Ba\u015fvuru; hapis cezas\u0131n\u0131n do\u011frudan a\u00e7\u0131k ceza infaz kurumunda yerine getirilmesi ve COVID-19 salg\u0131n\u0131 kapsam\u0131nda izinli say\u0131lma taleplerinin ilgili kanun h\u00fck\u00fcmlerinin \u00f6ng\u00f6r\u00fclemez yorumuyla reddedilmesi nedeniyle ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fi hakk\u0131n\u0131n, Cumhuriyet savc\u0131s\u0131n\u0131n itiraz\u0131 bildirilmeden kesin nitelikte karar verilmesi, davan\u0131n sonucuna etkili iddialar\u0131n yan\u0131tlanmamas\u0131 ve yarg\u0131sal s\u00fcre\u00e7 boyunca esasa ili\u015fkin taleplerin incelenmemesi nedeniyle de adil yarg\u0131lanma hakk\u0131n\u0131n ihlal edildi\u011fi iddialar\u0131na ili\u015fkindir. <\/p>\n<p>II. BA\u015eVURU S\u00dcREC\u0130<\/p>\n<p>2. Ba\u015fvuru 26\/7\/2021 tarihinde yap\u0131lm\u0131\u015ft\u0131r. Komisyon, ba\u015fvurunun kabul edilebilirlik incelemesinin B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na karar vermi\u015ftir.<\/p>\n<p>3. Ba\u015fvuru belgelerinin bir \u00f6rne\u011fi bilgi i\u00e7in Adalet Bakanl\u0131\u011f\u0131na (Bakanl\u0131k) g\u00f6nderilmi\u015ftir. Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcn\u00fc bildirmi\u015ftir. Ba\u015fvurucu, Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 beyanda bulunmu\u015ftur.<\/p>\n<p>III. OLAY VE OLGULAR <\/p>\n<p>4. Ba\u015fvuru formu ve eklerinde ifade edildi\u011fi \u015fekliyle ve Ulusal Yarg\u0131 A\u011f\u0131 Bili\u015fim Sistemi (UYAP) arac\u0131l\u0131\u011f\u0131yla eri\u015filen bilgi ve belgeler \u00e7er\u00e7evesinde olaylar \u00f6zetle \u015f\u00f6yledir:<\/p>\n<p>5. Kocaeli Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131, ba\u015fvurucunun baz\u0131 sosyal medya payla\u015f\u0131mlar\u0131 nedeniyle ter\u00f6r \u00f6rg\u00fct\u00fcn\u00fcn propagandas\u0131n\u0131 yapma su\u00e7unu i\u015fledi\u011fi gerek\u00e7esiyle hakk\u0131nda soru\u015fturma ba\u015flatm\u0131\u015f ve ayn\u0131 su\u00e7tan 4\/8\/2017 tarihinde iddianame d\u00fczenlemi\u015ftir.<\/p>\n<p>6. Yarg\u0131lamay\u0131 y\u00fcr\u00fcten Kocaeli 2. A\u011f\u0131r Ceza Mahkemesi (Mahkeme) 21\/2\/2018 tarihinde ba\u015fvuruya konu 20\/8\/2016 tarihli sosyal medya payla\u015f\u0131m\u0131 nedeniyle ter\u00f6r \u00f6rg\u00fct\u00fcn\u00fcn propagandas\u0131n\u0131 yapma su\u00e7undan ba\u015fvurucunun 2 y\u0131l 6 ay hapis cezas\u0131yla cezaland\u0131r\u0131lmas\u0131na h\u00fckmetmi\u015ftir. An\u0131lan kararda hapis cezas\u0131n\u0131n infaz \u015fekline ili\u015fkin herhangi bir a\u00e7\u0131klamaya yer verilmemi\u015ftir.<\/p>\n<p>7. Mahk\u00fbmiyet h\u00fckm\u00fcne kar\u015f\u0131 ba\u015fvurucu istinaf kanun yoluna ba\u015fvurmu\u015ftur. H\u00fckm\u00fcn istinaf incelemesi devam ederken ba\u015fvurucu 24\/6\/2018 tarihinde milletvekili se\u00e7ilmi\u015ftir.<\/p>\n<p>8. \u0130stinaf incelemesini yapan \u0130stanbul B\u00f6lge Adliye Mahkemesi 3. Ceza Dairesi 7\/12\/2018 tarihinde istinaf ba\u015fvurusunun esastan reddine ve cezan\u0131n yerine getirilmesinin milletvekilli\u011fi s\u0131fat\u0131n\u0131n sona ermesine b\u0131rak\u0131lmas\u0131na kesin olarak karar vermi\u015ftir.<\/p>\n<p>9. Ba\u015fvurucu 4\/11\/2019 tarihinde Mahkemeye ba\u015fvurarak 17\/10\/2019 tarihli ve 7188 say\u0131l\u0131 Kanun gere\u011fince temyiz yoluna ba\u015fvurma imk\u00e2n\u0131n\u0131n tan\u0131nd\u0131\u011f\u0131 gerek\u00e7esiyle infaz\u0131n durdurulmas\u0131n\u0131 talep etmi\u015ftir. Mahkeme 4\/11\/2019 tarihli ek karar\u0131yla ba\u015fvurucu hakk\u0131ndaki h\u00fckm\u00fcn infaz\u0131n\u0131n durdurulmas\u0131na ve dosyan\u0131n talep do\u011frultusunda temyiz incelemesi yap\u0131lmas\u0131 i\u00e7in Yarg\u0131taya g\u00f6nderilmek \u00fczere \u0130stanbul B\u00f6lge Adliye Mahkemesi 3. Ceza Dairesine g\u00f6nderilmesine karar vermi\u015ftir.<\/p>\n<p>10. Temyiz incelemesini yapan Yarg\u0131tay 16. Ceza Dairesi 28\/1\/2021 tarihinde oy\u00e7oklu\u011fuyla mahk\u00fbmiyet karar\u0131n\u0131 onam\u0131\u015ft\u0131r. Bu kararda hapis cezas\u0131n\u0131n infaz \u015fekline ili\u015fkin herhangi bir belirleme yap\u0131lmam\u0131\u015ft\u0131r.<\/p>\n<p>11. Hakk\u0131ndaki mahk\u00fbmiyet karar\u0131n\u0131n 17\/3\/2021 tarihinde T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi (TBMM) Genel Kurulunda okunmas\u0131yla ba\u015fvurucunun milletvekilli\u011fi d\u00fc\u015f\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>12. Ba\u015fvurucunun milletvekilli\u011finin d\u00fc\u015f\u00fcr\u00fclmesi \u00fczerine Ankara Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131 (Ba\u015fsavc\u0131l\u0131k) ba\u015fvurucu hakk\u0131ndaki mahk\u00fbmiyet karar\u0131n\u0131n infaz\u0131n\u0131 ba\u015flatm\u0131\u015f ve ba\u015fvurucu 2\/4\/2021 tarihinde Sincan 2 No.lu F Tipi Y\u00fcksek G\u00fcvenlikli Ceza \u0130nfaz Kurumuna (Ceza \u0130nfaz Kurumu) yerle\u015ftirilmi\u015ftir. Ba\u015fsavc\u0131l\u0131k taraf\u0131ndan d\u00fczenlenen m\u00fcddetnameye g\u00f6re ba\u015fvurucunun ko\u015fullu sal\u0131verilme tarihi 13\/2\/2023, hak ederek tahliye tarihi ise 29\/9\/2023&#8217;t\u00fcr. M\u00fcddetnamede ayr\u0131ca infaz t\u00fcr\u00fc olarak 12\/4\/1991 tarihli ve 3713 say\u0131l\u0131 Ter\u00f6rle M\u00fccadele Kanunu&#8217;nun 17. maddesinin (1) numaral\u0131 f\u0131kras\u0131 yollamas\u0131yla 13\/12\/2004 tarihli ve 5275 say\u0131l\u0131 Ceza ve G\u00fcvenlik Tedbirlerinin \u0130nfaz\u0131 Hakk\u0131nda Kanun&#8217;un 107. maddesinin (4) numaral\u0131 f\u0131kras\u0131 belirtilmi\u015ftir.<\/p>\n<p>13. Ba\u015fvurucu 19\/4\/2021 tarihinde Ceza \u0130nfaz Kurumu M\u00fcd\u00fcrl\u00fc\u011f\u00fcnden 5275 say\u0131l\u0131 Kanun&#8217;un 14. maddesinin (2) numaral\u0131 f\u0131kras\u0131 gere\u011fince do\u011frudan a\u00e7\u0131k ceza infaz kurumuna al\u0131nmas\u0131n\u0131 ve ayn\u0131 Kanun&#8217;un ge\u00e7ici 9. maddesinin (5) numaral\u0131 f\u0131kras\u0131 uygulanarak izinli say\u0131lmak suretiyle tahliyesine karar verilmesini talep etmi\u015ftir. Talep dilek\u00e7esinde ayr\u0131ca ilk derece mahkemesi karar\u0131nda infaz usul\u00fcne ili\u015fkin eksiklik bulundu\u011funu ve bu eksikli\u011fin kanun yolu mercileri taraf\u0131ndan giderilmedi\u011fini belirterek infaz\u0131n ola\u011fan usullere g\u00f6re yerine getirilmesi gerekti\u011fini ve ter\u00f6r \u00f6rg\u00fct\u00fcn\u00fcn propagandas\u0131n\u0131 yapma su\u00e7unun mevzuat h\u00fck\u00fcmleri gere\u011fi ter\u00f6r su\u00e7u olarak kabul\u00fcn\u00fcn m\u00fcmk\u00fcn olmad\u0131\u011f\u0131n\u0131 belirtmi\u015ftir.