Ba\u015fvuru, kamu g\u00f6revlisinin \u00fcyesi oldu\u011fu sendikan\u0131n \u00e7a\u011fr\u0131s\u0131 \u00fczerine d\u00fczenlenen bas\u0131n a\u00e7\u0131klamalar\u0131na kat\u0131lmas\u0131 nedeniyle disiplin cezas\u0131 ile cezaland\u0131r\u0131lmas\u0131n\u0131n toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131n\u0131 ihlal etti\u011fi iddias\u0131na ili\u015fkindir.<\/p>\n<p>2. Ba\u015fvurucu, ba\u015fvuruya konu olaylar\u0131n ya\u015fand\u0131\u011f\u0131 tarihte Nusaybin&#8217;de bulunan bir lisede \u00f6\u011fretmen olarak g\u00f6rev yapmaktad\u0131r. Ba\u015fvurucu E\u011fitim ve Bilim Emek\u00e7ileri Sendikas\u0131 (E\u011e\u0130T\u0130M SEN) \u00fcyesidir.<\/p>\n<p>3. Somut olay 2015 y\u0131l\u0131 Haziran ay\u0131ndan itibaren yo\u011fun bir \u015fekilde maruz kal\u0131nan ter\u00f6r eylemleriyle m\u00fccadele kapsam\u0131nda baz\u0131 il\u00e7elerde ilan edilen soka\u011fa \u00e7\u0131kma yasaklar\u0131 (arka plan bilgisi i\u00e7in bkz. Dilek Kaya, B. No: 2018\/14313, 17\/7\/2019, \u00a7\u00a7 8-11) ile yine ayn\u0131 y\u0131l\u0131n ekim ay\u0131nda meydana gelen Ankara Tren Gar\u0131 sald\u0131r\u0131s\u0131 (arka plan bilgisi i\u00e7in bkz. Tayyip Akbudak, B. No: 2018\/5558, 11\/9\/2019, \u00a7\u00a7 8-13) etraf\u0131nda \u015fekillenmi\u015ftir.<\/p>\n<p>4. E\u011e\u0130T\u0130M SEN, ba\u011fl\u0131 oldu\u011fu Kamu Emek\u00e7ileri Sendikalar\u0131 Konfederasyonunun (KESK) alm\u0131\u015f oldu\u011fu kararlar do\u011frultusunda (Dilek Kaya, \u00a714; Tayyip Akbudak, \u00a7 16) bahse konu olaylar\u0131 protesto etmek amac\u0131yla \u00fcyelerinin belirli tarihlerde g\u00f6reve gitmeyerek yap\u0131lacak bas\u0131n a\u00e7\u0131klamalar\u0131na kat\u0131lmalar\u0131 y\u00f6n\u00fcnde kararlar alm\u0131\u015ft\u0131r. An\u0131lan kararlar\u0131n ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;-E\u011ftim-Sen Merkez Y\u00fcr\u00fctme Kurulunun 10\/10\/2015 tarih ve 98 say\u0131l\u0131 karar\u0131: &#8230;10 Ekim 2015&#8217;te Ankara&#8217;da Emek, Bar\u0131\u015f ve Demokrasi Mitingine yap\u0131lan sald\u0131r\u0131ya tepki g\u00f6stermek i\u00e7in,&#8230;, 12-13 Ekim tarihlerinde 2(iki) g\u00fcnl\u00fck grev karar\u0131na kat\u0131l\u0131m sa\u011flanmas\u0131; ayr\u0131ca bas\u0131n a\u00e7\u0131klamalar\u0131 ve y\u00fcr\u00fcy\u00fc\u015fler yap\u0131lmas\u0131na, bildirilerin okullarda ve i\u015f yerlerinde, illerde belirlenecek alanlarda okunmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>&#8211; E\u011fitim-Sen Merkez Y\u00fcr\u00fctme Kurulunun 25\/12\/2015 tarih ve 12 say\u0131l\u0131 karar\u0131: 29 Aral\u0131k 2015 tarihinde,&#8230;, Sava\u015fa Hay\u0131r Bar\u0131\u015f\u0131 Savunaca\u011f\u0131z \u015fiar\u0131yla ger\u00e7ekle\u015ftirece\u011fi \u00fcretimden gelen g\u00fcc\u00fcm\u00fcz\u00fc kullanarak 1 g\u00fcnl\u00fck hizmet \u00fcretmeme karar\u0131n\u0131n i\u015f kolumuzda hayata ge\u00e7irilmesine oy birli\u011fi ile karar verilmi\u015ftir.&#8221;<\/p>\n<p>5. Ba\u015fvurucu, yukar\u0131da ifade edilen kararlar kapsam\u0131nda g\u00f6reve gitmeyerek bahse konu bas\u0131n a\u00e7\u0131klamalar\u0131na kat\u0131lm\u0131\u015ft\u0131r. \u0130dare, s\u00f6z konusu eylemleri nedeniyle ba\u015fvurucu hakk\u0131nda disiplin soru\u015fturmas\u0131 ba\u015flatm\u0131\u015f; soru\u015fturma neticesinde farkl\u0131 siyasi parti temsilcilerinin de kat\u0131ld\u0131\u011f\u0131 bas\u0131n a\u00e7\u0131klamalar\u0131n\u0131n siyasi i\u00e7erikli oldu\u011fu ve yap\u0131ld\u0131\u011f\u0131 ortamda iktidar partisinin aleyhinde ifadeler kullan\u0131larak k\u00f6t\u00fclendi\u011fi sonucuna varm\u0131\u015ft\u0131r. Nihayetinde ba\u015fvurucunun 4\/7\/1965 tarihli ve 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanunu&#8217;nun 125. maddesinin birinci f\u0131kras\u0131n\u0131n (D) bendinin (o) alt bendi uyar\u0131nca &#8220;herhangi bir siyasi parti yarar\u0131na veya zarar\u0131na fiilen faaliyette bulundu\u011fu&#8221; gerek\u00e7esiyle kademe ilerlemesinin durdurulmas\u0131 cezas\u0131 ile cezaland\u0131r\u0131lmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>6. Ba\u015fvurucu, hakk\u0131nda tesis edilen disiplin cezas\u0131n\u0131n iptali istemiyle idare mahkemesine ba\u015fvurmu\u015ftur. \u0130lk derece mahkemesi, sendikan\u0131n eylem kararlar\u0131na yer verdi\u011fi karar\u0131nda ba\u015fvurucunun \u00fczerine at\u0131l\u0131 fiilin s\u00fcbuta erdi\u011fini belirterek davan\u0131n reddine karar vermi\u015ftir. S\u00f6z konusu karar istinaf kanun yolunda kesinle\u015fmi\u015ftir.<\/p>\n<p>7. Ba\u015fvurucu, nihai karar\u0131 19\/1\/2020 tarihinde \u00f6\u011frendikten sonra 13\/2\/2020 tarihinde bireysel ba\u015fvuruda bulunmu\u015ftur.