Ba\u015fvuru, ba\u015fvuru formu ve eklerinin idari y\u00f6nden yap\u0131lan \u00f6n incelemesinden sonra Komisyona sunulmu\u015ftur.<\/p>\n<p>4. Komisyon, k\u00f6t\u00fc muamele yasa\u011f\u0131 ile maddi ve manevi varl\u0131\u011f\u0131n korunmas\u0131 ve geli\u015ftirilmesi hakk\u0131na ili\u015fkin \u015fik\u00e2yetler y\u00f6n\u00fcnden ba\u015fvurunun kabul edilebilirlik incelemesinin B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na karar vermi\u015f; di\u011fer ihlal iddialar\u0131n\u0131 ise kabul edilemez bulmu\u015ftur.<\/p>\n<p>5. Ba\u015fvuru belgelerinin bir \u00f6rne\u011fi bilgi i\u00e7in Adalet Bakanl\u0131\u011f\u0131na (Bakanl\u0131k) g\u00f6nderilmi\u015ftir. Bakanl\u0131k, g\u00f6r\u00fc\u015f\u00fcn\u00fc bildirmi\u015ftir. Ba\u015fvurucu, Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 s\u00fcresinde beyanda bulunmu\u015ftur.<\/p>\n<p>6. Birinci B\u00f6l\u00fcm ba\u015fvurunun Genel Kurul taraf\u0131ndan incelenmesine karar vermi\u015ftir.<\/p>\n<p>III. OLAY VE OLGULAR <\/p>\n<p>7. Ba\u015fvuru formu ve eklerinde ifade edildi\u011fi \u015fekliyle ve Ulusal Yarg\u0131 A\u011f\u0131 Bili\u015fim Sistemi (UYAP) arac\u0131l\u0131\u011f\u0131yla eri\u015filen bilgi ve belgeler \u00e7er\u00e7evesinde ilgili olaylar \u00f6zetle \u015f\u00f6yledir:<\/p>\n<p>8. Ba\u015fvurucu 28\/1\/2017 tarihinden 8\/10\/2022 tarihine kadar \u0130zmir 2 No.lu T Tipi Kapal\u0131 Ceza \u0130nfaz Kurumunda (\u0130nfaz Kurumu) bar\u0131nd\u0131r\u0131lm\u0131\u015ft\u0131r. Ba\u015fvurucu 8\/10\/2022 tarihinde ise ba\u015fka bir ceza infaz kurumuna nakledilmi\u015ftir.<\/p>\n<p>9. Ba\u015fvurucu; \u0130nfaz Kurumuna ba\u015fvurarak ba\u015fka \u015fik\u00e2yetlerinin yan\u0131 s\u0131ra tutuldu\u011fu odada kalan ki\u015fi say\u0131s\u0131n\u0131n fazlal\u0131\u011f\u0131 nedeniyle tutulma ko\u015fullar\u0131n\u0131n uygun olmamas\u0131ndan, ikinci battaniye verilmemesinden, ailesinin getirdi\u011fi ki\u015fisel e\u015fyas\u0131na eski ve yeni ayr\u0131m\u0131 yap\u0131larak eskilerin ve etiketsizlerin \u0130nfaz Kurumuna al\u0131nmamas\u0131ndan, ki\u015fisel e\u015fyas\u0131n\u0131n renk ve adet olarak k\u0131s\u0131tlanmas\u0131ndan yak\u0131nm\u0131\u015ft\u0131r. \u0130dare ve G\u00f6zlem Kurulu ba\u015fvurucunun taleplerinin reddine karar vermi\u015ftir. Kararda, ilk \u015fik\u00e2yet y\u00f6n\u00fcnden 15 Temmuz darbe te\u015febb\u00fcs\u00fc nedeniyle karar g\u00fcn\u00fc itibar\u0131yla \u0130nfaz Kurumunda 1.324 tutuklu ve h\u00fck\u00fcml\u00fc oldu\u011funu, \u0130nfaz Kurumunda bar\u0131nd\u0131r\u0131lan tutuklu ve h\u00fck\u00fcml\u00fc say\u0131s\u0131n\u0131n kurum kapasitesinin \u00fczerinde oldu\u011funu, \u0130nfaz Kurumunun kamp\u00fcs i\u00e7inde yer almas\u0131 nedeniyle Bakanl\u0131\u011f\u0131n ve Cumhuriyet Savc\u0131l\u0131\u011f\u0131n\u0131n emirleri gere\u011fi Kuruma s\u00fcrekli tutuklu ve h\u00fck\u00fcml\u00fc sevk edildi\u011fini belirterek oda ve ko\u011fu\u015f yerle\u015ftirmelerinin adil olarak ve hakkaniyet \u00e7er\u00e7evesinde yap\u0131ld\u0131\u011f\u0131n\u0131 a\u00e7\u0131klam\u0131\u015ft\u0131r. \u0130kinci \u015fik\u00e2yet y\u00f6n\u00fcnden ilgili mevzuattaki \u201cH\u00fck\u00fcml\u00fcler, kendilerine idare taraf\u0131ndan verilen nevresim tak\u0131m\u0131 ve battaniye d\u0131\u015f\u0131nda, kantinden temin edilmek \u015fart\u0131yla bir adet nevresim tak\u0131m\u0131 ve iklim ko\u015fullar\u0131 de\u011ferlendirilerek idarenin uygun g\u00f6rece\u011fi say\u0131da battaniye bulundurabilir.\u201d h\u00fckm\u00fc belirtildikten sonra mevcudun Kurum kapasitesinin \u00e7ok \u00fczerinde olmas\u0131, ko\u011fu\u015flar\u0131n kalabal\u0131k olmas\u0131 nedeniyle Kurum idaresi taraf\u0131ndan bir battaniye verilmesinin uygun g\u00f6r\u00fcld\u00fc\u011f\u00fcn\u00fc bildirmi\u015ftir. Son \u015fik\u00e2yet y\u00f6n\u00fcnden ise 17\/6\/2005 tarihli ve 25848 say\u0131l\u0131 Resm\u00ee Gazete\u2019de yay\u0131mlanan Ceza \u0130nfaz Kurumlar\u0131nda Bulundurulabilecek E\u015fya ve Maddeler Hakk\u0131nda Y\u00f6netmelik\u2019in 7. maddesindeki \u201cH\u00fck\u00fcml\u00fcler; ceza infaz kurumu d\u0131\u015f\u0131ndan getirilmesine izin verilen giyim e\u015fyalar\u0131ndan eskiyenlerini, yenileriyle de\u011fi\u015ftirebilir.\u201d d\u00fczenlemesi ile 13\/12\/2004 tarihli ve 5275 say\u0131l\u0131 Ceza ve G\u00fcvenlik Tedbirlerinin \u0130nfaz\u0131 Hakk\u0131nda Kanun\u2019un 64. maddesindeki \u201cH\u00fck\u00fcml\u00fclerin giysileri, i\u00e7 ve d\u0131\u015f g\u00fcvenlik g\u00f6revlilerinin giymekte oldu\u011fu \u00fcniformalara benzer \u015fekil ve renkte olamaz.\u201d d\u00fczenlemesi gere\u011fi eski olan veya Kurum personeli ile benzer renkte olan giyim e\u015fyas\u0131n\u0131n tutuklu ve h\u00fck\u00fcml\u00fclere teslim edilmedi\u011fini belirtmi\u015ftir.