Ba\u015fvuru, hakk\u0131nda y\u00fcr\u00fct\u00fclen ceza soru\u015fturmas\u0131n\u0131n uzun s\u00fcrmesinin avukatl\u0131k mesle\u011fini olumsuz etkilemesi nedeniyle \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ihlal edildi\u011fi iddias\u0131na ili\u015fkindir.<\/p>\n<p>II. BA\u015eVURU S\u00dcREC\u0130<\/p>\n<p>2. Ba\u015fvuru 30\/12\/2020 tarihinde yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>3. Komisyonca ba\u015fvurunun kabul edilebilirlik incelemesinin B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>4. Ba\u015fvuru belgelerinin bir \u00f6rne\u011fi bilgi i\u00e7in Adalet Bakanl\u0131\u011f\u0131na (Bakanl\u0131k) g\u00f6nderilmi\u015ftir. Bakanl\u0131k, g\u00f6r\u00fc\u015f\u00fcn\u00fc bildirmi\u015ftir. Ba\u015fvurucu, Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 beyanda bulunmam\u0131\u015ft\u0131r.<\/p>\n<p>5. \u0130kinci B\u00f6l\u00fcm, ba\u015fvurunun Genel Kurul taraf\u0131ndan incelenmesine karar vermi\u015ftir.<\/p>\n<p>III. OLAY VE OLGULAR <\/p>\n<p>6. Ba\u015fvuru formlar\u0131 ve eklerinde ifade edildi\u011fi \u015fekliyle ve Ulusal Yarg\u0131 A\u011f\u0131 Bili\u015fim Sistemi (UYAP) arac\u0131l\u0131\u011f\u0131yla eri\u015filen bilgi ve belgeler \u00e7er\u00e7evesinde ilgili olaylar \u00f6zetle \u015f\u00f6yledir:<\/p>\n<p>7. \u0130stanbul Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131 (Ba\u015fsavc\u0131l\u0131k) serbest avukat olan ba\u015fvurucu hakk\u0131nda silahl\u0131 ter\u00f6r \u00f6rg\u00fct\u00fcne \u00fcye olma su\u00e7undan 2012 y\u0131l\u0131nda ceza soru\u015fturmas\u0131 ba\u015flatm\u0131\u015ft\u0131r.<\/p>\n<p>8. \u00c7ok say\u0131da \u015f\u00fcpheli hakk\u0131nda y\u00fcr\u00fct\u00fclen ceza soru\u015fturmas\u0131nda Ba\u015fsavc\u0131l\u0131\u011f\u0131n talebi \u00fczerine \u0130stanbul 1. Sulh Ceza H\u00e2kimli\u011fince 27\/1\/2016 tarihinde, at\u0131l\u0131 su\u00e7un vasf\u0131 g\u00f6zetildi\u011finde soru\u015fturman\u0131n amac\u0131n\u0131 tehlikeye d\u00fc\u015f\u00fcrme ihtimali oldu\u011fu gerek\u00e7esiyle m\u00fcdafi veya vekilinin dosyay\u0131 inceleme veya dosyadan belge alma yetkilerinin k\u0131s\u0131tlanmas\u0131na karar verilmi\u015ftir. Ba\u015fvurucu, beyan\u0131na g\u00f6re 26\/1\/2016 tarihinde hakk\u0131ndaki soru\u015fturmadan haberdar olmu\u015f; dosyay\u0131 incelemek istedi\u011finde de an\u0131lan k\u0131s\u0131tl\u0131l\u0131k karar\u0131 kendisine sunulmu\u015ftur. Ba\u015fvurucu, bu durum \u00fczerine 5\/2\/2016 tarihinde k\u0131s\u0131tl\u0131l\u0131k karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131 i\u00e7in \u0130stanbul 1. Sulh Ceza H\u00e2kimli\u011fine ba\u015fvurmu\u015ftur.<\/p>\n<p>9. Ba\u015fvurucu, yakla\u015f\u0131k dokuz y\u0131l s\u00fcren ve k\u0131s\u0131tl\u0131l\u0131k karar\u0131 nedeniyle i\u00e7eri\u011fi hakk\u0131nda bilgi edinemedi\u011fi soru\u015fturman\u0131n sonland\u0131r\u0131lmas\u0131 talebiyle 21\/1\/2020 tarihinde Ba\u015fsavc\u0131l\u0131\u011fa ba\u015fvurmu\u015ftur. Dilek\u00e7esinde; bir m\u00fcvekkiliyle i\u015flem yaparken hakk\u0131nda ceza soru\u015fturmas\u0131 oldu\u011funu \u00f6\u011frendi\u011fini, Ba\u015fsavc\u0131l\u0131\u011f\u0131n soru\u015fturman\u0131n i\u00e7eri\u011fi hakk\u0131nda bilgi vermedi\u011fini, sadece \u015fifahi olarak soru\u015fturman\u0131n 2012 y\u0131l\u0131nda ba\u015flad\u0131\u011f\u0131n\u0131n kendisine bildirildi\u011fini, 2016 y\u0131l\u0131nda k\u0131s\u0131tlama karar\u0131 verildi\u011fini \u00f6\u011frendikten sonra bu karar\u0131n kald\u0131r\u0131lmas\u0131 i\u00e7in yapt\u0131\u011f\u0131 ba\u015fvurudan da sonu\u00e7 alamad\u0131\u011f\u0131n\u0131 belirtmi\u015ftir.<\/p>\n<p>10. Bununla birlikte ba\u015fvurucu 4\/12\/2004 tarihli ve 5271 say\u0131l\u0131 Ceza Muhakemesi Kanunu&#8217;nda ceza soru\u015fturmas\u0131n\u0131n sonu\u00e7lanmas\u0131 i\u00e7in herhangi bir \u00fcst s\u00fcre s\u0131n\u0131r\u0131 belirlenmese de an\u0131lan Kanun&#8217;un 160. ve devam\u0131 maddeleri g\u00f6zetildi\u011finde kanun koyucunun su\u00e7 \u015f\u00fcphesinin h\u0131zla ayd\u0131nlat\u0131lmas\u0131n\u0131 sa\u011flamak ve \u015f\u00fcphelinin uzun s\u00fcre soru\u015fturma tehdidi alt\u0131nda tutulmas\u0131n\u0131 \u00f6nlemek amac\u0131yla hareket etti\u011finin sabit oldu\u011funu vurgulam\u0131\u015ft\u0131r. Buradan hareketle ki\u015fi onuru ve g\u00fcvenli\u011fini dikkate almayan soru\u015fturma s\u00fcrelerinin lekelenmeme hakk\u0131 ile makul s\u00fcrede yarg\u0131lanma ve adil yarg\u0131lanma hakk\u0131n\u0131 ihlal edece\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr. Ayr\u0131ca2012 y\u0131l\u0131ndan beri y\u00fcr\u00fct\u00fclen ceza soru\u015fturmas\u0131 nedeniyle s\u00fcrekli bask\u0131 alt\u0131nda oldu\u011funu, tedirginlik ve belirsizlik i\u00e7inde ya\u015fad\u0131\u011f\u0131n\u0131, mesleki faaliyetlerinin de soru\u015fturmadan olumsuz etkilendi\u011fini vurgulam\u0131\u015ft\u0131r. Bu ba\u011flamda arabuluculuk s\u0131nav\u0131n\u0131 kazanmas\u0131na ra\u011fmen i\u00e7eri\u011fini bile \u00f6\u011frenemedi\u011fi ceza soru\u015fturmas\u0131 nedeniyle arabuluculuk siciline kayd\u0131n\u0131n yap\u0131lmad\u0131\u011f\u0131n\u0131, yasal gereklilikleri sa\u011flad\u0131\u011f\u0131 h\u00e2lde ye\u015fil pasaport m\u00fcracaat\u0131 yapamad\u0131\u011f\u0131n\u0131, g\u00fcvenlik soru\u015fturmas\u0131 gerektiren t\u00fcm alanlar\u0131n kendisine kapat\u0131lmas\u0131ndan dolay\u0131 maddi ve manevi zarara u\u011frad\u0131\u011f\u0131n\u0131 belirtmi\u015ftir. Bu durumun \u00f6zel hayat\u0131na sayg\u0131 hakk\u0131n\u0131 da ihlal etti\u011fini belirten ba\u015fvurucu, on y\u0131ld\u0131r ki\u015fisel ve mesleki haklar\u0131n\u0131 s\u0131n\u0131rland\u0131ran, \u00f6zel ya\u015fam\u0131 i\u00e7in ciddi bir tehdit olarak devam eden soru\u015fturman\u0131n ivedilikle sonu\u00e7land\u0131r\u0131lmas\u0131n\u0131, kovu\u015fturmaya yer olmad\u0131\u011f\u0131na karar verilmesini ve dosyay\u0131 incelemesine, belgelerden \u00f6rnek al\u0131nmas\u0131na izin verilmesini talep etmi\u015ftir.<\/p>\n<p>11. Ba\u015fvurucu 24\/7\/2020 tarihinde tekrar Ba\u015fsavc\u0131l\u0131\u011fa ba\u015fvurarak talebine dair herhangi bir i\u015flem yap\u0131lmad\u0131\u011f\u0131n\u0131, hakk\u0131ndaki soru\u015fturman\u0131n devam etti\u011fini ve bu durumun mesleki itibar\u0131na zarar verdi\u011fini ifade etmi\u015ftir. \u00d6nceki dilek\u00e7esindeki a\u00e7\u0131klamalar\u0131na ek olarak vekil s\u0131fat\u0131yla takip etti\u011fi dava dosyalar\u0131na Ba\u015fsavc\u0131l\u0131k taraf\u0131ndan hakk\u0131nda ter\u00f6r su\u00e7lar\u0131yla ba\u011flant\u0131l\u0131 ceza soru\u015fturmas\u0131 y\u00fcr\u00fct\u00fcld\u00fc\u011f\u00fcne ili\u015fkin yaz\u0131 g\u00f6nderildi\u011fini ilgili dosya numaralar\u0131n\u0131 da belirterek vurgulam\u0131\u015ft\u0131r. Takip etti\u011fi dosyalara bu \u015fekilde yaz\u0131 g\u00f6nderilmesi ile lekelenmeme hakk\u0131na ayk\u0131r\u0131 olarak soru\u015fturman\u0131n alenile\u015ftirildi\u011fini ve soru\u015fturman\u0131n gizli y\u00fcr\u00fct\u00fclmesi ilkesine ayk\u0131r\u0131 davran\u0131ld\u0131\u011f\u0131n\u0131 iddia etmi\u015ftir. On y\u0131ld\u0131r derdest olan soru\u015fturman\u0131n avukat olarak takip etti\u011fi dava dosyalar\u0131na g\u00f6nderilen yaz\u0131larla te\u015fhir edilmesi sonucu ki\u015fisel ve mesleki ya\u015fam\u0131n\u0131n olumsuz etkilendi\u011fini, hakk\u0131nda soru\u015fturma ba\u015flatmaya yetecek d\u00fczeyde bile bulgunun mevcut olmad\u0131\u011f\u0131n\u0131 vurgulayarak soru\u015fturman\u0131n ivedilikle sonu\u00e7land\u0131r\u0131lmas\u0131 talebini de yinelemi\u015ftir. UYAP \u00fczerinden yap\u0131lan incelemede ba\u015fvurucunun yukar\u0131da an\u0131lan taleplerine ili\u015fkin Ba\u015fsavc\u0131l\u0131k\u00e7a yap\u0131lan herhangi bir i\u015flem tespit edilmemi\u015ftir.<\/p>\n<p>12. Ba\u015fvurucu bu defa 7\/9\/2020 tarihinde, hakk\u0131nda hi\u00e7bir \u015f\u00fcphe yokken ba\u015flat\u0131lan ve on bir y\u0131ld\u0131r s\u00fcren ceza soru\u015fturmas\u0131nda ifadesinin dahi al\u0131nmad\u0131\u011f\u0131n\u0131, tefrik karar\u0131 verilen bir k\u0131s\u0131m \u015f\u00fcpheli hakk\u0131nda kovu\u015fturmaya yer olmad\u0131\u011f\u0131na karar verildi\u011fini belirterek soru\u015fturman\u0131n ivedilikle sonu\u00e7land\u0131r\u0131labilmesi i\u00e7in tefrik karar\u0131 verilmesini Ba\u015fsavc\u0131l\u0131ktan talep etmi\u015ftir.<\/p>\n<p>13. Ba\u015fvurucu 30\/12\/2020 tarihinde bireysel ba\u015fvuruda bulunmu\u015ftur.<\/p>\n<p>14. UYAP \u00fczerinden yap\u0131lan incelemede soru\u015fturma kapsam\u0131nda ba\u015fvurucunun ifadesinin 5\/3\/2021 tarihinde al\u0131nd\u0131\u011f\u0131 anla\u015f\u0131lm\u0131\u015ft\u0131r. 29\/3\/2021 tarihinde ise soru\u015fturman\u0131n ba\u015fvurucu y\u00f6n\u00fcnden tefrikine karar verilmi\u015f ve ba\u015fvurucunun silahl\u0131 ter\u00f6r \u00f6rg\u00fct\u00fcne \u00fcye olma su\u00e7undan cezaland\u0131r\u0131lmas\u0131 talebiyle iddianame d\u00fczenlenmi\u015ftir. \u0130stanbul A\u011f\u0131r Ceza Mahkemesince (A\u011f\u0131r Ceza Mahkemesi) yap\u0131lan yarg\u0131lama sonucunda 17\/11\/2021 tarihinde ba\u015fvurucunun at\u0131l\u0131 su\u00e7tan beraatine karar verilmi\u015ftir. Karar gerek\u00e7esinde; su\u00e7un unsurlar\u0131n\u0131n olu\u015fmad\u0131\u011f\u0131na, y\u00fcklenen fiilin kanunda su\u00e7 olarak tan\u0131mlanmad\u0131\u011f\u0131na i\u015faret edilmi\u015ftir. Ba\u015fvurucunun dinleme kay\u0131tlar\u0131na yans\u0131yan konu\u015fmalar\u0131 avukatl\u0131k mesle\u011fini icra etti\u011fi s\u0131rada sarf etti\u011fi ve bu konu\u015fmalar\u0131n i\u00e7erik itibar\u0131yla su\u00e7 bar\u0131nd\u0131rmad\u0131\u011f\u0131 belirtilmi\u015f; dosya kapsam\u0131nda \u00f6rg\u00fctle ba\u011f kuruldu\u011funa dair somut bir delil bulunmad\u0131\u011f\u0131 ifade edilmi\u015ftir. An\u0131lan karara ili\u015fkin istinaf incelemesi devam etmektedir.<\/p>\n<p>15. Ayr\u0131ca Adalet Bakanl\u0131\u011f\u0131n\u0131n (Bakanl\u0131k) 16\/10\/2020 tarihli yaz\u0131s\u0131yla, hakk\u0131nda y\u00fcr\u00fct\u00fclen ceza soru\u015fturmas\u0131 nedeniyle ter\u00f6r \u00f6rg\u00fct\u00fcyle iltisakl\u0131 veya irtibatl\u0131 olmama \u015fart\u0131n\u0131 sa\u011flayamad\u0131\u011f\u0131ndan arabuluculuk siciline yaz\u0131lma talebinin reddedildi\u011fi ba\u015fvurucuya tebli\u011f edilmi\u015ftir. Ba\u015fvurucu 11\/11\/2020 tarihinde an\u0131lan idari i\u015flemin iptali istemiyle Ankara \u0130dare Mahkemesinde (\u0130dare Mahkemesi) dava a\u00e7m\u0131\u015ft\u0131r.<\/p>\n<p>16. \u0130dare Mahkemesince 27\/4\/2021 tarihinde davan\u0131n reddine karar verilmi\u015ftir. Karar gerek\u00e7esinde, ba\u015fvurucunun hakk\u0131nda y\u00fcr\u00fct\u00fclen silahl\u0131 ter\u00f6r \u00f6rg\u00fct\u00fcne \u00fcye olma su\u00e7una ili\u015fkin ceza soru\u015fturmas\u0131na i\u015faret edilmi\u015f; ba\u015fvurucunun arabuluculuk siciline kay\u0131t i\u00e7in aranan ter\u00f6r \u00f6rg\u00fctleriyle iltisakl\u0131 veya irtibatl\u0131 olmamak \u015fart\u0131n\u0131 sa\u011flamad\u0131\u011f\u0131ndan idari i\u015flemde hukuka ayk\u0131r\u0131l\u0131k bulunmad\u0131\u011f\u0131 ifade edilmi\u015ftir. An\u0131lan karara ili\u015fkin istinaf incelemesi devam etmektedir.<\/p>\n<p>IV. \u0130LG\u0130L\u0130 HUKUK<\/p>\n<p>A. Ulusal Hukuk<\/p>\n<p>17. 5271 say\u0131l\u0131 Kanun&#8217;un &#8220;Tan\u0131mlar&#8221; ba\u015fl\u0131kl\u0131 2. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Bu Kanunun uygulanmas\u0131nda;<\/p>\n<p>&#8230;<\/p>\n<p>e) Soru\u015fturma: Kanuna g\u00f6re yetkili mercilerce su\u00e7 \u015f\u00fcphesinin \u00f6\u011frenilmesinden iddianamenin kabul\u00fcne kadar ge\u00e7en evreyi,<\/p>\n<p>&#8230;<\/p>\n<p>ifade eder.&#8221;<\/p>\n<p>18. 5271 say\u0131l\u0131 Kanun&#8217;un &#8220;Soru\u015fturman\u0131n gizlili\u011fi&#8221; ba\u015fl\u0131kl\u0131 157. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;(1) Kanunun ba\u015fka h\u00fck\u00fcm koydu\u011fu h\u00e2ller sakl\u0131 kalmak ve savunma haklar\u0131na zarar vermemek ko\u015fuluyla soru\u015fturma evresindeki usul i\u015flemleri gizlidir.&#8221;<\/p>\n<p>19. 5271 say\u0131l\u0131 Kanun&#8217;un &#8220;Bir su\u00e7un i\u015flendi\u011fini \u00f6\u011frenen Cumhuriyet savc\u0131s\u0131n\u0131n g\u00f6revi&#8221; ba\u015fl\u0131kl\u0131 160. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;(1) Cumhuriyet savc\u0131s\u0131, ihbar veya ba\u015fka bir suretle bir su\u00e7un i\u015flendi\u011fi izlenimini veren bir h\u00e2li \u00f6\u011frenir \u00f6\u011frenmez kamu davas\u0131n\u0131 a\u00e7maya yer olup olmad\u0131\u011f\u0131na karar vermek \u00fczere hemen i\u015fin ger\u00e7e\u011fini ara\u015ft\u0131rmaya ba\u015flar.<\/p>\n<p>\u00a0(2) Cumhuriyet savc\u0131s\u0131, madd\u00ee ger\u00e7e\u011fin ara\u015ft\u0131r\u0131lmas\u0131 ve adil bir yarg\u0131laman\u0131n yap\u0131labilmesi i\u00e7in, emrindeki adl\u00ee kolluk g\u00f6revlileri marifetiyle, \u015f\u00fcphelinin lehine ve aleyhine olan delilleri toplayarak muhafaza alt\u0131na almakla ve \u015f\u00fcphelinin haklar\u0131n\u0131 korumakla y\u00fck\u00fcml\u00fcd\u00fcr.&#8221;<\/p>\n<p>20. 5271 say\u0131l\u0131 Kanun&#8217;un &#8220;Cumhuriyet savc\u0131s\u0131n\u0131n g\u00f6rev ve yetkileri&#8221; ba\u015fl\u0131kl\u0131 161. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;(1) Cumhuriyet savc\u0131s\u0131, do\u011frudan do\u011fruya veya emrindeki adl\u00ee kolluk g\u00f6revlileri arac\u0131l\u0131\u011f\u0131 ile her t\u00fcrl\u00fc ara\u015ft\u0131rmay\u0131 yapabilir; yukar\u0131daki maddede yaz\u0131l\u0131 sonu\u00e7lara varmak i\u00e7in b\u00fct\u00fcn kamu g\u00f6revlilerinden her t\u00fcrl\u00fc bilgiyi isteyebilir. Cumhuriyet savc\u0131s\u0131, adl\u00ee g\u00f6revi gere\u011fince nezdinde g\u00f6rev yapt\u0131\u011f\u0131 mahkemenin yarg\u0131 \u00e7evresi d\u0131\u015f\u0131nda bir i\u015flem yapmak ihtiyac\u0131 ortaya \u00e7\u0131k\u0131nca, bu hususta o yer Cumhuriyet savc\u0131s\u0131ndan s\u00f6z konusu i\u015flemi yapmas\u0131n\u0131 ister.<\/p>\n<p>\u00a0(2) Adl\u00ee kolluk g\u00f6revlileri, elkoyduklar\u0131 olaylar\u0131, yakalanan ki\u015filer ile uygulanan tedbirleri emrinde \u00e7al\u0131\u015ft\u0131klar\u0131 Cumhuriyet savc\u0131s\u0131na derh\u00e2l bildirmek ve bu Cumhuriyet savc\u0131s\u0131n\u0131n adliyeye ili\u015fkin b\u00fct\u00fcn emirlerini gecikmeksizin yerine getirmekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p>\u00a0(3) Cumhuriyet savc\u0131s\u0131, adl\u00ee kolluk g\u00f6revlilerine emirleri yaz\u0131l\u0131; acele h\u00e2llerde, s\u00f6zl\u00fc olarak verir. S\u00f6zl\u00fc emir, en k\u0131sa s\u00fcrede yaz\u0131l\u0131 olarak da bildirilir.<\/p>\n<p>\u00a0(4) Di\u011fer kamu g\u00f6revlileri de, y\u00fcr\u00fct\u00fclmekte olan soru\u015fturma kapsam\u0131nda ihtiya\u00e7 duyulan bilgi ve belgeleri, talep eden Cumhuriyet savc\u0131s\u0131na vakit ge\u00e7irmeksizin temin etmekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p>\u00a0(5) Kanun taraf\u0131ndan kendilerine verilen veya kanun dairesinde kendilerinden istenen adliye ile ilgili g\u00f6rev veya i\u015flerde k\u00f6t\u00fcye kullanma veya ihmalleri g\u00f6r\u00fclen kamu g\u00f6revlileri ile Cumhuriyet savc\u0131lar\u0131n\u0131n s\u00f6zl\u00fc veya yaz\u0131l\u0131 istem ve emirlerini yapmakta k\u00f6t\u00fcye kullanma veya ihmalleri g\u00f6r\u00fclen kolluk \u00e2mir ve memurlar\u0131 hakk\u0131nda Cumhuriyet savc\u0131lar\u0131nca do\u011frudan do\u011fruya soru\u015fturma yap\u0131l\u0131r&#8230;<\/p>\n<p>&#8230;&#8221;<\/p>\n<p>21. 7\/6\/2012 tarihli ve 6325 say\u0131l\u0131 Hukuk Uyu\u015fmazl\u0131klar\u0131nda Arabuluculuk Kanunu&#8217;nun &#8220;Tan\u0131mlar&#8221; ba\u015fl\u0131kl\u0131 2. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Bu Kanunun uygulanmas\u0131nda;<\/p>\n<p>&#8230;<\/p>\n<p>\u00a0(a) Arabulucu: Arabuluculuk faaliyetini y\u00fcr\u00fcten ve Bakanl\u0131k\u00e7a d\u00fczenlenen arabulucular siciline kaydedilmi\u015f bulunan ger\u00e7ek ki\u015fiyi,<\/p>\n<p>\u00a0(b) Arabuluculuk: Sistematik teknikler uygulayarak, g\u00f6r\u00fc\u015fmek ve m\u00fczakerelerde bulunmak amac\u0131yla taraflar\u0131 bir araya getiren, onlar\u0131n birbirlerini anlamalar\u0131n\u0131 ve bu suretle \u00e7\u00f6z\u00fcmlerini kendilerinin \u00fcretmesini sa\u011flamak i\u00e7in aralar\u0131nda ileti\u015fim s\u00fcrecinin kurulmas\u0131n\u0131 ger\u00e7ekle\u015ftiren, uzmanl\u0131k e\u011fitimi alm\u0131\u015f olan tarafs\u0131z ve ba\u011f\u0131ms\u0131z bir \u00fc\u00e7\u00fcnc\u00fc ki\u015finin kat\u0131l\u0131m\u0131yla ve ihtiyar\u00ee olarak y\u00fcr\u00fct\u00fclen uyu\u015fmazl\u0131k \u00e7\u00f6z\u00fcm y\u00f6ntemini,<\/p>\n<p>&#8230;<\/p>\n<p>ifade eder.&#8221;<\/p>\n<p>22. 6325 say\u0131l\u0131 Kanun&#8217;un &#8220;Arabulucular siciline kay\u0131t \u015fartlar\u0131&#8221; ba\u015fl\u0131kl\u0131 20. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;(1) Sicile kay\u0131t, ilgilinin Daire Ba\u015fkanl\u0131\u011f\u0131na yaz\u0131l\u0131 olarak ba\u015fvurmas\u0131 \u00fczerine yap\u0131l\u0131r.<\/p>\n<p>\u00a0(2) Arabulucular siciline kaydedilebilmek i\u00e7in;<\/p>\n<p>a) T\u00fcrk vatanda\u015f\u0131 olmak,<\/p>\n<p>b) Mesle\u011finde en az be\u015f y\u0131ll\u0131k k\u0131deme sahip hukuk fak\u00fcltesi mezunu olmak,<\/p>\n<p>&#8230;<\/p>\n<p>\u00e7) (De\u011fi\u015fik: 12\/10\/2017-7036\/25 md.) 26\/9\/2004 tarihli ve 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanununun 53 \u00fcnc\u00fc maddesinde belirtilen s\u00fcreler ge\u00e7mi\u015f olsa bile; kasten i\u015flenen bir su\u00e7tan dolay\u0131 bir y\u0131ldan fazla s\u00fcreyle hapis cezas\u0131na ya da affa u\u011fram\u0131\u015f olsa bile Devletin g\u00fcvenli\u011fine kar\u015f\u0131 su\u00e7lar, Anayasal d\u00fczene ve bu d\u00fczenin i\u015fleyi\u015fine kar\u015f\u0131 su\u00e7lar, zimmet, irtik\u00e2p, r\u00fc\u015fvet, h\u0131rs\u0131zl\u0131k, doland\u0131r\u0131c\u0131l\u0131k, sahtecilik, g\u00fcveni k\u00f6t\u00fcye kullanma, hileli iflas, ihaleye fesat kar\u0131\u015ft\u0131rma, edimin ifas\u0131na fesat kar\u0131\u015ft\u0131rma, su\u00e7tan kaynaklanan malvarl\u0131\u011f\u0131 de\u011ferlerini aklama veya ka\u00e7ak\u00e7\u0131l\u0131k, ger\u00e7e\u011fe ayk\u0131r\u0131 bilirki\u015filik yapma, yalan tan\u0131kl\u0131k ve yalan yere yemin su\u00e7lar\u0131ndan mahk\u00fbm olmamak,<\/p>\n<p>d) (Ek: 5\/6\/2017-KHK-691\/9 md.; Aynen kabul: 31\/1\/2018-7069\/9 md.) Avrupa \u0130nsan Haklar\u0131 Mahkemesi \u0130\u00e7tihad\u0131<\/p>\n<p>25. Avrupa \u0130nsan Haklar\u0131 Mahkemesi (A\u0130HM) i\u00e7tihatlar\u0131nda \u00f6zel hayat\u0131n eksiksiz bir tan\u0131m\u0131 bulunmayan geni\u015f bir kavram oldu\u011funu belirtmektedir. \u00d6zel hayata sayg\u0131 hakk\u0131 alt kategorisinde ge\u00e7en \u00f6zel hayat kavram\u0131n\u0131 A\u0130HM olduk\u00e7a geni\u015f yorumlamakta ve bu kavrama ili\u015fkin t\u00fcketici bir tan\u0131m yap\u0131lmaktan \u00f6zellikle ka\u00e7\u0131nmaktad\u0131r (Koch\/Almanya, B. No: 497\/09, 19\/7\/2012, \u00a7 51). Bununla birlikte S\u00f6zle\u015fme&#8217;nin denetim organlar\u0131n\u0131n i\u00e7tihatlar\u0131nda bireyin ki\u015fili\u011fini serbest\u00e7e geli\u015ftirmesi ve ger\u00e7ekle\u015ftirmesi ve ki\u015fisel ba\u011f\u0131ms\u0131zl\u0131k kavramlar\u0131 \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n kapsam\u0131n\u0131n belirlenmesinde temel al\u0131nmaktad\u0131r (Sidabras ve D\u017eiautas\/Litvanya, B. A\u0130HM, kural olarak ilgili ki\u015finin mesleki ya\u015fant\u0131s\u0131na getirilen bir k\u0131s\u0131tlamay\u0131 S\u00f6zle\u015fme&#8217;nin 8. maddesinin kapsam\u0131 i\u00e7inde kabul etmektedir (Sodan\/T\u00fcrkiye, B. No: 18650\/05, 2\/2\/2016, \u00a7 37). A\u0130HM \u00f6ncelikle mesleki hayat\u0131n ki\u015fili\u011fin geli\u015ftirilmesi \u00fczerindeki etkisini tart\u0131\u015fm\u0131\u015f, mesleki hayata getirilen s\u0131n\u0131rlamalar\u0131n bireyin yak\u0131n \u00e7evresiyle ili\u015fkilerini geli\u015ftirmesi ve sosyal kimli\u011fini \u015fekillendirmesi \u00fczerinde etki do\u011furaca\u011f\u0131n\u0131 belirtmi\u015f ve bu ba\u011flamdaki m\u00fcdahalelerin 8. maddenin kapsam\u0131na girebilece\u011fini de\u011ferlendirmi\u015ftir (Fern\u00e1ndez Mart\u00ednez\/\u0130spanya [BD], B. No: 56030\/07, 12\/6\/2014, \u00a7 109).<\/p>\n<p>27. \u00d6te yandan A\u0130HM, mesleki hayatla ilgili ba\u015fvuru t\u00fcrlerinde \u00f6zel hayat kavram\u0131n\u0131 iki farkl\u0131 yakla\u015f\u0131ma g\u00f6re uygulamaktad\u0131r: Birincisi \u00f6zel hayata ili\u015fkin bir unsurun anla\u015fmazl\u0131k nedeni olup olmad\u0131\u011f\u0131 (sebebe dayal\u0131 yakla\u015f\u0131m), ikincisi ise itiraz edilen tedbirin sonu\u00e7lar\u0131 bak\u0131m\u0131ndan \u00f6zel hayata dokunan bir mesele olup olmad\u0131\u011f\u0131 (sonuca dayal\u0131 yakla\u015f\u0131m) (Denisov\/Ukrayna [BD], B. No: 2011\/76639, 25\/9\/2018, \u00a7\u00a7 100-103).<\/p>\n<p>28. A\u0130HM, ki\u015finin meslek hayat\u0131n\u0131 etkileyen bir tedbir i\u00e7in \u00f6ne s\u00fcr\u00fclen gerek\u00e7elerin ki\u015filerin \u00f6zel hayat\u0131na ili\u015fkin olmad\u0131\u011f\u0131 ancak s\u00f6z konusu tedbirin ki\u015finin \u00f6zel hayat\u0131na y\u00f6nelik ciddi olumsuz etkilerinin bulundu\u011fu veya bulunma ihtimali oldu\u011fu durumlar\u0131n konu edildi\u011fi ba\u015fvurular\u0131n sonuca dayal\u0131 yakla\u015f\u0131m \u00e7er\u00e7evesinde S\u00f6zle\u015fme&#8217;nin 8. maddesinin kapsam\u0131na girebilece\u011fini ifade etmi\u015ftir. Bu ba\u011flamda s\u00f6z konusu olumsuz etkilere ili\u015fkin de\u011ferlendirmede A\u0130HM, ki\u015finin yak\u0131n \u00e7evresi \u00fczerinde olan, \u00f6zellikle de maddi bak\u0131mdan ortaya \u00e7\u0131kan sonu\u00e7lar\u0131, di\u011ferleri ile ili\u015fki kurma ve geli\u015ftirme olanaklar\u0131 ile itibar\u0131 \u00fczerindeki olumsuzluklar\u0131 dikkate almaktad\u0131r (Denisov\/Ukrayna, \u00a7 107).<\/p>\n<p>29. A\u0130HM, sonuca dayal\u0131 yakla\u015f\u0131m uyar\u0131nca inceleme yap\u0131labilmesi i\u00e7in s\u00f6z konusu meslekle ilgili tasarrufun \u00f6zel hayat \u00fczerinde do\u011furdu\u011fu etkilerin belirli \u00f6nem ve ciddiyette olmas\u0131 \u015fart\u0131n\u0131 aramakta ve asgari a\u011f\u0131rl\u0131k seviyesine ula\u015fm\u0131\u015f olmas\u0131 gerekti\u011fini vurgulamaktad\u0131r. Bu kapsamda ba\u015fvurucunun s\u00f6z konusu tedbir \u00f6ncesi ve sonras\u0131ndaki ya\u015fam\u0131 k\u0131yaslanarak maruz kald\u0131\u011f\u0131 olumsuz etki de\u011ferlendirilmektedir. Ayr\u0131ca sonu\u00e7lar\u0131n ciddiyetinin belirlenmesinde ba\u015fvurucunun iddia etti\u011fi \u00f6znel alg\u0131lar\u0131n somut ba\u015fvuruda mevcut nesnel ko\u015fullarla birlikte de\u011ferlendirilmesi gerekmektedir. Bunun yan\u0131 s\u0131ra yap\u0131lacak inceleme iddia edilen tedbirin hem maddi hem de manevi etkilerini kapsamal\u0131d\u0131r. A\u0130HM, ba\u015fvurucular\u0131n \u015fik\u00e2yet edilen tasarrufun \u00f6zel hayatlar\u0131 \u00fczerindeki olumsuz sonu\u00e7lar\u0131n\u0131 somut verilere dayal\u0131 olarak uygun \u015fekilde ispatlamakla y\u00fck\u00fcml\u00fc olduklar\u0131n\u0131 ifade etmektedir. Ayr\u0131ca ba\u015fvurucular s\u00f6z konusu \u015fik\u00e2yetlerini ulusal merciler \u00f6n\u00fcnde de uygun \u015fekilde dile getirmi\u015f olmal\u0131d\u0131r (Denisov\/Ukrayna, \u00a7\u00a7 113-117).<\/p>\n<p>30. A\u0130HM, soru\u015fturman\u0131n ilerlemesini engelleyebilecek \u00f6zel durumlar\u0131n s\u00f6z konusu olabilece\u011fini kabul etmekle birlikte etkili bir soru\u015fturma y\u00fcr\u00fct\u00fclebilmesi i\u00e7in devletlerin ivedilik ve makul \u00f6zen kriterlerine uygun \u015fekilde hareket etmelerinin z\u0131mni bir gereklilik oldu\u011funu belirtmektedir (Al- Skeini ve Di\u011ferleri\/Birle\u015fik Krall\u0131k, B. A\u0130HM, Akta\u015f\/T\u00fcrkiye (B.No: 24351\/94, 24\/4\/2003) karar\u0131nda devletin soru\u015fturman\u0131n etkili y\u00fcr\u00fct\u00fclmesi noktas\u0131nda sonu\u00e7 de\u011fil s\u00fcre\u00e7 y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc oldu\u011funa dikkat \u00e7ekmi\u015ftir. Halk\u0131n hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fcne olan inanc\u0131n\u0131n korunmas\u0131 i\u00e7in soru\u015fturmada g\u00f6revli kamu makamlar\u0131n\u0131n kendilerine tan\u0131nan yetkiler \u00e7er\u00e7evesinde etkin tedbirleri s\u00fcratle almalar\u0131 gereklili\u011fine i\u015faret etmi\u015ftir (Akta\u015f\/T\u00fcrkiye,\u00a7 300).