat\u00fc \u00f6ng\u00f6r\u00fcl\u00fcp \u00f6ng\u00f6r\u00fclmedi\u011fi, personelinin stat\u00fcs\u00fc, zorunlu \u00fcyelik ve zorunlu aidat uygulamas\u0131n\u0131n bulunup bulunmad\u0131\u011f\u0131, i\u015flem ve eylemlerinin kamu hukuku kurallar\u0131 \u00e7er\u00e7evesinde idari yarg\u0131 kolunda denetlenip denetlenmedi\u011fi (Ayd\u0131n \u0130mar Sanayi ve Ticaret Anonim \u015eirketi, \u00a7 38).<\/p>\n<p>50. Kamu g\u00fcc\u00fcn\u00fcn kullan\u0131m\u0131na kat\u0131lmasa bile bir t\u00fczel ki\u015filik kamu otoritelerine ba\u011f\u0131ml\u0131 olarak faaliyetlerini y\u00fcr\u00fct\u00fcyorsa bu takdirde s\u00f6z konusu t\u00fczel ki\u015fili\u011fin kamuyla ba\u011flant\u0131l\u0131 oldu\u011fu sonucuna ula\u015f\u0131labilir. T\u00fczel ki\u015fili\u011fin kamu otoritelerinden yeterli \u00f6l\u00e7\u00fcde ba\u011f\u0131ms\u0131z olup olmad\u0131\u011f\u0131n\u0131n de\u011ferlendirilmesinde dikkate al\u0131nacak kriterlerin t\u00fcketici bir bi\u00e7imde \u00f6nceden belirlenmesi m\u00fcmk\u00fcn olmad\u0131\u011f\u0131ndan her somut olay\u0131n kendi ko\u015fullar\u0131 i\u00e7inde de\u011ferlendirmesi yap\u0131lmal\u0131d\u0131r. Bu ba\u011flamda yap\u0131lacak de\u011ferlendirmede kurulu\u015f senedi veya ana s\u00f6zle\u015fmesinin kamusal i\u015flemlerle onaylan\u0131p onaylanmad\u0131\u011f\u0131, kamusal kararlara dayal\u0131 olarak tasfiyeye tabi olup olmad\u0131\u011f\u0131, faaliyetlerinin finansman\u0131 i\u00e7in b\u00fcy\u00fck \u00f6l\u00e7\u00fcde kamu kaynaklar\u0131n\u0131 kullan\u0131p kullanmad\u0131\u011f\u0131, finansman\u0131n kamu d\u0131\u015f\u0131ndaki akt\u00f6rlerce sa\u011flan\u0131p sa\u011flanmad\u0131\u011f\u0131, faaliyetlerini nas\u0131l y\u00fcr\u00fctece\u011finin kamu makamlar\u0131nca belirlenip belirlenmedi\u011fi, faaliyetlerinde kamu m\u00fclklerini kullan\u0131p kullanmad\u0131\u011f\u0131, mal varl\u0131\u011f\u0131 \u00fczerinde devletin uygun g\u00f6rd\u00fc\u011f\u00fc \u015fekilde tasarrufta bulunup bulunmad\u0131\u011f\u0131, sermayesinin devlete ait olup olmad\u0131\u011f\u0131, y\u00f6netiminde siyasi otoritenin a\u011f\u0131rl\u0131\u011f\u0131n\u0131n bulunup bulunmad\u0131\u011f\u0131, do\u011frudan devlet kurumlar\u0131n\u0131n y\u00f6netimi alt\u0131nda olup olmad\u0131\u011f\u0131 hususlar\u0131 dikkate al\u0131n\u0131r (Ayd\u0131n \u0130mar Sanayi ve Ticaret Anonim \u015eirketi, \u00a7 39).<\/p>\n<p>51. Bu a\u00e7\u0131klamalar \u0131\u015f\u0131\u011f\u0131nda THK, \u00f6zel bir kanunla kurulmu\u015f veya resm\u00ee olarak idare te\u015fkilat\u0131 i\u00e7inde tan\u0131mlanm\u0131\u015f bir t\u00fczel ki\u015filik olmay\u0131p 4721 say\u0131l\u0131 Kanun ve 5253 say\u0131l\u0131 Kanunlar \u00e7er\u00e7evesinde faaliyet y\u00fcr\u00fctmektedir. \u00d6te yandan THK&#8217;n\u0131n mallar\u0131na, alacaklar\u0131na ve personeline di\u011fer derneklerden farkl\u0131 stat\u00fc tan\u0131nmam\u0131\u015f; mallar\u0131na haczedilemezlik ayr\u0131cal\u0131\u011f\u0131 sa\u011flanmam\u0131\u015ft\u0131r. THK, resen icra yetkisi ve i\u015flemlerinin hukuka uygunluk karinesinden yararlanmas\u0131 gibi ayr\u0131cal\u0131klarla da donat\u0131lmam\u0131\u015ft\u0131r.