<\/p>\n<p>10. Ba\u015fvurucu, \u0130dare ve G\u00f6zlem Kurulu karar\u0131na kar\u015f\u0131 Kar\u015f\u0131yaka \u0130nfaz H\u00e2kimli\u011fine (\u0130nfaz H\u00e2kimli\u011fi) ba\u015fvurup ma\u011fduriyetlerinin giderilmesini ve telafi edilmesini talep etmi\u015ftir. \u0130nfaz H\u00e2kimli\u011fi, karar\u0131n usul ve kanuna uygun oldu\u011fu gerek\u00e7esiyle ba\u015fvurucunun taleplerini reddetmi\u015ftir. Ba\u015fvurucunun an\u0131lan karara itiraz\u0131, ayn\u0131 gerek\u00e7eyle Kar\u015f\u0131yaka 1. A\u011f\u0131r Ceza Mahkemesince kesin olarak reddedilmi\u015ftir.<\/p>\n<p>11. Nihai karar 19\/9\/2019 tarihinde ba\u015fvurucuya tebli\u011f edilmi\u015f, ba\u015fvurucu 4\/10\/2019 tarihinde bireysel ba\u015fvuruda bulunmu\u015ftur.<\/p>\n<p>12. \u0130nfaz Kurumunun ba\u015fvurucunun tutulma ko\u015fullar\u0131 hakk\u0131nda haz\u0131rlad\u0131\u011f\u0131 27\/10\/2022 tarihli rapora g\u00f6re;<\/p>\n<p>&#8211; Ba\u015fvurucu A-25, A-26, A-27, C-1, B-5, A-23 No.lu odalarda kalm\u0131\u015ft\u0131r. A-25, A-26, A-27, A-23 No.lu odalar\u0131n \u00f6l\u00e7\u00fcleri ayn\u0131d\u0131r. Havaland\u0131rma bah\u00e7esi 25 m\u00b2, yatakhane b\u00f6l\u00fcm\u00fc 34 m\u00b2, ortak ya\u015fam alan\u0131 15 m\u00b2dir. C-1 ile B-5 No.lu odalar\u0131n \u00f6l\u00e7\u00fcleri ise ayn\u0131d\u0131r. Havaland\u0131rma bah\u00e7esi 35 m\u00b2, yatakhane b\u00f6l\u00fcm\u00fc 32,5 m\u00b2, ortak ya\u015fam alan\u0131 28 m\u00b2dir. Ortak ya\u015fam alan\u0131nda televizyon, satran\u00e7 tak\u0131m\u0131, kitap ve s\u00fcreli yay\u0131nlar bulunmaktad\u0131r.<\/p>\n<p>&#8211; Ko\u011fu\u015flar\u0131n giri\u015f kat\u0131nda yatakhane ve ortak kullan\u0131m alan\u0131ndan tamamen ba\u011f\u0131ms\u0131z olup toplam\u0131 3,5 m\u00b2 (1,3 m\u00b2 b\u00fcy\u00fckl\u00fc\u011f\u00fcnde tuvalet, 1,3 m\u00b2 b\u00fcy\u00fckl\u00fc\u011f\u00fcnde bir banyo ve bir de lavabo alan\u0131) olan s\u0131hhi alan vard\u0131r. Tuvalet ve banyonun kullan\u0131m s\u00fcrelerinde k\u0131s\u0131tlama yoktur, tuvalet ve banyo s\u00fcrekli a\u00e7\u0131kt\u0131r. S\u0131cak su pandemi d\u00f6neminde kota ve dakika s\u0131n\u0131r\u0131 olmadan, di\u011fer d\u00f6nemlerde ise farkl\u0131 zaman aral\u0131klar\u0131nda g\u00fcnde toplam on \u00fc\u00e7 saat verilmi\u015ftir.<\/p>\n<p>&#8211; Havaland\u0131rma bah\u00e7eleri ko\u011fu\u015ftan ba\u011f\u0131ms\u0131z de\u011fildir. Ko\u011fu\u015ftakiler, havaland\u0131rma bah\u00e7esinden kesintisiz \u015fekilde faydalanabilmekte olup, havaland\u0131rma bah\u00e7esi g\u00fcvenlik gerek\u00e7esiyle g\u00fcn \u0131\u015f\u0131y\u0131nca a\u00e7\u0131lmakta, hava karar\u0131nca kapat\u0131lmaktad\u0131r. Havaland\u0131rma bah\u00e7esi belirtilen saatler aral\u0131\u011f\u0131nda her g\u00fcn a\u00e7\u0131kt\u0131r, odada bar\u0131nd\u0131r\u0131lan tutuklu ve h\u00fck\u00fcml\u00fcler bu saatlerde havaland\u0131rma bah\u00e7esinden serbest\u00e7e yararlanabilmektedir.<\/p>\n<p>&#8211; H\u00fck\u00fcml\u00fc ve tutuklular\u0131n A-25, A-26, A-27, A-23 No.lu odalarda istedikleri zaman a\u00e7abildikleri be\u015f pencere (d\u00f6rd\u00fc 110&#215;125 cm, biri 67&#215;60 cm ebad\u0131nda), C-1 ile B-5 No.lu odalarda ise yedi pencere (be\u015fi 110&#215;125 cm, ikisi 67&#215;60 cm ebad\u0131nda) vard\u0131r.<\/p>\n<p>&#8211; Her bir h\u00fck\u00fcml\u00fc ve tutukluya \u00f6zel olarak yatak, battaniye, \u00e7ar\u015faf ve yast\u0131k verilmekte olup bunlardan d\u00f6n\u00fc\u015f\u00fcml\u00fc faydaland\u0131rma s\u00f6z konusu de\u011fildir.<\/p>\n<p>&#8211; Tutuklu ve h\u00fck\u00fcml\u00fclerin aileleri taraf\u0131ndan getirilen ki\u015fisel e\u015fyadan kullan\u0131m sebebiyle eskimeye y\u00fcz tutmu\u015f giyim e\u015fyas\u0131 ile renk, g\u00f6r\u00fcnt\u00fc itibar\u0131yla \u0130nfaz Kurumunda kullan\u0131lmas\u0131nda asayi\u015f ve g\u00fcvenlik y\u00f6n\u00fcnden sak\u0131nca olan (memur ve kolluk kuvveti k\u0131yafetlerine benzer, e\u015fk\u00e2l gizleyici vb.) giyim e\u015fyas\u0131 tutuklu ve h\u00fck\u00fcml\u00fclere teslim edilmemektedir.<\/p>\n<p>&#8211; Ko\u011fu\u015flarda koku, akma gibi nedenlerden dolay\u0131 bak\u0131m ve onar\u0131m ihtiyac\u0131 oldu\u011fu, dilek\u00e7e verilmek suretiyle yaz\u0131l\u0131 olarak bildirilmemi\u015ftir. \u00c7\u00f6pler g\u00fcnl\u00fck olarak toplanmakta, temizli\u011fe ili\u015fkin yeterli malzeme \u0130nfaz Kurumu b\u00fct\u00e7esinden kar\u015f\u0131lanmak \u00fczere temin edilmektedir. \u0130nfaz Kurumunda sabah ve ak\u015fam olmak \u00fczere iki kez rutin say\u0131m yap\u0131lmaktad\u0131r.