Kat M\u00fclkiyeti Kanunu, bu s\u0131n\u0131rlar\u0131 \u00e7izen ve ihlallere kar\u015f\u0131 h\u00e2kimin m\u00fcdahalesini d\u00fczenleyen g\u00fc\u00e7l\u00fc bir \u00e7er\u00e7eve sunar. Bu ba\u011flamda, Kat M\u00fclkiyeti Kanunu\u2019nun (KMK) 33. maddesi, apartman ve sitelerde ya\u015fanan ihlallere kar\u015f\u0131 h\u00e2kimin m\u00fcdahalesi yolunu a\u00e7\u0131k tutan temel d\u00fczenlemelerden biridir. Yarg\u0131tay kararlar\u0131, h\u00e2kimin m\u00fcdahalesinin kapsam\u0131n\u0131 belirlerken sadece \u015fekli ihlalleri de\u011fil, toplu ya\u015fam\u0131n ruhuna zarar veren davran\u0131\u015flar\u0131 da dikkate almaktad\u0131r.<\/p>\n<p>Bu \u00e7al\u0131\u015fma, Yarg\u0131tay i\u00e7tihatlar\u0131 \u0131\u015f\u0131\u011f\u0131nda h\u00e2kimin m\u00fcdahalesinin hangi hallerde, kimler taraf\u0131ndan ve nas\u0131l talep edilebilece\u011fini sistematik bi\u00e7imde incelemekte; uygulamada kar\u015f\u0131la\u015f\u0131lan sorunlar\u0131 ve \u00e7\u00f6z\u00fcm yollar\u0131n\u0131 analiz etmektedir.<\/p>\n<p>1. Kat Malikleri Kurulu Kararlar\u0131na Kar\u015f\u0131 H\u00e2kimin M\u00fcdahalesi<\/p>\n<p>Kat malikleri kurulu kararlar\u0131na kar\u015f\u0131 h\u00e2kimin m\u00fcdahalesi, \u00e7o\u011funlu\u011fun iradesinin bireysel haklar\u0131 ihlal etti\u011fi durumlarda g\u00fcndeme gelir. Bu m\u00fcdahale, \u00f6zellikle kararlar\u0131n kanunun emredici h\u00fck\u00fcmlerine, y\u00f6netim plan\u0131na ya da hakkaniyet ilkesine ayk\u0131r\u0131 olmas\u0131 h\u00e2linde s\u00f6z konusu olur.<\/p>\n<p>1.1. Emredici H\u00fck\u00fcmlere Ayk\u0131r\u0131l\u0131k<\/p>\n<p>Karar alma s\u00fcre\u00e7lerinde toplant\u0131 ve oy kullanma usullerine riayet edilmemesi, kararlar\u0131n ge\u00e7erlili\u011fini ortadan kald\u0131rabilir. Nitekim Yarg\u0131tay 18. Hukuk Dairesi, 16.09.2015 tarihli ve E. 2014\/16228, K. 2015\/12775 say\u0131l\u0131 karar\u0131nda, toplant\u0131 tutana\u011f\u0131n\u0131 \u201citiraz kayd\u0131yla\u201d imzalayan kat malikinin, a\u00e7\u0131k\u00e7a kar\u015f\u0131 oy kullanmamas\u0131 h\u00e2linde dava hakk\u0131n\u0131n bulunmad\u0131\u011f\u0131na h\u00fckmetmi\u015ftir. Bu karar, sadece \u015feklen de\u011fil, i\u00e7erik itibar\u0131yla da kar\u015f\u0131 \u00e7\u0131k\u0131lmas\u0131 gerekti\u011fini vurgulamaktad\u0131r.<\/p>\n<p>1.2. Y\u00f6netim Plan\u0131na Ayk\u0131r\u0131l\u0131k<\/p>\n<p>Y\u00f6netim plan\u0131, kat m\u00fclkiyeti ili\u015fkisinde ba\u011flay\u0131c\u0131 ve tamamlay\u0131c\u0131 h\u00fck\u00fcm niteli\u011fi ta\u015f\u0131r. Y\u00f6netim plan\u0131na ayk\u0131r\u0131 karar ve eylemler i\u00e7in h\u00e2kimin m\u00fcdahalesi istenebilir. Yarg\u0131tay 5. Hukuk Dairesi, 08.02.1992 tarihli ve E. 1991\/291, K. 1992\/930 say\u0131l\u0131 karar\u0131nda; y\u00f6netim plan\u0131nda \u201cg\u00fcr\u00fclt\u00fcl\u00fc i\u015fyeri\u201d faaliyetlerine izin verilmi\u015f olsa bile, bu faaliyetin KMK m.18 uyar\u0131nca di\u011fer maliklere rahats\u0131zl\u0131k vermemesi gerekti\u011fini vurgulam\u0131\u015ft\u0131r. Bu y\u00f6n\u00fcyle, plan h\u00fck\u00fcmleri emredici normlara ayk\u0131r\u0131 yorumlanamaz.<\/p>\n<p>1.3. Hakkaniyete Ayk\u0131r\u0131l\u0131k<\/p>\n<p>Kat maliklerinin ve ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm kullan\u0131c\u0131lar\u0131n\u0131n d\u00fcr\u00fcstl\u00fck ve hakkaniyet ilkelerine uygun davranmalar\u0131 gerekir. Yarg\u0131tay Hukuk Genel Kurulu, 27.06.2012 tarihli ve E. 2012\/18-102, K. 2012\/424 say\u0131l\u0131 karar\u0131nda; ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm ve ortak alan kullan\u0131mlar\u0131nda do\u011fruluk kurallar\u0131n\u0131n esas oldu\u011funu, rahats\u0131z edici davran\u0131\u015flardan ka\u00e7\u0131n\u0131lmas\u0131 gerekti\u011fini belirtmi\u015ftir. Yarg\u0131tay 22.06.2011 tarihli ve E. 2011\/18-251, K. 2011\/444 say\u0131l\u0131 karar\u0131nda da k\u00fc\u00e7\u00fck rahats\u0131zl\u0131klar\u0131n ho\u015fg\u00f6r\u00fcyle kar\u015f\u0131lanmas\u0131 gerekti\u011fine i\u015faret edilmi\u015ftir.