BA\u015eVURU S\u00dcREC\u0130<\/p>\n<p>2. Ba\u015fvuru 26\/4\/2019 tarihinde yap\u0131lm\u0131\u015ft\u0131r. Komisyon; ba\u015fvurunun makul s\u00fcrede yarg\u0131lanma hakk\u0131n\u0131n ihlal edildi\u011fi iddias\u0131 y\u00f6n\u00fcnden kabul edilemez oldu\u011funa, m\u00fclkiyet hakk\u0131n\u0131n ihlal edildi\u011fi iddias\u0131 y\u00f6n\u00fcnden kabul edilebilirlik incelemesinin ise B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na karar vermi\u015ftir.<\/p>\n<p>3. Ba\u015fvuru belgelerinin bir \u00f6rne\u011fi, bilgi i\u00e7in Adalet Bakanl\u0131\u011f\u0131na (Bakanl\u0131k) g\u00f6nderilmi\u015ftir. Bakanl\u0131k, g\u00f6r\u00fc\u015f\u00fcn\u00fc bildirmi\u015ftir. Ba\u015fvurucu, Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 s\u00fcresinde beyanda bulunmam\u0131\u015ft\u0131r.<\/p>\n<p>III. OLAY VE OLGULAR <\/p>\n<p>4. Ba\u015fvuru formu ve eklerinde ifade edildi\u011fi \u015fekliyle ilgili olaylar \u015f\u00f6yledir:<\/p>\n<p>A. Bireysel Ba\u015fvuruya Konu S\u00fcre\u00e7<\/p>\n<p>5. Ba\u015fvurucu, entegre ileti\u015fim ve teknoloji hizmeti alan\u0131nda faaliyet g\u00f6stermekte olup elektronik haberle\u015fme hizmeti sunan bir \u015firkettir. Ba\u015fvurucuyla benzer alanda faaliyet g\u00f6steren \u00e7e\u015fitli \u015firketler, 2009 y\u0131l\u0131nda Rekabet Kurumu Ba\u015fkanl\u0131\u011f\u0131na (Kurum) m\u00fcracaat ederek ba\u015fvurucunun distrib\u00fct\u00f6rlerine ve bayilerine y\u00f6nelik uygulamalar\u0131 nedeniyle 7\/12\/1994 tarihli ve 4054 say\u0131l\u0131 Rekabetin Korunmas\u0131 Hakk\u0131nda Kanun&#8217;un 4. ve 6. maddelerini ihlal etti\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr.<\/p>\n<p>6. Yap\u0131lan \u00f6n ara\u015ft\u0131rma sonucunda Kurum b\u00fcnyesindeki Rekabet Kurulu (Kurul) 11\/11\/2009 tarihinde ba\u015fvurucu hakk\u0131nda soru\u015fturma a\u00e7\u0131lmas\u0131na karar vermi\u015ftir. Kurul 17\/11\/2009 tarihinde ba\u015fvurucuya soru\u015fturma a\u00e7\u0131ld\u0131\u011f\u0131na ve ilk yaz\u0131l\u0131 savunmas\u0131n\u0131 g\u00f6ndermesine dair bildirimde bulunmu\u015ftur. Ba\u015fvurucu 31\/12\/2009 tarihinde ilk yaz\u0131l\u0131 savunmas\u0131n\u0131 sunmu\u015ftur. Kurul 6\/5\/2009 tarihinde soru\u015fturma s\u00fcresini alt\u0131 ay daha uzatm\u0131\u015ft\u0131r. \u0130kinci yaz\u0131l\u0131 savunma i\u00e7in ek s\u00fcre talebi kabul edilen ba\u015fvurucu 24\/1\/2011 tarihinde ikinci yaz\u0131l\u0131 savunmas\u0131n\u0131 bildirmi\u015ftir. \u0130kinci yaz\u0131l\u0131 savunmaya kar\u015f\u0131 haz\u0131rlanan g\u00f6r\u00fc\u015f ba\u015fvurucuya g\u00f6nderilmi\u015ftir. Ba\u015fvurucunun \u00fc\u00e7\u00fcnc\u00fc yaz\u0131l\u0131 savunmaya ili\u015fkin ek s\u00fcre talebi de kabul edilmi\u015ftir. Kurul 31\/5\/2011 tarihinde s\u00f6zl\u00fc savunma toplant\u0131s\u0131 yap\u0131lmas\u0131na karar vermi\u015f, karar taraflara tebli\u011f edilmi\u015f ve an\u0131lan tarihte s\u00f6zl\u00fc savunma ger\u00e7ekle\u015ftirilmi\u015ftir.<\/p>\n<p>7. Kurul 6\/6\/2011 tarihli karar\u0131nda; GSM hizmetleri pazar\u0131nda h\u00e2kim konumda bulunan ba\u015fvurucunun \u00e7ok markal\u0131 olmas\u0131 gereken pazarda alt bayileri fiil\u00ee olarak m\u00fcnhas\u0131rl\u0131\u011fa zorlayarak rakiplerinin faaliyetlerini zorla\u015ft\u0131r\u0131p h\u00e2kim durumunu k\u00f6t\u00fcye kulland\u0131\u011f\u0131n\u0131 belirterek 4054 say\u0131l\u0131 Kanun&#8217;un 6. maddesinin (a) bendini ihlal etti\u011finden bahisle ba\u015fvurucuya 91.942.343,31 TL idari para cezas\u0131 vermi\u015f; di\u011fer taraftan ba\u015fvurucunun tavsiye edilen fiyat\u0131 bildirmenin \u00f6tesinde yeniden sat\u0131\u015f fiyat\u0131 belirledi\u011fine ve tavsiye edilen fiyattan sapmalar\u0131 cezaland\u0131rd\u0131\u011f\u0131na ili\u015fkin yeterli delil elde edilemedi\u011fini belirterek 4054 say\u0131l\u0131 Kanun&#8217;un 4. maddesini ihlal etmedi\u011fine oy\u00e7oklu\u011fuyla karar vermi\u015ftir. Bu y\u00f6ndeki karara ili\u015fkin kar\u015f\u0131oy g\u00f6r\u00fc\u015f\u00fcnde ise soru\u015fturma dosyas\u0131nda yer alan \u00e7ok say\u0131da belge ve tespit kar\u015f\u0131s\u0131nda ba\u015fvurucunun yeniden sat\u0131\u015f fiyat\u0131 belirledi\u011fi anla\u015f\u0131ld\u0131\u011f\u0131ndan ba\u015fvurucunun 4054 say\u0131l\u0131 Kanun&#8217;un 4. maddesini de ihlal etti\u011fini kaydetmi\u015ftir.<\/p>\n<p>8. Ba\u015fvurucu aleyhine Kurula ba\u015fvuran \u015firketlerden biri olan D. Da\u011f\u0131t\u0131m Sat\u0131\u015f Pazarlama Matbaac\u0131l\u0131k \u00d6deme Arac\u0131l\u0131k ve Tahsilat Sistemleri Anonim \u015eirketi (D. \u015eirketi) 9\/12\/2011 tarihinde Kurul karar\u0131n\u0131n 4054 say\u0131l\u0131 Kanun&#8217;un 4. maddesinin ihlal edilmedi\u011fine ili\u015fkin k\u0131sm\u0131n\u0131n iptali i\u00e7in dava a\u00e7m\u0131\u015ft\u0131r. D. \u015eirketi yeniden sat\u0131\u015f fiyat\u0131 belirlenmesiyle ilgili yeterli bir inceleme yap\u0131lmad\u0131\u011f\u0131n\u0131 ileri s\u00fcrm\u00fc\u015ft\u00fcr.