Ba\u015fvuru, eczane ile yap\u0131lan s\u00f6zle\u015fmenin feshedilmesi nedeniyle \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ihlal edildi\u011fi iddias\u0131na ili\u015fkindir.<\/p>\n<p>II. BA\u015eVURU S\u00dcREC\u0130<\/p>\n<p>2. Ba\u015fvuru 10\/8\/2020 tarihinde yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>3. Ba\u015fvuru, ba\u015fvuru formu ve eklerinin idari y\u00f6nden yap\u0131lan \u00f6n incelemesinden sonra Komisyona sunulmu\u015ftur.<\/p>\n<p>4. Komisyonca ba\u015fvurunun kabul edilebilirlik incelemesinin B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>5. B\u00f6l\u00fcm Ba\u015fkan\u0131 taraf\u0131ndan ba\u015fvurunun kabul edilebilirlik ve esas incelemesinin birlikte yap\u0131lmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>6. Ba\u015fvuru belgelerinin bir \u00f6rne\u011fi bilgi i\u00e7in Adalet Bakanl\u0131\u011f\u0131&#8217;na (Bakanl\u0131k) g\u00f6nderilmi\u015ftir. Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcn\u00fc sunmu\u015ftur. Ba\u015fvurucu, Bakanl\u0131\u011f\u0131n g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 s\u00fcresinde beyanda bulunmu\u015ftur.<\/p>\n<p>III. OLAY VE OLGULAR <\/p>\n<p>7. Ba\u015fvuru formu ve eklerinde ifade edildi\u011fi \u015fekliyle ve Ulusal Yarg\u0131 A\u011f\u0131 Bili\u015fim Sistemi (UYAP) arac\u0131l\u0131\u011f\u0131yla eri\u015filen bilgi ve belgeler \u00e7er\u00e7evesinde olaylar \u00f6zetle \u015f\u00f6yledir:<\/p>\n<p>8. Ba\u015fvurucu, Batman&#8217;da faaliyet g\u00f6steren eczanenin sahibi ve mesul m\u00fcd\u00fcr\u00fc olarak 1\/4\/2016 tarihli Sosyal G\u00fcvenlik Kurumu (SGK) Kapsam\u0131ndaki Ki\u015filerin T\u00fcrk Eczac\u0131lar Birli\u011fi (TEB) \u00dcyesi Eczanelerden \u0130la\u00e7 Teminine \u0130li\u015fkin Protokol (Protokol) kapsam\u0131nda TEB ile imzalad\u0131\u011f\u0131 Tip S\u00f6zle\u015fme uyar\u0131nca SGK kapsam\u0131ndaki hastalara ila\u00e7 sat\u0131\u015f\u0131 yapmaktad\u0131r.<\/p>\n<p>9. SGK Ankara \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fcnce ba\u015fvurucuya g\u00f6nderilen 2\/1\/2018 tarihli yaz\u0131 ile Protokol&#8217;\u00fcn &#8220;Taraflar bir ay \u00f6nceden yaz\u0131l\u0131 bildirimde bulunmak \u015fart\u0131yla s\u00f6zle\u015fmeyi her zaman feshedebilir&#8221; \u015feklindeki 5.1. maddesi uyar\u0131nca s\u00f6zle\u015fmenin, yaz\u0131n\u0131n tebli\u011f tarihinden itibaren bir ay sonra feshedilece\u011fi bildirilmi\u015ftir.<\/p>\n<p>10. Ba\u015fvurucu, s\u00f6zle\u015fmenin fesih i\u015fleminin iptali ile Medikal Ulak (Medula) sisteminin a\u00e7\u0131lmas\u0131 amac\u0131yla 18\/1\/2018 tarihinde Ankara 14. Asliye Hukuk Mahkemesinde (Mahkeme) tedbir talepli dava a\u00e7m\u0131\u015ft\u0131r. Dava dilek\u00e7esinde \u00f6zetle; Tip S\u00f6zle\u015fmenin hangi h\u00e2llerde feshedilece\u011finin Protokol&#8217;\u00fcn 5.1. maddesinde d\u00fczenlendi\u011fi ancak SGK taraf\u0131ndan g\u00f6nderilen yaz\u0131da bu maddede say\u0131lan sebeplerden hi\u00e7birine yer verilmemesi nedeniyle ba\u015fvurucunun savunma hakk\u0131n\u0131n engellendi\u011fi ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr. Ayr\u0131ca ba\u015fvurucu hakk\u0131nda an\u0131lan s\u00f6zle\u015fmeyi etkileyebilecek soru\u015fturma ve kovu\u015fturma yap\u0131lmad\u0131\u011f\u0131 gibi disiplin cezas\u0131 da verilmedi\u011fi vurgulanm\u0131\u015ft\u0131r. Dilek\u00e7ede son olarak; Medula sisteminin kapat\u0131lmas\u0131n\u0131n yak\u0131n \u00e7evrede ba\u015fka bir eczane bulunmamas\u0131 nedeniyle burada ya\u015fayan hastalar i\u00e7in de olumsuz sonu\u00e7lar do\u011furaca\u011f\u0131ndan an\u0131lan sistemin tedbiren a\u00e7\u0131lmas\u0131 ve fesih i\u015fleminin iptali talep edilmi\u015ftir.<\/p>\n<p>11. Daval\u0131 SGK&#8217;n\u0131n 1\/2\/2018 tarihli cevap dilek\u00e7esinde \u00f6zetle; i\u015fin esas\u0131n\u0131 \u00e7\u00f6zecek mahiyette ihtiyati tedbir karar\u0131 verilemeyece\u011fi ve g\u00f6revli yarg\u0131 yerinin i\u015f mahkemeleri olmas\u0131 nedeniyle davan\u0131n g\u00f6rev y\u00f6n\u00fcnden reddi gerekti\u011fi belirtilmi\u015f ayr\u0131ca yarg\u0131lamaya devam edilecek ise ayr\u0131nt\u0131l\u0131 bilgi ve belgelerin sunulmas\u0131 i\u00e7in s\u00fcre verilmesi talep edilmi\u015ftir. \u00d6te yandan SGK&#8217;n\u0131n ibraz etti\u011fi 13\/3\/2018 tarihli delil dilek\u00e7esinin ekinde yer alan 9\/2\/2018 tarihli kurum i\u00e7i yaz\u0131\u015fmada; 22\/7\/2016 tarihli ve 667 say\u0131l\u0131 Ola\u011fan\u00fcst\u00fc Hal Kapsam\u0131nda Al\u0131nan Tedbirlere \u0130li\u015fkin Kanun H\u00fckm\u00fcnde Kararname (667 say\u0131l\u0131 KHK) gere\u011fince \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131nca yap\u0131lan ileri g\u00fcvenlik soru\u015fturmas\u0131 sonucunda ba\u015fvurucunun Medula eri\u015fiminin engellendi\u011fi ve s\u00f6zle\u015fmenin feshi yoluna gidildi\u011fi belirtilmi\u015ftir.<\/p>\n<p>12. Mahkeme 28\/3\/2018 tarihli ara karar\u0131 ile ihtiyati tedbir talebinin reddine karar vermi\u015f ve 11\/12\/2018 tarihinde davay\u0131 esastan reddetmi\u015ftir. Gerek\u00e7ede \u00f6zetle; SGK taraf\u0131ndan davaya konu s\u00f6zle\u015fmenin tek tarafl\u0131 olarak feshedildi\u011finin yaz\u0131l\u0131 olarak bildirildi\u011fi nitekim Protokol&#8217;\u00fcn 5.1. maddesinde yer alan &#8220;taraflar bir ay \u00f6nceden yaz\u0131l\u0131 bildirimde bulunmak \u015fart\u0131yla s\u00f6zle\u015fmeyi her zaman feshedebilir.&#8221; h\u00fckm\u00fc gere\u011fince somut olaya konu i\u015flemin Protokol h\u00fckm\u00fcne uygun oldu\u011fu ifade edilmi\u015ftir.<\/p>\n<p>13. Ba\u015fvurucu istinaf talebinde bulunmu\u015ftur. \u0130stinaf dilek\u00e7esinde \u00f6zetle; SGK taraf\u0131ndan fesih i\u015flemine dayanak g\u00f6sterilen Protokol&#8217;\u00fcn 5.1. maddesinde s\u0131n\u0131rl\u0131 \u015fekilde say\u0131lan fesih sebeplerinin ger\u00e7ekle\u015fmemesi nedeniyle s\u00f6z konusu kurumun hukuka ayk\u0131r\u0131 \u015fekilde hareket etti\u011fi ifade edilmi\u015ftir. Bunun yan\u0131nda ba\u015fvurucunun kulland\u0131\u011f\u0131 Medula sistemine eri\u015fiminin Protokol&#8217;de yer alan bir ayl\u0131k s\u00fcre beklenmeden engellendi\u011fi dikkate al\u0131nd\u0131\u011f\u0131nda fesih i\u015fleminin an\u0131lan Protokol&#8217;e de uygun olmad\u0131\u011f\u0131 belirtilmi\u015ftir. Dilek\u00e7ede son olarak; gelirinin %90 oran\u0131nda re\u00e7eteli i\u015flemlerden olu\u015ftu\u011fu, bu sebeple SGK ile anla\u015fma yapmadan ticari faaliyet y\u00fcr\u00fct\u00fclmesinin m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 vurgulanarak Protokol&#8217;deki tek tarafl\u0131 fesih d\u00fczenlemesinin h\u00fck\u00fcms\u00fcz oldu\u011fu bildirilmi\u015ftir.