<\/p>\n<p>14. Ceza \u0130nfaz Kurumu M\u00fcd\u00fcrl\u00fc\u011f\u00fc ba\u015fvurucunun an\u0131lan talebini 30\/4\/2021 tarihinde reddetmi\u015ftir. S\u00f6z konusu karar\u0131n ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Ankara Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131nca 2021\/7-5793 say\u0131l\u0131 m\u00fcddetnamenin d\u00fczenledi\u011fi, m\u00fcddetnamede 3713 say\u0131l\u0131 Kanun &#8216;un 17\/1 maddesi atf\u0131 ile 5275 say\u0131l\u0131 Kanun&#8217;un 107\/4 maddesi gere\u011fince 3\/4 oran\u0131nda ko\u015fullu sal\u0131verilme s\u00fcresinin belirlendi\u011fi, buna g\u00f6re hakederek tahliye tarihinin 29.09.2023, ko\u015fullu sal\u0131verilme tarihinin ise 13.02.2023 oldu\u011fu, Ter\u00f6rle M\u00fccadele Kanun&#8217;nun 17. maddesinin de Ter\u00f6rle M\u00fccadele Kanunu kapsam\u0131nda ger\u00e7ekle\u015ftirilen eylemlerin ter\u00f6r su\u00e7u kabul edilerek 3\/4 oran\u0131ndaki ko\u015fullu sal\u0131verilme oran\u0131n\u0131n kabul edildi\u011fi, h\u00fck\u00fcml\u00fcn\u00fcn ger\u00e7ekle\u015ftirmi\u015f oldu\u011fu eylemin Ter\u00f6rle M\u00fccadele Kanunu kapsam\u0131nda olmas\u0131 dolay\u0131s\u0131 ile 5275 say\u0131l\u0131 Kanunun 9. maddesi gere\u011fince y\u00fcksek g\u00fcvenlikli kapal\u0131 ceza infaz kurumunda cezan\u0131n infaz\u0131na ba\u015fland\u0131\u011f\u0131, y\u00fcksek g\u00fcvenlikli kapal\u0131 ceza infaz kurumlar\u0131nda cezan\u0131n infaz\u0131n\u0131n ba\u015flanmas\u0131 sebebiyle 5275 say\u0131l\u0131 Kanun &#8216;un9\/5 maddesindeki d\u00fczenlemede yer alan toplam cezan\u0131n 1\/3&#8217;nin kapal\u0131 ceza infaz kurumunda ge\u00e7irilmesi gerekti\u011finden s\u00fcre bak\u0131m\u0131ndan gerekli \u015fartlar\u0131 ta\u015f\u0131mamas\u0131 nedeniyle de\u011ferlendirmeye al\u0131namayaca\u011f\u0131 &#8230;&#8221;<\/p>\n<p>15. Ba\u015fvurucu, Ceza \u0130nfaz Kurumu M\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn ret karar\u0131na 26\/5\/2021 tarihinde itiraz etmi\u015ftir. \u0130tiraz\u0131 inceleyen Ankara Bat\u0131 1. \u0130nfaz H\u00e2kimli\u011fi (\u0130nfaz H\u00e2kimli\u011fi) usul\u00fcne uygun idare ve g\u00f6zlem kurulu karar\u0131 al\u0131nd\u0131ktan sonra bu karara kar\u015f\u0131 \u015fik\u00e2yette bulunulmas\u0131 durumunda ba\u015fvurucunun a\u00e7\u0131k ceza infaz kurumuna ayr\u0131l\u0131p ayr\u0131lamayaca\u011f\u0131 hususunun de\u011ferlendirilebilece\u011fine karar vermi\u015ftir. 9\/6\/2021 tarihli karar\u0131n ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Dilek\u00e7e, ceza infaz kurumundan g\u00f6nderilen bilgi ve belgeler birlikte de\u011ferlendirildi\u011finde; her ne kadar h\u00fck\u00fcml\u00fc vekilinin h\u00fck\u00fcml\u00fcn\u00fcn a\u00e7\u0131k ceza infaz kurumuna ayr\u0131lmas\u0131na karar verilmesi y\u00f6n\u00fcndeki talebinin kurum m\u00fcd\u00fcr\u00fc taraf\u0131ndan imza alt\u0131na al\u0131nan bir m\u00fczekkere ile reddine karar verilmi\u015f ise de, yukar\u0131da belirtilen kanun ve y\u00f6netmelik maddelerinden de a\u00e7\u0131k\u00e7a anla\u015f\u0131laca\u011f\u0131 \u00fczere, h\u00fck\u00fcml\u00fcn\u00fcn a\u00e7\u0131k ceza infaz kurumuna ayr\u0131l\u0131p ayr\u0131lamayaca\u011f\u0131 konusunda karar verme yetkisinin ceza infaz kurumu idare ve g\u00f6zlem kuruluna ait oldu\u011funun anla\u015f\u0131lmas\u0131 kar\u015f\u0131s\u0131nda, usul\u00fcne uygun bir \u015fekilde karar al\u0131narak de\u011ferlendirme yap\u0131lmamas\u0131 nedeniyle h\u00fck\u00fcml\u00fc vekilinin \u015fikayetinin kabul\u00fcne, talep konusunda idare ve g\u00f6zlem kurulu karar\u0131 al\u0131nmas\u0131 i\u00e7in dosyan\u0131n ceza infaz kurumuna tevdi edilmesine, usl\u00fcne uygun idare ve g\u00f6zlem karar\u0131 al\u0131nd\u0131ktan sonra bu karara kar\u015f\u0131 \u015fikayette bulunulmas\u0131 durumunda h\u00fck\u00fcml\u00fcn\u00fcn a\u00e7\u0131k ceza infaz kurumuna ayr\u0131l\u0131p ayr\u0131lamayaca\u011f\u0131 hususunun de\u011ferlendirilmesine karar vermek gerekmi\u015ftir.&#8221;<\/p>\n<p>16. Cumhuriyet savc\u0131s\u0131; ba\u015fvurucunun durumu gerekli s\u00fcre \u015fartlar\u0131n\u0131 ta\u015f\u0131mad\u0131\u011f\u0131 i\u00e7in ba\u015fvurucunun a\u00e7\u0131k ceza infaz kurumuna ayr\u0131lma talebinin yerinde olmad\u0131\u011f\u0131 gerek\u00e7esiyle \u0130nfaz H\u00e2kimli\u011fi karar\u0131na 14\/6\/2021 tarihinde itiraz etmi\u015ftir.<\/p>\n<p>17. Ankara Bat\u0131 1. A\u011f\u0131r Ceza Mahkemesi (itiraz mercii) 18\/6\/2021 tarihinde Cumhuriyet savc\u0131s\u0131n\u0131n itiraz\u0131n\u0131n kabul\u00fcne karar vermi\u015ftir. An\u0131lan karar\u0131n ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;T\u00fcm dosya kapsam\u0131 birlikte de\u011ferlendirildi\u011finde; Cumhuriyet Savc\u0131s\u0131 [F.A.] taraf\u0131ndan sunulan itiraz yaz\u0131s\u0131ndaki gerek\u00e7eler yerinde g\u00f6r\u00fclmekle itiraz\u0131n kabul\u00fc ile usul ve yasaya ayk\u0131r\u0131 bulunan Ankara Bat\u0131 1. \u0130nfaz Hakimli\u011fi&#8217;nin 09\/06\/2021 tarih ve 2021\/2275 esas 2021\/2413 karar say\u0131l\u0131 karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131na, H\u00fck\u00fcml\u00fc\/tutuklu \u00d6mer Faruk Gergerlio\u011flu vekili Av. [B.K.ya] itiraz\u0131n\u0131n reddine dair a\u015fa\u011f\u0131daki \u015fekilde karar verilmi\u015ftir.&#8221;<\/p>\n<p>18. Ba\u015fvurucu 24\/6\/2021 tarihinde itirazlar\u0131n\u0131n esastan incelenmedi\u011fi iddias\u0131yla \u0130nfaz H\u00e2kimli\u011fine yeniden ba\u015fvurmu\u015ftur.<\/p>\n<p>19. Ba\u015fvurucunun ceza yarg\u0131lamas\u0131 s\u00fcrecine ili\u015fkin iddialar\u0131n\u0131 de\u011ferlendiren Anayasa Mahkemesi 1\/7\/2021 tarihinde ba\u015fvurucunun ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc ile se\u00e7ilme ve siyasi faaliyette bulunma hakk\u0131n\u0131n ihlal edildi\u011fini tespit etmi\u015ftir (\u00d6mer Faruk Gergerlio\u011flu [GK], B. No: 2019\/10634, 1\/7\/2021). Kararda; ba\u015fvurucu lehine 30.000 TL manevi tazminat \u00f6denmesine ve s\u00f6z konusu ihlallerin giderimi i\u00e7in karar\u0131n bir \u00f6rne\u011finin yeniden yarg\u0131lama i\u015flemlerine ba\u015flanmas\u0131, mahk\u00fbmiyet h\u00fckm\u00fcn\u00fcn infaz\u0131n\u0131n durdurulmas\u0131 ile yeniden yap\u0131lacak yarg\u0131lamada durma karar\u0131 verilmesi \u015feklindeki i\u015flemlerin yerine getirilmesi i\u00e7in Kocaeli 2. A\u011f\u0131r Ceza Mahkemesine g\u00f6nderilmesine karar vermi\u015ftir (\u00d6mer Faruk Gergerlio\u011flu, \u00a7\u00a7 187-204).<\/p>\n<p>20. Anayasa Mahkemesinin an\u0131lan karar\u0131 \u00fczerine Kocaeli 2. A\u011f\u0131r Ceza Mahkemesi 6\/7\/2021 tarihli ek karar ile ba\u015fvurucunun cezas\u0131n\u0131n infaz\u0131n\u0131n durdurulmas\u0131na karar vermi\u015ftir. Ba\u015fvurucu ayn\u0131 g\u00fcn serbest b\u0131rak\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>21. \u0130nfaz H\u00e2kimli\u011fi 24\/6\/2021 tarihli taleple ilgili olarak ba\u015fvurucunun tahliyesine karar verildi\u011fi ve a\u00e7\u0131k ceza infaz kurumuna ayr\u0131lma talebinin konusuz kald\u0131\u011f\u0131 gerek\u00e7esiyle karar vermeye yer olmad\u0131\u011f\u0131na 9\/7\/2021 tarihinde h\u00fckmetmi\u015ftir.<\/p>\n<p>22. Kocaeli 2. A\u011f\u0131r Ceza Mahkemesi taraf\u0131ndan ihlal karar\u0131na uygun olarak 14\/7\/2021 tarihinde, ba\u015fvurucunun yeniden yarg\u0131lanmas\u0131na, kesinle\u015fmi\u015f mahk\u00fbmiyet h\u00fckm\u00fcn\u00fcn b\u00fct\u00fcn sonu\u00e7lar\u0131yla ortadan kald\u0131r\u0131lmas\u0131na ve ba\u015fvurucunun yasama dokunulmazl\u0131\u011f\u0131 kald\u0131r\u0131l\u0131ncaya kadar yarg\u0131laman\u0131n durmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>23. Ba\u015fvurucu, \u0130nfaz H\u00e2kimli\u011finin 9\/7\/2021 tarihli karar\u0131n\u0131 ayn\u0131 tarihte \u00f6\u011frendikten sonra 26\/7\/2021 tarihinde ba\u015fvuruda bulunmu\u015ftur.