Tarih \u2013 Say\u0131 : 24\/3\/2025 &#8211; 32851<\/p>\n<p>\u00a0<\/p>\n<p>\u0130T\u0130RAZ YOLUNA BA\u015eVURAN: Afyonkarahisar \u0130dare Mahkemesi<\/p>\n<p>\u0130T\u0130RAZIN KONUSU: 4\/6\/1985 tarihli ve 3213 say\u0131l\u0131 Maden Kanunu\u2019nun 26\/5\/2004 tarihli ve 5177 say\u0131l\u0131 Kanun\u2019un 12. maddesiyle de\u011fi\u015ftirilen 24. maddesinin 4\/2\/2015 tarihli ve 6592 say\u0131l\u0131 Kanun\u2019un 13. maddesiyle de\u011fi\u015ftirilen on birinci f\u0131kras\u0131n\u0131n d\u00f6rd\u00fcnc\u00fc c\u00fcmlesinin Anayasa\u2019n\u0131n 2., 13., 38. ve 123. maddelerine ayk\u0131r\u0131l\u0131\u011f\u0131 ileri s\u00fcr\u00fclerek iptaline karar verilmesi talebidir.<\/p>\n<p>OLAY: \u0130dari para cezas\u0131n\u0131n iptali talebiyle a\u00e7\u0131lan davada itiraz konusu kural\u0131n Anayasa&#8217;ya ayk\u0131r\u0131 oldu\u011fu kan\u0131s\u0131na varan Mahkeme, iptali i\u00e7in ba\u015fvurmu\u015ftur.<\/p>\n<p>I. \u0130PTAL\u0130 \u0130STENEN KANUN H\u00dcKM\u00dc<\/p>\n<p>Kanun\u2019un 24. maddesinin itiraz konusu kural\u0131n da yer ald\u0131\u011f\u0131 on birinci f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>\u201c(De\u011fi\u015fik onbirinci f\u0131kra: 4\/2\/2015 \u2013 6592\/13 md.) 7 nci maddeye g\u00f6re gerekli izinlerin al\u0131nmas\u0131ndan itibaren i\u015fletme izni verilir. Bu iznin verildi\u011fi tarihten itibaren Devlet hakk\u0131 al\u0131n\u0131r. Ruhsat sahibince, i\u015fletme ruhsat\u0131 y\u00fcr\u00fcrl\u00fck tarihinden itibaren \u00fc\u00e7 y\u0131l i\u00e7inde 7 nci maddeye g\u00f6re al\u0131nmas\u0131 gerekli olan \u00e7evresel etki de\u011ferlendirme karar\u0131, m\u00fclkiyet izni, i\u015fyeri a\u00e7ma ve \u00e7al\u0131\u015fma ruhsat\u0131 ile Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn kay\u0131tlar\u0131na i\u015flenmi\u015f alanlar ile ilgili izinlerin Genel M\u00fcd\u00fcrl\u00fc\u011fe verilmesini m\u00fcteakip, i\u015fletme izni d\u00fczenlenir. S\u00fcresi i\u00e7inde y\u00fck\u00fcml\u00fcl\u00fckleri yerine getirilmeyen ruhsatlar i\u00e7in her y\u0131l 50.000 TL idari para cezas\u0131 verilir. \u0130\u015fletme ruhsat s\u00fcresi sonuna kadar bu f\u0131krada belirtilen izinlerden dolay\u0131 i\u015fletme izninin al\u0131namamas\u0131 h\u00e2linde ruhsat s\u00fcresi uzat\u0131lmaz.\u201d<\/p>\n<p>II. \u0130LK \u0130NCELEME<\/p>\n<p>1. Anayasa Mahkemesi \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc h\u00fck\u00fcmleri uyar\u0131nca Hasan Tahsin G\u00d6KCAN, Basri BA\u011eCI, Engin YILDIRIM, R\u0131dvan G\u00dcLE\u00c7, Recai AKYEL, Yusuf \u015eevki HAKYEMEZ, Y\u0131ld\u0131z SEFER\u0130NO\u011eLU, Selahaddin MENTE\u015e, \u0130rfan F\u0130DAN, Kenan YA\u015eAR, Muhterem \u0130NCE, Y\u0131lmaz AK\u00c7\u0130L, \u00d6mer \u00c7INAR ve Metin KIRATLI\u2019n\u0131n kat\u0131l\u0131mlar\u0131yla 24\/9\/2024 tarihinde yap\u0131lan ilk inceleme toplant\u0131s\u0131nda dosyada eksiklik bulunmad\u0131\u011f\u0131ndan i\u015fin esas\u0131n\u0131n incelenmesine OYB\u0130RL\u0130\u011e\u0130YLE karar verilmi\u015ftir.<\/p>\n<p>III. ESASIN \u0130NCELENMES\u0130<\/p>\n<p>2. Ba\u015fvuru karar\u0131 ve ekleri, Raport\u00f6r \u015eermin B\u0130RTANE taraf\u0131ndan haz\u0131rlanan i\u015fin esas\u0131na ili\u015fkin rapor, itiraz konusu kanun h\u00fckm\u00fc, dayan\u0131lan Anayasa kurallar\u0131 ve bunlar\u0131n gerek\u00e7eleri ile di\u011fer yasama belgeleri okunup incelendikten sonra gere\u011fi g\u00f6r\u00fc\u015f\u00fcl\u00fcp d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. Anlam ve Kapsam<\/p>\n<p>3. 3213 say\u0131l\u0131 Kanun\u2019un 3. maddesinde ruhsat, madenlerin aranmas\u0131 ve i\u015fletilmesi i\u00e7in Maden ve Petrol \u0130\u015fleri Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc (Genel M\u00fcd\u00fcrl\u00fck) taraf\u0131ndan verilen belge olarak tan\u0131mlanm\u0131\u015ft\u0131r. An\u0131lan maddede arama ruhsat\u0131 ve i\u015fletme ruhsat\u0131 olmak \u00fczere iki t\u00fcr ruhsata yer verilmi\u015ftir.<\/p>\n<p>4. Maddeye g\u00f6re; arama ruhsat\u0131 belirli bir alanda maden arama faaliyetlerinde bulunulabilmesi i\u00e7in verilen yetki belgesini, i\u015fletme ruhsat\u0131 i\u015fletme faaliyetlerinin y\u00fcr\u00fct\u00fclebilmesi i\u00e7in verilen yetki belgesini, i\u015fletme izni ise bir madenin i\u015fletmeye al\u0131nabilmesi i\u00e7in gerekli olan izni ifade etmektedir.<\/p>\n<p>5. 3213 say\u0131l\u0131 Kanun\u2019un 7. maddesinin ikinci ve \u00fc\u00e7\u00fcnc\u00fc f\u0131kralar\u0131nda \u00f6zel \u00e7evre koruma b\u00f6lgeleri, mill\u00ee parklar, yaban hayat\u0131 koruma ve geli\u015ftirme sahalar\u0131, muhafaza ormanlar\u0131, 4\/4\/1990 tarihli ve 3621 say\u0131l\u0131 K\u0131y\u0131 Kanunu\u2019na g\u00f6re korunmas\u0131 gerekli alanlar, 1. derece asker\u00ee yasak b\u00f6lgeler, 1\/5000 \u00f6l\u00e7ekli imar plan\u0131 onaylanm\u0131\u015f alanlar, 1. derece sit alanlar\u0131 ile madencilik amac\u0131 d\u0131\u015f\u0131nda tahsis edilen ve Genel M\u00fcd\u00fcrl\u00fck taraf\u0131ndan uygun g\u00f6r\u00fc\u015f verilen elektrik santralleri, organize sanayi b\u00f6lgeleri, petrol, do\u011falgaz ve jeotermal boru hatlar\u0131 gibi yat\u0131r\u0131m alanlar\u0131na ait koordinatlar\u0131n ilgili kurumlar taraf\u0131ndan Genel M\u00fcd\u00fcrl\u00fc\u011fe bildirilece\u011fi, belirtilen alanlara yap\u0131lan ruhsat m\u00fcracaatlar\u0131n\u0131n hak sa\u011flamas\u0131 h\u00e2linde iki ay i\u00e7inde ruhsat bedelinin yat\u0131r\u0131lmas\u0131 ve 16. maddeye g\u00f6re m\u00fcracaatta bulunulmas\u0131 \u015fart\u0131yla ruhsat d\u00fczenlenece\u011fi belirtilmi\u015f, ruhsat sahas\u0131ndaki bu alanlara ili\u015fkin olarak ilgili kurumlardan izin al\u0131nmas\u0131 i\u00e7in ruhsat sahibine bir y\u0131l s\u00fcre verilece\u011fi h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>6. D\u00f6rd\u00fcnc\u00fc f\u0131kraya g\u00f6re devlet ormanlar\u0131 i\u00e7inde yap\u0131lacak maden arama ve i\u015fletme faaliyetleri ile bu faaliyetler i\u00e7in zorunlu ve ruhsat s\u00fcresine ba\u011fl\u0131 olarak yap\u0131lan ge\u00e7ici tesislere 31\/8\/1956 tarihli ve 6831 say\u0131l\u0131 Orman Kanunu h\u00fck\u00fcmlerine g\u00f6re izin verilir.