Ulusal Su Kurulu; Tar\u0131m ve Orman Bakan\u0131 ba\u015fkanl\u0131\u011f\u0131nda, Tar\u0131m ve Orman Bakan Yard\u0131mc\u0131s\u0131, \u00c7evre, \u015eehircilik ve \u0130klim De\u011fi\u015fikli\u011fi Bakan Yard\u0131mc\u0131s\u0131, D\u0131\u015fi\u015fleri Bakan Yard\u0131mc\u0131s\u0131, Enerji ve Tabii Kaynaklar Bakan Yard\u0131mc\u0131s\u0131, Hazine ve Maliye Bakan Yard\u0131mc\u0131s\u0131, \u0130\u00e7i\u015fleri Bakan Yard\u0131mc\u0131s\u0131, K\u00fclt\u00fcr ve Turizm Bakan Yard\u0131mc\u0131s\u0131, Milli E\u011fitim Bakan Yard\u0131mc\u0131s\u0131, Sa\u011fl\u0131k Bakan Yard\u0131mc\u0131s\u0131, Sanayi ve Teknoloji Bakan Yard\u0131mc\u0131s\u0131, Ula\u015ft\u0131rma ve Altyap\u0131 Bakan Yard\u0131mc\u0131s\u0131 ile Strateji ve B\u00fct\u00e7e Ba\u015fkan\u0131, T\u00fcrkiye Bilimsel ve Teknolojik Ara\u015ft\u0131rma Kurumu Ba\u015fkan\u0131, T\u00fcrkiye \u0130statistik Kurumu Ba\u015fkan\u0131, T\u00fcrkiye Odalar ve Borsalar Birli\u011fi Ba\u015fkan\u0131 ve T\u00fcrkiye Belediyeler Birli\u011fi Ba\u015fkan\u0131ndan olu\u015fur.<\/p>\n<p>(2) Ulusal Su Kurulunun g\u00f6rev ve yetkileri \u015funlard\u0131r:<\/p>\n<p>a) Kentlerde ve k\u0131rsalda su-g\u0131da-enerji-ekosistem ili\u015fkisini temel alan su arz\u0131na ili\u015fkin k\u0131sa ve uzun vadeli plan, politika ve stratejileri olu\u015fturmak, <\/p>\n<p>b) Su kaynaklar\u0131n\u0131n s\u00fcrd\u00fcr\u00fclebilir y\u00f6netimine ili\u015fkin al\u0131nacak tedbirlere ve uygulanacak politikalara y\u00f6nelik \u00f6nerilerde bulunmak, <\/p>\n<p>c) Su kaynaklar\u0131n\u0131n kalitesinin ve miktar\u0131n\u0131n korunmas\u0131na ili\u015fkin planlar\u0131n uygulanmas\u0131nda kar\u015f\u0131la\u015f\u0131lan sorunlar\u0131n \u00e7\u00f6z\u00fcm\u00fcne y\u00f6nelik kararlar almak, <\/p>\n<p>\u00e7) Su kaynaklar\u0131n\u0131n korunmas\u0131 ve iyile\u015ftirilmesine ili\u015fkin planlarda belirlenen tedbirlerin \u00f6nceliklendirilmesi ve uygulanmas\u0131 i\u00e7in kamu kaynaklar\u0131n\u0131n etkin ve verimli kullan\u0131lmas\u0131na y\u00f6nelik kararlar almak, <\/p>\n<p>d) Su tahsisinde arz ve talep dengesini sa\u011flamaya ve sekt\u00f6rel su payla\u015f\u0131m\u0131na y\u00f6nelik kararlar almak, <\/p>\n<p>e) Su konusundaki arz ve talepleri de\u011ferlendirmek ve karara ba\u011flamak, <\/p>\n<p>f) Ulusal su plan\u0131, havza \u00f6l\u00e7ekli y\u00f6netim planlar\u0131, su verimlili\u011fi il planlar\u0131 ile i\u00e7me ve kullanma suyu g\u00fcvenli\u011fi planlar\u0131n\u0131 karara ba\u011flamak. <\/p>\n<p> (3) Kurul, Ba\u015fkan ve en az 12 \u00fcyenin kat\u0131l\u0131m\u0131 ile toplan\u0131r ve \u00fcye tam say\u0131s\u0131n\u0131n salt \u00e7o\u011funlu\u011fu ile karar al\u0131r. Al\u0131nan kararlardan ulusal, havza ve il \u00f6l\u00e7ekli olanlar ile Kurul taraf\u0131ndan mahiyetine g\u00f6re Cumhurba\u015fkan\u0131 onay\u0131na sunulmas\u0131 kararla\u015ft\u0131r\u0131lanlar Cumhurba\u015fkan\u0131 onay\u0131 ile y\u00fcr\u00fcrl\u00fc\u011fe girer. <\/p>\n<p> (4) Kurul, gerekli g\u00f6rd\u00fc\u011f\u00fcnde di\u011fer bakanl\u0131klar, kamu kurum ve kurulu\u015flar\u0131, \u00fcniversiteler, sivil toplum kurulu\u015flar\u0131 ile sekt\u00f6r temsilcilerini toplant\u0131lara davet edebilir. Kurul taraf\u0131ndan konu baz\u0131nda alt kurullar ve \u00e7al\u0131\u015fma gruplar\u0131 olu\u015fturulabilir. Kurulun sekretarya hizmetleri, al\u0131nan kararlar\u0131n uygulanmas\u0131n\u0131n takibi ve koordinasyonu Su Y\u00f6netimi Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan y\u00fcr\u00fct\u00fcl\u00fcr. <\/p>\n<p> (5) Su konusundaki arz ve talepler her y\u0131l \u015eubat ve Eyl\u00fcl aylar\u0131nda Bakanl\u0131\u011fa g\u00f6nderilir. ESASIN \u0130NCELENMES\u0130<\/p>\n<p>2. Dava dilek\u00e7esi ve ekleri, Raport\u00f6r S\u00fcmeyye KOCAMAN taraf\u0131ndan haz\u0131rlanan i\u015fin esas\u0131na ili\u015fkin rapor, dava konusu CBK kurallar\u0131, dayan\u0131lan Anayasa kurallar\u0131 ve bunlar\u0131n gerek\u00e7eleri ile di\u011fer belgeler okunup incelendikten sonra gere\u011fi g\u00f6r\u00fc\u015f\u00fcl\u00fcp d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. CBK\u2019lar\u0131n Anayasal \u00c7er\u00e7evesi ve Yarg\u0131sal Denetimi <\/p>\n<p>3. Anayasa Mahkemesi CBK\u2019lar\u0131n anayasal \u00e7er\u00e7evesini ve yarg\u0131sal denetimine ili\u015fkin ilkeleri daha \u00f6nceki kararlar\u0131nda belirlemi\u015ftir. Buna g\u00f6re CBK\u2019lar\u0131n yarg\u0131sal denetiminde \u00f6ncelikle Anayasa\u2019n\u0131n 104. maddesinin on yedinci f\u0131kras\u0131n\u0131n birinci ila d\u00f6rd\u00fcnc\u00fc c\u00fcmlelerinde belirtilen konu bak\u0131m\u0131ndan yetki kurallar\u0131na uygunlu\u011funun ele al\u0131nmas\u0131 gerekmekte olup bu kapsamda d\u00fczenlemenin y\u00fcr\u00fctme yetkisine ili\u015fkin olmas\u0131, Anayasa\u2019n\u0131n \u0130kinci K\u0131sm\u0131\u2019n\u0131n Birinci ve \u0130kinci B\u00f6l\u00fcmlerinde yer alan temel haklar, ki\u015fi haklar\u0131 ve \u00f6devleriyle D\u00f6rd\u00fcnc\u00fc B\u00f6l\u00fcm\u00fc\u2019nde yer alan siyasi haklar ve \u00f6devlerle ilgili olmamas\u0131, Anayasa\u2019da m\u00fcnhas\u0131ran kanunla d\u00fczenlenmesi \u00f6ng\u00f6r\u00fclen ya da kanunda a\u00e7\u0131k\u00e7a d\u00fczenlenen konulara ili\u015fkin olmamas\u0131 gerekir. An\u0131lan f\u0131kra y\u00f6n\u00fcnden herhangi bir ayk\u0131r\u0131l\u0131k tespit edilmemesi durumunda ise bu defa CBK\u2019lar\u0131n i\u00e7erik y\u00f6n\u00fcnden Anayasa\u2019ya uygunluk denetimi yap\u0131lmal\u0131d\u0131r (AYM, E.2019\/78, K.2020\/6, 23\/1\/2020, \u00a7\u00a7 3-13; E.2019\/31, K.2020\/5, 23\/1\/2020, \u00a7\u00a7 3-13; E.2018\/119, K.2020\/25, 11\/6\/2020, \u00a7\u00a7 3-13; E.2018\/155, K.2020\/27, 11\/6\/2020, \u00a7\u00a7 3-13).