BA\u015eVURUNUN KONUSU<\/p>\n<p>1. Ba\u015fvurucu, tutuklulu\u011funun kanunda \u00f6ng\u00f6r\u00fclen azami s\u0131n\u0131r\u0131 a\u015fmas\u0131 nedeniyle hukuka ayk\u0131r\u0131 h\u00e2le geldi\u011fini, ayr\u0131ca makul s\u00fcreyi de a\u015ft\u0131\u011f\u0131n\u0131, bu nedenle \u00f6zg\u00fcrl\u00fck ve g\u00fcvenlik hakk\u0131n\u0131n ihlal edildi\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr.<\/p>\n<p>II. BA\u015eVURU S\u00dcREC\u0130<\/p>\n<p>2. Ba\u015fvuru, 12\/10\/2012 tarihinde Bak\u0131rk\u00f6y 8. A\u011f\u0131r Ceza Mahkemesi vas\u0131tas\u0131yla yap\u0131lm\u0131\u015ft\u0131r. Dilek\u00e7e ve eklerinin idari y\u00f6nden yap\u0131lan \u00f6n incelemesinde eksiklikler giderilerek ba\u015fvurunun Komisyona sunulmas\u0131na engel bir durumun bulunmad\u0131\u011f\u0131 tespit edilmi\u015ftir <\/p>\n<p>3. Birinci B\u00f6l\u00fcm \u0130kinci Komisyonunca, 25\/12\/2012 tarihinde ba\u015fvurunun karara ba\u011flanmas\u0131 i\u00e7in B\u00f6l\u00fcm taraf\u0131ndan ilke karar\u0131 al\u0131nmas\u0131 gerekli g\u00f6r\u00fcld\u00fc\u011f\u00fcnden, Anayasa Mahkemesi \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc\u2019n\u00fcn 33. maddesinin (3) numaral\u0131 f\u0131kras\u0131 uyar\u0131nca, kabul edilebilirlik incelemesinin B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na, dosyan\u0131n B\u00f6l\u00fcme g\u00f6nderilmesine karar verilmi\u015ftir.<\/p>\n<p>4. B\u00f6l\u00fcm, 12\/2\/2013 tarihinde yap\u0131lan toplant\u0131da, \u0130\u00e7t\u00fcz\u00fck\u2019\u00fcn 28. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (b) bendi uyar\u0131nca, kabul edilebilirlik ve esas hakk\u0131ndaki incelemenin birlikte yap\u0131lmas\u0131na karar vermi\u015ftir.<\/p>\n<p>5. Ba\u015fvuru konusu olay ve olgular 12\/2\/2013 tarihinde Adalet Bakanl\u0131\u011f\u0131na bildirilmi\u015ftir. Adalet Bakanl\u0131\u011f\u0131, g\u00f6r\u00fc\u015f\u00fcn\u00fc 16\/4\/2013 tarihinde Anayasa Mahkemesine sunmu\u015ftur.<\/p>\n<p>6. Adalet Bakanl\u0131\u011f\u0131 taraf\u0131ndan Anayasa Mahkemesine sunulan g\u00f6r\u00fc\u015f ba\u015fvurucuya 8\/5\/2013 tarihinde bildirilmi\u015ftir. Ba\u015fvurucu, diyeceklerini s\u00fcresi i\u00e7inde Anayasa Mahkemesine sunmu\u015ftur. <\/p>\n<p>III. OLAY VE OLGULAR<\/p>\n<p>A. Olaylar<\/p>\n<p>7. Ba\u015fvuru dilek\u00e7esi ve Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcnde ifade edildi\u011fi \u015fekliyle ilgili olaylar \u00f6zetle \u015f\u00f6yledir:<\/p>\n<p>8. Ba\u015fvurucu 4\/2\/2007 tarihinde g\u00f6zalt\u0131na al\u0131nm\u0131\u015f ve 8\/2\/2007 tarihinde Sultanbeyli Sulh Ceza Mahkemesince tutuklanm\u0131\u015ft\u0131r.<\/p>\n<p>9. \u0130stanbul Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131, 25\/6\/2007 tarihli iddianameyle ba\u015fvurucu ve be\u015f ki\u015fi hakk\u0131nda dava a\u00e7m\u0131\u015ft\u0131r. \u0130ddianamede, ba\u015fvurucunun \u00e7\u0131kar amac\u0131 ile silahl\u0131 su\u00e7 \u00f6rg\u00fct\u00fc kurma ve y\u00f6netme, nitelikli ya\u011fma, h\u0131rs\u0131zl\u0131k ve mala zarar verme, konut dokunulmazl\u0131\u011f\u0131n\u0131 ihlal ve ruhsats\u0131z silah bulundurma su\u00e7lar\u0131ndan cezaland\u0131r\u0131lmas\u0131 talep edilmi\u015ftir.<\/p>\n<p>10. Ba\u015fvurucu, 27\/9\/2012 tarihinde tutukluluk h\u00e2linin be\u015f y\u0131l\u0131 a\u015ft\u0131\u011f\u0131n\u0131 ileri s\u00fcrerek tahliye talebinde bulunmu\u015ftur.<\/p>\n<p>11. Mahkeme, m\u00fc\u015fteki beyanlar\u0131 ve ceraim evrak\u0131 dikkate al\u0131nd\u0131\u011f\u0131nda kuvvetli su\u00e7 \u015f\u00fcphesini g\u00f6steren olgular\u0131n bulunmas\u0131, tutuklama tarihi, at\u0131l\u0131 su\u00e7un 5271 say\u0131l\u0131 Kanun\u2019un 100. maddesinin (3) numaral\u0131 f\u0131kras\u0131nda say\u0131lan katalog su\u00e7lardan olmas\u0131, tutuklama nedenlerinin devam etmesi gerek\u00e7eleriyle bu talebi reddetmi\u015ftir.<\/p>\n<p>12. Ba\u015fvurucu 2\/10\/2012 tarihli dilek\u00e7e ile bu karara itiraz etmi\u015ftir. Mahkeme, tutukluluk halinin devam\u0131na ili\u015fkin kararda usul ve yasaya ayk\u0131r\u0131 bir y\u00f6n bulunmad\u0131\u011f\u0131 gerek\u00e7esiyle itiraz\u0131n yerinde olmad\u0131\u011f\u0131na karar vererek dilek\u00e7e ve dava dosyas\u0131n\u0131n itiraz\u0131 incelemeye yetkili \u0130stanbul 11. A\u011f\u0131r Ceza Mahkemesine g\u00f6nderilmesine karar vermi\u015ftir.<\/p>\n<p>13. \u0130stanbul 11. A\u011f\u0131r Ceza Mahkemesi, at\u0131l\u0131 su\u00e7un vas\u0131f ve mahiyeti, ceraim evrak\u0131, delil durumu, m\u00fc\u015fteki beyanlar\u0131 birlikte de\u011ferlendirildi\u011finde at\u0131l\u0131 su\u00e7un i\u015flendi\u011fine dair kuvvetli su\u00e7 \u015f\u00fcphesinin olmas\u0131 ve tutuklama tarihlerini dikkate alarak itiraz\u0131n reddine karar vermi\u015ftir.<\/p>\n<p>14. Davaya bakan \u0130stanbul 10. A\u011f\u0131r Ceza Mahkemesi&#8217;nin 25\/12\/2012 tarih ve E.2007\/346, K.2012\/300 say\u0131l\u0131 karar\u0131yla, ba\u015fvurucunun 27 ayr\u0131 su\u00e7tan toplam 76 y\u0131l 8 ay 10 g\u00fcn hapis ve 16.000 T\u00fcrk Liras\u0131 adli para cezas\u0131 ile cezaland\u0131r\u0131lmas\u0131na ve tutukluluk h\u00e2linin devam\u0131na karar verilmi\u015ftir.<\/p>\n<p>B. \u0130lgili Hukuk<\/p>\n<p>15. 5271 say\u0131l\u0131 Kanun\u2019un 8. ve 9. maddeleri \u015f\u00f6yledir:<\/p>\n<p>\u201cBa\u011flant\u0131 kavram\u0131<\/p>\n<p>Madde 8 \u2013 (1) Bir ki\u015fi, birden fazla su\u00e7tan san\u0131k olur veya bir su\u00e7ta her ne s\u0131fatla olursa olsun birden fazla san\u0131k bulunursa ba\u011flant\u0131 var say\u0131l\u0131r.<\/p>\n<p>(2) Su\u00e7un i\u015flenmesinden sonra su\u00e7luyu kay\u0131rma, su\u00e7 delillerini yok etme, gizleme veya de\u011fi\u015ftirme fiilleri de ba\u011flant\u0131l\u0131 su\u00e7 say\u0131l\u0131r.<\/p>\n<p>Davalar\u0131n birle\u015ftirilerek a\u00e7\u0131lmas\u0131<\/p>\n<p>Madde 9 \u2013 (1) Ba\u011flant\u0131l\u0131 su\u00e7lardan her biri de\u011fi\u015fik mahkemelerin g\u00f6revine giriyorsa, bunlar hakk\u0131nda birle\u015ftirilmek suretiyle y\u00fcksek g\u00f6revli mahkemede dava a\u00e7\u0131labilir.\u201d<\/p>\n<p>16. Ayn\u0131 Kanun\u2019un 102. Maddesinin (2) numaral\u0131 f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>\u201cA\u011f\u0131r ceza mahkemesinin g\u00f6revine giren i\u015flerde, tutukluluk s\u00fcresi en \u00e7ok iki y\u0131ld\u0131r. Bu s\u00fcre, zorunlu hallerde, gerek\u00e7esi g\u00f6sterilerek uzat\u0131labilir; uzatma s\u00fcresi toplam \u00fc\u00e7 y\u0131l\u0131 ge\u00e7emez..