Se\u00e7im Usul\u00fc<\/p>\n<p>Hakimler ve Savc\u0131lar Kurulu\u2019nun ka\u00e7 \u00fcyeden olu\u015faca\u011f\u0131, ka\u00e7 daire halinde \u00e7al\u0131\u015faca\u011f\u0131 ve \u00fcyelerinin nas\u0131l se\u00e7ilece\u011fi Anayasa m.159\u2019da ve 6087 say\u0131l\u0131 Hakimler ve Savc\u0131lar Kanunu\u2019nda d\u00fczenlenmi\u015ftir. 6087 say\u0131l\u0131 Kanunun 18 ila 20. maddelerinde, HSK \u00fcyelerinin se\u00e7imi usul\u00fcn\u00fcn d\u00fczenlendi\u011fi g\u00f6r\u00fclmektedir.<\/p>\n<p>HSK\u2019n\u0131n toplam 13 \u00fcyeden olu\u015fup, bunlardan Adalet Bakan\u0131n\u0131n Kurulun ba\u015fkan\u0131 oldu\u011fu, her ne kadar Anayasa m.159\/3\u2019\u00fcn ikinci c\u00fcmlesinde Adalet Bakanl\u0131\u011f\u0131 M\u00fcste\u015far\u0131n\u0131n Kurulun tabii \u00fcyesi oldu\u011fu s\u00f6ylense de, Anayasada olan bu s\u0131fat\u0131n kullan\u0131lmad\u0131\u011f\u0131, bunun yerine Adalet Bakan\u0131 yard\u0131mc\u0131lar\u0131ndan birisinin Kurulda \u00fcyelik yapt\u0131\u011f\u0131, Kurulun toplam 6 \u00fcyesinin T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi taraf\u0131ndan se\u00e7ilece\u011fi ve 4 \u00fcyesinin de Cumhurba\u015fkan\u0131 taraf\u0131ndan se\u00e7ilip atanaca\u011f\u0131 \u00f6ng\u00f6r\u00fclmektedir.<\/p>\n<p>TBMM taraf\u0131ndan se\u00e7ilen HSK \u00fcyelerinde ikili bir y\u00f6ntemin izlendi\u011fi, \u00f6nce aday olma ehliyetine sahip olan aday adaylar\u0131n\u0131n Meclis Ba\u015fkanl\u0131\u011f\u0131na ba\u015fvurdu\u011fu, adaylar\u0131n belirlenmesinde Anayasa ve Adalet Komisyonlar\u0131 \u00dcyelerinden Kurulu Karma Komisyonun adaylar\u0131 belirleme yetkisine sahip oldu\u011fu, Karma Komisyonun toplam 54 milletvekilinden olu\u015ftu\u011fu,<\/p>\n<p>Yarg\u0131tay\u2019dan, Dan\u0131\u015ftay\u2019dan, y\u00fcksek\u00f6\u011fretim kurumlar\u0131n\u0131n hukuk dallar\u0131nda g\u00f6rev yapan \u00f6\u011fretim \u00fcyeleri ile avukatlardan aday adayl\u0131\u011f\u0131 i\u00e7in ba\u015fvuranlar\u0131n, TBMM Genel Kurulunda yap\u0131lacak oylamaya aday olabilmeleri i\u00e7in, Karma Komisyonun \u00f6nce \u00fc\u00e7te iki, bu \u00e7o\u011funluk sa\u011flanamad\u0131\u011f\u0131 takdirde be\u015fte \u00fc\u00e7 \u00e7o\u011funlu\u011funu sa\u011flayan her bir \u00fcyelik i\u00e7in \u00fc\u00e7 aday\u0131n belirlenmesi gerekti\u011fi,<\/p>\n<p>Karma Komisyonda yap\u0131lan iki turlu se\u00e7imde yeterli \u00e7o\u011funluk sa\u011flanamad\u0131\u011f\u0131 takdirde, her bir \u00fcyelik i\u00e7in en \u00e7ok oyu alan iki aday aras\u0131nda ad \u00e7ekme usul\u00fc ile aday belirleme i\u015fleminin tamamlanaca\u011f\u0131n\u0131n belirtildi\u011fi, ancak Meclisin yapaca\u011f\u0131 aday ve \u00fcye belirleme se\u00e7imlerinde \u00fc\u00e7\u00fcnc\u00fc tur se\u00e7imin \u00f6ng\u00f6r\u00fclmedi\u011fi, hem Anayasa m.159\/3 ve hem de konuyu d\u00fczenleyen Anayasa h\u00fckm\u00fc ile uyumlu 6087 say\u0131l\u0131 Kanunun 20. maddesinin 3. ve 4. f\u0131kralar\u0131 incelendi\u011finde, Karma Komisyon ile Meclis taraf\u0131ndan HSK \u00fcyeli\u011fi i\u00e7in yap\u0131lacak se\u00e7imlerde \u00fc\u00e7\u00fcnc\u00fc tur se\u00e7im yap\u0131laca\u011f\u0131na dair bir h\u00fck\u00fcm olmad\u0131\u011f\u0131, bunun yerine ad \u00e7ekme usul\u00fc ile aday belirleme ve \u00fcye se\u00e7imi prosed\u00fcr\u00fcn\u00fcn tamamlanaca\u011f\u0131n\u0131n ifade edildi\u011fi,<\/p>\n<p>Ancak Meclis Genel Kurulu taraf\u0131ndan ikinci oylamada \u00fcye se\u00e7ilemedi\u011fi takdirde en \u00e7ok ay\u0131 olan iki aday aras\u0131nda ad \u00e7ekme usul\u00fc ile \u00fcye se\u00e7iminin tamamlanaca\u011f\u0131na dair h\u00fck\u00fcmde bir sorun olmasa bile, benzer h\u00fckm\u00fcn yer ald\u0131\u011f\u0131 Karma Komisyonda ad \u00e7ekme usul\u00fc ile aday belirlemede sorun oldu\u011fu, bir b\u00fct\u00fcnde aday belirleme ve \u00fcye se\u00e7iminde emredici nitelikte ne fazla iki nitelikli oya ba\u011fl\u0131 se\u00e7im usul\u00fcn\u00fcn benimsendi\u011finde ve ikinci se\u00e7imde aday veya \u00fcye belirlenemedi\u011finde ad \u00e7ekme usul\u00fcne ba\u011fl\u0131 aday belirleme veya \u00fcye se\u00e7imi yap\u0131laca\u011f\u0131nda tart\u0131\u015fman\u0131n bulunmad\u0131\u011f\u0131,<\/p>\n<p>Bu nedenle; Karma Komisyonda veya Meclis Genel Kurulunda \u00fc\u00e7\u00fcnc\u00fc tur se\u00e7imin yap\u0131lamayaca\u011f\u0131, hem aday belirlemede ve hem de \u00fcye se\u00e7iminde \u00fc\u00e7\u00fcnc\u00fc tur se\u00e7ime gidilmesinin Anayasa m.159\/3\u2019\u00fcn a\u00e7\u0131k h\u00fckm\u00fcne ayk\u0131r\u0131 olaca\u011f\u0131, bu h\u00fckme benzer y\u00f6nde bir h\u00fckme 6087 say\u0131l\u0131 Hakimler ve Savc\u0131lar Kurulu Kanunu m.20\/3-4\u2019de de yer verildi\u011finden, her iki a\u015famada gidilecek \u00fc\u00e7\u00fcnc\u00fc turun a\u00e7\u0131k yasal d\u00fczenlemeye de ayk\u0131r\u0131 olaca\u011f\u0131, Karma Komisyonun de\u011fil, sadece Meclisin \u00fcye se\u00e7imine ili\u015fkin olarak bu Kanunda h\u00fck\u00fcm bulunmayan hallerde TBMM \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc h\u00fck\u00fcmlerinin uygulanaca\u011f\u0131na dair bir h\u00fckme 6087 say\u0131l\u0131 Kanun m.20\/5\u2019de yer verildi\u011fi, HSK\u2019ya aday belirleme ve \u00fcye se\u00e7iminin Anayasada ve ilgili Kanunda \u00f6ng\u00f6r\u00fclen h\u00fck\u00fcmlerinin bu \u015fekilde oldu\u011fu,<\/p>\n<p>Bununla birlikte; Karma Komisyonun iki turlu se\u00e7imde aday belirleyemedi\u011fi durumda \u00fc\u00e7\u00fcnc\u00fc tur se\u00e7ime izin verilmedi\u011fi, fakat 6087 say\u0131l\u0131 Kanun m.20\/3\u2019de yer alan \u201cKarma Komisyon, ba\u015fvuru \u015fartlar\u0131n\u0131 ta\u015f\u0131yan adaylar aras\u0131ndan her bir \u00fcyelik i\u00e7in \u00fc\u00e7 aday\u0131, \u00fcye tam say\u0131s\u0131n\u0131n \u00fc\u00e7te iki \u00e7o\u011funlu\u011fuyla belirler. Birinci oylamada bu \u00e7o\u011funlukla aday belirlenemedi\u011fi takdirde ikinci oylamaya ge\u00e7ilir. \u0130kinci oylamada \u00fcye tamsay\u0131s\u0131n\u0131n be\u015fte \u00fc\u00e7 \u00e7o\u011funlu\u011fu aran\u0131r. Bu oylamada da yeterli \u00e7o\u011funlukla aday belirlenemedi\u011fi takdirde, her bir \u00fcyelik i\u00e7in en \u00e7ok oyu alan iki aday aras\u0131nda ad \u00e7ekme usul\u00fcyle aday belirleme i\u015flemi tamamlan\u0131r. Karma Komisyon, her bir \u00fcyelik i\u00e7in belirledi\u011fi \u00fc\u00e7 aday\u0131 Meclis Genel Kuruluna sunulmak \u00fczere Meclis Ba\u015fkanl\u0131\u011f\u0131na bildirir.