<\/p>\n<p>B. CBK\u2019n\u0131n 5. Maddesiyle (1) Numaral\u0131 CBK\u2019ya Eklenen 435\/A Maddesinin (1), (2) ve (6) Numaral\u0131 F\u0131kralar\u0131n\u0131n \u0130ncelenmesi<\/p>\n<p>1. Anlam ve Kapsam<\/p>\n<p>4. (1) numaral\u0131 CBK\u2019n\u0131n 435\/A maddesinin dava konusu (1) numaral\u0131 f\u0131kras\u0131nda su kaynaklar\u0131n\u0131n etkin y\u00f6netimi ve verimli kullan\u0131lmas\u0131n\u0131n temini i\u00e7in Ulusal Su Kurulunun (Kurul) kurulmas\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015f, ayn\u0131 zamanda bu Kurulun kimlerden olu\u015faca\u011f\u0131 h\u00fckme ba\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>5. (1) numaral\u0131 CBK\u2019n\u0131n 435\/A maddesinin dava konusu (1) ve (6) numaral\u0131 f\u0131kralar\u0131nda idari usul ve esaslar \u00e7er\u00e7evesinde Su Kurullar\u0131n\u0131n kurulmas\u0131na y\u00f6nelik d\u00fczenlemeler \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc g\u00f6zetildi\u011finde kurallar\u0131n y\u00fcr\u00fctme yetkisine ili\u015fkin konulardan oldu\u011fu a\u00e7\u0131kt\u0131r.<\/p>\n<p>11. Kurallar, Anayasa\u2019n\u0131n CBK ile d\u00fczenlenmesi yasaklanan \u0130kinci K\u0131sm\u0131\u2019n\u0131n Birinci ve \u0130kinci B\u00f6l\u00fcmlerinde yer alan temel haklar, ki\u015fi haklar\u0131 ve \u00f6devleri ile D\u00f6rd\u00fcnc\u00fc B\u00f6l\u00fcm\u00fc\u2019nde yer alan siyasi haklar ve \u00f6devlerle ilgili herhangi bir d\u00fczenleme i\u00e7ermemektedir.<\/p>\n<p>12. Anayasa\u2019n\u0131n 104. maddesinin on yedinci f\u0131kras\u0131n\u0131n \u00fc\u00e7\u00fcnc\u00fc c\u00fcmlesi uyar\u0131nca CBK\u2019lar bak\u0131m\u0131ndan aranan bir di\u011fer husus, CBK kural\u0131n\u0131n Anayasa\u2019da m\u00fcnhas\u0131ran kanunla d\u00fczenlenmesi gereken konulara ili\u015fkin olmamas\u0131 gere\u011fidir. Anayasa koyucunun bir konunun kanunla d\u00fczenlenmesini \u00f6zel olarak \u00f6ng\u00f6rmesi bu alan\u0131n m\u00fcnhas\u0131ran kanunla d\u00fczenlenmesini istedi\u011fi anlam\u0131na gelir. Bu kapsamda Anayasa bir konunun kanunla d\u00fczenlenece\u011fini \u00f6ng\u00f6rm\u00fc\u015fse bu konuda CBK \u00e7\u0131kar\u0131lamaz. Bununla birlikte Anayasa\u2019da CBK\u2019larla d\u00fczenlenece\u011fi \u00f6zel olarak belirtilen konularda CBK\u2019larla d\u00fczenleme yap\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr (AYM, E.2018\/127, K.2021\/18, 18\/3\/2021, \u00a7 40).<\/p>\n<p>13. Anayasa\u2019n\u0131n 123. maddesinin birinci f\u0131kras\u0131na g\u00f6re \u201c\u0130dare, kurulu\u015f ve g\u00f6revleriyle bir b\u00fct\u00fcnd\u00fcr ve kanunla d\u00fczenlenir.\u201d Ancak Anayasa\u2019n\u0131n 106. maddesinin on birinci f\u0131kras\u0131nda \u201cBakanl\u0131klar\u0131n kurulmas\u0131, kald\u0131r\u0131lmas\u0131, g\u00f6revleri ve yetkileri, te\u015fkilat yap\u0131s\u0131 ile merkez ve ta\u015fra te\u015fkilatlar\u0131n\u0131n kurulmas\u0131 Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesiyle d\u00fczenlenir.\u201d denilmek suretiyle bakanl\u0131klar\u0131n kurulmas\u0131, kald\u0131r\u0131lmas\u0131, g\u00f6revleri ve yetkileri, te\u015fkilat yap\u0131s\u0131 ile merkez ve ta\u015fra te\u015fkilatlar\u0131n\u0131n kurulmas\u0131 Anayasa\u2019n\u0131n 106. maddesinin on birinci f\u0131kras\u0131 uyar\u0131nca CBK ile d\u00fczenlenebilece\u011fi \u00f6zel olarak belirtilen konular kapsam\u0131nda kalmaktad\u0131r (AYM, E.2018\/119, K.2020\/25, 11\/6\/2020, \u00a7 25).<\/p>\n<p>14. S\u00f6z konusu Kurullar\u0131n faaliyet alan\u0131n\u0131n, Kurullar\u0131n olu\u015fumunda temsilcileri yer alacak bakanl\u0131klar\u0131n y\u00fcr\u00fctmekle y\u00fck\u00fcml\u00fc olduklar\u0131 kamu hizmeti alan\u0131yla ilgili oldu\u011fu dikkate al\u0131nd\u0131\u011f\u0131nda kurallar\u0131n ulusal ve b\u00f6lgesel d\u00fczeyde bir su politikas\u0131 te\u015fkilat\u0131 kurulmas\u0131n\u0131n hukuksal temelinin olu\u015fturulmas\u0131na y\u00f6nelik oldu\u011fu anla\u015f\u0131lmaktad\u0131r. CBK\u2019n\u0131n 435\/A maddesinin (1) numaral\u0131 f\u0131kras\u0131nda ise Ulusal Su Kurulunun Bakanl\u0131k b\u00fcnyesinde kuruldu\u011funun a\u00e7\u0131k\u00e7a ifade edildi\u011fi g\u00f6r\u00fclmektedir.