\u201d<\/p>\n<p>17. Ayn\u0131 Kanun\u2019un 104. maddesinin (1) numaral\u0131 f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>\u201cSoru\u015fturma ve kovu\u015fturma evrelerinin her a\u015famas\u0131nda \u015f\u00fcpheli veya san\u0131k sal\u0131verilmesini isteyebilir.\u201d<\/p>\n<p>18. An\u0131lan Kanun\u2019un 141. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (a) ve (d) bentleri ile son c\u00fcmlesi \u015f\u00f6yledir:<\/p>\n<p>Tazminat istemi<\/p>\n<p>\u201cMadde 141 \u2013 (1) Su\u00e7 soru\u015fturmas\u0131 veya kovu\u015fturmas\u0131 s\u0131ras\u0131nda;<\/p>\n<p>a) Kanunlarda belirtilen ko\u015fullar d\u0131\u015f\u0131nda yakalanan, tutuklanan veya tutuklulu\u011funun devam\u0131na karar verilen,<\/p>\n<p>\u2026<\/p>\n<p>d) Kanuna uygun olarak tutukland\u0131\u011f\u0131 h\u00e2lde makul s\u00fcrede yarg\u0131lama mercii huzuruna \u00e7\u0131kar\u0131lmayan ve bu s\u00fcre i\u00e7inde hakk\u0131nda h\u00fck\u00fcm verilmeyen,<\/p>\n<p>\u2026<\/p>\n<p>Ki\u015filer, madd\u00ee ve manev\u00ee her t\u00fcrl\u00fc zararlar\u0131n\u0131, Devletten isteyebilirler.\u201d<\/p>\n<p>19. An\u0131lan Kanun\u2019un 142. maddesinin (1) numaral\u0131 f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>\u201cKarar veya h\u00fck\u00fcmlerin kesinle\u015fti\u011finin ilgilisine tebli\u011finden itibaren \u00fc\u00e7 ay ve her h\u00e2lde karar veya h\u00fck\u00fcmlerin kesinle\u015fme tarihini izleyen bir y\u0131l i\u00e7inde tazminat isteminde bulunulabilir.\u201d<\/p>\n<p>IV. \u0130NCELEME VE GEREK\u00c7E<\/p>\n<p>20. Mahkemenin 2\/7\/2013 tarihinde yapm\u0131\u015f oldu\u011fu toplant\u0131da, ba\u015fvurucunun 12\/10\/2012 tarih ve 2012\/239 numaral\u0131 bireysel ba\u015fvurusu incelenip gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. Ba\u015fvurucunun \u0130ddialar\u0131<\/p>\n<p>21. Ba\u015fvurucu, uzun s\u00fcreden beri tutuklu oldu\u011funu, 5271 say\u0131l\u0131 Kanun\u2019daki tutukluluk s\u00fcresinin a\u015f\u0131ld\u0131\u011f\u0131n\u0131, Kanun\u2019daki a\u00e7\u0131k d\u00fczenlemeye ra\u011fmen \u00fcst s\u0131n\u0131r\u0131n a\u015f\u0131lmas\u0131n\u0131n e\u015fitlik ilkesine ayk\u0131r\u0131 oldu\u011funu, bu nedenle anayasal haklar\u0131n\u0131n ihlal edildi\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr. <\/p>\n<p>B. De\u011ferlendirme<\/p>\n<p>22. Anayasa\u2019n\u0131n 148. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131 ile 30\/3\/2011 tarih ve 6216 say\u0131l\u0131 Anayasa Mahkemesinin Kurulu\u015fu ve Yarg\u0131lama Usulleri Hakk\u0131nda Kanun\u2019un 45. maddesinin (1) numaral\u0131 f\u0131kras\u0131nda, herkesin, Anayasada g\u00fcvence alt\u0131na al\u0131nm\u0131\u015f temel hak ve \u00f6zg\u00fcrl\u00fcklerinden, Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi ve buna ek T\u00fcrkiye\u2019nin taraf oldu\u011fu protokoller kapsam\u0131ndaki herhangi birinin kamu g\u00fcc\u00fc taraf\u0131ndan, ihlal edildi\u011fi iddias\u0131yla Anayasa Mahkemesine ba\u015fvurabilece\u011fi h\u00fckm\u00fcne yer verilmi\u015ftir. Anayasa&#8217;n\u0131n an\u0131lan maddesinin s\u00f6z konusu f\u0131kras\u0131n\u0131n devam\u0131nda, ba\u015fvuruda bulunabilmek i\u00e7in ola\u011fan kanun yollar\u0131n\u0131n t\u00fcketilmi\u015f olmas\u0131n\u0131n \u015fart oldu\u011fu; ayn\u0131 maddenin d\u00f6rd\u00fcnc\u00fc f\u0131kras\u0131nda da, bireysel ba\u015fvuruda kanun yolunda g\u00f6zetilmesi gereken hususlarda inceleme yap\u0131lamayaca\u011f\u0131 belirtilmi\u015ftir.<\/p>\n<p>23. Ba\u015fvurucunun \u015fik\u00e2yetinin Kanun\u2019da \u00f6ng\u00f6r\u00fclen \u00fcst s\u0131n\u0131r\u0131n a\u015f\u0131lmas\u0131 nedeniyle tutuklulu\u011fun hukuki olmad\u0131\u011f\u0131 ve makul s\u00fcrenin a\u015f\u0131ld\u0131\u011f\u0131na ili\u015fkin oldu\u011fu, bu nedenle incelemenin Anayasa\u2019n\u0131n 19. maddesi \u00e7er\u00e7evesinde yap\u0131lmas\u0131 gerekti\u011fi sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>1. Kabul Edilebilirlik Y\u00f6n\u00fcnden<\/p>\n<p>24. Adalet Bakanl\u0131\u011f\u0131, 5271 say\u0131l\u0131 Kanun\u2019un 141. maddesi uyar\u0131nca, kanuna ayk\u0131r\u0131 olarak tutuldu\u011funu iddia eden ki\u015filerin tazminat talep etme hakk\u0131na sahip olduklar\u0131n\u0131, Avrupa \u0130nsan Haklar\u0131 Mahkemesi (A\u0130HM)\u2019nin Demir\/T\u00fcrkiye ve Balca\/T\u00fcrkiye kararlar\u0131na atfen, bu yola \u00f6ncelikle ba\u015fvurulmas\u0131 gerekti\u011fini, Yarg\u0131tay kararlar\u0131na at\u0131fla baz\u0131 durumlarda tazminat talebinin incelenebilmesi i\u00e7in ilk derece mahkemesinde g\u00f6r\u00fclen davan\u0131n esas\u0131yla ilgili karar\u0131n kesinle\u015fmesinin \u015fart olmad\u0131\u011f\u0131n\u0131, dolay\u0131s\u0131yla kabul edilebilirlik konusundaki incelemede bu hususlar\u0131n g\u00f6z \u00f6n\u00fcnde bulundurulmas\u0131 gerekti\u011fini ifade etmi\u015ftir.<\/p>\n<p>25. Ba\u015fvurucu, ba\u015fvurunun kabul edilebilirli\u011fi hakk\u0131ndaki Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 bireysel ba\u015fvuru dilek\u00e7esinde ileri s\u00fcrd\u00fc\u011f\u00fc iddialar\u0131n\u0131 tekrarlam\u0131\u015f ve bunlar d\u0131\u015f\u0131nda yeni herhangi bir g\u00f6r\u00fc\u015f dile getirmemi\u015ftir. <\/p>\n<p>26. Anayasa\u2019n\u0131n 148. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>\u201cHerkes, Anayasada g\u00fcvence alt\u0131na al\u0131nm\u0131\u015f temel hak ve \u00f6zg\u00fcrl\u00fcklerinden, Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi kapsam\u0131ndaki herhangi birinin kamu g\u00fcc\u00fc taraf\u0131ndan, ihlal edildi\u011fi iddias\u0131yla Anayasa Mahkemesine ba\u015fvurabilir. Ba\u015fvuruda bulunabilmek i\u00e7in ola\u011fan kanun yollar\u0131n\u0131n t\u00fcketilmi\u015f olmas\u0131 \u015fartt\u0131r.\u201d<\/p>\n<p>27. 6216 say\u0131l\u0131 Kanun\u2019un 45. maddesinin (2) numaral\u0131 f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>\u201c\u0130hlale neden oldu\u011fu ileri s\u00fcr\u00fclen i\u015flem, eylem ya da ihmal i\u00e7in kanunda \u00f6ng\u00f6r\u00fclm\u00fc\u015f idari ve yarg\u0131sal ba\u015fvuru yollar\u0131n\u0131n tamam\u0131n\u0131n bireysel ba\u015fvuru yap\u0131lmadan \u00f6nce t\u00fcketilmi\u015f olmas\u0131 gerekir.