Ba\u015fvuru, yurt d\u0131\u015f\u0131nda sat\u0131n al\u0131nan ve ka\u00e7ak\u00e7\u0131l\u0131k su\u00e7undan y\u00fcr\u00fct\u00fclen bir ceza soru\u015fturmas\u0131nda el konularak m\u00fczeye emanet edilen tarihi eser niteli\u011findeki mozaik tablolar\u0131n, ba\u015fvurucu hakk\u0131nda a\u00e7\u0131lan ceza davalar\u0131nda m\u00fcsadere karar\u0131 verilmemesine ra\u011fmen m\u00fczede tutulmaya devam edilmesi \u00fczerine bu tablolar\u0131n iade edilmesi veya ikramiye \u00f6denmesi talebiyle ba\u015fvurulan idari ve yarg\u0131sal s\u00fcre\u00e7lerden bir sonu\u00e7 al\u0131namamas\u0131 nedeniyle m\u00fclkiyet ve adil yarg\u0131lanma haklar\u0131n\u0131n ihlal edildi\u011fi iddialar\u0131na ili\u015fkindir.<\/p>\n<p>II. BA\u015eVURU S\u00dcREC\u0130<\/p>\n<p>2. Ba\u015fvuru 26\/8\/2014 tarihinde Anayasa Mahkemesine do\u011frudan yap\u0131lm\u0131\u015ft\u0131r. Ba\u015fvuru formu ve eklerinin idari y\u00f6nden yap\u0131lan \u00f6n incelemesi neticesinde ba\u015fvurunun Komisyona sunulmas\u0131na engel te\u015fkil edecek bir eksikli\u011finin bulunmad\u0131\u011f\u0131 tespit edilmi\u015ftir.<\/p>\n<p>3. \u0130kinci B\u00f6l\u00fcm Birinci Komisyonunca 30\/12\/2014 tarihinde, ba\u015fvurunun kabul edilebilirlik incelemesinin B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na karar verilmi\u015ftir. <\/p>\n<p>4. B\u00f6l\u00fcm Ba\u015fkan\u0131 taraf\u0131ndan 22\/2\/2016 tarihinde, ba\u015fvurunun kabul edilebilirlik ve esas incelemesinin birlikte yap\u0131lmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>5. Ba\u015fvuru belgelerinin bir \u00f6rne\u011fi bilgi i\u00e7in Adalet Bakanl\u0131\u011f\u0131na (Bakanl\u0131k) g\u00f6nderilmi\u015ftir. Bakanl\u0131k taraf\u0131ndan g\u00f6r\u00fc\u015f bildirilmemi\u015ftir.<\/p>\n<p>III. OLAY VE OLGULAR<\/p>\n<p>A. Olaylar <\/p>\n<p>6. Ba\u015fvuru formu ve eklerinde ifade edildi\u011fi \u015fekliyle ilgili olaylar \u00f6zetle \u015f\u00f6yledir:<\/p>\n<p>7. Ba\u015fvurucu uzun y\u0131llard\u0131r Kuveyt&#8217;te i\u015f\u00e7i olarak \u00e7al\u0131\u015fmakta iken sat\u0131n ald\u0131\u011f\u0131n\u0131 belirtti\u011fi Ge\u00e7 Roma d\u00f6nemine ait d\u00f6rt adet mozaik tabloyu 17\/8\/2000 tarihinde yurda sokmaya \u00e7al\u0131\u015fm\u0131\u015f ancak bu tablolar g\u00fcmr\u00fck ambar\u0131na al\u0131nm\u0131\u015ft\u0131r. Bu defa s\u00f6z konusu tablolar 13\/10\/2000 tarihinde Almanya&#8217;ya g\u00f6nderilmi\u015f, sonras\u0131nda A.Y. isimli bir \u015fah\u0131s taraf\u0131ndan bu tablolar yeniden yurda sokulmu\u015f, bu tarihi eserlere kolluk g\u00f6revlilerince 21\/11\/2000 tarihinde A.Y.&#8217;ye ait olan ve \u0130stanbul ili \u015ei\u015fli il\u00e7esinde bulunan bir depoda el konulmu\u015ftur. <\/p>\n<p>8. Tarihi eser niteli\u011findeki mozaik tablolar 29\/11\/2000 tarihinde \u0130stanbul Arkeoloji M\u00fczesinde koruma alt\u0131na al\u0131nm\u0131\u015ft\u0131r. \u0130stanbul Arkeoloji M\u00fczesi M\u00fcd\u00fcrl\u00fc\u011f\u00fc uzmanlar\u0131nca d\u00fczenlenen 30\/11\/2000 tarihli raporda; ele ge\u00e7irilerek m\u00fczeye getirilen d\u00f6rt adet mozai\u011fin orijinal yerlerinden beze yap\u0131\u015ft\u0131r\u0131larak al\u0131nm\u0131\u015f oldu\u011fu, do\u011fu Akdeniz at\u00f6lyeleri i\u015f\u00e7ili\u011fini g\u00f6sterdi\u011fi, par\u00e7alar\u0131n 21\/7\/1983 tarihli ve 2863 say\u0131l\u0131 K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma Kanunu kapsam\u0131nda tasnif ve tescile tabi m\u00fczelik de\u011ferde oldu\u011fu belirtilmi\u015ftir. <\/p>\n<p>1. Bak\u0131rk\u00f6y 1. A\u011f\u0131r Ceza Mahkemesinde G\u00f6r\u00fclen Ceza Davas\u0131 S\u00fcreci<\/p>\n<p>9. Ba\u015fvurucu ve bu olayla ilgili g\u00f6r\u00fclen di\u011fer on san\u0131k hakk\u0131nda Bak\u0131rk\u00f6y Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131n\u0131n 11\/12\/2000 tarihli iddianamesi ile &#8220;toplu ithal ka\u00e7ak\u00e7\u0131l\u0131\u011f\u0131&#8221; su\u00e7undan, m\u00fclga 7\/1\/1932 tarihli ve 1918 say\u0131l\u0131 Ka\u00e7ak\u00e7\u0131l\u0131\u011f\u0131n Men ve Takibine Dair Kanun&#8217;un 27. maddesinin ikinci ve \u00fc\u00e7\u00fcnc\u00fc f\u0131kralar\u0131, 33. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131 ile m\u00fclga 1\/3\/1926 tarihli ve 765 say\u0131l\u0131 T\u00fcrk Ceza Kanunu&#8217;nun 31. ve 33. maddeleri uyar\u0131nca cezaland\u0131r\u0131lmalar\u0131 istemiyle kamu davas\u0131 a\u00e7\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>10. Bak\u0131rk\u00f6y 1. A\u011f\u0131r Ceza Mahkemesinin 2\/3\/2007 tarihli ve E.2000\/794, K.2007\/81 say\u0131l\u0131 karar\u0131 ile san\u0131klar\u0131n ayr\u0131 ayr\u0131 beraatlerine ve su\u00e7a konu eserlerin m\u00fcsaderesine h\u00fckmedilmi\u015ftir. Karar\u0131n gerek\u00e7esinin ilgili k\u0131s\u0131mlar\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;&#8230; San\u0131klardan Arif G\u00fcven&#8217;in uzun y\u0131llar i\u015f\u00e7i olarak \u00e7al\u0131\u015ft\u0131\u011f\u0131 Kuveyt&#8217;te daha \u00f6nceden tan\u0131d\u0131\u011f\u0131 &#8230; isimli \u015fah\u0131stan 80.000 ABD dolar\u0131 kar\u015f\u0131l\u0131\u011f\u0131nda ge\u00e7 Roma d\u00f6nemine ait 4 adet mozaik tabloyu yurda yasal yollardan sokmaya \u00e7al\u0131\u015ft\u0131\u011f\u0131, g\u00fcmr\u00fc\u011fe mozaik vitrai olarak beyan edilen 4 adet tahta sand\u0131k i\u00e7indeki tablolar\u0131n g\u00fcmr\u00fck ambar\u0131na al\u0131nd\u0131\u011f\u0131, bu mallar\u0131n ithalinin ger\u00e7ekle\u015fmedi\u011fine kanaat getiren san\u0131k Arif G\u00fcven&#8217;in bu mallar\u0131n yurda sokulmas\u0131 konusunda ara\u015ft\u0131rma yapt\u0131\u011f\u0131, &#8230;. san\u0131k R.G.&#8217;nin \u00e7al\u0131\u015fmalar\u0131 sonucu resmi yoldan 13\/10\/2000 tarihinde mozaik tablolar\u0131n Almanya&#8217;ya yurt d\u0131\u015f\u0131 edildi\u011fi, bu tablolar\u0131n firari san\u0131k A.Y. taraf\u0131ndan yurt d\u0131\u015f\u0131ndan yasal olmayan yollardan \u00fclkemize sokuldu\u011fu, yap\u0131lan bir operasyonda bu tarihi eserlerin san\u0131k A.Y.&#8217;ye ait \u015ei\u015fli&#8217;deki bir depoda ele ge\u00e7ti\u011fi, bu suretle t\u00fcm san\u0131klar\u0131n iradi ve fiili i\u015fbirli\u011fi i\u00e7inde toplu ithal ka\u00e7ak\u00e7\u0131l\u0131\u011f\u0131 su\u00e7unu i\u015fledikleri [iddia edilmi\u015ftir]&#8230;<\/p>\n<p>&#8230; <\/p>\n<p>Su\u00e7a konu e\u015fyalar \u00fczerinde 7\/4\/2003 tarihinde ke\u015fif icra edilmi\u015f, ke\u015fif esnas\u0131nda bulunan bilirki\u015filer &#8230;. havale tarihli raporlar\u0131nda: Davaya konu eserlerin 2863 ve de\u011fi\u015fik 3386 say\u0131l\u0131 K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma Kanunu kapsam\u0131nda tescil ve tasnife tabi konservasyonu yap\u0131larak, m\u00fczede korunmas\u0131 gerekli eski eser olduklar\u0131n\u0131, bu t\u00fcr eserlerin yabanc\u0131 bir \u00fclkeden T\u00fcrkiye&#8217;ye getirilmesi s\u0131ras\u0131nda m\u00fczenin bilgilendirilmesi gerekti\u011fini, piyasa ve CIF de\u011ferleri konusunda fikir beyan etmenin yetkileri d\u0131\u015f\u0131nda oldu\u011funu, benzer eserlerin yasal yoldan m\u00fczeye teslim ve hibe edilmesi durumunda m\u00fczede bir komisyon kurularak ikramiye niteli\u011finde \u00f6denmek \u00fczere de\u011fer bi\u00e7ildi\u011fini ifade etmi\u015flerdir.<\/p>\n<p>Su\u00e7a konu eserlerin su\u00e7 tarihi itibar\u0131yla &#8216;CIF&#8217; de\u011ferlerinin tespiti i\u00e7in yeniden su\u00e7a konu e\u015fyalar \u00fczerinde ke\u015fif icra edilmi\u015f, ke\u015fif esnas\u0131nda bulunan bilirki\u015filer &#8230; 1\/2\/2005 havale tarihli raporlar\u0131nda: Su\u00e7a konu eserlerin m\u00fczelik de\u011ferde mozaik eserler olup 2863 say\u0131l\u0131 Kanun&#8217;un kapsam\u0131na girdi\u011fini, Kanun&#8217;un 23. maddesinin birinci f\u0131kras\u0131n\u0131n (a) bendi ve 25. maddesinde belirtilen t\u00fcm \u00f6zelliklere sahip bulundu\u011funu, tescil ve tasnife tabi olup onar\u0131mlar\u0131 yap\u0131larak m\u00fczede korunmas\u0131 gerekli eski eserlerden olduklar\u0131n\u0131, T\u00fcrkiye&#8217;ye getirilmesi s\u0131ras\u0131nda da m\u00fczenin haberdar edilip gerekli kurumlardan izin al\u0131nmas\u0131 zorunlu eserlerden oldu\u011funu belirtmi\u015fler, ancak &#8216;CIF&#8217; de\u011ferlerini belirtmemi\u015flerdir.