<\/p>\n<p>52. Buna kar\u015f\u0131l\u0131k THK B\u00fcy\u00fck Genel Kurulu ve Genel Y\u00f6netim Kurulunda kamu g\u00f6revlilerinin yer ald\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. Dernek t\u00fcz\u00fc\u011f\u00fcne g\u00f6re B\u00fcy\u00fck Genel Kurulda TBMM ba\u015fkan\u0131, ba\u015fbakan, genelkurmay ba\u015fkan\u0131, kara kuvvetleri komutan\u0131, deniz kuvvetleri komutan\u0131, hava kuvvetleri komutan\u0131, jandarma genel komutan\u0131, Ankara valisi, Ankara b\u00fcy\u00fck\u015fehir belediye ba\u015fkan\u0131 ve THK genel ba\u015fkanl\u0131\u011f\u0131 yapanlar, Ba\u015fbakanl\u0131ktan daire ba\u015fkan\u0131 veya daha \u00fcst d\u00fczeyde bir delege, Savunma Sanayii M\u00fcste\u015farl\u0131\u011f\u0131ndan daire ba\u015fkan\u0131 veya daha \u00fcst d\u00fczeyde bir delege, Hava Kuvvetleri Komutanl\u0131\u011f\u0131 kurmay ba\u015fkan\u0131, Genelkurmay Harek\u00e2t Ba\u015fkanl\u0131\u011f\u0131ndan iki delege, KKK&#8217;l\u0131\u011f\u0131 Havac\u0131l\u0131k Daire Ba\u015fkanl\u0131\u011f\u0131ndan iki general veya \u015fube m\u00fcd\u00fcr\u00fc d\u00fczeyinde delege, Dz.K.K. ve J.Gn.K.l\u0131\u011f\u0131ndan birer delege, Hv.K.K.l\u0131\u011f\u0131ndan muvazzaf veya emekli general ile \u015fube m\u00fcd\u00fcr\u00fc d\u00fczeyinde toplam be\u015f delege, sosyal yard\u0131mla\u015fma ve dayan\u0131\u015fma genel m\u00fcd\u00fcr\u00fc, Diyanet \u0130\u015fleri Ba\u015fkanl\u0131\u011f\u0131ndan, T\u00fcrkiye K\u0131z\u0131lay Derne\u011finden, Sosyal Hizmetler ve \u00c7ocuk Esirgeme Kurumundan birer delege, Mill\u00ee Savunma, \u0130\u00e7i\u015fleri, D\u0131\u015fi\u015fleri, Mill\u00ee E\u011fitim, Tar\u0131m ve K\u00f6yi\u015fleri, K\u00fclt\u00fcr ve Turizm ile \u00c7evre ve Orman Bakanl\u0131klar\u0131ndan daire ba\u015fkan\u0131 veya daha \u00fcst d\u00fczeyde birer delege, TRT, DHM\u0130, Sivil Havac\u0131l\u0131k, Posta ve Telgraf Te\u015fkilat\u0131 ile Gen\u00e7lik ve Spor Genel M\u00fcd\u00fcrl\u00fcklerinden birer delege, mesleki ve teknik y\u00f6nden havac\u0131l\u0131k e\u011fitimi veren \u00fcniversitelerden birer delege, Muhtarlar Federasyonundan bir delege, Ankara\u2019daki her \u00fcniversiteden ve GATA&#8217;dan \u00f6\u011fretim \u00fcyesi olmak kayd\u0131yla birer delege bulunmaktad\u0131r.<\/p>\n<p>53. THK&#8217;n\u0131n y\u00f6netim organlar\u0131n\u0131n kamu g\u00f6revlilerinden olu\u015fmas\u0131 THK&#8217;nin kamu otoritesinden ba\u011f\u0131ms\u0131z bir yap\u0131s\u0131n\u0131n bulunmad\u0131\u011f\u0131n\u0131, dolay\u0131s\u0131yla kamu g\u00fcc\u00fcn\u00fcn bir par\u00e7as\u0131n\u0131 olu\u015fturdu\u011funu d\u00fc\u015f\u00fcnd\u00fcrmeye elveri\u015fli olsa da tek ba\u015f\u0131na bu \u00f6zellikten hareketle THK&#8217;n\u0131n kamuyla ba\u011flant\u0131l\u0131 t\u00fczel ki\u015fi oldu\u011fu sonucuna var\u0131lamaz. THK&#8217;n\u0131n kamu g\u00fcc\u00fc ayr\u0131cal\u0131klar\u0131yla donat\u0131lmam\u0131\u015f olmas\u0131 kar\u015f\u0131s\u0131nda y\u00f6neticilerinin kamu g\u00f6revlisi olmas\u0131 THK&#8217;n\u0131n niteli\u011fini etkileyecek bir a\u011f\u0131rl\u0131\u011fa ula\u015fmamaktad\u0131r. THK&#8217;n\u0131n karar organlar\u0131nda kamu g\u00f6revlilerinin olmas\u0131 THK&#8217;n\u0131n kamu g\u00fcc\u00fc ayr\u0131cal\u0131klar\u0131yla donat\u0131lmas\u0131 h\u00e2linde bir anlam ifade edecektir. Kamu g\u00fcc\u00fc ayr\u0131cal\u0131klar\u0131 bulunmayan THK&#8217;n\u0131n s\u0131rf B\u00fcy\u00fck Genel Kurul ve\/veya Y\u00f6netim Kurulu \u00fcyelerinin kamu g\u00f6revlisi olmas\u0131ndan hareketle kamu g\u00fcc\u00fcn\u00fcn bir par\u00e7as\u0131 oldu\u011fu sonucuna ula\u015f\u0131lamaz. Aksi takdirde kurucu ve y\u00f6neticilerinin kamu g\u00f6revlisi oldu\u011fu t\u00fcm derneklerin kamu g\u00fcc\u00fcn\u00fcn kullan\u0131m\u0131na kat\u0131lan t\u00fczel ki\u015fi oldu\u011funun kabul edilmesi gerekecektir. \u00d6te yandan THK&#8217;n\u0131n y\u00f6netim kurulu \u00fcyelerinin \u00fcst d\u00fczey kamu g\u00f6revlilerden olu\u015fmas\u0131n\u0131n kanuni bir d\u00fczenlemeye de\u011fil dernek t\u00fcz\u00fc\u011f\u00fcne dayand\u0131\u011f\u0131n\u0131n alt\u0131n\u0131 \u00e7izmek gerekir. Bu itibarla kanuna dayal\u0131 zorunlu y\u00f6neticilik uygulamas\u0131n\u0131n bulunmad\u0131\u011f\u0131 not edilmelidir.