Ba\u015fvuru, k\u00f6t\u00fc muameleye maruz kalma riski bulunan \u00fclkeye s\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131 verilmesi nedeniylek\u00f6t\u00fc muamele yasa\u011f\u0131n\u0131n ihlal edildi\u011fi iddias\u0131na ili\u015fkindir.<\/p>\n<p>II. BA\u015eVURU S\u00dcREC\u0130<\/p>\n<p>2. Ba\u015fvuru 26\/3\/2020 tarihinde yap\u0131lm\u0131\u015ft\u0131r. Komisyon, ba\u015fvurunun kabul edilebilirlik ve esas incelemesinin B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na karar vermi\u015ftir.<\/p>\n<p>3. B\u00f6l\u00fcm, Anayasa Mahkemesi \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc&#8217;n\u00fcn 73. maddesi uyar\u0131nca s\u0131n\u0131r d\u0131\u015f\u0131 etme i\u015fleminin tedbiren durdurulmas\u0131na karar vermi\u015ftir.<\/p>\n<p>4. Ba\u015fvuru belgelerinin bir \u00f6rne\u011fi bilgi i\u00e7in Adalet Bakanl\u0131\u011f\u0131na g\u00f6nderilmi\u015ftir.<\/p>\n<p>III. OLAY VE OLGULAR <\/p>\n<p>5. Ba\u015fvuru formu ve ekleri ile Ulusal Yarg\u0131 A\u011f\u0131 Bili\u015fim Sistemi arac\u0131l\u0131\u011f\u0131yla eri\u015filen bilgi ve belgeler do\u011frultusunda tespit edilen ilgili olaylar \u00f6zetle \u015f\u00f6yledir:<\/p>\n<p>6. Ba\u015fvurucu 1979 do\u011fumlu bir erkektir ve \u00d6zbekistan Cumhuriyeti vatanda\u015f\u0131d\u0131r.<\/p>\n<p>7. Ba\u015fvurucu, 14\/3\/2017 tarihinde ba\u015fvuruda bulundu\u011fu Birle\u015fmi\u015f Milletler M\u00fclteciler Y\u00fcksek Komiserli\u011finin y\u00f6nlendirmesi ile 2\/11\/2017 tarihinde Yalova \u0130l G\u00f6\u00e7 \u0130daresi M\u00fcd\u00fcrl\u00fc\u011f\u00fc (G\u00f6\u00e7 \u0130daresi) nezdinde uluslararas\u0131 koruma ba\u015fvurusunda bulunmu\u015ftur. Ba\u015fvurucu bu ba\u015fvuruyla ilgili dilek\u00e7esinde T\u00fcrkiye&#8217;ye 2\/5\/2012 tarihinde Atat\u00fcrk Hava Hudut Kap\u0131s\u0131ndan giri\u015f yapt\u0131\u011f\u0131n\u0131, \u00fclkesinde ya\u015fad\u0131\u011f\u0131 problemlerden dolay\u0131 geri d\u00f6nemeyece\u011fini beyan etmi\u015ftir. Uluslararas\u0131 koruma ba\u015fvuru bildirim formundaki a\u00e7\u0131klamaya g\u00f6re ba\u015fvurucunun M\u00fcsl\u00fcman olarak dinini ya\u015famas\u0131 \u00fclkesinde tehdit olarak alg\u0131land\u0131\u011f\u0131 i\u00e7in inanc\u0131n\u0131 daha \u00f6zg\u00fcrce ya\u015fayabilmek i\u00e7in ailesiyle birlikte T\u00fcrkiye&#8217;ye gelmi\u015ftir. Ba\u015fvurucu, G\u00f6\u00e7 \u0130daresine sundu\u011fu tarihsiz el deklarasyonuna &#8220;din\u00ee s\u0131k\u0131nt\u0131&#8221; yazm\u0131\u015ft\u0131r.<\/p>\n<p>8. Ba\u015fvurucu, \u0130stanbul Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131 taraf\u0131ndan doland\u0131r\u0131c\u0131l\u0131k su\u00e7undan y\u00fcr\u00fct\u00fclen bir soru\u015fturma kapsam\u0131nda 12\/6\/2019 tarihinde \u015f\u00fcpheli s\u0131fat\u0131yla ifade vermi\u015ftir. \u0130fadesinin al\u0131nmas\u0131ndan sonra serbest b\u0131rak\u0131lan ba\u015fvurucu \u0130stanbul \u0130l G\u00f6\u00e7 \u0130daresi M\u00fcd\u00fcrl\u00fc\u011f\u00fcne g\u00f6nderilmi\u015ftir. \u0130stanbul Valili\u011fince 14\/6\/2019 tarihinde, 4\/4\/2013 tarihli ve 6458 say\u0131l\u0131 Yabanc\u0131lar ve Uluslararas\u0131 Koruma Kanunu&#8217;nun 54. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (b) ve (d) bentleri uyar\u0131nca ba\u015fvurucu hakk\u0131nda s\u0131n\u0131r d\u0131\u015f\u0131 etme ve ayn\u0131 Kanun&#8217;un 57. maddesi kapsam\u0131nda idari g\u00f6zetim karar\u0131 al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>9. Ba\u015fvurucu, an\u0131lan karar\u0131n iptali talebiyle \u0130stanbul 1. \u0130dare Mahkemesinde (\u0130dare Mahkemesi) dava a\u00e7m\u0131\u015ft\u0131r. Ba\u015fvurucu, dava dilek\u00e7esinde s\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131n\u0131n hukuka ayk\u0131r\u0131 oldu\u011funu, \u00d6zbekistan&#8217;\u0131n \u0130slam dininin vecibelerini yerine getirmek isteyen ve herhangi bir menfi eylemi bulunmayan M\u00fcsl\u00fcmanlar\u0131 potansiyel tehdit olarak g\u00f6r\u00fcp bask\u0131 alt\u0131nda tuttu\u011funu, direnenlere ise k\u00f6t\u00fc muamelede bulundu\u011funu belirtmi\u015ftir. Ba\u015fvurucu, kendisinin de M\u00fcsl\u00fcman oldu\u011funu,ya\u015fad\u0131klar\u0131 b\u00f6lgede imaml\u0131k yapan babas\u0131n\u0131n din\u00ee inanc\u0131 nedeniyle 1999 y\u0131l\u0131nda gerek\u00e7esiz bir \u015fekilde evinden al\u0131nd\u0131\u011f\u0131n\u0131, bir daha da kendisinden haber al\u0131namad\u0131\u011f\u0131n\u0131 belirtmi\u015ftir. \u0130ddias\u0131na g\u00f6re, iki bacana\u011f\u0131 da din\u00ee inan\u00e7lar\u0131 nedeniyle \u00d6zbek kolluk kuvvetlerince al\u0131konulmu\u015f, soyut iddia ve ithamlarla hapis cezas\u0131na mahk\u00fbm edilmi\u015flerdir.2009 y\u0131l\u0131nda ise bu kez kendisi cami \u00e7\u0131k\u0131\u015f\u0131nda al\u0131konulmu\u015f, bir ay boyunca i\u015fkence ve k\u00f6t\u00fc muamelelere maruz b\u0131rak\u0131ld\u0131ktan sonra serbest b\u0131rak\u0131lm\u0131\u015ft\u0131r. 2010 y\u0131l\u0131nda a\u011fabeyinin de ayn\u0131 sebeplerle al\u0131konulmas\u0131 ve bask\u0131lar\u0131n iyice artmas\u0131 \u00fczerine insan onuruna yara\u015f\u0131r bir hayat s\u00fcrebilmek i\u00e7in e\u015fi ve \u00e7ocuklar\u0131yla birlikte 2012 y\u0131l\u0131nda T\u00fcrkiye&#8217;ye gelmi\u015ftir. Ba\u015fvurucu, T\u00fcrkiye&#8217;ye gelmi\u015f olmas\u0131na ra\u011fmen \u00d6zbek makamlar\u0131n\u0131n kendisi ve e\u015fi hakk\u0131nda arama karar\u0131 \u00e7\u0131kard\u0131\u011f\u0131n\u0131, h\u00e2len rahat b\u0131rak\u0131lmad\u0131\u011f\u0131n\u0131 ileri s\u00fcrm\u00fc\u015f ve yarg\u0131lama a\u015famas\u0131nda hakk\u0131nda arama karar\u0131 oldu\u011funu g\u00f6sterir \u00d6zbekistan Cumhuriyeti \u0130\u00e7 \u0130\u015fleri Bakanl\u0131\u011f\u0131 resm\u00ee internet sitesi ekran g\u00f6r\u00fcnt\u00fcs\u00fcn\u00fc ve bu g\u00f6r\u00fcnt\u00fcn\u00fcn yeminli terc\u00fcman taraf\u0131ndan haz\u0131rlanm\u0131\u015f T\u00fcrk\u00e7e metnini sunmu\u015ftur. S\u00f6z konusu evrakta, ba\u015fvurucunun \u00d6zbekistan Ceza Kanunu&#8217;nun 159. maddesinin \u00fc\u00e7\u00fcnc\u00fc bendi ve 244. maddesinden arand\u0131\u011f\u0131 bilgisi mevcuttur.<\/p>\n<p>10. \u0130dare Mahkemesi 31\/12\/2019 tarihinde davan\u0131n reddine kesin olarak karar vermi\u015ftir. Karar gerek\u00e7esinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;&#8230; Uyu\u015fmazl\u0131kta, davac\u0131n\u0131n hakk\u0131nda doland\u0131r\u0131c\u0131l\u0131k su\u00e7u \u015f\u00fcphelisi \u015fah\u0131sla birlikte hareket etti\u011fi de\u011ferlendirilerek adli i\u015flem yap\u0131ld\u0131\u011f\u0131, hakk\u0131nda G-87 tahdit kod kay\u0131tl\u0131 genel g\u00fcvenlik giri\u015f yasa\u011f\u0131 bulundu\u011fu, hakk\u0131nda istihbarat \u00e7al\u0131\u015fmas\u0131 da bulundu\u011fu, dosya i\u00e7eri\u011finden davac\u0131 hakk\u0131nda yap\u0131lan de\u011ferlendirme neticesinde olu\u015fan makul \u015f\u00fcphe olgusunun s\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131n\u0131n tesisi i\u00e7in yeterli nitelikte