Ba\u015fvuru, bir internet sitesinde yaz\u0131lan makalelerden dolay\u0131 hakaret etme, 1\/11\/1983 tarihli ve 2937 say\u0131l\u0131 Devlet \u0130stihbarat Hizmetleri ve Milli \u0130stihbarat Te\u015fkilat\u0131 Kanunu&#8217;na muhalefet su\u00e7lar\u0131ndan cezaland\u0131r\u0131lma nedeniyle ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlal edildi\u011fi iddias\u0131na ili\u015fkindir.<\/p>\n<p>II. BA\u015eVURU S\u00dcREC\u0130<\/p>\n<p>2. Ba\u015fvuru16\/8\/2019 tarihinde yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>3. Ba\u015fvuru, ba\u015fvuru formu ve eklerinin idari y\u00f6nden yap\u0131lan \u00f6n incelemesinden sonra Komisyona sunulmu\u015ftur. Komisyonca ba\u015fvurular\u0131n kabul edilebilirlik incelemesinin B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na karar verilmi\u015ftir. B\u00f6l\u00fcm Ba\u015fkan\u0131 taraf\u0131ndan ba\u015fvurunun kabul edilebilirlik ve esas incelemesinin birlikte yap\u0131lmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>4. Ba\u015fvuru belgelerinin bir \u00f6rne\u011fi bilgi i\u00e7in Adalet Bakanl\u0131\u011f\u0131na (Bakanl\u0131k) g\u00f6nderilmi\u015ftir. Bakanl\u0131k, g\u00f6r\u00fc\u015f\u00fcn\u00fc bildirmi\u015ftir. Ba\u015fvurucu, Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 beyanda bulunmam\u0131\u015ft\u0131r.<\/p>\n<p>III. OLAY VE OLGULAR <\/p>\n<p>5. Ba\u015fvuru formu ve eklerinde ifade edildi\u011fi \u015fekliyle ilgili olaylar \u00f6zetle \u015f\u00f6yledir:<\/p>\n<p>6. 2012 y\u0131l\u0131nda Mill\u00ee \u0130stihbarat Te\u015fkilat\u0131ndan (M\u0130T) emekli olan ba\u015fvurucu, emekli oldu\u011fu tarihe kadarki yirmi \u00fc\u00e7 y\u0131ll\u0131k \u00e7al\u0131\u015fma hayat\u0131nda istihbarat, istihbarata kar\u015f\u0131 koyma, kararg\u00e2h, b\u00f6lge birimlerinde ve yurt d\u0131\u015f\u0131 birimlerde g\u00f6rev yapt\u0131\u011f\u0131n\u0131 belirtmi\u015ftir.<\/p>\n<p>7. Ba\u015fvurucu kendisine olan www.yenimilliistihbarat.com isimli internet sitesinde M\u0130T i\u00e7indeki g\u00f6revlendirmeleri ve M\u0130T m\u00fcste\u015far\u0131n\u0131 hedef alan yaz\u0131lar yaz\u0131p yay\u0131mlam\u0131\u015ft\u0131r. 12\/6\/2016 tarihli payla\u015f\u0131mlar\u0131 nedeniyle ba\u015fvurucu hakk\u0131nda Ankara Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131 (Ba\u015fsavc\u0131l\u0131k) taraf\u0131ndan hakaret, iftira ve istihbarat faaliyeti ile ilgili bilgi ve belgeleri if\u015fa etme su\u00e7lar\u0131ndan soru\u015fturma ba\u015flat\u0131lm\u0131\u015ft\u0131r. S\u00f6z konusu g\u00f6rev daha \u00f6nce d\u00f6nemin D\u0131\u015fi\u015fleri Bakanl\u0131\u011f\u0131 Stratejik Ara\u015ft\u0131rmalar Merkezi (SAM) Ba\u015fkan\u0131 [B.A.ya] teklif edilmi\u015f, ancak akademik a\u00e7\u0131dan son derece donan\u0131ml\u0131 olan [B.A.], [H.F.nin] m\u00fcste\u015farl\u0131k yapt\u0131\u011f\u0131 bir kurumda, an\u0131lan\u0131n emri alt\u0131nda \u00e7al\u0131\u015fmay\u0131 kabul etmemi\u015ftir. Ad\u0131 ge\u00e7enin [F.] ile birlikte M\u0130T\u2019e atand\u0131\u011f\u0131 anla\u015f\u0131l\u0131yor. M\u0130T\u2019te Ba\u015fkan olan [K.E.] isimli g\u00f6revli de yer ald\u0131. Polis k\u00f6kenli olan [B.A.] 1987-1996 y\u0131llar\u0131 aras\u0131nda \u0130stanbul Emniyet M\u00fcd\u00fcrl\u00fc\u011f\u00fc istihbarat \u015eubesi&#8217;nde g\u00f6rev yapm\u0131\u015f, 1990 y\u0131l\u0131nda ABD\u2019de dil \u00f6\u011frenimine gitmi\u015f, 1996\u2019da ise FBI Ulusal Akademisi\u2019nde e\u011fitim g\u00f6rm\u00fc\u015ft\u00fc. [B.A.], Ekim 2011\u2019de M\u0130T\u2019in en hassas birimlerinden olan Elektronik ve Teknik \u0130stihbarat Ba\u015fkanl\u0131\u011f\u0131\u2019na atanm\u0131\u015ft\u0131.\u201d <\/p>\n<p>8. Ba\u015fvurucu, soru\u015fturma a\u015famas\u0131ndaki savunmas\u0131nda yaz\u0131daki bilgileri a\u00e7\u0131k kaynaklardan derledi\u011fini belirtmi\u015ftir. Ba\u015fsavc\u0131l\u0131k, ba\u015fvuruya konu yaz\u0131daki bilgilerin temin edildi\u011fi kaynaklar olarak g\u00f6sterilen internet sitelerinde bahsi ge\u00e7en haberlerin olup olmad\u0131\u011f\u0131n\u0131n tespiti i\u00e7in bilirki\u015fi g\u00f6revlendirmi\u015ftir. 1\/6\/2017 tarihli bilirki\u015fi raporunda yaz\u0131 i\u00e7eri\u011fi ile at\u0131fta bulunulan a\u00e7\u0131k kaynaklardaki bilgilerin ayn\u0131 oldu\u011funun belirlendi\u011fi belirtilmi\u015ftir. Bunun \u00fczerine Ba\u015fsavc\u0131l\u0131k, hakaret ve iftira su\u00e7lar\u0131ndan kamu davas\u0131 a\u00e7m\u0131\u015f; istihbarat faaliyeti ile ilgili bilgi ve belgeleri if\u015fa etme su\u00e7undan ise su\u00e7un yasal unsurlar\u0131n\u0131n olu\u015fmad\u0131\u011f\u0131 gerek\u00e7esiyle ek kovu\u015fturmaya yer olmad\u0131\u011f\u0131na dair karar vermi\u015ftir. M\u0130T&#8217;in \u015fik\u00e2yet\u00e7i s\u0131fat\u0131yla karara itiraz etmesi \u00fczerine Ankara 1. Sulh Ceza Mahkemesi ek kovu\u015fturmaya yer olmad\u0131\u011f\u0131na dair karar\u0131n kald\u0131r\u0131lmas\u0131na karar vermi\u015ftir. Ba\u015fsavc\u0131l\u0131k bu kez 2937 say\u0131l\u0131 Kanun&#8217;un 27. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda d\u00fczenlenen istihbarat faaliyeti ile ilgili bilgi ve belgeleri if\u015fa etme su\u00e7undan kamu davas\u0131 a\u00e7m\u0131\u015ft\u0131r.<\/p>\n<p>9. Yarg\u0131lamay\u0131 yapan Ankara 24. Asliye Ceza Mahkemesi (Mahkeme) 15\/5\/2018 tarihinde ba\u015fvurucunun iftira su\u00e7undan beraatine, hakaret su\u00e7undan 11 ay 20 g\u00fcn hapis cezas\u0131 ile mahk\u00fbmiyetine ve h\u00fckm\u00fcn a\u00e7\u0131klanmas\u0131n\u0131n geri b\u0131rak\u0131lmas\u0131na, istihbarat faaliyeti ile ilgili bilgi ve belgeleri if\u015fa etme su\u00e7undan ise 3 y\u0131l 4 ay hapis cezas\u0131yla cezaland\u0131r\u0131lmas\u0131na karar vermi\u015ftir.<\/p>\n<p>10. Mahkeme, hakaret su\u00e7una ili\u015fkin gerek\u00e7esinde payla\u015f\u0131mlar\u0131n ele\u015ftiri mahiyetinde olmayan tahkir ve tezyif edici ifadeler oldu\u011fu de\u011ferlendirmesi yapm\u0131\u015ft\u0131r. Mahkemenin istihbarat faaliyeti ile ilgili bilgi ve belgeleri if\u015fa etme su\u00e7una ili\u015fkin gerek\u00e7esinde ise M\u0130T&#8217;te g\u00f6rev yapm\u0131\u015f pek \u00e7ok ki\u015finin isminin ve yapt\u0131\u011f\u0131 g\u00f6revin payla\u015f\u0131mlarla if\u015fa edildi\u011fi belirtilmi\u015ftir. Mahkemenin gerek\u00e7esi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Payla\u015f\u0131mlar\u0131 ile Milli \u0130stihbarat Te\u015fkilat\u0131&#8217;nda g\u00f6rev yapm\u0131\u015f pek \u00e7ok ki\u015fiyi isimleri ve yapt\u0131klar\u0131 g\u00f6revler ile if\u015fa etti\u011fi, bu durumda san\u0131\u011f\u0131n eyleminin 2937 say\u0131l\u0131 yasan\u0131n 27\/3 maddesinde d\u00fczenlenen su\u00e7u olu\u015fturdu\u011fu anla\u015f\u0131lm\u0131\u015f ve bu su\u00e7tan dolay\u0131 san\u0131\u011f\u0131n cezaland\u0131r\u0131lmas\u0131 yoluna gidilmi\u015ftir. San\u0131\u011f\u0131n yapt\u0131\u011f\u0131 payla\u015f\u0131mlar ile Milli \u0130stihbarat Te\u015fkilat\u0131 i\u00e7inde g\u00f6rev yapm\u0131\u015f pek \u00e7ok ki\u015fiyi if\u015fa etmi\u015f bulunmas\u0131 nedeniyle hakk\u0131nda ceza tayin edilirken alt s\u0131n\u0131rdan uzakla\u015f\u0131lm\u0131\u015f ve a\u015fa\u011f\u0131daki \u015fekilde h\u00fck\u00fcm kurulmu\u015ftur.