Taraflar aras\u0131ndaki kadastro tespitine itiraz davas\u0131ndan dolay\u0131, bozma karar\u0131 \u00fczerine direnme yoluyla verilen &#8230; Kadastro Mahkemesinin 28.06.2018 tarihli ve 2018\/5 Esas, 2018\/12 Karar say\u0131l\u0131 karar\u0131n\u0131n bozulmas\u0131na ili\u015fkin Yarg\u0131tay Hukuk Genel Kurulunun 12.07.2023 tarihli ve 2021\/(16)8-379 Esas, 2023\/746 Karar say\u0131l\u0131 karar\u0131n\u0131n karar d\u00fczeltme yoluyla incelenmesi davac\u0131 as\u0131l taraf\u0131ndan verilen dilek\u00e7eyle talep edilmi\u015ftir.<\/p>\n<p>2. Hukuk Genel Kurulunca dilek\u00e7e, d\u00fczeltilmesi istenen karar ve dosyadaki ilgili b\u00fct\u00fcn belgeler okunduktan sonra gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>I. YARGILAMA S\u00dcREC\u0130<\/p>\n<p>Davac\u0131 \u0130stemi<br \/>\n3. Davac\u0131 dava dilek\u00e7esinde; &#8230; ili, &#8230; il\u00e7esi, &#8230; k\u00f6y\u00fcnde yap\u0131lan kadastro tespit \u00e7al\u0131\u015fmalar\u0131 s\u0131ras\u0131nda m\u00fcvekkilinin eklemeli olarak 100 y\u0131l\u0131 a\u015fk\u0131n bir zamand\u0131r zilyet ve tasarrufunda bulunan ta\u015f\u0131nmaz\u0131n Hazine ad\u0131na tespit edildi\u011fini, yap\u0131lan tespitin hatal\u0131 oldu\u011funu ileri s\u00fcrerek kadastro tespitinin iptali ile 102 ada 395 parsel say\u0131l\u0131 ta\u015f\u0131nmaz\u0131n m\u00fcvekkili ad\u0131na tespit ve tesciline karar verilmesini talep etmi\u015ftir.<\/p>\n<p>Daval\u0131 Cevab\u0131<br \/>\n4. Daval\u0131 &#8230; vekili cevap dilek\u00e7esinde; dava konusu ta\u015f\u0131nmaz\u0131n &#8230; niteli\u011fi ile Hazine ad\u0131na tespit g\u00f6rd\u00fc\u011f\u00fcn\u00fc, imar ve ihya durumunun bulunmad\u0131\u011f\u0131n\u0131 ve ta\u015f\u0131nmaz\u0131n tar\u0131ma elveri\u015fli h\u00e2le getirilmedi\u011fini belirterek davan\u0131n reddini savunmu\u015ftur.<\/p>\n<p>Mahkemenin Birinci Karar\u0131<br \/>\n5. &#8230; Kadastro Mahkemesinin 18.06.2010 tarihli ve 2009\/31 Esas, 2010\/38 Karar say\u0131l\u0131 karar\u0131 ile; davac\u0131n\u0131n kendisine verilen s\u00fcre i\u00e7erisinde ke\u015fif giderlerini yat\u0131rmad\u0131\u011f\u0131, dolay\u0131s\u0131yla iddias\u0131n\u0131 kan\u0131tlayamad\u0131\u011f\u0131 gerek\u00e7esiyle davan\u0131n reddine karar verilmi\u015ftir.<\/p>\n<p>\u00d6zel Dairenin Birinci Bozma Karar\u0131<br \/>\n6. &#8230; Kadastro Mahkemesinin yukar\u0131da belirtilen karar\u0131 s\u00fcresi i\u00e7inde davac\u0131 vekili taraf\u0131ndan temyiz edilmi\u015ftir.<\/p>\n<p>7. Yarg\u0131tay (Kapat\u0131lan) 16. Hukuk Dairesinin 03.10.2011 tarihli ve 2010\/7110 Esas, 2011\/5054 Karar say\u0131l\u0131 karar\u0131 ile; &#8220;&#8230;3402 say\u0131l\u0131 Kadastro Kanunu&#8217;nun 36. maddesinin, ispat k\u00fclfeti kendisine d\u00fc\u015fen taraf aleyhine uygulanabilmesi i\u00e7in \u00f6ncelikle dosyan\u0131n ke\u015ffe haz\u0131r hale getirilmesi, bunun i\u00e7in uyu\u015fmazl\u0131\u011f\u0131 niteli\u011fine g\u00f6re taraflardan tan\u0131klar\u0131 ve di\u011fer delillerinin sorulup saptanmas\u0131, dayan\u0131lan kay\u0131tlar varsa celbedilip dosyaya konulmas\u0131, kom\u015fu parsel tutanak ve dayanaklar\u0131n\u0131n getirtilmesi, yerel bilirki\u015fi adaylar\u0131n\u0131n isimlerinin zab\u0131ta arac\u0131l\u0131\u011f\u0131 ile tespit edilmesi gerekir. Dosyan\u0131n ke\u015ffe haz\u0131r hale getirilmesinden sonra belirlenecek ke\u015fif g\u00fcn\u00fc ile ilgili ara karar\u0131nda hakim, katip, m\u00fcba\u015fir, yerel bilirki\u015fi adaylar\u0131, taraf tan\u0131klar\u0131, uzman bilirki\u015filere verilecek \u00fccretler, vas\u0131ta paras\u0131 ve yap\u0131lacak tebligatlarla ilgili masraflar kalemler halinde g\u00f6sterilip, bu \u00fccretlerin temini ve yat\u0131r\u0131lmas\u0131 i\u00e7in ilgililere makul bir s\u00fcre tan\u0131nmal\u0131, ilgiliye tan\u0131nacak s\u00fcre ile ke\u015fif g\u00fcn\u00fc aras\u0131nda bilirki\u015fi adaylar\u0131, taraf tan\u0131klar\u0131 ve uzman bilirki\u015filere \u00e7\u0131kar\u0131lacak davetiyelerin muhatab\u0131na ula\u015fabilmesi i\u00e7in yine uygun bir s\u00fcrenin bulunmas\u0131na \u00f6zen g\u00f6sterilmeli, bu ara karar\u0131na uymaman\u0131n sonu\u00e7lar\u0131, haz\u0131r bulunan davac\u0131lara ihtar edilip, haz\u0131r bulunmayanlara usulen tebli\u011f edilmelidir. Somut olayda; kom\u015fu parsel tutanak ve dayanaklar\u0131 getirtilmemi\u015f, ta\u015f\u0131nmaz\u0131n s\u0131n\u0131r\u0131nda mera parseli