bulundu\u011fu,tedbir niteli\u011finde ve h\u00fck\u00fcmranl\u0131k hakk\u0131 kapsam\u0131nda tesis edildi\u011fi sonucuna var\u0131lan dava konusu i\u015flemin hukuka ayk\u0131r\u0131 olmad\u0131\u011f\u0131 sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>\u00d6te yandan davac\u0131 \u00fclkesine geri g\u00f6nderilemeyecek yabanc\u0131lardan oldu\u011funu iddia etmekte ise de, davac\u0131n\u0131n g\u00fcvenli \u00fc\u00e7\u00fcnc\u00fc bir \u00fclkeye s\u0131n\u0131rd\u0131\u015f\u0131 edilebilece\u011finin dava konusu i\u015flemde belirtilmesi nedeniyle bu iddias\u0131na itibar edilmemi\u015ftir.&#8221;<\/p>\n<p>11. Ba\u015fvurucu, nihai karar\u0131 14\/3\/2020 tarihinde \u00f6\u011frendikten sonra s\u00fcresinde bireysel ba\u015fvuruda bulunmu\u015ftur.<\/p>\n<p>IV. \u0130LG\u0130L\u0130 HUKUK<\/p>\n<p>A. Ulusal Hukuk<\/p>\n<p>12. 6458 say\u0131l\u0131 Kanun&#8217;un &#8220;Geri g\u00f6nderme yasa\u011f\u0131&#8221; ba\u015fl\u0131kl\u0131 4. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Bu Kanun kapsam\u0131ndaki hi\u00e7 kimse, i\u015fkenceye, insanl\u0131k d\u0131\u015f\u0131 ya da onur k\u0131r\u0131c\u0131 ceza veya muameleye tabi tutulaca\u011f\u0131 veya \u0131rk\u0131, dini, tabiiyeti, belli bir toplumsal gruba mensubiyeti veya siyasi fikirleri dolay\u0131s\u0131yla hayat\u0131n\u0131n veya h\u00fcrriyetinin tehdit alt\u0131nda bulunaca\u011f\u0131 bir yere g\u00f6nderilemez.&#8221;<\/p>\n<p>13. 6458 say\u0131l\u0131 Kanun&#8217;un &#8220;S\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131&#8221; ba\u015fl\u0131kl\u0131 53. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;(1) S\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131, Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn talimat\u0131 \u00fczerine veya resen valiliklerce al\u0131n\u0131r.<\/p>\n<p>(2) Karar, gerek\u00e7eleriyle birlikte hakk\u0131nda s\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131 al\u0131nan yabanc\u0131ya veya yasal temsilcisine ya da avukat\u0131na tebli\u011f edilir. Hakk\u0131nda s\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131 al\u0131nan yabanc\u0131, bir avukat taraf\u0131ndan temsil edilmiyorsa kendisi veya yasal temsilcisi, karar\u0131n sonucu, itiraz usulleri ve s\u00fcreleri hakk\u0131nda bilgilendirilir.<\/p>\n<p>(3) (De\u011fi\u015fik:21\/11\/2024-7533\/36 md.) Yabanc\u0131 veya yasal temsilcisi ya da avukat\u0131, s\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131na kar\u015f\u0131, karar\u0131n tebli\u011finden itibaren yedi g\u00fcn i\u00e7inde idare mahkemesine ba\u015fvurabilir. Mahkemeye ba\u015fvuran ki\u015fi, s\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131n\u0131 veren makama da ba\u015fvurusunu bildirir. Mahkemeye yap\u0131lan ba\u015fvurularda savunman\u0131n verilmesi veya savunma verme s\u00fcresinin ge\u00e7mesiyle dosya tekemm\u00fcl etmi\u015f say\u0131l\u0131r. Davac\u0131n\u0131n g\u00f6sterdi\u011fi adrese tebligat yap\u0131lamamas\u0131 h\u00e2linde, 2577 say\u0131l\u0131 Kanunun 26 nc\u0131 maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda \u00f6ng\u00f6r\u00fclen s\u00fcre iki ay olarak uygulan\u0131r. Duru\u015fma yap\u0131lmas\u0131 mahkemenin takdirine ba\u011fl\u0131d\u0131r. Ba\u015fvurular dosyan\u0131n tekemm\u00fcl\u00fcnden veya ara karar ya da duru\u015fma yap\u0131lmas\u0131 gereken h\u00e2llerde bunlar\u0131n tamamlanmas\u0131ndan itibaren on be\u015f g\u00fcn i\u00e7inde sonu\u00e7land\u0131r\u0131l\u0131r. Mahkemenin bu konuda vermi\u015f oldu\u011fu karar kesindir. Yabanc\u0131n\u0131n r\u0131zas\u0131 sakl\u0131 kalmak kayd\u0131yla, dava a\u00e7ma s\u00fcresi i\u00e7inde veya yarg\u0131 yoluna ba\u015fvurulmas\u0131 h\u00e2linde yarg\u0131lama sonu\u00e7lan\u0131ncaya kadar yabanc\u0131 s\u0131n\u0131r d\u0131\u015f\u0131 edilmez&#8221;<\/p>\n<p>14. 