<\/p>\n<p>54. Bunun yan\u0131nda THK&#8217;n\u0131n mali kaynaklar\u0131n\u0131n kural olarak ba\u011f\u0131\u015flardan, kendi mal ve i\u015fletmelerinin gelirlerinden olu\u015ftu\u011funa da dikkat \u00e7ekmek gerekir. Bu manada THK&#8217;n\u0131n kamuya yararl\u0131 dernek stat\u00fcs\u00fcnde olmas\u0131 sebebiyle baz\u0131 vergisel muafiyetlerden yararland\u0131\u011f\u0131 bir ger\u00e7ektir. Vergi muafiyeti, ba\u011f\u0131\u015f\u0131k tutulan vergi miktar\u0131ndan derne\u011fin kazan\u00e7 sa\u011flamas\u0131 sonucunu do\u011furdu\u011fundan kamuya yararl\u0131 dernek stat\u00fcs\u00fcyle derne\u011fe dolayl\u0131 olarak kamu kayna\u011f\u0131 aktar\u0131ld\u0131\u011f\u0131 s\u00f6ylenebilir. Ancak bu durumun kamuya yararl\u0131 t\u00fcm dernekler i\u00e7in ge\u00e7erli oldu\u011fu unutulmamal\u0131d\u0131r. Dolay\u0131s\u0131yla kamuya yararl\u0131 dernek stat\u00fcs\u00fc de THK&#8217;n\u0131n kamu g\u00fcc\u00fcn\u00fcn bir par\u00e7as\u0131 oldu\u011fu h\u00fckm\u00fcne var\u0131lmas\u0131 i\u00e7in yeterli g\u00f6r\u00fclmemi\u015ftir.<\/p>\n<p>55. Sonu\u00e7 olarak kurucu ve y\u00f6neticilerinin \u00fcst d\u00fczey kamu g\u00f6revlilerden olu\u015fmas\u0131na ve kamu yarar\u0131 ta\u015f\u0131yan faaliyetlerde bulunmas\u0131na kar\u015f\u0131n kamu g\u00fcc\u00fcyle donat\u0131lmad\u0131\u011f\u0131, faaliyetlerinin kanunla kamu hizmeti olarak tan\u0131mlanmad\u0131\u011f\u0131, gelir kaynaklar\u0131n\u0131n b\u00fcy\u00fck \u00f6l\u00e7\u00fcde ba\u011f\u0131\u015flardan olu\u015ftu\u011fu, kamu gelirlerinden do\u011frudan THK&#8217;ya pay aktar\u0131lmad\u0131\u011f\u0131 dikkate al\u0131nd\u0131\u011f\u0131nda THK&#8217;n\u0131n kamu g\u00fcc\u00fcn\u00fcn bir par\u00e7as\u0131 oldu\u011fu sonucuna var\u0131lmas\u0131 m\u00fcmk\u00fcn g\u00f6r\u00fcnmemektedir.<\/p>\n<p>56. Bu a\u00e7\u0131klamalar dikkate al\u0131nd\u0131\u011f\u0131nda THK&#8217;n\u0131n kamu t\u00fczel ki\u015fisi olmamas\u0131, kamu g\u00fcc\u00fc yetkileri kullanmamas\u0131, kamuya ba\u011fl\u0131l\u0131\u011f\u0131 y\u00f6n\u00fcnden \u00f6zel hukuk h\u00fck\u00fcmlerine tabi olmas\u0131 gibi hususlar bir b\u00fct\u00fcn h\u00e2linde dikkate al\u0131nd\u0131\u011f\u0131nda ba\u015fvurucunun ki\u015fi bak\u0131m\u0131ndan ba\u015fvuru yapmaya ehliyeti oldu\u011fu kabul edilmelidir.<\/p>\n<p>57. A\u00e7\u0131k\u00e7a dayanaktan yoksun olmad\u0131\u011f\u0131 ve kabul edilemezli\u011fine karar verilmesini gerektirecek ba\u015fka bir neden de bulunmad\u0131\u011f\u0131 anla\u015f\u0131lan m\u00fclkiyet hakk\u0131n\u0131n ihlal edildi\u011fine ili\u015fkin iddian\u0131n kabul edilebilir oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>2. Esas Y\u00f6n\u00fcnden<\/p>\n<p>a. \u0130ncelemenin Kapsam\u0131 ve Y\u00f6ntemi<\/p>\n<p>58. Kamuyla ba\u011flant\u0131l\u0131 bir t\u00fczel ki\u015filik olarak kabul edilmeyen THK&#8217;n\u0131n akdetti\u011fi kira s\u00f6zle\u015fmesininin \u00f6zel hukuk h\u00fck\u00fcmleri \u00e7er\u00e7evesinde de\u011ferlendirilmesi gereken bir bor\u00e7 ili\u015fkisi oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Dolay\u0131s\u0131yla kira s\u00f6zle\u015fmesi ile ilgili uyu\u015fmazl\u0131\u011f\u0131n iki \u00f6zel hukuk ki\u015fisi aras\u0131nda cereyan eden bir uyu\u015fmazl\u0131k olarak kabul\u00fc gerekir. Bu durumda eldeki ba\u015fvurunun m\u00fclkiyet hakk\u0131n\u0131n devlete y\u00fckledi\u011fi pozitif y\u00fck\u00fcml\u00fcl\u00fckler kapsam\u0131nda incelenmesi zorunludur.