Ekli (2) Say\u0131l\u0131 Liste\u2019de yer alan kadrolar\u0131n ihdas edilerek (2) numaral\u0131 Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnamesi\u2019nin eki (I) Say\u0131l\u0131 Cetvel\u2019e Kentsel D\u00f6n\u00fc\u015f\u00fcm Ba\u015fkanl\u0131\u011f\u0131 b\u00f6l\u00fcm\u00fc olarak eklenmesinin,<\/p>\n<p>Anayasa\u2019n\u0131n Ba\u015flang\u0131\u00e7 k\u0131sm\u0131 ile 2., 6., 7., 8., 11., 104., 123., 127., 128., 153. ve 161. maddelerine ayk\u0131r\u0131l\u0131\u011f\u0131 ileri s\u00fcr\u00fclerek iptallerine ve y\u00fcr\u00fcrl\u00fcklerinin durdurulmas\u0131na karar verilmesi talebidir.<\/p>\n<p>I. \u0130PTAL\u0130 \u0130STENEN CUMHURBA\u015eKANLI\u011eI KARARNAMES\u0130 KURALLARI<\/p>\n<p>Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnamesi\u2019nin (CBK) iptali talep edilen kurallar\u0131n da yer ald\u0131\u011f\u0131;<\/p>\n<p>A. 3. maddesiyle (1) numaral\u0131 CBK\u2019n\u0131n 100. maddesinin (e) ve (f) bentlerinin eklendi\u011fi (1) numaral\u0131 f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>\u00a0\u201cYerel Y\u00f6netimler Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc<\/p>\n<p>MADDE 100 \u2013 (1) Yerel Y\u00f6netimler Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn g\u00f6rev ve yetkileri \u015funlard\u0131r:<\/p>\n<p>a) Mahalli idarelerin i\u015f ve i\u015flemlerine dair mevzuatla verilen g\u00f6rev ve hizmetleri yapmak, takip etmek, sonu\u00e7land\u0131rmak ve geli\u015ftirmek,<\/p>\n<p>b) Mahalli idare yat\u0131r\u0131m ve hizmetlerinin kalk\u0131nma planlar\u0131 ile y\u0131ll\u0131k programlara uygun \u015fekilde yap\u0131lmas\u0131n\u0131 g\u00f6zetmek,<\/p>\n<p>c) Mahalli idarelerin geli\u015ftirilmesi amac\u0131yla ara\u015ft\u0131rmalar yapmak, istatistiki bilgileri toplamak, de\u011ferlendirmek ve yay\u0131mlamak,<\/p>\n<p>\u00e7) Mahalli idareler personelinin hizmet i\u00e7i e\u011fitimini planlamak ve uygulanmas\u0131n\u0131 takip etmek,<\/p>\n<p>d) Mahalli idarelerin te\u015fkilat, ara\u00e7 ve kadro standartlar\u0131n\u0131 tespit etmek,<\/p>\n<p>e) (Ek:RG-16\/10\/2023-32341-C.K-153\/3 md.) Mahalli idarelerin altyap\u0131 sistemleri ile ilgili genel planlama, programlama, fizibilite, projelendirme, i\u015fletme, finansman ihtiyac\u0131 ve yat\u0131r\u0131m \u00f6nceliklerine; teknik altyap\u0131 tesislerinin mek\u00e2nsal strateji planlar\u0131 ile \u00e7evre d\u00fczeni ve imar planlar\u0131na uygun olarak planlanmas\u0131na, projelendirilmesine ve yap\u0131lmas\u0131na ili\u015fkin usul ve esaslar ile bu konulardaki her t\u00fcrl\u00fc et\u00fct, proje, yap\u0131 ruhsat\u0131 ve yap\u0131 kullanma iznine ili\u015fkin usul ve esaslar\u0131 belirlemek,<\/p>\n<p>f) (Ek:RG-16\/10\/2023-32341-C.K-153\/3 md.) Teknik altyap\u0131 tesisleri ve altyap\u0131 birlikleri kurulmas\u0131 konusunda mahalli idareler aras\u0131nda i\u015fbirli\u011fi ve koordinasyonu sa\u011flamak, rehberlikte bulunmak ve teknik altyap\u0131 tesislerine ili\u015fkin envanteri tutmak,<\/p>\n<p>g) (M\u00fclga: RG-15\/7\/2018-30479 &#8211; CK-4\/799 md.)<\/p>\n<p>\u011f) Bakan taraf\u0131ndan verilen di\u011fer g\u00f6revleri yapmak.