bulunmas\u0131 nedeniyle yerel bilirki\u015fi ve tan\u0131klar\u0131n kom\u015fu k\u00f6ylerden se\u00e7ilmesi gerekti\u011fi d\u00fc\u015f\u00fcn\u00fclmeden, ke\u015fif yerinde ayn\u0131 k\u00f6yden isimleri belirlenen be\u015f ki\u015finin haz\u0131r olmas\u0131 kararla\u015ft\u0131r\u0131lm\u0131\u015f oldu\u011fu gibi, mahkemece h\u00fckme dayanak yap\u0131lan ara kararda teknik bilirki\u015filerin ve davac\u0131 tan\u0131klar\u0131n\u0131n ke\u015fif mahallinde haz\u0131r bulunmalar\u0131 i\u00e7in yap\u0131lacak tebligat masraflar\u0131 g\u00f6sterilmemi\u015f ve yerel bilirki\u015filer ile tespit bilirki\u015fileri i\u00e7in tebligat gideri yat\u0131r\u0131lmas\u0131na karar verildi\u011fi halde, ayn\u0131 zamanda bu bilirki\u015filerin ke\u015fif g\u00fcn\u00fc ve saatinde ke\u015fif mahallinde haz\u0131r edilmeleri i\u00e7in il\u00e7e jandarma komutanl\u0131\u011f\u0131na yaz\u0131 yaz\u0131lmas\u0131na karar verilerek kar\u0131\u015f\u0131kl\u0131k yarat\u0131lm\u0131\u015ft\u0131r. Hal b\u00f6yle olunca, dosya ke\u015ffe haz\u0131r hale getirilmeden ke\u015fif karar\u0131 verilmesi isabetsiz oldu\u011fu gibi, bir an i\u00e7in ke\u015fif karar\u0131n\u0131n yerinde oldu\u011funun kabul edilmesi halinde dahi, a\u00e7\u0131klanan nedenlerle usul\u00fcne uygun olmayan ara karar\u0131na dayan\u0131larak verilen kesin s\u00fcreye uyulmamas\u0131 nedeniyle ke\u015fif delilinden vazge\u00e7ildi\u011fi kabul edilerek davan\u0131n reddine karar verilmi\u015f olmas\u0131 da isabetsiz&#8230;&#8221; oldu\u011fu gerek\u00e7esiyle karar bozulmu\u015ftur.<\/p>\n<p>Mahkemenin \u0130kinci Karar\u0131<br \/>\n8. &#8230; Kadastro Mahkemesinin 20.07.2012 tarihli ve 2012\/5 Esas, 2012\/35 Karar say\u0131l\u0131 karar\u0131 ile bozma karar\u0131na uyularak yap\u0131lan yarg\u0131lama sonucu; dava konusu ta\u015f\u0131nmaz\u0131n kadastro \u00e7al\u0131\u015fmalar\u0131 esnas\u0131nda &#8230; vasf\u0131 ile tespit edildi\u011fi, yap\u0131lan ke\u015fif sonucunda ta\u015f\u0131nmaz \u00fczerinde uzunlu\u011fu 50 cm olan otlar g\u00f6r\u00fcld\u00fc\u011f\u00fc, ta\u015f\u0131nmaz\u0131n d\u00fcz say\u0131labilecek bir alanda bulundu\u011fu ve kom\u015fu \u015fah\u0131s arazileri ile ayn\u0131 mahiyette oldu\u011fu, bu ta\u015f\u0131nmaz\u0131n iki hududunda bulunan mera parselinin daha \u00e7ok y\u00fcksek alanlara do\u011fru uzanan, da\u011fl\u0131k ve engebeli, bitki \u00f6rt\u00fcs\u00fcn\u00fcn tamamen yok oldu\u011fu alanlara tekab\u00fcl etti\u011fi, dava konusu ta\u015f\u0131nmaz\u0131n gerek bitki \u00f6rt\u00fcs\u00fc gerek toprak yap\u0131s\u0131 itibariyle mera vas\u0131fl\u0131 ta\u015f\u0131nmazdan ayr\u0131ld\u0131\u011f\u0131, ke\u015fif esnas\u0131nda dinlenen mahalli ve tespit bilirki\u015fileri davac\u0131n\u0131n karde\u015fiyle aralar\u0131nda 1999 y\u0131l\u0131nda harici taksim yapt\u0131klar\u0131n\u0131 ve o tarihten beri davac\u0131n\u0131n ta\u015f\u0131nmaz\u0131 ot bi\u00e7tirerek s\u00fcrekli kulland\u0131\u011f\u0131n\u0131 beyan ettikleri, ke\u015fif esnas\u0131nda davac\u0131n\u0131n da Kocaeli ilinde ikamet etti\u011fini ancak &#8230; k\u00f6y\u00fcnde b\u00fcy\u00fckba\u015f hayvan\u0131n\u0131n bulundu\u011funu, ta\u015f\u0131nmazdaki otlar\u0131 bi\u00e7tirerek hayvanlar\u0131na yedirdi\u011fini, ta\u015f\u0131nmaz\u0131 yakla\u015f\u0131k 13 senedir bahsetti\u011fi \u015fekilde kulland\u0131\u011f\u0131n\u0131 beyan etti\u011fi, \u00f6ncesinde de ta\u015f\u0131nmaz\u0131n davac\u0131n\u0131n anne, baba ve atalar\u0131n\u0131n zilyetli\u011finde bulundu\u011funun mahalli bilirki\u015filerle tespit bilirki\u015fisinin beyanlar\u0131ndan anla\u015f\u0131ld\u0131\u011f\u0131, yap\u0131lan ke\u015fifte davac\u0131n\u0131n dayand\u0131\u011f\u0131 tapu kayd\u0131n\u0131n dava konusu yere ait oldu\u011funun anla\u015f\u0131ld\u0131\u011f\u0131 gerek\u00e7esi ile davan\u0131n kabul\u00fcne, dava konusu ta\u015f\u0131nmaz\u0131n daval\u0131 &#8230; ad\u0131na yap\u0131lan tespitinin iptali ile kadastro tespit tutana\u011f\u0131nda belirtilen miktar, \u00f6l\u00e7\u00fc ve vas\u0131f ile davac\u0131 ad\u0131na tapuya kay\u0131t ve tesciline karar verilmi\u015ftir.<\/p>\n<p>\u00d6zel Dairenin \u0130kinci Bozma Karar\u0131<br \/>\n9. &#8230; Kadastro Mahkemesinin yukar\u0131da belirtilen karar\u0131 s\u00fcresi i\u00e7inde daval\u0131 &#8230; vekili taraf\u0131ndan temyiz edilmi\u015ftir.