Taraflar\u0131n, s\u00f6zle\u015fme imzalad\u0131klar\u0131 d\u00f6nemde ge\u00e7erli olan \u015fartlar\u0131n, ilerleyen s\u00fcre\u00e7te de\u011fi\u015fmesi durumunda, s\u00f6zle\u015fmenin dengesiz hale gelmesi ka\u00e7\u0131n\u0131lmaz olabiliyor. Bu \u200ct\u00fcr durumlarda, Bor\u00e7lar Kanunu&#8217;nun 138. maddesi \u2062devreye \u2063giriyor.<\/p>\n<p>Bu maddeye g\u00f6re, taraflar\u0131n \u00f6ng\u00f6remedi\u011fi ola\u011fan\u00fcst\u00fc durumlar nedeniyle bor\u00e7lunun ifa g\u00fc\u00e7l\u00fc\u011f\u00fc \u00e7ekmesi \u200dhalinde, s\u00f6zle\u015fmenin\u2064 uyarlanmas\u0131 veya feshedilmesi m\u00fcmk\u00fcn. \u00d6ne \u00e7\u0131kan unsurlar aras\u0131nda, s\u00f6zle\u015fmenin yap\u0131lmas\u0131\u2063 s\u0131ras\u0131nda i\u015flerin g\u00fcvenli ve makul bir \u015fekilde y\u00fcr\u00fct\u00fclebilmesi i\u00e7in gereken ko\u015fullar\u0131n \u200dsa\u011flanamamas\u0131 yer al\u0131yor. Eser s\u00f6zle\u015fmelerine ili\u015fkin h\u00fck\u00fcmler, \u200btaraflar\u0131n ba\u015flang\u0131\u00e7ta \u200c\u00f6ng\u00f6rmedikleri durumlar nedeniyle s\u00f6zle\u015fmenin ko\u015fullar\u0131n\u0131 uyarlama taleplerinin de\u011ferlendirilebilece\u011fini g\u00f6stermektedir. Uzun s\u00fcreli kiralarda, dengenin a\u015f\u0131r\u0131 bozulmas\u0131 veya taraflar i\u00e7in \u00e7ekilmez hale \u2062gelmesi durumlar\u0131nda\u200c kiralar\u0131n uyarlanabilmesi s\u00f6z konusudur.<\/p>\n<p>Ayr\u0131ca, eser s\u00f6zle\u015fmelerinde \u200dde benzer bir yakla\u015f\u0131m vard\u0131r. Bunun yan\u0131 s\u0131ra,\u200d bu durumun bor\u00e7lunun kusurundan kaynaklanmamas\u0131 gerekti\u011fi de vurgulanmaktad\u0131r. Bununla birlikte, bor\u00e7lar kanunun 138. maddesi ile \u2064sa\u011flanan uyarlama\u200d hakk\u0131, yaln\u0131zca\u200b konut veya \u00e7at\u0131l\u0131 i\u015fyeri\u2062 kira s\u00f6zle\u015fmeleri i\u00e7in ge\u00e7erli olmay\u0131p, genel\u2064 bir hak\u2062 olarak kabul edilmektedir.<\/p>\n<p>Bu gibi durumlarda, taraflar aras\u0131nda dengenin a\u015f\u0131r\u0131 bozulmas\u0131 durumunda, mahkemeye ba\u015fvurularak s\u00f6zle\u015fmenin \u015fartlar\u0131n\u0131n\u2064 g\u00fcncel ekonomik ko\u015fullara uyarlanmas\u0131 talep edilebilir. Yarg\u0131tay\u2019\u0131n uzun\u2064 s\u00fcreli kira s\u00f6zle\u015fmeleriyle\u200c ilgili\u2064 yeni\u200c kararlar\u0131 da, bu t\u00fcr uyarlama davalar\u0131n\u0131n nas\u0131l y\u00fcr\u00fct\u00fclece\u011fine\u2062 dair \u00f6nemli emsal te\u015fkil etmektedir.<\/p>\n<p>Eser s\u00f6zle\u015fmeleriyle ilgili durumlar ise daha farkl\u0131 bir ayr\u0131nt\u0131 i\u00e7ermektedir. Eser s\u00f6zle\u015fmeleri, belirli bir i\u015fin tamamlanmas\u0131 \u2063\u00fczerine yap\u0131lan anla\u015fmalard\u0131r ve \u2062bu t\u00fcr s\u00f6zle\u015fmelerde genel olarak uyarlama talep etme hakk\u0131 bulunmamaktad\u0131r.