<\/p>\n<p>b. M\u00fclk\u00fcn Varl\u0131\u011f\u0131<\/p>\n<p>59. M\u00fclkiyet hakk\u0131n\u0131n ihlal edildi\u011finden \u015fik\u00e2yet eden bir kimse, \u00f6nce b\u00f6yle bir hakk\u0131n\u0131n var oldu\u011funu kan\u0131tlamak zorundad\u0131r. Bu nedenle \u00f6ncelikle ba\u015fvurucunun Anayasa&#8217;n\u0131n 35. maddesi uyar\u0131nca korunmay\u0131 gerektiren m\u00fclkiyete ili\u015fkin bir menfaate sahip olup olmad\u0131\u011f\u0131 noktas\u0131ndaki hukuki durumu de\u011ferlendirilmelidir (Cemile \u00dcnl\u00fc [2. B.], B. No: 2013\/382, 16\/4\/2013, \u00a7 26; \u0130hsan Vurucuo\u011flu [1. B.], B. No: 2013\/539, 16\/5\/2013, \u00a7 31).<\/p>\n<p>60. Somut olayda tahliye davas\u0131na konu olan ta\u015f\u0131nmaz ba\u015fvurucunun m\u00fclkiyetinde oldu\u011fundan m\u00fclk\u00fcn varl\u0131\u011f\u0131 noktas\u0131nda tart\u0131\u015fma bulunmamaktad\u0131r.<\/p>\n<p>c. Genel \u0130lkeler<\/p>\n<p>61. M\u00fclkiyet hakk\u0131n\u0131n korunmas\u0131n\u0131n devlete birtak\u0131m pozitif y\u00fck\u00fcml\u00fcl\u00fckler y\u00fckledi\u011fi hususu Anayasa&#8217;n\u0131n 35. maddesinin lafz\u0131nda a\u00e7\u0131k bir bi\u00e7imde d\u00fczenlenmemi\u015f ise de bu g\u00fcvencenin sadece devlete atfedilebilen m\u00fcdahalelere y\u00f6nelik s\u0131n\u0131rlamalar getirdi\u011fi, bireyi \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin m\u00fcdahalelerine kar\u015f\u0131 korumas\u0131z b\u0131rakt\u0131\u011f\u0131 d\u00fc\u015f\u00fcn\u00fclemez. Pozitif y\u00fck\u00fcml\u00fcl\u00fcklerin ortaya \u00e7\u0131kmas\u0131n\u0131n nedeni ger\u00e7ek anlamda koruma sa\u011flanmas\u0131d\u0131r. Buna g\u00f6re an\u0131lan maddede bir temel hak olarak g\u00fcvence alt\u0131na al\u0131nan m\u00fclkiyet hakk\u0131n\u0131n ger\u00e7ekten ve etkili bir \u015fekilde korunabilmesi yaln\u0131zca devletin m\u00fcdahaleden ka\u00e7\u0131nmas\u0131na ba\u011fl\u0131 de\u011fildir. Ger\u00e7ek anlamda koruma sa\u011flanmas\u0131 i\u00e7in devletin negatif y\u00fck\u00fcml\u00fcl\u00fckleri d\u0131\u015f\u0131nda pozitif y\u00fck\u00fcml\u00fcl\u00fckleri de olmal\u0131d\u0131r. Dolay\u0131s\u0131yla Anayasa&#8217;n\u0131n 5. ve 35. maddeleri uyar\u0131nca devletin m\u00fclkiyet hakk\u0131n\u0131n korunmas\u0131na ili\u015fkin pozitif y\u00fck\u00fcml\u00fcl\u00fckleri bulunmaktad\u0131r. Bu ba\u011flamda s\u00f6z konusu pozitif y\u00fck\u00fcml\u00fcl\u00fckler, kimi durumlarda \u00f6zel ki\u015filer aras\u0131ndaki uyu\u015fmazl\u0131klar da d\u00e2hil olmak \u00fczere m\u00fclkiyet hakk\u0131n\u0131n korunmas\u0131 i\u00e7in belirli tedbirlerin al\u0131nmas\u0131n\u0131 gerektirmektedir (T\u00fcrkiye Emekliler Derne\u011fi [1. B.], B. No: 2012\/1035, 17\/7\/2014, \u00a7\u00a7 34-38; Eyy\u00fcp Boynukara[1. B.], B. No: 2013\/7842, 17\/2\/2016, \u00a7\u00a7 39-41; Osmano\u011flu \u0130n\u015faat E\u011fitim G\u0131da Temizlik Hizmetleri Petrol \u00dcr\u00fcnleri Sanayi Ticaret Limitet \u015eirketi [2. B.], B. No: 2014\/8649, 15\/2\/2017, \u00a7 43).