<\/p>\n<p>9. Ba\u015fvurucu 17\/7\/2012 tarihinde davaya m\u00fcdahil olma talebinde bulunmu\u015ftur. Davaya ilk derece mahkemesi s\u0131fat\u0131yla bakan Dan\u0131\u015ftay On\u00fc\u00e7\u00fcnc\u00fc Dairesi (Daire) 5\/12\/2012 tarihinde ba\u015fvurucunun daval\u0131 yan\u0131nda davan\u0131n bulundu\u011fu noktadan itibaren kat\u0131lma talebini kabul etmi\u015ftir. Dairenin 8\/3\/2016 tarihinde yapt\u0131\u011f\u0131 duru\u015fmada ba\u015fvurucu, avukatla temsil edilmi\u015f ve davan\u0131n taraflar\u0131na a\u00e7\u0131klamada bulunmak \u00fczere s\u00f6z verilmi\u015ftir.<\/p>\n<p>10. Daire 16\/10\/2017 tarihinde davan\u0131n kabul\u00fc ile Kurul karar\u0131n\u0131n dava konusu k\u0131sm\u0131n\u0131n iptaline karar vermi\u015f, karar gerek\u00e7esinde;<\/p>\n<p>i. Soru\u015fturma raporunun ekinde yer alan belgeler ile \u00f6n ara\u015ft\u0131rma a\u015famas\u0131ndaki tespitlere g\u00f6re ba\u015fvurucunun fiziki ve dijital kont\u00f6rlerin sat\u0131\u015f fiyat\u0131n\u0131 yeniden belirledi\u011fini,<\/p>\n<p>ii. Dosyadaki belge ve tablolarda ba\u015fvurucuya ba\u011fl\u0131 \u00e7e\u015fitli alt kademeler ve \u00fcr\u00fcn sat\u0131\u015f\u0131n\u0131 yapacaklar bak\u0131m\u0131ndan kont\u00f6r fiyatlar\u0131n\u0131n ve k\u00e2r oranlar\u0131n\u0131n ayr\u0131nt\u0131l\u0131 olarak saptand\u0131\u011f\u0131n\u0131, bunun d\u0131\u015f\u0131nda ba\u015fvurucunun \u00e7al\u0131\u015fanlar\u0131n\u0131n elektronik posta yaz\u0131\u015fmalar\u0131n\u0131n, alt kademedeki baz\u0131 yetkililerin beyanlar\u0131n\u0131n oldu\u011funu,<\/p>\n<p>iii. Soru\u015fturma raporunda POS cihazlar\u0131 ve internet \u00fczerinden yap\u0131lan dijital kont\u00f6r sat\u0131\u015flar\u0131nda sabit fiyat uygulamas\u0131 yap\u0131ld\u0131\u011f\u0131n\u0131n, mavi nokta (perakende sat\u0131\u015f yapan bayiler) olarak tabir edilen bayilere bu fiyatlar\u0131 de\u011fi\u015ftirme imk\u00e2n\u0131 verilmedi\u011finin tespit edildi\u011fini,<\/p>\n<p>iv. \u0130lgili pazarda h\u00e2kim durumda olan ba\u015fvurucunun yeniden sat\u0131\u015f fiyat\u0131 belirlemesinin rekabete ayk\u0131r\u0131l\u0131k olu\u015fturdu\u011funu ve buna izin verilmemesi gerekti\u011fini,<\/p>\n<p>v. Sonu\u00e7 olarak h\u00e2kim durumdaki te\u015febb\u00fcs\u00fcn fiyat, da\u011f\u0131t\u0131m ve sat\u0131\u015fa ili\u015fkin politika ve uygulamalar\u0131 \u00e7er\u00e7evesinde \u00f6zellikle kont\u00f6r fiyatlar\u0131n\u0131n her d\u00fczeyde belirlenmesi y\u00f6n\u00fcnde \u00e7ok say\u0131da bulgu ve belge dikkate al\u0131nd\u0131\u011f\u0131nda ba\u015fvurucunun 4054 say\u0131l\u0131 Kanun&#8217;un 4. maddesini ihlal etti\u011fi sonucuna var\u0131ld\u0131\u011f\u0131ndan an\u0131lan Kanun&#8217;un 4. maddesinin ihlal edilmedi\u011fine ve ba\u015fvurucu hakk\u0131nda idari para cezas\u0131 verilmesine gerek olmad\u0131\u011f\u0131na dair Kurul karar\u0131nda hukuka uygunluk bulunmad\u0131\u011f\u0131n\u0131 ifade etmi\u015ftir.<\/p>\n<p>11. Daval\u0131 Kurum yan\u0131nda karar\u0131 temyiz eden ba\u015fvurucu, gerek\u00e7esiz olarak karar verildi\u011fini, iddia ve itirazlar\u0131n\u0131n kar\u015f\u0131lanmad\u0131\u011f\u0131n\u0131, yarg\u0131lamadan haberdar edilmedi\u011fini belirtmi\u015ftir. Ayr\u0131ca dosyadaki bilgi ve belgelerle ilgili olarak gerekli inceleme ve ara\u015ft\u0131rmalar yap\u0131lmadan yerindelik denetimi niteli\u011finde hukuka ayk\u0131r\u0131 karar verildi\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr.<\/p>\n<p>12. Dan\u0131\u015ftay \u0130dari Dava Daireleri Kurulu 31\/1\/2019 tarihinde daval\u0131 Kurumun ve ba\u015fvurucunun temyiz talebini reddederek usul ve hukuka uygun buldu\u011fu karar\u0131 onam\u0131\u015ft\u0131r.<\/p>\n<p>13. Ba\u015fvurucu, nihai h\u00fckm\u00fc 2\/4\/2019 tarihinde \u00f6\u011frendikten sonra 26\/4\/2019 tarihinde bireysel ba\u015fvuruda bulunmu\u015ftur.<\/p>\n<p>B. Bireysel Ba\u015fvuru Sonras\u0131ndaki S\u00fcre\u00e7<\/p>\n<p>14. Kurul 10\/1\/2019 tarihinde Dairenin ilgili karar\u0131, ek rapor ve dosya kapsam\u0131na g\u00f6re ba\u015fvurucunun kont\u00f6rlerin yeniden sat\u0131\u015f fiyat\u0131n\u0131 belirlemek suretiyle 4054 say\u0131l\u0131 Kanun&#8217;un 4. maddesini ihlal etti\u011fi sonucuna ula\u015fm\u0131\u015ft\u0131r. Kurul, 4054 say\u0131l\u0131 Kanun&#8217;un 16. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131 ile 15\/2\/2009 tarihli ve 27142 say\u0131l\u0131 Resm\u00ee Gazete\u2019de yay\u0131mlanan Rekabeti S\u0131n\u0131rlay\u0131c\u0131 Anla\u015fma, Uyumlu Eylem ve Kararlar ile Hakim Durumun K\u00f6t\u00fcye Kullan\u0131lmas\u0131 Halinde Verilecek Para Cezalar\u0131na \u0130li\u015fkin Y\u00f6netmelik&#8217;in 5. ve 6. maddeleri uyar\u0131nca ba\u015fvurucunun 2010 y\u0131l\u0131 y\u0131ll\u0131k gayrisafi gelirinin takdiren %1,125 oran\u0131 kar\u015f\u0131l\u0131\u011f\u0131 olan 91.942.343,31 TL idari para cezas\u0131na karar vermi\u015ftir.<\/p>\n<p>15. Ceza tutar\u0131na yap\u0131lan itiraz sonucunda Kurul 12\/11\/2019 tarihinde ba\u015fvurucunun 2010 mali y\u0131l\u0131 sonunda olu\u015fan y\u0131ll\u0131k gayrisafi gelirlerinin takdiren %0,75 oran\u0131nda olmak \u00fczere 61.294.895,54 TL idari para cezas\u0131 ile cezaland\u0131r\u0131lmas\u0131na karar vermi\u015ftir.