Ba\u015fvuru, \u00fcyesi oldu\u011fu sendikan\u0131n ald\u0131\u011f\u0131 karar \u00fczerine n\u00f6bet g\u00f6revlerini yerine getirmeyen kamu g\u00f6revlisinin disiplin cezas\u0131 ile cezaland\u0131r\u0131lmas\u0131 nedeniyle sendika hakk\u0131n\u0131n ihlal edildi\u011fi iddias\u0131na ili\u015fkindir.<\/p>\n<p>2. Ba\u015fvurucu, ba\u015fvuruya konu olaylar\u0131n ya\u015fand\u0131\u011f\u0131 tarihte Batman&#8217;da bir lisede \u00f6\u011fretmen olarak g\u00f6rev yapmaktad\u0131r. Ba\u015fvurucu, E\u011fitim ve Bilim Emek\u00e7ileri Sendikas\u0131 (E\u011e\u0130T\u0130M SEN) \u00fcyesidir.<\/p>\n<p>3. Ba\u015fvuru konusu olay, kamu g\u00f6revlileri sendikalar\u0131n\u0131n \u00fcyesi olan \u00f6\u011fretmenlere n\u00f6bet g\u00f6revi kar\u015f\u0131l\u0131\u011f\u0131nda \u00fccret \u00f6denmesi talepleri etraf\u0131nda \u015fekillenmi\u015ftir. Bu ba\u011flamda ba\u015fvurucunun \u00fcyesi oldu\u011fu E\u011e\u0130T\u0130M SEN de \u00fcyelerinin 2015 y\u0131l\u0131 \u015eubat ay\u0131ndan itibaren kesintisiz olarak n\u00f6bet g\u00f6revini yerine getirmemesi y\u00f6n\u00fcnde bir eylem karar\u0131 alm\u0131\u015ft\u0131r (sendika karar\u0131 ve arka plan bilgisi i\u00e7in bkz. Osman Bayat ve di\u011ferleri [GK], B. No: 2016\/11319, 5\/9\/2024, \u00a7\u00a7 5-10).<\/p>\n<p>4. Ba\u015fvurucu, sendika karar\u0131 do\u011frultusunda 1\/4\/2015 tarihinden 10\/6\/2015 tarihine kadar toplam on iki kez n\u00f6bet g\u00f6revini yerine getirmemi\u015ftir. \u0130dare, s\u00f6z konusu eylemleri nedeniyle ba\u015fvurucu hakk\u0131nda disiplin soru\u015fturmas\u0131 ba\u015flatm\u0131\u015ft\u0131r. Nihayetinde ba\u015fvurucunun 14\/7\/1965 tarihli ve 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanunu&#8217;nun 125. maddesinin birinci f\u0131kras\u0131n\u0131n (A) bendinin (a) alt bendinde yer alan &#8220;verilen emir ve g\u00f6revlerin tam ve zaman\u0131nda yap\u0131lmas\u0131nda, g\u00f6rev mahallinde kurumlarca belirlenen usul ve esaslar\u0131n yerine getirilmesinde, g\u00f6revle ilgili resm\u00ee belge, ara\u00e7 ve gere\u00e7lerin korunmas\u0131, kullan\u0131lmas\u0131 ve bak\u0131m\u0131nda kay\u0131ts\u0131zl\u0131k g\u00f6stermek veya d\u00fczensiz davranmak&#8221; h\u00fckm\u00fc kapsam\u0131nda uyarma cezas\u0131 ile cezaland\u0131r\u0131lmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>5. Ba\u015fvurucu, hakk\u0131nda tesis edilen disiplin cezas\u0131n\u0131n iptali talebiyle idare mahkemesine ba\u015fvurmu\u015ftur. \u0130lk derece mahkemesi, \u00f6ncelikle somut olaya konu sendika karar\u0131n\u0131n uygulanma s\u00fcresinin belirsiz oldu\u011funa ve ba\u015fvurucunun n\u00f6bet tutmama eylemine birden fazla kez kat\u0131larak \u0131srarc\u0131 tav\u0131r tak\u0131nd\u0131\u011f\u0131na dikkat \u00e7ekmi\u015ftir. Bunun yan\u0131nda ba\u015fvurucunun eylemleriyle okuldaki i\u015fleyi\u015fin bozulmas\u0131na sebebiyet verdi\u011fi gibi sorumlu\u011fu alt\u0131ndaki \u00f6\u011frencilerin hayati, bedensel ve ruhsal b\u00fct\u00fcnl\u00fcklerine de zarar verebilecek olaylar\u0131n meydana gelmesine neden olabilece\u011finin alt\u0131n\u0131 \u00e7izmi\u015ftir. Sonu\u00e7 olarak ba\u015fvurucunun g\u00f6rev ve sorumluluklar\u0131ndan olan n\u00f6bet g\u00f6revini iki ay\u0131 a\u015fk\u0131n bir s\u00fcredir yerine getirmemesinin sendikal hakk\u0131n kullan\u0131m\u0131n\u0131 a\u015ft\u0131\u011f\u0131 ve mevzuatla getirilmi\u015f bir g\u00f6revin sendika karar\u0131yla s\u00fcrekli olarak kald\u0131r\u0131lmas\u0131n\u0131n m\u00fcmk\u00fcn olamayaca\u011f\u0131 gerek\u00e7esiyle davan\u0131n reddine karar vermi\u015ftir. S\u00f6z konusu karar istinaf kanun yolunda kesinle\u015fmi\u015ftir.<\/p>\n<p>6. Ba\u015fvurucu, nihai h\u00fckm\u00fc 31\/5\/2016 tarihinde \u00f6\u011frendikten sonra 14\/6\/2016 tarihinde bireysel ba\u015fvuruda bulunmu\u015ftur.<\/p>\n<p>7. Ba\u015fvurunun kabul edilebilirlik ve esas incelemesinin B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>II. DE\u011eERLEND\u0130RME<\/p>\n<p>8. Ba\u015fvurucu, n\u00f6bet g\u00f6revinin asli g\u00f6revi olmad\u0131\u011f\u0131n\u0131, taleplerinin daha sonraki toplu i\u015f s\u00f6zle\u015fmesinde dikkate al\u0131nmas\u0131n\u0131n hakl\u0131l\u0131klar\u0131n\u0131 g\u00f6sterdi\u011fini ve eylemi s\u00fcreli olarak yapt\u0131\u011f\u0131n\u0131 belirtmi\u015f; sendikal faaliyetlerinden dolay\u0131 m\u00fcdahaleye u\u011framas\u0131n\u0131n sendika hakk\u0131n\u0131 ihlal etti\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr.<\/p>\n<p>9. Anayasa Mahkemesi, \u00f6nceki kararlar\u0131nda kamu g\u00f6revlileri sendikalar\u0131n\u0131n faaliyet alanlar\u0131na ili\u015fkin olduk\u00e7a geni\u015f a\u00e7\u0131klamalarda bulunmu\u015ftur (Ahmet Parmaks\u0131z [GK], B. No: 2017\/29263, 22\/5\/2019, \u00a7\u00a7 50,62; Ayfer Altunta\u015f ve \u0130kbal \u00dcnzile G\u00fcrsoy, B. No: 2018\/24874, 31\/3\/2022, \u00a7\u00a7 26,36). Somut olayda ba\u015fvurucunun sendika karar\u0131 kapsam\u0131nda n\u00f6bet g\u00f6revini yerine getirmeyerek an\u0131lan g\u00f6revi kar\u015f\u0131l\u0131\u011f\u0131nda \u00fccret almay\u0131 hedefledi\u011fi g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Buna g\u00f6re an\u0131lan eylem \u00e7a\u011fr\u0131s\u0131n\u0131n kamu g\u00f6revlisinin \u00e7al\u0131\u015fma hayat\u0131yla ve bu ba\u011flamda sendikalar\u0131n \u00e7ekirdek faaliyet alan\u0131yla ilgili oldu\u011fu anla\u015f\u0131ld\u0131\u011f\u0131ndan ba\u015fvurunun sendika hakk\u0131ndan incelenmesi gerekti\u011fi de\u011ferlendirilmi\u015ftir (sendikal haklar\u0131n de\u011ferlendirme usul\u00fc ve mahiyeti i\u00e7in bkz. Ahmet Parmaks\u0131z, \u00a7\u00a7 48-63; Ayfer Altunta\u015f ve \u0130kbal \u00dcnzile G\u00fcrsoy, \u00a7\u00a7 24-34; Nigar H\u00fcrel ve di\u011ferleri, B. No: 2017\/16800, 22\/11\/2022, \u00a7 13).<\/p>\n<p>10. Anayasa Mahkemesi, Osman Bayat ve di\u011ferleri karar\u0131nda somut olayla ayn\u0131 sendika karar\u0131 \u00fczerine n\u00f6bet g\u00f6revini yerine getirmeyen kamu g\u00f6revlisi \u00f6\u011fretmenlere kar\u015f\u0131 ger\u00e7ekle\u015ftirilen disiplin cezas\u0131 \u015feklindeki m\u00fcdahaleleri sendika hakk\u0131 kapsam\u0131nda incelemi\u015ftir. An\u0131lan kararda \u00f6ncelikle konu ba\u011flam\u0131nda benzer bir meselenin ele al\u0131nd\u0131\u011f\u0131 Tayfun Cengiz (B. No: 2013\/8463, 18\/9\/2014) ba\u015fvurusunda yer verilen ilkelere de\u011finildikten sonra somut olay\u0131n Tayfun Cengiz ba\u015fvurusundan farkl\u0131 olarak yeni bir \u00f6zl\u00fck hakk\u0131 kazanma amac\u0131yla ger\u00e7ekle\u015ftirildi\u011fi ifade edilmi\u015ftir. Bu gibi reform taleplerinin hayata ge\u00e7irilmesinin ise teknik ve siyasi s\u00fcre\u00e7lerin i\u015fletilmesini gerektirdi\u011finden ka\u00e7\u0131n\u0131lmaz olarak belirli bir zaman alaca\u011f\u0131na dikkat \u00e7ekilerek somut olaya konu talebin basit bir y\u00f6netsel d\u00fczenlemeden ziyade n\u00f6bet g\u00f6revine ili\u015fkin yap\u0131sal bir reform olmas\u0131 nedeniyle sendikalar\u0131n bahse konu s\u00fcrece katlanmalar\u0131n\u0131n gerekti\u011fi vurgulanm\u0131\u015ft\u0131r (Osman Bayat ve di\u011ferleri, \u00a7\u00a7 39-43).<\/p>\n<p>11. Kararda, kamu g\u00f6revlileri sendikalar\u0131n\u0131n talepleri hakk\u0131nda imza ve dilek\u00e7e kampanyas\u0131, bas\u0131n a\u00e7\u0131klamas\u0131, kokart takarak n\u00f6bet tutma, h\u00fck\u00fbmet yetkililerinin de bulundu\u011fu toplant\u0131larda konuyu g\u00fcndeme getirme, milletvekilleri arac\u0131l\u0131\u011f\u0131yla parlamento d\u00fczeyinde g\u00fcndem olu\u015fturma gibi \u00e7ok \u00e7e\u015fitli sendikal ara\u00e7lara ba\u015fvurarak politika yap\u0131c\u0131lar\u0131 harekete ge\u00e7irdikleri ancak politika yapma s\u00fcreci devam ederken ald\u0131klar\u0131 eylem kararlar\u0131yla s\u00fcrece katlanma y\u00fck\u00fcml\u00fcl\u00fcklerine ve iyi y\u00f6neti\u015fim ilkelerine ayk\u0131r\u0131 hareket ettikleri belirtilmi\u015ftir (Osman Bayat ve di\u011ferleri, \u00a7\u00a7 7, 44).<\/p>\n<p>12. Bunun yan\u0131nda n\u00f6bet g\u00f6revinin ihtiva etti\u011fi izleme ve denetim \u00f6zellikleri ile ders \u00e7izilgesinin gerekti\u011fi gibi uygulanmas\u0131, ders d\u0131\u015f\u0131 zamanlarda okul ve \u00f6\u011frenci g\u00fcvenli\u011finin sa\u011flanmas\u0131, okulun fiziksel \u015fartlar\u0131n\u0131n kontrol edilmesi gibi bir dizi g\u00f6revler b\u00fct\u00fcn\u00fc oldu\u011fu g\u00f6zetildi\u011finde yerine getirilmemesinin ba\u015fta e\u011fitim hakk\u0131 olmak \u00fczere di\u011fer temel hak ve \u00f6zg\u00fcrl\u00fckler \u00fczerinde de olumsuz etkiler olu\u015fturma niteli\u011fi oldu\u011fu vurgulanm\u0131\u015ft\u0131r (Osman Bayat ve di\u011ferleri, \u00a7\u00a7 45, 46).<\/p>\n<p>13. Nihayetinde somut olayda kamu g\u00f6revlileri sendikalar\u0131n\u0131n taleplerine ili\u015fkin politika yapma s\u00fcrecini ba\u015flatabilmelerine ra\u011fmen g\u00f6revi yerine getirmeme \u015feklindeki eylemleriyle devletin \u00f6\u011fretmenler i\u00e7in asli g\u00f6rev olarak \u00f6ng\u00f6rd\u00fc\u011f\u00fc ve e\u011fitim \u00f6\u011fretim faaliyetlerinin kesintisiz olarak s\u00fcrd\u00fcr\u00fclmesinde yads\u0131namaz bir \u00f6nemi olan n\u00f6bet d\u00fczenlemesinin tamamen ve fiil\u00ee olarak i\u015flevsiz b\u0131rak\u0131lmas\u0131na neden olduklar\u0131 de\u011ferlendirilmi\u015ftir. Bu sebeple ba\u015fvuruculara verilen uyarma cezas\u0131n\u0131n -en hafif- mevzuat\u0131n olduk\u00e7a uzun kabul edilebilecek, iki ay boyunca devam eden s\u00fcrekli ihlaline son verilmesi i\u00e7in zorunlu oldu\u011fu, bu y\u00f6nden bir toplumsal ihtiyac\u0131 kar\u015f\u0131lad\u0131\u011f\u0131 ve orant\u0131l\u0131 oldu\u011fu sonucuyla sendika hakk\u0131n\u0131n ihlal edilmedi\u011fine karar verilmi\u015ftir (Osman Bayat ve di\u011ferleri, \u00a7\u00a7 47-50).<\/p>\n<p>14. Bu itibarla somut olay\u0131n ko\u015fullar\u0131n\u0131n Osman Bayat ve di\u011ferleri karar\u0131nda s\u00f6z\u00fc edilen ko\u015fullarla -sendika karar\u0131; eylemler; disiplin cezalar\u0131; ba\u015fvurucular\u0131n iddialar\u0131- mahkeme gerek\u00e7eleri- ayn\u0131 oldu\u011fu anla\u015f\u0131ld\u0131\u011f\u0131ndan bahse konu kararda a\u00e7\u0131klanan ilkelerden ve ula\u015f\u0131lan sonu\u00e7tan ayr\u0131lmay\u0131 gerektiren bir durum bulunmamaktad\u0131r.