<\/p>\n<p>62. Devletin pozitif y\u00fck\u00fcml\u00fcl\u00fckleri, m\u00fclkiyet hakk\u0131na yap\u0131lan m\u00fcdahalelere kar\u015f\u0131 usule ili\u015fkin g\u00fcvenceleri sunan yarg\u0131sal yollar\u0131 da i\u00e7eren etkili hukuksal bir \u00e7er\u00e7eve olu\u015fturma, olu\u015fturulan bu hukuksal \u00e7er\u00e7eve kapsam\u0131nda yarg\u0131sal ve idari makamlar\u0131n bireylerin \u00f6zel ki\u015filerle olan uyu\u015fmazl\u0131klar\u0131nda etkili ve adil bir karar vermesini temin etme sorumluluklar\u0131n\u0131 da i\u00e7ermektedir (Selahattin Turan [1. B.], B. No: 2014\/11410, 22\/6\/2017, \u00a7 41).<\/p>\n<p>63. \u00d6zel ki\u015filer aras\u0131ndaki uyu\u015fmazl\u0131klarda taraflar\u0131n birbirleriyle \u00e7at\u0131\u015fan menfaatleri bulunmaktad\u0131r. Dolay\u0131s\u0131yla taraflar\u0131n kar\u015f\u0131 kar\u015f\u0131ya gelen menfaatleri \u00e7er\u00e7evesinde m\u00fclkiyet hakk\u0131n\u0131 korumakla y\u00fck\u00fcml\u00fc bulunan devletin maddi ve usule ili\u015fkin pozitif y\u00fck\u00fcml\u00fcl\u00fcklerini yerine getirip getirmedi\u011fi dikkate al\u0131narak sonuca var\u0131lmal\u0131d\u0131r. Bu ba\u011flamda ilk olarak belirli, ula\u015f\u0131labilir ve \u00f6ng\u00f6r\u00fclebilir bir kanun h\u00fckm\u00fcn\u00fcn mevcut olup olmad\u0131\u011f\u0131 irdelenmelidir (H\u00fcseyin Ak [1. B.], B. No: 2016\/77854, 1\/7\/2020, \u00a7 53).<\/p>\n<p>64. \u0130kinci olarak ba\u015fvuruculara m\u00fclkiyet hakk\u0131na yap\u0131lan m\u00fcdahaleye etkin bir bi\u00e7imde itiraz edebilme, savunma ve iddialar\u0131n\u0131 yetkili makamlar \u00f6n\u00fcnde ortaya koyabilme olana\u011f\u0131n\u0131n tan\u0131n\u0131p tan\u0131nmad\u0131\u011f\u0131 incelenmelidir. Anayasa&#8217;n\u0131n 35. maddesi usule ili\u015fkin a\u00e7\u0131k bir g\u00fcvenceden s\u00f6z etmemektedir. Bununla birlikte m\u00fclkiyet hakk\u0131n\u0131n ger\u00e7ek anlamda korunabilmesi bak\u0131m\u0131ndan bu madde, Anayasa Mahkemesinin \u00e7e\u015fitli kararlar\u0131nda da ifade edildi\u011fi \u00fczere m\u00fclk sahibine m\u00fcdahalenin kanun d\u0131\u015f\u0131 veya keyf\u00ee ya da makul olmayan \u015fekilde uyguland\u0131\u011f\u0131na ili\u015fkin savunma ve itirazlar\u0131n\u0131 sorumlu makamlar \u00f6n\u00fcnde etkin bir bi\u00e7imde ortaya koyabilme olana\u011f\u0131n\u0131n tan\u0131nmas\u0131 g\u00fcvencesini kapsamaktad\u0131r. Bu de\u011ferlendirme ise uygulanan s\u00fcrecin b\u00fct\u00fcn\u00fcne bak\u0131larak yap\u0131lmal\u0131d\u0131r (Z\u00fcliye \u00d6zt\u00fcrk [1. B.], B. No: 2014\/1734, 14\/9\/2017, \u00a7 36; Bekir Yaz\u0131c\u0131 [GK], B. No: 2013\/3044, 17\/12\/2015, \u00a7 71).<\/p>\n<p>65. M\u00fclkiyet hakk\u0131n\u0131n usule ili\u015fkin g\u00fcvenceleri hem \u00f6zel ki\u015filer aras\u0131ndaki m\u00fclkiyet uyu\u015fmazl\u0131klar\u0131nda hem de taraflardan birinin kamu g\u00fcc\u00fc oldu\u011fu durumlarda ge\u00e7erlidir. Bu ba\u011flamda m\u00fclkiyet hakk\u0131n\u0131n korunmas\u0131n\u0131n s\u00f6z konusu oldu\u011fu durumlarda usule ili\u015fkin g\u00fcvencelerin somut olayda yerine getirildi\u011finden s\u00f6z edilebilmesi i\u00e7in derece mahkemelerinin kararlar\u0131nda konu ile ilgili ve yeterli gerek\u00e7e bulunmal\u0131d\u0131r. Ayr\u0131ca belirtmek gerekir ki bu zorunluluk davac\u0131n\u0131n b\u00fct\u00fcn iddialar\u0131na cevap verilmesi anlam\u0131na gelmemekle birlikte m\u00fclkiyet hakk\u0131n\u0131 ilgilendiren davan\u0131n sonucuna etkili, esasa ili\u015fkin temel iddia ve itirazlar\u0131n yarg\u0131lama makamlar\u0131nca \u00f6zenli bir \u015fekilde de\u011ferlendirilerek kar\u015f\u0131lanmas\u0131 gerekir (Kamil Darbaz ve GMO Yap\u0131 Grup End. San. Tic. Ltd. \u015eti. [2. B.], B. No: 2015\/12563, 24\/5\/2018, \u00a7 52).