&#8221;<\/p>\n<p>11. Ba\u015fvurucunun hakaret su\u00e7undan verilen cezaya yapt\u0131\u011f\u0131 itiraz\u0131 de\u011ferlendiren Ankara 1. A\u011f\u0131r Ceza Mahkemesi 3\/7\/2018 tarihinde itiraz\u0131n reddine kesin olarak karar vermi\u015ftir. Ba\u015fvurucu, hem hakaret su\u00e7una ili\u015fkin verilen itiraz\u0131n reddi karar\u0131na hem de istihbarat faaliyeti ile ilgili bilgi ve belgeleri if\u015fa etme su\u00e7undan verilen mahk\u00fbmiyet karar\u0131na kar\u015f\u0131 15\/5\/2019 tarihinde istinaf kanun yoluna ba\u015fvurmu\u015ftur. \u0130stinaf talebini inceleyen Ankara B\u00f6lge Adliye Mahkemesi 4. Ceza Dairesi (B\u00f6lge Adliye Mahkemesi) hakaret su\u00e7una ili\u015fkin olarak A\u011f\u0131r Ceza Mahkemesinin karar\u0131n\u0131n kesin oldu\u011fu gerek\u00e7esiyle karar verilmesine yer olmad\u0131\u011f\u0131na, di\u011fer su\u00e7 y\u00f6n\u00fcnden ise istinaf talebinin reddine 16\/7\/2019 tarihinde kesin olarak karar vermi\u015ftir.<\/p>\n<p>IV. \u0130LG\u0130L\u0130 HUKUK<\/p>\n<p>A. Ulusal Hukuk<\/p>\n<p>12. 2937 say\u0131l\u0131 Kanun&#8217;un &#8220;Cezai H\u00fck\u00fcmler&#8221; ba\u015fl\u0131kl\u0131 27. maddesinin ilgili k\u0131sm\u0131n\u0131n su\u00e7 tarihindeki h\u00e2li \u015f\u00f6yledir:<\/p>\n<p>\u201cMill\u00ee \u0130stihbarat Te\u015fkilat\u0131n\u0131n g\u00f6rev ve faaliyetlerine ili\u015fkin bilgi ve belgeleri, yetkisiz olarak alan, temin eden, \u00e7alan, sahte olarak \u00fcreten, bunlar \u00fczerinde sahtecilik yapan ve bunlar\u0131 yok eden ki\u015fiye d\u00f6rt y\u0131ldan on y\u0131la kadar hapis cezas\u0131 verilir.<\/p>\n<p>M\u0130T mensuplar\u0131 ve ailelerinin kimliklerini herhangi bir yolla if\u015fa edenler ile M\u0130T mensuplar\u0131n\u0131n kimliklerini sahte olarak d\u00fczenleyen veya de\u011fi\u015ftiren ya da bu sahte belgeleri kullananlara \u00fc\u00e7 y\u0131ldan yedi y\u0131la kadar hapis cezas\u0131 verilir.<\/p>\n<p>Birinci ve ikinci f\u0131kra kapsam\u0131ndaki bilgi ve belgelerin; radyo, televizyon, internet, sosyal medya, gazete, dergi, kitap ve di\u011fer t\u00fcm medya ara\u00e7lar\u0131 ile her t\u00fcrl\u00fc yaz\u0131l\u0131, g\u00f6rsel, i\u015fitsel ve elektronik kitle ileti\u015fim ara\u00e7lar\u0131 vas\u0131tas\u0131yla yay\u0131mlanmas\u0131, yay\u0131lmas\u0131 veya a\u00e7\u0131klanmas\u0131 h\u00e2linde; 9\/6\/2004 tarihli ve 5187 say\u0131l\u0131 Bas\u0131n Kanununun 11 inci maddesi ile 4\/5\/2007 tarihli ve 5651 say\u0131l\u0131 \u0130nternet Ortam\u0131nda Yap\u0131lan Yay\u0131nlar\u0131n D\u00fczenlenmesi ve Bu Yay\u0131nlar Yoluyla \u0130\u015flenen Su\u00e7larla M\u00fccadele Edilmesi Hakk\u0131nda Kanunun 4 \u00fcnc\u00fc ve 6 nc\u0131 maddeleri h\u00fck\u00fcmlerine g\u00f6re sorumluluklar\u0131 belirlenenler ile bunlar\u0131 yayanlar hakk\u0131nda \u00fc\u00e7 y\u0131ldan dokuz y\u0131la kadar hapis cezas\u0131 verilir.\u201d<\/p>\n<p>13. Su\u00e7 tarihinden sonra 25\/8\/2017 tarihli ve 30165 say\u0131l\u0131 Resm\u00ee Gazete&#8217;de yay\u0131mlanan 694 say\u0131l\u0131 Ola\u011fan\u00fcst\u00fc Hal Kapsam\u0131nda Baz\u0131 D\u00fczenlemeler Yap\u0131lmas\u0131 Hakk\u0131nda Kanun H\u00fckm\u00fcnde Kararname&#8217;nin 75. maddesiyle bu f\u0131krada yer alan \u201cailelerinin kimliklerini\u201d ibaresinden sonra gelmek \u00fczere \u201cmakam, g\u00f6rev ve faaliyetlerini\u201d ibaresi eklenmi\u015f, daha sonra bu h\u00fck\u00fcm 1\/2\/2018 tarihli ve 7078 say\u0131l\u0131 Ola\u011fan\u00fcst\u00fc Hal Kapsam\u0131nda Baz\u0131 D\u00fczenlemeler Yap\u0131lmas\u0131 Hakk\u0131nda Kanun H\u00fckm\u00fcnde Kararnamenin De\u011fi\u015ftirilerek Kabul Edilmesine Dair Kanun&#8217;un 71. maddesiyle aynen kabul edilerek kanunla\u015fm\u0131\u015ft\u0131r.<\/p>\n<p>14. Yukar\u0131da an\u0131lan kanun h\u00fckm\u00fcne ili\u015fkin madde gerek\u00e7esi \u015f\u00f6yledir:<\/p>\n<p>\u201cM\u0130T personelinin, bu Kanunda yaz\u0131l\u0131 g\u00f6revlerinin ifas\u0131n\u0131 veya yetkilerinin kullan\u0131lmas\u0131n\u0131 ihmal veya suiistimal suretiyle \u00f6nleyen kamu g\u00f6revlileri hakk\u0131nda bu madde ile cezai m\u00fceyyide \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr.\u201d<\/p>\n<p>15. 2937 say\u0131l\u0131 Kanun&#8217;un &#8220;Mill\u00ee istihbarat te\u015fkilat\u0131n\u0131n g\u00f6revleri&#8221; kenar ba\u015fl\u0131kl\u0131 4. maddesi \u015f\u00f6yledir:<\/p>\n<p>\u201ca) T\u00fcrkiye Cumhuriyetinin \u00fclkesi ve milleti ile b\u00fct\u00fcnl\u00fc\u011f\u00fcne, varl\u0131\u011f\u0131na, ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131na, g\u00fcvenli\u011fine, Anayasal d\u00fczenine ve milli g\u00fcc\u00fcn\u00fc meydana getiren b\u00fct\u00fcn unsurlar\u0131na kar\u015f\u0131 i\u00e7ten ve d\u0131\u015ftan y\u00f6neltilen mevcut ve muhtemel faaliyetler hakk\u0131nda milli g\u00fcvenlik istihbarat\u0131n\u0131 Devlet \u00e7ap\u0131nda olu\u015fturmak ve bu istihbarat\u0131 Cumhurba\u015fkan\u0131, Genelkurmay Ba\u015fkan\u0131, Milli G\u00fcvenlik Kurulu Genel Sekreteri ile gerekli kurulu\u015flara ula\u015ft\u0131rmak.<\/p>\n<p>b) Devletin milli g\u00fcvenlik siyasetiyle ilgili planlar\u0131n haz\u0131rlanmas\u0131 ve y\u00fcr\u00fct\u00fclmesinde; Cumhurba\u015fkan\u0131, Genelkurmay Ba\u015fkan\u0131, M\u00eell\u00ee G\u00fcvenlik Kurulu Genel Sekreteri ile ilgili bakanl\u0131klar\u0131n istihbarat istek ve ihtiya\u00e7lar\u0131n\u0131 kar\u015f\u0131lamak.<\/p>\n<p>c) Kamu kurum ve kurulu\u015flar\u0131n\u0131n istihbarat faaliyetlerinin y\u00f6nlendirilmesi i\u00e7in Cumhurba\u015fkan\u0131 ve Milli G\u00fcvenlik Kuruluna tekliflerde bulunmak.<\/p>\n<p>d) Kamu kurum ve kurulu\u015flar\u0131n\u0131n istihbarat ve istihbarata kar\u015f\u0131 koyma faaliyetlerine teknik konularda m\u00fc\u015favirlik yapmak ve koordinasyonun sa\u011flanmas\u0131nda yard\u0131mc\u0131 olmak.<\/p>\n<p>e) Genelkurmay Ba\u015fkanl\u0131\u011f\u0131nca Silahl\u0131 Kuvvetler i\u00e7in l\u00fczum g\u00f6r\u00fclecek haber ve istihbarat\u0131, yap\u0131lacak protokole g\u00f6re Genelkurmay Ba\u015fkanl\u0131\u011f\u0131na ula\u015ft\u0131rmak.