<\/p>\n<p>16. Ba\u015fvurucunun i\u015flemin iptali istemiyle a\u00e7t\u0131\u011f\u0131 davada Ankara 17. \u0130dare Mahkemesi 28\/1\/2021 tarihinde s\u00f6z konusu karar\u0131 hukuka uygun bularak davay\u0131 reddetmi\u015ftir.<\/p>\n<p>17. Ankara B\u00f6lge \u0130dare Mahkemesi 8. \u0130dari Dava Dairesi 4\/11\/2021 tarihinde ba\u015fvurucunun istinaf ba\u015fvurusunu reddetmi\u015ftir. Ba\u015fvurucunun temyiz etti\u011fi karar Daire \u00f6n\u00fcnde derdest durumdad\u0131r.<\/p>\n<p>IV. \u0130LG\u0130L\u0130 HUKUK<\/p>\n<p>18. 4054 say\u0131l\u0131 Kanun&#8217;un &#8220;Rekabeti S\u0131n\u0131rlay\u0131c\u0131 Anla\u015fma, Uyumlu Eylem ve Kararlar&#8221; kenar ba\u015fl\u0131kl\u0131 4. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Belirli bir mal veya hizmet piyasas\u0131nda do\u011frudan veya dolayl\u0131 olarak rekabeti engelleme, bozma ya da k\u0131s\u0131tlama amac\u0131n\u0131 ta\u015f\u0131yan veya bu etkiyi do\u011furan yahut do\u011furabilecek nitelikte olan te\u015febb\u00fcsler aras\u0131 anla\u015fmalar, uyumlu eylemler ve te\u015febb\u00fcs birliklerinin bu t\u00fcr karar ve eylemleri hukuka ayk\u0131r\u0131 ve yasakt\u0131r.<\/p>\n<p>Bu haller, \u00f6zellikle \u015funlard\u0131r:<\/p>\n<p>a) Mal veya hizmetlerin al\u0131m ya da sat\u0131m fiyat\u0131n\u0131n, fiyat\u0131 olu\u015fturan maliyet, kar gibi unsurlar ile her t\u00fcrl\u00fc al\u0131m yahut sat\u0131m \u015fartlar\u0131n\u0131n tesbit edilmesi,<\/p>\n<p>&#8230;&#8221;<\/p>\n<p>19. 4054 say\u0131l\u0131 Kanun&#8217;un &#8220;Hakim Durumun K\u00f6t\u00fcye Kullan\u0131lmas\u0131&#8221; kenar ba\u015fl\u0131kl\u0131 6. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Bir veya birden fazla te\u015febb\u00fcs\u00fcn \u00fclkenin b\u00fct\u00fcn\u00fcnde ya da bir b\u00f6l\u00fcm\u00fcnde bir mal veya hizmet piyasas\u0131ndaki hakim durumunu tek ba\u015f\u0131na yahut ba\u015fkalar\u0131 ile yapaca\u011f\u0131 anla\u015fmalar ya da birlikte davran\u0131\u015flar ile k\u00f6t\u00fcye kullanmas\u0131 hukuka ayk\u0131r\u0131 ve yasakt\u0131r.<\/p>\n<p>K\u00f6t\u00fcye kullanma halleri \u00f6zellikle \u015funlard\u0131r:<\/p>\n<p>a) Ticari faaliyet alan\u0131na ba\u015fka bir te\u015febb\u00fcs\u00fcn girmesine do\u011frudan veya dolayl\u0131 olarak engel olunmas\u0131 ya da rakiplerin piyasadaki faaliyetlerinin zorla\u015ft\u0131r\u0131lmas\u0131n\u0131 ama\u00e7layan eylemler,<\/p>\n<p>&#8230;&#8221;<\/p>\n<p>20. 4054 say\u0131l\u0131 Kanun&#8217;un &#8220;\u0130dar\u00ee Para Cezas\u0131&#8221; kenar ba\u015fl\u0131kl\u0131 16. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Bu Kanunun 4, 6 ve 7 nci maddelerinde yasaklanm\u0131\u015f davran\u0131\u015flarda bulunanlara, ceza verilecek te\u015febb\u00fcs ile te\u015febb\u00fcs birlikleri veya bu birliklerin \u00fcyelerinin nihai karardan bir \u00f6nceki mali y\u0131l sonunda olu\u015fan veya bunun hesaplanmas\u0131 m\u00fcmk\u00fcn olmazsa nihai karar tarihine en yak\u0131n mali y\u0131l sonunda olu\u015fan ve Kurul taraf\u0131ndan saptanacak olan y\u0131ll\u0131k gayri safi gelirlerinin y\u00fczde onuna kadar idar\u00ee para cezas\u0131 verilir.&#8221;<\/p>\n<p>V. \u0130NCELEME VE GEREK\u00c7E<\/p>\n<p>21. Anayasa Mahkemesinin 17\/9\/2024 tarihinde yapm\u0131\u015f oldu\u011fu toplant\u0131da ba\u015fvuru incelenip gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. Ba\u015fvurucunun \u0130ddialar\u0131 ve Bakanl\u0131k G\u00f6r\u00fc\u015f\u00fc<\/p>\n<p>22. Ba\u015fvurucu, yarg\u0131lama s\u00fcrecinde ileri s\u00fcrd\u00fc\u011f\u00fc iddia ve itirazlar\u0131n mahkemelerce de\u011ferlendirilmedi\u011fini, \u00f6zellikle soru\u015fturma a\u015famas\u0131nda aleyhe beyanda bulunan bir \u015firketin daha sonra bu iddialar\u0131ndan vazge\u00e7mi\u015f olmas\u0131n\u0131n dikkate al\u0131nmad\u0131\u011f\u0131n\u0131, Kurul karar\u0131n\u0131n kar\u015f\u0131oyunda yer verilen hususlar\u0131n do\u011frudan Dan\u0131\u015ftay Dairesi karar\u0131na ta\u015f\u0131nd\u0131\u011f\u0131n\u0131 ve temyiz itirazlar\u0131n\u0131n da gerek\u00e7e g\u00f6sterilmeksizin reddedildi\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr. Davan\u0131n a\u00e7\u0131lmas\u0131yla birlikte yarg\u0131lamaya resen d\u00e2hil edilmesi gerekti\u011fini belirten ba\u015fvurucu, dilek\u00e7eler a\u015famas\u0131 ge\u00e7ildikten sonra ve m\u00fcdahil olma talebi neticesinde davaya d\u00e2hil olmas\u0131n\u0131n savunma hakk\u0131n\u0131 k\u0131s\u0131tlad\u0131\u011f\u0131n\u0131 iddia etmi\u015ftir. Dan\u0131\u015ftay Dairesinin yarg\u0131sal denetim s\u0131n\u0131r\u0131n\u0131 a\u015farak idare yerine ge\u00e7ip ihlal tespiti yapt\u0131\u011f\u0131n\u0131 ve idari para cezas\u0131 uygulanmas\u0131 gerekti\u011fine karar verdi\u011fini, bu nedenle de Rekabet Kurulunun idari para cezas\u0131 uygulamak zorunda kald\u0131\u011f\u0131n\u0131 kaydetmi\u015ftir. Ba\u015fvurucu, Dan\u0131\u015ftay Dairesi karar\u0131na dayanak olan Kurul raporundaki kar\u015f\u0131oy yaz\u0131s\u0131nda dahi idari para cezas\u0131 verilmesi gerekti\u011finin belirtilmedi\u011fini, Kurulun benzer bir durumda tek bir maddeye dayal\u0131 olarak para cezas\u0131 vermesine kar\u015f\u0131l\u0131k hukuka ayk\u0131r\u0131 karar nedeniyle Kurul yerle\u015fik lehe uygulamadan yararlanmas\u0131 imk\u00e2n\u0131 kalmad\u0131\u011f\u0131n\u0131 ve ne bis in idem ilkesine ayk\u0131r\u0131 olarak tek bir davran\u0131\u015ftan dolay\u0131 iki defa cezaland\u0131r\u0131lm\u0131\u015f oldu\u011funu ifade etmi\u015ftir. Ba\u015fvurucu, sonu\u00e7 olarak bu gerek\u00e7elerle adil yarg\u0131lanma ve m\u00fclkiyet haklar\u0131n\u0131n ihlal edildi\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr.<\/p>\n<p>23. Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcnde ne bis in idem ilkesinin d\u00fczenlendi\u011fi Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi&#8217;ne ek (7) No.lu Protokol T\u00fcrkiye&#8217;de 1\/8\/2016 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011finden ve ba\u015fvurucunun idari para cezas\u0131na konu faaliyetleri ise 2006-2008 d\u00f6nemine ili\u015fkin oldu\u011fundan s\u00f6z konusu \u015fik\u00e2yetler y\u00f6n\u00fcnden konu bak\u0131m\u0131ndan yetkisizlik karar\u0131 verilmesi gerekti\u011fi a\u00e7\u0131klanm\u0131\u015ft\u0131r. Bakanl\u0131k, Dan\u0131\u015ftay Dairesi karar\u0131 sonras\u0131nda verilen idari para cezas\u0131na kar\u015f\u0131 ba\u015fvurucunun a\u00e7\u0131\u011f\u0131 davan\u0131n temyiz a\u015famas\u0131nda derdest oldu\u011fundan ba\u015fvuru yollar\u0131n\u0131n t\u00fcketilmedi\u011fini kaydetmi\u015ftir. M\u00fclkiyet hakk\u0131n\u0131n ihlal edildi\u011fi \u015fik\u00e2yetinin temellendirilmedi\u011fini belirten Bakanl\u0131k, ba\u015fvurucuya birden fazla idari para cezas\u0131 verilmesinin ne bis in idem ilkesine ayk\u0131r\u0131l\u0131k te\u015fkil etmedi\u011fini, 4054 say\u0131l\u0131 Kanun&#8217;un 4. maddesi ile 6. maddesinin farkl\u0131 olgular\u0131 d\u00fczenledi\u011fini ve somut olayda da farkl\u0131 fiillere farkl\u0131 cezalar\u0131n verildi\u011fini belirtmi\u015ftir.<\/p>\n<p>24. Ba\u015fvurucu, Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 s\u00fcresinde beyanda bulunmam\u0131\u015ft\u0131r.<\/p>\n<p>B. De\u011ferlendirme<\/p>\n<p>25. Anayasa\u2019n\u0131n &#8220;M\u00fclkiyet hakk\u0131&#8221; kenar ba\u015fl\u0131kl\u0131 35. maddesi \u015f\u00f6yledir:<\/p>\n<p>\u00a0\u201cHerkes, m\u00fclkiyet ve miras haklar\u0131na sahiptir.<\/p>\n<p>Bu haklar, ancak kamu yarar\u0131 amac\u0131yla, kanunla s\u0131n\u0131rlanabilir.<\/p>\n<p>M\u00fclkiyet hakk\u0131n\u0131n kullan\u0131lmas\u0131 toplum yarar\u0131na ayk\u0131r\u0131 olamaz.\u201d <\/p>\n<p>26. Anayasa Mahkemesi, olaylar\u0131n ba\u015fvurucu taraf\u0131ndan yap\u0131lan hukuki nitelendirmesi ile ba\u011fl\u0131 olmay\u0131p olay ve olgular\u0131n hukuki tavsifini kendisi takdir eder. Ba\u015fvurucu, m\u00fclkiyet hakk\u0131 ile birlikte adil yarg\u0131lanma hakk\u0131n\u0131n da ihlal edildi\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr. Bununla birlikte kesinle\u015fmi\u015f bir mahkeme karar\u0131yla ba\u015fvurucunun 4054 say\u0131l\u0131 Kanun&#8217;un 4. maddesine ayk\u0131r\u0131 davrand\u0131\u011f\u0131, buna ba\u011fl\u0131 olarak da ba\u015fvurucuya idari para cezas\u0131 verilmesi gerekti\u011fi h\u00fckme ba\u011flanm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla ba\u015fvurucunun \u015fik\u00e2yetlerinin esas itibar\u0131yla m\u00fclkiyet hakk\u0131n\u0131 ilgilendirdi\u011fi anla\u015f\u0131ld\u0131\u011f\u0131ndan ba\u015fvurunun m\u00fclkiyet hakk\u0131n\u0131n ihlali iddias\u0131 kapsam\u0131nda incelenmesi gerekti\u011fi de\u011ferlendirilmi\u015ftir.<\/p>\n<p>1. Kabul Edilebilirlik Y\u00f6n\u00fcnden<\/p>\n<p>27. Turkcell \u0130leti\u015fim Hizmetleri A.\u015e. (4) ([GK], B. No: 2017\/36186, 28\/12\/2022, karar\u0131nda kamu g\u00fcc\u00fc ayr\u0131cal\u0131\u011f\u0131 ile donat\u0131lmayan ve kamu t\u00fczel ki\u015fili\u011fini haiz olmayan ba\u015fvurucunun ki\u015fi bak\u0131m\u0131ndan ba\u015fvuru yapmaya ehliyetli oldu\u011fu kabul edilmi\u015ftir (ayn\u0131 kararda bkz. \u00a7 72). Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcnde ba\u015fvurucu hakk\u0131ndaki idari para cezas\u0131na ili\u015fkin yarg\u0131laman\u0131n temyiz a\u015famas\u0131nda oldu\u011fundan hen\u00fcz ba\u015fvuru yollar\u0131n\u0131n t\u00fcketilmedi\u011fi belirtilmi\u015ftir. Dan\u0131\u015ftay Dairesinin karar\u0131 sonras\u0131nda hakk\u0131nda uygulanan yapt\u0131r\u0131ma kar\u015f\u0131 ba\u015fvurucunun ba\u015flatt\u0131\u011f\u0131 yarg\u0131sal s\u00fcrecin devam etti\u011fi anla\u015f\u0131lmaktad\u0131r. Bununla birlikte Dan\u0131\u015ftay \u0130dari Dava Daireleri Kurulu karar\u0131yla nihayete eren eldeki ba\u015fvuruya konu yarg\u0131lama s\u00fcreciyle ilgili olarak ba\u015fvuru yollar\u0131n\u0131n usul\u00fcne uygun \u015fekilde t\u00fcketilmesinden sonra bireysel ba\u015fvuru yap\u0131ld\u0131\u011f\u0131 de\u011ferlendirilmi\u015ftir.