\u201d<\/p>\n<p>B. 4. maddesiyle (1) numaral\u0131 CBK\u2019n\u0131n 105. maddesinin (e) bendinin eklendi\u011fi (1) numaral\u0131 f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>\u00a0\u201cYap\u0131 \u0130\u015fleri Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc<\/p>\n<p>MADDE 105 \u2013 (1) Yap\u0131 \u0130\u015fleri Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn g\u00f6rev ve yetkileri \u015funlard\u0131r:<\/p>\n<p>a) Kamu kurum ve kurulu\u015flar\u0131na ait her t\u00fcrl\u00fc yap\u0131lar ile ilgili genel ilkeleri, stratejileri ve standartlar\u0131 belirlemek ve uygulanmas\u0131n\u0131 sa\u011flamak,<\/p>\n<p>b) Kamu yat\u0131r\u0131mlar\u0131n\u0131n projeleri ve yap\u0131mla ilgili i\u015f ve i\u015flemlere ili\u015fkin usul ve esaslar ile et\u00fct ve projelerin niteliklerini belirlemek ve uygulanmas\u0131n\u0131 sa\u011flamak,<\/p>\n<p>c) 97 nci maddenin birinci f\u0131kras\u0131n\u0131n (e) bendi ile Bakanl\u0131\u011fa verilen g\u00f6revleri y\u00fcr\u00fctmek,<\/p>\n<p>\u00e7) 5543 say\u0131l\u0131 \u0130skan Kanunu ile Bakanl\u0131\u011fa verilen g\u00f6revleri yapmak,<\/p>\n<p>d) 5543 say\u0131l\u0131 Kanun uyar\u0131nca daimi isk\u00e2n i\u00e7in kamu kurum ve kurulu\u015flar\u0131nca yapt\u0131r\u0131lacak her t\u00fcrl\u00fc yap\u0131lara ve konutlara ili\u015fkin et\u00fct ve planlama i\u015flerini yapmak veya yapt\u0131rmak, onaylamak veya onaylanmas\u0131n\u0131 sa\u011flamak, daimi isk\u00e2n i\u00e7in yapt\u0131r\u0131lacak her t\u00fcrl\u00fc yap\u0131lar\u0131n in\u015faatlar\u0131n\u0131 yapmak veya yapt\u0131rmak,<\/p>\n<p>e) (Ek:RG-16\/10\/2023-32341-C.K-153\/4 md.) 97 nci maddenin birinci f\u0131kras\u0131n\u0131n (\u011f) bendi kapsam\u0131ndaki taraf\u0131ndan verilen di\u011fer g\u00f6revleri yapmak.\u201d<\/p>\n<p>C. 6. maddesiyle (4) numaral\u0131 CBK\u2019ya eklenen 792\/M maddesi \u015f\u00f6yledir:<\/p>\n<p>\u00a0\u201cBa\u015fkanl\u0131\u011f\u0131n g\u00f6rev ve yetkileri<\/p>\n<p>MADDE 792\/M- (1) Ba\u015fkanl\u0131\u011f\u0131n g\u00f6rev ve yetkileri \u015funlard\u0131r:<\/p>\n<p>a) 6306 say\u0131l\u0131 Kanun ile verilen g\u00f6revleri yapmak ve yetkileri kullanmak. <\/p>\n<p>b) Afet riski alt\u0131ndaki yap\u0131lar\u0131n ve alanlar\u0131n d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesine ili\u015fkin mevzuat\u0131 haz\u0131rlamak.<\/p>\n<p>c) 3\/7\/2005 tarihli ve 5393 say\u0131l\u0131 Belediye Kanununun 73 \u00fcnc\u00fc maddesi kapsam\u0131ndaki uygulamalara ili\u015fkin kentsel d\u00f6n\u00fc\u015f\u00fcm ve geli\u015fim alan\u0131 ilan\u0131 ile 16\/6\/2005 tarihli ve 5366 say\u0131l\u0131 Y\u0131pranan Tarihi ve K\u00fclt\u00fcrel Ta\u015f\u0131nmaz Varl\u0131klar\u0131n Yenilenerek Korunmas\u0131 ve Ya\u015fat\u0131larak Kullan\u0131lmas\u0131 Hakk\u0131nda Kanun kapsam\u0131ndaki yenileme alan\u0131 ilan\u0131na ili\u015fkin gerekli haz\u0131rl\u0131k i\u015flemlerini y\u00fcr\u00fctmek.<\/p>\n<p>\u00e7) Bakan taraf\u0131ndan verilen di\u011fer g\u00f6revleri yapmak.\u201d<\/p>\n<p>\u00c7. 6. maddesiyle (4) numaral\u0131 CBK\u2019ya eklenen 792\/O maddesi \u015f\u00f6yledir:<\/p>\n<p>\u00a0\u201cBa\u015fkan yard\u0131mc\u0131lar\u0131<\/p>\n<p>MADDE 792\/O- (1) Ba\u015fkanl\u0131\u011f\u0131n g\u00f6revlerini y\u00fcr\u00fctmede Ba\u015fkana yard\u0131mc\u0131 olmak, Ba\u015fkan taraf\u0131ndan verilen g\u00f6revleri yapmak ve gerekti\u011finde Ba\u015fkana vek\u00e2let etmek \u00fczere iki Ba\u015fkan Yard\u0131mc\u0131s\u0131 atanabilir.