<\/p>\n<p>13. Ba\u015fvurucunun hangi odada ka\u00e7 ki\u015fi ile ne kadar s\u00fcre bar\u0131nd\u0131r\u0131ld\u0131\u011f\u0131na, ko\u011fu\u015fun \u00f6l\u00e7\u00fclerine ili\u015fkin olarak \u0130nfaz Kurumunun sundu\u011fu ve Bakanl\u0131\u011f\u0131n teyit etti\u011fi veriler a\u015fa\u011f\u0131da belirtilmi\u015ftir. Bu bilgilerden ko\u011fu\u015fun boyutunun ko\u011fu\u015f i\u00e7i s\u0131hhi alanlar hari\u00e7 tutularak ve havaland\u0131rma bah\u00e7esi d\u00e2hil edilerek hesapland\u0131\u011f\u0131, ko\u011fu\u015f mevcudunun ba\u015fvurucu d\u00e2hil edilerek bildirildi\u011fi anla\u015f\u0131lm\u0131\u015ft\u0131r. \u0130nfaz Kurumu ve Bakanl\u0131\u011fa g\u00f6re ba\u015fvurucunun ki\u015fisel alan\u0131na ili\u015fkin bilgiler \u015f\u00f6yledir:<\/p>\n<p>&#8211; 28\/1\/2017-3\/5\/2017 tarihleri aras\u0131nda A-25 No.lu odada be\u015f ki\u015fi bar\u0131nd\u0131r\u0131lm\u0131\u015ft\u0131r. Bir ki\u015fi i\u00e7in ya\u015fam alan\u0131 14,8 m\u00b2dir.<\/p>\n<p>&#8211; 3\/5\/2017-13\/10\/2017 tarihleri aras\u0131nda A-26 No.lu odada en az on, en \u00e7ok on d\u00f6rt (yedi hafta s\u00fcreyle) ve \u00e7o\u011funlukla on iki ki\u015fi bar\u0131nd\u0131r\u0131lm\u0131\u015ft\u0131r. Bir ki\u015fi i\u00e7in ya\u015fam alan\u0131 en \u00e7ok 7,4 m\u00b2, en az 5,28 m\u00b2dir.<\/p>\n<p>&#8211; 13\/10\/2017-8\/2\/2018 tarihleri aras\u0131nda A-27 No.lu odada en az on d\u00f6rt, en \u00e7ok on be\u015f ki\u015fi (be\u015f hafta s\u00fcreyle) bar\u0131nd\u0131r\u0131lm\u0131\u015ft\u0131r. Bir ki\u015fi i\u00e7in ya\u015fam alan\u0131 en \u00e7ok 5,28 m\u00b2, en az 4,93 m\u00b2dir.<\/p>\n<p>&#8211; 8\/2\/2018-30\/5\/2018 tarihleri aras\u0131nda C-1 No.lu odada en az yirmi, en \u00e7ok yirmi d\u00f6rt ki\u015fi bar\u0131nd\u0131r\u0131lm\u0131\u015ft\u0131r. Odada yirmi d\u00f6rt ki\u015fi yirmi yedi g\u00fcn, yirmi \u00fc\u00e7 ki\u015fi yirmi iki g\u00fcn; yirmi iki ki\u015fi yirmi alt\u0131 g\u00fcn, yirmi bir ki\u015fi yirmi g\u00fcn ve yirmi ki\u015fi on alt\u0131 g\u00fcn kalm\u0131\u015ft\u0131r. Bir ki\u015fi i\u00e7in ya\u015fam alan\u0131 en \u00e7ok 4,77 m\u00b2, en az 3,97 m\u00b2dir.<\/p>\n<p>&#8211; 30\/5\/2018-6\/6\/2018 tarihleri aras\u0131nda B-5 No.lu odada \u00fc\u00e7 g\u00fcn yirmi sekiz ki\u015fi, d\u00f6rt g\u00fcn yirmi yedi ki\u015fi bar\u0131nd\u0131r\u0131lm\u0131\u015ft\u0131r. De\u011ferlendirme <\/p>\n<p>20. Ba\u015fvuru, maddi ve manevi varl\u0131\u011f\u0131n korunmas\u0131 ve geli\u015ftirilmesi hakk\u0131 kapsam\u0131nda incelenmi\u015ftir.<\/p>\n<p>21. Somut ba\u015fvuru a\u00e7\u0131s\u0131ndan de\u011ferlendirilmesi gereken ilk husus, \u0130nfaz Kurumunun ba\u015fvuruya konu edilen uygulamas\u0131n\u0131n ba\u015fvurucu a\u00e7\u0131s\u0131ndan Anayasa\u2019n\u0131n 17. maddesi kapsam\u0131ndaki g\u00fcvenceleri harekete ge\u00e7irecek asgari a\u011f\u0131rl\u0131kta olup olmad\u0131\u011f\u0131d\u0131r. S\u00f6z konusu a\u011f\u0131rl\u0131k, olay\u0131n t\u00fcm \u015fartlar\u0131 dikkate al\u0131narak de\u011ferlendirilmelidir. Bu de\u011ferlendirmede m\u00fcdahalenin yo\u011funlu\u011fu, s\u00fcresi, fiziksel ve ruhsal etkisi dikkate al\u0131nmal\u0131; h\u00fcrriyeti ba\u011flay\u0131c\u0131 tedbir ya da ceza gere\u011fince mahpuslar taraf\u0131ndan katlan\u0131lmas\u0131 m\u00fcmk\u00fcn ve muhtemel g\u00f6r\u00fclen etki ve rahats\u0131zl\u0131klara oranla ba\u015fvurucu a\u00e7\u0131s\u0131ndan nas\u0131l bir \u00e7ekilmezli\u011fin olu\u015ftu\u011fu ya da olu\u015fma ihtimali bulundu\u011fu hususu g\u00f6z\u00f6n\u00fcne al\u0131nmal\u0131d\u0131r. Bu ba\u011flamda aranan asgari a\u011f\u0131rl\u0131k e\u015fi\u011fi, s\u00f6z konusu alana ili\u015fkin incelenebilir bir sorunun bulunup bulunmad\u0131\u011f\u0131n\u0131n belirlenebilmesi a\u00e7\u0131s\u0131ndan \u00f6nemli bir kriterdir (M\u00fcjdat G\u00fcrb\u00fcz, B. Ayr\u0131ca ba\u015fvuru dosyas\u0131ndaki bilgi ve belgeler birlikte de\u011ferlendirildi\u011finde ba\u015fvurucunun \u015fik\u00e2yetlerini temellendirecek arg\u00fcmanlar\u0131 somut delillerle ortaya koyabildi\u011fi de s\u00f6ylenemez. Sonu\u00e7 olarak ba\u015fvurucu, \u015fik\u00e2yetlerine konu temel olay ve olgular ile bireysel ba\u015fvuruya konu olan, maddi ve manevi varl\u0131\u011f\u0131n korunmas\u0131 ve geli\u015ftirilmesi hakk\u0131n\u0131n hangi nedenlerle ihlal edildi\u011fini a\u00e7\u0131klama y\u00f6n\u00fcndeki y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc yerine getirmemi\u015f; bu ba\u011flamda ileri s\u00fcrd\u00fc\u011f\u00fc ihlal iddialar\u0131n\u0131 temellendirememi\u015ftir.