<\/p>\n<p>28. A\u00e7\u0131k\u00e7a dayanaktan yoksun olmad\u0131\u011f\u0131 ve kabul edilemezli\u011fine karar verilmesini gerektirecek ba\u015fka bir neden de bulunmad\u0131\u011f\u0131 anla\u015f\u0131lan m\u00fclkiyet hakk\u0131n\u0131n ihlal edildi\u011fine ili\u015fkin iddian\u0131n kabul edilebilir oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>2. Esas Y\u00f6n\u00fcnden<\/p>\n<p>a. M\u00fclk\u00fcn Varl\u0131\u011f\u0131<\/p>\n<p>29. M\u00fclkiyet hakk\u0131n\u0131n ihlal edildi\u011finden \u015fik\u00e2yet eden bir kimse, \u00f6nce b\u00f6yle bir hakk\u0131n\u0131n var oldu\u011funu kan\u0131tlamak zorundad\u0131r (Mustafa Ate\u015fo\u011flu ve di\u011ferleri, B. No: 2013\/1178, 5\/11\/2015, \u00a7\u00a7 49-54). Anayasa&#8217;n\u0131n 35. maddesinin birinci f\u0131kras\u0131nda &#8220;Herkes, m\u00fclkiyet ve miras haklar\u0131na sahiptir.&#8221; denilmek suretiyle m\u00fclkiyet hakk\u0131 g\u00fcvenceye ba\u011flanm\u0131\u015ft\u0131r. Anayasa&#8217;n\u0131n an\u0131lan maddesiyle g\u00fcvenceye ba\u011flanan m\u00fclkiyet hakk\u0131, ekonomik de\u011fer ifade eden ve parayla de\u011ferlendirilebilen her t\u00fcrl\u00fc mal varl\u0131\u011f\u0131 hakk\u0131n\u0131 kapsamaktad\u0131r (AYM, E.2015\/39, K.2015\/62, 1\/7\/2015, \u00a7 20). Bu ba\u011flamda m\u00fclk olarak de\u011ferlendirilmesi gerekti\u011finde ku\u015fku bulunmayan menkul ve gayrimenkul mallar ile bunlar\u0131n \u00fczerinde tesis edilen s\u0131n\u0131rl\u0131 ayni ve fikr\u00ee haklar\u0131n yan\u0131 s\u0131ra icras\u0131 kabil olan her t\u00fcrl\u00fc alacak da m\u00fclkiyet hakk\u0131n\u0131n kapsam\u0131na d\u00e2hildir (Mahmut Duran ve di\u011ferleri, B. No: 2014\/11441, 1\/2\/2017, \u00a7 60). M\u00fclkiyet hakk\u0131, \u00f6zel hukukta veya idari yarg\u0131da kabul edilen m\u00fclkiyet hakk\u0131 kavramlar\u0131ndan farkl\u0131 bir anlam ve kapsama sahip olup bu alanlarda kabul edilen m\u00fclkiyet hakk\u0131, yasal d\u00fczenlemeler ile yarg\u0131 i\u00e7tihatlar\u0131ndan ba\u011f\u0131ms\u0131z olarak \u00f6zerk bir yorum ile ele al\u0131nmal\u0131d\u0131r (H\u00fcseyin Remzi Polge, B. No: 2013\/2166, 25\/6\/2015, \u00a7 31).<\/p>\n<p>30. Anayasa&#8217;n\u0131n 35. maddesinde d\u00fczenlenen m\u00fclkiyet hakk\u0131 mevcut mal, m\u00fclk ve varl\u0131klar\u0131 koruyan bir g\u00fcvencedir. Bir ki\u015finin h\u00e2lihaz\u0131rda sahibi olmad\u0131\u011f\u0131 bir m\u00fclk\u00fcn m\u00fclkiyetini kazanma hakk\u0131 -ki\u015finin bu konudaki menfaati ne kadar g\u00fc\u00e7l\u00fc olursa olsun- Anayasa&#8217;yla korunan m\u00fclkiyet kavram\u0131 i\u00e7inde de\u011fildir. Bu hususun istisnas\u0131 olarak belli durumlarda bir ekonomik de\u011fer veya icras\u0131 m\u00fcmk\u00fcn bir alaca\u011f\u0131 elde etmeye y\u00f6nelik me\u015fru bir beklenti Anayasa&#8217;da yer alan m\u00fclkiyet hakk\u0131 g\u00fcvencesinden yararlanabilir (Kemal Yeler ve Ali Arslan \u00c7elebi, B. No: 2012\/636, 15\/4\/2014, \u00a7\u00a7 36, 37).<\/p>\n<p>31. Somut olayda 4054 say\u0131l\u0131 Kanun&#8217;un 4. maddesine ayk\u0131r\u0131 davranmas\u0131 nedeniyle ba\u015fvurucu hakk\u0131nda idari para cezas\u0131 uygulanmas\u0131 gerekti\u011fine ili\u015fkin mahkeme karar\u0131 kesinle\u015fmi\u015ftir. Bu h\u00e2liyle ba\u015fvurucu, bir idari para cezas\u0131 yapt\u0131r\u0131m\u0131 ile kar\u015f\u0131 kar\u015f\u0131ya kalm\u0131\u015ft\u0131r. Nitekim kesinle\u015fen mahkeme karar\u0131 sonras\u0131nda Kurul, ba\u015fvurucuya -iptali i\u00e7in a\u00e7\u0131lan dava temyiz a\u015famas\u0131nda derdest olmakla birlikte- idari para cezas\u0131 vermi\u015ftir. Dolay\u0131s\u0131yla idari para cezas\u0131 uygulanmamas\u0131na ili\u015fkin idari i\u015flemin kesinle\u015fmi\u015f bir mahkeme karar\u0131yla iptal edilmesinin mal varl\u0131\u011f\u0131 \u00fczerinde bir azalma meydana getirece\u011fi g\u00f6zetildi\u011finde ve somut olay\u0131n ko\u015fullar\u0131 bir b\u00fct\u00fcn olarak ele al\u0131nd\u0131\u011f\u0131nda ba\u015fvurucunun Anayasa&#8217;n\u0131n 35. maddesi kapsam\u0131nda korunmas\u0131 gereken ekonomik bir menfaatinin oldu\u011fu de\u011ferlendirilmi\u015ftir.<\/p>\n<p>b. M\u00fcdahalenin Varl\u0131\u011f\u0131 ve T\u00fcr\u00fc<\/p>\n<p>32. Malikin m\u00fclk\u00fcn\u00fc kullanma, m\u00fclk\u00fcn semerelerinden yararlanma ve m\u00fclk\u00fc \u00fczerinde tasarruf etme yetkilerinden herhangi birinin s\u0131n\u0131rlanmas\u0131 m\u00fclkiyet hakk\u0131na m\u00fcdahale te\u015fkil eder (Recep Tarhan ve Afife Tarhan, B. No: 2014\/1546, 2\/2\/2017, \u00a7 53). Anayasa\u2019n\u0131n 35. maddesi ile m\u00fclkiyet hakk\u0131na temas eden di\u011fer h\u00fck\u00fcmleri birlikte de\u011ferlendirildi\u011finde Anayasa&#8217;n\u0131n m\u00fclkiyet hakk\u0131na m\u00fcdahaleyle ilgili \u00fc\u00e7 kural ihtiva etti\u011fi hat\u0131rlat\u0131lmal\u0131d\u0131r (Anayasa&#8217;n\u0131n 35. maddesinin yap\u0131s\u0131 ve i\u00e7erdi\u011fi \u00fc\u00e7 kural ile ilgili olarak bkz. Recep Tarhan ve Afife Tarhan, \u00a7\u00a7 55-58).