\u201d<\/p>\n<p>D. 7. maddesi \u015f\u00f6yledir:<\/p>\n<p>\u00a0\u201cMADDE 7- Ekli (1) say\u0131l\u0131 listede yer Anayasa\u2019n\u0131n 104. maddesinin on yedinci f\u0131kras\u0131n\u0131n \u00fc\u00e7\u00fcnc\u00fc c\u00fcmlesinde Anayasa\u2019da m\u00fcnhas\u0131ran kanunla d\u00fczenlenmesi \u00f6ng\u00f6r\u00fclen konularda CBK \u00e7\u0131kar\u0131lamayaca\u011f\u0131 h\u00fckm\u00fcne yer verilmi\u015ftir. Anayasa koyucunun bir konunun kanunla d\u00fczenlenmesini \u00f6zel olarak \u00f6ng\u00f6rmesi bu alan\u0131n m\u00fcnhas\u0131ran kanunla d\u00fczenlenmesini istedi\u011fi anlam\u0131na gelir. Bu kapsamda Anayasa bir konunun kanunla d\u00fczenlenece\u011fini \u00f6ng\u00f6rm\u00fc\u015fse bu konuda CBK \u00e7\u0131kar\u0131lamaz. Bununla birlikte Anayasa\u2019da CBK\u2019larla d\u00fczenlenece\u011fi \u00f6zel olarak \u00f6ng\u00f6r\u00fclen konulara ili\u015fkin Anayasa h\u00fck\u00fcmlerinin a\u00e7\u0131k\u00e7a izin verdi\u011fi hususlarda CBK\u2019larla d\u00fczenleme yap\u0131labilir (AYM, E.2021\/88, K.2021\/105, 30\/12\/2021, \u00a7 17; E.2019\/105, K.2020\/30, 12\/6\/2020, \u00a7 19).<\/p>\n<p>11. Anayasa\u2019n\u0131n 123. maddesinde idarenin kurulu\u015f ve g\u00f6revleriyle bir b\u00fct\u00fcn oldu\u011fu ve kanunla d\u00fczenlenece\u011fi \u00f6ng\u00f6r\u00fcld\u00fckten sonra idarenin kurulu\u015f ve g\u00f6revlerinin merkezden y\u00f6netim ve yerinden y\u00f6netim esaslar\u0131na dayand\u0131\u011f\u0131 h\u00fckme ba\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>12. Anayasa\u2019n\u0131n 127. maddesinin birinci f\u0131kras\u0131nda mahall\u00ee idarelerin il, belediye veya k\u00f6y halk\u0131n\u0131n mahall\u00ee m\u00fc\u015fterek ihtiya\u00e7lar\u0131n\u0131 kar\u015f\u0131lamak \u00fczere kurulu\u015f esaslar\u0131 kanunla belirtilen ve karar organlar\u0131 kanunda g\u00f6sterilen se\u00e7menler taraf\u0131ndan se\u00e7ilerek olu\u015fturulan kamu t\u00fczel ki\u015fileri olduklar\u0131; ikinci f\u0131kras\u0131nda mahall\u00ee idarelerin kurulu\u015f ve g\u00f6revleri ile yetkilerinin, yerinden y\u00f6netim ilkesine uygun olarak kanunla d\u00fczenlenece\u011fi; be\u015finci f\u0131kras\u0131nda merkez\u00ee idarenin, mahall\u00ee idareler \u00fczerinde, mahall\u00ee hizmetlerin idarenin b\u00fct\u00fcnl\u00fc\u011f\u00fc ilkesine uygun \u015fekilde y\u00fcr\u00fct\u00fclmesi, kamu g\u00f6revlerinde birli\u011fin sa\u011flanmas\u0131, toplum yarar\u0131n\u0131n korunmas\u0131 ve mahall\u00ee ihtiya\u00e7lar\u0131n gere\u011fi gibi kar\u015f\u0131lanmas\u0131 amac\u0131yla kanunda belirtilen esas ve usuller dairesinde idari vesayet yetkisine sahip oldu\u011fu; alt\u0131nc\u0131 f\u0131kras\u0131nda ise mahall\u00ee idarelerin belirli kamu hizmetlerinin g\u00f6r\u00fclmesi amac\u0131 ile kendi aralar\u0131nda Cumhurba\u015fkan\u0131n\u0131n izni ile birlik kurmalar\u0131n\u0131n, g\u00f6revlerinin, yetkilerinin, maliye ve kolluk i\u015flerinin ve merkez\u00ee idare ile kar\u015f\u0131l\u0131kl\u0131 ba\u011f ve ilgilerinin kanunla d\u00fczenlenece\u011fi belirtilmi\u015ftir.<\/p>\n<p>13. Anayasa\u2019n\u0131n 123. maddesinde d\u00fczenlenen idarenin b\u00fct\u00fcnl\u00fc\u011f\u00fc ilkesiyle idari g\u00f6revleri yerine getiren kurumlar aras\u0131nda birli\u011fin sa\u011flanmas\u0131 ve idari yap\u0131 i\u00e7inde yer alan kurumlar\u0131n bir b\u00fct\u00fcnl\u00fck i\u00e7inde \u00e7al\u0131\u015fmas\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. \u0130darenin b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc sa\u011flamak i\u00e7in hiyerar\u015fi ve idari vesayet olmak \u00fczere ba\u015fl\u0131ca iki hukuksal ara\u00e7 kullan\u0131lmaktad\u0131r. Yerinden y\u00f6netim kurulu\u015flar\u0131, yerel ve hizmet yerinden y\u00f6netim kurulu\u015flar\u0131 olarak ikiye ayr\u0131lmaktad\u0131r. Yerel yerinden y\u00f6netim kurulu\u015flar\u0131 