<\/p>\n<p>23. A\u00e7\u0131klanan gerek\u00e7elerle ba\u015fvurunun bu k\u0131sm\u0131n\u0131n a\u00e7\u0131k\u00e7a dayanaktan yoksun olmas\u0131 nedeniyle kabul edilemez oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>C. Ba\u015fvurucu; bar\u0131nd\u0131r\u0131ld\u0131\u011f\u0131 ko\u011fu\u015fun \u00e7ok kalabal\u0131k oldu\u011funu, 8 ki\u015filik odada 27 ki\u015fi tutuldu\u011funu, hijyen ko\u015fullar\u0131n\u0131n sa\u011flanmad\u0131\u011f\u0131n\u0131, yerde yatt\u0131\u011f\u0131n\u0131, talep etti\u011fi h\u00e2lde ikinci battaniyenin verilmedi\u011fini, bu nedenle bel a\u011fr\u0131s\u0131 \u00e7ekti\u011fini, doktorun yaz\u0131s\u0131na ra\u011fmen yeni yatak verilmedi\u011fini, sosyal ve k\u00fclt\u00fcrel faaliyetlere kat\u0131lamad\u0131\u011f\u0131n\u0131 belirterek k\u00f6t\u00fc muamele yasa\u011f\u0131n\u0131n ihlal edildi\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr. Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcnde; ba\u015fvurucunun tazminat yolunu t\u00fcketmedi\u011fi, esas y\u00f6n\u00fcnden yap\u0131lacak incelenmede Anayasa\u2019n\u0131n, mevzuat h\u00fck\u00fcmlerinin, Anayasa Mahkemesi ve A\u0130HM kararlar\u0131n\u0131n dikkate al\u0131nmas\u0131 gerekti\u011fi bildirilmi\u015ftir. Ba\u015fvurucu, Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 beyan\u0131nda B-5 ve C-1 No.lu odalar\u0131n sekiz ki\u015fi i\u00e7in, A-23, A-25, A-26, A-27 No.lu odalar\u0131n ise \u00fc\u00e7 ki\u015fi i\u00e7in tasarland\u0131\u011f\u0131n\u0131 belirtmi\u015ftir.<\/p>\n<p>2. De\u011ferlendirme<\/p>\n<p>a. Kabul Edilebilirlik Y\u00f6n\u00fcnden<\/p>\n<p>25. A\u00e7\u0131k\u00e7a dayanaktan yoksun olmad\u0131\u011f\u0131 ve kabul edilemezli\u011fine karar verilmesini gerektirecek ba\u015fka bir neden de bulunmad\u0131\u011f\u0131 anla\u015f\u0131lan k\u00f6t\u00fc muamele yasa\u011f\u0131n\u0131n ihlal edildi\u011fine ili\u015fkin iddian\u0131n kabul edilebilir oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>b. Esas Y\u00f6n\u00fcnden <\/p>\n<p>i. Genel ilkeler<\/p>\n<p>26. \u0130nsan onurunun korunmas\u0131 amac\u0131yla Anayasa\u2019n\u0131n 17. maddesinin ilk f\u0131kras\u0131nda maddi ve manevi varl\u0131\u011f\u0131n korunmas\u0131 ve geli\u015ftirilmesi hakk\u0131 g\u00fcvence alt\u0131na al\u0131nm\u0131\u015f; ayn\u0131 maddenin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131yla da ki\u015filere i\u015fkence ve eziyet yap\u0131lmas\u0131, ki\u015filerin insan haysiyetiyle ba\u011fda\u015fmayan bir cezaya veya muameleye tabi tutulmas\u0131 yasaklanm\u0131\u015ft\u0131r. Bu yasak i\u00e7in herhangi bir istisnan\u0131n kabul edilmemesi ve Anayasa\u2019n\u0131n 15. maddesinde sava\u015f, seferberlik veya ola\u011fan\u00fcst\u00fc h\u00e2llerde de maddi ve manevi varl\u0131\u011f\u0131n\u0131n b\u00fct\u00fcnl\u00fc\u011f\u00fcne dokunulamayaca\u011f\u0131n\u0131n ifade edilmesi, yasa\u011f\u0131n mutlak niteli\u011fini ortaya koymaktad\u0131r (Cezmi Demir ve di\u011ferleri, B. No: 2013\/293, 17\/7\/2014, \u00a7\u00a7 80, 83; Ali R\u0131za \u00d6zer ve di\u011ferleri [GK], B. No: 2013\/3924, 6\/1\/2015, \u00a7\u00a7 72, 74, 75).<\/p>\n<p>27. An\u0131lan yasak kapsam\u0131nda kalan hususlar, ceza infaz kurumlar\u0131nda farkl\u0131 \u015fekillerde tezah\u00fcr edebilir. Bunlar ceza infaz kurumu idaresi ve g\u00f6revlilerinin kas\u0131tl\u0131 davran\u0131\u015flar\u0131ndan kaynaklanabilece\u011fi gibi y\u00f6netimsel hatalar veya yetersiz kaynaklar sebebiyle de ortaya \u00e7\u0131kabilir (Turan G\u00fcnana, B. No: 2013\/3550, 19\/11\/2014, \u00a7 37).<\/p>\n<p>28. Anayasa\u2019n\u0131n 17. maddesi, tutuklu ve h\u00fck\u00fcml\u00fclerin tutulma ko\u015fullar\u0131n\u0131n da insan onuruna yak\u0131\u015f\u0131r bir \u015fekilde olmas\u0131n\u0131 koruma alt\u0131na al\u0131r. Bu nedenle tutuklu ve h\u00fck\u00fcml\u00fcler \u00f6zg\u00fcrl\u00fckten mahrum kalmalar\u0131n\u0131n do\u011fal sonucu olan ka\u00e7\u0131n\u0131lmaz elem seviyesinden daha fazla s\u0131k\u0131nt\u0131 veya eziyet \u00e7ekecekleri bir duruma sokulmamal\u0131d\u0131r. Ayr\u0131ca bu ki\u015filerin sa\u011fl\u0131k ve esenlikleri yeterli bir \u015fekilde g\u00fcvence alt\u0131na al\u0131nmal\u0131 ve bu ki\u015filere gerekli duyduklar\u0131 t\u0131bbi yard\u0131m sa\u011flanmal\u0131d\u0131r (Turan G\u00fcnana, \u00a7 39).<\/p>\n<p>29. Anayasa Mahkemesi a\u015f\u0131r\u0131 kalabal\u0131kla\u015fma ve ki\u015fisel alan eksikli\u011fine ili\u015fkin ilkelerini yukar\u0131da bahsedilen Cengiz Yetgin karar\u0131nda belirlemi\u015ftir. Bu kararda tutulma ko\u015fullar\u0131n\u0131n Anayasa\u2019n\u0131n 17. maddesi y\u00f6n\u00fcnden yap\u0131lacak asgari a\u011f\u0131rl\u0131k seviyesi de\u011ferlendirmesinde tutulma s\u00fcresi, a\u00e7\u0131k havada egzersiz yapma olanaklar\u0131, ko\u015fullar\u0131n fiziksel ve zihinsel etkileri, baz\u0131 durumlarda mahpusun ya\u015f\u0131, cinsiyeti, sa\u011fl\u0131\u011f\u0131 ve davan\u0131n t\u00fcm ko\u015fullar\u0131 gibi bir\u00e7ok hususun \u00f6nemli rol oynad\u0131\u011f\u0131n\u0131 belirttikten sonra an\u0131lan unsurlarla birlikte ki\u015fisel alan fakt\u00f6r\u00fcn\u00fcn temel bir unsur olarak dikkate al\u0131nmas\u0131 gerekti\u011fini vurgulam\u0131\u015ft\u0131r. Anayasa\u2019n\u0131n 17. maddesine uymak i\u00e7in bir mahpusa sa\u011flanmas\u0131 gereken alan\u0131n net olarak ka\u00e7 metrekare olmas\u0131 gerekti\u011finin kesin olarak belirlenemeyece\u011fini, alan\u0131n metrekare cinsinden b\u00fcy\u00fckl\u00fc\u011f\u00fc belirlenirken bir\u00e7ok hususun dikkate al\u0131naca\u011f\u0131n\u0131 ifade etmi\u015ftir (an\u0131lan kararda bkz. \u00a7\u00a7 58, 59).