<\/p>\n<p> Mahkememizce tescil ve tasnife tabi k\u00fclt\u00fcr ve tabiat varl\u0131\u011f\u0131 niteli\u011findeki dava konusu e\u015fyalar\u0131n ithali ile ilgili g\u00fcmr\u00fck mevzuat\u0131n\u0131n ne oldu\u011fu, yasak olup olmad\u0131\u011f\u0131, ithalinin herhangi bir g\u00fcmr\u00fck vergisine tabi olup olmad\u0131\u011f\u0131 hususlar\u0131nda \u0130stanbul G\u00fcmr\u00fckler Ba\u015fm\u00fcd\u00fcrl\u00fc\u011f\u00fcne m\u00fczekkere yaz\u0131lm\u0131\u015f, cevabi m\u00fczekkereden, s\u00f6z konusu e\u015fyalar\u0131n ithalinin serbest ve ithalde K\u00fclt\u00fcr Bakanl\u0131\u011f\u0131 izin yaz\u0131s\u0131n\u0131n arand\u0131\u011f\u0131, g\u00fcmr\u00fck vergisinden muaf oldu\u011fu anla\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>&#8230;<\/p>\n<p>\u0130ddia, savunma, bilirki\u015fi raporlar\u0131, \u0130stanbul G\u00fcmr\u00fckler Ba\u015fm\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn cevabi m\u00fczekkeresi ve tam dosya kapsam\u0131 kar\u015f\u0131s\u0131nda; her ne kadar san\u0131klar hakk\u0131nda toplu g\u00fcmr\u00fck ka\u00e7ak\u00e7\u0131l\u0131\u011f\u0131 su\u00e7undan cezaland\u0131r\u0131lmalar\u0131 talebi ile mahkememize kamu davas\u0131 a\u00e7\u0131lm\u0131\u015f ise de, san\u0131klar\u0131n eyleminin 2863 say\u0131l\u0131 Kanun kapsam\u0131nda de\u011ferlendirilebilece\u011fi, san\u0131klar hakk\u0131nda bu su\u00e7 ile ilgili olarak evrak\u0131n tefrik edilerek \u015ei\u015fli 7. Asliye Ceza Mahkemesinin 2001\/160 esas say\u0131l\u0131 dosyas\u0131nda davan\u0131n g\u00f6r\u00fcld\u00fc\u011f\u00fc, mahkemece 7\/4\/2006 tarihinde san\u0131klar\u0131n &#8216;2863 say\u0131l\u0131 Kanun&#8217;a Muhalefet&#8217; su\u00e7undan ayr\u0131 ayr\u0131 beraatlerine karar verildi\u011fi, san\u0131klar\u0131n toplu g\u00fcmr\u00fck ka\u00e7ak\u00e7\u0131l\u0131\u011f\u0131 su\u00e7unu i\u015flediklerine dair savunmalar\u0131n\u0131n aksini g\u00f6sterir, cezaland\u0131r\u0131lmalar\u0131na yeterli, her t\u00fcrl\u00fc \u015f\u00fcpheden uzak, kesin ve inand\u0131r\u0131c\u0131 delil elde edilemedi\u011fi anla\u015f\u0131lmakla, m\u00fcsnet su\u00e7tan ayr\u0131 ayr\u0131 beraatleri yolunda a\u015fa\u011f\u0131daki h\u00fck\u00fcm kurulmu\u015ftur.&#8221;<\/p>\n<p>11. Karar temyiz edilmi\u015f, Yarg\u0131tay 7. Ceza Dairesinin 26\/5\/2008 tarihli ve E.2008\/4811, K.2008\/14241 say\u0131l\u0131 ilam\u0131yla, zamana\u015f\u0131m\u0131 nedeniyle h\u00fckm\u00fcn bozulmas\u0131na ve kamu davas\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131na, 2863 say\u0131l\u0131 Kanun kapsam\u0131nda oldu\u011fu belirlenen dava konusu tescil ve tasnife tabi tarihi eser niteli\u011findeki e\u015fyan\u0131n ise m\u00fczeye verilmesine karar verilmi\u015ftir. \u0130lam\u0131n gerek\u00e7esinin ilgili k\u0131s\u0131mlar\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Su\u00e7 tarihi olan 22.11.2000 g\u00fcn\u00fc itibariyle temyiz inceleme g\u00fcn\u00fcnde san\u0131klar yarar\u0131na h\u00fck\u00fcmler ta\u015f\u0131yan 765 say\u0131l\u0131 TCK&#8217;n\u0131n 102\/4 ve 104\/2.maddelerinde \u00f6ng\u00f6r\u00fclen zamana\u015f\u0131m\u0131 s\u00fcresi tahakkuk etti\u011fi cihetle m\u00fcdahil idare vekili ve san\u0131k Arif G\u00fcven m\u00fcdafiinin temyiz itirazlar\u0131 bu itibarla yerinde g\u00f6r\u00fcld\u00fc\u011f\u00fcnden h\u00fckm\u00fcn bozulmas\u0131na, san\u0131klar hakk\u0131ndaki kamu davas\u0131n\u0131n an\u0131lan maddeler uyar\u0131nca zamana\u015f\u0131m\u0131 nedeniyle ortadan kald\u0131r\u0131lmas\u0131na, 2863 say\u0131l\u0131 Yasa kapsam\u0131nda oldu\u011fu belirlenen dava konusu tescil ve tasnife tabi tarihi eser niteli\u011findeki e\u015fyalar\u0131n, m\u00fczeye verilmesine, &#8230; karar verildi.&#8221;<\/p>\n<p>2. \u015ei\u015fli 7. Asliye Ceza Mahkemesinde G\u00f6r\u00fclen Dava S\u00fcreci <\/p>\n<p>12. Bak\u0131rk\u00f6y 1. A\u011f\u0131r Ceza Mahkemesinin E.2000\/794 say\u0131l\u0131 dosyas\u0131nda ba\u015fvurucunun da aralar\u0131nda bulundu\u011fu san\u0131klar hakk\u0131nda &#8220;2863 say\u0131l\u0131 Kanun&#8217;a Muhalefet&#8221; su\u00e7undan dosya tefrik edilerek \u015ei\u015fli 7. Asliye Ceza Mahkemesine g\u00f6nderilmi\u015ftir. Mahkemenin 7\/4\/2006 tarihli ve E.2001\/163, K.2006\/241 say\u0131l\u0131 karar\u0131 ile san\u0131klar\u0131n at\u0131l\u0131 su\u00e7u i\u015flediklerinin sabit olmad\u0131\u011f\u0131 gerek\u00e7esiyle ayr\u0131 ayr\u0131 beraatlerine h\u00fckmedilmi\u015ftir. <\/p>\n<p>13. Kat\u0131lan s\u0131fat\u0131yla \u0130stanbul Muhakemat M\u00fcd\u00fcrl\u00fc\u011f\u00fcnce karar temyiz edilmi\u015f, Yarg\u0131tay 7. Ceza Dairesinin 29\/6\/2009 tarihli ve E.2008\/3788, K.2009\/7764 say\u0131l\u0131 ilam\u0131yla; &#8220;Su\u00e7tan do\u011frudan do\u011fruya zarar g\u00f6ren K\u00fclt\u00fcr Bakanl\u0131\u011f\u0131 ad\u0131na Hazine vekilinin kat\u0131lma iste\u011finde bulunmas\u0131 ve m\u00fcdahilli\u011fine karar verilmesi gerekti\u011fi g\u00f6zetilmeden, do\u011frudan zarar g\u00f6rmeyen Maliye Bakanl\u0131\u011f\u0131n\u0131n m\u00fcdahilli\u011fine karar verilmesi hukuken ge\u00e7ersiz olup h\u00fckm\u00fc temyiz hakk\u0131 vermeyece\u011finden Hazine vekilinin vaki temyiz isteminin &#8230;.. reddine&#8221; karar verilmi\u015ftir.<\/p>\n<p>3. Ankara 8. \u0130dare Mahkemesinde G\u00f6r\u00fclen Tam Yarg\u0131 Davas\u0131 S\u00fcreci<\/p>\n<p>14. Ba\u015fvurucu, Kuveyt&#8217;ten sat\u0131n alarak T\u00fcrkiye&#8217;ye sokmaya \u00e7al\u0131\u015ft\u0131\u011f\u0131 mozaik tablolara 21\/11\/2000 tarihinde el konularak 29\/11\/2000 tarihinde \u0130stanbul M\u00fcze M\u00fcd\u00fcrl\u00fc\u011f\u00fcne emanet edildi\u011fini ancak sat\u0131n ald\u0131\u011f\u0131 tablolar\u0131n yurda sokulmas\u0131n\u0131n su\u00e7 olmad\u0131\u011f\u0131n\u0131 ve m\u00fcsadere karar\u0131 da verilmeyen \u00f6zel m\u00fclke konu tablolara bedelsiz el konuldu\u011funu belirterek kurulacak bir komisyon taraf\u0131ndan uluslararas\u0131 rayici hesap edilerek bu hesap \u00fczerinden ikramiye \u00f6denmesi veya eserlerin taraf\u0131na iade edilmesi istemiyle K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131na (\u0130dare) ba\u015fvuruda bulunmu\u015ftur. Ba\u015fvurucunun bu talebi \u0130darece 19\/3\/2009 tarihinde reddedilmi\u015ftir. <\/p>\n<p>15. Ba\u015fvurucu bu defa \u0130dare aleyhine 20\/5\/2009 tarihinde an\u0131lan i\u015flemin iptali istemiyle Ankara 8. \u0130dare Mahkemesinde dava a\u00e7m\u0131\u015ft\u0131r. Mahkeme 16\/12\/2010 tarihli ve E.2009\/668, K.2010\/2330 say\u0131l\u0131 karar\u0131 ile davan\u0131n reddine karar vermi\u015ftir. Karar\u0131n gerek\u00e7esinin ilgili k\u0131s\u0131mlar\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;&#8230; s\u00f6z konusu mozaik tablolar\u0131n kurulacak bir komisyon taraf\u0131ndan uluslararas\u0131 rayicinin hesap edilerek bu hesap \u00fczerinden kendisine ikramiye \u00f6denmesi veya eserlerin kendisine iade edilmesi i\u00e7in ba\u015fvurdu\u011fu, ba\u015fvurusunun reddi \u00fczerine bu i\u015flemin iptali istemiyle bak\u0131lmakta olan davan\u0131n a\u00e7\u0131ld\u0131\u011f\u0131 anla\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Olayda, Bak\u0131rk\u00f6y 1. A\u011f\u0131r Ceza Mahkemesinde g\u00f6r\u00fclen davada, Mahkemece yapt\u0131r\u0131lan bilirki\u015fi incelemesi sonucunda d\u00fczenlenen raporda; dava konusu d\u00f6\u015feme mozai\u011fi panolar\u0131n (d\u00f6rt adet) in situ olarak bulundu\u011fu yerden ka\u00e7ak kaz\u0131 yap\u0131larak s\u00f6k\u00fclm\u00fc\u015f oldu\u011fu, mozaik panolar\u0131n hem \u00fczerindeki mitolojik tasvirler hem de i\u015f\u00e7ilik \u00f6zellikleriyle Akdenizin do\u011fu \u00fclkelerinde hakim olan Ge\u00e7 Roma d\u00f6nemi mozaik sanat\u0131n\u0131n konu ve \u00fcslup \u00f6zelliklerini ta\u015f\u0131d\u0131\u011f\u0131, sanat tarihi a\u00e7\u0131s\u0131ndan \u00f6nem ta\u015f\u0131yan m\u00fczelik de\u011ferde olan bu mozaik eserlerin tescile ve tasnife tabi oldu\u011fu, onar\u0131mlar\u0131n\u0131n yap\u0131larak m\u00fczede korunmas\u0131 gerekti\u011fi belirtilmi\u015ftir. <\/p>\n<p>Buna g\u00f6re, yukar\u0131da metni yer alan y\u00f6netmeli\u011fin amac\u0131n\u0131n T\u00fcrkiye Cumhuriyeti s\u0131n\u0131rlar\u0131 i\u00e7inde bulunan ta\u015f\u0131n\u0131r k\u00fclt\u00fcr ve tabiat varl\u0131klar\u0131n\u0131 bulanlara, varl\u0131\u011f\u0131n\u0131 haber verenlere ve bunlar\u0131 yakalayan kamu g\u00f6revlilerine Devlet taraf\u0131ndan ikramiye verilmesini d\u00fczenlemek oldu\u011fu, ta\u015f\u0131nmaz k\u00fclt\u00fcr ve tabiat varl\u0131klar\u0131 i\u00e7in ise ihbar ikramiyesinin \u00f6denmeyece\u011fi belirtilmi\u015ftir. <\/p>\n<p>Bu durumda, Bak\u0131rk\u00f6y 1. A\u011f\u0131r Ceza Mahkemesince yapt\u0131r\u0131lan bilirki\u015fi incelemesi sonucunda d\u00fczenlenen bilirki\u015fi raporunda eserlerin 2863 say\u0131l\u0131 Kanun kapsam\u0131nda tescile ve tasnife tabi m\u00fczelik de\u011ferde mozaik eserler oldu\u011fu belirtilmesi \u00fczerine korunmas\u0131 gerekli ta\u015f\u0131nmaz k\u00fclt\u00fcr ve tabiat varl\u0131\u011f\u0131 oldu\u011fu anla\u015f\u0131lmakla, davac\u0131n\u0131n, s\u00f6z konusu mozaik tablolar\u0131n kurulacak bir komisyon taraf\u0131ndan uluslararas\u0131 rayicinin hesap edilerek bu hesap \u00fczerinden kendisine ikramiye \u00f6denmesi veya eserlerin kendisine iade edilmesi istemiyle yapt\u0131\u011f\u0131 ba\u015fvurunun reddine dair dava konusu i\u015flemde hukuka ayk\u0131r\u0131l\u0131k bulunmad\u0131\u011f\u0131 sonu\u00e7 ve kanaatine var\u0131lm\u0131\u015ft\u0131r.&#8221;<\/p>\n<p>16. Temyiz edilen karar, Dan\u0131\u015ftay Ond\u00f6rd\u00fcnc\u00fc Dairesinin 29\/05\/2013 tarihli ve E.2011\/14561,K.2013\/4111 say\u0131l\u0131 ilam\u0131yla onanm\u0131\u015ft\u0131r. Ba\u015fvurucunun karar d\u00fczeltme istemi de ayn\u0131 Dairenin 18\/6\/2014 tarihli ve E.2013\/10178, K.2014\/6916 say\u0131l\u0131 ilam\u0131yla reddedilmi\u015ftir.