An\u0131lan b\u00f6l\u00fcm\u00fcn (h) bendinde ise gelir uzmanlar\u0131, il istihdam uzmanlar\u0131, mali hizmetler uzmanlar\u0131, vergi istihbarat uzmanlar\u0131, i\u00e7i\u015fleri bakanl\u0131\u011f\u0131 planlama uzmanlar\u0131, il g\u00f6\u00e7 uzmanlar\u0131, \u00fcr\u00fcn denetmenleri, g\u00fcmr\u00fck ve ticaret denetmenleri, sosyal g\u00fcvenlik denetmenleri, defterdarl\u0131k uzmanlar\u0131 kadrolar\u0131na atanm\u0131\u015f olanlar\u0131n bulunduklar\u0131 derecelere g\u00f6re 1400 ila 3600 g\u00f6sterge rakamlar\u0131ndan yararlanacaklar\u0131 d\u00fczenlenmi\u015ftir.<\/p>\n<p>6. S\u00f6z konusu ek g\u00f6sterge rakamlar\u0131ndan yararlanabilmek i\u00e7in an\u0131lan bentlerde say\u0131lan kadrolarda bulunmakla birlikte en az \u00fc\u00e7 y\u0131l s\u00fcreli y\u00fcksek\u00f6\u011fretim veren fak\u00fclte ve y\u00fcksekokullar\u0131 bitirerek mesle\u011fe \u00f6zel yar\u0131\u015fma s\u0131nav\u0131yla girmi\u015f ve belirli s\u00fcreli meslek i\u00e7i e\u011fitimden sonra \u00f6zel bir yeterlik s\u0131nav\u0131 sonunda atanm\u0131\u015f olmak gerekmektedir. Buna g\u00f6re belirtilen kadrolara mesle\u011fe \u00f6zel yar\u0131\u015fma s\u0131nav\u0131yla girmi\u015f ve belirli s\u00fcreli meslek i\u00e7i e\u011fitimden sonra \u00f6zel bir yeterlik s\u0131nav\u0131 sonunda atanm\u0131\u015f olma \u015fart\u0131na tabi olmadan atananlardan atamas\u0131 ge\u00e7ici 47. maddesinin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten \u00f6nce yap\u0131lm\u0131\u015f olanlar da s\u00f6z konusu ek g\u00f6sterge rakamlar\u0131ndan yararlanabilecektir. \u0130tiraz konusu kural an\u0131lan f\u0131krada yer alan \u201c\u2026bu maddenin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten \u00f6nce \u2026\u201d ibaresidir.<\/p>\n<p>8. 657 say\u0131l\u0131 Kanun\u2019un ge\u00e7ici 47. maddesi 15\/1\/2023 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015ftir. Dolay\u0131s\u0131yla an\u0131lan madde h\u00fckm\u00fcyle getirilen imk\u00e2ndan yararlan\u0131labilmek i\u00e7in s\u00f6z konusu kadrolara 15\/1\/2023 tarihinden \u00f6nce atanm\u0131\u015f olunmas\u0131 gerekmektedir.<\/p>\n<p>9. Buna g\u00f6re ilgili mevzuat h\u00fck\u00fcmlerine uygun olarak an\u0131lan bentlerde say\u0131lan kadrolara atanm\u0131\u015f olanlar\u0131n s\u00f6z konusu bentler i\u00e7in \u00f6ng\u00f6r\u00fclen ek g\u00f6sterge rakamlar\u0131ndan yararlanabilmesi i\u00e7in en az \u00fc\u00e7 y\u0131l s\u00fcreli y\u00fcksek\u00f6\u011fretim veren fak\u00fclte ve y\u00fcksekokullar\u0131 bitirmi\u015f olmalar\u0131 ve atama tarihlerinin kural uyar\u0131nca 657 say\u0131l\u0131 Kanun\u2019un ge\u00e7ici 47. maddesinin y\u00fcr\u00fcrl\u00fck tarihinden \u00f6nce olmas\u0131 gerekmektedir.<\/p>\n<p>10. An\u0131lan kadrolara ilgili mevzuat h\u00fck\u00fcmleri uyar\u0131nca s\u00f6z konusu maddenin y\u00fcr\u00fcrl\u00fck tarihinde ve sonras\u0131nda atanan ki\u015filer s\u00f6z konusu bentler i\u00e7in \u00f6ng\u00f6r\u00fclen ek g\u00f6sterge rakamlar\u0131ndan yararlanamayacaklard\u0131r.