<\/p>\n<p>7. Madencilik faaliyetleri kapsam\u0131nda maden i\u015fletme ruhsat\u0131n\u0131n al\u0131nmas\u0131, tek ba\u015f\u0131na maden \u00fcretim faaliyetlerinde bulunabilmek i\u00e7in yeterli olmay\u0131p maden i\u015fletme ruhsat\u0131n\u0131n al\u0131nmas\u0131ndan itibaren i\u015fletme faaliyetine ba\u015flayabilmek i\u00e7in s\u00f6z konusu Kanun\u2019un 7. maddesinde belirtilen zorunlu izinlerin de al\u0131nmas\u0131 gerekmektedir. An\u0131lan izinlerin tamamlanmas\u0131ndan sonra ruhsat sahipleri taraf\u0131ndan mevzuatta aranan belgeler ile i\u015fletme izni talebinde bulunulmakta ve gerekli incelemeler neticesinde uygun g\u00f6r\u00fclmesi h\u00e2linde madenin i\u015fletmeye al\u0131nmas\u0131 i\u00e7in Genel M\u00fcd\u00fcrl\u00fck\u00e7e i\u015fletme izni verilmektedir.<\/p>\n<p>8. S\u00f6z konusu maddeye g\u00f6re i\u015fletme izni i\u00e7in al\u0131nmas\u0131 gereken \u00fc\u00e7 temel belge; \u00e7evresel etki de\u011ferlendirme (\u00c7ED) belgesi, m\u00fclkiyet izni, i\u015fyeri a\u00e7ma ve \u00e7al\u0131\u015fma ruhsat\u0131 olup bunlar d\u0131\u015f\u0131nda -varsa- Genel M\u00fcd\u00fcrl\u00fck kay\u0131tlar\u0131na i\u015flenmi\u015f \u00f6zel alanlar ile ilgili izinlerin de al\u0131nmas\u0131 gerekebilmektedir. \u0130zinlerin, i\u015fletme ruhsat\u0131 al\u0131nmas\u0131ndan itibaren \u00fc\u00e7 y\u0131l i\u00e7inde temin edilmesi gerekmektedir.<\/p>\n<p>9. Maddenin on birinci f\u0131kras\u0131nda \u00c7ED izni olmaks\u0131z\u0131n madencilik faaliyetinde bulunulamayaca\u011f\u0131 h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. \u00c7ED i\u015flemleri \u00c7evre, \u015eehircilik ve \u0130klim De\u011fi\u015fikli\u011fi Bakanl\u0131\u011f\u0131 taraf\u0131ndan y\u00fcr\u00fct\u00fcl\u00fcr.<\/p>\n<p>10. 9\/8\/1983 tarihli ve 2872 say\u0131l\u0131 \u00c7evre Kanunu\u2019nun \u201c\u00c7evresel etki de\u011ferlendirilmesi\u201d ba\u015fl\u0131kl\u0131 10. maddesinde ger\u00e7ekle\u015ftirmeyi planlad\u0131klar\u0131 faaliyetleri sonucu \u00e7evre sorunlar\u0131na yol a\u00e7abilecek kurum, kurulu\u015f ve i\u015fletmelerin \u00e7evresel etki de\u011ferlendirmesi raporu veya proje tan\u0131t\u0131m dosyas\u0131 haz\u0131rlamakla y\u00fck\u00fcml\u00fc olduklar\u0131, \u00c7ED olumlu karar\u0131 veya \u00c7ED gerekli de\u011fildir karar\u0131 al\u0131nmad\u0131k\u00e7a bu projelerle ilgili onay, izin, te\u015fvik, yap\u0131 ve kullan\u0131m ruhsat\u0131n\u0131n verilemeyece\u011fi, proje i\u00e7in yat\u0131r\u0131ma ba\u015flanamayaca\u011f\u0131 ve ihale edilemeyece\u011fi h\u00fckme ba\u011flanm\u0131\u015ft\u0131r.<\/p>\n<p>11. M\u00fclkiyet izni, Kanun\u2019un 16. maddesi uyar\u0131nca \u00f6zel m\u00fclkiyete tabi gayrimenkullerde m\u00fclk sahibinden; orman arazilerinde ise Tar\u0131m ve Orman Bakanl\u0131\u011f\u0131ndan al\u0131nan izni ifade etmektedir. 6831 say\u0131l\u0131 Kanun\u2019un 16. maddesi uyar\u0131nca devlet ormanlar\u0131 i\u00e7inde maden aranmas\u0131 ve i\u015fletilmesi ile madencilik faaliyeti i\u00e7in zorunlu; tesis, yol, enerji, su, haberle\u015fme ve altyap\u0131 tesislerine, fon bedelleri hari\u00e7, bedeli al\u0131narak Tar\u0131m ve Orman Bakanl\u0131\u011f\u0131nca izin verilmektedir.<\/p>\n<p>12. \u0130\u015fyeri a\u00e7ma ve \u00e7al\u0131\u015fma ruhsat\u0131 ise yetkili idareler taraf\u0131ndan maden \u00fcretim faaliyetleri ve\/veya bu faaliyetlere dayal\u0131 olarak \u00fcretim yap\u0131lan tesislerin a\u00e7\u0131l\u0131p faaliyet g\u00f6stermesi i\u00e7in verilen izni ifade etmektedir. 3213 say\u0131l\u0131 Kanun\u2019un 7. maddesinin dokuzuncu f\u0131kras\u0131na g\u00f6re maden \u00fcretim faaliyetleri ile bu faaliyetlere dayal\u0131 ruhsat sahas\u0131ndaki tesisler i\u00e7in i\u015fyeri a\u00e7ma ve \u00e7al\u0131\u015fma ruhsatlar\u0131 il \u00f6zel idareleri taraf\u0131ndan verilmektedir. \u0130\u015fyeri a\u00e7ma ve \u00e7al\u0131\u015fma ruhsatlar\u0131na ili\u015fkin usul ve esaslar, 14\/6\/1989 tarihli ve 3572 say\u0131l\u0131 \u0130\u015fyeri A\u00e7ma ve \u00c7al\u0131\u015fma Ruhsatlar\u0131na Dair Kanun H\u00fckm\u00fcnde Kararnamenin De\u011fi\u015ftirilerek Kabul\u00fcne Dair Kanun\u2019da d\u00fczenlenmi\u015ftir.<\/p>\n<p>13. 3213 say\u0131l\u0131 Kanun\u2019un \u201c\u0130\u015fletme ruhsat\u0131 ve madenin i\u015fletilmesi\u201d ba\u015fl\u0131kl\u0131 24. maddesinin on birinci f\u0131kras\u0131n\u0131n birinci c\u00fcmlesinde, an\u0131lan Kanun\u2019un 7. maddesine g\u00f6re gerekli izinlerin al\u0131nmas\u0131ndan itibaren i\u015fletme izni verilece\u011fi belirtilmi\u015f; \u00fc\u00e7\u00fcnc\u00fc c\u00fcmlesinde ise ruhsat sahibince i\u015fletme ruhsat\u0131 y\u00fcr\u00fcrl\u00fck tarihinden itibaren \u00fc\u00e7 y\u0131l i\u00e7inde 7. maddeye g\u00f6re al\u0131nmas\u0131 gerekli olan \u00c7ED karar\u0131, m\u00fclkiyet izni, i\u015fyeri a\u00e7ma ve \u00e7al\u0131\u015fma ruhsat\u0131 ile Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn kay\u0131tlar\u0131na i\u015flenmi\u015f alanlar ile ilgili izinlerin Genel M\u00fcd\u00fcrl\u00fc\u011fe verilmesini m\u00fcteakip i\u015fletme izninin d\u00fczenlenece\u011fi ifade edilmi\u015ftir.