Kira bedelinin zaman\u0131nda \u00f6denmemesi veya eksik \u00f6denmesi sebebiyle bir kira y\u0131l\u0131 i\u00e7inde kendilerine iki hakl\u0131 ihtar yap\u0131lan kirac\u0131lar aleyhine, kiraya veren taraf\u0131ndan kira s\u00fcresinin sonunda tahliye davas\u0131 a\u00e7\u0131labilecektir.<\/p>\n<p>\u0130ki hakl\u0131 ihtar nedeniyle tahliye davas\u0131 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu m.352\/2\u2019de d\u00fczenlenmi\u015ftir. Buna g\u00f6re \u201cKirac\u0131, bir y\u0131ldan k\u0131sa s\u00fcreli kira s\u00f6zle\u015fmelerinde kira s\u00fcresi i\u00e7inde; bir y\u0131l ve daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde ise bir kira y\u0131l\u0131 veya bir kira y\u0131l\u0131n\u0131 a\u015fan s\u00fcre i\u00e7inde kira bedelini \u00f6demedi\u011fi i\u00e7in kendisine yaz\u0131l\u0131 olarak iki hakl\u0131 ihtarda bulunulmas\u0131na sebep olmu\u015fsa kiraya veren, kira s\u00fcresinin ve bir y\u0131ldan uzun s\u00fcreli kiralarda ihtarlar\u0131n yap\u0131ld\u0131\u011f\u0131 kira y\u0131l\u0131n\u0131n bitiminden ba\u015flayarak bir ay i\u00e7inde, dava yoluyla kira s\u00f6zle\u015fmesini sona erdirebilir.\u201d denilmektedir. \u0130lgili madde uyar\u0131nca iki hakl\u0131 sebebe dayal\u0131 ihtarname ile yasal s\u00fcre i\u00e7erisinde kirac\u0131 aleyhine dava a\u00e7\u0131larak kirac\u0131n\u0131n tahliyesi sa\u011flanabilecektir.<\/p>\n<p>\u0130ki hakl\u0131 ihtar sebebiyle tahliyenin belli ba\u015fl\u0131 \u015fartlar\u0131 bulunmaktad\u0131r. Bu \u015fartlar\u0131 ba\u015fl\u0131klar halinde inceleyecek olursak:<\/p>\n<p>&#8211; \u0130htarlar\u0131n hakl\u0131 sebebe dayanmas\u0131<\/p>\n<p>&#8211; \u0130htarlar\u0131n yaz\u0131l\u0131 olmas\u0131<\/p>\n<p>&#8211; \u0130htarlar\u0131n bir kira y\u0131l\u0131 i\u00e7erisinde iki farkl\u0131 aya ait olmas\u0131<\/p>\n<p>&#8211; Kira y\u0131l\u0131n\u0131n bitiminden itibaren 1 ay i\u00e7erisinde davan\u0131n a\u00e7\u0131lm\u0131\u015f olmas\u0131d\u0131r.<\/p>\n<p>\u015eartlar\u0131n tamam\u0131n\u0131n sa\u011flanmas\u0131 halinde dava a\u00e7\u0131labilecektir.<\/p>\n<p>1-HAKLI SEBEB\u0130N VARLI\u011eI<\/p>\n<p>\u00d6ncelikle kirac\u0131ya g\u00f6nderilecek ihtarlar\u0131n hakl\u0131 sebebe dayanmas\u0131 gerekmektedir. Kira bedelinin s\u00f6zle\u015fmede belirlenen s\u00fcrede ya da hangi s\u00fcrede \u00f6denece\u011fi s\u00f6zle\u015fme ile belirlenmemi\u015fse kanun h\u00fck\u00fcmlerine g\u00f6re ifa zaman\u0131nda \u00f6denmemesi veyahut eksik \u00f6denmesi durumunda hakl\u0131 sebebin varl\u0131\u011f\u0131 kabul edilir.