\u201d<\/p>\n<p>28. An\u0131lan Anayasa ve Kanun h\u00fck\u00fcmleri uyar\u0131nca Anayasa Mahkemesine bireysel ba\u015fvuruda bulunabilmek i\u00e7in ihlale neden oldu\u011fu iddia edilen i\u015flem veya eylem i\u00e7in \u00f6ng\u00f6r\u00fclen idari ve yarg\u0131sal ba\u015fvuru yollar\u0131n\u0131n tamam\u0131n\u0131n t\u00fcketilmi\u015f olmas\u0131 gerekir. Bireysel ba\u015fvurunun ikincil nitelikte bir hak arama yolu olmas\u0131 nedeniyle, as\u0131l olan hak ve \u00f6zg\u00fcrl\u00fcklere kamu otoritelerince sayg\u0131 g\u00f6sterilmesi ve olas\u0131 bir ihlal durumunda bunun idari ve\/veya yarg\u0131sal ola\u011fan yollarla giderilmesidir. Bu nedenle bireysel ba\u015fvuru yoluna ancak kanunda \u00f6ng\u00f6r\u00fclen ola\u011fan yollar t\u00fcketilmesine ra\u011fmen ihlalin ortadan kald\u0131r\u0131lamad\u0131\u011f\u0131 durumlarda gidilebilir. <\/p>\n<p>29. Ancak t\u00fcketilmesi gereken ba\u015fvuru yollar\u0131n\u0131n ula\u015f\u0131labilir olmalar\u0131 yan\u0131nda, telafi kabiliyetini haiz ve t\u00fcketildiklerinde ba\u015fvurucunun \u015fik\u00e2yetlerini gidermede makul ba\u015far\u0131 \u015fans\u0131 tan\u0131malar\u0131 gerekir. Dolay\u0131s\u0131yla mevzuatta bu yollara yer verilmesi tek ba\u015f\u0131na yeterli olmay\u0131p uygulamada da etkili olduklar\u0131n\u0131n g\u00f6sterilmesi ya da en az\u0131ndan etkili olmad\u0131klar\u0131n\u0131n kan\u0131tlanmam\u0131\u015f olmas\u0131 gerekir.<\/p>\n<p>30. Adalet Bakanl\u0131\u011f\u0131n\u0131n g\u00f6r\u00fc\u015f\u00fcnde i\u015faret edildi\u011fi \u00fczere 5271 say\u0131l\u0131 Kanun\u2019un tazminat isteminin d\u00fczenlendi\u011fi 141. maddesinin (1) numaral\u0131 f\u0131kras\u0131na g\u00f6re, kanunlarda belirtilen ko\u015fullar d\u0131\u015f\u0131nda yakalanan, tutuklanan veya tutuklulu\u011funun devam\u0131na karar verilenler ile kanuna uygun olarak tutukland\u0131\u011f\u0131 h\u00e2lde makul s\u00fcrede yarg\u0131lama mercii huzuruna \u00e7\u0131kar\u0131lmayan ve bu s\u00fcre i\u00e7inde hakk\u0131nda h\u00fck\u00fcm verilmeyen ki\u015filerin, madd\u00ee ve manev\u00ee her t\u00fcrl\u00fc zararlar\u0131n\u0131 Devletten isteyebileceklerine ili\u015fkin h\u00fck\u00fcmlerin bu hususta bir ba\u015fvuru mekanizmas\u0131 \u00f6ng\u00f6rd\u00fc\u011f\u00fc g\u00f6r\u00fclmektedir. Ancak, ayn\u0131 Kanun\u2019un tazminat isteminin ko\u015fullar\u0131n\u0131n d\u00fczenlendi\u011fi 142. maddesinin (1) numaral\u0131 f\u0131kras\u0131nda \u201cKarar veya h\u00fck\u00fcmlerin kesinle\u015fti\u011finin ilgilisine tebli\u011finden itibaren \u00fc\u00e7 ay ve her h\u00e2lde karar veya h\u00fck\u00fcmlerin kesinle\u015fme tarihini izleyen bir y\u0131l i\u00e7inde\u201d tazminat isteminde bulunulabilece\u011fi ifade edilmi\u015ftir. <\/p>\n<p>31. Somut olayda be\u015f y\u0131ll\u0131k azami tutukluluk s\u00fcresinin dolmas\u0131 nedeniyle tutuklulu\u011fun yasal dayana\u011f\u0131n\u0131n kalmad\u0131\u011f\u0131 ve tutuklulu\u011fun makul s\u00fcreyi a\u015ft\u0131\u011f\u0131 iddia edilmektedir. Buna g\u00f6re, yasal olarak m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 h\u00e2lde tutuklulu\u011fun devam\u0131na karar verilmi\u015f ise madde kapsam\u0131nda bunun ma\u011fduru maddi ve\/veya manevi tazminat istemiyle dava a\u00e7abilecektir. Ayn\u0131 \u015fekilde makul s\u00fcreyi a\u015fan tutukluluk da tazminat istemi nedenlerinden biridir.<\/p>\n<p>32. Ancak ba\u015fvurucunun ba\u015fvuru tarihi itibariyle istemi tazminat de\u011fildir. Ba\u015fvurucu, Kanun\u2019da \u00f6ng\u00f6r\u00fclen azami tutukluluk s\u00fcresinin dolmu\u015f oldu\u011funun tespitiyle tahliyesine karar verilmesini talep etmektedir. Bundan ba\u015fka uzun s\u00fcren tutukluluk h\u00e2linden de \u015fik\u00e2yet\u00e7idir.<\/p>\n<p>33. 5271 say\u0131l\u0131 Kanun\u2019un koruma tedbirleri nedeniyle tazminata dair d\u00fczenlemelerine bu a\u00e7\u0131dan bak\u0131ld\u0131\u011f\u0131nda, ba\u015fvurucunun \u015fik\u00e2yetiyle ilgili bir \u00e7\u00f6z\u00fcm getirilmedi\u011fi g\u00f6r\u00fclmektedir. Ba\u015fvurulmas\u0131 h\u00e2linde bu yol yaln\u0131zca maddi ve manevi zararlar\u0131n giderilmesini teminat alt\u0131na almakta, fakat hukuka ayk\u0131r\u0131 tutuldu\u011fu tespit edilse dahi ki\u015fiye serbest b\u0131rak\u0131lma konusunda bir imk\u00e2n sunmamaktad\u0131r. Bireysel ba\u015fvurunun esastan incelenmesinden \u00f6nce tutukluluk h\u00e2li sona ermedi\u011fi s\u00fcrece, ki\u015finin bu yola gitmesi somut talebi a\u00e7\u0131s\u0131ndan etkili say\u0131lamaz, dolay\u0131s\u0131yla t\u00fcketilmesi gerekmez.<\/p>\n<p>34. Bununla birlikte ba\u015fvurucu hakk\u0131ndaki davan\u0131n karara ba\u011flanm\u0131\u015f olmas\u0131 nedeniyle tutukluluk halinin h\u00fckmen tutuklulu\u011fa d\u00f6n\u00fc\u015ft\u00fc\u011f\u00fc, dolay\u0131s\u0131yla her ne kadar ba\u015fvuru an\u0131ndaki talebi tahliye ise de, kararla birlikte bunun m\u00fcmk\u00fcn olamamas\u0131 dikkate al\u0131nd\u0131\u011f\u0131nda \u015fik\u00e2yet konusu anayasal haklar\u0131n ihlaline dair bir tespit ve tazminata h\u00fckmedilmesi h\u00e2linde ihlalin giderilmesi m\u00fcmk\u00fcnd\u00fcr. Bu durumda 5271 say\u0131l\u0131 Kanun\u2019un 141. vd. maddelerinde belirtilen yola \u00f6ncelikle ba\u015fvurulmas\u0131n\u0131n zorunlu olup olmad\u0131\u011f\u0131n\u0131n de\u011ferlendirilmesi gerekir.<\/p>\n<p>35. Bakanl\u0131k, bu yola \u00f6ncelikle gidilmesi gerekti\u011fini bir k\u0131s\u0131m kararlara at\u0131fla ileri s\u00fcrm\u00fc\u015ft\u00fcr. Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcnde bahsetti\u011fi Yarg\u0131tay kararlar\u0131 belli durumlarda tazminat talebi i\u00e7in as\u0131l h\u00fckm\u00fcn kesinle\u015fmesinin aranmad\u0131\u011f\u0131n\u0131 g\u00f6stermektedir (Yarg\u0131tay 12. Ceza Dairesi\u2019nin 4\/4\/2012 tarih ve E. 2011\/15700, K. 2012\/9187; 15\/5\/2012 tarih ve E. 2011\/20114, K.2012\/12183 say\u0131l\u0131 kararlar\u0131). Tutukluluk s\u00fcresinin verilen cezadan fazla olmas\u0131 nedeniyle makul g\u00f6r\u00fclmedi\u011fi, bu nedenle tazminata h\u00fckmedilmesi gerekti\u011fini belirten kararlara rastlamak da m\u00fcmk\u00fcnd\u00fcr (Yarg\u0131tay 12. Ceza Dairesinin 17\/12\/2012 tarih ve E. 2012\/20277, K.2012\/27572; 3\/1\/2013 tarih ve E.2012\/24083, K. 2013\/1 say\u0131l\u0131 kararlar\u0131). Ancak bu \u00f6rneklerin hi\u00e7biri somut olay a\u00e7\u0131s\u0131ndan bahse konu yolun etkili oldu\u011funa \u00f6rnek te\u015fkil etmemektedir. <\/p>\n<p>36. A\u00e7\u0131klanan nedenlerle Bakanl\u0131\u011f\u0131n ba\u015fvuru yollar\u0131n\u0131n t\u00fcketilmedi\u011fi y\u00f6n\u00fcndeki