<\/p>\n<p>B. \u0130tiraz\u0131n Gerek\u00e7esi<\/p>\n<p>11. Ba\u015fvuru karar\u0131nda \u00f6zetle; ki\u015filerin ayn\u0131 mevzuat kapsam\u0131nda farkl\u0131 tarihlerde yap\u0131lan iki s\u0131nav sonucu kendilerine atfedilebilecek bir kusur olmaks\u0131z\u0131n s\u0131rf farkl\u0131 tarihlerde atanmalar\u0131 nedeniyle farkl\u0131 ek g\u00f6sterge rakamlar\u0131ndan faydaland\u0131r\u0131lmalar\u0131n\u0131n makul ve hakl\u0131 bir sebebe dayanmad\u0131\u011f\u0131, bu durumun ayn\u0131 konumda bulunan ki\u015filer aras\u0131nda e\u015fitsizli\u011fe neden oldu\u011fu belirtilerek kural\u0131n Anayasa\u2019n\u0131n 2., 10. ve 35. maddelerine ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>C. Anayasa\u2019ya Ayk\u0131r\u0131l\u0131k Sorunu<\/p>\n<p>12. Anayasa\u2019n\u0131n 10. maddesinde \u201cHerkes, dil, \u0131rk, renk, cinsiyet, siyas\u00ee d\u00fc\u015f\u00fcnce, felsef\u00ee inan\u00e7, din, mezhep ve benzeri sebeplerle ay\u0131r\u0131m g\u00f6zetilmeksizin kanun \u00f6n\u00fcnde e\u015fittir.\/ Kad\u0131nlar ve erkekler e\u015fit haklara sahiptir. Devlet, bu e\u015fitli\u011fin ya\u015fama ge\u00e7mesini sa\u011flamakla y\u00fck\u00fcml\u00fcd\u00fcr. Bu maksatla al\u0131nacak tedbirler e\u015fitlik ilkesine ayk\u0131r\u0131 olarak yorumlanamaz.\/ \u00c7ocuklar, ya\u015fl\u0131lar, \u00f6z\u00fcrl\u00fcler, harp ve vazife \u015fehitlerinin dul ve yetimleri ile malul ve gaziler i\u00e7in al\u0131nacak tedbirler e\u015fitlik ilkesine ayk\u0131r\u0131 say\u0131lmaz.\/ Hi\u00e7bir ki\u015fiye, aileye, z\u00fcmreye veya s\u0131n\u0131fa imtiyaz tan\u0131namaz.\/ Devlet organlar\u0131 ve idare makamlar\u0131 b\u00fct\u00fcn i\u015flemlerinde kanun \u00f6n\u00fcnde e\u015fitlik ilkesine uygun olarak hareket etmek zorundad\u0131rlar.\u201d denilmek suretiyle kanun \u00f6n\u00fcnde e\u015fitlik ilkesine yer verilmi\u015ftir.<\/p>\n<p>13. Anayasa\u2019n\u0131n an\u0131lan maddesinde belirtilen kanun \u00f6n\u00fcnde e\u015fitlik ilkesi hukuksal durumlar\u0131 ayn\u0131 olanlar i\u00e7in s\u00f6z konusudur. Bu ilke ile eylemli de\u011fil hukuksal e\u015fitlik \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. \u0130lkenin amac\u0131 ayn\u0131 durumda bulunan ki\u015filerin kanunlar kar\u015f\u0131s\u0131nda ayn\u0131 i\u015fleme ba\u011fl\u0131 tutulmalar\u0131n\u0131 sa\u011flamak, ki\u015filere ayr\u0131m yap\u0131lmas\u0131n\u0131 ve ayr\u0131cal\u0131k tan\u0131nmas\u0131n\u0131 \u00f6nlemektir. \u0130lkeyle, ayn\u0131 durumda bulunan kimi ki\u015fi ve topluluklara ayr\u0131 kurallar uygulanarak kanun kar\u015f\u0131s\u0131nda e\u015fitli\u011fin ihlali yasaklanm\u0131\u015ft\u0131r. Kanun \u00f6n\u00fcnde e\u015fitlik, herkesin her y\u00f6nden ayn\u0131 kurallara ba\u011fl\u0131 tutulaca\u011f\u0131 anlam\u0131na gelmez. Durumlar\u0131ndaki \u00f6zellikler, kimi ki\u015filer ya da topluluklar i\u00e7in farkl\u0131 kurallar\u0131 ve uygulamalar\u0131 gerektirebilir. Ayn\u0131 hukuksal durumlar ayn\u0131, ayr\u0131 hukuksal durumlar farkl\u0131 kurallara ba\u011fl\u0131 tutulursa Anayasa\u2019da \u00f6ng\u00f6r\u00fclen e\u015fitlik ilkesi zedelenmez (AYM, E.2021\/129, K.2022\/33, 24\/3\/2022, \u00a7 23).