<\/p>\n<p>14. An\u0131lan f\u0131kran\u0131n itiraz konusu d\u00f6rd\u00fcnc\u00fc c\u00fcmlesinde ise s\u00fcresi i\u00e7inde y\u00fck\u00fcml\u00fcl\u00fckleri yerine getirilmeyen ruhsatlar i\u00e7in her y\u0131l 50.000 TL idari para cezas\u0131 verilece\u011fi h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla i\u015fletme ruhsat\u0131 tarihinden itibaren ilk \u00fc\u00e7 y\u0131l i\u00e7inde Kanun\u2019da \u00f6ng\u00f6r\u00fclen izinlerin al\u0131nmamas\u0131 durumunda \u00fc\u00e7 y\u0131ldan sonraki her y\u0131l i\u00e7in idari para cezas\u0131 uygulanacakt\u0131r.<\/p>\n<p>15. Kanun\u2019un 24. maddesinin on birinci f\u0131kras\u0131 6592 say\u0131l\u0131 Kanun\u2019un 13. maddesiyle de\u011fi\u015ftirilmi\u015ftir. De\u011fi\u015fiklikten \u00f6nce on birinci f\u0131kraya g\u00f6re ruhsat sahibince, i\u015fletme ruhsat\u0131 y\u00fcr\u00fcrl\u00fck tarihinden itibaren \u00fc\u00e7 y\u0131l i\u00e7inde Kanun\u2019un 7. maddesine g\u00f6re al\u0131nmas\u0131 gerekli olan izinlerin temin edilmeyerek y\u00fck\u00fcml\u00fcl\u00fckleri yerine getirilmeyen ruhsatlar\u0131n teminat\u0131 irat kaydedilerek iptal edilece\u011fi d\u00fczenlenmi\u015ftir. On birinci f\u0131kran\u0131n 6592 say\u0131l\u0131 Kanun\u2019la de\u011fi\u015ftirilmesinden sonraki h\u00e2linde ise s\u00fcresi i\u00e7inde gerekli izinlerin temin edilmemesi durumunda ruhsat iptali yerine ilgililer hakk\u0131nda idari para cezas\u0131 uygulanmas\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>B. \u0130tiraz\u0131n Gerek\u00e7esi<\/p>\n<p>16. Ba\u015fvuru karar\u0131nda \u00f6zetle; maden i\u015fletme ruhsat\u0131na dayan\u0131larak ba\u015fvurulan izin taleplerinin kamu kurumlar\u0131 taraf\u0131ndan uygun g\u00f6r\u00fclmemesi veya b\u00fcrokratik i\u015flemlerin uzamas\u0131 nedeniyle iznin temin edilememesi h\u00e2linde itiraz konusu kuralla ki\u015filerin yapt\u0131r\u0131ma tabi tutuldu\u011fu, s\u00f6z konusu izinlerin idare taraf\u0131ndan ge\u00e7 verilmesinde veya verilmemesinde ba\u015fvuru sahibi ki\u015filerin kusurunun bulunmayabilece\u011fi, izinlerin herhangi birinin al\u0131namam\u0131\u015f olmas\u0131 ile hi\u00e7birinin al\u0131nmam\u0131\u015f olmas\u0131 aras\u0131nda bir ayr\u0131m yap\u0131lmaks\u0131z\u0131n ayn\u0131 tutarda cezan\u0131n belirlendi\u011fi, ceza h\u00fckm\u00fcnde beklenmeyen h\u00e2l istisnas\u0131n\u0131n bulunmad\u0131\u011f\u0131, bu durumun hukuki belirlilik, \u00f6l\u00e7\u00fcl\u00fcl\u00fck, su\u00e7 ve cezalar\u0131n \u015fahsili\u011fi ilkelerini ihlal etti\u011fi belirtilerek kural\u0131n Anayasa\u2019n\u0131n 2., 13., 38. ve 123. maddelerine ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>C. Anayasa\u2019ya Ayk\u0131r\u0131l\u0131k Sorunu<\/p>\n<p>17. Anayasa\u2019n\u0131n 2. maddesinde belirtilen hukuk devleti; eylem ve i\u015flemleri hukuka uygun, insan haklar\u0131na sayg\u0131l\u0131, bu hak ve \u00f6zg\u00fcrl\u00fckleri koruyup g\u00fc\u00e7lendiren, her alanda adil bir hukuk d\u00fczeni kurup bunu geli\u015ftirerek s\u00fcrd\u00fcren, hukuki g\u00fcvenli\u011fi sa\u011flayan, Anayasa\u2019ya ayk\u0131r\u0131 durum ve tutumlardan ka\u00e7\u0131nan, hukuk kurallar\u0131yla kendini ba\u011fl\u0131 sayan ve yarg\u0131 denetimine a\u00e7\u0131k olan devlettir.<\/p>\n<p>18. Hukuk devletinin belirlilik ve \u00f6ng\u00f6r\u00fclebilirlik ilkeleri hukuk kurallar\u0131n\u0131n d\u00fczenlenmesinde hangi davran\u0131\u015f\u0131n yasakland\u0131\u011f\u0131n\u0131n ve yapt\u0131r\u0131ma ba\u011fland\u0131\u011f\u0131n\u0131n kanun metninde a\u00e7\u0131k\u00e7a ve keyf\u00eeli\u011fe yol a\u00e7mayacak bi\u00e7imde d\u00fczenlenmesini zorunlu k\u0131lmakta ve hukuk g\u00fcvenli\u011fi ilkesine hizmet etmektedir. \u00d6te yandan somut olay ko\u015fullar\u0131nda objektif olarak \u00f6ng\u00f6r\u00fclmesi veya \u00f6nlenmesi m\u00fcmk\u00fcn olmayan bir neticeden veya kendisine kusur y\u00fcklenemeyen bir fiilinden dolay\u0131 bir kimsenin cezaland\u0131r\u0131lmas\u0131, belirlilik ve \u00f6ng\u00f6r\u00fclebilirlik ilkelerine ayk\u0131r\u0131 olacak; keyf\u00eeli\u011fe kap\u0131 a\u00e7abilecek ve hukuk g\u00fcvenli\u011fini ortadan kald\u0131racakt\u0131r.<\/p>\n<p>19. Anayasa\u2019n\u0131n 38. maddesinin birinci f\u0131kras\u0131nda \u201cKimse, i\u015flendi\u011fi zaman y\u00fcr\u00fcrl\u00fckte bulunan kanunun su\u00e7 saymad\u0131\u011f\u0131 bir fiilden dolay\u0131 cezaland\u0131r\u0131lamaz; kimseye su\u00e7u i\u015fledi\u011fi zaman kanunda o su\u00e7 i\u00e7in konulmu\u015f olan cezadan daha a\u011f\u0131r bir ceza verilemez\u201d denilerek su\u00e7un kanunili\u011fi; \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda da \u201cCeza ve ceza yerine ge\u00e7en g\u00fcvenlik tedbirleri ancak kanunla konulur\u201d denilerek cezan\u0131n kanunili\u011fi ilkesi g\u00fcvence alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>20. Anayasa\u2019n\u0131n an\u0131lan maddesinde yer alan su\u00e7ta ve cezada kanunilik ilkesi uyar\u0131nca hangi fiillerin yasakland\u0131\u011f\u0131n\u0131n ve bu yasak fiillere verilecek cezalar\u0131n hi\u00e7bir ku\u015fkuya yer b\u0131rakmayacak a\u00e7\u0131kl\u0131kta, anla\u015f\u0131l\u0131r ve s\u0131n\u0131rlar\u0131 belirli olarak kanunda g\u00f6sterilmesi gerekmektedir. Ki\u015filerin yasak fiilleri \u00f6nceden bilmeleri d\u00fc\u015f\u00fcncesine dayanan bu ilkeyle temel hak ve \u00f6zg\u00fcrl\u00fcklerin g\u00fcvence alt\u0131na al\u0131nmas\u0131 ama\u00e7lanmaktad\u0131r (AYM, E.2020\/16, K.2020\/33, 25\/6\/2020, \u00a7 15).