g\u00f6r\u00fc\u015f\u00fc kabul edilemez. Ba\u015fvurucunun iddialar\u0131n dayanaktan yoksun olmad\u0131\u011f\u0131, ayr\u0131ca ba\u015fka bir kabul edilemezlik nedeni de bulunmad\u0131\u011f\u0131 i\u00e7in ba\u015fvurunun kabul edilebilir oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>2. Esas \u0130nceleme<\/p>\n<p>37. Ba\u015fvurucu, tutukluluk s\u00fcresinin Kanunda \u00f6ng\u00f6r\u00fclen azami s\u00fcreyi a\u015fmas\u0131 nedeniyle tutulmas\u0131n\u0131n hukuki dayana\u011f\u0131n\u0131n olmad\u0131\u011f\u0131ndan ve a\u015f\u0131r\u0131 uzun bir s\u00fcredir tutuklu oldu\u011fundan \u015fik\u00e2yet etmektedir. <\/p>\n<p>38. Anayasa\u2019n\u0131n 19. maddesi \u015f\u00f6yledir:<\/p>\n<p>\u201cHerkes, ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fine sahiptir. <\/p>\n<p>\u015eekil ve \u015fartlar\u0131 kanunda g\u00f6sterilen:<\/p>\n<p>Mahkemelerce verilmi\u015f h\u00fcrriyeti k\u0131s\u0131tlay\u0131c\u0131 cezalar\u0131n ve g\u00fcvenlik tedbirlerinin yerine getirilmesi; bir mahkeme karar\u0131n\u0131n veya kanunda \u00f6ng\u00f6r\u00fclen bir y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn gere\u011fi olarak ilgilinin yakalanmas\u0131 veya tutuklanmas\u0131; bir k\u00fc\u00e7\u00fc\u011f\u00fcn g\u00f6zetim alt\u0131nda \u0131slah\u0131 veya yetkili merci \u00f6n\u00fcne \u00e7\u0131kar\u0131lmas\u0131 i\u00e7in verilen bir karar\u0131n yerine getirilmesi; toplum i\u00e7in tehlike te\u015fkil eden bir ak\u0131l hastas\u0131, uyu\u015fturucu madde veya alkol tutkunu, bir serseri veya hastal\u0131k yayabilecek bir ki\u015finin bir m\u00fcessesede tedavi, e\u011fitim veya \u0131slah\u0131 i\u00e7in kanunda belirtilen esaslara uygun olarak al\u0131nan tedbirin yerine getirilmesi; usul\u00fcne ayk\u0131r\u0131 \u015fekilde \u00fclkeye girmek isteyen veya giren, ya da hakk\u0131nda s\u0131n\u0131r d\u0131\u015f\u0131 etme yahut geri verme karar\u0131 verilen bir ki\u015finin yakalanmas\u0131 veya tutuklanmas\u0131; halleri d\u0131\u015f\u0131nda kimse h\u00fcrriyetinden yoksun b\u0131rak\u0131lamaz.<\/p>\n<p>Su\u00e7lulu\u011fu hakk\u0131nda kuvvetli belirti bulunan ki\u015filer, ancak ka\u00e7malar\u0131n\u0131, delillerin yokedilmesini veya de\u011fi\u015ftirilmesini \u00f6nlemek maksad\u0131yla veya bunlar gibi tutuklamay\u0131 zorunlu k\u0131lan ve kanunda g\u00f6sterilen di\u011fer hallerde hakim karar\u0131yla tutuklanabilir. Hakim karar\u0131 olmadan yakalama, ancak su\u00e7\u00fcst\u00fc halinde veya gecikmesinde sak\u0131nca bulunan hallerde yap\u0131labilir; bunun \u015fartlar\u0131n\u0131 kanun g\u00f6sterir.<\/p>\n<p>Yakalanan veya tutuklanan ki\u015filere, yakalama veya tutuklama sebepleri ve haklar\u0131ndaki iddialar herhalde yaz\u0131l\u0131 ve bunun hemen m\u00fcmk\u00fcn olmamas\u0131 halinde s\u00f6zl\u00fc olarak derhal, toplu su\u00e7larda en ge\u00e7 hakim huzuruna \u00e7\u0131kar\u0131l\u0131ncaya kadar bildirilir.<\/p>\n<p>Yakalanan veya tutuklanan ki\u015fi, tutulma yerine en yak\u0131n mahkemeye g\u00f6nderilmesi i\u00e7in gerekli s\u00fcre hari\u00e7 en ge\u00e7 k\u0131rksekiz saat ve toplu olarak i\u015flenen su\u00e7larda en \u00e7ok d\u00f6rt g\u00fcn i\u00e7inde hakim \u00f6n\u00fcne \u00e7\u0131kar\u0131l\u0131r. Kimse, bu s\u00fcreler ge\u00e7tikten sonra hakim karar\u0131 olmaks\u0131z\u0131n h\u00fcrriyetinden yoksun b\u0131rak\u0131lamaz. Bu s\u00fcreler ola\u011fan\u00fcst\u00fc hal, s\u0131k\u0131y\u00f6netim ve sava\u015f hallerinde uzat\u0131labilir.<\/p>\n<p>Ki\u015finin yakaland\u0131\u011f\u0131 veya tutukland\u0131\u011f\u0131, yak\u0131nlar\u0131na derhal bildirilir.<\/p>\n<p>Tutuklanan ki\u015filerin, makul s\u00fcre i\u00e7inde yarg\u0131lanmay\u0131 ve soru\u015fturma veya kovu\u015fturma s\u0131ras\u0131nda serbest b\u0131rak\u0131lmay\u0131 isteme haklar\u0131 vard\u0131r. Serbest b\u0131rak\u0131lma ilgilinin yarg\u0131lama s\u00fcresince duru\u015fmada haz\u0131r bulunmas\u0131n\u0131 veya h\u00fckm\u00fcn yerine getirilmesini sa\u011flamak i\u00e7in bir g\u00fcvenceye ba\u011flanabilir.<\/p>\n<p>Her ne sebeple olursa olsun, h\u00fcrriyeti k\u0131s\u0131tlanan ki\u015fi, k\u0131sa s\u00fcrede durumu hakk\u0131nda karar verilmesini ve bu k\u0131s\u0131tlaman\u0131n kanuna ayk\u0131r\u0131l\u0131\u011f\u0131 halinde hemen serbest b\u0131rak\u0131lmas\u0131n\u0131 sa\u011flamak amac\u0131yla yetkili bir yarg\u0131 merciine ba\u015fvurma hakk\u0131na sahiptir.<\/p>\n<p>Bu esaslar d\u0131\u015f\u0131nda bir i\u015fleme tabi tutulan ki\u015filerin u\u011frad\u0131klar\u0131 zarar, tazminat hukukunun genel prensiplerine g\u00f6re, Devlet\u00e7e \u00f6denir.\u201d<\/p>\n<p>39. Ba\u015fvurucunun kanuni tutukluluk s\u00fcresinin a\u015f\u0131ld\u0131\u011f\u0131na ili\u015fkin \u015fik\u00e2yetinin Anayasa\u2019n\u0131n 19. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131, tutukluluk s\u00fcresinin makull\u00fc\u011f\u00fc ile ilgili \u015fik\u00e2yetinin ise yedinci f\u0131kras\u0131 a\u00e7\u0131s\u0131ndan de\u011ferlendirilmesi gerekir.<\/p>\n<p>a. Anayasa\u2019n\u0131n 19. Maddesinin \u00dc\u00e7\u00fcnc\u00fc F\u0131kras\u0131n\u0131n \u0130hlal Edildi\u011fi \u0130ddias\u0131<\/p>\n<p>40. Ba\u015fvurucu, \u00f6ncelikle, Kanun\u2019daki azami tutukluluk s\u00fcresinin a\u015f\u0131lmas\u0131 nedeniyle tutulmas\u0131n\u0131n hukuka ayk\u0131r\u0131 oldu\u011funu iddia etmi\u015ftir.<\/p>\n<p>41. Adalet Bakanl\u0131\u011f\u0131, g\u00f6r\u00fc\u015f\u00fcnde, keyfili\u011fe ka\u00e7mamak \u015fart\u0131yla mahkemelerin kanunlar\u0131 yorumlamada tam takdir yetkisine sahip olduklar\u0131n\u0131, \u0130stanbul 10. A\u011f\u0131r Ceza Mahkemesinin somut olayda be\u015f y\u0131ll\u0131k \u00fcst s\u0131n\u0131r\u0131 her bir su\u00e7 i\u00e7in ayr\u0131 ayr\u0131 dikkate ald\u0131\u011f\u0131n\u0131, bununla birlikte A\u0130HM\u2019in birden fazla su\u00e7 isnad\u0131na dayal\u0131 tutuklulu\u011fu tek bir tutukluluk olarak de\u011ferlendirebilece\u011fini ifade etmi\u015ftir.