BA\u015eVURUNUN KONUSU<\/p>\n<p>1. Ba\u015fvuru, telefonla g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fme yapt\u0131r\u0131lmamas\u0131 nedeniyle haberle\u015fme h\u00fcrriyeti ile aile hayat\u0131na sayg\u0131 hakk\u0131 ve bu haklarla ba\u011flant\u0131l\u0131 olarak ayr\u0131mc\u0131l\u0131k yasa\u011f\u0131n\u0131n ihlal edildi\u011fi iddialar\u0131na ili\u015fkindir.<\/p>\n<p>II. BA\u015eVURU S\u00dcREC\u0130 <\/p>\n<p>2. Ba\u015fvuru 3\/6\/2022 tarihinde yap\u0131lm\u0131\u015ft\u0131r. Komisyon, ba\u015fvurunun kabul edilebilirlik incelemesinin B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na karar vermi\u015ftir. B\u00f6l\u00fcm, ba\u015fvurunun Genel Kurul taraf\u0131ndan incelenmesine karar vermi\u015ftir.<\/p>\n<p>3. Ba\u015fvuru belgelerinin bir \u00f6rne\u011fi bilgi i\u00e7in Adalet Bakanl\u0131\u011f\u0131na (Bakanl\u0131k) g\u00f6nderilmi\u015ftir. Bakanl\u0131k, g\u00f6r\u00fc\u015f\u00fcn\u00fc bildirmi\u015ftir. Ba\u015fvurucu, Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 beyanda bulunmam\u0131\u015ft\u0131r.<\/p>\n<p>4. Birinci B\u00f6l\u00fcm, ba\u015fvurunun Genel Kurul taraf\u0131ndan incelenmesine karar vermi\u015ftir.<\/p>\n<p>III. OLAY VE OLGULAR <\/p>\n<p>5. Ba\u015fvuru formu ve eklerinde ifade edildi\u011fi \u015fekliyle olaylar \u015f\u00f6yledir:<\/p>\n<p>6. Ba\u015fvurucu, h\u00fck\u00fcml\u00fc olarak Kayseri 2 No.lu T Tipi Kapal\u0131 Ceza \u0130nfaz Kurumunda (\u0130nfaz Kurumu) kalmaktad\u0131r. Ba\u015fvurucu, ilgili mevzuata at\u0131fla haftal\u0131k 30 dakika g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fme yapma ve ziyaret hakk\u0131n\u0131 kullanmad\u0131\u011f\u0131 zamanlar i\u00e7in de ayr\u0131ca 30 dakika g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fme yapma hakk\u0131n\u0131n oldu\u011funu belirterek an\u0131lan haklardan yararlanmay\u0131 \u0130nfaz Kurumundan talep etmi\u015ftir. Ceza \u0130nfaz Kurumu \u0130dare G\u00f6zlem Kurulu (Kurul), 15\/4\/2022 tarihli karar\u0131yla ba\u015fvurucunun talebini reddetmi\u015ftir.<\/p>\n<p>7. An\u0131lan kararda ba\u015fvurucunun silahl\u0131 ter\u00f6r \u00f6rg\u00fct\u00fcne \u00fcye olma su\u00e7undan h\u00fck\u00fcml\u00fc oldu\u011fu, g\u00f6r\u00fcnt\u00fcl\u00fc ve sesli g\u00f6r\u00fc\u015fme sistemi alt yap\u0131s\u0131n\u0131n bu kapsamda yer alan mahpuslar\u0131n yaln\u0131zca haftal\u0131k 10 dakika sesli g\u00f6r\u00fc\u015fme yapmalar\u0131na izin verdi\u011fi, sistem \u00fczerinden yap\u0131lacak g\u00f6r\u00fc\u015fmelerin sesli veya g\u00f6r\u00fcnt\u00fcl\u00fc olarak de\u011fi\u015ftirilmesinin mevcut alt yap\u0131 itibar\u0131yla m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 belirtilmi\u015ftir. Ayr\u0131ca g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fmenin yap\u0131lamamas\u0131 h\u00e2linde ne yap\u0131laca\u011f\u0131na ili\u015fkin bir d\u00fczenleme bulunmad\u0131\u011f\u0131 gibi haftal\u0131k telefon g\u00f6r\u00fc\u015fmesi hakk\u0131n\u0131n ek s\u00fcre verilmek suretiyle kulland\u0131rma yap\u0131laca\u011f\u0131na dair bir mevzuat h\u00fckm\u00fcn\u00fcn de bulunmad\u0131\u011f\u0131 vurgulanm\u0131\u015ft\u0131r. Kurul ayr\u0131ca 28\/4\/2022 tarihinde ba\u015fvurucunun iyi h\u00e2lli oldu\u011funa karar vermi\u015ftir.