A\u011f\u0131r Ceza Mahkemesinin 2010\/283 Esas say\u0131l\u0131 dosyas\u0131nda birle\u015ftirilmi\u015ftir. \u00dc\u00e7 ayr\u0131 iddianameyle a\u00e7\u0131lan ve birle\u015ftirilen dava kapsam\u0131nda 367 san\u0131k hakk\u0131nda yarg\u0131lama yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>12. \u0130stanbul 10. A\u011f\u0131r Ceza Mahkemesinin 21\/9\/2012 tarih ve E.2010\/283, K.2012\/245 say\u0131l\u0131 karar\u0131yla, yarg\u0131lanan 36 san\u0131k hakk\u0131nda beraat, ba\u015fvurucular\u0131n da aralar\u0131nda oldu\u011fu 325 san\u0131k hakk\u0131nda ise T\u00fcrkiye Cumhuriyeti \u0130cra Vekilleri Heyetini cebren \u0131skat veya vazife g\u00f6rmekten men etmeye te\u015febb\u00fcs su\u00e7undan 765 Say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun 147. ve 61. maddeleri gere\u011fince mahkumiyet karar\u0131 verilmi\u015ftir. <\/p>\n<p>13. Temyiz incelemesi sonunda, ba\u015fvurucular\u0131n da aralar\u0131nda oldu\u011fu 237 san\u0131k hakk\u0131ndaki mahk\u00fbmiyet karar\u0131 Yarg\u0131tay 9. Ceza Dairesinin 9\/10\/2013 tarih ve E.2013\/9110, K.2013\/12351 say\u0131l\u0131 ilam\u0131yla d\u00fczeltilerek onanm\u0131\u015ft\u0131r. Ayr\u0131ca, 36 san\u0131k hakk\u0131ndaki beraat karar\u0131 onanm\u0131\u015f, 88 san\u0131k hakk\u0131ndaki mahk\u00fbmiyet karar\u0131 ise ceza verilmesine yer olmad\u0131\u011f\u0131na karar verilmesi veya beraat karar\u0131 verilmesi gerekti\u011fi gerek\u00e7esiyle bozulmu\u015ftur.<\/p>\n<p>B. \u0130lgili Hukuk<\/p>\n<p>14. Mahkumiyet esas al\u0131nan su\u00e7 tarihinde y\u00fcr\u00fcrl\u00fckte olan 1\/3\/1926 tarih ve 765 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun 147. maddesi \u015f\u00f6yledir:<\/p>\n<p>\u201cT\u00fcrkiye Cumhuriyeti \u0130cra Vekilleri Heyetini cebren iskat veya vazife g\u00f6rmekten cebren menedenlerle bunlar\u0131 te\u015fvik eyliyenlerea\u011f\u0131rla\u015ft\u0131r\u0131lm\u0131\u015f m\u00fcebbet a\u011f\u0131r hapiscezas\u0131 h\u00fckmolunur.\u201d<\/p>\n<p>15. 765 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun 171. maddesi \u015f\u00f6yledir:<\/p>\n<p>125, 131, 133, 146, 147, 149 ve 156 nc\u0131 maddelerde yaz\u0131l\u0131 c\u00fcr\u00fcmlerden birini veya baz\u0131lar\u0131n\u0131 hususi vas\u0131talarla i\u015flemek \u00fczere bir ka\u00e7 ki\u015fi aralar\u0131nda gizlice ittifak ederlerse bunlardan her biri a\u015fa\u011f\u0131da yaz\u0131l\u0131 cezalar\u0131 g\u00f6r\u00fcr.<\/p>\n<p>1 &#8211; Yukar\u0131daki f\u0131krada yaz\u0131l\u0131 ittifak 125, 131, 133 ve 156 nc\u0131 maddelerde yaz\u0131l\u0131 c\u00fcr\u00fcmlerin yap\u0131lmas\u0131na dair ise sekiz seneden on be\u015f seneye kadar a\u011f\u0131r hapis cezas\u0131 h\u00fckmolunur.<\/p>\n<p>\u00a02 &#8211; Bu ittifak 146 ve 147 nci maddelerde g\u00f6sterilen c\u00fcr\u00fcmlerin icras\u0131na m\u00fcteallik ise d\u00f6rt seneden on iki seneye ve 149 uncu maddede g\u00f6sterilen c\u00fcr\u00fcmlerin icras\u0131na aid ise \u00fc\u00e7 seneden yedi seneye kadar a\u011f\u0131r hapis cezas\u0131 verilir.<\/p>\n<p>\u00a0C\u00fcrm\u00fcn icras\u0131na ve kanuni takibata ba\u015flanmazdan evvel bu ittifaktan \u00e7ekilenler ceza g\u00f6rmezler.\u201d<\/p>\n<p>IV. \u0130NCELEME VE GEREK\u00c7E<\/p>\n<p>16. Mahkemenin 18\/6\/2014 tarihinde yapm\u0131\u015f oldu\u011fu toplant\u0131da ba\u015fvuru dosyas\u0131 incelenerek gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. Ba\u015fvurucular\u0131n \u0130ddialar\u0131<\/p>\n<p>17. Ba\u015fvurucular, <\/p>\n<p>\u00a0i. Soru\u015fturma ve kovu\u015fturma boyunca tutuklu olarak tutulduklar\u0131n\u0131, adli kontrol taleplerinin kal\u0131pla\u015fm\u0131\u015f gerek\u00e7elerle ve sistematik olarak reddedildi\u011fini ve bu sebeple Anayasa\u2019n\u0131n 19. maddesinin ihlal edildi\u011fini,<\/p>\n<p>\u00a0ii. Dijital deliller \u00fczerinde yap\u0131lan bilirki\u015fi incelemesinin yeterli olmad\u0131\u011f\u0131n\u0131 ve tekrarlanmas\u0131na ili\u015fkin taleplerin reddedildi\u011fini,<\/p>\n<p>\u00a0iii. Bilirki\u015fi raporlar\u0131 aras\u0131ndaki \u00e7eli\u015fkiler nedeniyle ortaya \u00e7\u0131kan delillerin s\u0131hhati konusundaki teredd\u00fctlere ra\u011fmen mahk\u00fbm edildiklerini,<\/p>\n<p>\u00a0iv. Kendilerine isnat edilen su\u00e7un i\u015flenmesine an\u0131lan tarihte g\u00f6revde olan Genelkurmay Ba\u015fkan\u0131 ve Kara Kuvvetleri Komutan\u0131 taraf\u0131ndan engel olundu\u011funun kabul edilmesi nedeniyle bu ki\u015filerin tan\u0131kl\u0131k yapmak \u00fczere davet edilmeleri taleplerinin reddedildi\u011fini,<\/p>\n<p>\u00a0v. Delillerin ortaya konulmas\u0131 ve tart\u0131\u015f\u0131lmas\u0131 safhas\u0131n\u0131n usul\u00fcnce yerine getirilmedi\u011fini,<\/p>\n<p>\u00a0vi. H\u00fckm\u00fcn, san\u0131k m\u00fcdafileri olmaks\u0131z\u0131n verildi\u011fini ve Cumhuriyet Savc\u0131s\u0131n\u0131n esas hakk\u0131ndaki m\u00fctalaas\u0131na kar\u015f\u0131 beyanda bulunmak \u00fczere san\u0131klara yeterli s\u00fcre verilmedi\u011fini,<\/p>\n<p>\u00a0vii. Duru\u015fma salonunda uygulanan oturum d\u00fczeni ve duru\u015fma s\u0131ras\u0131nda yap\u0131lan ses kayd\u0131 nedeniyle ba\u015fkalar\u0131 taraf\u0131ndan duyulmadan avukatla ileti\u015fim kurarak m\u00fcdafi yard\u0131m\u0131ndan yararlanamad\u0131klar\u0131n\u0131,<\/p>\n<p>\u00a0viii. Hukuka ayk\u0131r\u0131 olarak elde edilen, ger\u00e7ek d\u0131\u015f\u0131 delillere dayan\u0131larak mahk\u00fbm edildiklerini,<\/p>\n<p>\u00a0ix. Soru\u015fturma a\u015famas\u0131nda tutuklama karar\u0131 veren h\u00e2kimlerin yarg\u0131lamaya kat\u0131lmalar\u0131 nedeniyle mahkemenin tarafs\u0131zl\u0131\u011f\u0131 ilkesinin ihlal edildi\u011fini,<\/p>\n<p>\u00a0x. \u0130lk Derece Mahkemenin g\u00f6revli ve yetkili olmad\u0131\u011f\u0131n\u0131,<\/p>\n<p>\u00a0xi. Duru\u015fma salonunun konum itibariyle uzakl\u0131\u011f\u0131n\u0131n, duru\u015fma salonuna eri\u015fimin zorlu\u011funun, giri\u015fte al\u0131nan g\u00fcvenlik \u00f6nlemlerinin, duru\u015fmalar\u0131n aleniyetini ihlal etti\u011fini,<\/p>\n<p>\u00a0xii. Haklar\u0131nda yeterli somut delil bulunmaks\u0131z\u0131n kolektif gerek\u00e7elere dayan\u0131larak mahk\u00fbm edildiklerini, darbe planlar\u0131n\u0131n sunuldu\u011fu plan seminerine kat\u0131lmad\u0131klar\u0131na veya o tarihlerde yurtd\u0131\u015f\u0131nda g\u00f6revde olmak vb. engelleyici nedenlerinin oldu\u011funu, dijital verilerin kendileri ile illiyet ba\u011flar\u0131n\u0131n ispatlanamad\u0131\u011f\u0131n\u0131,<\/p>\n<p>\u00a0xiii. Derece mahkemesi karar\u0131n\u0131n temyiz incelemesi sonucunda Yarg\u0131tay\u2019ca verilen d\u00fczeltilerek onama karar\u0131n\u0131n gerek\u00e7esinin yeterli olmad\u0131\u011f\u0131n\u0131,<\/p>\n<p>\u00a0xiv. Kendileriyle ayn\u0131 durumda olan bir k\u0131s\u0131m \u015f\u00fcpheliler hakk\u0131nda kovu\u015fturmaya yer olmad\u0131\u011f\u0131 karar\u0131, bir k\u0131sm\u0131 san\u0131klar hakk\u0131nda da beraat karar\u0131 verildi\u011fini, s\u00f6z konusu plan seminerine kat\u0131lmad\u0131klar\u0131n\u0131, buna kar\u015f\u0131n dava konusu plan seminerine kat\u0131lan, ortaya \u00e7\u0131kan ses kay\u0131tlar\u0131n\u0131 kabul eden, dava konusu dijital verilerin \u00fcst veri yollar\u0131nda isimleri olan ve bu \u015fekilde eylemleri sabit g\u00f6r\u00fclerek mahkum edilen bir k\u0131s\u0131m san\u0131klar\u0131n gerek\u00e7esiz olarak Yarg\u0131tay taraf\u0131ndan mahkumiyet h\u00fck\u00fcmlerinin bozuldu\u011funu,<\/p>\n<p>\u00a0xv. Sabit kabul edilen eylemlerinin yanl\u0131\u015f vas\u0131fland\u0131r\u0131ld\u0131\u011f\u0131n\u0131, haz\u0131rl\u0131k hareketlerinin icra hareketi olarak de\u011ferlendirildi\u011fini ve temel cezan\u0131n yanl\u0131\u015f belirlendi\u011fini,<\/p>\n<p>\u00a0xvi. Ba\u015fvurucular taraf\u0131ndan al\u0131nan bilirki\u015fi raporlar\u0131 ile ba\u015fvurucular\u0131n iste\u011fi \u00fczerine dinlenen bilirki\u015fi beyanlar\u0131n\u0131n mahk\u00fbmiyet karar\u0131n\u0131n dayana\u011f\u0131 olan dijital delillerin manip\u00fclasyona a\u00e7\u0131k oldu\u011funu ortaya koymas\u0131na ra\u011fmen bu delillere dayanarak mahk\u00fbmiyet karar\u0131 verildi\u011fini, <\/p>\n<p>Belirterek, Anayasa\u2019n\u0131n 10. maddesinde g\u00fcvence alt\u0131na al\u0131nan e\u015fitlik ilkesinin, Anayasa\u2019n\u0131n 36. maddesinde g\u00fcvence alt\u0131na al\u0131nan adil yarg\u0131lama hakk\u0131n\u0131n ve Anayasa\u2019n\u0131n 38. maddesinde g\u00fcvence alt\u0131na al\u0131nan masumiyet karinesinin ihlal edildi\u011fini ileri s\u00fcrm\u00fc\u015flerdir. <\/p>\n<p>B. De\u011ferlendirme<\/p>\n<p>1. Kabul Edilebilirlik Y\u00f6n\u00fcnden <\/p>\n<p>a. Tutuklulukla \u0130lgili \u015eik\u00e2yetler <\/p>\n<p>18. Soru\u015fturma ve kovu\u015fturma boyunca tutuklu olarak tutulduklar\u0131n\u0131, adli kontrol taleplerinin kal\u0131pla\u015fm\u0131\u015f gerek\u00e7elerle reddedildi\u011fini ve bu sebeple Anayasa\u2019n\u0131n 19. maddesinin ihlal edildi\u011fini ileri s\u00fcrm\u00fc\u015flerdir.<\/p>\n<p>19. 