<\/p>\n<p>14. \u00d6te yandan Anayasa Mahkemesi \u201cbenzeri sebeplerle\u201d ifadesinin yorumu ba\u011flam\u0131nda \u201c&#8230;\u00d6zg\u00fcrl\u00fcklerle ilgili olarak Anayasada yer alan en \u00f6nemli kavramlardan birini de yasa \u00f6n\u00fcnde e\u015fitlik ilkesi olu\u015fturmaktad\u0131r. \u2026 e\u015fitlik a\u00e7\u0131s\u0131ndan ay\u0131r\u0131m yap\u0131lmayacak hususlar madde metninde say\u0131lanlarla s\u0131n\u0131rl\u0131 de\u011fildir. \u2018Benzeri sebeplerle\u2019 de ay\u0131r\u0131m yap\u0131lamayaca\u011f\u0131 esas\u0131 getirilmek suretiyle ay\u0131r\u0131m yap\u0131lamayacak konular geni\u015fletilmi\u015f ve b\u00f6ylece kurala uygulama a\u00e7\u0131s\u0131ndan da a\u00e7\u0131kl\u0131k kazand\u0131r\u0131lm\u0131\u015ft\u0131r&#8230;\u201d diyerek ayr\u0131mc\u0131l\u0131k temellerinin maddede say\u0131lanlarla s\u0131n\u0131rl\u0131 olmad\u0131\u011f\u0131n\u0131 a\u00e7\u0131k\u00e7a ifade etmi\u015ftir (AYM, E.1986\/11, K.1986\/26, 4\/11\/1986).<\/p>\n<p>15. Anayasa\u2019n\u0131n 35. maddesinde \u201cHerkes, m\u00fclkiyet ve miras haklar\u0131na sahiptir.\/Bu haklar, ancak kamu yarar\u0131 amac\u0131yla, kanunla s\u0131n\u0131rlanabilir.\/ M\u00fclkiyet hakk\u0131n\u0131n kullan\u0131lmas\u0131 toplum yarar\u0131na ayk\u0131r\u0131 olamaz.\u201d denilmektedir. Anayasa\u2019n\u0131n an\u0131lan maddesiyle g\u00fcvenceye ba\u011flanan m\u00fclkiyet hakk\u0131, ekonomik de\u011fer ifade eden ve parasal kar\u015f\u0131l\u0131\u011f\u0131 olan her t\u00fcrl\u00fc mal varl\u0131\u011f\u0131n\u0131 kapsamaktad\u0131r.<\/p>\n<p>16. Anayasa Mahkemesi norm denetimi ve bireysel ba\u015fvuru kapsam\u0131nda verdi\u011fi kararlar\u0131nda ki\u015filere \u00f6denmesi \u00f6ng\u00f6r\u00fclen \u00fccret, maa\u015f, ya\u015fl\u0131l\u0131k ayl\u0131\u011f\u0131, emeklilik ikramiyesi ve k\u0131dem tazminat\u0131 gibi \u00f6demeleri m\u00fclkiyet hakk\u0131 kapsam\u0131nda de\u011ferlendirmektedir (Ya\u015fl\u0131l\u0131k ayl\u0131\u011f\u0131yla ilgili olarak norm denetiminde verilen karar i\u00e7in bkz. No: 2016\/7192, 7\/11\/2019, \u00a7 30).<\/p>\n<p>17. \u00dccret, ayl\u0131k ve benzeri mali imk\u00e2nlar\u0131n m\u00fclkiyet hakk\u0131 kapsam\u0131nda incelenebilmesi i\u00e7in bunlar\u0131n kanunla tan\u0131nm\u0131\u015f olmas\u0131 gerekir. S\u00f6z konusu mali imk\u00e2nlar\u0131n tan\u0131nmas\u0131 gerekti\u011fine ili\u015fkin iddialar kural olarak m\u00fclkiyet hakk\u0131 kapsam\u0131nda incelenemez. Bunun tek istisnas\u0131, belirtilen mali imk\u00e2nlar\u0131n baz\u0131 ki\u015filere tan\u0131nmamas\u0131n\u0131n e\u015fitlik ilkesi kapsam\u0131nda incelenebilmesi \u015fartlar\u0131n\u0131n olu\u015fmas\u0131d\u0131r. \u015eartlar\u0131n varl\u0131\u011f\u0131 ise e\u015fitlik ilkesine ayk\u0131r\u0131l\u0131\u011f\u0131 ileri s\u00fcr\u00fclen neden olmasayd\u0131 