<\/p>\n<p>15. A\u00e7\u0131klanan gerek\u00e7elerle demokratik toplum d\u00fczeninin gereklerine uygun olan m\u00fcdahaleyle Anayasa\u2019n\u0131n 51. maddesinde g\u00fcvence alt\u0131na al\u0131nan sendika hakk\u0131n\u0131n ihlal edilmedi\u011fine karar verilmesi gerekir.<\/p>\n<p>Kenan YA\u015eAR bu g\u00f6r\u00fc\u015fe kat\u0131lmam\u0131\u015ft\u0131r.<\/p>\n<p>III. H\u00dcK\u00dcM<\/p>\n<p>A\u00e7\u0131klanan gerek\u00e7elerle;<\/p>\n<p>A. Sendika hakk\u0131n\u0131n ihlal edildi\u011fine ili\u015fkin iddian\u0131n KABUL ED\u0130LEB\u0130L\u0130R OLDU\u011eUNA OYB\u0130RL\u0130\u011e\u0130YLE,<\/p>\n<p>B. Anayasa\u2019n\u0131n 51. maddesinde g\u00fcvence alt\u0131na al\u0131nan sendika hakk\u0131n\u0131n \u0130HLAL ED\u0130LMED\u0130\u011e\u0130NE Kenan YA\u015eAR\u2019\u0131n kar\u015f\u0131oyu ve OY\u00c7OKLU\u011eUYLA,<\/p>\n<p>C. Yarg\u0131lama giderlerinin ba\u015fvurucu \u00fczerinde BIRAKILMASINA,<\/p>\n<p>D. Karar\u0131n bir \u00f6rne\u011finin Adalet Bakanl\u0131\u011f\u0131na G\u00d6NDER\u0130LMES\u0130NE 8\/1\/2025 tarihinde karar verildi.<\/p>\n<p>KAR\u015eIOY GEREK\u00c7ES\u0130<\/p>\n<p>1. Ba\u015fvurucunun \u00fcyesi oldu\u011fu sendika, \u00f6\u011fretmenlerin n\u00f6bet hizmetinin fazla mesai olarak kabul edilmesi ve \u00fccretlendirilmesi ve her t\u00fcrl\u00fc ek \u00f6demenin temel \u00fccrete yans\u0131t\u0131lmas\u0131na y\u00f6nelik taleplerinin yerine gelinceye dek n\u00f6bet g\u00f6revinin yerine getirilmemesine ili\u015fkin karar alm\u0131\u015ft\u0131r. Ba\u015fvurucu s\u00f6z konusu karar \u00fczerine 2015 y\u0131l\u0131 Nisan-Haziran d\u00f6neminde toplamda 12 g\u00fcn s\u00fcresince n\u00f6bet g\u00f6revini yerine getirmemi\u015f; idare, s\u00f6z konusu eylem nedeniyle ba\u015fvurucunun uyarma cezas\u0131 ile cezaland\u0131r\u0131lmas\u0131na karar vermi\u015ftir.<\/p>\n<p>2. Ba\u015fvurucu, hakk\u0131nda tesis edilen disiplin cezas\u0131n\u0131n iptali talebiyle idare mahkemesinde dava a\u00e7m\u0131\u015f, a\u00e7\u0131lan dava reddedilerek istinaf kanun yolunda kesinle\u015fmesi \u00fczerine sendika hakk\u0131n\u0131n ihlal etti\u011fi iddias\u0131 ile s\u00fcresinde bireysel ba\u015fvuruda bulunmu\u015ftur.<\/p>\n<p>3. Mahkememiz ba\u015fvurunun kabul edilebilirli\u011fine oybirli\u011fi ile, sendika hakk\u0131n\u0131n ihlal edilmedi\u011fine oy \u00e7oklu\u011fu ile karar vermi\u015ftir. A\u015fa\u011f\u0131da belirtilen sebeplerle Mahkeme \u00e7o\u011funlu\u011funun karar\u0131na i\u015ftirak edilmemi\u015ftir.<\/p>\n<p>4. Mahkememizin \u00e7o\u011funluk karar\u0131nda belirtildi\u011fi \u00fczere bu maddenin Anayasa\u2019n\u0131n 13. maddesi \u0131\u015f\u0131\u011f\u0131nda Anayasa&#8217;n\u0131n 51. maddesinde g\u00fcvence alt\u0131na al\u0131nan sendika hakk\u0131yla ve dolay\u0131s\u0131yla sendika hakk\u0131na i\u00e7kin olan toplu eylem hakk\u0131yla birlikte ve uyumlu \u015fekilde yorumlanmas\u0131 gerekir. Aksi h\u00e2lde sendika hakk\u0131 kapsam\u0131ndaki toplu eylem hakk\u0131n\u0131n anlams\u0131z h\u00e2le gelece\u011fi a\u00e7\u0131kt\u0131r.<\/p>\n<p>5. Mahkememizin \u00e7o\u011funlu\u011funun m\u00fcdahalenin varl\u0131\u011f\u0131 ile kanunilik ve me\u015fru ama\u00e7 \u015fartlar\u0131n\u0131n varl\u0131\u011f\u0131 konusundaki de\u011ferlendirmesine kat\u0131l\u0131yorum. Ba\u015fvurunun demokratik toplum d\u00fczeninin gereklerine uygunluk \u015fartlar\u0131n\u0131 ta\u015f\u0131y\u0131p ta\u015f\u0131mad\u0131\u011f\u0131 a\u00e7\u0131s\u0131ndan A\u0130HM ve bug\u00fcne kadar olu\u015fturulan Anayasa Mahkemesi i\u00e7tihatlar\u0131 da dikkate al\u0131narak bir de\u011ferlendirme yap\u0131lmas\u0131 gerekir.<\/p>\n<p>6. Bir sendikal eylemin t\u00fcm\u00fcyle yasaklanmas\u0131 veya ger\u00e7ekle\u015ftirilmesinin a\u011f\u0131r ko\u015fullara ba\u011flanmas\u0131 hakk\u0131n \u00f6z\u00fcne zarar vermesi muhtemel olmakla birlikte mevcut ba\u015fvurudaki gibi sendika \u00fcyelerinin i\u015f b\u0131rakma t\u00fcr\u00fc eylemlere kat\u0131lmas\u0131na ili\u015fkin yasal d\u00fczenlemeler ve yasal d\u00fczenlemelere ba\u011fl\u0131 olarak genel d\u00fczenleyici i\u015flemler yapmak, yasama ve y\u00fcr\u00fctme organlar\u0131n\u0131n takdirindedir (Tayfun Cengiz, B. No: 2013\/8463, 18\/9\/2014, \u00a7 60 ).<\/p>\n<p>7. Ba\u015fvurucunun bir devlet okulunda \u00f6\u011fretmen oldu\u011fu g\u00f6z \u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda devlet memurlar\u0131n\u0131n bu haktan b\u00fct\u00fcn\u00fcyle mahrum b\u0131rak\u0131lamayacaklar\u0131n\u0131 da not etmek gerekir. Bununla birlikte, demokratik bir toplumda gereklili\u011fi tart\u0131\u015f\u0131lmaz olan durumlarda ordu, emniyet veya ba\u015fka baz\u0131 sekt\u00f6rlerde sendikal faaliyetlere s\u0131n\u0131rlamalar getirilmesi m\u00fcmk\u00fcnd\u00fcr. Ba\u015fvurucunun bu t\u00fcrden s\u0131n\u0131rlamalara tabi tutulmas\u0131n\u0131 gerektirecek bir g\u00f6revde bulundu\u011fu da ileri s\u00fcr\u00fclmemi\u015ftir (Tayfun Cengiz, B. No: 2013\/8463, 18\/9\/2014, \u00a7 61 ).<\/p>\n<p>8. Anayasa Mahkemesi Tayfun Cengiz karar\u0131 sonras\u0131nda \u00e7ok say\u0131da ba\u015fvuruda Anayasa&#8217;n\u0131n 51. maddesinde g\u00fcvence alt\u0131na al\u0131nan sendika hakk\u0131n\u0131n kapsam\u0131na y\u00f6nelik benzer de\u011ferlendirmelerde bulunmu\u015ftur.