<\/p>\n<p>Y\u00f6netim plan\u0131nda a\u00e7\u0131k\u00e7a yasaklay\u0131c\u0131 bir h\u00fck\u00fcm bulunmasa dahi, di\u011fer kat maliklerini rahats\u0131z edecek d\u00fczeyde bir durum ortaya \u00e7\u0131karsa, bu durum h\u00e2kim m\u00fcdahalesini gerektirebilir. Yarg\u0131tay 18. Hukuk Dairesi\u2019nin 08.09.2014 tarihli, 2014\/10395 Esas ve 2014\/12213 Karar say\u0131l\u0131 karar\u0131nda, rahats\u0131zl\u0131k yaratt\u0131\u011f\u0131 saptanan bir k\u00f6pe\u011fin, y\u00f6netim plan\u0131nda yasaklay\u0131c\u0131 h\u00fck\u00fcm bulunmasa bile uzakla\u015ft\u0131r\u0131lmas\u0131 gerekti\u011fine h\u00fckmedilmi\u015ftir.<\/p>\n<p>2. Kat Maliklerinin Bor\u00e7 ve Y\u00fck\u00fcml\u00fcl\u00fcklerine Ayk\u0131r\u0131l\u0131klar<\/p>\n<p>2.1. Ortak Giderlere Kat\u0131lmama<\/p>\n<p>Yarg\u0131tay 18. Hukuk Dairesi, 20.03.2001 tarihli ve E. 2001\/2212, K. 2001\/2577 say\u0131l\u0131 karar\u0131nda; iskan al\u0131nmam\u0131\u015f olsa dahi, yap\u0131 fiilen kullan\u0131lmaya ba\u015flanm\u0131\u015f ve ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin \u00fc\u00e7te ikisi fiilen kullan\u0131l\u0131yor ise kat m\u00fclkiyeti h\u00fck\u00fcmlerinin uygulanaca\u011f\u0131na ve t\u00fcm maliklerin ortak giderlere kat\u0131lmakla y\u00fck\u00fcml\u00fc oldu\u011funa h\u00fckmetmi\u015ftir.<\/p>\n<p>2.2. Ortak Yerlerin Amac\u0131 D\u0131\u015f\u0131nda Kullan\u0131m\u0131<\/p>\n<p>Ortak yerlerin kullan\u0131m\u0131na ili\u015fkin uyu\u015fmazl\u0131klarda, do\u011frudan dava a\u00e7\u0131lmadan \u00f6nce kat malikleri kuruluna ba\u015fvurulmas\u0131 gerekir. Nitekim Yarg\u0131tay 20. Hukuk Dairesi, 21.09.2017 tarihli ve 2017\/3826 E., 2017\/6664 K. say\u0131l\u0131 karar\u0131nda, ortak alan kullan\u0131m\u0131yla ilgili olarak mahkemeye ba\u015fvurmadan \u00f6nce kat malikleri kurulunda konunun g\u00f6r\u00fc\u015f\u00fclmesi gerekti\u011fini ifade etmi\u015ftir. Benzer \u015fekilde, sitenin ortak havuzunun kullan\u0131m\u0131na ili\u015fkin olarak \u00e7\u0131kan uyu\u015fmazl\u0131kta da Yarg\u0131tay 18. Hukuk Dairesi, 24.01.2008 tarihli ve 2007\/8115 E., 2008\/288 K. say\u0131l\u0131 karar\u0131nda, kat maliklerinin \u00f6ncelikle y\u00f6netimle konuyu m\u00fczakere etmesi, sonu\u00e7 al\u0131namamas\u0131 h\u00e2linde kat malikleri kuruluna ba\u015fvurmas\u0131 ve ancak bu yollar t\u00fcketildikten sonra h\u00e2kimin m\u00fcdahalesinin talep edilebilece\u011fini belirtmi\u015ftir.<\/p>\n<p>2.3. D\u0131\u015f Cephe ve Estetik Y\u00fck\u00fcml\u00fcl\u00fckler<\/p>\n<p>Yarg\u0131tay Hukuk Genel Kurulu, 18.01.2022 tarihli ve E. 2017\/1996, K. 2022\/5 say\u0131l\u0131 karar\u0131nda, balkonlar\u0131n mimari projeye ayk\u0131r\u0131 \u015fekilde kapat\u0131lmas\u0131 ve d\u0131\u015f cepheye kap\u0131 a\u00e7\u0131lmas\u0131 i\u015flemlerinin, proje de\u011fi\u015fikli\u011fi anlam\u0131na geldi\u011fini, bu t\u00fcr esasl\u0131 tadilatlar i\u00e7in t\u00fcm maliklerin oybirli\u011fi gerekti\u011fini belirtmi\u015ftir.\u2028Yarg\u0131tay 20. Hukuk Dairesi, 17.01.2019 tarihli ve E. 2017\/5345, K. 2019\/211 say\u0131l\u0131 karar\u0131nda ise, d\u0131\u015f cepheye klima d\u0131\u015f \u00fcnitesi veya \u00e7irkin tabelalar\u0131n as\u0131lmas\u0131n\u0131n anagayrimenkul\u00fcn g\u00f6r\u00fcn\u00fcm\u00fcn\u00fc bozdu\u011fu ve h\u00e2kimin m\u00fcdahalesinin m\u00fcmk\u00fcn oldu\u011fu ifade edilmi\u015ftir.