6458 say\u0131l\u0131 Kanun&#8217;un &#8220;S\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131 al\u0131nacaklar&#8221; ba\u015fl\u0131kl\u0131 54. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;(1) A\u015fa\u011f\u0131da say\u0131lan yabanc\u0131lar hakk\u0131nda s\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131 al\u0131n\u0131r:<\/p>\n<p>&#8230;<\/p>\n<p>b) Ter\u00f6r \u00f6rg\u00fct\u00fc y\u00f6neticisi, \u00fcyesi, destekleyicisi veya \u00e7\u0131kar ama\u00e7l\u0131 su\u00e7 \u00f6rg\u00fct\u00fc y\u00f6neticisi, \u00fcyesi veya destekleyicisi olanlar <\/p>\n<p>&#8230; <\/p>\n<p>d) Kamu d\u00fczeni veya kamu g\u00fcvenli\u011fi ya da kamu sa\u011fl\u0131\u011f\u0131 a\u00e7\u0131s\u0131ndan tehdit olu\u015fturanlar<\/p>\n<p>&#8230;&#8221;<\/p>\n<p>15. 6458 say\u0131l\u0131 Kanun&#8217;un &#8220;S\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131 al\u0131nmayacaklar&#8221; ba\u015fl\u0131kl\u0131 55. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;(1) 54 \u00fcnc\u00fc madde kapsam\u0131nda olsalar dahi, a\u015fa\u011f\u0131daki yabanc\u0131lar hakk\u0131nda s\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131 al\u0131nmaz:<\/p>\n<p>a) S\u0131n\u0131r d\u0131\u015f\u0131 edilece\u011fi \u00fclkede \u00f6l\u00fcm cezas\u0131na, i\u015fkenceye, insanl\u0131k d\u0131\u015f\u0131 ya da onur k\u0131r\u0131c\u0131 ceza veya muameleye maruz kalaca\u011f\u0131 konusunda ciddi emare bulunanlar<\/p>\n<p>&#8230;&#8221;<\/p>\n<p>B. Uluslararas\u0131 Hukuk<\/p>\n<p>1. Uluslararas\u0131 Mevzuat<\/p>\n<p>16. Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi&#8217;nin (S\u00f6zle\u015fme) &#8220;\u0130\u015fkence yasa\u011f\u0131&#8221; ba\u015fl\u0131kl\u0131 3. maddesi \u015f\u00f6yledir:<\/p>\n<p>&#8220;Hi\u00e7 kimse i\u015fkenceye veya insanl\u0131k d\u0131\u015f\u0131 ya da a\u015fa\u011f\u0131lay\u0131c\u0131 muamele veya cezaya tabi tutulamaz.&#8221;<\/p>\n<p>2. Avrupa \u0130nsan Haklar\u0131 Mahkemesi Uygulamas\u0131<\/p>\n<p>17. Avrupa \u0130nsan Haklar\u0131 Mahkemesinin (A\u0130HM) s\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131n\u0131n uygulanmas\u0131 h\u00e2linde k\u00f6t\u00fc muamele yasa\u011f\u0131n\u0131n ihlal edilece\u011fine ili\u015fkin \u015fik\u00e2yetlerle ilgili ilkesel yakla\u015f\u0131m\u0131 i\u00e7in bkz. A.A. ve A.A. [GK], B. No: 2015\/3941, 1\/3\/2017, \u00a7 38.<\/p>\n<p>18. \u00d6zbek makamlar\u0131 taraf\u0131ndan din\u00ee veya siyasi faaliyetlerden dolay\u0131 su\u00e7lanan \u00d6zbekistan vatanda\u015flar\u0131n\u0131n \u00d6zbekistan&#8217;a s\u0131n\u0131r d\u0131\u015f\u0131 edilmeleri veya iade edilmeleri h\u00e2linde k\u00f6t\u00fc muameleye maruz kalacaklar\u0131na ili\u015fkin yapt\u0131klar\u0131 \u00e7ok say\u0131da ba\u015fvuru A\u0130HM taraf\u0131ndan de\u011ferlendirilmi\u015ftir (bir\u00e7ok karar aras\u0131ndan bkz. Ermakov\/Rusya, B. No: 43165\/10, 7\/10\/2013, \u00a7\u00a7 201-207; Kasymakhunov\/Rusya, B. No: 29604\/12, 14\/11\/2013, \u00a7\u00a7 122-128; Isma\u0131lov\/Rusya, B. Anayasa Mahkemesinin 15\/4\/2025 tarihinde yapm\u0131\u015f oldu\u011fu toplant\u0131da ba\u015fvuru incelenip gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. Adli