<\/p>\n<p>30. Zemin alan\u0131 hesaplan\u0131rken ilgili ko\u011fu\u015ftan ba\u011f\u0131ms\u0131z olmayan ve sadece o ko\u011fu\u015fun kullan\u0131m\u0131na a\u00e7\u0131k olan, g\u00fcn \u0131\u015f\u0131\u011f\u0131yla a\u00e7\u0131l\u0131p kapat\u0131lan ve bu s\u00fcrede bireysel veya grup olarak faaliyet yap\u0131labilen, faaliyet konusunda k\u0131s\u0131tlama olmayan havaland\u0131rma bah\u00e7esinin ya\u015fam alan\u0131na d\u00e2hil edilmesi gerekti\u011fi ancak havaland\u0131rma bah\u00e7esinin kullan\u0131m\u0131n\u0131n an\u0131landan farkl\u0131 oldu\u011fu veya k\u0131s\u0131tlamalara tabi oldu\u011fu durumlarda alan fakt\u00f6r\u00fcne d\u00e2hil edilmeme y\u00f6n\u00fcnde de\u011ferlendirme yap\u0131labilece\u011fi sonucuna var\u0131lm\u0131\u015ft\u0131r. Ayr\u0131ca ki\u015fisel alan hesab\u0131na mobilyalar\u0131n kaplad\u0131\u011f\u0131 alan d\u00e2hil edilirken banyo ve tuvalet gibi s\u0131hhi b\u00f6l\u00fcm\u00fcn bu hesaptan ayr\u0131 tutulmas\u0131 gerekti\u011fi ifade edilmi\u015ftir. \u0130kinci fakt\u00f6r her mahpusun ayr\u0131 bir uyku yeri olmas\u0131, \u00fc\u00e7\u00fcnc\u00fc ve son fakt\u00f6r ise ko\u011fu\u015fun genel y\u00fczeyinin mahpuslar\u0131n mobilyalar aras\u0131nda serbest\u00e7e hareket etmesine izin verecek \u015fekilde olmas\u0131d\u0131r (Cengiz Yetgin, \u00a7\u00a7 59, 60).<\/p>\n<p>31. Yukar\u0131da an\u0131lan \u00fc\u00e7 fakt\u00f6rden birinin yoklu\u011fu kendi ba\u015f\u0131na tutulma ko\u015fullar\u0131n\u0131n k\u00f6t\u00fc muamele yasa\u011f\u0131n\u0131 ihlal etti\u011fi y\u00f6n\u00fcnde g\u00fc\u00e7l\u00fc bir karine olu\u015fturacakt\u0131r. Ayr\u0131ca \u00e7ok ki\u015filik ko\u011fu\u015flarda bir ki\u015fi i\u00e7in olan asgari ya\u015fam alan\u0131n\u0131n 4 m\u00b2nin alt\u0131na d\u00fc\u015fmesi h\u00e2linde Anayasa\u2019n\u0131n 17. maddesinin ihlaline y\u00f6nelik olarak ortaya \u00e7\u0131kaca\u011f\u0131 de\u011ferlendirilen g\u00fc\u00e7l\u00fc karine \u00fc\u00e7 unsurun bir arada bulunmas\u0131 durumunda ortadan kald\u0131r\u0131labilecektir. \u0130lk olarak asgari ki\u015fisel alan\u0131n 4 m\u00b2nin alt\u0131na inmesi k\u0131sa s\u00fcreli, k\u00fc\u00e7\u00fck \u00e7apl\u0131 ve ara s\u0131ra olmal\u0131d\u0131r. \u0130kinci olarak bu t\u00fcr azalmalar ko\u011fu\u015f d\u0131\u015f\u0131 yeterli dola\u015f\u0131m \u00f6zg\u00fcrl\u00fc\u011f\u00fc ve yeterli ko\u011fu\u015f d\u0131\u015f\u0131 etkinliklerle desteklenmelidir. Son olarak ba\u015fvurucu, genel olarak uygun nitelikte bulunan ve tutulma ko\u015fullar\u0131n\u0131 a\u011f\u0131rla\u015ft\u0131r\u0131c\u0131 ba\u015fka bir unsur ta\u015f\u0131mayan bir ceza infaz kurumunda tutuluyor olmal\u0131d\u0131r (Cengiz Yetgin, \u00a7\u00a7 63-65).<\/p>\n<p>32. Mahpuslar\u0131n 4 m\u00b2 ile 5 m\u00b2 aras\u0131nda ki\u015fisel alana sahip oldu\u011fu h\u00e2llerde alan fakt\u00f6r\u00fc, tutulma ko\u015fullar\u0131n\u0131n yeterlili\u011finin de\u011ferlendirilmesinde \u00f6nemli bir kriter olmaya devam etmektedir ancak bu t\u00fcr durumlarda alan fakt\u00f6r\u00fc uygunsuz tutulma ko\u015fullar\u0131n\u0131n di\u011fer y\u00f6nleriyle birle\u015firse k\u00f6t\u00fc muamele yasa\u011f\u0131 ihlal edilmi\u015f olur. Tutulma ko\u015fullar\u0131n\u0131n di\u011fer y\u00f6nleri aras\u0131nda temel s\u0131hhi ve hijyen gereklerine uygunluk, tuvalet ve banyonun mahrem kullan\u0131lmas\u0131, a\u00e7\u0131k hava egzersizine, do\u011fal \u0131\u015f\u0131k veya havaya eri\u015fim, havaland\u0131rma ve \u0131s\u0131tma sistemlerinin yeterlili\u011fi yer al\u0131r. Belirtilen ko\u015fullar alt\u0131nda tutulman\u0131n s\u00fcresi de dikkate al\u0131nmal\u0131d\u0131r (baz\u0131 de\u011fi\u015fikliklerle birlikte bkz. Cengiz Yetgin, \u00a7 61).