<\/p>\n<p>8. Ba\u015fvurucu, Kurulun g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fme talebinin reddine dair karar\u0131na kar\u015f\u0131 Kayseri 2. \u0130nfaz H\u00e2kimli\u011fine (\u0130nfaz H\u00e2kimli\u011fi) itiraz etmi\u015ftir. \u0130tiraz dilek\u00e7esinde ba\u015fvurucu, ko\u011fu\u015funda sesli ve g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fme kabini kuruldu\u011funu, di\u011fer su\u00e7 gruplar\u0131n\u0131n g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fme yapabildi\u011fini, kendisinin ise sadece haftada on dakika sesli g\u00f6r\u00fc\u015fme yapabildi\u011fini belirtmi\u015ftir. Mevzuat kapsam\u0131nda kendisinin de g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fme hakk\u0131n\u0131n oldu\u011funu, bu haktan yararland\u0131r\u0131lmamas\u0131 durumda sesli g\u00f6r\u00fc\u015fmeye ek g\u00f6r\u00fc\u015fme hakk\u0131 verilmesine y\u00f6nelik yarg\u0131 karar\u0131 bulundu\u011funu vurgulayarak Kurul karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131n\u0131 talep etmi\u015ftir.<\/p>\n<p>9. \u0130nfaz H\u00e2kimli\u011fi 21\/4\/2022 tarihinde itiraz\u0131 reddetmi\u015ftir. Karar\u0131n gerek\u00e7esinde ilgili mevzuat ile Anayasa Mahkemesi ve Avrupa \u0130nsan Haklar\u0131 Mahkemesinin mahpuslar\u0131n haberle\u015fme h\u00fcrriyetine y\u00f6nelik i\u00e7tihatlar\u0131na at\u0131f yapt\u0131ktan sonra, infaz kurumunda bulunan bir h\u00fck\u00fcml\u00fcn\u00fcn telefonla g\u00f6r\u00fc\u015fme hakk\u0131n\u0131n mevcut oldu\u011fu ancak makul ve \u00f6l\u00e7\u00fcl\u00fc olmak kayd\u0131yla bu hakk\u0131n s\u0131n\u0131rlanabilece\u011fi tespiti yap\u0131lm\u0131\u015ft\u0131r. Bu ba\u011flamda mahpusun telefonla g\u00f6r\u00fc\u015fme hakk\u0131n\u0131 sesli g\u00f6r\u00fc\u015fme olarak kulland\u0131r\u0131ld\u0131\u011f\u0131nda haberle\u015fmenin sa\u011flanaca\u011f\u0131, g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fmenin yap\u0131lamamas\u0131n\u0131n haberle\u015fme h\u00fcrriyetine m\u00fcdahale olarak de\u011ferlendirilemeyece\u011fi vurgulanm\u0131\u015ft\u0131r. Ba\u015fvurucunun sesli g\u00f6r\u00fc\u015fmeye ili\u015fkin bir \u015fik\u00e2yetinin bulunmad\u0131\u011f\u0131, sesli g\u00f6r\u00fc\u015fmeleri mevzuatta belirtildi\u011fi \u015fekilde yapabildi\u011fi, g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fme yap\u0131labilmesi konusunda idarenin takdir yetkisini haiz oldu\u011fu dolay\u0131s\u0131yla haberle\u015fme h\u00fcrriyetine bir m\u00fcdahale olmad\u0131\u011f\u0131 belirtilmi\u015ftir.<\/p>\n<p>10. Ba\u015fvurucunun an\u0131lan karara itiraz\u0131n\u0131 Kayseri 1.A\u011f\u0131r Ceza Mahkemesi 10\/5\/2022 tarihinde \u0130nfaz H\u00e2kimli\u011finin gerek\u00e7esini yineleyerek usul ve kanuna ayk\u0131r\u0131l\u0131k bulunmad\u0131\u011f\u0131n\u0131 vurgulamak suretiyle reddetmi\u015ftir.<\/p>\n<p>11. Nihai karar 17\/5\/2022 tarihinde ba\u015fvurucuya tebli\u011f edilmi\u015ftir.<\/p>\n<p>12. Adalet Bakanl\u0131\u011f\u0131 Ceza ve Tevkif Evleri Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc 30\/1\/2025 tarihli yaz\u0131yla ba\u015fvuru konusuna ili\u015fkin olarak \u015fu hususlar\u0131 Anayasa Mahkemesine bildirmi\u015ftir:<\/p>\n<p>i. Cumhurba\u015fkan\u0131 taraf\u0131ndan kamuoyuna duyurulan Yarg\u0131 Reformu Stratejisi ile \u0130nsan Haklar\u0131 Eylem Plan\u0131nda da yer alan Ak\u0131ll\u0131 Teknolojilerin Ceza \u0130nfaz Kurumlar\u0131na Entegrasyonu Projesi (ACEP) kapsam\u0131nda, Sincan ve Bak\u0131rk\u00f6y Kad\u0131n ile Sincan \u00c7ocuk ve Gen\u00e7lik Kapal\u0131 Ceza \u0130nfaz Kurumlar\u0131nda yap\u0131lan pilot denemelerin akabinde gerekli revizeler yap\u0131larak \u00fclkemiz genelinde bulunan t\u00fcm ceza infaz