\u201d h\u00fckm\u00fcnde bir hata bulundu\u011fu, bu hatan\u0131n esasen Anayasa m.159\/3\u2019de yer alan Karma Komisyonun aday belirleme i\u00e7in \u00f6ng\u00f6rd\u00fc\u011f\u00fc h\u00fckm\u00fcn aynen 6087 say\u0131l\u0131 Kanun m.20\/3\u2019e al\u0131nmas\u0131ndan kaynakland\u0131\u011f\u0131,<\/p>\n<p>Buna g\u00f6re; Karma Komisyon olarak her bir \u00fcyelik i\u00e7in \u00fc\u00e7 aday belirleyip, bunu Meclis Genel Kuruluna sunmak \u00fczere Meclis Ba\u015fkanl\u0131\u011f\u0131na bildirmesi gerekirken, hem Anayasa m.159\/3\u2019de ve 6087 say\u0131l\u0131 Kanun m.20\/3\u2019de bulunan \u201cBu oylamada da yeterli \u00e7o\u011funlukla aday belirlenemedi\u011fi takdirde, her bir \u00fcyelik i\u00e7in en \u00e7ok oyu alan iki aday aras\u0131nda ad \u00e7ekme usul\u00fcyle aday belirleme i\u015flemi tamamlan\u0131r.\u201d h\u00fckm\u00fcnden hareketle, nas\u0131l olup da Karma Komisyonun bu ad \u00e7ekme usul\u00fc, yani kura ile \u00fc\u00e7 aday belirleyip bunu Meclis Ba\u015fkanl\u0131\u011f\u0131na bildirece\u011finin anla\u015f\u0131lamad\u0131\u011f\u0131, Meclis Genel Kurulunda yap\u0131lacak kura bak\u0131m\u0131ndan sorun olmasa da, bu konuda Karma Komisyonda sorun oldu\u011fu, bu sorunun Anayasa ve ilgili Kanun h\u00fck\u00fcmlerinden kaynakland\u0131\u011f\u0131, bunu a\u015fman\u0131n yolunun Karma Komisyonda \u00fc\u00e7\u00fcnc\u00fc tur se\u00e7ime gitmek olamayaca\u011f\u0131, bir an i\u00e7in \u00fcye say\u0131s\u0131n\u0131n salt \u00e7o\u011funlu\u011funa dayal\u0131 olarak Karma Komisyonda \u00fc\u00e7\u00fcnc\u00fc tura gidilmi\u015fse, bu y\u00f6ntemin Meclis Genel Kurulunda yap\u0131lacak \u00fcye se\u00e7iminde de benimsenmesinin gerekti\u011fi, aksi halde yasama organ\u0131n\u0131n tasarrufu olsa da yasama i\u015flemi olmayan, bir t\u00fcr idari i\u015flem olan HSK\u2019ya \u00fcye ve aday belirleme se\u00e7imlerinde usulde paralellik ilkesinin ihlale u\u011frayaca\u011f\u0131, mevcut durumda yap\u0131lmas\u0131 gerekenin her iki se\u00e7im y\u00f6n\u00fcnden \u00fc\u00e7\u00fcnc\u00fc tura gitmek olmay\u0131p, Anayasan\u0131n ve Kanunun amir h\u00fck\u00fcmlerinde \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc \u015fekilde, Karma Komisyon taraf\u0131ndan ad \u00e7ekme usul\u00fc ile her bir \u00fcyelik i\u00e7in \u00fc\u00e7 aday belirlenmek suretiyle bu listenin Meclis Ba\u015fkanl\u0131\u011f\u0131na bildirilmesi olaca\u011f\u0131, aksi halde yap\u0131lacak i\u015f ve i\u015flemde Anayasa ve ilgili Kanun h\u00fck\u00fcmlerine ayk\u0131r\u0131l\u0131\u011f\u0131n g\u00fcndeme gelece\u011fi,<\/p>\n<p>Sonucuna var\u0131lmal\u0131d\u0131r.<\/p>\n<p>II. HSK\u2019ya Aday Belirleme veya \u00dcye Se\u00e7iminde Usule Ayk\u0131r\u0131l\u0131k Yap\u0131ld\u0131\u011f\u0131nda, Yani Anayasan\u0131n ve \u0130lgili Kanunun H\u00fck\u00fcmlerinin \u0130hlal Edildi\u011fi \u0130ddias\u0131na Kar\u015f\u0131 Gidilecek Kanun Yolu Nedir?<\/p>\n<p>T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi\u2019nin yasama organ\u0131 olarak yasama ile ilgili i\u015f ve i\u015flemlerine kar\u015f\u0131 Anayasa Mahkemesi\u2019ne gidilece\u011fi, hem Anayasa m.148\/1-2\u2019de ve hem de 6216 say\u0131l\u0131 Anayasa Mahkemesinin Kurulu\u015fu ve Yarg\u0131lama Usulleri Hakk\u0131nda Kanun\u2019un 3. maddesinde yer almaktad\u0131r. Her iki h\u00fck\u00fcm de Anayasa Mahkemesi\u2019nin g\u00f6rev ve yetkileri tan\u0131mlanm\u0131\u015ft\u0131r. Bu h\u00fck\u00fcmlerin hi\u00e7birisinde, Anayasa m.159\/3\u2019e ve 6087 say\u0131l\u0131 Kanun m.20\u2019ye g\u00f6re yap\u0131lacak HSK\u2019ya aday belirleme ve \u00fcye se\u00e7imi i\u015flemlerinin hukuka ayk\u0131r\u0131l\u0131\u011f\u0131na dair iddialarla ilgili do\u011frudan Cumhurba\u015fkan\u0131 veya TBMM\u2019de en fazla \u00fcyeye sahip iki siyasi parti grubu veya \u00fcye tam say\u0131s\u0131n\u0131n en az be\u015fte biri kadar \u00fcye taraf\u0131ndan Anayasa Mahkemesi\u2019nde iptal davas\u0131 a\u00e7\u0131labilece\u011fine dair bir h\u00fck\u00fcm bulunmamaktad\u0131r. \u201cAnayasaya ayk\u0131r\u0131l\u0131\u011f\u0131n di\u011fer mahkemelerde ileri s\u00fcr\u00fclmesi\u201d ba\u015fl\u0131kl\u0131 Anayasa m.152\u2019nin ise, TBMM taraf\u0131ndan HSK\u2019ya aday belirleme \u00fcye se\u00e7imi ile ilgisi bulunmamaktad\u0131r.