<\/p>\n<p>21. Su\u00e7ta ve cezada kanunilik ilkesi Anayasa\u2019n\u0131n 13. maddesinde ifade edilen temel hak ve \u00f6zg\u00fcrl\u00fcklerin ancak kanunla s\u0131n\u0131rlanabilece\u011fine ili\u015fkin kural\u0131n su\u00e7 ve cezalar y\u00f6n\u00fcnden \u00f6zel d\u00fczenlemesi olarak de\u011ferlendirilebilir. Su\u00e7ta ve cezada kanunilik ilkesi, cezaland\u0131rman\u0131n temel haklara etkisinden kaynaklanan \u00f6nemi nedeniyle zaman i\u00e7inde bir ceza hukuku kavram\u0131 olarak alt ilkeler de i\u00e7erecek \u015fekilde geli\u015fmi\u015ftir (AYM, E.2019\/9, K.2019\/27, 11\/4\/2019, \u00a7 15). Dolay\u0131s\u0131yla su\u00e7 ve cezada kanunilik ilkesi a\u00e7\u0131s\u0131ndan da temel haklar\u0131 s\u0131n\u0131rlayan kanunun \u015feklen var olmas\u0131 yeterli olmay\u0131p yasal kurallar\u0131n keyf\u00eeli\u011fe izin vermeyecek \u015fekilde belirli ve \u00f6ng\u00f6r\u00fclebilir nitelikte olmas\u0131 gerekir.<\/p>\n<p>22. Anayasa\u2019n\u0131n 38. maddesinin yedinci f\u0131kras\u0131nda ise ceza sorumlulu\u011funun \u015fahsi oldu\u011fu belirtilerek herkesin kendi eyleminden sorumlu tutulaca\u011f\u0131, ba\u015fkalar\u0131n\u0131n su\u00e7 olu\u015fturan eylemlerinden dolay\u0131 cezaland\u0131r\u0131lamayaca\u011f\u0131 kabul edilmi\u015ftir.<\/p>\n<p>23. Ceza hukukunun ilkelerinden biri ve anayasal bir ilke olan ceza sorumlulu\u011funun \u015fahsili\u011fi ilkesi kusur ilkesine dayanmaktad\u0131r. Bu konuda Anayasa\u2019n\u0131n 38. maddesinin yedinci f\u0131kras\u0131 ile ilgili gerek\u00e7ede \u201c&#8230;f\u0131kra, ceza sorumlulu\u011funun \u2018\u015fahs\u00ee\u2019 oldu\u011fu; yani failden gayri ki\u015filerin bir su\u00e7 sebebiyle cezaland\u0131r\u0131lamayaca\u011f\u0131 h\u00fckm\u00fcn\u00fc getirmektedir. Bu ilke dahi ceza hukukuna yerle\u015fmi\u015f ve \u2018kusura dayanan ceza sorumlulu\u011fu\u2019 ilkesine dahil, terki m\u00fcmk\u00fcn olmayan bir temel kurald\u0131r.\u201d denilmektedir (AYM, E.2016\/191, K.2017\/131, 26\/07\/2017, \u00a7 38). Ceza sorumlulu\u011funun \u015fahsili\u011fi ilkesi bir kimsenin yaln\u0131zca kendi kusurlu fiilinden sorumlu tutulabilece\u011fini, ba\u015fkas\u0131n\u0131n fiilinden dolay\u0131 sorumlu tutulmayaca\u011f\u0131n\u0131 g\u00fcvence alt\u0131na almaktad\u0131r.<\/p>\n<p>24. Anayasa\u2019n\u0131n s\u00f6z konusu maddesinde idari ve adli cezalar aras\u0131nda bir ayr\u0131m yap\u0131lmad\u0131\u011f\u0131ndan idari para cezalar\u0131 da bu maddede \u00f6ng\u00f6r\u00fclen ilkelere tabidir.<\/p>\n<p>25. Anayasa Mahkemesi bir\u00e7ok karar\u0131nda belirlilik ilkesinin yaln\u0131zca yasal belirlili\u011fi de\u011fil daha geni\u015f anlamda hukuki belirlili\u011fi ifade etti\u011fini, yasal d\u00fczenlemeye dayanarak eri\u015filebilir, bilinebilir ve \u00f6ng\u00f6r\u00fclebilir olma gibi niteliklere ili\u015fkin gereklilikleri kar\u015f\u0131lamas\u0131 \u015fart\u0131yla mahkeme i\u00e7tihatlar\u0131 ve y\u00fcr\u00fctmenin d\u00fczenleyici i\u015flemleri ile de hukuki belirlili\u011fin sa\u011flanabilece\u011fini, as\u0131l olan\u0131n muhtemel muhataplar\u0131n\u0131n mevcut \u015fartlar alt\u0131nda belirli bir i\u015flemin ne t\u00fcr sonu\u00e7lar do\u011furabilece\u011fini \u00f6ng\u00f6rmelerini m\u00fcmk\u00fcn k\u0131lacak bir normun varl\u0131\u011f\u0131 oldu\u011funu vurgulam\u0131\u015ft\u0131r (AYM, E.2011\/45, K.2013\/24, 31\/1\/2013; E.2014\/118, K.2015\/35, 1\/4\/2015; E.2016\/44, K.2016\/153, 7\/9\/2016, \u00a7 6; E.2015\/41, K.2017\/98, 4\/5\/2017, \u00a7 43; E.2017\/179, K.2018\/106, 8\/11\/2018, \u00a7 10; E.2017\/21, K.2020\/77, 24\/12\/2020, \u00a7 247; E.2018\/112, K.2021\/24, 31\/3\/2021, \u00a7 41).<\/p>\n<p>26. Kanun\u2019un 24. maddesinin on birinci f\u0131kras\u0131n\u0131n \u00fc\u00e7\u00fcnc\u00fc c\u00fcmlesinde ruhsat sahibince, i\u015fletme ruhsat\u0131 y\u00fcr\u00fcrl\u00fck tarihinden itibaren \u00fc\u00e7 y\u0131l i\u00e7inde 7. maddeye g\u00f6re al\u0131nmas\u0131 gerekli olan \u00c7ED karar\u0131, m\u00fclkiyet izni, i\u015fyeri a\u00e7ma ve \u00e7al\u0131\u015fma ruhsat\u0131 ile Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn kay\u0131tlar\u0131na i\u015flenmi\u015f alanlar ile ilgili izinlerin Genel M\u00fcd\u00fcrl\u00fc\u011fe verilmesini m\u00fcteakip i\u015fletme izni d\u00fczenlenece\u011fi \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. An\u0131lan f\u0131kran\u0131n itiraz konusu d\u00f6rd\u00fcnc\u00fc c\u00fcmlesinde ise s\u00fcresi i\u00e7inde y\u00fck\u00fcml\u00fcl\u00fckleri yerine getirilmeyen ruhsatlar i\u00e7in her y\u0131l 50.000 TL idari para cezas\u0131 verilece\u011fi h\u00fckme ba\u011flanm\u0131\u015ft\u0131r. Buna g\u00f6re itiraz konusu kural gere\u011fince i\u015fletme izni i\u00e7in al\u0131nmas\u0131 gerekli olan izinler 7. maddeye g\u00f6re al\u0131nmas\u0131 gerekli olan izinler ile Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn kay\u0131tlar\u0131na i\u015flenmi\u015f alanlarla ilgili di\u011fer izinlerdir.