6216 say\u0131l\u0131 Kanun\u2019un ge\u00e7ici 1. maddesinin (8) numaral\u0131 f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>\u00a0\u201cMahkeme, 23\/9\/2012 tarihinden sonra kesinle\u015fen nihai i\u015flem ve kararlar aleyhine yap\u0131lacak bireysel ba\u015fvurular\u0131 inceler.\u201d <\/p>\n<p>20. Bu h\u00fck\u00fcm gere\u011fince Anayasa Mahkemesi, 23\/9\/2012 tarihinden sonra kesinle\u015fen nihai i\u015flem ve kararlar aleyhine yap\u0131lacak bireysel ba\u015fvurular\u0131 inceler. Dolay\u0131s\u0131yla Mahkeme\u2019nin zaman bak\u0131m\u0131ndan yetkisi ancak bu tarihten sonra kesinle\u015fen nihai i\u015flem ve kararlar aleyhine yap\u0131lan bireysel ba\u015fvurularla s\u0131n\u0131rl\u0131d\u0131r. Kamu d\u00fczenine ili\u015fkin bu d\u00fczenleme kar\u015f\u0131s\u0131nda, an\u0131lan tarihten \u00f6nce kesinle\u015fmi\u015f niha\u00ee i\u015flem ve kararlar\u0131 da i\u00e7erecek \u015fekilde yetki kapsam\u0131n\u0131n geni\u015fletilmesi m\u00fcmk\u00fcn de\u011fildir (B. No: 2012\/832, \u00a7 14, 12\/2\/2013).<\/p>\n<p>21. Devam eden tutuklulu\u011fun hukuka ayk\u0131r\u0131 oldu\u011fu iddias\u0131yla yap\u0131lan bireysel ba\u015fvurularda \u015fik\u00e2yetlerin temel amac\u0131, tutuklulu\u011fun hukuka ayk\u0131r\u0131 oldu\u011funun ya da devam\u0131n\u0131 hakl\u0131 k\u0131lan sebep veya sebeplerin bulunmad\u0131\u011f\u0131n\u0131n tespitidir. Bu tespit yap\u0131ld\u0131\u011f\u0131 takdirde buna ba\u011fl\u0131 olarak ilgilinin tutukluluk halinin devam\u0131na gerek\u00e7e olarak g\u00f6sterilen hukuki sebeplerin varl\u0131\u011f\u0131 sona erecek ve b\u00f6ylece ki\u015finin serbest kalmas\u0131n\u0131n yolu a\u00e7\u0131labilecektir. Bu ama\u00e7la yap\u0131lan bir ba\u015fvuruda, itiraz kanun yolunda \u00e7eli\u015fmeli yarg\u0131lama ve\/veya silahlar\u0131n e\u015fitli\u011fi gibi ilkelere uygun olarak bir inceleme yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131 da dikkate al\u0131nacakt\u0131r. Dolay\u0131s\u0131yla belirtilen nedenlerle ve serbest b\u0131rak\u0131lmay\u0131 temin edebilecek bir karar alma amac\u0131yla yap\u0131lacak bireysel ba\u015fvurular\u0131n, ola\u011fan kanun yollar\u0131 t\u00fcketilmek \u015fart\u0131yla, tutukluluk hali devam etti\u011fi s\u00fcrece yap\u0131labilmesi m\u00fcmk\u00fcnd\u00fcr (B. No: 2012\/726, 2\/7\/2013, \u00a7 30).<\/p>\n<p>22. Ancak, ba\u015fvurunun kabul edilebilir bulunabilmesi i\u00e7in ihlal iddias\u0131na dayanak te\u015fkil eden nihai i\u015flem veya kararlar\u0131n 23\/9\/2012 tarihinden evvel kesinle\u015fmemi\u015f olmalar\u0131 da gerekmektedir. Mahkemenin yarg\u0131 yetkisine ili\u015fkin bu tespitin bireysel ba\u015fvuru incelemesinin her a\u015famas\u0131nda yap\u0131labilmesi m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>23. Somut olayda ba\u015fvurucular\u0131n mahk\u00fbmiyet karar\u0131n\u0131n a\u00e7\u0131kland\u0131\u011f\u0131 21\/9\/2012 tarihinde tutukluluk halleri sona ermi\u015ftir. Buna g\u00f6re tutuklulukla ilgili \u015fik\u00e2yetlerin bir b\u00fct\u00fcn olarak ba\u015fvurucular hakk\u0131nda h\u00fck\u00fcm verilmeden \u00f6nceki d\u00f6nemde kesinle\u015fen kararlara ili\u015fkin oldu\u011fu a\u00e7\u0131kt\u0131r.<\/p>\n<p>24. Ba\u015fvurucular\u0131n tutukluluk halleri davan\u0131n esas\u0131na ili\u015fkin karar\u0131n a\u00e7\u0131klanmas\u0131yla birlikte sona ermi\u015f ve ba\u015fvuruculara isnat olunan su\u00e7 sabit g\u00f6r\u00fclerek cezaland\u0131r\u0131lmalar\u0131na h\u00fckmedilmi\u015ftir. Dolay\u0131s\u0131yla, h\u00fckmen tutuklulu\u011fa itiraz incelemesinin 23\/9\/2012 tarihinden sonra ger\u00e7ekle\u015ftirilmi\u015f olmas\u0131n\u0131n Anayasa Mahkemesinin zaman bak\u0131m\u0131ndan yetkisi \u00fczerinde herhangi bir etkisi bulunmamaktad\u0131r (B. No: 2012\/239, 2\/7\/2013, \u00a7 35).<\/p>\n<p>25. A\u00e7\u0131klanan nedenlerle, ba\u015fvurucular\u0131n tutuklulu\u011fa ili\u015fkin \u015fik\u00e2yetlerine konu olan kararlar\u0131n Anayasa Mahkemesinin yetkisinin ba\u015flad\u0131\u011f\u0131 tarihten \u00f6nce kesinle\u015fti\u011fi anla\u015f\u0131ld\u0131\u011f\u0131ndan, ba\u015fvurular\u0131n bu k\u0131sm\u0131n\u0131n \u201czaman bak\u0131m\u0131ndan yetkisizlik\u201d nedeniyle kabul edilemez oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>b. Tan\u0131k Dinlenmesi Talepleri ve Dijital Delillerin De\u011ferlendirilmesine \u0130li\u015fkin \u015eik\u00e2yetler <\/p>\n<p>26. A\u00e7\u0131k\u00e7a dayanaktan yoksun olmayan ve kabul edilemezli\u011fine karar verilmesini gerektirecek ba\u015fka bir neden de g\u00f6r\u00fclmeyen ba\u015fvurunun bu k\u0131sm\u0131n\u0131n kabul edilebilir oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>2. Esas Y\u00f6n\u00fcnden<\/p>\n<p>a. Dijital Delillerin De\u011ferlendirilmesine \u0130li\u015fkin \u015eik\u00e2yetler<\/p>\n<p>27. Ba\u015fvurucular\u0131n bu ba\u015fl\u0131k alt\u0131ndaki \u015fik\u00e2yetleri \u00f6zetle \u015f\u00f6yledir: <\/p>\n<p>\u00a0i. Bilirki\u015fi raporlar\u0131 ile mahk\u00fbmiyet karar\u0131n\u0131n dayana\u011f\u0131 olan Eski\u015fehir\u2019de ele ge\u00e7irilen fla\u015f bellek, G\u00f6lc\u00fck Donanma Komutanl\u0131\u011f\u0131nda ele ge\u00e7irilen CD\u2019ler ve harddisklerin 2003 y\u0131l\u0131nda olu\u015fturuldu\u011fu iddia edildi\u011fi halde bu depolama ara\u00e7lar\u0131nda yer alan verilerin 2007 y\u0131l\u0131na ait bir program olan Microsoft Office 2007 program\u0131 ile yaz\u0131lm\u0131\u015f olmas\u0131n\u0131n belgelerin sahteli\u011fini kan\u0131tlad\u0131\u011f\u0131, <\/p>\n<p>\u00a0ii. Savunma taraf\u0131nca yurti\u00e7i ve yurtd\u0131\u015f\u0131ndaki \u00e7e\u015fitli \u00fcniversite ve ba\u011f\u0131ms\u0131z kurulu\u015flardan al\u0131nan bilirki\u015fi raporlar\u0131n\u0131n mahk\u00fbmiyet karar\u0131n\u0131n temel dayana\u011f\u0131 olan dijital verilerdeki manip\u00fclasyonlar\u0131 ortaya koydu\u011fu ve dijital veriler \u00fczerinde ikibine yak\u0131n \u00e7eli\u015fkiyi ortaya \u00e7\u0131kard\u0131\u011f\u0131 halde \u0130lk Derece Mahkemesi ve Yarg\u0131tayca bu raporlar\u0131n dikkate al\u0131nmayarak dijital belgelerin ilk olu\u015fturulduklar\u0131 gibi orijinal oldu\u011fu \u015feklindeki T\u00dcB\u0130TAK raporuna dayand\u0131\u011f\u0131,<\/p>\n<p>\u00a0iii. Mahkeme taraf\u0131ndan itibar edildi\u011fi gerek\u00e7eli h\u00fck\u00fcmde kabul ve ifade edilen T\u00dcB\u0130TAK g\u00f6revlilerince d\u00fczenlenmi\u015f raporlarda ve mahkemeye sunulan uzman raporlar\u0131nda ortak g\u00f6r\u00fc\u015f olarak ifade edilen; dijital bir verinin kullan\u0131c\u0131 dosya yollar\u0131n\u0131n, olu\u015fturulma ve son kaydedilme tarihlerinin kolayl\u0131kla de\u011fi\u015ftirilebilece\u011fi veya manip\u00fcle edilebilece\u011fi ya da eski tarihli olarak sonradan d\u00fczenlenebilece\u011fi ger\u00e7e\u011fi kar\u015f\u0131s\u0131nda, bir gazeteci olan M.B. taraf\u0131ndan savc\u0131l\u0131\u011fa teslim edilen 11, 16 ve 17 no.lu CD\u2019ler i\u00e7erisinde yer alan imzas\u0131z dijital verilerin, verilerde isimleri yaz\u0131l\u0131 ki\u015fi veya san\u0131klar bak\u0131m\u0131ndan hukuka uygun \u015fekilde elde edilmi\u015f bir delil olarak kabul edilmesinin adil yarg\u0131lanma hakk\u0131n\u0131n ihlali niteli\u011finde oldu\u011fu, <\/p>\n<p>\u00a0iv. Delil olarak ileri s\u00fcr\u00fclen t\u00fcm dijital materyaller ile ilgili olarak kapsaml\u0131 bir bilirki\u015fi incelemesi yapt\u0131rt\u0131lmas\u0131 taleplerinin davaya bir katk\u0131 sa\u011flamayaca\u011f\u0131 gerek\u00e7esiyle reddedilmi\u015f olmas\u0131n\u0131n savunma hakk\u0131n\u0131n k\u0131s\u0131tlanmas\u0131 niteli\u011finde oldu\u011fu, ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr. <\/p>\n<p>28. Anayasa\u2019n\u0131n \u201cHak arama h\u00fcrriyeti\u201d kenar ba\u015fl\u0131kl\u0131 36. maddesinin birinci f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>\u201cHerkes, me\u015fru vas\u0131ta ve yollardan faydalanmak suretiyle yarg\u0131 mercileri \u00f6n\u00fcnde davac\u0131 veya daval\u0131 olarak iddia ve savunma ile adil yarg\u0131lanma hakk\u0131na sahiptir.\u201d <\/p>\n<p>29. A\u0130HS\u2019nin \u201cAdil yarg\u0131lanma hakk\u0131\u201d ba\u015fl\u0131kl\u0131 6. maddesinin (1) numaral\u0131 f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>\u201c1. Herkes davas\u0131n\u0131n, \u2026 cezai alanda kendisine y\u00f6neltilen su\u00e7lamalar\u0131n esas\u0131 konusunda karar verecek olan, yasayla kurulmu\u015f, ba\u011f\u0131ms\u0131z ve tarafs\u0131z bir mahkeme taraf\u0131ndan, adil ve kamuya a\u00e7\u0131k olarak, \u2026 g\u00f6r\u00fclmesini isteme hakk\u0131na sahiptir.