<\/p>\n<p>f) Mill\u00ee G\u00fcvenlik Kurulunda belirlenecek di\u011fer g\u00f6revleri yapmak.<\/p>\n<p>g) \u0130stihbarata kar\u015f\u0131 koymak.<\/p>\n<p>h) D\u0131\u015f g\u00fcvenlik, ter\u00f6rle m\u00fccadele ve mill\u00ee g\u00fcvenli\u011fe ili\u015fkin konularda Cumhurba\u015fkan\u0131nca verilen g\u00f6revleri yerine getirmek.<\/p>\n<p>i) D\u0131\u015f istihbarat, mill\u00ee savunma, ter\u00f6rle m\u00fccadele ve uluslararas\u0131 su\u00e7lar ile siber g\u00fcvenlik konular\u0131nda her t\u00fcrl\u00fc teknik istihbarat ve insan istihbarat\u0131 usul, ara\u00e7 ve sistemlerini kullanmak suretiyle bilgi, belge, haber ve veri toplamak, kaydetmek, analiz etmek ve \u00fcretilen istihbarat\u0131 gerekli kurulu\u015flara ula\u015ft\u0131rmak.<\/p>\n<p>j) \u0130stihbarat kapasitesini, niteli\u011fini ve etkinli\u011fini art\u0131rmak amac\u0131yla \u00e7a\u011fda\u015f istihbarat usul ve y\u00f6ntemlerini ara\u015ft\u0131rmak, teknolojik geli\u015fmeleri takip etmek ve uygun g\u00f6r\u00fclenleri temin etmek.<\/p>\n<p>Mill\u00ee \u0130stihbarat Te\u015fkilat\u0131na bu g\u00f6revler d\u0131\u015f\u0131nda g\u00f6rev verilemez. Mill\u00ee \u0130stihbarat Te\u015fkilat\u0131 birimlerinin g\u00f6rev, yetki ve sorumluluklar\u0131 Cumhurba\u015fkan\u0131nca onaylanacak bir y\u00f6netmelikte belirtilir.\u201d<\/p>\n<p>B. Avrupa \u0130nsan Haklar\u0131 Mahkemesi \u0130\u00e7tihad\u0131<\/p>\n<p>16. Ulusal g\u00fcvenlik gerek\u00e7esinin ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc s\u0131n\u0131rlamak i\u00e7in kullan\u0131ld\u0131\u011f\u0131 \u00f6nemli davalardan biri olan Observer ve Guardian\/Birle\u015fik Krall\u0131k (B. No: 13585\/88, 26\/11\/1991) karar\u0131nda Avrupa \u0130nsan Haklar\u0131 Mahkemesi (A\u0130HM) ulusal g\u00fcvenlik gibi \u00e7ok hassas bir konuda gazetecilerin yapaca\u011f\u0131 haberlere devletin s\u0131n\u0131rlama getirmesinin ve bu ba\u011flamda baz\u0131 haberlerin yap\u0131lmas\u0131n\u0131n kamu otoritelerince engellenmesinin m\u00fcmk\u00fcn oldu\u011funu belirtmi\u015ftir (Observer ve Guardian\/Birle\u015fik Krall\u0131k, \u00a7\u00a7 61-65).<\/p>\n<p>17. A\u0130HM, eldeki ba\u015fvuruya benzer ba\u015fvurulardan olan Sunday Times\/Birle\u015fik Krall\u0131k (No. 2) (B. No: 13166\/87, 26\/11\/1991, \u00a7\u00a7 53, 54) karar\u0131nda, ulusal istihbarat\u0131n gazeteciler taraf\u0131ndan a\u00e7\u0131klanmas\u0131 meselesini ele alm\u0131\u015ft\u0131r. Ba\u015fvurucu Sunday Times gazetesi &#8220;Spycather (Casus Avc\u0131s\u0131)&#8221; kitab\u0131yla ilgili olarak Observer ve Guardian gazeteleri i\u00e7in mahkemece verilen tedbir karar\u0131n\u0131n kendileri i\u00e7in de konmu\u015f say\u0131laca\u011f\u0131n\u0131 \u00e7\u00fcnk\u00fc ayn\u0131 karar\u0131n mahkemeye sayg\u0131s\u0131zl\u0131k etmeme kavram\u0131 nedeniyle kendilerini de ba\u011flad\u0131\u011f\u0131n\u0131 d\u00fc\u015f\u00fcnerek bir ba\u015fvuru yapm\u0131\u015ft\u0131r. Ba\u015fvurucu, di\u011ferlerinin yan\u0131 s\u0131ra kitab\u0131n Amerika Birle\u015fik Devletleri&#8217;nde bas\u0131lmas\u0131n\u0131n davan\u0131n \u015fartlar\u0131n\u0131 radikal bi\u00e7imde de\u011fi\u015ftirdi\u011fini iddia etmi\u015ftir. Bu ba\u015fvuru, tedbir karar\u0131n\u0131n y\u00fcr\u00fcrl\u00fckte oldu\u011fu 30\/7\/1987 ile 13\/10\/1987 tarihleri aras\u0131ndaki d\u00f6nemde yap\u0131lm\u0131\u015f ve bu d\u00f6nemde tedbir karar\u0131n\u0131n y\u00fcr\u00fcrl\u00fckte olmas\u0131n\u0131n ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc ihlal etti\u011fi ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr. A\u0130HM&#8217;e g\u00f6re ba\u015fvuru konusu kitab\u0131n Amerika Birle\u015fik Devletleri&#8217;nde yay\u0131mlanmas\u0131ndan sonra s\u00f6z konusu materyalin gizlili\u011fi kalmam\u0131\u015ft\u0131r. A\u0130HM, Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi&#8217;nin (S\u00f6zle\u015fme) ama\u00e7lar\u0131 ile ba\u011flant\u0131l\u0131 olarak kitab\u0131n yay\u0131mland\u0131\u011f\u0131 30\/7\/1987 tarihinde kitaptaki materyallerin gizlili\u011fiyle elde edilmek istenen faydan\u0131n ortadan kalkt\u0131\u011f\u0131n\u0131 tespit etmi\u015ftir. Bu sebeple A\u0130HM&#8217;e g\u00f6re bu tarihten sonra gizlili\u011fin korunmas\u0131 demokratik toplumda gerekli bir m\u00fcdahale say\u0131lamayaca\u011f\u0131ndan kitab\u0131n gazetelerde tefrika edilmesine ili\u015fkin yasak bak\u0131m\u0131ndan ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlal edildi\u011fi kabul edilmelidir (The Sunday Times (No. 2)).<\/p>\n<p>18. Yukar\u0131daki karar\u0131ndan farkl\u0131 olarak A\u0130HM, yay\u0131mlanana kadar kamunun i\u00e7eri\u011fine v\u00e2k\u0131f olmad\u0131\u011f\u0131 gizli bilgilerin yay\u0131mlanmas\u0131 meselesini dikkatli \u015fekilde ele alm\u0131\u015ft\u0131r. Stoll\/\u0130svi\u00e7re ([BD], B. No: 69698\/01, 10\/12\/2007) ba\u015fvurusunda A\u0130HM, ulusal menfaatlere ili\u015fkin gizli raporun bir k\u0131sm\u0131n\u0131 yay\u0131mlayan gazetecinin cezaland\u0131r\u0131lmas\u0131n\u0131 S\u00f6zle\u015fme&#8217;ye ayk\u0131r\u0131 bulmam\u0131\u015ft\u0131r. Oysa ba\u015fvurucudan hemen sonra raporun bir k\u0131sm\u0131 veya tamam\u0131 di\u011fer bas\u0131n yay\u0131n organlar\u0131nda yay\u0131mlanm\u0131\u015f ancak di\u011fer gazeteciler hakk\u0131nda herhangi bir soru\u015fturma a\u00e7\u0131lmam\u0131\u015ft\u0131r. A\u0130HM B\u00fcy\u00fck Dairesi meseleyi ayr\u0131nt\u0131l\u0131 olarak ele alm\u0131\u015ft\u0131r. Bu karar\u0131n Anayasa Mahkemesinin \u00f6n\u00fcndeki mevcut ba\u015fvuruya \u0131\u015f\u0131k tutacak yanlar\u0131 \u015fu \u015fekilde \u00f6zetlenebilir: \u0130lk olarak \u0130svi\u00e7re makamlar\u0131n\u0131n ald\u0131\u011f\u0131 tedbirin gereklili\u011fini de\u011ferlendirirken A\u0130HM, mevcut iki kamu \u00e7\u0131kar\u0131n\u0131n (okuyucular\u0131n g\u00fcncel bir konuda bilgilenme haklar\u0131 ve devlet makamlar\u0131n\u0131n y\u00fcr\u00fct\u00fclmekte olan diplomatik pazarl\u0131klardan kendi lehlerine ve tatmin edici bir sonu\u00e7 elde etme haklar\u0131n\u0131) dengelenmesini dikkate alm\u0131\u015ft\u0131r. \u0130kinci olarak ba\u015fvuruya konu yaz\u0131 yay\u0131mlanana kadar kamunun s\u00f6z konusu diplomatik rapor i\u00e7eri\u011fine v\u00e2k\u0131f olmad\u0131\u011f\u0131n\u0131 vurgulam\u0131\u015ft\u0131r (ayn\u0131 kararda bkz. \u00a7 113). \u00dc\u00e7\u00fcnc\u00fc olarak ise raporun if\u015fas\u0131n\u0131n ve s\u00f6z konusu yaz\u0131n\u0131n yay\u0131mlanmas\u0131n\u0131n yaz\u0131n\u0131n yay\u0131mland\u0131\u011f\u0131 tarihte \u0130svi\u00e7re&#8217;nin ulusal menfaatlerine hat\u0131r\u0131 say\u0131l\u0131r derecede zarar verme ihtimali oldu\u011funu tespit etmi\u015ftir (ayn\u0131 kararda bkz. \u00a7 130). B\u00fcy\u00fck Daire s\u00f6z konusu belgenin s\u0131zmas\u0131ndan sorumlu personel ile gazetecinin eylemlerini birbirinden ay\u0131rm\u0131\u015f ve yetkili organlar\u0131n belgenin s\u0131zmas\u0131na neden olan personelin yarg\u0131lanmas\u0131 i\u00e7in bir soru\u015fturma a\u00e7abilecek durumda oldu\u011funun alt\u0131n\u0131 \u00e7izmi\u015ftir (ayn\u0131 kararda bkz. \u00a7 143).