<\/p>\n<p>2.4. G\u00fcr\u00fclt\u00fc, Koku ve Rahats\u0131zl\u0131k Verici Davran\u0131\u015flar<\/p>\n<p>G\u00fcr\u00fclt\u00fc, k\u00f6t\u00fc koku, duman, kliman\u0131n sesi gibi unsurlar, kat maliklerinin g\u00fcnl\u00fck ya\u015fam\u0131n\u0131 do\u011frudan etkiler. Yarg\u0131tay, y\u00fcksek sesle m\u00fczik dinleme, balkonda mangal yapma, hal\u0131 silkeleme, ba\u011f\u0131rma gibi davran\u0131\u015flar\u0131n h\u00e2kim m\u00fcdahalesini gerektirecek nitelikte oldu\u011funu kabul etmektedir. Nitekim Yarg\u0131tay 18. Hukuk Dairesi\u2019nin 11 May\u0131s 2009 tarihli ve 2009\/4903 Esas, 2009\/5003 Karar say\u0131l\u0131; ayr\u0131ca 12 Mart 2009 tarihli ve 2008\/11233 Esas, 2009\/3381 Karar say\u0131l\u0131 kararlar\u0131nda bu y\u00f6nde de\u011ferlendirme yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Ayr\u0131ca, bu t\u00fcr davran\u0131\u015flar ceza hukuku kapsam\u0131nda da sonu\u00e7 do\u011furabilir. \u00d6rne\u011fin, s\u00fcrekli g\u00fcr\u00fclt\u00fc \u00e7\u0131karan bir ki\u015finin eylemi, gerekli \u015fartlar olu\u015ftu\u011funda T\u00fcrk Ceza Kanunu\u2019nun 123. Bu durum, \u201cKi\u015filerin Huzur ve S\u00fck\u00fbnunu Bozma\u201d su\u00e7u kapsam\u0131nda say\u0131labilir. Bu husus, Yarg\u0131tay 18. Hukuk Dairesi\u2019nin 15 Haziran 2009 tarihli ve 2009\/842 Esas, 2009\/6478 Karar say\u0131l\u0131 karar\u0131nda da ifade edilmi\u015ftir.<\/p>\n<p>2.5. Y\u00f6netim Belgelerinin Teslim Edilmemesi<\/p>\n<p>Kat M\u00fclkiyeti rejiminde, y\u00f6netici de\u011fi\u015fikli\u011fi durumunda eski y\u00f6neticinin g\u00f6rev s\u00fcresince tuttu\u011fu defter, makbuz ve di\u011fer belgeleri yeni y\u00f6netime teslim etmesi bir zorunluluktur. Aksi h\u00e2lde y\u00f6netim faaliyeti sekteye u\u011frar ve maliklerin ortak haklar\u0131 zedelenir. Yarg\u0131tay 18. Hukuk Dairesi\u2019nin 19 \u015eubat 2009 tarihli ve 2009\/946 Esas, 2009\/1359 Karar say\u0131l\u0131 karar\u0131nda da a\u00e7\u0131k\u00e7a belirtildi\u011fi \u00fczere, eski y\u00f6neticinin bu belgeleri teslimden ka\u00e7\u0131nmas\u0131 h\u00e2linde, Kat M\u00fclkiyeti Kanunu\u2019nun 33. maddesi uyar\u0131nca do\u011frudan h\u00e2kimin m\u00fcdahalesi istenebilir ve mahkeme karar\u0131yla belgelerin yeni y\u00f6neticiye teslimi sa\u011flanabilir.<\/p>\n<p>2.6. Y\u00f6netici Atanmas\u0131 Talebi<\/p>\n<p>Kat maliklerinin y\u00f6netici se\u00e7memesi, mevcut y\u00f6neticinin g\u00f6revi b\u0131rakmas\u0131 ya da g\u00f6revini yapmamas\u0131 durumunda, h\u00e2kimden y\u00f6netici atanmas\u0131 istenebilir. Bu talepte bulunan kat malikinin mutlaka bir aday g\u00f6stermesi gerekmez. E\u011fer bir aday g\u00f6sterilse bile, h\u00e2kim bu ki\u015fiyle ba\u011fl\u0131 de\u011fildir; isterse kat maliklerinden birini, isterse d\u0131\u015far\u0131dan bir ki\u015fiyi y\u00f6netici olarak atayabilir. Bu durum, Yarg\u0131tay 18. Hukuk Dairesi\u2019nin 24.06.2002 tarihli, 2002\/6225 Esas ve 2002\/7188 Karar say\u0131l\u0131 karar\u0131nda a\u00e7\u0131k\u00e7a ifade edilmi\u015ftir.<\/p>\n<p>3. M\u00fcsaade Mecburiyeti ve M\u00fcdahale Talebi<\/p>\n<p>Yarg\u0131tay 18. Hukuk Dairesi, 22.12.2003 tarihli ve E. 2003\/8423, K. 2003\/10272 say\u0131l\u0131 karar\u0131nda ise, m\u00fclkiyetin devri yapt\u0131r\u0131m\u0131 i\u00e7in sadece mahkeme karar\u0131n\u0131n varl\u0131\u011f\u0131n\u0131n yeterli olmad\u0131\u011f\u0131, bu karar\u0131n icras\u0131n\u0131n engellenmesi, ihtar ve \u0131srar\u0131n a\u00e7\u0131k\u00e7a tespit edilmesi gerekti\u011fi ifade edilmi\u015ftir.