Yard\u0131m Talebi Y\u00f6n\u00fcnden <\/p>\n<p>20. Anayasa Mahkemesi taraf\u0131ndan adli yard\u0131m talebinin kabul edilebilmesi i\u00e7in gerekli \u015fartlar Mehmet \u015eerif Ay ([2. B.], B. No: 2012\/1181, 17\/9\/2013, \u00a7 23) karar\u0131nda, yabanc\u0131lar\u0131n adli yard\u0131m talepleri konusunda benimsenen ilkeler ise Nadali Aghel\u0131 Kohne Shahr\u0131 ([1. B.], B. Somut ba\u015fvuruda yarg\u0131lama giderlerini \u00f6deme g\u00fcc\u00fcnden yoksun oldu\u011fu anla\u015f\u0131lan ba\u015fvurucunun adli yard\u0131m talebinin kabul\u00fcne karar verilmesi gerekir.<\/p>\n<p>B. K\u00f6t\u00fc Muamele Yasa\u011f\u0131n\u0131n \u0130hlal Edildi\u011fine \u0130li\u015fkin \u0130ddia<\/p>\n<p>1. Ba\u015fvurucunun \u0130ddialar\u0131<\/p>\n<p>21. Ba\u015fvurucu, s\u0131n\u0131r d\u0131\u015f\u0131 etme i\u015fleminin iptali talebiyle \u0130dare Mahkemesinde a\u00e7t\u0131\u011f\u0131 davada dile getirdi\u011fi iddialar\u0131 (bkz. \u00a7 9) tekrar ederek \u00fclkesine geri g\u00f6nderildi\u011fi takdirde ya\u015fam\u0131n\u0131n tehlikeye girece\u011fini, k\u00f6t\u00fc muameleye maruz kalaca\u011f\u0131n\u0131 ileri s\u00fcrm\u00fc\u015ft\u00fcr.<\/p>\n<p>2. De\u011ferlendirme<\/p>\n<p>22. Ba\u015fvurucunun iddialar\u0131n\u0131n Anayasa&#8217;n\u0131n 17. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda g\u00fcvence alt\u0131na al\u0131nan k\u00f6t\u00fc muamele yasa\u011f\u0131 \u00e7er\u00e7evesinde incelenmesi gerekti\u011fi de\u011ferlendirilmi\u015ftir.<\/p>\n<p>a. Kabul Edilebilirlik Y\u00f6n\u00fcnden<\/p>\n<p>23. A\u00e7\u0131k\u00e7a dayanaktan yoksun olmad\u0131\u011f\u0131 ve kabul edilemezli\u011fine karar verilmesini gerektirecek ba\u015fka bir neden de bulunmad\u0131\u011f\u0131 anla\u015f\u0131lan k\u00f6t\u00fc muamele yasa\u011f\u0131n\u0131n ihlal edildi\u011fine ili\u015fkin iddian\u0131n kabul edilebilir oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>b. Esas Y\u00f6n\u00fcnden<\/p>\n<p>i. Genel \u0130lkeler<\/p>\n<p>24. Yabanc\u0131lar\u0131n \u00fclkeye giri\u015fleri, \u00fclkede ikamet etmeleri ve \u00fclkeden \u00e7\u0131kar\u0131lmalar\u0131,uluslararas\u0131 hukukta da kabul edildi\u011fi \u00fczere devletin egemenlik yetkisi kapsam\u0131ndad\u0131r (bir\u00e7ok karar aras\u0131ndan bkz. A.A. ve A.A., \u00a7 54).<\/p>\n<p>25. Anayasa&#8217;n\u0131n 17. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda k\u00f6t\u00fc muamele yasa\u011f\u0131 g\u00fcvence alt\u0131na al\u0131nm\u0131\u015ft\u0131r. Bu yasakla ilgili herhangi bir istisna da kabul edilmemi\u015ftir. \u201cTemel hak ve h\u00fcrriyetlerin kullan\u0131lmas\u0131n\u0131n durdurulmas\u0131\u201d kenar ba\u015fl\u0131kl\u0131 15. maddede ise sava\u015f, seferberlik veya ola\u011fan\u00fcst\u00fc hallerde de sava\u015f hukukuna uygun fiiller sonucu meydana gelen \u00f6l\u00fcmler d\u0131\u015f\u0131nda ya\u015fam hakk\u0131 ile maddi ve manevi varl\u0131\u011f\u0131n b\u00fct\u00fcnl\u00fc\u011f\u00fcne dokunulamayaca\u011f\u0131 ifade edilmi\u015ftir. K\u00f6t\u00fc muamele yasa\u011f\u0131n\u0131n mutlak niteli\u011fini ortaya koyan s\u00f6z\u00fc edilen d\u00fczenlemelere g\u00f6re bir yabanc\u0131n\u0131n s\u0131n\u0131r d\u0131\u015f\u0131 edilece\u011fi \u00fclkede Anayasa&#8217;n\u0131n 17. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131na ayk\u0131r\u0131 bir muameleye u\u011frayaca\u011f\u0131 konusunda ger\u00e7ek bir riskle kar\u015f\u0131 kar\u015f\u0131ya kalaca\u011f\u0131na inan\u0131lmas\u0131 i\u00e7in esasl\u0131 gerek\u00e7elerin g\u00f6sterildi\u011fi h\u00e2llerde yabanc\u0131n\u0131n s\u0131n\u0131r d\u0131\u015f\u0131 edilmesi k\u00f6t\u00fc muamele yasa\u011f\u0131n\u0131 ihlal edebilir zira b\u00f6yle bir durumda yabanc\u0131n\u0131n k\u00f6t\u00fc muamele riskiyle kar\u015f\u0131 kar\u015f\u0131ya kalmas\u0131 devletin tutumunun do\u011frudan bir sonucudur. Dolay\u0131s\u0131yla devlet bu h\u00e2llerde yabanc\u0131y\u0131 o \u00fclkeye s\u0131n\u0131r d\u0131\u015f\u0131 etmeme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc alt\u0131ndad\u0131r (baz\u0131 de\u011fi\u015fikliklerle birlikte bkz. A.A. ve A.A., \u00a7\u00a7 55, 56; Masoud Taleb\u0131 [2. B.], B. No: 2023\/26088, 19\/3\/2024, \u00a7 64). Bu y\u00fck\u00fcml\u00fcl\u00fck, yabanc\u0131lar\u0131n riskin bulundu\u011fu \u00fclkeye dolayl\u0131 olarak g\u00f6nderilmemelerini de kapsamaktad\u0131r (A.D. [1. B.], B. No: 2014\/19506, 3\/4\/2019, \u00a7 55).<\/p>\n<p>26. S\u0131n\u0131r d\u0131\u015f\u0131 edilmesi h\u00e2linde k\u00f6t\u00fc muameleye u\u011frayaca\u011f\u0131n\u0131 iddia eden yabanc\u0131, ilke olarak, s\u0131n\u0131r d\u0131\u015f\u0131 edilece\u011fi \u00fclkede k\u00f6t\u00fc muameleye u\u011frayaca\u011f\u0131 konusunda ger\u00e7ek bir riskle kar\u015f\u0131 kar\u015f\u0131ya kalaca\u011f\u0131na inan\u0131lmas\u0131 i\u00e7in esasl\u0131 nedenler bulundu\u011funu kan\u0131tlayabilecek delilleri idari merciler ile yarg\u0131 mercilerine sunmal\u0131d\u0131r. Bu do\u011frultuda yabanc\u0131, s\u0131n\u0131r d\u0131\u015f\u0131 edilece\u011fi\u00fclkede var oldu\u011funu iddia etti\u011fi k\u00f6t\u00fc muamele riskinin ne oldu\u011funu makul \u015fekilde a\u00e7\u0131klamal\u0131 ve varsa bu iddiay\u0131 destekleyen bilgi ve belgeleri ibraz etmelidir (A.A. ve A.A., \u00a7 68).<\/p>\n<p>27. Yabanc\u0131 s\u0131n\u0131r d\u0131\u015f\u0131 edilece\u011fi \u00fclkedeki kamu makamlar\u0131n\u0131n; etnik k\u00f6kenleri, din\u00ee inan\u00e7lar\u0131, siyasi g\u00f6r\u00fc\u015fleri ya da belirli bir gruba mensubiyetleri gibi nedenlerle ki\u015filere sistematik olarak k\u00f6t\u00fc muamelede bulunduklar\u0131n\u0131 iddia ediyor ise uygulaman\u0131n varl\u0131\u011f\u0131 ile risk alt\u0131nda oldu\u011fu iddia edilen gruba mensup oldu\u011funa inan\u0131lmas\u0131 i\u00e7in ciddi nedenler bulundu\u011funu ortaya koymal\u0131d\u0131r. Geri g\u00f6nderilece\u011fi \u00fclkedeki riskin kamu g\u00f6revlisi olmayan ki\u015fi veya gruplardan kaynakland\u0131\u011f\u0131n\u0131 ileri s\u00fcren yabanc\u0131, hem riskin ger\u00e7ekli\u011fini hem de s\u00f6z konusu \u00fclkenin kamu makamlar\u0131n\u0131n bu riski ortadan kald\u0131rmak konusunda yeterli korumay\u0131 sa\u011flamakta yetersiz kalacaklar\u0131n\u0131 kan\u0131tlamal\u0131d\u0131r. Bununla birlikte yabanc\u0131, s\u0131n\u0131r d\u0131\u015f\u0131 edilece\u011fi \u00fclkede uzun s\u00fcredir devam eden genel siyasi istikrars\u0131zl\u0131k ya da \u00fclkenin tamam\u0131na yay\u0131lm\u0131\u015f i\u00e7 kar\u0131\u015f\u0131kl\u0131k nedeniyle k\u00f6t\u00fc muameleye maruz kalaca\u011f\u0131n\u0131 ileri s\u00fcrm\u00fc\u015fse an\u0131lan \u00fclkenin genel ko\u015fullar\u0131n\u0131n nesnel olarak k\u00f6t\u00fc muamele yasa\u011f\u0131na ayk\u0131r\u0131l\u0131k olu\u015fturmayaca\u011f\u0131 idari ve yarg\u0131sal makamlar taraf\u0131ndan ortaya konulmal\u0131d\u0131r(A.A. ve A.A., \u00a7\u00a7 66-69).