<\/p>\n<p>27. Bu itibarla kuralda gerekli izin al\u0131nmamas\u0131 durumunda idari para cezas\u0131n\u0131n \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc, al\u0131nmas\u0131 gerekli izinlerin 7. maddede say\u0131lan izinler oldu\u011fu, yapt\u0131r\u0131ma tabi eylemler ile bu eylemler hakk\u0131nda uygulanacak idari para cezas\u0131n\u0131n maddede a\u00e7\u0131k\u00e7a d\u00fczenlendi\u011fi g\u00f6zetildi\u011finde kuralda herhangi bir belirsizli\u011fin bulunmad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Bu itibarla kapsam ve s\u0131n\u0131rlar\u0131n\u0131n belirli ve sonu\u00e7lar\u0131n\u0131n \u00f6ng\u00f6r\u00fclebilir oldu\u011fu anla\u015f\u0131lan kural\u0131n kanunilik \u015fart\u0131n\u0131 ta\u015f\u0131d\u0131\u011f\u0131 sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>28. Kural uyar\u0131nca ruhsat sahiplerine idari para cezas\u0131 uygulanabilmesi i\u00e7in s\u00fcresi i\u00e7inde y\u00fck\u00fcml\u00fcl\u00fcklerini yerine getirmeme \u015fart\u0131 \u00f6ng\u00f6r\u00fclmektedir. Bir ba\u015fka deyi\u015fle idari para cezas\u0131 uygulanabilmesi ancak ruhsat sahiplerinin ilgili izinlerin al\u0131nmas\u0131 i\u00e7in gerekli ba\u015fvuru ve i\u015flemlere dair sorumluluklar\u0131n\u0131 s\u00fcresi i\u00e7inde yerine getirmemeleri durumunda m\u00fcmk\u00fcnd\u00fcr. Kanun\u2019un 7. maddesinin on birinci f\u0131kras\u0131nda; \u00e7evresel etki de\u011ferlendirmesi i\u015flemlerinin \u00c7evre, \u015eehircilik ve \u0130klim De\u011fi\u015fikli\u011fi Bakanl\u0131\u011f\u0131 taraf\u0131ndan, di\u011fer izinlere ili\u015fkin i\u015flemlerin de ilgili bakanl\u0131klar ve di\u011fer kamu kurum ve kurulu\u015flar\u0131nca \u00e7evresel etki de\u011ferlendirmesi s\u00fcrecinde en ge\u00e7 \u00fc\u00e7 ay i\u00e7inde bitirilece\u011fi belirtilmek suretiyle s\u00fcreye ba\u011fland\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Bu s\u00fcre i\u00e7inde izinlere ili\u015fkin i\u015flemlerin ruhsat sahiplerinin kusuru olmaks\u0131z\u0131n bitirilememesi h\u00e2linde ise bu durumun idare ve mahkemeler taraf\u0131ndan dikkate al\u0131naca\u011f\u0131 a\u00e7\u0131kt\u0131r. Zira hukuk devletinde ki\u015filere yapt\u0131r\u0131m uygulanabilmesi i\u00e7in hukuka ayk\u0131r\u0131 eylemin kanunda unsurlar\u0131yla belirtilmi\u015f olmas\u0131, bu eylemin de o ki\u015fi taraf\u0131ndan kusurlu bir hareketle ger\u00e7ekle\u015ftirilmi\u015f oldu\u011funun ortaya konmas\u0131 gerekmektedir. Bu ba\u011flamda ki\u015fiye atfedilecek bir kusur olmaks\u0131z\u0131n Kanun\u2019da \u00f6ng\u00f6r\u00fclen s\u00fcrelerin ge\u00e7irilmesi h\u00e2linde kuralla \u00f6ng\u00f6r\u00fclen idari para cezas\u0131n\u0131n uygulanmas\u0131 s\u00f6z konusu olamaz. Di\u011fer bir deyi\u015fle Kanun\u2019da \u00f6ng\u00f6r\u00fclen idari yapt\u0131r\u0131m\u0131n uygulanabilmesi i\u00e7in izinlerin s\u00fcresi i\u00e7inde al\u0131namamas\u0131nda m\u00fcracaat sahibine atf\u0131 kabil bir kusurun varl\u0131\u011f\u0131 zorunludur (ayn\u0131 y\u00f6ndeki de\u011ferlendirmeler i\u00e7in bkz. AYM, E.2017\/36, K.2017\/147, 1\/11\/2017, \u00a7 25).<\/p>\n<p>29. \u00d6te yandan idari yapt\u0131r\u0131m uygulanan ki\u015filerin Kanun\u2019da \u00f6ng\u00f6r\u00fclen izinlerin s\u00fcresi i\u00e7erisinde al\u0131nmamas\u0131nda kendilerinin herhangi bir kusurlar\u0131n\u0131n bulunmad\u0131\u011f\u0131 iddias\u0131yla yarg\u0131 yerlerine ba\u015fvurma imk\u00e2nlar\u0131n\u0131n bulundu\u011fu ve mahkemelerin de uygulanan yapt\u0131r\u0131mlar\u0131n hukuka ayk\u0131r\u0131 oldu\u011funu tespit etmeleri h\u00e2linde bunlar\u0131 iptal etme yetkisine sahip olduklar\u0131 g\u00f6zetildi\u011finde kural\u0131n keyf\u00ee olarak uygulanmas\u0131n\u0131 engelleyecek g\u00fcvencelerin de bulundu\u011fu g\u00f6r\u00fclmektedir. Dolay\u0131s\u0131yla kural\u0131n su\u00e7 ve cezalar\u0131n \u015fahsili\u011fi ilkesine ayk\u0131r\u0131 bir d\u00fczenleme i\u00e7ermedi\u011fi anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>30. Anayasa\u2019n\u0131n \u201cSa\u011fl\u0131k hizmetleri ve \u00e7evrenin korunmas\u0131\u201d ba\u015fl\u0131kl\u0131 56. maddesinin birinci ve ikinci f\u0131kralar\u0131nda \u201cHerkes, sa\u011fl\u0131kl\u0131 ve dengeli bir \u00e7evrede ya\u015fama hakk\u0131na sahiptir.\/ \u00c7evreyi geli\u015ftirmek, \u00e7evre sa\u011fl\u0131\u011f\u0131n\u0131 korumak ve \u00e7evre kirlenmesini \u00f6nlemek Devletin ve vatanda\u015flar\u0131n \u00f6devidir.\u201d d\u00fczenlemeleri yer almaktad\u0131r. Buna g\u00f6re \u00e7evrenin geli\u015ftirilmesi, \u00e7evre sa\u011fl\u0131\u011f\u0131n\u0131n korunmas\u0131 ve \u00e7evre kirlenmesinin \u00f6nlenmesine y\u00f6nelik tedbirleri almak devletin temel \u00f6devlerindendir. Bu ama\u00e7la devlet, \u00e7evrenin korunmas\u0131n\u0131 sa\u011flamak i\u00e7in etkili bir hukuk d\u00fczeni olu\u015fturmakla y\u00fck\u00fcml\u00fcd\u00fcr (AYM, E.2020\/10, K.2020\/67, 12\/11\/2020, \u00a7 14; E.2019\/21, K.2020\/51, 24\/9\/2020, \u00a7 41).<\/p>\n<p>31. Anayasa\u2019n\u0131n 168. maddesinde de \u201cTabi\u00ee servetler ve kaynaklar Devletin h\u00fck\u00fcm ve tasarrufu alt\u0131ndad\u0131r. Bunlar\u0131n aranmas\u0131 ve i\u015fletilmesi hakk\u0131 Devlete aittir. Devlet bu hakk\u0131n\u0131 belli bir s\u00fcre i\u00e7in, ger\u00e7ek ve t\u00fczelki\u015filere devredebilir. Hangi tabi\u00ee servet ve kayna\u011f\u0131n arama ve i\u015fletmesinin, Devletin ger\u00e7ek ve t\u00fczelki\u015filerle ortak olarak veya do\u011frudan ger\u00e7ek ve t\u00fczelki\u015filer eliyle yap\u0131lmas\u0131, kanunun a\u00e7\u0131k iznine ba\u011fl\u0131d\u0131r. Bu durumda ger\u00e7ek ve t\u00fczelki\u015filerin uymas\u0131 gereken \u015fartlar ve Devlet\u00e7e yap\u0131lacak g\u00f6zetim, denetim usul ve esaslar\u0131 ve m\u00fceyyideler kanunda g\u00f6sterilir.