<\/p>\n<p>6.3. Para Cezas\u0131na \u0130li\u015fkin Ba\u015fvurunun Usul\u00fc<\/p>\n<p>Kat M\u00fclkiyeti Kanunu\u2019nun 33\/3. maddesi uyar\u0131nca h\u00e2kim karar\u0131na uymayan kat maliki hakk\u0131nda para cezas\u0131 uygulanabilmesi i\u00e7in, bu talebin ayr\u0131 bir dilek\u00e7eyle yap\u0131lmas\u0131 ve bu dilek\u00e7enin yeni bir esasa kaydedilmesi gerekmektedir. Yarg\u0131tay 18. Hukuk Dairesi, 07.09.2015 tarihli ve E. 2015\/9807, K. 2015\/11983 say\u0131l\u0131 karar\u0131nda; h\u00e2kim karar\u0131na uymayan ki\u015fiye \u00f6nceki dosya \u00fczerinden ek karar yoluyla para cezas\u0131 verilmesinin hukuken m\u00fcmk\u00fcn olmad\u0131\u011f\u0131na h\u00fckmetmi\u015ftir. Bu nedenle para cezas\u0131 talebi, \u00f6nceki dava dosyas\u0131na dilek\u00e7e sunmakla de\u011fil, yeni bir dava a\u00e7\u0131larak ileri s\u00fcr\u00fclmelidir.<\/p>\n<p>6.4. Hukuk Dairesi, 30.11.2015 tarihli ve E. 2015\/4105, K. 2015\/17346 say\u0131l\u0131 karar\u0131nda; s\u00f6z konusu kurul toplant\u0131s\u0131 yap\u0131lmadan, do\u011frudan dava a\u00e7\u0131lmas\u0131n\u0131n m\u00fcmk\u00fcn olmad\u0131\u011f\u0131na h\u00fckmetmi\u015ftir.<\/p>\n<p>6.5. M\u00fclkiyetin Devri Talebinde \u201cIsrar\u201d Unsurunun Varl\u0131\u011f\u0131<\/p>\n<p>Kat M\u00fclkiyeti Kanunu\u2019nun 25. maddesi uyar\u0131nca, bir kat malikinin m\u00fclkiyetinin devrine zorlama davas\u0131 a\u00e7\u0131labilmesi i\u00e7in, yaln\u0131zca KMK m.\u202f33 kapsam\u0131nda verilen karar\u0131n kesinle\u015fmi\u015f olmas\u0131 ve bir y\u0131l i\u00e7inde bu karar\u0131n kendili\u011finden yerine getirilmemesi yeterli de\u011fildir. Bu s\u00fcrecin sonunda, ilgili kat malikinin mahkeme karar\u0131na ra\u011fmen h\u00e2l\u00e2 ihlalde \u0131srar etti\u011finin somut bi\u00e7imde ortaya konulmas\u0131 gerekir.<\/p>\n<p>Yarg\u0131tay 18. Hukuk Dairesi, 22.12.2003 tarihli ve E. 2003\/8423, K. 2003\/10272 say\u0131l\u0131 karar\u0131nda; bu \u0131srar unsurunun var say\u0131labilmesi i\u00e7in, ilgili mahkeme karar\u0131n\u0131n infaz\u0131 amac\u0131yla daval\u0131n\u0131n usul\u00fcne uygun bi\u00e7imde uyar\u0131lmas\u0131 veya icra takibi ba\u015flat\u0131lmas\u0131 gerekti\u011fini a\u00e7\u0131k\u00e7a belirtmi\u015ftir. Aksi takdirde, s\u0131rf karar\u0131n yerine getirilmemesi gerek\u00e7esiyle \u201c\u0131srar\u201d olgusunun ger\u00e7ekle\u015fti\u011fi kabul edilemez. Aksi yorumun, Anayasa ile g\u00fcvence alt\u0131na al\u0131nan m\u00fclkiyet hakk\u0131yla ba\u011fda\u015fmayaca\u011f\u0131 ve KMK m.\u202f25\u2019in amac\u0131na da ayk\u0131r\u0131 d\u00fc\u015fece\u011fi vurgulanm\u0131\u015ft\u0131r.<\/p>\n<p>7. H\u00e2kimin M\u00fcdahalesini Gerektirmeyen Haller<\/p>\n<p>Kat M\u00fclkiyeti Kanunu kapsam\u0131nda baz\u0131 uyu\u015fmazl\u0131klarda do\u011frudan h\u00e2kim m\u00fcdahalesi talep edilebilse de, baz\u0131 durumlarda bu m\u00fcdahaleye gerek bulunmamaktad\u0131r. Bu h\u00e2ller genellikle ortak ya\u015fam\u0131n ola\u011fan ak\u0131\u015f\u0131, y\u00f6netim plan\u0131, mimari proje ve yarg\u0131 i\u00e7tihatlar\u0131 \u00e7er\u00e7evesinde belirlenmektedir.<\/p>\n<p>Arsa bo\u015flu\u011funun otopark olarak kullan\u0131m\u0131 rahats\u0131zl\u0131k say\u0131lmaz.<\/p>\n<p>Baz\u0131 kullan\u0131m bi\u00e7imleri ise do\u011frudan rahats\u0131zl\u0131k do\u011furmad\u0131\u011f\u0131 i\u00e7in h\u00e2kim m\u00fcdahalesine gerek bulunmamaktad\u0131r. \u00d6rne\u011fin, apartman arsa bo\u015flu\u011funun otopark olarak kullan\u0131lmas\u0131 tek ba\u015f\u0131na bir rahats\u0131zl\u0131k sebebi olarak de\u011ferlendirilemez. Bu y\u00f6nde Yarg\u0131tay Hukuk Genel Kurulu, 09.06.1993 tarihli ve 1986\/4-425 K. say\u0131l\u0131 karar\u0131nda, bu t\u00fcr kullan\u0131m\u0131n ola\u011fan s\u0131n\u0131rlar i\u00e7inde kald\u0131\u011f\u0131n\u0131 kabul etmi\u015ftir.<\/p>\n<p>Zihinsel engelli \u00e7ocu\u011fun varl\u0131\u011f\u0131, tek ba\u015f\u0131na m\u00fcdahale sebebi de\u011fildir.