<\/p>\n<p>19. A\u0130HM, S\u00fcrek (2)\/T\u00fcrkiye (B. No: 24122\/94, 8\/7\/1999) karar\u0131nda ba\u015fka \u015feylerin yan\u0131 s\u0131ra ba\u015fvuruya konu makalede if\u015fa edilen bilgilerin ba\u015fka gazetelerde yay\u0131mlan\u0131p yay\u0131mlanmad\u0131\u011f\u0131 meselesine de e\u011filmi\u015ftir. Karar\u0131n ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>\u00a0&#8220;Ayr\u0131ca, haber makalesine dayanak te\u015fkil eden bas\u0131n a\u00e7\u0131klamas\u0131n\u0131n zaten ba\u015fka gazetelerde yay\u0131nlanm\u0131\u015f oldu\u011fu ve su\u00e7lama konusu haberde s\u00f6z konusu rapor kapsam\u0131na bir ekleme yap\u0131lmad\u0131\u011f\u0131 tart\u0131\u015fmas\u0131zd\u0131r. Ayr\u0131ca di\u011fer gazetelerin an\u0131lan a\u00e7\u0131klamadan kaynaklanan yay\u0131ndan dolay\u0131 cezaland\u0131r\u0131lm\u0131\u015f oldu\u011fu da belirtilmemi\u015ftir (bkz. Weber\/\u0130svi\u00e7re, B. No:11034\/84, 22\/05\/1990 \u00a7 51). Mevcut davadaki haber makalesinin yay\u0131nland\u0131\u011f\u0131 tarihte baz\u0131 yanl\u0131\u015f davran\u0131\u015flarda bulunan polis ve jandarma g\u00f6revlilerini if\u015fa eden s\u00f6z konusu bilgi zaten halka a\u00e7\u0131klanm\u0131\u015ft\u0131r. A\u0130HM&#8217;in yerle\u015fik i\u00e7tihad\u0131na g\u00f6re bir kez kamuya a\u00e7\u0131k h\u00e2le getirildikten veya gizli olmaktan \u00e7\u0131kt\u0131ktan sonra bilgilerin if\u015fa edilmesini \u00f6nlemek demokratik toplumda gerekli bir m\u00fcdahale say\u0131lamayacakt\u0131r (Observer ve Guardian\/Birle\u015fik Krall\u0131k, \u00a7\u00a7 66-70; Weber\/\u0130svi\u00e7re, \u00a7 49; Sunday Times\/Birle\u015fik Krall\u0131k (No. 2), \u00a7\u00a7 52-56). A\u0130HM gizli bilgilerin veya ulusal g\u00fcvenlik meseleleriyle ilgili bilgilerin gazeteciler taraf\u0131ndan if\u015fa edilmesiyle ilgili bir\u00e7ok davada, devletin ald\u0131\u011f\u0131 tedbirlerin gazetecilerin ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne m\u00fcdahale te\u015fkil etti\u011fine karar vermi\u015ftir (Girleanu\/Romanya, B. No: 50376\/09, 26\/6\/2018, \u00a7\u00a7 71, 72; Dammann\/\u0130svi\u00e7re, B. No: 77551\/01, 25\/4\/2006, \u00a7 28).<\/p>\n<p>22. A\u0130HM, gazetecinin tutumunun de\u011ferlendirilmesinde gazetecinin gizli bilgiyi elde etme y\u00f6ntemi ve s\u00f6z konusu yay\u0131n\u0131n \u015fekli olmak \u00fczere iki hususun dikkate al\u0131nmas\u0131 gerekti\u011fini belirtmi\u015ftir (Stoll\/\u0130svi\u00e7re, \u00a7 140). Bu kapsamda ba\u015fvurucunun bir gazetecilik ara\u015ft\u0131rmas\u0131 ba\u011flam\u0131nda gizli asker\u00ee bilgileri if\u015fa etmesi nedeniyle yapt\u0131r\u0131ma maruz kald\u0131\u011f\u0131 bir davada A\u0130HM; ba\u015fvurucunun \u00f6zel g\u00f6rev ve sorumluluklar\u0131 bulunan silahl\u0131 kuvvetlerin bir \u00fcyesi olmamas\u0131n\u0131, bilgileri hukuka ayk\u0131r\u0131 yollarla elde etmemesini ve aktif olarak da elde etmeye \u00e7al\u0131\u015fmamas\u0131n\u0131 tutum kriteri a\u00e7\u0131s\u0131ndan ihlal sonucuna ula\u015f\u0131rken g\u00f6z\u00f6n\u00fcnde bulundurmu\u015ftur (Girleanu\/Romanya, \u00a7 91).<\/p>\n<p>23. Yerel mahkemelerce yap\u0131lan inceleme kriteri a\u00e7\u0131s\u0131ndan A\u0130HM, geleneksel olarak devletin egemenli\u011finin sert \u00e7ekirde\u011fi ile ilgili bir alan olan ulusal \u00e7\u0131karlar\u0131n tan\u0131mlanmas\u0131nda S\u00f6zle\u015fme\u2019ye taraf devletlerin yerini almak gibi bir g\u00f6revi olmad\u0131\u011f\u0131n\u0131, bununla birlikte S\u00f6zle\u015fme&#8217;nin 10. maddesi ile g\u00fcvence alt\u0131na al\u0131nan haklar\u0131n kullan\u0131m\u0131na yap\u0131lan m\u00fcdahalenin incelenmesinde yarg\u0131laman\u0131n hakkaniyete uygunlu\u011funa ili\u015fkin tespitlerin dikkate al\u0131nmas\u0131 gerekebilece\u011fini belirtmi\u015ftir (G\u00f6rm\u00fc\u015f ve di\u011ferleri\/T\u00fcrkiye, \u00a7 64). Ayr\u0131ca yerel mahkemelerin ba\u015fvurucunun tutumunu dikkate almalar\u0131n\u0131n, s\u00f6z konusu bilgilerin ger\u00e7ekten bir tehdit olu\u015fturup olu\u015fturmayaca\u011f\u0131n\u0131 teyit etmelerinin ve s\u00f6z konusu belgelerin gizlili\u011fini korumaya y\u00f6nelik menfaat ile bir gazetecilik ara\u015ft\u0131rmas\u0131ndan do\u011fan menfaat ve kamunun if\u015fadan hatta belgelerin ger\u00e7ek i\u00e7eri\u011finden haberdar olma menfaati aras\u0131nda bir dengeleme yap\u0131lmas\u0131n\u0131n gerekli oldu\u011funu belirtmi\u015ftir (Girleanu\/Romanya, \u00a7 95).<\/p>\n<p>24. Yapt\u0131r\u0131m\u0131n orant\u0131l\u0131l\u0131\u011f\u0131yla ilgili olarak A\u0130HM, gizli asker\u00ee bilgilerin if\u015fa edilmesine ili\u015fkin cezai yapt\u0131r\u0131mlara dair davalarda ulusal makamlara belirli bir takdir pay\u0131 b\u0131rak\u0131lmas\u0131 gerekti\u011fini vurgulam\u0131\u015ft\u0131r. Ancak bir gazetecilik ara\u015ft\u0131rmas\u0131 i\u00e7in uygulanan para cezas\u0131n\u0131n nispeten d\u00fc\u015f\u00fck miktar\u0131n\u0131n bile S\u00f6zle\u015fme&#8217;nin 10. maddesinin ihlal edildi\u011fine karar vermesini engellemeyece\u011fini belirtmi\u015ftir. Ba\u015fvurucunun t\u00fcm \u015fik\u00e2yetleri, Anayasa&#8217;n\u0131n 26. maddesinde g\u00fcvence alt\u0131na al\u0131nan ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc kapsam\u0131nda incelenmi\u015ftir.<\/p>\n<p>29. Dolay\u0131s\u0131yla s\u00f6z konusu mahkeme karar\u0131yla ba\u015fvurucunun ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne y\u00f6nelik bir m\u00fcdahalede bulunuldu\u011fu a\u00e7\u0131kt\u0131r.<\/p>\n<p>ii. M\u00fcdahalenin \u0130hlal Olu\u015fturup Olu\u015fturmad\u0131\u011f\u0131<\/p>\n<p>32. Anayasa Mahkemesi her zaman ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn demokratik bir toplumun zorunlu temellerinden oldu\u011funu, toplumun ilerlemesi ve her bireyin geli\u015fmesi i\u00e7in gerekli temel \u015fartlardan birini olu\u015fturdu\u011funu ifade etmi\u015ftir (Mehmet Ali Ayd\u0131n, \u00a7 69; Bekir Co\u015fkun, \u00a7\u00a7 34-36). Nitekim Anayasa&#8217;n\u0131n 26. maddesinin birinci f\u0131kras\u0131, ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne i\u00e7erik bak\u0131m\u0131ndan bir s\u0131n\u0131rlama getirmemekte; siyasi, sanatsal, bilimsel, akademik veya ticari d\u00fc\u015f\u00fcnce ve kanaat a\u00e7\u0131klamalar\u0131 gibi her t\u00fcrl\u00fc ifadeyi kapsam\u0131na almaktad\u0131r (Erg\u00fcn Poyraz (2) [GK], B. No: 2013\/8503, 27\/10\/2015, \u00a7 37; \u00d6nder Bal\u0131k\u00e7\u0131 [2.B], B. No: 2014\/6009, 15\/2\/2017, \u00a7 40).