Hukuk Dairesi<\/p>\n<p>2018\/2913 E., 2019\/2489 K.<\/p>\n<p>&#8220;\u0130\u00e7tihat Metni&#8221;<\/p>\n<p>MAHKEMES\u0130 :Sulh Hukuk Mahkemesi<\/p>\n<p>Taraflar aras\u0131ndaki davan\u0131n yap\u0131lan duru\u015fmas\u0131 sonunda kurulan h\u00fckm\u00fcn Yarg\u0131tayca incelenmesi davac\u0131 vekili taraf\u0131ndan istenilmekle, s\u00fcresinde oldu\u011fu anla\u015f\u0131lan temyiz dilek\u00e7esinin kabul\u00fcne karar verildikten sonra dosya incelendi, gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>K A R A R<\/p>\n<p>Davac\u0131 vekili; &#8230; ili, &#8230; il\u00e7esi, &#8230; mahallesi, 1252 ada 14 say\u0131l\u0131 parsel 17 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm maliki oldu\u011funu, kat malikine \u00e7a\u011fr\u0131 yap\u0131lmadan 10 kat malikinin kat\u0131l\u0131m\u0131yla 26.03.2012 tarihinde de\u011ferlendirme toplant\u0131s\u0131 yap\u0131ld\u0131\u011f\u0131, al\u0131nan kararlar\u0131n \u015fahs\u0131na tebli\u011f edilmedi\u011fini, an\u0131lan toplant\u0131da apartmana ili\u015fkin \u00e7e\u015fitli tadilat kararlar\u0131n\u0131n al\u0131nd\u0131\u011f\u0131, bu tadilatlar\u0131n g\u00fcn \u0131s\u0131s\u0131 &#8230; ayaklar\u0131n\u0131n yap\u0131m\u0131, d\u0131\u015f cephe silikon s\u0131va tamiri, d\u0131\u015f cephe ve merdivenlerin boyanmas\u0131, merdiven mermer kaplamalar\u0131, teras ve \u0131s\u0131 yal\u0131t\u0131m\u0131, teras tesviye tabakas\u0131 ve su yal\u0131t\u0131m\u0131, al\u00fcminyum teras korkulu\u011fu, apartman giri\u015f, &#8230; ve \u00e7at\u0131 kap\u0131s\u0131 yenilenmesi, yeni asans\u00f6r yap\u0131m\u0131, mutfak baca tamiri, kanalizasyon ba\u011flant\u0131s\u0131, merdiven ve elektrik panosu elektrik donan\u0131m\u0131, temiz ve pis su borular\u0131n\u0131n de\u011fi\u015fimi, saya\u00e7 kolekt\u00f6rleri, do\u011fal gaz ba\u011flant\u0131s\u0131, al\u00fcminyum caml\u0131 balkon yap\u0131m\u0131 oldu\u011fu ancak s\u00f6z konusu tadilatlar i\u00e7in 10 ki\u015finin oyu ile karar al\u0131nd\u0131\u011f\u0131, 634 say\u0131l\u0131 Kanunun 19. maddesi gere\u011fi i\u015fbu davay\u0131 a\u00e7mak zorunda kald\u0131klar\u0131n\u0131, &#8230; apartman\u0131n\u0131n 26.03.2012 tarihli kat malikleri kurulunda al\u0131nan tadilat kararlar\u0131n\u0131n iptalini talep ve dava etmi\u015ftir.<\/p>\n<p>Mahkemece davan\u0131n reddine karar verilmi\u015f, h\u00fckm\u00fcn temyizi \u00fczerine, Kapat\u0131lan 18. Hukuk Dairesinin 02.03.2016 g\u00fcn ve 2015\/7930 E. &#8211; 2016\/3649 K. say\u0131l\u0131 karar\u0131 ile bozulmas\u0131na karar verilmi\u015ftir. Mahkemece bozma karar\u0131na uyularak yap\u0131lan yarg\u0131lamada, davan\u0131n reddine karar verilmi\u015f, h\u00fck\u00fcm davac\u0131 vekili taraf\u0131ndan temyiz edilmi\u015ftir.