\u201d denilmektedir. Buna g\u00f6re tabii servetler ve kaynaklar kapsam\u0131nda bulunan madenlerin aranmas\u0131 ve i\u015fletilmesi ile ilgili olarak ger\u00e7ek ve t\u00fczel ki\u015filerin uyacaklar\u0131 ko\u015fullar\u0131n, devlet\u00e7e yap\u0131lacak g\u00f6zetim, denetim usul ve esaslar\u0131 ile yapt\u0131r\u0131mlar\u0131n kanunla d\u00fczenlenmesi gerekmektedir.<\/p>\n<p>32. Madencilik faaliyeti, ekonomik ve sosyal alanda \u00f6nemli yere sahip bulunmakla birlikte \u00e7evre ve insan sa\u011fl\u0131\u011f\u0131 \u00fczerinde ciddi etkilere sebebiyet verebilen bir sekt\u00f6rd\u00fcr. Madencili\u011fin su, toprak, hava kirlenmesi, g\u00fcr\u00fclt\u00fc ve titre\u015fim, ekosistemlere zarar ve \u00e7evre esteti\u011finin bozulmas\u0131 \u015feklinde \u00e7evre ve insan sa\u011fl\u0131\u011f\u0131na olumsuz etkileri olabilmektedir. Kanun\u2019un 7. maddesinde madencilik i\u00e7in \u00f6ng\u00f6r\u00fclen \u00c7ED karar\u0131, m\u00fclkiyet izni, i\u015fyeri a\u00e7ma ve \u00e7al\u0131\u015fma ruhsat\u0131 izni gibi belgelerin madencilik faaliyetinin bu olumsuz sonu\u00e7lar\u0131n\u0131n \u00f6nlenebilmesi veya etkilerinin en aza indirgenmesi amac\u0131n\u0131 ta\u015f\u0131d\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>33. Bu itibarla Kanun\u2019un 7. maddesinde d\u00fczenlenen izinler madencilik faaliyetlerinde Kanun\u2019da \u00f6ng\u00f6r\u00fclen esas ve usullere uyulup uyulmad\u0131\u011f\u0131n\u0131n denetlenmesi bak\u0131m\u0131ndan \u00f6nemli bir i\u015fleve sahiptir. Bu ba\u011flamda kuralla s\u00fcresi i\u00e7inde izinleri al\u0131namam\u0131\u015f ruhsatlar hakk\u0131nda idari para cezas\u0131n\u0131n \u00f6ng\u00f6r\u00fclmesi suretiyle ruhsat sahiplerinin s\u00f6z konusu izinleri almalar\u0131 i\u00e7in harekete ge\u00e7meye zorlanmalar\u0131yla bir yandan madencilik faaliyetlerinin denetlenmesinin, di\u011fer yandan i\u015fletme ruhsat\u0131 d\u00fczenlenmi\u015f yerler hakk\u0131nda i\u015fletme izni verilmesi suretiyle madencilik faaliyetlerinin devam ettirilmesinin sa\u011flanmaya \u00e7al\u0131\u015f\u0131ld\u0131\u011f\u0131 a\u00e7\u0131kt\u0131r (AYM, E.2017\/36, K.2017\/147, 01\/11\/2017, \u00a7 23). Bu durumda kural\u0131n Anayasa\u2019n\u0131n 168. maddesi de dikkate al\u0131narak kamu yarar\u0131na d\u00f6n\u00fck oldu\u011fu ve anayasal a\u00e7\u0131dan me\u015fru bir amaca dayand\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>34. Bununla birlikte kuralda \u00f6ng\u00f6r\u00fclen yapt\u0131r\u0131m\u0131n kanunilik ve me\u015fru ama\u00e7 \u015fartlar\u0131n\u0131 ta\u015f\u0131mas\u0131 yeterli olmay\u0131p ayn\u0131 zamanda \u00f6l\u00e7\u00fcl\u00fc de olmas\u0131 gerekir. \u00d6l\u00e7\u00fcl\u00fcl\u00fck ilkesi elveri\u015flilik, gereklilik ve orant\u0131l\u0131l\u0131k olmak \u00fczere \u00fc\u00e7 alt ilkeden olu\u015fmaktad\u0131r. Elveri\u015flilik ba\u015fvurulan \u00f6nlemin ula\u015f\u0131lmak istenen ama\u00e7 i\u00e7in elveri\u015fli olmas\u0131n\u0131, gereklilik ba\u015fvurulan \u00f6nlemin ula\u015f\u0131lmak istenen ama\u00e7 bak\u0131m\u0131ndan gerekli olmas\u0131n\u0131 ve orant\u0131l\u0131l\u0131k ise ba\u015fvurulan \u00f6nlem ve ula\u015f\u0131lmak istenen ama\u00e7 aras\u0131nda olmas\u0131 gereken \u00f6l\u00e7\u00fcy\u00fc ifade etmektedir.<\/p>\n<p>35. Kanunla yap\u0131lan d\u00fczenlemelerin etkili bir \u015fekilde hayata ge\u00e7irilebilmesi bak\u0131m\u0131ndan \u00f6ng\u00f6r\u00fclen y\u00fck\u00fcml\u00fcl\u00fcklerin yerine getirilmesini sa\u011flamak ve yasaklanan fiillerin i\u015flenmesini \u00f6nlemek i\u00e7in hangi t\u00fcr ve \u00f6l\u00e7ekte idari yapt\u0131r\u0131m uygulanaca\u011f\u0131 kanun koyucunun takdir yetkisi kapsam\u0131ndad\u0131r. Kural, maddede belirtilen y\u00fck\u00fcml\u00fcl\u00fcklerin yerine getirilmemesi h\u00e2linde idari yapt\u0131r\u0131m\u0131 d\u00fczenlemektedir. Bu ba\u011flamda itiraz konusu kural\u0131n ula\u015f\u0131lmak istenen me\u015fru ama\u00e7 bak\u0131m\u0131ndan elveri\u015fli ve gerekli olmad\u0131\u011f\u0131 s\u00f6ylenemez.<\/p>\n<p>36. \u00d6l\u00e7\u00fcl\u00fcl\u00fck incelemesinde son olarak kuralda \u00f6ng\u00f6r\u00fclen yapt\u0131r\u0131m ile ula\u015f\u0131lmak istenen me\u015fru ama\u00e7 aras\u0131ndaki makul dengeyi ifade eden orant\u0131l\u0131l\u0131k ilkesine dikkat edilmesi gerekir. Kural\u0131n anlam ve kapsam\u0131 itiraz\u0131n gerek\u00e7esi Anayasa Mahkemesi\u2019nin gerek\u00e7eli karar\u0131nda belirtildi\u011finden kar\u015f\u0131 oyda ayr\u0131ca tekrar edilmemi\u015ftir.<\/p>\n<p>4. Kural\u0131n anlam ve kapsam\u0131n\u0131n belirlenebilmesi i\u00e7in mevzuata ili\u015fkin i\u015fleyi\u015fi k\u0131saca belirtmek gerekmektedir. \u00dclkemizde i\u015fletme ruhsatlar\u0131 MAPEG kurumu taraf\u0131ndan verilmektedir. \u0130\u015fletme ruhsat\u0131 d\u00fczenlenebilmesi i\u00e7in tek kriter maden varl\u0131\u011f\u0131d\u0131r. Sahan\u0131n vasf\u0131, orman olup olmamas\u0131, ve mera tar\u0131m arazisi gibi unsurlar maden i\u015fletme ruhsat\u0131 d\u00fczenlenebilmesi i\u00e7in MAPEG taraf\u0131ndan aranmamaktad\u0131r. Maden sahas\u0131n\u0131n fiilen i\u015fletmeye a\u00e7\u0131labilmesi i\u00e7in ayr\u0131ca i\u015fletme izni gerekmektedir. \u0130\u015fletme izni i\u00e7in bir\u00e7ok \u00f6zel kanunda ve farkl\u0131 bakanl\u0131klarda birbirinden farkl\u0131 ve raporlamalar\u0131 gerektiren s\u00fcre\u00e7ler bulunmaktad\u0131r. Bu y\u00fck\u00fcml\u00fcl\u00fcklerin yerine getirilmesi ruhsat sahibinin sorumlulu\u011funda bulunmakta