<\/p>\n<p>33. Somut olayda idari para cezas\u0131 uygulanmamas\u0131na ili\u015fkin idari i\u015flemin ba\u015fvurucunun rekabet kurallar\u0131na ayk\u0131r\u0131 davrand\u0131\u011f\u0131n\u0131 tespit eden kesinle\u015fmi\u015f bir mahkeme karar\u0131yla iptal edilmesi m\u00fclkiyet hakk\u0131na m\u00fcdahale te\u015fkil etmektedir. S\u00f6z konusu m\u00fcdahale ile rekabet ortam\u0131n\u0131n korunmas\u0131 ama\u00e7lanmaktad\u0131r. Bu durumda ba\u015fvurucunun m\u00fclkiyet hakk\u0131na yap\u0131lan m\u00fcdahalenin m\u00fclkiyetin kamu yarar\u0131na kullan\u0131m\u0131n\u0131n kontrol\u00fcne veya d\u00fczenlenmesine ili\u015fkin \u00fc\u00e7\u00fcnc\u00fc kural \u00e7er\u00e7evesinde incelenmesi gerekir (benzer y\u00f6ndeki de\u011ferlendirmeler i\u00e7in bkz. Mars Sinema Turizm ve Sportif Tesisler \u0130\u015fletmecili\u011fi A.\u015e., B. No: 2017\/23849, 10\/10\/2018, \u00a7 48)<\/p>\n<p>c. M\u00fcdahalenin \u0130hlal Olu\u015fturup Olu\u015fturmad\u0131\u011f\u0131<\/p>\n<p>34. Anayasa&#8217;n\u0131n 13. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Temel hak ve h\u00fcrriyetler, \u00f6zlerine dokunulmaks\u0131z\u0131n yaln\u0131zca Anayasan\u0131n ilgili maddelerinde belirtilen sebeplere ba\u011fl\u0131 olarak ve ancak kanunla s\u0131n\u0131rlanabilir. Bu s\u0131n\u0131rlamalar, Anayasan\u0131n s\u00f6z\u00fcne ve ruhuna, demokratik toplum d\u00fczeninin ve l\u00e2ik Cumhuriyetin gereklerine ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olamaz.&#8221;<\/p>\n<p>35. Anayasa\u2019n\u0131n 35. maddesinde m\u00fclkiyet hakk\u0131 s\u0131n\u0131rs\u0131z bir hak olarak d\u00fczenlenmemi\u015f, bu hakk\u0131n kamu yarar\u0131 amac\u0131yla ve kanunla s\u0131n\u0131rland\u0131r\u0131labilece\u011fi \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. M\u00fclkiyet hakk\u0131na m\u00fcdahalede bulunulurken temel hak ve \u00f6zg\u00fcrl\u00fcklerin s\u0131n\u0131rland\u0131r\u0131lmas\u0131na ili\u015fkin genel ilkeleri d\u00fczenleyen Anayasa&#8217;n\u0131n 13. maddesinin de g\u00f6z\u00f6n\u00fcnde bulundurulmas\u0131 gerekmektedir. Dolay\u0131s\u0131yla m\u00fclkiyet hakk\u0131na y\u00f6nelik m\u00fcdahalenin Anayasa&#8217;ya uygun olabilmesi i\u00e7in m\u00fcdahalenin kanuna dayanmas\u0131, kamu yarar\u0131 amac\u0131 ta\u015f\u0131mas\u0131 ve ayr\u0131ca \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesi g\u00f6zetilerek yap\u0131lmas\u0131 gerekmektedir(Recep Tarhan ve Afife Tarhan, \u00a7 62).<\/p>\n<p>i. Kanunilik <\/p>\n<p>36. M\u00fclkiyet hakk\u0131na y\u00f6nelik m\u00fcdahalelerde ilk incelenmesi gereken \u00f6l\u00e7\u00fct kanuna dayal\u0131 olma \u00f6l\u00e7\u00fct\u00fcd\u00fcr. Bu \u00f6l\u00e7\u00fct\u00fcn sa\u011flanmad\u0131\u011f\u0131 tespit edildi\u011finde di\u011fer \u00f6l\u00e7\u00fctler bak\u0131m\u0131ndan inceleme yap\u0131lmaks\u0131z\u0131n m\u00fclkiyet hakk\u0131n\u0131n ihlal edildi\u011fi sonucuna var\u0131lacakt\u0131r. M\u00fcdahalenin kanuna dayal\u0131 olmas\u0131, m\u00fcdahaleye ili\u015fkin yeterince ula\u015f\u0131labilir, belirli ve \u00f6ng\u00f6r\u00fclebilir kanun h\u00fck\u00fcmlerinin bulunmas\u0131n\u0131 gerektirmektedir (T\u00fcrkiye \u0130\u015f Bankas\u0131 A.\u015e. [GK], B. No: 2014\/6192, 12\/11\/2014, \u00a7 44; Ford Motor Company, B. No: 2014\/13518, 26\/10\/2017, \u00a7 49; Necmiye \u00c7ift\u00e7i ve di\u011ferleri, B. No: 2013\/1301, 30\/12\/2014, \u00a7 55).<\/p>\n<p>37. Kesinle\u015fen mahkeme karar\u0131yla piyasada h\u00e2kim durumda oldu\u011fu tespit edilen ba\u015fvurucunun yeniden sat\u0131\u015f fiyat\u0131 belirlemesinin 4054 say\u0131l\u0131 Kanun&#8217;un 4. maddesine ayk\u0131r\u0131l\u0131k olu\u015fturdu\u011fu kabul edilmi\u015ftir. M\u00fcdahaleye dayanak olan 4054 say\u0131l\u0131 Kanun h\u00fck\u00fcmlerinin a\u00e7\u0131k, ula\u015f\u0131labilir ve \u00f6ng\u00f6r\u00fclebilir mahiyette oldu\u011fu dikkate al\u0131nd\u0131\u011f\u0131nda ba\u015fvurucunun m\u00fclkiyet hakk\u0131na yap\u0131lan m\u00fcdahalenin kanuna dayal\u0131 oldu\u011fu ku\u015fkusuzdur.<\/p>\n<p>ii. Me\u015fru Ama\u00e7<\/p>\n<p>38. Anayasa&#8217;n\u0131n 13. ve 35. maddeleri uyar\u0131nca m\u00fclkiyet hakk\u0131 ancak kamu yarar\u0131 amac\u0131yla s\u0131n\u0131rland\u0131r\u0131labilmektedir. Kamu yarar\u0131 kavram\u0131, m\u00fclkiyet hakk\u0131n\u0131n kamu yarar\u0131n\u0131n gerektirdi\u011fi durumlarda s\u0131n\u0131rland\u0131r\u0131lmas\u0131 imk\u00e2n\u0131 vermekle bir s\u0131n\u0131rland\u0131rma amac\u0131 olmas\u0131n\u0131n yan\u0131 s\u0131ra m\u00fclkiyet hakk\u0131n\u0131n kamu yarar\u0131 amac\u0131 d\u0131\u015f\u0131nda s\u0131n\u0131rlanamayaca\u011f\u0131n\u0131 \u00f6ng\u00f6rerek ve bu anlamda bir s\u0131n\u0131rlama s\u0131n\u0131r\u0131 olu\u015fturarak m\u00fclkiyet hakk\u0131n\u0131 etkin bir \u015fekilde korumaktad\u0131r. Kamu yarar\u0131 kavram\u0131, devlet organlar\u0131n\u0131n takdir yetkisini de beraberinde getiren bir kavram olup objektif bir tan\u0131ma elveri\u015fli olmayan bu \u00f6l\u00e7\u00fct\u00fcn her somut olay temelinde ayr\u0131ca de\u011ferlendirilmesi gerekir (Nusrat K\u00fclah,B. No : 2013\/6151, 21\/4\/2016, \u00a7\u00a7 53, 56; Yunis A\u011flar, B. No: 2013\/1239, 20\/3\/2014, \u00a7\u00a7 28, 29).