kapsam d\u0131\u015f\u0131 b\u0131rak\u0131lan ki\u015filerin de s\u00f6z konusu haktan yararlanma imk\u00e2nlar\u0131n\u0131n bulunup bulunmad\u0131\u011f\u0131yla belirlenebilecektir. Bu gibi durumlarda kural\u0131n m\u00fclkiyet hakk\u0131yla ba\u011flant\u0131l\u0131 olarak e\u015fitlik ilkesi kapsam\u0131nda incelenmesi m\u00fcmk\u00fcnd\u00fcr. Bu ba\u011flamda m\u00fclkiyet hakk\u0131n\u0131n ihlal edilip edilmedi\u011fi de\u011ferlendirilirken m\u00fclk\u00fcn varl\u0131\u011f\u0131n\u0131n emsal durumda olan ki\u015fiye g\u00f6re belirlenmesi gerekir (benzer y\u00f6ndeki kararlar i\u00e7in bkz. No: 20452\/14, 19\/12\/2018, \u00a7 127).<\/p>\n<p>18. 657 say\u0131l\u0131 Kanun\u2019a ekli (1) say\u0131l\u0131 Ek G\u00f6sterge Cetveli\u2019nde belirtilen kadro ve \u00fcnvanlarda bulunan kamu g\u00f6revlilerine de\u011fi\u015fen rakamlarda ek g\u00f6sterge \u00f6denmesi \u00f6ng\u00f6r\u00fclmektedir. Cetvel\u2019e g\u00f6re, s\u00f6z konusu ek g\u00f6stergeden yararlanabilmek i\u00e7in an\u0131lan kadrolarda bulunulmas\u0131 yeterli olmay\u0131p ayr\u0131ca en az 3 y\u0131l s\u00fcreli y\u00fcksek\u00f6\u011fretim veren fak\u00fclte ve y\u00fcksekokullar\u0131 bitirerek mesle\u011fe \u00f6zel yar\u0131\u015fma s\u0131nav\u0131 ile girmi\u015f ve belirli s\u00fcreli meslek i\u00e7i e\u011fitimden sonra \u00f6zel bir yeterlik s\u0131nav\u0131 sonunda atanm\u0131\u015f olmak gerekmektedir. Bu \u015fartlar\u0131 ta\u015f\u0131madan, ba\u015fka bir usulle an\u0131lan kadrolara atananlar\u0131n ([g] bendi y\u00f6n\u00fcnden parantez i\u00e7i h\u00fck\u00fcmde belirtilen usulle atananlar hari\u00e7) s\u00f6z\u00fc edilen ek g\u00f6sterge rakam\u0131ndan yararlanmas\u0131 m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p>19. \u0130tiraz konusu kuralda ise ola\u011fan usul\u00fcn d\u0131\u015f\u0131ndaki bir usulle atanm\u0131\u015f olanlar\u0131n da s\u00f6z\u00fc edilen ek g\u00f6sterge rakam\u0131ndan yararlanmalar\u0131n\u0131n temin edilmesine y\u00f6nelik olarak bir d\u00fczenleme yap\u0131lm\u0131\u015ft\u0131r. Buna g\u00f6re Cetvel\u2019in \u201cI- Genel \u0130dare Hizmetleri S\u0131n\u0131f\u0131\u201d b\u00f6l\u00fcm\u00fcn\u00fcn (g) ve (h) bentlerinde say\u0131lan kadrolara, mesle\u011fe \u00f6zel yar\u0131\u015fma s\u0131nav\u0131 ile girmi\u015f ve belirli s\u00fcreli meslek i\u00e7i e\u011fitimden sonra \u00f6zel bir yeterlik s\u0131nav\u0131 sonunda atanm\u0131\u015f olma \u015fart\u0131na tabi olmadan, ilgili mevzuat\u0131 uyar\u0131nca atananlar\u0131n da an\u0131lan ek g\u00f6sterge rakam\u0131ndan yararlanmas\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Bununla birlikte bu imk\u00e2n sadece Kanun\u2019un ge\u00e7ici 47. maddesinin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi 15\/1\/2023 tarihinden \u00f6nce atanm\u0131\u015f olanlarla s\u0131n\u0131rl\u0131 tutulmu\u015ftur. Buna g\u00f6re ge\u00e7ici 47. maddenin y\u00fcr\u00fcrl\u00fck tarihi ve sonras\u0131nda atanm\u0131\u015f olanlar s\u00f6z konusu ek g\u00f6sterge rakamlar\u0131ndan yararlanamayacakt\u0131r.