<\/p>\n<p>17. Nihai karar, ba\u015fvurucu vekiline 12\/8\/2014 tarihinde tebli\u011f edilmi\u015ftir.<\/p>\n<p>18. Ba\u015fvurucu 26\/8\/2014 tarihinde bireysel ba\u015fvuruda bulunmu\u015ftur.<\/p>\n<p>B. \u0130lgili Hukuk<\/p>\n<p>19. M\u00fclga 1918 say\u0131l\u0131 Kanun\u2019un 27. maddesinin ikinci ve \u00fc\u00e7\u00fcnc\u00fc f\u0131kralar\u0131 \u015f\u00f6yledir: <\/p>\n<p>&#8220;Birinci f\u0131kradaki hal d\u0131\u015f\u0131nda iki veya daha fazla kimselerin toplu olarak ka\u00e7ak\u00e7\u0131l\u0131k yapmalar\u0131 halinde sekiz seneden oniki seneye kadar a\u011f\u0131r hapis cezas\u0131na h\u00fckmolunur.<\/p>\n<p> Birinci ve ikinci f\u0131kralarda h\u00fckmolunacak a\u011f\u0131r hapis cezas\u0131yla beraber tekel maddeleri i\u00e7in CIF de\u011feri ile birlikte hususi kanunlar\u0131ndaki para cezalar\u0131 veya resim tutar\u0131n\u0131n, e\u015fya ka\u00e7ak\u00e7\u0131l\u0131\u011f\u0131 i\u00e7in de g\u00fcmr\u00fcklenmi\u015f de\u011ferinin d\u00f6rt mislinden ve yasak e\u015fya ve maddeler i\u00e7in de bunlar\u0131n de\u011ferinin alt\u0131 mislinden a\u015fa\u011f\u0131 olmamak \u00fczere a\u011f\u0131r para cezas\u0131na h\u00fckmolunur. Ka\u00e7ak e\u015fya ve maddeler de m\u00fcsadere edilir.&#8221;<\/p>\n<p>20. 1918 say\u0131l\u0131 Kanun\u2019un 33. maddesi \u015f\u00f6yledir: <\/p>\n<p> \u201c25,26 ve 27 nci maddelerdeki ka\u00e7ak\u00e7\u0131l\u0131k c\u00fcr\u00fcmlerine veya te\u015fekk\u00fcllerine, faillerinin hal ve s\u0131fatlar\u0131n\u0131 bilerek her ne \u015fekilde olursa olsun yard\u0131m edenler hakk\u0131nda as\u0131l su\u00e7lular\u0131n o maddeler h\u00fckm\u00fcnce g\u00f6recekleri cezalar\u0131n yar\u0131s\u0131 h\u00fckmolunur.<\/p>\n<p> Bu fiillere i\u015ftirak eden memur ise as\u0131l fail gibi ceza g\u00f6r\u00fcr. (Ek: 12\/6\/1979-2248\/27 md.; De\u011fi\u015fik: 26\/7\/1983-2867\/13 md.) Bu Kanunda \u00f6ng\u00f6r\u00fclen su\u00e7lar i\u015flendi\u011fi tarihte giri\u015fte tekel ka\u00e7a\u011f\u0131 maddelerin hususi kanunlar\u0131nda yaz\u0131l\u0131 para cezas\u0131 veya resmi ile CIF de\u011feri toplam\u0131, g\u00fcmr\u00fck ka\u00e7a\u011f\u0131 e\u015fyan\u0131n g\u00fcmr\u00fcklenmi\u015f de\u011feri, bunlar\u0131n \u00e7\u0131k\u0131\u015f\u0131nda ve yerli tekel mallar\u0131nda FOB de\u011feri pek fahi\u015f ise mahkeme fiile mahsus olan cezay\u0131 yar\u0131s\u0131na kadar art\u0131r\u0131r ve e\u011fer hafif ise yar\u0131s\u0131na ve e\u011fer pek hafif ise \u00fc\u00e7te birine kadar eksiltir.E\u011fer fail bu Kanunda yaz\u0131l\u0131 su\u00e7lardan dolay\u0131 m\u00fckerrir ise, cezas\u0131 indirilmez.\u201d<\/p>\n<p>21. 2863 say\u0131l\u0131 Kanun&#8217;un &#8220;Tan\u0131mlar ve k\u0131saltmalar&#8221; kenar ba\u015fl\u0131kl\u0131 3. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Bu Kanunda ge\u00e7en tan\u0131mlar ve k\u0131saltmalar \u015funlard\u0131r:<\/p>\n<p>a) Tan\u0131mlar:<\/p>\n<p>(1) (De\u011fi\u015fik:14\/7\/2004 \u2013 5226\/1 md.)&#8221;K\u00fclt\u00fcr varl\u0131klar\u0131&#8221;; kale, hisar, bur\u00e7, sur, tarihi k\u0131\u015fla, tabya ve isihkamlar ile bunlarda bulunan sabit silahlar; harabeler, kervansaraylar, han, hamam ve medreseler; k\u00fcmbet, t\u00fcrbe ve kitabeler, k\u00f6pr\u00fcler, su kemerleri, su yollar\u0131, sarn\u0131\u00e7 ve kuyular; tarihi yol kal\u0131nt\u0131lar\u0131, mesafe ta\u015flar\u0131, eski s\u0131n\u0131rlar\u0131 belirten delikli ta\u015flar, dikili ta\u015flar; sunaklar, tersaneler, r\u0131ht\u0131mlar; tarihi saraylar, k\u00f6\u015fkler, evler, yal\u0131lar ve konaklar; K\u00fclt\u00fcr varl\u0131\u011f\u0131n\u0131n nakli dolay\u0131s\u0131yla ta\u015f\u0131nmaz\u0131n maliki bir zarara maruz kalm\u0131\u015fsa, K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131nca olu\u015fturulacak bir komisyonun tespit edece\u011fi tazminat zarar g\u00f6rene \u00f6denir.&#8221;<\/p>\n<p>25. 2863 say\u0131l\u0131 Kanun&#8217;un &#8220;Yurt d\u0131\u015f\u0131ndan getirme&#8221; kenar ba\u015fl\u0131kl\u0131 33. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Yurt d\u0131\u015f\u0131ndan k\u00fclt\u00fcr varl\u0131\u011f\u0131 getirmek serbesttir.&#8221;<\/p>\n<p>26. 2863 say\u0131l\u0131 Kanun&#8217;un &#8220;K\u00fclt\u00fcr varl\u0131klar\u0131n\u0131 bulanlara verilecek ikramiye&#8221; kenar ba\u015fl\u0131kl\u0131 64. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;T\u00fcrkiye Cumhuriyeti s\u0131n\u0131rlar\u0131 i\u00e7inde yer \u00fcst\u00fcnde, yer alt\u0131nda ve su alt\u0131nda bulunan ta\u015f\u0131n\u0131r k\u00fclt\u00fcr varl\u0131klar\u0131n\u0131 4 \u00fcnc\u00fc maddede yaz\u0131l\u0131 makam ve mercilere, ayn\u0131 maddede yaz\u0131l\u0131 s\u00fcreler i\u00e7erisinde haber verenlere:<\/p>\n<p> a) Bulunan varl\u0131k, bunlar\u0131n m\u00fclk\u00fc i\u00e7inde ise bu Kanunun 24 \u00fcnc\u00fc ve 25 inci maddeleri uygulan\u0131r. Ayr\u0131ca ikramiye verilmez.<\/p>\n<p> b) Bulunan varl\u0131k ba\u015fkas\u0131n\u0131n m\u00fclk\u00fc i\u00e7inde ise K\u00fclt\u00fcr ve Turizm Bakanl\u0131\u011f\u0131nca varl\u0131\u011f\u0131n de\u011feri dikkate al\u0131narak, takdir olunacak bedelin % 80&#8217;i ikramiye olarak bulan ile m\u00fclk sahibi aras\u0131nda yar\u0131 yar\u0131ya payla\u015ft\u0131r\u0131l\u0131r.<\/p>\n<p> c) K\u00fclt\u00fcr varl\u0131\u011f\u0131 Devlete ait arazide bulunmu\u015f ise, takdir olunacak bedelin % 40&#8217;\u0131 bulana ikramiye olarak verilir.<\/p>\n<p> d) Nerede bulunursa bulunsun haber verilen k\u00fclt\u00fcr varl\u0131\u011f\u0131 korunmas\u0131 gerekli nitelikte olmad\u0131\u011f\u0131 takdirde haber verenlere bu Kanunun 25 inci maddesindeki i\u015flem uygulan\u0131r. Ayr\u0131ca ikramiye verilmez.<\/p>\n<p> e) Nerede olursa olsun yeni bulunup da 4 \u00fcnc\u00fc maddede yaz\u0131l\u0131 s\u00fcreler i\u00e7inde haber verilmedi\u011finden dolay\u0131 gizlenmi\u015f say\u0131lan k\u00fclt\u00fcr varl\u0131klar\u0131n\u0131 haber verenler ile, bunlar\u0131 yakalayan kamu g\u00f6revlilerine, 1905 say\u0131l\u0131 &#8220;Menkul ve Gayrimenkul Emval ile Bunlar\u0131n \u0130ntifa Haklar\u0131n\u0131n ve Daimi Vergilerin Mektumlar\u0131n\u0131 Haber verenlere Verilecek \u0130kramiyelere Dair Kanun&#8221;da ta\u015f\u0131n\u0131r mallar i\u00e7in g\u00f6sterilen oranlar dahilinde tespit edilen bedel ikramiye olarak verilir.<\/p>\n<p> f) Yukar\u0131daki f\u0131kralardan herhangi biri uyar\u0131nca k\u00fclt\u00fcr varl\u0131klar\u0131n\u0131 bulan, haber veren veya yakalayan ki\u015filer birden fazla ise verilecek ikramiyeler bunlar aras\u0131nda e\u015fit olarak payla\u015ft\u0131r\u0131l\u0131r. <\/p>\n<p> g) Yukarda belirtilen ikramiyelerin tahakkuk ve tediyesine ait i\u015flemler Maliye ve K\u00fclt\u00fcr ve Turizm bakanl\u0131klar\u0131nca birlikte haz\u0131rlanacak y\u00f6netmelik esaslar\u0131na g\u00f6re yap\u0131l\u0131r.&#8221;<\/p>\n<p>27. 2863 say\u0131l\u0131 Kanun&#8217;un &#8220;Cezalar&#8221; kenar ba\u015fl\u0131kl\u0131 65. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Tescil edilen sit alanlar\u0131 ve korunmas\u0131 gerekli ta\u015f\u0131nmaz k\u00fclt\u00fcr ve tabiat varl\u0131klar\u0131 ile korunma alanlar\u0131n\u0131n bu Kanuna g\u00f6re tebli\u011f veya ilan edilmi\u015f olmas\u0131na ra\u011fmen y\u0131k\u0131lmas\u0131na, bozulmas\u0131na, tahribine, yok olmas\u0131na veya her ne suretle olursa olsun zarar g\u00f6rmesine kasten sebebiyet verenler ile koruma b\u00f6lge kurullar\u0131ndan izin al\u0131nmaks\u0131z\u0131n in\u015fa\u00ee ve fiziki m\u00fcdahale yapanlar veya yapt\u0131ranlar, iki y\u0131ldan be\u015f y\u0131la kadar hapis ve be\u015f bin g\u00fcne kadar adli para cezas\u0131yla cezaland\u0131r\u0131l\u0131r.<\/p>\n<p>Bu Kanuna ayk\u0131r\u0131 olarak y\u0131kma veya imar izni verenler, iki y\u0131ldan be\u015f y\u0131la kadar hapis ve be\u015f bin g\u00fcne kadar adli para cezas\u0131yla cezaland\u0131r\u0131l\u0131r.<\/p>\n<p>Birinci ve ikinci f\u0131kralarda belirtilen fiiller, korunmas\u0131 gerekli k\u00fclt\u00fcr ve tabiat varl\u0131\u011f\u0131n\u0131 yurt d\u0131\u015f\u0131na ka\u00e7\u0131rmak amac\u0131yla i\u015flenmi\u015f ise verilecek cezalar bir kat art\u0131r\u0131l\u0131r.<\/p>\n<p>B\u00fcnyesinde koruma, uygulama ve denetim b\u00fcrolar\u0131 kurulan idarelerden 57 nci maddenin yedinci f\u0131kras\u0131 uyar\u0131nca izin almaks\u0131z\u0131n veya izne ayk\u0131r\u0131 olarak tamirat ve tadilat yapanlar ile izinsiz in\u015fa\u00ee ve fiziki m\u00fcdahale yapanlar veya yapt\u0131ranlar alt\u0131 aydan \u00fc\u00e7 y\u0131la kadar hapis veya adli para cezas\u0131 ile cezaland\u0131r\u0131l\u0131rlar.&#8221; <\/p>\n<p>28. 2863 say\u0131l\u0131 Kanun&#8217;un 75. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Bu Kanun kapsam\u0131nda kalan su\u00e7lar nedeniyle elkonulan ta\u015f\u0131n\u0131r k\u00fclt\u00fcr ve tabiat varl\u0131klar\u0131 m\u00fczeye teslim edilir.