<\/p>\n<p>10. Yarg\u0131tay (Kapat\u0131lan) 16. Hukuk Dairesinin 17.12.2012 tarihli ve 2012\/8393 Esas, 2012\/10855 Karar say\u0131l\u0131 karar\u0131 ile; &#8220;&#8230;Mahkemece davac\u0131 dayana\u011f\u0131 tapu kayd\u0131n\u0131n dava konusu ta\u015f\u0131nmaz\u0131 kapsad\u0131\u011f\u0131, \u00e7eki\u015fmeli ta\u015f\u0131nmaz\u0131n devletin h\u00fck\u00fcm ve tasarrufu alt\u0131nda bulunan mera niteli\u011findeki yerlerden olmad\u0131\u011f\u0131 kabul edilmek suretiyle h\u00fck\u00fcm kurulmu\u015f ise de; yap\u0131lan ara\u015ft\u0131rma ve uygulama h\u00fck\u00fcm kurmaya yeterli bulunmamaktad\u0131r. Davac\u0131 ile dayana\u011f\u0131 tapu kayd\u0131n\u0131n malikleri aras\u0131ndaki akti veya \u0131rsi ili\u015fkinin bulunup bulunmad\u0131\u011f\u0131 ara\u015ft\u0131r\u0131lmam\u0131\u015f, dayanak tapu kayd\u0131n\u0131n gayri sabit s\u0131n\u0131rl\u0131 olmas\u0131 nedeniyle miktar\u0131yla ge\u00e7erli olaca\u011f\u0131 dikkate al\u0131n\u0131p kapsam\u0131 buna g\u00f6re tayin edilmemi\u015f, s\u0131n\u0131r\u0131nda mera bulunmas\u0131na ra\u011fmen y\u00f6ntemince mera ara\u015ft\u0131rmas\u0131 yap\u0131lmam\u0131\u015ft\u0131r. Sa\u011fl\u0131kl\u0131 sonuca varabilmek i\u00e7in davac\u0131n\u0131n dayanak tapu kayd\u0131nda adlar\u0131 ge\u00e7en ki\u015filerle akti veya irsi ili\u015fkileri belirlenmeli, mahallinde ya\u015fl\u0131, tarafs\u0131z, y\u00f6reyi iyi bilen, davada yarar\u0131 bulunmayan kom\u015fu k\u00f6ylerde ikamet eden \u015fah\u0131slar aras\u0131ndan se\u00e7ilecek yerel bilirki\u015filerle ve ayn\u0131 y\u00f6nteme g\u00f6re tespit edilecek taraf tan\u0131klar\u0131, fen ve \u00fc\u00e7 ki\u015filik ziraat m\u00fchendisleri kurulu huzuruyla ke\u015fif icra edilmelidir. Ke\u015fif s\u0131ras\u0131nda dayan\u0131lan tapu kayd\u0131n\u0131n gayri sabit s\u0131n\u0131rl\u0131 olmas\u0131 nedeniyle kapsam\u0131n\u0131n miktar\u0131 ile ge\u00e7erli olaca\u011f\u0131 dikkate al\u0131narak uygulan\u0131p kapsam\u0131 belirlenmeli, bilirki\u015filerce g\u00f6sterilemeyen s\u0131n\u0131rlar i\u00e7in taraflara tan\u0131k dinletme imkan\u0131 sa\u011flanmal\u0131, bilirki\u015fi ve tan\u0131klardan ta\u015f\u0131nmaz\u0131n ilk maliki, intikali ve tasarrufu hususlar\u0131nda maddi olaylara dayal\u0131 ayr\u0131nt\u0131l\u0131 bilgi al\u0131nmal\u0131, teknik bilirki\u015fiye uygulanan tapu kayd\u0131n\u0131n kapsam\u0131n\u0131 belirtir ve ke\u015ffi takibe imkan verir kroki d\u00fczenlettirilmelidir. Tapu kayd\u0131n\u0131n \u00e7eki\u015fmeli ta\u015f\u0131nmaz\u0131 kapsad\u0131\u011f\u0131n\u0131n anla\u015f\u0131lmas\u0131 halinde ayn\u0131 kay\u0131t kapsam\u0131nda kalan ta\u015f\u0131nmazlar\u0131n tutanak \u00f6rnekleri getirtilerek ak\u0131betleri ara\u015ft\u0131r\u0131lmal\u0131d\u0131r. \u00c7eki\u015fmeli ta\u015f\u0131nmaz\u0131n, tapu kayd\u0131n\u0131n miktar\u0131na g\u00f6re kapsam\u0131nda kalmad\u0131\u011f\u0131n\u0131n anla\u015f\u0131lmas\u0131 halinde ise; s\u0131n\u0131r\u0131nda mera bulundu\u011fundan \u00f6ncesinin mera olup olmad\u0131\u011f\u0131, ta\u015f\u0131nmaz\u0131n devletin h\u00fck\u00fcm ve tasarrufu alt\u0131nda bulunan yerlerden olmas\u0131 halinde imar ve ihyaya konu edilip edilmedi\u011fi, imar ve ihyaya konu edilmi\u015f ise ihyan\u0131n hangi tarihte ba\u015flay\u0131p ne zaman bitirildi\u011fi yerel bilirki\u015fi ve tan\u0131klara etrafl\u0131ca sorulup maddi olaylara dayal\u0131 olarak a\u00e7\u0131klatt\u0131r\u0131lmal\u0131, yerel bilirki\u015fi ve tan\u0131k s\u00f6zleri kom\u015fu parsel tutanak ve dayanaklar\u0131 ile denetlenmeli, \u00fc\u00e7 ki\u015filik uzman ziraat m\u00fchendislerinden olu\u015fan bilirki\u015fi kurulundan ta\u015f\u0131nmaz\u0131n niteli\u011fiyle ilgili ayr\u0131nt\u0131l\u0131 ve gerek\u00e7eli rapor al\u0131narak bundan sonra t\u00fcm deliller birlikte de\u011ferlendirilerek sonucuna g\u00f6re karar verilmelidir. Yarg\u0131tay (Kapat\u0131lan) 16. Hukuk Dairesinin 09.02.2018 tarihli ve 2015\/20884 Esas, 2018\/748 Karar say\u0131l\u0131 karar\u0131 ile; &#8220;&#8230;Mahkemece davac\u0131n\u0131n dayana\u011f\u0131 tapu kayd\u0131n\u0131n ta\u015f\u0131nmaz\u0131 kapsad\u0131\u011f\u0131 gerek\u00e7esi ile yaz\u0131l\u0131 \u015fekilde h\u00fck\u00fcm kurulmu\u015ftur. Ne var ki, tapu kayd\u0131n\u0131n gayri sabit s\u0131n\u0131rl\u0131 oldu\u011fu \u00f6nceki bozma ilam\u0131nda da belirtilmi\u015f olup, kay\u0131t kapsam\u0131 miktar\u0131 ile