<\/p>\n<p>20. S\u00f6z konusu maddenin y\u00fcr\u00fcrl\u00fck tarihinden \u00f6nce ilgili mevzuat\u0131 uyar\u0131nca an\u0131lan Cetvel\u2019in (g) ve (h) bentlerinde say\u0131lan \u00fcnvanl\u0131 kadrolara atananlar i\u00e7in belirlenen ek g\u00f6sterge rakam\u0131ndan, ayn\u0131 kadrolara maddenin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarih ve sonras\u0131nda atanmas\u0131 sebebiyle yararland\u0131r\u0131lmayanlar y\u00f6n\u00fcnden an\u0131lan ek g\u00f6sterge rakam\u0131, ekonomik bir menfaate kar\u015f\u0131l\u0131k gelmektedir. Bu nedenle kural\u0131n m\u00fclkiyet hakk\u0131 ba\u011flam\u0131nda e\u015fitlik ilkesi y\u00f6n\u00fcnden incelenmesi gerekmektedir.<\/p>\n<p>21. M\u00fclkiyet hakk\u0131yla ba\u011flant\u0131l\u0131 olarak e\u015fitlik ilkesi y\u00f6n\u00fcnden yap\u0131lacak anayasall\u0131k denetiminde \u00f6ncelikle Anayasa\u2019n\u0131n 10. maddesi \u00e7er\u00e7evesinde ayn\u0131 ya da benzer durumda bulunan ki\u015filere farkl\u0131 muamelenin mevcut olup olmad\u0131\u011f\u0131 tespit edilmeli, bu ba\u011flamda ayn\u0131 ya da benzer durumdaki ki\u015filer aras\u0131nda m\u00fclkiyet hakk\u0131na getirilen s\u0131n\u0131rlama bak\u0131m\u0131ndan farkl\u0131l\u0131k g\u00f6zetilip g\u00f6zetilmedi\u011fi belirlenmelidir. Bundan sonra farkl\u0131 uygulaman\u0131n nesnel ve makul bir temele dayan\u0131p dayanmad\u0131\u011f\u0131 ve nihayetinde \u00f6l\u00e7\u00fcl\u00fc olup olmad\u0131\u011f\u0131 incelenmelidir (AYM, E.2021\/129, K.2022\/33, 24\/3\/2022, \u00a7 26; E.2018\/8, K.2018\/85, 11\/7\/2018, \u00a7 41; Reis Otomotiv Ticaret ve Sanayi A.\u015e. Cetvel\u2019in \u201cI- Genel \u0130dare Hizmetleri S\u0131n\u0131f\u0131\u201d b\u00f6l\u00fcm\u00fcn\u00fcn (g) ve (h) bentlerinde say\u0131lan \u00fcnvanl\u0131 kadrolara, mesle\u011fe \u00f6zel yar\u0131\u015fma s\u0131nav\u0131 ile girmi\u015f ve belirli s\u00fcreli meslek i\u00e7i e\u011fitimden sonra \u00f6zel bir yeterlik s\u0131nav\u0131 sonunda atanm\u0131\u015f olma \u015fart\u0131na tabi olmadan, ilgili mevzuat\u0131 uyar\u0131nca atanm\u0131\u015f olmak bak\u0131m\u0131ndan 15\/1\/2023 tarihinden \u00f6nce atanm\u0131\u015f olanlar ile bu tarih ve sonras\u0131nda atanm\u0131\u015f olanlar\u0131n durumlar\u0131 benzer ve kar\u015f\u0131la\u015ft\u0131r\u0131labilir niteliktedir. Buna g\u00f6re Cetvel\u2019in \u201cI- Genel \u0130dare Hizmetleri S\u0131n\u0131f\u0131\u201d b\u00f6l\u00fcm\u00fcn\u00fcn (g) ve (h) bentlerinde yer alan ek g\u00f6stergelerden yararlanma imk\u00e2n\u0131n\u0131n sadece 15\/1\/2023 tarihinden \u00f6nce atanm\u0131\u015f olanlara tan\u0131nmas\u0131n\u0131n bu tarih ve sonras\u0131nda atanlar y\u00f6n\u00fcnden farkl\u0131 muamele te\u015fkil etti\u011fi a\u00e7\u0131kt\u0131r. Bu farkl\u0131 muamelenin 15\/1\/2023 tarihinden \u00f6nce atanm\u0131\u015f olup olmama temelinde ger\u00e7ekle\u015ftirildi\u011fi anla\u015f\u0131lmaktad\u0131r. Bu durumda farkl\u0131 muamelenin makul ve nesnel bir temele dayan\u0131p dayanmad\u0131\u011f\u0131n\u0131n de\u011ferlendirilmesi gerekmektedir.