<\/p>\n<p>Dosyan\u0131n incelenmesinde, anayap\u0131da g\u00fc\u00e7lendirme projesi kapsam\u0131nda g\u00fc\u00e7lendirme i\u015flemleri yap\u0131ld\u0131\u011f\u0131 ancak, daha sonra iptali istenen toplant\u0131da bir tak\u0131m kararlar\u0131n al\u0131nd\u0131\u011f\u0131, h\u00fckme esas al\u0131nan bilirki\u015fi raporunda al\u0131nan kararlar\u0131n yap\u0131n\u0131n g\u00fc\u00e7lendirilmesi i\u015flemleri kapsam\u0131nda kald\u0131\u011f\u0131n\u0131n belirtildi\u011fi ve i\u015flemlerin tadilat projesine (teras \u00e7at\u0131 parapeti \u00fczerindeki al\u00fcminyum profil korkuluklar haricinde) uygun oldu\u011funun belirtildi\u011fi, iptali istenen kararlar y\u00f6n\u00fcnden her biri hakk\u0131nda hangisinin g\u00fc\u00e7lendirme kapsam\u0131nda kald\u0131\u011f\u0131 veya g\u00fc\u00e7lendirme i\u015flemlerinin do\u011fal sonucu oldu\u011funun tek tek tespit edilmedi\u011fi gibi bir k\u0131s\u0131m kararlar\u0131n (\u00f6rne\u011fin merdivenlerin mermer kaplamas\u0131n\u0131n) yap\u0131n\u0131n g\u00fc\u00e7lendirilmesi ile ilgisinin de\u011ferlendirilmedi\u011fi, tadilat projesine t\u00fcm kat maliklerinin r\u0131zas\u0131n\u0131n olup olmad\u0131\u011f\u0131 ara\u015ft\u0131r\u0131lmadan bozma karar\u0131na ayk\u0131r\u0131 h\u00fck\u00fcm kuruldu\u011fu anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>Mahkemece bozma karar\u0131na uyulmu\u015f ise de gere\u011fi yerine getirilmemi\u015ftir.<\/p>\n<p>Anata\u015f\u0131nmaz\u0131n mimari projesinin de\u011fi\u015ftirilmesine y\u00f6nelik tadilat projesi, t\u00fcm kat maliklerinin muvafakat\u0131 ile yap\u0131labilir. Oybirli\u011fi sa\u011flanmadan haz\u0131rlanan tadilat projeleri ge\u00e7erli de\u011fildir ve s\u0131rf belediye onay\u0131 da ge\u00e7erli hale getirmez. Bununla birlikte, Kat M\u00fclkiyeti Kanununun 19. maddesine g\u00f6re, anata\u015f\u0131nmazda bir k\u0131s\u0131m de\u011fi\u015fiklikler kat maliklerinin 4\/5 r\u0131zas\u0131 ile yap\u0131labilecek ise de bu de\u011fi\u015fikliklerin, \u00f6ncelikle mimari projede oybirli\u011fi gerektirecek \u015fekilde esasl\u0131 de\u011fi\u015fiklik yapmamas\u0131, kat maliklerinin m\u00fclkiyet hakk\u0131n\u0131 ihlal etmemesi, yap\u0131lacak de\u011fi\u015fikliklerin di\u011fer kat maliklerinin ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm ve eklentisinden istifadelerini engellememesi ve rahats\u0131z etmemesi, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm i\u00e7erisinde yap\u0131lan de\u011fi\u015fikliklerin ise anayap\u0131n\u0131n stati\u011fine zarar vermemesi gerekir. S\u0131rf ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm i\u00e7erisinde kalan (su, elektrik, \u0131s\u0131nma gibi ortak tesisler ile kolon, kiri\u015f, tavan