<\/p>\n<p>9. Mahkememiz i\u015f bu ba\u015fvuruda sendikal haklar\u0131n, korunmaya muhta\u00e7 ve re\u015fit olmayan \u00e7ocuklar\u0131n e\u011fitim hakk\u0131 nedeniyle s\u0131n\u0131rlanabilece\u011fi dolay\u0131s\u0131yla ba\u015fvurucular\u0131n sendikal haklar\u0131n\u0131n ihlal edilmedi\u011fi sonucuna ula\u015fm\u0131\u015f ve A\u0130HM\u2019in Humpert ve di\u011ferleri\/Almanya karar\u0131n\u0131n 137. Paragraf\u0131na at\u0131fta bulunmu\u015ftur. S\u00f6z konusu atfa g\u00f6re insan haklar\u0131n\u0131n ilerletilmesi i\u00e7in elzem olan e\u011fitim hakk\u0131 demokratik bir toplumda temel bir rol oynar. Bu hak, e\u011fitim \u00e7a\u011f\u0131ndaki her \u00e7ocu\u011fun ki\u015fisel geli\u015fimi ve gelecekteki ba\u015far\u0131s\u0131 i\u00e7in son derece \u00f6nemlidir. Bu anlamda \u00f6zg\u00fcrl\u00fck, demokrasi, insan haklar\u0131 ve hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fc gibi konular\u0131n e\u011fitim sisteminin bir par\u00e7as\u0131 h\u00e2line getirilmesine \u00f6ncelik verilmesi gerekir. Bunun yan\u0131nda e\u011fitim hakk\u0131n\u0131n demokratik kurumlar\u0131n ve toplumlar\u0131n mevcudiyetini s\u00fcrd\u00fcrebilmesi i\u00e7in ihtiya\u00e7 duydu\u011fu demokratik k\u00fclt\u00fcr\u00fc geli\u015ftirmek i\u00e7in kritik oldu\u011fu ve devletin bu ba\u011flamda ilgili kamu hizmetinin gere\u011fi gibi y\u00fcr\u00fct\u00fclmesinden sorumlu oldu\u011fu da hat\u0131rlanmal\u0131d\u0131r (\u00a7 45).<\/p>\n<p>10. Bireysel ba\u015fvuru hakk\u0131n\u0131n Anayasa\u2019m\u0131zda yer almas\u0131n\u0131n iki gerek\u00e7esi vard\u0131r: Bireylerin temel hak ve \u00f6zg\u00fcrl\u00fcklerine y\u00f6nelik hak ihlallerinin ulusal d\u00fczeyde tespit edilip giderim sa\u011flamak ve A\u0130HM\u2019e yap\u0131lacak ba\u015fvurular\u0131n say\u0131s\u0131n\u0131 azaltmak. Bu iki hedefe ula\u015fman\u0131n yolu ise A\u0130HM taraf\u0131ndan y\u0131llar i\u00e7erisinde geli\u015ftirilen ilkelerin ve yorumlar\u0131n i\u00e7 hukuka aktar\u0131larak temel hak ve \u00f6zg\u00fcrl\u00fcklere y\u00f6nelik de\u011ferlendirme ve kararlarda paralellik sa\u011flamakt\u0131r.<\/p>\n<p>11. Bu sebeple i\u015f bu ba\u015fvuruda da A\u0130HM\u2019in Humpert ve di\u011ferleri\/Almanya karar\u0131n\u0131n bir b\u00fct\u00fcn halinde de\u011ferlendirilip \u00f6yle sonuca var\u0131lmas\u0131 gerekirken A\u0130HM karar\u0131n\u0131n sadece bir paragraf\u0131na at\u0131fla sonuca ula\u015fmak yerinde olmam\u0131\u015ft\u0131r. Her ne kadar par\u00e7a b\u00fct\u00fcn\u00fcn habercisi ise de mahkeme kararlar\u0131nda h\u00fck\u00fcm kadar yap\u0131lan de\u011ferlendirmeler sonucunda olu\u015fturulan gerek\u00e7eler de \u00f6nemlidir.<\/p>\n<p>12. Humpert ve di\u011ferleri\/Almanya karar\u0131n\u0131n d\u0131\u015f\u0131nda A\u0130HM&#8217;in konuya ili\u015fkin en kapsaml\u0131 de\u011ferlendirme i\u00e7eren kararlar\u0131ndan biri olan Enerji Yap\u0131-Yol Sen\/T\u00fcrkiye (B. No: 68959\/01, 21\/4\/2009) karar\u0131d\u0131r. Humpert ve di\u011ferleri\/Almanya karar\u0131nda s\u00f6z konusu karara s\u0131k s\u0131k at\u0131f yap\u0131lmas\u0131 sebebiyle bu karar\u0131n \u00f6ncelikle de\u011ferlendirilmesi gerekir.<\/p>\n<p>13. Enerji Yap\u0131-Yol Sen\/T\u00fcrkiye karar\u0131nda, KESK memurlara toplu s\u00f6zle\u015fme hakk\u0131 tan\u0131nmas\u0131 i\u00e7in 18\/4\/1996 tarihinde i\u015f b\u0131rakma ve i\u015f yava\u015flatma eylemi planlam\u0131\u015ft\u0131r. Kamu makamlar\u0131 bu eylemden haberdar olunca, Ba\u015fbakanl\u0131k Personel Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc 13\/4\/1996 tarihinde bir Genelge yay\u0131mlam\u0131\u015ft\u0131r. Genelgede, memurlar i\u00e7in yasak olmas\u0131na ra\u011fmen i\u015f b\u0131rakma haz\u0131rl\u0131\u011f\u0131 oldu\u011funa dair bilgi verilmi\u015f ve gerekli tedbirlerin al\u0131nmas\u0131 gerekti\u011fi ifade edilmi\u015ftir. Eylem planland\u0131\u011f\u0131 gibi ger\u00e7ekle\u015ftirilmi\u015f, kat\u0131lan baz\u0131 memurlara disiplin cezalar\u0131 verilmi\u015ftir. Bunun \u00fczerine ba\u015fvurucu i\u00e7 hukuk yollar\u0131n\u0131 t\u00fcketip A\u0130HM&#8217;e ba\u015fvurarak Genelge&#8217;nin sendika hakk\u0131n\u0131 ihlal etti\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr.<\/p>\n<p>14. A\u0130HM, Enerji Yap\u0131-Yol Sen\/T\u00fcrkiye karar\u0131nda; grev hakk\u0131n\u0131n mutlak bir hak olmad\u0131\u011f\u0131n\u0131 ve belirli ko\u015fullara ba\u011fl\u0131 k\u0131s\u0131tlamalara tabi olabilece\u011fini kabul etmektedir. Devletin memurlara grev yasa\u011f\u0131 getirmesi sendikal \u00f6zg\u00fcrl\u00fck ilkesine uygun olabilir, ancak bu yasak genel olarak t\u00fcm memurlar\u0131 kapsayamaz. Grev hakk\u0131na getirilen k\u0131s\u0131tlamalar\u0131n a\u00e7\u0131k ve s\u0131n\u0131rlay\u0131c\u0131 bir \u015fekilde tan\u0131mlanmas\u0131 gerekmektedir. A\u0130HM, mevcut davada, genelgenin A\u0130HS\u2019nin 11. maddesinde belirtilen ama\u00e7larla dengelenmeden t\u00fcm memurlara grev yasa\u011f\u0131 getirdi\u011fini belirtiyor. Ayr\u0131ca, 18 Nisan 1996&#8217;daki ulusal