olan mahall\u00ee idareler, Anayasa\u2019n\u0131n 127. maddesinde d\u00fczenlenmi\u015f ve bunlara tan\u0131nan idari ve mali \u00f6zerkli\u011fin kapsam\u0131 g\u00f6sterilmi\u015ftir. An\u0131lan maddenin be\u015finci f\u0131kras\u0131nda d\u00fczenlenen idari vesayet yetkisi yerel y\u00f6netimlere tan\u0131nan ve g\u00fcvence alt\u0131na al\u0131nan \u00f6zerkli\u011fin istisnas\u0131n\u0131 olu\u015fturmakta olup kanunla \u00e7er\u00e7evesi \u00e7izilen s\u0131n\u0131rlar i\u00e7inde kullan\u0131lmas\u0131 gereken istisnai bir yetkidir. \u0130stisnailik ve kanunilik idari vesayetin en belirgin iki temel \u00f6zelli\u011fidir (AYM, E.2011\/100, K.2012\/191, 29\/11\/2012). Buna g\u00f6re Anayasa\u2019da belirtilen ama\u00e7 ve \u00e7er\u00e7eve i\u00e7inde kalmak ko\u015fuluyla bu yetkinin kapsam ve s\u0131n\u0131r\u0131n\u0131 belirleme yetkisi kanun koyucuya aittir.<\/p>\n<p>15. \u00d6te yandan Anayasa\u2019n\u0131n 127. maddesinde kanunla d\u00fczenlenmesi \u00f6ng\u00f6r\u00fclen konular merkez\u00ee idarenin mahall\u00ee idareler \u00fczerinde sahip oldu\u011fu idari vesayet yetkisine ili\u015fkin esas ve usullerle s\u0131n\u0131rl\u0131 de\u011fildir. An\u0131lan maddede mahall\u00ee idarelerin kurulu\u015flar\u0131n\u0131n, karar organlar\u0131n\u0131n, g\u00f6revlerinin, yetkilerinin ve merkez\u00ee idare ile kar\u015f\u0131l\u0131kl\u0131 ba\u011f ve ili\u015fkilerinin de kanunla belirlenmesi g\u00fcvencesi getirilmi\u015ftir.<\/p>\n<p>16. Anayasa\u2019da merkez\u00ee y\u00f6netim ve yerel y\u00f6netim ayr\u0131m\u0131n\u0131n yap\u0131lmas\u0131, yerel y\u00f6netimlerin organlar\u0131n\u0131n se\u00e7imle g\u00f6reve gelmesinin \u00f6ng\u00f6r\u00fclmesi, se\u00e7imlerinin s\u00fcreli olmas\u0131, kararlar\u0131n\u0131 kendi organlar\u0131 eliyle almas\u0131 ve uygulatmas\u0131, kendilerine \u00f6zg\u00fc b\u00fct\u00e7elerinin bulunmas\u0131, g\u00f6revleri ile orant\u0131l\u0131 gelir kaynaklar\u0131n\u0131n sa\u011flanmas\u0131 gibi yetki ve ayr\u0131cal\u0131klar\u0131n tan\u0131nm\u0131\u015f olmas\u0131 mahall\u00ee idarelerin \u00f6zerkliklerinin g\u00f6stergesidir (AYM, E.2019\/112, K.2020\/35, 25\/6\/2020, \u00a7 30).<\/p>\n<p>17. \u00d6zerklik, ki\u015fi ve kurulu\u015flar\u0131n kanunla belirlenen s\u0131n\u0131rlar i\u00e7inde kalmak \u015fart\u0131yla kendi faaliyetlerine ili\u015fkin kararlar\u0131 alma ve uygulama konusunda gerekli yetkiyle donat\u0131lm\u0131\u015f olmas\u0131 anlam\u0131na gelmektedir. Bu ayn\u0131 zamanda kurumlar\u0131n d\u0131\u015f etkilere kar\u015f\u0131 korunmas\u0131n\u0131 ifade eder. Kamu kurulu\u015flar\u0131na \u00f6zerklik tan\u0131nmas\u0131n\u0131n nedeni faaliyetlerini hizmetin gereklerine ve kamu yarar\u0131na uygun bir \u015fekilde s\u00fcrd\u00fcrmelerini g\u00fcvence alt\u0131na almakt\u0131r (AYM, E.2019\/112, K.2020\/35, 25\/6\/2020, \u00a7 31).<\/p>\n<p>18. An\u0131lan CBK\u2019n\u0131n 792\/\u0130 maddesinde Kentsel D\u00f6n\u00fc\u015f\u00fcm Ba\u015fkanl\u0131\u011f\u0131n\u0131n (Ba\u015fkanl\u0131k) afet riski alt\u0131ndaki alanlar ile bu alanlar d\u0131\u015f\u0131ndaki riskli yap\u0131lar\u0131n bulundu\u011fu arsa ve arazilerde kentsel d\u00f6n\u00fc\u015f\u00fcm uygulamalar\u0131n\u0131 y\u00fcr\u00fctmek \u00fczere kuruldu\u011fu belirtilmi\u015f, 792\/K maddesinde de Ba\u015fkanl\u0131\u011f\u0131n kamu t\u00fczel ki\u015fili\u011fini haiz, \u00f6zel b\u00fct\u00e7eli ve Bakanl\u0131\u011fa ba\u011fl\u0131 oldu\u011fu h\u00fckme