vb. ortak yerlere m\u00fcdahale niteli\u011fi ta\u015f\u0131mayan) ve yap\u0131n\u0131n stati\u011fine zarar vermeyen de\u011fi\u015fiklikler i\u00e7in muvafakat al\u0131nmas\u0131na gerek yoktur. Yap\u0131lan de\u011fi\u015fikliklere sonradan da muvafakat verilmesi ise m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>Mahkemece, al\u0131nan her bir karar\u0131n anayap\u0131n\u0131n g\u00fc\u00e7lendirilmesi i\u015flemleri kapsam\u0131nda de\u011ferlendirilmesi, g\u00fc\u00e7lendirme i\u015flemleri kapsam\u0131nda olmayan kararlar y\u00f6n\u00fcnden tadilat projesine t\u00fcm kat maliklerinin r\u0131zas\u0131n\u0131n bulunup bulunmad\u0131\u011f\u0131 ara\u015ft\u0131r\u0131larak, t\u00fcm kat maliklerinin r\u0131zas\u0131n\u0131n olmad\u0131\u011f\u0131n\u0131n anla\u015f\u0131lmas\u0131 halinde, mahallinde ke\u015fif yap\u0131larak anata\u015f\u0131nmaz\u0131n mimari projesi yerinde uygulan\u0131p al\u0131nan kararlardan hangilerinin projeye ayk\u0131r\u0131 oldu\u011fu tespit edilerek, oybirli\u011fi gerektiren kararlar y\u00f6n\u00fcnden al\u0131nan kararlar\u0131n iptaline, Kat M\u00fclkiyeti Kanununun 19\/2. maddesi gere\u011fince 4\/5 \u00e7o\u011funlu\u011fu gerektiren kararlar y\u00f6n\u00fcnden bu \u00e7o\u011funlu\u011fun sa\u011flan\u0131p sa\u011flanmad\u0131\u011f\u0131 belirlenip sa\u011flanmad\u0131\u011f\u0131n\u0131n belirlenmesi halinde iptaline, ayn\u0131 Kanunun 42. ve 43. maddeleri kapsam\u0131ndaki kararlar y\u00f6n\u00fcnden say\u0131 ve arsa pay\u0131 \u00e7o\u011funlu\u011fu ile al\u0131n\u0131p al\u0131nmad\u0131\u011f\u0131 belirlenip sa\u011flanmad\u0131\u011f\u0131n\u0131n anla\u015f\u0131lmas\u0131 halinde iptaline karar verilmesi gerekirken, yetersiz ara\u015ft\u0131rma ve eksik incelemeyle h\u00fck\u00fcm kurulmas\u0131 do\u011fru g\u00f6r\u00fclmemi\u015ftir.<\/p>\n<p>SONU\u00c7: Yukar\u0131da a\u00e7\u0131klanan nedenlerle, davac\u0131 vekilinin temyiz itirazlar\u0131n\u0131n kabul\u00fc ile h\u00fckm\u00fcn BOZULMASINA, temyiz harc\u0131n\u0131n istek halinde iadesine 09\/04\/2019 g\u00fcn\u00fc oy birli\u011fi ile karar verildi.<\/p>\n<p>&#8212;<\/p>\n<p>&#8211; KAT M\u00dcLK\u0130YET\u0130 KANUNUNA DAYALI ELATMANIN \u00d6NLENMES\u0130 VE ESK\u0130 HALE GET\u0130RME DAVASI<br \/>\n&#8211; ORTAK YERE MONTE ED\u0130LEN KL\u0130MA MOTORUNUN S\u00d6K\u00dcLMES\u0130 TALEB\u0130<\/p>\n<p>&#8211; KAT M\u00dcLK\u0130YET\u0130 KANUNU (634) Madde 19<\/p>\n<p>II &#8211; Anagayrimenkul\u00fcn bak\u0131m\u0131, korunmas\u0131 ve zarardan sorumluluk:<\/p>\n<p>Madde 19 \u2013\u00a0Kat malikleri, anagayrimenkul\u00fcn bak\u0131m\u0131na ve mimar\u0131 durumu ile g\u00fczelli\u011fini ve sa\u011flaml\u0131\u011f\u0131n\u0131 titizlikle korumaya mecburdurlar.