eylem g\u00fcn\u00fcn\u00fcn yasakland\u0131\u011f\u0131na dair hi\u00e7bir kan\u0131t bulunmad\u0131\u011f\u0131n\u0131 vurgulamaktad\u0131r. Genelge, sadece bu eyleme kat\u0131l\u0131m\u0131 yasaklamakta, ancak sendikan\u0131n \u00fcyeleri bar\u0131\u015f\u00e7\u0131l toplanma \u00f6zg\u00fcrl\u00fcklerini kullanm\u0131\u015ft\u0131r. Disiplin cezalar\u0131n\u0131n, sendika \u00fcyeleri a\u00e7\u0131s\u0131ndan cayd\u0131r\u0131c\u0131 etkisi oldu\u011fu d\u00fc\u015f\u00fcn\u00fclmektedir. A\u0130HM, H\u00fck\u00fcmet\u2019in bu k\u0131s\u0131tlaman\u0131n gereklili\u011fini kan\u0131tlayamad\u0131\u011f\u0131n\u0131 belirterek, genelgenin kabul\u00fc ve uygulanmas\u0131n\u0131n \u201czorlay\u0131c\u0131 bir sosyal gereksinimi\u201d kar\u015f\u0131lamad\u0131\u011f\u0131 ve m\u00fcdahalenin orant\u0131s\u0131z oldu\u011fu sonucuna ula\u015fm\u0131\u015ft\u0131r.<\/p>\n<p>15. A\u0130HM, Kaya ve Seyhan\/T\u00fcrkiye karar\u0131nda (B. No: 30946\/04, 15\/9\/2009), 2003 y\u0131l\u0131nda kamu y\u00f6netimi kanun tasar\u0131s\u0131n\u0131 protesto etmek \u00fczere KESK taraf\u0131ndan d\u00fczenlenen eyleme kat\u0131larak i\u015fe gitmeyen, ard\u0131ndan da uyarma cezas\u0131 ile tecziye edilen ba\u015fvurucular\u0131n sendika hakk\u0131n\u0131n ihlal edildi\u011fi y\u00f6n\u00fcndeki \u015fik\u00e2yetleri hakk\u0131nda da ihlal karar\u0131 vermi\u015ftir. A\u0130HM, s\u00f6z konusu bir g\u00fcnl\u00fck eylemin \u00f6nceden ulusal makamlara bildirildi\u011fini ve bu eylemin ilgili makamlarca yasaklanmad\u0131\u011f\u0131n\u0131 vurgulam\u0131\u015f, ba\u015fvurucular\u0131n bar\u0131\u015f\u00e7\u0131l toplant\u0131 haklar\u0131n\u0131 kulland\u0131klar\u0131n\u0131 belirtmi\u015ftir. A\u0130HM ard\u0131ndan ba\u015fvurucular\u0131n bir g\u00fcnl\u00fck eyleme kat\u0131lmalar\u0131 nedeniyle uyarma cezas\u0131 ald\u0131klar\u0131n\u0131 belirtmi\u015f, daha sonra bu ceza \u00e7ok hafif de olsa sendika \u00fcyelerini grev ya da eylemlere kat\u0131lmaktan vazge\u00e7irecek bir nitelik ta\u015f\u0131d\u0131\u011f\u0131n\u0131, dolay\u0131s\u0131yla ba\u015fvuruculara verilen disiplin cezas\u0131n\u0131n acil bir sosyal ihtiyaca kar\u015f\u0131l\u0131k gelmedi\u011fini belirtmi\u015ftir (Kaya ve Seyhan, \u00a7\u00a7 15-32).<\/p>\n<p>16. A\u0130HM, sendika \u00e7a\u011fr\u0131s\u0131 \u00fczerine bir ya da birka\u00e7 g\u00fcnl\u00fck i\u015f b\u0131rakma eylemlerine kat\u0131lan memurlar\u0131n yapt\u0131\u011f\u0131 bir\u00e7ok ba\u015fvuruda yukar\u0131daki gerek\u00e7elere benzer gerek\u00e7elerle ihlal kararlar\u0131 vermi\u015ftir (bkz. Dilek ve di\u011ferleri\/T\u00fcrkiye, B. No: 74611\/01 &#8230; 17\/7\/2007; Urcan ve di\u011ferleri\/T\u00fcrkiye, B. No: 23018\/04 &#8230;, 17\/7\/2008).<\/p>\n<p>17. \u00d6te yandan Anayasa Mahkemesi, E\u011fitim Sen&#8217;in e\u011fitimle ilgili bir kanun teklifinin geri \u00e7ekilmesini sa\u011flamak \u00fczere 28-29\/3\/2012 tarihlerinde t\u00fcm \u00fclke \u00e7ap\u0131nda \u201cuyar\u0131 grevi\u201d ad\u0131 alt\u0131nda ba\u015flatt\u0131\u011f\u0131 eyleme kat\u0131larak i\u015fe gitmeyen, ard\u0131ndan da uyarma cezas\u0131 ile tecziye edilen bir \u00f6\u011fretmenin sendika hakk\u0131n\u0131n ihlal edildi\u011fi iddias\u0131yla yapt\u0131\u011f\u0131 bireysel ba\u015fvuruda (Tayfun Cengiz, B. No: 2013\/8463, 18\/9\/2014), A\u0130HM&#8217;in yukar\u0131daki kararlar\u0131ndan hareketle sendika hakk\u0131n\u0131n ihlal edildi\u011fine karar vermi\u015ftir.<\/p>\n<p>18. Anayasa Mahkemesi s\u00f6z konusu karar\u0131nda, ba\u015fvurucunun E\u011e\u0130T\u0130M SEN&#8217;in d\u00fczenledi\u011fi i\u015fe gelmeme eylemine kat\u0131ld\u0131\u011f\u0131 i\u00e7in uyarma cezas\u0131 ald\u0131\u011f\u0131n\u0131 belirtmi\u015ftir. \u0130darenin ola\u011fan uygulamalar\u0131nda ve idari yarg\u0131 i\u00e7tihatlar\u0131nda sendikal faaliyet kapsam\u0131nda i\u015fe gelmeme durumlar\u0131n\u0131n mazeret izni olarak kabul edildi\u011fi ve disiplin soru\u015fturmas\u0131 a\u00e7\u0131lmad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. Ancak, bu konuda yeknesak hareketi sa\u011flayacak mevzuat eksikli\u011fi nedeniyle, sendika hakk\u0131n\u0131 kullanan ki\u015filerin disiplin soru\u015fturmas\u0131 tehdidi alt\u0131nda kald\u0131klar\u0131 vurgulanmaktad\u0131r. Verilen ceza hafif olmas\u0131na ra\u011fmen, sendikaya \u00fcye bireyleri me\u015fru grev veya eylemlere kat\u0131lmaktan cayd\u0131rabilecek bir nitelik ta\u015f\u0131maktad\u0131r. Uyarma cezas\u0131n\u0131n &#8220;toplumsal bir ihtiya\u00e7 bask\u0131s\u0131na&#8221; yan\u0131t vermemesi nedeniyle &#8220;demokratik toplumda gerekli olmad\u0131\u011f\u0131&#8221; sonucuna var\u0131lm\u0131\u015ft\u0131r. Bu nedenle, ba\u015fvurucunun Anayasa&#8217;n\u0131n 51. maddesinde g\u00fcvence alt\u0131na al\u0131nan sendika hakk\u0131n\u0131n ihlal edildi\u011fine karar verilmesi gerekti\u011fi sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r. (Tayfun Cengiz, B. No: 2013\/8463, 18\/9\/2014, \u00a7 59-63).<\/p>\n<p>19. Anayasa Mahkemesi Tayfun Cengiz karar\u0131ndan sonra i\u015f b\u0131rakma eylemleriyle ilgili olarak benzer y\u00f6nde kararlar vermi\u015ftir (Bu kararlar aras\u0131ndan bkz. Abidin Ayd\u0131n T\u00fcfek\u00e7i, B. No: 2013\/1315, 15\/4\/2015).