<\/p>\n<p>30. Anayasa\u2019daki haklar\u0131n etkili bir bi\u00e7imde korunmas\u0131 i\u00e7in, davaya bakan mahkemelerin Anayasa\u2019n\u0131n 36. maddesine g\u00f6re \u201ctaraflar\u0131n dayanaklar\u0131n\u0131, iddialar\u0131n\u0131 ve delillerini etkili bir bi\u00e7imde inceleme g\u00f6revi\u201d vard\u0131r (benzer y\u00f6ndeki A\u0130HM karar\u0131 i\u00e7in bkz. Dulaurans\/Fransa, B. No: 34553\/97, 21\/3\/2000, \u00a7 33). A\u0130HM i\u00e7tihatlar\u0131na g\u00f6re bir mahkemenin davaya yakla\u015f\u0131m\u0131, ba\u015fvurucular\u0131n iddialar\u0131na yan\u0131t vermekten ve ba\u015fvurucular\u0131n temel \u015fikayetlerini incelemekten ka\u00e7\u0131nmalar\u0131na neden olmas\u0131 halinde S\u00f6zle\u015fme\u2019nin 6. maddesi davan\u0131n d\u00fczg\u00fcn bir bi\u00e7imde incelenmesi hakk\u0131 bak\u0131m\u0131ndan ihlal edilmi\u015f olur (bkz. Kuznetsov\/Rusya, B. No: 184\/02, 11\/4\/2007, \u00a7\u00a7 84-85). <\/p>\n<p>31. \u00d6te yandan mahkemelerin, ba\u015fvurucular\u0131n \u00f6nemli baz\u0131 iddialar\u0131na yan\u0131t vermemi\u015f olmas\u0131, ki\u015finin iddialar\u0131n\u0131n incelenmesi hakk\u0131n\u0131n yan\u0131nda, adil yarg\u0131lanma hakk\u0131n\u0131n \u00f6nemli gerekliliklerinden biri olan mahkemelerin karar\u0131 gerek\u00e7elendirme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc ile de ili\u015fkilidir. Zira bir muhakemede usule ili\u015fkin koruma sa\u011flayan adil yarg\u0131lanma hakk\u0131n\u0131n \u00f6nemli unsurlar\u0131ndan biri olan gerek\u00e7eli karar hakk\u0131 da ki\u015filerin adil bir \u015fekilde yarg\u0131lanmalar\u0131n\u0131 sa\u011flamay\u0131 ve denetlemeyi ama\u00e7lamaktad\u0131r. <\/p>\n<p>32. Nitekim Anayasa Mahkemesi \u00f6nceki kararlar\u0131nda, Anayasa\u2019n\u0131n, b\u00fct\u00fcn mahkemelerin her t\u00fcrl\u00fc kararlar\u0131n\u0131n gerek\u00e7eli olarak yaz\u0131lmas\u0131n\u0131 ifade eden 141. maddesinin, adil yarg\u0131lanma hakk\u0131n\u0131n kapsam\u0131n\u0131n belirlenmesinde g\u00f6zetilmesi gerekti\u011fini belirtmi\u015ftir (bkz. B. No: 2013\/3351, 18\/9\/2013, \u00a7 49).<\/p>\n<p>33. Derece Mahkemeleri, kararlar\u0131n yap\u0131s\u0131 ve i\u00e7eri\u011fi ile ilgili olarak geni\u015f bir takdir yetkisine sahiptirler. \u00d6zellikle taraflarca ileri s\u00fcr\u00fclen kan\u0131tlar\u0131n kabul\u00fc ve de\u011ferlendirilmesi \u00f6ncelikle derece mahkemelerinin g\u00f6revidir (bkz. Van Mechelen ve Di\u011ferleri\/Hollanda, B. No: 21363\/93, 21364\/93, 21427\/93 ve 22056\/93, 23\/4\/1997, \u00a7 50). Bu nedenle, a\u00e7\u0131k\u00e7a keyfi olmad\u0131k\u00e7a, belirli bir kan\u0131t t\u00fcr\u00fcn\u00fcn kabul edilebilir olup olmad\u0131\u011f\u0131na, de\u011ferlendirme \u015fekline veya asl\u0131nda ba\u015fvurucunun su\u00e7lu olup olmad\u0131\u011f\u0131na karar vermek, Anayasa Mahkemesinin g\u00f6revi de\u011fildir (benzer de\u011ferlendirmeler i\u00e7in bkz. Garcia Ruiz \/\u0130spanya, B.No. 30544\/96, 21\/1\/1996, \u00a7 28).<\/p>\n<p>34. Buna kar\u015f\u0131n mahkemeler, \u201ckararlar\u0131n\u0131 hangi temele dayand\u0131rd\u0131klar\u0131n\u0131 yeterince a\u00e7\u0131k olarak belirtme\u201d y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc alt\u0131ndad\u0131rlar. Bu y\u00fck\u00fcml\u00fcl\u00fck, taraflar\u0131n temyiz hakk\u0131n\u0131 kullanabilmeleri i\u00e7in gerekli olmas\u0131n\u0131n yan\u0131 s\u0131ra (bkz. Hadj\u0131anastass\u0131ou\/Yunanistan, B. No: 12945\/87, 16\/12\/1992, \u00a7 33), taraflar\u0131n, muhakeme s\u0131ras\u0131nda ileri s\u00fcrd\u00fckleri iddialar\u0131n\u0131n kurallara uygun bir bi\u00e7imde incelenip incelenmedi\u011fini bilmeleri ve ayr\u0131ca demokratik bir toplumda, toplumun kendi ad\u0131na verilen yarg\u0131 kararlar\u0131n\u0131n sebeplerini \u00f6\u011frenmelerinin sa\u011flanmas\u0131 i\u00e7in de gereklidir. <\/p>\n<p>35. Mahkemelerin bu y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc, yarg\u0131lamada ileri s\u00fcr\u00fclen her t\u00fcrl\u00fc iddia ve savunmaya, karar gerek\u00e7esinde ayr\u0131nt\u0131l\u0131 \u015fekilde yan\u0131t verilmesi \u015feklinde anla\u015f\u0131lamaz (bkz. B. No: 2013\/1213, 4\/12\/2013, \u00a7 26). Bu nedenle, bir kararda tam olarak hangi unsurlar\u0131n bulunmas\u0131 gerekti\u011fi, davan\u0131n niteli\u011fine ve ko\u015fullar\u0131na ba\u011fl\u0131d\u0131r. Bununla birlikte muhakeme s\u0131ras\u0131nda a\u00e7\u0131k ve somut bir bi\u00e7imde \u00f6ne s\u00fcr\u00fclen iddia ve savunmalar\u0131n davan\u0131n sonucuna etkili olmas\u0131, ba\u015fka bir deyi\u015fle davan\u0131n sonucunu de\u011fi\u015ftirebilecek nitelikte bulunmas\u0131 halinde, davayla do\u011frudan ilgili olan bu hususlara mahkemelerce makul bir gerek\u00e7e ile yan\u0131t verilmesi gerekir. <\/p>\n<p>36. Ayr\u0131ca, insan haklar\u0131na ili\u015fkin g\u00fcvencelerin soyut ve teorik olarak de\u011fil, uygulamada ve etkili bir \u015fekilde sa\u011flanmas\u0131 gerekir. Buna g\u00f6re, mahkemelerin ileri s\u00fcr\u00fclen iddia ve savunmalara \u015feklen cevap vermi\u015f olmalar\u0131 yeterli olmay\u0131p, iddia ve savunmalara verilen cevaplar\u0131n dayanaks\u0131z olmamas\u0131, mant\u0131kl\u0131 ve tutarl\u0131 olmas\u0131 da gerekir. Di\u011fer bir ifadeyle mahkemelerce belirtilen gerek\u00e7eler, davan\u0131n \u015fartlar\u0131 dikkate al\u0131nd\u0131\u011f\u0131nda makul olmal\u0131d\u0131r. <\/p>\n<p>37. Makul gerek\u00e7e, davaya konu olay ve olgular\u0131n mahkemece nas\u0131l nitelendirildi\u011fini, kurulan h\u00fckm\u00fcn hangi nedenlere ve hukuksal d\u00fczenlemelere dayand\u0131r\u0131ld\u0131\u011f\u0131n\u0131 ortaya koyacak, olay ve olgular ile h\u00fck\u00fcm aras\u0131ndaki ba\u011flant\u0131y\u0131 g\u00f6sterecek nitelikte olmal\u0131d\u0131r (bkz. B. No: 2013\/1235, 13\/6\/2013, \u00a7 24). Gerek\u00e7elendirme, davan\u0131n sonucuna etkili olay, olgu ve arg\u00fcmanlar\u0131 a\u00e7\u0131klamak y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc olmakla birlikte, bu \u015fekildeki gerek\u00e7elendirmenin mutlaka detayl\u0131 olmas\u0131 \u015fart de\u011fildir. Ancak gerek\u00e7elendirmenin, iddia ve savunmadan birinin di\u011ferine \u00fcst\u00fcn tutulma sebebinin ve bu kapsamda davan\u0131n taraflar\u0131nca g\u00f6sterilen delillerden karara dayanak olarak al\u0131nanlar\u0131n mahkemelerce kabul edilme ve di\u011ferlerinin reddedilmesi hususunda, makul dayanaklar\u0131 olan bir bilgilendirmeyi sa\u011flayacak \u00f6l\u00e7\u00fc ve \u00f6zene sahip olmas\u0131 gerekmektedir. <\/p>\n<p>38. Zira bir davada taraflar\u0131n, hukuk d\u00fczenince hangi nedenle hakl\u0131 veya haks\u0131z g\u00f6r\u00fcld\u00fcklerini anlay\u0131p de\u011ferlendirebilmeleri i\u00e7in usul\u00fcne uygun \u015fekilde olu\u015fturulmu\u015f, h\u00fckm\u00fcn i\u00e7erik ve kapsam\u0131 ile bu h\u00fckme var\u0131l\u0131rken mahkemenin neleri dikkate ald\u0131\u011f\u0131 ya da almad\u0131\u011f\u0131n\u0131 g\u00f6steren, ifadeleri \u00f6zenle se\u00e7ilmi\u015f ve ku\u015fkuya yer vermeyecek a\u00e7\u0131kl\u0131ktaki bir gerek\u00e7e b\u00f6l\u00fcm\u00fcn\u00fcn ve buna uyumlu h\u00fck\u00fcm f\u0131kralar\u0131n\u0131n bulunmas\u0131 \u201cgerek\u00e7eli karar hakk\u0131\u201d y\u00f6n\u00fcnden zorunludur. <\/p>\n<p>39. Aksi bir tutumla, mahkemenin, davan\u0131n sonucuna etkili oldu\u011funu kabul etti\u011fi bir husus hakk\u0131nda \u201cilgili ve yeterli bir yan\u0131t\u201d vermemesi veya yan\u0131t verilmesini gerektiren usul veya esasa dair iddialar\u0131n cevaps\u0131z b\u0131rak\u0131lm\u0131\u015f olmas\u0131 bir hak ihlaline neden olabilecektir.<\/p>\n<p>40. Ba\u015fvurucular somut davada, bir gazeteci taraf\u0131ndan Cumhuriyet Savc\u0131l\u0131\u011f\u0131na teslim edilen 11, 16 ve 17 nolu CD\u2019ler ile G\u00f6lc\u00fck Donanma Komutanl\u0131\u011f\u0131nda bulunan 5 nolu harddisk ve Eski\u015fehir\u2019de bir san\u0131\u011f\u0131n evinde bulunan flash bellekte yer alan dijital verilerin sahte olarak olu\u015fturulduklar\u0131n\u0131, bu verilerde pek \u00e7ok manip\u00fclasyon yap\u0131ld\u0131\u011f\u0131n\u0131, savunma taraf\u0131nca yurti\u00e7i ve yurtd\u0131\u015f\u0131ndaki \u00e7e\u015fitli \u00fcniversite ve ba\u011f\u0131ms\u0131z kurulu\u015flardan al\u0131nan bilirki\u015fi raporlar\u0131nda mahk\u00fbmiyet karar\u0131n\u0131n temel dayana\u011f\u0131 olan dijital verilerdeki manip\u00fclasyonlar\u0131n ortaya konuldu\u011funu ve dijital veriler \u00fczerinde ikibine yak\u0131n \u00e7eli\u015fkinin ortaya \u00e7\u0131kart\u0131ld\u0131\u011f\u0131n\u0131, buna ra\u011fmen \u0130lk Derece Mahkemesi ve Yarg\u0131tay\u0131n bu raporlar\u0131 dikkate almad\u0131\u011f\u0131n\u0131 ve dikkate almama nedenlerinin makul bir gerek\u00e7eyle izah etmediklerini ileri s\u00fcrm\u00fc\u015flerdir.<\/p>\n<p>41. Ba\u015fvurucular\u0131n, esas olarak san\u0131klardan elde edilmemi\u015f, T\u00fcrk Silahl\u0131 Kuvvetlerinde bulunan bir bilgisayarda haz\u0131rland\u0131\u011f\u0131 kan\u0131tlanamam\u0131\u015f, zaman, mekan ve muhteva \u00e7eli\u015fkileri bulunan ve bu sebeple esas itibariyle sahte olarak olu\u015fturulmu\u015f dijital belgelere dayanarak su\u00e7land\u0131klar\u0131 yolundaki savunmalar\u0131na kar\u015f\u0131 Mahkemenin a\u015fa\u011f\u0131da \u00f6zetlenen gerek\u00e7elerinin makul, ba\u015fka bir deyi\u015fle yeterince a\u00e7\u0131k ve yeterli olup olmad\u0131\u011f\u0131n\u0131n tespiti i\u00e7in ba\u015fvurucular taraf\u0131ndan sunulan bilirki\u015fi raporlar\u0131 ve uzman m\u00fctalaalar\u0131n\u0131n denetlenebilir, makul yan\u0131t\u0131n\u0131n verilmesi gerekir (bkz. gerek\u00e7eli karar, s.874-904).