ba\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>32. Dava konusu kuralda 5393 say\u0131l\u0131 Kanun\u2019un 73. maddesi kapsam\u0131ndaki uygulamalara ili\u015fkin kentsel d\u00f6n\u00fc\u015f\u00fcm ve geli\u015fim alan\u0131 ilan\u0131 ile 16\/6\/2005 tarihli ve 5366 say\u0131l\u0131 Y\u0131pranan Tarihi ve K\u00fclt\u00fcrel Ta\u015f\u0131nmaz Varl\u0131klar\u0131n Yenilenerek Korunmas\u0131 ve Ya\u015fat\u0131larak Kullan\u0131lmas\u0131 Hakk\u0131nda Kanun kapsam\u0131ndaki yenileme alan\u0131 ilan\u0131na ili\u015fkin gerekli haz\u0131rl\u0131k i\u015flemlerini y\u00fcr\u00fctmek Ba\u015fkanl\u0131\u011f\u0131n g\u00f6rev ve yetkileri aras\u0131nda say\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>33. 5393 say\u0131l\u0131 Kanun\u2019un 73. maddesinin birinci f\u0131kras\u0131nda konut alanlar\u0131, sanayi alanlar\u0131, ticaret alanlar\u0131, teknoloji parklar\u0131, kamu hizmeti alanlar\u0131, rekreasyon alanlar\u0131 ve her t\u00fcrl\u00fc sosyal donat\u0131 alanlar\u0131 olu\u015fturmak, eskiyen kent k\u0131s\u0131mlar\u0131n\u0131 yeniden in\u015fa ve restore etmek, kentin tarih\u00ee ve k\u00fclt\u00fcrel dokusunu korumak veya deprem riskine kar\u015f\u0131 tedbirler almak amac\u0131yla kentsel d\u00f6n\u00fc\u015f\u00fcm ve geli\u015fim projeleri uygulama yetkisi belediyelere verilmi\u015ftir. S\u00f6z konusu yetki belediye meclisi taraf\u0131ndan al\u0131nan karar arac\u0131l\u0131\u011f\u0131yla kullan\u0131lmaktad\u0131r. Kamunun m\u00fclkiyetinde veya kullan\u0131m\u0131nda olan yerlerde kentsel d\u00f6n\u00fc\u015f\u00fcm ve geli\u015fim proje alan\u0131 ilan edilebilmesi ve uygulama yap\u0131labilmesi i\u00e7in ise ilgili belediyenin talebi ve Cumhurba\u015fkan\u0131nca bu y\u00f6nde karar al\u0131nmas\u0131 \u015fart\u0131 aranmaktad\u0131r.<\/p>\n<p>34. An\u0131lan maddenin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131na g\u00f6re b\u00fcy\u00fck\u015fehir belediye ve m\u00fccavir alan s\u0131n\u0131rlar\u0131 i\u00e7inde kentsel d\u00f6n\u00fc\u015f\u00fcm ve geli\u015fim projesi alan\u0131 ilan etmeye ise b\u00fcy\u00fck\u015fehir belediyeleri yetkilidir. B\u00fcy\u00fck\u015fehir belediye meclisince uygun g\u00f6r\u00fclmesi h\u00e2linde il\u00e7e belediyeleri kendi s\u0131n\u0131rlar\u0131 i\u00e7inde kentsel d\u00f6n\u00fc\u015f\u00fcm ve geli\u015fim projeleri uygulayabilmektedir.<\/p>\n<p>35. Kural\u0131n at\u0131fta bulundu\u011fu 5366 say\u0131l\u0131 Kanun\u2019da da y\u0131pranan tarih\u00ee ve k\u00fclt\u00fcrel ta\u015f\u0131nmaz varl\u0131klar\u0131n yenilenerek korunmas\u0131 ve ya\u015fat\u0131larak kullan\u0131lmas\u0131na ili\u015fkin hususlar d\u00fczenlenmektedir. An\u0131lan Kanun\u2019un 1. maddesinde Kanun\u2019un amac\u0131, b\u00fcy\u00fck\u015fehir belediyeleri, b\u00fcy\u00fck\u015fehir belediyeleri s\u0131n\u0131rlar\u0131 i\u00e7indeki il\u00e7e ve ilk kademe belediyeleri, il ve il\u00e7e belediyeleri ve n\u00fcfusu 50.000&#8217;in \u00fczerindeki belediyelerce ve bu belediyelerin yetki alan\u0131 d\u0131\u015f\u0131nda il \u00f6zel idarelerince, y\u0131pranan ve \u00f6zelli\u011fini kaybetmeye y\u00fcz tutmu\u015f, k\u00fclt\u00fcr ve tabiat varl\u0131klar\u0131n\u0131 koruma kurullar\u0131nca sit alan\u0131 olarak tescil ve ilan edilen b\u00f6lgeler ile bu b\u00f6lgelere ait koruma alanlar\u0131n\u0131n, b\u00f6lgenin geli\u015fimine uygun olarak yeniden in\u015fa ve restore edilerek bu b\u00f6lgelerde konut, ticaret, k\u00fclt\u00fcr, turizm ve sosyal donat\u0131 alanlar\u0131 olu\u015fturulmas\u0131, tabi\u00ee afet riskine kar\u015f\u0131 tedbirler al\u0131nmas\u0131, tarih\u00ee ve k\u00fclt\u00fcrel ta\u015f\u0131nmaz varl\u0131klar\u0131n yenilenerek korunmas\u0131 ve ya\u015fat\u0131larak kullan\u0131lmas\u0131 olarak ifade edilmi\u015ftir.