<\/p>\n<p>Bu konuda TBMM \u0130\u00e7 T\u00fcz\u00fc\u011f\u00fcne bak\u0131lmas\u0131 gerekti\u011fi ileri s\u00fcr\u00fclebilir. Gerek TBMM \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc ve gerekse 6216 say\u0131l\u0131 Kanunun 45. maddesi hari\u00e7, di\u011fer maddeleri ile h\u00fck\u00fcmleri, yine Anayasa m.148\u2019in 3 ila 5. f\u0131kralar\u0131nda d\u00fczenlenen Anayasa Mahkemesi\u2019ne bireysel ba\u015fvuru yolu d\u0131\u015f\u0131nda, TBMM taraf\u0131ndan HSK\u2019ya aday belirlenmesine ve \u00fcye se\u00e7imine kar\u015f\u0131 yasa yola gidilebilece\u011fine dair a\u00e7\u0131k bir d\u00fczenlemeye yer verilmedi\u011fi g\u00f6r\u00fclmektedir. Bu halde ortaya iki g\u00f6r\u00fc\u015f \u00e7\u0131kabilir. \u0130lk g\u00f6r\u00fc\u015fe g\u00f6re; HSK\u2019ya aday belirleme ve \u00fcye se\u00e7imi bir b\u00fct\u00fcn se\u00e7im prosed\u00fcr\u00fc kabul edilerek, Anayasa Mahkemesi\u2019nin 01.05.2007 tarihli, 2007\/45 E. ve 2007\/54 K. say\u0131l\u0131 karar\u0131n\u0131n emsal kabul edilmesi suretiyle Anayasa m.150 ve m.151 gere\u011fince Anayasa Mahkemesi\u2019nde iptal davas\u0131 a\u00e7\u0131labilece\u011fi fikri ileri s\u00fcr\u00fclebilir. \u0130kinci g\u00f6r\u00fc\u015f ise; bizim de kat\u0131ld\u0131\u011f\u0131m\u0131z d\u00fc\u015f\u00fcnce olup, 6216 say\u0131l\u0131 Kanunun \u201cBireysel ba\u015fvuru hakk\u0131\u201d ba\u015fl\u0131kl\u0131 h\u00fckm\u00fcnden hareket edilerek, Mecliste yap\u0131lacak aday belirleme ve \u00fcyelik se\u00e7imlerinden ma\u011fdur oldu\u011funu iddia eden herhangi bir aday aday\u0131n\u0131n veya aday\u0131n Anayasa Mahkemesi\u2019ne bireysel ba\u015fvuru hakk\u0131n\u0131 kullanmas\u0131d\u0131r.<\/p>\n<p>Anayasa Mahkemesi\u2019nin 01.05.2007 tarihli karar\u0131 incelendi\u011finde;<\/p>\n<p>Anayasa Mahkemesi\u2019nin Anayasada ve ilgili yasalarda Cumhurba\u015fkan\u0131 se\u00e7iminde g\u00f6zetilmesi gereken toplant\u0131 yeter say\u0131s\u0131 ile ilgili usul tart\u0131\u015fmas\u0131 sonucunda olu\u015fan TBMM karar\u0131na kar\u015f\u0131 a\u00e7\u0131lan iptal davas\u0131na bakmakla kendisini yetkili g\u00f6rd\u00fc\u011f\u00fc ve sonu\u00e7ta Cumhurba\u015fkan\u0131 se\u00e7imi i\u00e7in al\u0131nan TBMM karar\u0131n\u0131 toplant\u0131 yeter say\u0131s\u0131 y\u00f6n\u00fcnden iptal etti\u011fi anla\u015f\u0131lmaktad\u0131r. Karar incelendi\u011finde; iptal davas\u0131 a\u00e7an toplam 136 milletvekilinin iddias\u0131n\u0131n, TBMM \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc\u2019n\u00fcn 121. maddesinin 1. f\u0131kras\u0131nda yer alan \u201cAnayasan\u0131n 102 inci h\u00fck\u00fcmlerine g\u00f6re\u201d ibaresini eylemli olarak de\u011fi\u015ftiren TBMM karar\u0131n\u0131n, bu karara dayal\u0131 uygulaman\u0131n ve bu uygulaman\u0131n ayr\u0131lmaz par\u00e7as\u0131 olan 11. Cumhurba\u015fkan\u0131 se\u00e7imine ili\u015fkin 27.04.2007 g\u00fcnl\u00fc ilk oylaman\u0131n Anayasa m.96\u2019ya ve m.102\u2019ye ayk\u0131r\u0131l\u0131\u011fa dayand\u0131\u011f\u0131,<\/p>\n<p>\u0130ptal ba\u015fvurusu ile ilgili AYM\u2019nin yetkili olup olmad\u0131\u011f\u0131n\u0131n AYM taraf\u0131ndan tart\u0131\u015f\u0131ld\u0131\u011f\u0131, TBMM\u2019nin 27.04.2007 g\u00fcn\u00fcn\u00fcn, 96. Birle\u015fiminde Meclis Ba\u015fkan\u0131n\u0131n, 184 milletvekilinin Meclis Genel Kurulunda haz\u0131r bulunmas\u0131n\u0131n, g\u00fcndemin Cumhurba\u015fkan\u0131 se\u00e7imi ile ilgili k\u0131sm\u0131na ge\u00e7ilebilmesi i\u00e7in yeterli oldu\u011funa ili\u015fkin TBMM karar\u0131n\u0131n Meclis \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc\u2019n\u00fcn 121. maddesinin eylemli bi\u00e7imde de\u011fi\u015ftirilmesi niteli\u011finde oldu\u011fundan, bu karar\u0131n Anayasaya uygunlu\u011funun denetiminin AYM\u2019nin g\u00f6rev ve yetkisi i\u00e7inde oldu\u011funa d\u00f6rt \u00fcyenin kar\u015f\u0131oylar\u0131yla ve oy\u00e7oklu\u011fu ile karar verildi\u011fi,<\/p>\n<p>Anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>AYM\u2019nin 2007 y\u0131l\u0131nda verdi\u011fi bu karar\u0131n, iptal ba\u015fvurusuna bakmakla kendisini yetkili sayd\u0131\u011f\u0131 k\u0131sm\u0131na kat\u0131lmad\u0131\u011f\u0131m\u0131z\u0131 belirtmek isteriz. Anayasa h\u00fck\u00fcmleri herkes i\u00e7in ba\u011flay\u0131c\u0131d\u0131r, hatta yarg\u0131 mensuplar\u0131 bak\u0131m\u0131ndan ba\u011flay\u0131c\u0131l\u0131\u011f\u0131na dair Anayasa m.11\/1\u2019in yan\u0131nda, Anayasa m.138\/1\u2019de bir h\u00fck\u00fcm daha bulunmaktad\u0131r. \u201cG\u00f6rev ve yetkileri\u201d ba\u015fl\u0131kl\u0131 Anayasa m.148\/1\u2019in ilk c\u00fcmlesine g\u00f6re; \u201cAnayasa Mahkemesi, kanunlar\u0131n, Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamelerinin ve T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi \u0130\u00e7t\u00fcz\u00fc\u011f\u00fcn\u00fcn Anayasaya \u015fekil ve esas bak\u0131mlar\u0131ndan uygunlu\u011funu denetler ve bireysel ba\u015fvurular\u0131 karara ba\u011flar. Anayasa de\u011fi\u015fikliklerini ise sadece \u015fekil bak\u0131m\u0131ndan inceler ve denetler\u201d.<\/p>\n<p>Bu h\u00fck\u00fcmden anla\u015f\u0131laca\u011f\u0131 \u00fczere, kendisine usule uygun ba\u015fvuru yap\u0131lmas\u0131 halinde AYM\u2019nin TBMM \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc\u2019n\u00fcn Anayasaya \u015fekil ve esas bak\u0131mlar\u0131ndan uygunlu\u011funu denetleme yetkisinin oldu\u011funda tart\u0131\u015fma bulunmamaktad\u0131r. Ancak bu yetki; TBMM taraf\u0131ndan al\u0131nan bir kararla TBMM \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc\u2019n\u00fcn ihlal edildi\u011fi ve bu konuda bir hukuka ayk\u0131r\u0131l\u0131\u011f\u0131n ortaya \u00e7\u0131kt\u0131\u011f\u0131 iddias\u0131n\u0131 kapsamaz, yani Meclis \u0130\u00e7t\u00fcz\u00fc\u011f\u00fcnde de\u011fi\u015fiklik yap\u0131lmas\u0131na kar\u015f\u0131, bu de\u011fi\u015fikli\u011fin Anayasaya ayk\u0131r\u0131l\u0131\u011f\u0131 iddias\u0131yla AYM\u2019ye iptal davas\u0131 a\u00e7\u0131lmas\u0131 ba\u015fka, Meclis \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc h\u00fckm\u00fcn\u00fcn hatal\u0131 