<\/p>\n<p>28. \u0130spat k\u00fclfetinin ba\u015fvurucuya ait oldu\u011fu ve bu k\u00fclfetten do\u011fan y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn yerinegetirildi\u011fi h\u00e2llerde idari ve yarg\u0131 mercileri ger\u00e7ek riskin varl\u0131\u011f\u0131 konusunda titiz bir inceleme yapmal\u0131d\u0131r. Bu inceleme yap\u0131l\u0131rken yabanc\u0131n\u0131n s\u0131n\u0131r d\u0131\u015f\u0131 edilmesinin \u00f6ng\u00f6r\u00fclebilir sonu\u00e7lar\u0131, yabanc\u0131n\u0131n s\u0131n\u0131r d\u0131\u015f\u0131 edilece\u011fi \u00fclkenin genel durumu, yabanc\u0131n\u0131n ki\u015fisel durumu ve u\u011fran\u0131laca\u011f\u0131 iddia edilen muamelenin k\u00f6t\u00fc muamele yasa\u011f\u0131 i\u00e7in aranan asgari a\u011f\u0131rl\u0131k e\u015fi\u011fine ula\u015f\u0131p ula\u015fmad\u0131\u011f\u0131 dikkate al\u0131nmal\u0131d\u0131r. Riskin varl\u0131\u011f\u0131 ara\u015ft\u0131r\u0131l\u0131rken ulusal veya uluslararas\u0131 kurum ve kurulu\u015flar\u0131n d\u00fczenledikleri raporlardan ya da somut olay hakk\u0131nda bilgi edinilmesini sa\u011flayacak ba\u015fka kaynaklardan yararlan\u0131lmas\u0131 m\u00fcmk\u00fcnd\u00fcr (A.A. ve A.A.,\u00a7\u00a7 62-64).<\/p>\n<p>29. Ger\u00e7ek riskin varl\u0131\u011f\u0131yla ilgili de\u011ferlendirmede kural olarak s\u0131n\u0131r d\u0131\u015f\u0131 karar\u0131n\u0131n verildi\u011fi tarihteki ko\u015fullar dikkate al\u0131nmal\u0131d\u0131r ancak yap\u0131lacak de\u011ferlendirmenin sonucunu do\u011frudan etkileyecek \u00f6nemli geli\u015fmeler de g\u00f6z\u00f6n\u00fcnde tutulmal\u0131d\u0131r (A.A. ve A.A., \u00a7 70).<\/p>\n<p>30. S\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131 verilmesi nedeniyle k\u00f6t\u00fc muamele yasa\u011f\u0131n\u0131n ihlal edildi\u011fi iddias\u0131yla yap\u0131lan ve ba\u015fvurucunun s\u0131n\u0131r d\u0131\u015f\u0131 edilece\u011fi \u00fclkede Anayasa&#8217;n\u0131n 17. maddesinin \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131na ayk\u0131r\u0131 bir muameleye u\u011frayaca\u011f\u0131 konusunda ger\u00e7ek bir riskle kar\u015f\u0131 kar\u015f\u0131ya kalaca\u011f\u0131na inan\u0131lmas\u0131 i\u00e7in esasl\u0131 gerek\u00e7elerin g\u00f6sterildi\u011fi bireysel ba\u015fvurularda Anayasa Mahkemesinin rol\u00fc, kural olarak ba\u015fvurucuyu do\u011frudan veya dolayl\u0131 olarak k\u00f6t\u00fc muamele riskiyle kar\u015f\u0131la\u015faca\u011f\u0131 \u00fclkeye g\u00f6nderilmesine kar\u015f\u0131 koruyan etkili usul g\u00fcvencelerinin sa\u011flan\u0131p sa\u011flanmad\u0131\u011f\u0131n\u0131 tespittir. Usul g\u00fcvencelerinin sa\u011fland\u0131\u011f\u0131 durumlarda geri g\u00f6nderilen \u00fclkede ger\u00e7ek bir k\u00f6t\u00fc muamele riskinin bulunup bulunmad\u0131\u011f\u0131 ayr\u0131ca de\u011ferlendirilir (baz\u0131 de\u011fi\u015fikliklerle birlikte bkz. A.A. ve A.A., \u00a7 71). Bununla birlikte Anayasa Mahkemesi, somut olay\u0131n \u00f6zel ko\u015fullar\u0131 alt\u0131nda gerekli g\u00f6rd\u00fc\u011f\u00fc h\u00e2llerde geri g\u00f6nderilen \u00fclkede ger\u00e7ek bir k\u00f6t\u00fc muamele riski bulunup bulunmad\u0131\u011f\u0131n\u0131 istisnai olarak ilk elden kendisi de inceleyebilir (A.A. ve A.A., \u00a7 72).