&#8221;<\/p>\n<p>IV. \u0130NCELEME VE GEREK\u00c7E<\/p>\n<p>29. Mahkemenin 15\/2\/2017 tarihinde yapm\u0131\u015f oldu\u011fu toplant\u0131da ba\u015fvuru incelenip gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. Ba\u015fvurucunun \u0130ddialar\u0131<\/p>\n<p>30. Ba\u015fvurucu yurt d\u0131\u015f\u0131ndan bedelini \u00f6deyerek sat\u0131n ald\u0131\u011f\u0131 mozaik tablolara havaalan\u0131 g\u00fcmr\u00fc\u011f\u00fcnde el konuldu\u011funu ve g\u00fcmr\u00fck ka\u00e7ak\u00e7\u0131l\u0131\u011f\u0131 su\u00e7undan hakk\u0131nda ceza davas\u0131 a\u00e7\u0131ld\u0131\u011f\u0131n\u0131 ancak yap\u0131lan yarg\u0131lama neticesinde bu su\u00e7tan beraat etti\u011fini, buna ra\u011fmen s\u00f6z konusu mozaiklerin \u0130dare taraf\u0131ndan m\u00fczede tutulmakta oldu\u011funu, bu mozaiklerin iade edilmesi veya en az\u0131ndan ikramiye \u00f6denmesi istemiyle idari yarg\u0131 yerinde a\u00e7t\u0131\u011f\u0131 davadan da bir sonu\u00e7 alamad\u0131\u011f\u0131n\u0131 belirterek sat\u0131n ald\u0131\u011f\u0131 tablolar\u0131n \u0130darece bedeli \u00f6denmeden el konulmas\u0131 nedeniyle m\u00fclkiyet ve adil yarg\u0131lanma haklar\u0131n\u0131n ihlal edildi\u011fini ileri s\u00fcrm\u00fc\u015f; kendisi hakk\u0131nda adli yard\u0131m karar\u0131 verilmesi, ihlallerin tespiti ve 30.000 TL avukatl\u0131k \u00fccreti ile 20.000.000 TL tazminat talebinde bulunmu\u015ftur.<\/p>\n<p>B. De\u011ferlendirme<\/p>\n<p>31. Ba\u015fvurucu, ba\u015fvuru harc\u0131n\u0131 yat\u0131ramayaca\u011f\u0131n\u0131 belirterek adli yard\u0131m talebinde bulunmu\u015f ise de ba\u015fvuru harc\u0131n\u0131 yat\u0131rd\u0131\u011f\u0131n\u0131n anla\u015f\u0131lmas\u0131 sebebiyle bu konuda bir karar vermeye gerek g\u00f6r\u00fclmemi\u015ftir.<\/p>\n<p>32. Anayasa Mahkemesi, olaylar\u0131n ba\u015fvurucu taraf\u0131ndan yap\u0131lan hukuki nitelendirmesi ile ba\u011fl\u0131 olmay\u0131p olay ve olgular\u0131n hukuki tavsifini kendisi takdir eder (Tahir Canan, B. No: 2012\/969, 18\/9\/2013, \u00a7 16). <\/p>\n<p>33. Ba\u015fvurucu adil yarg\u0131lanma hakk\u0131n\u0131n da ihlal edildi\u011fini ileri s\u00fcrmekte ise de ba\u015fvurucunun \u015fik\u00e2yetlerinin, yurt d\u0131\u015f\u0131ndan sat\u0131n ald\u0131\u011f\u0131 mozaik tablolar\u0131na el konulmas\u0131 ve bir m\u00fcsadere karar\u0131 bulunmamas\u0131na ra\u011fmen bu tablolar\u0131n iade edilmeyip herhangi bir tazminat da \u00f6denmemesi nedeniyle m\u00fclkten yoksun b\u0131rakmaya ili\u015fkin olup bu nedenle ba\u015fvurucunun b\u00fct\u00fcn \u015fik\u00e2yetlerinin m\u00fclkiyet hakk\u0131n\u0131n ihlali iddias\u0131 kapsam\u0131nda incelenmesi gerekti\u011fi de\u011ferlendirilmi\u015ftir.<\/p>\n<p>1. Kabul Edilebilirlik Y\u00f6n\u00fcnden<\/p>\n<p>34. A\u00e7\u0131k\u00e7a dayanaktan yoksun olmad\u0131\u011f\u0131 ve kabul edilemezli\u011fine karar verilmesini gerektirecek ba\u015fka bir nedeni de bulunmad\u0131\u011f\u0131 anla\u015f\u0131lan m\u00fclkiyet hakk\u0131n\u0131n ihlal edildi\u011fine ili\u015fkin iddian\u0131n kabul edilebilir oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>2. Esas Y\u00f6n\u00fcnden<\/p>\n<p>35. Ba\u015fvurucu Kuveyt&#8217;te ya\u015fad\u0131\u011f\u0131 d\u00f6nemde sat\u0131n ald\u0131\u011f\u0131 mozaik tablolar\u0131na havaalan\u0131 g\u00fcmr\u00fc\u011f\u00fcnde el konuldu\u011funu, hakk\u0131nda g\u00fcmr\u00fck ka\u00e7ak\u00e7\u0131l\u0131\u011f\u0131 su\u00e7undan ceza davas\u0131 a\u00e7\u0131ld\u0131\u011f\u0131n\u0131, hatta bir s\u00fcre bu su\u00e7 nedeniyle tutuklu kald\u0131\u011f\u0131n\u0131 ancak bu ceza davas\u0131nda beraatine h\u00fckmedildi\u011fini, mozaiklerin ise bir m\u00fczede tutulmaya devam edildi\u011fini, tarihi eser olmakla birlikte \u00f6zel m\u00fclk\u00fc olan ve faturas\u0131 bulunan s\u00f6z konusu e\u015fyan\u0131n yurda sokulmas\u0131n\u0131n su\u00e7 olmad\u0131\u011f\u0131n\u0131, ceza mahkemelerince verilmi\u015f m\u00fcsadere karar\u0131 da bulunmad\u0131\u011f\u0131 h\u00e2lde g\u00fcmr\u00fck vergisini \u00f6dedi\u011fi mallar\u0131n\u0131n bedelsiz devletle\u015ftirilerek m\u00fczeye al\u0131nd\u0131\u011f\u0131n\u0131, bu mozaik tablolar\u0131n iade edilmesi veya en az\u0131ndan bir ikramiye \u00f6denmesine ili\u015fkin idari ve yarg\u0131sal s\u00fcre\u00e7lerden de bir sonu\u00e7 alamad\u0131\u011f\u0131n\u0131 belirterek m\u00fclkiyet hakk\u0131n\u0131n ihlal edildi\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr.<\/p>\n<p>36. Anayasa&#8217;n\u0131n &#8220;M\u00fclkiyet hakk\u0131&#8221; kenar ba\u015fl\u0131kl\u0131 35. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Herkes, m\u00fclkiyet ve miras haklar\u0131na sahiptir.<\/p>\n<p>Bu haklar, ancak kamu yarar\u0131 amac\u0131yla, kanunla s\u0131n\u0131rlanabilir. <\/p>\n<p>M\u00fclkiyet hakk\u0131n\u0131n kullan\u0131lmas\u0131 toplum yarar\u0131na ayk\u0131r\u0131 olamaz.&#8221; <\/p>\n<p>37. Somut olayda \u00e7\u00f6z\u00fcmlenmesi gereken ilk mesele \u201cm\u00fclkiyet hakk\u0131na\u201d y\u00f6nelik bir m\u00fcdahale bulunup bulunmad\u0131\u011f\u0131n\u0131 belirlemektir. Sonraki a\u015famalarda varl\u0131\u011f\u0131 kabul edilen m\u00fcdahalenin kanuni dayana\u011f\u0131 olup olmad\u0131\u011f\u0131, me\u015fru ama\u00e7lara dayan\u0131p dayanmad\u0131\u011f\u0131, m\u00fcdahalenin amac\u0131 ve kullan\u0131lan ara\u00e7lar ile ba\u015fvurucuya y\u00fcklenen k\u00fclfetin \u00f6l\u00e7\u00fcl\u00fc olup olmad\u0131\u011f\u0131 hususlar\u0131n\u0131n tespit edilmesi gerekir.<\/p>\n<p>a. M\u00fclk\u00fcn Varl\u0131\u011f\u0131<\/p>\n<p>38. Anayasa&#8217;n\u0131n 35. maddesi kapsam\u0131ndaki m\u00fclkiyet hakk\u0131n\u0131n ihlal edildi\u011fini ileri s\u00fcren ba\u015fvurucu, b\u00f6yle bir hakk\u0131n varl\u0131\u011f\u0131n\u0131 kan\u0131tlamak zorundad\u0131r. Bu nedenle \u00f6ncelikle ba\u015fvurucunun, Anayasa&#8217;n\u0131n 35. maddesi uyar\u0131nca korunmay\u0131 gerektiren m\u00fclkiyete ili\u015fkin bir menfaate sahip olup olmad\u0131\u011f\u0131 noktas\u0131ndaki hukuki durumunun de\u011ferlendirilmesi gerekir (Cemile \u00dcnl\u00fc, B. No. 2013\/382, 16\/4\/2013, \u00a7 26).<\/p>\n<p>39. Anayasa ve Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi&#8217;nin (S\u00f6zle\u015fme) ortak koruma alan\u0131nda yer alan m\u00fclkiyet hakk\u0131; mevcut mal, m\u00fclk ve varl\u0131klar\u0131 koruyan bir g\u00fcvencedir. Bir ki\u015finin h\u00e2lihaz\u0131rda sahibi olmad\u0131\u011f\u0131 bir m\u00fclk\u00fcn m\u00fclkiyetini kazanma hakk\u0131, ki\u015finin bu konudaki menfaati ne kadar g\u00fc\u00e7l\u00fc olursa olsun Anayasa ve S\u00f6zle\u015fme&#8217;yle korunan m\u00fclkiyet kavram\u0131 i\u00e7inde de\u011fildir. Bu hususun istisnas\u0131 olarak belli durumlarda bir &#8220;ekonomik de\u011fer&#8221; veya icras\u0131 m\u00fcmk\u00fcn bir &#8220;alaca\u011f\u0131&#8221; elde etmeye y\u00f6nelik &#8220;me\u015fru bir beklenti&#8221; Anayasa ve S\u00f6zle\u015fme&#8217;nin ortak koruma alan\u0131nda yer alan m\u00fclkiyet hakk\u0131 g\u00fcvencesinden yararlanabilir(Kemal Yeler ve Ali Arslan \u00c7elebi, B. No: 2012\/636, 15\/4\/2014, \u00a7\u00a7 36, 37). <\/p>\n<p>40. Somut olayda ba\u015fvurucu el konulan mozaik tablolar\u0131 Kuveyt&#8217;te ya\u015fad\u0131\u011f\u0131 d\u00f6nemde sat\u0131n ald\u0131\u011f\u0131n\u0131 beyan etmektedir. Bak\u0131rk\u00f6y Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131n\u0131n 11\/12\/2000 tarihli iddianamesinde de ba\u015fvurucunun uzun y\u0131llar i\u015f\u00e7i olarak \u00e7al\u0131\u015ft\u0131\u011f\u0131 Kuveyt&#8217;te bu \u00fclke vatanda\u015f\u0131 bir \u015fah\u0131stan 80.000 ABD dolar\u0131 kar\u015f\u0131l\u0131\u011f\u0131nda d\u00f6rt adet mozaik tabloyu sat\u0131n ald\u0131\u011f\u0131 ve bu tablolar\u0131n yurda sokulmaya \u00e7al\u0131\u015f\u0131l\u0131rken g\u00fcmr\u00fck ambar\u0131na al\u0131nd\u0131\u011f\u0131 belirtilmektedir. <\/p>\n<p>41. Ba\u015fvuru konusu olayda yarg\u0131sal makamlar\u0131n tespitlerine g\u00f6re ba\u015fvurucu uyu\u015fmazl\u0131\u011fa konu k\u00fclt\u00fcr varl\u0131klar\u0131n\u0131 yurt d\u0131\u015f\u0131nda edinerek yurda getirmi\u015ftir. Ba\u015fvurucunun kar\u015f\u0131l\u0131\u011f\u0131nda parasal bir bedel \u00f6dedi\u011fi de dikkate al\u0131nd\u0131\u011f\u0131nda bu eski eserlerin &#8220;ekonomik bir de\u011fer&#8221; ifade etti\u011fi ve dolay\u0131s\u0131yla somut olay bak\u0131m\u0131ndan ba\u015fvurucunun Anayasa\u2019n\u0131n 35. maddesi kapsam\u0131nda korunmas\u0131 gereken bir menfaatinin mevcut oldu\u011fu kanaatine var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>b. M\u00fcdahalenin Varl\u0131\u011f\u0131 ve T\u00fcr\u00fc<\/p>\n<p>42. Anayasa\u2019n\u0131n 35. maddesi ve S\u00f6zle\u015fme\u2019ye ek (1) No.lu Protokol\u2019\u00fcn 1. maddesi benzer d\u00fczenlemelerle m\u00fclkiyet hakk\u0131na yer vermi\u015ftir. Her iki d\u00fczenleme de \u00fc\u00e7 kural ihtiva etmektedir. S\u00f6zle\u015fme\u2019nin ilk c\u00fcmlesi herkese m\u00fclk\u00fcnden bar\u0131\u015f\u00e7\u0131l yararlanma hakk\u0131 verirken