kurumlar\u0131na yayg\u0131nla\u015ft\u0131rma \u00e7al\u0131\u015fmalar\u0131 ba\u015flat\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>ii. ACEP ile h\u00fck\u00fcml\u00fclerin personel taraf\u0131ndan oda ve ko\u011fu\u015f d\u0131\u015f\u0131na \u00e7\u0131kart\u0131lmas\u0131 suretiyle y\u00fcr\u00fct\u00fclen \u00e7e\u015fitli hizmetlerin ses izolasyonlu bir kabin i\u00e7erisinde oda ve ko\u011fu\u015flara yerle\u015ftirilen multimedya cihaz marifetiyle personel sirk\u00fclasyonuna gerek olmaks\u0131z\u0131n daha az insan kayna\u011f\u0131 harcanarak h\u0131zl\u0131 ve g\u00fcvenilir bir bi\u00e7imde ger\u00e7ekle\u015ftirilmesi hedeflenmi\u015f; proje kapsam\u0131nda, g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fme ve e-doktor uygulamas\u0131 gibi daha \u00f6nce hi\u00e7 yap\u0131lmam\u0131\u015f uygulamalar\u0131n da hayata ge\u00e7irilmesi planlanm\u0131\u015ft\u0131r.<\/p>\n<p>iii. \u0130lgili mevzuata g\u00f6re ter\u00f6r ve \u00e7\u0131kar ama\u00e7l\u0131 su\u00e7 \u00f6rg\u00fct\u00fc \u00fcyeleri, g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fme ve g\u00f6r\u00fc\u015fme s\u00fcresinin uzat\u0131lmas\u0131na ili\u015fkin haktan yararland\u0131r\u0131lmalar\u0131 ad\u0131na Ulusal Yarg\u0131 A\u011f\u0131 Bili\u015fim Sistemi (UYAP) karar ekran\u0131 yaz\u0131l\u0131m \u00e7al\u0131\u015fmas\u0131n\u0131n ACEP sistem kabulleri ile birlikte e\u015f zamanl\u0131 olarak yap\u0131lmas\u0131 gerekmektedir. Bunu sa\u011flayacak yaz\u0131l\u0131m ve donan\u0131m geli\u015ftirme \u00e7al\u0131\u015fmas\u0131 ise devam etmektedir. Ceza infaz kurumlar\u0131n\u0131n sisteme bu minvalde bir m\u00fcdahale yetkisi bulanmamaktad\u0131r.<\/p>\n<p>iv. 165 ceza infaz kurumunda ACEP sistemi k\u0131sm\u00ee olarak kurulmu\u015f ise de ter\u00f6r ve \u00e7\u0131kar ama\u00e7l\u0131 su\u00e7 \u00f6rg\u00fct\u00fc \u00fcyelerinin bahse konu sistemden -yaz\u0131l\u0131m ve donan\u0131m \u00e7al\u0131\u015fmalar\u0131n\u0131n devam etmesi nedeniyle- mevcut durum itibar\u0131yla g\u00f6r\u00fcnt\u00fcl\u00fc olarak faydalanmas\u0131 m\u00fcmk\u00fcn de\u011fildir. Ba\u015fvurucunun bulundu\u011fu kurum ile birlikte hi\u00e7bir ceza infaz kurumunda &#8221;ACEP UYAP Karar Ekranlar\u0131&#8221; ve ilgili su\u00e7 gruplar\u0131na y\u00f6nelik ilave g\u00fcvenlik tedbirlerine ili\u015fkin teknik altyap\u0131 tamamlanmam\u0131\u015ft\u0131r.<\/p>\n<p>IV. \u0130LG\u0130L\u0130 HUKUK<\/p>\n<p>A. Ulusal Hukuk<\/p>\n<p>13. 13\/12\/2004 tarihli ve 5275 say\u0131l\u0131 Ceza ve G\u00fcvenlik Tedbirlerinin \u0130nfaz\u0131 Hakk\u0131nda Kanun&#8217;un &#8220;H\u00fck\u00fcml\u00fcn\u00fcn telefonla haberle\u015fme hakk\u0131&#8221; ba\u015fl\u0131kl\u0131 66. maddesinin (1) numaral\u0131 f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Kapal\u0131 ceza infaz kurumlar\u0131ndaki h\u00fck\u00fcml\u00fcler, Cumhurba\u015fkan\u0131nca \u00e7\u0131kar\u0131lan y\u00f6netmelikte belirlenen esas ve usullere g\u00f6re idarenin kontrol\u00fcndeki \u00fccretli telefonlar ile g\u00f6r\u00fc\u015fme yapabilirler. Telefon g\u00f6r\u00fc\u015fmesi idarece dinlenir ve kay\u0131t alt\u0131na al\u0131n\u0131r. Bu hak, tehlikeli h\u00e2lde bulunan ve \u00f6rg\u00fct mensubu h\u00fck\u00fcml\u00fcler bak\u0131m\u0131ndan k\u0131s\u0131tlanabilir&#8230;&#8221;<\/p>\n<p>14. 