<\/p>\n<p>42. \u00d6zet olarak \u0130lk Derece Mahkemesi, elde edilen dijital belgelere ili\u015fkin olarak haz\u0131rlanan bilirki\u015fi raporlar\u0131ndan yaln\u0131zca Cumhuriyet savc\u0131l\u0131\u011f\u0131nca soru\u015fturma a\u015famas\u0131nda T\u00dcB\u0130TAK uzmanlar\u0131nca haz\u0131rlanan bilirki\u015fi raporu ile arama ve el koyma tedbirleri s\u0131ras\u0131nda ele ge\u00e7irilen delillerin tespitine y\u00f6nelik \u00fc\u00e7 raporu h\u00fckme esas alm\u0131\u015f, ba\u015fvurucular taraf\u0131ndan al\u0131nm\u0131\u015f olan bilirki\u015fi raporlar\u0131 ile duru\u015fmada dinlenen uzman m\u00fctalaalar\u0131n\u0131n hi\u00e7birine itibar etmemi\u015ftir. Mahkeme, ba\u015fvurucular taraf\u0131ndan sunulan t\u00fcm rapor ve m\u00fctalaalar\u0131n \u00f6z\u00fcn\u00fcn dijital veriler \u00fczerinde de\u011fi\u015fiklik yap\u0131ld\u0131\u011f\u0131na ili\u015fkin oldu\u011funu, kendisinin de bu de\u011fi\u015fiklik i\u015flemini zaten kabul etti\u011fini, rapor ve uzman m\u00fctalaalar\u0131n\u0131n bunun d\u0131\u015f\u0131ndaki k\u0131s\u0131mlar\u0131nda ise \u201cdijital verilerin delil olamayaca\u011f\u0131 y\u00f6n\u00fcnde ve adeta san\u0131k m\u00fcdafii gibi ayr\u0131nt\u0131l\u0131 tespitlerde bulunmu\u015f ve t\u00fcm \u00e7abalar\u0131 ile bu delilleri \u00e7\u00fcr\u00fctmeye \u00e7al\u0131\u015fm\u0131\u015f\u201d olmalar\u0131 nedeniyle bu bilirki\u015fi raporlar\u0131 ve uzman m\u00fctalaalar\u0131n\u0131n h\u00fckme esas al\u0131namayaca\u011f\u0131n\u0131 belirtmi\u015ftir. <\/p>\n<p>43. \u0130lk Derece Mahkemesi, ba\u015fvurucular taraf\u0131ndan sunulan rapor ve m\u00fctalaalara ra\u011fmen dijital verileri h\u00fckme esas alma nedenini \u015fu hususlara dayand\u0131rm\u0131\u015ft\u0131r (bkz. gerek\u00e7eli karar, s.1036-1044) <\/p>\n<p>Mahkeme;<\/p>\n<p>\u00a0a. \u00dc\u00e7 ayr\u0131 yerden elde edilen dijital delillerin birbirlerini do\u011frular i\u00e7eriklere sahip oldu\u011fu;<\/p>\n<p>\u00a0b. Belgelerde zaman \u00e7eli\u015fkilerinin bulundu\u011fu ve 2003 y\u0131l\u0131ndan sonraki tarihlerdeki olaylara ili\u015fkin bilgilerin oldu\u011fu do\u011fru ise de 2003 y\u0131l\u0131ndan sonra olu\u015fturulmu\u015f olan belgelerin Balyoz Harekat Plan\u0131, Eylem Planlar\u0131 ve ses kay\u0131tlar\u0131nda yer alan bilgilerin g\u00fcncellenece\u011fi y\u00f6n\u00fcndeki talimatlar\u0131n yerine getirilmesinden ibaret oldu\u011fu ve 2003 y\u0131l\u0131ndan sonra da plan, bilgi ve listelerin g\u00fcncelle\u015ftirildi\u011fi; <\/p>\n<p>\u00a0c. Balyoz Harekat Plan\u0131 kapsam\u0131ndaki cunta yap\u0131lanmas\u0131n\u0131n elinde bulunan dijital belgelerin veri yollar\u0131nda, yazar bilgilerinde uygunsuzluk olmas\u0131n\u0131n, dijital verilerin delil olma niteli\u011fini tek ba\u015f\u0131na ortadan kald\u0131rmayaca\u011f\u0131, san\u0131klar\u0131n bir\u00e7ok konuyu \u00f6ng\u00f6rd\u00fckleri ve bu kapsamda mevzuat \u00e7al\u0131\u015fmalar\u0131 yapt\u0131klar\u0131, hata kod tablolar\u0131 ve ihtimalat planlar\u0131 haz\u0131rlad\u0131klar\u0131, gerek san\u0131klar\u0131n belgelerin olu\u015fturulma a\u015famas\u0131nda gerekse san\u0131klar\u0131n ve cunta yap\u0131lanmalar\u0131n\u0131n g\u00fcncellenmesi \u00e7al\u0131\u015fmalar\u0131nda dijital verilerde bug\u00fcnk\u00fc savunmalar\u0131n temelini olu\u015fturabilmek amac\u0131yla bir\u00e7ok \u00e7eli\u015fkinin yakalanmalar\u0131 halinde kullan\u0131lmak \u00fczere bizzat san\u0131klar taraf\u0131ndan bilerek yap\u0131lm\u0131\u015f olma ihtimalinin bulundu\u011fu;<\/p>\n<p>\u00a0e. Davan\u0131n esas\u0131n\u0131 olu\u015fturan CD\u2019lerin 2007-2008 y\u0131llar\u0131na kadar plan odas\u0131nda kald\u0131\u011f\u0131 ve daha sonra bir \u015fekilde buradan \u00e7\u0131kart\u0131ld\u0131\u011f\u0131 sabit olmakla birlikte plan odas\u0131n\u0131n herkesin girip \u00e7\u0131kmas\u0131na a\u00e7\u0131k, kontrol\u00fcn\u00fcn zay\u0131f bir yer oldu\u011fu;<\/p>\n<p>\u00a0f. Dijital belgelerden baz\u0131lar\u0131 2007 y\u0131l\u0131na ait Microsoft Office program\u0131 ile yaz\u0131lm\u0131\u015f olmakla birlikte, Microsoft Office\u2019in \u00f6nceki versiyonlar\u0131 kullan\u0131lmak suretiyle bir veri haz\u0131rland\u0131ktan sonra, haz\u0131rlanan verinin yeni tarihli bir program ile a\u00e7\u0131lmaya \u00e7al\u0131\u015f\u0131ld\u0131\u011f\u0131nda bilgisayar\u0131n eski tarihli veriyi sanki a\u00e7\u0131lma tarihindeki yeni versiyonu ile yaz\u0131lm\u0131\u015f gibi d\u00f6n\u00fc\u015ft\u00fcrerek a\u00e7abilece\u011fi, bu nedenle de somut olarak 2003 y\u0131l\u0131nda yaz\u0131lm\u0131\u015f olan bir word belgesinin 2007 y\u0131l\u0131nda yeni versiyon y\u00fckl\u00fc bir bilgisayarda a\u00e7\u0131ld\u0131\u011f\u0131nda bu 2003 tarihinde yaz\u0131lm\u0131\u015f olan belgenin sanki 2007 y\u0131l\u0131nda haz\u0131rlanm\u0131\u015f ve yaz\u0131lm\u0131\u015f gibi g\u00f6r\u00fcnebilece\u011fi; <\/p>\n<p>\u00a0g. 2003 y\u0131l\u0131nda tanzim edildi\u011fi iddia edilen ke\u015fif ve plan krokilerindeki sokak isimlerinden baz\u0131lar\u0131n\u0131n resmi olarak 2007 y\u0131l\u0131ndan sonra verilmesi nedeniyle krokilerin, sokaklara resmi olarak bu isimler verildikten sonra \u00e7izildi\u011fi iddia edilmi\u015f ise de bu sokaklar\u0131n isimlerinin halk aras\u0131nda, a\u00e7\u0131k kaynaklarda da g\u00f6r\u00fclece\u011fi \u00fczere, de\u011fi\u015fiklikten \u00f6nceki isimleriyle 40-50 y\u0131ld\u0131r kullan\u0131ld\u0131\u011f\u0131; <\/p>\n<p>\u00a0h. 2005-2006 y\u0131llar\u0131nda fiilen T\u00fcrk Silahl\u0131 Kuvvetleri b\u00fcnyesine kat\u0131lan bir geminin ad\u0131n\u0131n 2003 y\u0131l\u0131nda haz\u0131rlanan bir CD i\u00e7erisinde olmas\u0131n\u0131n CD\u2019nin sahteli\u011fine i\u015faret etti\u011fi ileri s\u00fcr\u00fclm\u00fc\u015f ise de, bir geminin isminin in\u015fa ve sat\u0131n alma s\u00f6zle\u015fmesinin kesinle\u015fmesine m\u00fcteakip verilmi\u015f olabilece\u011fi; <\/p>\n<p>\u00a0\u0131. San\u0131klar\u0131n, kendilerince haz\u0131rlanan bir darbe \u00e7al\u0131\u015fmas\u0131nda \u015fu veya bu \u015fekilde, bilerek veya bilmeyerek yapt\u0131klar\u0131 yanl\u0131\u015flar ve \u00e7eli\u015fkilerin, t\u00fcm dosya g\u00f6z \u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda te\u015febb\u00fcs edilen darbe su\u00e7unun s\u00fcbutunu etkilemeyece\u011fi;<\/p>\n<p>\u00a0\u015feklinde a\u00e7\u0131klamalarda bulunmu\u015ftur. <\/p>\n<p>44. \u0130lk Derece Mahkemesinin gerek\u00e7esinde rapor ve m\u00fctalaalarda ileri s\u00fcr\u00fclen g\u00f6r\u00fc\u015fleri yeterince a\u00e7\u0131k olarak de\u011ferlendirme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc yerine getirip getirmedi\u011fini tespit edebilmek i\u00e7in ba\u015fvurucular taraf\u0131ndan sunulan rapor ve m\u00fctalaalar\u0131n \u00f6z\u00fcn\u00fcn kavranmas\u0131 gerekir. <\/p>\n<p>45. Gerek iddia makam\u0131 ve gerekse savunma makam\u0131 taraf\u0131ndan sunulan rapor ve m\u00fctalaalarda mahkumiyet karar\u0131n\u0131n dayana\u011f\u0131 olan 11, 16 ve 17 no\u2019lu CD\u2019lerdeki dok\u00fcmanlarda, 5 no\u2019lu harddiskte ve flash bellekte yer alan dok\u00fcmanlar\u0131n kolayca kurgulanma veya bu t\u00fcr veriler \u00fczerinde kolayca manip\u00fclasyon yap\u0131lma ihtimali bulundu\u011fu, bu dijital verilerin, bir ger\u00e7ekli\u011fi kesin olarak temsil etti\u011finin s\u00f6ylenemeyece\u011fi ifade edilmi\u015ftir. Nitekim \u0130lk Derece Mahkemesi de bu sebeple karar\u0131n\u0131 yaln\u0131zca dijital verilere dayand\u0131rmad\u0131\u011f\u0131n\u0131 ba\u015fka delillerle birlikte ba\u015fvurucular\u0131n mahk\u00fbmiyetlerine karar verdi\u011fini belirtmi\u015ftir. <\/p>\n<p>46. \u0130lk Derece Mahkemesine sunulan bilirki\u015fi raporlar\u0131nda, 17 no\u2019lu CD\u2019nin 04\/03\/2003 tarihinde saat 23:52:02\u2019de, 11 no\u2019lu CD\u2019nin 05\/03\/2003 tarihinde saat 23:50:42\u2019de, 16 no\u2019lu CD\u2019nin ise 14\/10\/2003 tarihinde saat 12:14:34\u2019de olu\u015fturuldu\u011fu g\u00f6r\u00fclmektedir. Ayn\u0131 raporlarda, CD\u2019lerde yer alan dosyalar\u0131n olu\u015fturma ve son kaydetme tarihleri CD\u2019lerin yazd\u0131r\u0131ld\u0131\u011f\u0131 tarih olan 04\/03\/2003, 05\/03\/2003 ve 14\/10\/2003 tarihinden \u00f6nceye ait olmakla birlikte pek \u00e7ok belgenin asl\u0131nda bu tarihlerden sonra \u00fcretildi\u011fi, 2003 y\u0131l\u0131 sonras\u0131na ait programlar\u0131n kullan\u0131ld\u0131\u011f\u0131 veya belge i\u00e7eriklerinde 2003 y\u0131l\u0131 sonras\u0131na ait bilgilerin yer ald\u0131\u011f\u0131 tespit edilmi\u015ftir. Bu tespitler \u00fczerine bilirki\u015filer, s\u00f6z konusu belgelerin bir defada, sistem saati g\u00fcncel olmayan bir bilgisayarda CD\u2019lere yazd\u0131r\u0131ld\u0131\u011f\u0131 g\u00f6r\u00fc\u015f\u00fcn\u00fc bildirmi\u015flerdir. \u0130lk Derece Mahkemesi, 2003 y\u0131l\u0131ndan sonra olu\u015fturulmu\u015f belgelerin plan, bilgi ve listelerin g\u00fcncelle\u015ftirildi\u011fini g\u00f6sterdi\u011fini kabul etmi\u015ftir. Bununla birlikte Mahkeme, 2003 y\u0131l\u0131 sonras\u0131 \u201cg\u00fcncelle\u015ftirilmi\u015f\u201d olarak kabul etti\u011fi belgelerin, nas\u0131l olup da CD\u2019lerin yazd\u0131r\u0131lma tarihlerinden \u00f6nceki tarihleri g\u00f6sterdi\u011fini cevaplamam\u0131\u015ft\u0131r. <\/p>\n<p>47. \u0130lk derece Mahkemesinin karar\u0131nda dayanak ald\u0131\u011f\u0131 \u0130stanbul Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131nca g\u00f6revlendirilen Emniyet M\u00fcd\u00fcrl\u00fc\u011f\u00fc uzmanlar\u0131nca haz\u0131rlanan bilirki\u015fi raporunda (gerek\u00e7eli karar, s.887); 11 nolu CD\u2019nin olu\u015fturulma tarihi ve saati &#8220;05\/03\/2003, 23:50:42&#8221; oldu\u011fu, CD i\u00e7erisinde 68 adet klas\u00f6r i\u00e7erisinde toplam 287 adet dosya bulundu\u011fu ve t\u00fcm dosyalar\u0131n &#8220;08.04.1996 16:39:44&#8221; ila &#8220;04.03.2003 13:01&#8221; tarihleri aras\u0131nda olu\u015fturuldu\u011fu, bu noktadan hareketle b\u00fct\u00fcn dosyalar\u0131n olu\u015fturulma tarihlerinin CD\u2019nin olu\u015fturulma tarihinden \u00f6nce oldu\u011fu ve son d\u00fczenlenme tarihi en ge\u00e7 olan dosyan\u0131n, &#8220;04.03.2003, 22:07&#8221; tarihinde d\u00fczenlenen &#8220;EK-M LAH\u0130KA-\u0130 B\u0130RLE\u015eT\u0130R\u0130LM\u0130\u015e L\u0130STE.doc&#8221; isimli MS Word dosyas\u0131 oldu\u011fu, bu dosyan\u0131n son d\u00fczenlenme tarihinin de yine CD\u2019nin olu\u015fturulma tarihinden \u00f6nce oldu\u011fu belirtilmi\u015ftir.