<\/p>\n<p>20. Sendika hakk\u0131na ili\u015fkin Anayasa Mahkemesi ile A\u0130HM i\u00e7tihad\u0131 yukar\u0131da \u00f6zetlendi\u011fi gibi iken A\u0130HM 2023 y\u0131l\u0131nda Humpert ve di\u011ferleri\/Almanya karar\u0131n\u0131 vermi\u015ftir.<\/p>\n<p>21. Karara konu olayda, Almanya\u2019da devlet memuru stat\u00fcs\u00fcne sahip d\u00f6rt \u00f6\u011fretmen, \u00e7al\u0131\u015fma \u015fartlar\u0131n\u0131n k\u00f6t\u00fcle\u015fmesini protesto etmek amac\u0131yla \u00fcyesi olduklar\u0131 sendikan\u0131n organize etti\u011fi greve kat\u0131lm\u0131\u015flard\u0131r. Ba\u015fvurucular greve kat\u0131ld\u0131klar\u0131 i\u00e7in iki ila on iki aras\u0131nda de\u011fi\u015fen say\u0131da derse (bir g\u00fcn ila \u00fc\u00e7 g\u00fcne yay\u0131lacak \u015fekilde) girmemi\u015flerdir. Bunun \u00fczerine ba\u015fvurucular \u00e7al\u0131\u015fma saatleri i\u00e7inde greve kat\u0131larak g\u00f6revlerini yerine getirmedikleri gerek\u00e7esiyle disiplin cezalar\u0131yla tecziye edilmi\u015flerdir. Ba\u015fvurucular s\u00f6z konusu cezalar\u0131n iptali istemiyle i\u00e7 hukukta davalar a\u00e7m\u0131\u015f ancak bunlardan olumlu bir netice alamam\u0131\u015flard\u0131r. Ba\u015fvurucular\u0131n Alman Federal Anayasa Mahkemesine yapt\u0131\u011f\u0131 bireysel ba\u015fvurular da reddedilmi\u015ftir (Humpert ve di\u011ferleri\/Almanya, \u00a7\u00a7 8-36).<\/p>\n<p>22. A\u0130HM, ba\u015fvuruyu kabul ederek esas incelemeye ge\u00e7mi\u015ftir. \u00d6ncelikle sendika \u00f6zg\u00fcrl\u00fc\u011f\u00fcne dair genel a\u00e7\u0131klamalarda bulunmu\u015f, ard\u0131ndan grev hakk\u0131 \u00fczerine de\u011ferlendirmeler yapm\u0131\u015ft\u0131r. A\u0130HM, sendika \u00f6zg\u00fcrl\u00fc\u011f\u00fcne ili\u015fkin iki temel ilke belirlemi\u015ftir: birincisi, devletin sendika \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc g\u00fcvence alt\u0131na almak i\u00e7in ald\u0131\u011f\u0131 tedbirlerin b\u00fct\u00fcn\u00fcn\u00fc dikkate almak; ikincisi ise, bu tedbirlerin sendika \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn \u00f6z\u00fcn\u00fc yok edecek \u015fekilde olmamas\u0131 gerekti\u011fidir. A\u0130HM, grev yasa\u011f\u0131n\u0131n sendika \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn esasl\u0131 bir unsuru olup olmad\u0131\u011f\u0131n\u0131 belirlemenin zor oldu\u011funu ifade etmi\u015ftir. Bu sorunun ba\u011flama \u00f6zg\u00fc oldu\u011funu ve ilgili devletin sendika \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc g\u00fcvence alt\u0131na almak i\u00e7in ald\u0131\u011f\u0131 tedbirlerin dikkate al\u0131nmas\u0131 gerekti\u011fini vurgulam\u0131\u015ft\u0131r. A\u0130HM, yukar\u0131daki a\u00e7\u0131klamalardan sonra, greve kat\u0131ld\u0131klar\u0131 i\u00e7in derse girmeyen ve disiplin cezas\u0131 alan ba\u015fvurucular\u0131n sendika \u00f6zg\u00fcrl\u00fc\u011f\u00fcne m\u00fcdahale edildi\u011fini belirtmi\u015ftir. A\u0130HM, sendika \u00f6zg\u00fcrl\u00fc\u011f\u00fcne y\u00f6nelik m\u00fcdahalenin gereklili\u011fini de\u011ferlendirirken t\u00fcm olgusal ve yasal ba\u011flam\u0131 dikkate alaca\u011f\u0131n\u0131 belirtmi\u015ftir (Humpert ve di\u011ferleri\/Almanya, \u00a7\u00a7 113-122).<\/p>\n<p>24. A\u0130HM bu kapsamda ilk olarak Almanya&#8217;da grev hakk\u0131na getirilen k\u0131s\u0131tlaman\u0131n niteli\u011fini ve kapsam\u0131n\u0131 ele alm\u0131\u015ft\u0131r. Almanya&#8217;da devlet memurlar\u0131n\u0131n, \u00f6\u011fretmenler de dahil olmak \u00fczere, grev yasa\u011f\u0131n\u0131n mutlak oldu\u011funu ve ciddi \u015fekilde de\u011ferlendirilebilece\u011fini belirtmi\u015ftir. Ba\u015fvurucular, A\u0130HM&#8217;in Enerji Yap\u0131-Yol Sen\/T\u00fcrkiye karar\u0131ndaki grev yasa\u011f\u0131n\u0131n genel olarak memurlar\u0131 kapsamayaca\u011f\u0131na dair ifadelerine at\u0131fta bulunmu\u015flard\u0131r. A\u0130HM, bu t\u00fcr bir genel grev yasa\u011f\u0131n\u0131n S\u00f6zle\u015fme kapsam\u0131nda \u00f6zel sorunlar do\u011furdu\u011funu kabul etse de grev yasa\u011f\u0131n\u0131n sendika \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn \u00f6z\u00fcn\u00fc yok edip etmedi\u011fine ili\u015fkin de\u011ferlendirmenin bir\u00e7ok unsura ba\u011fl\u0131 oldu\u011funu vurgulam\u0131\u015ft\u0131r. A\u0130HM, Almanya&#8217;daki memur sendikalar\u0131n\u0131n ve memurlar\u0131n mesleki menfaatlerini koruma olanaklar\u0131n\u0131 incelemi\u015ftir. Almanya&#8217;da memur sendikalar\u0131n\u0131n, devlet memurlar\u0131n\u0131n \u00e7\u0131karlar\u0131n\u0131 korumak i\u00e7in yasa yapma s\u00fcrecine kat\u0131lma hakk\u0131na sahip oldu\u011fu belirtilmi\u015ftir. Sendikalar\u0131n kanun taslaklar\u0131na yorum yapma s\u00fcresi ve h\u00fck\u00fcmetin bu yorumlar\u0131 dikkate alma y\u00fck\u00fcml\u00fcl\u00fckleri de vurgulanm\u0131\u015ft\u0131r. A\u0130HM, devlet memurlar\u0131n\u0131n personel konseyleri arac\u0131l\u0131\u011f\u0131yla temsil edilme hakk\u0131n\u0131n da grev yasa\u011f\u0131n\u0131n de\u011ferlendirilmesinde dikkate al\u0131nmas\u0131 gerekti\u011fini belirtmi\u015ftir. Son olarak, Almanya&#8217;da kamu hizmetinde \u00e7al\u0131\u015fanlar\u0131n b\u00fcy\u00fck k\u0131sm\u0131n\u0131n s\u00f6zle\u015fmeli oldu\u011fu ve bu \u00e7al\u0131\u015fanlar\u0131n grev hakk\u0131na sahip oldu\u011fu belirtilmi\u015ftir. A\u0130HM, Almanya&#8217;daki mevcut grev yasa\u011f\u0131n\u0131n \u00e7e\u015fitli haklar aras\u0131nda makul bir denge sa\u011flad\u0131\u011f\u0131 sonucuna vararak, S\u00f6zle\u015fme&#8217;nin 11. maddesinin ihlal edilmedi\u011fine karar vermi\u015ftir (Humpert ve di\u011ferleri\/Almanya, \u00a7\u00a7 130-147).