<\/p>\n<p>36. Kanun\u2019un 2. maddesinin birinci f\u0131kras\u0131nda belirtilen ama\u00e7lar do\u011frultusunda olu\u015fturulacak olan yenileme alanlar\u0131n\u0131n; il \u00f6zel idarelerinde il genel meclisinin ve belediyelerde belediye meclisinin \u00fcye tam say\u0131s\u0131n\u0131n salt \u00e7o\u011funlu\u011funun karar\u0131 ile belirlenmesi \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. \u0130l \u00f6zel idaresinde il genel meclisince ve b\u00fcy\u00fck\u015fehirler d\u0131\u015f\u0131ndaki belediyelerde belediye meclisince bu konuda al\u0131nan kararlar do\u011frudan; b\u00fcy\u00fck\u015fehirlerde ise il\u00e7e belediye meclislerince al\u0131nan kararlar b\u00fcy\u00fck\u015fehir belediye meclisince onayland\u0131ktan sonra Cumhurba\u015fkan\u0131na sunulmaktad\u0131r. B\u00f6ylece kuralla an\u0131lan Kanunlar uyar\u0131nca mahall\u00ee idarelerce y\u00fcr\u00fct\u00fclen kentsel d\u00f6n\u00fc\u015f\u00fcm ve geli\u015fim alanlar\u0131 ile yenileme alanlar\u0131n\u0131n belirlenmesi ve bu alanlar\u0131n ilan edilmesine y\u00f6nelik s\u00fcre\u00e7lere merkez\u00ee idare taraf\u0131ndan d\u0131\u015far\u0131dan m\u00fcdahalede bulunulmas\u0131na imk\u00e2n tan\u0131nmaktad\u0131r. Bu itibarla kural\u0131n yerel y\u00f6netimlere tan\u0131nan idari \u00f6zerkli\u011fin istisnas\u0131n\u0131 olu\u015fturan idari vesayet yetkisine ve mahall\u00ee idarelerin merkez\u00ee idare ile kar\u015f\u0131l\u0131kl\u0131 ili\u015fkilerine ili\u015fkin d\u00fczenleme i\u00e7erdi\u011fi anla\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>41. Dolay\u0131s\u0131yla CBK\u2019n\u0131n 3. maddesiyle (1) numaral\u0131 CBK\u2019n\u0131n 100. maddesinin (1) numaral\u0131 f\u0131kras\u0131na eklenen (e) bendinin Anayasa\u2019ya uygunluk denetimi b\u00f6l\u00fcm\u00fcnde belirtilen gerek\u00e7eler dava konusu kural y\u00f6n\u00fcnden de ge\u00e7erlidir. Anayasa Mahkemesinin yerle\u015fik kararlar\u0131na g\u00f6re an\u0131lan ilke, yasal d\u00fczenlemelerin hem ki\u015filer hem de idare y\u00f6n\u00fcnden herhangi bir duraksamaya ve ku\u015fkuya yer vermeyecek \u015fekilde a\u00e7\u0131k, net, anla\u015f\u0131l\u0131r, uygulanabilir ve nesnel olmas\u0131n\u0131 gerektirmektedir.<\/p>\n<p>53. An\u0131lan ilkenin y\u00fcr\u00fctmenin asli d\u00fczenleyici i\u015flemi niteli\u011finde olan CBK\u2019lar bak\u0131m\u0131ndan da ge\u00e7erli oldu\u011funda \u015f\u00fcphe bulunmamaktad\u0131r (AYM, E.2018\/125, K.2020\/4, 22\/01\/2020, \u00a7 28).<\/p>\n<p>54. Mahkememiz \u00e7o\u011funlu\u011funun 15\/10\/2023 tarihli ve (153) numaral\u0131 Baz\u0131 Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnamelerinde De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnamesi\u2019nin 7. maddesinin konu bak\u0131m\u0131ndan yetki y\u00f6n\u00fcnden Anayasa\u2019ya ayk\u0131r\u0131 olmad\u0131\u011f\u0131na ve iptal talebinin reddine ili\u015fkin karara kat\u0131lmamaktay\u0131m.<\/p>\n<p>2. \u0130ptali talep edilen Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnamesi h\u00fckm\u00fcnde kadro ihdas\u0131 ve mevcut baz\u0131 kadrolar\u0131n iptali ile ilgili hususlara ili\u015fkin d\u00fczenlemeler yer almaktad\u0131r.