<\/p>\n<p>48. Mahkeme, bu \u00e7eli\u015fkilerin bizzat san\u0131klarca daha sonra yarg\u0131lanma ihtimallerine kar\u015f\u0131n bilin\u00e7li olarak olu\u015fturulmu\u015f olabilece\u011fi ihtimalini karar\u0131na gerek\u00e7e yapm\u0131\u015f ve ayr\u0131ca bu t\u00fcr belgelerin mahk\u00fbmiyet karar\u0131n\u0131n dayand\u0131\u011f\u0131 belgeler olmad\u0131\u011f\u0131, say\u0131ca fazla olmad\u0131\u011f\u0131 ve karar\u0131n sonucunu etkileyecek nitelikte olmad\u0131klar\u0131n\u0131 belirtmi\u015ftir. <\/p>\n<p>49. Arsenel\u2019in DATA MFT\u2019de tespit etti\u011fi tarih ve zaman ayk\u0131r\u0131l\u0131klar\u0131ndan biri, Samsung Sabit Disk\u2019e en son yaz\u0131lan 120 dosya ve klas\u00f6r\u00fcn, 8 Nisan 2004 \u2018de olu\u015fturulmu\u015f gibi g\u00f6r\u00fcnmesidir. Arsenal\u2019e g\u00f6re bu husus, Samsung sabit diski 28 Temmuz 2009 \u2018a kadar kullan\u0131mda oldu\u011fu i\u00e7in m\u00fcmk\u00fcn de\u011fildir. Buna kar\u015f\u0131n Mahkeme verilerin uzun s\u00fcre san\u0131klar\u0131n ve dava d\u0131\u015f\u0131 ki\u015filerin elinde bulunmas\u0131 s\u0131ras\u0131nda zaman ve i\u00e7erik \u00e7eli\u015fkileri bulunan belgelerin ileride yeni bir darbe yapmak amac\u0131yla k\u0131smen veya tamamen g\u00fcncellenmi\u015f olma ihtimalini de d\u0131\u015flamamaktad\u0131r. Mahkumiyet karar\u0131n\u0131n dayana\u011f\u0131n\u0131 olu\u015fturmas\u0131 nedeniyle, s\u00f6z konusu CD\u2019lerin sistem saati g\u00fcncel olmayan bir bilgisayarda 2003 y\u0131l\u0131ndan sonra ve muhtemelen 2007 y\u0131l\u0131ndan sonraki bir tarihte olu\u015fturuldu\u011fu kabul edilse bile CD\u2019lerin olu\u015fturuldu\u011fu tarihe kadar san\u0131klar\u0131n ya da dava d\u0131\u015f\u0131 baz\u0131 kimselerin elinde bulunan ve Mahkemenin kabul\u00fcne g\u00f6re g\u00fcncellenen bir k\u0131s\u0131m dok\u00fcman\u0131n olu\u015fturulma tarihinin hangi surette CD\u2019lerin olu\u015fturuldu\u011fu tarihten \u00f6nce \u00fcretildi\u011fi hususunun, Mahkemece \u015f\u00fcpheye yer b\u0131rakmayacak ve ikna edici bir \u015fekilde a\u00e7\u0131klanmas\u0131 gerekmektedir. <\/p>\n<p>56. \u0130lk Derece Mahkemesinin g\u00fcncelleme varsay\u0131m\u0131na kar\u015f\u0131 ba\u015fvurucular taraf\u0131ndan ileri s\u00fcr\u00fclen \u00f6nemli bir iddia da davaya konu belgelerin \u00fcstveri bilgilerinde g\u00fcncelleme yap\u0131ld\u0131\u011f\u0131n\u0131n g\u00f6r\u00fclmedi\u011fidir. \u0130lk Derece Mahkemesine sunulan bilirki\u015fi raporlar\u0131 ve uzman m\u00fctalaalar\u0131na g\u00f6re (\u00f6rne\u011fin Prof. Dr. Ahmet Co\u015fkun S\u00f6nmez\u2019in m\u00fctalaas\u0131) 2003 y\u0131l\u0131nda yaz\u0131lm\u0131\u015f olan bir belgenin 2007 y\u0131l\u0131nda \u00fcretilmi\u015f bir programla a\u00e7\u0131lmas\u0131 tabiidir. S\u00f6z konusu rapor ve m\u00fctalaa, 2\/5\/2011 tarihli duru\u015fmada tart\u0131\u015f\u0131lm\u0131\u015f olmas\u0131na ve CD\u2019ler \u00fczerindeki yaz\u0131lar\u0131n san\u0131k S\u00fcha Tanyeri\u2019nin davaya konu 1. Ordu Plan Semineri s\u0131ras\u0131nda tuttu\u011fu el yaz\u0131s\u0131ndan kopyaland\u0131\u011f\u0131 iddia olunmas\u0131na ra\u011fmen, \u0130lk Derece Mahkemesi ve Yarg\u0131tay taraf\u0131ndan bu hususta bir a\u00e7\u0131klama yap\u0131lmam\u0131\u015ft\u0131r.<\/p>\n<p>58. Tarafs\u0131zl\u0131\u011f\u0131, keyfili\u011fi, denetimden ka\u00e7may\u0131 ve perdelemeyi \u00f6nlemek i\u00e7in mahkemeler, karar\u0131n verilmesine neden olan temelleri yeterince a\u00e7\u0131k olarak belirtmekle y\u00fck\u00fcml\u00fcd\u00fcrler. Mahkemelerin yarg\u0131lama s\u00fcresince kendilerine iletilen her iddia ve talebi g\u00f6zetme zorunda olmad\u0131klar\u0131 bi\u00e7imindeki serbesti, karar\u0131n verilmesine neden olan temellere asgari a\u00e7\u0131kl\u0131kta de\u011finilmesi g\u00f6revini ortadan kald\u0131racak \u015fekilde yorumlanamaz. <\/p>\n<p>59. Bireysel ba\u015fvuru yolunda derece mahkemelerinin gerek\u00e7elerinin niteli\u011fi, ancak a\u00e7\u0131k bir keyfilik veya takdir hatas\u0131 olu\u015fturdu\u011fu ya da makul ve ikna edici a\u00e7\u0131klamalar i\u00e7eren bir gerek\u00e7e g\u00f6sterilmedi\u011fi, iddia olunan eylem ile h\u00fck\u00fcm aras\u0131nda \u201cuygun illiyet ba\u011f\u0131\u201d kurulmad\u0131\u011f\u0131 durumlarda denetlenebilir. Derece mahkemesi kararlar\u0131n\u0131n, adalet gereksinimini giderecek \u00f6l\u00e7\u00fc ve nitelikte yeterli gerek\u00e7e ile a\u00e7\u0131klan\u0131p a\u00e7\u0131klanmad\u0131\u011f\u0131 hususlar\u0131, adil yarg\u0131lanma hakk\u0131n\u0131n ihlali iddias\u0131yla yap\u0131lan bireysel ba\u015fvurularda Anayasa Mahkemesince yap\u0131lacak denetimin kapsam\u0131nda yer almaktad\u0131r. <\/p>\n<p>60. Somut ba\u015fvuruda, \u0130lk Derece Mahkemesinin h\u00fckme esas ald\u0131\u011f\u0131, bir gazeteci taraf\u0131ndan Cumhuriyet Savc\u0131l\u0131\u011f\u0131na teslim edilen 11, 16 ve 17 nolu CD\u2019ler ile G\u00f6lc\u00fck Donanma Komutanl\u0131\u011f\u0131nda bulunan 5 nolu harddisk ve Eski\u015fehir\u2019de bir san\u0131\u011f\u0131n evinde bulunan flash bellekte yer alan ve ba\u015fvurucular\u0131n T\u00fcrkiye Cumhuriyeti \u0130cra Vekilleri Heyetini Cebren Iskat veya Vazife G\u00f6rmekten Men Etmek su\u00e7una te\u015febb\u00fcs ettiklerini ispatlad\u0131\u011f\u0131 kabul edilen dijital dok\u00fcmanlar\u0131n g\u00fcvenilirli\u011fine ili\u015fkin iddialar ileri s\u00fcr\u00fclm\u00fc\u015f, savunmalarda bulunulmu\u015ftur. \u0130lk Derece Mahkemesi bu \u00e7eli\u015fkilerin varl\u0131\u011f\u0131n\u0131 kabul etmi\u015f, bir k\u0131s\u0131m zaman \u00e7eli\u015fkilerinin dava konusu belgelerin san\u0131klarca g\u00fcncellenmi\u015f olmas\u0131 nedeniyle olu\u015fmu\u015f olabilece\u011fi ihtimaline, bir k\u0131sm\u0131n\u0131n bizzat san\u0131klarca daha sonra yarg\u0131lanma ihtimallerine kar\u015f\u0131n bilin\u00e7li olarak olu\u015fturulmu\u015f olabilece\u011fi ihtimaline dayand\u0131rm\u0131\u015f ve bu t\u00fcr belgelerin mahk\u00fbmiyet karar\u0131n\u0131n dayand\u0131\u011f\u0131 belgeler olmad\u0131\u011f\u0131, say\u0131ca fazla olmad\u0131\u011f\u0131 ve karar\u0131n sonucunu etkileyecek nitelikte olmad\u0131klar\u0131n\u0131 belirtmi\u015ftir. Buna kar\u015f\u0131n, Amerikan Forensic Labratory isimli firman\u0131n bilirki\u015fi raporu \u00f6rne\u011finde oldu\u011fu gibi davan\u0131n esas\u0131n\u0131 etkileyecek baz\u0131 savunma delillerine ise gerek\u00e7eli kararda hi\u00e7 de\u011finilmemi\u015f, baz\u0131 raporlara neden itibar edilmedi\u011fine ili\u015fkin bir a\u00e7\u0131klamaya da yer verilmemi\u015ftir.<\/p>\n<p>61. Savunmalar\u0131n dayana\u011f\u0131n\u0131 olu\u015fturan ve dijital verilerin g\u00fcvenilirli\u011fine ili\u015fkin ciddi ku\u015fkular uyanmas\u0131na neden olan bilirki\u015fi raporlar\u0131 ve uzman m\u00fctalaalar\u0131 g\u00f6zetildi\u011finde, \u00f6nemli \u00f6l\u00e7\u00fcde, dijital veri ve i\u00e7eriklerine dayanan \u0130lk Derece Mahkemesince verilen karar\u0131n gerek\u00e7esi, adalet gereksinimini giderecek \u00f6l\u00e7\u00fc ve nitelikte, yeterli ve makul olarak de\u011ferlendirilemez. Bu sebeple \u201cgerek\u00e7eli karar hakk\u0131\u201d ihlal edilmi\u015ftir.