<\/p>\n<p>\u0130htarname ya da icra yoluyla \u00f6deme emrinin tebli\u011f edilmesi durumunda tebligat\u0131n kirac\u0131ya ula\u015fmas\u0131ndan \u00f6nce \u00f6deme yap\u0131lmas\u0131 hakl\u0131 sebebi ortadan kald\u0131rmaktad\u0131r. \u0130htar veya \u00f6deme emri tebligat\u0131n\u0131n kirac\u0131ya ula\u015ft\u0131ktan sonra kira bedelinin \u00f6denmesinde ise hakl\u0131 sebep \u015fart\u0131 sa\u011flanmaktad\u0131r.<\/p>\n<p>Yarg\u0131tay 3. HD., 02.10.2018 tarihli, 2018\/5827 E. ve 2018\/9394 K. say\u0131l\u0131 karar\u0131nda,<\/p>\n<p>\u201c\u0130ki hakl\u0131 ihtar nedeniyle a\u00e7\u0131lan davada tahliyeye karar verilebilmesi i\u00e7in kirac\u0131ya bir y\u0131ldan k\u0131sa s\u00fcreli kira s\u00f6zle\u015fmelerinde kira s\u00fcresi i\u00e7inde, bir y\u0131l ve daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde ise bir kira y\u0131l\u0131 veya bir kira y\u0131l\u0131n\u0131 a\u015fan s\u00fcre i\u00e7inde kira bedelini \u00f6demedi\u011fi i\u00e7in yaz\u0131l\u0131 olarak iki hakl\u0131 ihtarda bulunulmas\u0131 gerekir. \u0130htar tebli\u011finden sonra yap\u0131lan \u00f6demeler iki hakl\u0131 ihtar\u0131n olu\u015fmas\u0131na engel te\u015fkil etmez. S\u00fcresiz s\u00f6zle\u015fmelerde ve kira paras\u0131n\u0131n y\u0131ll\u0131k \u00f6denmesi gereken hallerde iki hakl\u0131 ihtar olu\u015fmaz.\u201d demek suretiyle tebli\u011fden sonra yap\u0131lan \u00f6demelerin ihtar\u0131n hakl\u0131l\u0131\u011f\u0131n\u0131 ortadan kald\u0131rmayaca\u011f\u0131n\u0131 belirtmi\u015ftir. Yine ilgili kararda belirsiz s\u00fcreli s\u00f6zle\u015fmelerde ve kiran\u0131n y\u0131ll\u0131k \u00f6dendi\u011fi durumlarda iki hakl\u0131 sebebe dayal\u0131 ihtar ile tahliye yoluna gidilemeyece\u011fi de a\u00e7\u0131kl\u0131\u011fa kavu\u015fturulmu\u015ftur.<\/p>\n<p>\u00d6nemli olan bir di\u011fer husus da ilk ihtar tarihinde muaccel olan iki ayr\u0131 aya ait \u00f6denmeyen kira i\u00e7in iki ayr\u0131 ihtarname g\u00f6nderilmesi iki hakl\u0131 ihtar durumunu olu\u015fturmayacakt\u0131r. Basit bir \u00f6rnekle; ocak ve \u015fubat ay\u0131 i\u00e7in kiras\u0131n\u0131 \u00f6demeyen kirac\u0131ya muacceliyet tarihinden sonra g\u00f6nderilecek ilk ihtarnamede, Ocak ve \u015fubat aylar\u0131 i\u00e7in iki ihtarname g\u00f6nderilerek iki hakl\u0131 sebepli ihtarname olgusuna dayan\u0131lmaz.<\/p>\n<p>2-\u0130HTARIN YAZILI OLMASI \u015eARTI<\/p>\n<p>\u0130htar\u0131n yaz\u0131l\u0131 olarak yap\u0131lmas\u0131 gerekmektedir. \u0130htar\u0131n noter arac\u0131l\u0131\u011f\u0131 ile yap\u0131lmas\u0131 ispat a\u00e7\u0131s\u0131ndan en sa\u011fl\u0131kl\u0131 y\u00f6ntemdir. Uygulamada da en \u00e7ok tercih edilen y\u00f6ntem noter arac\u0131l\u0131\u011f\u0131 ile ihtar g\u00f6nderilmesidir.