<\/p>\n<p>14. Ankara B\u00f6lge Adliye Mahkemesi 4. Hukuk Dairesi (Daire), 12\/2\/2019 tarihinde istinaf talebinin esastan reddine karar vermi\u015ftir. Gerek\u00e7ede; taraflar aras\u0131nda \u00f6zel hukuk kurallar\u0131na tabi bir s\u00f6zle\u015fme bulundu\u011fu ve an\u0131lan s\u00f6zle\u015fme h\u00fck\u00fcmlerinin taraflar\u0131 ba\u011flayaca\u011f\u0131 a\u00e7\u0131klanarak s\u00f6zle\u015fmenin uygulanmas\u0131ndan kaynaklanan uyu\u015fmazl\u0131klar\u0131n yine bu s\u00f6zle\u015fme h\u00fck\u00fcmleri uyar\u0131nca \u00e7\u00f6z\u00fcmlenmesi gerekti\u011fi belirtilmi\u015ftir. Bu kapsamda Protokol&#8217;\u00fcn 5.1. maddesi gere\u011fince SGK&#8217;n\u0131n fesih gerek\u00e7esi bildirmek zorunda olmad\u0131\u011f\u0131, basiretli bir tacir gibi davranmas\u0131 beklenen eczac\u0131n\u0131n s\u00f6zle\u015fme h\u00fck\u00fcmleri ile ba\u011fl\u0131 oldu\u011fu ayr\u0131ca taraflar\u0131n her zaman yeniden s\u00f6zle\u015fme yapma imk\u00e2n\u0131na sahip olduklar\u0131 ifade edilmi\u015ftir.<\/p>\n<p>15. Ba\u015fvurucu temyiz talebinde bulunmu\u015ftur. Dilek\u00e7ede; dava ve istinaf dilek\u00e7elerindeki hususlar tekrar edilerek kararlar\u0131n gerek\u00e7esiz oldu\u011fu, iddialar\u0131 tart\u0131\u015f\u0131lmadan ve herhangi bir delil toplanmadan karar verildi\u011fi ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr. Ayr\u0131ca an\u0131lan kararlarda s\u00f6zle\u015fme serbestisinden s\u00f6z edilmesine ra\u011fmen somut olayda s\u00f6zle\u015fme yapma mecburiyeti bulundu\u011fu zira eczanelerin SGK ile s\u00f6zle\u015fme yapmadan ticari hayatlar\u0131na devam etmelerinin m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 belirtilmi\u015ftir. Yarg\u0131tay 3. Hukuk Dairesi, 2\/7\/2020 tarihinde Dairenin karar\u0131n\u0131 usul ve yasaya uygun oldu\u011fu gerek\u00e7esiyle onam\u0131\u015ft\u0131r.<\/p>\n<p>16. Ba\u015fvurucu nihai karar\u0131 17\/7\/2020 tarihinde \u00f6\u011frenmi\u015f ve 10\/8\/2020 tarihinde bireysel ba\u015fvuruda bulunmu\u015ftur.<\/p>\n<p>IV. \u0130LG\u0130L\u0130 HUKUK<\/p>\n<p>17. 31\/5\/2006 tarihli ve 5510 say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanunu&#8217;nun 73. maddesinin birinci f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Bu Kanuna g\u00f6re sa\u011fl\u0131k hizmetleri, Kurum ile yurt i\u00e7indeki veya yurt d\u0131\u015f\u0131ndaki sa\u011fl\u0131k hizmeti sunucular\u0131 aras\u0131nda yap\u0131lan s\u00f6zle\u015fmeler yoluyla ve\/veya bu Kanun h\u00fck\u00fcmlerine uygun olarak genel sa\u011fl\u0131k sigortal\u0131s\u0131 ve bakmakla y\u00fck\u00fcml\u00fc oldu\u011fu ki\u015filerin s\u00f6zle\u015fmesiz sa\u011fl\u0131k hizmeti sunucular\u0131ndan sat\u0131n ald\u0131klar\u0131 sa\u011fl\u0131k hizmeti giderlerinin \u00f6denmesi suretiyle sa\u011flan\u0131r.&#8221;<\/p>\n<p>18. 25\/1\/1956 tarihli ve 6643 say\u0131l\u0131 T\u00fcrk Eczac\u0131lar\u0131 Birli\u011fi Kanunu&#8217;nun 39. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Merkez Heyetinin g\u00f6revleri \u015funlard\u0131r:<\/p>\n<p>&#8230;<\/p>\n<p>j) Eczanelerden sa\u011fl\u0131k hizmeti sat\u0131n alacak b\u00fct\u00fcn kamu ve \u00f6zel kurum ve kurulu\u015flarla anla\u015fmalar yapmak,imzalanan protokole uygun tip s\u00f6zle\u015fmeleri bast\u0131rmak ve belirleyece\u011fi bedel kar\u015f\u0131l\u0131\u011f\u0131 eczanelere da\u011f\u0131tmak,<\/p>\n<p>&#8230;&#8221;<\/p>\n<p>19. 18\/12\/1953 tarihli ve 6197 say\u0131l\u0131 Eczac\u0131lar ve Eczaneler Hakk\u0131nda Kanun&#8217;un 5. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Serbest eczaneler, eczac\u0131l\u0131k yapma hakk\u0131n\u0131 haiz bir eczac\u0131n\u0131n sahip ve mesul m\u00fcd\u00fcrl\u00fc\u011f\u00fcnde y\u00f6netmelikte belirlenen belgelerle il sa\u011fl\u0131k m\u00fcd\u00fcrl\u00fc\u011f\u00fcnce d\u00fczenlenmi\u015f ve valilik\u00e7e onaylanm\u0131\u015f bir ruhsatname ile a\u00e7\u0131l\u0131r.<\/p>\n<p>&#8230;<\/p>\n<p>Eczaneler i\u00e7in belediyeden ayr\u0131ca bir i\u015f yeri ruhsat\u0131 al\u0131nmas\u0131 ve belediyeye har\u00e7 \u00f6denmesi gerekmez. Eczaneler i\u00e7in ayr\u0131ca ba\u015fka herhangi bir kurum veya kurulu\u015ftan kay\u0131t veya onay belgesi aranmaz.<\/p>\n<p>&#8230;&#8221;<\/p>\n<p>20. 10\/8\/2005 tarihli ve 25902 say\u0131l\u0131 Resm\u00ee Gazete&#8217;de yay\u0131mlanan \u0130\u015fyeri A\u00e7ma ve \u00c7al\u0131\u015fma Ruhsatlar\u0131na \u0130li\u015fkin Y\u00f6netmelik&#8217;in 6. maddesinin birinci f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8221; Yetkili idarelerden usul\u00fcne uygun olarak i\u015fyeri a\u00e7ma ve \u00e7al\u0131\u015fma ruhsat\u0131 al\u0131nmadan i\u015fyeri a\u00e7\u0131lamaz ve \u00e7al\u0131\u015ft\u0131r\u0131lamaz. \u0130\u015fyerlerine bu Y\u00f6netmelikte belirtilen yetkili idareler d\u0131\u015f\u0131nda di\u011fer kamu kurum ve kurulu\u015flar\u0131 ile ilgili meslek kurulu\u015flar\u0131 taraf\u0131ndan \u00f6zel mevzuat\u0131na g\u00f6re verilen izinler ile tescil ve benzeri i\u015flemler bu Y\u00f6netmelik h\u00fck\u00fcmlerine g\u00f6re ruhsat alma m\u00fckellefiyetini ortadan kald\u0131rmaz. \u0130\u015fyeri a\u00e7ma ve \u00e7al\u0131\u015fma ruhsat\u0131 al\u0131nmadan a\u00e7\u0131lan i\u015fyerleri yetkili idareler taraf\u0131ndan kapat\u0131l\u0131r.&#8221;<\/p>\n<p>21. 24\/3\/2013 tarihli ve 28597 say\u0131l\u0131 Resm\u00ee Gazete&#8217;de yay\u0131mlanan Sosyal G\u00fcvenlik Kurumu Sa\u011fl\u0131k Uygulama Tebli\u011fi&#8217;nin &#8220;MEDULA sistemi&#8221; kenar ba\u015fl\u0131kl\u0131 5. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8221; (1) Kurumla s\u00f6zle\u015fmeli sa\u011fl\u0131k hizmeti sunucular\u0131na, sunduklar\u0131 sa\u011fl\u0131k hizmetlerine ili\u015fkin bedellerin \u00f6denebilmesi i\u00e7in Kurum mevzuat\u0131 gere\u011fi istenilen bilgilerin belirlenen istisnalar hari\u00e7 olmak \u00fczere MEDULA sistemine girilmesi zorunludur.