<\/p>\n<p>38. Bununla birlikte ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc mutlak bir hak olmay\u0131p Anayasa\u2019da yer alan temel hak ve \u00f6zg\u00fcrl\u00fcklerin s\u0131n\u0131rlama rejimine tabidir (Abdullah \u00d6calan [GK], B. No: 2013\/409, 25\/6\/2014, \u00a7 70). Bu kapsamda Anayasa&#8217;n\u0131n 26. maddesinin ikinci f\u0131kras\u0131na g\u00f6re ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc mill\u00ee g\u00fcvenlik, su\u00e7lar\u0131n \u00f6nlenmesi, su\u00e7lular\u0131n cezaland\u0131r\u0131lmas\u0131, devlet s\u0131rr\u0131 olarak usul\u00fcnce belirtilmi\u015f bilgilerin a\u00e7\u0131klanmamas\u0131 ve devlete ait gizli bilgilerin a\u00e7\u0131klanmas\u0131n\u0131n \u00f6nlenmesi ama\u00e7lar\u0131yla s\u0131n\u0131rlanabilir. Bu ama\u00e7lar do\u011frultusunda mill\u00ee g\u00fcvenli\u011fi ilgilendiren ve devlete ait olan gizli bilgilerin a\u00e7\u0131klanmas\u0131n\u0131n su\u00e7 olarak d\u00fczenlenmesi ve cezaland\u0131r\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr (Erdem G\u00fcl ve Can D\u00fcndar [GK], B. No: 2015\/18567, 25\/2\/2016, \u00a7 89) ancak mill\u00ee g\u00fcvenlik gerek\u00e7e g\u00f6sterilerek yap\u0131lacak k\u0131s\u0131tlama siyasi ve toplumsal meselelere ili\u015fkin salt ho\u015fa gitmeyen g\u00f6r\u00fc\u015flerin dile getirilmesini engellemeye, mill\u00ee g\u00fcvenlik kavram\u0131yla ilgili olmayan \u00e7\u0131karlar\u0131 korumaya, kurumlar\u0131n\u0131n faaliyetleri hakk\u0131nda bilgi edinmeyi ya da ele\u015ftiride bulunmay\u0131 engellemeye matuf ise me\u015frulu\u011fundan bahsedilemeyecek ve ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlali sonucunu do\u011furacakt\u0131r (J.R.H. [1. B.], B. No: 2021\/4791, 6\/3\/2024, \u00a7 31).<\/p>\n<p>\u00a0(b) \u0130lkelerin Olaya Uygulanmas\u0131<\/p>\n<p>39. Somut olayda M\u0130T&#8217;ten emekli olan ba\u015fvurucu, bir internet sitesinde birtak\u0131m bilgiler payla\u015fmas\u0131 nedeniyle M\u0130T mensuplar\u0131n\u0131n kimliklerini ve istihbarat faaliyeti ile ilgili bilgi ve belgeleri if\u015fa etme su\u00e7undan cezaland\u0131r\u0131lm\u0131\u015ft\u0131r. O h\u00e2lde tart\u0131\u015f\u0131lmas\u0131 gereken esas mesele ba\u015fvurucunun payla\u015f\u0131m\u0131nda yer alan bilgilerin ger\u00e7ekten de M\u0130T mensuplar\u0131 ve onlar\u0131n aileleri ile istihbarat faaliyetlerine y\u00f6nelik ger\u00e7ek bir tehdit olu\u015fturup olu\u015fturmad\u0131\u011f\u0131d\u0131r. Dolay\u0131s\u0131yla derece mahkemelerince yap\u0131lmas\u0131 gereken, s\u00f6z konusu bilgilerin gizlili\u011fini korumaya y\u00f6nelik menfaatler ile toplumun bu bilgilerden haberdar olma menfaati aras\u0131nda bir denge kurmakt\u0131r.<\/p>\n<p>40. Bu kapsamda Anayasa Mahkemesi ilk olarak ba\u015fvuruya konu yaz\u0131da a\u00e7\u0131klanan bilgilerin gizli olup olmad\u0131\u011f\u0131na, dolay\u0131s\u0131yla bu payla\u015f\u0131m\u0131n if\u015fa etme olarak kabul edilip edilemeyece\u011fine odaklanacakt\u0131r. \u0130f\u015fa etmek; gizli herhangi bir \u015feyi ortaya d\u00f6kmek, a\u00e7\u0131\u011fa vurmak, yaymak anlamlar\u0131na gelmektedir. Bir haber ya da bilginin i\u00e7eri\u011finin ilk kez a\u00e7\u0131\u011fa \u00e7\u0131kar\u0131lmas\u0131n\u0131n ve yay\u0131lmas\u0131n\u0131n ceza hukuku anlam\u0131nda if\u015fa olarak kabul edilmesi kolay olmakla birlikte daha \u00f6nce yay\u0131mlanm\u0131\u015f veya kamunun bildi\u011fi bir i\u00e7eri\u011fin yenidenifade edilmesi veya yay\u0131lmas\u0131 h\u00e2linde eylemin if\u015fa etmek olarak kabul edilip edilmeyece\u011fi tart\u0131\u015fmal\u0131 bir meseledir. Dolay\u0131s\u0131yla bir bilginin ilk kez if\u015fa edilmesiyle daha \u00f6nce if\u015fa edilen bir bilginin payla\u015f\u0131lmas\u0131 aras\u0131nda dikkatli bir ayr\u0131m yap\u0131lmal\u0131d\u0131r (benzer de\u011ferlendirmelerin yap\u0131ld\u0131\u011f\u0131 kararlar i\u00e7in bkz. Somut olayda ba\u015fvurucu, M\u0130T&#8217;in personel atamalar\u0131na ili\u015fkin olarak yakla\u015f\u0131k yirmi farkl\u0131 internet sitesinde yer alan haber ve yorumlar\u0131 derleyip bu atamalara ili\u015fkin ele\u015ftirilerini de ekleyerek ba\u015fvuruya konu yaz\u0131y\u0131 payla\u015ft\u0131\u011f\u0131n\u0131 iddia etmi\u015ftir. Ba\u015fvurucu, an\u0131lan yaz\u0131da bilgilerin kaynaklar\u0131n\u0131 da g\u00f6stermi\u015ftir. Bunun \u00fczerine Ba\u015fsavc\u0131l\u0131k bu konuda bilirki\u015fi marifetiyle inceleme yapt\u0131rm\u0131\u015ft\u0131r. 1\/6\/2017 tarihli bilirki\u015fi raporunda yaz\u0131 i\u00e7eri\u011finin ve at\u0131fta bulunulan a\u00e7\u0131k kaynaklardaki bilgilerin \u00f6rt\u00fc\u015ft\u00fc\u011f\u00fc belirtilmi\u015ftir (bkz. \u00a7 7). Bu h\u00e2liyle yaz\u0131da yer alan bilgilerin a\u00e7\u0131k kaynaklarda yer alan, daha \u00f6nce aleni h\u00e2le gelmi\u015f, gizlilik vasf\u0131 olmayan bilgiler oldu\u011fu y\u00f6n\u00fcnde soru\u015fturma dosyas\u0131na giren teknik bir tespit oldu\u011fu g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Bu nedenle bilgilerin gizli oldu\u011fu ve payla\u015f\u0131m\u0131n da if\u015fa niteli\u011fini ta\u015f\u0131d\u0131\u011f\u0131 tespitinin yap\u0131labilmesi i\u00e7in bilirki\u015fi raporundaki tespitlerin \u00e7\u00fcr\u00fct\u00fclmesi gerekir.<\/p>\n<p>42. Ba\u015fsavc\u0131l\u0131\u011f\u0131n bilirki\u015fi raporuna istinaden kovu\u015fturmaya yer olmad\u0131\u011f\u0131na dair verdi\u011fi ek karar\u0131n itiraz \u00fczerine kald\u0131r\u0131lmas\u0131 sonras\u0131 a\u00e7\u0131lan kamu davas\u0131nda ba\u015fvurucu, kovu\u015fturma a\u015famas\u0131nda da yaz\u0131s\u0131nda dile getirdi\u011fi hususlar\u0131n gizli olmad\u0131\u011f\u0131, daha \u00f6nce belirtti\u011fi a\u00e7\u0131k kaynaklarda bu bilgilerin yer ald\u0131\u011f\u0131 itiraz\u0131n\u0131 s\u00fcrd\u00fcrm\u00fc\u015ft\u00fcr. Buna kar\u015f\u0131n yarg\u0131 makamlar\u0131, soru\u015fturma a\u015famas\u0131nda ba\u015fvurucunun savunmas\u0131n\u0131 do\u011frulayan bilirki\u015fi raporunu \u00e7\u00fcr\u00fcten yeni bir bilirki\u015fi raporu alma yoluna gitmedi\u011fi gibi ba\u015fvurucunun yarg\u0131laman\u0131n sonucunu de\u011fi\u015ftirmeye matuf savunmalar\u0131na da neden itibar etmedi\u011fini a\u00e7\u0131klamadan mahk\u00fbmiyet sonucuna ula\u015fm\u0131\u015ft\u0131r (bkz. \u00a7 9). Karar\u0131 kanun yolu a\u015famas\u0131nda inceleyen B\u00f6lge Adliye Mahkemesi de ek bir gerek\u00e7e belirtmeden istinaf talebini reddetmi\u015ftir. Sonu\u00e7 olarak yarg\u0131 makamlar\u0131, ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc ile mill\u00ee g\u00fcvenli\u011fin korunmas\u0131 me\u015fru amac\u0131 aras\u0131nda adil bir denge kurmaya \u00e7al\u0131\u015fmam\u0131\u015f; yaln\u0131zca soyut bir de\u011ferlendirmeyle s\u00f6z konusu yaz\u0131n\u0131n an\u0131lan su\u00e7u olu\u015fturdu\u011funu kabul ederek ba\u015fvurucunun 3 y\u0131l 4 ay hapis cezas\u0131 ile mahk\u00fbmiyetine karar vermi\u015ftir.