<\/p>\n<p>23. Benzer durumda bulunanlara farkl\u0131 muamelede bulunulmas\u0131n\u0131n hakl\u0131 bir temelinin bulunup bulunmad\u0131\u011f\u0131n\u0131n veya farkl\u0131l\u0131\u011f\u0131n ne dereceye kadar m\u00fcstahak olaca\u011f\u0131n\u0131n de\u011ferlendirilmesinde kanun koyucunun belli \u00f6l\u00e7\u00fcde takdir yetkisi bulundu\u011funun alt\u0131 \u00e7izilmelidir. Bununla birlikte bu takdir yetkisinin kapsam\u0131n\u0131n, d\u00fczenlemenin temas etti\u011fi hak veya \u00f6zg\u00fcrl\u00fc\u011f\u00fcn nitelik ve \u00f6zelliklerine ba\u011fl\u0131 olarak geni\u015fleyip daralabilece\u011fi vurgulanmal\u0131d\u0131r (baz\u0131 farklarla birlikte bkz. Nuriye Arpa, \u00a7 59).<\/p>\n<p>24. Kuralla, en az \u00fc\u00e7 y\u0131l s\u00fcreli y\u00fcksek\u00f6\u011fretim veren fak\u00fclte ve y\u00fcksekokullar\u0131 bitirmi\u015f olup (g) ve (h) bentlerinde say\u0131lan \u00fcnvanl\u0131 kadrolara -mesle\u011fe \u00f6zel yar\u0131\u015fma s\u0131nav\u0131 ile girmi\u015f ve belirli s\u00fcreli meslek i\u00e7i e\u011fitimden sonra \u00f6zel bir yeterlik s\u0131nav\u0131 sonunda atanm\u0131\u015f olma \u015fart\u0131na tabi olmadan- ilgili mevzuat h\u00fck\u00fcmleri uyar\u0131nca atananlara, an\u0131lan kadrolar i\u00e7in belirlenen ek g\u00f6stergelerden yararlanma imk\u00e2n\u0131 tan\u0131nm\u0131\u015ft\u0131r. Bununla birlikte bu imk\u00e2ndan yararlan\u0131lmas\u0131 i\u00e7in maddenin y\u00fcr\u00fcrl\u00fck tarihinden \u00f6nce atanm\u0131\u015f olma \u015fart\u0131 getirilmi\u015ftir. Buna g\u00f6re ayn\u0131 \u00fcnvanl\u0131 kadrolara ayn\u0131 mevzuat h\u00fck\u00fcmleri uyar\u0131nca atanan ki\u015filerden bir k\u0131sm\u0131 atama tarihlerinin maddenin y\u00fcr\u00fcrl\u00fck tarihinden \u00f6nce olmas\u0131 nedeniyle s\u00f6z konusu bentler i\u00e7in \u00f6ng\u00f6r\u00fclen ek g\u00f6stergelerden faydalanabilirken atama i\u015flemleri maddenin y\u00fcr\u00fcrl\u00fck tarihinden itibaren yap\u0131lanlar\u0131n an\u0131lan g\u00f6stergelerden faydalanabilmesi m\u00fcmk\u00fcn bulunmamaktad\u0131r.<\/p>\n<p>25. Kanun koyucunun hak do\u011furucu d\u00fczenlemeler yapmas\u0131 ve bu d\u00fczenlemelerin kapsam\u0131ndaki hak ve imk\u00e2nlardan yararlan\u0131lmas\u0131 bak\u0131m\u0131ndan belirli veya belirlenebilir bir tarihi esas almas\u0131, zaman bak\u0131m\u0131ndan hakk\u0131n kapsam\u0131 d\u0131\u015f\u0131nda kalanlar y\u00f6n\u00fcnden kural olarak e\u015fitlik ilkesini ihlal etmez. Bununla birlikte itiraz konusu kuralda \u00f6ng\u00f6r\u00fclen d\u00fczenleme genel bir d\u00fczenleme mahiyetinde olmay\u0131p s\u0131n\u0131rl\u0131 baz\u0131 durumlara uygulanan bir d\u00fczenleme niteli\u011findedir. Kural, \u00f6zel yar\u0131\u015fma s\u0131nav\u0131 ile girilebilen ve belirli s\u00fcreli meslek i\u00e7i e\u011fitimden sonra \u00f6zel bir yeterlik s\u0131nav\u0131 sonunda atama yap\u0131labilen baz\u0131 kadrolara bu usul\u00fcn d\u0131\u015f\u0131ndaki