<\/p>\n<p>Benzer \u015fekilde, Yarg\u0131tay 18. Hukuk Dairesi\u2019nin 30.06.2003 tarihli ve 2003\/4759 E., 2003\/5686 K. say\u0131l\u0131 karar\u0131nda, zihinsel engelli bir \u00e7ocu\u011fun \u00e7\u0131kard\u0131\u011f\u0131 ses ve g\u00fcr\u00fclt\u00fclerin, salt varl\u0131\u011f\u0131 nedeniyle rahats\u0131zl\u0131k olu\u015fturdu\u011funun kabul edilemeyece\u011fi belirtilmi\u015ftir. Kararda, rahats\u0131zl\u0131k kavram\u0131n\u0131n ki\u015fiye g\u00f6re de\u011fi\u015fkenlik g\u00f6sterebilece\u011fi, \u00e7ocu\u011fun ailesi yan\u0131nda kalmas\u0131n\u0131n t\u0131bbi gereklilik oldu\u011fu ve somut, objektif veriler olmadan m\u00fcdahaleye h\u00fckmedilemeyece\u011fi vurgulanm\u0131\u015ft\u0131r.<\/p>\n<p>Projesiz \u00e7at\u0131 yap\u0131m\u0131nda h\u00e2kim, malik iradesinin yerine ge\u00e7emez.<\/p>\n<p>Mimari projeye ayk\u0131r\u0131 yap\u0131la\u015fmalarda ise h\u00e2kim do\u011frudan m\u00fcdahale edemez. Yarg\u0131tay 18. Hukuk Dairesi, 11.02.2013 tarihli ve 2013\/953 E., 2013\/1630 K. say\u0131l\u0131 karar\u0131nda, ana ta\u015f\u0131nmaz\u0131n mimari projesinde yer almayan bir \u00e7at\u0131n\u0131n in\u015fas\u0131 i\u00e7in t\u00fcm kat maliklerinin oybirli\u011fiyle alaca\u011f\u0131 karar ve buna dayal\u0131 olarak belediyeden al\u0131nm\u0131\u015f tadilat projesi gerekti\u011fini, bu ko\u015fullar olmadan mahkemenin kat maliklerinin iradesi yerine ge\u00e7erek karar veremeyece\u011fini belirtmi\u015ftir.<\/p>\n<p>Y\u00f6netim plan\u0131 de\u011fi\u015fikli\u011fi do\u011frudan dava konusu edilemez.<\/p>\n<p>Y\u00f6netim plan\u0131 de\u011fi\u015fiklikleri de do\u011frudan dava konusu yap\u0131lamaz. Yarg\u0131tay 18. Hukuk Dairesi, 19.07.2005 tarihli ve 2005\/5235 E., 2005\/7657 K. say\u0131l\u0131 karar\u0131nda, y\u00f6netim plan\u0131nda yap\u0131lacak de\u011fi\u015fikliklerin \u00f6nce kat malikleri kurulunda g\u00f6r\u00fc\u015f\u00fclmesi gerekti\u011fini, bu toplant\u0131 yap\u0131lmadan do\u011frudan dava a\u00e7\u0131lmas\u0131n\u0131n m\u00fcmk\u00fcn olmad\u0131\u011f\u0131n\u0131 ifade etmi\u015ftir.<\/p>\n<p>\u0130\u015fletme projesine yedi g\u00fcn i\u00e7inde itiraz edilmelidir.<\/p>\n<p>\u0130\u015fletme projelerine y\u00f6nelik itirazlar ise s\u0131n\u0131rl\u0131 bir s\u00fcreye tabidir. Yarg\u0131tay 20. Hukuk Dairesi, 07.11.2017 tarihli ve 2017\/3688 E., 2017\/9092 K. say\u0131l\u0131 karar\u0131na g\u00f6re, i\u015fletme projesine kar\u015f\u0131 tebli\u011fden itibaren yedi g\u00fcn i\u00e7inde itiraz edilmesi gerekmekte olup, bu s\u00fcre ge\u00e7tikten sonra do\u011frudan dava yoluyla h\u00e2kim m\u00fcdahalesi talep edilemez.<\/p>\n<p>Kre\u015fin jimnastik salonu olarak kullan\u0131m\u0131 m\u00fcdahale gerektirmez; rahats\u0131zl\u0131k varsa m\u00fcdahale m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>Son olarak, kre\u015fin jimnastik salonu olarak kullan\u0131lmas\u0131 gibi durumlarda, rahats\u0131zl\u0131k do\u011fmad\u0131\u011f\u0131 s\u00fcrece m\u00fcdahale gerekmez. Ancak rahats\u0131zl\u0131\u011f\u0131n varl\u0131\u011f\u0131 somut olarak tespit edilirse, h\u00e2kimin m\u00fcdahalesi m\u00fcmk\u00fcnd\u00fcr. Bu konuda Yarg\u0131tay 18. Hukuk Dairesi, 19.06.1997 tarihli ve 1997\/4789 E., 1997\/6941 K. say\u0131l\u0131 karar\u0131nda, rahats\u0131zl\u0131k olu\u015fmas\u0131 h\u00e2linde m\u00fcdahalenin m\u00fcmk\u00fcn olaca\u011f\u0131 ifade edilmi\u015ftir.<\/p>\n<p>\u200bApartman ve site ya\u015fam\u0131, bireysel \u00f6zg\u00fcrl\u00fcklerin toplu ya\u015fam\u0131n d\u00fczeniyle s\u0131n\u0131rland\u0131\u011f\u0131 bir olu\u015fumdur. Kat M\u00fclkiyeti Kanunu, bu s\u0131n\u0131rlar\u0131 \u00e7izen ve ihlallere kar\u015f\u0131 h\u00e2kimin m\u00fcdahalesini d\u00fczenleyen g\u00fc\u00e7l\u00fc bir \u00e7er\u00e7eve sunar. Bu ba\u011flamda, Kat M\u00fclkiyeti Kanunu\u2019nun (KMK) 33. maddesi, apartman ve sitelerde ya\u015fanan ihlallere kar\u015f\u0131 h\u00e2kimin m\u00fcdahalesi yolunu a\u00e7\u0131k tutan temel d\u00fczenlemelerden biridir. Yarg\u0131tay kararlar\u0131, h\u00e2kimin m\u00fcdahalesinin kapsam\u0131n\u0131 belirlerken sadece \u015fekli ihlalleri de\u011fil, toplu ya\u015fam\u0131n ruhuna zarar veren davran\u0131\u015flar\u0131 da dikkate almaktad\u0131r.