29\/3\/2020 tarihli ve 301083 say\u0131l\u0131 Resm\u00ee Gazete&#8217;de yay\u0131mlanarak y\u00fcr\u00fcrl\u00fc\u011fe giren Ceza \u0130nfaz Kurumlar\u0131n\u0131n Y\u00f6netimi ile Ceza ve G\u00fcvenlik Tedbirlerinin \u0130nfaz\u0131 Hakk\u0131nda Y\u00f6netmelik&#8217;in (Y\u00f6netmelik) &#8220;\u0130dare ve g\u00f6zlem kurulunun g\u00f6rev ve yetkileri&#8221; ba\u015fl\u0131kl\u0131 28. maddesinin (1) numaral\u0131 f\u0131kras\u0131 ve (f) bendi \u015f\u00f6yledir:<\/p>\n<p>&#8221; (1) \u0130dare ve g\u00f6zlem kurulu a\u015fa\u011f\u0131da say\u0131lan i\u015fleri yapmakla g\u00f6revli ve yetkilidir:&#8230; <\/p>\n<p>f) Tehlikeli h\u00e2li bulunan ya da \u00f6rg\u00fct mensubu olan h\u00fck\u00fcml\u00fclerle ilgili olarak, &#8221; (1) \u0130dare ve g\u00f6zlem kurulu a\u015fa\u011f\u0131da say\u0131lan i\u015fleri yapmakla g\u00f6revli ve yetkilidir:&#8230; <\/p>\n<p>f) Tehlikeli h\u00e2li bulunan ya da \u00f6rg\u00fct mensubu olan h\u00fck\u00fcml\u00fclerle ilgili olarak,telefon g\u00f6r\u00fc\u015fmeleri ile radyo, televizyon yay\u0131nlar\u0131 ve internet olanaklar\u0131ndan yararlanma hakk\u0131n\u0131n k\u0131s\u0131tlanmas\u0131na karar vermek&#8230;&#8221;<\/p>\n<p>15. Y\u00f6netmelik&#8217;in &#8220;Telefonla g\u00f6r\u00fc\u015fme hakk\u0131&#8221; ba\u015fl\u0131kl\u0131 74. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;(1) Kapal\u0131 kurumlarda bulunan h\u00fck\u00fcml\u00fcler, belgelendirmeleri ko\u015fuluyla e\u015fi, d\u00f6rd\u00fcnc\u00fc dereceye kadar kan ve kay\u0131n h\u0131s\u0131mlar\u0131 ve vasisi ile telefon g\u00f6r\u00fc\u015fmesi yapabilir.<\/p>\n<p> (2) Telefonla g\u00f6r\u00fc\u015fmeleri a\u015fa\u011f\u0131da belirtilen esaslara g\u00f6re yap\u0131l\u0131r:<\/p>\n<p>a) H\u00fck\u00fcml\u00fcler, haberle\u015fme veya ileti\u015fim ara\u00e7lar\u0131ndan yoksun b\u0131rak\u0131lma veya k\u0131s\u0131tlama cezas\u0131 ile h\u00fccreye koyma cezas\u0131n\u0131n infaz\u0131 s\u0131ras\u0131nda olmamak ko\u015fuluyla, idarenin kontrol\u00fcnde bulunan ve kurumun uygun yerlerine yerle\u015ftirilen telefonlardan yararland\u0131r\u0131l\u0131r.<\/p>\n<p>b) Disiplin cezalar\u0131 olsa bile, anne, baba, e\u015f, \u00e7ocuk ve karde\u015flerin \u00f6l\u00fcm veya a\u011f\u0131r hastal\u0131klar\u0131 veya do\u011fal afet h\u00e2llerinde, h\u00fck\u00fcml\u00fclerin telefon g\u00f6r\u00fc\u015fme haklar\u0131 hi\u00e7bir \u015fekilde engellenemez.<\/p>\n<p>&#8230;<\/p>\n<p>e) H\u00fck\u00fcml\u00fclerin telefonla g\u00f6r\u00fc\u015fme g\u00fcn ve saatleri, kurumda bulunan telefon adedi, ba\u015fvuru s\u0131ras\u0131, kurumun asayi\u015f ve g\u00fcvenli\u011fi dikkate al\u0131narak idare taraf\u0131ndan belirlenir.<\/p>\n<p>f) H\u00fck\u00fcml\u00fcler g\u00f6r\u00fc\u015febilecekleri yak\u0131nlar\u0131ndan bir veya birden fazla ki\u015fi ile haftada bir kez ve bir telefon numaras\u0131yla ba\u011flant\u0131 kurarak kesintisiz g\u00f6r\u00fc\u015fme yapabilir. Herhangi bir nedenle g\u00f6r\u00fc\u015fme ger\u00e7ekle\u015fememi\u015fse daha \u00f6nceden bildirilen numaralardan bir di\u011feriyle g\u00f6r\u00fc\u015febilir. Konu\u015fma s\u00fcresi g\u00f6r\u00fc\u015fme ba\u015flad\u0131\u011f\u0131 andan itibaren on dakikay\u0131 ge\u00e7emez. Deprem, salg\u0131n hastal\u0131k, do\u011fal afet gibi zaruri h\u00e2llerde Bakanl\u0131k karar\u0131 ile telefon ile g\u00f6r\u00fc\u015fme s\u00fcresi ve say\u0131s\u0131 art\u0131r\u0131labilir.