<\/p>\n<p>17. Anayasa\u2019n\u0131n 106. maddesinin on birinci f\u0131kras\u0131nda yer alan \u201cte\u015fkilat yap\u0131s\u0131\u201d kavram\u0131, belirli bir hizmeti y\u00fcr\u00fctmek \u00fczere kurulan kamu kurum ve kurulu\u015flar\u0131n\u0131n bu ama\u00e7la \u00fcstlendikleri g\u00f6rev ve yetkilerin ifa edilebilmesi i\u00e7in olu\u015fturulan ve s\u00f6z konusu hizmetin y\u00fcr\u00fct\u00fclmesinde do\u011frudan ya da dolayl\u0131 olarak rol alan ayn\u0131 kurum b\u00fcnyesindeki farkl\u0131 d\u00fczey ve nitelikteki birimlerin b\u00fct\u00fcn\u00fcn\u00fc ifade etmektedir (AYM, E.2019\/105, K.2020\/30, 12\/06\/2020, \u00a7 21; E.2018\/124, K.2020\/56, 15\/10\/2020, \u00a7 21). Bu itibarla Tar\u0131m ve Orman Bakanl\u0131\u011f\u0131 b\u00fcnyesinde kurulan Ulusal Su Kurulu ile merkez\u00ee idarenin ta\u015fra te\u015fkilat\u0131 i\u00e7erisinde kurulmas\u0131 \u00f6ng\u00f6r\u00fclen Havza ve \u0130l Su Kurullar\u0131n\u0131n te\u015fkilat yap\u0131s\u0131 kavram\u0131na d\u00e2hil oldu\u011fu anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>18. Dava konusu CBK kurallar\u0131n\u0131n bakanl\u0131klar\u0131n te\u015fkilat\u0131yla ilgili hususlara ili\u015fkin oldu\u011fu, b\u00f6ylelikle CBK ile d\u00fczenlenmesine engel bir durumun s\u00f6z konusu olmad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Bu itibarla kurallar\u0131n Anayasa\u2019n\u0131n 106. maddesinin on birinci f\u0131kras\u0131yla ba\u011flant\u0131l\u0131 olarak 104. maddesinin on yedinci f\u0131kras\u0131n\u0131n \u00fc\u00e7\u00fcnc\u00fc c\u00fcmlesine ayk\u0131r\u0131 bir y\u00f6n\u00fc de bulunmamaktad\u0131r.<\/p>\n<p>19. Anayasa\u2019n\u0131n 104. maddesinin on yedinci f\u0131kras\u0131n\u0131n d\u00f6rd\u00fcnc\u00fc c\u00fcmlesinde kanunda a\u00e7\u0131k\u00e7a d\u00fczenlenen konularda CBK \u00e7\u0131kar\u0131lamayaca\u011f\u0131 kurala ba\u011flanm\u0131\u015ft\u0131r. Bu ba\u011flamda yap\u0131lacak incelemede \u00f6ncelikle CBK ile kar\u015f\u0131la\u015ft\u0131rmaya esas olabilecek daha \u00f6nce \u00e7\u0131kar\u0131lm\u0131\u015f bir kanun olup olmad\u0131\u011f\u0131 tespit edilmeli, sonras\u0131nda ise -b\u00f6yle bir kanun varsa- incelenen CBK\u2019n\u0131n kanunun a\u00e7\u0131k\u00e7a d\u00fczenledi\u011fi konuyu d\u00fczenleyip d\u00fczenlemedi\u011fi belirlenmelidir. Bu de\u011ferlendirme yap\u0131l\u0131rken \u00f6nce ilgili kanunun CBK\u2019yla d\u00fczenlenen alanda h\u00fck\u00fcm ifade edip etmedi\u011finin belirlenmesi, ard\u0131ndan da kanundaki d\u00fczenlemenin a\u00e7\u0131k olup olmad\u0131\u011f\u0131n\u0131n tespit edilmesi gerekir. Bu ba\u011flamda CBK olmasayd\u0131 kar\u015f\u0131la\u015ft\u0131rmaya esas al\u0131nan kanun h\u00fckm\u00fcn\u00fcn CBK\u2019yla d\u00fczenleme yap\u0131lan konuya uygulanacak olup olmamas\u0131 CBK\u2019n\u0131n kanun ile d\u00fczenlenen konuda \u00e7\u0131kar\u0131l\u0131p \u00e7\u0131kar\u0131lmad\u0131\u011f\u0131na dair bir g\u00f6sterge olacakt\u0131r (benzer y\u00f6ndeki de\u011ferlendirme i\u00e7in bkz. AYM, E.2019\/31, K.2020\/5, 23\/1\/2020, \u00a7 17).<\/p>\n<p>20. Dava konusu CBK kurallar\u0131ndaki ama\u00e7lar\u0131 ger\u00e7ekle\u015ftirmek \u00fczere ulusal ve yerel d\u00fczeyde Su Kurullar\u0131 olu\u015fturulmas\u0131na y\u00f6nelik olarak kar\u015f\u0131la\u015ft\u0131rmaya esas olabilecek nitelikte olan ve kanunla yap\u0131lan herhangi bir d\u00fczenleme tespit edilememi\u015ftir.<\/p>\n<p>21. \u00d6te yandan Havza ve \u0130l Su Kurullar\u0131na ili\u015fkin d\u00fczenlemeden daha \u00f6nce mahall\u00ee idarelerle ilgili olarak \u00e7\u0131kar\u0131lm\u0131\u015f olan baz\u0131 kanunlarda, su politikas\u0131na dair d\u00fczenlemelerin bulundu\u011fu g\u00f6r\u00fclmekle birlikte s\u00f6z konusu Kurullar\u0131n g\u00f6rev alan\u0131n\u0131n su verimlili\u011fi il planlar\u0131 ile i\u00e7me ve kullanma suyu g\u00fcvenli\u011fi planlar\u0131n\u0131n haz\u0131rlanmas\u0131na katk\u0131da bulunmakla, su kaynaklar\u0131n\u0131n korunmas\u0131na ve etkin y\u00f6netimine y\u00f6nelik uygulamalar\u0131n izlenmesi ve de\u011ferlendirilmesiyle ilgili \u00e7al\u0131\u015fmalar\u0131 y\u00fcr\u00fctmekle s\u0131n\u0131rl\u0131 oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Dolay\u0131s\u0131yla Havza ve \u0130l Su Kurullar\u0131n\u0131n g\u00f6revleri bak\u0131m\u0131ndan da kar\u015f\u0131la\u015ft\u0131rmaya esas olabilecek nitelikte olan ve kanunla yap\u0131lan herhangi bir d\u00fczenlemenin bulunmad\u0131\u011f\u0131 sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>22. Hukuk devletinin temel unsurlar\u0131ndan biri belirlilik ilkesidir. Anayasa Mahkemesinin yerle\u015fik kararlar\u0131na g\u00f6re an\u0131lan ilke, yasal d\u00fczenlemelerin hem ki\u015filer hem de idare y\u00f6n\u00fcnden herhangi bir duraksamaya ve ku\u015fkuya yer vermeyecek \u015fekilde a\u00e7\u0131k, net, anla\u015f\u0131l\u0131r, uygulanabilir ve nesnel olmas\u0131n\u0131 gerektirmektedir.<\/p>\n<p>25. An\u0131lan ilkenin y\u00fcr\u00fctmenin asli d\u00fczenleyici i\u015flemi niteli\u011finde olan CBK\u2019lar bak\u0131m\u0131ndan da ge\u00e7erli oldu\u011funda \u015f\u00fcphe bulunmamaktad\u0131r (AYM, E.2022\/113, K.2023\/112, 22\/6\/2023, \u00a7 29; E.2018\/149, K.2022\/163, 29\/12\/2022, \u00a7 26; E.2019\/96, K.2022\/17, 24\/2\/2022, \u00a7 47; E.2018\/134, K.2021\/13, 3\/3\/2021, \u00a7 38; E.2018\/125, K.2020\/4, 22\/1\/2020, \u00a7 28).