<\/p>\n<p>39. Rekabetin korunmas\u0131 amac\u0131yla te\u015febb\u00fcslere y\u00fck\u00fcml\u00fcl\u00fckler y\u00fcklenmesinin ve bu y\u00fck\u00fcml\u00fcl\u00fcklerin ihlali h\u00e2linde yapt\u0131r\u0131m uygulanmas\u0131n\u0131n kamu yarar\u0131n\u0131 sa\u011flamaya y\u00f6nelik oldu\u011fu a\u00e7\u0131kt\u0131r (Ford Otomotiv Sanayi A.\u015e. [GK], B. No: 2019\/40991, 23\/3\/2023, \u00a7 95). Somut olayda da te\u015febb\u00fcsler aras\u0131ndaki rekabetin korunmas\u0131 amac\u0131yla ger\u00e7ekle\u015ftirilen m\u00fcdahalede kamu yarar\u0131 bulundu\u011fu de\u011ferlendirilmi\u015ftir.<\/p>\n<p>iii. \u00d6l\u00e7\u00fcl\u00fcl\u00fck<\/p>\n<p>40. Son olarak kamu makamlar\u0131nca ba\u015fvurucunun m\u00fclkiyet hakk\u0131na yap\u0131lan m\u00fcdahaleyle ger\u00e7ekle\u015ftirilmek istenen ama\u00e7 ile bu amac\u0131n ger\u00e7ekle\u015ftirilmesi i\u00e7in kullan\u0131lan ara\u00e7lar aras\u0131nda makul bir \u00f6l\u00e7\u00fcl\u00fcl\u00fck ili\u015fkisinin olup olmad\u0131\u011f\u0131 de\u011ferlendirilmelidir.<\/p>\n<p>41. \u00d6l\u00e7\u00fcl\u00fcl\u00fck ilkesi elveri\u015flilik, gereklilik ve orant\u0131l\u0131l\u0131k olmak \u00fczere \u00fc\u00e7 alt ilkeden olu\u015fmaktad\u0131r. Elveri\u015flilik \u00f6ng\u00f6r\u00fclen m\u00fcdahalenin ula\u015f\u0131lmak istenen amac\u0131 ger\u00e7ekle\u015ftirmeye elveri\u015fli olmas\u0131n\u0131, gereklilik ula\u015f\u0131lmak istenen ama\u00e7 bak\u0131m\u0131ndan m\u00fcdahalenin zorunlu olmas\u0131n\u0131 yani ayn\u0131 amaca daha hafif bir m\u00fcdahale ile ula\u015f\u0131lmas\u0131n\u0131n m\u00fcmk\u00fcn olmamas\u0131n\u0131, orant\u0131l\u0131l\u0131k ise bireyin hakk\u0131na yap\u0131lan m\u00fcdahale ile ula\u015f\u0131lmak istenen ama\u00e7 aras\u0131nda makul bir dengenin g\u00f6zetilmesi gereklili\u011fini ifade etmektedir (AYM, E.2011\/111, K.2012\/56, 11\/4\/2012; E.2014\/176, K.2015\/53, 27\/5\/2015; E.2016\/13, K.2016\/127, 22\/6\/2016, \u00a7 18; Mehmet Akdo\u011fan ve di\u011ferleri, B. No: 2013\/817, 19\/12\/2013, \u00a7 38).<\/p>\n<p>42. Orant\u0131l\u0131l\u0131k ilkesi gere\u011fi ki\u015filerin m\u00fclkiyet hakk\u0131n\u0131n s\u0131n\u0131rland\u0131r\u0131lmas\u0131 h\u00e2linde elde edilmek istenen kamu yarar\u0131 ile bireyin haklar\u0131 aras\u0131nda adil bir dengenin kurulmas\u0131 gerekmektedir. Bu adil denge, ba\u015fvurucunun \u015fahsi olarak a\u015f\u0131r\u0131 bir y\u00fcke katland\u0131\u011f\u0131n\u0131n tespit edilmesi durumunda bozulmu\u015f olacakt\u0131r. M\u00fcdahalenin orant\u0131l\u0131l\u0131\u011f\u0131n\u0131 de\u011ferlendirirken Anayasa Mahkemesi; bir taraftan ula\u015f\u0131lmak istenen me\u015fru amac\u0131n \u00f6nemini, di\u011fer taraftan da m\u00fcdahalenin niteli\u011fini, ba\u015fvurucunun ve kamu otoritelerinin davran\u0131\u015flar\u0131n\u0131 g\u00f6z\u00f6n\u00fcnde bulundurarak ba\u015fvurucuya y\u00fcklenen k\u00fclfeti dikkate alacakt\u0131r (Arif G\u00fcven, B. No: 2014\/13966, 15\/2\/2017, \u00a7\u00a7 58, 60; Osman Ukav, B. No: 2014\/12501, 6\/7\/2017, \u00a7 71).<\/p>\n<p>43. Anayasa&#8217;n\u0131n 35. maddesi usule ili\u015fkin a\u00e7\u0131k bir g\u00fcvenceden s\u00f6z etmemektedir. Bununla birlikte m\u00fclkiyet hakk\u0131n\u0131n ger\u00e7ek anlamda korunabilmesi bak\u0131m\u0131ndan bu madde, Anayasa Mahkemesinin \u00e7e\u015fitli kararlar\u0131nda da ifade edildi\u011fi \u00fczere m\u00fclk sahibine m\u00fcdahalenin kanun d\u0131\u015f\u0131 veya keyf\u00ee ya da makul olmayan \u015fekilde uyguland\u0131\u011f\u0131na ili\u015fkin savunma ve itirazlar\u0131n\u0131 sorumlu makamlar \u00f6n\u00fcnde etkin bir bi\u00e7imde ortaya koyabilme olana\u011f\u0131n\u0131n tan\u0131nmas\u0131 g\u00fcvencesini kapsamaktad\u0131r. Bu de\u011ferlendirme ise uygulanan s\u00fcrecin b\u00fct\u00fcn\u00fcne bak\u0131larak yap\u0131lmal\u0131d\u0131r (Z\u00fcliye \u00d6zt\u00fcrk, B. No: 2014\/1734, 14\/9\/2017, \u00a7 64; Bekir Yaz\u0131c\u0131 [GK], B. No: 2013\/3044, 17\/12\/2015, \u00a7 71).<\/p>\n<p>44. Ba\u015fvurucuya rekabet kurallar\u0131na ayk\u0131r\u0131 davrand\u0131\u011f\u0131ndan dolay\u0131 idari para cezas\u0131 verilmesi gerekti\u011fine ili\u015fkin kesinle\u015fmi\u015f mahkeme karar\u0131n\u0131n kamu makamlar\u0131nca takip edilen rekabetin korunmas\u0131 amac\u0131n\u0131 ger\u00e7ekle\u015ftirmeye elveri\u015fli oldu\u011funda \u015f\u00fcphe yoktur. \u0130kinci olarak ba\u015fvurucunun m\u00fclkiyet hakk\u0131na yap\u0131lan m\u00fcdahalenin gerekli olup olmad\u0131\u011f\u0131 irdelenmelidir. Buna g\u00f6re m\u00fclkiyetin kamu yarar\u0131na kullan\u0131m\u0131n\u0131n kontrol\u00fcne ili\u015fkin \u00fc\u00e7\u00fcnc\u00fc kural \u00e7er\u00e7evesinde kamu makamlar\u0131n\u0131n sahip oldu\u011fu geni\u015f takdir yetkisi, ayn\u0131 amaca varmak i\u00e7in daha hafif bir m\u00fcdahale y\u00f6nteminin varl\u0131\u011f\u0131n\u0131n ortaya konulmamas\u0131 ve ba\u015fvurucu hakk\u0131nda yaln\u0131zca idari para cezas\u0131 uyguland\u0131\u011f\u0131 dikkate al\u0131nd\u0131\u011f\u0131nda m\u00fcdahalenin gerekli olmad\u0131\u011f\u0131 s\u00f6ylenemez.