<\/p>\n<p>IV. \u0130LG\u0130L\u0130 HUKUK<\/p>\n<p>24. 26\/9\/2004 tarihli ve 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu&#8217;nun &#8220;Tan\u0131mlar&#8221; kenar ba\u015fl\u0131kl\u0131 6. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (j) bendi \u015f\u00f6yledir:<\/p>\n<p>&#8220;\u00d6rg\u00fct mensubu su\u00e7lu deyiminden; bir su\u00e7 \u00f6rg\u00fct\u00fcn\u00fc kuran, y\u00f6neten, \u00f6rg\u00fcte kat\u0131lan veya \u00f6rg\u00fct ad\u0131na di\u011ferleriyle birlikte veya tek ba\u015f\u0131na su\u00e7 i\u015fleyen ki\u015fi, anla\u015f\u0131l\u0131r.&#8221;<\/p>\n<p>25. 5237 say\u0131l\u0131 Kanun&#8217;un &#8220;Zaman bak\u0131m\u0131ndan uygulama&#8221; kenar ba\u015fl\u0131kl\u0131 7. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;(1) \u0130\u015flendi\u011fi zaman y\u00fcr\u00fcrl\u00fckte bulunan kanuna g\u00f6re su\u00e7 say\u0131lmayan bir fiilden dolay\u0131 kimseye ceza verilemez ve g\u00fcvenlik tedbiri uygulanamaz. \u0130\u015flendikten sonra y\u00fcr\u00fcrl\u00fc\u011fe giren kanuna g\u00f6re su\u00e7 say\u0131lmayan bir fiilden dolay\u0131 da kimse cezaland\u0131r\u0131lamaz ve hakk\u0131nda g\u00fcvenlik tedbiri uygulanamaz. B\u00f6yle bir ceza veya g\u00fcvenlik tedbiri h\u00fckmolunmu\u015fsa infaz\u0131 ve kanuni neticeleri kendili\u011finden kalkar.<\/p>\n<p>\u00a0(2) Su\u00e7un i\u015flendi\u011fi zaman y\u00fcr\u00fcrl\u00fckte bulunan kanun ile sonradan y\u00fcr\u00fcrl\u00fc\u011fe giren kanunlar\u0131n h\u00fck\u00fcmleri farkl\u0131 ise, failin lehine olan kanun uygulan\u0131r ve infaz olunur.<\/p>\n<p>\u00a0(3) (De\u011fi\u015fik: 29\/6\/2005 \u2013 5377\/2 md.) Hapis cezas\u0131n\u0131n ertelenmesi, ko\u015fullu sal\u0131verilme ve tekerr\u00fcrle ilgili olanlar hari\u00e7; infaz rejimine ili\u015fkin h\u00fck\u00fcmler, derhal uygulan\u0131r.<\/p>\n<p>&#8230;&#8221;<\/p>\n<p>26. 3713 say\u0131l\u0131 Kanun&#8217;un &#8220;Ter\u00f6r su\u00e7lusu&#8221; kenar ba\u015fl\u0131kl\u0131 2. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Birinci maddede belirlenen ama\u00e7lara ula\u015fmak i\u00e7in meydana getirilmi\u015f \u00f6rg\u00fctlerin mensubu olup da, bu ama\u00e7lar do\u011frultusunda di\u011ferleri ile beraber veya tek ba\u015f\u0131na su\u00e7 i\u015fleyen veya ama\u00e7lanan su\u00e7u i\u015flemese dahi \u00f6rg\u00fctlerin mensubu olan ki\u015fi ter\u00f6r su\u00e7lusudur.<\/p>\n<p>Ter\u00f6r \u00f6rg\u00fct\u00fcne mensup olmasa dahi \u00f6rg\u00fct ad\u0131na su\u00e7 i\u015fleyenler de ter\u00f6r su\u00e7lusu say\u0131l\u0131r.&#8221;<\/p>\n<p>27. 3713 say\u0131l\u0131 Kanun&#8217;un &#8220;Ter\u00f6r su\u00e7lar\u0131&#8221; kenar ba\u015fl\u0131kl\u0131 3. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;(De\u011fi\u015fik: 29\/6\/2006-5532\/2 md.) 26\/9\/2004 tarihli ve 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanununun 302, 307, 309, 311, 312, 313, 314, 315 ve 320 nci maddeleri ile 310 uncu maddesinin birinci f\u0131kras\u0131nda yaz\u0131l\u0131 su\u00e7lar, ter\u00f6r su\u00e7lar\u0131d\u0131r.&#8221;<\/p>\n<p>28. 3713 say\u0131l\u0131 Kanun&#8217;un &#8220;Ter\u00f6r amac\u0131 ile i\u015flenen su\u00e7lar&#8221; kenar ba\u015fl\u0131kl\u0131 4. maddesi \u015f\u00f6yledir:<\/p>\n<p>\u00a0\u201c(De\u011fi\u015fik: 29\/6\/2006-5532\/3 md.) A\u015fa\u011f\u0131daki su\u00e7lar 1 inci maddede belirtilen ama\u00e7lar do\u011frultusunda su\u00e7 i\u015flemek \u00fczere kurulmu\u015f bir ter\u00f6r \u00f6rg\u00fct\u00fcn\u00fcn faaliyeti \u00e7er\u00e7evesinde i\u015flendi\u011fi takdirde, ter\u00f6r su\u00e7u say\u0131l\u0131r:<\/p>\n<p>a) T\u00fcrk Ceza Kanununun 79, 80, 81, 82, 84, 86, 87, 96, 106, 107, 108, 109, 112, 113, 114, 115, 116, 117, 118, 142, 148, 149, 151, 152, 170, 172, 173, 174, 185, 188, 199, 200, 202, 204, 210, 213, 214, 215, 223, 224, 243, 244, 265, 294, 300, 316, 317, 318 ve 319 uncu maddeleri ile 310 uncu maddesinin ikinci f\u0131kras\u0131nda yer alan su\u00e7lar. <\/p>\n<p>b) 10\/7\/1953 tarihli ve 6136 say\u0131l\u0131 Ate\u015fli Silahlar ve B\u0131\u00e7aklar ile Di\u011fer Aletler Hakk\u0131nda Kanunda tan\u0131mlanan su\u00e7lar.<\/p>\n<p>c) 31\/8\/1956 tarihli ve 6831 say\u0131l\u0131 Orman Kanununun 110 uncu maddesinin d\u00f6rd\u00fcnc\u00fc ve be\u015finci f\u0131kralar\u0131nda tan\u0131mlanan kasten orman yakma su\u00e7lar\u0131.<\/p>\n<p>\u00e7) 10\/7\/2003 tarihli ve 4926 say\u0131l\u0131 Ka\u00e7ak\u00e7\u0131l\u0131kla M\u00fccadele Kanununda tan\u0131mlanan ve hapis cezas\u0131n\u0131 gerektiren su\u00e7lar.<\/p>\n<p>d) Anayasan\u0131n 120 nci maddesi gere\u011fince ola\u011fan\u00fcst\u00fc hal ilan edilen b\u00f6lgelerde, ola\u011fan\u00fcst\u00fc halin ilan\u0131na neden olan olaylara ili\u015fkin su\u00e7lar.<\/p>\n<p>e) 21\/7\/1983 tarihli ve 2863 say\u0131l\u0131 K\u00fclt\u00fcr ve Tabiat Varl\u0131klar\u0131n\u0131 Koruma Kanununun 68 inci maddesinde tan\u0131mlanan su\u00e7.\u201d<\/p>\n<p>29. 3713 say\u0131l\u0131 Kanun&#8217;un &#8220;Ter\u00f6r \u00f6rg\u00fctleri&#8221; kenar ba\u015fl\u0131kl\u0131 7. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;(De\u011fi\u015fik ikinci f\u0131kra: 11\/4\/2013-6459\/8 md.) Ter\u00f6r \u00f6rg\u00fct\u00fcn\u00fcn; cebir, \u015fiddet veya tehdit i\u00e7eren y\u00f6ntemlerini me\u015fru g\u00f6sterecek veya \u00f6vecek ya da bu y\u00f6ntemlere ba\u015fvurmay\u0131 te\u015fvik edecek \u015fekilde propagandas\u0131n\u0131 yapan ki\u015fi, bir y\u0131ldan be\u015f y\u0131la kadar hapis cezas\u0131 ile cezaland\u0131r\u0131l\u0131r. Ter\u00f6r \u00f6rg\u00fct\u00fcne \u00fcye olmamakla birlikte \u00f6rg\u00fct ad\u0131na;<\/p>\n<p>a) \u0130kinci f\u0131krada tan\u0131mlanan su\u00e7u,<\/p>\n<p>&#8230;<\/p>\n<p>i\u015fleyenler hakk\u0131nda, 5237 say\u0131l\u0131 Kanunun 314 \u00fcnc\u00fc maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda tan\u0131mlanan su\u00e7tan dolay\u0131 ayr\u0131ca ceza verilmez.&#8221;<\/p>\n<p>30. 5275 say\u0131l\u0131 Kanun&#8217;un &#8220;Kapal\u0131 ceza infaz kurumlar\u0131&#8221; kenar ba\u015fl\u0131kl\u0131 8. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Kapal\u0131 ceza infaz kurumlar\u0131, i\u00e7 ve d\u0131\u015f g\u00fcvenlik g\u00f6revlileri bulunan, firara kar\u015f\u0131 teknik, mekanik, elektronik veya fizik\u00ee engellerle donat\u0131lm\u0131\u015f, oda ve koridor kap\u0131lar\u0131 kapal\u0131 tutulan, ancak mevzuat\u0131n belirtti\u011fi h\u00e2llerde ayn\u0131 oda d\u0131\u015f\u0131ndaki h\u00fck\u00fcml\u00fcler aras\u0131nda ve d\u0131\u015f \u00e7evre ile temas\u0131n olanakl\u0131 bulundu\u011fu, yeterli d\u00fczeyde g\u00fcvenlik sa\u011flanm\u0131\u015f ve h\u00fck\u00fcml\u00fcn\u00fcn gereksinimine g\u00f6re bireysel, grup h\u00e2linde veya toplu olarak iyile\u015ftirme y\u00f6ntemlerinin uygulanabilece\u011fi tesislerdir.&#8221;<\/p>\n<p>31. 