<\/p>\n<p>32. A\u0130HM, A.K.\/T\u00fcrkiye (B. No: 27607\/11, 9\/9\/2018) karar\u0131nda ne kadar karma\u015f\u0131k olursa olsun bir ceza yarg\u0131lamas\u0131nda kamu makamlar\u0131n\u0131n sonuca varma konusunda neden olduklar\u0131 gecikmenin yarg\u0131laman\u0131n etkinli\u011fine ka\u00e7\u0131n\u0131lmaz olarak zarar verdi\u011fini vurgulam\u0131\u015ft\u0131r. Bu ba\u011flamda kamu makamlar\u0131n\u0131n devlete d\u00fc\u015fen pozitif y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc g\u00f6zeterek yarg\u0131lamay\u0131 y\u00fcr\u00fctmek i\u00e7in kendilerine tan\u0131nan t\u00fcm imk\u00e2nlar\u0131 en k\u0131sa s\u00fcrede kullanmalar\u0131 gerekti\u011fine i\u015faret etmi\u015ftir (A.K.\/T\u00fcrkiye, \u00a7 48).<\/p>\n<p>V. \u0130NCELEME VE GEREK\u00c7E<\/p>\n<p>33. Anayasa Mahkemesinin 4\/7\/2024 tarihinde yapm\u0131\u015f oldu\u011fu toplant\u0131da ba\u015fvuru incelenip gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>1. Ba\u015fvurucunun \u0130ddialar\u0131 ve Bakanl\u0131k G\u00f6r\u00fc\u015f\u00fc<\/p>\n<p>34. Ba\u015fvurucu; hakk\u0131nda ceza soru\u015fturmas\u0131 oldu\u011funu 2016 y\u0131l\u0131nda tesad\u00fcfen \u00f6\u011frendi\u011fini, soru\u015fturmaya ili\u015fkin k\u0131s\u0131tlama karar\u0131 nedeniyle soru\u015fturman\u0131n i\u00e7eri\u011fi konusunda bilgi sahibi olamad\u0131\u011f\u0131n\u0131, bununla birlikte k\u0131s\u0131tlama karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131na ve dosyadan belge alma iznine ili\u015fkin taleplerinin kar\u015f\u0131lanmad\u0131\u011f\u0131n\u0131 ifade etmi\u015ftir. Dayana\u011f\u0131 bulunmayan ve uzun s\u00fcren soru\u015fturma nedeniyle mesleki ve ki\u015fisel haklar\u0131n\u0131n hukuksuz ve \u00f6l\u00e7\u00fcs\u00fcz \u015fekilde s\u0131n\u0131rland\u0131r\u0131ld\u0131\u011f\u0131n\u0131 belirterek soru\u015fturman\u0131n ivedilikle sonland\u0131r\u0131lmas\u0131na ve tefrik edilmesine dair taleplerine ili\u015fkin de Ba\u015fsavc\u0131l\u0131k\u00e7a bir i\u015flem yap\u0131lmad\u0131\u011f\u0131n\u0131 vurgulam\u0131\u015ft\u0131r. Ayr\u0131ca s\u0131navda ba\u015far\u0131l\u0131 olmas\u0131na ra\u011fmen hakk\u0131nda y\u00fcr\u00fct\u00fclen ceza soru\u015fturmas\u0131 gerek\u00e7e g\u00f6sterilerek arabuluculuk siciline yaz\u0131lma talebinin reddedildi\u011fini belirtmi\u015ftir. Anayasa&#8217;n\u0131n 20. maddesinin amac\u0131n\u0131n bireyleri kamu makamlar\u0131n\u0131n keyf\u00ee m\u00fcdahalelerine kar\u015f\u0131 korumak oldu\u011funu, bu ba\u011flamda hak ve \u00f6zg\u00fcrl\u00fckleri s\u0131n\u0131rlay\u0131c\u0131 i\u015flemlerin gizli y\u00fcr\u00fct\u00fclmesi yetkisi tan\u0131nd\u0131\u011f\u0131nda bu yetkinin k\u00f6t\u00fcye kullan\u0131lmas\u0131n\u0131 engelleyecek g\u00fcvencelerin de \u00f6ng\u00f6r\u00fclmesi gerekti\u011fini iddia etmi\u015ftir. Hakk\u0131ndaki ceza soru\u015fturmas\u0131n\u0131n \u00f6zel hayat\u0131na m\u00fcdahale olu\u015fturan \u00e7o\u011funlu\u011fu gizli bir dizi i\u015flemden kaynakland\u0131\u011f\u0131n\u0131, ba\u015fka dosyalarda bilgilerin payla\u015f\u0131lmas\u0131 sonucu bu i\u015flemlerden haberdar oldu\u011funu belirtmi\u015ftir. Ba\u015fvurucu5271 say\u0131l\u0131 Kanun&#8217;un Cumhuriyet savc\u0131l\u0131\u011f\u0131n\u0131n soru\u015fturma yetkisini d\u00fczenleyen maddelerinde bu yetkinin k\u00f6t\u00fcye kullan\u0131lmas\u0131n\u0131 \u00f6nleyecek g\u00fcvencelerin yer almad\u0131\u011f\u0131n\u0131, on y\u0131ldan fazla devam eden soru\u015fturman\u0131n \u00f6zel ya\u015fam\u0131 \u00fczerinde hukuken \u00f6ng\u00f6r\u00fclemeyecek bir m\u00fcdahale olu\u015fturdu\u011funu vurgulayarak \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ihlal edildi\u011fini ileri s\u00fcrm\u00fc\u015f, soru\u015fturman\u0131n niteli\u011fi ve ifa etti\u011fi mesle\u011fe olas\u0131 etkileri nedeniyle kamuya a\u00e7\u0131k belgelerde isminin gizli tutulmas\u0131n\u0131 talep etmi\u015ftir.<\/p>\n<p>35. Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcnde, ba\u015fvurucunun Ba\u015fsavc\u0131l\u0131\u011fa sundu\u011fu 7\/9\/2020 tarihli dilek\u00e7ede soru\u015fturman\u0131n uzun s\u00fcrmesinin \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131 ihlal etti\u011fine dair bir iddian\u0131n yer almad\u0131\u011f\u0131 belirtilmi\u015ftir. Bununla birlikte ba\u015fvuru formunda da \u015fik\u00e2yetin temellendirilmedi\u011fi, soru\u015fturman\u0131n ba\u015fvurucunun \u00f6zel hayat\u0131na olan etkilerinin somut bir \u015fekilde ortaya konulmad\u0131\u011f\u0131 ifade edilmi\u015ftir. Arabuluculuk siciline yaz\u0131lma talebinin reddi karar\u0131na kar\u015f\u0131 ba\u015fvurucunun idari yarg\u0131da iptal davas\u0131 a\u00e7t\u0131\u011f\u0131na, sonucunu beklemeksizin ba\u015fvuruda bulunmas\u0131 nedeniyle ola\u011fan kanun yollar\u0131n\u0131 t\u00fcketmedi\u011fine i\u015faret edilmi\u015ftir. Ba\u015fvurucu, Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 beyanda bulunmam\u0131\u015ft\u0131r.<\/p>\n<p>2. De\u011ferlendirme<\/p>\n<p>a. Uygulanabilirlik Y\u00f6n\u00fcnden <\/p>\n<p>36. Anayasa\u2019n\u0131n &#8220;\u00d6zel hayat\u0131n gizlili\u011fi&#8221; kenar ba\u015fl\u0131kl\u0131 20. maddesinin birinci f\u0131kras\u0131n\u0131n ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>\u201cHerkes, \u00f6zel hayat\u0131na &#8230; sayg\u0131 g\u00f6sterilmesini isteme hakk\u0131na sahiptir. \u00d6zel hayat\u0131n &#8230; gizlili\u011fine dokunulamaz.&#8221;<\/p>\n<p>37. Anayasa Mahkemesi, olaylar\u0131n ba\u015fvurucu taraf\u0131ndan yap\u0131lan hukuki nitelendirmesi ile ba\u011fl\u0131 olmay\u0131p olay ve olgular\u0131n hukuki tavsifini kendisi takdir eder (Tahir Canan, B. No: 2012\/969, 18\/9\/2013, \u00a7 16).<\/p>\n<p>38. Anayasa Mahkemesi \u00f6nceki bir\u00e7ok karar\u0131nda \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ki\u015finin \u00e7evresinde bulunanlarla temas kurma hakk\u0131n\u0131 i\u00e7erdi\u011fini, \u00f6zel bir sosyal hayat s\u00fcrd\u00fcrmeyi g\u00fcvence alt\u0131na ald\u0131\u011f\u0131n\u0131 ve ki\u015filerin mesleki hayatlar\u0131n\u0131n \u00f6zel hayatlar\u0131yla s\u0131k\u0131 bir ili\u015fki i\u00e7inde oldu\u011funu s\u0131kl\u0131kla vurgulam\u0131\u015ft\u0131r. Anayasa Mahkemesi \u00f6zel hayata ili\u015fkin hususlar\u0131n ki\u015finin mesle\u011fi ile ilgili tasarruflara esas al\u0131nd\u0131\u011f\u0131 durumlarda sebebe dayal\u0131 yakla\u015f\u0131ma ve \u00f6zel hayata ili\u015fkin herhangi bir nedene dayan\u0131lmaks\u0131z\u0131n mesleki hayata y\u00f6nelen m\u00fcdahalelerin sonuca dayal\u0131 yakla\u015f\u0131m ba\u011flam\u0131nda \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda de\u011ferlendirilebilmesi i\u00e7in gerekli olan ko\u015fullar\u0131n neler oldu\u011funa ili\u015fkin detayl\u0131 de\u011ferlendirmelerde bulunmu\u015ftur. Ceza soru\u015fturmas\u0131n\u0131n\/kovu\u015fturmas\u0131n\u0131n makul s\u00fcrede sonu\u00e7land\u0131r\u0131lmamas\u0131 kural olarak \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n g\u00fcvencelerini harekete ge\u00e7iren bir olgu olarak kabul edilemez. Bununla birlikte ceza soru\u015fturmas\u0131n\u0131n makul s\u00fcratte y\u00fcr\u00fct\u00fclmemesinin ki\u015finin mesleki\/\u00f6zel hayat\u0131na y\u00f6nelik ciddi olumsuz etkilerinin olmas\u0131 h\u00e2linde \u00f6zel hayata sayg\u0131 hakk\u0131na ili\u015fkin anayasal g\u00fcvenceler harekete ge\u00e7ebilir. Di\u011fer bir ifadeyle hayat\u0131n ola\u011fan ko\u015fullar\u0131 ve somut olay\u0131n \u00f6zelli\u011fi g\u00f6zetildi\u011finde ceza soru\u015fturmas\u0131n\u0131n uzun bir s\u00fcre devam etmesinin ba\u015fvurucunun mesleki faaliyetlerinin \u00f6nemli \u00f6l\u00e7\u00fcde aksamas\u0131na ve mesleki\/ki\u015fisel ili\u015fkilerinin ve itibar\u0131n\u0131n ciddi \u015fekilde zedelenmesine yol a\u00e7acak bir boyuta ula\u015fmas\u0131 durumunda \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n g\u00fcvenceleri kapsam\u0131nda incelenebilir oldu\u011fu s\u00f6ylenebilir. Bu durumda yap\u0131lacak inceleme \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n g\u00fcvencelerini g\u00f6zeten etkili bir soru\u015fturma yap\u0131lmas\u0131 kapsam\u0131nda devletin pozitif y\u00fck\u00fcml\u00fcl\u00fcklerinin gere\u011fi gibi yerine getirilip getirilmedi\u011fine ili\u015fkin olacakt\u0131r.<\/p>\n<p>41. Somut olayda ba\u015fvurucu, ter\u00f6r \u00f6rg\u00fct\u00fcne \u00fcye olma su\u00e7undan ba\u015flat\u0131lan ceza soru\u015fturmas\u0131n\u0131n mesleki\/\u00f6zel hayat\u0131n\u0131 ve sosyal ili\u015fkilerini olumsuz etkiledi\u011fini, bu kapsamda g\u00fcvenlik soru\u015fturmas\u0131 gerektiren t\u00fcm i\u015flerde kar\u015f\u0131s\u0131na engel olarak \u00e7\u0131kt\u0131\u011f\u0131n\u0131 Ba\u015fsavc\u0131l\u0131\u011fa verdi\u011fi dilek\u00e7elerde tekrarlam\u0131\u015ft\u0131r. Bu kapsamda \u015fartlar\u0131 olu\u015fmas\u0131na ra\u011fmen ye\u015fil pasaport almak i\u00e7in ba\u015fvuramad\u0131\u011f\u0131n\u0131, arabuluculuk siciline kaydedilmedi\u011fini, takip etti\u011fi davalara soru\u015fturma bilgisi g\u00f6nderilerek mesleki itibar\u0131n\u0131n\/ili\u015fkilerinin zedelendi\u011fini belirtmi\u015ftir.<\/p>\n<p>42. \u00d6te yandan, 19\/3\/1969 tarihli ve 1136 say\u0131l\u0131 Avukatl\u0131k Kanunu&#8217;nun 1. maddesinde avukatl\u0131k kamu hizmeti ve serbest bir meslek olarak tan\u0131mlanmaktad\u0131r. Adalet sistemindeki rol\u00fc nedeniyle toplum g\u00f6z\u00fcnde \u00f6nemli bir yere ve sayg\u0131nl\u0131\u011fa sahip olan avukatl\u0131\u011f\u0131n niteli\u011fi gere\u011fi g\u00fc\u00e7l\u00fc sosyal ili\u015fkiler kurularak ifa edilen bir meslek oldu\u011fu s\u00f6ylenebilir (\u00d6zlem Kenan, B. No: 2018\/25808, 7\/4\/2021, \u00a7 42). A\u00e7\u0131klamalar kapsam\u0131nda somut olay de\u011ferlendirildi\u011finde avukatl\u0131k mesle\u011fini ifa eden ba\u015fvurucunun ter\u00f6r \u00f6rg\u00fct\u00fcyle ilgili bir soru\u015fturmada uzun bir s\u00fcre \u015f\u00fcpheli olarak yer almas\u0131n\u0131n \u00f6rg\u00fctle irtibatl\u0131 ve iltisakl\u0131 oldu\u011fu izlenimi olu\u015fturaca\u011f\u0131, bu durumun da meslek hayat\u0131n\u0131, \u00fc\u00e7\u00fcnc\u00fc ki\u015filerle ili\u015fki kurabilme ve geli\u015ftirebilme imk\u00e2n\u0131n\u0131 olumsuz etkileyece\u011fi, sosyal ve mesleki itibar\u0131n\u0131 koruyabilmesi a\u00e7\u0131s\u0131ndan ciddi sonu\u00e7lara yol a\u00e7aca\u011f\u0131 \u00f6ng\u00f6r\u00fclebilir bir durumdur.<\/p>\n<p>43. Bununla birlikte somut etkilerini de ortaya koyarak \u015fik\u00e2yetlerini yarg\u0131 makamlar\u0131 \u00f6n\u00fcnde dile getirdi\u011fi g\u00f6r\u00fclen ba\u015fvurucu, an\u0131lan dilek\u00e7eleri ba\u015fvuru formuyla ibraz etmi\u015f ve soru\u015fturman\u0131n uzun s\u00fcrmesinin \u00f6zel hayat\u0131na hukuken \u00f6ng\u00f6r\u00fclemeyecek bir m\u00fcdahale oldu\u011fundan yak\u0131narak soru\u015fturman\u0131n arabuluculuk siciline kaydedilmesine engel te\u015fkil etti\u011fini belirtmi\u015ftir. Arabuluculuk siciline kaydolman\u0131n \u015fartlar\u0131ndan birinin de ter\u00f6r \u00f6rg\u00fct\u00fcyle irtibatl\u0131 ve iltisakl\u0131 olmamak oldu\u011fu (bkz. \u00a7\u00a7 22, 23 ) ve ba\u015fvurucu hakk\u0131ndaki soru\u015fturman\u0131n bu kapsamda g\u00f6r\u00fclmesi nedeniyle sicile kayd\u0131n\u0131n yap\u0131lmad\u0131\u011f\u0131 da sabittir. A\u00e7\u0131klanan gerek\u00e7elerle ter\u00f6r \u00f6rg\u00fct\u00fcne \u00fcye olma su\u00e7undan ba\u015flat\u0131lan soru\u015fturman\u0131n uzun s\u00fcre sonu\u00e7land\u0131r\u0131lmamas\u0131n\u0131n ba\u015fvurucunun mesleki ve \u00f6zel hayat\u0131 \u00fczerinde ciddi olumsuz etkileri bulundu\u011fu anla\u015f\u0131lmakla sonuca dayal\u0131 yakla\u015f\u0131m kapsam\u0131nda ba\u015fvurunun \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda incelenebilir nitelikte oldu\u011fu kanaatine var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>b. Kabul Edilebilirlik Y\u00f6n\u00fcnden<\/p>\n<p>44. A\u00e7\u0131k\u00e7a dayanaktan yoksun olmad\u0131\u011f\u0131 ve kabul edilemezli\u011fine karar verilmesini gerektirecek ba\u015fka bir neden de bulunmad\u0131\u011f\u0131 anla\u015f\u0131lan \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ihlal edildi\u011fine ili\u015fkin iddian\u0131n kabul edilebilir oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>Kadir \u00d6ZKAYA, \u0130rfan F\u0130DAN, Y\u0131lmaz AK\u00c7\u0130L ve \u00d6mer \u00c7INAR bu g\u00f6r\u00fc\u015fe kat\u0131lmam\u0131\u015ft\u0131r.