de\u011ferlendirildi\u011finde uygulanan tapu kayd\u0131n\u0131n sabit say\u0131labilecek Saza yolundan itibaren ta\u015f\u0131nmaz\u0131n bulundu\u011fu yere ula\u015fma imkan\u0131 olmay\u0131p, bu nedenle ta\u015f\u0131nmaz\u0131n kay\u0131t kapsam\u0131nda kald\u0131\u011f\u0131n\u0131n kabul\u00fcne imkan bulunmamaktad\u0131r. Yarg\u0131tay Hukuk Genel Kurulunun 12.07.2023 tarihli ve 2021\/(16)8-379 Esas, 2023\/746 Karar say\u0131l\u0131 karar\u0131 ile;<\/p>\n<p>&#8220;&#8230;26. Yap\u0131lan a\u00e7\u0131klamalar \u0131\u015f\u0131\u011f\u0131nda somut olay incelendi\u011finde, 07.01.2009 tarihinde yap\u0131lan kadastro \u00e7al\u0131\u015fmalar\u0131 s\u0131ras\u0131nda &#8230; ili, &#8230; il\u00e7esi, &#8230; k\u00f6y\u00fc, &#8230; mevkinde bulunan dava konusu 102 ada 395 parsel say\u0131l\u0131 ta\u015f\u0131nmaz\u0131n 89.282,00 m2 y\u00fcz\u00f6l\u00e7\u00fcm\u00fcnde, belgesizden, &#8230; vasf\u0131 ile &#8230; &#8230; k\u0131z\u0131 &#8230; &#8230;&#8217;\u0131n zilyet ve tasarrufunda bulundu\u011fu, ad\u0131 ge\u00e7enin ayn\u0131 \u00e7al\u0131\u015fma alan\u0131nda kuru arazide edindi\u011fi ta\u015f\u0131nmaz miktar\u0131n\u0131n 100 d\u00f6n\u00fcm\u00fc ge\u00e7ti\u011fi belirtilerek Hazine ad\u0131na tespit edildi\u011fi, tutana\u011f\u0131n ask\u0131 ilan\u0131na \u00e7\u0131kar\u0131lmas\u0131ndan sonra davac\u0131 taraf\u0131ndan zilyetlik sebebine dayal\u0131 olarak eldeki davan\u0131n a\u00e7\u0131ld\u0131\u011f\u0131 g\u00f6r\u00fclm\u00fc\u015f, yarg\u0131laman\u0131n devam\u0131 s\u0131ras\u0131nda ise davac\u0131n\u0131n bu yere ait dedesi ad\u0131na tapu kayd\u0131n\u0131n bulundu\u011funu ve dava konusu ta\u015f\u0131nmaz \u00fczerindeki zilyetli\u011finin eklemeli olarak 100 y\u0131la yak\u0131n oldu\u011funu ileri s\u00fcrd\u00fc\u011f\u00fc anla\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>27. \u00d6ncelikle davac\u0131n\u0131n dayand\u0131\u011f\u0131 1943 tarihli, cilt no 30, sayfa 89, s\u0131ra 1&#8217;de kay\u0131tl\u0131 tapu kayd\u0131n\u0131n gayri sabit s\u0131n\u0131rl\u0131 olmas\u0131 nedeniyle kapsam\u0131n\u0131n miktar\u0131 ile ge\u00e7erli olaca\u011f\u0131 dikkate al\u0131narak uygulan\u0131p kapsam\u0131 belirlenmelidir. Buna g\u00f6re uygulanan tapu kayd\u0131 1.000 d\u00f6n\u00fcm olup, Saza yoluna kom\u015fu parsellerin miktar\u0131 dikkate al\u0131nd\u0131\u011f\u0131nda tapu kayd\u0131n\u0131n sabit say\u0131labilecek Saza yolundan itibaren dava konusu ta\u015f\u0131nmaz\u0131n bulundu\u011fu yere ula\u015fma imk\u00e2n\u0131 olmay\u0131p, bu nedenle ta\u015f\u0131nmaz\u0131n kay\u0131t kapsam\u0131nda kald\u0131\u011f\u0131n\u0131n kabul\u00fcne imk\u00e2n bulunmamaktad\u0131r. Di\u011fer taraftan, davac\u0131 dava dilek\u00e7esinde dava konusu 102 ada 395 parsel say\u0131l\u0131 ta\u015f\u0131nmaz \u00fczerindeki zilyetli\u011finin eklemeli olarak 100 y\u0131la yak\u0131n oldu\u011funu ileri s\u00fcrerek ad\u0131na tesciline karar verilmesini talep etmi\u015f ise de 03.07.2012 tarihinde yap\u0131lan ke\u015fifte karde\u015fleri ile yapt\u0131\u011f\u0131 taksim sonucu dava konusu ta\u015f\u0131nmaz\u0131n kendisine d\u00fc\u015ft\u00fc\u011f\u00fcn\u00fc, 02.06.2015 tarihinde yap\u0131lan ke\u015fifte ise bu yerin babas\u0131 taraf\u0131ndan kendisine ba\u011f\u0131\u015fland\u0131\u011f\u0131n\u0131 beyan etmi\u015ftir. Kadastro tutana\u011f\u0131na g\u00f6re ta\u015f\u0131nmaz miktar fazlas\u0131 olarak daval\u0131 &#8230; ad\u0131na tespit edilmi\u015f olup, dosya kapsam\u0131na g\u00f6re davac\u0131n\u0131n ta\u015f\u0131nmaz \u00fczerinde ekonomik amaca uygun zilyetli\u011finin bulunmad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Yine ke\u015fif esnas\u0131nda \u00e7ekilen foto\u011fraflardan ta\u015f\u0131nmaza biti\u015fik mera parseli ile aras\u0131nda ay\u0131r\u0131c\u0131 bir unsur bulunmad\u0131\u011f\u0131 da g\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>28. Hukuk Genel Kurulunda yap\u0131lan g\u00f6r\u00fc\u015fmeler s\u0131ras\u0131nda; davac\u0131n\u0131n dayand\u0131\u011f\u0131 tapu kayd\u0131n\u0131n dava konusu yeri de i\u00e7ine alacak \u015fekilde geni\u015f bir alan\u0131 kapsad\u0131\u011f\u0131, mera parseli ile dava konusu yer aras\u0131nda bulunan kuru derenin ay\u0131r\u0131c\u0131 unsur oldu\u011fu ve davac\u0131n\u0131n ekonomik amaca uygun zilyetli\u011finin de bulundu\u011fu, a\u00e7\u0131klanan sebeplerle direnme karar\u0131n\u0131n onanmas\u0131 gerekti\u011fi g\u00f6r\u00fc\u015f\u00fc ileri s\u00fcr\u00fclm\u00fc\u015f ise de bu g\u00f6r\u00fc\u015f Kurul \u00e7o\u011funlu\u011funca benimsenmemi\u015ftir.