Anayasa daha geni\u015f manada m\u00fclkiyet hakk\u0131n\u0131 tan\u0131maktad\u0131r. D\u00fczenlemelerin ikinci c\u00fcmleleri ise ki\u015filerin hangi ko\u015fullarda m\u00fclk\u00fcnden yoksun b\u0131rak\u0131labilece\u011fini ya da ki\u015filere ait m\u00fclkiyetin hangi ko\u015fullarla s\u0131n\u0131rland\u0131r\u0131labilece\u011fini h\u00fck\u00fcm alt\u0131na almaktad\u0131r (Necmiye \u00c7ift\u00e7i ve di\u011ferleri, B. No: 2013\/1301, 30\/12\/2014, \u00a7 45). <\/p>\n<p>43. Her iki d\u00fczenlemenin \u00fc\u00e7\u00fcnc\u00fc c\u00fcmleleri ise m\u00fclkiyetin kullan\u0131m\u0131n\u0131n kontrol\u00fc ya da d\u00fczenlenmesine ili\u015fkindir. Anayasa\u2019n\u0131n 35. maddesinin son f\u0131kras\u0131 m\u00fclkiyet hakk\u0131n\u0131n kullan\u0131m\u0131n\u0131n toplum yarar\u0131na ayk\u0131r\u0131 olamayaca\u011f\u0131 \u015feklinde hakk\u0131n kullan\u0131m\u0131na ili\u015fkin genel bir ilkeye yer verirken S\u00f6zle\u015fme\u2019ye ek (1) No.lu Protokol&#8217;\u00fcn 1. maddesinin ikinci f\u0131kras\u0131 devletlere m\u00fclkiyeti kamu yarar\u0131 amac\u0131yla d\u00fczenleme, vergiler ve di\u011fer katk\u0131lar ile cezalar\u0131n tahsili konusunda gerekli g\u00f6rd\u00fckleri yasalar\u0131 uygulama konusundaki haklar\u0131n\u0131 sakl\u0131 tutarak taraf devletlerin genel yarara uygun olarak \u201cm\u00fclkiyetin kullan\u0131m\u0131n\u0131 kontrol\u201d yetkisine sahip oldu\u011funu kabul etmektedir. Bununla beraber Anayasa\u2019n\u0131n bir\u00e7ok maddesi ilgili oldu\u011fu hususta devlete m\u00fclkiyetin kullan\u0131m\u0131n\u0131n kontrol\u00fc ya da m\u00fclkiyeti d\u00fczenleme yetkisi vermektedir (Necmiye \u00c7ift\u00e7i ve di\u011ferleri, \u00a7 46). <\/p>\n<p>44. Avrupa \u0130nsan Haklar\u0131 Mahkemesi&#8217;ne (A\u0130HM) g\u00f6re ikinci ve \u00fc\u00e7\u00fcnc\u00fc kurallar, m\u00fclkiyetten bar\u0131\u015f\u00e7\u0131l yararlanma ilkesi \u015feklinde ifade edilen birinci kural\u0131n \u00f6zel g\u00f6r\u00fcn\u00fcm \u015fekilleridir ve bu nedenle genel nitelikli birinci kural\u0131n \u0131\u015f\u0131\u011f\u0131 alt\u0131nda anla\u015f\u0131lmalar\u0131 gerekmektedir (James ve di\u011ferleri\/Birle\u015fik Krall\u0131k [GK], B. No: 8793\/79, 21\/2\/1986, \u00a7 37). <\/p>\n<p>45. A\u0130HM&#8217;in, idari bir i\u015flem veya ceza yarg\u0131lamas\u0131 neticesine ba\u011fl\u0131 olup olmad\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n bir yapt\u0131r\u0131m olarak m\u00fclkiyetin kamuya ge\u00e7irilmesi sonucuna yol a\u00e7an m\u00fcdahalelere ili\u015fkin genel yakla\u015f\u0131m\u0131; bu yapt\u0131r\u0131m\u0131n, m\u00fclkten yoksun b\u0131rakmay\u0131 i\u00e7erse dahi S\u00f6zle\u015fme&#8217;ye ek (1) No.lu Protokol&#8217;\u00fcn 1. maddesinin ikinci paragraf\u0131 kapsam\u0131nda &#8220;m\u00fclkiyetin kullan\u0131m\u0131n\u0131n kontrol\u00fc&#8221; olarak de\u011ferlendirilmesi gerekti\u011fi y\u00f6n\u00fcndedir (Milosavljev\/S\u0131rbistan, B. No: 15112\/07, 12\/6\/2012, \u00a7 53; Frizen\/Rusya, B. No: 58524\/00, 24\/3\/2005, \u00a7 31; Veits\/Estonya, B. No: 12951\/11, 15\/1\/2015, \u00a7 70 ve AGOSI\/Birle\u015fik Krall\u0131k, B. No: 9118\/80, 24\/10\/1986, \u00a7 51). <\/p>\n<p>46. Ba\u015fvuru konusu olayda, ba\u015fvurucunun yurt d\u0131\u015f\u0131nda sat\u0131n alarak yurda getirdi\u011fi mozaik tablolara el konularak tablolar m\u00fczeye emanet edilmi\u015f, ba\u015fvurucu hakk\u0131nda ka\u00e7ak\u00e7\u0131l\u0131k ve 2863 say\u0131l\u0131 Kanun&#8217;a muhalefet su\u00e7lar\u0131ndan kamu davalar\u0131 a\u00e7\u0131lm\u0131\u015ft\u0131r. Ka\u00e7ak\u00e7\u0131l\u0131k su\u00e7undan a\u00e7\u0131lan kamu davas\u0131nda Bak\u0131rk\u00f6y 1. A\u011f\u0131r Ceza Mahkemesinin 2\/3\/2007 tarihli karar\u0131 ile ba\u015fvurucunun beraatine ve eserlerin m\u00fcsadere edilmesine h\u00fckmedilmi\u015f ancak h\u00fckm\u00fcn temyiz edilmesi \u00fczerine Yarg\u0131tay 7. Ceza Dairesinin 26\/5\/2008 tarihli ilam\u0131yla zamana\u015f\u0131m\u0131 nedeniyle davan\u0131n ortadan kald\u0131r\u0131lmas\u0131na ve davaya konu eski eserlerin m\u00fczeye verilmesine karar verilmi\u015ftir. 2863 say\u0131l\u0131 Kanun&#8217;a muhalefet su\u00e7undan a\u00e7\u0131lan kamu davas\u0131nda ise \u015ei\u015fli 7. Asliye Ceza Mahkemesinin 7\/4\/2006 tarihli karar\u0131 ile ba\u015fvurucunun beraatine karar verilmi\u015f, Hazine vekilinin temyiz istemi ise Yarg\u0131tay 7. Ceza Dairesinin 29\/6\/2009 tarihli ilam\u0131yla reddedilmi\u015ftir. M\u00fczeye verilmesine karar verilen s\u00f6z konusu mozaik tablolar m\u00fczede tutulmaya devam edilmekte olup bu tablolar\u0131n iadesi veya ikramiye \u00f6denmesi istemiyle ba\u015fvurucunun a\u00e7t\u0131\u011f\u0131 dava ise Ankara 8. \u0130dare Mahkemesinin 16\/12\/2010 tarihli karar\u0131 ile reddedilmi\u015ftir. Bu nedenle ba\u015fvurucunun m\u00fclkiyet hakk\u0131na yap\u0131lan m\u00fcdahaleyi belirleyebilmek i\u00e7in ceza yarg\u0131lamas\u0131nda verilen &#8220;m\u00fczeye verilme&#8221; karar\u0131n\u0131n hukuki niteli\u011finin ortaya konulmas\u0131 zorunludur.<\/p>\n<p>47. 2863 say\u0131l\u0131 Kanun&#8217;un 75. maddesinin birinci f\u0131kras\u0131na g\u00f6re bu Kanun kapsam\u0131nda kalan su\u00e7lar nedeniyle el konulan ta\u015f\u0131n\u0131r k\u00fclt\u00fcr ve tabiat varl\u0131klar\u0131 m\u00fczeye teslim edilir. Hemen belirtmek gerekir ki ta\u015f\u0131nmaz k\u00fclt\u00fcr ve tabiat varl\u0131klar\u0131 y\u00f6n\u00fcnden an\u0131lan Kanun&#8217;da b\u00f6yle bir h\u00fckme yer verilmemi\u015ftir. Dan\u0131\u015ftay i\u00e7tihatlar\u0131nda ceza yarg\u0131lamas\u0131nda verilen &#8220;m\u00fczeye verilme veya teslim edilme&#8221; kararlar\u0131n\u0131n iki ayr\u0131 boyutunun oldu\u011fu kabul edilmektedir. Buna g\u00f6re su\u00e7a konu olmas\u0131 nedeniyle el konulan e\u015fyan\u0131n ceza mahkemesince korunmas\u0131 gerekli ta\u015f\u0131n\u0131r k\u00fclt\u00fcr varl\u0131\u011f\u0131 niteli\u011fi ta\u015f\u0131d\u0131\u011f\u0131ndan dolay\u0131 m\u00fczeye teslimine karar verilmesi h\u00e2linde idari yoldan s\u00f6z konusu e\u015fyalar hakk\u0131nda de\u011ferlendirme yap\u0131lmas\u0131na olanak bulunmad\u0131\u011f\u0131 kabul edilmi\u015ftir (Dan\u0131\u015ftay Alt\u0131nc\u0131 Dairesinin 3\/11\/2008 tarihli ve E.2007\/6892, K.2008\/7327 say\u0131l\u0131 karar\u0131). Di\u011fer bir deyi\u015fle yarg\u0131 karar\u0131 uyar\u0131nca su\u00e7a konu oldu\u011fu tespit edilen korunmas\u0131 gerekli k\u00fclt\u00fcr varl\u0131klar\u0131 hakk\u0131nda 2863 say\u0131l\u0131 Kanun h\u00fck\u00fcmlerine g\u00f6re &#8220;m\u00fczeye al\u0131nma i\u015flemi&#8221; \u00e7er\u00e7evesinde idari yoldan ayr\u0131ca bir de\u011ferlendirme ve uygulama yap\u0131lmas\u0131 m\u00fcmk\u00fcn bulunmamaktad\u0131r. \u00d6te yandan ceza mahkemesince su\u00e7a konu oldu\u011fu tespit edilmeyen e\u015fyalar\u0131n m\u00fczeye teslimine karar verilmesi durumunda 2863 say\u0131l\u0131 Kanun&#8217;un 23. ve 25. maddeleri ile Korunmas\u0131 Gerekli K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131n Tasnifi, Tescili ve M\u00fczeye Al\u0131nmalar\u0131 Hakk\u0131ndaki Y\u00f6netmelik h\u00fck\u00fcmleri uyar\u0131nca i\u015flem yap\u0131lmak \u00fczere idari yoldan &#8220;m\u00fczeye al\u0131nma&#8221; i\u015flemi \u00e7er\u00e7evesinde uygulama yap\u0131lmas\u0131 gerekmektedir (Dan\u0131\u015ftay Ond\u00f6rd\u00fcnc\u00fc Dairesinin 25\/4\/2013 tarihli ve E.2011\/13958, K.2013\/3192 say\u0131l\u0131 karar\u0131). B\u00f6yle bir durumda ise 2863 say\u0131l\u0131 Kanun&#8217;un 23. ve devam\u0131 maddeleri ile an\u0131lan Y\u00f6netmelik h\u00fck\u00fcmlerine g\u00f6re m\u00fcze idarelerine getirilen varl\u0131klar\u0131n k\u00fclt\u00fcr varl\u0131\u011f\u0131 olup olmad\u0131klar\u0131n\u0131n tespitinin yap\u0131larak k\u00fclt\u00fcr ve tabiat varl\u0131\u011f\u0131 oldu\u011funa karar verilenlerin m\u00fczeye al\u0131narak tescillerinin yap\u0131lmas\u0131; k\u00fclt\u00fcr varl\u0131\u011f\u0131 olmayan eserlerin ise ilgililere iadesine karar verilmesi ve karar\u0131n ilgililerine bildirilmesi gerekmektedir. <\/p>\n<p>48. Somut olayda ise ba\u015fvurucunun yurt d\u0131\u015f\u0131nda sat\u0131n alarak yurda getirdi\u011fi mozaik tablolara ceza soru\u015fturmas\u0131 kapsam\u0131nda el konulmu\u015f ve yap\u0131lan ceza yarg\u0131lamas\u0131 neticesinde de ta\u015f\u0131nmaz k\u00fclt\u00fcr varl\u0131\u011f\u0131 olmas\u0131na kar\u015f\u0131n bu tablolar\u0131n korunmas\u0131 gerekli eski eser niteli\u011finde olduklar\u0131 gerek\u00e7esiyle &#8220;m\u00fczeye verilmesine&#8221; karar verilmi\u015ftir. Bu durumda, s\u00f6z konusu tablolar\u0131n bu \u015fekilde m\u00fczede tutulmalar\u0131n\u0131n, Anayasa\u2019n\u0131n 35. maddesi anlam\u0131nda m\u00fclkiyet hakk\u0131na m\u00fcdahale olu\u015fturdu\u011fu a\u00e7\u0131k olup ba\u015fvurunun m\u00fclkiyetin kullan\u0131m\u0131n\u0131n d\u00fczenlenmesine veya kontrol\u00fcne ili\u015fkin \u00fc\u00e7\u00fcnc\u00fc kural \u00e7er\u00e7evesinde incelenmesi gerekir.