uyguland\u0131\u011f\u0131 iddias\u0131yla ortaya \u00e7\u0131kan hukuka ayk\u0131r\u0131l\u0131\u011fa kar\u015f\u0131 yasa yoluna gidilmesi ba\u015fkad\u0131r. Her ne kadar AYM 01.05.2007 tarihli karar\u0131nda; TBMM karar\u0131yla \u201cCumhurba\u015fkan\u0131 se\u00e7imi\u201d ba\u015fl\u0131kl\u0131 \u0130\u00e7t\u00fcz\u00fc\u011f\u00fcn 121. maddesinin eylemli bi\u00e7imde de\u011fi\u015ftirildi\u011fini kabul ederek, Cumhurba\u015fkan\u0131 se\u00e7iminin toplant\u0131 yeter say\u0131s\u0131nda yap\u0131ld\u0131\u011f\u0131 ileri s\u00fcr\u00fclen hukuka ayk\u0131r\u0131l\u0131ktan bahisle bu Meclis karar\u0131n\u0131n Anayasaya uygunlu\u011funu denetleme konusunda kendisini g\u00f6revli ve yetkili ilgili saym\u0131\u015ft\u0131r. Oysa AYM\u2019nin; i\u015fin esas\u0131 ile ilgili kimin hakl\u0131 olup olmad\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n, \u0130\u00e7t\u00fcz\u00fck de\u011fi\u015fikli\u011fi i\u00e7ermeyen, \u0130\u00e7t\u00fcz\u00fc\u011f\u00fcn hatal\u0131 uyguland\u0131\u011f\u0131 iddias\u0131n\u0131 denetleme yetkisi bulunmamaktad\u0131r.<\/p>\n<p>Anayasan\u0131n g\u00f6revli ve yetkili k\u0131lmad\u0131\u011f\u0131 bir konuda; k\u0131yas yaparak veya k\u0131yasa varan yorumla kanun koyucunun yerine ge\u00e7erek, \u0130\u00e7t\u00fcz\u00fc\u011f\u00fcn herhangi bir h\u00fckm\u00fcn\u00fcn Mecliste al\u0131nan kararda hatal\u0131 uyguland\u0131\u011f\u0131ndan bahisle eylemli \u015fekilde \u0130\u00e7t\u00fcz\u00fck de\u011fi\u015fikli\u011fi yap\u0131ld\u0131\u011f\u0131n\u0131n kabul\u00fc yoluyla AYM\u2019nin Anayasa m.150\u2019de d\u00fczenlenen iptal davas\u0131n\u0131 esastan inceleme g\u00f6rev ve yetkisine sahip oldu\u011fu kabul edilemez.<\/p>\n<p>Ortada \u0130\u00e7t\u00fcz\u00fck de\u011fi\u015fikli\u011fi yap\u0131lmad\u0131\u011f\u0131 s\u00fcrece; bir oylamada, toplant\u0131da veya kararda yeter say\u0131s\u0131 veya \u00e7o\u011funlu\u011fun sa\u011flan\u0131p sa\u011flanmad\u0131\u011f\u0131 ile ilgili hukukilik denetimi yapan AYM, ba\u015fvuruyu hakl\u0131 g\u00f6rd\u00fc\u011f\u00fcnde \u0130\u00e7t\u00fcz\u00fc\u011f\u00fcn hangi h\u00fckm\u00fcn\u00fc Anayasaya ayk\u0131r\u0131 bularak iptal edecektir? AYM burada Meclis karar\u0131n\u0131n al\u0131nmas\u0131nda usul hatas\u0131 g\u00f6rm\u00fc\u015fse, bu durumda sadece Meclis karar\u0131n\u0131 iptal edecektir ki, Anayasa m.148\u2019de bu konuda AYM\u2019ye tan\u0131nm\u0131\u015f bir g\u00f6rev ve yetki oldu\u011fu s\u00f6ylenemez.<\/p>\n<p>Bu nedenle; Anayasa m.159\/3\u2019de ve 6087 say\u0131l\u0131 Kanun m.20\/3-4\u2019de d\u00fczenlenen Meclis taraf\u0131ndan HSK\u2019ya aday belirleme ve \u00fcye se\u00e7iminde ger\u00e7ekle\u015fen Anayasaya ve ilgili kanuna ayk\u0131r\u0131l\u0131klara dair iddian\u0131n, Anayasa m.150 kapsam\u0131nda AYM\u2019ye g\u00f6t\u00fcr\u00fclebilmesi, ortada soyut norm denetimi yap\u0131labilmesini m\u00fcmk\u00fcn k\u0131lan bir hal varm\u0131\u015f gibi bir kabulle AYM taraf\u0131ndan HSK\u2019n\u0131n se\u00e7imine ili\u015fkin al\u0131nan karar\u0131n iptalinin sa\u011flanmas\u0131 m\u00fcmk\u00fcn g\u00f6z\u00fckmemektedir.<\/p>\n<p>Meclis taraf\u0131ndan HSK i\u00e7in yap\u0131lan aday belirleme ve \u00fcye se\u00e7iminde bir usuls\u00fczl\u00fck g\u00fcndeme gelmi\u015fse, HSK\u2019ya aday aday\u0131 veya aday olan bir veya birden fazla ba\u015fvurucunun hak ihlaline u\u011fray\u0131p ma\u011fdur oldu\u011funa dair iddian\u0131n, bu hak sahipleri taraf\u0131ndan 6216 say\u0131l\u0131 Kanunun 45 ila 51. maddelerinde d\u00fczenlenen bireysel ba\u015fvuru yoluna ba\u015fvurmak suretiyle konuyu AYM\u2019ye ta\u015f\u0131nabilmesi m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>\u201cBireysel ba\u015fvuru hakk\u0131\u201d ba\u015fl\u0131kl\u0131 6216 say\u0131l\u0131 Kanun m.45 incelendi\u011finde; herkesin, Anayasa\u2019da g\u00fcvence alt\u0131na al\u0131nm\u0131\u015f temel hak ve \u00f6zg\u00fcrl\u00fcklerinden, \u0130nsan Haklar\u0131 Avrupa S\u00f6zle\u015fmesi ve buna ek T\u00fcrkiye\u2019nin taraf oldu\u011fu protokoller kapsam\u0131na giren herhangi birisinin kamu g\u00fcc\u00fc taraf\u0131ndan ihlal edildi\u011fi iddias\u0131yla AYM\u2019ye ba\u015fvurabilece\u011finin \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc, yasama i\u015flemleri ile d\u00fczenleyici idari i\u015flemler aleyhine do\u011frudan bireysel ba\u015fvuru yap\u0131lamayaca\u011f\u0131 gibi, AYM kararlar\u0131 ile Anayasan\u0131n yarg\u0131 denetimi d\u0131\u015f\u0131nda b\u0131rakt\u0131\u011f\u0131 i\u015flemlerin de bireysel ba\u015fvuruya konu edilemeyece\u011fi,<\/p>\n<p>Bu durumda; Meclis taraf\u0131ndan HSK\u2019ya aday belirleme ve \u00fcye se\u00e7imine kar\u015f\u0131 bireysel ba\u015fvuru yap\u0131lmas\u0131na bir engelin bulunmad\u0131\u011f\u0131, ortada bir yasama i\u015fleminin, yani kanunla\u015ft\u0131rman\u0131n da bulunmad\u0131\u011f\u0131, bu nedenle Meclisin HSK\u2019ya aday belirleme ve \u00fcye se\u00e7imi ile ilgili kararlar\u0131na kar\u015f\u0131 bireysel ba\u015fvuru yoluna gidilmesinde bir engel olmad\u0131\u011f\u0131, ancak burada ba\u015fvurucunun hangi temel hak veya h\u00fcrriyetin ihlal edildi\u011finin \u00f6nemli oldu\u011fu, \u00e7\u00fcnk\u00fc her ihlal iddias\u0131 bak\u0131m\u0131ndan AYM\u2019ye bireysel ba\u015fvuruda bulunulamad\u0131\u011f\u0131,<\/p>\n<p>\u0130HAS 1. Ek Protokol m.3\u2019\u00fcn g\u00fcvencesi alt\u0131nda bulunan serbest se\u00e7im hakk\u0131n\u0131n yasama organ\u0131n\u0131n se\u00e7ilmesi ile ilgili oldu\u011fu, HSK se\u00e7iminin bu kapsama girmedi\u011fi, bu durumda ba\u015fvurucu y\u00f6n\u00fcnden 1. Se\u00e7im Usul\u00fc<\/p>\n<p>Hakimler ve Savc\u0131lar Kurulu\u2019nun ka\u00e7 \u00fcyeden olu\u015faca\u011f\u0131, ka\u00e7 daire halinde \u00e7al\u0131\u015faca\u011f\u0131 ve \u00fcyelerinin nas\u0131l se\u00e7ilece\u011fi Anayasa m.159\u2019da ve 6087 say\u0131l\u0131 Hakimler ve Savc\u0131lar Kanunu\u2019nda d\u00fczenlenmi\u015ftir. 6087 say\u0131l\u0131 Kanunun 18 ila 20. maddelerinde, HSK \u00fcyelerinin se\u00e7imi usul\u00fcn\u00fcn d\u00fczenlendi\u011fi g\u00f6r\u00fclmektedir.