<\/p>\n<p>&#8230;<\/p>\n<p>\u00a0(3) Ayr\u0131ca Kurumla s\u00f6zle\u015fmeli sa\u011fl\u0131k hizmeti sunucular\u0131n\u0131n, sunduklar\u0131 sa\u011fl\u0131k hizmetlerine ili\u015fkin bedellerin \u00f6denebilmesi i\u00e7in, Kurumca belirlenecek sa\u011fl\u0131k hizmetlerine ait olu\u015fturulan ulusal kay\u0131t formlar\u0131n\u0131 ve MEDULA sistemine girilmesi gerekli g\u00f6r\u00fclen geri \u00f6demeye esas te\u015fkil edecek di\u011fer bilgi\/belgelerini MEDULA sistemine girmesi zorunludur&#8230;<\/p>\n<p>\u00a0(4) Sunulan hizmete ili\u015fkin MEDULA sisteminden al\u0131nan provizyonlar \u00f6n izin niteli\u011finde olup mevzuat ile a\u00e7\u0131k\u00e7a belirtilmedi\u011fi s\u00fcrece tek ba\u015f\u0131na yeterli de\u011fildir. Sa\u011fl\u0131k hizmetine ili\u015fkin elektronik olarak sisteme eklenmemi\u015f kurallar\u0131n varl\u0131\u011f\u0131 halinde gerekli kontroller sa\u011fl\u0131k hizmeti sunucular\u0131nca yap\u0131l\u0131r.<\/p>\n<p>5. 2 &#8211; Fatura d\u00fczenlenmesi<\/p>\n<p>\u00a0(1) Sa\u011fl\u0131k hizmeti sunucular\u0131;<\/p>\n<p>a) MEDULA sisteminden provizyon alarak MEDULA sistemine kaydettikleri hizmetler i\u00e7in (SUT\u2019ta belirtilen istisnalar hari\u00e7) tek fatura\/e-fatura d\u00fczenler.<\/p>\n<p>b) MEDULA sisteminden provizyon al\u0131namamas\u0131 nedeniyle MEDULA sistemine kaydedilemeyen a\u015fa\u011f\u0131da say\u0131lan hizmetler i\u00e7in ayr\u0131 manuel fatura d\u00fczenler.<\/p>\n<p>&#8230;&#8221;<\/p>\n<p>22. Protokol&#8217;\u00fcn &#8220;S\u00f6zle\u015fmenin Feshi ve Cezai \u015eartlar&#8221; kenar ba\u015fl\u0131kl\u0131 5. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;5.1. Taraflar bir ay \u00f6nceden yaz\u0131l\u0131 bildirimde bulunmak \u015fart\u0131yla s\u00f6zle\u015fmeyi her zaman feshedebilir.<\/p>\n<p>5.2. Bu Protokol\u00fcn (5) numaral\u0131 maddesinde yer alan fiillerin tespiti halinde 15 (on be\u015f) g\u00fcn s\u00fcre verilerek eczac\u0131n\u0131n yaz\u0131l\u0131 savunmas\u0131 istenir&#8230; Savunma talep yaz\u0131s\u0131n\u0131n tebli\u011f tarihinden itibaren 15 (on be\u015f) g\u00fcn i\u00e7inde eczac\u0131 savunmas\u0131n\u0131 verir. S\u00fcresi i\u00e7erisinde savunma verilmemesi halinde Kurumca i\u015flemlere devam edilir&#8230; <\/p>\n<p>&#8230;<\/p>\n<p>5.3.1. Re\u00e7etede yaz\u0131lan ilac\u0131n eczanede bulundu\u011fu halde eczanede bulunan ilac\u0131n verilmedi\u011finin ve\/veya re\u00e7ete kar\u015f\u0131lamada re\u00e7ete veya hasta se\u00e7imi yap\u0131ld\u0131\u011f\u0131n\u0131n ve\/veya re\u00e7ete sahibinin kurallara uygun yaz\u0131lm\u0131\u015f ve provizyon sisteminin onay verdi\u011fi re\u00e7etesinde yer alan ilac\u0131 hastaya bedeli kar\u015f\u0131l\u0131\u011f\u0131nda sat\u0131ld\u0131\u011f\u0131n\u0131n tespiti halinde, eczane yaz\u0131l\u0131 olarak uyar\u0131l\u0131r, tekrar\u0131 halinde s\u00f6zle\u015fme feshedilir ve 2 (iki) ay s\u00fcre ile s\u00f6zle\u015fme yap\u0131lmaz&#8230;<\/p>\n<p>5.3.2. Eczac\u0131n\u0131n Kuruma fatura etti\u011fi re\u00e7etelerde&#8230; bulunmas\u0131 gereken ve re\u00e7ete muhteviyat\u0131 ila\u00e7lar\u0131n re\u00e7ete sahibine ya da ilac\u0131 alana teslim edildi\u011fine ili\u015fkin imzan\u0131n, re\u00e7ete sahibine veya ilac\u0131 alana ait olmad\u0131\u011f\u0131n\u0131n denetim ile tespitinin kesinlik kazanmas\u0131 halinde, re\u00e7ete bedelinin 2 (iki) kat\u0131 tutar\u0131nda cezai \u015fart uygulanarak eczac\u0131 yaz\u0131l\u0131 olarak uyar\u0131l\u0131r, tekrar\u0131 halinde re\u00e7ete bedelinin 5 (be\u015f) kat\u0131 tutar\u0131nda cezai \u015fart uygulanarak s\u00f6zle\u015fme feshedilir ve 1 (bir) ay s\u00fcre ile s\u00f6zle\u015fme yap\u0131lmaz&#8230;<\/p>\n<p>5.3.3. S\u00f6zle\u015fmesi feshedilen eczac\u0131ya ait re\u00e7etelerin Kurum ile s\u00f6zle\u015fmeli eczac\u0131 taraf\u0131ndan Kuruma fatura edilmesi halinde, re\u00e7ete bedelinin 10 (on) kat\u0131 tutar\u0131nda cezai \u015fart uygulanarak eczac\u0131 uyar\u0131l\u0131r. Tekrar\u0131 halinde re\u00e7ete bedelinin 20 (yirmi) kat\u0131 tutar\u0131nda cezai \u015fart uygulanarak s\u00f6zle\u015fme feshedilir ve 6 (alt\u0131) ay s\u00fcre ile s\u00f6zle\u015fme yap\u0131lmaz.<\/p>\n<p>5.3.4. Re\u00e7etede yaz\u0131l\u0131 ila\u00e7 yerine farmas\u00f6tik e\u015fde\u011fer olmayan ila\u00e7 verilmesi durumunda 500 (be\u015f y\u00fcz) TL\u2019den az 1000 (bin) TL\u2019den fazla olmamak \u00fczere ila\u00e7 bedelinin 5 (be\u015f) kat\u0131 tutar\u0131nda cezai \u015fart uygulan\u0131r. Bu maddenin uygulanmas\u0131nda re\u00e7etenin kar\u015f\u0131land\u0131\u011f\u0131 tarihteki Kurum provizyon sistemindeki e\u015fde\u011fer tablosu dikkate al\u0131n\u0131r. <\/p>\n<p>5.3.5. Kurum, \u0130l Sa\u011fl\u0131k M\u00fcd\u00fcrl\u00fc\u011f\u00fc veya Eczac\u0131 Odas\u0131 taraf\u0131ndan eczanede yap\u0131lan denetimde, re\u00e7ete sahibi veya ilac\u0131 alan ki\u015fiye teslim edilmeyen ila\u00e7lara ait re\u00e7etelerin Kuruma fatura edildi\u011finin tespiti halinde ila\u00e7 bedelinin 2 (iki) kat\u0131 tutar\u0131nda cezai \u015fart uygulanarak eczac\u0131 uyar\u0131l\u0131r. Tekrar\u0131 halinde ila\u00e7 bedelinin 10 (on) kat\u0131 tutar\u0131nda cezai \u015fart uygulanarak s\u00f6zle\u015fme feshedilir ve 3 (\u00fc\u00e7) ay s\u00fcre ile s\u00f6zle\u015fme yap\u0131lmaz&#8230;<\/p>\n<p>5.3.6. &#8230; al\u0131nmas\u0131 gereken ila\u00e7 kat\u0131l\u0131m paylar\u0131 ve\/veya ayakta tedavide hekim ve di\u015f hekimi muayenesi kat\u0131l\u0131m paylar\u0131n\u0131, ve\/veya e\u015fde\u011fer ila\u00e7 uygulamas\u0131 nedeniyle olu\u015fan fiyat farklar\u0131n\u0131 tahsil etmeyen veya hastaya iade eden eczac\u0131lara, ilk tespitte 1000 (bin) TL cezai \u015fart uygulanarak eczane yaz\u0131l\u0131 olarak uyar\u0131l\u0131r, yaz\u0131l\u0131 uyar\u0131ya ra\u011fmen tekrar\u0131 halinde s\u00f6zle\u015fme feshedilir ve 1 (Bir) ay s\u00fcre ile s\u00f6zle\u015fme yap\u0131lmaz&#8230; <\/p>\n<p>5.3.7. Resmi veya \u00f6zel sa\u011fl\u0131k kurum ve kurulu\u015flar\u0131na ait ila\u00e7lar\u0131n kup\u00fcrlerinin veya bedeli daha \u00f6nce \u00f6denmi\u015f re\u00e7etelere ait kup\u00fcrlerin Kuruma fatura edildi\u011finin tespit edilmesi halinde 3.000 (\u00fc\u00e7 bin) TL cezai \u015fart uygulan\u0131r. Bu madde protokol\u00fcn imzalanmas\u0131ndan itibaren 1 (bir) y\u0131l ge\u00e7erlidir.