<\/p>\n<p>66. Son olarak ise ba\u015fvurucunun m\u00fclkiyet hakk\u0131n\u0131 koruyacak ve yeterli g\u00fcvenceler sa\u011flayacak hukuksal mekanizmalar\u0131n olu\u015fturulup olu\u015fturulmad\u0131\u011f\u0131 incelenmelidir. \u00d6zel ki\u015filerin m\u00fclkiyet haklar\u0131n\u0131n \u00e7at\u0131\u015ft\u0131\u011f\u0131 bu gibi durumlarda bunlardan hangisine \u00fcst\u00fcnl\u00fck tan\u0131naca\u011f\u0131n\u0131n takdiri, kanun koyucuya ve somut olay\u0131n ko\u015fullar\u0131 g\u00f6z\u00f6n\u00fcnde bulundurularak derece mahkemelerine ait bir yetkidir. Bununla birlikte her iki taraf\u0131n menfaatlerinin m\u00fcmk\u00fcn oldu\u011funca dengelenmesi ve s\u00fcrecin taraflardan biri aleyhine \u00f6l\u00e7\u00fcs\u00fcz bir sonuca yol a\u00e7mamas\u0131 gerekir. Menfaatler dengesinin kurulmas\u0131nda taraflardan biri aleyhine bireysel olarak a\u015f\u0131r\u0131 ve ola\u011fan d\u0131\u015f\u0131 bir k\u00fclfetin y\u00fcklenmesi pozitif y\u00fck\u00fcml\u00fcl\u00fcklerin ihlali sonucunu do\u011furabilir. Olay\u0131n b\u00fct\u00fcn ko\u015fullar\u0131 ve taraflara tan\u0131nan t\u00fcm imk\u00e2nlar ile taraflar\u0131n tutum ve davran\u0131\u015flar\u0131 g\u00f6z\u00f6n\u00fcnde bulundurularak menfaatlerin adil bir \u015fekilde dengelenip dengelenmedi\u011fi de\u011ferlendirilmelidir (Faik Tari ve Sultan Tari, [2. B.], B. No: 2014\/12321, 20\/7\/2017, \u00a7 52).<\/p>\n<p>d. \u0130lkelerin Olaya Uygulanmas\u0131<\/p>\n<p>67. Olayda ba\u015fvurucu, \u00f6denmeyen kira bedellerinin tahsili iletemerr\u00fct nedeniyle tahliyeye karar verilmesi istemiyle dava a\u00e7m\u0131\u015ft\u0131r. Yarg\u0131laman\u0131n sonucunda dava tahliye istemi y\u00f6n\u00fcnden ihtarnamelerin kirac\u0131ya usul\u00fcne uygun bi\u00e7imde tebli\u011f edilmedi\u011finden esastan reddedilmi\u015ftir. \u0130stinaf Mahkemesi kirac\u0131n\u0131n usul\u00fcne uygun tebli\u011f edilmeyen ihtarlardan haricen haberdar oldu\u011funun kabul edilemeyece\u011fini de belirtmi\u015ftir.<\/p>\n<p>68. Pozitif y\u00fck\u00fcml\u00fcl\u00fckler y\u00f6n\u00fcnden yap\u0131lacak incelemede \u00f6ncelikle iddia ve savunmalar\u0131n\u0131 etkin bir bi\u00e7imde ortaya koyabilme olana\u011f\u0131n\u0131n ba\u015fvurucuya tan\u0131n\u0131p tan\u0131nmad\u0131\u011f\u0131 de\u011ferlendirilmelidir. Bu ba\u011flamda ba\u015fvurucunun iddia ve itirazlar\u0131n\u0131 ilk derece mahkemesi, \u0130stinaf Mahkemesi ve Yarg\u0131tay \u00f6n\u00fcnde ileri s\u00fcrme hususunda hi\u00e7bir engelle kar\u015f\u0131la\u015fmad\u0131\u011f\u0131, kendisini avukatla temsil ettirebildi\u011fi g\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>69. Somut olayda ba\u015fvurucu, ihtarnamelerin usul\u00fcne uygun bi\u00e7imde tebli\u011f edildi\u011fini iddia ederek tebligata ili\u015fkin kurallar\u0131n\u0131n somut olaya hatal\u0131 uyguland\u0131\u011f\u0131ndan yak\u0131nm\u0131\u015ft\u0131r. Ba\u015fvurucuya g\u00f6re \u0130stinaf Mahkemesi ve Daire karar\u0131nda ihtarnamelerin neden usuls\u00fcz oldu\u011funa ili\u015fkin yeterli bir a\u00e7\u0131klama ve gerek\u00e7e bulunmamaktad\u0131r.