5275 say\u0131l\u0131 Kanun&#8217;un &#8220;Y\u00fcksek g\u00fcvenlikli kapal\u0131 ceza infaz kurumlar\u0131&#8221; kenar ba\u015fl\u0131kl\u0131 9. maddesinin (1) numaral\u0131 f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Y\u00fcksek g\u00fcvenlikli kapal\u0131 ceza infaz kurumlar\u0131, i\u00e7 ve d\u0131\u015f g\u00fcvenlik g\u00f6revlilerine sahip, firara kar\u015f\u0131 teknik, mekanik, elektronik ve fizik\u00ee engellerle donat\u0131lm\u0131\u015f, oda ve koridor kap\u0131lar\u0131 s\u00fcrekli kapal\u0131 tutulan, ancak mevzuat\u0131n belirtti\u011fi h\u00e2llerde ayn\u0131 oda d\u0131\u015f\u0131ndaki h\u00fck\u00fcml\u00fcler aras\u0131nda ve d\u0131\u015f \u00e7evre ile temaslar\u0131n ge\u00e7erli oldu\u011fu s\u0131k\u0131 g\u00fcvenlik rejimine t\u00e2bi h\u00fck\u00fcml\u00fclerin bir veya \u00fc\u00e7 ki\u015filik odalarda bar\u0131nd\u0131r\u0131ld\u0131klar\u0131 tesislerdir. Bu kurumlarda bireysel veya grup h\u00e2linde iyile\u015ftirme y\u00f6ntemleri uygulan\u0131r.&#8221;<\/p>\n<p>32. 5275 say\u0131l\u0131 Kanun&#8217;un &#8220;A\u00e7\u0131k ceza infaz kurumlar\u0131&#8221; kenar ba\u015fl\u0131kl\u0131 14. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;(1) A\u00e7\u0131k ceza infaz kurumlar\u0131, h\u00fck\u00fcml\u00fclerin iyile\u015ftirilmelerinde, \u00e7al\u0131\u015ft\u0131r\u0131lmalar\u0131 ve meslek edindirilmelerine \u00f6ncelik verilen, firara kar\u015f\u0131 engelleri ve d\u0131\u015f g\u00fcvenlik g\u00f6revlisi bulunmayan, g\u00fcvenlik bak\u0131m\u0131ndan kurum g\u00f6revlilerinin g\u00f6zetim ve denetimi ile yetinilen kurumlard\u0131r. &#8230;<\/p>\n<p>\u00a0(2) (De\u011fi\u015fik:14\/4\/2020-7242\/18 md.) A\u015fa\u011f\u0131daki h\u00e2llerde h\u00fck\u00fcml\u00fcler hakk\u0131nda verilen cezalar do\u011frudan a\u00e7\u0131k ceza infaz kurumlar\u0131nda yerine getirilir:<\/p>\n<p>a) Ter\u00f6r su\u00e7lar\u0131, \u00f6rg\u00fct kurmak, y\u00f6netmek veya \u00f6rg\u00fcte \u00fcye olmak su\u00e7lar\u0131 ile \u00f6rg\u00fct faaliyeti kapsam\u0131nda i\u015flenen su\u00e7lar ve cinsel dokunulmazl\u0131\u011fa kar\u015f\u0131 i\u015flenen su\u00e7lardan mahk\u00fbm olanlar ile ikinci defa m\u00fckerrir olanlar ve ko\u015fullu sal\u0131verilme karar\u0131n\u0131n geri al\u0131nmas\u0131 nedeniyle cezas\u0131 aynen infaz edilenler hari\u00e7 olmak \u00fczere, kas\u0131tl\u0131 su\u00e7lardan toplam \u00fc\u00e7 y\u0131l veya daha az hapis cezas\u0131na mahk\u00fbm olanlar.<\/p>\n<p>&#8230;<\/p>\n<p>\u00a0(3) (De\u011fi\u015fik:14\/4\/2020-7242\/18 md.) H\u00fck\u00fcml\u00fclerin kapal\u0131 ceza infaz kurumundan a\u00e7\u0131k ceza infaz kurumuna ayr\u0131lmalar\u0131na 89 uncu madde uyar\u0131nca yap\u0131lan de\u011ferlendirme sonucunda karar verilir.&#8221;<\/p>\n<p>33. 5275 say\u0131l\u0131 Kanun&#8217;un ge\u00e7ici 9. maddesinin (5) ve (6) numaral\u0131 f\u0131kralar\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;(5) Covid-19 salg\u0131n hastal\u0131\u011f\u0131n\u0131n \u00fclkemizde g\u00f6r\u00fclm\u00fc\u015f olmas\u0131 sebebiyle, a\u00e7\u0131k ceza infaz kurumlar\u0131nda bulunanlar ile kapal\u0131 ceza infaz kurumunda bulunup da a\u00e7\u0131k ceza infaz kurumlar\u0131na ayr\u0131lmaya hak kazanan h\u00fck\u00fcml\u00fcler, 105\/A maddesi kapsam\u0131nda denetimli serbestlik tedbiri uygulanarak cezas\u0131n\u0131n infaz\u0131na karar verilen h\u00fck\u00fcml\u00fcler ve 106 nc\u0131 madde veya di\u011fer kanunlar uyar\u0131nca denetimli serbestlik tedbirinden yararlanan h\u00fck\u00fcml\u00fcler, 31\/5\/2020 tarihine kadar izinli say\u0131l\u0131r. Salg\u0131n\u0131n devam etmesi h\u00e2linde bu s\u00fcre, Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131n\u0131n \u00f6nerisi \u00fczerine Adalet Bakanl\u0131\u011f\u0131 taraf\u0131ndan her defas\u0131nda iki ay\u0131 ge\u00e7memek \u00fczere ondokuz kez uzat\u0131labilir. Bu f\u0131kra uyar\u0131nca izinli say\u0131lanlar hakk\u0131nda 95 ve 97 nci madde h\u00fck\u00fcmleri uygulan\u0131r.<\/p>\n<p>\u00a0(6) T\u00fcrk Ceza Kanununun \u0130kinci Kitap D\u00f6rd\u00fcnc\u00fc K\u0131s\u0131m D\u00f6rd\u00fcnc\u00fc, Be\u015finci, Alt\u0131nc\u0131 ve Yedinci B\u00f6l\u00fcm\u00fcnde tan\u0131mlanan su\u00e7lar, Ter\u00f6rle M\u00fccadele Kanunu kapsam\u0131na giren su\u00e7lar ve \u00f6rg\u00fct faaliyeti kapsam\u0131nda i\u015flenen su\u00e7lar hari\u00e7 olmak \u00fczere, toplam hapis cezas\u0131 on y\u0131ldan az olanlar bir ay\u0131n\u0131, on y\u0131l ve daha fazla olanlar ise \u00fc\u00e7 ay\u0131n\u0131 kapal\u0131 ceza infaz kurumunda ge\u00e7irmi\u015f olan iyi h\u00e2lli h\u00fck\u00fcml\u00fclerden ilgili mevzuat uyar\u0131nca a\u00e7\u0131k ceza infaz kurumlar\u0131na ayr\u0131lmalar\u0131na bir y\u0131l veya daha az s\u00fcre kalanlar, talepleri h\u00e2linde a\u00e7\u0131k ceza infaz kurumlar\u0131na g\u00f6nderilebilirler. Bu h\u00fck\u00fcml\u00fcler, a\u00e7\u0131k ceza infaz kurumlar\u0131nda bar\u0131nd\u0131r\u0131l\u0131r. \u0130lgili mevzuat uyar\u0131nca a\u00e7\u0131k ceza infaz kurumlar\u0131na ayr\u0131lmaya, be\u015finci f\u0131krada belirtilen s\u00fcreler i\u00e7inde hak kazand\u0131klar\u0131 takdirde be\u015finci f\u0131kra uyar\u0131nca izinli say\u0131l\u0131rlar. Be\u015finci f\u0131krada belirtilen s\u00fcrenin tamamlanmas\u0131ndan sonra ise a\u00e7\u0131k ceza infaz kurumlar\u0131na ayr\u0131lmaya hak kazan\u0131p kazanmad\u0131klar\u0131na bak\u0131lmaks\u0131z\u0131n, 95 inci maddede d\u00fczenlenen izin hakk\u0131ndan yararlan\u0131rlar. Bu f\u0131kra h\u00fckm\u00fc 31\/7\/2023 tarihine kadar uygulan\u0131r.&#8221;<\/p>\n<p>34. 2\/9\/2012 tarihli ve 28399 say\u0131l\u0131 Resm\u00ee Gazete&#8217;de yay\u0131mlanan A\u00e7\u0131k Ceza \u0130nfaz Kurumlar\u0131na Ayr\u0131lma Y\u00f6netmeli\u011fi&#8217;nin (Y\u00f6netmelik) &#8220;Do\u011frudan a\u00e7\u0131k kuruma al\u0131nacak h\u00fck\u00fcml\u00fcler&#8221; kenar ba\u015fl\u0131kl\u0131 5. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;(1) Ter\u00f6r su\u00e7lar\u0131, \u00f6rg\u00fct faaliyeti kapsam\u0131nda i\u015flenen su\u00e7lar ile cinsel dokunulmazl\u0131\u011fa kar\u015f\u0131 i\u015flenen su\u00e7lar hari\u00e7 olmak \u00fczere;<\/p>\n<p>a) Kas\u0131tl\u0131 su\u00e7lardan toplam \u00fc\u00e7 y\u0131l veya daha az s\u00fcreyle hapis cezas\u0131na mahk\u00fbm olanlar\u0131n,<\/p>\n<p>b) Taksirli su\u00e7lardan toplam be\u015f y\u0131l veya daha az s\u00fcreyle hapis cezas\u0131na mahk\u00fbm olanlar\u0131n,<\/p>\n<p>c) Adl\u00ee para cezas\u0131 hapis cezas\u0131na \u00e7evrilenlerin,<\/p>\n<p>\u00e7) 9\/6\/1932 tarihli ve 2004 say\u0131l\u0131 \u0130cra ve \u0130flas Kanunu gere\u011fince tazyik hapsine tabi tutulanlar\u0131n, cezalar\u0131 do\u011frudan a\u00e7\u0131k kurumlarda yerine getirilir.&#8221;<\/p>\n<p>35. Y\u00f6netmelik&#8217;in &#8220;Kapal\u0131 kurumdan a\u00e7\u0131k kuruma ayr\u0131lacak h\u00fck\u00fcml\u00fcler&#8221; kenar ba\u015fl\u0131kl\u0131 6. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;(1) H\u00fck\u00fcml\u00fclerden;<\/p>\n<p>&#8230;<\/p>\n<p>c) Cezalar\u0131 y\u00fcksek g\u00fcvenlikli kapal\u0131 kurumlar veya di\u011fer kapal\u0131 kurumlar\u0131n y\u00fcksek g\u00fcvenlikli b\u00f6l\u00fcmlerinde infaz edilenlerden toplam cezalar\u0131n\u0131n \u00fc\u00e7te birini bu kurumlarda iyi h\u00e2lli olarak ge\u00e7iren ve ko\u015fullu sal\u0131verilme tarihine \u00fc\u00e7 y\u0131l veya daha az s\u00fcre kalanlar, a\u00e7\u0131k kurumlara ayr\u0131labilir.<\/p>\n<p>\u00a0(2) A\u00e7\u0131k kurumlara ayr\u0131labilmek i\u00e7in, ayr\u0131ca;<\/p>\n<p>&#8230;<\/p>\n<p>\u00e7) Ter\u00f6r ve \u00f6rg\u00fctl\u00fc su\u00e7lardan h\u00fck\u00fcml\u00fc olup, mensup olduklar\u0131 \u00f6rg\u00fctten ayr\u0131ld\u0131klar\u0131 idare ve g\u00f6zlem kurulu karar\u0131yla tespit edilenlerin ko\u015fullu sal\u0131verilme tarihine bir y\u0131ldan az s\u00fcre kalmas\u0131, \u015fart\u0131 aran\u0131r.&#8221;<\/p>\n<p>V. \u0130NCELEME VE GEREK\u00c7E<\/p>\n<p>36. Anayasa Mahkemesinin 20\/11\/2024 tarihinde yapm\u0131\u015f oldu\u011fu toplant\u0131da ba\u015fvuru incelenip gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. Ki\u015fi H\u00fcrriyeti ve G\u00fcvenli\u011fi Hakk\u0131n\u0131n \u0130hlal Edildi\u011fine \u0130li\u015fkin \u0130ddia<\/p>\n<p>1. Ba\u015fvurucunun \u0130ddialar\u0131 ve Bakanl\u0131k G\u00f6r\u00fc\u015f\u00fc<\/p>\n<p>37. Ba\u015fvurucu, ba\u015fvuru formunda \u00f6zetle;<\/p>\n<p>i. Baz\u0131 istisnalar d\u0131\u015f\u0131nda kas\u0131tl\u0131 su\u00e7lardan toplam \u00fc\u00e7 y\u0131l veya daha az hapis cezas\u0131na mahk\u00fbm olan h\u00fck\u00fcml\u00fclerin cezalar\u0131n\u0131n do\u011frudan a\u00e7\u0131k ceza infaz kurumlar\u0131nda yerine getirilmesinin 5275 say\u0131l\u0131 Kanun&#8217;un 14. maddesinin (2) numaral\u0131 f\u0131kras\u0131 ile ilgili Y\u00f6netmelik&#8217;in 5. maddesinin gere\u011fi oldu\u011funu,<\/p>\n<p>ii. Mahk\u00fbmiyetine esas al\u0131nan ve 3713 say\u0131l\u0131 Kanun&#8217;un 7. maddesinin (2) numaral\u0131 f\u0131kras\u0131nda d\u00fczenlenen ter\u00f6r \u00f6rg\u00fct\u00fcn\u00fcn propagandas\u0131n\u0131 yapma su\u00e7unun do\u011frudan a\u00e7\u0131k ceza infaz kurumlarda yerine getirilecek cezalar\u0131n istisnas\u0131 olan ter\u00f6r su\u00e7lar\u0131, \u00f6rg\u00fct kurmak, y\u00f6netmek veya \u00f6rg\u00fcte \u00fcye olmak su\u00e7lar\u0131 ile \u00f6rg\u00fct faaliyeti kapsam\u0131nda i\u015flenen su\u00e7lardan olmad\u0131\u011f\u0131n\u0131,<\/p>\n<p>iii. Ter\u00f6r su\u00e7lusu kavram\u0131n\u0131n d\u00fczenlendi\u011fi 3713 say\u0131l\u0131 Kanun&#8217;un 2. maddesi uyar\u0131nca \u00f6rg\u00fct \u00fcyeli\u011fi su\u00e7u ya da 5237 say\u0131l\u0131 Kanun&#8217;un 220. maddesinin (6), (7) veya (8) numaral\u0131 f\u0131kralar\u0131nda d\u00fczenlenen su\u00e7lar\u0131 i\u015flemeyen ki\u015finin salt ter\u00f6r \u00f6rg\u00fct\u00fcn\u00fcn propagandas\u0131n\u0131 yapma su\u00e7una istinaden ter\u00f6r su\u00e7lusu oldu\u011funun kabul edilemeyece\u011fini, bir ki\u015finin hem propaganda su\u00e7undan hem de \u00f6rg\u00fcte \u00fcye olmamakla birlikte \u00f6rg\u00fct ad\u0131na su\u00e7 i\u015fleme su\u00e7undan cezaland\u0131r\u0131lmas\u0131n\u0131n kanun gere\u011fi m\u00fcmk\u00fcn olmamas\u0131 kar\u015f\u0131s\u0131nda propaganda yoluyla \u00f6rg\u00fct \u00fcyesi olmamakla \u00f6rg\u00fct ad\u0131na su\u00e7 i\u015fleme ihtimalinin de bulunmad\u0131\u011f\u0131n\u0131,<\/p>\n<p>iv. 3713 say\u0131l\u0131 Kanun&#8217;un ter\u00f6r su\u00e7lar\u0131n\u0131 d\u00fczenleyen 3. maddesi ile belirli ko\u015fullarda ter\u00f6r su\u00e7u say\u0131labilecek su\u00e7lar\u0131n tahdid\u00ee olarak say\u0131ld\u0131\u011f\u0131 4. maddesinde de ter\u00f6r \u00f6rg\u00fct\u00fcn\u00fcn propagandas\u0131n\u0131 yapma su\u00e7una yer verilmedi\u011fini, bu nedenle an\u0131lan su\u00e7un ter\u00f6r su\u00e7u olarak kabul\u00fcn\u00fcn m\u00fcmk\u00fcn olmad\u0131\u011f\u0131n\u0131,<\/p>\n<p>v. Kendisinin ter\u00f6r su\u00e7lusu, mahk\u00fbmiyetine esas al\u0131nan su\u00e7un da ter\u00f6r su\u00e7u olmamas\u0131 nedeniyle cezas\u0131n\u0131n do\u011frudan a\u00e7\u0131k ceza infaz kurumunda yerine getirilmesi ve 5275 say\u0131l\u0131 Kanun&#8217;un ge\u00e7ici 9. maddesinin (5) numaral\u0131 f\u0131kras\u0131 uyar\u0131nca izinli say\u0131lmas\u0131 gerekti\u011fi h\u00e2lde bu y\u00f6ndeki talebinin kamu otoritelerinin \u00f6ng\u00f6r\u00fclemez yorumu sonucu reddedildi\u011fini beyan ederek su\u00e7ta ve cezada kanunilik ilkesi ile ki\u015fi \u00f6zg\u00fcrl\u00fc\u011f\u00fc ve g\u00fcvenli\u011fi hakk\u0131n\u0131n ihlal edildi\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr.<\/p>\n<p>38. Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcnde;<\/p>\n<p>i. Anayasa Mahkemesinin 1\/7\/2021 tarihli ihlal karar\u0131 \u00fczerine tahliye olmas\u0131 nedeniyle ba\u015fvurucunun ma\u011fduriyetinin giderildi\u011fi belirtilerek an\u0131lan karar ile somut ba\u015fvurunun ayn\u0131 konuya ili\u015fkin olup olmad\u0131\u011f\u0131n\u0131n \u00f6ncelikle de\u011ferlendirilmesi gerekti\u011fi,<\/p>\n<p>ii. An\u0131lan \u015fik\u00e2yetle ilgili olarak 4\/12\/2004 tarihli ve 5271 say\u0131l\u0131 Ceza Muhakemesi Kanunu&#8217;nun 141. ve devam\u0131 maddeleri uyar\u0131nca a\u00e7\u0131lmas\u0131 gereken bir tazminat davas\u0131 a\u00e7\u0131lmad\u0131\u011f\u0131ndan s\u00f6z konusu iddia bak\u0131m\u0131ndan ola\u011fan ba\u015fvuru yollar\u0131 t\u00fcketilmeden bireysel ba\u015fvuru yap\u0131ld\u0131\u011f\u0131,<\/p>\n<p>iii. Ba\u015fvurucunun iddialar\u0131n\u0131n kanun yolu \u015fik\u00e2yeti niteli\u011finde olup olmad\u0131\u011f\u0131n\u0131n de\u011ferlendirilmesi gerekti\u011fi,<\/p>\n<p>iv. Anayasa Mahkemesinin 17\/7\/2020 tarihinde 14\/4\/2020 tarihli ve 7242 say\u0131l\u0131 Kanun&#8217;un baz\u0131 maddelerine ili\u015fkin somut norm denetimi kapsam\u0131nda verdi\u011fi kararda a\u00e7\u0131klad\u0131\u011f\u0131 \u00fczere su\u00e7 ve cezan\u0131n kapsam\u0131na y\u00f6nelik olmayan, sadece cezan\u0131n infaz \u015fekline ili\u015fkin olan d\u00fczenlemelerin s\u00f6z konusu oldu\u011fu somut olayda incelemenin su\u00e7ta ve cezada kanunilik ilkesi kapsam\u0131nda yap\u0131lmamas\u0131 gerekti\u011fi,<\/p>\n<p>v. Ancak an\u0131lan ilke kapsam\u0131nda bir inceleme yap\u0131lmas\u0131 h\u00e2linde Anayasa ve mevzuat h\u00fck\u00fcmleri do\u011frultusunda somut olay\u0131n kendine \u00f6zg\u00fc ko\u015fullar\u0131n\u0131n g\u00f6z\u00f6n\u00fcne al\u0131nmas\u0131 gerekti\u011fi,<\/p>\n<p>vi. Ba\u015fvurucunun taleplerinin ilgili mevzuat h\u00fck\u00fcmleri g\u00f6zetilerek de\u011ferlendirildi\u011fi ve infaz\u0131n kapsam\u0131 belirlenirken herhangi bir keyf\u00eeli\u011fe mahal vermeyecek \u015fekilde hareket edildi\u011fi belirtilmi\u015ftir.