<\/p>\n<p>8. Ba\u015fvurunun kabul edilebilirlik ve esas incelemesinin B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>II. DE\u011eERLEND\u0130RME<\/p>\n<p>9. Ba\u015fvurucu; \u00fcyesi oldu\u011fu sendikan\u0131n ald\u0131\u011f\u0131 kararlar\u0131 icra etmesi nedeniyle disiplin cezas\u0131yla cezaland\u0131r\u0131ld\u0131\u011f\u0131n\u0131, b\u00f6lge idare mahkemesi karar\u0131n\u0131n gerek\u00e7esiz oldu\u011funu ve \u00fcyesi oldu\u011fu sendikaya y\u00f6nelik ayr\u0131mc\u0131l\u0131k yap\u0131ld\u0131\u011f\u0131n\u0131 belirterek ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn, adil yarg\u0131lanma hakk\u0131n\u0131n ve e\u015fitlik ilkesinin ihlal edildi\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr. Adalet Bakanl\u0131\u011f\u0131 g\u00f6r\u00fc\u015f\u00fcnde, mevcut ba\u015fvuruda ba\u015fvurucunun ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlal edilip edilmedi\u011fi konusunda Anayasa Mahkemesi taraf\u0131ndan yap\u0131lacak incelemede ilgili ulusal ve uluslararas\u0131 mevzuat h\u00fck\u00fcmleri ile yarg\u0131 i\u00e7tihatlar\u0131n\u0131n dikkate al\u0131nmas\u0131 gerekti\u011fi belirtilmi\u015ftir.<\/p>\n<p>10. Anayasa Mahkemesi, \u00f6nceki kararlar\u0131nda kamu g\u00f6revlileri sendikalar\u0131n\u0131n faaliyet alanlar\u0131na ili\u015fkin olduk\u00e7a geni\u015f a\u00e7\u0131klamalarda bulunmu\u015ftur (Ahmet Parmaks\u0131z [GK], B. No: 2017\/29263, 22\/5\/2019, \u00a7\u00a7 50,62; Ayfer Altunta\u015f ve \u0130kbal \u00dcnzile G\u00fcrsoy, B. No: 2018\/24874, 31\/3\/2022, \u00a7\u00a7 26,36). Buna g\u00f6re somut olaya konu sendika kararlar\u0131n\u0131n (bkz. \u00a7 3) kamu g\u00f6revlileri sendikalar\u0131n\u0131n \u00e7ekirdek faaliyet alan\u0131 ile ilgili olmad\u0131\u011f\u0131 anla\u015f\u0131ld\u0131\u011f\u0131ndan bas\u0131n a\u00e7\u0131klamalar\u0131na kat\u0131l\u0131m nedeniyle yap\u0131lan m\u00fcdahalenin bir b\u00fct\u00fcn h\u00e2linde toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131 kapsam\u0131nda incelenmesine karar vermi\u015ftir (benzer y\u00f6ndeki de\u011ferlendirmeler i\u00e7in bkz. Leyla Sezen, B. No: 2016\/15197, 29\/5\/2019, \u00a7 22; G\u00fclistan Atasoy ve di\u011ferleri [GK], B. No: 2017\/15845, 21\/1\/2021, \u00a7 39; eylem y\u00f6n\u00fcnden benzer y\u00f6ndeki de\u011ferlendirmeler i\u00e7in Sercan Av\u015far, B. No: 2016\/63088, 9\/6\/2021, \u00a7 22).<\/p>\n<p>11. A\u00e7\u0131k\u00e7a dayanaktan yoksun olmad\u0131\u011f\u0131 ve kabul edilemezli\u011fine karar verilmesini gerektirecek ba\u015fka bir neden de bulunmad\u0131\u011f\u0131 anla\u015f\u0131lan ba\u015fvurunun kabul edilebilir oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>12. Toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131na y\u00f6nelik m\u00fcdahalenin dayana\u011f\u0131 olan 657 say\u0131l\u0131 Kanun\u2019un 125. maddesinin birinci f\u0131kras\u0131n\u0131n (D) bendinin (o) alt bendinin kanunla s\u0131n\u0131rlama \u00f6l\u00e7\u00fct\u00fcn\u00fc kar\u015f\u0131lad\u0131\u011f\u0131 sonucuna var\u0131lm\u0131\u015ft\u0131r. M\u00fcdahalenin kamu hizmetlerinin tarafs\u0131zl\u0131\u011f\u0131n\u0131n ve nesnelli\u011finin sa\u011flanmas\u0131na y\u00f6nelik \u00f6nlemlerin bir par\u00e7as\u0131 oldu\u011fu, Anayasa&#8217;n\u0131n 34. maddesinin ikinci f\u0131kras\u0131nda yer alan kamu d\u00fczeninin korunmas\u0131 me\u015fru amac\u0131n\u0131 ta\u015f\u0131d\u0131\u011f\u0131 de\u011ferlendirilmi\u015ftir. Toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131na y\u00f6nelik bir m\u00fcdahalenin demokratik toplum d\u00fczeninin gereklerine uygun kabul edilebilmesi i\u00e7in zorunlu bir toplumsal ihtiyac\u0131 kar\u015f\u0131lamas\u0131 ve orant\u0131l\u0131 olmas\u0131 gerekir (Y\u0131lmaz G\u00fcne\u015f ve Yusuf Karada\u015f, B. Toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131, demokratik toplumun en temel de\u011ferleri aras\u0131nda yer almakta olup bu hakk\u0131n bireylerin ortak fikirlerini birlikte savunmak ve ba\u015fkalar\u0131na duyurmak i\u00e7in bir araya gelebilme imk\u00e2n\u0131n\u0131 korumay\u0131 ama\u00e7lamaktad\u0131r. Kolektif bir \u015fekilde kullan\u0131lan ve d\u00fc\u015f\u00fcncelerini ifade etmek isteyen ki\u015filere \u015fiddeti d\u0131\u015flayan y\u00f6ntemlerle d\u00fc\u015f\u00fcncelerini a\u00e7\u0131klama imk\u00e2n\u0131 veren bu hak \u00e7o\u011fulcu demokrasilerin geli\u015fmesinde zorunlu olan farkl\u0131 d\u00fc\u015f\u00fcncelerin ortaya \u00e7\u0131kmas\u0131, korunmas\u0131 ve yay\u0131lmas\u0131n\u0131 g\u00fcvence alt\u0131na almaktad\u0131r (Dilan \u00d6g\u00fcz Canan, B. Bu hak, ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn \u00f6zel bir bi\u00e7imidir. Anayasal haklar i\u00e7inde \u00f6zerk rol\u00fcn\u00fcn ve \u00f6zel uygulama alan\u0131n\u0131n varl\u0131\u011f\u0131na ra\u011fmen toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131, ayn\u0131 zamanda ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc \u0131\u015f\u0131\u011f\u0131nda de\u011ferlendirilmelidir. \u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn demokratik ve \u00e7o\u011fulcu bir toplumdaki \u00f6nemi, toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131 i\u00e7in de ge\u00e7erlidir (Dilan \u00d6g\u00fcz Canan, \u00a7 34; Ali R\u0131za \u00d6zer ve di\u011ferleri, \u00a7 115; Osman Erbil, \u00a7\u00a7 31, 45; E\u011fitim ve Bilim Emek\u00e7ileri Sendikas\u0131 ve di\u011ferleri, \u00a7 72; G\u00fcl\u015fah \u00d6zt\u00fcrk ve di\u011ferleri, B. Somut olayda, ba\u015fvurucu, E\u011e\u0130T\u0130M SEN&#8217;in \u00e7a\u011fr\u0131s\u0131 \u00fczerine belirli tarihlerde g\u00f6reve gitmeyerek ayn\u0131 tarihlerde organize edilen bas\u0131n a\u00e7\u0131klamalar\u0131na kat\u0131lmas\u0131 nedeniyle kademe ilerlemesinin durdurulmas\u0131 disiplin cezas\u0131 ile cezaland\u0131r\u0131lm\u0131\u015ft\u0131r. \u0130lk derece mahkemesi, ba\u015fvurucunun \u00fczerine at\u0131l\u0131 olan fiilin s\u00fcbuta erdi\u011fi gerek\u00e7esiyle davan\u0131n reddine karar vermi\u015ftir. An\u0131lan karar istinaf kanun yolunda kesinle\u015fmi\u015ftir (bkz. \u00a7\u00a7 4, 6).