<\/p>\n<p>(De\u011fi\u015fik ikinci f\u0131kra: 14\/11\/2007-5711\/8 md.)\u00a0Kat maliklerinden biri, b\u00fct\u00fcn kat maliklerinin be\u015fte d\u00f6rd\u00fcn\u00fcn yaz\u0131l\u0131 r\u0131zas\u0131 olmad\u0131k\u00e7a anagayrimenkul\u00fcn ortak yerlerinde in\u015faat, onar\u0131m ve tesisler, de\u011fi\u015fik renkte d\u0131\u015f badana veya boya yapt\u0131ramaz. Ancak, ortak yer ve tesislerdeki bir bozuklu\u011fun anayap\u0131ya veya ba\u011f\u0131ms\u0131z bir b\u00f6l\u00fcme veya b\u00f6l\u00fcmlere zarar verdi\u011finin ve acilen onar\u0131lmas\u0131 gerekti\u011finin veya anayap\u0131n\u0131n g\u00fc\u00e7lendirilmesinin zorunlu oldu\u011funun mahkemece tespit edilmi\u015f olmas\u0131 halinde, bu onar\u0131m ve g\u00fc\u00e7lendirmenin projesine ve tekni\u011fine uygun bi\u00e7imde yap\u0131lmas\u0131 konusunda kat maliklerinin r\u0131zas\u0131 aranmaz. Kat maliki kendi ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcnde anayap\u0131ya zarar verecek nitelikte onar\u0131m, tesis ve de\u011fi\u015fiklik yapamaz. Tavan, taban veya duvar ile birbirine ba\u011flant\u0131l\u0131 bulunan ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin ba\u011flant\u0131l\u0131 yerlerinde, bu b\u00f6l\u00fcm maliklerinin ortak r\u0131zas\u0131 ile anayap\u0131ya zarar vermeyecek onar\u0131m, tesis ve de\u011fi\u015fiklik yap\u0131labilir.<\/p>\n<p>Her kat maliki anagayrimenkule ve di\u011fer ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlere, kusuru ile verdi\u011fi zarardan dolay\u0131 di\u011fer kat maliklerine kar\u015f\u0131 sorumludur.<\/p>\n<p>T.C.<\/p>\n<p>Yarg\u0131tay\u00a0<\/p>\n<p>Hukuk Genel Kurulu<\/p>\n<p>2013\/1466 E., 2015\/42 K.<\/p>\n<p>&#8220;\u0130\u00e7tihat Metni&#8221;<\/p>\n<p>Taraflar aras\u0131ndaki \u201ceski hale getirme\u201d davas\u0131ndan dolay\u0131 yap\u0131lan yarg\u0131lama sonunda; Manisa 2. Sulh Hukuk Mahkemesince davan\u0131n k\u0131smen kabul\u00fcne dair verilen 14.06.2012 g\u00fcn ve 2011\/1084 E. 2012\/537 K.say\u0131l\u0131 karar\u0131n incelenmesi taraf vekillerince istenilmesi \u00fczerine, Yarg\u0131tay 18.Hukuk Dairesi\u2019nin 22.11.2012 g\u00fcn ve 2012\/11547 E- 2012\/13130 K. say\u0131l\u0131 ilam\u0131 ile;<\/p>\n<p>(&#8230;Dosyadaki yaz\u0131lara, karar\u0131n dayand\u0131\u011f\u0131 kan\u0131tlarla yasal gerektirici nedenlere ve \u00f6zellikle kan\u0131tlar\u0131n takdirinde bir isabetsizlik g\u00f6r\u00fclmemesine g\u00f6re sair temyiz itirazlar\u0131 yerinde de\u011fildir.