<\/p>\n<p>70. Anayasa Mahkemesinin bireysel ba\u015fvuru kapsam\u0131nda tebligat hukukuna ili\u015fkin olay ve olgular\u0131 de\u011ferlendirme g\u00f6revi yoktur. Bu a\u015famada belirtmek gerekir ki delillerin de\u011ferlendirilmesi ve hukuk kurallar\u0131n\u0131n yorumlanmas\u0131 yetkisi kural olarak -keyf\u00ee olmad\u0131\u011f\u0131 veya a\u00e7\u0131k ve bariz bir takdir hatas\u0131 i\u00e7ermedi\u011fi s\u00fcrece- mahkemelere aittir. Ancak ba\u015fvurucu, 6\/3\/2020 tarihli temyiz dilek\u00e7esinde ihtarnamelerin usul\u00fcne uygun \u015fekilde \u015firket evrak memuruna tebli\u011f edildi\u011fini, bunun ka\u015feli ve m\u00fch\u00fcrl\u00fc bi\u00e7imde tevsik edildi\u011fini a\u00e7\u0131klam\u0131\u015f; tebligat\u0131n usuls\u00fcz oldu\u011funa y\u00f6nelik \u0130stinaf Mahkemesi ve Daire kararlar\u0131nda yeterli a\u00e7\u0131klama ve gerek\u00e7e olmad\u0131\u011f\u0131ndan yak\u0131nm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla ba\u015fvurucunun bu iddias\u0131 nedeniyle m\u00fclkiyet hakk\u0131n\u0131n korunmas\u0131na y\u00f6nelik usule ili\u015fkin g\u00fcvencelerin somut olayda yerine getirilip getirilmedi\u011fi de\u011ferlendirilerek bir sonuca var\u0131lmal\u0131d\u0131r. M\u00fclkiyet hakk\u0131n\u0131n korunmas\u0131n\u0131n s\u00f6z konusu oldu\u011fu durumlarda usule ili\u015fkin g\u00fcvencelerin somut olayda yerine getirildi\u011finden s\u00f6z edilebilmesi i\u00e7in mahkeme kararlar\u0131nda konu ile ilgili ve yeterli gerek\u00e7e bulunmas\u0131 zorunludur.<\/p>\n<p>71. 7201 say\u0131l\u0131 Kanun ve Y\u00f6netmelik&#8217;in amac\u0131 tebligat\u0131n muhatab\u0131na en k\u0131sa zamanda ula\u015fmas\u0131, muhataplar\u0131n bilgilendirilmesi (tebligat\u0131n bilgilendirme fonksiyonu) ve bu hususlar\u0131n belgeye (tebligat\u0131n belgelendirme fonksiyonu) ba\u011flanmas\u0131d\u0131r. Bu kapsamda tebligat i\u015flemi bilgilendirme yan\u0131nda belgelendirme \u00f6zelli\u011fi de bulunan bir usul i\u015flemi olup gerek tebli\u011f i\u015flemi ve gerekse tebli\u011f tarihi ancak 7201 say\u0131l\u0131 Kanun ve Y\u00f6netmelik&#8217;te emredilen \u015fekillerle tevsik ve dolay\u0131s\u0131yla ispat olunabilir. 7201 say\u0131l\u0131 Kanun&#8217;un ve Y\u00f6netmeli\u011fin belirledi\u011fi \u015fekilde yap\u0131lmam\u0131\u015f ve belgelendirilmemi\u015f olan tebligatlar\u0131n ge\u00e7erli olmayaca\u011f\u0131 yerle\u015fik yarg\u0131sal i\u00e7tihatlarda da a\u00e7\u0131k\u00e7a vurgulanm\u0131\u015ft\u0131r. (bkz. Hukuk Genel Kurulu, 4\/11\/2024, E.2023\/6384, K.2024\/5924; Yarg\u0131tay 12. Hukuk Dairesi, 5\/11\/2024, E.2024\/4152, K.2024\/9242).<\/p>\n<p>72. 7201 say\u0131l\u0131 Kanun&#8217;un 13. maddesi ile Y\u00f6netmelik&#8217;in 21. maddesi gere\u011fince t\u00fczel ki\u015filer ad\u0131na tebligat\u0131 almaya yetkili ki\u015filer, herhangi bir sebeple mutat i\u015f saatlerinde i\u015fyerinde bulunmamalar\u0131 veya o s\u0131rada evrak\u0131 bizzat alamayacak bir h\u00e2lde olmalar\u0131 durumunda tebli\u011f, t\u00fczel ki\u015finin o yerdeki s\u00fcrekli \u00e7al\u0131\u015fan memur veya m\u00fcstahdemlerinden birine yap\u0131l\u0131r. Ancak, kendisine tebli\u011f yap\u0131lacak memur veya m\u00fcstahdemin, t\u00fczel ki\u015finin o yerdeki te\u015fkilat\u0131 veya personeli i\u00e7inde g\u00f6rev itibar\u0131yla tebligat\u0131n muhatab\u0131 olan t\u00fczel ki\u015finin temsilcisinden sonra gelen bir kimse veya evrak m\u00fcd\u00fcr\u00fc gibi esasen bu t\u00fcr i\u015flerle g\u00f6revlendirilmi\u015f bir ki\u015fi olmas\u0131 gereklidir. Bu ki\u015filerin de bulunmamas\u0131 halinde, bu husus tebli\u011f mazbatas\u0131nda belirtilir ve tebli\u011f, o yerdeki di\u011fer bir memur veya m\u00fcstahdeme yap\u0131l\u0131r Yarg\u0131tay&#8217;\u0131n yerle\u015fik i\u00e7tihad\u0131 da bu y\u00f6ndedir (bkz. Yarg\u0131tay 10. Hukuk Dairesi, E.2024\/12054, K.2024\/13699; Yarg\u0131tay 10. Hukuk Dairesi, E.2024\/4642, K.2024\/10314; Yarg\u0131tay 12. Hukuk Dairesi, E.2024\/6651, K.2024\/8915).