<\/p>\n<p>29. H\u00e2l b\u00f6yle olunca, taraflar\u0131n kar\u015f\u0131l\u0131kl\u0131 iddia ve savunmalar\u0131na, dosyadaki tutanak ve kan\u0131tlara, bozma karar\u0131nda a\u00e7\u0131klanan gerektirici nedenlere ve \u00f6zellikle uygulanan tapu kayd\u0131n\u0131n Saza yolundan itibaren ta\u015f\u0131nmaz\u0131n bulundu\u011fu yere ula\u015fma imk\u00e2n\u0131 olmay\u0131p, bu nedenle ta\u015f\u0131nmaz\u0131n bu tapu kayd\u0131 kapsam\u0131nda kald\u0131\u011f\u0131n\u0131n kabul\u00fcne imk\u00e2n bulunmad\u0131\u011f\u0131, mera parseli ile arada ay\u0131r\u0131c\u0131 bir unsur olmad\u0131\u011f\u0131 gibi ta\u015f\u0131nmaz\u0131n konumu ve eylemli durumu itibar\u0131yla ve dosyaya ekli foto\u011fraflara g\u00f6re \u00fczerinde ekonomik amaca uygun zilyetli\u011fin de bulunmad\u0131\u011f\u0131 anla\u015f\u0131ld\u0131\u011f\u0131ndan Hukuk Genel Kurulunca da benimsenen \u00d6zel Daire bozma karar\u0131na uyulmas\u0131 gerekirken \u00f6nceki h\u00fck\u00fcmde direnilmesi do\u011fru olmam\u0131\u015ft\u0131r.<\/p>\n<p>30. Bu nedenle direnme karar\u0131 bozulmal\u0131d\u0131r&#8230;&#8221; gerek\u00e7esiyle karar oy \u00e7oklu\u011fuyla bozulmu\u015ftur.<\/p>\n<p>Hukuk Genel Kurulu Karar\u0131na Kar\u015f\u0131 Karar D\u00fczeltme \u0130stemi<br \/>\n17. Hukuk Genel Kurulu karar\u0131na kar\u015f\u0131 s\u00fcresi i\u00e7inde davac\u0131 as\u0131l karar d\u00fczeltme isteminde bulunmu\u015ftur.<\/p>\n<p>II. UYU\u015eMAZLIK<\/p>\n<p>18. Direnme yolu ile Hukuk Genel Kurulu \u00f6n\u00fcne gelen uyu\u015fmazl\u0131k; kadastro tespitine itiraz istemli eldeki davada, davac\u0131n\u0131n dayand\u0131\u011f\u0131 eski tarihli tapu kayd\u0131n\u0131n dava konusu ta\u015f\u0131nmaz\u0131 kapsay\u0131p kapsamad\u0131\u011f\u0131, davac\u0131n\u0131n ekonomik amaca uygun zilyetli\u011finin bulunup bulunmad\u0131\u011f\u0131, buradan var\u0131lacak sonuca g\u00f6re davan\u0131n reddine karar verilmesinin gerekip gerekmedi\u011fi noktas\u0131nda toplanmaktad\u0131r.<\/p>\n<p>III. GEREK\u00c7E<\/p>\n<p>19. Uyu\u015fmazl\u0131\u011f\u0131n \u00e7\u00f6z\u00fcm\u00fc i\u00e7in \u00f6ncelikle konuya ili\u015fkin yasal d\u00fczenlemeler ile hukuki kavramlar\u0131n ortaya konulmas\u0131nda yarar vard\u0131r.<\/p>\n<p>20. 3402 say\u0131l\u0131 Kadastro Kanunu&#8217;nun (3402 say\u0131l\u0131 Kanun) 20 nci maddesinde kay\u0131t ve belgelerin kapsam\u0131n\u0131n ne \u015fekilde tayin edilece\u011fi d\u00fczenlenmi\u015ftir. Kanun&#8217;un 20\/A maddesine g\u00f6re tapu kay\u0131tlar\u0131n\u0131n kapsad\u0131\u011f\u0131 yer tayin edilirken, tapu kay\u0131tlar\u0131 ve belgeler, harita, plan ve krokiye dayanmakta ve bunlar\u0131n yerlerine uygulanmas\u0131 m\u00fcmk\u00fcn bulunmakta ise harita, plan ve krokideki s\u0131n\u0131rlara itibar olunaca\u011f\u0131; 20\/B maddesinde harita, plan ve krokiye dayanmayan kay\u0131t ve belgelerde belirtilen s\u0131n\u0131rlar mahalline uygulanabiliyor ve bu s\u0131n\u0131rlar i\u00e7inde kalan yer hak sahibi taraf\u0131ndan kullan\u0131l\u0131yor ise s\u0131n\u0131r yerlerine itibar edilerek kapsam\u0131n\u0131n belirlenece\u011fi h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>21. 3402 say\u0131l\u0131 Kanun&#8217;un 20\/C maddesi h\u00fckm\u00fcne g\u00f6re; &#8220;Harita, plan ve krokiye dayanmayan kay\u0131t ve belgelerde belirtilen s\u0131n\u0131rlar, de\u011fi\u015febilir ve geni\u015fletilmeye elveri\u015fli nitelikte ise, bunlarda g\u00f6sterilen miktara itibar olunur. Ancak de\u011fi\u015febilir ve geni\u015fletilmeye elveri\u015fli s\u0131n\u0131rlardaki ta\u015f\u0131nmaz mallar\u0131n kay\u0131tlar\u0131, fizik yap\u0131lar\u0131 ve konumlar\u0131 itibariyle belli bir yeri kaps\u0131yorsa, tespit o s\u0131n\u0131r esas al\u0131narak yap\u0131l\u0131r&#8221; \u015feklindedir. Ger\u00e7ekten de belgenin birbiri ile ba\u011flant\u0131s\u0131z, de\u011fi\u015fmeye ve geni\u015fletilmeye elveri\u015fli s\u0131n\u0131rlar\u0131 g\u00f6stermesi h\u00e2linde kay\u0131tlar\u0131n kapsam\u0131n\u0131n miktar\u0131na g\u00f6re belirlenmesi gerekmektedir. Di\u011fer bir deyi\u015fle; tapu kayd\u0131 sabit s\u0131n\u0131rl\u0131 de\u011filse kay\u0131t \u00fczerinde yaz\u0131l\u0131 olan miktar kadar ge\u00e7erlidir ve kapsam\u0131 da bu miktara e\u015fit \u015fekilde tayin edilmelidir.