<\/p>\n<p>Ancak;<\/p>\n<p>Dosya i\u00e7indeki bilgi ve belgelerden, yarg\u0131lama s\u0131ras\u0131nda yerinde yap\u0131lan bilirki\u015fi incelemesi sonucu d\u00fczenlenen rapor i\u00e7eri\u011finden; kat m\u00fclkiyeti kurulu anata\u015f\u0131nmazda davac\u0131 ve daval\u0131 taraf\u0131n ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm maliki oldu\u011fu, daval\u0131 taraf\u0131ndan klima d\u0131\u015f \u00fcnitesinin zemin katla 1. kat aras\u0131nda bulunan zemin kata ait kiri\u015f sistemine monte edildi\u011fi anla\u015f\u0131lmaktad\u0131r. Ortak yere klima d\u0131\u015f \u00fcnitesinin monte edilmesinin 634 Say\u0131l\u0131 Kat M\u00fclkiyeti Yasas\u0131n\u0131n 19. maddesinin ikinci f\u0131kras\u0131na ayk\u0131r\u0131 oldu\u011fu dikkate al\u0131narak, mahkemece ortak yere m\u00fcdahalenin \u00f6nlenmesi ile klima d\u0131\u015f \u00fcnitesinin kald\u0131r\u0131lmas\u0131na karar verilmesi gerekirken yaz\u0131l\u0131 gerek\u00e7e ile bu y\u00f6nden davan\u0131n reddi yolunda h\u00fck\u00fcm kurulmas\u0131 do\u011fru g\u00f6r\u00fclmemi\u015ftir.<br \/>\nBu itibarla yukar\u0131da a\u00e7\u0131klanan esaslar g\u00f6z\u00f6n\u00fcnde tutulmaks\u0131z\u0131n yaz\u0131l\u0131 \u015fekilde h\u00fck\u00fcm tesisi isabetsizdir&#8230;.) gerek\u00e7esi ile bozularak dosya yerine geri \u00e7evrilmekle yeniden yap\u0131lan yarg\u0131lama sonunda, mahkemece \u00f6nceki kararda direnilmi\u015ftir.<\/p>\n<p>HUKUK GENEL KURULU KARARI<\/p>\n<p>Hukuk Genel Kurulunca incelenerek direnme karar\u0131n\u0131n s\u00fcresinde temyiz edildi\u011fi anla\u015f\u0131ld\u0131ktan ve dosyadaki ka\u011f\u0131tlar okunduktan sonra gere\u011fi g\u00f6r\u00fc\u015f\u00fcld\u00fc:<\/p>\n<p>Dava, 634 say\u0131l\u0131 Kat M\u00fclkiyeti Kanunu\u2019na dayal\u0131 el atman\u0131n \u00f6nlenmesi ve eski hale getirme istemine ili\u015fkindir.<\/p>\n<p>Davac\u0131, daval\u0131ya ait dairenin balkon ve pencerelerine yap\u0131lan demir parmakl\u0131klar\u0131n, Belediyece yap\u0131lan uyar\u0131ya ra\u011fmen 634 say\u0131l\u0131 Kat M\u00fclkiyeti Kanunu\u2019na uygun hale getirilmedi\u011fi gibi, daval\u0131 taraf\u0131ndan klima motorunun da apartman\u0131n ortak alan\u0131na konuldu\u011funu ve kald\u0131r\u0131lmas\u0131 gerekti\u011fini ileri s\u00fcrerek, daval\u0131n\u0131n ortak yere haks\u0131z m\u00fcdahalesinin \u00f6nlenmesini; Kat M\u00fclkiyeti Kanununun 19. maddesinin ikinci bendi gere\u011fince kat maliklerinden biri b\u00fct\u00fcn kat maliklerinin be\u015fte d\u00f6rd\u00fcn\u00fcn yaz\u0131l\u0131 r\u0131zas\u0131 olmad\u0131k\u00e7a anata\u015f\u0131nmaz\u0131n ortak yerlerinde in\u015faat, onar\u0131m ve tesisler yapt\u0131ramaz. Ortak yerin kullan\u0131m\u0131n\u0131n y\u00f6netim plan\u0131 veya projesi ile bir veya bir ka\u00e7 kat malikine b\u0131rak\u0131lmas\u0131 m\u00fcmk\u00fcn ise de, bu kullan\u0131m hakk\u0131 o kat malikine ortak yeri oldu\u011fu gibi kullanma hakk\u0131 verece\u011finden bu yerde yeni tesis ve de\u011fi\u015fiklikler yapma hakk\u0131 vermez.