<\/p>\n<p>\u0130htar\u0131n yaz\u0131l\u0131 olmas\u0131 sadece noter arac\u0131l\u0131\u011f\u0131 ile yap\u0131lmas\u0131 anlam\u0131na gelmemektedir. Posta yoluyla ya da mail ile yap\u0131lan ihtarname de ge\u00e7erlidir ancak kar\u015f\u0131 tarafa ula\u015ft\u0131\u011f\u0131n\u0131n kiraya veren taraf\u0131ndan ispatlanmas\u0131 gerekmektedir.<\/p>\n<p>Kirac\u0131ya ayn\u0131 kira d\u00f6nemi i\u00e7erisinde kira bedelinin eksik ya da zaman\u0131nda \u00f6denmemesi nedeniyle farkl\u0131 zamanlarda iki defa icra takibi ba\u015flat\u0131lm\u0131\u015fsa veyahut bir icra takibi ba\u015flat\u0131lm\u0131\u015f bir de ihtar g\u00f6nderilmi\u015fse bu durumda da yaz\u0131l\u0131 \u015fekilde iki hakl\u0131 ihtar yap\u0131lm\u0131\u015f kabul edilmektedir.<\/p>\n<p>3-\u0130HTARLARIN B\u0130R K\u0130RA YILI \u0130\u00c7ER\u0130S\u0130NDE \u0130K\u0130 FARKLI AYA A\u0130T OLMASI \u015eARTI<\/p>\n<p>Yukar\u0131da da izah edildi\u011fi \u00fczere s\u00fcresiz s\u00f6zle\u015fmelerde ve kiran\u0131n y\u0131ll\u0131k olarak belirlendi\u011fi s\u00f6zle\u015fmelerde iki hakl\u0131 ihtara dayal\u0131 tahliye y\u00f6ntemi uygulanmayacakt\u0131r.<\/p>\n<p>\u0130htarlar\u0131n bir kira d\u00f6nemi i\u00e7erisinde iki farkl\u0131 aya ait olmas\u0131 gerekmektedir. Yine muaccel olan iki ayr\u0131 aya ait \u00f6denmeyen kira i\u00e7in muacceliyet tarihinden sonra g\u00f6nderilecek ilk ihtarnamede aylar b\u00f6l\u00fcnerek ayr\u0131 ayr\u0131 istenemez. Yukar\u0131daki \u00f6rne\u011fi yineleyecek olursak ocak ve \u015fubat ay\u0131 kiralar\u0131n\u0131 \u00f6demeyen kirac\u0131ya ilk ihtarname g\u00f6nderilecekse Ocak ve \u015fubat aylar\u0131 b\u00f6l\u00fcnmeden tek ihtarnamede istenebilir. Ancak kirac\u0131 Ocak ay\u0131n\u0131 \u00f6demedi ve bir ihtarname g\u00f6nderildi daha sonra \u015fubat ay\u0131n\u0131 \u00f6demedi\u011fi i\u00e7in ikinci bir ihtarname g\u00f6nderildiyse bu durumda ihtarnameler ge\u00e7erli olacakt\u0131r.<\/p>\n<p>4-K\u0130RA YILININ B\u0130T\u0130M\u0130NDEN \u0130T\u0130BAREN 1 AY \u0130\u00c7ER\u0130S\u0130NDE DAVA A\u00c7MA \u015eARTI<\/p>\n<p>\u0130ki hakl\u0131 ihtar nedeniyle tahliye davas\u0131 bir ayl\u0131k hak d\u00fc\u015f\u00fcr\u00fcc\u00fc s\u00fcreye tabidir. Kira s\u00f6zle\u015fmesi bir y\u0131ldan k\u0131sa s\u00fcreli ise kira s\u00fcresinin bitiminden itibaren, kira s\u00f6zle\u015fmesi bir y\u0131ll\u0131ksa yine kira s\u00f6zle\u015fmesinin bitiminden itibaren, kira s\u00f6zle\u015fmesi bir y\u0131ldan uzun s\u00fcreli ise kira d\u00f6neminin bitiminden itibaren bir ay i\u00e7erisinde dava a\u00e7\u0131lmal\u0131d\u0131r.