<\/p>\n<p>22. Bu a\u00e7\u0131klamalardan sonra zilyetlikle kazanma olgusu y\u00f6n\u00fcnden de bir tak\u0131m a\u00e7\u0131klamalar yap\u0131lmas\u0131 gerekmektedir.<\/p>\n<p>23. 3402 say\u0131l\u0131 Kanun&#8217;un &#8220;Tapuda kay\u0131tl\u0131 olmayan ta\u015f\u0131nmaz mallar\u0131n tespiti&#8221; ba\u015fl\u0131kl\u0131 14 \u00fcnc\u00fc maddesinde;<br \/>\n&#8220;Tapuda kay\u0131tl\u0131 olmayan ve ayn\u0131 \u00e7al\u0131\u015fma alan\u0131 i\u00e7inde bulunan ve toplam y\u00fcz\u00f6l\u00e7\u00fcm\u00fc sulu toprakta 40, kuru toprakta 100 d\u00f6n\u00fcme kadar olan (40 ve 100 d\u00f6n\u00fcm dahil) bir veya birden fazla ta\u015f\u0131nmaz mal, \u00e7eki\u015fmesiz ve aral\u0131ks\u0131z en az yirmi y\u0131ldan beri malik s\u0131fat\u0131yla zilyetli\u011fini belgelerle veya bilirki\u015fi veyahut tan\u0131k beyanlar\u0131yla ispat eden zilyedi ad\u0131na tespit edilir&#8230;&#8221; h\u00fckm\u00fc yer almaktad\u0131r.<\/p>\n<p>24. A\u00e7\u0131klanan Kanun h\u00fckm\u00fcne g\u00f6re, ola\u011fan\u00fcst\u00fc zamana\u015f\u0131m\u0131 yolu ile ta\u015f\u0131nmaz m\u00fclkiyetinin kazan\u0131lmas\u0131na ili\u015fkin temel ko\u015fullar\u0131n 3402 say\u0131l\u0131 Kanun&#8217;un 14 \u00fcnc\u00fc maddesinde h\u00fck\u00fcm alt\u0131na al\u0131nd\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. Buna g\u00f6re; tapuda kay\u0131tl\u0131 olmayan bir ta\u015f\u0131nmaz\u0131 aral\u0131ks\u0131z ve nizas\u0131z yirmi y\u0131ll\u0131k s\u00fcreyle malik s\u0131fat\u0131 ile elinde bulunduran ve zilyedi olan ki\u015fi, ta\u015f\u0131nmaz\u0131n kendi m\u00fclk\u00fc olmak \u00fczere ad\u0131na tescilini talep edebilir.<\/p>\n<p>25. Uygulama ve teorideki a\u00e7\u0131klamalara g\u00f6re 3402 say\u0131l\u0131 Kanun&#8217;un 14 \u00fcnc\u00fc maddesinde h\u00fck\u00fcm alt\u0131na al\u0131nan ko\u015fullar\u0131, ta\u015f\u0131nmaza ili\u015fkin ko\u015fullar ve zilyetli\u011fe ili\u015fkin ko\u015fullar olarak ikiye ay\u0131rmak m\u00fcmk\u00fcnd\u00fcr. Tapuda kay\u0131tl\u0131 olmayan ta\u015f\u0131nmazlar\u0131n zamana\u015f\u0131m\u0131na dayan\u0131larak kazan\u0131labilmesi i\u00e7in ta\u015f\u0131nmaz\u0131n \u00f6zel m\u00fclkiyete elveri\u015fli olmas\u0131, zamana\u015f\u0131m\u0131 ile kazan\u0131lmas\u0131n\u0131 yasaklayan bir kanun h\u00fckm\u00fcn\u00fcn bulunmamas\u0131 ve ta\u015f\u0131nmaz\u0131n kanunlar uyar\u0131nca Devlete kalan ta\u015f\u0131nmazlardan olmamas\u0131 gerekir. Ta\u015f\u0131nmaz \u00fczerinde s\u00fcrd\u00fcr\u00fclmesi gerekli olan zilyetli\u011fin ise malik s\u0131fat\u0131 ile aral\u0131ks\u0131z ve nizas\u0131z ve yirmi y\u0131ll\u0131k s\u00fcreyle olmas\u0131 gereklidir.<\/p>\n<p>26. 3402 say\u0131l\u0131 Kanun&#8217;un 14 \u00fcnc\u00fc maddesinde kazand\u0131r\u0131c\u0131 zamana\u015f\u0131m\u0131 zilyetli\u011finin s\u00fcresi \u00e7eki\u015fmesiz ve aral\u0131ks\u0131z yirmi y\u0131l olarak kabul edilmi\u015ftir. Kazanmay\u0131 sa\u011flayan zilyetli\u011fin lehine olan taraf\u00e7a kan\u0131tlanmas\u0131 gerekir. Maddi olaylardan olan zilyetlik her t\u00fcrl\u00fc delille kan\u0131tlanabilir.<\/p>\n<p>27. Yap\u0131lan a\u00e7\u0131klamalar \u0131\u015f\u0131\u011f\u0131nda somut olay incelendi\u011finde, 07.01.2009 tarihinde yap\u0131lan kadastro \u00e7al\u0131\u015fmalar\u0131 s\u0131ras\u0131nda &#8230; ili, &#8230; il\u00e7esi, &#8230; k\u00f6y\u00fc, &#8230; mevkinde bulunan dava konusu 102 ada 395 parsel say\u0131l\u0131 ta\u015f\u0131nmaz\u0131n 89.282,00 m2 y\u00fcz\u00f6l\u00e7\u00fcm\u00fcnde, belgesizden, &#8230; vasf\u0131 ile &#8230; &#8230; k\u0131z\u0131 &#8230; &#8230;&#8217;\u0131n zilyet ve tasarrufunda bulundu\u011fu, ad\u0131 ge\u00e7enin ayn\u0131 \u00e7al\u0131\u015fma alan\u0131nda kuru arazide edindi\u011fi ta\u015f\u0131nmaz miktar\u0131n\u0131n 100 d\u00f6n\u00fcm\u00fc ge\u00e7ti\u011fi belirtilerek Hazine ad\u0131na tespit edildi\u011fi, tutana\u011f\u0131n ask\u0131 ilan\u0131na \u00e7\u0131kar\u0131lmas\u0131ndan sonra davac\u0131 taraf\u0131ndan zilyetlik sebebine dayal\u0131 olarak eldeki davan\u0131n a\u00e7\u0131ld\u0131\u011f\u0131 g\u00f6r\u00fclm\u00fc\u015f, yarg\u0131laman\u0131n devam\u0131 s\u0131ras\u0131nda ise davac\u0131n\u0131n bu yere ait dedesi ad\u0131na tapu kayd\u0131n\u0131n bulundu\u011funu ve dava konusu ta\u015f\u0131nmaz \u00fczerindeki zilyetli\u011finin