<\/p>\n<p>Bu \u00e7al\u0131\u015fma, Yarg\u0131tay i\u00e7tihatlar\u0131 \u0131\u015f\u0131\u011f\u0131nda h\u00e2kimin m\u00fcdahalesinin hangi hallerde, kimler taraf\u0131ndan ve nas\u0131l talep edilebilece\u011fini sistematik bi\u00e7imde incelemekte; uygulamada kar\u015f\u0131la\u015f\u0131lan sorunlar\u0131 ve \u00e7\u00f6z\u00fcm yollar\u0131n\u0131 analiz etmektedir.<\/p>\n<p>1. Kat Malikleri Kurulu Kararlar\u0131na Kar\u015f\u0131 H\u00e2kimin M\u00fcdahalesi<\/p>\n<p>Kat malikleri kurulu kararlar\u0131na kar\u015f\u0131 h\u00e2kimin m\u00fcdahalesi, \u00e7o\u011funlu\u011fun iradesinin bireysel haklar\u0131 ihlal etti\u011fi durumlarda g\u00fcndeme gelir. Bu m\u00fcdahale, \u00f6zellikle kararlar\u0131n kanunun emredici h\u00fck\u00fcmlerine, y\u00f6netim plan\u0131na ya da hakkaniyet ilkesine ayk\u0131r\u0131 olmas\u0131 h\u00e2linde s\u00f6z konusu olur.<\/p>\n<p>1.1. Emredici H\u00fck\u00fcmlere Ayk\u0131r\u0131l\u0131k<\/p>\n<p>Karar alma s\u00fcre\u00e7lerinde toplant\u0131 ve oy kullanma usullerine riayet edilmemesi, kararlar\u0131n ge\u00e7erlili\u011fini ortadan kald\u0131rabilir. Nitekim Yarg\u0131tay 18. Hukuk Dairesi, 16.09.2015 tarihli ve E. 2014\/16228, K. 2015\/12775 say\u0131l\u0131 karar\u0131nda, toplant\u0131 tutana\u011f\u0131n\u0131 \u201citiraz kayd\u0131yla\u201d imzalayan kat malikinin, a\u00e7\u0131k\u00e7a kar\u015f\u0131 oy kullanmamas\u0131 h\u00e2linde dava hakk\u0131n\u0131n bulunmad\u0131\u011f\u0131na h\u00fckmetmi\u015ftir. Bu karar, sadece \u015feklen de\u011fil, i\u00e7erik itibar\u0131yla da kar\u015f\u0131 \u00e7\u0131k\u0131lmas\u0131 gerekti\u011fini vurgulamaktad\u0131r.<\/p>\n<p>1.2. Y\u00f6netim Plan\u0131na Ayk\u0131r\u0131l\u0131k<\/p>\n<p>Y\u00f6netim plan\u0131, kat m\u00fclkiyeti ili\u015fkisinde ba\u011flay\u0131c\u0131 ve tamamlay\u0131c\u0131 h\u00fck\u00fcm niteli\u011fi ta\u015f\u0131r. Y\u00f6netim plan\u0131na ayk\u0131r\u0131 karar ve eylemler i\u00e7in h\u00e2kimin m\u00fcdahalesi istenebilir. Yarg\u0131tay 5. Hukuk Dairesi, 08.02.1992 tarihli ve E. 1991\/291, K. 1992\/930 say\u0131l\u0131 karar\u0131nda; y\u00f6netim plan\u0131nda \u201cg\u00fcr\u00fclt\u00fcl\u00fc i\u015fyeri\u201d faaliyetlerine izin verilmi\u015f olsa bile, bu faaliyetin KMK m.18 uyar\u0131nca di\u011fer maliklere rahats\u0131zl\u0131k vermemesi gerekti\u011fini vurgulam\u0131\u015ft\u0131r. Bu y\u00f6n\u00fcyle, plan h\u00fck\u00fcmleri emredici normlara ayk\u0131r\u0131 yorumlanamaz.<\/p>\n<p>1.3. Hakkaniyete Ayk\u0131r\u0131l\u0131k<\/p>\n<p>Kat maliklerinin ve ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm kullan\u0131c\u0131lar\u0131n\u0131n d\u00fcr\u00fcstl\u00fck ve hakkaniyet ilkelerine uygun davranmalar\u0131 gerekir. Yarg\u0131tay Hukuk Genel Kurulu, 27.06.2012 tarihli ve E. 2012\/18-102, K. 2012\/424 say\u0131l\u0131 karar\u0131nda; ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm ve ortak alan kullan\u0131mlar\u0131nda do\u011fruluk kurallar\u0131n\u0131n esas oldu\u011funu, rahats\u0131z edici davran\u0131\u015flardan ka\u00e7\u0131n\u0131lmas\u0131 gerekti\u011fini belirtmi\u015ftir. Yarg\u0131tay 22.06.2011 tarihli ve E. 2011\/18-251, K. 2011\/444 say\u0131l\u0131 karar\u0131nda da k\u00fc\u00e7\u00fck rahats\u0131zl\u0131klar\u0131n ho\u015fg\u00f6r\u00fcyle kar\u015f\u0131lanmas\u0131 gerekti\u011fine i\u015faret edilmi\u015ftir.