<\/p>\n<p>39. Ba\u015fvurucu, Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 beyan\u0131nda hakk\u0131nda daha \u00f6nce verilen ihlal karar\u0131na konu ba\u015fvurular ile somut ba\u015fvurunun konusunun farkl\u0131 oldu\u011funu, haks\u0131z \u015fekilde \u00f6zg\u00fcrl\u00fc\u011f\u00fcnden mahrum b\u0131rak\u0131lmas\u0131na ili\u015fkin ihlal tespiti yap\u0131lan herhangi bir karar bulunmad\u0131\u011f\u0131 gibi telafi edici bir giderimin de s\u00f6z konusu olmad\u0131\u011f\u0131n\u0131 ifade etmi\u015ftir. Ba\u015fvurucu 5271 say\u0131l\u0131 Kanun&#8217;un hukuka ayk\u0131r\u0131 infaz uygulamalar\u0131 nedeniyle \u00f6zg\u00fcrl\u00fcklerinden mahrum kalan ki\u015filere tazminat talep hakk\u0131 vermemesi nedeniyle bu yola ba\u015fvurulmad\u0131\u011f\u0131n\u0131 beyan ederek ba\u015fvuru formundaki iddialar\u0131n\u0131 tekrarlam\u0131\u015ft\u0131r.<\/p>\n<p>2. De\u011ferlendirme<\/p>\n<p>40. Anayasa&#8217;n\u0131n &#8220;Ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fi&#8221; kenar ba\u015fl\u0131kl\u0131 19. maddesinin ilgili b\u00f6l\u00fcm\u00fc \u015f\u00f6yledir:<\/p>\n<p>&#8220;Herkes, ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fine sahiptir.<\/p>\n<p>\u015eekil ve \u015fartlar\u0131 kanunda g\u00f6sterilen:<\/p>\n<p>Mahkemelerce verilmi\u015f h\u00fcrriyeti k\u0131s\u0131tlay\u0131c\u0131 cezalar\u0131n ve g\u00fcvenlik tedbirlerinin yerine getirilmesi; &#8230; halleri d\u0131\u015f\u0131nda kimse h\u00fcrriyetinden yoksun b\u0131rak\u0131lamaz.&#8221;<\/p>\n<p>41. Somut olayda \u00f6ncelikle mahk\u00fbmiyet karar\u0131 sonras\u0131nda verilen cezan\u0131n infaz\u0131nda Anayasa\u2019n\u0131n 38. maddesinin \u00f6ng\u00f6rd\u00fc\u011f\u00fc ilkelerin uygulan\u0131p uygulanmayaca\u011f\u0131 hususu belirlenmelidir.<\/p>\n<p>42. Anayasa&#8217;n\u0131n 38. maddesinin birinci f\u0131kras\u0131nda belirtilen &#8220;ceza&#8221; kavram\u0131 \u00f6zerk bir kavramd\u0131r. Bu ba\u011flamda Anayasa&#8217;n\u0131n 38. maddesinde g\u00fcvence alt\u0131na al\u0131nan ilkeyi etkin korumak i\u00e7in bir tedbirin \u00f6z\u00fc itibar\u0131yla bir ceza olu\u015fturup olu\u015fturmayaca\u011f\u0131 konusunda yarg\u0131 makamlar\u0131n\u0131n yorumlar\u0131na ve mevzuattaki nitelendirmelere ba\u011fl\u0131 kal\u0131nmadan de\u011ferlendirme yap\u0131labilecektir (Yunis Karata\u015f [GK], B. No: 2021\/34231, 26\/1\/2023, \u00a7 43).<\/p>\n<p>43. \u00d6te yandan ceza kabul edilen bir tedbir ile cezan\u0131n infaz\u0131 veya uygulanmas\u0131n\u0131 ilgilendiren bir tedbir aras\u0131nda ayr\u0131m yap\u0131lmal\u0131d\u0131r. Bu \u00e7er\u00e7evede tedbirin niteli\u011fi ve amac\u0131n\u0131n cezan\u0131n indirilmesi veya erken tahliyeye ili\u015fkin bir de\u011fi\u015fiklikle ilgili oldu\u011funda bu tedbir kural olarak Anayasa&#8217;n\u0131n 38. maddesi anlam\u0131nda ceza olarak kabul edilemeyebilecektir. Anayasa&#8217;n\u0131n 38. maddesi cezan\u0131n infaz\u0131n\u0131n \u015fekliyle de\u011fil kendisiyle, di\u011fer bir ifadeyle cezan\u0131n kendisinin etkilenip etkilenmedi\u011fiyle ilgilenir. Ancak fiiliyatta ceza te\u015fkil eden bir tedbir ile cezan\u0131n infaz\u0131n\u0131 ilgilendiren bir tedbir aras\u0131ndaki ayr\u0131m her zaman net olmayabilecektir. Bunun sonucu olarak da cezaya h\u00fckmedildikten sonra veya ceza infaz edilirken idari yetkililer ve mahkemeler taraf\u0131ndan yap\u0131lacak uygulamalar\u0131n cezay\u0131 veren mahkemenin \u00f6ng\u00f6rd\u00fc\u011f\u00fc, kapsam\u0131n\u0131 belirledi\u011fi cezan\u0131n farkl\u0131 tan\u0131mlanmas\u0131na veya de\u011fi\u015ftirilmesine yol a\u00e7abilece\u011fi ihtimali g\u00f6zard\u0131 edilmemelidir. Aksi takdirde idari yetkililer veya mahkemelerin verilen cezan\u0131n kapsam\u0131n\u0131 ge\u00e7mi\u015fe d\u00f6n\u00fck olarak, mahk\u00fbm edilen ki\u015finin su\u00e7u i\u015fledi\u011fi veya cezaya \u00e7arpt\u0131r\u0131ld\u0131\u011f\u0131 zamanda b\u00f6yle bir geli\u015fmeyi \u00f6ng\u00f6remeyecek ve zarar\u0131na olacak \u015fekilde yeniden tan\u0131mlayan tedbirler alabilece\u011fi kabul edilecektir (benzer y\u00f6ndeki bir karar i\u00e7in bkz. Efendi Yald\u0131z, B. No: 2013\/1202, 25\/3\/2015, \u00a7 36; Yunis Karata\u015f, \u00a7 44).<\/p>\n<p>44. Bir tedbirin maddi ceza hukukuna m\u0131 yoksa infaz hukukuna m\u0131 d\u00e2hil oldu\u011fu tespit edilirken tedbirin \u015fekl\u00ee olarak hangi alana girdi\u011finden ziyade niteli\u011fine bak\u0131larak karar verilmelidir. Bu \u00e7er\u00e7evede bir tedbir, san\u0131\u011fa verilecek cezayla ilgili bir konu hakk\u0131nda ise ve ceza verme d\u00fc\u015f\u00fcncesi i\u00e7inde kabul ediliyorsa tedbirin maddi ceza hukuku alan\u0131nda oldu\u011funun kabul edilmesi gerekir. Dolay\u0131s\u0131yla h\u00fck\u00fcml\u00fc hakk\u0131nda uygulanan tedbirin bir su\u00e7tan kaynaklanan bir mahk\u00fbmiyetin sonucu olup olmad\u0131\u011f\u0131, tedbirin niteli\u011fi, amac\u0131, mahkemeler ve yetkili idari makamlar a\u00e7\u0131s\u0131ndan nas\u0131l kabul edildi\u011fi, tedbirin al\u0131nmas\u0131nda ve uygulamas\u0131ndaki usullerin ve tedbirin a\u011f\u0131rl\u0131\u011f\u0131 de\u011ferlendirilerek Anayasa\u2019n\u0131n 38. maddesinin g\u00fcvencesi alt\u0131nda olup olmad\u0131\u011f\u0131 tespit edilmelidir. Bir h\u00fckm\u00fcn infaz\u0131 s\u0131ras\u0131nda al\u0131nan bir tedbirin sadece h\u00fckm\u00fcn infaz\u0131n\u0131n \u015fekline ili\u015fkin olup olmad\u0131\u011f\u0131n\u0131n veya aksine h\u00fckm\u00fcn kapsam\u0131n\u0131 etkileyip etkilemedi\u011finin belirlenmesi i\u00e7in h\u00fckmedilen cezan\u0131n ilgili zamanda y\u00fcr\u00fcrl\u00fckte olan i\u00e7 hukuka g\u00f6re asl\u0131nda neyi gerektirdi\u011fi, di\u011fer bir ifadeyle onun as\u0131l do\u011fas\u0131n\u0131n ne oldu\u011funun incelenmesi gerekir. Bu ba\u011flamda Yarg\u0131tay Ceza Genel Kurulunun 18\/11\/1985 tarihli ve E.1985\/268, K.1985\/361 say\u0131l\u0131 karar\u0131nda \u201c\u2026cezalar\u0131n yerine getirilmesine ili\u015fkin rejimleri de\u011fi\u015ftiren yasalar\u0131n derhal uygulanmas\u0131 gerekmekte ise de, de\u011fi\u015fikli\u011fi yapan yasalar\u0131n, cezalar\u0131n niteli\u011fini de\u011fi\u015ftirmemesi gerekir. Cezan\u0131n yerine getirilmesine ili\u015fkin yasadaki de\u011fi\u015fiklik, mahk\u00fbmiyet s\u00fcresini uzat\u0131yorsa veya h\u00fck\u00fcml\u00fcye y\u00fcklenen y\u00fck\u00fc art\u0131r\u0131yorsa, bu hal cezan\u0131n niteli\u011fini de\u011fi\u015ftirdi\u011finden derhal uygulanamaz.\u201d (benzer y\u00f6ndeki bir karar i\u00e7in bkz. Yarg\u0131tay 6. Ceza Dairesinin 5\/7\/1973 tarihli ve E.1973\/6567, K.1973\/6535 say\u0131l\u0131 karar\u0131) denilerek bir tedbirin infaz hukukuna ili\u015fkin olmas\u0131n\u0131n tek ba\u015f\u0131na derh\u00e2l uygulanmas\u0131 i\u00e7in yeterli olmad\u0131\u011f\u0131, aksine mahk\u00fbmiyet s\u00fcresini uzat\u0131p uzatmad\u0131\u011f\u0131 hususu g\u00f6zetilerek karar verilmesi gerekti\u011fi sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r (Efendi Yald\u0131z, \u00a7 40; Yunis Karata\u015f, \u00a7 44).<\/p>\n<p>45. Ba\u015fvurucunun \u015fik\u00e2yeti \u00f6zetle 5275 say\u0131l\u0131 Kanun&#8217;un 14. maddesinin (2) numaral\u0131 f\u0131kras\u0131 gere\u011fince hapis cezas\u0131n\u0131n do\u011frudan a\u00e7\u0131k ceza infaz kurumunda yerine getirilmesi ve 5275 say\u0131l\u0131 Kanun&#8217;un ge\u00e7ici 9. maddesinin (5) numaral\u0131 f\u0131kras\u0131 uyar\u0131nca COVID-19 salg\u0131n\u0131 kapsam\u0131nda izinli say\u0131lmas\u0131 gerekirken kanun h\u00fck\u00fcmlerinin \u00f6ng\u00f6r\u00fclemez yorumu dolay\u0131s\u0131yla \u00f6zg\u00fcrl\u00fc\u011f\u00fcnden mahrum b\u0131rak\u0131ld\u0131\u011f\u0131na ili\u015fkindir. 