<\/p>\n<p>26. Kurallarla, Ulusal Su Kurulu ile Havza ve \u0130l Su Kurullar\u0131n\u0131n olu\u015fumu ile Havza ve \u0130l Su Kurullar\u0131n\u0131n g\u00f6revlerine ili\u015fkin hususlar\u0131n a\u00e7\u0131k, net, anla\u015f\u0131l\u0131r, uygulanabilir ve nesnel \u015fekilde d\u00fczenlendi\u011fi g\u00f6r\u00fcld\u00fc\u011f\u00fcnden kurallar\u0131n bu y\u00f6n\u00fcyle bir belirsizlik i\u00e7ermedi\u011fi sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>27. Kurulun Tar\u0131m ve Orman Bakanl\u0131\u011f\u0131 b\u00fcnyesinde olu\u015fturuldu\u011fu g\u00f6zetildi\u011finde, kural\u0131n bakanl\u0131klar\u0131n g\u00f6rev ve yetkileriyle ilgili hususlara ili\u015fkin oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Bu itibarla kural\u0131n Anayasa\u2019n\u0131n 106. maddesinin on birinci f\u0131kras\u0131yla ba\u011flant\u0131l\u0131 olarak 104. maddesinin on yedinci f\u0131kras\u0131n\u0131n \u00fc\u00e7\u00fcnc\u00fc c\u00fcmlesine ayk\u0131r\u0131 bir y\u00f6n\u00fc de bulunmamaktad\u0131r.<\/p>\n<p>32. CBK\u2019n\u0131n 5. maddesiyle 1 numaral\u0131 CBK\u2019ya eklenen 435\/A maddesinde Tar\u0131m ve Orman Bakan\u0131 ba\u015fkanl\u0131\u011f\u0131nda Ulusal Su Kurulu, su havzalar\u0131n\u0131n bulundu\u011fu yerde koordinat\u00f6r il vali yard\u0131mc\u0131s\u0131 ba\u015fkanl\u0131\u011f\u0131nda Havza Su Kurulu ve her ilde il valisi ba\u015fkanl\u0131\u011f\u0131nda \u0130l Su Kurulu kurulaca\u011f\u0131 d\u00fczenlenmektedir. Kurullar, \u00e7e\u015fitli bakanl\u0131klar ve meslek kurulu\u015flar\u0131n\u0131n temsilcilerinin biraraya gelmesiyle te\u015fekk\u00fcl etmektedir. Kanundaki bu d\u00fczenlemeye g\u00f6re kurullar\u0131n t\u00fczel ki\u015fili\u011fi bulunmamaktad\u0131r. Ayr\u0131ca kurullar 1 numaral\u0131 CBK\u2019n\u0131n Tar\u0131m ve Orman Bakanl\u0131\u011f\u0131 b\u00f6l\u00fcm\u00fcnde d\u00fczenlenmesine kar\u015f\u0131n bu bakanl\u0131\u011f\u0131n merkez veya ta\u015fra te\u015fkilat\u0131na dahil edilmemi\u015ftir.<\/p>\n<p>2. Anayasa\u2019n\u0131n ilgili h\u00fck\u00fcmlerinde Cumhurba\u015fkan\u0131na kararname ile m\u00fcstakil bir idari birim kurma yetkisi verilmemi\u015ftir. Bu yetki, Anayasa\u2019n\u0131n bakanl\u0131klar\u0131n kurulmas\u0131 ve kald\u0131r\u0131lmas\u0131na ili\u015fkin olarak CBK ile d\u00fczenleme yapma yetkisi veren 106. maddesinin onbirinci f\u0131kras\u0131 kapsam\u0131na da girmemektedir. Nitekim Mahkememizin bir karar\u0131nda da kamu t\u00fczelki\u015fili\u011fi bulunmayan ve herhangi bir bakanl\u0131\u011f\u0131n merkez veya ta\u015fra te\u015fkilat\u0131na dahil olmayan idari bir birimin g\u00f6rev ve yetkilerinin Anayasa\u2019n\u0131n 106\/11. maddesinin verdi\u011fi yetki i\u00e7erisine girmedi\u011fi belirtilmi\u015ftir (AYM 22.1.2022, E. 2018\/125 \u2013 K. 2020\/4). \u00d6te yandan t\u00fczelki\u015fili\u011fi olmayan m\u00fcstakil idari bir birimin kurulmas\u0131 konusunda CBK\u2019ya Anayasa\u2019da \u00f6zel olarak bir yetki de verilmemi\u015ftir. Her ne kadar madde 435\/A\u2019n\u0131n ilk f\u0131kras\u0131nda kurulu\u015fun \u201cbakanl\u0131k b\u00fcnyesinde\u201d olaca\u011f\u0131 ibaresine yer verilmi\u015f ise de te\u015fkilat\u0131n \u00e7ok say\u0131da bakanl\u0131\u011f\u0131n bakan yard\u0131mc\u0131lar\u0131ndan ve meslek kurulu\u015flar\u0131n\u0131n temsilcilerinden olu\u015ftu\u011fu, yine sekreterya hizmetlerinin Su Y\u00f6netimi Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan y\u00fcr\u00fct\u00fclece\u011fi y\u00f6n\u00fcndeki (CBK m. 421\/i) d\u00fczenleme g\u00f6zetildi\u011finde, s\u00f6z konusu \u201cb\u00fcnyesinde\u201d ibaresinin bakanl\u0131k te\u015fkilat\u0131na dahil olmay\u0131 ifade i\u00e7in yeterli olmayaca\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>3. Anayasa\u2019n\u0131n 123. maddesi uyar\u0131nca genel olarak idari te\u015fkilata yeni bir idari birimin dahil edilmesine, bu te\u015fkilat\u0131n g\u00f6rev ve yetkilerinin d\u00fczenlenmesine ili\u015fkin hususlar\u0131n m\u00fcnhas\u0131ran kanunla d\u00fczenlenmesi gerekmektedir. Bu durumda CBK ile idari te\u015fkilatta yeni bir birim olu\u015fturma ve g\u00f6rev ve yetkilerini belirlemeye ili\u015fkin olarak yap\u0131lan d\u00fczenleme Anayasa\u2019n\u0131n 104. maddesinin on yedinci f\u0131kras\u0131n\u0131n \u00fc\u00e7\u00fcnc\u00fc c\u00fcmlesine ayk\u0131r\u0131d\u0131r. Nitekim Mahkememizin bu y\u00f6nde \u00e7ok say\u0131da karar\u0131 bulunmaktad\u0131r (di\u011ferleri aras\u0131nda bkz. AYM 14.3.2024, E. 2021\/163 \u2013 K. 2024\/78; AYM 1.6.2022, E. 2020\/4 \u2013 K. 2022\/61). Bu nedenle an\u0131lan maddenin incelenen 1., 2. ve 6. f\u0131kralar\u0131ndaki kurallar\u0131n konu bak\u0131m\u0131ndan yetki y\u00f6n\u00fcnden Anayasa\u2019ya ayk\u0131r\u0131 bulunmas\u0131 nedeniyle iptal edilmesi gerekti\u011fi g\u00f6r\u00fc\u015f\u00fcndeyim.