<\/p>\n<p>5.3.8. Kuruma fatura edilen re\u00e7etede ya da re\u00e7ete ekinde bulunmas\u0131 gereken belgelerde (e-re\u00e7ete ve\/veya e-rapor olarak d\u00fczenlenenler hari\u00e7) (t\u0131bbi bilgi ve belgeler de dahil olmak \u00fczere) eczac\u0131 veya eczane \u00e7al\u0131\u015fanlar\u0131 taraf\u0131ndan tahrifat yap\u0131ld\u0131\u011f\u0131n\u0131n ve Kurum zarar\u0131n\u0131n olu\u015ftu\u011funun tespiti halinde re\u00e7ete bedelinin 10 (on) kat\u0131 tutar\u0131nda cezai \u015fart uygulanarak eczac\u0131 uyar\u0131l\u0131r. Tekrar\u0131 halinde re\u00e7ete bedelinin 20 (yirmi) kat\u0131 tutar\u0131nda cezai \u015fart uygulanarak s\u00f6zle\u015fme feshedilir ve 1 (bir) y\u0131l s\u00fcreyle s\u00f6zle\u015fme yap\u0131lmaz.<\/p>\n<p>5.3.9. Kurumca yap\u0131lan incelemeler neticesinde provizyon sistemine ger\u00e7e\u011fe ayk\u0131r\u0131 re\u00e7ete kayd\u0131 yap\u0131larak Kuruma fatura edildi\u011finin tespiti halinde re\u00e7ete bedelinin 5 (be\u015f) kat\u0131 tutar\u0131nda cezai \u015fart uygulanarak eczac\u0131ya ilk uyar\u0131 tebli\u011f edilir. \u0130lk uyar\u0131n\u0131n tebli\u011f tarihinden itibaren 1 (bir) y\u0131l i\u00e7erisinde fiilin tekrar i\u015flendi\u011finin tespiti halinde re\u00e7ete bedelinin 10 (on) kat\u0131 tutar\u0131nda cezai \u015fart uygulanarak eczac\u0131ya ikinci uyar\u0131 tebli\u011f edilir. \u0130lk uyar\u0131n\u0131n tebli\u011f tarihinden itibaren bir y\u0131l i\u00e7erisinde, ikinci uyar\u0131dan sonra fiilin yeniden (\u00fc\u00e7\u00fcnc\u00fc kez) i\u015flendi\u011finin tespit edilmesi halinde re\u00e7ete bedelinin 20 (yirmi) kat\u0131 tutar\u0131nda cezai \u015fart uygulanarak s\u00f6zle\u015fme feshedilir ve 1 (bir) y\u0131l s\u00fcreyle s\u00f6zle\u015fme yap\u0131lmaz&#8230;<\/p>\n<p>5.3.10. Eczac\u0131 ya da eczane \u00e7al\u0131\u015fanlar\u0131nca Kurumu zarara u\u011fratmak amac\u0131yla kas\u0131tl\u0131 olarak Kuruma sahte ila\u00e7 fiyat kup\u00fcr\u00fc\/sahte karekod, sahte re\u00e7ete veya sahte rapor fatura edildi\u011finin tespiti halinde re\u00e7ete bedelinin 10 (on) kat\u0131 tutar\u0131nda cezai \u015fart uygulanarak eczac\u0131 uyar\u0131l\u0131r. Tekrar\u0131 halinde re\u00e7ete bedelinin 20 (yirmi) kat\u0131 tutar\u0131nda cezai \u015fart uygulanarak s\u00f6zle\u015fme feshedilir ve 1 (bir) y\u0131l s\u00fcreyle s\u00f6zle\u015fme yap\u0131lmaz&#8230;<\/p>\n<p>5.3.11. Eczac\u0131, Kurum ile Kuruma ba\u011fl\u0131 vak\u0131f, dernek gibi kurulu\u015flara ba\u011f\u0131\u015f yapamaz, hediye vb. \u015fekilde katk\u0131da bulunamaz. Bu durumun tespit edilmesi halinde s\u00f6zle\u015fme feshedilir, 3 (\u00fc\u00e7) ay s\u00fcre ile s\u00f6zle\u015fme yap\u0131lmaz&#8230; Tespit i\u015fleminin, ilgili eczac\u0131 odas\u0131nca yap\u0131lmas\u0131 ve T\u00fcrk Eczac\u0131lar\u0131 Birli\u011fi Merkez Heyetince onaylanarak Kuruma yaz\u0131l\u0131 olarak bildirilmesi halinde Kurumca fesih yap\u0131l\u0131r. Yarg\u0131 karar\u0131 ile haks\u0131z yap\u0131ld\u0131\u011f\u0131na karar verilen tespitler nedeniyle s\u00f6zle\u015fmesi feshedilen eczac\u0131n\u0131n u\u011frad\u0131\u011f\u0131 her t\u00fcrl\u00fc maddi ve manevi zarar, tespiti yapan eczac\u0131 odas\u0131 ile T\u00fcrk Eczac\u0131lar\u0131 Birli\u011fince m\u00fcteselsilen kar\u015f\u0131lan\u0131r&#8230;<\/p>\n<p>5.3.12. Eczanenin muvazaal\u0131 olarak faaliyet g\u00f6sterdi\u011fine ili\u015fkin bulgular\u0131n tespit edilmesi halinde&#8230; Kurum gerekli incelemeleri yapar. Bu s\u00fcre\u00e7 i\u00e7erisinde Sa\u011fl\u0131k M\u00fcd\u00fcrl\u00fc\u011f\u00fcnden ve\/veya TEB\u2019den eczanenin muvazaal\u0131 oldu\u011funa dair bilgi\/karar gelmesi halinde s\u00f6zle\u015fme feshedilir. <\/p>\n<p>&#8230;<\/p>\n<p>Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131 taraf\u0131ndan muvazaal\u0131 eczane i\u015fletmesi nedeni ile ruhsatnamesi iptal edilmi\u015f eczac\u0131 ile 5 (be\u015f) y\u0131l s\u00fcre ile s\u00f6zle\u015fme yap\u0131lmaz..<\/p>\n<p>&#8230;&#8221;<\/p>\n<p>23. Protokol&#8217;\u00fcn &#8220;Cezai \u015eart ve Feshe \u0130li\u015fkin Genel H\u00fck\u00fcmler&#8221; kenar ba\u015fl\u0131kl\u0131 6. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;&#8230;<\/p>\n<p>6.9. Fesih nedeniyle s\u00f6zle\u015fme yap\u0131lmayacak s\u00fcre doldu\u011funda, feshe ili\u015fkin yarg\u0131 s\u00fcreci devam etse d\u00e2hi Eczac\u0131n\u0131n talebi halinde s\u00f6zle\u015fme yap\u0131l\u0131r.<\/p>\n<p>&#8230;&#8221;<\/p>\n<p>V. \u0130NCELEME VE GEREK\u00c7E<\/p>\n<p>24. Anayasa Mahkemesinin 2\/10\/2024 tarihinde yapm\u0131\u015f oldu\u011fu toplant\u0131da ba\u015fvuru incelenip gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. \u00d6zel Hayata Sayg\u0131 Hakk\u0131n\u0131n \u0130hlal Edildi\u011fine \u0130li\u015fkin \u0130ddia<\/p>\n<p>1. Ba\u015fvurucunun \u0130ddialar\u0131 ve Bakanl\u0131k G\u00f6r\u00fc\u015f\u00fc<\/p>\n<p>25. Ba\u015fvurucu; somut hi\u00e7bir neden bulunmaks\u0131z\u0131n ger\u00e7ekle\u015ftirilen fesih i\u015fleminin hukuka ayk\u0131r\u0131 oldu\u011funu, nitekim SGK&#8217;ya bir\u00e7ok kez ba\u015fvurmas\u0131na ra\u011fmen ileri g\u00fcvenlik soru\u015fturmas\u0131 nedeniyle i\u015flem tesis edildi\u011finin belirtilmesi ile yetinildi\u011fini \u00f6ne s\u00fcrm\u00fc\u015ft\u00fcr. Ba\u015fvurucu, yarg\u0131lama a\u015famas\u0131nda da Protokol&#8217;de yer alan fesih nedenleri aras\u0131nda g\u00fcvenlik soru\u015fturmas\u0131na ili\u015fkin bir d\u00fczenleme bulunmad\u0131\u011f\u0131n\u0131 beyan etti\u011fini ancak yarg\u0131 mercilerince soyut ve genel ge\u00e7er ifadeler ile ret karar\u0131 verildi\u011fini belirtmi\u015ftir. Medula sisteminin kapat\u0131lmas\u0131 nedeniyle ila\u00e7 sat\u0131\u015f\u0131 yapamad\u0131\u011f\u0131n\u0131 ifade eden ba\u015fvurucu, gelirinin tamam\u0131na yak\u0131n\u0131n\u0131 kaybetti\u011fi gibi \u015fahsi ve mesleki itibar\u0131n\u0131n da zedelendi\u011fini vurgulayarak gerek\u00e7eli karar hakk\u0131n\u0131n, maddi ve manevi varl\u0131\u011f\u0131n korunmas\u0131 ve geli\u015ftirilmesi hakk\u0131n\u0131n, \u00e7al\u0131\u015fma hakk\u0131n\u0131n ve \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ihlal edildi\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr.<\/p>\n<p>26. Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcnde ba\u015fvurucu taraf\u0131ndan ileri s\u00fcr\u00fclen iddialar\u0131n kanun yolu \u015fik\u00e2yeti niteli\u011finde olup olmad\u0131\u011f\u0131n\u0131n, yap\u0131lacak kabul edilebilirlik incelemesinde dikkate al\u0131nmas\u0131 gerekti\u011fi belirtilmi\u015ftir. G\u00f6r\u00fc\u015fte ayr\u0131ca, masumiyet karinesinin ihlali iddias\u0131 bak\u0131m\u0131ndan yarg\u0131 mercilerinin de\u011ferlendirmesinin, ba\u015fvurucuya ceza yarg\u0131lamas\u0131 anlam\u0131nda su\u00e7 isnat eden ya da ba\u015fvurucunun su\u00e7lu oldu\u011funu ifade veya ima eden bir tespiti i\u00e7ermedi\u011fi ifade edilmi\u015ftir. Sonu\u00e7 olarak, mevcut ba\u015fvuruda ba\u015fvurucunun adil yarg\u0131lanma hakk\u0131 kapsam\u0131nda masumiyet karinesinin ihlal edilip edilmedi\u011fi konusunda inceleme yap\u0131l\u0131rken yukar\u0131da yer verilen Anayasa ve ilgili mevzuat h\u00fck\u00fcmleri, Anayasa Mahkemesi i\u00e7tihatlar\u0131 ve somut olay\u0131n kendine \u00f6zg\u00fc ko\u015fullar\u0131 dikkate al\u0131narak bir inceleme yap\u0131lmas\u0131 gerekti\u011fi bildirilmi\u015ftir. Ba\u015fvurucu, Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 verdi\u011fi cevapta bireysel ba\u015fvuru formundaki beyanlar\u0131n\u0131 tekrar ederek ayn\u0131 y\u00f6ndeki uzman m\u00fctalaas\u0131n\u0131 sunmu\u015ftur.<\/p>\n<p>B. De\u011ferlendirme<\/p>\n<p>27. Anayasa\u2019n\u0131n &#8220;\u00d6zel hayat\u0131n gizlili\u011fi&#8221; kenar ba\u015fl\u0131kl\u0131 20. maddesinin birinci f\u0131kras\u0131n\u0131n ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>\u201cHerkes, \u00f6zel hayat\u0131na &#8230; sayg\u0131 g\u00f6sterilmesini isteme hakk\u0131na sahiptir. \u00d6zel hayat\u0131n &#8230; gizlili\u011fine dokunulamaz.&#8221;<\/p>\n<p>28. Anayasa Mahkemesi, olaylar\u0131n ba\u015fvurucu taraf\u0131ndan yap\u0131lan hukuki nitelendirmesi ile ba\u011fl\u0131 olmay\u0131p olay ve olgular\u0131n hukuki tavsifini kendisi takdir eder (Tahir Canan, B. No: 2012\/969, 18\/9\/2013, \u00a7 16).<\/p>\n<p>1. Uygulanabilirlik Y\u00f6n\u00fcnden<\/p>\n<p>29. Ba\u015fvurucunun iddialar\u0131n\u0131n Protokol&#8217;e ba\u011fl\u0131 olarak imzalanan Tip S\u00f6zle\u015fmenin haks\u0131z \u015fekilde feshedilmesinin sonucu olarak SGK kapsam\u0131ndaki ki\u015filere ila\u00e7 sat\u0131\u015f\u0131n\u0131n engellenmesine ili\u015fkin oldu\u011fu g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Mesleki hayata y\u00f6nelik bu t\u00fcr tedbirlerin ya da m\u00fcdahalelerin hangi durumlarda \u00f6zel hayat ba\u011flam\u0131nda uygulanabilir oldu\u011fu hususunda belirlenen \u00f6l\u00e7\u00fctler C.A. (3)([GK], B. No: 2018\/10286, 2\/7\/2020, \u00a7\u00a7 90-96) karar\u0131nda a\u00e7\u0131klanm\u0131\u015ft\u0131r.<\/p>\n<p>30. \u00d6zel eczane i\u015fleten ba\u015fvurucunun ila\u00e7 al\u0131m\u0131, sat\u0131m\u0131, re\u00e7ete giri\u015fi gibi bir\u00e7ok faaliyetini SGK ile yap\u0131lan Protokol \u00e7er\u00e7evesinde yerine getirebildi\u011fi anla\u015f\u0131lmaktad\u0131r. Ancak ba\u015fvurucunun Tip S\u00f6zle\u015fmesinin feshedildi\u011fi g\u00f6zetildi\u011finde i\u015fletmekte oldu\u011fu eczanenin ila\u00e7 satmas\u0131n\u0131n ve faaliyetlerine devam etmesinin m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 s\u00f6ylenebilir. Bu durumda ba\u015fvurucunun SGK anla\u015fmas\u0131n\u0131n feshedilmesinin, ba\u015fvurucu hakk\u0131ndaki i\u015flemin ba\u015fkalar\u0131yla mesle\u011fi \u00e7er\u00e7evesinde ili\u015fki kurabilme ve geli\u015ftirebilme imk\u00e2n\u0131n\u0131n \u00f6nemli \u00f6l\u00e7\u00fcde zay\u0131flamas\u0131na, mesle\u011fini devam ettirebilmesi, sosyal ve mesleki itibar\u0131n\u0131 koruyabilmesi a\u00e7\u0131s\u0131ndan ciddi sonu\u00e7lar do\u011furmas\u0131na yol a\u00e7aca\u011f\u0131 anla\u015f\u0131lm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla ba\u015fvurucunun SGK anla\u015fmas\u0131n\u0131n feshedilmesinin g\u00fcvenlik soru\u015fturmas\u0131 ile elde edilen ki\u015fisel verilere dayand\u0131\u011f\u0131 ayr\u0131ca fesih i\u015fleminin ba\u015fvurucunun \u00f6zel hayat\u0131na ciddi \u015fekilde etki etti\u011fi ve bu etkinin belirli bir a\u011f\u0131rl\u0131k d\u00fczeyine ula\u015ft\u0131\u011f\u0131 g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Neticede somut ba\u015fvurunun sonuca dayal\u0131 olarak \u00f6zel hayata sayg\u0131 hakk\u0131 kapsam\u0131nda incelenebilir nitelikte oldu\u011fu belirlendi\u011finden an\u0131lan kararda belirtilen ilkelerden ayr\u0131lmay\u0131 gerektiren bir y\u00f6n bulunmad\u0131\u011f\u0131 de\u011ferlendirilmi\u015ftir.<\/p>\n<p>2. Kabul Edilebilirlik Y\u00f6n\u00fcnden<\/p>\n<p>31. A\u00e7\u0131k\u00e7a dayanaktan yoksun olmad\u0131\u011f\u0131 ve kabul edilemezli\u011fine karar verilmesini gerektirecek ba\u015fka bir neden de bulunmad\u0131\u011f\u0131 anla\u015f\u0131lan \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ihlal edildi\u011fine ili\u015fkin iddian\u0131n kabul edilebilir oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>3. Devlet i\u00e7in \u00f6ng\u00f6r\u00fclen negatif y\u00fck\u00fcml\u00fcl\u00fckler, her durumda \u00f6zel hayata sayg\u0131 hakk\u0131na keyf\u00ee surette m\u00fcdahaleden ka\u00e7\u0131nmay\u0131 gerekli k\u0131lar. Pozitif y\u00fck\u00fcml\u00fcl\u00fckler de \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n korunmas\u0131n\u0131 ve bireyler aras\u0131 ili\u015fkiler alan\u0131nda olsa da \u00f6zel hayata sayg\u0131n\u0131n g\u00fcvencelerini sa\u011flamaya y\u00f6nelik olaya \u00f6zg\u00fc tedbirlerin al\u0131nmas\u0131n\u0131 zorunlu k\u0131lar (benzer y\u00f6ndeki de\u011ferlendirmeler i\u00e7in bkz. Ba\u015fvurucunun SGK kapsam\u0131ndaki ki\u015filere ila\u00e7 sat\u0131\u015f\u0131na imk\u00e2n sa\u011flayan Tip S\u00f6zle\u015fme SGK taraf\u0131ndan tek tarafl\u0131 olarak feshedilmi\u015ftir. SGK&#8217;n\u0131n kamu ve \u00f6zel sekt\u00f6rde \u00e7al\u0131\u015fan herkesi kapsayacak \u015fekilde sosyal g\u00fcvenlik alan\u0131nda faaliyet g\u00f6steren ve kamu g\u00fcc\u00fcn\u00fcn ayr\u0131cal\u0131klar\u0131 ile donat\u0131lm\u0131\u015f bir kamu kurumu oldu\u011fu bilinmektedir. Ayr\u0131ca Tip S\u00f6zle\u015fmelerin haz\u0131rlanmas\u0131nda eczac\u0131lar\u0131n hi\u00e7bir iradesi bulunmad\u0131\u011f\u0131 gibi Protokol gere\u011fince SGK&#8217;n\u0131n, s\u00f6zle\u015fmenin taraf\u0131 olan eczanelere -Protokol&#8217;e ayk\u0131r\u0131l\u0131k te\u015fkil eden belirli davran\u0131\u015flar\u0131 h\u00e2linde- idari nitelikte cezalar verme yetkisinin bulundu\u011fu anla\u015f\u0131lmaktad\u0131r. Dolay\u0131s\u0131yla somut olaydaki hukuki ili\u015fkinin kamu g\u00fcc\u00fcn\u00fcn etkisi alt\u0131nda \u015fekillendi\u011fi ve ba\u015fvurucunun \u00f6zel hayat\u0131na y\u00f6nelen m\u00fcdahalenin kamu kurumunun fesih i\u015fleminden kaynakland\u0131\u011f\u0131 dikkate al\u0131nd\u0131\u011f\u0131nda ba\u015fvurunun devletin negatif y\u00fck\u00fcml\u00fcl\u00fckleri ba\u011flam\u0131nda incelenmesi gerekti\u011fi de\u011ferlendirilmi\u015ftir (benzer y\u00f6ndeki de\u011ferlendirmeler i\u00e7in bkz. C.A. (3) \u00a7 104).