<\/p>\n<p>Y\u00f6netim plan\u0131nda a\u00e7\u0131k\u00e7a yasaklay\u0131c\u0131 bir h\u00fck\u00fcm bulunmasa dahi, di\u011fer kat maliklerini rahats\u0131z edecek d\u00fczeyde bir durum ortaya \u00e7\u0131karsa, bu durum h\u00e2kim m\u00fcdahalesini gerektirebilir. Yarg\u0131tay 18. Hukuk Dairesi\u2019nin 08.09.2014 tarihli, 2014\/10395 Esas ve 2014\/12213 Karar say\u0131l\u0131 karar\u0131nda, rahats\u0131zl\u0131k yaratt\u0131\u011f\u0131 saptanan bir k\u00f6pe\u011fin, y\u00f6netim plan\u0131nda yasaklay\u0131c\u0131 h\u00fck\u00fcm bulunmasa bile uzakla\u015ft\u0131r\u0131lmas\u0131 gerekti\u011fine h\u00fckmedilmi\u015ftir.<\/p>\n<p>2. Kat Maliklerinin Bor\u00e7 ve Y\u00fck\u00fcml\u00fcl\u00fcklerine Ayk\u0131r\u0131l\u0131klar<\/p>\n<p>2.1. Ortak Giderlere Kat\u0131lmama<\/p>\n<p>Yarg\u0131tay 18. Ortak Yerlerin Amac\u0131 D\u0131\u015f\u0131nda Kullan\u0131m\u0131<\/p>\n<p>Ortak yerlerin kullan\u0131m\u0131na ili\u015fkin uyu\u015fmazl\u0131klarda, do\u011frudan dava a\u00e7\u0131lmadan \u00f6nce kat malikleri kuruluna ba\u015fvurulmas\u0131 gerekir. Nitekim Yarg\u0131tay 20. Hukuk Dairesi, 21.09.2017 tarihli ve 2017\/3826 E., 2017\/6664 K. say\u0131l\u0131 karar\u0131nda, ortak alan kullan\u0131m\u0131yla ilgili olarak mahkemeye ba\u015fvurmadan \u00f6nce kat malikleri kurulunda konunun g\u00f6r\u00fc\u015f\u00fclmesi gerekti\u011fini ifade etmi\u015ftir. Benzer \u015fekilde, sitenin ortak havuzunun kullan\u0131m\u0131na ili\u015fkin olarak \u00e7\u0131kan uyu\u015fmazl\u0131kta da Yarg\u0131tay 18. Hukuk Dairesi, 24.01.2008 tarihli ve 2007\/8115 E., 2008\/288 K. say\u0131l\u0131 karar\u0131nda, kat maliklerinin \u00f6ncelikle y\u00f6netimle konuyu m\u00fczakere etmesi, sonu\u00e7 al\u0131namamas\u0131 h\u00e2linde kat malikleri kuruluna ba\u015fvurmas\u0131 ve ancak bu yollar t\u00fcketildikten sonra h\u00e2kimin m\u00fcdahalesinin talep edilebilece\u011fini belirtmi\u015ftir.<\/p>\n<p>2.3. D\u0131\u015f Cephe ve Estetik Y\u00fck\u00fcml\u00fcl\u00fckler<\/p>\n<p>Yarg\u0131tay Hukuk Genel Kurulu, 18.01.2022 tarihli ve E. 2017\/1996, K. 2022\/5 say\u0131l\u0131 karar\u0131nda, balkonlar\u0131n mimari projeye ayk\u0131r\u0131 \u015fekilde kapat\u0131lmas\u0131 ve d\u0131\u015f cepheye kap\u0131 a\u00e7\u0131lmas\u0131 i\u015flemlerinin, proje de\u011fi\u015fikli\u011fi anlam\u0131na geldi\u011fini, bu t\u00fcr esasl\u0131 tadilatlar i\u00e7in t\u00fcm maliklerin oybirli\u011fi gerekti\u011fini belirtmi\u015ftir.\u2028Yarg\u0131tay 20. Hukuk Dairesi, 17.01.2019 tarihli ve E. 2017\/5345, K. 2019\/211 say\u0131l\u0131 karar\u0131nda ise, d\u0131\u015f cepheye klima d\u0131\u015f \u00fcnitesi veya \u00e7irkin tabelalar\u0131n as\u0131lmas\u0131n\u0131n anagayrimenkul\u00fcn g\u00f6r\u00fcn\u00fcm\u00fcn\u00fc bozdu\u011fu ve h\u00e2kimin m\u00fcdahalesinin m\u00fcmk\u00fcn oldu\u011fu ifade edilmi\u015ftir.<\/p>\n<p>2.4. G\u00fcr\u00fclt\u00fc, Koku ve Rahats\u0131zl\u0131k Verici Davran\u0131\u015flar<\/p>\n<p>G\u00fcr\u00fclt\u00fc, k\u00f6t\u00fc koku, duman, kliman\u0131n sesi gibi unsurlar, kat maliklerinin g\u00fcnl\u00fck ya\u015fam\u0131n\u0131 do\u011frudan etkiler. Yarg\u0131tay, y\u00fcksek sesle m\u00fczik dinleme, balkonda mangal yapma, hal\u0131 silkeleme, ba\u011f\u0131rma gibi davran\u0131\u015flar\u0131n h\u00e2kim m\u00fcdahalesini gerektirecek nitelikte oldu\u011funu kabul etmektedir. Nitekim Yarg\u0131tay 18. Hukuk Dairesi\u2019nin 11 May\u0131s 2009 tarihli ve 2009\/4903 Esas, 2009\/5003 Karar say\u0131l\u0131; ayr\u0131ca 12 Mart 2009 tarihli ve 2008\/11233 Esas, 2009\/3381 Karar say\u0131l\u0131 kararlar\u0131nda bu y\u00f6nde de\u011ferlendirme yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Ayr\u0131ca, bu t\u00fcr davran\u0131\u015flar ceza hukuku kapsam\u0131nda da sonu\u00e7 do\u011furabilir. \u00d6rne\u011fin, s\u00fcrekli g\u00fcr\u00fclt\u00fc \u00e7\u0131karan bir ki\u015finin eylemi, gerekli \u015fartlar olu\u015ftu\u011funda T\u00fcrk Ceza Kanunu\u2019nun 123. Bu durum, \u201cKi\u015filerin Huzur ve S\u00fck\u00fbnunu Bozma\u201d su\u00e7u kapsam\u0131nda say\u0131labilir. Bu husus, Yarg\u0131tay 18. Hukuk Dairesi\u2019nin 15 Haziran 2009 tarihli ve 2009\/842 Esas, 2009\/6478 Karar say\u0131l\u0131 karar\u0131nda da ifade edilmi\u015ftir.