<\/p>\n<p>4. CBK\u2019n\u0131n 6. maddesiyle; ekli 1 say\u0131l\u0131 listede yer alan kadrolar\u0131n iptal edilerek 2 numaral\u0131 Genel Kadro Usul\u00fc Hakk\u0131nda Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnamesinin eki I say\u0131l\u0131 Cetvelin \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131 b\u00f6l\u00fcm\u00fcnden \u00e7\u0131kart\u0131l\u0131p, ekli 2 say\u0131l\u0131 listede yer alan kadrolar ihdas edilerek 2 numaral\u0131 CBK\u2019n\u0131n eki 1 say\u0131l\u0131 Cetvelin ilgili b\u00f6l\u00fcm\u00fcne eklendi\u011fi belirtilmektedir. Bahse konu 435\/A maddenin (1), (2) ve (6) numaral\u0131 f\u0131kralar\u0131 ile Ulusal Su Kurulu, Havza Su Kurulu ve \u0130l Su Kurulu kurulmakta olup bu kurullar\u0131n olu\u015fumu, g\u00f6revleri ve yetkileri d\u00fczenlenmektedir.<\/p>\n<p>3. Dava konusu kurallar\u0131n konu bak\u0131m\u0131ndan yetki y\u00f6n\u00fc ile ger\u00e7ekle\u015ftirilen denetimde Ulusal Su Kurulunun olu\u015fumu ve idare i\u00e7erisindeki yeri belirleyici olacakt\u0131r. Dava konusu kurallarla Ulusal Su Kurulunun su kaynaklar\u0131n\u0131n etkin y\u00f6netimi ve verimli kullan\u0131m\u0131n\u0131n temini i\u00e7in \u00fcst d\u00fczeyde koordinasyon ve i\u015fbirli\u011fini sa\u011flamak \u00fczere Tar\u0131m ve Orman Bakanl\u0131\u011f\u0131 b\u00fcnyesinde kurulmas\u0131 \u00f6ng\u00f6r\u00fclmektedir.<\/p>\n<p>4. Ulusal Su Kurulunun Tar\u0131m ve Orman Bakan\u0131 ba\u015fkanl\u0131\u011f\u0131nda, Tar\u0131m ve Orman Bakan Yard\u0131mc\u0131s\u0131 ve Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnamesinde say\u0131lan di\u011fer bakanl\u0131klar\u0131n bakan yard\u0131mc\u0131lar\u0131 ile Strateji ve B\u00fct\u00e7e Ba\u015fkan\u0131, T\u00fcrkiye Bilimsel ve Teknolojik Ara\u015ft\u0131rma Kurumu Ba\u015fkan\u0131, T\u00fcrkiye \u0130statistik Kurumu Ba\u015fkan\u0131, T\u00fcrkiye Odalar ve Borsalar Birli\u011fi Ba\u015fkan\u0131 ve T\u00fcrkiye Belediyeler Birli\u011fi Ba\u015fkan\u0131ndan olu\u015faca\u011f\u0131 h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>5. Konu bak\u0131m\u0131ndan yetki y\u00f6n\u00fc ile yap\u0131lan denetimde kurallar\u0131n Anayasa\u2019n\u0131n 104. maddesinin on yedinci f\u0131kras\u0131n\u0131n birinci ve ikinci c\u00fcmlelerine ayk\u0131r\u0131l\u0131k olmad\u0131\u011f\u0131 \u015feklindeki \u00e7o\u011funluk g\u00f6r\u00fc\u015f\u00fcne kat\u0131lmaktay\u0131m. Zira d\u00fczenlenen konu y\u00fcr\u00fctme yetkisine ili\u015fkin oldu\u011fu gibi dava konusu kurallar Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnamesi ile d\u00fczenlenemeyecek olan haklarla ilgili yasak alanda d\u00fczenlemeler i\u00e7ermemektedirler. Bununla birlikte kurallar\u0131n Anayasa\u2019n\u0131n 104. maddesinin on yedinci f\u0131kras\u0131n\u0131n \u00fc\u00e7\u00fcnc\u00fc c\u00fcmlesine ayk\u0131r\u0131l\u0131k ta\u015f\u0131d\u0131\u011f\u0131 kanaatindeyim.<\/p>\n<p>6. \u00c7o\u011funluk karar\u0131nda red sonucuna ula\u015f\u0131l\u0131rken s\u00f6z konusu Kurullar\u0131n faaliyet alan\u0131n\u0131n Kurullar\u0131n olu\u015fumunda temsilcileri yer alacak bakanl\u0131klar\u0131n y\u00fcr\u00fctmekle y\u00fck\u00fcml\u00fc olduklar\u0131 kamu hizmeti alan\u0131yla ilgili oldu\u011fu dikkate al\u0131nm\u0131\u015f ve Tar\u0131m ve Orman Bakanl\u0131\u011f\u0131 b\u00fcnyesinde kurulan Ulusal Su Kurulu ile merkez\u00ee idarenin ta\u015fra te\u015fkilat\u0131 i\u00e7erisinde kurulmas\u0131 \u00f6ng\u00f6r\u00fclen Havza ve \u0130l Su Kurullar\u0131n\u0131n Bakanl\u0131klar\u0131n te\u015fkilat yap\u0131s\u0131 kavram\u0131na d\u00e2hil oldu\u011fu gerek\u00e7esine dayan\u0131lm\u0131\u015ft\u0131r (bkz.: \u00a7\u00a7 16-17).<\/p>\n<p>7. Ulusal Su Kurulunun stat\u00fcs\u00fc ile ilgili olarak dava konusu d\u00fczenlemelere bak\u0131ld\u0131\u011f\u0131nda bu Kurulun ayr\u0131 bir kamu t\u00fczelki\u015fili\u011fine sahip olmad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. \u00d6te yandan kuralda Ulusal Su Kurulunun su kaynaklar\u0131n\u0131n etkin y\u00f6netimi ve verimli kullan\u0131m\u0131n\u0131n temini i\u00e7in \u00fcst d\u00fczeyde koordinasyon ve i\u015fbirli\u011fini sa\u011flamak \u00fczere Bakanl\u0131k b\u00fcnyesinde kurulmas\u0131 \u00f6ng\u00f6r\u00fclmektedir. Ancak kurallarda Kurulun Bakanl\u0131kla ba\u011f\u0131n\u0131n ba\u011fl\u0131 veya ilgili kurulu\u015f d\u00fczeylerinden biri ile ili\u015fkilendirildi\u011fine dair bir a\u00e7\u0131kl\u0131k bulunmamaktad\u0131r.<\/p>\n<p>8. Mahkememiz yerle\u015fik i\u00e7tihad\u0131nda ifade edildi\u011fi \u00fczere Anayasa\u2019n\u0131n 104. maddesinin on yedinci f\u0131kras\u0131n\u0131n \u00fc\u00e7\u00fcnc\u00fc c\u00fcmlesinde Anayasa\u2019da m\u00fcnhas\u0131ran kanunla d\u00fczenlenmesi \u00f6ng\u00f6r\u00fclen konularda Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnamesi \u00e7\u0131kar\u0131lamayaca\u011f\u0131 h\u00fckm\u00fcne yer verilmi\u015ftir. Anayasa koyucunun bir konunun kanunla d\u00fczenlenmesini \u00f6zel olarak \u00f6ng\u00f6rmesi bu alan\u0131n m\u00fcnhas\u0131ran kanunla d\u00fczenlenmesini istedi\u011fi anlam\u0131na gelmektedir. Bu kapsamda Anayasa bir konunun kanunla d\u00fczenlenece\u011fini \u00f6ng\u00f6rm\u00fc\u015f ise bu konuda Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnamesi \u00e7\u0131kar\u0131lamaz. Bununla birlikte Anayasa\u2019da Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnameleriyle d\u00fczenlenece\u011fi \u00f6zel olarak \u00f6ng\u00f6r\u00fclen konulara ili\u015fkin Anayasa h\u00fck\u00fcmlerinin a\u00e7\u0131k\u00e7a izin verdi\u011fi hususlarda Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnameleriyle d\u00fczenleme yap\u0131labilir (AYM, E.2019\/105, K.2020\/30, 12\/6\/2020, \u00a7 19; (AYM, E.2021\/88, K.2021\/105, 30\/12\/2021, \u00a7 17).