bu izinlerin ruhsat sahibi taraf\u0131ndan al\u0131nmas\u0131 gerekmektedir. Bir maden sahas\u0131n\u0131n i\u015fletme ruhsat sahas\u0131n\u0131n faaliyete ge\u00e7irilebilmesi i\u00e7in \u00f6ncelikle ve genel olarak \u00c7ED s\u00fcrecinin \u00c7ED gerekli de\u011fildir veya \u00c7ED olumlu karar\u0131 neticelenmesi \u00c7ED s\u00fcrecine ba\u011fl\u0131 olarak m\u00fclkiyet izinlerinin Orman, mera izinlerinin al\u0131nmas\u0131 devam\u0131nda GSM i\u015fyeri a\u00e7ma ve \u00e7al\u0131\u015fma ruhsat\u0131n\u0131n d\u00fczenlenmesi gerekmektedir. Bu s\u00fcre\u00e7ler tamamland\u0131ktan sonra ancak maden i\u015fletme izni d\u00fczenlenmektedir. \u0130\u015fleyen bu s\u00fcre\u00e7lerin tamam\u0131 ayn\u0131 anda y\u00fcr\u00fct\u00fclemeyen, bir iznin al\u0131nmas\u0131 di\u011ferine ba\u015fvuru i\u00e7in gerekli k\u0131l\u0131nan ve birbirine ba\u011f\u0131ml\u0131 silsile halinde y\u00fcr\u00fcyen s\u00fcre\u00e7lerdir.<\/p>\n<p>5. Anayasa\u2019n\u0131n 2. maddesinde belirtilen hukuk devleti; eylem ve i\u015flemleri hukuka uygun, insan haklar\u0131na sayg\u0131l\u0131, bu hak ve \u00f6zg\u00fcrl\u00fckleri koruyup g\u00fc\u00e7lendiren, her alanda adil bir hukuk d\u00fczeni kurup bunu geli\u015ftirerek s\u00fcrd\u00fcren, Anayasa\u2019ya ayk\u0131r\u0131 durum ve tutumlardan ka\u00e7\u0131nan, hukuki g\u00fcvenli\u011fi sa\u011flayan, hukuk kurallar\u0131yla kendini ba\u011fl\u0131 sayan ve yarg\u0131 denetimine a\u00e7\u0131k olan devlettir.<\/p>\n<p>6. Hukuk devletinin temel ilkelerinden biri belirliliktir. Bu ilkeye g\u00f6re yasal d\u00fczenlemelerin hem ki\u015filer hem de idare y\u00f6n\u00fcnden herhangi bir duraksamaya ve ku\u015fkuya yer vermeyecek \u015fekilde a\u00e7\u0131k, net, anla\u015f\u0131l\u0131r, uygulanabilir ve nesnel olmas\u0131, ayr\u0131ca kamu otoritelerinin keyf\u00ee uygulamalar\u0131na imk\u00e2n tan\u0131mamas\u0131 gerekir. Belirlilik ilkesi; hukuksal g\u00fcvenlikle ba\u011flant\u0131l\u0131 olup bireyin kanundan, belirli bir kesinlik i\u00e7inde, hangi somut eylem ve olguya hangi hukuksal yapt\u0131r\u0131m\u0131n veya sonucun ba\u011fland\u0131\u011f\u0131n\u0131, bunlar\u0131n idareye hangi m\u00fcdahale yetkisini verdi\u011fini bilmesini zorunlu k\u0131lmaktad\u0131r.<\/p>\n<p>7. Anayasa\u2019n\u0131n 38. maddesinin birinci f\u0131kras\u0131nda, \u201cKimse, i\u015flendi\u011fi zaman y\u00fcr\u00fcrl\u00fckte bulunan kanunun su\u00e7 saymad\u0131\u011f\u0131 bir fiilden dolay\u0131 cezaland\u0131r\u0131lamaz.\u201d denilerek su\u00e7un kanunili\u011fi ilkesi; \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda da \u201cCeza ve ceza yerine ge\u00e7en g\u00fcvenlik tedbirleri ancak kanunla konulur.\u201d ifadesine yer verilerek cezan\u0131n kanunili\u011fi ilkesi getirilmi\u015ftir. Anayasa\u2019n\u0131n an\u0131lan maddesinde yer alan su\u00e7ta ve cezada kanunilik ilkesi uyar\u0131nca yasaklanan eylemler ile bunlara verilecek cezalar\u0131n hi\u00e7bir ku\u015fkuya yer b\u0131rakmayacak bi\u00e7imde kanunda g\u00f6sterilmesi ayr\u0131ca kural\u0131n a\u00e7\u0131k, anla\u015f\u0131l\u0131r ve s\u0131n\u0131rlar\u0131n\u0131n belirli olmas\u0131 gerekmektedir. Ki\u015filerin yasaklanan eylemleri \u00f6nceden bilmeleri gerekti\u011fi d\u00fc\u015f\u00fcncesine dayanan bu ilkeyle temel hak ve \u00f6zg\u00fcrl\u00fcklerin g\u00fcvence alt\u0131na al\u0131nmas\u0131 ama\u00e7lanmaktad\u0131r.<\/p>\n<p>8. Anayasa\u2019n\u0131n an\u0131lan maddesinde idari su\u00e7 ve cezalar ile adli su\u00e7 ve cezalar aras\u0131nda bir ayr\u0131m yap\u0131lmad\u0131\u011f\u0131ndan her ikisi de bu maddede \u00f6ng\u00f6r\u00fclen ilkelere tabidir. Adli ve idari su\u00e7larda davran\u0131\u015f normlar\u0131na ayk\u0131r\u0131 ve haks\u0131zl\u0131k te\u015fkil eden bir fiille, kanun koyucunun koruma alt\u0131na ald\u0131\u011f\u0131 hukuki bir de\u011ferin ihlali s\u00f6z konusu olup adli ve idari cezalar\u0131n her ikisi de cebir i\u00e7ermektedir (AYM, E.2015\/85, K.2016\/3, 13\/1\/2016, \u00a713).<\/p>\n<p>9. Bu ba\u011flamda Anayasa\u2019n\u0131n 38. maddesinin gerek\u00e7esinde de belirtildi\u011fi \u00fczere su\u00e7ta ve cezada kanunilik ilkesi, kanun koyucunun a\u00e7\u0131k su\u00e7 h\u00fckm\u00fc koymas\u0131na engel de\u011filse de bir idari su\u00e7 ve cezan\u0131n Anayasa\u2019n\u0131n an\u0131lan maddesine uygun kabul edilebilmesi i\u00e7in su\u00e7 konusunun ve yapt\u0131r\u0131m\u0131n\u0131n teredd\u00fcde yer b\u0131rakmayacak \u015fekilde kanunda a\u00e7\u0131k\u00e7a belirtilmesi ve ki\u015filerin belirlenen somut su\u00e7 fiilini \u00f6nceden bilmelerini sa\u011flayacak kanuni g\u00fcvencenin sa\u011flanmas\u0131 gerekir. Nitekim Anayasa Mahkemesi kararlar\u0131nda da belirtildi\u011fi \u00fczere idari nitelikteki su\u00e7lar\u0131n kanunda belirlenerek kar\u015f\u0131l\u0131\u011f\u0131nda cezas\u0131n\u0131n g\u00f6sterilmi\u015f olmas\u0131 yeterli olup su\u00e7 say\u0131lan eylemler ve cezas\u0131, bireylerin hangi somut fiil ve olguya hangi hukuksal yapt\u0131r\u0131m\u0131n veya sonucun ba\u011fland\u0131\u011f\u0131n\u0131 belirli bir a\u00e7\u0131kl\u0131k ve kesinlikte \u00f6ng\u00f6rebilmelerine imk\u00e2n verecek \u015fekilde kanunda g\u00f6sterildikten sonra yasama organ\u0131n\u0131n uzmanl\u0131k ve idare tekni\u011fine ili\u015fkin konularda al\u0131nacak \u00f6nlemlerin kamu hizmetlerinin ve toplumsal ihtiya\u00e7lar\u0131n de\u011fi\u015fkenli\u011fi \u00e7er\u00e7evesinde duyulan gereksinmelere uygunlu\u011funu sa\u011flamak amac\u0131yla y\u00fcr\u00fctme organ\u0131na yetki vermesi idari kararlarla su\u00e7 ihdas\u0131 ve dolay\u0131s\u0131yla kanunilik ve belirlilik ilkesinin ihlali anlam\u0131na gelmemektedir (AYM, E.2018\/30, K.2018\/94, 25\/9\/2018, \u00a715; E.2019\/110, K.2021\/85, 11\/11\/2021, \u00a7 21).