<\/p>\n<p>c. Pozitif y\u00fck\u00fcml\u00fcl\u00fckler de \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n korunmas\u0131n\u0131 ve bireyler aras\u0131 ili\u015fkiler alan\u0131nda olsa da \u00f6zel hayata sayg\u0131n\u0131n g\u00fcvencelerini sa\u011flamaya y\u00f6nelik olaya \u00f6zg\u00fc tedbirlerin al\u0131nmas\u0131n\u0131 zorunlu k\u0131lar (benzer y\u00f6ndeki de\u011ferlendirmeler i\u00e7in bkz. Bireysel ba\u015fvuru kapsam\u0131nda yap\u0131lacak de\u011ferlendirmede yeterli usule ili\u015fkin g\u00fcvenceleri sunan etkili bir ceza soru\u015fturmas\u0131 y\u00fcr\u00fct\u00fcl\u00fcp y\u00fcr\u00fct\u00fclmedi\u011fi incelenirken soru\u015fturman\u0131n derh\u00e2l ba\u015flamas\u0131, ba\u011f\u0131ms\u0131z bir bi\u00e7imde ve kamu denetimine tabi olarak \u00f6zenle ve s\u00fcratle y\u00fcr\u00fct\u00fclmesi ile etkili olmas\u0131 unsurlar\u0131 ara\u015ft\u0131r\u0131lmaktad\u0131r (Mehmet Arif K\u0131l\u0131n\u00e7, B. No: 2013\/1656, 16\/7\/2014, \u00a7 29). Soru\u015fturman\u0131n etkili yap\u0131ld\u0131\u011f\u0131ndan bahsedilebilmesi i\u00e7in \u00f6ncelikle soru\u015fturmaya derh\u00e2l ba\u015flanmal\u0131 ve h\u0131zl\u0131 hareket edilerek delillerin kaybolmas\u0131 \u00f6nlenmelidir. Ancak soru\u015fturmaya derh\u00e2l ba\u015flanmas\u0131, etkili soru\u015fturma yapma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn yerine getirildi\u011finin s\u00f6ylenebilmesi i\u00e7in tek ba\u015f\u0131na yeterli de\u011fildir. Etkili soru\u015fturma yapma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc, iddialar do\u011frultusunda lehe ve aleyhe delillerin toplanmas\u0131n\u0131 ve ula\u015f\u0131lan sonucun temel haklar\u0131n \u00f6ng\u00f6rd\u00fc\u011f\u00fc g\u00fcvenceleri sa\u011flayacak \u015fekilde ilgili ve yeterli gerek\u00e7elerle a\u00e7\u0131klanmas\u0131n\u0131 gerekli k\u0131lar (Meral Talay B. No: 2018\/8050, 7\/10\/2021, \u00a7 37).<\/p>\n<p>47. Bu kapsamda ki\u015filerin hayatlar\u0131n\u0131 su\u00e7 isnad\u0131 alt\u0131nda idame ettirdi\u011fi s\u00fcre\u00e7ler olarak ceza soru\u015fturmalar\u0131 ivedilikle sonu\u00e7land\u0131r\u0131lmal\u0131d\u0131r. Zira, bu s\u00fcre\u00e7te ki\u015filer masumiyet karinesinin korumas\u0131 alt\u0131ndad\u0131r ve an\u0131lan s\u00fcre\u00e7 ne kadar uzun s\u00fcrerse \u015feref ve itibar\u0131n\u0131n zedelenme riski o kadar artmaktad\u0131r.<\/p>\n<p>48. Bu \u00e7er\u00e7evede ilgili idari ve yarg\u0131sal i\u015flemlerin s\u00fcratle yerine getirilmesi kadar soru\u015fturma s\u00fcrecinde ilgili ki\u015filerin g\u00f6r\u00fc\u015flerini tam olarak sunabildikleri adil bir s\u00fcrecin sa\u011flanmas\u0131 da \u00f6nemlidir. Anayasa\u2019n\u0131n 20. maddesi kapsam\u0131nda \u00f6zel hayata sayg\u0131 hakk\u0131na ili\u015fkin pozitif y\u00fck\u00fcml\u00fcl\u00fck de\u011ferlendirmesinin i\u00e7eri\u011fine ilgili yarg\u0131sal s\u00fcre\u00e7lerin ivedilikle taraflar\u0131n kat\u0131l\u0131m\u0131na a\u00e7\u0131k ve adil yarg\u0131lanma hakk\u0131n\u0131n usule ili\u015fkin gereklerine riayetle y\u00fcr\u00fct\u00fclmesi \u015feklindeki usule ili\u015fkin y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn de eklenmesi gerekmektedir (benzer y\u00f6nde de\u011ferlendirmeler i\u00e7in bkz. Marcus Frank Cerny [GK], B. No: 2013\/5126, 2\/7\/2015\u00a7 81; Bahad\u0131r \u00dcney ve di\u011ferleri [GK], B. No: 2018\/4453, 10\/3\/2022, \u00a7 53).<\/p>\n<p>ii. \u0130lkelerin Olaya Uygulanmas\u0131<\/p>\n<p>49. Ba\u015fvurucunun ter\u00f6r \u00f6rg\u00fct\u00fcne \u00fcye olma su\u00e7undan ba\u015flat\u0131lan ceza soru\u015fturmas\u0131n\u0131n yakla\u015f\u0131k 10 y\u0131l sonu\u00e7land\u0131r\u0131lmamas\u0131 nedeniyle mesleki ve ki\u015fisel ili\u015fkilerinin olumsuz etkilenmesinden yak\u0131nd\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Bu kapsamda \u00f6zellikle arabuluculuk siciline kay\u0131t talebinin devam eden ceza soru\u015fturmas\u0131 gerek\u00e7e g\u00f6sterilerek reddedilmesini, g\u00fcvenlik soru\u015fturmas\u0131 gerektiren alanlarda derdest soru\u015fturman\u0131n haklar\u0131n\u0131 kullanmakta engel te\u015fkil etmesini, takip etti\u011fi davalara soru\u015fturma bilgisi g\u00f6nderilerek alenile\u015ftirilmesini ceza soru\u015fturmas\u0131n\u0131n \u00f6zel hayat\u0131na somut etkisi olarak vurgulad\u0131\u011f\u0131 g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Bu h\u00e2lde bireysel ba\u015fvuru kapsam\u0131nda yap\u0131lacak de\u011ferlendirmede dikkate al\u0131nacak husus; yeterli usule ili\u015fkin g\u00fcvencelerin sunuldu\u011fu, temel haklar\u0131n i\u00e7erdi\u011fi g\u00fcvenceleri koruyan \u00f6zenli, s\u00fcratli bir ceza soru\u015fturmas\u0131n\u0131n yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131na ili\u015fkin olacakt\u0131r (benzer y\u00f6nde bkz Erol Kumcu, B. No: 2015\/18988, 9\/5\/2019, \u00a7 38; H.\u00d6., B. No: 2019\/20473, 3\/2\/2022, \u00a7 45).<\/p>\n<p>50. 5271 say\u0131l\u0131 Kanun&#8217;un ilgili maddeleri g\u00f6zetildi\u011finde Cumhuriyet savc\u0131s\u0131n\u0131n ger\u00e7e\u011fi ortaya \u00e7\u0131karmak i\u00e7in i\u015fin gere\u011fini derh\u00e2l yapmas\u0131, \u015f\u00fcphelinin haklar\u0131n\u0131 da korumas\u0131 gerekir. An\u0131lan mevzuatta ceza soru\u015fturmas\u0131n\u0131n ne kadar s\u00fcrede tamamlanaca\u011f\u0131na dair a\u00e7\u0131k d\u00fczenleme yok ise de savc\u0131n\u0131n h\u0131zl\u0131 hareket etmesini sa\u011flamaya y\u00f6nelik ki\u015filere ve kamu kurumlar\u0131na da y\u00fck\u00fcml\u00fcl\u00fckler y\u00fcklenmi\u015ftir (bkz. \u00a7 20). Dolay\u0131s\u0131yla kanun koyucunun soru\u015fturma hukukunda izledi\u011fi temel ilkelerden birinin ivedilik oldu\u011fu ve konuya ili\u015fkin olarak kurdu\u011fu hukuki yap\u0131n\u0131n da s\u00f6z konusu ilkeyi hayata ge\u00e7irmeye elveri\u015fli oldu\u011fu g\u00f6r\u00fclmektedir. Bu ba\u011flamda kanun koyucunun somut olay\u0131n \u00f6zelli\u011fine g\u00f6re soru\u015fturman\u0131n en k\u0131sa s\u00fcrede tamamlanmas\u0131n\u0131 ama\u00e7lad\u0131\u011f\u0131 s\u00f6ylenebilir. Dolay\u0131s\u0131yla yukar\u0131da aktar\u0131lan ilkeler de g\u00f6zetildi\u011finde \u00f6zel hayata sayg\u0131 hakk\u0131 ba\u011flam\u0131nda etkili bir soru\u015fturmadan bahsedilebilmesi i\u00e7in de soru\u015fturman\u0131n makul bir s\u00fcrede sonu\u00e7land\u0131r\u0131lmas\u0131 ve usule ili\u015fkin yeterli g\u00fcvencelerin sunulmas\u0131 gerekti\u011fi vurgulanmal\u0131d\u0131r. Ayr\u0131ca somut olaya g\u00f6re soru\u015fturman\u0131n en k\u0131sa s\u00fcrede sonland\u0131r\u0131larak \u015f\u00fcpheli s\u0131fat\u0131n\u0131n neticelendirilmesi ve ki\u015filerin ceza soru\u015fturmas\u0131 bask\u0131s\u0131ndan kurtulmas\u0131n\u0131n sa\u011flanmas\u0131 devletin pozitif y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn de gere\u011fidir. Zira s\u00fcrenin belirsiz bir s\u00fcre uzamas\u0131 ki\u015filerin hak ve \u00f6zg\u00fcrl\u00fcklerine olan m\u00fcdahaleyi a\u011f\u0131rla\u015ft\u0131raca\u011f\u0131 gibi hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fcne olan inanc\u0131n zay\u0131flamas\u0131na, soru\u015fturmadan beklenen kamusal yarar ile ki\u015filerin menfaatleri aras\u0131nda g\u00f6zetilmesi gereken dengenin de ki\u015filer aleyhine bozulmas\u0131na sebep olabilir.<\/p>\n<p>51. Ba\u015fvuru konusu olayda serbest avukat olarak \u00e7al\u0131\u015fan ba\u015fvurucu hakk\u0131nda 2012 y\u0131l\u0131nda ter\u00f6r \u00f6rg\u00fct\u00fcne \u00fcye olma su\u00e7undan ceza soru\u015fturmas\u0131 ba\u015flat\u0131lm\u0131\u015ft\u0131r. Soru\u015fturman\u0131n \u00e7ok say\u0131da \u015f\u00fcphelisi olan kapsaml\u0131 bir soru\u015fturma oldu\u011fu kabul edilse bile nihayetinde ba\u015fvurucu y\u00f6n\u00fcnden tefrik edilebilir nitelikte oldu\u011fu ancak ba\u015fvurucunun bu y\u00f6ndeki taleplerinin 2021 y\u0131l\u0131na kadar kar\u015f\u0131lanmad\u0131\u011f\u0131 g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Ayr\u0131ca ba\u015fvurucu, hakk\u0131nda y\u00fcr\u00fct\u00fclen g\u00fcvenlik soru\u015fturmalar\u0131n\u0131n bu ceza soru\u015fturmas\u0131 gerek\u00e7e g\u00f6sterilerek olumsuz sonu\u00e7land\u0131r\u0131ld\u0131\u011f\u0131n\u0131, meslek hayat\u0131n\u0131n, mesleki ili\u015fkilerinin\/itibar\u0131n\u0131n ve ki\u015fisel ya\u015fant\u0131s\u0131n\u0131n olumsuz etkilendi\u011fini vurgulayarak soru\u015fturman\u0131n ivedilikle sonland\u0131r\u0131lmas\u0131n\u0131 bir\u00e7ok kez Ba\u015fsavc\u0131l\u0131ktan talep etmesine ra\u011fmen Ba\u015fsavc\u0131l\u0131k hareketsiz kalm\u0131\u015ft\u0131r. Ba\u015fvurucunun ceza soru\u015fturmas\u0131n\u0131n \u00f6zellikle \u00f6zel hayat\u0131n\u0131 ve mesleki hayat\u0131n\u0131 nas\u0131l ve neden etkiledi\u011fini (ye\u015fil pasaport almak i\u00e7in ba\u015fvuramamas\u0131, takip etti\u011fi dosyalara bildirim yap\u0131lmas\u0131, arabulucuk siciline kaydedilmemesi gibi) ortaya koymas\u0131na ra\u011fmen ceza soru\u015fturmas\u0131nda uzun s\u00fcre bir ilerleme kaydedilmedi\u011fi g\u00f6zlemlenmi\u015ftir.<\/p>\n<p>52. Son olarak s\u0131nav\u0131 kazanmas\u0131na ra\u011fmen ba\u015fvurucu, 6325 say\u0131l\u0131 Kanun&#8217;da yer alan ter\u00f6r \u00f6rg\u00fct\u00fcyle iltisakl\u0131 veya irtibatl\u0131 olmama \u015fart\u0131n\u0131, hakk\u0131nda devam eden ceza soru\u015fturmas\u0131 nedeniyle sa\u011flayamad\u0131\u011f\u0131 gerek\u00e7esiyle arabuluculuk siciline kaydedilmemi\u015f bu i\u015flemle mesleki hayat\u0131na dair s\u0131n\u0131rlama daha da somutla\u015fm\u0131\u015ft\u0131r. \u00dcstelik k\u0131s\u0131tlama karar\u0131 nedeniyle ba\u015fvurucunun hakk\u0131ndaki soru\u015fturman\u0131n i\u00e7eri\u011fini uzun s\u00fcre \u00f6\u011frenemedi\u011fi, bu y\u00f6ndeki taleplerinin de kar\u015f\u0131lanmad\u0131\u011f\u0131 vurgulanmal\u0131d\u0131r. Soru\u015fturma s\u00fcreci g\u00f6zetildi\u011finde ba\u015fvurucunun \u015fik\u00e2yetini somut dayanaklarla a\u00e7\u0131klayarak adli makamlar \u00f6n\u00fcnde de dile getirdi\u011fi ancak Ba\u015fsavc\u0131l\u0131k taraf\u0131ndan somut olay\u0131n ko\u015fullar\u0131na uygun \u00e7\u00f6z\u00fcmler \u00fcretilmedi\u011fi, makul s\u00fcrede sonu\u00e7land\u0131r\u0131lmayan soru\u015fturman\u0131n ba\u015fvurucunun \u00f6zel hayat\u0131na etkilerin giderek a\u011f\u0131rla\u015ft\u0131\u011f\u0131 g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Bu a\u00e7\u0131klamalar kapsam\u0131nda soru\u015fturman\u0131n ivedilikle ve \u00f6zenli \u015fekilde y\u00fcr\u00fct\u00fcld\u00fc\u011f\u00fc, ba\u015fvurucunun usuli g\u00fcvencelerden yeteri kadar yararland\u0131r\u0131ld\u0131\u011f\u0131, dolay\u0131s\u0131yla devletin pozitif y\u00fck\u00fcml\u00fcl\u00fcklerinin yerine getirildi\u011fi s\u00f6ylenemez.<\/p>\n<p>53. A\u00e7\u0131klanan gerek\u00e7elerle ba\u015fvurucunun Anayasa&#8217;n\u0131n 20. maddesinde g\u00fcvence alt\u0131na al\u0131nan \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ihlal edildi\u011fine karar verilmesi gerekir.