<\/p>\n<p>43. Bu durumda ba\u015fvurucunun h\u00fcrriyeti ba\u011flay\u0131c\u0131 bir ceza ile mahk\u00fbmiyetinin zorunlu bir ihtiyac\u0131 kar\u015f\u0131lad\u0131\u011f\u0131 ve amaca ula\u015fmak bak\u0131m\u0131ndan orant\u0131l\u0131 oldu\u011fu ortaya konulamam\u0131\u015ft\u0131r. Derece mahkemelerinin ileri s\u00fcrd\u00fc\u011f\u00fc gerek\u00e7eler ba\u015fvurucunun ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne yap\u0131lan m\u00fcdahale i\u00e7in ilgili ve yeterli olarak kabul edilemez.<\/p>\n<p>44. A\u00e7\u0131klanan gerek\u00e7elerle Anayasa\u2019n\u0131n 26. maddesinde g\u00fcvence alt\u0131na al\u0131nan ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn usul g\u00fcvenceleri y\u00f6n\u00fcnden ihlal edildi\u011fine karar verilmesi gerekir.<\/p>\n<p>Muhterem \u0130NCE bu g\u00f6r\u00fc\u015fe kat\u0131lmam\u0131\u015ft\u0131r.<\/p>\n<p>B. Hakaret Su\u00e7u Y\u00f6n\u00fcnden<\/p>\n<p>1. Ba\u015fvurucunun \u0130ddialar\u0131<\/p>\n<p>45. Ba\u015fvurucu, payla\u015ft\u0131\u011f\u0131 yaz\u0131da ge\u00e7en ifadeler nedeniyle hakaret su\u00e7undan cezaland\u0131r\u0131lmas\u0131n\u0131n ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc ihlal etti\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr.<\/p>\n<p>2. De\u011ferlendirme<\/p>\n<p>46. 30\/3\/2011 tarihli ve 6216 say\u0131l\u0131 Anayasa Mahkemesinin Kurulu\u015fu ve Yarg\u0131lama Usulleri Hakk\u0131nda Kanun\u2019un 47. maddesinin (5) numaral\u0131 f\u0131kras\u0131 ile Anayasa Mahkemesi \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc&#8217;n\u00fcn 64. maddesinin (1) numaral\u0131 f\u0131kras\u0131 gere\u011fi ba\u015fvuru yollar\u0131n\u0131n t\u00fcketildi\u011fi, ba\u015fvuru yolu \u00f6ng\u00f6r\u00fclmemi\u015f ise ihlalin \u00f6\u011frenildi\u011fi tarihten itibaren otuz g\u00fcn i\u00e7inde bireysel ba\u015fvuru yap\u0131lmas\u0131 gerekir.<\/p>\n<p>47. Somut olayda ba\u015fvurucunun h\u00fckm\u00fcn a\u00e7\u0131klanmas\u0131n\u0131n geri b\u0131rak\u0131lmas\u0131 karar\u0131na y\u00f6nelik itiraz\u0131n\u0131n Ankara 1. A\u011f\u0131r Ceza Mahkemesince 3\/7\/2018 tarihinde reddedilerek karar\u0131n kesinle\u015fti\u011fi g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Ba\u015fvurucu kesin nitelikteki ret karar\u0131na kar\u015f\u0131 15\/5\/2019 tarihinde istinaf talebinde bulunmu\u015ftur. B\u00f6lge Adliye Mahkemesi, itiraz konusunda \u00f6nceden kesin karar verildi\u011finden ayn\u0131 karara y\u00f6nelik karar verilmesine yer olmad\u0131\u011f\u0131na karar vermi\u015ftir.<\/p>\n<p>48. Ba\u015fvurucunun kesin oldu\u011fu a\u00e7\u0131k olan ve karar i\u00e7eri\u011finde de belirtilen bir karara kar\u015f\u0131 hatal\u0131 \u015fekilde ba\u015fka bir kanun yoluna ba\u015fvurarak kanun yolunda yan\u0131lmas\u0131 karar\u0131n kesinle\u015fmesini ve bireysel ba\u015fvuru s\u00fcresinin yeniden canland\u0131r\u0131lmas\u0131n\u0131 etkilememektedir. Ankara 1. A\u011f\u0131r Ceza Mahkemesinin itiraz\u0131n reddine dair karar\u0131nda bu karar\u0131n kesin oldu\u011fu hat\u0131rlat\u0131lm\u0131\u015ft\u0131r (bkz. \u00a7 9). A\u011f\u0131r Ceza Mahkemesinin kesin karar\u0131na y\u00f6nelik itiraz\u0131n esastan incelenmemesine dair karar verilmesi ve bu karar\u0131n tebli\u011f edilmesi bireysel ba\u015fvuru s\u00fcresini yeniden ba\u015flatmayacakt\u0131r. Dolay\u0131s\u0131yla ba\u015fvurucunun nihai karar\u0131 en ge\u00e7 istinaf talebinde bulundu\u011fu 15\/5\/2019 tarihinde \u00f6\u011frendi\u011fi kabul edilmelidir. Ba\u015fvurucunun nihai karar\u0131 \u00f6\u011frendi\u011fi 15\/5\/2019 tarihinden itibaren otuz g\u00fcnl\u00fck ba\u015fvuru s\u00fcresi ge\u00e7tikten sonra 16\/8\/2019 tarihinde bireysel ba\u015fvuruda bulundu\u011fu anla\u015f\u0131lm\u0131\u015ft\u0131r (benzer y\u00f6ndeki kararlar i\u00e7in bkz. Erendiz \u00d6nal, B. No: 2014\/1133, 30\/6\/2014; Mustafa \u0130leri, B. No: 2019\/3949, 7\/4\/2021).<\/p>\n<p>49. A\u00e7\u0131klanan gerek\u00e7elerle ba\u015fvurunun di\u011fer kabul edilebilirlik ko\u015fullar\u0131 y\u00f6n\u00fcnden incelenmeksizin s\u00fcre a\u015f\u0131m\u0131 nedeniyle kabul edilemez oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>VI. G\u0130DER\u0130M<\/p>\n<p>50. Ba\u015fvurucu; ihlalin tespiti ile yeniden yarg\u0131lamaya h\u00fckmedilmesi, maddi ve manevi olmak \u00fczere ayr\u0131 ayr\u0131 50.000 TL tazminat \u00f6denmesi talebinde bulunmu\u015ftur.<\/p>\n<p>51. Ba\u015fvuruda tespit edilen ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc ihlalinin sonu\u00e7lar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131 i\u00e7in yeniden yarg\u0131lama yap\u0131lmas\u0131nda hukuki yarar ve zorunluluk bulunmaktad\u0131r. Anayasa&#8217;n\u0131n 148. ve 153. maddeleri ile 30\/3\/2011 tarihli ve 6216 say\u0131l\u0131 Anayasa Mahkemesinin Kurulu\u015fu ve Yarg\u0131lama Usulleri Hakk\u0131nda Kanun&#8217;un 50. ve 66. maddeleri uyar\u0131nca ihlal karar\u0131n\u0131n g\u00f6nderildi\u011fi yarg\u0131 mercilerince yap\u0131lmas\u0131 gereken i\u015f, yeniden yarg\u0131lama i\u015flemlerini ba\u015flat\u0131p Anayasa Mahkemesinin ihlal karar\u0131nda belirtilen ilkelere ve gerek\u00e7elere uygun bi\u00e7imde y\u00fcr\u00fct\u00fclecek yarg\u0131lama sonunda hak ihlalinin nedenlerini gidererek yeni bir karar vermektir (yeniden yarg\u0131lama konusunda bkz. Mehmet Do\u011fan [GK], B. No: 2014\/8875, 7\/6\/2018, \u00a7\u00a7 54-60; Alig\u00fcl Alkaya ve di\u011ferleri (2), B. No: 2016\/12506, 7\/11\/2019, \u00a7\u00a7 53-60, 66; Kadri Enis Berbero\u011flu (3) [GK], B. No: 2020\/32949, 21\/1\/2021, \u00a7\u00a7 93-100).<\/p>\n<p>52. \u00d6te yandan hak ihlali karar\u0131ndan Anayasa Mahkemesinin davan\u0131n sonucuyla ilgili olarak bir tutum sergiledi\u011fi sonucu \u00e7\u0131kar\u0131lmamal\u0131d\u0131r. Anayasa Mahkemesince verilen hak ihlali karar\u0131 uyu\u015fmazl\u0131\u011f\u0131n sonu\u00e7lar\u0131ndan ba\u011f\u0131ms\u0131z olup davan\u0131n kabul\u00fcne, reddine ya da beraate veya mahk\u00fbmiyete karar verilmesi gerekti\u011fi anlam\u0131na gelmemektedir. Kural olarak, yarg\u0131laman\u0131n her a\u015famas\u0131nda oldu\u011fu gibi ihlalin sonu\u00e7lar\u0131n\u0131 gidermek \u00fczere yeniden yap\u0131lacak yarg\u0131lama sonunda da delillerin dava ile ili\u015fkisini kurma ve bunlar\u0131 de\u011ferlendirip sonu\u00e7 \u00e7\u0131karma yetkisi ilgili mahkemelere aittir (Hasan Sar\u0131c\u0131 [GK], B. No: 2018\/37695, 9\/10\/2024, \u00a7 55).