5275 say\u0131l\u0131 Kanun&#8217;un ge\u00e7ici 9. maddesinin (5) numaral\u0131 f\u0131kras\u0131 gere\u011fince a\u00e7\u0131k ceza infaz kurumlar\u0131nda bulunanlar ile kapal\u0131 ceza infaz kurumunda bulunup da a\u00e7\u0131k ceza infaz kurumlar\u0131na ayr\u0131lmaya hak kazanan h\u00fck\u00fcml\u00fcler herhangi bir ek ko\u015ful aranmaks\u0131z\u0131n izinli say\u0131lmaktad\u0131r. Dolay\u0131s\u0131yla an\u0131lan h\u00fck\u00fcm uyar\u0131nca izinli say\u0131lma a\u00e7\u0131s\u0131ndan a\u00e7\u0131k ceza infaz kurumunda bulunma veya bu kurumlara ayr\u0131lma hakk\u0131na sahip olman\u0131n belirleyici bir unsur oldu\u011fu anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>46. Somut olaydaki mesele, ba\u015fvurucu hakk\u0131nda verilen s\u00fcreli hapis cezas\u0131n\u0131n a\u00e7\u0131k ceza infaz kurumunda infaz edilip edilemeyece\u011fidir. Bir h\u00fck\u00fcml\u00fcn\u00fcn cezas\u0131n\u0131n a\u00e7\u0131k ceza infaz kurumu yerine kapal\u0131 ceza infaz kurumu veya y\u00fcksek g\u00fcvenlikli kapal\u0131 ceza infaz kurumunda yerine getirilmesi h\u00e2linde h\u00fck\u00fcml\u00fcn\u00fcn daha kat\u0131 bir infaz rejimine tabi tutuldu\u011fu s\u00f6ylenebilir. Ancak cezan\u0131n daha s\u0131k\u0131 ko\u015fullarda yerine getirilmesine ili\u015fkin bu durum, benzer nitelikteki uygulamalar\u0131n ceza olarak kabul\u00fcn\u00fc gerektirmez. Bir h\u00fck\u00fcml\u00fcn\u00fcn cezas\u0131n\u0131n hangi t\u00fcr ceza infaz kurumunda ve ne \u015fekilde yerine getirilece\u011fine ili\u015fkin tedbirler, cezay\u0131 veren mahkemenin \u00f6ng\u00f6rd\u00fc\u011f\u00fc ve kapsam\u0131n\u0131 belirledi\u011fi cezan\u0131n farkl\u0131 tan\u0131mlanmas\u0131na veya de\u011fi\u015ftirilmesine neden olmad\u0131\u011f\u0131ndan ceza olarak kabul edilemez. Bu kapsamdaki uygulamalar cezayla ilgili de\u011fil cezan\u0131n infaz \u015fekliyle ilgilidir.<\/p>\n<p>47. Dolay\u0131s\u0131yla ba\u015fvurucunun an\u0131lan ihlal iddialar\u0131n\u0131 Anayasa&#8217;n\u0131n 38. maddesi kapsam\u0131nda incelemek m\u00fcmk\u00fcn de\u011fildir. Bu nedenle ba\u015fvurucunun \u015fik\u00e2yetlerinin ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fi hakk\u0131 kapsamda incelenmesi uygun g\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>48. Anayasa&#8217;n\u0131n 19. maddesinin birinci f\u0131kras\u0131nda herkesin ki\u015fi \u00f6zg\u00fcrl\u00fc\u011f\u00fc ve g\u00fcvenli\u011fi hakk\u0131na sahip oldu\u011fu ilke olarak konduktan sonra ikinci ve \u00fc\u00e7\u00fcnc\u00fc f\u0131kralar\u0131nda \u015fekil ve \u015fartlar\u0131 kanunda g\u00f6sterilmek kayd\u0131yla ki\u015filerin \u00f6zg\u00fcrl\u00fc\u011f\u00fcnden mahrum b\u0131rak\u0131labilece\u011fi durumlar s\u0131n\u0131rl\u0131 olarak say\u0131lm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla ki\u015finin \u00f6zg\u00fcrl\u00fck ve g\u00fcvenlik hakk\u0131n\u0131n k\u0131s\u0131tlanmas\u0131 ancak Anayasa&#8217;n\u0131n an\u0131lan maddesi kapsam\u0131nda belirlenen durumlardan herhangi birinin varl\u0131\u011f\u0131 h\u00e2linde s\u00f6z konusu olabilir (Murat Narman, B. No: 2012\/1137, 2\/7\/2013, \u00a7 42).<\/p>\n<p>49. Anayasa&#8217;n\u0131n 19. maddesinde tan\u0131mlanan ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fi hakk\u0131n\u0131n ilk istisnas\u0131 &#8220;mahkemelerce verilmi\u015f h\u00fcrriyeti k\u0131s\u0131tlay\u0131c\u0131 cezalar\u0131n ve g\u00fcvenlik tedbirlerinin yerine getirilmesi&#8221; olarak belirlenmi\u015ftir. Bu kapsamda yarg\u0131 organlar\u0131nca verilecek mahk\u00fbmiyet kararlar\u0131n\u0131n sonucu olarak hapis cezas\u0131 veya g\u00fcvenlik tedbirlerinin uygulanmas\u0131 ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fi hakk\u0131n\u0131n ihlali olarak kabul edilmeyecektir. Di\u011fer taraftan su\u00e7 \u015f\u00fcphesine ba\u011fl\u0131 tutma kapsam\u0131nda olan durumdan farkl\u0131 olarak an\u0131lan istisna bir mahk\u00fbmiyet karar\u0131na ba\u011fl\u0131 olarak tutmay\u0131 ifade etmektedir (Tahir Canan (2), B. No: 2013\/839, 5\/11\/2014, \u00a7 33).<\/p>\n<p>50. Bununla birlikte Anayasa\u2019n\u0131n 19. maddesinin ikinci f\u0131kras\u0131 ve Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi\u2019nin (S\u00f6zle\u015fme) 5. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (a) bendi kapsam\u0131na mahkemelerce verilmi\u015f mahk\u00fbmiyet h\u00fckm\u00fcn\u00fcn yerine getirilmesi durumunda ortaya \u00e7\u0131kan \u00f6zg\u00fcrl\u00fckten yoksun b\u0131rakma h\u00e2lleri d\u00e2hil ise de an\u0131lan kurallar, mahk\u00fbmiyet karar\u0131n\u0131n de\u011fil tutman\u0131n hukuka uygun olmas\u0131n\u0131 g\u00fcvence alt\u0131na almaktad\u0131r. Dolay\u0131s\u0131yla bu g\u00fcvence kapsam\u0131nda, ki\u015fi hakk\u0131nda h\u00fckmedilen hapis cezas\u0131n\u0131n yerindeli\u011fi veya orant\u0131l\u0131l\u0131\u011f\u0131 incelemeye tabi tutulamayacakt\u0131r (G\u00fcnay Okan, B. No: 2013\/8114, 17\/9\/2014, \u00a7 18).<\/p>\n<p>51. Bir mahk\u00fbmiyet karar\u0131n\u0131n infaz\u0131na ili\u015fkin olarak Anayasa&#8217;n\u0131n 19. maddesi a\u00e7\u0131k bir h\u00fck\u00fcm i\u00e7ermemektedir. Ancak Anayasa&#8217;n\u0131n 19. maddesinin amac\u0131 ki\u015fileri keyf\u00ee bir \u015fekilde h\u00fcrriyetten yoksun b\u0131rak\u0131lmaya kar\u015f\u0131 korumak olup maddede \u00f6ng\u00f6r\u00fclen istisnai h\u00e2llerde ki\u015fi h\u00fcrriyetine getirilecek s\u0131n\u0131rlamalar\u0131n da maddenin amac\u0131na uygun olmas\u0131 gerekir (Abdullah \u00dcnal, B. No: 2012\/1094, 7\/3\/2014, \u00a7 38). Bir kimsenin mahkemelerce verilmi\u015f h\u00fcrriyeti k\u0131s\u0131tlay\u0131c\u0131 cezalar\u0131n ve g\u00fcvenlik tedbirlerinin yerine getirilmesi kapsam\u0131nda h\u00fcrriyetinden yoksun b\u0131rak\u0131ld\u0131\u011f\u0131n\u0131n s\u00f6ylenebilmesi i\u00e7in her \u015feyden \u00f6nce h\u00fcrriyeti k\u0131s\u0131tlay\u0131c\u0131 ceza veya g\u00fcvenlik tedbirinin bir mahkeme taraf\u0131ndan verilmesi, ikinci olarak yerine getirilecek karar\u0131n h\u00fcrriyeti k\u0131s\u0131tlay\u0131c\u0131 ceza veya g\u00fcvenlik tedbirlerine ili\u015fkin olmas\u0131 gerekir. Ceza veya g\u00fcvenlik tedbiri i\u00e7ermeyen bir karara dayan\u0131larak bir kimsenin h\u00fcrriyetinden yoksun b\u0131rak\u0131lmas\u0131 m\u00fcmk\u00fcn de\u011fildir. Son olarak h\u00fcrriyetten yoksun b\u0131rak\u0131lman\u0131n mahkemece verilen h\u00fcrriyeti k\u0131s\u0131tlay\u0131c\u0131 ceza veya g\u00fcvenlik tedbirinin kapsam\u0131n\u0131 a\u015fmamas\u0131 gerekir (Ercan Bucak (2), B. No: 2014\/11651, 16\/2\/2017, \u00a7 40; \u015eaban Dal, B. No: 2014\/2891, 16\/2\/2017 \u00a7 32; \u00c7.\u00d6. [GK], B. No: 2014\/5927, 19\/7\/2018 \u00a7 33).