<\/p>\n<p>HSK\u2019n\u0131n toplam 13 \u00fcyeden olu\u015fup, bunlardan Adalet Bakan\u0131n\u0131n Kurulun ba\u015fkan\u0131 oldu\u011fu, her ne kadar Anayasa m.159\/3\u2019\u00fcn ikinci c\u00fcmlesinde Adalet Bakanl\u0131\u011f\u0131 M\u00fcste\u015far\u0131n\u0131n Kurulun tabii \u00fcyesi oldu\u011fu s\u00f6ylense de, Anayasada olan bu s\u0131fat\u0131n kullan\u0131lmad\u0131\u011f\u0131, bunun yerine Adalet Bakan\u0131 yard\u0131mc\u0131lar\u0131ndan birisinin Kurulda \u00fcyelik yapt\u0131\u011f\u0131, Kurulun toplam 6 \u00fcyesinin T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi taraf\u0131ndan se\u00e7ilece\u011fi ve 4 \u00fcyesinin de Cumhurba\u015fkan\u0131 taraf\u0131ndan se\u00e7ilip atanaca\u011f\u0131 \u00f6ng\u00f6r\u00fclmektedir.<\/p>\n<p>TBMM taraf\u0131ndan se\u00e7ilen HSK \u00fcyelerinde ikili bir y\u00f6ntemin izlendi\u011fi, \u00f6nce aday olma ehliyetine sahip olan aday adaylar\u0131n\u0131n Meclis Ba\u015fkanl\u0131\u011f\u0131na ba\u015fvurdu\u011fu, adaylar\u0131n belirlenmesinde Anayasa ve Adalet Komisyonlar\u0131 \u00dcyelerinden Kurulu Karma Komisyonun adaylar\u0131 belirleme yetkisine sahip oldu\u011fu, Karma Komisyonun toplam 54 milletvekilinden olu\u015ftu\u011fu,<\/p>\n<p>Yarg\u0131tay\u2019dan, Dan\u0131\u015ftay\u2019dan, y\u00fcksek\u00f6\u011fretim kurumlar\u0131n\u0131n hukuk dallar\u0131nda g\u00f6rev yapan \u00f6\u011fretim \u00fcyeleri ile avukatlardan aday adayl\u0131\u011f\u0131 i\u00e7in ba\u015fvuranlar\u0131n, TBMM Genel Kurulunda yap\u0131lacak oylamaya aday olabilmeleri i\u00e7in, Karma Komisyonun \u00f6nce \u00fc\u00e7te iki, bu \u00e7o\u011funluk sa\u011flanamad\u0131\u011f\u0131 takdirde be\u015fte \u00fc\u00e7 \u00e7o\u011funlu\u011funu sa\u011flayan her bir \u00fcyelik i\u00e7in \u00fc\u00e7 aday\u0131n belirlenmesi gerekti\u011fi,<\/p>\n<p>Karma Komisyonda yap\u0131lan iki turlu se\u00e7imde yeterli \u00e7o\u011funluk sa\u011flanamad\u0131\u011f\u0131 takdirde, her bir \u00fcyelik i\u00e7in en \u00e7ok oyu alan iki aday aras\u0131nda ad \u00e7ekme usul\u00fc ile aday belirleme i\u015fleminin tamamlanaca\u011f\u0131n\u0131n belirtildi\u011fi, ancak Meclisin yapaca\u011f\u0131 aday ve \u00fcye belirleme se\u00e7imlerinde \u00fc\u00e7\u00fcnc\u00fc tur se\u00e7imin \u00f6ng\u00f6r\u00fclmedi\u011fi, hem Anayasa m.159\/3 ve hem de konuyu d\u00fczenleyen Anayasa h\u00fckm\u00fc ile uyumlu 6087 say\u0131l\u0131 Kanunun 20. maddesinin 3. ve 4. f\u0131kralar\u0131 incelendi\u011finde, Karma Komisyon ile Meclis taraf\u0131ndan HSK \u00fcyeli\u011fi i\u00e7in yap\u0131lacak se\u00e7imlerde \u00fc\u00e7\u00fcnc\u00fc tur se\u00e7im yap\u0131laca\u011f\u0131na dair bir h\u00fck\u00fcm olmad\u0131\u011f\u0131, bunun yerine ad \u00e7ekme usul\u00fc ile aday belirleme ve \u00fcye se\u00e7imi prosed\u00fcr\u00fcn\u00fcn tamamlanaca\u011f\u0131n\u0131n ifade edildi\u011fi,<\/p>\n<p>Ancak Meclis Genel Kurulu taraf\u0131ndan ikinci oylamada \u00fcye se\u00e7ilemedi\u011fi takdirde en \u00e7ok ay\u0131 olan iki aday aras\u0131nda ad \u00e7ekme usul\u00fc ile \u00fcye se\u00e7iminin tamamlanaca\u011f\u0131na dair h\u00fck\u00fcmde bir sorun olmasa bile, benzer h\u00fckm\u00fcn yer ald\u0131\u011f\u0131 Karma Komisyonda ad \u00e7ekme usul\u00fc ile aday belirlemede sorun oldu\u011fu, bir b\u00fct\u00fcnde aday belirleme ve \u00fcye se\u00e7iminde emredici nitelikte ne fazla iki nitelikli oya ba\u011fl\u0131 se\u00e7im usul\u00fcn\u00fcn benimsendi\u011finde ve ikinci se\u00e7imde aday veya \u00fcye belirlenemedi\u011finde ad \u00e7ekme usul\u00fcne ba\u011fl\u0131 aday belirleme veya \u00fcye se\u00e7imi yap\u0131laca\u011f\u0131nda tart\u0131\u015fman\u0131n bulunmad\u0131\u011f\u0131,<\/p>\n<p>Bu nedenle; Karma Komisyonda veya Meclis Genel Kurulunda \u00fc\u00e7\u00fcnc\u00fc tur se\u00e7imin yap\u0131lamayaca\u011f\u0131, hem aday belirlemede ve hem de \u00fcye se\u00e7iminde \u00fc\u00e7\u00fcnc\u00fc tur se\u00e7ime gidilmesinin Anayasa m.159\/3\u2019\u00fcn a\u00e7\u0131k h\u00fckm\u00fcne ayk\u0131r\u0131 olaca\u011f\u0131, bu h\u00fckme benzer y\u00f6nde bir h\u00fckme 6087 say\u0131l\u0131 Hakimler ve Savc\u0131lar Kurulu Kanunu m.20\/3-4\u2019de de yer verildi\u011finden, her iki a\u015famada gidilecek \u00fc\u00e7\u00fcnc\u00fc turun a\u00e7\u0131k yasal d\u00fczenlemeye de ayk\u0131r\u0131 olaca\u011f\u0131, Karma Komisyonun de\u011fil, sadece Meclisin \u00fcye se\u00e7imine ili\u015fkin olarak bu Kanunda h\u00fck\u00fcm bulunmayan hallerde TBMM \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc h\u00fck\u00fcmlerinin uygulanaca\u011f\u0131na dair bir h\u00fckme 6087 say\u0131l\u0131 Kanun m.20\/5\u2019de yer verildi\u011fi, HSK\u2019ya aday belirleme ve \u00fcye se\u00e7iminin Anayasada ve ilgili Kanunda \u00f6ng\u00f6r\u00fclen h\u00fck\u00fcmlerinin bu \u015fekilde oldu\u011fu,<\/p>\n<p>Bununla birlikte; Karma Komisyonun iki turlu se\u00e7imde aday belirleyemedi\u011fi durumda \u00fc\u00e7\u00fcnc\u00fc tur se\u00e7ime izin verilmedi\u011fi, fakat 6087 say\u0131l\u0131 Kanun m.20\/3\u2019de yer alan \u201cKarma Komisyon, ba\u015fvuru \u015fartlar\u0131n\u0131 ta\u015f\u0131yan adaylar aras\u0131ndan her bir \u00fcyelik i\u00e7in \u00fc\u00e7 aday\u0131, \u00fcye tam say\u0131s\u0131n\u0131n \u00fc\u00e7te iki \u00e7o\u011funlu\u011fuyla belirler. Birinci oylamada bu \u00e7o\u011funlukla aday belirlenemedi\u011fi takdirde ikinci oylamaya ge\u00e7ilir. \u0130kinci oylamada \u00fcye tamsay\u0131s\u0131n\u0131n be\u015fte \u00fc\u00e7 \u00e7o\u011funlu\u011fu aran\u0131r. Bu oylamada da yeterli \u00e7o\u011funlukla aday belirlenemedi\u011fi takdirde, her bir \u00fcyelik i\u00e7in en \u00e7ok oyu alan iki aday aras\u0131nda ad \u00e7ekme usul\u00fcyle aday belirleme i\u015flemi tamamlan\u0131r. Karma Komisyon, her bir \u00fcyelik i\u00e7in belirledi\u011fi \u00fc\u00e7 aday\u0131 Meclis Genel Kuruluna sunulmak \u00fczere Meclis Ba\u015fkanl\u0131\u011f\u0131na bildirir.