<\/p>\n<p>16. Anayasa Mahkemesi Dilek Kaya ve Tayyip Akbudak kararlar\u0131nda ba\u015fvuru konusu ile ayn\u0131 sendika kararlar\u0131 nedeniyle g\u00f6reve gitmeyen ba\u015fvuruculara yap\u0131lan ayl\u0131ktan kesme disiplin cezas\u0131 \u015feklindeki m\u00fcdahaleleri \u00f6rg\u00fctlenme \u00f6zg\u00fcrl\u00fc\u011f\u00fc y\u00f6n\u00fcnden incelemi\u015ftir. Buna g\u00f6re eylemlerin \u00fclkenin i\u00e7 siyasetine ili\u015fkin sosyopolitik unsurlar\u0131n a\u011f\u0131rl\u0131kta oldu\u011fu bir amaca ili\u015fkin oldu\u011funu ve konusunun sendikalar\u0131n \u00e7ekirdek faaliyet alan\u0131nda kalmad\u0131\u011f\u0131n\u0131 belirterek sendika \u00fcyelerinin ekonomik ve sosyal menfaatleriyle do\u011frudan ilgili olmayan ve politik y\u00f6n\u00fc a\u011f\u0131r basan bir ama\u00e7la i\u015fe gitmeme \u015feklinde bir eylemin yol a\u00e7aca\u011f\u0131 sonu\u00e7lara devlet idaresinin ve toplumun katlanmas\u0131n\u0131 gerektiren bir sebep bulunmad\u0131\u011f\u0131 kanaatine ula\u015fm\u0131\u015ft\u0131r (Dilek Kaya, \u00a7 60; Tayyip Akbudak, \u00a7 73). Ancak somut olaya konu m\u00fcdahalenin bahse konu kararlarda oldu\u011fu gibi 657 say\u0131l\u0131 Kanun&#8217;un 125. maddesinin birinci f\u0131kras\u0131n\u0131n (C) bendinin (b) alt bendinde yer alan &#8220;\u00d6z\u00fcrs\u00fcz olarak bir veya iki g\u00fcn g\u00f6reve gelmemek&#8221; de\u011fil ayn\u0131 maddenin birinci f\u0131kras\u0131n\u0131n (D) bendinin (o) alt bendindeki &#8220;Herhangi bir siyasi parti yarar\u0131na veya zarar\u0131na fiilen faaliyette bulunmak&#8221; nedeniyle yap\u0131ld\u0131\u011f\u0131 g\u00f6zetildi\u011finde ba\u015fvurunun bu y\u00f6n\u00fcyle irdelenmesi gerekir.<\/p>\n<p>17. A\u00e7\u0131kt\u0131r ki idare ve yarg\u0131 mercileri, ba\u015fvurucunun eylemiyle t\u00e2bi oldu\u011fu stat\u00fc hukukuna ayk\u0131r\u0131 hareket etti\u011fi sonucuna varm\u0131\u015ft\u0131r. Anayasa&#8217;n\u0131n 128. maddesinin birinci f\u0131kras\u0131na g\u00f6re devletin y\u00fcr\u00fctmekle y\u00fck\u00fcml\u00fc oldu\u011fu kamu hizmetlerinin gerektirdi\u011fi asli ve s\u00fcrekli g\u00f6revler, memurlar ve di\u011fer kamu g\u00f6revlileri eliyle g\u00f6r\u00fclmektedir. Anayasa&#8217;n\u0131n 128. maddesinin ikinci f\u0131kras\u0131nda ayr\u0131ca \u00f6nemi nedeniyle memurlar\u0131n ve di\u011fer kamu g\u00f6revlilerinin g\u00f6rev ve yetkilerinin, haklar\u0131n\u0131n ve y\u00fck\u00fcml\u00fcl\u00fcklerinin kanun ile d\u00fczenlenece\u011fi de ifade edilmi\u015ftir. Anayasa&#8217;n\u0131n 129. maddesinin birinci f\u0131kras\u0131nda ise memurlar ve di\u011fer kamu g\u00f6revlilerinin Anayasa ve kanunlara sad\u0131k kalarak faaliyette bulunmakla y\u00fck\u00fcml\u00fc olduklar\u0131n\u0131n alt\u0131 \u00e7izilmi\u015ftir. 657 say\u0131l\u0131 Kanunu\u2019nun 7. maddesine g\u00f6re ise devlet memuru, tarafs\u0131zl\u0131\u011f\u0131n\u0131 g\u00f6lgeleyecek \u015fekilde bir siyasi parti, ki\u015fi veya z\u00fcmrenin yarar\u0131n\u0131 veya zarar\u0131n\u0131 hedef tutan bir davran\u0131\u015fta bulunamayaca\u011f\u0131 gibi siyasi ve ideolojik ama\u00e7l\u0131 beyanda da bulunamaz. Nitekim ayn\u0131 Kanun&#8217;un 125. maddesinde herhangi bir siyasi parti yarar\u0131na veya zarar\u0131na faaliyette bulunan devlet memurlar\u0131na disiplin cezalar\u0131 verilece\u011fi ifade edilmi\u015ftir.<\/p>\n<p>18. Anayasal ve ilgili yasal \u00e7er\u00e7eve g\u00f6stermektedir ki gerek Anayasa koyucu gerekse kanun koyucu kamu hizmetlerinin Anayasa\u2019ya sadakat \u00f6devi ile tarafs\u0131zl\u0131k y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne ayk\u0131r\u0131 davranan ya da ayk\u0131r\u0131 davranabilece\u011fi yolunda hakl\u0131 ve objektif bir kanaat uyand\u0131ran kamu g\u00f6revlileriyle y\u00fcr\u00fct\u00fclmesini arzu etmemektedir (\u015eah \u0130smail Harmanc\u0131, B. No: 2018\/15359, 17\/11\/2021, \u00a7 40). S\u00f6z konusu arzunun bir sonucu olarak kanun koyucu kamu g\u00f6revlisinin meslek hayat\u0131 ile s\u0131n\u0131rl\u0131 olacak \u015fekilde apolitik g\u00f6r\u00fcnmesini ama\u00e7lam\u0131\u015f ve bu \u015fekilde kamu g\u00fcc\u00fcn\u00fc kullanan g\u00f6revlilerin siyasi kutupla\u015fmalarda yer almas\u0131n\u0131n \u00f6n\u00fcne ge\u00e7erek idareye tarafs\u0131z bir pozisyon kazand\u0131rmak istemi\u015ftir (Levent Tun\u00e7el, B. No: 2017\/34185, 16\/3\/2022, \u00a7 44).