<\/p>\n<p>g) G\u00f6r\u00fcnt\u00fcl\u00fc telefon g\u00f6r\u00fc\u015fmesi yap\u0131lmas\u0131na imkan sa\u011flayan teknik alt yap\u0131n\u0131n kurulu bulundu\u011fu Bakanl\u0131k\u00e7a belirlenen kurumlarda, haftal\u0131k g\u00f6r\u00fc\u015fme s\u00fcresi otuz dakika olarak uygulan\u0131r. Bakanl\u0131k g\u00f6r\u00fc\u015f yaz\u0131s\u0131nda; ilgili mevzuat ve Anayasa Mahkemesi i\u00e7tihatlar\u0131 hat\u0131rlat\u0131ld\u0131ktan sonra ba\u015fvurucunun \u015fik\u00e2yetleri incelenirken Anayasa ve mevzuat h\u00fck\u00fcmleri do\u011frultusunda somut olay\u0131n kendine \u00f6zg\u00fc ko\u015fullar\u0131n\u0131n g\u00f6z\u00f6n\u00fcne al\u0131nmas\u0131 gerekti\u011fi belirtilmi\u015ftir. Ba\u015fvurucu Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 beyanda bulunmam\u0131\u015ft\u0131r.<\/p>\n<p>2. De\u011ferlendirme<\/p>\n<p>24. Ba\u015fvurunun de\u011ferlendirilmesinde dikkate al\u0131nacak Anayasa\u2019n\u0131n &#8220;\u00d6zel hayat\u0131n gizlili\u011fi ve korunmas\u0131&#8221; ba\u015fl\u0131kl\u0131 20. maddesinin birinci f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Herkes, \u00f6zel hayat\u0131na ve aile hayat\u0131na sayg\u0131 g\u00f6sterilmesini isteme hakk\u0131na sahiptir. \u00d6zel hayat\u0131n ve aile hayat\u0131n\u0131n gizlili\u011fine dokunulamaz.&#8221;<\/p>\n<p>25. Anayasa\u2019n\u0131n &#8220;Haberle\u015fme h\u00fcrriyeti&#8221; ba\u015fl\u0131kl\u013122. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Herkes, haberle\u015fme h\u00fcrriyetine sahiptir. Haberle\u015fmenin gizlili\u011fi esast\u0131r.<\/p>\n<p>Mill\u00ee g\u00fcvenlik, kamu d\u00fczeni, su\u00e7 i\u015flenmesinin \u00f6nlenmesi, genel sa\u011fl\u0131k ve genel ahl\u00e2k\u0131n korunmas\u0131 veya ba\u015fkalar\u0131n\u0131n hak ve \u00f6zg\u00fcrl\u00fcklerinin korunmas\u0131 sebeplerinden biri veya birka\u00e7\u0131na ba\u011fl\u0131 olarak usul\u00fcne g\u00f6re verilmi\u015f h\u00e2kim karar\u0131 olmad\u0131k\u00e7a; yine bu sebeplere ba\u011fl\u0131 olarak gecikmesinde sak\u0131nca bulunan hallerde de kanunla yetkili k\u0131l\u0131nm\u0131\u015f merciin yaz\u0131l\u0131 emri bulunmad\u0131k\u00e7a; haberle\u015fme engellenemez ve gizlili\u011fine dokunulamaz. Yetkili merciin karar\u0131 yirmid\u00f6rt saat i\u00e7inde g\u00f6revli h\u00e2kimin onay\u0131na sunulur. H\u00e2kim, karar\u0131n\u0131 k\u0131rksekiz saat i\u00e7inde a\u00e7\u0131klar; aksi halde, karar kendili\u011finden kalkar.<\/p>\n<p>\u0130stisnalar\u0131n uygulanaca\u011f\u0131 kamu kurum ve kurulu\u015flar\u0131 kanunda belirtilir.&#8221;<\/p>\n<p>26. Anayasa\u2019n\u0131n &#8220;Kanun \u00f6n\u00fcnde e\u015fitlik&#8221; ba\u015fl\u0131kl\u0131 10. maddesinin birinci, d\u00f6rd\u00fcnc\u00fc ve be\u015finci f\u0131kralar\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Herkes, dil, \u0131rk, renk, cinsiyet, siyas\u00ee d\u00fc\u015f\u00fcnce, felsef\u00ee inan\u00e7, din, mezhep ve benzeri sebeplerle ay\u0131r\u0131m g\u00f6zetilmeksizin kanun \u00f6n\u00fcnde e\u015fittir\u2026<\/p>\n<p>Hi\u00e7bir ki\u015fiye, aileye, z\u00fcmreye veya s\u0131n\u0131fa imtiyaz tan\u0131namaz.<\/p>\n<p>Devlet organlar\u0131 ve idare makamlar\u0131 b\u00fct\u00fcn i\u015flemlerinde kanun \u00f6n\u00fcnde e\u015fitlik ilkesine uygun olarak hareket etmek zorundad\u0131rlar.&#8221;<\/p>\n<p>27. Anayasa Mahkemesi, olaylar\u0131n ba\u015fvurucu taraf\u0131ndan yap\u0131lan hukuki tavsifi ile ba\u011fl\u0131 olmay\u0131p olay ve olgular\u0131n hukuki nitelendirmesini kendisi takdir eder. Telefonla g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fme \u00f6z\u00fc itibar\u0131yla mahpuslar\u0131n d\u0131\u015far\u0131yla ve aileyle ileti\u015fimine ili\u015fkin oldu\u011fundan ba\u015fvuru, aile hayat\u0131na sayg\u0131 hakk\u0131 ile haberle\u015fme h\u00fcrriyeti ve bu haklarla ba\u011flant\u0131l\u0131 olarak ayr\u0131mc\u0131l\u0131k yasa\u011f\u0131 kapsam\u0131nda incelenmi\u015ftir.