<\/p>\n<p>62. \u0130lk Derece Mahkemesince, ba\u015fvurucular taraf\u0131ndan mahkemeye sunulan rapor ve uzman m\u00fctalaalar\u0131n\u0131n h\u00fckme esas almamas\u0131 gerek\u00e7esi olarak, s\u00f6z konusu rapor ve m\u00fctalaalarda Mahkemenin yerine ge\u00e7erek delil de\u011ferlendirmesi yap\u0131lmas\u0131 hususu g\u00f6sterilmi\u015ftir. Mahkemeye g\u00f6re bu rapor ve beyanlarda \u201cdijital verilerin delil olamayaca\u011f\u0131 y\u00f6n\u00fcnde ve adeta san\u0131k m\u00fcdafii gibi ayr\u0131nt\u0131l\u0131 tespitlerde\u201d bulunulmu\u015f ve uzman ki\u015filer \u201ct\u00fcm \u00e7abalar\u0131 ile bu delilleri \u00e7\u00fcr\u00fctmeye \u00e7al\u0131\u015fm\u0131\u015flard\u0131r\u201d. Mahkeme, 5271 say\u0131l\u0131 Kanun\u2019un 67. maddesinin (3) numaral\u0131 f\u0131kras\u0131nda yer alan ve bilirki\u015filerin raporlar\u0131nda, h\u00e2kim taraf\u0131ndan yap\u0131lmas\u0131 gereken hukuki de\u011ferlendirmede bulunamayaca\u011f\u0131na ili\u015fkin h\u00fckm\u00fc hat\u0131rlatm\u0131\u015f ve ba\u015fvurucular taraf\u0131ndan sunulan rapor ve m\u00fctalaalar\u0131n \u201cbilimsel tespitlerde bulunup de\u011ferlendirmeyi Mahkemeye b\u0131rakmas\u0131 gerekirken bu y\u00f6nde bir \u00e7aba i\u00e7erisine girmeleri de tarafs\u0131z olmad\u0131klar\u0131 y\u00f6n\u00fcnde\u201d kanaat olu\u015fturdu\u011fu belirtilmi\u015ftir. \u0130lk Derece Mahkemesince verilen kararda, \u201cMahkemenin yerine ge\u00e7erek delil de\u011ferlendirmesi niteli\u011fi ta\u015f\u0131yan bu yetersiz ve tarafs\u0131zl\u0131ktan uzak bir y\u00f6ntemle haz\u0131rlanm\u0131\u015f bilirki\u015fi raporlar\u0131na itibar edilmemi\u015f, Mahkememizin hukuki bilgisi kapsam\u0131nda yapaca\u011f\u0131 de\u011ferlendirme de yeni bir bilirki\u015fi g\u00f6r\u00fc\u015f\u00fcne ihtiya\u00e7 bulunmad\u0131\u011f\u0131ndan tekrar bilirki\u015fi incelemesi yapt\u0131r\u0131lmam\u0131\u015ft\u0131r\u201d (gerek\u00e7eli karar, s.1043-1044) demi\u015ftir. Ba\u015fka bir deyi\u015fle \u0130lk Derece Mahkemesi, bilirki\u015fi rapor ve m\u00fctalaalar\u0131nda bulunan hukuki de\u011ferlendirmelerin bu rapor ve m\u00fctalaalar\u0131 haz\u0131rlayanlar\u0131n tarafs\u0131z olmad\u0131klar\u0131n\u0131 g\u00f6sterdi\u011fini belirterek ba\u015fvurucular taraf\u0131ndan sunulan hi\u00e7bir rapor ve m\u00fctalaaya itibar etmemi\u015ftir. <\/p>\n<p>63. \u0130lk Derece Mahkemesi, bilirki\u015fi rapor ve uzman m\u00fctalaalar\u0131nda bulunan ve hakim taraf\u0131ndan yap\u0131lmas\u0131 gereken hukuki de\u011ferlendirmelerin neler oldu\u011funu belirtmemi\u015f, sunulan rapor ve m\u00fctalaalar\u0131n olduk\u00e7a karma\u015f\u0131k teknik sorunlar\u0131n ele al\u0131nd\u0131\u011f\u0131 teknik bilgi i\u00e7eren k\u0131s\u0131mlar\u0131na da hangi sebeple itibar edilmedi\u011fini karar\u0131nda g\u00f6stermemi\u015ftir. <\/p>\n<p>64. \u0130lk Derece Mahkemesi yukar\u0131da g\u00f6sterildi\u011fi gibi, yeterli olmayan gerek\u00e7eler ile ba\u015fvurucular taraf\u0131ndan sunulan bilirki\u015fi raporlar\u0131 ve uzman m\u00fctalaalar\u0131n\u0131 g\u00f6z ard\u0131 etmi\u015ftir. A\u0130HM i\u00e7tihatlar\u0131nda da ortaya konuldu\u011fu gibi adil yarg\u0131lanma hakk\u0131n\u0131n temel unsurlar\u0131ndan biri olan \u201csilahlar\u0131n e\u015fitli\u011fi\u201d ilkesi iddia makam\u0131n\u0131n tan\u0131k veya bilirki\u015fileri ile san\u0131klar\u0131n tan\u0131k ve bilirki\u015filerinin duru\u015fmalarda e\u015fit muameleye tabi tutulmas\u0131 gerekir (bkz. B\u00f6n\u0131sch\/Avusturya, B. No: \u00a08658\/79, 6\/5\/1985, \u00a7\u00a7 32-33).<\/p>\n<p>65. Hem cezai, hem de cezai olmayan davalarda uygulanan silahlar\u0131n e\u015fitli\u011fi ilkesi, taraflara, talep ve a\u00e7\u0131klamalar\u0131n\u0131 di\u011fer tarafa nazaran dezavantajl\u0131 olmayacak \u015fekilde ileri s\u00fcrebilmeleri i\u00e7in f\u0131rsat verilmesini gerektirir (Kress\/Fransa, B. No: \u00a039594\/98, 7\/6\/2001, \u00a7 72). Bu gereklili\u011fin bir sonucu olarak S\u00f6zle\u015fme\u2019de bilirki\u015filerin mahkeme \u00f6n\u00fcnde dinlenmesi ile ilgili \u00f6zel bir h\u00fck\u00fcm bulunmamas\u0131na kar\u015f\u0131n A\u0130HM, bilirki\u015filik kurumunu, S\u00f6zle\u015fme\u2019nin 6. maddesinin (3) numaral\u0131 f\u0131kras\u0131n\u0131n (d) bendinde yer alan tan\u0131k dinletme hakk\u0131ndan yola \u00e7\u0131karak \u201csilahlar\u0131n e\u015fitli\u011fi ilkesi\u201d ile ba\u011flant\u0131 kurarak de\u011ferlendirmi\u015ftir (bkz. B\u00f6nisch\/Avusturya, B. No: 8658\/79, 6\/5\/1985, \u00a7 32; Brandstetter\/Avusturya, B. No: 11170\/84, 12876\/87, 13468\/87, 28\/8\/1991, \u00a7 42). <\/p>\n<p>66. A\u0130HM, bilirki\u015fi raporlar\u0131n\u0131n kapsam\u0131n\u0131 olduk\u00e7a geni\u015f bir \u015fekilde yorumlamaktad\u0131r. Bilirki\u015fi raporlar\u0131n\u0131n yaz\u0131l\u0131 ya da s\u00f6zl\u00fc olabilece\u011fi gibi inceleme konular\u0131 a\u00e7\u0131s\u0131ndan da bilimsel, teknik ya da olay analizleri \u015feklinde olabilece\u011fini kabul etmektedir (Khodorkovskiy ve Lebedev\/Rusya, B. No: 11082\/06, 13772\/05, 25\/7\/2013, \u00a7 717). <\/p>\n<p>67. \u0130lk Derece Mahkemesi, ba\u015fvurucular taraf\u0131ndan sunulan bilirki\u015fi raporlar\u0131 ile duru\u015fmada dinlenen uzman g\u00f6r\u00fc\u015flerinden hi\u00e7birine itibar etmemi\u015f buna kar\u015f\u0131n Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131nca soru\u015fturma s\u0131ras\u0131nda al\u0131nan bilirki\u015fi raporlar\u0131n\u0131n t\u00fcm\u00fcne ise itibar etmi\u015ftir (gerek\u00e7eli karar, s.1042-1043). Bunun \u00fczerine ba\u015fvurucular, Cumhuriyet Savc\u0131s\u0131nca al\u0131nan bilirki\u015fi raporlar\u0131n\u0131n eksik oldu\u011funu ve olay\u0131 ayd\u0131nlatmaya yeterli olmad\u0131\u011f\u0131n\u0131, kendileri taraf\u0131ndan sunulan rapor ve m\u00fctalaalara da itibar edilmedi\u011fini ileri s\u00fcrerek yarg\u0131laman\u0131n temelini olu\u015fturan dijital delillere ili\u015fkin olarak Mahkemenin bilirki\u015fi raporu ald\u0131rmas\u0131 talebinde bulunmu\u015flard\u0131r. \u0130lk Derece Mahkemesi, bu talepleri ise \u201cH\u00e2kimlik mesle\u011finin gerektirdi\u011fi genel ve hukuki bilgi ile \u00e7\u00f6z\u00fclmesi olanakl\u0131 konular\u0131n de\u011ferlendirilmesi\u201d i\u00e7in bilirki\u015fi raporu al\u0131nmas\u0131na gerek bulunmad\u0131\u011f\u0131 gerek\u00e7esi ile reddetmi\u015ftir (gerek\u00e7eli karar, s.1042). <\/p>\n<p>68. Anayasa Mahkemesinin g\u00f6revi herhangi bir davada bilirki\u015fi raporu veya uzman m\u00fctalaas\u0131n\u0131n gerekli olup olmad\u0131\u011f\u0131na karar vermek de\u011fildir. Savunma makam\u0131n\u0131n tan\u0131k dinletme taleplerinin gereklili\u011fi ya da bilirki\u015fi raporu benzeri delillerin kabul edilebilirli\u011fi ve de\u011ferlendirilmesi hususlar\u0131 derece mahkemelerinin yetkisi d\u00e2hilindedir (bkz. S.N.\/\u0130sve\u00e7, B. No:34209\/96, 2\/7\/2002, \u00a7 44). A\u0130HM\u2019e g\u00f6re, derece mahkemeleri, S\u00f6zle\u015fme ile uyumlu olmak ko\u015fuluyla, somut davadaki maddi ger\u00e7e\u011fin ortaya \u00e7\u0131kmas\u0131na yard\u0131mc\u0131 olmayaca\u011f\u0131n\u0131 de\u011ferlendirdi\u011fi savunma tan\u0131klar\u0131n\u0131n dinlenmesi talebini reddedebilir (bkz. Huseyn ve Di\u011ferleri\/Azerbaycan, B. No: 35485\/05, 45553\/05, 35680\/05 ve 36085\/05, 26\/7\/2011, \u00a7 196).<\/p>\n<p>69. Buna kar\u015f\u0131n Anayasa Mahkemesi, ba\u015fvurucular taraf\u0131ndan savunma kapsam\u0131nda talep edilen savunma tan\u0131klar\u0131n\u0131n dinlenmesi talebinin reddi karar\u0131 gibi bilirki\u015fi raporu al\u0131nmas\u0131 talebinin reddi karar\u0131n\u0131n da san\u0131klar\u0131n haklar\u0131n\u0131 koruma amac\u0131na y\u00f6nelik yeterli g\u00fcvenceleri i\u00e7eren bir usul \u00e7er\u00e7evesinde verilip verilmedi\u011fini incelemelidir.<\/p>\n<p>70. Kural olarak, bilirki\u015filerin sundu\u011fu rapor ve m\u00fctalaalar derece mahkemeleri a\u00e7\u0131s\u0131ndan ba\u011flay\u0131c\u0131 olmamakla birlikte, \u0130lk Derece Mahkemesi taraf\u0131ndan esasa ili\u015fkin de\u011ferlendirmeler yap\u0131l\u0131rken Cumhuriyet Savc\u0131s\u0131 taraf\u0131ndan sunulan bilirki\u015fi raporlar\u0131n\u0131n belirleyici bir etkisi olmu\u015ftur. Ba\u015fka bir deyi\u015fle somut davada \u0130lk Derece Mahkemesi, yaln\u0131zca Cumhuriyet Savc\u0131s\u0131 taraf\u0131ndan sunulan bilirki\u015fi raporlar\u0131na itibar etmi\u015f, bu raporlara kar\u015f\u0131n ba\u015fvurucular\u0131n savunmalar\u0131n\u0131n bir par\u00e7as\u0131 olarak sunduklar\u0131 bilirki\u015fi rapor ve uzman g\u00f6r\u00fc\u015fleri ise dikkate al\u0131nmam\u0131\u015ft\u0131r. Mahkeme ayr\u0131ca ba\u015fvurucular\u0131n, mahkumiyet karar\u0131n\u0131n dayana\u011f\u0131 olan dijital verilerin ger\u00e7e\u011fi yans\u0131tmad\u0131\u011f\u0131 iddialar\u0131n\u0131 de\u011ferlendirmek \u00fczere mahkemenin bilirki\u015fi heyeti tayin etmesi ve rapor ald\u0131rmas\u0131 y\u00f6n\u00fcndeki taleplerini de yeterli olmayan gerek\u00e7e ile reddetmi\u015ftir. <\/p>\n<p>71. B\u00f6ylece ba\u015fvurucular\u0131n, haklar\u0131nda y\u00f6neltilen su\u00e7lamalar\u0131n dayana\u011f\u0131 olan delillere kar\u015f\u0131 kovu\u015fturman\u0131n geni\u015fletilmesini isteme haklar\u0131 k\u0131s\u0131tlanm\u0131\u015f, ceza yarg\u0131lamas\u0131n\u0131n, maddi ger\u00e7e\u011fin ortaya \u00e7\u0131kart\u0131lmas\u0131 amac\u0131na y\u00f6nelik olarak \u201csilahlar\u0131n e\u015fitli\u011fi\u201d ilkesi ihlal edilmi\u015ftir. <\/p>\n<p>72. A\u00e7\u0131klanan nedenlerle, dijital delillerin de\u011ferlendirilmesine ili\u015fkin \u015fikayetler y\u00f6n\u00fcnden, ba\u015fvurucular\u0131n sunduklar\u0131 bilirki\u015fi raporlar\u0131 ve uzman m\u00fctalaalar\u0131n\u0131n \u0130lk Derece Mahkemesince kabul edilmemesi ve bu konularda Mahkemece bilirki\u015fi incelemesi yapt\u0131r\u0131lmas\u0131 yolundaki taleplerinin de yetersiz gerek\u00e7elerle reddedilmesi, \u201cgerek\u00e7eli karar hakk\u0131na\u201d ve \u201csilahlar\u0131n e\u015fitli\u011fi\u201d ilkesine ayk\u0131r\u0131 oldu\u011fundan, Anayasa\u2019n\u0131n 36. maddesinde g\u00fcvence alt\u0131na al\u0131nan adil yarg\u0131lanma hakk\u0131 ihlal edilmi\u015ftir. <\/p>\n<p>b. Tan\u0131k Dinlenmesi Talepleri Y\u00f6n\u00fcnden<\/p>\n<p>73. Ba\u015fvurucular, ilk derece mahkemesi taraf\u0131ndan mahk\u00fbmiyetlerine karar verilen su\u00e7un tamamlanmas\u0131na engel olduklar\u0131 kabul edilen d\u00f6nemin Genelkurmay Ba\u015fkan\u0131 Hilmi \u00d6zk\u00f6k ve Kara Kuvvetleri Komutan\u0131 Ayta\u00e7 Yalman\u2019\u0131n tan\u0131kl\u0131klar\u0131na ili\u015fkin talebin reddi nedeniyle adil yarg\u0131lanma haklar\u0131n\u0131n ihlal edildi\u011fini ileri s\u00fcrm\u00fc\u015flerdir.