<\/p>\n<p>a. M\u00fcdahalenin Varl\u0131\u011f\u0131<\/p>\n<p>34. Ba\u015fvurucunun SGK ile yapt\u0131\u011f\u0131 s\u00f6zle\u015fmenin feshedilmesi, s\u00f6z konusu i\u015flemin haks\u0131z olarak ger\u00e7ekle\u015fti\u011fi iddias\u0131n\u0131n yarg\u0131 mercilerince reddedilmesi ve bu suretle SGK kapsam\u0131ndaki ki\u015filere ila\u00e7 sat\u0131\u015f\u0131ndan al\u0131konulmas\u0131 nedeniyle ba\u015fvurucunun mesleki hayat\u0131na m\u00fcdahalede bulunuldu\u011fu sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla s\u00f6zle\u015fmenin feshine ili\u015fkin al\u0131nan kararla kamusal bir makam taraf\u0131ndan ba\u015fvurucunun \u00f6zel hayat\u0131na sayg\u0131 hakk\u0131na bir m\u00fcdahalede bulunuldu\u011fu a\u00e7\u0131kt\u0131r.<\/p>\n<p>b. M\u00fcdahalenin \u0130hlal Olu\u015fturup Olu\u015fturmad\u0131\u011f\u0131<\/p>\n<p>35. Anayasa\u2019n\u0131n 13. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Temel hak ve h\u00fcrriyetler, \u00f6zlerine dokunulmaks\u0131z\u0131n yaln\u0131zca Anayasan\u0131n ilgili maddelerinde belirtilen sebeplere ba\u011fl\u0131 olarak ve ancak kanunla s\u0131n\u0131rlanabilir. Bu s\u0131n\u0131rlamalar, Anayasan\u0131n s\u00f6z\u00fcne ve ruhuna, demokratik toplum d\u00fczeninin ve l\u00e2ik Cumhuriyetin gereklerine ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olamaz.&#8221;<\/p>\n<p>36. Yukar\u0131da belirlenen m\u00fcdahale, Anayasa\u2019n\u0131n 13. maddesinde belirtilen ko\u015fullara uygun olmad\u0131\u011f\u0131 takdirde Anayasa\u2019n\u0131n 20. maddesini ihlal edecektir. Bu sebeple s\u0131n\u0131rlaman\u0131n Anayasa\u2019n\u0131n 13. maddesinde \u00f6ng\u00f6r\u00fclen ve somut ba\u015fvuruya uygun d\u00fc\u015fen, kanun taraf\u0131ndan \u00f6ng\u00f6r\u00fclme, me\u015fru ama\u00e7 ta\u015f\u0131ma, demokratik toplum d\u00fczeninin gereklerine ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olmama kriterlerine uygun olup olmad\u0131\u011f\u0131n\u0131n belirlenmesi gerekir (Halil Berk, B. No: 2017\/31619, 23\/7\/2020, \u00a7 82).<\/p>\n<p>\u00a0(1) Kanunilik <\/p>\n<p>37. Yarg\u0131 mercileri, somut olaya konu olan m\u00fcdahalenin Protokol&#8217;de yer verilen feshe ili\u015fkin d\u00fczenlemelere dayand\u0131\u011f\u0131n\u0131 kabul etmi\u015ftir. Protokol&#8217;\u00fcn yasal dayana\u011f\u0131n\u0131 5510 say\u0131l\u0131 Kanun&#8217;un 73. maddesi ile 6643 say\u0131l\u0131 Kanun&#8217;un 39. maddesi olu\u015fturmaktad\u0131r. TEB, 6643 say\u0131l\u0131 Kanun&#8217;un verdi\u011fi yetki dahilinde SGK kapsam\u0131ndaki ki\u015filere ila\u00e7 sat\u0131\u015f\u0131 yapmay\u0131 talep eden eczac\u0131lar ile Protokol&#8217;e uygun olarak haz\u0131rlanan Tip S\u00f6zle\u015fmeleri imzalamaktad\u0131r. Somut olayda da ba\u015fvurucu ile TEB aras\u0131nda an\u0131lan s\u00f6zle\u015fmenin yap\u0131ld\u0131\u011f\u0131 a\u00e7\u0131kt\u0131r. Bununla birlikte an\u0131lan kanun maddelerinin somut ba\u015fvuruya konu m\u00fcdahaleye dayanak olu\u015fturdu\u011fu yarg\u0131 merciilerince a\u00e7\u0131k\u00e7a ortaya konulmam\u0131\u015ft\u0131r. An\u0131lan tespitlerle birlikte ba\u015fvurunun niteli\u011fi ve kapsam\u0131 itibar\u0131yla, incelemeye devam edilerek somut olaya konu m\u00fcdahalenin demokratik toplum d\u00fczeninin gereklerine uygun olup olmad\u0131\u011f\u0131na y\u00f6nelik de\u011ferlendirme yap\u0131lmas\u0131 gerekti\u011fi anla\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>\u00a0(2) Me\u015fru Ama\u00e7 <\/p>\n<p>38. Ki\u015finin mesle\u011fi, \u00f6zel hayat\u0131n\u0131n bir par\u00e7as\u0131 olarak nitelendirildi\u011fi s\u00fcrece mesle\u011fe, dolay\u0131s\u0131yla \u00f6zel hayata sayg\u0131 hakk\u0131na y\u00f6nelik m\u00fcdahalelerin me\u015fru bir amaca dayanmas\u0131 gerekir. Somut olayda da Protokol&#8217;\u00fcn taraf\u0131 olan ve kamu g\u00fcc\u00fcn\u00fc kullanan SGK, -yarg\u0131 mercilerinin kabul\u00fcne g\u00f6re- ba\u015fvurucunun devletin mill\u00ee g\u00fcvenli\u011fine kar\u015f\u0131 faaliyette bulundu\u011funa karar verilen yap\u0131, olu\u015fum veya gruplara \u00fcyeli\u011fi, mensubiyeti veya iltisak\u0131 oldu\u011fu gerek\u00e7esiyle i\u015f s\u00f6zle\u015fmesini feshetmi\u015ftir. \u00d6zellikle kamu g\u00fcc\u00fcn\u00fc kullanan idarelerin mill\u00ee g\u00fcvenli\u011fin ve kamu d\u00fczeninin korunmas\u0131 ile kamu hizmetinin s\u00fcrd\u00fcr\u00fclebilirli\u011finin sa\u011flanmas\u0131 amac\u0131n\u0131 ta\u015f\u0131d\u0131klar\u0131 durumlarda takdir yetkilerinin daha geni\u015f oldu\u011fu s\u00f6ylenebilir. Dolay\u0131s\u0131yla \u00f6zel hayata sayg\u0131 hakk\u0131na m\u00fcdahale te\u015fkil eden mesle\u011fe ili\u015fkin tedbirlerde mill\u00ee g\u00fcvenli\u011fin ve kamu d\u00fczeninin korunmas\u0131n\u0131n, kamu hizmetinin s\u00fcrd\u00fcr\u00fclebilirli\u011finin sa\u011flanmas\u0131n\u0131n hakk\u0131n do\u011fas\u0131ndan kaynaklanan bir s\u0131n\u0131rland\u0131rma nedeni olarak kabul edilebilece\u011fi de\u011ferlendirilmektedir. Bu ba\u011flamda somut olay \u00f6zelinde SGK taraf\u0131ndan ba\u015fvurucunun \u00f6zel hayat\u0131na sayg\u0131 hakk\u0131na y\u00f6nelen m\u00fcdahalenin s\u00f6z konusu s\u0131n\u0131rlama nedenlerine dayand\u0131\u011f\u0131 ve bu suretle me\u015fru ama\u00e7 unsurunu ta\u015f\u0131d\u0131\u011f\u0131 sonucuna var\u0131lm\u0131\u015ft\u0131r (benzer y\u00f6ndeki de\u011ferlendirmeler i\u00e7in bkz. C.A. (3) [GK], \u00a7\u00a7 109-113).