<\/p>\n<p>a. Genel \u0130lkeler <\/p>\n<p>28. Anayasa\u2019n\u0131n 22. maddesinde, herkesin haberle\u015fme \u00f6zg\u00fcrl\u00fc\u011f\u00fcne sahip oldu\u011fu ve haberle\u015fmenin gizlili\u011finin esas oldu\u011fu h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r (Mehmet Koray Erya\u015fa,\u00a7 49). Anayasa\u2019n\u0131n 20. maddesinde g\u00fcvence alt\u0131na al\u0131nan aile hayat\u0131na sayg\u0131 hakk\u0131 ise resm\u00ee makamlar\u0131n \u00f6zel hayata ve aile hayat\u0131na m\u00fcdahale edememesi ile ki\u015finin ferd\u00ee ve aile hayat\u0131n\u0131 kendi anlad\u0131\u011f\u0131 gibi d\u00fczenleyip ya\u015fayabilmesi gere\u011fine i\u015faret etmektedir (Murat At\u0131lgan [2. B.], B. No: 2013\/9047, 7\/5\/2015, \u00a7 22; Marcus Frank Cerny [GK], B. No: 2013\/5126, 2\/7\/2015, \u00a7 36).<\/p>\n<p>29. Anayasa&#8217;n\u0131n 19. maddesi gere\u011fince h\u00fck\u00fcml\u00fc ve tutuklular\u0131n haberle\u015fme h\u00fcrriyeti ve aile hayat\u0131na sayg\u0131 hakk\u0131n\u0131n s\u0131n\u0131rlanmas\u0131, hukuka uygun olarak ceza infaz kurumunda tutulman\u0131n ka\u00e7\u0131n\u0131lmaz ve do\u011fal bir sonucudur. \u00d6te yandan h\u00fck\u00fcml\u00fc ve tutuklular\u0131n aile hayat\u0131na sayg\u0131 g\u00f6sterilmesi hakk\u0131, ceza infaz kurumu idaresinin h\u00fck\u00fcml\u00fc ve tutuklular\u0131n ailesi ve yak\u0131nlar\u0131yla temas\u0131n\u0131 devam ettirecek \u00f6nlemleri almas\u0131n\u0131 zorunlu k\u0131lmaktad\u0131r (Mehmet Zahit \u015eahin [1. B.], B. No: 2013\/4708, 20\/4\/2016, \u00a7 36).<\/p>\n<p>30. Bununla beraber bu y\u00fck\u00fcml\u00fcl\u00fck yerine getirilirken ceza infaz kurumunda tutulman\u0131n ka\u00e7\u0131n\u0131lmaz ve do\u011fal sonu\u00e7lar\u0131n\u0131n g\u00f6zetilmesi gerekmektedir. Bu ba\u011flamda kamu d\u00fczeni ve su\u00e7 i\u015flenmesinin \u00f6nlenmesi ile aile hayat\u0131na sayg\u0131 hakk\u0131 ve haberle\u015fme h\u00fcrriyeti aras\u0131nda adil bir denge sa\u011flanmal\u0131d\u0131r. Ancak ceza infaz kurumunda bulunman\u0131n do\u011fal sonucu olarak idarenin m\u00fcdahale konusunda takdir yetkisinin daha geni\u015f oldu\u011fu g\u00f6zetilmelidir (Mehmet Koray Erya\u015fa, \u00a7 89).<\/p>\n<p>31. Anayasa ve S\u00f6zle\u015fme&#8217;de herkesin haberle\u015fme h\u00fcrriyetine sahip oldu\u011fu d\u00fczenlenirken haberle\u015fmenin hangi ara\u00e7larla yap\u0131laca\u011f\u0131 a\u00e7\u0131k bir \u015fekilde belirtilmemi\u015ftir. Ancak cezaevinde tutulan h\u00fck\u00fcml\u00fc ve tutuklular a\u00e7\u0131s\u0131ndan haberle\u015fme h\u00fcrriyetinin kapsam\u0131n\u0131n her t\u00fcrl\u00fc ileti\u015fim arac\u0131n\u0131 i\u00e7ermeyece\u011fi a\u00e7\u0131kt\u0131r. \u00d6zellikle di\u011fer haberle\u015fme yollar\u0131n\u0131n kullan\u0131labildi\u011fi ve yeterli oldu\u011fu durumlarda, Anayasa\u2019n\u0131n 22. maddesi ve S\u00f6zle\u015fme\u2019nin 8. maddesinin h\u00fck\u00fcml\u00fc ve tutuklular\u0131n telefonla g\u00f6r\u00fc\u015fmesini g\u00fcvence alt\u0131na ald\u0131\u011f\u0131 \u015fekilde yorumlanmas\u0131 m\u00fcmk\u00fcn de\u011fildir. Burada dikkat edilecek nokta h\u00fck\u00fcml\u00fc ve tutuklular\u0131n d\u0131\u015f d\u00fcnya ile haberle\u015fmesinin sa\u011flanmas\u0131nda kamu otoritelerinin takdir marj\u0131n\u0131n geni\u015f yorumlanmas\u0131 gerekti\u011fidir. Haberle\u015fme y\u00f6ntemlerinden bir veya birka\u00e7\u0131n\u0131n kullan\u0131lma ve yeterli olmas\u0131 durumunda h\u00fck\u00fcml\u00fc ve tutuklular\u0131n telefonla g\u00f6r\u00fc\u015fmesine izin verilmemesi tek ba\u015f\u0131na haberle\u015fme h\u00fcrriyetinin ihlali olarak de\u011ferlendirilemez (Mehmet Koray Erya\u015fa, \u00a7\u00a7 54, 55).