<\/p>\n<p>Kadir \u00d6ZKAYA, \u0130rfan F\u0130DAN, Y\u0131lmaz AK\u00c7\u0130L ve \u00d6mer \u00c7INAR bu g\u00f6r\u00fc\u015fe kat\u0131lmam\u0131\u015ft\u0131r.<\/p>\n<p>VI. G\u0130DER\u0130M<\/p>\n<p>54. Ba\u015fvurucu ihlalin tespiti ile 20.000 TL manevi tazminat talebinde bulunmu\u015ftur.<\/p>\n<p>55. \u0130hlalin niteli\u011fi dikkate al\u0131narak talebiyle s\u0131n\u0131rl\u0131 olarak ba\u015fvurucuya 20.000 TL manevi tazminat \u00f6denmesi gerekti\u011fi sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>VII. H\u00dcK\u00dcM<\/p>\n<p>A\u00e7\u0131klanan gerek\u00e7elerle;<\/p>\n<p>A. Kamuya a\u00e7\u0131k belgelerde ba\u015fvurucunun kimli\u011finin gizli tutulmas\u0131 talebinin KABUL\u00dcNE,<\/p>\n<p>B. \u00d6zel hayata sayg\u0131 hakk\u0131n\u0131n ihlal edildi\u011fine ili\u015fkin iddian\u0131n KABUL ED\u0130LEB\u0130L\u0130R OLDU\u011eUNA Kadir \u00d6ZKAYA, \u0130rfan F\u0130DAN, Y\u0131lmaz AK\u00c7\u0130L ve \u00d6mer \u00c7INAR&#8217;\u0131n kar\u015f\u0131oylar\u0131 ve OY\u00c7OKLU\u011eUYLA,<\/p>\n<p>C. Karar\u0131n bir \u00f6rne\u011finin bilgi i\u00e7in \u0130stanbul Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131na (Sor. No: 2014\/38195) ve Adalet Bakanl\u0131\u011f\u0131na G\u00d6NDER\u0130LMES\u0130NE 4\/7\/2024 tarihindekarar verildi.<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>KAR\u015eIOY<\/p>\n<p>1. Hakk\u0131nda y\u00fcr\u00fct\u00fclen ceza soru\u015fturmas\u0131n\u0131n uzun s\u00fcrmesinin avukatl\u0131k mesle\u011fini icra etmesini olumsuz etkiledi\u011fi, bu duruma ba\u011fl\u0131 olarak \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ihlal edildi\u011fi iddias\u0131 ile yap\u0131lan ba\u015fvuruda, Mahkememiz \u00c7o\u011funlu\u011funca, ba\u015fvurunun kabul edilebilir oldu\u011fu sonucuna var\u0131lm\u0131\u015f ve i\u015fin esas\u0131na ge\u00e7ilerek ba\u015fvurucunun Anayasa&#8217;n\u0131n 20. maddesinde g\u00fcvence alt\u0131na al\u0131nan \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ihlal edildi\u011fine karar verilmi\u015ftir.<\/p>\n<p>2. A\u015fa\u011f\u0131da a\u00e7\u0131klanan gerek\u00e7elerle Say\u0131n \u00c7o\u011funlu\u011fun kabul edilebilirlik ve esas y\u00f6n\u00fcnden vard\u0131\u011f\u0131 sonu\u00e7lara kat\u0131lm\u0131yoruz.<\/p>\n<p>3. Say\u0131n \u00c7o\u011funluk, ba\u015fvurucu hakk\u0131nda y\u00fcr\u00fct\u00fclen soru\u015fturman\u0131n ivedilikle ve \u00f6zenli \u015fekilde y\u00fcr\u00fct\u00fclmedi\u011fi, ba\u015fvurucunun usul g\u00fcvencelerinden yeteri kadar yararland\u0131r\u0131lmad\u0131\u011f\u0131, dolay\u0131s\u0131yla somut olayda devletin pozitif y\u00fck\u00fcml\u00fcl\u00fcklerinin yerine getirilmedi\u011fi gerek\u00e7esiyle ihlal sonucuna ula\u015fm\u0131\u015ft\u0131r.<\/p>\n<p>4. Bu ba\u011flamda, karar\u0131n sonucuna ili\u015fkin de\u011ferlendirmelere ge\u00e7meden \u00f6nce, \u00e7o\u011funlu\u011fun yukar\u0131da belirtilen \u015fekilde sonuca varmas\u0131na etki etti\u011fini d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fcm\u00fcz karardaki usule ili\u015fkin baz\u0131 sorunlara de\u011finilmesi uygun olacakt\u0131r.<\/p>\n<p>5. \u00d6ncelikle belirtmek gerekir ki kararda A\u0130HM kararlar\u0131na atfen yer verilen ilkeler, a\u015fa\u011f\u0131da ayr\u0131nt\u0131l\u0131 olarak a\u00e7\u0131klanaca\u011f\u0131 \u00fczere somut olayda tam olarak uygulanmam\u0131\u015f, isabetli olmad\u0131\u011f\u0131n\u0131 d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fcm\u00fcz de\u011ferlendirmeler \u00fczerinden sonuca var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>6. \u00d6rne\u011fin, karar\u0131n &#8220;\u0130lgili Hukuk&#8221; b\u00f6l\u00fcm\u00fcnde bir A\u0130HM karar\u0131na at\u0131fla &#8220;25. Avrupa \u0130nsan Haklar\u0131 Mahkemesi (A\u0130HM) i\u00e7tihatlar\u0131nda \u00f6zel hayat\u0131n eksiksiz bir tan\u0131m\u0131 bulunmayan geni\u015f bir kavram oldu\u011funu belirtmektedir. \u00d6zel hayata sayg\u0131 hakk\u0131 alt kategorisinde ge\u00e7en \u00f6zel hayat kavram\u0131n\u0131 A\u0130HM olduk\u00e7a geni\u015f yorumlamakta ve bu kavrama ili\u015fkin t\u00fcketici bir tan\u0131m yap\u0131lmaktan \u00f6zellikle ka\u00e7\u0131nmaktad\u0131r (Koch\/Almanya, B. No: 497\/09, 19\/7\/2012, \u00a7 51).&#8221; ifadelerine yer verilmi\u015ftir.<\/p>\n<p>7. At\u0131f yap\u0131lan A\u0130HM karar\u0131n\u0131n ilgili paragraf\u0131nda, kararda yer verilen birinci c\u00fcmle yer almakla birlikte ikinci c\u00fcmlede belirtilen &#8220;\u00f6zel hayat kavram\u0131n\u0131 A\u0130HM olduk\u00e7a geni\u015f yorumlamakta&#8221; de\u011ferlendirmesini ortaya koyacak herhangi bir veri bulunmamaktad\u0131r. Hal b\u00f6yle olunca, birinci c\u00fcmlede belirtilen \u015fekilde &#8220;\u00f6zel hayat\u0131n eksiksiz bir tan\u0131m\u0131 bulunmayan geni\u015f bir kavram&#8221; olmas\u0131 ba\u015fka bir \u015feydir, ikinci c\u00fcmlede belirtilen \u015fekilde bu kavram\u0131 A\u0130HM&#8217;in &#8220;olduk\u00e7a geni\u015f yorumlamakta&#8221; olmas\u0131 ba\u015fka bir \u015feydir. Bir hakk\u0131n alan\u0131n\u0131n geni\u015f olmas\u0131, yani kapsam\u0131na \u00e7ok fazla konunun girmesi ile onun mahkemelerce olduk\u00e7a geni\u015f yorumlanmas\u0131 farkl\u0131d\u0131r. Alan\u0131 geni\u015f olmayan kavramlar da olduk\u00e7a geni\u015f yorumlanabilir.<\/p>\n<p>8. \u00d6te yandan karar\u0131n &#8220;\u0130lgili Hukuk&#8221; b\u00f6l\u00fcm\u00fcnde, ba\u015fka A\u0130HM kararlar\u0131na at\u0131fla &#8220;26. A\u0130HM, kural olarak ilgili ki\u015finin mesleki ya\u015fant\u0131s\u0131na getirilen bir k\u0131s\u0131tlamay\u0131 S\u00f6zle\u015fme&#8217;nin 8. maddesinin kapsam\u0131 i\u00e7inde kabul etmektedir (Sodan\/T\u00fcrkiye, B. No: 18650\/05, 2\/2\/2016, \u00a7 37). A\u0130HM \u00f6ncelikle mesleki hayat\u0131n ki\u015fili\u011fin geli\u015ftirilmesi \u00fczerindeki etkisini tart\u0131\u015fm\u0131\u015f, mesleki hayata getirilen s\u0131n\u0131rlamalar\u0131n bireyin yak\u0131n \u00e7evresiyle ili\u015fkilerini geli\u015ftirmesi ve sosyal kimli\u011fini \u015fekillendirmesi \u00fczerinde etki do\u011furaca\u011f\u0131n\u0131 belirtmi\u015f ve bu ba\u011flamdaki m\u00fcdahalelerin 8. maddenin kapsam\u0131na girebilece\u011fini de\u011ferlendirmi\u015ftir (Fern\u00e1ndez Mart\u00ednez\/\u0130spanya [BD], B. No: 56030\/07, 12\/6\/2014, \u00a7 109).&#8221; denilmi\u015ftir.<\/p>\n<p>9. Paragrafta at\u0131f yap\u0131lan birinci karar\u0131n ilgili paragraf\u0131nda B\u00fcy\u00fck Daire karar\u0131 olan ikinci karara at\u0131f yap\u0131lm\u0131\u015ft\u0131r. An\u0131lan kararlar\u0131n ikisinde de A\u0130HM mesleki ya\u015fant\u0131ya ili\u015fkin k\u0131s\u0131tlamalar\u0131 kural olarak 8. madde kapsam\u0131nda g\u00f6rd\u00fc\u011f\u00fcn\u00fc s\u00f6ylememektedir. Aksine, A\u0130HM, ilk olarak S\u00f6zle\u015fme&#8217;nin \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131 g\u00fcvence alt\u0131na alan8. maddesinden genel bir hakk\u0131n \u00e7\u0131kar\u0131lamayaca\u011f\u0131n\u0131 belirtmekte, sonras\u0131nda ise \u00f6zel ya\u015fam\u0131n ki\u015finin ya\u015fam\u0131n\u0131n &#8220;i\u00e7 \u00e7ember&#8221;inden ibaret olmad\u0131\u011f\u0131n\u0131, mesleki ya\u015fant\u0131n\u0131n da \u00f6zel ya\u015fam kapsam\u0131na girebilece\u011fini a\u00e7\u0131klamakta, -kararda yer verilmeyen- Fern\u00e1ndez Mart\u00ednez\/\u0130spanya karar\u0131n\u0131n 110. paragraf\u0131nda ise &#8220;Mahkeme&#8217;nin i\u00e7tihad\u0131na g\u00f6re, \u2018\u00f6zel hayat\u2019 kavram\u0131n\u0131n mesleki faaliyetleri d\u0131\u015far\u0131da b\u0131rakacak \u015fekilde anla\u015f\u0131lmas\u0131 i\u00e7in ilkesel bir neden bulunmamaktad\u0131r.&#8221; demektedir.<\/p>\n<p>10. Dolay\u0131s\u0131yla, A\u0130HM&#8217;in i\u00e7tihad\u0131, \u00e7o\u011funluk g\u00f6r\u00fc\u015f\u00fcnde belirtildi\u011finin aksine, mesleki hayat\u0131n kural olarak \u00f6zel hayat kapsam\u0131nda oldu\u011fu de\u011fil, 8. maddede genel olarak d\u00fczenlenmemi\u015f olsa da mesleki hayat\u0131n duruma g\u00f6re \u00f6zel hayat kapsam\u0131na girebilece\u011fi, bu alan\u0131 ilkesel olarak \u00f6zel hayat alan\u0131 d\u0131\u015f\u0131nda b\u0131rakman\u0131n m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 y\u00f6n\u00fcndedir. Nitekim \u00e7o\u011funluk g\u00f6r\u00fc\u015f\u00fcne dayal\u0131 karar\u0131n devam eden paragraflar\u0131ndan da a\u00e7\u0131k\u00e7a anla\u015f\u0131laca\u011f\u0131 \u00fczere, A\u0130HM i\u00e7tihad\u0131nda mesleki faaliyetlerle ilgili bir k\u0131s\u0131tlaman\u0131n otomatik olarak \u00f6zel hayat kapsam\u0131nda de\u011ferlendirilmedi\u011fi, s\u00f6z konusu k\u0131s\u0131tlamalar\u0131n sebep ya da sonu\u00e7lar\u0131 itibar\u0131yla \u00f6zel hayat \u00fczerinde etkisi oldu\u011fu \u00f6l\u00e7\u00fcde \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda de\u011ferlendirildi\u011fi anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>11. Belirtilen durumla birlikte ayr\u0131ca \u00e7o\u011funluk g\u00f6r\u00fc\u015f\u00fcne dayal\u0131 karar\u0131n &#8220;\u0130lgili Hukuk&#8221; b\u00f6l\u00fcm\u00fcnde 30 ila 32. paragraflarda yer verilen d\u00f6rt A\u0130HM karar\u0131 ile bu kararlara atfen ortaya konulan \u201cdevletlerin pozitif y\u00fck\u00fcml\u00fcl\u00fckleri \u00e7er\u00e7evesinde etkili bir soru\u015fturma y\u00fcr\u00fct\u00fclebilmesi i\u00e7in ivedilik ve makul \u00f6zen kriterlerine uygun \u015fekilde hareket etmelerinin gerekti\u011fi\u201d bi\u00e7imindeki \u201cA\u0130HM i\u00e7tihad\u0131\u201d \u00e7\u0131kar\u0131m\u0131 da somut olay ba\u011flam\u0131nda isabetli de\u011fildir.<\/p>\n<p>12. Zira kanaatimizce burada iki temel de\u011ferlendirme hatas\u0131 bulunmaktad\u0131r. Birincisi, an\u0131lan kararlarda at\u0131f yap\u0131lan b\u00f6l\u00fcmlerin hi\u00e7biri, S\u00f6zle\u015fme&#8217;nin \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131 g\u00fcvence alt\u0131na alan 8. maddesi ile ilgili de\u011fildir. \u0130lk \u00fc\u00e7 karar S\u00f6zle\u015fme&#8217;nin 2. maddesinde g\u00fcvence alt\u0131na al\u0131nan ya\u015fam hakk\u0131na, son karar ise 3. maddesinde d\u00fczenlenen k\u00f6t\u00fc muamele yasa\u011f\u0131na ili\u015fkindir.<\/p>\n<p>13. Bu ba\u011flamda belirtmek gerekir ki A\u0130HM&#8217;in -Anayasa Mahkemesi kararlar\u0131nda da s\u0131k\u0131l\u0131kla at\u0131f yap\u0131lan- yerle\u015fik i\u00e7tihad\u0131na g\u00f6re, ya\u015fam hakk\u0131 ile k\u00f6t\u00fc muamele yasa\u011f\u0131 kapsam\u0131nda devletlerin etkili bir ceza soru\u015fturmas\u0131 y\u00fcr\u00fctme \u015feklinde di\u011fer y\u00fck\u00fcml\u00fcl\u00fcklerinden ba\u011f\u0131ms\u0131z bir y\u00fck\u00fcml\u00fcl\u00fckleri bulunmaktad\u0131r. Di\u011fer haklar ve bu arada \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda b\u00f6yle ba\u011f\u0131ms\u0131z ve otomatik olarak devreye giren etkili ceza soru\u015fturmas\u0131 y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bulunmamaktad\u0131r. Di\u011fer haklar y\u00f6n\u00fcnden sadece somut olay\u0131n \u00f6zel \u015fartlar\u0131 gerektiriyorsa bir ceza soru\u015fturmas\u0131 yapma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc devreye girebilmektedir. Dolay\u0131s\u0131yla \u00e7o\u011funluk g\u00f6r\u00fc\u015f\u00fcne dayal\u0131 kararda, at\u0131f yap\u0131lan kararlar\u0131n S\u00f6zle\u015fme&#8217;nin 2 ve 3. maddeleri kapsam\u0131nda oldu\u011fu belirtilmeden, onlara 8. madde kapsam\u0131ndaym\u0131\u015flar gibi izlenime neden olacak bi\u00e7imde yer verilmesi uygun de\u011fildir.<\/p>\n<p>14. Yukar\u0131da belirtilen ikinci de\u011ferlendirme hatas\u0131 ise \u015fudur: Somut olayda ne ya\u015fam hakk\u0131na ne de k\u00f6t\u00fc muamele yasa\u011f\u0131na ili\u015fkin bir \u015fik\u00e2yet bulunmaktad\u0131r; ne soru\u015fturman\u0131n konusu \u00f6zel hayata ili\u015fkindir, ne de ba\u015fvurucu ma\u011fdur konumundad\u0131r. Dolay\u0131s\u0131yla at\u0131f yap\u0131lan kararlar bir\u00e7ok y\u00f6nden somut olayla ilgili de\u011fildir.