<\/p>\n<p>52. Somut olayda ba\u015fvurucu, Ceza \u0130nfaz Kurumunda tutuldu\u011fu s\u00fcrenin Mahkemece verilen h\u00fcrriyeti k\u0131s\u0131tlay\u0131c\u0131 cezay\u0131 a\u015ft\u0131\u011f\u0131na ili\u015fkin bir iddia ileri s\u00fcrmemi\u015ftir. Bu nedenle inceleme, ba\u015fvurucu hakk\u0131nda verilen hapis cezas\u0131n\u0131n a\u00e7\u0131k ceza infaz kurumunda yerine getirilmesi talebinin reddine ili\u015fkin yarg\u0131sal s\u00fcre\u00e7le s\u0131n\u0131rl\u0131 olarak yap\u0131lacakt\u0131r.<\/p>\n<p>53. Ba\u015fvurucu, Kocaeli 2. A\u011f\u0131r Ceza Mahkemesi taraf\u0131ndan 3713 say\u0131l\u0131 Kanun&#8217;un 7. maddesinin (2) numaral\u0131 f\u0131kras\u0131nda d\u00fczenlenen ter\u00f6r \u00f6rg\u00fct\u00fcn\u00fcn propagandas\u0131n\u0131 yapma su\u00e7undan 2 y\u0131l 6 ay hapis cezas\u0131na mahk\u00fbm edilmi\u015ftir. Dolay\u0131s\u0131yla ba\u015fvurucunun incelemeye konu s\u00fcre\u00e7te &#8220;mahkemelerce verilmi\u015f h\u00fcrriyeti k\u0131s\u0131tlay\u0131c\u0131 cezalar\u0131n yerine getirilmesi&#8221; kapsam\u0131nda h\u00fcrriyetinden yoksun b\u0131rak\u0131ld\u0131\u011f\u0131 hususunda ku\u015fku bulunmamaktad\u0131r. Somut olay kapsam\u0131nda tespit edilmesi gereken husus, ba\u015fvurucunun cezas\u0131n\u0131n a\u00e7\u0131k ceza infaz kurumu yerine y\u00fcksek g\u00fcvenlikli kapal\u0131 ceza infaz kurumunda \u00e7ektirilmesinin Anayasa&#8217;n\u0131n 19. maddesi kapsam\u0131nda m\u00fcstakil bir h\u00fcrriyetten yoksun b\u0131rakma h\u00e2li olup olmad\u0131\u011f\u0131d\u0131r.<\/p>\n<p>54. 5275 say\u0131l\u0131 Kanun&#8217;un 8. maddesinde kapal\u0131 ceza infaz kurumlar\u0131, 9. Maddesinde y\u00fcksek g\u00fcvenlikli kapal\u0131 ceza infaz kurumlar\u0131, 14. maddesinde ise a\u00e7\u0131k ceza infaz kurumlar\u0131 tan\u0131mlanm\u0131\u015ft\u0131r. Buna g\u00f6re y\u00fcksek g\u00fcvenlikli kapal\u0131 ceza infaz kurumlar\u0131n\u0131n i\u00e7inde ve d\u0131\u015f\u0131nda g\u00fcvenlik g\u00f6revlileri bulunmas\u0131na, bu t\u00fcr kurumlarda firara kar\u015f\u0131 teknik, mekanik, elektronik veya fiziki \u00f6nlemler al\u0131nmas\u0131na, oda ve koridor kap\u0131lar\u0131 s\u00fcrekli kapal\u0131 tutulmas\u0131na ra\u011fmen a\u00e7\u0131k ceza infaz kurumlar\u0131nda h\u00fck\u00fcml\u00fclerin iyile\u015ftirilmeleri i\u00e7in \u00e7al\u0131\u015ft\u0131r\u0131lmalar\u0131na ve meslek edindirilmelerine \u00f6ncelik verilmekte, firara kar\u015f\u0131 engeller ve d\u0131\u015f g\u00fcvenlik g\u00f6revlisi bulunmamakta ve g\u00fcvenlik bak\u0131m\u0131ndan kurum g\u00f6revlilerinin g\u00f6zetim ve denetimi ile yetinilmektedir. Bununla birlikte y\u00fcksek g\u00fcvenlikli kapal\u0131 ceza infaz kurumlar\u0131nda mevzuatta belirtilen h\u00e2llerde ayn\u0131 oda d\u0131\u015f\u0131ndaki h\u00fck\u00fcml\u00fcler aras\u0131nda ve d\u0131\u015f \u00e7evreyle temas kurulmas\u0131na olanak sa\u011flanabilmektedir.<\/p>\n<p>55. \u0130lgili mevzuat uyar\u0131nca h\u00fcrriyetlerinden yoksun b\u0131rak\u0131lan ki\u015filer y\u00f6n\u00fcnden a\u00e7\u0131k ceza infaz kurumlar\u0131nda y\u00fcksek g\u00fcvenlikli kapal\u0131 ceza infaz kurumlar\u0131na g\u00f6re daha geni\u015f imk\u00e2nlar\u0131n bulundu\u011fu ve tutulman\u0131n ko\u015fullar\u0131n\u0131n daha hafif oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Bu kapsamda an\u0131lan ceza infaz kurumlar\u0131nda uygulanan infaz rejimleri aras\u0131nda g\u00fcvenlik tedbirlerine ili\u015fkin \u00f6nemli bir yo\u011funluk fark\u0131 oldu\u011fu g\u00f6r\u00fclmektedir. Bu farkl\u0131l\u0131k, ki\u015finin ceza infaz kurumunda tabi olaca\u011f\u0131 rejim ve ko\u015fullarda bir de\u011fi\u015fiklik yaratmakta ancak h\u00fcrriyetten yoksun b\u0131rakman\u0131n niteli\u011fini de\u011fi\u015ftirecek bir durum olu\u015fturmamaktad\u0131r. Bu nedenle ba\u015fvurucunun hapis cezas\u0131n\u0131n y\u00fcksek g\u00fcvenlikli kapal\u0131 ceza infaz kurumunda yerine getirilmesinin, m\u00fcstakil bir h\u00fcrriyetten yoksun b\u0131rakma h\u00e2li olarak kabul\u00fc m\u00fcmk\u00fcn de\u011fildir. Ayr\u0131ca hapis cezas\u0131n\u0131n hangi t\u00fcr ceza infaz kurumunda yerine getirilece\u011fi meselesinin, bir mahk\u00fbmiyet karar\u0131n\u0131n infaz\u0131na ba\u011fl\u0131 olarak h\u00fcrriyetten yoksun b\u0131rakma h\u00e2linin Anayasa&#8217;n\u0131n 19. maddesinin gerekliliklerine uygunlu\u011fu \u00fczerinde herhangi bir etkisi de bulunmamaktad\u0131r.<\/p>\n<p>56. Anayasa&#8217;n\u0131n 19. maddesinin bir mahk\u00fbmiyet karar\u0131n\u0131n infaz\u0131na ili\u015fkin olarak a\u00e7\u0131k bir h\u00fck\u00fcm i\u00e7ermedi\u011fi ve hapis cezas\u0131n\u0131n infaz \u015fekline ili\u015fkin uygulamalar\u0131n ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fi hakk\u0131n\u0131n kapsam\u0131 d\u0131\u015f\u0131nda oldu\u011fu da g\u00f6z\u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda ba\u015fvurucunun, cezas\u0131n\u0131n a\u00e7\u0131k ceza infaz kurumu yerine y\u00fcksek g\u00fcvenlikli kapal\u0131 ceza infaz kurumunda yerine getirildi\u011fi ve bu nedenle COVID-19 izni kulland\u0131r\u0131lmad\u0131\u011f\u0131 y\u00f6n\u00fcndeki \u015fik\u00e2yetlerinin konu bak\u0131m\u0131ndan yetkisizlik nedeniyle kabul edilemez oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>B. Ba\u015fvurucu; Cumhuriyet savc\u0131s\u0131n\u0131n itiraz\u0131 kendisine bildirilmeden ve savunma imk\u00e2n\u0131 tan\u0131nmadan kesin nitelikte karar verildi\u011fini, dilek\u00e7elerinde \u00f6ne s\u00fcrd\u00fc\u011f\u00fc ve davan\u0131n sonucuna etkili iddialar\u0131n\u0131n \u0130nfaz H\u00e2kimli\u011fi ve itiraz mercii kararlar\u0131nda tart\u0131\u015f\u0131lmad\u0131\u011f\u0131n\u0131 ve yarg\u0131sal s\u00fcre\u00e7 boyunca esasa ili\u015fkin talebinin incelenmedi\u011fini beyan ederek silahlar\u0131n e\u015fitli\u011fi ve \u00e7eli\u015fmeli yarg\u0131lama ilkeleri, gerek\u00e7eli karar hakk\u0131 ve mahkemeye eri\u015fim hakk\u0131n\u0131n ihlal edildi\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr.<\/p>\n<p>58. Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcnde, gerek\u00e7eli karar hakk\u0131n\u0131n ihlal edilip edilmedi\u011fi konusunda yap\u0131lacak incelemede Anayasa ve mevzuat h\u00fck\u00fcmleri do\u011frultusunda somut olay\u0131n kendine \u00f6zg\u00fc ko\u015fullar\u0131n\u0131n g\u00f6z\u00f6n\u00fcne al\u0131nmas\u0131 gerekti\u011fi belirtilmi\u015ftir.<\/p>\n<p>2. De\u011ferlendirme<\/p>\n<p>59. Anayasa Mahkemesi Mustafa Takyan ([GK], B. No: 2020\/27974, 15\/12\/2021) karar\u0131nda mahk\u00fbmiyet karar\u0131 kesinle\u015ftikten sonra a\u00e7\u0131k ceza infaz kurumuna ayr\u0131lma ve denetimli serbestlikten yararlanma \u015fartlar\u0131n\u0131n ta\u015f\u0131n\u0131p ta\u015f\u0131nmad\u0131\u011f\u0131 meselesinin do\u011frudan do\u011fruya cezan\u0131n infaz edilme \u015fekline ili\u015fkin oldu\u011funu, su\u00e7un esas\u0131 ya da cezan\u0131n miktar\u0131 ile herhangi bir ilgisinin olmad\u0131\u011f\u0131n\u0131, dolay\u0131s\u0131yla su\u00e7 isnad\u0131 alt\u0131nda bulunulmad\u0131\u011f\u0131 bir d\u00f6nemi ilgilendiren bu uyu\u015fmazl\u0131\u011f\u0131n adil yarg\u0131lanma hakk\u0131n\u0131n cezai boyutu kapsam\u0131nda kalmad\u0131\u011f\u0131n\u0131 belirtmi\u015ftir.