bir usulle atamas\u0131 yap\u0131lan ki\u015filerin de ola\u011fan usulle atamas\u0131 yap\u0131lanlar i\u00e7in \u00f6ng\u00f6r\u00fclen ek g\u00f6stergeden yararlanabilmelerinin sa\u011flanmas\u0131 amac\u0131yla ihdas edilmi\u015ftir. Dolay\u0131s\u0131yla kural s\u00fcrekli ve genel nitelikli bir durumu\/imk\u00e2n\u0131 de\u011fil, ge\u00e7ici ve \u00f6zel bir durumu d\u00fczenlemektedir. H\u00e2l b\u00f6yle olunca atama tarihi itibar\u0131yla bu imk\u00e2n\u0131n kapsam\u0131 d\u0131\u015f\u0131nda kalanlar\u0131n maruz kald\u0131\u011f\u0131 farkl\u0131 muamelenin nesnel ve makul bir nedeninin bulunup bulunmad\u0131\u011f\u0131n\u0131n incelenmesi gerekir.<\/p>\n<p>26. Mesle\u011fe \u00f6zel yar\u0131\u015fma s\u0131nav\u0131 ile girmi\u015f ve belirli s\u00fcreli meslek i\u00e7i e\u011fitimden sonra \u00f6zel bir yeterlik s\u0131nav\u0131 sonunda atanm\u0131\u015f olma \u015fartlar\u0131 aranmaks\u0131z\u0131n Cetvel\u2019in \u201cI- Genel \u0130dare Hizmetleri S\u0131n\u0131f\u0131\u201d b\u00f6l\u00fcm\u00fcnde belirtilen kadrolara atanm\u0131\u015f olanlar\u0131n an\u0131lan Cetvel\u2019in (g) ve (h) bentlerinde belirtilen ek g\u00f6stergelerden yararland\u0131r\u0131p yararland\u0131rmama konusunda d\u00fczenleme yap\u0131lmas\u0131nda kanun koyucunun takdir yetkisinin bulundu\u011fu ku\u015fkusuzdur. Bu ba\u011flamda mesle\u011fe \u00f6zel yar\u0131\u015fma s\u0131nav\u0131 ile girmi\u015f ve belirli s\u00fcreli meslek i\u00e7i e\u011fitimden sonra \u00f6zel bir yeterlik s\u0131nav\u0131 sonunda atanm\u0131\u015f ki\u015filere sa\u011flanan mali haklar\u0131n belirtilen kadrolara bu \u015fartlar\u0131 sa\u011flamadan atanm\u0131\u015f ki\u015filere de tan\u0131nmas\u0131 kanun koyucunun takdir yetkisi kapsam\u0131nda kalmaktad\u0131r. Bununla birlikte bu \u015fekilde bir d\u00fczenleme yap\u0131ld\u0131\u011f\u0131nda, mesle\u011fe \u00f6zel yar\u0131\u015fma s\u0131nav\u0131 ile girmi\u015f ve belirli s\u00fcreli meslek i\u00e7i e\u011fitimden sonra \u00f6zel bir yeterlik s\u0131nav\u0131 sonunda atanm\u0131\u015f olma \u015fartlar\u0131n\u0131 ta\u015f\u0131mamak bak\u0131m\u0131ndan ayn\u0131 durumda olan ki\u015filere (15\/1\/2023 tarihinden \u00f6nce atanm\u0131\u015f olanlar ile bu tarih ve sonras\u0131nda atanm\u0131\u015f olanlara) farkl\u0131 muamelede bulunulmas\u0131n\u0131n nesnel ve makul bir temeli bulunmamaktad\u0131r.<\/p>\n<p>27. Kanun\u2019un ge\u00e7ici 47. maddesinin gerek\u00e7esinde mesle\u011fe \u00f6zel yar\u0131\u015fma s\u0131nav\u0131 ile girmi\u015f ve belirli s\u00fcreli meslek i\u00e7i e\u011fitimden sonra \u00f6zel bir yeterlik s\u0131nav\u0131 sonunda atanm\u0131\u015f olma \u015fart\u0131n\u0131n; Cetvel\u2019in \u201cI- Genel \u0130dare Hizmetleri S\u0131n\u0131f\u0131\u201d b\u00f6l\u00fcm\u00fcn\u00fcn (g) ve (h) bentlerinde belirtilen ek g\u00f6stergelerin dikkate al\u0131nabilmesi i\u00e7in bentlerde say\u0131lan kadrolara atanm\u0131\u015f olanlardan en az \u00fc\u00e7 y\u0131l s\u00fcreli y\u00fcksek\u00f6\u011fretim