<\/p>\n<p>2.5. Y\u00f6netim Belgelerinin Teslim Edilmemesi<\/p>\n<p>Kat M\u00fclkiyeti rejiminde, y\u00f6netici de\u011fi\u015fikli\u011fi durumunda eski y\u00f6neticinin g\u00f6rev s\u00fcresince tuttu\u011fu defter, makbuz ve di\u011fer belgeleri yeni y\u00f6netime teslim etmesi bir zorunluluktur. Aksi h\u00e2lde y\u00f6netim faaliyeti sekteye u\u011frar ve maliklerin ortak haklar\u0131 zedelenir. Yarg\u0131tay 18. Hukuk Dairesi\u2019nin 19 \u015eubat 2009 tarihli ve 2009\/946 Esas, 2009\/1359 Karar say\u0131l\u0131 karar\u0131nda da a\u00e7\u0131k\u00e7a belirtildi\u011fi \u00fczere, eski y\u00f6neticinin bu belgeleri teslimden ka\u00e7\u0131nmas\u0131 h\u00e2linde, Kat M\u00fclkiyeti Kanunu\u2019nun 33. maddesi uyar\u0131nca do\u011frudan h\u00e2kimin m\u00fcdahalesi istenebilir ve mahkeme karar\u0131yla belgelerin yeni y\u00f6neticiye teslimi sa\u011flanabilir.<\/p>\n<p>2.6. Y\u00f6netici Atanmas\u0131 Talebi<\/p>\n<p>Kat maliklerinin y\u00f6netici se\u00e7memesi, mevcut y\u00f6neticinin g\u00f6revi b\u0131rakmas\u0131 ya da g\u00f6revini yapmamas\u0131 durumunda, h\u00e2kimden y\u00f6netici atanmas\u0131 istenebilir. Bu talepte bulunan kat malikinin mutlaka bir aday g\u00f6stermesi gerekmez. E\u011fer bir aday g\u00f6sterilse bile, h\u00e2kim bu ki\u015fiyle ba\u011fl\u0131 de\u011fildir; isterse kat maliklerinden birini, isterse d\u0131\u015far\u0131dan bir ki\u015fiyi y\u00f6netici olarak atayabilir. M\u00fclkiyetin Devri Talebinde \u201cIsrar\u201d Unsurunun Varl\u0131\u011f\u0131<\/p>\n<p>Kat M\u00fclkiyeti Kanunu\u2019nun 25. maddesi uyar\u0131nca, bir kat malikinin m\u00fclkiyetinin devrine zorlama davas\u0131 a\u00e7\u0131labilmesi i\u00e7in, yaln\u0131zca KMK m.\u202f33 kapsam\u0131nda verilen karar\u0131n kesinle\u015fmi\u015f olmas\u0131 ve bir y\u0131l i\u00e7inde bu karar\u0131n kendili\u011finden yerine getirilmemesi yeterli de\u011fildir. Bu s\u00fcrecin sonunda, ilgili kat malikinin mahkeme karar\u0131na ra\u011fmen h\u00e2l\u00e2 ihlalde \u0131srar etti\u011finin somut bi\u00e7imde ortaya konulmas\u0131 gerekir.<\/p>\n<p>Yarg\u0131tay 18. H\u00e2kimin M\u00fcdahalesini Gerektirmeyen Haller<\/p>\n<p>Kat M\u00fclkiyeti Kanunu kapsam\u0131nda baz\u0131 uyu\u015fmazl\u0131klarda do\u011frudan h\u00e2kim m\u00fcdahalesi talep edilebilse de, baz\u0131 durumlarda bu m\u00fcdahaleye gerek bulunmamaktad\u0131r. Bu h\u00e2ller genellikle ortak ya\u015fam\u0131n ola\u011fan ak\u0131\u015f\u0131, y\u00f6netim plan\u0131, mimari proje ve yarg\u0131 i\u00e7tihatlar\u0131 \u00e7er\u00e7evesinde belirlenmektedir.<\/p>\n<p>Arsa bo\u015flu\u011funun otopark olarak kullan\u0131m\u0131 rahats\u0131zl\u0131k say\u0131lmaz.<\/p>\n<p>Baz\u0131 kullan\u0131m bi\u00e7imleri ise do\u011frudan rahats\u0131zl\u0131k do\u011furmad\u0131\u011f\u0131 i\u00e7in h\u00e2kim m\u00fcdahalesine gerek bulunmamaktad\u0131r. \u00d6rne\u011fin, apartman arsa bo\u015flu\u011funun otopark olarak kullan\u0131lmas\u0131 tek ba\u015f\u0131na bir rahats\u0131zl\u0131k sebebi olarak de\u011ferlendirilemez. Bu y\u00f6nde Yarg\u0131tay Hukuk Genel Kurulu, 09.06.1993 tarihli ve 1986\/4-425 K. say\u0131l\u0131 karar\u0131nda, bu t\u00fcr kullan\u0131m\u0131n ola\u011fan s\u0131n\u0131rlar i\u00e7inde kald\u0131\u011f\u0131n\u0131 kabul etmi\u015ftir.<\/p>\n<p>Zihinsel engelli \u00e7ocu\u011fun varl\u0131\u011f\u0131, tek ba\u015f\u0131na m\u00fcdahale sebebi de\u011fildir.<\/p>\n<p>Benzer \u015fekilde, Yarg\u0131tay 18.