<\/p>\n<p>32. \u00d6te yandan Anayasa\u2019n\u0131n 10. maddesinde yer verilen e\u015fitlik ilkesi hukuksal durumlar\u0131 ayn\u0131 olanlar i\u00e7in s\u00f6z konusudur. Bu ilke ile eylemli de\u011fil, hukuksal e\u015fitlik \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. E\u015fitlik ilkesinin amac\u0131, ayn\u0131 durumda bulunan ki\u015filerin yasalar kar\u015f\u0131s\u0131nda ayn\u0131 i\u015fleme ba\u011fl\u0131 tutulmalar\u0131n\u0131 sa\u011flamak, ayr\u0131m yap\u0131lmas\u0131n\u0131 ve ayr\u0131cal\u0131k tan\u0131nmas\u0131n\u0131 \u00f6nlemektir. Bu ilkeyle ayn\u0131 durumda bulunan kimi ki\u015fi ve topluluklara ayr\u0131 kurallar uygulanarak yasa kar\u015f\u0131s\u0131nda e\u015fitli\u011fin ihlali yasaklanm\u0131\u015ft\u0131r. Yasa \u00f6n\u00fcnde e\u015fitlik, herkesin her y\u00f6nden ayn\u0131 kurallara ba\u011fl\u0131 tutulaca\u011f\u0131 anlam\u0131na gelmez. Ayr\u0131mc\u0131l\u0131k yasa\u011f\u0131na ili\u015fkin g\u00fcvencelerin tatbik edilmesi di\u011fer h\u00fck\u00fcmlerin ihlal edilmi\u015f olmas\u0131n\u0131 zorunlu k\u0131lmasa da ihtilaf konusu mesele Anayasa&#8217;daki di\u011fer haklardan biri veya birka\u00e7\u0131n\u0131n kapsam\u0131na girmedik\u00e7e ayr\u0131mc\u0131l\u0131k yasa\u011f\u0131na ili\u015fkin g\u00fcvencelerin uygulanmas\u0131 m\u00fcmk\u00fcn de\u011fildir (Nuriye Arpa, \u00a7 43).<\/p>\n<p>b. \u0130lkelerin Olaya Uygulanmas\u0131 <\/p>\n<p>35. \u00d6ncelikle ceza infaz kurumlar\u0131n\u0131n g\u00fcvenli\u011finin ve d\u00fczeninin sa\u011flanmas\u0131 gibi makul sebeplerle s\u0131n\u0131rl\u0131 olmak \u00fczere mahpuslar\u0131n d\u0131\u015far\u0131yla ve aileleriyle hangi yollarla nas\u0131l ileti\u015fim sa\u011flayacaklar\u0131 konusunda kamu makamlar\u0131n\u0131n geni\u015f bir takdir yetkisi bulunmaktad\u0131r. Ancak bu ba\u011flamda mahpuslar\u0131n d\u0131\u015far\u0131yla ve aileleriyle ileti\u015fimini sa\u011flayacak, a\u00e7\u0131k ve kapal\u0131 ziyaret, mektupla ve telefonla haberle\u015fme gibi imk\u00e2nlara yeterince sahip olup olmamalar\u0131 \u00f6nem ta\u015f\u0131maktad\u0131r. Bu ba\u011flamda aile hayat\u0131na sayg\u0131 hakk\u0131 ile haberle\u015fme h\u00fcrriyeti d\u0131\u015far\u0131 ile yeterli ileti\u015fim sa\u011flamaya elveri\u015fli asgari imk\u00e2nlar\u0131n olu\u015fturulmas\u0131 d\u0131\u015f\u0131nda h\u00fck\u00fcml\u00fc ve tutuklular\u0131n ayr\u0131ca g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fme yapmalar\u0131n\u0131 zorunlu k\u0131lacak a\u00e7\u0131k bir g\u00fcvence sa\u011flamamaktad\u0131r. Bu nedenle g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fmenin hak olarak d\u00fczenlenmesi ve \u015fartlar\u0131 y\u00f6n\u00fcnden devletin geni\u015f takdir yetkisine sahip oldu\u011fu s\u00f6ylenebilir. Di\u011fer yandan tutuklu ve h\u00fck\u00fcml\u00fclerin telefonla g\u00f6r\u00fc\u015fme hakk\u0131n\u0131n oldu\u011fu 5275 say\u0131l\u0131 Kanun&#8217;da kabul edilmi\u015f, bununla birlikte bu hakk\u0131n tehlikeli h\u00e2lde bulunan ve \u00f6rg\u00fct mensubu h\u00fck\u00fcml\u00fcler