<\/p>\n<p>42. Ba\u015fvurucu, ba\u015fvurunun esas\u0131 hakk\u0131ndaki Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcne kat\u0131lmad\u0131\u011f\u0131n\u0131 belirterek bireysel ba\u015fvuru dilek\u00e7esinde ileri s\u00fcrd\u00fc\u011f\u00fc iddialar\u0131n\u0131 tekrarlam\u0131\u015ft\u0131r. <\/p>\n<p>43. Anayasa\u2019n\u0131n 19. maddesinin birinci f\u0131kras\u0131nda herkesin ki\u015fi \u00f6zg\u00fcrl\u00fc\u011f\u00fc ve g\u00fcvenli\u011fi hakk\u0131na sahip oldu\u011fu ilke olarak konduktan sonra, ikinci ve \u00fc\u00e7\u00fcnc\u00fc f\u0131kralar\u0131nda \u015fekil ve \u015fartlar\u0131 kanunda g\u00f6sterilmek \u015fart\u0131yla ki\u015filerin \u00f6zg\u00fcrl\u00fc\u011f\u00fcnden mahrum b\u0131rak\u0131labilece\u011fi durumlar s\u0131n\u0131rl\u0131 olarak say\u0131lm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla ki\u015finin \u00f6zg\u00fcrl\u00fck ve g\u00fcvenlik hakk\u0131n\u0131n k\u0131s\u0131tlanmas\u0131 ancak Anayasa\u2019n\u0131n an\u0131lan maddesi kapsam\u0131nda belirlenen durumlardan herhangi birinin varl\u0131\u011f\u0131 halinde s\u00f6z konusu olabilir. <\/p>\n<p>44. Anayasa\u2019n\u0131n \u201cTemel hak ve h\u00fcrriyetlerin s\u0131n\u0131rlanmas\u0131\u201d ba\u015fl\u0131kl\u0131 13. maddesinde temel hak ve h\u00fcrriyetlerin, \u00f6zlerine dokunulmaks\u0131z\u0131n yaln\u0131zca Anayasa\u2019n\u0131n ilgili maddelerinde belirtilen sebeplere ba\u011fl\u0131 olarak ve ancak kanunla s\u0131n\u0131rlanabilece\u011fi, bu s\u0131n\u0131rlamalar\u0131n, Anayasa\u2019n\u0131n s\u00f6z\u00fcne ve ruhuna, demokratik toplum d\u00fczeninin ve laik Cumhuriyetin gereklerine ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olamayaca\u011f\u0131 h\u00fckme ba\u011flanm\u0131\u015ft\u0131r. Anayasa\u2019n\u0131n 19. maddesindeki ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fi hakk\u0131n\u0131n s\u0131n\u0131rlanabilece\u011fi durumlar\u0131n \u015fekil ve \u015fartlar\u0131n\u0131n kanunda g\u00f6sterilmesi \u00f6l\u00e7\u00fct\u00fc, Anayasa\u2019n\u0131n 13. maddesindeki temel hak ve h\u00fcrriyetlerin ancak kanunla s\u0131n\u0131rlanabilece\u011fine dair kural ile uyumludur. <\/p>\n<p>45. Ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fine ili\u015fkin s\u0131n\u0131rlamalar\u0131n, kanunda belirtilen esas ve usule uygunlu\u011funu sa\u011flama y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc ilke olarak idari organlara ve derece mahkemelerine aittir. \u0130dare organlar\u0131 ve mahkemeler esas ve usule ili\u015fkin hukuk kurallar\u0131na uymakla y\u00fck\u00fcml\u00fcd\u00fcrler. Anayasa\u2019n\u0131n 19. maddesinin amac\u0131 bireyi keyfi bir \u015fekilde \u00f6zg\u00fcrl\u00fc\u011f\u00fcnden al\u0131koymaya kar\u015f\u0131 korumak olup, maddede \u00f6ng\u00f6r\u00fclen istisnai h\u00e2llerde ki\u015fi \u00f6zg\u00fcrl\u00fc\u011f\u00fcne getirilecek s\u0131n\u0131rlamalar\u0131n maddenin amac\u0131na uygun olmas\u0131 ve keyfi uygulamaya yol a\u00e7mamas\u0131 gerekir. Bu nedenle Anayasa\u2019n\u0131n 19. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda yer alan h\u00fcrriyetten yoksun b\u0131rakman\u0131n \u015fekil ve \u015fartlar\u0131n\u0131n kanunda g\u00f6sterilmesi kural\u0131 gere\u011fince, ba\u015fvurucunun tutukluluk durumunun \u201ckanuni\u201d dayana\u011f\u0131n\u0131n bulunup bulunmad\u0131\u011f\u0131n\u0131n, kanunun \u00f6zg\u00fcrl\u00fckten yoksun k\u0131lmaya izin verdi\u011fi h\u00e2llerde ise, kanunun hukuk devleti ilkesi gere\u011fi, keyfili\u011fi \u00f6nlemek i\u00e7in, uygulanmas\u0131nda yeterli \u00f6l\u00e7\u00fcde eri\u015filebilir, kesin ve \u00f6ng\u00f6r\u00fclebilir olup olmad\u0131\u011f\u0131n\u0131n Anayasa Mahkemesince incelenmesi gerekir.<\/p>\n<p>46. Tutukluluk, 5271 say\u0131l\u0131 Kanun\u2019un 100. ve devam\u0131 maddelerinde d\u00fczenlenmi\u015ftir. 100. maddeye g\u00f6re ki\u015fi ancak hakk\u0131nda su\u00e7 i\u015fledi\u011fine dair kuvvetli \u015f\u00fcphelerin varl\u0131\u011f\u0131n\u0131 g\u00f6steren olgular\u0131n ve bir tutuklama nedeninin bulunmas\u0131 halinde tutuklanabilir. Maddede tutuklama nedenlerinin neler oldu\u011fu da belirtilmi\u015ftir. Buna g\u00f6re, (a) \u015f\u00fcpheli veya san\u0131\u011f\u0131n ka\u00e7mas\u0131, saklanmas\u0131 veya ka\u00e7aca\u011f\u0131 \u015f\u00fcphesini uyand\u0131ran somut olgular varsa, (b) \u015f\u00fcpheli veya san\u0131\u011f\u0131n davran\u0131\u015flar\u0131; 1) delilleri yok etme, gizleme veya de\u011fi\u015ftirme, 2) tan\u0131k, ma\u011fdur veya ba\u015fkalar\u0131 \u00fczerinde bask\u0131 yap\u0131lmas\u0131 giri\u015fiminde bulunma hususlar\u0131nda kuvvetli \u015f\u00fcphe olu\u015fturuyorsa tutukluluk karar\u0131 verilebilecektir. Kuralda ayr\u0131ca i\u015flendi\u011fi konusunda kuvvetli \u015f\u00fcphe bulunmas\u0131 halinde tutuklama nedeninin varsay\u0131labilece\u011fi su\u00e7lar bir liste halinde belirtilmi\u015ftir. <\/p>\n<p>47. 5271 say\u0131l\u0131 Kanun\u2019un 102. maddesinin (2) numaral\u0131 f\u0131kras\u0131nda, a\u011f\u0131r ceza mahkemesinin g\u00f6revine giren i\u015flerde tutukluluk s\u00fcresinin en \u00e7ok iki y\u0131l oldu\u011fu ve bu s\u00fcrenin zorunlu hallerde gerek\u00e7esi g\u00f6sterilerek uzat\u0131labilece\u011fi, ancak uzatma s\u00fcresinin toplam \u00fc\u00e7 y\u0131l\u0131 ge\u00e7emeyece\u011fi belirtilmi\u015ftir. Buna g\u00f6re uzatma s\u00fcreleri d\u00e2hil toplam tutukluluk s\u00fcresinin azami be\u015f y\u0131l olabilece\u011fi anla\u015f\u0131lmaktad\u0131r (bkz: Yarg\u0131tay Ceza Genel Kurulunun 12\/4\/2011 tarih ve E.2011\/1-51, K.2011\/42 say\u0131l\u0131 karar\u0131). <\/p>\n<p>48. Somut olayda ba\u015fvurucu 4\/2\/2007 tarihinde \u0130stanbul\u2019da g\u00f6zalt\u0131na al\u0131nm\u0131\u015f ve 8\/2\/2007 tarihinde tutuklanm\u0131\u015ft\u0131r. Ba\u015fvurucu, 5271 say\u0131l\u0131 Kanun\u2019un yukar\u0131da belirtilen h\u00fck\u00fcmleri uyar\u0131nca tutukluluk i\u00e7in \u00f6ng\u00f6r\u00fclen azami s\u00fcrenin doldu\u011fu iddias\u0131yla tahliye talebinde bulunmu\u015ftur. Davaya bakan mahkeme ile itiraz mercii, azami be\u015f y\u0131ll\u0131k s\u00fcre konusunda herhangi bir de\u011ferlendirme yapmadan di\u011fer gerek\u00e7elerle talebi reddetmi\u015f ve tutuklulu\u011fun devam\u0131na karar vermi\u015flerdir (\u00a7\u00a711-13).<\/p>\n<p>49. Anayasa\u2019da yer alan hak ve \u00f6zg\u00fcrl\u00fckler ihlal edilmedi\u011fi s\u00fcrece derece mahkemelerinin kararlar\u0131ndaki kanunun yorumuna ya da maddi veya hukuki hatalara dair hususlar bireysel ba\u015fvuru incelemesinde ele al\u0131namaz. Tutukluluk konusundaki kanun h\u00fck\u00fcmlerinin yorumu ve somut olaylara uygulanmas\u0131 da derece mahkemelerinin takdir yetkisi kapsam\u0131ndad\u0131r. Ancak kanun veya Anayasa\u2019ya bariz \u015fekilde ayk\u0131r\u0131 yorumlar ile delillerin takdirinde a\u00e7\u0131k\u00e7a keyfilik halinde hak ve \u00f6zg\u00fcrl\u00fck ihlaline sebebiyet veren bu t\u00fcr kararlar\u0131n bireysel ba\u015fvuruda incelenmesi gerekir. Aksinin kabul\u00fc bireysel ba\u015fvurunun getirili\u015f amac\u0131yla ba\u011fda\u015fmaz. Dolay\u0131s\u0131yla incelemenin bu \u00e7er\u00e7evede yap\u0131lmas\u0131 gerekir. <\/p>\n<p>50. 