<\/p>\n<p>15. \u00d6te yandan ayr\u0131ca belirtmek gerekir ki her durumda etkili ceza soru\u015fturmas\u0131 yapma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc ma\u011fdurlar y\u00f6n\u00fcnden ge\u00e7erli bir g\u00fcvencedir. Bu y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn devreye girdi\u011fi durumlarda bir temel hakk\u0131n ihlal edildi\u011fi iddias\u0131 dile getirilmekte, bunu ara\u015ft\u0131rmak ve gerekti\u011finde sorumlular\u0131 cezaland\u0131rmak \u00fczere etkili bir ceza soru\u015fturmas\u0131 yap\u0131lmas\u0131 gerekmektedir. Di\u011fer bir ifadeyle bu y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn ge\u00e7erli oldu\u011fu durumlarda bile soru\u015fturman\u0131n konusu ma\u011fdura ait \u00f6zel hayata ili\u015fkin bir menfaati korumakt\u0131r. Aleyhlerine soru\u015fturma yap\u0131lan \u015f\u00fcpheliler\/san\u0131klar y\u00f6n\u00fcnden devreye giren g\u00fcvence ise adil yarg\u0131lanma hakk\u0131 g\u00fcvenceleridir. <\/p>\n<p>16. A\u015fama itibar\u0131yla, belirtilen hususlar bir b\u00fct\u00fcn olarak de\u011ferlendirildi\u011finde, \u00c7o\u011funluk g\u00f6r\u00fc\u015f\u00fcne dayal\u0131 kararda, A\u0130HM i\u00e7tihad\u0131 ba\u011flam\u0131nda \u201cA\u0130HM \u00f6zel hayat\u0131 \u00e7ok geni\u015f yorumlamaktad\u0131r, bu nedenle mesleki faaliyetler de kural olarak \u00f6zel hayat kapsam\u0131ndad\u0131r, mesleki faaliyetleri etkileyen soru\u015fturmalar\u0131n ivedi ve \u00f6zenli yap\u0131lmamas\u0131 \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ihlaline neden olur.\u201d bi\u00e7iminde isabetli olmayan bir sonuca var\u0131ld\u0131\u011f\u0131, ihlal sonucuna da s\u00f6z konusu sonu\u00e7 \u00fczerinden ula\u015f\u0131ld\u0131\u011f\u0131 g\u00f6zlemlenmektedir. Kanaatimizce var\u0131lan bu sonu\u00e7 somut ba\u015fvuru ba\u011flam\u0131nda A\u0130HM i\u00e7tihad\u0131n\u0131 yans\u0131tmamaktad\u0131r.<\/p>\n<p>17. \u00d6te yandan karar\u0131n &#8220;\u0130lgili Hukuk&#8221; b\u00f6l\u00fcm\u00fcnde A\u0130HM i\u00e7tihad\u0131na at\u0131fla ilgili olarak yap\u0131lan ve yukar\u0131da belirtilen hususlar\u0131n, karar\u0131n &#8220;De\u011ferlendirme&#8221; b\u00f6l\u00fcm\u00fcnde de bulundu\u011funu, bu duruma ba\u011fl\u0131 olarak da somut olay ile etkili soru\u015fturma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc aras\u0131nda kanaatimizce ilgili olmayan bir ba\u011flant\u0131 kuruldu\u011funu da belirtmek gerekmektedir.<\/p>\n<p>18. \u00c7o\u011funluk g\u00f6r\u00fc\u015f\u00fcne dayal\u0131 karar\u0131n 40. paragraf\u0131nda &#8220;&#8230; somut olay\u0131n \u00f6zelli\u011fi g\u00f6zetildi\u011finde ceza soru\u015fturmas\u0131n\u0131n uzun bir s\u00fcre devam etmesinin ba\u015fvurucunun mesleki faaliyetlerinin \u00f6nemli \u00f6l\u00e7\u00fcde aksamas\u0131na ve mesleki\/ki\u015fisel ili\u015fkilerinin ve itibar\u0131n\u0131n ciddi \u015fekilde zedelenmesine yol a\u00e7acak bir boyuta ula\u015fmas\u0131 durumunda \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n g\u00fcvenceleri kapsam\u0131nda incelenebilir oldu\u011fu s\u00f6ylenebilir.&#8221; denildikten hemen sonra &#8220;Bu durumda yap\u0131lacak inceleme \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n g\u00fcvencelerini g\u00f6zeten etkili bir soru\u015fturma yap\u0131lmas\u0131 kapsam\u0131nda devletin pozitif y\u00fck\u00fcml\u00fcl\u00fcklerinin gere\u011fi gibi yerine getirilip getirilmedi\u011fine ili\u015fkin olacakt\u0131r.&#8221; denilmi\u015ftir. Kanaatimizce bu ifadeler kendi i\u00e7inde ba\u011flant\u0131s\u0131z meselelerin bir araya getirildi\u011fini, bunun da isabetli olmayan bir sonucun ortaya \u00e7\u0131kmas\u0131na neden oldu\u011funu g\u00f6stermektedir.<\/p>\n<p>19. Zira ilk ifadeye g\u00f6re ceza soru\u015fmas\u0131n\u0131n uzun s\u00fcrmesi ba\u011flam\u0131nda ara\u015ft\u0131r\u0131lmas\u0131 gereken husus s\u00f6z konusu uzun s\u00fcrmenin &#8220;mesleki\/ki\u015fisel ili\u015fkilerinin ve itibar\u0131n\u0131n ciddi \u015fekilde zedelenmesine yol a\u00e7acak bir boyuta&#8221; ula\u015f\u0131p ula\u015fmad\u0131\u011f\u0131 iken; ikinci ifadeye g\u00f6re ara\u015ft\u0131r\u0131lacak husus &#8220;etkili bir soru\u015fturma yap\u0131lmas\u0131 kapsam\u0131nda devletin pozitif y\u00fck\u00fcml\u00fcl\u00fcklerinin gere\u011fi gibi yerine getirilip getirilmedi\u011fi&#8221; olacakt\u0131r. Sonraki a\u00e7\u0131klamalardan da anla\u015f\u0131laca\u011f\u0131 \u00fczere etkili soru\u015fturma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc bak\u0131m\u0131ndan sorun g\u00f6r\u00fclen husus zaten soru\u015fturman\u0131n ivedi ve \u00f6zenli y\u00fcr\u00fct\u00fclmemesi oldu\u011funa g\u00f6re, birinci c\u00fcmle \u00e7er\u00e7evesinde ivedi ve \u00f6zenli y\u00fcr\u00fct\u00fclmedi\u011fi, di\u011fer bir ifadeyle uzun s\u00fcrd\u00fc\u011f\u00fc anla\u015f\u0131lan soru\u015fturman\u0131n &#8220;mesleki\/ki\u015fisel ili\u015fkilerinin ve itibar\u0131n\u0131n ciddi \u015fekilde zedelenmesine yol a\u00e7acak bir boyuta&#8221; ula\u015f\u0131p ula\u015fmad\u0131\u011f\u0131n\u0131 incelemeye gerek kalmayacakt\u0131r.<\/p>\n<p>20. \u00d6te yandan \u00c7o\u011funluk g\u00f6r\u00fc\u015f\u00fcne dayal\u0131 karar\u0131n 46. paragraf\u0131nda, \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda etkili soru\u015fturma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc ba\u011flam\u0131nda \u00f6nce Anayasa Mahkemesinin \u00f6nceki kararlar\u0131na yer verilmi\u015f, sonras\u0131nda ise -tespit edebildi\u011fimiz kadar\u0131yla- daha \u00f6nce herhangi bir Anayasa Mahkemesi karar\u0131nda yer almam\u0131\u015f olan &#8220;47. Bu kapsamda ki\u015filerin hayatlar\u0131n\u0131 su\u00e7 isnad\u0131 alt\u0131nda idame ettirdi\u011fi s\u00fcre\u00e7ler olarak ceza soru\u015fturmalar\u0131 ivedilikle sonu\u00e7land\u0131r\u0131lmal\u0131d\u0131r. Zira, bu s\u00fcre\u00e7te ki\u015filer masumiyet karinesinin korumas\u0131 alt\u0131ndad\u0131r ve an\u0131lan s\u00fcre\u00e7 ne kadar uzun s\u00fcrerse \u015feref ve itibar\u0131n\u0131n zedelenme riski o kadar artmaktad\u0131r.&#8221; \u015feklinde bir de\u011ferlendirme yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>21. Daha \u00f6nce de de\u011finildi\u011fi gibi etkili soru\u015fturma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc ya\u015fam hakk\u0131 ve k\u00f6t\u00fc muamele yasa\u011f\u0131 d\u0131\u015f\u0131ndaki haklar y\u00f6n\u00fcnden somut olay\u0131n \u00f6zel ko\u015fullar\u0131 alt\u0131nda istisnai olarak devreye girer. B\u00f6yle istisnai bir durumda bile soru\u015fturman\u0131n konusunun o hakk\u0131 korumaya y\u00f6nelik olmas\u0131 gerekir. Bu y\u00f6n\u00fcyle etkili soru\u015fturma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc ma\u011fdurlar y\u00f6n\u00fcnden ge\u00e7erli bir g\u00fcvencedir. At\u0131f yap\u0131lan Anayasa Mahkemesinin \u00f6nceki kararlar\u0131 da bu \u00e7er\u00e7evededir. Bunlardan M. A. K. karar\u0131 su\u00e7 ma\u011fduru olan ba\u015fvurucunun &#8220;r\u0131zas\u0131 olmaks\u0131z\u0131n bir \u00fc\u00e7\u00fcnc\u00fc ki\u015fi taraf\u0131ndan \u00f6zel hayat\u0131na ili\u015fkin g\u00f6r\u00fcnt\u00fclerinin kayda al\u0131narak, elde edilen bu g\u00f6r\u00fcnt\u00fclerin \u015fantaj maksatl\u0131 kullan\u0131lmas\u0131 ve bu kapsamda yapt\u0131\u011f\u0131 su\u00e7 duyurusu \u00fczerine kovu\u015fturmaya yer olmad\u0131\u011f\u0131na karar verilmesi nedeniyle&#8221; \u00f6zel hayat\u0131n ihlal edildi\u011fi iddias\u0131na ili\u015fkindir. Ayn\u0131 paragrafta at\u0131f yap\u0131lan M. T. karar\u0131 da &#8220;cinsel taciz su\u00e7unun i\u015flendi\u011fi iddias\u0131yla Cumhuriyet ba\u015fsavc\u0131l\u0131\u011f\u0131na yap\u0131lan \u015fik\u00e2yet \u00fczerine ba\u015flat\u0131lan soru\u015fturmada kovu\u015fturmaya yer olmad\u0131\u011f\u0131na karar verilmesi nedeniyle&#8221; ki\u015finin maddi ve manevi varl\u0131\u011f\u0131n\u0131 koruma hakk\u0131n\u0131n ihlal edildi\u011fi iddias\u0131na ili\u015fkin olup ba\u015fvurucu su\u00e7 ma\u011fdurudur. Dolay\u0131s\u0131yla kapsam\u0131 bu \u00e7er\u00e7evede olan kararlar\u0131n bu \u00f6zelliklerine de\u011finilmeden, bu kararlara at\u0131f yap\u0131larak &#8220;Bu kapsamda &#8230;&#8221; diye ba\u015flay\u0131p ma\u011fdurlar y\u00f6n\u00fcnden olu\u015fturulmu\u015f olan ilkelerin su\u00e7 isnad\u0131 alt\u0131nda olan ki\u015filere uygulanaca\u011f\u0131n\u0131 belirtmek, ba\u015fvuruda ula\u015f\u0131lan sonucu do\u011frudan etkileyen isabetsiz bir tercih olarak ortaya \u00e7\u0131kmaktad\u0131r. Elbette ki ceza soru\u015fturmalar\u0131n\u0131n makul s\u00fcrede sonu\u00e7land\u0131r\u0131lmas\u0131 ba\u011flam\u0131nda \u015f\u00fcphelilerin\/san\u0131klar\u0131n g\u00fcvenceleri vard\u0131r. Ancak bu g\u00fcvence -somut olay\u0131n olduk\u00e7a istisnai ko\u015fullar\u0131 bunu gerektirmedik\u00e7e- kural olarak \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda de\u011fil, adil yarg\u0131lanma hakk\u0131n\u0131n yans\u0131malar\u0131ndan biri olan makul s\u00fcrede yarg\u0131lanma hakk\u0131 kapsam\u0131ndaki bir g\u00fcvencedir. Bu istisnai ko\u015fullar olsa bile buradaki g\u00fcvence tamamen farkl\u0131 bir kavram olan ve ma\u011fdurlar y\u00f6n\u00fcnden ge\u00e7erli olan etkili soru\u015fturma y\u00fck\u00fcml\u00fc\u011f\u00fc kapsam\u0131nda de\u011ferlendirilmez, genel olarak usul y\u00fck\u00fcml\u00fcl\u00fckleri kapsam\u0131nda de\u011ferlendirilebilir.<\/p>\n<p>22. Yine \u00c7o\u011funluk g\u00f6r\u00fc\u015f\u00fcne dayal\u0131 karar\u0131n 48. paragraf\u0131nda, Anayasa Mahkemesinin \u00f6nceki kararlar\u0131na at\u0131f yap\u0131larak &#8220;Bu \u00e7er\u00e7evede ilgili idari ve yarg\u0131sal i\u015flemlerin s\u00fcratle yerine getirilmesi kadar soru\u015fturma s\u00fcrecinde ilgili ki\u015filerin g\u00f6r\u00fc\u015flerini tam olarak sunabildikleri adil bir s\u00fcrecin sa\u011flanmas\u0131 da \u00f6nemlidir. Anayasa\u2019n\u0131n 20. maddesi kapsam\u0131nda \u00f6zel hayata sayg\u0131 hakk\u0131na ili\u015fkin pozitif y\u00fck\u00fcml\u00fcl\u00fck de\u011ferlendirmesinin i\u00e7eri\u011fine ilgili yarg\u0131sal s\u00fcre\u00e7lerin ivedilikle taraflar\u0131n kat\u0131l\u0131m\u0131na a\u00e7\u0131k ve adil yarg\u0131lanma hakk\u0131n\u0131n usule ili\u015fkin gereklerine riayetle y\u00fcr\u00fct\u00fclmesi \u015feklindeki usule ili\u015fkin y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn de eklenmesi gerekmektedir (benzer y\u00f6nde de\u011ferlendirmeler i\u00e7in bkz. Marcus Frank Cerny [GK], B. No: 2013\/5126, 2\/7\/2015\u00a7 81; Bahad\u0131r \u00dcney ve di\u011ferleri [GK], B. No: 2018\/4453, 10\/3\/2022, \u00a7 53).&#8221; de\u011ferlendirmesine yer verilmi\u015ftir.<\/p>\n<p>23. Paragrafa &#8220;Bu \u00e7er\u00e7evede &#8230;&#8221; denilerek ba\u015fland\u0131\u011f\u0131ndan, belirtilen tercihin burada da devam ettirildi\u011fi anla\u015f\u0131lmaktad\u0131r. Zira bu paragrafta at\u0131f yap\u0131lan kararlardaki hukuki s\u00fcre\u00e7ler ile somut olaydaki hukuki s\u00fcre\u00e7ler de farkl\u0131d\u0131r. At\u0131f yap\u0131lan kararlar hukuk davalar\u0131na ve davalar\u0131n konular\u0131 da \u00f6zel ve aile hayat\u0131na ili\u015fkindir. Ayr\u0131ca an\u0131lan kararlardaki paragraflarda yer alan ilkelerde kanaatimizce sonuca etkili olabilecek baz\u0131 de\u011fi\u015fiklikler de yap\u0131lm\u0131\u015ft\u0131r. \u00d6rne\u011fin B. \u00dc. ve di\u011ferleri karar\u0131n\u0131n at\u0131f yap\u0131lan paragraf\u0131 &#8220;53. Velayet ve ki\u015fisel ili\u015fki tesisine ili\u015fkin davalar-zaman ge\u00e7mesi \u00e7ocu\u011fun birlikte ya\u015famad\u0131\u011f\u0131 ebeveyn ile aras\u0131ndaki ili\u015fkiler \u00fczerinde telafisi m\u00fcmk\u00fcn olmayan sonu\u00e7lar do\u011furabilece\u011finden- ivedi \u015fekilde sonu\u00e7land\u0131r\u0131lmal\u0131d\u0131r. Aile hayat\u0131na sayg\u0131 hakk\u0131 ba\u011flam\u0131ndaki uyu\u015fmazl\u0131klarda, pozitif y\u00fck\u00fcml\u00fcl\u00fcklerin yerine getirilmesi hususunda ilgili idari ve yarg\u0131sal i\u015flemlerin s\u00fcratle yerine getirilmesi kadar karar olu\u015fturma s\u00fcrecinin ilgili ki\u015filerin g\u00f6r\u00fc\u015flerini tam olarak sunabildikleri adil bir s\u00fcre\u00e7 olmas\u0131n\u0131n sa\u011flanmas\u0131 da \u00f6nemlidir. Bu \u00e7er\u00e7evede Anayasa\u2019n\u0131n 20. maddesi kapsam\u0131nda aile hayat\u0131na sayg\u0131 hakk\u0131na ili\u015fkin pozitif y\u00fck\u00fcml\u00fcl\u00fck de\u011ferlendirmesinin i\u00e7eri\u011fine ilgili yarg\u0131sal s\u00fcre\u00e7lerin ivedilikle taraflar\u0131n kat\u0131l\u0131m\u0131na a\u00e7\u0131k ve adil yarg\u0131lanma hakk\u0131n\u0131n usule ili\u015fkin gereklerine riayetle y\u00fcr\u00fct\u00fclmesi \u015feklindeki usule ili\u015fkin y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn de eklenmesi gerekmektedir (Marcus Frank Cerny, \u00a7 81).