\u201d h\u00fckm\u00fcnde bir hata bulundu\u011fu, bu hatan\u0131n esasen Anayasa m.159\/3\u2019de yer alan Karma Komisyonun aday belirleme i\u00e7in \u00f6ng\u00f6rd\u00fc\u011f\u00fc h\u00fckm\u00fcn aynen 6087 say\u0131l\u0131 Kanun m.20\/3\u2019e al\u0131nmas\u0131ndan kaynakland\u0131\u011f\u0131,<\/p>\n<p>Buna g\u00f6re; Karma Komisyon olarak her bir \u00fcyelik i\u00e7in \u00fc\u00e7 aday belirleyip, bunu Meclis Genel Kuruluna sunmak \u00fczere Meclis Ba\u015fkanl\u0131\u011f\u0131na bildirmesi gerekirken, hem Anayasa m.159\/3\u2019de ve 6087 say\u0131l\u0131 Kanun m.20\/3\u2019de bulunan \u201cBu oylamada da yeterli \u00e7o\u011funlukla aday belirlenemedi\u011fi takdirde, her bir \u00fcyelik i\u00e7in en \u00e7ok oyu alan iki aday aras\u0131nda ad \u00e7ekme usul\u00fcyle aday belirleme i\u015flemi tamamlan\u0131r.\u201d h\u00fckm\u00fcnden hareketle, nas\u0131l olup da Karma Komisyonun bu ad \u00e7ekme usul\u00fc, yani kura ile \u00fc\u00e7 aday belirleyip bunu Meclis Ba\u015fkanl\u0131\u011f\u0131na bildirece\u011finin anla\u015f\u0131lamad\u0131\u011f\u0131, Meclis Genel Kurulunda yap\u0131lacak kura bak\u0131m\u0131ndan sorun olmasa da, bu konuda Karma Komisyonda sorun oldu\u011fu, bu sorunun Anayasa ve ilgili Kanun h\u00fck\u00fcmlerinden kaynakland\u0131\u011f\u0131, bunu a\u015fman\u0131n yolunun Karma Komisyonda \u00fc\u00e7\u00fcnc\u00fc tur se\u00e7ime gitmek olamayaca\u011f\u0131, bir an i\u00e7in \u00fcye say\u0131s\u0131n\u0131n salt \u00e7o\u011funlu\u011funa dayal\u0131 olarak Karma Komisyonda \u00fc\u00e7\u00fcnc\u00fc tura gidilmi\u015fse, bu y\u00f6ntemin Meclis Genel Kurulunda yap\u0131lacak \u00fcye se\u00e7iminde de benimsenmesinin gerekti\u011fi, aksi halde yasama organ\u0131n\u0131n tasarrufu olsa da yasama i\u015flemi olmayan, bir t\u00fcr idari i\u015flem olan HSK\u2019ya \u00fcye ve aday belirleme se\u00e7imlerinde usulde paralellik ilkesinin ihlale u\u011frayaca\u011f\u0131, mevcut durumda yap\u0131lmas\u0131 gerekenin her iki se\u00e7im y\u00f6n\u00fcnden \u00fc\u00e7\u00fcnc\u00fc tura gitmek olmay\u0131p, Anayasan\u0131n ve Kanunun amir h\u00fck\u00fcmlerinde \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc \u015fekilde, Karma Komisyon taraf\u0131ndan ad \u00e7ekme usul\u00fc ile her bir \u00fcyelik i\u00e7in \u00fc\u00e7 aday belirlenmek suretiyle bu listenin Meclis Ba\u015fkanl\u0131\u011f\u0131na bildirilmesi olaca\u011f\u0131, aksi halde yap\u0131lacak i\u015f ve i\u015flemde Anayasa ve ilgili Kanun h\u00fck\u00fcmlerine ayk\u0131r\u0131l\u0131\u011f\u0131n g\u00fcndeme gelece\u011fi,<\/p>\n<p>Sonucuna var\u0131lmal\u0131d\u0131r.<\/p>\n<p>II. HSK\u2019ya Aday Belirleme veya \u00dcye Se\u00e7iminde Usule Ayk\u0131r\u0131l\u0131k Yap\u0131ld\u0131\u011f\u0131nda, Yani Anayasan\u0131n ve \u0130lgili Kanunun H\u00fck\u00fcmlerinin \u0130hlal Edildi\u011fi \u0130ddias\u0131na Kar\u015f\u0131 Gidilecek Kanun Yolu Nedir?<\/p>\n<p>T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi\u2019nin yasama organ\u0131 olarak yasama ile ilgili i\u015f ve i\u015flemlerine kar\u015f\u0131 Anayasa Mahkemesi\u2019ne gidilece\u011fi, hem Anayasa m.148\/1-2\u2019de ve hem de 6216 say\u0131l\u0131 Anayasa Mahkemesinin Kurulu\u015fu ve Yarg\u0131lama Usulleri Hakk\u0131nda Kanun\u2019un 3. maddesinde yer almaktad\u0131r. Her iki h\u00fck\u00fcm de Anayasa Mahkemesi\u2019nin g\u00f6rev ve yetkileri tan\u0131mlanm\u0131\u015ft\u0131r. Bu h\u00fck\u00fcmlerin hi\u00e7birisinde, Anayasa m.159\/3\u2019e ve 6087 say\u0131l\u0131 Kanun m.20\u2019ye g\u00f6re yap\u0131lacak HSK\u2019ya aday belirleme ve \u00fcye se\u00e7imi i\u015flemlerinin hukuka ayk\u0131r\u0131l\u0131\u011f\u0131na dair iddialarla ilgili do\u011frudan Cumhurba\u015fkan\u0131 veya TBMM\u2019de en fazla \u00fcyeye sahip iki siyasi parti grubu veya \u00fcye tam say\u0131s\u0131n\u0131n en az be\u015fte biri kadar \u00fcye taraf\u0131ndan Anayasa Mahkemesi\u2019nde iptal davas\u0131 a\u00e7\u0131labilece\u011fine dair bir h\u00fck\u00fcm bulunmamaktad\u0131r. \u201cAnayasaya ayk\u0131r\u0131l\u0131\u011f\u0131n di\u011fer mahkemelerde ileri s\u00fcr\u00fclmesi\u201d ba\u015fl\u0131kl\u0131 Anayasa m.152\u2019nin ise, TBMM taraf\u0131ndan HSK\u2019ya aday belirleme \u00fcye se\u00e7imi ile ilgisi bulunmamaktad\u0131r.