eklemeli olarak 100 y\u0131la yak\u0131n oldu\u011funu ileri s\u00fcrd\u00fc\u011f\u00fc anla\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>28. Mahkemece 03.07.2012 tarihli ke\u015fif s\u0131ras\u0131nda yap\u0131lan g\u00f6zlemde; dava konusu ta\u015f\u0131nmaz\u0131n \u00fczerinde yakla\u015f\u0131k 50 cm uzunlu\u011funda otlar\u0131n bulundu\u011fu, d\u00fcz bir alanda oldu\u011fu, toprak yap\u0131s\u0131, e\u011fim durumu, bitki \u00f6rt\u00fcs\u00fc a\u00e7\u0131s\u0131ndan \u015fah\u0131s arazileri ile ayn\u0131 mahiyette oldu\u011fu, mera parseli ile aras\u0131nda bariz bir e\u011fim fark\u0131n\u0131n bulundu\u011fu, mera vas\u0131fl\u0131 arazinin da\u011f\u0131n yama\u00e7lar\u0131na do\u011fru uzand\u0131\u011f\u0131, y\u00fcksek yerlerde oldu\u011fu, bitki \u00f6rt\u00fcs\u00fcn\u00fcn tamamen yok oldu\u011fu, dava konusu ta\u015f\u0131nmaz\u0131n ise kom\u015fular\u0131 konumunda bulunan \u015fah\u0131s arazileri ile ayn\u0131 bitki \u00f6rt\u00fcs\u00fc ve toprak yap\u0131s\u0131na sahip oldu\u011fu hususunun zapta ge\u00e7irildi\u011fi anla\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>29. 03.07.2012 tarihinde yap\u0131lan ke\u015fifte beyanlar\u0131 al\u0131nan mahalli ve tespit bilirki\u015fileri ise dava konusu ta\u015f\u0131nmaz\u0131n davac\u0131ya ait oldu\u011funu, ona atalar\u0131ndan kald\u0131\u011f\u0131n\u0131, annesi 1999 y\u0131l\u0131nda Fransa&#8217;ya g\u00f6\u00e7 edince ta\u015f\u0131nmaz\u0131n o tarihten beri davac\u0131n\u0131n kullan\u0131m\u0131 ve tasarrufunda bulundu\u011funu beyan etmi\u015flerdir.<\/p>\n<p>30. Mahallinde 03.07.2012 tarihinde yap\u0131lan ke\u015fif sonras\u0131 al\u0131nan 09.07.2012 tarihli fen bilirki\u015fi raporunda davac\u0131n\u0131n dayand\u0131\u011f\u0131 1943 tarihli, cilt no 30, sayfa 89, s\u0131ra 1&#8217;de kay\u0131tl\u0131 tapu kayd\u0131n\u0131n mevkii ve hudutlar\u0131 itibari ile mahalli bilirki\u015filerin yer g\u00f6sterme ve beyanlar\u0131na g\u00f6re dava konusu 102 ada 395 say\u0131l\u0131 parsel ile birlikte \u00e7ok b\u00fcy\u00fck bir alan\u0131 kapsad\u0131\u011f\u0131, 10.07.2012 tarihli ziraat bilirki\u015fi raporunda ise dava konusu ta\u015f\u0131nmaz\u0131n do\u011fusu ve g\u00fcneyinde mera parseli, kuzeyi ve bat\u0131s\u0131nda &#8230; vas\u0131fl\u0131 parsellerle \u00e7evrili oldu\u011fu, kuzeyi ve bat\u0131s\u0131nda yer alan kom\u015fu parselleri ile ayn\u0131 \u00f6zellikleri ta\u015f\u0131d\u0131\u011f\u0131 ve h\u00e2li haz\u0131rda &#8230; vasf\u0131yla kullan\u0131ld\u0131\u011f\u0131, toprak yap\u0131s\u0131, co\u011frafi yap\u0131 ve bitki \u00f6rt\u00fcs\u00fc a\u00e7\u0131s\u0131ndan \u00f6zel m\u00fclkiyet kullan\u0131m ve tasarrufunda olan &#8230; vasf\u0131 ta\u015f\u0131yan tar\u0131m arazisi oldu\u011fu belirtilmi\u015ftir.<\/p>\n<p>31. Mahkemece 02.06.2015 tarihli ke\u015fifte yap\u0131lan g\u00f6zlemde; dava konusu 102 ada 395 parsel say\u0131l\u0131 ta\u015f\u0131nmaz\u0131n bat\u0131s\u0131nda 182 say\u0131l\u0131 parsel, g\u00fcneyinde k\u0131smen 201 say\u0131l\u0131 parsel, kuzeyinde k\u0131smen 156 say\u0131l\u0131 parselin bulundu\u011fu, kuzeyinde, do\u011fusunda ve g\u00fcneyinde ta\u015f\u0131nmaz\u0131n s\u0131n\u0131rlar\u0131 ile beraber uzanan dere oldu\u011fu, bu derenin aktif dere olmay\u0131p h\u00e2len kuru dere oldu\u011fu, kuru dereden sonra 394 say\u0131l\u0131 mera parselinin geldi\u011fi, 394 say\u0131l\u0131 mera parseli ile dava konusu 395 say\u0131l\u0131 parseli zeminde mevcut olan kuru derenin ay\u0131rd\u0131\u011f\u0131, mera parseli ile dava konusu parselin bitki \u00f6rt\u00fclerinin birbirinden farkl\u0131 oldu\u011fu hususunun zapta ge\u00e7irildi\u011fi anla\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>32. 02.06.2015 tarihinde yap\u0131lan ke\u015fifte beyanlar\u0131 al\u0131nan mahalli ve tespit bilirki\u015fileri, dava konusu ta\u015f\u0131nmaz\u0131n davac\u0131n\u0131n dedesine ait oldu\u011funu ve \u00f6l\u00fcm\u00fcne kadar kulland\u0131\u011f\u0131n\u0131, \u00f6l\u00fcm\u00fc ile ta\u015f\u0131nmaz\u0131n davac\u0131n\u0131n babas\u0131na kald\u0131\u011f\u0131n\u0131, ot bi\u00e7mek suretiyle tar\u0131m arazisi olarak kullan\u0131ld\u0131\u011f\u0131n\u0131, davac\u0131n\u0131n da tapulu ta\u015f\u0131nmaz\u0131 ayn\u0131 \u015fekilde 20 y\u0131ldan fazla s\u00fcredir kulland\u0131\u011f\u0131 ve zilyetlik s\u00fcresinin eklemeli olarak 100 y\u0131l\u0131 ge\u00e7ti\u011fini, dava konusu ta\u015f\u0131nmaz ile mera parseli aras\u0131nda kuru dere oldu\u011funu, ta\u015f\u0131nmaz\u0131n Hazine ile ilgisinin bulunmad\u0131\u011f\u0131n\u0131 beyan etmi\u015flerdir.