<\/p>\n<p>ii. \u0130lkelerin Olaya Uygulanmas\u0131<\/p>\n<p>31. Ba\u015fvurucu, \u0130slam dinini benimsemi\u015f bir ailenin mensubu oldu\u011funu, bir \u015fekilde din\u00ee inanc\u0131 nedeniyle a\u00e7\u0131k hedef h\u00e2line geldi\u011fini, bask\u0131lar neticesinde \u00fclkesini terk etti\u011fini, buna ra\u011fmen hakk\u0131nda arama karar\u0131 \u00e7\u0131kar\u0131ld\u0131\u011f\u0131n\u0131 ileri s\u00fcrm\u00fc\u015ft\u00fcr. Ayr\u0131ca, s\u0131n\u0131r d\u0131\u015f\u0131 i\u015fleminin iptali talebiyle a\u00e7t\u0131\u011f\u0131 davada \u00d6zbekistan makamlar\u0131nca hakk\u0131nda \u00e7\u0131kar\u0131lm\u0131\u015f arama karar\u0131n\u0131n resm\u00ee internet sitesi ekran g\u00f6r\u00fcnt\u00fcs\u00fcn\u00fc ve bu g\u00f6r\u00fcnt\u00fcn\u00fcn T\u00fcrk\u00e7e terc\u00fcmesini sunmu\u015ftur (bkz. \u00a7 9). Sundu\u011fu belgeler ve yapt\u0131\u011f\u0131 a\u00e7\u0131klamalar dikkate al\u0131nd\u0131\u011f\u0131nda ba\u015fvurucu, s\u0131n\u0131r d\u0131\u015f\u0131 edilece\u011fi \u00fclkede k\u00f6t\u00fc muameleye u\u011frayaca\u011f\u0131 konusunda ger\u00e7ek bir riskle kar\u015f\u0131 kar\u015f\u0131ya kalaca\u011f\u0131na inan\u0131lmas\u0131 i\u00e7in esasl\u0131 nedenler bulundu\u011funa ili\u015fkin gerek\u00e7eler ortaya koymu\u015ftur. Bu durumda idari ve yarg\u0131 mercileri ger\u00e7ek riskin varl\u0131\u011f\u0131 konusunda titiz bir inceleme yapmakla y\u00fck\u00fcml\u00fcd\u00fcrler. Buna ra\u011fmen \u0130dare Mahkemesi; sunulan arama karar\u0131n\u0131n ger\u00e7ekli\u011fi, \u015fayet ger\u00e7ek ise \u00fclkesine g\u00f6nderilmesi h\u00e2linde ba\u015fvurucunun k\u00f6t\u00fc muameleye u\u011frama konusunda ger\u00e7ek bir riskle kar\u015f\u0131 kar\u015f\u0131ya kal\u0131p kalmayaca\u011f\u0131 konusunda herhangi bir ara\u015ft\u0131rma yapmam\u0131\u015f, s\u00f6z konusu arama karar\u0131na neden itibar etmedi\u011fini de a\u00e7\u0131klamam\u0131\u015ft\u0131r. Ayr\u0131ca \u0130dare Mahkemesi, ba\u015fvurucunun g\u00fcvenli \u00fc\u00e7\u00fcnc\u00fc bir \u00fclkeye s\u0131n\u0131r d\u0131\u015f\u0131 edilebilece\u011fi gerek\u00e7esiyle davay\u0131 reddetse de ba\u015fvurucunun men\u015fe \u00fclkesine s\u0131n\u0131r d\u0131\u015f\u0131 edilmesinin \u00f6n\u00fcnde hukuki bir engel bulunmamaktad\u0131r.<\/p>\n<p>32. Sonu\u00e7 olarak s\u0131n\u0131r d\u0131\u015f\u0131 etme karar\u0131na kar\u015f\u0131 a\u00e7\u0131lan iptal davas\u0131nda ba\u015fvurucuya k\u00f6t\u00fc muamele riskiyle kar\u015f\u0131la\u015faca\u011f\u0131 \u00fclkeye g\u00f6nderilmesine kar\u015f\u0131 koruyan etkili usul g\u00fcvenceler sa\u011flanmam\u0131\u015ft\u0131r.<\/p>\n<p>33. A\u00e7\u0131klanan gerek\u00e7elerle Anayasa&#8217;n\u0131n 17. maddesinde g\u00fcvence alt\u0131na al\u0131nan k\u00f6t\u00fc muamele yasa\u011f\u0131n\u0131n ihlal edildi\u011fine karar verilmesi gerekir.<\/p>\n<p>VI. G\u0130DER\u0130M<\/p>\n<p>34. Ba\u015fvurucu, ihlalin tespiti ve 15.000 TL manevi tazminat talebinde bulunmu\u015ftur.<\/p>\n<p>35. Ba\u015fvuruda tespit edilen anayasal hak ihlalinin sonu\u00e7lar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131 i\u00e7in yeniden yarg\u0131lama yap\u0131lmas\u0131nda hukuki yarar ve zorunluluk bulunmaktad\u0131r. Anayasa&#8217;n\u0131n 148. ve 153. maddeleri ile 30\/3\/2011 tarihli ve 6216 say\u0131l\u0131 Anayasa Mahkemesinin Kurulu\u015fu ve Yarg\u0131lama Usulleri Hakk\u0131nda Kanun&#8217;un 50. ve 66. maddeleri uyar\u0131nca ihlal karar\u0131n\u0131n g\u00f6nderildi\u011fi yarg\u0131 mercilerince yap\u0131lmas\u0131 gereken i\u015f, yeniden yarg\u0131lama i\u015flemlerini ba\u015flat\u0131p Anayasa Mahkemesinin ihlal karar\u0131nda belirtilen ilkelere ve gerek\u00e7elere uygun bi\u00e7imde y\u00fcr\u00fct\u00fclecek yarg\u0131lama sonunda hak ihlalinin nedenlerini gidererek yeni bir karar vermektir (yeniden yarg\u0131lama konusunda bkz.