<\/p>\n<p>73. Bunun yan\u0131nda 7201 say\u0131l\u0131 Kanun&#8217;un 32. maddesinde tebligat\u0131n usul\u00fcne ayk\u0131r\u0131 yap\u0131lmas\u0131 h\u00e2linde muhatap tebli\u011fe muttali olmu\u015f ise tebligat\u0131n ge\u00e7erli say\u0131laca\u011f\u0131, muhatab\u0131n beyan etti\u011fi tarihin tebli\u011f tarihi olarak kabul edilece\u011fi hususu d\u00fczenlenmi\u015ftir. Yine Y\u00f6netmelik&#8217;in 53. maddesinde tebli\u011f usul\u00fcne ayk\u0131r\u0131 yap\u0131lm\u0131\u015f olsa bile muhatab\u0131n tebli\u011fi \u00f6\u011frenmesi h\u00e2linde ge\u00e7erli olaca\u011f\u0131, aksi takdirde tebligat\u0131n yap\u0131lmam\u0131\u015f say\u0131laca\u011f\u0131, muhatab\u0131n her ne \u015fekilde olursa olsun tebli\u011f evrak\u0131n\u0131 veya davetiyeyi almas\u0131 ya da bunlar\u0131n i\u00e7eri\u011fini \u00f6\u011frenmesi h\u00e2linde tebli\u011fi \u00f6\u011frenmi\u015f say\u0131laca\u011f\u0131, muhatab\u0131n tebli\u011fi \u00f6\u011frendi\u011fini beyan etti\u011fi tarihin tebli\u011f tarihi olarak kabul edilece\u011fi, tebli\u011fin usul\u00fcne ayk\u0131r\u0131 yap\u0131lmas\u0131 h\u00e2linde muhatab\u0131n tebli\u011fi \u00f6\u011frendi\u011finin ve bunun tarihinin iddia ve ispat\u0131n\u0131n m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 belirtilmi\u015ftir.<\/p>\n<p>74. Somut olayda Ankara 54. Noterli\u011fi&#8217;nce tebli\u011fe \u00e7\u0131kar\u0131lan 30\/11\/2017 ve 6\/12\/2017 tarihli ihtarnamelerin tebli\u011f mazbatalar\u0131 incelendi\u011finde ihtarnamelerin \u015firketin daim\u00ee \u00e7al\u0131\u015fan\u0131\/\u015firket evrak memuruna &#8220;Tebli\u011f edildi.&#8221; ka\u015fesiyle, G.B. taraf\u0131ndan imza kar\u015f\u0131l\u0131\u011f\u0131 al\u0131nd\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. Sulh Hukuk Mahkemesi yap\u0131lan tebligatlar\u0131n usul\u00fcne uygun oldu\u011funa karar vermi\u015fken \u0130stinaf Mahkemesi tebligatlar\u0131n usuls\u00fcz oldu\u011funa karar vermi\u015ftir (bkz. \u00a7 24). H\u00fckm\u00fcn onanmas\u0131na ili\u015fkin Yarg\u0131tay karar\u0131nda da \u0130stinaf Mahkemesi karar\u0131na at\u0131f yap\u0131lmakla yetinilmi\u015ftir. Buna kar\u015f\u0131l\u0131k \u0130stinaf Mahkemesi ve Daire kararlar\u0131nda tebligat\u0131n hangi y\u00f6nden usuls\u00fcz oldu\u011fu konusunda herhangi bir gerek\u00e7e ortaya konulmam\u0131\u015ft\u0131r. Bu itibarla gerek \u0130stinaf Mahkemesi gerekse Daire karar\u0131nda ba\u015fvurucunun davas\u0131n\u0131n sonucuna etkili olabilecek mahiyetteki iddia ve itirazlar\u0131na cevap verecek nitelikte yeterli bir gerek\u00e7e i\u00e7ermedi\u011fi tespit edilmi\u015ftir. Bu sebeple m\u00fclkiyet hakk\u0131n\u0131n korunmas\u0131na ili\u015fkin usule ili\u015fkin g\u00fcvencelerin somut olayda yerine getirilmedi\u011fi sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>75. A\u00e7\u0131klanan gerek\u00e7elerle Anayasa&#8217;n\u0131n 35. maddesinde g\u00fcvence alt\u0131na al\u0131nan m\u00fclkiyet hakk\u0131n\u0131n ihlal edildi\u011fine karar verilmesi gerekir.<\/p>\n<p>VI. G\u0130DER\u0130M<\/p>\n<p>76. Ba\u015fvurucu, yeniden yarg\u0131lama isteminde bulunmu\u015ftur.<\/p>\n<p>77. Ba\u015fvuruda tespit edilen hak ihlalinin sonu\u00e7lar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131 i\u00e7in yeniden yarg\u0131lama yap\u0131lmas\u0131nda hukuki yarar bulunmaktad\u0131r.