<\/p>\n<p>74. A\u0130HS\u2019nin \u201cAdil yarg\u0131lanma hakk\u0131\u201d ba\u015fl\u0131kl\u0131 6. maddesinin (1) numaral\u0131 f\u0131kras\u0131 ve (3) numaral\u0131 f\u0131kras\u0131n\u0131n (d) bendi \u015f\u00f6yledir:<\/p>\n<p>\u201c1. Herkes davas\u0131n\u0131n, \u2026 cezai alanda kendisine y\u00f6neltilen su\u00e7lamalar\u0131n esas\u0131 konusunda karar verecek olan, yasayla kurulmu\u015f, ba\u011f\u0131ms\u0131z ve tarafs\u0131z bir mahkeme taraf\u0131ndan, adil ve kamuya a\u00e7\u0131k olarak, \u2026 g\u00f6r\u00fclmesini isteme hakk\u0131na sahiptir.<\/p>\n<p>\u2026<\/p>\n<p>3. Bir su\u00e7 ile itham edilen herkes a\u015fa\u011f\u0131daki asgari haklara sahiptir:<\/p>\n<p>\u2026<\/p>\n<p>d) \u0130ddia tan\u0131klar\u0131n\u0131 sorguya \u00e7ekmek veya \u00e7ektirmek, savunma tan\u0131klar\u0131n\u0131n da iddia tan\u0131klar\u0131yla ayn\u0131 ko\u015fullar alt\u0131nda davet edilmelerinin ve dinlenmelerinin sa\u011flanmas\u0131n\u0131 istemek;\u201d<\/p>\n<p>75. A\u0130HS\u2019nin 6. maddesinin (3) numaral\u0131 f\u0131kras\u0131n\u0131n (d) bendinde, san\u0131\u011f\u0131n iddia tan\u0131klar\u0131n\u0131 sorguya \u00e7ekme veya \u00e7ektirme hakk\u0131 g\u00fcvence alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Kovu\u015fturma s\u0131ras\u0131nda b\u00fct\u00fcn kan\u0131tlar\u0131n tart\u0131\u015f\u0131labilmesi i\u00e7in, kural olarak bu kan\u0131tlar\u0131n aleni bir duru\u015fmada ve san\u0131\u011f\u0131n huzurunda ortaya konulmas\u0131 gerekir. Bu kural istisnas\u0131z olmamakla birlikte, e\u011fer bir mahk\u00fbmiyet sadece veya belirleyici \u00f6l\u00e7\u00fcde, san\u0131\u011f\u0131n soru\u015fturma veya yarg\u0131lama a\u015famas\u0131nda sorgulama veya sorgulatma imk\u00e2n\u0131 bulamad\u0131\u011f\u0131 bir kimse taraf\u0131ndan verilen ifadelere dayand\u0131r\u0131lm\u0131\u015f ise, san\u0131\u011f\u0131n haklar\u0131 A\u0130HS\u2019nin 6. maddesindeki g\u00fcvencelerle ba\u011fda\u015fmayacak \u00f6l\u00e7\u00fcde k\u0131s\u0131tlanm\u0131\u015f olur (B. No: 2013\/99, 20\/3\/2014, \u00a7 46).<\/p>\n<p>76. Mahkemeler, somut davadaki maddi ger\u00e7e\u011fin ortaya \u00e7\u0131kmas\u0131na yard\u0131mc\u0131 olmayaca\u011f\u0131n\u0131 de\u011ferlendirdi\u011fi savunma tan\u0131klar\u0131n\u0131n dinlenmesi talebini reddedebilir (Huseynve di\u011ferleri\/Azerbaycan, B. No: 35485\/05, 45553\/05,35680\/05ve36085\/05, 26\/7\/2011, \u00a7 196).<\/p>\n<p>77. Tan\u0131klar\u0131n dinlenmek \u00fczere \u00e7a\u011f\u0131r\u0131lmas\u0131n\u0131n uygun olup olmad\u0131\u011f\u0131n\u0131n de\u011ferlendirilmesi kural olarak derece mahkemelerinin takdir yetkisi d\u00e2hilindedir. Dolay\u0131s\u0131yla bir san\u0131\u011f\u0131n baz\u0131 tan\u0131klar\u0131 dinletemedi\u011finden \u015fik\u00e2yet etmesi yeterli olmay\u0131p, ayr\u0131ca bu tan\u0131klar\u0131n dinlenmesinin ni\u00e7in \u00f6nemli oldu\u011funu ve ger\u00e7e\u011fin ortaya \u00e7\u0131kmas\u0131 i\u00e7in ni\u00e7in gerekli oldu\u011funu a\u00e7\u0131klamak suretiyle tan\u0131k dinletme talebini desteklemelidir (B. No: 2013\/99, 20\/3\/2014, \u00a7 54).<\/p>\n<p>78. Adil yarg\u0131lanma hakk\u0131 bireylere dava sonucunda verilen karar\u0131n de\u011fil, yarg\u0131lama s\u00fcrecinin ve usul\u00fcn\u00fcn adil olup olmad\u0131\u011f\u0131n\u0131 denetletme imk\u00e2n\u0131 verir. Bu nedenle, bireysel ba\u015fvuruda adil yarg\u0131lanmaya ili\u015fkin \u015fik\u00e2yetlerin incelenebilmesi i\u00e7in ba\u015fvurucunun yarg\u0131lama s\u00fcrecinde haklar\u0131na sayg\u0131 g\u00f6sterilmedi\u011fine, bu \u00e7er\u00e7evede yarg\u0131lama s\u00fcrecinde iddia makam\u0131n\u0131n sundu\u011fu deliller ve g\u00f6r\u00fc\u015flerden bilgi sahibi olamad\u0131\u011f\u0131 veya bunlara etkili bir \u015fekilde itiraz etme f\u0131rsat\u0131 bulamad\u0131\u011f\u0131, kendi delillerini ve iddialar\u0131n\u0131 sunamad\u0131\u011f\u0131 ya da uyu\u015fmazl\u0131\u011f\u0131n \u00e7\u00f6z\u00fcme kavu\u015fturulmas\u0131yla ilgili iddialar\u0131n\u0131n derece mahkemesi taraf\u0131ndan dinlenmedi\u011fi veya karar\u0131n gerek\u00e7esiz oldu\u011fu gibi, mahkeme karar\u0131n\u0131n olu\u015fumuna sebep olan unsurlardan de\u011ferlendirmeye al\u0131nmam\u0131\u015f eksiklik, ihmal ya da a\u00e7\u0131k keyfili\u011fe ili\u015fkin bir iddian\u0131n dayanaklar\u0131yla ileri s\u00fcr\u00fclm\u00fc\u015f olmas\u0131 gerekir (B. No: 2013\/2767, 2\/10\/2013, \u00a7 22).<\/p>\n<p>79. Yarg\u0131lama makamlar\u0131 yarg\u0131laman\u0131n taraflar\u0131nca ileri s\u00fcr\u00fclen iddialar\u0131 ve g\u00f6sterdikleri delilleri gere\u011fi gibi incelemek zorundad\u0131r. Bununla birlikte, belirli bir davaya ili\u015fkin olarak delilleri de\u011ferlendirme ve g\u00f6sterilmek istenen delilin davayla ilgili olup olmad\u0131\u011f\u0131na karar verme yetkisi esasen derece mahkemelerine aittir. Mevcut yarg\u0131lamada ge\u00e7erli olan delil sunma ve inceleme y\u00f6ntemlerinin adil yarg\u0131lanma hakk\u0131na uygun olup olmad\u0131\u011f\u0131n\u0131 denetlemek Anayasa Mahkemesinin g\u00f6revi kapsam\u0131nda olmay\u0131p, Mahkemenin g\u00f6revi ba\u015fvuru konusu yarg\u0131laman\u0131n bir b\u00fct\u00fcn olarak adil olup olmad\u0131\u011f\u0131n\u0131n de\u011ferlendirilmesidir (B. No: 2013\/1213, 4\/12\/2013, \u00a7 27). <\/p>\n<p>80. Genel anlamda hakkaniyete uygun bir yarg\u0131laman\u0131n y\u00fcr\u00fct\u00fclebilmesi i\u00e7in \u201csilahlar\u0131n e\u015fitli\u011fi\u201d ve \u201c\u00e7eli\u015fmeli yarg\u0131lama\u201d ilkeleri \u0131\u015f\u0131\u011f\u0131nda, taraflara iddialar\u0131n\u0131 sunmak hususunda uygun olanaklar\u0131n sa\u011flanmas\u0131 \u015fartt\u0131r. Taraflara tan\u0131k delili de d\u00e2hil olmak \u00fczere delillerini sunma ve inceletme noktas\u0131nda uygun imk\u00e2nlar\u0131n tan\u0131nmas\u0131 gerekir. Bu anlamda, delillere ili\u015fkin dengesizlik veya hakkaniyetsizlik iddialar\u0131n\u0131n yarg\u0131laman\u0131n b\u00fct\u00fcn\u00fc \u0131\u015f\u0131\u011f\u0131nda de\u011ferlendirilmesi gerekir (B. No: 2013\/1213, 4\/12\/2013, \u00a7 27).<\/p>\n<p>81. \u0130lk Derece Mahkemesi karar\u0131nda, <\/p>\n<p>\u00a0\u201cBalyoz Darbe Plan\u0131n\u0131n hayata ge\u00e7irilmesi i\u00e7in gereken ortam \u015fekillendirmesini sa\u011flamak \u00fczere, Havac\u0131 unsurlar\u0131n Oraj ve Denizci unsurlar\u0131n Suga isimli harek\u00e2t planlar\u0131 haz\u0131rlad\u0131klar\u0131, bu planlar vas\u0131tas\u0131yla Ege\u2019de Yunanistan ile gerginlik \u00e7\u0131kart\u0131l\u0131p, bu durumun y\u00fcr\u00fctme organ\u0131 \u00fczerinde \u00e7ekilmeye y\u00f6nelik bask\u0131 arac\u0131 olarak kullan\u0131lmas\u0131n\u0131n istendi\u011fi,<\/p>\n<p>\u00a0Jandarma unsurlar\u0131nca Fatih ve Beyaz\u0131t camilerine y\u00f6nelik olarak \u00c7ar\u015faf ve Sakal isimli bombal\u0131 eylem planlar\u0131 haz\u0131rland\u0131\u011f\u0131, bu eylemler sonras\u0131nda iltisakl\u0131 \u015fah\u0131slar arac\u0131l\u0131\u011f\u0131yla irticai g\u00f6r\u00fcnt\u00fcl\u00fc protesto eylemleri d\u00fczenlenip, karga\u015fa ortam\u0131 olu\u015fturulmak istendi\u011fi, <\/p>\n<p>\u00a0Gereken ortam \u015fekillendirilmesinin ard\u0131ndan s\u0131k\u0131y\u00f6netim ilan\u0131m m\u00fcteakip y\u00fcr\u00fctme organ\u0131n\u0131n devrilip, devlet idaresinin cunta yap\u0131lanmas\u0131n\u0131n istedi\u011fi \u015fekilde yeniden yap\u0131land\u0131r\u0131lmas\u0131n\u0131n planland\u0131\u011f\u0131, bu kapsamda yukar\u0131da belirtilen haz\u0131rl\u0131klar\u0131n tamamland\u0131\u011f\u0131, harek\u00e2t plan\u0131n\u0131n d\u00fc\u015f\u00fcnce a\u015famas\u0131ndan \u00e7\u0131kt\u0131\u011f\u0131,<\/p>\n<p>\u00a0Muhtemel eylem yerlerinin ke\u015ffi, tutuklanacak ki\u015filer (siyasi parti mensuplar\u0131, belediye ba\u015fkanlar\u0131, sivil toplum \u00f6rg\u00fctlerinin y\u00f6netici ve \u00fcyeleri, gazeteciler, ayd\u0131nlar, bilim adamlar\u0131, kanaat \u00f6nderleri), okulundan at\u0131lacak \u00f6\u011frenciler, el konulacak ara\u00e7lar, g\u00f6revden uzakla\u015ft\u0131r\u0131lacak, tutuklanacak, emekliye sevk