<\/p>\n<p>19. Hi\u00e7 \u015f\u00fcphesiz anayasa ve kanun koyucunun s\u00f6z konusu beklentisi ba\u015fta ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc olmak \u00fczere temel hak ve \u00f6zg\u00fcrl\u00fckler alan\u0131nda kamu g\u00f6revlilerinin s\u0131radan bireylere g\u00f6re daha fazla s\u0131n\u0131rlanmalar\u0131 anlam\u0131na gelecektir. Bununla birlikte Anayasa Mahkemesinin \u00e7ok say\u0131da karar\u0131nda alt\u0131n\u0131 \u00e7izdi\u011fi gibi kamu g\u00f6revlisi olmak sa\u011flad\u0131\u011f\u0131 birtak\u0131m ayr\u0131cal\u0131klar ve avantajlar\u0131n yan\u0131nda baz\u0131 k\u00fclfet ve sorumluluklara katlanmay\u0131 ve di\u011fer ki\u015filerin tabi olmad\u0131\u011f\u0131 s\u0131n\u0131rlamalara tabi olmay\u0131 da gerektirir. Ki\u015fi kamu g\u00f6revine kendi iste\u011fi ile girmekle bu stat\u00fcn\u00fcn gerektirdi\u011fi ayr\u0131cal\u0131klardan yararlanmay\u0131 ve k\u00fclfetlere katlanmay\u0131 kabul etmi\u015f say\u0131l\u0131r, kamu hizmetinin kendine has \u00f6zellikleri bu avantaj ve s\u0131n\u0131rlamalar\u0131 zorunlu k\u0131lmaktad\u0131r (\u0130hsan Asutay, B. No: 2012\/606, 20\/2\/2014, \u00a7 38; Cem \u00d6zayd\u0131n, B. No: 2017\/26800, 13\/1\/2022, \u00a7 36; Elif G\u00fcneysu, B. No: 2017\/31733, 7\/10\/2021, \u00a7 42). Bu sebeplerle kamu g\u00f6revlilerinin ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne yap\u0131lan m\u00fcdahalelerde Anayasa Mahkemesi kamu g\u00f6revlisinin bu y\u00f6n\u00fcn\u00fc g\u00f6rmezden gelemez.<\/p>\n<p>20. Kamu g\u00f6revlileri tabi olduklar\u0131 s\u00f6z konusu devlet memurlu\u011fu stat\u00fclerinin -kanun ve di\u011fer alt mevzuata dayanan- gereklerini yerine getirmemeleri h\u00e2linde bir disiplin cezas\u0131 ile kar\u015f\u0131la\u015facakt\u0131r. Disiplin uygulamalar\u0131 devlet organizasyonu i\u00e7inde d\u00fczenin sa\u011flanmas\u0131 ve korunmas\u0131, memurun g\u00f6revine ba\u011flanmas\u0131, hizmetlerin en etkin ve verimli bir \u015fekilde y\u00fcr\u00fct\u00fclmesi i\u00e7in kullan\u0131l\u0131r; hukuki gerek\u00e7eleri ve sonu\u00e7lar\u0131 vard\u0131r. Disiplin uygulamalar\u0131n\u0131n nihai hedefi sa\u011flanan d\u00fczen sayesinde verimli bir \u00e7al\u0131\u015fma ortam\u0131n\u0131n ve nihai olarak da kamu yarar\u0131n\u0131n sa\u011flanmas\u0131d\u0131r. Bu bak\u0131mdan disiplin cezalar\u0131 memurlar\u0131n g\u00f6revlerini lay\u0131k\u0131yla ve uyum i\u00e7inde yerine getirmesi i\u00e7in \u00f6nemli bir ara\u00e7t\u0131r (Ayfer Altunta\u015f ve \u0130kbal \u00dcnzile G\u00fcrsoy, \u00a7 53). \u00d6te yandan m\u00fcnhas\u0131ran memurlar\u0131n g\u00f6revleriyle ilgili olmas\u0131 disiplin cezalar\u0131 hakk\u0131nda yap\u0131lan de\u011ferlendirmelerin ciddiyetini azaltmamaktad\u0131r. \u00c7\u00fcnk\u00fc d\u00fc\u015f\u00fcnce a\u00e7\u0131klamalar\u0131 kar\u015f\u0131l\u0131\u011f\u0131nda uygulanan disiplin cezalar\u0131n\u0131n kamu g\u00f6revlilerinin temel hak ve \u00f6zg\u00fcrl\u00fckleri \u00fczerinde bir cayd\u0131r\u0131c\u0131 etki olu\u015fturaca\u011f\u0131 a\u00e7\u0131kt\u0131r (Mehmet Alan\u00e7 ve di\u011ferleri [GK], B. No: 2017\/15462, 29\/9\/2021, \u00a7 49; \u015eah \u0130smail Harmanc\u0131, \u00a7 41).<\/p>\n<p>21. Bu nedenle Anayasa Mahkemesi daha \u00f6nceki kararlar\u0131nda, d\u00fc\u015f\u00fcnce a\u00e7\u0131klamalar\u0131 nedeniyle kamu g\u00f6revlileri hakk\u0131nda verilen disiplin cezalar\u0131na ili\u015fkin olarak idarenin ve bu t\u00fcr cezalar\u0131n hukuka uygunlu\u011funu denetleyen yarg\u0131 mercilerinin subjektif yorumlardan ka\u00e7\u0131nmalar\u0131 i\u00e7in yapmalar\u0131 gerekenleri a\u00e7\u0131klam\u0131\u015ft\u0131r. Bu itibarla kat\u0131ld\u0131\u011f\u0131 toplant\u0131lar\u0131n siyasi i\u00e7erikli oldu\u011fu de\u011ferlendirilerek (bkz. \u00a7 5) bir siyasi parti yarar\u0131na veya zarar\u0131na faaliyette bulundu\u011fu kabul edilen kamu g\u00f6revlisi ba\u015fvurucuya yap\u0131lan m\u00fcdahalenin toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131na ili\u015fkin oldu\u011fu ve bu hakk\u0131n ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn \u00f6zel bir bi\u00e7imini te\u015fkil etti\u011fi (bkz. \u00a7 14) g\u00f6z\u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda idare ve yarg\u0131 mercilerince somut olayda en az\u0131ndan \u00f6ncelikle \u015fu de\u011ferlendirmelerin yap\u0131lmas\u0131 beklenir (di\u011ferleri aras\u0131ndan bkz. Sinan Akbulut, B. No: 2019\/1396, 2\/11\/2022, \u00a7\u00a7 30-34; J\u00fclide Hansu, B. No: 2018\/21380, 3\/11\/2022, \u00a7\u00a7 29-33; Serdar Topal, B. No: 2018\/23179, 16\/11\/2022, \u00a7\u00a7 26-30):<\/p>\n<p>i. S\u00f6z konusu olan ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc oldu\u011fu i\u00e7in devlet memurlar\u0131n\u0131n da birer birey oldu\u011fu, siyasi g\u00f6r\u00fc\u015f sahibi olma, \u00fclke sorunlar\u0131yla ilgilenme, tercih yapma gibi sosyal y\u00f6nlere sahip olma haklar\u0131n\u0131n bulundu\u011fu g\u00f6zard\u0131 edilmemelidir (Hasan G\u00fcng\u00f6r, B. Sosyal y\u00f6nleri de bulunan bireyler olduklar\u0131 d\u00fc\u015f\u00fcn\u00fcld\u00fc\u011f\u00fcnde kamu g\u00f6revlilerinin her t\u00fcr d\u00fc\u015f\u00fcnce a\u00e7\u0131klamalar\u0131n\u0131n de\u011fil siyasi partiler lehine veya aleyhine olarak ba\u015fkalar\u0131n\u0131 ikna etme \u00e7abas\u0131 olarak kabul edilebilecek a\u00e7\u0131klamalar\u0131 propaganda olarak kabul edilmelidir. Bu kapsamda bir kamu g\u00f6revlisinin a\u00e7\u0131klad\u0131\u011f\u0131 d\u00fc\u015f\u00fcncenin ba\u015fkalar\u0131n\u0131 siyasi partiler lehine veya aleyhine ikna etme \u00e7abas\u0131 olarak kabul edilebilmesi i\u00e7in a\u00e7\u0131klaman\u0131n siyasi partilerle yahut siyasal meselelerle ilgili olmas\u0131 tek ba\u015f\u0131na yeterli kabul edilemez. Dolay\u0131s\u0131yla kamu g\u00f6revlisinin bulundu\u011fu konum ve \u00fcstlendi\u011fi devlet g\u00f6revinin -i\u00e7eri\u011fiyle birlikte de\u011ferlendirildi\u011finde- a\u00e7\u0131klaman\u0131n yap\u0131ld\u0131\u011f\u0131 ko\u015fullarda siyasi partiler lehine veya aleyhine olarak ba\u015fkalar\u0131n\u0131 ikna \u00e7abas\u0131 olarak vas\u0131fland\u0131rmaya elveri\u015fli oldu\u011fu ortaya konulmal\u0131d\u0131r (Sinan Akbulut, \u00a7 34).