<\/p>\n<p>28. Grev hakk\u0131na ili\u015fkin yukar\u0131daki t\u00fcm kararlar dikkate al\u0131nd\u0131\u011f\u0131nda A\u0130HM&#8217;in Humpert ve di\u011ferleri\/Almanya karar\u0131, memurlara getirilen grev yasa\u011f\u0131n\u0131n S\u00f6zle\u015fme&#8217;nin 11. maddesiyle uyumlu olup olmad\u0131\u011f\u0131n\u0131 kapsaml\u0131 bir \u015fekilde ele alm\u0131\u015ft\u0131r. A\u0130HM, bu yasa\u011f\u0131n soyut bir \u015fekilde incelenemeyece\u011fini, ilgili \u00fclkedeki ko\u015fullar\u0131n dikkate al\u0131nmas\u0131 gerekti\u011fini vurgulam\u0131\u015ft\u0131r. Bu karar ile \u00f6nceki Enerji Yap\u0131-Yol Sen\/T\u00fcrkiye karar\u0131ndan ilkesel olarak ayr\u0131\u015f\u0131lmam\u0131\u015f, ancak Almanya&#8217;n\u0131n kendine \u00f6zg\u00fc \u00f6zellikleri g\u00f6z \u00f6n\u00fcnde bulundurularak farkl\u0131 sonu\u00e7lara ula\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>29. A\u0130HM, Humpert ve di\u011ferleri\/Almanya karar\u0131nda, memurlara getirilen grev yasa\u011f\u0131n\u0131n soyut olarak de\u011ferlendirilemeyece\u011fini vurgularken, Enerji Yap\u0131-Yol Sen\/T\u00fcrkiye karar\u0131nda, baz\u0131 memur kategorilerine grev yasa\u011f\u0131 getirilebilece\u011fini, ancak genel olarak memurlar\u0131 kapsayan bir yasa\u011f\u0131n S\u00f6zle\u015fme ile uyumlu olamayaca\u011f\u0131n\u0131 belirtmi\u015ftir. Bu a\u00e7\u0131klamalar, \u00f6zellikle silahl\u0131 kuvvetler ve kolluk kuvvetleri d\u0131\u015f\u0131nda kalan memurlar i\u00e7in genel bir grev yasa\u011f\u0131n\u0131n kabul edilemeyece\u011fini g\u00f6stermektedir. A\u0130HM, yasal k\u0131s\u0131tlamalar\u0131n a\u00e7\u0131k ve s\u0131n\u0131rlay\u0131c\u0131 \u015fekilde tan\u0131mlanmas\u0131 gerekti\u011fini de ifade etmi\u015ftir.<\/p>\n<p>30. Enerji Yap\u0131-Yol Sen\/T\u00fcrkiye karar\u0131, Anayasa Mahkemesi&#8217;nin kararlar\u0131n\u0131 etkilemi\u015ftir. Anayasa Mahkemesi, Tayfun Cengiz karar\u0131nda, sendika karar\u0131 do\u011frultusunda i\u015f b\u0131rakma eylemi yapan ba\u015fvurucuya verilen uyarma cezas\u0131n\u0131, sendika \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlali olarak de\u011ferlendirmi\u015ftir. Mahkeme, devlet okulunda \u00f6\u011fretmen olan ba\u015fvurucunun durumunu g\u00f6z \u00f6n\u00fcnde bulundurarak, devlet memurlar\u0131n\u0131n bu haktan tamamen mahrum b\u0131rak\u0131lamayaca\u011f\u0131na dikkat \u00e7ekmi\u015f ve belirli g\u00f6revler d\u0131\u015f\u0131ndaki kamu g\u00f6revlileri i\u00e7in getirilen genel grev yasaklar\u0131n\u0131n Anayasa ile uyumlu olmad\u0131\u011f\u0131n\u0131 belirtmi\u015ftir.<\/p>\n<p>31. Anayasa Mahkemesi Tayfun Cengiz karar\u0131nda ba\u015fvurucunun davran\u0131\u015f\u0131n\u0131 a\u00e7\u0131k\u00e7a grev olarak tan\u0131mlamam\u0131\u015f olsa bile bu tarz eylemlerin A\u0130HM taraf\u0131ndan grev olarak nitelendirildi\u011fi a\u00e7\u0131kt\u0131r. Zira A\u0130HM, Humpert ve di\u011ferleri\/Almanya karar\u0131nda, sendika \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc iki derse girmeyen ba\u015fvurucu y\u00f6n\u00fcnden bile grev hakk\u0131yla ba\u011flant\u0131l\u0131 olarak incelemi\u015ftir.<\/p>\n<p>32. A\u0130HM, Humpert ve di\u011ferleri\/Almanya karar\u0131nda Almanya ile T\u00fcrkiye aras\u0131ndaki farkl\u0131l\u0131klara dikkat \u00e7ekmi\u015ftir. Almanya&#8217;da memurlar\u0131n maa\u015f ve \u00f6zl\u00fck haklar\u0131, kamu personeli ile k\u0131yasland\u0131\u011f\u0131nda daha iyi durumdayken, T\u00fcrkiye&#8217;de memurlar\u0131n bu haklar\u0131 s\u00f6zle\u015fmeli \u00e7al\u0131\u015fanlarla \u00f6nemli \u00f6l\u00e7\u00fcde benzerlik g\u00f6stermektedir. Ayr\u0131ca, Enerji Yap\u0131-Yol Sen\/T\u00fcrkiye karar\u0131ndaki grev yasa\u011f\u0131n\u0131n dengeleme eksikli\u011fine vurgu yaparak, toplu s\u00f6zle\u015fme ile grev hakk\u0131 aras\u0131nda yak\u0131n bir ba\u011f bulundu\u011funu belirtmi\u015ftir.<\/p>\n<p>33. Humpert ve di\u011ferleri\/Almanya karar\u0131 sonras\u0131 verilen i\u015f bu karar ile memurlara getirilen grev yasa\u011f\u0131na ili\u015fkin Anayasa Mahkemesi i\u00e7tihad\u0131 de\u011fi\u015fmektedir. Karardaki de\u011ferlendirmelerden T\u00fcrk hukuk sisteminde memurlara grev yasa\u011f\u0131 getirilmesinin Anayasa ile uyumlu oldu\u011fu sonucu \u00e7\u0131kmaktad\u0131r. Karardaki de\u011ferlendirmelere g\u00f6re art\u0131k bir g\u00fcnl\u00fck i\u015f b\u0131rakma eyleminin cezaland\u0131r\u0131lmas\u0131 dahi Anayasa ile uyumlu hale gelmektedir. Mahkememizce, A\u0130HM\u2019in Humpert ve di\u011ferleri\/Almanya karar\u0131 esas al\u0131narak ayn\u0131 sonuca var\u0131lacak ise T\u00fcrkiye&#8217;deki grev yasa\u011f\u0131n\u0131n ba\u015fka baz\u0131 ara\u00e7larla telafi edildi\u011finin ortaya konulmas\u0131 gerekirdi.