edilecek, kullan\u0131lacak kamu g\u00f6revlilerinin belirlenmesi, hassas olarak belirlenen kurum ve kurulu\u015flar\u0131n ba\u015f\u0131na hangi askeri personelin atanaca\u011f\u0131, zararl\u0131 olarak nitelenmesi sebebiyle ili\u015fi\u011fi kesilmesi planlanan askeri personelin belirlenmesi, polis te\u015fkilat\u0131n\u0131n ne \u015fekilde y\u00f6nlendirilece\u011fi ve kullan\u0131laca\u011f\u0131n\u0131n tespiti, bas\u0131n yay\u0131n kurulu\u015flar\u0131 ve \u00e7al\u0131\u015fanlar hakk\u0131nda yap\u0131lan planlamalar (kimlerin tutuklanaca\u011f\u0131, kimlerin kullan\u0131labilece\u011finin tespiti), Milli Mutabakat H\u00fck\u00fcmeti ismiyle harek\u00e2t sonras\u0131nda i\u015fba\u015f\u0131na getirilmesi planlanan h\u00fck\u00fcmetin dizayn edilmesi gibi icra a\u015famas\u0131na ge\u00e7ildi\u011fi, ancak icra hareketlerinin tamamlanamad\u0131\u011f\u0131, harek\u00e2t plan\u0131n\u0131n Genelkurmay Ba\u015fkanl\u0131\u011f\u0131 ve Kara kuvvetleri Komutanl\u0131\u011f\u0131nca \u00f6\u011frenildi\u011fi, bu hususun Ya\u015far B\u00fcy\u00fckan\u0131t\u2019\u0131n seminer sonu\u00e7 raporunu hukuk\u00e7ulara inceletmesi, KKK\u2019n\u0131n OEYTS\u2019nin oynanmamas\u0131 talimatlar\u0131, Genelkurmay Ba\u015fkan\u0131n\u0131n san\u0131k \u00c7etin Do\u011fan\u2019\u0131 bu konuda uyarmas\u0131 ile belli oldu\u011fu\u201d <\/p>\n<p>ifade edilmektedir (gerek\u00e7eli karar, s.1022).<\/p>\n<p>82. \u0130lk Derece Mahkemesi, \u00c7etin Do\u011fan liderli\u011findeki cunta yap\u0131lanmas\u0131n\u0131n su\u00e7un icras\u0131 i\u00e7in elveri\u015fli ara\u00e7 gere\u00e7 ve personelle icra hareketlerini ger\u00e7ekle\u015ftirmeye ba\u015flad\u0131\u011f\u0131n\u0131 ancak \u00c7etin Do\u011fan\u2019\u0131n kalp ameliyat\u0131 olmas\u0131 ve ard\u0131ndan A\u011fustos 2003\u2019te emekliye sevk edilmesi, baz\u0131 san\u0131klar\u0131n g\u00f6rev yerlerinin de\u011fi\u015fmesi ve \u201cGenelkurmay Kararg\u00e2h\u0131n\u0131n \u00f6ncelikle muhtemel darbeye kar\u015f\u0131 \u00e7\u0131kmas\u0131, sonras\u0131nda da g\u00fcn\u00fcn \u015fartlar\u0131n\u0131n elverdi\u011fi \u00f6l\u00e7\u00fcde engellemek i\u00e7in \u00e7aba g\u00f6stermesi sebebiyle cunta yap\u0131lanmas\u0131n\u0131n darbe su\u00e7unu i\u015fleme elveri\u015flili\u011fini kaybetti\u011fini ve icra hareketlerinin tamamlanamad\u0131\u011f\u0131n\u0131\u201d belirtmektedir (gerek\u00e7eli karar, s.1023).<\/p>\n<p>83. An\u0131lan tarihlerde g\u00f6revde olan Genelkurmay Ba\u015fkan\u0131 Hilmi \u00d6zk\u00f6k ve Kara Kuvvetleri Komutan\u0131 Ayta\u00e7 Yalman\u2019\u0131n tan\u0131k olarak dinlenmesi talepleri, <\/p>\n<p>\u00a0\u201cMahkemenin ilk ve as\u0131l hedefi maddi ger\u00e7e\u011fi ortaya \u00e7\u0131karmakt\u0131r. Bir delilin ileri s\u00fcr\u00fclmesinin ger\u00e7e\u011fin ortaya \u00e7\u0131kar\u0131lmas\u0131na yarar\u0131 olmayaca\u011f\u0131 gibi davay\u0131 uzatma durumu varsa Mahkemenin bu hususta bir karar vermesi gerekir. T\u00fcm tan\u0131klar\u0131n ve bilirki\u015filerin dinlenmeleri ve \u00f6teki kan\u0131tlar\u0131n ortaya konulmalar\u0131na imkan vermek kural ise de; dinlenen bir k\u0131s\u0131m tan\u0131\u011f\u0131n anlat\u0131m\u0131 ve bilirki\u015finin g\u00f6r\u00fc\u015f\u00fcn\u00fcn al\u0131nmas\u0131yla olay hi\u00e7bir ku\u015fkuya yer b\u0131rakmayacak bir bi\u00e7imde \u00e7\u00f6z\u00fcmlenmi\u015f ise zaman kayb\u0131na ve gereksiz u\u011fra\u015f\u0131ya yol a\u00e7\u0131lmamas\u0131 i\u00e7in, yarg\u0131lamaya yenilik getirmeyecek ve maddi ger\u00e7e\u011fin ortaya \u00e7\u0131kmas\u0131na hizmet etmeyecek nitelikteki geride kalan tan\u0131k ve bilirki\u015filerin dinlenilmemesi doktrinde ve uygulamada kabul g\u00f6rm\u00fc\u015f bir uygulamad\u0131r. Aksi halde t\u00fcm delillerin ortaya konulmas\u0131 zorunlulu\u011fu yarg\u0131lamay\u0131 uzatmay\u0131 ama\u00e7layan k\u00f6t\u00fc niyetlilerin i\u015fine yarar. Bu nedenlerle delillerin reddi ve s\u0131n\u0131rland\u0131r\u0131lmas\u0131 durumlar\u0131n\u0131n delil g\u00f6sterilmesine yasal olanak bulunmad\u0131\u011f\u0131, durumun delil gerektirmeyecek \u015fekilde a\u00e7\u0131k oldu\u011fu, kan\u0131tlanmas\u0131 istenilen olay\u0131n karara etkisinin olmad\u0131\u011f\u0131 ya da daha \u00f6nce kan\u0131tlanm\u0131\u015f bir hususa ili\u015fkin oldu\u011fu, yine kan\u0131t\u0131n amaca elveri\u015fli olmad\u0131\u011f\u0131, elde edilmesinin m\u00fcmk\u00fcn bulunmad\u0131\u011f\u0131, kan\u0131t g\u00f6sterilmesi iste\u011finin i\u015fi uzatmak amac\u0131yla yap\u0131lm\u0131\u015f oldu\u011fu ileri s\u00fcr\u00fclen olay\u0131n ger\u00e7ek olarak kabul edilebilecek nitelikte oldu\u011fu durumlarda kan\u0131t\u0131n reddi gerekti\u011fi doktrinde tart\u0131\u015f\u0131lm\u0131\u015ft\u0131r. Belirtilen bu hususlar de\u011fi\u015fik a\u015famalarda g\u00f6sterilen t\u00fcm tan\u0131k ve bilirki\u015filer i\u00e7in uygulanmas\u0131 m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>\u00a0San\u0131klar ve m\u00fcdafileri dosyaya rapor d\u00fczenleyen bilirki\u015filer ile tan\u0131klar Ayta\u00e7 Yalman ve Hilmi \u00d6zk\u00f6k\u2019\u00fcn dinlenilmesini \u0131srarla talep etmi\u015flerdir. Bilirki\u015filerin ve ad\u0131 ge\u00e7en tan\u0131klar\u0131n, san\u0131klara at\u0131l\u0131 su\u00e7un niteli\u011fi g\u00f6z \u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda toplanan kan\u0131tlara g\u00f6re beyanlar\u0131n\u0131n al\u0131nmas\u0131n\u0131n karara etkisi bulunmad\u0131\u011f\u0131, kan\u0131t\u0131n amaca uygun olmad\u0131\u011f\u0131 de\u011ferlendirildi\u011finde; tan\u0131k g\u00f6sterilmesi iste\u011finin mahkeme \u00fczerinde kamuoyu nezdinde bask\u0131 olu\u015fturmak amac\u0131yla yap\u0131lmas\u0131, seminer ve di\u011fer belgelerin ger\u00e7ek olmas\u0131 nedeniyle de bilirki\u015filer ve tan\u0131klar\u0131n dinlenilmesinin sonuca etkili olmad\u0131\u011f\u0131 kanaatine var\u0131larak\u2026\u201d gerek\u00e7esiyle reddedilmi\u015ftir (gerek\u00e7eli karar, s. 1046).<\/p>\n<p>84. \u0130snat edilen darbe su\u00e7unun, yap\u0131lanman\u0131n lideri kabul edilen \u00c7etin Do\u011fan\u2019\u0131n sa\u011fl\u0131k durumu, baz\u0131 san\u0131klar\u0131n tayin edilmeleri yan\u0131nda, Genelkurmay Kararg\u00e2h\u0131n\u0131n \u00f6ncelikle muhtemel darbeye kar\u015f\u0131 \u00e7\u0131kmas\u0131, sonras\u0131nda da g\u00fcn\u00fcn \u015fartlar\u0131n\u0131n elverdi\u011fi \u00f6l\u00e7\u00fcde engellemek i\u00e7in \u00e7aba g\u00f6stermesi sebebiyle i\u015flenemedi\u011finin belirtilmesine kar\u015f\u0131n, su\u00e7un niteli\u011fi g\u00f6z \u00f6n\u00fcne al\u0131narak toplanan delillere g\u00f6re Genelkurmay Ba\u015fkan\u0131 ve Kara Kuvvetleri Komutan\u0131n\u0131n tan\u0131kl\u0131klar\u0131n\u0131n karara etkisi bulunmad\u0131\u011f\u0131 belirtilmektedir.<\/p>\n<p>85. San\u0131klara isnat edilen su\u00e7 fiillerinin esasl\u0131 bi\u00e7imde bilgisayar programlar\u0131yla olu\u015fturulmu\u015f belgelere dayand\u0131\u011f\u0131, bu belgelerin i\u00e7eriklerinin maddi olay ve olgular\u0131 yans\u0131tt\u0131\u011f\u0131 ve ger\u00e7ek olduklar\u0131n\u0131n kabul edildi\u011fi, bilirki\u015fi raporlar\u0131nda\/uzman g\u00f6r\u00fc\u015flerinde belirtildi\u011fi \u00fczere bu verilerin m\u00fcdahale edilebilir nitelikte oldu\u011fu ve bu verilerin teknik bilgileri ile i\u00e7eriklerinin uyumsuzlu\u011fu dikkate al\u0131nd\u0131\u011f\u0131nda, tan\u0131k olarak dinlenmesi talep edilen bu ki\u015filerin beyanlar\u0131 maddi ger\u00e7e\u011fe ula\u015fma bak\u0131m\u0131ndan \u00f6nemsiz kabul edilemez.<\/p>\n<p>86. Ayr\u0131ca 1. Ordu Komutanl\u0131\u011f\u0131 merkezli bir yap\u0131lanman\u0131n darbe amac\u0131na y\u00f6nelik faaliyetlerinin Genelkurmay Ba\u015fkanl\u0131\u011f\u0131 ve Kara Kuvvetleri Komutanl\u0131\u011f\u0131nca \u00f6\u011frenildi\u011fi ve te\u015febb\u00fcs edilen su\u00e7a engel olundu\u011fu kabul edildi\u011fine g\u00f6re, toplanan kan\u0131tlara g\u00f6re tan\u0131k olarak dinlenmesi talep edilen an\u0131lan g\u00f6revdeki ki\u015filerin beyanlar\u0131n\u0131n karara etkisi bulunmad\u0131\u011f\u0131 gerek\u00e7esi makul de\u011fildir.<\/p>\n<p>87. Bunun yan\u0131nda tan\u0131k dinlenmesine ili\u015fkin talepler, \u201cmahkeme \u00fczerinde kamuoyu nezdinde bask\u0131 olu\u015fturmak amac\u0131yla yap\u0131ld\u0131\u011f\u0131\u201d ek gerek\u00e7esiyle reddedilmi\u015ftir. Ba\u015fka bir ama\u00e7la yap\u0131ld\u0131\u011f\u0131 ve karara etkisi bulunmad\u0131\u011f\u0131 kabul edilen bu talepler, yaln\u0131zca objektif olarak yarg\u0131lamaya etkisi dikkate al\u0131narak de\u011ferlendirilmelidir.<\/p>\n<p>88. Ba\u015fvurucular\u0131n tan\u0131k olarak \u00e7a\u011fr\u0131lmalar\u0131n\u0131 istedikleri ki\u015filerin, g\u00f6sterdikleri tutum ve g\u00f6revleri kapsam\u0131nda yapt\u0131klar\u0131 i\u015flemlerle su\u00e7un i\u015flenmesini engellediklerinin kabul edilmesi kar\u015f\u0131s\u0131nda, bu ki\u015filerin beyanlar\u0131 sadece san\u0131klar lehine sonu\u00e7 do\u011furacak tan\u0131k beyan\u0131 olman\u0131n \u00f6tesinde bir delil niteli\u011fi ta\u015f\u0131maktad\u0131r.