<\/p>\n<p>Dava a\u00e7\u0131lmadan arabuluculu\u011fa ba\u015fvuru zorunlu olup 6325 say\u0131l\u0131 Kanunun 18\/A maddesi uyar\u0131nca arabuluculuk b\u00fcrosuna ba\u015fvurulmas\u0131ndan son tutana\u011f\u0131n d\u00fczenlendi\u011fi tarihe kadar ge\u00e7en s\u00fcrede hak d\u00fc\u015f\u00fcr\u00fcc\u00fc s\u00fcre i\u015flemez. Arabuluculu\u011fa ba\u015fvuru yap\u0131lmadan dava a\u00e7\u0131lmas\u0131 halinde dava, dava \u015fart\u0131 yoklu\u011fundan usulden reddedilir.<\/p>\n<p>Sonu\u00e7 olarak yukar\u0131da yaz\u0131lan \u015fartlar\u0131n tamam\u0131n\u0131n birlikte var olmas\u0131 durumunda iki hakl\u0131 ihtar sebebiyle sulh hukuk mahkemelerinde tahliye davas\u0131 a\u00e7\u0131labilecek ve kirac\u0131 a\u00e7\u0131lacak dava ile mecurdan tahliye edilebilecektir.<\/p>\n<p>\u200bKira s\u00f6zle\u015fmesi yap\u0131lmas\u0131 durumunda kirac\u0131n\u0131n asli y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc kiran\u0131n zaman\u0131nda ve eksiksiz \u00f6denmesidir. Kira bedelinin zaman\u0131nda \u00f6denmemesi veya eksik \u00f6denmesi sebebiyle bir kira y\u0131l\u0131 i\u00e7inde kendilerine iki hakl\u0131 ihtar yap\u0131lan kirac\u0131lar aleyhine, kiraya veren taraf\u0131ndan kira s\u00fcresinin sonunda tahliye davas\u0131 a\u00e7\u0131labilecektir.<\/p>\n<p>\u0130ki hakl\u0131 ihtar nedeniyle tahliye davas\u0131 6098 say\u0131l\u0131 T\u00fcrk Bor\u00e7lar Kanunu m.352\/2\u2019de d\u00fczenlenmi\u015ftir. Buna g\u00f6re \u201cKirac\u0131, bir y\u0131ldan k\u0131sa s\u00fcreli kira s\u00f6zle\u015fmelerinde kira s\u00fcresi i\u00e7inde; bir y\u0131l ve daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde ise bir kira y\u0131l\u0131 veya bir kira y\u0131l\u0131n\u0131 a\u015fan s\u00fcre i\u00e7inde kira bedelini \u00f6demedi\u011fi i\u00e7in kendisine yaz\u0131l\u0131 olarak iki hakl\u0131 ihtarda bulunulmas\u0131na sebep olmu\u015fsa kiraya veren, kira s\u00fcresinin ve bir y\u0131ldan uzun s\u00fcreli kiralarda ihtarlar\u0131n yap\u0131ld\u0131\u011f\u0131 kira y\u0131l\u0131n\u0131n bitiminden ba\u015flayarak bir ay i\u00e7inde, dava yoluyla kira s\u00f6zle\u015fmesini sona erdirebilir.\u201d denilmektedir. \u0130lgili madde uyar\u0131nca iki hakl\u0131 sebebe dayal\u0131 ihtarname ile yasal s\u00fcre i\u00e7erisinde kirac\u0131 aleyhine dava a\u00e7\u0131larak kirac\u0131n\u0131n tahliyesi sa\u011flanabilecektir.