<\/p>\n<p>33. A\u0130HM daha \u00f6nce bahsi ge\u00e7en \u0130lerde ve di\u011ferleri\/T\u00fcrkiye karar\u0131nda, ko\u011fu\u015flara ba\u011fl\u0131 a\u00e7\u0131k hava bah\u00e7elerinin mahpuslar\u0131n a\u00e7\u0131k havaya ve do\u011fal \u0131\u015f\u0131\u011fa eri\u015febilecekleri ve hava \u015fartlar\u0131 uygunsa zaman ge\u00e7irebilecekleri alanlar oldu\u011fu a\u00e7\u0131k olsa da insanlar\u0131n bar\u0131nabilece\u011fi, ya\u015fayabilece\u011fi ve uyuyabilece\u011fi bir konaklama anlam\u0131nda ya\u015fam alan\u0131 olu\u015fturdu\u011funun d\u00fc\u015f\u00fcn\u00fclemeyece\u011fini ifade etmi\u015f, bu yakla\u015f\u0131m\u0131 Yasak\/T\u00fcrkiye karar\u0131nda da devam ettirmi\u015ftir (bkz. \u00a7 16). Bu geli\u015fmeler nedeniyle Anayasa Mahkemesi, i\u00e7tihad\u0131n\u0131 ki\u015fisel y\u00fczey alan\u0131 hesab\u0131na havaland\u0131rma bah\u00e7esinin d\u00e2hil edilmemesi ve \u00e7ok ki\u015filik odalarda her bir mahpus i\u00e7in en az 3 m\u00b2 zemin alan\u0131 sa\u011flanmas\u0131 y\u00f6n\u00fcnde g\u00fcncellenmesi gerekti\u011fi kanaatine ula\u015fm\u0131\u015ft\u0131r. Bu nedenle a\u015f\u0131r\u0131 kalabal\u0131kla\u015fma ve ki\u015fisel alan eksikli\u011fine ili\u015fkin \u015fik\u00e2yetlerde de\u011ferlendirme kriterlerinden en \u00f6nemlisi olan alan fakt\u00f6r\u00fcn\u00fcn \u00e7ok ki\u015filik ko\u011fu\u015flarda her bir mahpus i\u00e7in en az 3 m\u00b2 zemin alan\u0131 olarak belirlenmesi, zemin alan\u0131 hesaplan\u0131rken havaland\u0131rma bah\u00e7esinin ya\u015fam alan\u0131na d\u00e2hil edilmemesi ve ki\u015fisel alan hesab\u0131na mobilyalar\u0131n kaplad\u0131\u011f\u0131 alan\u0131n d\u00e2hil edilmesi fakat banyo ve tuvalet gibi s\u0131hhi tesis b\u00f6l\u00fcm\u00fcn\u00fcn bu hesaptan ayr\u0131 tutulmas\u0131 gerekti\u011fi kanaatine ula\u015f\u0131lm\u0131\u015ft\u0131r. Bununla birlikte her mahpusun ayr\u0131 bir uyku yeri olmas\u0131na ili\u015fkin ikinci fakt\u00f6r ile ko\u011fu\u015fun genel y\u00fczeyinin mahpuslar\u0131n mobilyalar aras\u0131nda serbest\u00e7e hareket etmesine izin verecek \u015fekilde olmas\u0131 gerekti\u011fine ili\u015fkin \u00fc\u00e7\u00fcnc\u00fc fakt\u00f6r y\u00f6n\u00fcnden var olan i\u00e7tihad\u0131n devam ettirilmesi gerekti\u011fi sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>34. Yukar\u0131da an\u0131lan \u00fc\u00e7 fakt\u00f6rden birinin yoklu\u011fu kendi ba\u015f\u0131na tutulma ko\u015fullar\u0131n\u0131n k\u00f6t\u00fc muamele yasa\u011f\u0131n\u0131 ihlal etti\u011fi y\u00f6n\u00fcnde g\u00fc\u00e7l\u00fc bir karine olu\u015fturacakt\u0131r. Ayr\u0131ca \u00e7ok ki\u015filik ko\u011fu\u015flarda bir ki\u015fi i\u00e7in olan asgari ya\u015fam alan\u0131n\u0131n 3 m\u00b2nin alt\u0131na d\u00fc\u015fmesi h\u00e2linde Anayasa\u2019n\u0131n 17. maddesinin ihlaline y\u00f6nelik ortaya \u00e7\u0131kaca\u011f\u0131 de\u011ferlendirilen g\u00fc\u00e7l\u00fc karine \u00fc\u00e7 unsurun bir arada bulunmas\u0131 durumunda ortadan kald\u0131r\u0131labilecektir. \u0130lk olarak asgari ki\u015fisel alan\u0131n 3 m\u00b2nin alt\u0131na inmesi k\u0131sa s\u00fcreli, k\u00fc\u00e7\u00fck \u00e7apl\u0131 ve ara s\u0131ra olmal\u0131d\u0131r. \u0130kinci olarak bu t\u00fcr azalmalar ko\u011fu\u015f d\u0131\u015f\u0131 yeterli dola\u015f\u0131m \u00f6zg\u00fcrl\u00fc\u011f\u00fc ve yeterli ko\u011fu\u015f d\u0131\u015f\u0131 etkinliklerle desteklenmelidir. Son olarak ba\u015fvurucu, genel olarak uygun nitelikte bulunan ve tutulma ko\u015fullar\u0131n\u0131 a\u011f\u0131rla\u015ft\u0131r\u0131c\u0131 ba\u015fka bir unsur ta\u015f\u0131mayan bir ceza infaz kurumunda tutuluyor olmal\u0131d\u0131r.<\/p>\n<p>35. Mahpuslar\u0131n 3 m\u00b2 ile 4 m\u00b2 aras\u0131nda ki\u015fisel alana sahip oldu\u011fu h\u00e2llerde alan fakt\u00f6r\u00fc, tutulma ko\u015fullar\u0131n\u0131n yeterlili\u011finin de\u011ferlendirilmesinde \u00f6nemlidir ve bu durumun uygunsuz tutulma ko\u015fullar\u0131n\u0131n di\u011fer y\u00f6nleriyle birle\u015fmesi h\u00e2linde k\u00f6t\u00fc muamele yasa\u011f\u0131 ihlal edilmi\u015f olur. Mahpuslar\u0131n daha fazla ki\u015fisel alana sahip olmalar\u0131 nedeniyle ki\u015fisel alan fakt\u00f6r\u00fcne ili\u015fkin olarak herhangi bir sorunun ortaya \u00e7\u0131kmad\u0131\u011f\u0131 durumlarda ise tutulma ko\u015fullar\u0131n\u0131n di\u011fer y\u00f6nleri de\u011ferlendirilmelidir. Tutulma ko\u015fullar\u0131n\u0131n di\u011fer y\u00f6nleri aras\u0131nda temel s\u0131hhi ve hijyen gereklerine uygunluk, tuvalet ve banyonun mahrem kullan\u0131lmas\u0131, a\u00e7\u0131k hava egzersizine, do\u011fal \u0131\u015f\u0131k ve havaya eri\u015fim, havaland\u0131rma ve \u0131s\u0131tma sistemlerinin yeterlili\u011fi yer al\u0131r. Belirtilen ko\u015fullar alt\u0131nda tutulman\u0131n s\u00fcresi de dikkate al\u0131nmal\u0131d\u0131r.