<\/p>\n<p>Bu konuda TBMM \u0130\u00e7 T\u00fcz\u00fc\u011f\u00fcne bak\u0131lmas\u0131 gerekti\u011fi ileri s\u00fcr\u00fclebilir. Gerek TBMM \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc ve gerekse 6216 say\u0131l\u0131 Kanunun 45. maddesi hari\u00e7, di\u011fer maddeleri ile h\u00fck\u00fcmleri, yine Anayasa m.148\u2019in 3 ila 5. f\u0131kralar\u0131nda d\u00fczenlenen Anayasa Mahkemesi\u2019ne bireysel ba\u015fvuru yolu d\u0131\u015f\u0131nda, TBMM taraf\u0131ndan HSK\u2019ya aday belirlenmesine ve \u00fcye se\u00e7imine kar\u015f\u0131 yasa yola gidilebilece\u011fine dair a\u00e7\u0131k bir d\u00fczenlemeye yer verilmedi\u011fi g\u00f6r\u00fclmektedir. Bu halde ortaya iki g\u00f6r\u00fc\u015f \u00e7\u0131kabilir. \u0130lk g\u00f6r\u00fc\u015fe g\u00f6re; HSK\u2019ya aday belirleme ve \u00fcye se\u00e7imi bir b\u00fct\u00fcn se\u00e7im prosed\u00fcr\u00fc kabul edilerek, Anayasa Mahkemesi\u2019nin 01.05.2007 tarihli, 2007\/45 E. ve 2007\/54 K. say\u0131l\u0131 karar\u0131n\u0131n emsal kabul edilmesi suretiyle Anayasa m.150 ve m.151 gere\u011fince Anayasa Mahkemesi\u2019nde iptal davas\u0131 a\u00e7\u0131labilece\u011fi fikri ileri s\u00fcr\u00fclebilir. \u0130kinci g\u00f6r\u00fc\u015f ise; bizim de kat\u0131ld\u0131\u011f\u0131m\u0131z d\u00fc\u015f\u00fcnce olup, 6216 say\u0131l\u0131 Kanunun \u201cBireysel ba\u015fvuru hakk\u0131\u201d ba\u015fl\u0131kl\u0131 h\u00fckm\u00fcnden hareket edilerek, Mecliste yap\u0131lacak aday belirleme ve \u00fcyelik se\u00e7imlerinden ma\u011fdur oldu\u011funu iddia eden herhangi bir aday aday\u0131n\u0131n veya aday\u0131n Anayasa Mahkemesi\u2019ne bireysel ba\u015fvuru hakk\u0131n\u0131 kullanmas\u0131d\u0131r.<\/p>\n<p>Anayasa Mahkemesi\u2019nin 01.05.2007 tarihli karar\u0131 incelendi\u011finde;<\/p>\n<p>Anayasa Mahkemesi\u2019nin Anayasada ve ilgili yasalarda Cumhurba\u015fkan\u0131 se\u00e7iminde g\u00f6zetilmesi gereken toplant\u0131 yeter say\u0131s\u0131 ile ilgili usul tart\u0131\u015fmas\u0131 sonucunda olu\u015fan TBMM karar\u0131na kar\u015f\u0131 a\u00e7\u0131lan iptal davas\u0131na bakmakla kendisini yetkili g\u00f6rd\u00fc\u011f\u00fc ve sonu\u00e7ta Cumhurba\u015fkan\u0131 se\u00e7imi i\u00e7in al\u0131nan TBMM karar\u0131n\u0131 toplant\u0131 yeter say\u0131s\u0131 y\u00f6n\u00fcnden iptal etti\u011fi anla\u015f\u0131lmaktad\u0131r. Karar incelendi\u011finde; iptal davas\u0131 a\u00e7an toplam 136 milletvekilinin iddias\u0131n\u0131n, TBMM \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc\u2019n\u00fcn 121. maddesinin 1. f\u0131kras\u0131nda yer alan \u201cAnayasan\u0131n 102 inci h\u00fck\u00fcmlerine g\u00f6re\u201d ibaresini eylemli olarak de\u011fi\u015ftiren TBMM karar\u0131n\u0131n, bu karara dayal\u0131 uygulaman\u0131n ve bu uygulaman\u0131n ayr\u0131lmaz par\u00e7as\u0131 olan 11. Cumhurba\u015fkan\u0131 se\u00e7imine ili\u015fkin 27.04.2007 g\u00fcnl\u00fc ilk oylaman\u0131n Anayasa m.96\u2019ya ve m.102\u2019ye ayk\u0131r\u0131l\u0131\u011fa dayand\u0131\u011f\u0131,<\/p>\n<p>\u0130ptal ba\u015fvurusu ile ilgili AYM\u2019nin yetkili olup olmad\u0131\u011f\u0131n\u0131n AYM taraf\u0131ndan tart\u0131\u015f\u0131ld\u0131\u011f\u0131, TBMM\u2019nin 27.04.2007 g\u00fcn\u00fcn\u00fcn, 96. Birle\u015fiminde Meclis Ba\u015fkan\u0131n\u0131n, 184 milletvekilinin Meclis Genel Kurulunda haz\u0131r bulunmas\u0131n\u0131n, g\u00fcndemin Cumhurba\u015fkan\u0131 se\u00e7imi ile ilgili k\u0131sm\u0131na ge\u00e7ilebilmesi i\u00e7in yeterli oldu\u011funa ili\u015fkin TBMM karar\u0131n\u0131n Meclis \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc\u2019n\u00fcn 121. maddesinin eylemli bi\u00e7imde de\u011fi\u015ftirilmesi niteli\u011finde oldu\u011fundan, bu karar\u0131n Anayasaya uygunlu\u011funun denetiminin AYM\u2019nin g\u00f6rev ve yetkisi i\u00e7inde oldu\u011funa d\u00f6rt \u00fcyenin kar\u015f\u0131oylar\u0131yla ve oy\u00e7oklu\u011fu ile karar verildi\u011fi,<\/p>\n<p>Anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>AYM\u2019nin 2007 y\u0131l\u0131nda verdi\u011fi bu karar\u0131n, iptal ba\u015fvurusuna bakmakla kendisini yetkili sayd\u0131\u011f\u0131 k\u0131sm\u0131na kat\u0131lmad\u0131\u011f\u0131m\u0131z\u0131 belirtmek isteriz. Anayasa h\u00fck\u00fcmleri herkes i\u00e7in ba\u011flay\u0131c\u0131d\u0131r, hatta yarg\u0131 mensuplar\u0131 bak\u0131m\u0131ndan ba\u011flay\u0131c\u0131l\u0131\u011f\u0131na dair Anayasa m.11\/1\u2019in yan\u0131nda, Anayasa m.138\/1\u2019de bir h\u00fck\u00fcm daha bulunmaktad\u0131r. \u201cG\u00f6rev ve yetkileri\u201d ba\u015fl\u0131kl\u0131 Anayasa m.148\/1\u2019in ilk c\u00fcmlesine g\u00f6re; \u201cAnayasa Mahkemesi, kanunlar\u0131n, Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamelerinin ve T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi \u0130\u00e7t\u00fcz\u00fc\u011f\u00fcn\u00fcn Anayasaya \u015fekil ve esas bak\u0131mlar\u0131ndan uygunlu\u011funu denetler ve bireysel ba\u015fvurular\u0131 karara ba\u011flar. Anayasa de\u011fi\u015fikliklerini ise sadece \u015fekil bak\u0131m\u0131ndan inceler ve denetler\u201d.<\/p>\n<p>Bu h\u00fck\u00fcmden anla\u015f\u0131laca\u011f\u0131 \u00fczere, kendisine usule uygun ba\u015fvuru yap\u0131lmas\u0131 halinde AYM\u2019nin TBMM \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc\u2019n\u00fcn Anayasaya \u015fekil ve esas bak\u0131mlar\u0131ndan uygunlu\u011funu denetleme yetkisinin oldu\u011funda tart\u0131\u015fma bulunmamaktad\u0131r. Ancak bu yetki; TBMM taraf\u0131ndan al\u0131nan bir kararla TBMM \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc\u2019n\u00fcn ihlal edildi\u011fi ve bu konuda bir hukuka ayk\u0131r\u0131l\u0131\u011f\u0131n ortaya \u00e7\u0131kt\u0131\u011f\u0131 iddias\u0131n\u0131 kapsamaz, yani Meclis \u0130\u00e7t\u00fcz\u00fc\u011f\u00fcnde de\u011fi\u015fiklik yap\u0131lmas\u0131na kar\u015f\u0131, bu de\u011fi\u015fikli\u011fin Anayasaya ayk\u0131r\u0131l\u0131\u011f\u0131 iddias\u0131yla AYM\u2019ye iptal davas\u0131 a\u00e7\u0131lmas\u0131 ba\u015fka, Meclis \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc h\u00fckm\u00fcn\u00fcn hatal\u0131 