5271 say\u0131l\u0131 Kanun\u2019un 102. maddesinde soru\u015fturma ve kovu\u015fturma evrelerinde ki\u015filerin tutulabilece\u011fi azami kanuni s\u00fcreler d\u00fczenlenmi\u015ftir. Madde metninde, a\u011f\u0131r ceza mahkemesinin g\u00f6revine giren ve girmeyen i\u015fler bak\u0131m\u0131ndan bir ayr\u0131ma gidilmi\u015ftir. Bireyler hakk\u0131ndaki birden fazla su\u00e7a ili\u015fkin soru\u015fturma ve kovu\u015fturmalar\u0131n bir dosya \u00fczerinden y\u00fcr\u00fct\u00fclmesi veya bir dosyada birle\u015ftirilmi\u015f olmas\u0131 halinde bu soru\u015fturma ve kovu\u015fturmalar\u0131n belli bir b\u00fct\u00fcnl\u00fck i\u00e7inde y\u00fcr\u00fct\u00fclece\u011fi g\u00f6z \u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda, uygulanan bir tutuklama tedbirinin soru\u015fturma ve kovu\u015fturmalar\u0131n tamam\u0131 a\u00e7\u0131s\u0131ndan sonu\u00e7 do\u011furaca\u011f\u0131 a\u00e7\u0131kt\u0131r. Bu nedenle azami tutukluluk s\u00fcresinin ki\u015finin yarg\u0131land\u0131\u011f\u0131 dosya kapsam\u0131ndaki t\u00fcm su\u00e7lar a\u00e7\u0131s\u0131ndan en fazla be\u015f y\u0131l olmas\u0131 gerekti\u011fi anla\u015f\u0131lmaktad\u0131r. Tutuklama tedbiri, bir yapt\u0131r\u0131m olmad\u0131\u011f\u0131ndan ayn\u0131 dosya kapsam\u0131ndaki her bir su\u00e7 i\u00e7in azami tutukluluk s\u00fcresinin ayr\u0131 ayr\u0131 hesaplanmas\u0131 kabul edilemez. Su\u00e7 ve san\u0131k say\u0131s\u0131, davan\u0131n karma\u015f\u0131k olmas\u0131 gibi etkenler tutukluluk s\u00fcresinin makul olup olmad\u0131\u011f\u0131 konusundaki de\u011ferlendirmede ele al\u0131nabilecek fakt\u00f6rler olup kanuni tutukluluk s\u00fcresinin belirlenmesinde esas al\u0131nmalar\u0131 m\u00fcmk\u00fcn de\u011fildir. Normun lafz\u0131 ve amac\u0131, tutuklama tedbirinin ceza adalet sistemi i\u00e7erisindeki yeri ve 5271 say\u0131l\u0131 Kanun\u2019un 102. maddesindeki d\u00fczenleme ile ki\u015fi \u00f6zg\u00fcrl\u00fc\u011f\u00fcne y\u00f6nelik s\u0131n\u0131rlamalar\u0131n dar yorumlanmas\u0131 hususlar\u0131 birlikte de\u011ferlendirildi\u011finde aksine bir sonuca varmak m\u00fcmk\u00fcn g\u00f6r\u00fcnmemektedir. <\/p>\n<p>51. Di\u011fer taraftan, Anayasa&#8217;n\u0131n 19. maddesinin yedinci f\u0131kras\u0131 tutuklulukta makul s\u00fcreyi g\u00fcvence alt\u0131na alm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla kanunla tutukluluk s\u00fcresi i\u00e7in getirilen \u00fcst s\u0131n\u0131rlar makul s\u00fcrenin a\u015f\u0131lmad\u0131\u011f\u0131 istisnai durumlar i\u00e7in ge\u00e7erli olabilir ve hi\u00e7bir \u015fekilde ki\u015finin bu s\u00fcre doluncaya kadar tutulabilece\u011fi anlam\u0131na gelmez. Aksine, \u00fcst s\u0131n\u0131r\u0131n a\u015f\u0131lmad\u0131\u011f\u0131 durumlarda dahi, tutukluluk makul s\u00fcreyi a\u015fm\u0131\u015fsa, anayasal hakk\u0131n ihlal edildi\u011fi sonucuna var\u0131lacakt\u0131r. <\/p>\n<p>52. Anayasa\u2019n\u0131n 36. maddesinde adil yarg\u0131lanma hakk\u0131 g\u00fcvence alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Bu kapsamda makul s\u00fcrede yarg\u0131lanma herkese tan\u0131nan bir hakt\u0131r. Davalar\u0131n en az giderle ve m\u00fcmk\u00fcn olan s\u00fcratle sonu\u00e7land\u0131r\u0131lmas\u0131 da Anayasa&#8217;n\u0131n 141. maddesinde yarg\u0131ya bir g\u00f6rev olarak y\u00fcklenmi\u015ftir. Azami s\u00fcrenin, su\u00e7 say\u0131s\u0131 gerek\u00e7esiyle uzat\u0131lmas\u0131na dair yorumlarla veya gerek\u00e7e g\u00f6sterilmeden genel ifadelerle uzat\u0131lmas\u0131, muhtemel \u00f6zg\u00fcrl\u00fck ve g\u00fcvenlik ihlallerine ilave olarak, makul s\u00fcrede yarg\u0131lanma hakk\u0131 a\u00e7\u0131s\u0131ndan da olas\u0131 ihlallere zemin haz\u0131rlayabilecek niteliktedir. B\u00f6yle bir uygulama, \u00f6zg\u00fcrl\u00fck ve g\u00fcvenlik ihlalini neredeyse otomatik, makul s\u00fcrede yarg\u0131lanma hakk\u0131n\u0131n ihlalini ise potansiyel hale getirebilece\u011finden kabul edilemez.<\/p>\n<p>53. Di\u011fer yandan, \u00f6zg\u00fcrl\u00fck ve g\u00fcvenlik hakk\u0131na ili\u015fkin s\u0131n\u0131rlamalar\u0131n kanunla yap\u0131lmas\u0131 ve s\u0131n\u0131rlaman\u0131n \u015fekil ve \u015fartlar\u0131n\u0131n da kanunda a\u00e7\u0131k\u00e7a belirtilmesi gerekir. Kanunun metni, bireylerin, gerekti\u011finde hukuki yard\u0131m almak suretiyle, tutuklama nedenlerini ve s\u00fcrelerini belli bir a\u00e7\u0131kl\u0131k ve kesinlikte \u00f6ng\u00f6rebilmelerine imk\u00e2n verecek \u015fekilde kaleme al\u0131nm\u0131\u015f olmal\u0131d\u0131r. Dolay\u0131s\u0131yla uygulanmas\u0131 \u00f6ncesinde kanun, muhtemel etki ve sonu\u00e7lar\u0131 bak\u0131m\u0131ndan yeterli derecede \u00f6ng\u00f6r\u00fclebilir olmal\u0131d\u0131r. Bununla birlikte, kanun metninin t\u00fcm sonu\u00e7 ve etkileri g\u00f6stermesi her zaman beklenemeyece\u011finden, aranan a\u00e7\u0131kl\u0131\u011f\u0131n \u00f6l\u00e7\u00fcs\u00fc, s\u00f6z konusu metnin i\u00e7eri\u011fi, d\u00fczenlemeyi hedefledi\u011fi alan ile hitap etti\u011fi kitlenin stat\u00fc ve b\u00fcy\u00fckl\u00fc\u011f\u00fc gibi fakt\u00f6rler dikkate al\u0131narak belirlenebilir. Bu \u00f6zelliklere sahip kanunun ayn\u0131 zamanda kolayl\u0131kla eri\u015filebilir olmas\u0131 da gerekir.<\/p>\n<p>54. 