<\/p>\n<p>iii. Bununla birlikte somut olay\u0131n ko\u015fullar\u0131nda kamu g\u00f6revlisinin d\u00fc\u015f\u00fcnce a\u00e7\u0131klamas\u0131n\u0131 kamu g\u00f6revi stat\u00fcs\u00fcn\u00fcn ve g\u00f6rev yapt\u0131\u011f\u0131 alan\u0131n kendisine sa\u011flad\u0131\u011f\u0131 unvan\u0131 d\u00e2hil herhangi bir olana\u011f\u0131 kullanarak yapm\u0131\u015f ise bu g\u00f6sterilmelidir (kamu g\u00f6revinin niteli\u011fine ili\u015fkin olarak bkz. Adem Talas [GK], B. No: 2014\/12143, 16\/11\/2017, \u00a7 47).<\/p>\n<p>iv. Yap\u0131lan d\u00fc\u015f\u00fcnce a\u00e7\u0131klamas\u0131n\u0131n kamu hizmetlerinin s\u00fcreklili\u011fini, etkinli\u011fini, verimlili\u011fini ya da gere\u011fi gibi yerine getirilmesini ne \u015fekilde etkiledi\u011fi ve cezay\u0131 gerekli k\u0131lan sonu\u00e7lar\u0131n (devlet organizasyonu i\u00e7inde d\u00fczenin bozulmas\u0131, hizmetlerin y\u00fcr\u00fct\u00fclememesi gibi) neler oldu\u011fu veya bu t\u00fcr sonu\u00e7lara neden olmas\u0131n\u0131n kuvvetle muhtemel oldu\u011fu ortaya konulmal\u0131d\u0131r (disiplin cezas\u0131 ile cezaland\u0131r\u0131labilmeleri i\u00e7in kamu g\u00f6revlisinin fiillerinin memuriyetlerini etkiledi\u011finin g\u00f6sterilmesi gereklili\u011fine ili\u015fkin olarak bkz. H\u00fckmedilen disiplin cezas\u0131yla kamusal \u00f6nemi bulunan objektif amaca ula\u015f\u0131labilece\u011fi ba\u015fka bir deyi\u015fle kamu g\u00f6revlisinin cezaland\u0131r\u0131lmas\u0131n\u0131n zorunlu bir sosyal ihtiyaca kar\u015f\u0131l\u0131k geldi\u011fi g\u00f6sterilmeli, d\u00fc\u015f\u00fcnce a\u00e7\u0131klamas\u0131n\u0131n kamu g\u00f6revini etkileme derecesiyle orant\u0131l\u0131 bir disiplin cezas\u0131na h\u00fckmedilmedir (bkz. Mehmet Alan\u00e7 ve di\u011ferleri, \u00a7 45; \u015eah \u0130smail Harmanc\u0131, \u00a7 37; Ayfer Altunta\u015f ve \u0130kbal \u00dcnzile G\u00fcrsoy, \u00a7 45).<\/p>\n<p>vii. De\u011ferlendirmeler olduk\u00e7a a\u00e7\u0131k, spesifik ve tekil olarak yap\u0131lmal\u0131d\u0131r (bireyselle\u015ftirilmi\u015f de\u011ferlendirme zorunlulu\u011funa ili\u015fkin olarak bkz. \u015eah \u0130smail Harmanc\u0131, \u00a7 41).<\/p>\n<p>22. Bunun yan\u0131nda somut olayda oldu\u011fu gibi sendikalar\u0131n \u00e7a\u011fr\u0131s\u0131 \u00fczerine veya ba\u015fka \u015fekilde d\u00fczenlenmi\u015f ve yetkililerce siyasi mesajlar\u0131n verildi\u011fi kabul edilen toplant\u0131lar\u0131n s\u0131rf kat\u0131l\u0131mc\u0131s\u0131 olan kamu g\u00f6revlilerinin bir siyasi parti yarar\u0131na ya da zarar\u0131na faaliyette bulunduklar\u0131n\u0131 do\u011frudan kabul etmek m\u00fcmk\u00fcn de\u011fildir. Aksi durum ise bu t\u00fcr toplant\u0131lara kat\u0131lan kamu g\u00f6revlilerinin otomatik olarak disiplin cezalar\u0131 ile cezaland\u0131r\u0131lmalar\u0131na, ba\u015fta ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc ve toplant\u0131 hakk\u0131 olmak \u00fczere temel hak ve \u00f6zg\u00fcrl\u00fcklerinin ciddi \u015fekilde zarar g\u00f6rmesine neden olur. Dolay\u0131s\u0131yla an\u0131lan mercilerin bu gibi h\u00e2llerde somut olay\u0131n ko\u015fullar\u0131n\u0131 g\u00f6zeterek birtak\u0131m ilave de\u011ferlendirmelerde bulunmalar\u0131 da gerekir (G\u00fcven \u00c7elik ve Kadri Dursun, B. No: 2018\/5060, 8\/6\/2023, \u00a7 22; \u0130smail Tutal ve di\u011ferleri, B. No: 2019\/7199, 25\/1\/2024, \u00a7 22).<\/p>\n<p>23. Buna g\u00f6re ilgili toplant\u0131n\u0131n konusu, amac\u0131, kapsam\u0131 ve seyri a\u00e7\u0131k bir \u015fekilde ortaya konulmal\u0131 ve toplant\u0131ya konu edilen fikirlerin bar\u0131\u015f\u00e7\u0131l (silahs\u0131z ve sald\u0131r\u0131s\u0131z) bir \u015fekilde ifade edilip edilmedi\u011fi incelenmelidir. E\u011fer toplant\u0131 \u015fiddet i\u00e7eriyorsa veya bu toplant\u0131da \u015fiddete \u00e7a\u011fr\u0131da bulunuluyorsa bu toplant\u0131n\u0131n bar\u0131\u015f\u00e7\u0131l kabul edilmesi ve anayasal korumadan yararlanmas\u0131 m\u00fcmk\u00fcn de\u011fildir. Bununla birlikte her durumda siyasal ve toplumsal olaylarla ilgili olarak kamu g\u00f6revlisinin bilgi edinme merak\u0131 ve duyarl\u0131l\u0131\u011f\u0131n\u0131 g\u00f6sterme talebi de g\u00f6zetilerek kat\u0131l\u0131mc\u0131n\u0131n toplant\u0131daki rol\u00fcne (dinleyici, konu\u015fmac\u0131, slogan atan gibi) ili\u015fkin dikkatli bir ayr\u0131mda bulunulmas\u0131 gerekir (benzer de\u011ferlendirmeler i\u00e7in bkz. An\u0131lan merciler, s\u00f6z konusu bas\u0131n a\u00e7\u0131klamalar\u0131n\u0131n siyasi i\u00e7erikli oldu\u011funu veya ba\u015fvurucunun \u00fczerine at\u0131l\u0131 eylemin s\u00fcbuta erdi\u011fini belirtmek haricinde, Anayasa Mahkemesinin kamu g\u00f6revlisinin toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131na y\u00f6nelen bu gibi m\u00fcdahalelerde uygulanmas\u0131n\u0131 bekledi\u011fi ve yukar\u0131da s\u0131ralanan ilkeler (bkz. \u00a7\u00a7 