<\/p>\n<p>c. M\u00fcdahalenin \u0130hlal Olu\u015fturup Olu\u015fturmad\u0131\u011f\u0131<\/p>\n<p>i. Kanunilik <\/p>\n<p>49. Anayasa ve S\u00f6zle\u015fme\u2019de yer alan ve yukar\u0131da yer verilen \u00fc\u00e7\u00fcnc\u00fc kurallar devlete, m\u00fclkiyetin kullan\u0131m\u0131 veya m\u00fclkiyetten yararlanma hakk\u0131n\u0131 kontrol etme ve bu konuda d\u00fczenleme yetkisi vermektedir. M\u00fclkiyetten yoksun b\u0131rakmaya g\u00f6re daha geni\u015f takdir yetkisi veren d\u00fczenleme veya kontrol yetkisinin kullan\u0131m\u0131nda da yasall\u0131k, me\u015fruluk ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkelerinin gereklerinin kar\u015f\u0131lanmas\u0131 kural olarak aranmaktad\u0131r. Buna g\u00f6re m\u00fclkiyet hakk\u0131n\u0131n d\u00fczenlenmesi veya kontrol\u00fc yetkisi de kamu yarar\u0131 amac\u0131yla ve kanunla kullan\u0131lmal\u0131d\u0131r (Orhan Y\u00fcksel [GK], B.No: 2013\/604, 10\/12\/2015, \u00a7\u00a7 57, 58).<\/p>\n<p>50. M\u00fclkiyet hakk\u0131na y\u00f6nelik m\u00fcdahalelerde ilk incelenmesi gereken \u00f6l\u00e7\u00fct hukuka dayal\u0131 olma \u00f6l\u00e7\u00fct\u00fcd\u00fcr. Bu \u00f6l\u00e7\u00fct\u00fcn sa\u011flanmad\u0131\u011f\u0131 tespit edildi\u011finde di\u011fer \u00f6l\u00e7\u00fctler bak\u0131m\u0131ndan inceleme yap\u0131lmaks\u0131z\u0131n m\u00fclkiyet hakk\u0131n\u0131n ihlal edildi\u011fi sonucuna var\u0131lacakt\u0131r. M\u00fcdahalenin hukuka dayal\u0131 olmas\u0131, i\u00e7 hukukta m\u00fcdahaleye ili\u015fkin yeterince ula\u015f\u0131labilir ve \u00f6ng\u00f6r\u00fclebilir kurallar\u0131n bulunmas\u0131n\u0131 gerektirmektedir (T\u00fcrkiye \u0130\u015f Bankas\u0131 A.\u015e. [GK], \u00a7 44).<\/p>\n<p>51. Somut olayda Bak\u0131rk\u00f6y 1. A\u011f\u0131r Ceza Mahkemesinde yap\u0131lan yarg\u0131lama neticesinde ba\u015fvurucular\u0131n beraatine karar verilmekle birlikte ba\u015fvuruya konu e\u015fyalar m\u00fcsadere edilmi\u015ftir. Ancak bu karar\u0131n temyizi \u00fczerine, Yarg\u0131tay 7. Ceza Dairesinin 26\/5\/2008 tarihli karar\u0131yla davan\u0131n zamana\u015f\u0131m\u0131 nedeniyle ortadan kald\u0131r\u0131lmas\u0131na ve bu e\u015fyalar\u0131n da &#8220;korunmas\u0131 gereken k\u00fclt\u00fcr varl\u0131klar\u0131ndan&#8221; olduklar\u0131 gerek\u00e7esiyle &#8220;m\u00fczeye verilmesine&#8221; karar verilmi\u015ftir. \u00d6te yandan, bu e\u015fyalar\u0131n iadesi veya tazminat istemiyle ba\u015fvurulan idari ve yarg\u0131sal s\u00fcre\u00e7te Ankara 8. \u0130dare Mahkemesince, ancak ta\u015f\u0131n\u0131r k\u00fclt\u00fcr varl\u0131klar\u0131 y\u00f6n\u00fcnden ikramiye verilmesinin \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc gerek\u00e7esiyle ba\u015fvurucunun talebi reddedilmi\u015ftir.<\/p>\n<p>52. Anayasa Mahkemesinin hukuk kurallar\u0131n\u0131n uygulanmas\u0131na y\u00f6nelik \u015fik\u00e2yetleri bak\u0131m\u0131ndan g\u00f6revi, bireysel ba\u015fvurunun ikincillik do\u011fas\u0131 gere\u011fi s\u0131n\u0131rl\u0131 olup bireysel ba\u015fvuru kapsam\u0131ndaki hak ve \u00f6zg\u00fcrl\u00fcklere m\u00fcdahale te\u015fkil eden, bariz takdir hatas\u0131 veya a\u00e7\u0131k keyf\u00eelik i\u00e7eren durumlar d\u0131\u015f\u0131nda derece mahkemelerinin hukuk kurallar\u0131n\u0131 uygulama ve yorumlama bak\u0131m\u0131ndan takdir yetkisine kar\u0131\u015famayaca\u011f\u0131 daha \u00f6nceki kararlarda da a\u00e7\u0131klanm\u0131\u015ft\u0131r (Ahmet Sa\u011flam, B. No: 2013\/3351, 18\/9\/2013, \u00a7 42). Somut olayda da m\u00fcdahalenin niteli\u011fini dikkate alan Anayasa Mahkemesi, hukukun uygulanmas\u0131na dair kamusal makamlar\u0131n yakla\u015f\u0131m\u0131n\u0131n Anayasa&#8217;n\u0131n 35. maddesindeki gereklilikleri kar\u015f\u0131lay\u0131p kar\u015f\u0131lamad\u0131\u011f\u0131 konusunda m\u00fcdahalenin takip edilen me\u015fru amac\u0131 ger\u00e7ekle\u015ftirmede ba\u015far\u0131l\u0131 olup olmad\u0131\u011f\u0131n\u0131 sorgulayarak sonuca varacakt\u0131r (Benzer y\u00f6ndeki A\u0130HM karar\u0131 i\u00e7in bkz. Microintelect OOD\/Bulgaristan, B. No: 34129\/03, 04.03.2014, \u00a7 39).<\/p>\n<p>ii. Me\u015fru Ama\u00e7<\/p>\n<p>53. Anayasa&#8217;n\u0131n 35. maddesi uyar\u0131nca m\u00fclkiyet hakk\u0131 kamu yarar\u0131 amac\u0131yla s\u0131n\u0131rland\u0131r\u0131labilmektedir. Kamu yarar\u0131 kavram\u0131, m\u00fclkiyet hakk\u0131n\u0131n kamu yarar\u0131n\u0131n gerektirdi\u011fi durumlarda s\u0131n\u0131rland\u0131r\u0131lmas\u0131 imk\u00e2n\u0131 vermekle, bir s\u0131n\u0131rland\u0131rma amac\u0131 olmas\u0131n\u0131n yan\u0131 s\u0131ra m\u00fclkiyet hakk\u0131n\u0131n kamu yarar\u0131 amac\u0131 d\u0131\u015f\u0131nda s\u0131n\u0131rlanamayaca\u011f\u0131n\u0131 \u00f6ng\u00f6rerek ve bu anlamda bir s\u0131n\u0131rlama s\u0131n\u0131r\u0131 olu\u015fturarak m\u00fclkiyet hakk\u0131n\u0131 etkin bir \u015fekilde korumaktad\u0131r (Nusrat K\u00fclah, B. No: 2013\/6151, 21\/4\/2016, \u00a7 53).<\/p>\n<p>54. Anayasa&#8217;n\u0131n 63. maddesinde devletin tarih, k\u00fclt\u00fcr ve tabiat varl\u0131klar\u0131n\u0131n ve de\u011ferlerinin korunmas\u0131n\u0131 sa\u011flama ve bu ama\u00e7la destekleyici ve te\u015fvik edici tedbirleri alma \u00f6devine yer verilmi\u015f ve \u00f6zel m\u00fclkiyet konusu olan varl\u0131k ve de\u011ferlere getirilecek s\u0131n\u0131rlamalar\u0131n ve bu nedenle hak sahiplerine yap\u0131lacak yard\u0131mlar\u0131n ve tan\u0131nacak muafiyetlerin kanunla d\u00fczenlenece\u011fi h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r(AYM, E.2011\/18, K.2012\/53, 11\/4\/2012). <\/p>\n<p>55. Ayr\u0131ca \u00fclkemizin de taraf\u0131 oldu\u011fu 14\/11\/1970 tarihinde kabul edilen K\u00fclt\u00fcr Varl\u0131klar\u0131n\u0131n Kanunsuz \u0130thal, \u0130hra\u00e7 ve M\u00fclkiyet Transferinin \u00d6nlenmesi ve Yasaklanmas\u0131 \u0130\u00e7in Al\u0131nacak Tedbirlerle \u0130lgili S\u00f6zle\u015fme&#8217;nin 3. maddesinde, taraf devletlerce kabul edilmi\u015f mevzuata ayk\u0131r\u0131 olarak yap\u0131lan k\u00fclt\u00fcr varl\u0131klar\u0131n\u0131n ithal, ihra\u00e7 vem\u00fclkiyet transferinin kanunsuz oldu\u011fu belirtilmi\u015f ve bu S\u00f6zle\u015fme ile taraf devletler bak\u0131m\u0131ndan \u00e7e\u015fitli y\u00fck\u00fcml\u00fcl\u00fckler getirilmi\u015ftir. Bu y\u00fck\u00fcml\u00fcl\u00fckler \u00e7er\u00e7evesinde S\u00f6zle\u015fme&#8217;nin 7. maddesinde, bu S\u00f6zle\u015fme&#8217;nin ilgili devletler i\u00e7in y\u00fcr\u00fcrl\u00fc\u011fe girmesinden sonra \u00e7al\u0131n\u0131p ithal edilmi\u015f k\u00fclt\u00fcr varl\u0131klar\u0131yla ilgili taraf devletin ba\u015fvurmas\u0131 \u00fczerine el konulaca\u011f\u0131 ve bu varl\u0131klar\u0131 iyi niyetli al\u0131c\u0131 s\u0131fat\u0131yla edinmi\u015f olan sahibine ise hak\u00e7a bir giderim \u00f6denmesi gerekti\u011fi d\u00fczenlenmi\u015ftir.<\/p>\n<p>56. Dolay\u0131s\u0131yla an\u0131lan S\u00f6zle\u015fme ve Anayasa&#8217;n\u0131n 63. maddesi uyar\u0131nca k\u00fclt\u00fcr varl\u0131klar\u0131n\u0131n korunmas\u0131 ve gerek duyuldu\u011funda m\u00fczelere al\u0131n\u0131p korunmas\u0131n\u0131n sa\u011flanmas\u0131 kamu yarar\u0131na dayal\u0131 me\u015fru bir ama\u00e7 te\u015fkil etmektedir.<\/p>\n<p>iii. \u00d6l\u00e7\u00fcl\u00fcl\u00fck<\/p>\n<p>Genel \u0130lkeler<\/p>\n<p>57. Son olarak kamu makamlar\u0131nca ba\u015fvurucunun m\u00fclkiyet hakk\u0131na yap\u0131lan m\u00fcdahaleyle ger\u00e7ekle\u015ftirilmek istenilen ama\u00e7 ile bu amac\u0131 ger\u00e7ekle\u015ftirmek i\u00e7in kullan\u0131lan ara\u00e7lar aras\u0131nda makul bir \u00f6l\u00e7\u00fcl\u00fcl\u00fck ili\u015fkisinin olup olmad\u0131\u011f\u0131 de\u011ferlendirilmelidir.<\/p>\n<p>58. Anayasa\u2019n\u0131n 35. maddesine g\u00f6re ki\u015filerin m\u00fclkiyet haklar\u0131 ancak kanunun \u00f6ng\u00f6rd\u00fc\u011f\u00fc usullerle ve kamu yarar\u0131 gere\u011fi s\u0131n\u0131rland\u0131r\u0131labilir. Anayasa\u2019n\u0131n 13. maddesinde yer alan \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesi gere\u011fi ki\u015filerin m\u00fclkiyet haklar\u0131n\u0131n s\u0131n\u0131rland\u0131r\u0131lmas\u0131 h\u00e2linde elde edilmek istenen kamu yarar\u0131 ile bireyin haklar\u0131 aras\u0131nda adil bir dengenin kurulmas\u0131 gerekmektedir. Bu adil denge, ba\u015fvurucunun \u015fahsi olarak a\u015f\u0131r\u0131 bir y\u00fcke katland\u0131\u011f\u0131n\u0131n tespit edilmesi durumunda bozulmu\u015f olacakt\u0131r . <\/p>\n<p>59. \u00d6l\u00e7\u00fcl\u00fcl\u00fck ilkesi \u201celveri\u015flilik\u201d, \u201cgereklilik\u201d ve \u201corant\u0131l\u0131l\u0131k\u201d olmak \u00fczere \u00fc\u00e7 alt ilkeden olu\u015fmaktad\u0131r. \u201cElveri\u015flilik\u201d \u00f6ng\u00f6r\u00fclen m\u00fcdahalenin ula\u015f\u0131lmak istenen amac\u0131 ger\u00e7ekle\u015ftirmeye elveri\u015fli olmas\u0131n\u0131, \u201cgereklilik\u201d ula\u015f\u0131lmak istenen ama\u00e7 bak\u0131m\u0131ndan m\u00fcdahalenin zorunlu olmas\u0131n\u0131 yani ayn\u0131 amaca daha hafif bir m\u00fcdahale ile ula\u015f\u0131lmas\u0131n\u0131n m\u00fcmk\u00fcn olmamas\u0131n\u0131, \u201corant\u0131l\u0131l\u0131k\u201d ise bireyin hakk\u0131na yap\u0131lan m\u00fcdahale ile ula\u015f\u0131lmak istenen ama\u00e7 aras\u0131nda makul bir dengenin g\u00f6zetilmesi gereklili\u011fini ifade etmektedir (Mehmet Akdo\u011fan ve di\u011ferleri, \u00a7 38).