5271 say\u0131l\u0131 Kanun\u2019daki azami tutukluluk s\u00fcresinin a\u011f\u0131r cezal\u0131k i\u015fler bak\u0131m\u0131ndan uzatmalarla birlikte azami be\u015f y\u0131l oldu\u011fu, bu haliyle d\u00fczenlemenin \u00f6ng\u00f6r\u00fclebilir oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Ancak derece mahkemelerinin kanuni tutukluluk s\u00fcresinin her su\u00e7 i\u00e7in ayr\u0131 ayr\u0131 hesaplanmas\u0131 gerekti\u011fi y\u00f6n\u00fcndeki yorumu, bireylerin tutuklu olarak yarg\u0131lanabilece\u011fi azami s\u00fcreyi belirsiz ve \u00f6ng\u00f6r\u00fclemez bir \u015fekilde uzatmaya elveri\u015flidir. Zira bir ki\u015fi hakk\u0131nda birden fazla su\u00e7 isnad\u0131 olmas\u0131 halinde azami tutukluluk s\u00fcresi her biri i\u00e7in ayr\u0131 ayr\u0131 hesapland\u0131\u011f\u0131nda ki\u015finin \u00f6zg\u00fcrl\u00fc\u011f\u00fcnden mahrum b\u0131rak\u0131labilece\u011fi s\u00fcre \u00f6ng\u00f6r\u00fclemez bir \u015fekilde uzayacakt\u0131r. Bu durumun ba\u015fvurucu a\u00e7\u0131s\u0131ndan \u00f6ng\u00f6r\u00fclebilir olmad\u0131\u011f\u0131 a\u00e7\u0131kt\u0131r. Bir hukuk devletinde hen\u00fcz su\u00e7lulu\u011fu sabit hale gelmemi\u015f bir bireyin mahkemenin benimsedi\u011fi yorum nedeniyle belirsiz bir s\u00fcre boyunca \u00f6zg\u00fcrl\u00fc\u011f\u00fcnden yoksun b\u0131rak\u0131lmas\u0131 d\u00fc\u015f\u00fcn\u00fclemez. <\/p>\n<p>55. Ba\u015fvurucunun 4\/2\/2007 tarihinde g\u00f6z alt\u0131na al\u0131nd\u0131\u011f\u0131 ve 8\/2\/2007 tarihinde tutukland\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Sultanbeyli Sulh Ceza Mahkemesinin tutuklama karar\u0131nda ba\u015fvurucuya isnat olunan fiiller h\u0131rs\u0131zl\u0131k, silahl\u0131 ya\u011fma, \u00e7\u0131kar ama\u00e7l\u0131 su\u00e7 \u00f6rg\u00fct\u00fc kurmak ve y\u00f6netmek olarak say\u0131lm\u0131\u015ft\u0131r. Soru\u015fturma ve kovu\u015fturma bir b\u00fct\u00fcn olarak y\u00fcr\u00fct\u00fclm\u00fc\u015ft\u00fcr. Buna g\u00f6re 5271 say\u0131l\u0131 Kanun\u2019un 102. maddesinin (2) numaral\u0131 f\u0131kras\u0131nda \u00f6ng\u00f6r\u00fclen azami tutukluluk s\u00fcresi 4\/2\/2012 tarihinde dolmu\u015ftur. Bu durumda ba\u015fvurucunun bu tarihle h\u00fck\u00fcm tarihi olan 25\/12\/2012 aras\u0131ndaki 10 ay 21 g\u00fcn s\u00fcren tutukluluk halinin kanunda \u00f6ng\u00f6r\u00fclen \u015fekil ve \u015fartlara uymad\u0131\u011f\u0131 sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>56. A\u00e7\u0131klanan nedenlerle, Anayasa\u2019n\u0131n 19. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131n\u0131n ihlal edildi\u011fine karar verilmesi gerekir.<\/p>\n<p>b. Anayasa\u2019n\u0131n 19. Maddesinin Yedinci F\u0131kras\u0131n\u0131n \u0130hlal Edildi\u011fi \u0130ddias\u0131<\/p>\n<p>57. Ba\u015fvurucu ayr\u0131ca tutukluluk s\u00fcresinin uzunlu\u011fundan \u015fik\u00e2yet etmi\u015ftir.<\/p>\n<p>58. Adalet Bakanl\u0131\u011f\u0131 g\u00f6r\u00fc\u015f\u00fcnde, ba\u015fvurucunun di\u011fer be\u015f san\u0131kla birlikte su\u00e7 i\u015flemek amac\u0131yla \u00e7\u0131kar ama\u00e7l\u0131 su\u00e7 \u00f6rg\u00fct\u00fc kurma, h\u0131rs\u0131zl\u0131k ve ya\u011fma su\u00e7lar\u0131ndan yarg\u0131land\u0131\u011f\u0131n\u0131, su\u00e7lamalar\u0131n ciddi ve a\u011f\u0131r oldu\u011funu, ba\u015fvuran hakk\u0131nda dokuz kez h\u0131rs\u0131zl\u0131k, iki kez ya\u011fma ve yine \u00e7ok say\u0131da konut dokunulmazl\u0131\u011f\u0131n\u0131 ihlal ve mala zarar verme su\u00e7lar\u0131ndan yarg\u0131land\u0131\u011f\u0131n\u0131, \u00e7ok say\u0131da delil bulundu\u011funu, bu itibarla, davan\u0131n karma\u015f\u0131k oldu\u011funu belirtmi\u015f ve A\u0130HM\u2019in, tutuklaman\u0131n veya tutuklulu\u011fun devam\u0131 kararlar\u0131n\u0131n gerek\u00e7esi olarak \u201cdelillerin durumu\u201d ifadesini ciddi su\u00e7 g\u00f6stergelerinin mevcudiyeti ve devaml\u0131l\u0131\u011f\u0131 hususunda bir etken olarak de\u011ferlendirdi\u011fini, ba\u015fvuran\u0131n su\u00e7land\u0131\u011f\u0131 su\u00e7un ciddiyetini ve su\u00e7lu bulunmas\u0131 halinde \u00e7arpt\u0131r\u0131laca\u011f\u0131 cezan\u0131n a\u011f\u0131rl\u0131\u011f\u0131n\u0131 ka\u00e7ma riskinin de\u011ferlendirilmesinde ilgili bir unsur olarak g\u00f6rd\u00fc\u011f\u00fcn\u00fc, ancak belirli bir s\u00fcre sonra birbirine benzer gerek\u00e7elerin tutuklamalar\u0131n hakl\u0131l\u0131\u011f\u0131n\u0131 ortaya koymayaca\u011f\u0131n\u0131 ifade etti\u011fini (Getiren\/T\u00fcrkiye, No. 10301\/03, 22\/7\/2008; Cahit Demirel\/T\u00fcrkiye, No. 18623\/03, 7\/7\/2009), belirtmek suretiyle ba\u015fvuran\u0131n tutukluluk s\u00fcresinin uzunlu\u011funa ili\u015fkin \u015fik\u00e2yeti konusunda takdiri Anayasa Mahkemesine b\u0131rakm\u0131\u015ft\u0131r.<\/p>\n<p>59. Ba\u015fvurucu, Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcnde belirtilen dosyan\u0131n karma\u015f\u0131k oldu\u011fu g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 \u00e7\u0131km\u0131\u015ft\u0131r.<\/p>\n<p>60. Anayasa\u2019n\u0131n 19. maddesinin yedinci f\u0131kras\u0131nda bir ceza soru\u015fturmas\u0131 kapsam\u0131nda tutuklanan ki\u015filerin, yarg\u0131laman\u0131n makul s\u00fcrede bitirilmesini ve soru\u015fturma veya kovu\u015fturma s\u0131ras\u0131nda serbest b\u0131rak\u0131lmay\u0131 isteme haklar\u0131na sahip oldu\u011fu g\u00fcvence alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>61. Tutukluluk s\u00fcresinin makul olup olmad\u0131\u011f\u0131 konusunun, genel bir ilke \u00e7er\u00e7evesinde de\u011ferlendirilmesi m\u00fcmk\u00fcn de\u011fildir. Bir san\u0131\u011f\u0131n tutuklu olarak bulunduruldu\u011fu s\u00fcrenin makul olup olmad\u0131\u011f\u0131, her davan\u0131n kendi \u00f6zelliklerine g\u00f6re de\u011ferlendirilmelidir. Tutuklulu\u011fun devam\u0131 ancak masumiyet karinesine ra\u011fmen Anayasa\u2019n\u0131n 19. maddesinde g\u00fcvence alt\u0131na al\u0131nan ki\u015fi h\u00fcrriyeti ve g\u00fcvenli\u011fi hakk\u0131ndan daha a\u011f\u0131r basan ger\u00e7ek bir kamu yarar\u0131n\u0131n mevcut olmas\u0131 durumunda hakl\u0131 bulunabilir (bkz: Labita\/\u0130talya [BD], B. No: 26772\/95, 6 Nisan 2000, \u00a7 119).<\/p>\n<p>62. Bir davada tutuklulu\u011fun belli bir s\u00fcreyi a\u015fmamas\u0131n\u0131 sa\u011flamak, \u00f6ncelikle derece mahkemelerinin g\u00f6revidir. Bu ama\u00e7la, yukar\u0131da belirtilen kamu yarar\u0131 gere\u011fini etkileyen t\u00fcm olaylar\u0131n derece mahkemeleri taraf\u0131ndan incelenmesi ve serbest b\u0131rak\u0131lma taleplerine ili\u015fkin kararlar\u0131nda bu olgu ve olaylar\u0131n ortaya konulmas\u0131 gerekir. <\/p>\n<p>63. Tutuklama tedbirine ki\u015filerin su\u00e7lulu\u011fu hakk\u0131nda kuvvetli belirti bulunmas\u0131n\u0131n yan\u0131s\u0131ra bu ki\u015filerin ka\u00e7malar\u0131n\u0131, delillerin yok edilmesini veya de\u011fi\u015ftirilmesini \u00f6nlemek maksad\u0131yla ba\u015fvurulabilir. Ba\u015flang\u0131\u00e7taki bu tutuklama nedenleri belli bir s\u00fcreye kadar tutuklulu\u011fun devam\u0131 i\u00e7in yeterli g\u00f6r\u00fclebilirse de bu s\u00fcre ge\u00e7tikten sonra, uzatmaya ili\u015fkin kararlarda tutuklama nedenlerinin h\u00e2l\u00e2 devam etti\u011finin gerek\u00e7eleriyle birlikte g\u00f6sterilmesi gerekir. Bu gerek\u00e7eler \u201cilgili\u201d ve \u201cyeterli\u201d g\u00f6r\u00fcld\u00fc\u011f\u00fc takdirde, yarg\u0131lama s\u00fcrecinin \u00f6zenli