<\/p>\n<p>3. Dava konusu kurallar\u0131n \u201ckonu bak\u0131m\u0131ndan yetki\u201d boyutu ile Anayasa\u2019ya uygunluk denetiminde Mahkememiz \u00e7o\u011funlu\u011funca Anayasa\u2019n\u0131n 104. maddesinin onyedinci f\u0131kras\u0131na bir ayk\u0131r\u0131l\u0131k bulunmad\u0131\u011f\u0131 kanaatine ula\u015f\u0131lsa da kurallar\u0131n Anayasa\u2019n\u0131n 104. maddesinin on yedinci f\u0131kras\u0131n\u0131n birinci, ikinci ve \u00fc\u00e7\u00fcnc\u00fc c\u00fcmlelerine ayk\u0131r\u0131 oldu\u011fu i\u00e7in iptali gerekmektedir.<\/p>\n<p>4. Nitekim Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnamesi ile kadro ihdas\u0131 konusunu d\u00fczenleyen bir kurala ili\u015fkin Anayasa Mahkemesinin daha \u00f6nce verdi\u011fi bir kararda bu konunun Cumhurba\u015fkanl\u0131\u011f\u0131 Kararnamesi ile d\u00fczenlenmesinin Anayasa\u2019ya ayk\u0131r\u0131l\u0131k te\u015fkil etti\u011fi g\u00f6r\u00fc\u015f\u00fcnde oldu\u011fumdan Mahkememiz \u00e7o\u011funlu\u011funun iptal isteminin reddi y\u00f6n\u00fcndeki kanaatine kat\u0131lmam\u0131\u015ft\u0131m (Bkz.: E. A\u015fa\u011f\u0131da a\u00e7\u0131klanan nedenlerle bu karara kat\u0131lma imk\u00e2n\u0131 olmam\u0131\u015ft\u0131r.<\/p>\n<p>1. \u00c7o\u011funluk g\u00f6r\u00fc\u015f\u00fcnde iptale konu kurallar ile yap\u0131lan d\u00fczenlemelerin Anayasa\u2019n\u0131n 123. maddesi ve 106. maddesinin on birinci f\u0131kras\u0131 uyar\u0131nca te\u015fkilat yap\u0131s\u0131 kapsam\u0131nda de\u011ferlendirilmesi gerekti\u011fi ve bu y\u00f6n\u00fcyle Anayasa\u2019ya ayk\u0131r\u0131 olmad\u0131\u011f\u0131 sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>2. Yukar\u0131da belirtilen kurallar ile d\u00fczenleme yap\u0131lan kadrolarda g\u00f6rev alacak ki\u015filerin Anayasa\u2019n\u0131n 128. maddesinde belirtilen memur veya di\u011fer kamu g\u00f6revlisi niteli\u011fini haiz olduklar\u0131 dikkate al\u0131nd\u0131\u011f\u0131nda ilgili kadrolara ili\u015fkin kadro ihdas\u0131, kadro iptali ve istihdama y\u00f6nelik d\u00fczenlemelerin kanunla yap\u0131lmas\u0131 gerekti\u011fi a\u00e7\u0131kt\u0131r.<\/p>\n<p>3. Kurallar ile d\u00fczenlemelerin kapsad\u0131\u011f\u0131 ki\u015filerin \u00fcst d\u00fczey kamu y\u00f6neticisi olarak de\u011ferlendirilmesi de m\u00fcmk\u00fcn olmad\u0131\u011f\u0131ndan ilgili d\u00fczenlemelerin Anayasa\u2019n\u0131n 128. (1) numaral\u0131 CBK\u2019n\u0131n 100. maddesinin (1) numaral\u0131 f\u0131kras\u0131na eklenen dava konusu (e) bendinde \u201cMahalli idarelerin altyap\u0131 sistemleri ile ilgili genel planlama, programlama, fizibilite, projelendirme, i\u015fletme, finansman ihtiyac\u0131 ve yat\u0131r\u0131m \u00f6nceliklerine; teknik altyap\u0131 tesislerinin mek\u00e2nsal strateji planlar\u0131 ile \u00e7evre d\u00fczeni ve imar planlar\u0131na uygun olarak planlanmas\u0131na, projelendirilmesine ve yap\u0131lmas\u0131na ili\u015fkin usul ve esaslar ile bu konulardaki her t\u00fcrl\u00fc et\u00fct, proje, yap\u0131 ruhsat\u0131 ve yap\u0131 kullanma iznine ili\u015fkin usul ve esaslar\u0131 belirlemek\u201d; (f) bendinde ise \u201cTeknik altyap\u0131 tesisleri ve altyap\u0131 birlikleri kurulmas\u0131 konusunda mahalli idareler aras\u0131nda i\u015fbirli\u011fi ve koordinasyonu sa\u011flamak, rehberlikte bulunmak ve teknik altyap\u0131 tesislerine ili\u015fkin envanteri tutmak\u201d \u00c7evre, \u015eehircilik ve \u0130klim De\u011fi\u015fikli\u011fi Bakanl\u0131\u011f\u0131n\u0131n (Bakanl\u0131k) hizmet birimlerinden olan Yerel