<\/p>\n<p>60. M\u00fclkiyet hakk\u0131na yap\u0131lan m\u00fcdahalenin, bireyin \u00e7\u0131karlar\u0131 ile kamunun genel yarar\u0131 aras\u0131nda bulunmas\u0131 gereken adil dengeyi bozmamas\u0131 gerekmektedir. M\u00fcdahalenin \u00f6l\u00e7\u00fcl\u00fcl\u00fc\u011f\u00fcn\u00fc de\u011ferlendirirken mahkeme, bir taraftan ula\u015f\u0131lmak istenen me\u015fru amac\u0131n \u00f6nemini ve di\u011fer taraftan m\u00fcdahalenin niteli\u011fini, ba\u015fvurucunun ve kamu otoritelerinin davran\u0131\u015flar\u0131n\u0131 da g\u00f6z\u00f6n\u00fcnde tutarak ba\u015fvurucuya y\u00fcklenen k\u00fclfeti dikkate alacakt\u0131r (Lavrechov\/\u00c7ek Cumhuriyeti, B. No: 57404\/08, 20\/6\/2013, \u00a7 44). <\/p>\n<p>61. A\u0130HM&#8217;e g\u00f6re S\u00f6zle\u015fme&#8217;ye ek 1 No.lu Protokol&#8217;\u00fcn 1. maddesi kural olarak usule ili\u015fkin g\u00fcvenceleri i\u00e7ermemekle birlikte ki\u015filere, keyf\u00ee m\u00fcdahalelerden korunmak amac\u0131yla m\u00fclkiyet hakk\u0131na m\u00fcdahale te\u015fkil eden bu \u00f6nlemlerin kanun d\u0131\u015f\u0131 veya keyf\u00ee ya da makul olmayan \u015fekilde uyguland\u0131\u011f\u0131na ili\u015fkin savunma ve itirazlar\u0131n\u0131 sorumlu makamlar \u00f6n\u00fcnde etkin bir bi\u00e7imde ortaya koyabilme olana\u011f\u0131n\u0131n tan\u0131nmas\u0131 g\u00fcvencesini kapsamaktad\u0131r. Bu de\u011ferlendirme ise uygulanan s\u00fcrecin b\u00fct\u00fcn\u00fcne bak\u0131larak yap\u0131lmal\u0131d\u0131r (AGOSI\/Birle\u015fik Krall\u0131k, B. No: 9118\/80, 24\/1\/1986, \u00a7 60; Saccocia\/Avusturya, B. No: 69917\/01, 18\/12\/2008,\u00a7 89; Microintelect Ood\/Bulgaristan, \u00a7 48; \u00dcnsped Paket Servisi\/Bulgaristan, B. No: 3503\/08, 13\/1\/2015, \u00a7 38).<\/p>\n<p>62. Ayr\u0131ca m\u00fcsaderenin S\u00f6zle\u015fme&#8217;ye uygun olabilmesi i\u00e7in kamu makamlar\u0131n\u0131n ba\u015fvurucunun kusur veya \u00f6zen y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn derecesini ya da en az\u0131ndan davran\u0131\u015flar\u0131 ile su\u00e7 veya kanuna ayk\u0131r\u0131l\u0131k aras\u0131ndaki ili\u015fkiyi makul bir bi\u00e7imde de\u011ferlendirmesi de zorunludur (AGOSI\/Birle\u015fik Krall\u0131k, \u00a7\u00a7 58-60; Air Canada\/Birle\u015fik Krall\u0131k, B. Yine &#8220;iyi niyetli&#8221; e\u015fya malikine, m\u00fcsadere edilen veya m\u00fclkiyeti kamuya ge\u00e7irilen e\u015fyalar\u0131 -tehlikeli olmamalar\u0131 kayd\u0131yla- geri kazanabilme olana\u011f\u0131n\u0131n tan\u0131nmas\u0131 veya iyi niyetli malikin bu nedenle olu\u015fan zarar\u0131n\u0131n tazmin edilmesi gerekmektedir (Bekir Yaz\u0131c\u0131 [GK], B. No: 2013\/3044, 17\/12\/2015, \u00a7\u00a7 31-80).<\/p>\n<p>\u0130lkelerin Olaya Uygulanmas\u0131<\/p>\n<p>63. Ba\u015fvuru konusu olayda, yarg\u0131sal makamlar\u0131n tespitlerine g\u00f6re ba\u015fvurucu ihlal iddias\u0131na konu etti\u011fi d\u00f6rt adet mozaik tabloyu yurt d\u0131\u015f\u0131ndan bir bedel \u00f6deyerek sat\u0131n alm\u0131\u015f ve yurda getirmi\u015ftir. Ba\u015fvurucunun m\u00fclkiyet hakk\u0131n\u0131n ihlali iddias\u0131na konu mozaik tablolar\u0131n Ge\u00e7 Roma d\u00f6neminden kalma tarihi eserler olduklar\u0131 ba\u015fvuruya konu yarg\u0131lama s\u00fcre\u00e7lerinde tespit edilmi\u015ftir. 2863 say\u0131l\u0131 Kanun&#8217;un 32. maddesinin birinci f\u0131kras\u0131n\u0131n birinci c\u00fcmlesinde, yurt i\u00e7inde korunmas\u0131 gerekli ta\u015f\u0131n\u0131r k\u00fclt\u00fcr ve tabiat varl\u0131klar\u0131n\u0131n yurt d\u0131\u015f\u0131na \u00e7\u0131kar\u0131lamayaca\u011f\u0131 belirtilmi\u015f, 33. maddesinin birinci f\u0131kras\u0131nda ise yurt d\u0131\u015f\u0131ndan k\u00fclt\u00fcr varl\u0131\u011f\u0131 getirmenin serbest oldu\u011fu h\u00fckme ba\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>64. Bak\u0131rk\u00f6y 1. A\u011f\u0131r Ceza Mahkemesinin 2\/3\/2007 tarihli karar\u0131nda, ba\u015fvurucunun da aralar\u0131nda bulundu\u011fu san\u0131klar\u0131n beraatlerine karar verilmekle birlikte, ba\u015fvurucunun yurt d\u0131\u015f\u0131ndan getirdi\u011fi k\u00fclt\u00fcr varl\u0131klar\u0131n\u0131n m\u00fcsaderesine karar verilmi\u015ftir. Mahkeme yarg\u0131lama s\u0131ras\u0131nda bu e\u015fyan\u0131n ithalinin yasak olup olmad\u0131\u011f\u0131n\u0131 \u0130stanbul G\u00fcmr\u00fckler Ba\u015fm\u00fcd\u00fcrl\u00fc\u011f\u00fcnden sormu\u015f, G\u00fcmr\u00fckler Ba\u015fm\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn cevap yaz\u0131s\u0131nda, &#8220;bu e\u015fyan\u0131n ithalinin serbest oldu\u011fu&#8221; ve &#8220;g\u00fcmr\u00fck vergisine tabi olmad\u0131\u011f\u0131&#8221; bildirilmi\u015ftir. Anayasa Mahkemesi ba\u015fvurucunun, yurt d\u0131\u015f\u0131ndan k\u00fclt\u00fcr varl\u0131\u011f\u0131 getirmenin yasak veya su\u00e7 olmad\u0131\u011f\u0131n\u0131 dile getirdi\u011fini g\u00f6zlemlemektedir. Ceza mahkemesi karar\u0131 incelendi\u011finde, e\u015fyan\u0131n m\u00fcsaderesine karar verilirken herhangi bir kanun maddesine i\u015faret edilmedi\u011fi gibi m\u00fcsadere ile ilgili olarak herhangi bir gerek\u00e7eye de dayan\u0131lmad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. <\/p>\n<p>65. M\u00fcsadere karar\u0131n\u0131n temyizi \u00fczerine Yarg\u0131tay 7. Ceza Dairesinin 26\/5\/2008 tarihli ilam\u0131yla zamana\u015f\u0131m\u0131 nedeniyle davan\u0131n ortadan kald\u0131r\u0131lmas\u0131na, tarihi eserlerin ise &#8220;m\u00fczeye verilmesine&#8221; karar verilmi\u015ftir. Yarg\u0131tay ilam\u0131nda da yaln\u0131zca ceza yarg\u0131lamas\u0131nda al\u0131nan bilirki\u015fi raporundaki &#8220;2863 say\u0131l\u0131 Kanun kapsam\u0131nda oldu\u011fu belirlenen tescil ve tasnife tabi eser&#8221; nitelemesine yer verilmi\u015ftir. Ancak yurt d\u0131\u015f\u0131ndan getirilen ve G\u00fcmr\u00fckler Ba\u015fm\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn yaz\u0131s\u0131na g\u00f6re de ithalinin serbest oldu\u011fu anla\u015f\u0131lan bu e\u015fyan\u0131n, 2863 say\u0131l\u0131 Kanun&#8217;da veya ba\u015fkaca herhangi bir kanunda yer alan hangi d\u00fczenlemeye ya da gerek\u00e7elere g\u00f6re &#8220;m\u00fczeye verilmesi&#8221; gerekti\u011fine dair herhangi bir a\u00e7\u0131klamaya yer verilmemi\u015ftir. Ayr\u0131ca ilamda ba\u015fvurucunun tutum ve davran\u0131\u015flar\u0131 ile varsa bir kanuna ayk\u0131r\u0131l\u0131k aras\u0131ndaki ili\u015fki bak\u0131m\u0131ndan herhangi bir de\u011ferlendirmenin de yap\u0131lmad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.<\/p>\n<p>66. Bu durumda \u00f6ncelikle ba\u015fvurucunun yurt d\u0131\u015f\u0131ndan ka\u00e7ak olarak k\u00fclt\u00fcr varl\u0131\u011f\u0131 getirdi\u011fi gerek\u00e7esiyle mahk\u00fbm edilmedi\u011fi anla\u015f\u0131lmaktad\u0131r. Bunun aksine Bak\u0131rk\u00f6y 1. Ceza Mahkemesi karar\u0131nda ve G\u00fcmr\u00fckler Ba\u015fm\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn yaz\u0131s\u0131nda bu e\u015fyan\u0131n ithalinin serbest oldu\u011fu y\u00f6n\u00fcnde tespitlere yer verildi\u011fi g\u00f6r\u00fclmektedir.<\/p>\n<p>67. \u00d6te yandan m\u00fczede tutulan e\u015fyan\u0131n iadesi veya ikramiye verilmesi istemiyle ba\u015fvurucunun a\u00e7t\u0131\u011f\u0131 davada Ankara 8. \u0130dare Mahkemesinin 16\/12\/2010 tarihli karar\u0131 ile bu &#8220;mozaiklerin&#8221; 2863 say\u0131l\u0131 Kanun&#8217;un 6. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131na g\u00f6re &#8220;korunmas\u0131 gerekli ta\u015f\u0131nmaz k\u00fclt\u00fcr varl\u0131klar\u0131&#8221; niteli\u011finde olduklar\u0131 belirtilmi\u015ftir. Mahkeme karar\u0131nda bunlar\u0131n m\u00fczede korunmas\u0131 gereken eski eserlerden oldu\u011fu belirtilmi\u015f ancak m\u00fclkiyetinin devlete ait oldu\u011funa ili\u015fkin herhangi bir tespite yer verilmemi\u015ftir. \u0130dare Mahkemesince yaln\u0131zca ta\u015f\u0131n\u0131r k\u00fclt\u00fcr varl\u0131klar\u0131 ile ilgili ikramiye \u00f6denmesi hakk\u0131ndaki kanuni d\u00fczenleme gerek\u00e7e g\u00f6sterilerek davan\u0131n reddi gerekti\u011fi sonucuna var\u0131lm\u0131\u015ft\u0131r. Bunun d\u0131\u015f\u0131nda, &#8220;yurt d\u0131\u015f\u0131ndan getirilen ta\u015f\u0131nmaz k\u00fclt\u00fcr varl\u0131klar\u0131 y\u00f6n\u00fcnden&#8221; m\u00fczede tutma i\u015fleminin mahiyeti ve bu i\u015flemin kanuni dayana\u011f\u0131 ile ilgili olarak bir gerek\u00e7e g\u00f6sterilmemi\u015ftir. Ayr\u0131ca kararda \u00fclkemizin de taraf\u0131 oldu\u011fu K\u00fclt\u00fcr Varl\u0131klar\u0131n\u0131n Kanunsuz \u0130thal, \u0130hra\u00e7 ve M\u00fclkiyet Transferinin \u00d6nlenmesi ve Yasaklanmas\u0131 \u0130\u00e7in Al\u0131nacak Tedbirlerle \u0130lgili S\u00f6zle\u015fme&#8217;nin 7. maddesindeki ko\u015fullar\u0131n somut olayda ger\u00e7ekle\u015fip ger\u00e7ekle\u015fmedi\u011finin de\u011ferlendirilmedi\u011fi de