<\/p>\n<p>\u00a0(3) Demokratik Toplum D\u00fczeninin Gereklerine Uygunluk ve \u00d6l\u00e7\u00fcl\u00fcl\u00fck <\/p>\n<p>\u00a0(a) Genel \u0130lkeler <\/p>\n<p>39. Anayasa Mahkemesi kararlar\u0131na g\u00f6re demokratik toplum d\u00fczeninin gerekleri kavram\u0131 \u00f6ncelikle ilgili hak y\u00f6n\u00fcnden getirilen s\u0131n\u0131rlamalar\u0131n zorunlu ya da istisnai tedbir niteli\u011finde olmas\u0131n\u0131, ba\u015fvurulabilecek en son \u00e7are ya da al\u0131nabilecek en son \u00f6nlem olarak kendisini g\u00f6stermesini gerektirmektedir. Anayasa\u2019n\u0131n 13. maddesinde demokratik toplum d\u00fczeninin gerekleri ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck kriterleri iki ayr\u0131 \u00f6l\u00e7\u00fct olarak d\u00fczenlenmi\u015f olmakla birlikte bu iki \u00f6l\u00e7\u00fct aras\u0131nda ayr\u0131lmaz bir ili\u015fki vard\u0131r. \u00d6l\u00e7\u00fcl\u00fcl\u00fck ilkesinin amac\u0131 temel hak ve \u00f6zg\u00fcrl\u00fcklerin gere\u011finden fazla s\u0131n\u0131rland\u0131r\u0131lmas\u0131n\u0131n \u00f6nlenmesidir. Anayasa Mahkemesi kararlar\u0131 uyar\u0131nca \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesi, s\u0131n\u0131rlama i\u00e7in kullan\u0131lan arac\u0131n s\u0131n\u0131rlama amac\u0131n\u0131 ger\u00e7ekle\u015ftirmeye uygun olmas\u0131n\u0131 ifade eden elveri\u015flilik, s\u0131n\u0131rlay\u0131c\u0131 \u00f6nlemin s\u0131n\u0131rlama amac\u0131na ula\u015fmak bak\u0131m\u0131ndan zorunlu olmas\u0131na i\u015faret eden gereklilik ve ara\u00e7la amac\u0131n orant\u0131s\u0131z bir \u00f6l\u00e7\u00fc i\u00e7inde bulunmamas\u0131 ile s\u0131n\u0131rlaman\u0131n \u00f6l\u00e7\u00fcs\u00fcz bir y\u00fck\u00fcml\u00fcl\u00fck getirmemesi anlam\u0131na gelen orant\u0131l\u0131l\u0131k unsurlar\u0131n\u0131 i\u00e7ermektedir (B\u00fclent Polat [GK], B. Belirtilen \u00f6l\u00e7\u00fctlere riayetle bir s\u0131n\u0131rland\u0131rma yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131n\u0131n tespiti i\u00e7in m\u00fcdahale te\u015fkil eden \u00f6nlemin temelini olu\u015fturan me\u015fru ama\u00e7 kar\u015f\u0131s\u0131nda, bireye d\u00fc\u015fen fedak\u00e2rl\u0131\u011f\u0131n a\u011f\u0131rl\u0131\u011f\u0131n\u0131n g\u00f6z\u00f6n\u00fcnde bulundurulmas\u0131 ve g\u00f6zetilen genel yarar\u0131n gerekleri ile bireyin temel hakk\u0131n\u0131n korunmas\u0131 aras\u0131nda adil bir dengenin kurulup kurulmad\u0131\u011f\u0131n\u0131n belirlenmesi zorunludur. Anayasa&#8217;n\u0131n 13. maddesi vas\u0131tas\u0131yla Anayasa&#8217;da yer alan t\u00fcm temel hak ve \u00f6zg\u00fcrl\u00fcklerin s\u0131n\u0131rland\u0131r\u0131lmas\u0131 hususunda ge\u00e7erli olan bu denge, \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n s\u0131n\u0131rland\u0131r\u0131lmas\u0131nda da g\u00f6z\u00f6n\u00fcnde bulundurulmal\u0131d\u0131r (B\u00fclent Polat, \u00a7 107).<\/p>\n<p>42. Kamusal makamlar\u0131n bir hakk\u0131n s\u0131n\u0131rland\u0131r\u0131lmas\u0131 s\u00fcrecinde iki ayr\u0131 a\u015famada takdir yetkisi bulunmaktad\u0131r. Bunlardan ilki, s\u0131n\u0131rlama \u00f6l\u00e7\u00fct\u00fcn\u00fcn se\u00e7imidir. \u0130kincisi ise ilgili s\u0131n\u0131rlama \u00f6l\u00e7\u00fct\u00fc \u00e7er\u00e7evesinde izlenen me\u015fru amac\u0131 ger\u00e7ekle\u015ftirmek \u00fczere yap\u0131lan s\u0131n\u0131rlaman\u0131n gereklili\u011fidir. Ancak kamusal makamlara tan\u0131nan bu takdir yetkisi s\u0131n\u0131rs\u0131z olmay\u0131p ihlal iddias\u0131na konu \u00f6nlemin anayasal temel hak ve \u00f6zg\u00fcrl\u00fcklerle ba\u011fda\u015f\u0131r olmas\u0131 yani m\u00fcdahaleyi me\u015frula\u015ft\u0131rmak \u00fczere kullan\u0131lan arg\u00fcmanlar\u0131n elveri\u015fli, zorunlu ve orant\u0131l\u0131 olmas\u0131 gerekir (B\u00fclent Polat, \u00a7 108).<\/p>\n<p>43. Belirtilen takdir yetkisi, her bir olay \u00f6zelinde ayr\u0131 bir kapsama sahiptir. G\u00fcvence alt\u0131na al\u0131nan hakk\u0131n veya hukuksal yarar\u0131n niteli\u011fi ve bunun birey bak\u0131m\u0131ndan \u00f6nemi gibi unsurlara ba\u011fl\u0131 olarak bu yetkinin kapsam\u0131 daralmakta veya geni\u015flemektedir. \u00d6te yandan personel rejimi gibi s\u0131k\u0131 kural ve \u015fartlara tabi bir alanda, kamu makamlar\u0131n\u0131n faaliyetin niteli\u011fine ve s\u0131n\u0131rlaman\u0131n amac\u0131na g\u00f6re de\u011fi\u015fen geni\u015f bir takdir yetkisinin bulunmas\u0131 do\u011fald\u0131r. Bununla birlikte \u00f6zel hayata sayg\u0131 hakk\u0131 ile kamu hizmetinin yukar\u0131da belirtilen temellere uygun y\u00fcr\u00fct\u00fclmesini g\u00f6zetmek konusundaki me\u015fru menfaat aras\u0131nda adil bir denge kurulup kurulmad\u0131\u011f\u0131n\u0131n g\u00f6z\u00f6n\u00fcnde bulundurulmas\u0131 zorunludur (B\u00fclent Polat, \u00a7\u00a7 109, 110).<\/p>\n<p>44. Ayr\u0131ca \u00f6zel hayata sayg\u0131 hakk\u0131na y\u00f6nelik m\u00fcdahalenin demokratik bir toplumda gerekli olma ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkelerine uygun oldu\u011fu konusunda yarg\u0131sal makamlar taraf\u0131ndan olu\u015fturulan gerek\u00e7elerin ikna edici nitelikte ilgili ve yeterli olmas\u0131 gerekir (benzer y\u00f6ndeki de\u011ferlendirmeler i\u00e7in bkz. Ata T\u00fcrkeri, \u00a7\u00a7 45, 47; Murat Deniz, B. No: 2014\/5318, 21\/9\/2016, \u00a7 66). Yine m\u00fcdahalenin yarg\u0131sal denetiminin usule ili\u015fkin gereklilikler yerine getirilerek etkili bir \u015fekilde ve makul s\u00fcrede tamamlanmas\u0131 \u00f6nemlidir.<\/p>\n<p>\u00a0(b) \u0130lkelerin Olaya Uygulanmas\u0131 <\/p>\n<p>45. Somut olayda SGK taraf\u0131ndan ba\u015fvurucunun Medula sistemine eri\u015fimi 4\/1\/2018 tarihinde engellenmi\u015f ayr\u0131ca ba\u015fvurucuya g\u00f6nderilen 2\/1\/2018 tarihli yaz\u0131 ile Protokol&#8217;\u00fcn 5.1. maddesi uyar\u0131nca yaz\u0131n\u0131n tebli\u011f tarihinden itibaren bir ay sonra ba\u015fvurucu ile yap\u0131lan s\u00f6zle\u015fmenin feshedilece\u011fi bildirilmi\u015ftir.<\/p>\n<p>46. SGK ve TEB aras\u0131nda d\u00fczenli olarak yenilenen Protokoller arac\u0131l\u0131\u011f\u0131yla SGK mensubu olan ki\u015filerin ila\u00e7 ve t\u0131bbi malzeme ihtiya\u00e7lar\u0131n\u0131n kar\u015f\u0131lanmas\u0131 ama\u00e7lanmaktad\u0131r. An\u0131lan Protokol ayn\u0131 zamanda TEB ile eczaneler aras\u0131nda imzalanan Tip S\u00f6zle\u015fmelerin dayana\u011f\u0131n\u0131 olu\u015fturmakta ve eczaneler, Tip S\u00f6zle\u015fmenin ge\u00e7erli oldu\u011fu s\u00fcre i\u00e7erisinde SGK mensubu ki\u015filerin taleplerini kar\u015f\u0131lamaktad\u0131r (bkz. \u00a7 17-18). SGK ile eczaneler aras\u0131ndaki hukuki ili\u015fkinin fiili yans\u0131mas\u0131 Medula sistemi \u00fczerinden ger\u00e7ekle\u015fmektedir. Zira Tip S\u00f6zle\u015fmeyi imzalayan eczaneler, SGK&#8217;n\u0131n ilgili birimine ba\u015fvurarak Medula sistemine eri\u015fim yetkisi almaktad\u0131r.