Y\u00f6netimler Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn g\u00f6rev ve yetkileri aras\u0131nda say\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>3. Anayasa\u2019n\u0131n 104. maddesinin on yedinci f\u0131kras\u0131n\u0131n birinci ila d\u00f6rd\u00fcnc\u00fc c\u00fcmleleri uyar\u0131nca CBK\u2019larla yap\u0131lacak d\u00fczenlemelerin konu bak\u0131m\u0131ndan yetki y\u00f6n\u00fcnden; y\u00fcr\u00fctme yetkisine ili\u015fkin olmas\u0131, Anayasa\u2019n\u0131n \u0130kinci K\u0131sm\u0131\u2019n\u0131n Birinci ve \u0130kinci B\u00f6l\u00fcmlerinde yer alan temel haklar, ki\u015fi haklar\u0131 ve \u00f6devleriyle D\u00f6rd\u00fcnc\u00fc B\u00f6l\u00fcm\u00fc\u2019nde yer alan siyasi haklar ve \u00f6devlerle ilgili olmamas\u0131, Anayasa\u2019da m\u00fcnhas\u0131ran kanunla d\u00fczenlenmesi \u00f6ng\u00f6r\u00fclen ya da kanunda a\u00e7\u0131k\u00e7a d\u00fczenlenen konulara ili\u015fkin olmamas\u0131 gerekir.<\/p>\n<p>5. Bakanl\u0131\u011f\u0131n\u0131n ve ba\u011fl\u0131 kurulu\u015funun g\u00f6rev ve yetkilerine ili\u015fkin d\u00fczenlemeler \u00f6ng\u00f6ren kurallar\u0131n y\u00fcr\u00fctme yetkisine ili\u015fkin oldu\u011fu a\u00e7\u0131kt\u0131r.<\/p>\n<p>6. Kurallar, Anayasa\u2019n\u0131n CBK ile d\u00fczenlenmesi yasaklanan \u0130kinci K\u0131sm\u0131\u2019n\u0131n Birinci ve \u0130kinci B\u00f6l\u00fcmlerinde yer alan temel haklar, ki\u015fi haklar\u0131 ve \u00f6devleriyle D\u00f6rd\u00fcnc\u00fc B\u00f6l\u00fcm\u00fc\u2019nde yer alan siyasi haklar ve \u00f6devler ile ilgili herhangi bir d\u00fczenleme i\u00e7ermemektedir.<\/p>\n<p>7. Anayasa\u2019n\u0131n 106. maddesinin on birinci f\u0131kras\u0131nda \u201cBakanl\u0131klar\u0131n kurulmas\u0131, kald\u0131r\u0131lmas\u0131, g\u00f6revleri ve yetkileri, te\u015fkilat yap\u0131s\u0131 ile merkez ve ta\u015fra te\u015fkilatlar\u0131n\u0131n kurulmas\u0131 Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesiyle d\u00fczenlenir.\u201d denilmek suretiyle bakanl\u0131klar\u0131n kurulmas\u0131, kald\u0131r\u0131lmas\u0131, g\u00f6revleri ve yetkileri, te\u015fkilat yap\u0131s\u0131 ile merkez ve ta\u015fra te\u015fkilatlar\u0131n\u0131n kurulmas\u0131 Anayasa\u2019n\u0131n 106. maddesinin on birinci f\u0131kras\u0131 uyar\u0131nca CBK ile d\u00fczenlenebilece\u011fi \u00f6zel olarak belirtilen konular kapsam\u0131nda kalmaktad\u0131r (AYM, E.2020\/8, K.2021\/25, 31\/3\/2021, \u00a7 21).<\/p>\n<p>8. Bu ba\u011flamda Anayasa\u2019n\u0131n CBK\u2019lar taraf\u0131ndan d\u00fczenlenece\u011fini \u00f6zel olarak \u00f6ng\u00f6rd\u00fc\u011f\u00fc bakanl\u0131klar\u0131n kurulmas\u0131, kald\u0131r\u0131lmas\u0131, g\u00f6revleri ve yetkileri, te\u015fkilat yap\u0131s\u0131 ile merkez ve ta\u015fra te\u015fkilatlar\u0131n\u0131n kurulmas\u0131n\u0131n d\u00fczenlenmesi kapsam\u0131nda, bu konularla s\u0131n\u0131rl\u0131 olmak \u00fczere Anayasa\u2019n\u0131n 127. maddesinde belirtilen hususlarda d\u00fczenleme yap\u0131labilir.<\/p>\n<p>9. Bu \u00e7er\u00e7evede Bakanl\u0131\u011f\u0131n hizmet birimi olan Yerel Y\u00f6netimler Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc ile Bakanl\u0131\u011f\u0131n ba\u011fl\u0131 kurulu\u015fu olan Kentsel D\u00f6n\u00fc\u015f\u00fcm Ba\u015fkanl\u0131\u011f\u0131n\u0131n g\u00f6rev ve yetkilerini d\u00fczenleyen kurallar\u0131n Anayasa\u2019n\u0131n 106. maddesinin on birinci f\u0131kras\u0131nda \u00f6ng\u00f6r\u00fclen bakanl\u0131klar\u0131n g\u00f6revleri ve yetkilerine ili\u015fkin oldu\u011fu anla\u015f\u0131lmaktad\u0131r.