<\/p>\n<p>\u0130ki hakl\u0131 ihtar sebebiyle tahliyenin belli ba\u015fl\u0131 \u015fartlar\u0131 bulunmaktad\u0131r. Bu \u015fartlar\u0131 ba\u015fl\u0131klar halinde inceleyecek olursak:<\/p>\n<p>&#8211; \u0130htarlar\u0131n hakl\u0131 sebebe dayanmas\u0131<\/p>\n<p>&#8211; \u0130htarlar\u0131n yaz\u0131l\u0131 olmas\u0131<\/p>\n<p>&#8211; \u0130htarlar\u0131n bir kira y\u0131l\u0131 i\u00e7erisinde iki farkl\u0131 aya ait olmas\u0131<\/p>\n<p>&#8211; Kira y\u0131l\u0131n\u0131n bitiminden itibaren 1 ay i\u00e7erisinde davan\u0131n a\u00e7\u0131lm\u0131\u015f olmas\u0131d\u0131r.<\/p>\n<p>\u015eartlar\u0131n tamam\u0131n\u0131n sa\u011flanmas\u0131 halinde dava a\u00e7\u0131labilecektir.<\/p>\n<p>1-HAKLI SEBEB\u0130N VARLI\u011eI<\/p>\n<p>\u00d6ncelikle kirac\u0131ya g\u00f6nderilecek ihtarlar\u0131n hakl\u0131 sebebe dayanmas\u0131 gerekmektedir. Kira bedelinin s\u00f6zle\u015fmede belirlenen s\u00fcrede ya da hangi s\u00fcrede \u00f6denece\u011fi s\u00f6zle\u015fme ile belirlenmemi\u015fse kanun h\u00fck\u00fcmlerine g\u00f6re ifa zaman\u0131nda \u00f6denmemesi veyahut eksik \u00f6denmesi durumunda hakl\u0131 sebebin varl\u0131\u011f\u0131 kabul edilir.<\/p>\n<p>\u0130htarname ya da icra yoluyla \u00f6deme emrinin tebli\u011f edilmesi durumunda tebligat\u0131n kirac\u0131ya ula\u015fmas\u0131ndan \u00f6nce \u00f6deme yap\u0131lmas\u0131 hakl\u0131 sebebi ortadan kald\u0131rmaktad\u0131r. \u0130htar veya \u00f6deme emri tebligat\u0131n\u0131n kirac\u0131ya ula\u015ft\u0131ktan sonra kira bedelinin \u00f6denmesinde ise hakl\u0131 sebep \u015fart\u0131 sa\u011flanmaktad\u0131r.<\/p>\n<p>Yarg\u0131tay 3. HD., 02.10.2018 tarihli, 2018\/5827 E. ve 2018\/9394 K. say\u0131l\u0131 karar\u0131nda,<\/p>\n<p>\u201c\u0130ki hakl\u0131 ihtar nedeniyle a\u00e7\u0131lan davada tahliyeye karar verilebilmesi i\u00e7in kirac\u0131ya bir y\u0131ldan k\u0131sa s\u00fcreli kira s\u00f6zle\u015fmelerinde kira s\u00fcresi i\u00e7inde, bir y\u0131l ve daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde ise bir kira y\u0131l\u0131 veya bir kira y\u0131l\u0131n\u0131 a\u015fan s\u00fcre i\u00e7inde kira bedelini \u00f6demedi\u011fi i\u00e7in yaz\u0131l\u0131 olarak iki hakl\u0131 ihtarda bulunulmas\u0131 gerekir. \u0130htar tebli\u011finden sonra yap\u0131lan \u00f6demeler iki hakl\u0131 ihtar\u0131n olu\u015fmas\u0131na engel te\u015fkil etmez. S\u00fcresiz s\u00f6zle\u015fmelerde ve kira paras\u0131n\u0131n y\u0131ll\u0131k \u00f6denmesi gereken hallerde iki hakl\u0131 ihtar olu\u015fmaz.\u201d demek suretiyle tebli\u011fden sonra yap\u0131lan \u00f6demelerin ihtar\u0131n hakl\u0131l\u0131\u011f\u0131n\u0131 ortadan kald\u0131rmayaca\u011f\u0131n\u0131 belirtmi\u015ftir.