<\/p>\n<p>10. Bununla birlikte temel hak ve h\u00fcrriyetlerin s\u0131n\u0131rland\u0131r\u0131lmas\u0131na ili\u015fkin kanunlar\u0131n \u015feklen var olmas\u0131 yeterli de\u011fildir. Kanunilik \u00f6l\u00e7\u00fct\u00fc ayn\u0131 zamanda maddi bir i\u00e7eri\u011fi de gerektirmekte olup bu noktada kanunun niteli\u011fi \u00f6nem kazanmaktad\u0131r. Kanunla s\u0131n\u0131rlama \u00f6l\u00e7\u00fct\u00fc s\u0131n\u0131rlaman\u0131n eri\u015filebilirli\u011fini, \u00f6ng\u00f6r\u00fclebilirli\u011fini ve kesinli\u011fini ifade etmekte; b\u00f6ylece uygulay\u0131c\u0131n\u0131n keyf\u00ee davran\u0131\u015flar\u0131n\u0131n \u00f6n\u00fcne ge\u00e7ti\u011fi gibi ki\u015finin hukuku bilmesine de yard\u0131mc\u0131 olmakta; bu y\u00f6n\u00fcyle hukuk g\u00fcvenli\u011fi teminat\u0131 sa\u011flamaktad\u0131r (Halime Sare Aysal [GK], B. No: 2013\/1789, 11\/11\/2015, \u00a7 62; Fatih Saraman, \u00a7 66; Turgut Duman, \u00a7 67; Tamer Mahmuto\u011flu, \u00a7 104; Ay\u015fe Ortak, \u00a7 73).<\/p>\n<p>11. Kanunun bu gerekliliklere uygun oldu\u011funun s\u00f6ylenebilmesi i\u00e7in yeterince ula\u015f\u0131labilir olmas\u0131, vatanda\u015flar\u0131n belirli bir olaya uygulanabilir nitelikteki hukuk kurallar\u0131n\u0131n varl\u0131\u011f\u0131 hakk\u0131nda yeterli bilgiye sahip olabilmesi, ayr\u0131ca ilgili normun keyf\u00eeli\u011fe kar\u015f\u0131 uygun bir koruma sa\u011flamas\u0131, yetkili makamlara verilen yetkinin geni\u015fli\u011fini ve icra edilme bi\u00e7imlerini yeterli bir netlikte tan\u0131mlamas\u0131 gerekir (Halime Sare Aysal, \u00a7 63; Fatih Saraman, \u00a7 67; Turgut Duman, \u00a7 68; Tamer Mahmuto\u011flu, \u00a7 105; Ay\u015fe Ortak \u00a7 74).<\/p>\n<p>12. Hukukun kendisi -beraberinde getirece\u011fi idari prati\u011fin d\u0131\u015f\u0131nda- s\u00f6z konusu i\u015flemin me\u015fru amac\u0131n\u0131 da g\u00f6z\u00f6n\u00fcnde tutarak keyf\u00ee m\u00fcdahalelere kar\u015f\u0131 bireyi korumak i\u00e7in yetkili makamlara b\u0131rak\u0131lan takdir yetkisinin kapsam\u0131n\u0131 yeterince a\u00e7\u0131k bir \u015fekilde g\u00f6stermelidir. Di\u011fer bir anlat\u0131mla hukuk sistemi, kamu makamlar\u0131na hangi ko\u015fullarda ve hangi s\u0131n\u0131rlar i\u00e7inde m\u00fcdahalelerde bulunma yetkisinin verildi\u011fini a\u00e7\u0131k ifadelerle ortaya koyacak nitelikte olmal\u0131 ve bu ba\u011flamda ilgili m\u00fcdahalenin muhataplar\u0131na m\u00fcdahaleye zemin haz\u0131rlayan ko\u015fullar ile m\u00fcdahalenin sonu\u00e7lar\u0131 a\u00e7\u0131s\u0131ndan bir \u00f6ng\u00f6r\u00fcde bulunabilmeleri imk\u00e2n\u0131 tan\u0131mal\u0131d\u0131r (Halime Sare Aysal, \u00a7 64; Fatih Saraman, \u00a7 68; Turgut Duman, \u00a7 69; Tamer Mahmuto\u011flu, \u00a7 106; Ay\u015fe Ortak \u00a7 75).<\/p>\n<p>13. \u00d6te yandan her ihtimale \u00e7\u00f6z\u00fcm getiremeyecek olan yasal mevzuat\u0131n sa\u011flad\u0131\u011f\u0131 koruma seviyesi, b\u00fcy\u00fck \u00f6l\u00e7\u00fcde ilgili metnin d\u00fczenledi\u011fi alan ve i\u00e7eri\u011fiyle birlikte muhataplar\u0131n\u0131n niteli\u011fi ve say\u0131s\u0131yla yak\u0131ndan ba\u011flant\u0131l\u0131d\u0131r. Bu nedenle kural\u0131n karma\u015f\u0131k olmas\u0131 ya da belirli \u00f6l\u00e7\u00fclerde soyutluk i\u00e7ermesi ve buna ba\u011fl\u0131 olarak hukuki yard\u0131m ile tam olarak anla\u015f\u0131labilir h\u00e2le gelmesi tek ba\u015f\u0131na hukuken \u00f6ng\u00f6r\u00fclebilirlik ilkesine ayk\u0131r\u0131 g\u00f6r\u00fclemez. Bu kapsamda hak ya da \u00f6zg\u00fcrl\u00fc\u011fe m\u00fcdahale eden kural belirli \u00f6l\u00e7\u00fclerdeki takdir alan\u0131n\u0131 elbette uygulay\u0131c\u0131ya b\u0131rakabilir. Fakat bu takdir alan\u0131n\u0131n s\u0131n\u0131rlar\u0131n\u0131n da yeterli a\u00e7\u0131kl\u0131kta belirlenmesi ve kural\u0131n \u00f6ng\u00f6r\u00fclebilirli\u011fini sa\u011flayacak \u015fekilde asgari bir kesinlik i\u00e7ermesi zaruridir (Halime Sare Aysal, \u00a7 65; Fatih Saraman, \u00a7 69; Turgut Duman, \u00a7 70; Tamer Mahmuto\u011flu, \u00a7 107; Ay\u015fe Ortak \u00a7 76).<\/p>\n<p>14. Nihayetinde s\u00f6z konusu ko\u015fullar\u0131n yerine getirilip getirilmedi\u011fini denetleyecek merci olan yarg\u0131 organlar\u0131, m\u00fcdahalelere dayanak olarak g\u00f6sterilen kanuni d\u00fczenlemelerin eri\u015filebilir, \u00f6ng\u00f6r\u00fclebilir ve kesin nitelikte olup olmad\u0131\u011f\u0131n\u0131 irdelemekle, en ba\u015fta da ilgili kanuni d\u00fczenlemeleri \u00f6nlerine gelen davalarda an\u0131lan \u00e7er\u00e7evede kalarak uygulamakla y\u00fck\u00fcml\u00fcd\u00fcr (Tamer Mahmuto\u011flu, \u00a7 108; Ay\u015fe Ortak \u00a7 77).<\/p>\n<p>15. \u0130tiraz konusu kural incelendi\u011finde bu izinlerin tamam\u0131 ilgili mevzuatlar\u0131nda \u00f6ng\u00f6r\u00fclm\u00fc\u015f, Devlet kurumlar\u0131 taraf\u0131ndan onaylanan izinlerdir. Bu izinler i\u015fletme ruhsat\u0131 sonras\u0131 hepsi ayn\u0131 anda ba\u015fvurulup al\u0131nan izinler de\u011fillerdir. Birbirine ba\u011f\u0131ml\u0131 olan bir izin olmadan di\u011ferine ba\u015fvuru yap\u0131lamayan prosed\u00fcrleri i\u00e7ermektedir. Bu s\u00fcre\u00e7lerden herhangi birindeki gecikme nedeniyle i\u015fletme ruhsat\u0131 alan ger\u00e7ek ya da t\u00fczel ki\u015filer cezaland\u0131r\u0131lmaktad\u0131r.