<\/p>\n<p>34. Her ne kadar T\u00fcrk hukuk sisteminde kamuda \u00f6\u011fretmenlik mesle\u011finin istihdam t\u00fcrlerine g\u00f6re \u00f6\u011fretmen ve s\u00f6zle\u015fmeli \u00f6\u011fretmen ayr\u0131m\u0131 var ise de Almanya&#8217;n\u0131n aksine grev yasa\u011f\u0131 y\u00f6n\u00fcnden kadrolu \u00f6\u011fretmenler ile s\u00f6zle\u015fmeli \u00f6\u011fretmenler aras\u0131nda bir fark bulunmamaktad\u0131r. T\u00fcrk hukuk sisteminde ikisi i\u00e7in de grev yasakt\u0131r. A\u0130HM, Almanya&#8217;da devlet okullar\u0131nda s\u00f6zle\u015fmeli olarak istihdam edilen \u00f6\u011fretmenlerin grev hakk\u0131na sahip oldu\u011funa vurgu yaparak kamuda genel bir grev yasa\u011f\u0131n\u0131n bulunmad\u0131\u011f\u0131n\u0131 belirtmi\u015ftir. Bu tespit A\u0130HM\u2019in Almanya \u00f6zelinde grev yasa\u011f\u0131 y\u00f6n\u00fcnden ihlal bulmamas\u0131n\u0131n \u00f6nemli bir gerek\u00e7esidir.<\/p>\n<p>35. A\u0130HM, Almanya&#8217;da memurlar\u0131n maa\u015flar\u0131n\u0131n kanunla belirlenmesine \u00f6zel \u00f6nem atfetmi\u015ftir. Humpert ve di\u011ferleri\/Almanya karar\u0131nda toplu pazarl\u0131k ile grev hakk\u0131 aras\u0131nda yak\u0131n bir ili\u015fki oldu\u011fu belirtilmesi nedeniyle i\u015f bu \u00e7o\u011funluk karar\u0131nda T\u00fcrk hukukunda memurlara getirilen toplu s\u00f6zle\u015fme hakk\u0131 ile grev hakk\u0131 aras\u0131ndaki ili\u015fki de\u011ferlendirilip toplu s\u00f6zle\u015fmede istenilen ko\u015fullar\u0131n elde edilebilmesi i\u00e7in kamu makamlar\u0131n\u0131 grev yoluyla zorlayacak bir arac\u0131n var oldu\u011fu ortaya konulmam\u0131\u015ft\u0131r.<\/p>\n<p>36. Humpert ve di\u011ferleri\/ Almanya karar\u0131nda A\u0130HM ayr\u0131ca T\u00fcrkiye&#8217;de memurlar\u0131n maa\u015f ve di\u011fer \u00f6zl\u00fck haklar\u0131 konusunda kamudaki di\u011fer s\u00f6zle\u015fmeli \u00e7al\u0131\u015fanlardan \u00f6nemli \u00f6l\u00e7\u00fcde iyi olmad\u0131\u011f\u0131na vurgu yapm\u0131\u015f ve Almanya ile T\u00fcrkiye aras\u0131nda b\u00f6yle bir farkl\u0131l\u0131\u011f\u0131n bulundu\u011fundan s\u00f6z etmi\u015ftir. \u00c7o\u011funluk karar\u0131nda bu konudaki tespitleri bo\u015fa \u00e7\u0131karacak bir de\u011ferlendirmede bulunulmam\u0131\u015ft\u0131r.<\/p>\n<p>37. A\u0130HM Enerji Yap\u0131-Yol Sen\/T\u00fcrkiye karar\u0131nda grev yasa\u011f\u0131na ili\u015fkin o d\u00f6nemde y\u00fcr\u00fcrl\u00fckte olan Genelge&#8217;nin yar\u0131\u015fan menfaatler aras\u0131nda dengeleme yapma konusundaki eksikli\u011fine i\u015faret etmi\u015f ve bunu Humpert ve di\u011ferleri\/Almanya karar\u0131nda da T\u00fcrkiye ile Almanya aras\u0131ndaki farkl\u0131l\u0131klar\u0131 belirtirken kullanm\u0131\u015ft\u0131r. Bu durum dikkate al\u0131nd\u0131\u011f\u0131nda T\u00fcrkiye&#8217;deki sisteme bir b\u00fct\u00fcn olarak bak\u0131lmas\u0131 ve yar\u0131\u015fan menfaatler aras\u0131nda makul bir dengeleme yap\u0131ld\u0131\u011f\u0131n\u0131n ortaya konulmas\u0131 gerekirdi.<\/p>\n<p>38. Ayr\u0131ca A\u0130HM Humpert ve di\u011ferleri\/Almanya karar\u0131nda Almanya&#8217;da Sendikalar\u0131n memurlarla ilgili yasama s\u00fcre\u00e7lerine kat\u0131l\u0131m imkan\u0131na ve maa\u015f d\u00fc\u015f\u00fckl\u00fc\u011f\u00fc iddialar\u0131n\u0131 dava konusu edebilme haklar\u0131na da vurgu yapm\u0131\u015ft\u0131r. T\u00fcrkiye&#8217;de bu imk\u00e2n ve hakk\u0131 dengeleyecek imk\u00e2n ve haklar\u0131n oldu\u011fu ortaya konulmam\u0131\u015ft\u0131r.<\/p>\n<p>39. Milli E\u011fitim Bakan\u0131, \u00f6\u011fretmenlerin n\u00f6bet \u00fccretine ili\u015fkin taleplerinin fark\u0131nda olduklar\u0131na ve bu konuda \u00e7al\u0131\u015fma yapt\u0131klar\u0131na ili\u015fkin a\u00e7\u0131klamas\u0131n\u0131, ba\u015fvurucular\u0131n \u00fcyesi oldu\u011fu sendikan\u0131n 2015 y\u0131l\u0131 \u015fubat ay\u0131nda ald\u0131\u011f\u0131 karardan sonra 2015 y\u0131l\u0131n\u0131n mart ay\u0131nda yapm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla s\u00fcrecin n\u00f6bet tutmama eyleminden \u00f6nce olgunla\u015ft\u0131\u011f\u0131 iddias\u0131 tart\u0131\u015fmaya a\u00e7\u0131kt\u0131r. S\u00fcrecin \u00f6nceki eylemlerle mi yoksa n\u00f6bet tutmama karar\u0131yla m\u0131 olgunla\u015ft\u0131\u011f\u0131 belli de\u011fildir.<\/p>\n<p>40. Ba\u015fvurucu \u00f6\u011fretme, sendikan\u0131n s\u00f6z konusu karar\u0131 \u00fczerine 12 g\u00fcn n\u00f6bet tutmam\u0131\u015ft\u0131r. \u0130dare, kamu hizmetinin yava\u015flama ve aksamas\u0131na y\u00f6nelik somut bir olgu ortaya koyamam\u0131\u015ft\u0131r. E\u011fitim ve \u00f6\u011fretimin kesintisiz s\u00fcrd\u00fcr\u00fclmesine ba\u015fvurucunun eyleminin engel oldu\u011fu idarece ortaya konulamam\u0131\u015ft\u0131r. Bu durum Mahkememizce de dikkate al\u0131nmam\u0131\u015ft\u0131r.<\/p>\n<p>41. T\u00fcm bu hususlar dikkate al\u0131nd\u0131\u011f\u0131nda mevcut ba\u015fvuruda sendika hakk\u0131na yap\u0131lan m\u00fcdahalenin demokratik toplum d\u00fczeninde gerekli ve \u00f6l\u00e7\u00fcl\u00fc oldu\u011fu s\u00f6ylenemez.<\/p>\n<p>42.