21-23) kapsam\u0131nda ba\u015fvurucunun hangi fiilinin ne \u015fekilde bir siyasi partinin zarar\u0131na faaliyet olarak kabul edildi\u011fini a\u00e7\u0131klamam\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla ba\u015fvurucunun bas\u0131n a\u00e7\u0131klamalar\u0131ndaki rol\u00fcn\u00fcn dinleyici olman\u0131n \u00f6tesine ge\u00e7ti\u011finin, organizasyonun siyasi bir karakter kazanmas\u0131na katk\u0131 sundu\u011funun, kamu g\u00f6revi stat\u00fcs\u00fcn\u00fc ve g\u00f6rev yapt\u0131\u011f\u0131 alan\u0131n kendisine sa\u011flad\u0131\u011f\u0131 \u00fcnvan\u0131 d\u00e2hil herhangi bir olana\u011f\u0131 kullanarak s\u00f6z, fiil ve davran\u0131\u015flar\u0131yla belirli bir siyasi parti aleyhine olarak ba\u015fkalar\u0131n\u0131 ikna etme \u00e7abas\u0131na giri\u015fti\u011finin somut bir gerek\u00e7eyle ortaya konuldu\u011funu kabul etmek m\u00fcmk\u00fcn olmam\u0131\u015ft\u0131r (benzer de\u011ferlendirmeler i\u00e7in bkz. \u0130smail Tutal ve di\u011ferleri, \u00a7 24; dinleyici s\u0131fat\u0131na ili\u015fkin de\u011ferlendirmeler i\u00e7in bkz. Hasan G\u00fcng\u00f6r, \u00a7 53).<\/p>\n<p>25. Anayasa Mahkemesi, \u00e7ok say\u0131daki karar\u0131nda toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131na gerek\u00e7esiz olarak veya Anayasa Mahkemesince ortaya konulan kriterleri kar\u015f\u0131lamayan bir gerek\u00e7e ile yap\u0131lan m\u00fcdahalelerin Anayasa&#8217;n\u0131n 34. maddesini ihlal edece\u011fini ifade etmi\u015ftir. Toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131na yap\u0131lan bir m\u00fcdahalenin demokratik toplum d\u00fczeninin gereklerine uygun kabul edilebilmesi i\u00e7in kamu makamlar\u0131 taraf\u0131ndan ortaya konulan gerek\u00e7elerin ilgili ve yeterli olmas\u0131 gerekir (di\u011ferleri aras\u0131ndan Dilan \u00d6g\u00fcz Canan, \u00a7 53; Y\u0131lmaz G\u00fcne\u015f ve Yusuf Karada\u015f, \u00a7 48; Kenan G\u00fcven, B. No: 2018\/21657, 6\/10\/2022, \u00a7 13).<\/p>\n<p>26. Nihayetinde somut olayda idare ve yarg\u0131 mercileri, ba\u015fvurucunun toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131 ile kamu hizmetlerinin tarafs\u0131zl\u0131\u011f\u0131 ve nesnelli\u011finin sa\u011flanmas\u0131 me\u015fru amac\u0131 aras\u0131nda adil bir denge kuramam\u0131\u015f ve iktidar partisinin ele\u015ftirildi\u011fi bir bas\u0131n a\u00e7\u0131klamas\u0131na kat\u0131lmaktan ibaret olan ba\u015fvurucunun eylemlerinin bir siyasi partinin zarar\u0131na fiili faaliyet kabul edilerek ceza verilmesinin demokratik toplumda zorunlu bir toplumsal ihtiyac\u0131 kar\u015f\u0131lad\u0131\u011f\u0131n\u0131 g\u00f6sterememi\u015ftir. Bunun yan\u0131nda ba\u015fvurucunun kademe ilerlemesinin durdurulmas\u0131 cezas\u0131 ile cezaland\u0131r\u0131lmas\u0131 da g\u00f6zard\u0131 edilemez. Nitekim an\u0131lan ceza, be\u015f dereceli disiplin cezas\u0131 sisteminde d\u00f6rd\u00fcnc\u00fc derecede yer almakta olup tekerr\u00fcr durumunda ba\u015fvurucunun memurluktan \u00e7\u0131kar\u0131lmas\u0131na neden olabilecek niteliktedir. Dolay\u0131s\u0131yla m\u00fcdahalenin bireyin haber ve bilgiye ula\u015fma imk\u00e2n\u0131 \u00fczerinde cayd\u0131r\u0131c\u0131 bir etki olu\u015fturma kapasitesi de bulundu\u011fundan orant\u0131l\u0131 da olmad\u0131\u011f\u0131 sonucuna var\u0131lm\u0131\u015ft\u0131r (benzer de\u011ferlendirmeler i\u00e7in bkz. \u0130smail Tutal ve di\u011ferleri, \u00a7 26; orant\u0131l\u0131l\u0131k y\u00f6n\u00fcnden benzer de\u011ferlendirmeler i\u00e7in bkz. Hasan G\u00fcng\u00f6r, \u00a7 54).<\/p>\n<p>27. A\u00e7\u0131klanan gerek\u00e7elerle ba\u015fvuruya konu demokratik toplum d\u00fczeninin gereklerine uygun olmayan m\u00fcdahale nedeniyle Anayasa\u2019n\u0131n 34. maddesinde g\u00fcvence alt\u0131na al\u0131nan toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakk\u0131n\u0131n ihlal edildi\u011fine karar verilmesi gerekir.<\/p>\n<p>\u00d6mer \u00c7INAR bu g\u00f6r\u00fc\u015fe kat\u0131lmam\u0131\u015ft\u0131r.<\/p>\n<p>III. G\u0130DER\u0130M <\/p>\n<p>28. Ba\u015fvurucu; ihlalin tespiti, yeniden yarg\u0131lama yap\u0131lmas\u0131 ile maddi ve manevi tazminat istemlerinde bulunmu\u015ftur.<\/p>\n<p>29. Ba\u015fvuruda tespit edilen hak ihlalinin sonu\u00e7lar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131 i\u00e7in yeniden yarg\u0131lama yap\u0131lmas\u0131nda hukuki yarar bulunmaktad\u0131r. Bu kapsamda karar\u0131n g\u00f6nderildi\u011fi mahkemece yap\u0131lmas\u0131 gereken i\u015f, yeniden yarg\u0131lama i\u015flemlerini ba\u015flatmak ve Anayasa Mahkemesini ihlal sonucuna ula\u015ft\u0131ran nedenleri gideren, ihlal karar\u0131nda belirtilen ilkelere uygun yeni bir karar vermektir (Mehmet Do\u011fan [GK], B. Ba\u015fvurucunun \u00fcyesi oldu\u011fu (EG\u0130T\u0130M SEN) Ekim 2015&#8217;te Ankara&#8217;da Emek, Bar\u0131\u015f ve Demokrasi Mitingine yap\u0131lan sald\u0131r\u0131ya tepki g\u00f6stermek i\u00e7in 12-13 Ekim tarihlerinde 2(iki) g\u00fcnl\u00fck grev karar\u0131na kat\u0131l\u0131m sa\u011flanmas\u0131; ayr\u0131ca bas\u0131n a\u00e7\u0131klamalar\u0131 ve y\u00fcr\u00fcy\u00fc\u015fler yap\u0131lmas\u0131na, bildirilerin okullarda ve i\u015fyerlerinde, illerde belirlenecek alanlarda okunmas\u0131na karar vermi\u015ftir. Yine ayn\u0131 Sendika, Sava\u015fa