<\/p>\n<p>53. Son olarak somut olayda ihlalin tespit edilmesinin ba\u015fvurucunun u\u011frad\u0131\u011f\u0131 zararlar\u0131n giderilmesi bak\u0131m\u0131ndan yetersiz kalaca\u011f\u0131 a\u00e7\u0131kt\u0131r. Dolay\u0131s\u0131yla eski h\u00e2le getirme kural\u0131 \u00e7er\u00e7evesinde ihlalin b\u00fct\u00fcn sonu\u00e7lar\u0131yla ortadan kald\u0131r\u0131labilmesi i\u00e7in ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlali nedeniyle yaln\u0131zca ihlal tespitiyle giderilemeyecek olan manevi zararlar\u0131 kar\u015f\u0131l\u0131\u011f\u0131nda ba\u015fvurucuya net 34.000 TL manevi tazminat \u00f6denmesine karar verilmesi gerekir. Ba\u015fvurucu, bilgi ve belge sunmad\u0131\u011f\u0131ndan ba\u015fvurucunun maddi tazminat talebinin reddi gerekir.<\/p>\n<p>VII. H\u00dcK\u00dcM<\/p>\n<p>A\u00e7\u0131klanan gerek\u00e7elerle;<\/p>\n<p>A. 1. \u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn 2937 say\u0131l\u0131 Kanunu&#8217;na muhalefet su\u00e7u y\u00f6n\u00fcnden ihlal edildi\u011fine ili\u015fkin iddian\u0131n KABUL ED\u0130LEB\u0130L\u0130R OLDU\u011eUNA OYB\u0130RL\u0130\u011e\u0130YLE,<\/p>\n<p>2. \u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn hakaret su\u00e7u y\u00f6n\u00fcnden ihlal edildi\u011fine ili\u015fkin iddian\u0131n s\u00fcre a\u015f\u0131m\u0131 nedeniyle KABUL ED\u0130LEMEZ OLDU\u011eUNA OYB\u0130RL\u0130\u011e\u0130YLE,<\/p>\n<p>B. Ba\u015fvurucuya net 34.000 TL manevi tazminat \u00d6DENMES\u0130NE, tazminata ili\u015fkin di\u011fer taleplerin REDD\u0130NE,<\/p>\n<p>E. 364,60 TL har\u00e7 ve 30.000 TL vek\u00e2let \u00fccretinden olu\u015fan toplam 30.364,60 TL yarg\u0131lama giderinin ba\u015fvurucuya \u00d6DENMES\u0130NE,<\/p>\n<p>F. \u00d6demelerin karar\u0131n tebli\u011fini takiben ba\u015fvurucunun Hazine ve Maliye Bakanl\u0131\u011f\u0131na ba\u015fvuru tarihinden itibaren d\u00f6rt ay i\u00e7inde yap\u0131lmas\u0131na, \u00f6demede gecikme olmas\u0131 h\u00e2linde bu s\u00fcrenin sona erdi\u011fi tarihten \u00f6deme tarihine kadar ge\u00e7en s\u00fcre i\u00e7in yasal FA\u0130Z UYGULANMASINA,<\/p>\n<p>G. Karar\u0131n bir \u00f6rne\u011finin Adalet Bakanl\u0131\u011f\u0131na G\u00d6NDER\u0130LMES\u0130NE 15\/1\/2025 tarihinde karar verildi.<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>KAR\u015eIOY GEREK\u00c7ES\u0130<\/p>\n<p>1. Ba\u015fvurucunun, bir internet sitesinde yazd\u0131\u011f\u0131 makelelerden dolay\u0131 2937 say\u0131l\u0131 Kanun&#8217;da yer alan if\u015fa su\u00e7unu i\u015fledi\u011finden bahisle cezaland\u0131r\u0131lmas\u0131 nedeniyle ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlal edildi\u011fi ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr. Mahkememiz \u00e7o\u011funlu\u011fu taraf\u0131ndan, ba\u015fvurucunun makalelerinde yer verilen istihbarat g\u00f6revlilerinin daha \u00f6nce haberle\u015ftirilerek if\u015fa edilmi\u015f olmalar\u0131na ra\u011fmen mahkumiyet karar\u0131nda ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne yap\u0131lan m\u00fcdahalenin zorunlu bir toplumsal ihtiyac\u0131 kar\u015f\u0131lad\u0131\u011f\u0131n\u0131n ilgili ve yeterli gerek\u00e7eyle g\u00f6sterilmedi\u011fi belirtilerek ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlal edildi\u011fi sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>2. \u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fc ki\u015finin haber ve bilgilere, ba\u015fkalar\u0131n\u0131n fikirlerine serbest\u00e7e ula\u015fabilmesi, d\u00fc\u015f\u00fcnce ve kanaatlerinden dolay\u0131 k\u0131nanmamas\u0131, bunlar\u0131 tek ba\u015f\u0131na veya ba\u015fkalar\u0131yla birlikte \u00e7e\u015fitli yollarla serbest\u00e7e ifade edebilmesi, anlatabilmesi, savunabilmesi, ba\u015fkalar\u0131na aktarabilmesi ve yayabilmesi anlam\u0131na gelir. Anayasa Mahkemesi ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn demokrasinin i\u015fleyi\u015fi i\u00e7in ya\u015famsal \u00f6nemde oldu\u011funu daha \u00f6nce pek \u00e7ok karar\u0131nda a\u00e7\u0131klam\u0131\u015ft\u0131r (Bekir Co\u015fkun [GK], B. No: 2014\/12151, 4\/6\/2015, \u00a7\u00a7 33-35; Mehmet Ali Ayd\u0131n [GK], B. No: 2013\/9343, 4\/6\/2015, \u00a7\u00a7 42, 43;Tansel \u00c7\u00f6la\u015fan [1.B.], B. No: 2014\/6128, 7\/7\/2015, \u00a7\u00a7 35-38).<\/p>\n<p>3. \u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne y\u00f6nelik bir m\u00fcdahalenin demokratik toplum d\u00fczeninin gereklerine uygun kabul edilebilmesi i\u00e7in zorunlu bir toplumsal ihtiyac\u0131 kar\u015f\u0131lamas\u0131 ve orant\u0131l\u0131 olmas\u0131 gerekir (Bekir Co\u015fkun, \u00a7\u00a7 53-55; Mehmet Ali Ayd\u0131n, \u00a7\u00a7 70-72; AYM, E.2007\/4, K.2007\/81, 18\/10\/2007). Derece mahkemeleri, bireylerin fikirlerini ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc yoluyla ifade etme haklar\u0131 ile Anayasa&#8217;n\u0131n 26. maddesinin ikinci f\u0131kras\u0131nda belirtilen me\u015fru ama\u00e7lar aras\u0131nda adil bir denge sa\u011flamal\u0131d\u0131r (Bekir Co\u015fkun, \u00a7\u00a7 44, 47, 48; Hakan Yi\u011fit [2.B.], B. No: 2015\/3378, 5\/7\/2017, \u00a7\u00a7 58, 61, 66). Derece mahkemeleri s\u00f6z konusu dengelemeyi yaparken ve ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne yap\u0131lan m\u00fcdahalenin zorunlu bir toplumsal ihtiyac\u0131 kar\u015f\u0131lay\u0131p kar\u015f\u0131lamad\u0131\u011f\u0131n\u0131 de\u011ferlendirirken belirli bir takdir yetkisine sahiptir (Kemal K\u0131l\u0131\u00e7daro\u011flu [2.B.], B. No: 2014\/1577, 25\/10\/2017, \u00a7 57).<\/p>\n<p>4. Anayasa Mahkemesi, kamu g\u00f6revlisi olman\u0131n sa\u011flad\u0131\u011f\u0131 birtak\u0131m ayr\u0131cal\u0131klar ve avantajlar\u0131n yan\u0131nda baz\u0131 k\u00fclfet ve sorumluluklara katlanmay\u0131 ve di\u011fer ki\u015filerin tabi olmad\u0131\u011f\u0131 s\u0131n\u0131rlamalara tabi olmay\u0131 da gerektirdi\u011fini belirtmi\u015ftir. Ki\u015finin kamu g\u00f6revine kendi iste\u011fi ile girmekle bu stat\u00fcn\u00fcn gerektirdi\u011fi ayr\u0131cal\u0131klardan yararlanmay\u0131 ve k\u00fclfetlere katlanmay\u0131 kabul etmi\u015f say\u0131ld\u0131\u011f\u0131n\u0131, kamu hizmetinin kendine has \u00f6zelliklerinin bu avantaj ve s\u0131n\u0131rlamalar\u0131 zorunlu k\u0131ld\u0131\u011f\u0131n\u0131 ifade etmi\u015ftir (\u0130hsan Asutay, B. No: 2012\/606, 20\/2\/2014, \u00a7 38).