uyguland\u0131\u011f\u0131 iddias\u0131yla ortaya \u00e7\u0131kan hukuka ayk\u0131r\u0131l\u0131\u011fa kar\u015f\u0131 yasa yoluna gidilmesi ba\u015fkad\u0131r. Her ne kadar AYM 01.05.2007 tarihli karar\u0131nda; TBMM karar\u0131yla \u201cCumhurba\u015fkan\u0131 se\u00e7imi\u201d ba\u015fl\u0131kl\u0131 \u0130\u00e7t\u00fcz\u00fc\u011f\u00fcn 121. maddesinin eylemli bi\u00e7imde de\u011fi\u015ftirildi\u011fini kabul ederek, Cumhurba\u015fkan\u0131 se\u00e7iminin toplant\u0131 yeter say\u0131s\u0131nda yap\u0131ld\u0131\u011f\u0131 ileri s\u00fcr\u00fclen hukuka ayk\u0131r\u0131l\u0131ktan bahisle bu Meclis karar\u0131n\u0131n Anayasaya uygunlu\u011funu denetleme konusunda kendisini g\u00f6revli ve yetkili ilgili saym\u0131\u015ft\u0131r. Oysa AYM\u2019nin; i\u015fin esas\u0131 ile ilgili kimin hakl\u0131 olup olmad\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n, \u0130\u00e7t\u00fcz\u00fck de\u011fi\u015fikli\u011fi i\u00e7ermeyen, \u0130\u00e7t\u00fcz\u00fc\u011f\u00fcn hatal\u0131 uyguland\u0131\u011f\u0131 iddias\u0131n\u0131 denetleme yetkisi bulunmamaktad\u0131r.<\/p>\n<p>Anayasan\u0131n g\u00f6revli ve yetkili k\u0131lmad\u0131\u011f\u0131 bir konuda; k\u0131yas yaparak veya k\u0131yasa varan yorumla kanun koyucunun yerine ge\u00e7erek, \u0130\u00e7t\u00fcz\u00fc\u011f\u00fcn herhangi bir h\u00fckm\u00fcn\u00fcn Mecliste al\u0131nan kararda hatal\u0131 uyguland\u0131\u011f\u0131ndan bahisle eylemli \u015fekilde \u0130\u00e7t\u00fcz\u00fck de\u011fi\u015fikli\u011fi yap\u0131ld\u0131\u011f\u0131n\u0131n kabul\u00fc yoluyla AYM\u2019nin Anayasa m.150\u2019de d\u00fczenlenen iptal davas\u0131n\u0131 esastan inceleme g\u00f6rev ve yetkisine sahip oldu\u011fu kabul edilemez.<\/p>\n<p>Ortada \u0130\u00e7t\u00fcz\u00fck de\u011fi\u015fikli\u011fi yap\u0131lmad\u0131\u011f\u0131 s\u00fcrece; bir oylamada, toplant\u0131da veya kararda yeter say\u0131s\u0131 veya \u00e7o\u011funlu\u011fun sa\u011flan\u0131p sa\u011flanmad\u0131\u011f\u0131 ile ilgili hukukilik denetimi yapan AYM, ba\u015fvuruyu hakl\u0131 g\u00f6rd\u00fc\u011f\u00fcnde \u0130\u00e7t\u00fcz\u00fc\u011f\u00fcn hangi h\u00fckm\u00fcn\u00fc Anayasaya ayk\u0131r\u0131 bularak iptal edecektir? AYM burada Meclis karar\u0131n\u0131n al\u0131nmas\u0131nda usul hatas\u0131 g\u00f6rm\u00fc\u015fse, bu durumda sadece Meclis karar\u0131n\u0131 iptal edecektir ki, Anayasa m.148\u2019de bu konuda AYM\u2019ye tan\u0131nm\u0131\u015f bir g\u00f6rev ve yetki oldu\u011fu s\u00f6ylenemez.<\/p>\n<p>Bu nedenle; Anayasa m.159\/3\u2019de ve 6087 say\u0131l\u0131 Kanun m.20\/3-4\u2019de d\u00fczenlenen Meclis taraf\u0131ndan HSK\u2019ya aday belirleme ve \u00fcye se\u00e7iminde ger\u00e7ekle\u015fen Anayasaya ve ilgili kanuna ayk\u0131r\u0131l\u0131klara dair iddian\u0131n, Anayasa m.150 kapsam\u0131nda AYM\u2019ye g\u00f6t\u00fcr\u00fclebilmesi, ortada soyut norm denetimi yap\u0131labilmesini m\u00fcmk\u00fcn k\u0131lan bir hal varm\u0131\u015f gibi bir kabulle AYM taraf\u0131ndan HSK\u2019n\u0131n se\u00e7imine ili\u015fkin al\u0131nan karar\u0131n iptalinin sa\u011flanmas\u0131 m\u00fcmk\u00fcn g\u00f6z\u00fckmemektedir.<\/p>\n<p>Meclis taraf\u0131ndan HSK i\u00e7in yap\u0131lan aday belirleme ve \u00fcye se\u00e7iminde bir usuls\u00fczl\u00fck g\u00fcndeme gelmi\u015fse, HSK\u2019ya aday aday\u0131 veya aday olan bir veya birden fazla ba\u015fvurucunun hak ihlaline u\u011fray\u0131p ma\u011fdur oldu\u011funa dair iddian\u0131n, bu hak sahipleri taraf\u0131ndan 6216 say\u0131l\u0131 Kanunun 45 ila 51. maddelerinde d\u00fczenlenen bireysel ba\u015fvuru yoluna ba\u015fvurmak suretiyle konuyu AYM\u2019ye ta\u015f\u0131nabilmesi m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>\u201cBireysel ba\u015fvuru hakk\u0131\u201d ba\u015fl\u0131kl\u0131 6216 say\u0131l\u0131 Kanun m.45 incelendi\u011finde; herkesin, Anayasa\u2019da g\u00fcvence alt\u0131na al\u0131nm\u0131\u015f temel hak ve \u00f6zg\u00fcrl\u00fcklerinden, \u0130nsan Haklar\u0131 Avrupa S\u00f6zle\u015fmesi ve buna ek T\u00fcrkiye\u2019nin taraf oldu\u011fu protokoller kapsam\u0131na giren herhangi birisinin kamu g\u00fcc\u00fc taraf\u0131ndan ihlal edildi\u011fi iddias\u0131yla AYM\u2019ye ba\u015fvurabilece\u011finin \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc, yasama i\u015flemleri ile d\u00fczenleyici idari i\u015flemler aleyhine do\u011frudan bireysel ba\u015fvuru yap\u0131lamayaca\u011f\u0131 gibi, AYM kararlar\u0131 ile Anayasan\u0131n yarg\u0131 denetimi d\u0131\u015f\u0131nda b\u0131rakt\u0131\u011f\u0131 i\u015flemlerin de bireysel ba\u015fvuruya konu edilemeyece\u011fi,<\/p>\n<p>Bu durumda; Meclis taraf\u0131ndan HSK\u2019ya aday belirleme ve \u00fcye se\u00e7imine kar\u015f\u0131 bireysel ba\u015fvuru yap\u0131lmas\u0131na bir engelin bulunmad\u0131\u011f\u0131, ortada bir yasama i\u015fleminin, yani kanunla\u015ft\u0131rman\u0131n da bulunmad\u0131\u011f\u0131, bu nedenle Meclisin HSK\u2019ya aday belirleme ve \u00fcye se\u00e7imi ile ilgili kararlar\u0131na kar\u015f\u0131 bireysel ba\u015fvuru yoluna gidilmesinde bir engel olmad\u0131\u011f\u0131, ancak burada ba\u015fvurucunun hangi temel hak veya h\u00fcrriyetin ihlal edildi\u011finin \u00f6nemli oldu\u011fu, \u00e7\u00fcnk\u00fc her ihlal iddias\u0131 bak\u0131m\u0131ndan AYM\u2019ye bireysel ba\u015fvuruda bulunulamad\u0131\u011f\u0131,<\/p>\n<p>\u0130HAS 1. Ek Protokol m.3\u2019\u00fcn g\u00fcvencesi alt\u0131nda bulunan serbest se\u00e7im hakk\u0131n\u0131n yasama organ\u0131n\u0131n se\u00e7ilmesi ile ilgili oldu\u011fu, HSK se\u00e7iminin bu kapsama girmedi\u011fi, bu durumda ba\u015fvurucu y\u00f6n\u00fcnden 1.