&#8221; \u015feklinde iken, \u00e7o\u011funluk g\u00f6r\u00fc\u015f\u00fcnde yer verilen versiyonda kanaatimizce incelemenin nas\u0131l yap\u0131laca\u011f\u0131 hususunu do\u011frudan etkileyebilecek baz\u0131 b\u00f6l\u00fcmler yer almam\u0131\u015ft\u0131r.<\/p>\n<p>24. \u00c7o\u011funluk g\u00f6r\u00fc\u015f\u00fcne dayal\u0131 kararda, Mahkememizin yerle\u015fik i\u00e7tihad\u0131nda at\u0131fla &#8220;39. &#8230; \u00f6zel hayata ili\u015fkin herhangi bir nedene dayanmayan ve ki\u015finin mesleki hayat\u0131na y\u00f6nelen her m\u00fcdahalenin ya da tedbirin do\u011frudan do\u011fruya \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda de\u011ferlendirilmesi kural olarak m\u00fcmk\u00fcn de\u011fildir. Bu t\u00fcrden m\u00fcdahalelerin \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda de\u011ferlendirilebilmesi i\u00e7in m\u00fcdahalenin ki\u015finin \u00f6zel hayat\u0131na y\u00f6nelik ciddi olumsuz etki ve sonu\u00e7lar\u0131n\u0131n bulundu\u011fu veya bulunma ihtimali oldu\u011fu ortaya konulmal\u0131d\u0131r.&#8221; ilkesine yer verilmi\u015ftir. Sonras\u0131nda ise somut olayla ba\u011flant\u0131l\u0131 olarak &#8220;40. &#8230; somut olay\u0131n \u00f6zelli\u011fi g\u00f6zetildi\u011finde ceza soru\u015fturmas\u0131n\u0131n uzun bir s\u00fcre devam etmesinin ba\u015fvurucunun mesleki faaliyetlerinin \u00f6nemli \u00f6l\u00e7\u00fcde aksamas\u0131na ve mesleki\/ki\u015fisel ili\u015fkilerinin ve itibar\u0131n\u0131n ciddi \u015fekilde zedelenmesine yol a\u00e7acak bir boyuta ula\u015fmas\u0131 durumunda \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n g\u00fcvenceleri kapsam\u0131nda incelenebilir oldu\u011fu s\u00f6ylenebilir.&#8221; denilmi\u015ftir. Ard\u0131ndan da (uygulanabilirlik y\u00f6n\u00fcnden) 41, 43, (esas y\u00f6n\u00fcnden ise) 51 ve 52. paragraflarda somut olayda da ceza soru\u015fturmas\u0131n\u0131n uzun s\u00fcr\u00fcd\u00fc\u011f\u00fcn\u00fcn, di\u011fer bir ifadeyle ivedilikle ve \u00f6zenle y\u00fcr\u00fct\u00fclmedi\u011finin anla\u015f\u0131ld\u0131\u011f\u0131 vurgulan\u0131p, \u015fartlar\u0131 olu\u015fmas\u0131na ra\u011fmen ba\u015fvurucunun ye\u015fil pasaporta ba\u015fvuramamas\u0131, arabuluculuk siciline kaydedilmemesi, takip etti\u011fi davalara soru\u015fturma bilgisi g\u00f6nderilerek mesleki itibar\u0131n\u0131n\/ili\u015fkilerinin zedelenmesi \u015feklinde ortaya konulan \u00fc\u00e7 husus nedeniyle soru\u015fturman\u0131n uzun s\u00fcrmesinin \u00f6zel hayata etki etki etti\u011fi de\u011ferlendirmesi yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>25. Somut olayda \u00e7\u00f6z\u00fclmesi gereken as\u0131l mesele ceza soru\u015fturmas\u0131n\u0131n uzun s\u00fcr\u00fcp s\u00fcrmedi\u011fi de\u011fildir. Zira daha \u00f6nce de ifade edildi\u011fi gibi, su\u00e7 isnad\u0131 alt\u0131ndaki ki\u015fi hakk\u0131ndaki soru\u015fturman\u0131n uzun s\u00fcrmesi kural olarak adil yarg\u0131lanma hakk\u0131 kapsam\u0131ndaki makul s\u00fcrede yarg\u0131lama hakk\u0131 \u00e7er\u00e7evesinde de\u011ferlendirilmesi gereken bir meseledir. Anayasa Mahkemesinin uygulamas\u0131 bu y\u00f6ndedir. Bu konuda \u00e7ok say\u0131da karar bulunmaktad\u0131r. Dolay\u0131s\u0131yla somut olayda as\u0131l \u00e7\u00f6z\u00fclmesi gereken mesele ceza soru\u015fturmas\u0131n\u0131n uzun s\u00fcrmesinin \u00f6zel hayat \u00fczerinde \u00f6nemli ve olumsuz somut yans\u0131malar\u0131 olup olmad\u0131\u011f\u0131, dolay\u0131s\u0131yla da sonucu itibar\u0131yla \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda inceleme yap\u0131l\u0131p yap\u0131lamayaca\u011f\u0131d\u0131r. Esasen yukar\u0131da al\u0131nt\u0131lanan \u00e7o\u011funluk g\u00f6r\u00fc\u015f\u00fcndeki 39 ve 40. paragraflarda da bu husus dile getirilmi\u015ftir.<\/p>\n<p>26. Belirtilen durumla birlikte \u00c7o\u011funluk g\u00f6r\u00fc\u015f\u00fcne dayal\u0131 karar\u0131n 42. paragraf\u0131nda &#8220;\u00d6te yandan 19\/3\/1969 tarihli ve 1136 say\u0131l\u0131 Avukatl\u0131k Kanunu&#8217;nun 1.maddesinde avukatl\u0131k kamu hizmeti ve serbest bir meslek olarak tan\u0131mlanmaktad\u0131r. Adalet sistemindeki rol\u00fc nedeniyle toplum g\u00f6z\u00fcnde \u00f6nemli bir yere ve sayg\u0131nl\u0131\u011fa sahip olan avukatl\u0131\u011f\u0131n niteli\u011fi gere\u011fi g\u00fc\u00e7l\u00fc sosyal ili\u015fkiler kurularak ifa edilen bir meslek oldu\u011fu s\u00f6ylenebilir (\u00d6zlem Kenan, B. No: 2018\/25808, 7\/4\/2021, \u00a7 42). A\u00e7\u0131klamalar kapsam\u0131nda somut olay de\u011ferlendirildi\u011finde avukatl\u0131k mesle\u011fini ifa eden ba\u015fvurucunun ter\u00f6r \u00f6rg\u00fct\u00fcyle ilgili bir soru\u015fturmada uzun bir s\u00fcre \u015f\u00fcpheli olarak yer almas\u0131n\u0131n \u00f6rg\u00fctle irtibatl\u0131 ve iltisakl\u0131 oldu\u011fu izlenimi olu\u015fturaca\u011f\u0131, bu durumun da meslek hayat\u0131n\u0131, \u00fc\u00e7\u00fcnc\u00fc ki\u015filerle ili\u015fki kurabilme ve geli\u015ftirebilme imk\u00e2n\u0131n\u0131 olumsuz etkileyece\u011fi, sosyal ve mesleki itibar\u0131n\u0131 koruyabilmesi a\u00e7\u0131s\u0131ndan ciddi sonu\u00e7lara yol a\u00e7aca\u011f\u0131 \u00f6ng\u00f6r\u00fclebilir bir durumdur.&#8221; \u015feklinde de\u011ferlendirme yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>27. Bir\u00e7ok meslek dal\u0131 i\u00e7in kolayl\u0131kla yap\u0131labilecek bu de\u011ferlendirmelerin tek ba\u015f\u0131na bir ceza soru\u015fturmas\u0131n\u0131 \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131na sokmas\u0131 m\u00fcmk\u00fcn de\u011fildir. Aksi halde belli mesleklere mensup ki\u015filer hakk\u0131nda yap\u0131lan her soru\u015fturman\u0131n otomatik olarak \u015feref ve itibar\u0131 zedeledi\u011fi s\u00f6ylenebilecektir. Burada isnat edilen su\u00e7un da ter\u00f6rle ba\u011flant\u0131l\u0131 olmas\u0131 gerekmeyebilecektir. Zira \u00f6rne\u011fin h\u0131rs\u0131zl\u0131k, doland\u0131r\u0131c\u0131l\u0131k, cinsel istismar vs. bir\u00e7ok su\u00e7 y\u00f6n\u00fcnden itibarla ba\u011flant\u0131 kurmak olduk\u00e7a kolayd\u0131r. Nitekim \u00e7o\u011funluk g\u00f6r\u00fc\u015f\u00fcnde de avukatl\u0131k mesle\u011fine ili\u015fkin yukar\u0131da al\u0131nt\u0131lanan de\u011ferlendirme tek ba\u015f\u0131na kullan\u0131lmam\u0131\u015f ceza soru\u015fturmas\u0131n\u0131n somut olaydaki etkilerine ili\u015fkin \u00fc\u00e7 hususa de\u011finilmi\u015ftir. Bu durumda \u00f6nemli olan ceza soru\u015fturmas\u0131n\u0131n uzun s\u00fcrmesinin \u00f6zel hayata somut etkileri olarak kabul edilen \u00fc\u00e7 hususun ger\u00e7ekten ceza soru\u015fturmas\u0131n\u0131n uzun s\u00fcrmesinin sonu\u00e7lar\u0131 olup olmad\u0131\u011f\u0131, \u00f6yle olsalar bile \u00f6zel hayat kapsam\u0131nda bulunup bulunmad\u0131klar\u0131, bulunsalar bile konuya ili\u015fkin iddialar\u0131n ba\u015fvurucu taraf\u0131ndan temellendirilip temellendirilmedi\u011fi, temellendirmi\u015f olsa bile ola\u011fan ba\u015fvuru yollar\u0131n\u0131n t\u00fcketilip t\u00fcketilmedi\u011fidir.<\/p>\n<p>28. Bu ba\u011flamda \u00f6ncelikle belirtilmelidir ki \u015fartlar\u0131 olu\u015fmas\u0131na ra\u011fmen ba\u015fvurucunun ye\u015fil pasaporta ba\u015fvuramamas\u0131, arabuluculuk siciline kaydedilmemesi, takip etti\u011fi davalara soru\u015fturma bilgisi g\u00f6nderilerek mesleki itibar\u0131n\u0131n\/ili\u015fkilerinin zedelenmesi \u015feklindeki \u00fc\u00e7 hususun hi\u00e7birinin, \u00e7o\u011funluk g\u00f6r\u00fc\u015f\u00fcndeki kabul\u00fcn aksine, kanaatimizce ba\u015fvurucu hakk\u0131ndaki ceza soru\u015fturmas\u0131n\u0131n uzun s\u00fcrmesiyle do\u011frudan bir ilgisi bulunmamaktad\u0131r. Zira bu hususlar ceza soru\u015fturmas\u0131n\u0131n uzun s\u00fcrmesinden ba\u011f\u0131ms\u0131z olarak ceza soru\u015fturmas\u0131n\u0131n herhangi bir safhas\u0131nda ger\u00e7ekle\u015febilmesi m\u00fcmk\u00fcn olan durumlard\u0131r. Kald\u0131 ki olayda bu hususlar\u0131n salt soru\u015fturman\u0131n uzun s\u00fcrmesi nedeniyle ortaya \u00e7\u0131kt\u0131\u011f\u0131na ili\u015fkin bir tespit de bulunmamaktad\u0131r.<\/p>\n<p>29. \u00d6te yandan, \u00e7o\u011funluk g\u00f6r\u00fc\u015f\u00fcnde, halk aras\u0131nda pasaportun rengine atfen ifade edildi\u011fi \u015fekliyle &#8220;ye\u015fil pasaporta&#8221; (15\/7\/1950 tarihli ve 5682 say\u0131l\u0131 Pasaport Kanunu&#8217;nda ifade edildi\u011fi \u015fekliyle ise &#8220;hususi damgal\u0131 pasaporta&#8221;) ba\u015fvurulamamas\u0131n\u0131n \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda incelenmesi de konuya ili\u015fkin Anayasa Mahkemesi i\u00e7tihad\u0131 ile uyumlu de\u011fildir.<\/p>\n<p>30. Konuya ili\u015fkin Anayasa Mahkemesi i\u00e7tihad\u0131na ge\u00e7meden \u00f6nce belirtmek gerekir ki \u00c7o\u011funluk\u00e7a \u00f6ncelikle somut olayda 5682 say\u0131l\u0131 Kanun&#8217;un 14. maddesi uyar\u0131nca avukatlar i\u00e7in hususi pasaport al\u0131nmas\u0131n\u0131n ko\u015fullar\u0131ndan olan &#8220;en az on be\u015f y\u0131l k\u0131demi bulunan avukat&#8221; olma ko\u015fulunun sa\u011flan\u0131p sa\u011flanmad\u0131\u011f\u0131na bak\u0131lmas\u0131 gerekirken, bu konu \u00fczerinde durulmam\u0131\u015f, konu ara\u015ft\u0131r\u0131lmam\u0131\u015f; ba\u015fvurucunun t\u00fcm ko\u015fullar\u0131 sa\u011flad\u0131\u011f\u0131na ili\u015fkin genel ve soyut beyan\u0131 esas al\u0131nm\u0131\u015ft\u0131r. Kald\u0131 ki somut olayda bu konudaki t\u00fcm ko\u015fullar\u0131n sa\u011fland\u0131\u011f\u0131 kabul edilse bile hususi damgal\u0131 pasaport alabilme konusu \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda incelenemez. Zira yukar\u0131da belirtilen ko\u015fulu sa\u011flad\u0131\u011f\u0131 varsay\u0131lan ba\u015fvurucunun hususi damgal\u0131 pasaport almas\u0131na engel olan ve ba\u015fvuru konusu ceza soru\u015fturmas\u0131yla ba\u011flant\u0131l\u0131 olan ko\u015fulu d\u00fczenleyen 5682 say\u0131l\u0131 Kanun&#8217;un 14. maddesinin &#8220;&#8230; haklar\u0131nda 26\/9\/2004 tarihli ve 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanununun \u0130kinci Kitap D\u00f6rd\u00fcnc\u00fc K\u0131s\u0131m D\u00f6rd\u00fcnc\u00fc, Be\u015finci, Alt\u0131nc\u0131 ve Yedinci B\u00f6l\u00fcm\u00fcnde tan\u0131mlanan su\u00e7lar ile 12\/4\/1991 tarihli ve 3713 say\u0131l\u0131 Ter\u00f6rle M\u00fccadele Kanunu kapsam\u0131na giren su\u00e7lardan dolay\u0131 soru\u015fturma veya kovu\u015fturma bulunmamas\u0131 kayd\u0131yla&#8230;&#8221; \u015feklindeki h\u00fckm\u00fc Anayasa Mahkemesinin yak\u0131n tarihli bir karar\u0131nda (AYM, E.2019\/114, K.2021\/36, 03\/06\/2021) incelenmi\u015f ve hususi damgal\u0131 pasaporta ili\u015fkin k\u0131s\u0131tlamalar\u0131n -\u00f6zel hayata sayg\u0131 hakk\u0131na s\u0131n\u0131rlama te\u015fkil etmek bir tarafa- en ilgili olabilece\u011fi temel hak ve \u00f6zg\u00fcrl\u00fck olan seyahat \u00f6zg\u00fcrl\u00fc\u011f\u00fcne bile s\u0131n\u0131rlama getirmedi\u011fi, dolay\u0131s\u0131yla Anayasa&#8217;n\u0131n 23. maddesine ayk\u0131r\u0131 olmad\u0131\u011f\u0131 sonucuna varm\u0131\u015ft\u0131r.