<\/p>\n<p>9. Bu ba\u011flamda Anayasa\u2019n\u0131n 123. maddesinin birinci f\u0131kras\u0131ndaki \u201c\u0130dare, kurulu\u015f ve g\u00f6revleriyle bir b\u00fct\u00fcnd\u00fcr ve kanunla d\u00fczenlenir.\u201d h\u00fckm\u00fc gere\u011fince idarenin ve organlar\u0131n\u0131n g\u00f6rev ve yetkilerinin kanunla d\u00fczenlenmesi gerekmektedir. Bu h\u00fckm\u00fcn bir istisnas\u0131 olarak 2017 Anayasa de\u011fi\u015fikli\u011fi ile Anayasa\u2019n\u0131n 106. maddesinin on birinci f\u0131kras\u0131nda \u201cBakanl\u0131klar\u0131n kurulmas\u0131, kald\u0131r\u0131lmas\u0131, g\u00f6revleri ve yetkileri, te\u015fkilat yap\u0131s\u0131 ile merkez ve ta\u015fra te\u015fkilatlar\u0131n\u0131n kurulmas\u0131 Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesiyle d\u00fczenlenir.\u201d denilmek suretiyle bakanl\u0131klar\u0131n kurulmas\u0131, kald\u0131r\u0131lmas\u0131, g\u00f6revleri ve yetkileri, te\u015fkilat yap\u0131s\u0131 ile merkez ve ta\u015fra te\u015fkilatlar\u0131n\u0131n kurulmas\u0131 y\u00f6n\u00fcnden Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnameleriyle d\u00fczenleme yap\u0131lmas\u0131na a\u00e7\u0131k\u00e7a izin verilmektedir. Ulusal Su Kurulunun kurulu\u015fu, g\u00f6revleri ve olu\u015fumu dikkate al\u0131nd\u0131\u011f\u0131nda Bakanl\u0131\u011f\u0131n hiyerar\u015fik yap\u0131s\u0131 i\u00e7inde oldu\u011fu s\u00f6ylenemez. Aksine ba\u011fl\u0131 veya ilgili kurulu\u015f \u015feklindeki bir ba\u011fl\u0131l\u0131\u011fa da yer verilmemi\u015f olmas\u0131 bu Kurulun esas\u0131nda kendine \u00f6zg\u00fc bir kurul oldu\u011funu desteklemektedir.<\/p>\n<p>11. Ek olarak Kurulda \u00fcye olarak merkezi idaredeki temsilciler yan\u0131nda T\u00fcrkiye Bilimsel ve Teknolojik Ara\u015ft\u0131rma Kurumu Ba\u015fkan\u0131, T\u00fcrkiye \u0130statistik Kurumu Ba\u015fkan\u0131, T\u00fcrkiye Odalar ve Borsalar Birli\u011fi Ba\u015fkan\u0131 ve T\u00fcrkiye Belediyeler Birli\u011fi Ba\u015fkan\u0131 gibi yerinden y\u00f6netim esas\u0131na g\u00f6re \u00e7al\u0131\u015fan ve \u00f6zerklikleri \u00f6n planda olan ve ayr\u0131 kamu t\u00fczelki\u015fili\u011fine sahip kurum temsilcilerine yer verilmi\u015f olmas\u0131 Kurulun kendine \u00f6zg\u00fc bir idari kurul oldu\u011fu g\u00f6r\u00fc\u015f\u00fcn\u00fc g\u00fc\u00e7lendirmektedir.<\/p>\n<p>12. Nitekim Mahkememiz i\u00e7tihad\u0131nda da vurgulanmakta oldu\u011fu \u00fczere, kamu t\u00fczel ki\u015fili\u011fi bulunmayan ve Cumhurba\u015fkanl\u0131\u011f\u0131 veya herhangi bir bakanl\u0131k te\u015fkilat\u0131na d\u00e2hil olmayan idari bir birimin g\u00f6rev ve yetkileri Anayasa\u2019da Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnamesiyle d\u00fczenlenece\u011fi \u00f6zel olarak \u00f6ng\u00f6r\u00fclen konulardan de\u011fildir. (AYM, E.2021\/88, K.2021\/105, 30\/12\/2021, \u00a7 21; (AYM, E.2021\/85, K.2022\/60, 01\/06\/2022, \u00a7 21)<\/p>\n<p>13. Sonu\u00e7 olarak yukar\u0131da s\u0131ralanan \u00f6zelliklerine binaen Ulusal Su Kurulunun Anayasa\u2019n\u0131n 123. maddesi gere\u011fince m\u00fcnhas\u0131ran kanunla d\u00fczenlenmesi gerekti\u011finden kuralda Anayasa\u2019n\u0131n 123. maddesi ba\u011flam\u0131nda 104. maddesinin on yedinci f\u0131kras\u0131n\u0131n \u00fc\u00e7\u00fcnc\u00fc c\u00fcmlesine ayk\u0131r\u0131l\u0131k s\u00f6z konusudur. Bu nedenle kural\u0131n konu bak\u0131m\u0131ndan yetki y\u00f6n\u00fcnden iptali gerekti\u011fi kanaatinde oldu\u011fumdan \u00e7o\u011funlu\u011fun aksi y\u00f6ndeki karar\u0131na kat\u0131lmamaktay\u0131m.<\/p>\n<p>14. \u0130ptali talep edilen Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnamesinin di\u011fer h\u00fckm\u00fc olan 6. maddesinde kadro ihdas\u0131 ve mevcut baz\u0131 kadrolar\u0131n iptalini de i\u00e7eren kadro ile ilgili hususlara ili\u015fkin d\u00fczenlemeler yer almaktad\u0131r.<\/p>\n<p>15. Dava konusu kural\u0131n \u201ckonu bak\u0131m\u0131ndan yetki\u201d boyutu ile Anayasa\u2019ya uygunluk denetiminde Mahkememiz \u00e7o\u011funlu\u011funca Anayasa\u2019n\u0131n 104. maddesinin on yedinci f\u0131kras\u0131na bir ayk\u0131r\u0131l\u0131k bulunmad\u0131\u011f\u0131 kanaatine ula\u015f\u0131lsa da kurallar\u0131n Anayasa\u2019n\u0131n 104. maddesinin on yedinci f\u0131kras\u0131n\u0131n birinci, ikinci ve \u00fc\u00e7\u00fcnc\u00fc c\u00fcmlelerine ayk\u0131r\u0131 oldu\u011fu i\u00e7in iptali gerekmektedir.