Hay\u0131r Bar\u0131\u015f\u0131 Savunaca\u011f\u0131z \u015fiar\u0131yla 29 Aral\u0131k 2015 tarihinde bir g\u00fcnl\u00fck hizmet \u00fcretmeme karar\u0131 alm\u0131\u015ft\u0131r. Ba\u015fvurucu, yukar\u0131da ifade edilen kararlar kapsam\u0131nda g\u00f6reve gitmeyerek bahse konu bas\u0131n a\u00e7\u0131klamalar\u0131na kat\u0131lm\u0131\u015f, bunun \u00fczerine idare, s\u00f6z konusu eylemleri nedeniyle ba\u015fvurucu hakk\u0131nda disiplin soru\u015fturmas\u0131 yapm\u0131\u015ft\u0131r. Soru\u015fturma sonucunda farkl\u0131 siyasi parti temsilcilerinin de kat\u0131ld\u0131\u011f\u0131 bas\u0131n a\u00e7\u0131klamalar\u0131n\u0131n siyasi i\u00e7erikli oldu\u011fu ve yap\u0131ld\u0131\u011f\u0131 ortamda iktidar partisinin aleyhinde ifadeler kullan\u0131larak k\u00f6t\u00fclendi\u011fi gerek\u00e7esi ile ba\u015fvurucuya 657 say\u0131l\u0131 Devlet Memurlar\u0131 Kanunu&#8217;nun 125. maddesinin birinci f\u0131kras\u0131n\u0131n (D) bendinin (o) alt bendinde d\u00fczenlenen &#8220;herhangi bir siyasi parti yarar\u0131na veya zarar\u0131na fiilen faaliyette bulunma&#8221; fiilinden kademe ilerlemesinin durdurulmas\u0131 cezas\u0131 verilmi\u015ftir. Ba\u015fvurucu, hakk\u0131nda tesis edilen disiplin cezas\u0131n\u0131n iptali istemiyle idare mahkemesine ba\u015fvurmu\u015f, yerel mahkeme davan\u0131n reddine karar vermi\u015f, s\u00f6z konusu karar istinaf kanun yolundan ge\u00e7erek kesinle\u015fmi\u015ftir.<\/p>\n<p>\u00c7o\u011funluk taraf\u0131ndan ba\u015fvurucu lehine hak ihlali sonucuna ula\u015f\u0131lmas\u0131na gerek\u00e7e olarak, Anayasa Mahkemesi\u2019nin (Dilek Kaya [2.B.], B. No: 2018\/14313, 17\/7\/2019) ve(Tayyip Akbudak [1.B.], B. No: 2018\/5558, 11\/9\/2019) kararlar\u0131na at\u0131fta bulunularak, s\u00f6z konusu ba\u015fvurularda, ba\u015fvuruculara i\u015fe gelmeme nedeniyle disiplin cezas\u0131 uyguland\u0131\u011f\u0131, ancak bu ba\u015fvuruda Kanunun 125. maddesinin (D) bendi (o) alt bendinden hareketle disiplin cezas\u0131 verildi\u011fi, bu nedenle ba\u015fvurunun Dilek Kaya ve Tayyip Akbudak ba\u015fvurular\u0131ndan farkl\u0131 olarak Anayasa\u2019n\u0131n 33. maddesinde d\u00fczenlenen \u00f6rg\u00fctlenme \u00f6zg\u00fcrl\u00fc\u011f\u00fcnden de\u011fil, Anayasa\u2019n\u0131n 34. maddesinde d\u00fczenlenen toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc yapma hakk\u0131 ba\u011flam\u0131nda incelenmesi gerekti\u011fi, somut olayda idare ve yarg\u0131 mercilerinin, ba\u015fvurucunun toplant\u0131 ve g\u00f6steri y\u00fcr\u00fcy\u00fc\u015f\u00fc d\u00fczenleme hakki ile kamu hizmetlerinin tarafs\u0131zl\u0131\u011f\u0131 ve nesnelli\u011finin sa\u011flanmas\u0131 me\u015fru amac\u0131 aras\u0131nda adil bir denge kuramad\u0131\u011f\u0131 ve iktidar partisinin ele\u015ftirildi\u011fi bir bas\u0131n a\u00e7\u0131klamas\u0131na kat\u0131lmaktan ibaret olan ba\u015fvurucunun eylemlerinin bir siyasi partinin zarar\u0131na fiili faaliyet kabul edilerek ceza verilmesinin demokratik toplumda zorunlu bir toplumsal ihtiyac\u0131 kar\u015f\u0131lad\u0131\u011f\u0131n\u0131 g\u00f6steremedi\u011fi, bunun yan\u0131nda ba\u015fvurucunun kademe ilerlemesinin durdurulmas\u0131 cezas\u0131 ile cezaland\u0131r\u0131lmas\u0131 da g\u00f6z ard\u0131 edilemeyece\u011fi, nitekim an\u0131lan cezan\u0131n, be\u015f dereceli disiplin cezas\u0131 sisteminde d\u00f6rd\u00fcnc\u00fc derecede yer almakta olup tekerr\u00fcr durumunda ba\u015fvurucunun memurluktan \u00e7\u0131kar\u0131lmas\u0131na neden olabilece\u011fi, m\u00fcdahalenin bireyin haber ve bilgiye ula\u015fma imk\u00e2n\u0131 \u00fczerinde cayd\u0131r\u0131c\u0131 bir etki olu\u015fturma kapasitesi de bulundu\u011fundan orant\u0131l\u0131 da olmad\u0131\u011f\u0131 belirtilmi\u015ftir.<\/p>\n<p>\u00d6\u011fretmen olan ba\u015fvurucunun sendikan\u0131n \u00e7ekirdek faaliyeti ile ilgili olmayan bir konuda ald\u0131\u011f\u0131 karara i\u015ftirak etti\u011fi, g\u00f6rev yerine gitmeyerek bas\u0131n a\u00e7\u0131klamalar\u0131na kat\u0131ld\u0131\u011f\u0131 ve s\u00f6z konusu bas\u0131n a\u00e7\u0131klamalar\u0131nda iktidar partisinin ele\u015ftirildi\u011fi tart\u0131\u015fmadan uzakt\u0131r. Buna g\u00f6re, idarenin ilgili disiplin mevzuat\u0131n\u0131n i\u015fe gelmeme maddesinden de\u011fil de siyasi parti yarar\u0131na veya zarar\u0131na faaliyette bulunma maddesinden disiplin soru\u015fturmas\u0131 yapmas\u0131 ve disiplin cezas\u0131 uygulanmas\u0131 Mahkemece hukuka uygun bulunmu\u015ftur. Anayasa Mahkemesi\u2019nin yerle\u015fik i\u00e7tihatlar\u0131nda belirtildi\u011fi \u00fczere, delillerin de\u011ferlendirilmesi ve hukuk kurallar\u0131n\u0131n yorumlanmas\u0131 bireysel ba\u015fvurunun ikincilli\u011fi ilkesi yarg\u0131lamay\u0131 yapan derece mahkemelerinin g\u00f6revidir. Anayasa Mahkemesinin g\u00f6revi ise, derece mahkemelerinin yorumlar\u0131n\u0131n a\u00e7\u0131k\u00e7a keyfi veya bariz takdir hatas\u0131 i\u00e7erecek nitelikte olup olmad\u0131\u011f\u0131n\u0131 incelemektir. Ba\u015fvurucu hakk\u0131nda yerel mahkeme somut olay ba\u011flam\u0131nda delilleri de\u011ferlendirmi\u015f, karar\u0131n\u0131 gerek\u00e7elendirmi\u015f ve h\u00fck\u00fcm kurmu\u015ftur. Yerel mahkemenin gerek\u00e7esi incelendi\u011finde hukuk kurallar\u0131n\u0131n uygulanmas\u0131nda bariz takdir hatas\u0131 veya a\u00e7\u0131k bir keyfilik de mevcut de\u011fildir.Buna g\u00f6re, \u00e7o\u011funluk taraf\u0131ndan ba\u015fvurucunun kademe ilerlemesinin durdurulmas\u0131 cezas\u0131 ile cezaland\u0131r\u0131lmas\u0131n\u0131n g\u00f6z ard\u0131 edilemeyece\u011fi, an\u0131lan cezan\u0131n, be\u015f dereceli disiplin cezas\u0131 sisteminde d\u00f6rd\u00fcnc\u00fc derecede yer almakta olup tekerr\u00fcr durumunda ba\u015fvurucunun memurluktan \u00e7\u0131kar\u0131lmas\u0131na neden olabilece\u011fi gibi gerek\u00e7eler kanaatimizce ba\u015fvurunun ikincilli\u011fi ilkesine ayk\u0131r\u0131 olup, kabul edilemez.