<\/p>\n<p>31. Mahkememiz an\u0131lan karar\u0131nda &#8220;16. &#8230; kanun koyucunun hususi damgal\u0131 pasaportlardan yararlanabilecek ki\u015filere ili\u015fkin d\u00fczenleme yaparken birtak\u0131m \u015fartlar\u0131 \u00f6ng\u00f6rmesi yaln\u0131zca bu t\u00fcr pasaportlar\u0131n elde edilmesine y\u00f6nelik bir s\u0131n\u0131rlamad\u0131r. Zira 5682 say\u0131l\u0131 Kanun\u2019un 15. maddesi uyar\u0131nca kural olarak her T\u00fcrk vatanda\u015f\u0131n\u0131n umuma mahsus pasaport hamili s\u0131fat\u0131yla yurt d\u0131\u015f\u0131na \u00e7\u0131kabilmesi m\u00fcmk\u00fcnd\u00fcr. \/ 17. Buna g\u00f6re hususi damgal\u0131 pasaport hamili olarak yurt d\u0131\u015f\u0131na \u00e7\u0131kabilmenin sa\u011flad\u0131\u011f\u0131 imk\u00e2nlara ula\u015fabilmede birtak\u0131m \u015fartlar\u0131n \u00f6ng\u00f6r\u00fclmesi \u015feklinde \u00f6zetlenebilecek dava konusu kural\u0131n Anayasa\u2019n\u0131n 23. maddesinde g\u00fcvence alt\u0131na al\u0131nan yurt d\u0131\u015f\u0131na \u00e7\u0131kma h\u00fcrriyetini s\u0131n\u0131rlayan bir y\u00f6n\u00fc bulunmamaktad\u0131r.&#8221; \u015feklinde de\u011ferlendirme yapm\u0131\u015ft\u0131r. \u00c7o\u011funluk g\u00f6r\u00fc\u015f\u00fcnde s\u00f6z konusu karardan neden ayr\u0131l\u0131nd\u0131\u011f\u0131 a\u00e7\u0131klanmadan, hususi damgal\u0131 pasaportun seyahat \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn de \u00f6tesine ge\u00e7ilerek \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131na sokulmas\u0131 Anayasa&#8217;n\u0131n 2. maddesinde d\u00fczenlenen hukuk devleti ilkesiyle yak\u0131ndan ba\u011flant\u0131l\u0131 olan i\u00e7tihatta istikrar\u0131n sa\u011flanmas\u0131 ilkesiyle ba\u011fda\u015fmamaktad\u0131r. Ayr\u0131ca somut olayda ba\u015fvurucu taraf\u0131ndan hususi damgal\u0131 pasaport i\u00e7in ba\u015fvurulmu\u015f ve reddedilmi\u015f de de\u011fildir.<\/p>\n<p>32. Belirtilen durumlarla birlikte ba\u015fvurucunun takip etti\u011fi davalara soru\u015fturma bilgisi g\u00f6nderilerek mesleki itibar\u0131n\u0131n\/ili\u015fkilerinin zedelenmesi iddias\u0131 da \u00e7o\u011funluk g\u00f6r\u00fc\u015f\u00fcnde ceza soru\u015fturmas\u0131n\u0131n uzun s\u00fcrmesinin \u00f6zel hayata olumsuz etkilerinden biri olarak de\u011ferlendirilmi\u015ftir. Oysa bu konudaki (b\u00f6yle bir olay\u0131n ger\u00e7ekle\u015fti\u011fine dair) tek dayanak ba\u015fvurucunun ba\u015fvuru \u00f6ncesi bu y\u00f6nde bir vaka meydana geldi\u011fine dair verdi\u011fi dilek\u00e7edeki beyand\u0131r. Kald\u0131 ki ba\u015fvurucunun takip etti\u011fi davalara soru\u015fturma bilgisi g\u00f6nderilmi\u015f olsa bile bu bilginin i\u00e7eri\u011finin ne oldu\u011fu, ilgili davalara bakan mahkemece mi istendi\u011fi veya Cumhuriyet savc\u0131s\u0131 taraf\u0131ndan resen mi g\u00f6nderildi\u011fi, hangi mevzuata dayan\u0131larak ve neden g\u00f6nderildi\u011fi, o davalar ile soru\u015fturman\u0131n ilgisinin olup olmad\u0131\u011f\u0131 gibi hi\u00e7bir bilgi sahibi olunmayan ve ba\u015fvurucu taraf\u0131ndan da bunlardan herhangi birine dair somut bilgi ve belge sunulmam\u0131\u015f olan bir durumun kanaatimizce h\u00fckme esas al\u0131nmamas\u0131 gerekir. \u00c7o\u011funluk g\u00f6r\u00fc\u015f\u00fcnde ise bu konu h\u00fckme esas al\u0131nm\u0131\u015ft\u0131r. \u00d6te taraftan \u00e7o\u011funluk g\u00f6r\u00fc\u015f\u00fcnde ilkesel olarak &#8220;39. &#8230; m\u00fcdahalenin ki\u015finin \u00f6zel hayat\u0131na y\u00f6nelik ciddi olumsuz etki ve sonu\u00e7lar\u0131n\u0131n bulundu\u011fu veya bulunma ihtimali oldu\u011fu ortaya konulmal\u0131d\u0131r.&#8221; denilmesine, ayr\u0131ca Adalet Bakanl\u0131\u011f\u0131 g\u00f6r\u00fc\u015f\u00fcnde iddialar\u0131n temellendirilmedi\u011fine dair g\u00f6r\u00fc\u015f sunulmas\u0131na ra\u011fmen, \u00e7o\u011funluk g\u00f6r\u00fc\u015f\u00fcnde &#8220;Kabul Edilebilirlik&#8221; ba\u015fl\u0131\u011f\u0131 alt\u0131nda bir de\u011ferlendirme yap\u0131lmadan &#8220;A\u00e7\u0131k\u00e7a dayanaktan yoksun olmad\u0131\u011f\u0131 ve kabul edilemezli\u011fine karar verilmesini gerektirecek ba\u015fka bir neden de bulunmad\u0131\u011f\u0131 anla\u015f\u0131lan \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ihlal edildi\u011fine ili\u015fkin iddian\u0131n kabul edilebilir oldu\u011funa karar verilmesi gerekir.&#8221; \u015feklinde a\u00e7\u0131klama yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>33. Ba\u015fvurucunun arabuluculuk siciline kaydedilmemesi meselesine gelince: \u00c7o\u011funluk g\u00f6r\u00fc\u015f\u00fcnde bu mesele de ceza soru\u015fturmas\u0131n\u0131n uzun s\u00fcrmesinin \u00f6zel hayata olumsuz etkilerinden biri olarak de\u011ferlendirilmi\u015ftir. Yukar\u0131da a\u00e7\u0131klanan hususi damgal\u0131 pasaport \u015fartlar\u0131ndan farkl\u0131 olarak, ilgili kanun h\u00fck\u00fcmlerine g\u00f6re, belli su\u00e7lardan hakk\u0131nda soru\u015fturma yap\u0131l\u0131yor olmas\u0131 arabulucu olman\u0131n ko\u015fullar\u0131ndan biri de\u011fildir. Bu durumla birlikte 6325 say\u0131l\u0131 Kanun&#8217;un 20. maddesinde, arabuluculuk siciline kay\u0131t i\u00e7in gerekli \u015fartlardan biri olarak kabul edilen &#8220;Ter\u00f6r \u00f6rg\u00fctleriyle iltisakl\u0131 veya irtibatl\u0131 olmamak&#8221; \u015feklindeki kural Anayasa Mahkemesi taraf\u0131ndan norm denetiminde incelemi\u015f ve \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda de\u011fil Anayasa&#8217;n\u0131n \u00e7al\u0131\u015fma hakk\u0131n\u0131 d\u00fczenleyen 48 ve 49. maddeleri kapsam\u0131nda ele alm\u0131\u015ft\u0131r (AYM, E.2018\/89, K.2019\/84, 14\/11\/2019, \u00a7\u00a7 40 ve devam\u0131). \u00d6te yandan arabuluculuk siciline kaydetmeme i\u015flemi idari bir i\u015flemdir. \u0130dari i\u015flemlere kar\u015f\u0131 yarg\u0131 yolu a\u00e7\u0131kt\u0131r. Kanun&#8217;da ki\u015filer hakk\u0131nda belli su\u00e7lar nedeniyle soru\u015fturma bulunmamak de\u011fil ter\u00f6r \u00f6rg\u00fctleriyle iltisakl\u0131 veya irtibatl\u0131 olmamak arabuluculu\u011fa engel olarak d\u00fczenlenmi\u015ftir. Dolay\u0131s\u0131yla ba\u015fvurucu burada kanuna ayk\u0131r\u0131 bir idari i\u015flem tesis edildi\u011fini d\u00fc\u015f\u00fcn\u00fcyorsa idari yarg\u0131 mercilerine ba\u015fvurmas\u0131 gerekir. Anayasa Mahkemesinin yukar\u0131da belirtilen karar\u0131nda da &#8220;51. Ayr\u0131ca kural\u0131n uygulanmas\u0131ndan do\u011facak uyu\u015fmazl\u0131klar\u0131n yarg\u0131ya ta\u015f\u0131nabilmesi m\u00fcmk\u00fcnd\u00fcr. Bu kapsamda kural, yarg\u0131 yoluna ba\u015fvurma g\u00fcvencesi bak\u0131m\u0131ndan herhangi bir s\u0131n\u0131rlama getirmedi\u011finden arabuluculuk siciline kaydedilmeyen bireylerin kural\u0131n \u00f6ng\u00f6rd\u00fc\u011f\u00fc ko\u015fulun ger\u00e7ekle\u015fmedi\u011fi, bir ba\u015fka deyi\u015fle herhangi bir ter\u00f6r \u00f6rg\u00fct\u00fcyle iltisakl\u0131 veya irtibatl\u0131 bulunmad\u0131klar\u0131 gerek\u00e7esiyle yarg\u0131 yoluna ba\u015fvurmalar\u0131nda ve yarg\u0131 yerlerince hakl\u0131 bulunmalar\u0131 h\u00e2linde arabuluculuk siciline kaydedilmelerinde bir engel bulunmamaktad\u0131r. Buna g\u00f6re Kanun\u2019da kural\u0131n amac\u0131 d\u0131\u015f\u0131nda keyfi olarak kullan\u0131lmas\u0131n\u0131 \u00f6nleyecek yasal g\u00fcvenceye yer verildi\u011finden kuralla ula\u015f\u0131lmak istenen amaca ili\u015fkin kamu yarar\u0131 ile bireyin kamu hizmetine girme hakk\u0131 aras\u0131nda bulunmas\u0131 gereken makul dengenin g\u00f6zetildi\u011fi anla\u015f\u0131lmaktad\u0131r. Bu itibarla kural\u0131n orant\u0131s\u0131z bir m\u00fcdahaleye de neden olmad\u0131\u011f\u0131, dolay\u0131s\u0131yla an\u0131lan h\u00fcrriyet ve hakka \u00f6l\u00e7\u00fcs\u00fcz bir s\u0131n\u0131rlama getirmedi\u011fi sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r.&#8221; \u015feklinde de\u011ferlendirme yap\u0131lm\u0131\u015ft\u0131r. Nitekim somut olayda ba\u015fvurucu idari yarg\u0131 yerlerine de ba\u015fvuru yapm\u0131\u015ft\u0131r. Ancak eldeki ba\u015fvuruda buna ili\u015fkin ola\u011fan kanun yollar\u0131n\u0131 t\u00fcketmeden ceza soru\u015fturmas\u0131 \u00fczerinden \u015fikayetini dile getirmi\u015ftir. \u0130dari yarg\u0131 yolunun art\u0131k etkisiz hale geldi\u011fine dair de bir a\u00e7\u0131klamas\u0131 bulunmamaktad\u0131r. \u00c7o\u011funluk g\u00f6r\u00fc\u015f\u00fcnde ise bu sorunlu durumla ilgili olarak &#8220;52. &#8230; Soru\u015fturma s\u00fcreci g\u00f6zetildi\u011finde ba\u015fvurucunun \u015fik\u00e2yetini somut dayanaklarla a\u00e7\u0131klayarak adli makamlar \u00f6n\u00fcnde de dile getirdi\u011fi ancak Ba\u015fsavc\u0131l\u0131k taraf\u0131ndan somut olay\u0131n ko\u015fullar\u0131na uygun \u00e7\u00f6z\u00fcmler \u00fcretilmedi\u011fi, makul s\u00fcrede sonu\u00e7land\u0131r\u0131lmayan soru\u015fturman\u0131n ba\u015fvurucunun \u00f6zel hayat\u0131na etkilerin giderek a\u011f\u0131rla\u015ft\u0131\u011f\u0131 g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. &#8230;&#8221; \u015feklinde de\u011ferlendirme yap\u0131lm\u0131\u015ft\u0131r. Oysa idarenin hatal\u0131 oldu\u011fu iddia edilen idari i\u015flemiyle ilgili olarak ceza soru\u015fturmas\u0131n\u0131 y\u00fcr\u00fcten Ba\u015fsavc\u0131l\u0131\u011f\u0131n \u00fcretece\u011fi bir \u00e7\u00f6z\u00fcm bulunmamaktad\u0131r. S\u0131rf soru\u015fturman\u0131n y\u00fcr\u00fcyor olmas\u0131 da Kanun&#8217;a g\u00f6re arabuluculuk siciline kaydedilmeye engel de\u011fildir. Kanun&#8217;a ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclen i\u015flem ancak idari yarg\u0131 yolunda iptal edilerek bir \u00e7\u00f6z\u00fcm \u00fcretilebilirdi. Ancak \u00e7o\u011funluk g\u00f6r\u00fc\u015f\u00fcnde bireysel ba\u015fvurunun ikincilli\u011fi ilkesine, buna ili\u015fkin Anayasa&#8217;n\u0131n 148. maddesinin &#8220;Ba\u015fvuruda bulunabilmek i\u00e7in ola\u011fan kanun yollar\u0131n\u0131n t\u00fcketilmi\u015f olmas\u0131 \u015fartt\u0131r.&#8221; ve 6216 say\u0131l\u0131 Kanun&#8217;un 45. maddesinin &#8220;\u0130hlale neden oldu\u011fu ileri s\u00fcr\u00fclen i\u015flem, eylem ya da ihmal i\u00e7in kanunda \u00f6ng\u00f6r\u00fclm\u00fc\u015f idari ve yarg\u0131sal ba\u015fvuru yollar\u0131n\u0131n tamam\u0131n\u0131n bireysel ba\u015fvuru yap\u0131lmadan \u00f6nce t\u00fcketilmi\u015f olmas\u0131 gerekir.&#8221; \u015feklindeki a\u00e7\u0131k h\u00fck\u00fcmlerine ra\u011fmen arabuluculuk siciline kaydedilmemeye ili\u015fkin idari i\u015flem h\u00fckme esas al\u0131narak sonuca var\u0131lm\u0131\u015ft\u0131r1.<\/p>\n<p>34. Sonu\u00e7 olarak, yukar\u0131da belirtilen hususlar birlikte g\u00f6zetildi\u011finde, somut olayda, su\u00e7 isnad\u0131 alt\u0131ndaki ba\u015fvurucu hakk\u0131ndaki ceza soru\u015fturmas\u0131n\u0131n uzun s\u00fcrmesi meselesinin kanaatimizce su\u00e7 isnad\u0131 alt\u0131ndaki ki\u015filerin sahip oldu\u011fu usule ili\u015fkin g\u00fcvenceleri i\u00e7eren adil yarg\u0131lanma hakk\u0131 kapsam\u0131ndaki makul s\u00fcrede yarg\u0131lanma hakk\u0131 kapsam\u0131nda de\u011ferlendirilmesi ve bu kapsamda yap\u0131lacak inceleme sonucunda, Adalet Bakanl\u0131\u011f\u0131 b\u00fcnyesinde kurulan Tazminat Komisyonuna ba\u015fvuru yolunun t\u00fcketilmesi gerekti\u011finden bahisle ba\u015fvuru yollar\u0131n\u0131n t\u00fcketilmemesi nedeniyle kabul edilmezlik karar\u0131 verilmesi gerekirken, \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda incelenmesi ve neticede ba\u015fvurucunun \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ihlal edildi\u011fine karar verilmesi kanaatimizce isabetli olmam\u0131\u015ft\u0131r.<\/p>\n<p>35. \u00d6te yandan \u015fu hususun da belirtilmesi gerekir ki somut ba\u015fvuruda, yukar\u0131da ayr\u0131nt\u0131l\u0131 olarak a\u00e7\u0131kland\u0131\u011f\u0131 \u00fczere, \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda ileri s\u00fcr\u00fclen baz\u0131 iddialar\u0131n temellendirilemedi\u011fi, baz\u0131lar\u0131n\u0131n \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda olmad\u0131\u011f\u0131, baz\u0131lar\u0131 y\u00f6n\u00fcnden ise ba\u015fvuru yollar\u0131n\u0131n t\u00fcketilmedi\u011fi anla\u015f\u0131ld\u0131\u011f\u0131ndan, bu hak ba\u011flam\u0131nda yap\u0131lan inceleme ve de\u011ferlendirme sonucunda da kabul edilmezlik karar\u0131 verilmesi gerekirdi.<\/p>\n<p>36.