<\/p>\n<p>47. Medula sisteminin \u00fclkemizde faaliyet g\u00f6steren t\u00fcm resmi ve \u00f6zel sa\u011fl\u0131k kurumlar\u0131n\u0131n kullanmas\u0131 zorunlu olan bir veritaban\u0131 niteli\u011finde oldu\u011fu g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Buna g\u00f6re, SGK kapsam\u0131nda olsun ya da olmas\u0131n ila\u00e7 talebinde bulanan hastalar i\u00e7in Medula sistemi \u00fczerinden d\u00fczenlenen e-re\u00e7ete kodlar\u0131 s\u00f6z konusu sistemi kullanan t\u00fcm eczanelerce g\u00f6r\u00fcnt\u00fclenebilmektedir. Dolay\u0131s\u0131yla SGK&#8217;n\u0131n Medula sistemine eri\u015fim yetkisi vermedi\u011fi bir eczanenin SGK mensubu olan bir hastan\u0131n e-re\u00e7ete kodunu g\u00f6r\u00fcnt\u00fcleyerek hastan\u0131n talebini kar\u015f\u0131lamas\u0131 m\u00fcmk\u00fcn olmad\u0131\u011f\u0131 gibi hastan\u0131n SGK kapsam\u0131nda olmamas\u0131 bir ba\u015fka deyi\u015fle \u00fccret kar\u015f\u0131l\u0131\u011f\u0131nda ila\u00e7 almay\u0131 talep etmesi h\u00e2linde de belirtilen sonu\u00e7 de\u011fi\u015fmemektedir. Buradan hareketle \u00f6z\u00fcnde serbest meslek olan eczac\u0131l\u0131\u011f\u0131n esasen bu s\u00f6zle\u015fmeler \u00e7er\u00e7evesinde etkili bir \u015fekilde \u00eefa edilebilir bir meslek oldu\u011fu ve Medula sistemine eri\u015fimin eczanelerin ticari faaliyetlerinin devam\u0131 i\u00e7in elzem oldu\u011fu sonucuna ula\u015f\u0131lmaktad\u0131r (bkz. \u00a7 21).<\/p>\n<p>48. Eczac\u0131l\u0131k faaliyeti, \u00f6z\u00fcnde bir serbest meslek olmas\u0131na ra\u011fmen sa\u011fl\u0131k hizmetlerinin yerine getirilmesine arac\u0131l\u0131k etmesi itibar\u0131yla an\u0131lan faaliyetin kamusal y\u00f6n\u00fcn\u00fcn de bulundu\u011fu a\u00e7\u0131kt\u0131r. Mesle\u011fin belirtilen \u00f6zelli\u011fi nedeniyle di\u011fer mesleklerden farkl\u0131 kurallar ve denetleme y\u00f6ntemlerine tabi olmas\u0131 ola\u011fan olarak kabul edilebilir. Ancak her durumda mesle\u011fin ifas\u0131na ili\u015fkin kurallar\u0131n, uygulamalar\u0131n ve tedbirlerin esaslar\u0131n\u0131n a\u00e7\u0131k\u00e7a mevzuatta d\u00fczenlenmesi gerekir. Bununla birlikte mesle\u011fin ifas\u0131n\u0131n imk\u00e2ns\u0131z h\u00e2le getirilmesi ya da meslek sahibine \u00f6l\u00e7\u00fcs\u00fcz k\u00fclfet y\u00fcklenmesi h\u00e2linde mesle\u011fe yap\u0131lan m\u00fcdahalenin somut olaya g\u00f6re temel hak ve \u00f6zg\u00fcrl\u00fckleri ihlal edebilece\u011fi vurgulanmal\u0131d\u0131r.<\/p>\n<p>49. Somut olayda mahkemelerce an\u0131lan hukuki ili\u015fkinin Protokol&#8217;\u00fcn 5.1. maddesi gere\u011fince yaln\u0131zca bir ay \u00f6nceden bildirimde bulunularak ve herhangi bir sebep g\u00f6sterilmeden feshedilebilece\u011fi sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r. Oysa yarg\u0131lama s\u00fcrecinde ba\u015fvurucu; s\u00f6zle\u015fmenin yaln\u0131zca Protokol&#8217;\u00fcn 5. maddesinde belirtilen sebeplerle ve s\u0131n\u0131rl\u0131 bir s\u00fcre i\u00e7in feshedilebilece\u011fini, g\u00fcvenlik soru\u015fturmas\u0131n\u0131n olumsuz sonu\u00e7lanmas\u0131n\u0131n an\u0131lan fesih nedenleri aras\u0131nda say\u0131lmad\u0131\u011f\u0131n\u0131 ve bu soru\u015fturman\u0131n i\u00e7eri\u011finden haberdar olmad\u0131\u011f\u0131n\u0131 ileri s\u00fcrm\u00fc\u015ft\u00fcr. Buna kar\u015f\u0131n mahkemelerce an\u0131lan iddia ve itirazlar hakk\u0131nda hi\u00e7bir inceleme ve de\u011ferlendirme yap\u0131lmad\u0131\u011f\u0131 g\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>50. Protokol&#8217;\u00fcn 5. maddesinin bir b\u00fct\u00fcn olarak ele al\u0131nmas\u0131 durumunda g\u00f6r\u00fclece\u011fi \u00fczere ba\u015fvurucudan -takdire ba\u011fl\u0131 olmaks\u0131z\u0131n- savunma istenece\u011fine ili\u015fkin d\u00fczenlemeler bulundu\u011fu gibi maddenin devam\u0131nda hangi h\u00e2llerde fesih i\u015fleminin ger\u00e7ekle\u015ftirilece\u011fi ve ceza verilece\u011fine dair ayr\u0131nt\u0131l\u0131 h\u00fck\u00fcmler bulunmaktad\u0131r. Oysa yarg\u0131 mercileri taraf\u0131ndan fesih i\u015fleminin usul\u00fc ve nedenleri de\u011ferlendirilmemi\u015f ayr\u0131ca ba\u015fvurucunun esasa etkili olabilece\u011fi de\u011ferlendirilen, kendisi hakk\u0131nda adli veya idari bir soru\u015fturma yap\u0131lmamas\u0131na ra\u011fmen somut dayanak ta\u015f\u0131mayan g\u00fcvenlik soru\u015fturmas\u0131na itibar edilmesine ili\u015fkin itirazlar\u0131 hakk\u0131nda da inceleme yap\u0131lmam\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla mahkemelerce idarenin takdir yetkisini kullan\u0131rken bu yetkinin keyf\u00ee \u015fekilde kullan\u0131lmas\u0131n\u0131 \u00f6nleyecek bir yarg\u0131sal denetim yap\u0131ld\u0131\u011f\u0131 s\u00f6ylenemez. Bunun yan\u0131nda ba\u015fvurucu hakk\u0131ndaki g\u00fcvenlik soru\u015fturmas\u0131n\u0131n i\u00e7eri\u011fi ve kapsam\u0131 ile sonu\u00e7lar\u0131n\u0131n denetlenmesine dair bir ara\u015ft\u0131rman\u0131n yap\u0131lmamas\u0131n\u0131n sonucu olarak ba\u015fvurucu hakk\u0131nda bireyselle\u015ftirilmi\u015f bir gerek\u00e7eye yer verilmedi\u011fi g\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>51. Sonu\u00e7 olarak, gerek fesih i\u015flemini ger\u00e7ekle\u015ftiren SGK taraf\u0131ndan verilen kararda gerekse yarg\u0131 mercilerince verilen kararlarda, kullan\u0131lan takdir yetkisinin kanuni dayanaklar\u0131n\u0131n g\u00f6sterilmesi, m\u00fcdahalenin nedenlerine ve ba\u015fvurucunun mesle\u011fi \u00fczerindeki etkilerine ili\u015fkin bireyselle\u015ftirilmi\u015f g\u00fc\u00e7l\u00fc ve yeterli gerek\u00e7e sunma konusundaki gerekliliklerin yerine getirilmedi\u011fi g\u00f6r\u00fclmektedir. Dolay\u0131s\u0131yla -dava s\u00fcrecindeki bilgi ve belgeler dikkate al\u0131nd\u0131\u011f\u0131nda- ba\u015fvurucunun \u00f6zel hayata sayg\u0131 hakk\u0131na y\u00f6nelik m\u00fcdahale demokratik toplum d\u00fczeninin gereklerine uygunluk ko\u015fulunu sa\u011flamamaktad\u0131r.<\/p>\n<p>52. A\u00e7\u0131klanan gerek\u00e7elerle Anayasa&#8217;n\u0131n 20. maddesinde g\u00fcvence alt\u0131na al\u0131nan \u00f6zel hayata sayg\u0131 hakk\u0131n\u0131n ihlal edildi\u011fine karar verilmesi gerekir.<\/p>\n<p>VI. G\u0130DER\u0130M<\/p>\n<p>53. Ba\u015fvurucu, ihlalin tespiti, yarg\u0131laman\u0131n yenilenmesi ve tazminata h\u00fckmedilmesi talebinde bulunmu\u015ftur.<\/p>\n<p>54. Ba\u015fvuruda tespit edilen hak ihlalinin sonu\u00e7lar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131 i\u00e7in yeniden yarg\u0131lama yap\u0131lmas\u0131nda hukuki yarar bulunmaktad\u0131r.