<\/p>\n<p>Ba\u015fvuru her ne kadar Anayasa\u2019n\u0131n 34. maddesi \u00e7er\u00e7evesinde incelenmi\u015f ise de ayn\u0131 konuda daha \u00f6nce verilen(Dilek Kaya [2.B.], B. No: 2018\/14313, 17\/7\/2019) ve(Tayyip Akbudak [1.B.], B. No: 2018\/5558, 11\/9\/2019) ba\u015fvurular\u0131nda ortaya konulan ilkeler i\u015fbu ba\u015fvuru a\u00e7\u0131s\u0131ndan da ge\u00e7erlidir. Anayasa Mahkemesi Dilek Kaya ve Tayyip Akbudak ba\u015fvurular\u0131nda, Anayasa Mahkemesi Genel Kurulu\u2019nun Ahmet Parmaks\u0131z (G.K., B. No: 2017\/29263, 22\/5\/2019) karar\u0131na at\u0131fta bulunmu\u015ftur. Anayasa Mahkemesi, disiplin cezas\u0131 verilmesinin sebebini te\u015fkil eden i\u015fe gitmeme \u015feklindeki eylemin amac\u0131 ve bu eyleme kat\u0131lan sendika \u00fcyelerinin sendikal \u00e7\u0131karlar\u0131 ile ba\u015fvurucuya y\u00f6nelik disiplin cezas\u0131 sendikal haklar\u0131n niteli\u011fiyle birlikte ele al\u0131nd\u0131\u011f\u0131n\u0131 belirterek, Ahmet Parmaks\u0131z ba\u015fvurusunda \u00f6rg\u00fctlenme hakk\u0131n\u0131n ihlal edilmedi\u011fine karar verildi\u011fini belirtmi\u015ftir. Mahkeme, Dilek Kaya ba\u015fvurusunda da disiplin cezas\u0131n\u0131n sebebini te\u015fkil eden eylem \u00fclkenin i\u00e7 siyasetine ili\u015fkin sosyo-politik unsurlar\u0131n a\u011f\u0131rl\u0131kta oldu\u011fu bir amaca(bkz. \u00a7\u00a7 14-15) y\u00f6nelik olup, eylemin konusunun sendikalar\u0131n \u00e7ekirdek faaliyet alan\u0131nda kalmad\u0131\u011f\u0131, eylemin bu amac\u0131 ile bir g\u00fcn i\u015f b\u0131rakma \u015feklindeki niteli\u011fi (bkz. \u00a7 16) dikkate al\u0131nd\u0131\u011f\u0131nda yap\u0131lan m\u00fcdahalede devletin takdir marj\u0131n\u0131n daha geni\u015f oldu\u011fu kabul edilmesi gerekti\u011fi, bu nedenle sendika \u00fcyelerinin ekonomik ve sosyal menfaatleriyle do\u011frudan ilgili olmayan ve politik y\u00f6n\u00fc a\u011f\u0131r basan bir ama\u00e7la i\u015fe gitmemek \u015feklinde bir eylemin yol a\u00e7aca\u011f\u0131 sonu\u00e7lara devlet idaresinin ve toplumun katlanmas\u0131n\u0131 gerektiren bir sebep bulunmad\u0131\u011f\u0131 kanaatine ula\u015f\u0131ld\u0131\u011f\u0131n\u0131 (bkz. \u00a7 62), bu nedenle Ahmet Parmaks\u0131z karar\u0131nda ula\u015f\u0131lan sonu\u00e7tan ayr\u0131lmay\u0131 gerektiren bir husus bulunmad\u0131\u011f\u0131ndan m\u00fcdahalenin toplumsal bir ihtiyaca kar\u015f\u0131l\u0131k geldi\u011fi ve izlenen me\u015fru ama\u00e7la orant\u0131l\u0131 oldu\u011fu (bkz. \u00a7 63), disiplin cezas\u0131 verilmesi \u015feklinde yap\u0131lan m\u00fcdahalenin demokratik toplum d\u00fczeninin gereklerine uygun olmas\u0131 nedeniyle Anayasa\u2019n\u0131n 33. maddesinde g\u00fcvence alt\u0131na al\u0131nan \u00f6rg\u00fctlenme \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlal edilmedi\u011fi sonucuna ula\u015fm\u0131\u015ft\u0131r.<\/p>\n<p>Tayyip Akbudak ba\u015fvurusunun konusunu da ba\u015fvurucu taraf\u0131ndan, \u00fcyesi oldu\u011fu sendikan\u0131n ald\u0131\u011f\u0131 karar uyar\u0131nca iki g\u00fcn i\u015f b\u0131rakma eylemi ger\u00e7ekle\u015ftirilmesi ve bunun \u00fczerine idare taraf\u0131ndan ba\u015fvurucuya 1\/30 ayl\u0131ktan kesme disiplin cezas\u0131 uygulanmas\u0131 olu\u015fturmaktad\u0131r. Anayasa Mahkemesi, sendika \u00fcyelerinin ekonomik ve sosyal menfaatleriyle do\u011frudan ilgili olmayan ve politik y\u00f6n\u00fc a\u011f\u0131r basan bir ama\u00e7la i\u015fe gitmemek \u015feklindeki eylemin yol a\u00e7aca\u011f\u0131 sonu\u00e7lara devlet idaresinin ve toplumun katlanmas\u0131n\u0131 gerektiren bir sebep bulunmad\u0131\u011f\u0131 gerek\u00e7esini tekrar ederek (bkz. \u00a7 73), ba\u015fvurucuya verilen disiplin cezas\u0131n\u0131n Anayasa\u2019n\u0131n 33. maddesini ihlal etmedi\u011fini belirtmi\u015ftir.<\/p>\n<p>Ba\u015fvurucunun kamu g\u00f6revine gitmeme \u015feklinde i\u015f b\u0131rakarak, bir siyasi partinin ele\u015ftirildi\u011fi bas\u0131n a\u00e7\u0131klamas\u0131na kat\u0131lmas\u0131 yeterli olup, bas\u0131n a\u00e7\u0131klamas\u0131 s\u0131ras\u0131nda pasif kalmas\u0131 ya da aktif olarak s\u00f6ylemde bulunmas\u0131 Devlet Memurlar\u0131 Kanununun 125. maddesinin (D) bendinin (o) alt bendinin uygulanmas\u0131 a\u00e7\u0131s\u0131ndan \u00f6nem arz etmemektedir. S\u00f6z konusu h\u00fck\u00fcmde \u201cherhangi bir siyasi parti yarar\u0131na veya zarar\u0131na fiilen faaliyette bulunmak\u201d ifadesine yer verildi\u011finden, iktidar partisinin ele\u015ftirildi\u011fi bas\u0131n a\u00e7\u0131klamas\u0131nda bulunulmas\u0131 fiili bir faaliyet olarak disiplin cezas\u0131n\u0131n uygulanmas\u0131 i\u00e7in yeterlidir.