<\/p>\n<p>45. Orant\u0131l\u0131l\u0131k y\u00f6n\u00fcnden ise \u00f6ncelikle m\u00fclkiyet hakk\u0131na yap\u0131lan m\u00fcdahaleye kar\u015f\u0131 ba\u015fvurucuya iddia ve savunmalar\u0131n\u0131 etkin bir bi\u00e7imde ortaya koyabilme olana\u011f\u0131 tan\u0131n\u0131p tan\u0131nmad\u0131\u011f\u0131 de\u011ferlendirilmelidir. Ba\u015fvurucunun rekabet kurallar\u0131na ayk\u0131r\u0131 hareket etti\u011finden bahisle yap\u0131lan \u015fik\u00e2yetler sonras\u0131nda y\u00fcr\u00fct\u00fclen soru\u015fturma a\u015famas\u0131nda yaz\u0131l\u0131 olarak savunmalar\u0131n\u0131 sunan ba\u015fvurucuya ayr\u0131ca s\u00f6zl\u00fc savunma imk\u00e2n\u0131 sa\u011flanm\u0131\u015ft\u0131r. Yine Daire \u00f6n\u00fcnde g\u00f6r\u00fclen davada ba\u015fvurucu davaya d\u00e2hil olmu\u015f ve yap\u0131lan duru\u015fmada yer alm\u0131\u015ft\u0131r. Ba\u015fvurucu, davaya ge\u00e7 kat\u0131ld\u0131\u011f\u0131ndan yak\u0131nmaktaysa da bu gecikmenin iddia ve itirazlar\u0131n\u0131 ileri s\u00fcrmesini ne \u015fekilde etkiledi\u011fine dair bir a\u00e7\u0131klamada bulunmam\u0131\u015ft\u0131r. Davan\u0131n aleyhine sonu\u00e7lanmas\u0131 \u00fczerine ba\u015fvurucu, daval\u0131 idare yan\u0131nda temyiz kanun yoluna gidebilmi\u015ftir. \u00dcstelik ba\u015fvurucu, t\u00fcm yarg\u0131lama s\u00fcrecinde avukatla temsil edilmi\u015ftir.<\/p>\n<p>46. Kurul, ba\u015fvurucunun yeniden sat\u0131\u015f fiyat\u0131 belirlemesi suretiyle rekabet kurallar\u0131na ayk\u0131r\u0131 davrand\u0131\u011f\u0131na dair yeterli delil elde edilemedi\u011fini kaydetmi\u015f; buna kar\u015f\u0131l\u0131k Daire aksi bir kanaate vararak fiyatlar\u0131n belirlenmesi konusunda \u00e7ok say\u0131da bulgu ve belge oldu\u011funu belirtmi\u015ftir. Ba\u015fvurucu, bir \u015firketin \u015fik\u00e2yetinden vazge\u00e7mi\u015f olmas\u0131na ra\u011fmen bunun dikkate al\u0131nmad\u0131\u011f\u0131n\u0131 ileri s\u00fcrm\u00fc\u015ft\u00fcr. \u00d6te yandan Dairenin sonuca ula\u015f\u0131rken ba\u015fvurucu hakk\u0131ndaki soru\u015fturma dosyas\u0131 ve eklerinde yer alan ba\u015fka bir\u00e7ok tespit ve belgelere de at\u0131fta bulundu\u011fu g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Dolay\u0131s\u0131yla Dairenin davan\u0131n esas\u0131na ili\u015fkin temel iddia ve itirazlar\u0131 kar\u015f\u0131lad\u0131\u011f\u0131, karar\u0131nda ilgili ve yeterli gerek\u00e7e ortaya koydu\u011fu anla\u015f\u0131lm\u0131\u015ft\u0131r. Ayr\u0131ca daval\u0131 idare yan\u0131nda ba\u015fvurucunun da temyiz etti\u011fi karar hukuka uygun bulunmu\u015ftur.<\/p>\n<p>47. Ba\u015fvurucu, Dairenin yarg\u0131sal denetim s\u0131n\u0131r\u0131n\u0131 a\u015farak idare yerine ge\u00e7ti\u011fini ve ihlal tespiti yap\u0131p idari para cezas\u0131 uygulanmas\u0131 gerekti\u011fine karar verdi\u011fini belirtmektedir. Daire ,ba\u015fvurucunun 4054 say\u0131l\u0131 Kanun&#8217;un 4. maddesini ihlal etti\u011fi sonucuna vard\u0131\u011f\u0131ndan Kurulun an\u0131lan maddenin ihlal edilmedi\u011fine ve idari para cezas\u0131 verilmesine gerek olmad\u0131\u011f\u0131na ili\u015fkin karar\u0131nda hukuka uygunluk bulunmad\u0131\u011f\u0131n\u0131 kaydetmi\u015ftir. Kurul, yarg\u0131lama devam ederken Dairenin iptal karar\u0131 do\u011frultusunda ba\u015fvurucu hakk\u0131nda idari para cezas\u0131 uygulam\u0131\u015ft\u0131r. S\u00f6z konusu yapt\u0131r\u0131ma kar\u015f\u0131 a\u00e7\u0131lan dava ise eldeki bireysel ba\u015fvurunun inceleme tarihi itibar\u0131yla temyiz a\u015famas\u0131nda derdesttir. Bu h\u00e2liyle Dairenin Kurul karar\u0131n\u0131 hukuka ayk\u0131r\u0131 bularak iptal etti\u011fi,<\/p>\n<p>buna uygun olarak ba\u015fvurucu hakk\u0131nda yeni bir soru\u015fturma a\u00e7\u0131p rekabet kural\u0131na ayk\u0131r\u0131 davrand\u0131\u011f\u0131n\u0131 tespit edenin ve buna ba\u011fl\u0131 olarak da idari para cezas\u0131 verenin Kurul oldu\u011fu g\u00f6r\u00fclmektedir. Kald\u0131 ki idari para cezas\u0131na iptali talebiyle a\u00e7\u0131lan davan\u0131n inceleme tarihi itibariyle sonu\u00e7lanmad\u0131\u011f\u0131 belirtilmelidir.<\/p>\n<p>48. Sonu\u00e7 olarak mevcut a\u015fama itibar\u0131yla m\u00fclkiyet hakk\u0131na yap\u0131lan m\u00fcdahalenin ba\u015fvurucuya \u015fahsi olarak a\u015f\u0131r\u0131 ve ola\u011fan d\u0131\u015f\u0131 bir k\u00fclfet y\u00fcklemedi\u011fi de\u011ferlendirilmi\u015ftir. \u00d6te yandan kesinle\u015fen mahkeme karar\u0131 sonras\u0131nda Kurul taraf\u0131ndan uygulanan idari para cezas\u0131na ili\u015fkin yarg\u0131lama s\u00fcreci ise devam etti\u011finden Anayasa Mahkemesi, incelemesini nihayete ermi\u015f olan ba\u015fvuruya konu yarg\u0131lama s\u00fcreci ile s\u0131n\u0131rl\u0131 olarak yapt\u0131\u011f\u0131n\u0131 kaydetmektedir.<\/p>\n<p>49. A\u00e7\u0131klanan gerek\u00e7elerle Anayasa\u2019n\u0131n 35. maddesinde g\u00fcvence alt\u0131na al\u0131nan m\u00fclkiyet hakk\u0131n\u0131n ihlal edilmedi\u011fine karar verilmesi gerekir.<\/p>\n<p>VI.