y\u00fcr\u00fct\u00fcl\u00fcp y\u00fcr\u00fct\u00fclmedi\u011fi de incelenmelidir. Davan\u0131n karma\u015f\u0131kl\u0131\u011f\u0131, organize su\u00e7lara dair olup olmad\u0131\u011f\u0131 veya san\u0131k say\u0131s\u0131 gibi fakt\u00f6rler s\u00fcrecin i\u015fleyi\u015finde g\u00f6sterilen \u00f6zenin de\u011ferlendirilmesinde dikkate al\u0131n\u0131r. T\u00fcm bu unsurlar\u0131n birlikte de\u011ferlendirilmesiyle s\u00fcrenin makul olup olmad\u0131\u011f\u0131 konusunda bir sonuca ula\u015f\u0131labilir. <\/p>\n<p>64. Dolay\u0131s\u0131yla Anayasa\u2019n\u0131n 19. maddesinin yedinci f\u0131kras\u0131n\u0131n ihlal edilip edilmedi\u011finin de\u011ferlendirmesinde esas olarak, serbest b\u0131rak\u0131lma taleplerine ili\u015fkin kararlar\u0131n gerek\u00e7elerine bak\u0131lmal\u0131 ve tutuklu bulunan ki\u015filer taraf\u0131ndan yap\u0131lan tutuklulu\u011fa itiraz ba\u015fvurular\u0131nda sunulan belgeler \u00e7er\u00e7evesinde kararlar\u0131n yeterince gerek\u00e7elendirilmi\u015f olup olmad\u0131\u011f\u0131 g\u00f6z \u00f6n\u00fcne al\u0131nmal\u0131d\u0131r.<\/p>\n<p>65. \u00d6te yandan hukuka uygun olarak tutuklanan bir ki\u015finin, su\u00e7 i\u015fledi\u011fi y\u00f6n\u00fcnde kuvvetli belirti ve tutuklama nedeninin varl\u0131\u011f\u0131 devam etti\u011fi s\u00fcrece ilke olarak belli bir s\u00fcreye kadar tutukluluk halinin makul kabul edilmesi gerekir. <\/p>\n<p>66. Makul s\u00fcrenin hesaplanmas\u0131nda s\u00fcrenin ba\u015flang\u0131c\u0131, ba\u015fvurucunun ilk kez yakalan\u0131p g\u00f6zalt\u0131na al\u0131nd\u0131\u011f\u0131 durumlarda bu tarih, do\u011frudan tutukland\u0131\u011f\u0131 durumlarda ise tutuklama tarihidir. S\u00fcrenin sonu ise kural olarak ki\u015finin serbest b\u0131rak\u0131ld\u0131\u011f\u0131 tarihtir.<\/p>\n<p>67. Ancak ki\u015fi serbest b\u0131rak\u0131lmadan yarg\u0131lanmakta oldu\u011fu davada ilk derece mahkemesi karar\u0131yla mahk\u00fbm olmu\u015fsa, mahk\u00fbmiyet tarihi itibariyle de tutukluluk hali sona erer. \u00c7\u00fcnk\u00fc bu durumda ki\u015finin hukuki durumu \u201cbir su\u00e7 isnad\u0131na ba\u011fl\u0131 olarak tutuklu\u201d olma kapsam\u0131ndan \u00e7\u0131kmaktad\u0131r. Bireysel ba\u015fvuru incelemesi a\u00e7\u0131s\u0131ndan, tutuklaman\u0131n \u015fartlar\u0131 ile mahk\u00fbmiyete h\u00fckmedilmesi aras\u0131ndaki esasl\u0131 fark bunu gerektirir. Zira mahk\u00fbmiyete karar verilmi\u015f olmakla, isnat olunan su\u00e7un i\u015flendi\u011fi, bundan failin sorumlu oldu\u011funun s\u00fcbuta erdi\u011fi kabul edilmekte ve bu nedenle san\u0131k hakk\u0131nda h\u00fcrriyeti ba\u011flay\u0131c\u0131 cezaya ve\/veya para cezas\u0131na h\u00fckmedilmektedir. Mahk\u00fbmiyetle birlikte ki\u015finin kuvvetli su\u00e7 \u015f\u00fcphesi ve bir tutuklama nedenine ba\u011fl\u0131 olarak tutukluluk hali sona ermektedir. Bu a\u00e7\u0131dan mahk\u00fbmiyet karar\u0131n\u0131n kesinle\u015fmi\u015f olmas\u0131 ayr\u0131ca gerekmez. Nitekim gerek A\u0130HM, gerekse Yarg\u0131tay, mahk\u00fbmiyet karar\u0131 sonras\u0131 tutulma halini tutukluluk olarak nitelendirmemektedir. A\u0130HM, ilk derece mahkemesi karar\u0131yla mahk\u00fbm olan bir san\u0131\u011f\u0131n, s\u00f6z konusu mahk\u00fbmiyet karar\u0131ndan sonraki tutulmas\u0131n\u0131 S\u00f6zle\u015fme\u2019nin 5. maddesinin birinci f\u0131kras\u0131n\u0131n (a) bendi h\u00fckm\u00fc uyar\u0131nca \u201cmahk\u00fbmiyet sonras\u0131 tutma\u201d olarak de\u011ferlendirmekte ve tutukluluk s\u00fcresinin hesab\u0131nda dikkate almamaktad\u0131r (Bkz. Solmaz \/ T\u00fcrkiye, no. 27561\/02, 16 Ocak 2007, \u00a7\u00a7 23,24; \u015eahap Do\u011fan \/ T\u00fcrkiye, no.29361\/07, 27 May\u0131s 2010, \u00a7 26). Ayn\u0131 yakla\u015f\u0131m Yarg\u0131tay Ceza Genel Kurulu taraf\u0131ndan da benimsenmektedir. Kurul, 12 Nisan 2011 tarihli ve E. 2011\/1-51, K. 2011\/42 say\u0131l\u0131 karar\u0131nda, \u201chakk\u0131nda mahk\u00fbmiyet h\u00fckm\u00fc kurulmakla san\u0131\u011f\u0131n at\u0131l\u0131 su\u00e7u i\u015fledi\u011fi yerel mahkeme taraf\u0131ndan sabit g\u00f6r\u00fclmekte ve bu a\u015famadan sonra tutuklulu\u011fun dayana\u011f\u0131 mahk\u00fbmiyet h\u00fckm\u00fc olmaktad\u0131r.\u201d gerek\u00e7esiyle, temyizde ge\u00e7en s\u00fcrenin tutukluluk s\u00fcresine d\u00e2hil edilmeyece\u011fine karar vermi\u015ftir.<\/p>\n<p>68. Somut olayda ba\u015fvurucu g\u00f6zalt\u0131na al\u0131nd\u0131\u011f\u0131 4\/2\/2007 tarihi ile ilk derece mahkemesinin h\u00fckm\u00fcn\u00fc a\u00e7\u0131klad\u0131\u011f\u0131 25\/12\/2012 tarihi aras\u0131nda tutuklu kalm\u0131\u015ft\u0131r. Buna g\u00f6re s\u00fcre 5 y\u0131l 10 ay 21 g\u00fcn olarak tespit edilmektedir. Ancak bu s\u00fcrenin be\u015f y\u0131l\u0131 a\u015fan k\u0131sm\u0131n\u0131n kanunda \u00f6ng\u00f6r\u00fclen \u015fekil ve \u015farta uygun olmad\u0131\u011f\u0131na karar verildi\u011finden, makul s\u00fcrenin be\u015f y\u0131l \u00fczerinden de\u011ferlendirilmesi gerekmektedir.<\/p>\n<p>69. Dava toplam alt\u0131 san\u0131k hakk\u0131nda \u00e7ok say\u0131da su\u00e7 isnad\u0131na dayal\u0131 olarak g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Yarg\u0131lama boyunca 18 duru\u015fma yap\u0131lm\u0131\u015ft\u0131r. Bu itibarla davan\u0131n nispeten karma\u015f\u0131k oldu\u011fu s\u00f6ylenebilir.<\/p>\n<p>70. Ancak, kuvvetli su\u00e7 \u015f\u00fcphesi ile birlikte devam\u0131n\u0131 g\u00f6steren hakl\u0131 nedenlerin g\u00f6sterilmesi \u015fart\u0131yla soru\u015fturma veya kovu\u015fturman\u0131n tutuklu s\u00fcrd\u00fcr\u00fclmesi m\u00fcmk\u00fcn olabilir. Buna dair gerek\u00e7elere mahkeme kararlar\u0131 ve Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcnde yer verilmedi\u011fi gibi ilk tutuklama m\u00fczekkeresi d\u0131\u015f\u0131nda dosyaya herhangi bir karar \u00f6rne\u011fi de sunulmam\u0131\u015ft\u0131r. Dahas\u0131, be\u015f y\u0131ll\u0131k s\u00fcre dolmas\u0131na ra\u011fmen, kanundaki azami s\u00fcrenin dolmu\u015f oldu\u011fu iddias\u0131yla ba\u015fvurucu tahliye talebinde bulunmu\u015f, davay\u0131 g\u00f6ren ve itiraz\u0131 inceleyen mahkemeler kararlar\u0131nda tahliye talebini reddetmi\u015fler fakat be\u015f y\u0131ll\u0131k azami s\u00fcre konusundaki iddiaya hi\u00e7bir \u015fekilde de\u011finmemi\u015flerdir (\u00a7\u00a7 12-14). Be\u015f y\u0131l\u0131 hayli a\u015fan bir tutukluluk halinin devam\u0131na ili\u015fkin bu gerek\u00e7elerin ilgili ve yeterli oldu\u011fu s\u00f6ylenemez.<\/p>\n<p>71.