veren fak\u00fclte ve y\u00fcksekokullar\u0131 bitirmi\u015f olanlar i\u00e7in dikkate al\u0131nmayarak (g) ve (h) bentlerinde belirtilen g\u00f6sterge rakamlar\u0131n\u0131n bu durumda olanlar i\u00e7in uygulanmas\u0131n\u0131n ama\u00e7land\u0131\u011f\u0131 belirtilmi\u015ftir. Buna g\u00f6re d\u00fczenlemenin temel amac\u0131n\u0131n, Cetvel\u2019in \u201cI- Genel \u0130dare Hizmetleri S\u0131n\u0131f\u0131\u201d b\u00f6l\u00fcm\u00fcn\u00fcn (g) ve (h) bentlerinde belirtilen kadrolara, mesle\u011fe \u00f6zel yar\u0131\u015fma s\u0131nav\u0131 ile girmi\u015f ve belirli s\u00fcreli meslek i\u00e7i e\u011fitimden sonra \u00f6zel bir yeterlik s\u0131nav\u0131 sonunda atanm\u0131\u015f olma \u015fart\u0131n\u0131 ta\u015f\u0131madan atananlar\u0131n da s\u00f6z konusu kadrolar i\u00e7in \u00f6ng\u00f6r\u00fclen ek g\u00f6stergeden yararlanmas\u0131n\u0131n sa\u011flanmas\u0131 oldu\u011fu anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>28. Belirtilen kadrolara mesle\u011fe \u00f6zel yar\u0131\u015fma s\u0131nav\u0131 ile girmi\u015f ve belirli s\u00fcreli meslek i\u00e7i e\u011fitimden sonra \u00f6zel bir yeterlik s\u0131nav\u0131 sonunda atanm\u0131\u015f olma \u015fart\u0131na tabi olmaks\u0131z\u0131n atama yap\u0131lmas\u0131 uygulamas\u0131n\u0131n 15\/1\/2023 tarihi \u00f6ncesiyle s\u0131n\u0131rl\u0131 olmad\u0131\u011f\u0131, bu tarihten sonra da bu uygulamaya devam edildi\u011fi g\u00f6zlemlenmektedir. S\u00f6z konusu usulle atama uygulamas\u0131n\u0131n 15\/1\/2023 tarihinden sonra da devam etti\u011fi g\u00f6zetildi\u011finde an\u0131lan ek g\u00f6stergeden yararlanma imk\u00e2n\u0131n\u0131n 15\/1\/2023 tarihi ve sonras\u0131nda atanm\u0131\u015f olanlara tan\u0131nmamas\u0131n\u0131n makul bir nedene dayand\u0131\u011f\u0131n\u0131n ve kanun koyucunun farkl\u0131 muamelede bulunma hususunda haiz oldu\u011fu takdir yetkisinin s\u0131n\u0131rlar\u0131 i\u00e7erisinde kald\u0131\u011f\u0131n\u0131n kabul\u00fc m\u00fcmk\u00fcn g\u00f6r\u00fclmemi\u015ftir.<\/p>\n<p>29. Bu itibarla kuralla en az \u00fc\u00e7 y\u0131l s\u00fcreli y\u00fcksek\u00f6\u011fretim veren fak\u00fclte ve y\u00fcksek okullar\u0131 bitirmi\u015f olup Cetvel\u2019in \u201cI- Genel \u0130dare Hizmetleri S\u0131n\u0131f\u0131\u201d b\u00f6l\u00fcm\u00fcn\u00fcn (g) ve (h) bentlerinde say\u0131lan \u00fcnvanl\u0131 kadrolara ilgili mevzuat h\u00fck\u00fcmleri uyar\u0131nca -mesle\u011fe \u00f6zel yar\u0131\u015fma s\u0131nav\u0131 ile girmi\u015f ve belirli s\u00fcreli meslek i\u00e7i e\u011fitimden sonra \u00f6zel bir yeterlik s\u0131nav\u0131 sonunda atanm\u0131\u015f olma \u015fart\u0131na tabi olmadan- atananlardan yaln\u0131zca 15\/1\/2023 tarihinden \u00f6nce atamas\u0131 yap\u0131lanlara (g) ve (h) bentlerinde belirtilen g\u00f6sterge rakamlar\u0131n\u0131n uygulanmas\u0131n\u0131n \u00f6ng\u00f6r\u00fclmesi suretiyle olu\u015fturulan farkl\u0131 muamelenin nesnel ve makul bir temele dayanmad\u0131\u011f\u0131 sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>30.
