CEVAP<\/p>\n<p>Daval\u0131 vekili davaya cevap vermemi\u015ftir.<\/p>\n<p>III. \u0130LK DERECE MAHKEMES\u0130 KARARI<\/p>\n<p>\u0130lk Derece Mahkemesinin yukar\u0131da tarih ve say\u0131s\u0131 belirtilen karar\u0131 ile harca esas dava de\u011ferinin 40.000.000,00 TL (k\u0131rkmilyon TL) oldu\u011fu, 492 say\u0131l\u0131 Har\u00e7lar Kanunu (492 say\u0131l\u0131 Kanun) uyar\u0131nca yat\u0131r\u0131lmas\u0131 gereken nispi karar ve ilam harc\u0131n\u0131n 2.732.400,00 TL oldu\u011fu, an\u0131lan Kanun&#8217;un 28 inci maddesinin (a) f\u0131kras\u0131 gere\u011fince karar ve ilam harc\u0131n\u0131n 1\/4&#8217;\u00fcn\u00fcn pe\u015fin yat\u0131r\u0131lmas\u0131 gerekti\u011fi, 2.732.400,00 TL\/4=683.100,00 TL pe\u015fin har\u00e7 yat\u0131r\u0131lmas\u0131 gerekirken 853,88 TL pe\u015fin har\u00e7 yat\u0131r\u0131ld\u0131\u011f\u0131, al\u0131nmas\u0131 gerekli 683.100,00 TL pe\u015fin har\u00e7tan, pe\u015fin yat\u0131r\u0131lan 853,88 TL &#8216;nin mahsubu ile bakiye 682.246,12 TL pe\u015fin harc\u0131n eksik yat\u0131r\u0131ld\u0131\u011f\u0131 anla\u015f\u0131ld\u0131\u011f\u0131ndan, davac\u0131 vekiline bakiye 682.246,12 TL pe\u015fin harc\u0131 yat\u0131rmas\u0131 i\u00e7in 6100 say\u0131l\u0131 Hukuk Muhakemeleri Kanunu&#8217;nun (6100 say\u0131l\u0131 Kanun) 120 nci maddesinin birinci ve ikinci f\u0131kras\u0131 gere\u011fince iki haftal\u0131k ihtaratl\u0131 kesin s\u00fcre verildi\u011fi, Mahkemece verilen kesin s\u00fcre i\u00e7erisinde bakiye 682.246,12 TL har\u00e7 yat\u0131r\u0131lmad\u0131\u011f\u0131ndan 20.05.2022 tarihli ara karar ile 10.05.2022 tarihi itibariyle dosyan\u0131n yenileninceye kadar i\u015flemden kald\u0131r\u0131lmas\u0131na karar verildi\u011fi, 10.05.2022 tarihinden itibaren 6100 say\u0131l\u0131 Kanun&#8217;un 150 nci maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131 gere\u011fince \u00fc\u00e7 ayl\u0131k s\u00fcre i\u00e7erisinde bakiye har\u00e7 yat\u0131r\u0131larak dosyan\u0131n yenilenmesine ili\u015fkin talepte bulunulmad\u0131\u011f\u0131, araya adli tatil girmesi nedeniyle 3 ayl\u0131k s\u00fcrenin 08.09.2022 tarihinde doldu\u011fu anla\u015f\u0131ld\u0131\u011f\u0131ndan, 09.09.2022 tarihi itibariyle davan\u0131n a\u00e7\u0131lmam\u0131\u015f say\u0131lmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>IV. \u0130ST\u0130NAF<\/p>\n<p>A. \u0130stinaf Yoluna Ba\u015fvuranlar<\/p>\n<p>\u0130lk Derece Mahkemesinin yukar\u0131da belirtilen karar\u0131na kar\u015f\u0131 s\u00fcresi i\u00e7inde davac\u0131 vekili istinaf ba\u015fvurusunda bulunmu\u015ftur.<\/p>\n<p>B. \u0130stinaf Sebepleri<\/p>\n<p>Davac\u0131 vekili istinaf dilek\u00e7esinde \u00f6zetle; dava konusu edilen Mu\u011fla ili, &#8230;. il\u00e7esi, &#8230; Mah., &#8230; ada, eski 3-4-5-6 parsel (tevhid i\u015fleminden sonra &#8230; ada 20 parsel) say\u0131l\u0131 ana ta\u015f\u0131nmaz \u00fczerinde toplamda 50 adet ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm \u00fczerine payla\u015ft\u0131r\u0131larak tesis edilen 30.01.2015 tarih 1951 yevmiye numaral\u0131 7.000.000,00 TL bedelli ipotek ve 30.01.2015 tarih 1952 yevmiye numaral\u0131 33.000.000,00 TL bedelli ipotekler baz al\u0131narak ve var olmayan ipotekler de dahil edilerek 40.000.000,00 TL \u00fczerinden har\u00e7 hesaplanmas\u0131n\u0131n eri\u015fim hakk\u0131n\u0131n k\u0131s\u0131tlanmas\u0131 niteli\u011finde oldu\u011funu, 93000\/4827000 arsa payl\u0131 A Blok Zemin Kat 3 nolu i\u015fyeri niteli\u011findeki 1 adet ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm \u00fczerinde bulunan ipoteklerin mevcut durumda art\u0131k var olmayan alaca\u011f\u0131n ne kadarl\u0131k bir miktar\u0131n\u0131 g\u00fcvence alt\u0131na ald\u0131\u011f\u0131n\u0131n tespit edilmesi ve bu tespit sonucu 492 say\u0131l\u0131 Kanun uyar\u0131nca tek bir ta\u015f\u0131nmaz i\u00e7in \u00f6denmesi gereken nispi harc\u0131n belirlenip dosyan\u0131n esas\u0131na girilerek yeniden yarg\u0131lama yap\u0131lmak \u00fczere \u0130lk Derece Mahkemesi karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131n\u0131 istemi\u015ftir.<\/p>\n<p>C. Gerek\u00e7e ve Sonu\u00e7<\/p>\n<p>B\u00f6lge Adliye Mahkemesinin yukar\u0131da tarih ve say\u0131s\u0131 belirtilen karar\u0131 ile ta\u015f\u0131nmaz\u0131n resmi senet ve tapu kay\u0131tlar\u0131ndan, kald\u0131r\u0131lmas\u0131 talebinde bulunulan ipotek bedelinin her bir ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm nezdinde 7.000.000,00 TL ve 33.000.000,00 TL olarak tesis olundu\u011fu, davac\u0131n\u0131n tacir olmas\u0131 nedeniyle basiretli davranmakla y\u00fck\u00fcml\u00fc oldu\u011fu, davac\u0131 vekilinin sadece (A) blok zemin kat 3 numaral\u0131 i\u015fyeri niteli\u011findeki ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm y\u00f6n\u00fcnden \u00f6denmesi gereken nispi harc\u0131n belirlenerek davan\u0131n esas\u0131na girilmesi y\u00f6n\u00fcndeki istinaf isteminin yerinde olmad\u0131\u011f\u0131 gerek\u00e7esiyle davac\u0131 vekilinin istinaf ba\u015fvurusunun esastan reddine karar verilmi\u015ftir.<\/p>\n<p>V.