<\/p>\n<p>16. Nitekim Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnamesi ile kadro ihdas\u0131 konusunu d\u00fczenleyen bir kurala ili\u015fkin Anayasa Mahkemesinin daha \u00f6nce verdi\u011fi bir kararda bu konunun Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnamesi ile d\u00fczenlenmesinin Anayasa\u2019ya ayk\u0131r\u0131l\u0131k te\u015fkil etti\u011fi g\u00f6r\u00fc\u015f\u00fcnde oldu\u011fumdan Mahkememiz \u00e7o\u011funlu\u011funun iptal isteminin reddi y\u00f6n\u00fcndeki kanaatine kat\u0131lmam\u0131\u015ft\u0131m (Bkz.: E. Anayasa Mahkemesi CBK\u2019lar\u0131n anayasal \u00e7er\u00e7evesini ve yarg\u0131sal denetimine ili\u015fkin ilkeleri daha \u00f6nceki kararlar\u0131nda belirlemi\u015ftir. Buna g\u00f6re CBK\u2019lar\u0131n yarg\u0131sal denetiminde \u00f6ncelikle Anayasa\u2019n\u0131n 104. maddesinin on yedinci f\u0131kras\u0131n\u0131n birinci ila d\u00f6rd\u00fcnc\u00fc c\u00fcmlelerinde belirtilen konu bak\u0131m\u0131ndan yetki kurallar\u0131na uygunlu\u011funun ele al\u0131nmas\u0131 gerekmekte olup bu kapsamda d\u00fczenlemenin y\u00fcr\u00fctme yetkisine ili\u015fkin olmas\u0131, Anayasa\u2019n\u0131n \u0130kinci K\u0131sm\u0131\u2019n\u0131n Birinci ve \u0130kinci B\u00f6l\u00fcmlerinde yer alan temel haklar, ki\u015fi haklar\u0131 ve \u00f6devleriyle D\u00f6rd\u00fcnc\u00fc B\u00f6l\u00fcm\u00fc\u2019nde yer alan siyasi haklar ve \u00f6devlerle ilgili olmamas\u0131, Anayasa\u2019da m\u00fcnhas\u0131ran kanunla d\u00fczenlenmesi \u00f6ng\u00f6r\u00fclen ya da kanunda a\u00e7\u0131k\u00e7a d\u00fczenlenen konulara ili\u015fkin olmamas\u0131 gerekir. CBK\u2019n\u0131n 5. maddesiyle (1) numaral\u0131 CBK\u2019ya eklenen 435\/A maddesinin ilk f\u0131kras\u0131nda, su kaynaklar\u0131n\u0131n etkin y\u00f6netimi ve verimli kullan\u0131lmas\u0131n\u0131n temini i\u00e7in Ulusal Su Kurulu kurulmas\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015f; ayn\u0131 zamanda kurulun kimlerden olu\u015faca\u011f\u0131 h\u00fckme ba\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>5. \u0130ptali talep edilen (2) numaral\u0131 f\u0131krada, kentlerde ve k\u0131rsalda su-g\u0131da-enerji-ekosistem ili\u015fkisini temel alan su arz\u0131na ili\u015fkin k\u0131sa ve uzun vadeli plan, politika ve stratejileri olu\u015fturma, kaynaklar\u0131n\u0131n s\u00fcrd\u00fcr\u00fclebilir y\u00f6netimine ili\u015fkin al\u0131nacak tedbirlere ve uygulanacak politikalara y\u00f6nelik \u00f6nerilerde bulunma, su kaynaklar\u0131n\u0131n kalitesinin ve miktar\u0131n\u0131n korunmas\u0131na ili\u015fkin planlar\u0131n uygulanmas\u0131nda kar\u015f\u0131la\u015f\u0131lan sorunlar\u0131n \u00e7\u00f6z\u00fcm\u00fcne y\u00f6nelik kararlar alma, su kaynaklar\u0131n\u0131n korunmas\u0131 ve iyile\u015ftirilmesine ili\u015fkin planlarda belirlenen tedbirlerin \u00f6nceliklendirilmesi ve uygulanmas\u0131 i\u00e7in kamu kaynaklar\u0131n\u0131n etkin ve verimli kullan\u0131lmas\u0131na y\u00f6nelik kararlar alma, su tahsisinde arz ve talep dengesini sa\u011flamaya ve sekt\u00f6rel su payla\u015f\u0131m\u0131na y\u00f6nelik kararlar alma, su konusundaki arz ve talepleri de\u011ferlendirme ve karara ba\u011flama, ulusal su plan\u0131, havza \u00f6l\u00e7ekli y\u00f6netim planlar\u0131, su verimlili\u011fi il planlar\u0131 ile i\u00e7me ve kullanma suyu g\u00fcvenli\u011fi planlar\u0131n\u0131 karara ba\u011flaman\u0131n Ulusal Su Kurulunun g\u00f6rev ve yetkileri olarak d\u00fczenlendi\u011fi g\u00f6r\u00fclmektedir.<\/p>\n<p>6. CBK\u2019n\u0131n 5. maddesiyle (1) numaral\u0131 CBK\u2019ya eklenen 435\/A maddesinin (6) numaral\u0131 f\u0131kras\u0131nda ise; havza \u00f6l\u00e7ekli y\u00f6netim planlar\u0131, su verimlili\u011fi il planlar\u0131 ile i\u00e7me ve kullanma suyu g\u00fcvenli\u011fi planlar\u0131n\u0131n haz\u0131rlanmas\u0131na katk\u0131da bulunmak, su kaynaklar\u0131n\u0131n korunmas\u0131 ve etkin y\u00f6netimine y\u00f6nelik uygulamalar\u0131n izlenmesi ve de\u011ferlendirilmesiyle ilgili \u00e7al\u0131\u015fmalar\u0131 y\u00fcr\u00fctmek \u00fczere ilgili bakanl\u0131klar, kamu kurum ve kurulu\u015flar\u0131, meslek odalar\u0131, sivil toplum kurulu\u015flar\u0131, sekt\u00f6r temsilcileri ve konu ile ilgili uzmanlar\u0131n kat\u0131l\u0131m\u0131 ile her su havzas\u0131nda Bakanl\u0131k\u00e7a belirlenen koordinat\u00f6r il valisi ba\u015fkanl\u0131\u011f\u0131nda Havza Su Kurulu, her ilde il valisi ba\u015fkanl\u0131\u011f\u0131nda \u0130l Su Kurulu kurulmas\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>7. Bu ba\u011flamda madde h\u00fck\u00fcmleri birlikte de\u011ferlendirildi\u011finde; CBK\u2019n\u0131n an\u0131lan f\u0131kralar\u0131n\u0131n temel konusunun, su kaynaklar\u0131n\u0131n y\u00f6netimi ve verimli kullan\u0131lmas\u0131na y\u00f6nelik politika belirlenmesi ve bu do\u011frultudaki politikalara katk\u0131da bulunulmas\u0131 amac\u0131yla ulusal ve b\u00f6lgesel d\u00fczeyde su kurullar\u0131 kurulmas\u0131n\u0131n hukuksal temelinin olu\u015fturulmas\u0131 oldu\u011fu anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>8. Dava dilek\u00e7esinde CBK\u2019ya y\u00f6nelik ileri s\u00fcr\u00fclen ayk\u0131r\u0131l\u0131k iddialar\u0131n\u0131n \u00f6z\u00fc CBK \u00e7\u0131kar\u0131lamayacak bir alanda CBK ile d\u00fczenleme yap\u0131ld\u0131\u011f\u0131d\u0131r. Bu husus, konu bak\u0131m\u0131ndan yetki y\u00f6n\u00fcnden Anayasa\u2019ya uygunluk denetimiyle ilgili oldu\u011fundan inceleme Anayasa\u2019n\u0131n 104. maddesinin on yedinci f\u0131kras\u0131 kapsam\u0131nda incelenmelidir.