bak\u0131m\u0131ndan k\u0131s\u0131tlanabilece\u011fi belirlenmi\u015ftir. An\u0131lan Kanun&#8217;da g\u00f6r\u00fc\u015fmenin sesli ya da g\u00f6r\u00fcnt\u00fcl\u00fc olarak yap\u0131lmas\u0131na dair bir belirleme olmamakla birlikte bu hakk\u0131n nas\u0131l yararland\u0131r\u0131laca\u011f\u0131n\u0131n Y\u00f6netmelik ile d\u00fczenlenece\u011fi belirtilmi\u015ftir. Y\u00f6netmelik ile de bu hakk\u0131n sesli ve g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fme \u015feklinde kullan\u0131labilece\u011fi d\u00fczenlenmi\u015ftir. Y\u00f6netmelik&#8217;te g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fmenin yapt\u0131r\u0131labilmesi i\u00e7in \u00f6ncelikle teknik alt yap\u0131n\u0131n tamamlanm\u0131\u015f oldu\u011funun Bakanl\u0131k taraf\u0131ndan tespiti gerekti\u011fi, haftal\u0131k ziyaret hakk\u0131n\u0131 kullanmayan h\u00fck\u00fcml\u00fclere ilave g\u00f6r\u00fc\u015fme hakk\u0131 verilece\u011fi ancak g\u00f6r\u00fc\u015fmelerin sadece sesli de yapt\u0131r\u0131labilece\u011fi d\u00fczenlenmi\u015ftir. Bununla birlikte ter\u00f6r ve \u00e7\u0131kar ama\u00e7l\u0131 su\u00e7 \u00f6rg\u00fct\u00fc \u00fcyelerinin g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fmeye ve g\u00f6r\u00fc\u015fme s\u00fcresinin uzat\u0131lmas\u0131na ili\u015fkin haktan yararlanabilmeleri, teknik alt yap\u0131n\u0131n kurulmas\u0131 \u015fart\u0131 ile birlikte di\u011fer mahpuslardan farkl\u0131 olarak \u00f6ncelikle idare ve g\u00f6zlem kurulunun bu y\u00f6nde bir karar almas\u0131na ba\u011fl\u0131 oldu\u011fu anla\u015f\u0131lmaktad\u0131r (bkz. \u00a7\u00a7 13-15).<\/p>\n<p>37. Y\u00f6netmelik, ter\u00f6r ve \u00e7\u0131kar ama\u00e7l\u0131 su\u00e7 \u00f6rg\u00fct\u00fc \u00fcyeli\u011finden mahpus olanlar\u0131n g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fmeden yararland\u0131r\u0131lmas\u0131 konusunda karar alma yetkisini sadece Kurula tan\u0131m\u0131\u015ft\u0131r. Kurulun, kendisine tan\u0131nan takdir yetkisini kullan\u0131rken mahpusun tutum ve davran\u0131\u015flar\u0131n\u0131, kurumun g\u00fcvenli\u011fini ve disiplinin sa\u011flama y\u00fck\u00fcml\u00fc\u011f\u00fc ile kurumun fiziki ko\u015fullar\u0131 gibi hususlar\u0131 da g\u00f6z\u00f6n\u00fcnde bulunduraca\u011f\u0131 mevzuattan anla\u015f\u0131lmaktad\u0131r. Bununla birlikte an\u0131lan yetkiye ba\u011fl\u0131 kararlar\u0131n denetime elveri\u015fli, ilgili ve yeterli gerek\u00e7e i\u00e7ermesi gerekti\u011fi vurgulanmal\u0131d\u0131r. Bu zorunluluk idarenin kendisine tan\u0131nan takdir yetkisini objektif olarak kullan\u0131p kullanmad\u0131\u011f\u0131n\u0131n ve keyf\u00ee veya olaya uygun d\u00fc\u015fmeyen bir de\u011ferlendirmede bulunup bulunmad\u0131\u011f\u0131n\u0131n yarg\u0131lama makamlar\u0131nca \u00f6zenli bir \u015fekilde de\u011ferlendirilmesi a\u00e7\u0131s\u0131ndan da elzemdir. Bu genel a\u00e7\u0131klamalar \u00e7er\u00e7evesinde somut olay de\u011ferlendirildi\u011finde ilgili mevzuata g\u00f6re ter\u00f6r \u00f6rg\u00fct\u00fcne \u00fcye olmak su\u00e7undan h\u00fck\u00fcml\u00fc olan ba\u015fvurucunun g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fme hakk\u0131ndan yararlanabilmesi i\u00e7in bulundu\u011fu su\u00e7 grubuna y\u00f6nelik g\u00f6r\u00fcnt\u00fcl\u00fc g\u00f6r\u00fc\u015fme alt yap\u0131 sisteminin kurulmu\u015f olmas\u0131 ve- iyi h\u00e2lli oldu\u011funun tespitiyle- g\u00f6r\u00fc\u015fme yapabilece\u011fine dair Kurul taraf\u0131ndan karar verilmi\u015f olmas\u0131 gerekir.