g\u00f6r\u00fclmektedir. B\u00f6ylece ba\u015fvurucunun iyi niyetli malik konumunda olup olmad\u0131\u011f\u0131 da a\u00e7\u0131kl\u0131\u011fa kavu\u015fturulmam\u0131\u015ft\u0131r. <\/p>\n<p>68. Gerek ceza yarg\u0131lamas\u0131nda gerekse de bu e\u015fyan\u0131n iadesi ya da tazminine ili\u015fkin idari s\u00fcre\u00e7 ve yarg\u0131lamada ba\u015fvurucunun kusur veya \u00f6zen y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn derecesi ya da en az\u0131ndan davran\u0131\u015flar\u0131 ile herhangi bir su\u00e7 veya kanuna ayk\u0131r\u0131l\u0131k aras\u0131ndaki ili\u015fkinin de\u011ferlendirilmedi\u011fi g\u00f6r\u00fclmektedir. Bununla birlikte b\u00f6yle bir ili\u015fki mevcut olmasa dahi kamu yarar\u0131n\u0131n gerektirdi\u011fi kimi durumlarda el koyma veya m\u00fcsadere gibi tedbirlerin uygulanmas\u0131 \u00f6ng\u00f6r\u00fclebilir (ba\u015fvurucu mahk\u00fbm edilmemekle birlikte karayollar\u0131n\u0131n g\u00fcvenli\u011fi i\u00e7in arac\u0131n m\u00fcsaderesinin etkin bir tazminat yolunun varl\u0131\u011f\u0131 nedeniyle \u00f6l\u00e7\u00fcl\u00fc g\u00f6r\u00fcld\u00fc\u011f\u00fc karar i\u00e7in bkz. Bekir Yaz\u0131c\u0131, \u00a7\u00a7 66-80). Somut olayda da kamu yarar\u0131 bak\u0131m\u0131ndan derece mahkemelerince k\u00fclt\u00fcr varl\u0131klar\u0131n\u0131n m\u00fczede tutulmas\u0131 gerekti\u011fi kabul edilmi\u015ftir. Anayasa Mahkemesi k\u00fclt\u00fcr varl\u0131klar\u0131n\u0131n korunmas\u0131na verdi\u011fi \u00f6nemi \u00f6nceki kararlar\u0131nda da a\u00e7\u0131k olarak belirtmi\u015ftir (Ahmet B\u00f6lge, B. No: 2014\/13313, 28\/9\/2016, \u00a7\u00a7 55, 56). Ayr\u0131ca kamu makamlar\u0131n\u0131n k\u00fclt\u00fcr varl\u0131klar\u0131n\u0131n korunmas\u0131 i\u00e7in somut olayda oldu\u011fu gibi gerekli tedbirleri almas\u0131nda geni\u015f bir takdir yetkisi oldu\u011fu da kabul edilmektedir. <\/p>\n<p>69. Nitekim K\u00fclt\u00fcr Varl\u0131klar\u0131n\u0131n Kanunsuz \u0130thal, \u0130hra\u00e7 ve M\u00fclkiyet Transferinin \u00d6nlenmesi ve Yasaklanmas\u0131 \u0130\u00e7in Al\u0131nacak Tedbirlerle \u0130lgili S\u00f6zle\u015fme \u00e7er\u00e7evesinde ve Anayasa&#8217;n\u0131n 63. maddesi uyar\u0131nca yurt d\u0131\u015f\u0131ndan edinilerek yurda getirilen \u00f6zel m\u00fclke konu k\u00fclt\u00fcr varl\u0131klar\u0131n\u0131n korunmas\u0131n\u0131 ve gerek duyuldu\u011funda m\u00fczelere al\u0131nmas\u0131n\u0131 ve korunmas\u0131n\u0131 sa\u011flama hususu kamu makamlar\u0131n\u0131n takdirindedir. Ancak yine an\u0131lan S\u00f6zle\u015fme&#8217;nin 3. ve 7. maddeleri, Anayasa&#8217;n\u0131n 13. ve 35. maddeleri ile 63. maddesinin ikinci f\u0131kras\u0131 uyar\u0131nca m\u00fclkiyet hakk\u0131na yap\u0131lan bu m\u00fcdahale ve s\u0131n\u0131rlaman\u0131n, belirlenen me\u015fru ama\u00e7 do\u011frultusunda kanuna dayal\u0131 olarak \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesi ve kamu yarar\u0131 ile bireyin haklar\u0131 aras\u0131nda olmas\u0131 gereken adil denge de g\u00f6zetilerek yap\u0131lmas\u0131 zorunludur. Bunun i\u00e7in de \u00f6ncelikle malike, uygulanan tedbirlere kar\u015f\u0131 savunma ve itirazlar\u0131n\u0131 etkin bi\u00e7imde ortaya koyabilme olana\u011f\u0131n\u0131n tan\u0131nmas\u0131, bunun i\u00e7in de s\u00f6z konusu iddia ve savunmalar\u0131n makul bi\u00e7imde kar\u015f\u0131lanmas\u0131 ve ayr\u0131ca malikin iyi niyetli oldu\u011funun tespit edilmesi durumunda zarar\u0131n\u0131n tazmini gerekmektedir. Bu gerekliliklere uyuldu\u011fu takdirde m\u00fclkiyet hakk\u0131na yap\u0131lan m\u00fcdahale \u00f6l\u00e7\u00fcl\u00fc olacakt\u0131r (ba\u015fvurucuya di\u011fer unsurlar yan\u0131nda ayr\u0131ca etkin bir savunma hakk\u0131 tan\u0131nd\u0131\u011f\u0131 i\u00e7in m\u00fcdahalenin \u00f6l\u00e7\u00fcl\u00fc g\u00f6r\u00fcld\u00fc\u011f\u00fc kararlar i\u00e7in bkz. Eyy\u00fcp Baran, B. No: 2014\/8060, 29\/9\/2016, \u00a7\u00a7 75-95; Fatma \u00c7avu\u015fo\u011flu ve Bilal \u00c7avu\u015fo\u011flu, B. No: 2014\/5167, 28\/9\/2016, \u00a7\u00a7 74-89. Buna kar\u015f\u0131l\u0131k, ayn\u0131 ko\u015fulun yarg\u0131lama s\u00fcrecinde sa\u011flanmamas\u0131 nedeniyle m\u00fcdahalenin \u00f6l\u00e7\u00fcs\u00fcz g\u00f6r\u00fcld\u00fc\u011f\u00fc karar i\u00e7in bkz. Ba\u015fvurucu temel olarak yurt d\u0131\u015f\u0131ndan k\u00fclt\u00fcr varl\u0131\u011f\u0131 getirmenin serbest oldu\u011fu y\u00f6n\u00fcndeki kanuni d\u00fczenlemeye dayanmaktad\u0131r. Ba\u015fvurucu ayr\u0131ca bunlar\u0131 iyi niyetle elde etti\u011fini ve yurda soktu\u011funu belirterek e\u015fyan\u0131n iade edilmesi veya zarar\u0131n\u0131n tazmin edilmesi gerekti\u011fini savunmu\u015ftur. Buna kar\u015f\u0131n somut olayda s\u00f6z konusu e\u015fyalar\u0131n m\u00fczede tutulmas\u0131 ile ilgili olarak uygulanan s\u00fcrecin b\u00fct\u00fcn\u00fcne bak\u0131ld\u0131\u011f\u0131nda ba\u015fvurucunun belirtilen iddia ve savunmalar\u0131n\u0131n yeterli ve makul bir bi\u00e7imde kar\u015f\u0131lanmad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. <\/p>\n<p>71. Sonu\u00e7 olarak; kamu makamlar\u0131n\u0131n, k\u00fclt\u00fcr varl\u0131klar\u0131n\u0131n korunmas\u0131nda geni\u015f bir takdir yetkisi oldu\u011fu kabul edilmekle birlikte, ba\u015fvurucunun kanuna g\u00f6re yurt d\u0131\u015f\u0131nda edindi\u011fi k\u00fclt\u00fcr varl\u0131klar\u0131n\u0131 getirmesinin serbest olmas\u0131ndan dolay\u0131 iyi niyetli malik oldu\u011fu gerek\u00e7esiyle e\u015fyalar\u0131n iadesi veya zarar\u0131n\u0131n tazmin edilmesi gerekti\u011fi y\u00f6n\u00fcndeki iddialar\u0131, idari ve yarg\u0131sal s\u00fcre\u00e7ler boyunca yeterli ve makul bir bi\u00e7imde kar\u015f\u0131lanmad\u0131\u011f\u0131na g\u00f6re ba\u015fvurucuya m\u00fclkiyet hakk\u0131 kapsam\u0131nda etkin bir itiraz hakk\u0131n\u0131n tan\u0131nmad\u0131\u011f\u0131 de\u011ferlendirilmi\u015ftir. Bu nedenle, yap\u0131lan m\u00fcdahalenin kamu yarar\u0131 ile ba\u015fvurucunun m\u00fclkiyet hakk\u0131 aras\u0131ndaki adil dengeyi ba\u015fvurucu aleyhine bozdu\u011fu ve ba\u015fvurucuya a\u015f\u0131r\u0131 ve orant\u0131s\u0131z bir k\u00fclfet y\u00fckledi\u011fi sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>72. A\u00e7\u0131klanan nedenlerle ba\u015fvurucunun, Anayasa&#8217;n\u0131n 35. maddesinde g\u00fcvence alt\u0131na al\u0131nan m\u00fclkiyet hakk\u0131n\u0131n ihlal edildi\u011finin kabul edilmesi gerekir.<\/p>\n<p>3. 6216 Say\u0131l\u0131 Kanun&#8217;un 50. Maddesi Y\u00f6n\u00fcnden<\/p>\n<p>73. 30\/3\/2011 tarihli ve 6216 say\u0131l\u0131 Anayasa Mahkemesinin Kurulu\u015fu ve Yarg\u0131lama Usulleri Hakk\u0131nda Kanun&#8217;un 50. maddesinin (1) ve (2) numaral\u0131 f\u0131kralar\u0131 \u015f\u00f6yledir:<\/p>\n<p> \u201c(1) Esas inceleme sonunda, ba\u015fvurucunun hakk\u0131n\u0131n ihlal edildi\u011fine ya da edilmedi\u011fine karar verilir. \u0130hlal karar\u0131 verilmesi h\u00e2linde ihlalin ve sonu\u00e7lar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131 i\u00e7in yap\u0131lmas\u0131 gerekenlere h\u00fckmedilir. \u2026<\/p>\n<p> (2) Tespit edilen ihlal bir mahkeme karar\u0131ndan kaynaklanm\u0131\u015fsa, ihlali ve sonu\u00e7lar\u0131n\u0131 ortadan kald\u0131rmak i\u00e7in yeniden yarg\u0131lama yapmak \u00fczere dosya ilgili mahkemeye g\u00f6nderilir. Yeniden yarg\u0131lama yap\u0131lmas\u0131nda hukuki yarar bulunmayan h\u00e2llerde ba\u015fvurucu lehine tazminata h\u00fckmedilebilir veya genel mahkemelerde dava a\u00e7\u0131lmas\u0131 yolu g\u00f6sterilebilir. Yeniden yarg\u0131lama yapmakla y\u00fck\u00fcml\u00fc mahkeme, Anayasa Mahkemesinin ihlal karar\u0131nda a\u00e7\u0131klad\u0131\u011f\u0131 ihlali ve sonu\u00e7lar\u0131n\u0131 ortadan kald\u0131racak \u015fekilde m\u00fcmk\u00fcnse dosya \u00fczerinden karar verir.\u201d<\/p>\n<p>74. Ba\u015fvurucu ihlallerin tespiti ve 30.000 TL avukatl\u0131k \u00fccreti ile 20.000.000 TL tazminat talebinde bulunmu\u015ftur.<\/p>\n<p>75. Ba\u015fvuruda Anayasa&#8217;n\u0131n 35. maddesiyle g\u00fcvence alt\u0131na al\u0131nan m\u00fclkiyet hakk\u0131n\u0131n ihlal edildi\u011fi sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>76. Ba\u015fvurucunun m\u00fclkiyet hakk\u0131n\u0131n ihlalinin sonu\u00e7lar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131 i\u00e7in yeniden yarg\u0131lama yap\u0131lmas\u0131nda hukuki yarar bulundu\u011fundan karar\u0131n bir \u00f6rne\u011finin yeniden yarg\u0131lama yap\u0131lmak \u00fczere Ankara 8. \u0130dare Mahkemesine g\u00f6nderilmesine karar verilmesi gerekir.<\/p>\n<p>77. Ba\u015fvurunun incelenmesinde, Anayasa&#8217;n\u0131n 35. maddesinin ihlal edildi\u011fi sonucuna var\u0131ld\u0131\u011f\u0131ndan ve tespit edilen ihlal nedeniyle yeniden yarg\u0131lama yap\u0131lmas\u0131na karar verildi\u011finden tazminat taleplerinin reddine karar verilmesi gerekir. <\/p>\n<p>78. Dosyadaki belgelerden tespit edilen 206,10 TL har\u00e7 ve 1.800 TL vek\u00e2let \u00fccretinden olu\u015fan toplam 2.006,10 TL yarg\u0131lama giderinin ba\u015fvurucuya \u00f6denmesine karar verilmesi gerekir.<\/p>\n<p>V.