<\/p>\n<p>ii. \u0130lkelerin Olaya Uygulanmas\u0131<\/p>\n<p>36. Ba\u015fvurucu, \u015fik\u00e2yet\u00e7i oldu\u011fu infaz kurumunda 5 y\u0131l 8 ay 10 g\u00fcn bar\u0131nd\u0131r\u0131lm\u0131\u015ft\u0131r. \u0130nfaz Kurumu ve Bakanl\u0131k taraf\u0131ndan bildirilen ba\u015fvurucuya sa\u011flanan ki\u015fisel alan bilgisinin 33. paragrafta belirlenen metodolojiye g\u00f6re revize edilmesi gerekmektedir. Bu durumda ba\u015fvurucuya tahsis edilen ki\u015fisel alan\u0131n 102 g\u00fcn 3 m\u00b2nin alt\u0131nda oldu\u011fu tespit edilmi\u015ftir. Ba\u015fvurucu, en az alt\u0131 ay devam eden s\u00fcre\u00e7te ise 3 m\u00b2 ile 4 m\u00b2 aras\u0131nda ki\u015fisel alanda bar\u0131nd\u0131r\u0131lm\u0131\u015ft\u0131r. Bu nedenle ba\u015fvurucunun tutulma ko\u015fullar\u0131 -sahip oldu\u011fu ki\u015fisel ya\u015fam alan\u0131 g\u00f6zetilerek- iki ba\u015fl\u0131k alt\u0131nda incelenecektir:<\/p>\n<p>(1) Ba\u015fvurucunun 3 m\u00b2den Daha Az Ki\u015fisel Ya\u015fam Alan\u0131na Sahip Oldu\u011fu D\u00f6nem Y\u00f6n\u00fcnden<\/p>\n<p>37. Ba\u015fvurucuya 8\/2\/2018-30\/5\/2018 tarihleri aras\u0131nda C-1 No.lu odada 112 g\u00fcn boyunca en az 2,52 m\u00b2 ile en \u00e7ok 3 m\u00b2lik bir ki\u015fisel alan sa\u011flanabilmi\u015ftir. \u0130nfaz Kurumu bu tarih aral\u0131\u011f\u0131 i\u00e7in verdi\u011fi bilgide odadaki mahpus say\u0131s\u0131n\u0131n yirmi d\u00f6rt ki\u015fiye y\u00fckseldi\u011fi g\u00fcn say\u0131s\u0131n\u0131 yirmi yedi g\u00fcn olarak belirttikten sonra yirmi \u00fc\u00e7 ki\u015finin yirmi iki g\u00fcn; yirmi iki ki\u015finin yirmi alt\u0131 g\u00fcn; yirmi bir ki\u015finin yirmi g\u00fcn birlikte kald\u0131\u011f\u0131n\u0131 bildirmi\u015ftir. Buna g\u00f6re ba\u015fvurucu 95 g\u00fcn boyunca 3 m\u00b2nin alt\u0131nda bir alana sahip olmu\u015ftur. Ba\u015fvurucu 30\/5\/2018-6\/6\/2018 tarihleri aras\u0131nda yedi g\u00fcn B-5 No.lu odada 3 g\u00fcn 2,16 m\u00b2lik, d\u00f6rt g\u00fcn 2,24 m\u00b2lik ya\u015fam alan\u0131na sahip olmu\u015ftur. Sonu\u00e7 olarak ba\u015fvurucuya sa\u011flanan y\u00fczey alan\u0131n\u0131n 8\/2\/2018-6\/6\/2018 tarihleri aras\u0131ndaki yakla\u015f\u0131k d\u00f6rt ayl\u0131k s\u00fcrenin on alt\u0131 g\u00fcn\u00fc d\u0131\u015f\u0131nda 3 m\u00b2nin alt\u0131na indi\u011fi g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Asgari ki\u015fisel ya\u015fam alan\u0131ndaki bu azalma kendi ba\u015f\u0131na tutulma ko\u015fullar\u0131n\u0131n k\u00f6t\u00fc muamele yasa\u011f\u0131n\u0131 ihlal etti\u011fi y\u00f6n\u00fcnde g\u00fc\u00e7l\u00fc bir karine olu\u015fturmaktad\u0131r.<\/p>\n<p>38. Anayasa\u2019n\u0131n 17. maddesinin ihlaline y\u00f6nelik ortaya \u00e7\u0131kan g\u00fc\u00e7l\u00fc karine \u00fc\u00e7 unsurun bir arada bulunmas\u0131 h\u00e2linde ortadan kald\u0131r\u0131labilecektir. \u0130lk olarak de\u011ferlendirilmesi gereken, asgari ki\u015fisel alan\u0131n 3 m\u00b2nin alt\u0131na inmesinin s\u00fcresi, s\u0131kl\u0131\u011f\u0131 ve \u00e7ap\u0131d\u0131r. Bu kapsamda \u00fc\u00e7 g\u00fcn 2,16 m\u00b2, d\u00f6rt g\u00fcn 2,24 m\u00b2, yirmi bir g\u00fcn 2,52 m\u00b2, yirmi iki g\u00fcn 2,63 m\u00b2, yirmi alt\u0131 g\u00fcn 2,75 m\u00b2, yirmi g\u00fcn 2,88 m\u00b2 olan ve d\u00f6rt ayl\u0131k s\u00fcrede ard\u0131\u015f\u0131k olarak 102 g\u00fcn bu \u015fekilde devam eden ki\u015fisel alan eksikli\u011finin k\u0131sa s\u00fcreli, k\u00fc\u00e7\u00fck \u00e7apl\u0131 ve ara s\u0131ra oldu\u011fu s\u00f6ylenemeyecektir. Bu nedenle meydana gelen alan azalmalar\u0131n\u0131n tutulma ko\u015fullar\u0131n\u0131n ayr\u0131 ayr\u0131 ve ba\u015fvurucu \u00fczerindeki toplu etkileri de hesaba kat\u0131larak Anayasa\u2019n\u0131n 17. maddesi anlam\u0131nda k\u00f6t\u00fc muamele olarak nitelendirilmesi i\u00e7in gerekli olan a\u011f\u0131rl\u0131k seviyesine ula\u015ft\u0131\u011f\u0131 sonucuna var\u0131lm\u0131\u015ft\u0131r. G\u00fc\u00e7l\u00fc karinenin ortadan kalkmas\u0131 i\u00e7in aranan ilk unsurun sa\u011flanmad\u0131\u011f\u0131 anla\u015f\u0131ld\u0131\u011f\u0131ndan asgari ki\u015fisel alandaki azalmalar\u0131n ko\u011fu\u015f d\u0131\u015f\u0131 yeterli dola\u015f\u0131m \u00f6zg\u00fcrl\u00fc\u011f\u00fc ve ko\u011fu\u015f d\u0131\u015f\u0131 etkinliklerle desteklenmesine, ba\u015fvurucunun genel olarak uygun nitelikte olan ve tutulma ko\u015fullar\u0131n\u0131 a\u011f\u0131rla\u015ft\u0131r\u0131c\u0131 ba\u015fka bir unsur ta\u015f\u0131mayan bir ceza infaz kurumunda tutuluyor olmas\u0131na ili\u015fkin di\u011fer iki unsurun de\u011ferlendirilmesine gerek g\u00f6r\u00fclmemi\u015ftir.<\/p>\n<p>39. A\u00e7\u0131klanan gerek\u00e7elerle Anayasa\u2019n\u0131n 17. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda g\u00fcvence alt\u0131na al\u0131nan k\u00f6t\u00fc muamele yasa\u011f\u0131n\u0131n ihlal edildi\u011fine karar verilmesi gerekir.