<\/p>\n<p>5. Kamu g\u00f6revlilerinin stat\u00fclerinden kaynaklanan ve katlanmak zorunda olduklar\u0131 y\u00fck\u00fcml\u00fcl\u00fcklerden biri de Anayasa&#8217;n\u0131n 129. maddesinde \u00f6ng\u00f6r\u00fclen sadakat y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcd\u00fcr. Kamu g\u00f6revlisinin devlete sadakat y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc, kamu hizmetinin etkin bir \u015fekilde y\u00fcr\u00fct\u00fclmesi ve mesleki disiplinin sa\u011flanmas\u0131 konusunda bir fonksiyon icra etmektedir. Bu y\u00fck\u00fcml\u00fcl\u00fck, \u00f6zellikle ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn kullan\u0131m\u0131 y\u00f6n\u00fcnden kamu g\u00f6revlilerini di\u011fer vatanda\u015flardan daha k\u0131s\u0131tl\u0131 bir konuma getirebilir. Di\u011fer yandan bu k\u0131s\u0131tlama, kamu g\u00f6revlilerini temel haklar\u0131n\u0131 kullanmalar\u0131n\u0131 tamamen imk\u00e2ns\u0131zla\u015ft\u0131racak \u015fekilde a\u015f\u0131r\u0131 bir y\u00fck\u00fcml\u00fcl\u00fck alt\u0131nda da b\u0131rakmamal\u0131d\u0131r. Bu noktada temel hakk\u0131n kullan\u0131m\u0131 ile devlete sadakat y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc gibi kamu g\u00f6revlisi stat\u00fcs\u00fcnden kaynaklanan gereklilikler aras\u0131nda adil bir denge kurulmal\u0131d\u0131r (G\u00fclistan Atasoy ve di\u011ferleri [G.K.], B. No: 2017\/15845, 21\/1\/2021, \u00a7 68).<\/p>\n<p>6. Devletin kamu hizmetinde \u00e7al\u0131\u015fan memurlar\u0131na bir ba\u011fl\u0131l\u0131k g\u00f6revi getirmesi, \u00f6dev ve sorumluluklar y\u00fcklemesi memurlar\u0131n stat\u00fcleri gere\u011fi me\u015fru kabul edilebilir bir durumdur. Fakat devlet memurlar\u0131n\u0131n da birer birey oldu\u011fu, siyasi g\u00f6r\u00fc\u015f sahibi olma, \u00fclke sorunlar\u0131yla ilgilenme, tercih yapma gibi sosyal y\u00f6nlere sahip olma haklar\u0131n\u0131n bulundu\u011fu \u015f\u00fcpheden uzakt\u0131r (Hasan G\u00fcng\u00f6r [2.B.], B. No: 2013\/6152, 24\/2\/2016, \u00a7 49).<\/p>\n<p>7. Bununla birlikte devlet memurlar\u0131 s\u00f6z konusu oldu\u011funda g\u00f6r\u00fc\u015flerin dengeli ve siyaseten yans\u0131z olarak a\u00e7\u0131klan\u0131p a\u00e7\u0131klanmad\u0131\u011f\u0131, ki\u015fisel tav\u0131rlar sergilenip sergilenmedi\u011fi ve tarafs\u0131zl\u0131klar\u0131n\u0131n g\u00fcvence alt\u0131nda olup olmad\u0131\u011f\u0131 ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc incelemesinde de\u011ferlendirmeye al\u0131n\u0131r. Bu ba\u011flamda memurun bulundu\u011fu konum ve g\u00f6rev yapt\u0131\u011f\u0131 alanla ilgili olarak \u00f6dev ve sorumluluk derecesini belirlemede ulusal makamlar\u0131n bir takdir marj\u0131 vard\u0131r (Hasan G\u00fcng\u00f6r, \u00a7 48).<\/p>\n<p>8. Somut olayda, ba\u015fvurucu taraf\u0131ndan kaleme al\u0131nan makalelerde daha \u00f6nce haberlere konu olan bilgilerin yan\u0131nda emekli M\u0130T mensubu olmas\u0131 nedeniyle vak\u0131f oldu\u011fu bilgilerden kaynakl\u0131 de\u011ferlendirmelerini de i\u00e7erdi\u011fi anla\u015f\u0131lmaktad\u0131r. Buna ra\u011fmen \u00e7o\u011funluk karar\u0131nda ba\u015fvurucunun hem emekli M\u0130T mensubu oldu\u011fu hem de makalelerde yer verilen de\u011ferlendirmeler y\u00f6n\u00fcnden bir inceleme yap\u0131lmad\u0131\u011f\u0131 tespit edilmi\u015ftir.<\/p>\n<p>9. Bu kapsamda \u00f6ncelikle emekli olan ba\u015fvurucunun kamu g\u00f6revlilerine ili\u015fkin sadakat y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn devam edip etmedi\u011finin tespit edilmesi gerekir.<\/p>\n<p>10. Milli g\u00fcvenli\u011fin sa\u011flanmas\u0131 me\u015fru amac\u0131na y\u00f6nelik olarak devletin demokratik toplumda zorunluluk \u00e7er\u00e7evesinde acil sosyal ihtiyac\u0131 belirlemek ve milli g\u00fcvenli\u011fi koruma ara\u00e7lar\u0131n\u0131 se\u00e7mek hususunda takdir yetkisi olduk\u00e7a geni\u015ftir (\u00d6.\u00c7. [1.B.], B. No: 2014\/8203, 21\/9\/2016, \u00a7 73).<\/p>\n<p>11. Zira &#8220;milli g\u00fcvenlik&#8221;, gerek T\u00fcrk hukukunda, gerek Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesinde ve gerekse Amerikan hukukunda ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn \u00f6zel bir g\u00f6r\u00fcn\u00fcm\u00fc olan bas\u0131n \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn s\u0131n\u0131rland\u0131rma nedenlerinden birisidir. Bas\u0131n \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ulusal g\u00fcvenlik nedeniyle s\u0131n\u0131rland\u0131r\u0131lmas\u0131 devletin ve toplumun korunmas\u0131 kategorisi i\u00e7erisindedir.<\/p>\n<p>12. A\u0130HM de milli g\u00fcvenlik kavram\u0131n\u0131 de\u011ferlendirirken \u00fclkelerin kendi konumlar\u0131n\u0131 g\u00f6zard\u0131 etmemekte, her \u00fclkenin kendi ko\u015fullar\u0131na g\u00f6re de\u011fi\u015fkenlik g\u00f6sterebilece\u011fini kabul etmekte ve bu konuda ulusal makamlara geni\u015f bir takdir alan\u0131 b\u0131rakmaktad\u0131r. Ancak bu de\u011ferlendirmeyi yaparken asgari bir s\u0131n\u0131r belirlemekte ve milli g\u00fcvenlik gerek\u00e7esiyle ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne yap\u0131lacak m\u00fcdahalenin hakl\u0131l\u0131\u011f\u0131n\u0131n ispatlanmas\u0131n\u0131, milli g\u00fcvenli\u011fe ili\u015fkin gizliliklerin ve endi\u015felerin alenile\u015ftirilmemesi y\u00f6n\u00fcndeki kabul edilebilir tedbirlerin olabilece\u011fini s\u00f6yleyerek devlete y\u00fcklemektedir.<\/p>\n<p>13. 2937 say\u0131l\u0131 Kanun&#8217;un 4. maddesinde M\u0130T&#8217;in g\u00f6revleri say\u0131lm\u0131\u015f ve bu g\u00f6revler aras\u0131nda \u00fclkenin varl\u0131\u011f\u0131na, ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131na, g\u00fcvenli\u011fine ve anayasal d\u00fczenine kar\u015f\u0131 i\u00e7ten ve d\u0131\u015ftan y\u00f6neltilen mevcut ve muhtemel faaliyetler hakk\u0131nda mill\u00ee g\u00fcvenlik istihbarat\u0131n\u0131 devlet \u00e7ap\u0131nda olu\u015fturma ve istihbarata kar\u015f\u0131 koyma g\u00f6rev ve sorumlulu\u011funun da bulundu\u011fu belirtilmi\u015ftir.<\/p>\n<p>14. M\u0130T&#8217;e verilen bu g\u00f6revlerin niteli\u011fi dikkate al\u0131nd\u0131\u011f\u0131nda ise bunlar\u0131n, ki\u015filerin temel hak ve \u00f6zg\u00fcrl\u00fcklerini, anayasal d\u00fczeni ve toplumun g\u00fcvenli\u011fini tesis etmekle g\u00f6revli devletin varl\u0131\u011f\u0131, ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 ve anayasal d\u00fczenin devam\u0131 y\u00f6n\u00fcnden \u00f6nemli oldu\u011fu, dolay\u0131s\u0131yla bu g\u00f6revlerin etkin bir \u015fekilde y\u00fcr\u00fct\u00fclmesinde \u00f6nemli bir kamu yarar\u0131n\u0131n bulundu\u011fu sonucuna ula\u015f\u0131lmaktad\u0131r(AYM, E.2014\/122, K.2015\/123, 30\/12\/2015, \u00a7 47).<\/p>\n<p>15.