<\/p>\n<p>33. Mahallinde 02.06.2015 tarihinde yap\u0131lan ke\u015fifte al\u0131nan fen bilirki\u015fi raporunda davac\u0131n\u0131n dayand\u0131\u011f\u0131 1943 tarihli, cilt no 30, sayfa 89, s\u0131ra 1&#8217;de kay\u0131tl\u0131 tapu kayd\u0131 s\u0131n\u0131r\u0131 ile kadastro paftas\u0131n\u0131 \u00fcst \u00fcste \u00e7ak\u0131\u015ft\u0131rma sonucunda tapu kayd\u0131n\u0131n dava konusu parseli de kapsad\u0131\u011f\u0131, ziraat m\u00fchendislerinden olu\u015fan bilirki\u015fi kurulu raporunda ise dava konusu ta\u015f\u0131nmaz\u0131n bulundu\u011fu yerin il\u00e7e merkezine oranla daha y\u00fcksek oldu\u011fu, y\u00f6rede bu t\u00fcr yerlerin &#8230; olarak kullan\u0131ld\u0131\u011f\u0131, dava konusu ta\u015f\u0131nmaz ile mera parseli aras\u0131nda 5-10 metre derinli\u011finde ve yer yer 4-5 metre eninde kuru derenin bulundu\u011fu, mera parselinin dava konusu parsele g\u00f6re daha engebeli ve ta\u015fl\u0131k oldu\u011fu, dava konusu ta\u015f\u0131nmaz\u0131n &#8230; tar\u0131m\u0131na uygun oldu\u011fu, &#8230; olarak kullan\u0131ld\u0131\u011f\u0131 ve dolay\u0131s\u0131yla &#8230; vasf\u0131nda ta\u015f\u0131nmaz oldu\u011fu belirtilmi\u015ftir.<\/p>\n<p>34. Bu durumda yap\u0131lan ke\u015fif, mahkeme g\u00f6zlemi, mahalli ve tespit bilirki\u015filerinin beyanlar\u0131 ile dosya kapsam\u0131 birlikte de\u011ferlendirildi\u011finde; dava konusu ta\u015f\u0131nmaz\u0131n kuzeyi, do\u011fusu ve g\u00fcney s\u0131n\u0131rlar\u0131 ile beraber uzanan kuru derenin bulundu\u011fu, kuru dereden sonra 394 say\u0131l\u0131 mera parselinin geldi\u011fi, 394 say\u0131l\u0131 mera parseli ile dava konusu 395 say\u0131l\u0131 parseli zeminde birbirinden kuru derenin ay\u0131rd\u0131\u011f\u0131, &#8230; Tapu Sicil M\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn yaz\u0131s\u0131na g\u00f6re davac\u0131n\u0131n dayand\u0131\u011f\u0131 tapu kayd\u0131n\u0131n revizyon g\u00f6rmedi\u011fi, al\u0131nan bilirki\u015fi raporlar\u0131na g\u00f6re bu tapu kayd\u0131n\u0131n t\u00fcm s\u0131n\u0131rlar\u0131 itibar\u0131yla dava konusu ta\u015f\u0131nmaz\u0131 da i\u00e7erisine alacak \u015fekilde \u00e7ok geni\u015f bir alan\u0131 kapsad\u0131\u011f\u0131, ta\u015f\u0131nmaz\u0131n davac\u0131n\u0131n dedesine ait oldu\u011fu ve \u00f6l\u00fcm\u00fcne kadar kulland\u0131\u011f\u0131, ot bi\u00e7mek suretiyle tar\u0131m arazisi olarak kullan\u0131lan ta\u015f\u0131nmazda davac\u0131n\u0131n da ayn\u0131 \u015fekilde 20 y\u0131ldan fazla s\u00fcredir zilyet oldu\u011fu ve zilyetlik s\u00fcresinin eklemeli olarak 100 y\u0131l\u0131 ge\u00e7ti\u011fi anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>35. H\u00e2l b\u00f6yle olunca, direnme karar\u0131n\u0131n yukar\u0131da a\u00e7\u0131klanan gerek\u00e7eyle onanmas\u0131 gerekmi\u015ftir.<\/p>\n<p>36. Hukuk Genel Kurulunda yap\u0131lan g\u00f6r\u00fc\u015fmeler s\u0131ras\u0131nda; uygulanan tapu kayd\u0131n\u0131n Saza yolundan itibaren ta\u015f\u0131nmaz\u0131n bulundu\u011fu yere ula\u015fma imk\u00e2n\u0131 olmay\u0131p bu nedenle ta\u015f\u0131nmaz\u0131n bu tapu kayd\u0131 kapsam\u0131nda kald\u0131\u011f\u0131n\u0131n kabul\u00fcne imk\u00e2n bulunmad\u0131\u011f\u0131, mera parseli ile arada ay\u0131r\u0131c\u0131 bir unsur olmad\u0131\u011f\u0131 gibi ta\u015f\u0131nmaz\u0131n konumu ve eylemli durumu itibar\u0131yla ve dosyaya ekli foto\u011fraflara g\u00f6re \u00fczerinde ekonomik amaca uygun zilyetli\u011fin de bulunmad\u0131\u011f\u0131 gerek\u00e7esi ile karar d\u00fczeltme isteminin reddi gerekti\u011fi g\u00f6r\u00fc\u015f\u00fc ile davac\u0131n\u0131n dayand\u0131\u011f\u0131 tapu kayd\u0131n\u0131n uygulanmas\u0131n\u0131n m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 ancak ot bi\u00e7mek suretiyle kullan\u0131lan ta\u015f\u0131nmazda ekonomik amaca uygun zilyetli\u011fin ger\u00e7ekle\u015fti\u011fi ve karar d\u00fczeltme isteminin bu de\u011fi\u015fik gerek\u00e7e ile kabul\u00fcne karar verilmesi gerekti\u011fi g\u00f6r\u00fc\u015fleri ileri s\u00fcr\u00fclm\u00fc\u015f ise de bu g\u00f6r\u00fc\u015fler yukar\u0131da a\u00e7\u0131klanan nedenlerle Kurul \u00e7o\u011funlu\u011fu taraf\u0131ndan benimsenmemi\u015ftir.<\/p>\n<p>37.