<\/p>\n<p>9. CBK\u2019n\u0131n dava konusu 435\/A maddesinin (1), (2) ve (6) numaral\u0131 f\u0131kralar\u0131nda idari usul ve esaslar \u00e7er\u00e7evesinde su kurullar\u0131n\u0131n kurulmas\u0131 ve i\u015fleyi\u015fine y\u00f6nelik d\u00fczenlemeler \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>10. Anayasa\u2019n\u0131n 104. maddesinin on yedinci f\u0131kras\u0131n\u0131n \u00fc\u00e7\u00fcnc\u00fc c\u00fcmlesinde Anayasa\u2019da m\u00fcnhas\u0131ran kanunla d\u00fczenlenmesi \u00f6ng\u00f6r\u00fclen konularda CBK \u00e7\u0131kar\u0131lamayaca\u011f\u0131 h\u00fckm\u00fcne yer verilmi\u015ftir. Anayasa koyucunun bir konunun kanunla d\u00fczenlenmesini \u00f6zel olarak \u00f6ng\u00f6rmesi bu alan\u0131n m\u00fcnhas\u0131ran kanunla d\u00fczenlenmesini istedi\u011fi anlam\u0131na gelir. Bu kapsamda Anayasa bir konunun kanunla d\u00fczenlenece\u011fini \u00f6ng\u00f6rm\u00fc\u015fse bu konuda CBK \u00e7\u0131kar\u0131lamaz. Bununla birlikte Anayasa\u2019da CBK\u2019larla d\u00fczenlenece\u011fi \u00f6zel olarak \u00f6ng\u00f6r\u00fclen konulara ili\u015fkin Anayasa h\u00fck\u00fcmlerinin a\u00e7\u0131k\u00e7a izin verdi\u011fi hususlarda CBK\u2019larla d\u00fczenleme yap\u0131labilir (AYM, E.2019\/105, K.2020\/30, 12\/6\/2020, \u00a7 19).<\/p>\n<p>11. Anayasa\u2019n\u0131n 123. maddesinin birinci f\u0131kras\u0131na g\u00f6re \u201c\u0130dare, kurulu\u015f ve g\u00f6revleriyle bir b\u00fct\u00fcnd\u00fcr ve kanunla d\u00fczenlenir.\u201d Anayasa\u2019n\u0131n an\u0131lan maddesinde d\u00fczenlenen idarenin kanunili\u011fi ilkesi, idarenin ve organlar\u0131n\u0131n g\u00f6rev ve yetkilerinin kanunla d\u00fczenlenmesini gerekli k\u0131lar (AYM, E.2013\/114, K.2014\/184, 4\/12\/2014, \u00a7 136, AYM, E.2012\/102, K.2012\/207, 27\/12\/2012). Ancak Anayasa\u2019n\u0131n 106. maddesinin on birinci f\u0131kras\u0131nda \u201cBakanl\u0131klar\u0131n kurulmas\u0131, kald\u0131r\u0131lmas\u0131, g\u00f6revleri ve yetkileri, te\u015fkilat yap\u0131s\u0131 ile merkez ve ta\u015fra te\u015fkilatlar\u0131n\u0131n kurulmas\u0131 Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesiyle d\u00fczenlenir.\u201d denilmek suretiyle bakanl\u0131klar\u0131n kurulmas\u0131, kald\u0131r\u0131lmas\u0131, g\u00f6revleri ve yetkileri, te\u015fkilat yap\u0131s\u0131 ile merkez ve ta\u015fra te\u015fkilatlar\u0131n\u0131n kurulmas\u0131 y\u00f6n\u00fcnden CBK\u2019larla d\u00fczenleme yap\u0131lmas\u0131na a\u00e7\u0131k\u00e7a izin verilmi\u015ftir.<\/p>\n<p>12. An\u0131lan kurullar\u0131n t\u00fczel ki\u015filikleri bulunmad\u0131\u011f\u0131 gibi (1) numaral\u0131 CBK\u2019n\u0131n \u201cTar\u0131m ve Orman Bakanl\u0131\u011f\u0131\u201d B\u00f6l\u00fcm\u00fc\u2019nde d\u00fczenlenmelerine kar\u015f\u0131n s\u00f6z konusu Bakanl\u0131\u011f\u0131n merkez veya ta\u015fra te\u015fkilat\u0131na da d\u00e2hil olmad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>14. Anayasa Mahkemesinin 22\/1\/2020 tarihli ve E.2018\/125 ve K.2020\/4 say\u0131l\u0131 karar\u0131nda ifade edildi\u011fi \u00fczere kamu t\u00fczel ki\u015fili\u011fi bulunmayan, herhangi bir bakanl\u0131\u011f\u0131n merkez veya ta\u015fra te\u015fkilat\u0131na da d\u00e2hil olmayan idari bir birimin g\u00f6rev ve yetkilerinin CBK\u2019yla d\u00fczenlenmesi Anayasa\u2019n\u0131n 106. maddesinin on birinci f\u0131kras\u0131nda \u00f6ng\u00f6r\u00fclen \u201cBakanl\u0131klar\u0131n kurulmas\u0131, kald\u0131r\u0131lmas\u0131, g\u00f6revleri ve yetkileri, te\u015fkilat yap\u0131s\u0131 ile merkez ve ta\u015fra te\u015fkilatlar\u0131n\u0131n kurulmas\u0131 Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesiyle d\u00fczenlenir\u201d \u015feklindeki kural kapsam\u0131nda bulunmamaktad\u0131r. Ayr\u0131ca s\u00f6z konusu g\u00f6rev ve yetkiler Anayasa\u2019da CBK ile d\u00fczenlenece\u011fi \u00f6zel olarak \u00f6ng\u00f6r\u00fclen di\u011fer konulardan da de\u011fildir. Dolay\u0131s\u0131yla kamu t\u00fczel ki\u015fili\u011fi bulunmayan ve Cumhurba\u015fkanl\u0131\u011f\u0131 veya herhangi bir bakanl\u0131k te\u015fkilat\u0131na d\u00e2hil olmayan Kurullar\u0131n g\u00f6rev ve yetkileri Anayasa\u2019da CBK ile d\u00fczenlenece\u011fi \u00f6zel olarak \u00f6ng\u00f6r\u00fclen konulardan de\u011fildir.<\/p>\n<p>15. CBK 421\/-i maddesinde yer alan Ulusal Su Kurulunun sekreterya hizmetlerinin Su Y\u00f6netimi Genel Y\u00f6netimi taraf\u0131ndan y\u00fcr\u00fct\u00fclece\u011fine dair d\u00fczenlemeden CBK koyucunun kurdu\u011fu kurumun bakanl\u0131k hiyerar\u015fisinde yer almayacak bir kurum olarak d\u00fczenlendi\u011fi anla\u015f\u0131lmaktad\u0131r. Ayn\u0131 zamanda farkl\u0131 bakanl\u0131klar kurum ve kurulu\u015flardan olu\u015fmas\u0131 sebebiyle de Tar\u0131m ve Orman Bakanl\u0131\u011f\u0131 hiyerar\u015fisinde kabul edilemeyece\u011fi a\u015fikard\u0131r.<\/p>\n<p>16. Dava konusu CBK h\u00fck\u00fcmleri, idari te\u015fkilat i\u00e7erisinde yeni bir birimin do\u011frudan kurulu\u015fu ile g\u00f6rev ve yetkilerine ili\u015fkin olup belirtilen hususlar Anayasa\u2019n\u0131n 123. maddesi uyar\u0131nca kanunla d\u00fczenlenmelidir.