<\/p>\n<p> (2) Ba\u015fvurucunun 3 m\u00b2 ile 4 m\u00b2 Aras\u0131nda Ki\u015fisel Ya\u015fam Alan\u0131na Sahip Oldu\u011fu D\u00f6nem Y\u00f6n\u00fcnden<\/p>\n<p>40. Ba\u015fvurucunun 5 y\u0131l 8 ay 10 g\u00fcn tutulmas\u0131n\u0131n en az alt\u0131 ay\u0131nda 3 m\u00b2 ile 4 m\u00b2 aras\u0131nda ki\u015fisel alanda bar\u0131nd\u0131r\u0131ld\u0131\u011f\u0131 tespit edilmi\u015ftir (bkz. \u00a7 13). Anayasa Mahkemesi mahpuslar\u0131n asgari ki\u015fisel alana sahip oldu\u011fu h\u00e2llerde k\u00f6t\u00fc muamele yasa\u011f\u0131 kapsam\u0131nda bir de\u011ferlendirme yaparken ki\u015fisel ya\u015fam alan\u0131 b\u00fcy\u00fckl\u00fc\u011f\u00fcn\u00fcn asgari standard\u0131 kar\u015f\u0131lamas\u0131n\u0131n her zaman tek ba\u015f\u0131na yeterli olmad\u0131\u011f\u0131n\u0131, tutulma ko\u015fullar\u0131n\u0131n di\u011fer y\u00f6nlerinin yeterlili\u011finin de incelenmesi gerekti\u011fini belirtmi\u015ftir. Bu durumda alan fakt\u00f6r\u00fc asgari standard\u0131 kar\u015f\u0131lasa da a\u00e7\u0131k hava egzersizine, do\u011fal \u0131\u015f\u0131\u011fa ve havaya eri\u015fim, havaland\u0131rman\u0131n mevcudiyeti, \u0131s\u0131tma d\u00fczenlemelerinin yeterlili\u011fi, tuvaleti \u00f6zel olarak kullanma, temel s\u0131hhi ve hijyen gerekliliklere uygunluk gibi di\u011fer unsurlar\u0131n eksikli\u011fiyle birle\u015fti\u011finde 17. maddenin ihlal edildi\u011fine karar verilebilecektir (bkz. \u00a7 35). Bu nedenle ba\u015fvurucunun alan fakt\u00f6r\u00fc d\u0131\u015f\u0131ndaki tutulma ko\u015fullar\u0131 incelenmelidir.<\/p>\n<p>41. Ba\u015fvurucu, odas\u0131 d\u0131\u015f\u0131nda d\u00fczenlenen faaliyetlere kat\u0131lamad\u0131\u011f\u0131n\u0131 iddia etmi\u015ftir. Burada de\u011ferlendirilecek durum mahpuslar\u0131n yeterli do\u011fal \u0131\u015f\u0131\u011fa eri\u015fimleri veya egzersiz yapma ya da di\u011fer ama\u00e7l\u0131 aktivitelere kat\u0131lma f\u0131rsatlar\u0131 olmadan odalar\u0131na hapsedildikleri durumlardan ay\u0131rt edilmelidir (benzer de\u011ferlendirme i\u00e7in bkz. Gaspari\/Ermenistan, B. No:44769\/08, 20\/9\/2018, \u00a7 64). Ba\u015fvurucu, g\u00fcn \u0131\u015f\u0131\u011f\u0131 ve temiz havadan yararlanabilece\u011fi ve temel bireysel egzersiz i\u00e7in kullanabilece\u011fi havaland\u0131rma bah\u00e7esine g\u00fcn \u0131\u015f\u0131\u011f\u0131nda s\u0131n\u0131rs\u0131z bir bi\u00e7imde eri\u015fme imk\u00e2n\u0131na sahiptir. Bu durum ki\u015fisel alan k\u0131s\u0131tl\u0131l\u0131\u011f\u0131n\u0131n yol a\u00e7t\u0131\u011f\u0131 olumsuz etkiyi \u00f6nemli \u00f6l\u00e7\u00fcde hafifletici bir fakt\u00f6r olarak dikkate al\u0131nmal\u0131d\u0131r.<\/p>\n<p>42. Ba\u015fvurucunun iddia etti\u011fi durumlar\u0131n, tutuldu\u011fu s\u00fcre\u00e7te zaman zaman ger\u00e7ekle\u015fti\u011fi kabul edilse bile ba\u015fvurucuya yatak ve yatak tak\u0131mlar\u0131 sa\u011fland\u0131\u011f\u0131, ba\u015fvurucunun yata\u011f\u0131n\u0131 payla\u015fmak veya s\u0131rayla uyumak zorunda olmad\u0131\u011f\u0131 ger\u00e7e\u011fi dikkate al\u0131nd\u0131\u011f\u0131nda bu durumun -tek ba\u015f\u0131na veya tutulman\u0131n di\u011fer maddi y\u00f6nleriyle birlikte- ba\u015fvurucuyu tutulman\u0131n do\u011fas\u0131nda bulunan ka\u00e7\u0131n\u0131lmaz ac\u0131 seviyesini a\u015fan yo\u011funlukta bir s\u0131k\u0131nt\u0131ya veya zorlu\u011fa maruz b\u0131rakmad\u0131\u011f\u0131 kanaatine ula\u015f\u0131lm\u0131\u015ft\u0131r. Ayr\u0131ca ba\u015fvurucunun sa\u011fl\u0131k raporuna ra\u011fmen kendisine yeni yatak verilmedi\u011fi iddias\u0131n\u0131 \u0130nfaz Kurumu ve \u0130nfaz H\u00e2kimli\u011fi \u00f6n\u00fcnde ileri s\u00fcrmedi\u011fi, iddia etti\u011fi raporu da bireysel ba\u015fvuru formuna eklemedi\u011fi g\u00f6r\u00fcld\u00fc\u011f\u00fcnden bu iddia y\u00f6n\u00fcnden bir de\u011ferlendirme yap\u0131lmam\u0131\u015ft\u0131r.<\/p>\n<p>44. Sonu\u00e7 olarak tutulma ko\u015fullar\u0131n\u0131n fiziksel ve ruhsal etkileri ayr\u0131 ayr\u0131 ve ba\u015fvurucu \u00fczerindeki toplu etkisi hesaba kat\u0131larak de\u011ferlendirildi\u011finde ba\u015fvurucunun 3 m\u00b2 ile 4 m\u00b2 aras\u0131nda ki\u015fisel ya\u015fam alan\u0131na sahip oldu\u011fu d\u00f6nemdeki tutulma ko\u015fullar\u0131n\u0131n Anayasa\u2019n\u0131n 17. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131 kapsam\u0131na girebilmesi i\u00e7in aranan asgari a\u011f\u0131rl\u0131k e\u015fi\u011fine ula\u015fmad\u0131\u011f\u0131 sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>45. A\u00e7\u0131klanan gerek\u00e7elerle Anayasa\u2019n\u0131n 17. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda g\u00fcvence alt\u0131na al\u0131nan k\u00f6t\u00fc muamele yasa\u011f\u0131n\u0131n ihlal edilmedi\u011fine karar verilmesi gerekir.<\/p>\n<p>VI. G\u0130DER\u0130M <\/p>\n<p>46. Ba\u015fvurucu, ihlalin tespitini ve lehine 1.000.000 TL maddi tazminat ile 3.000.000 TL manevi tazminata karar verilmesini talep etmi\u015ftir.<\/p>\n<p>47.
