Hukuk Dairesi&#8217;nin 28.03.2017 tarihli, 2016\/6308 Esas ve 2017\/967 Karar say\u0131l\u0131 ilam\u0131 ile, s\u00f6zle\u015fme uyar\u0131nca yap\u0131 denetim \u00fccreti ile SGK prim borcundan da y\u00fcklenicinin sorumlu tutlmas\u0131 gerekti\u011fi belirtilerek, karar bozulmu\u015f, Yerel Mahkemenin \u00f6nceki karar\u0131nda direnmesi \u00fczerine dosya incelenmek \u00fczere Yarg\u0131tay Hukuk Genel Kurulu&#8217;na g\u00f6nderilmi\u015ftir.<\/p>\n<p>Yarg\u0131tay Hukuk Genel Kurulu&#8217;nun 22.02.2022 tarihli, 2019\/(23)6-303 Esas, 2022\/180 Karar say\u0131l\u0131 ilam\u0131yla, yap\u0131 denetim hizmet bedelinden kanunen arsa sahiplerinin sorumlu oldu\u011fu, bu bedel d\u0131\u015f\u0131ndaki kalemlerin ifas\u0131 i\u00e7in 3 no.lu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn sat\u0131\u015f\u0131na izin verilmesinin yeterli olaca\u011f\u0131 belirtilerek, direnme karar\u0131n\u0131n de\u011fi\u015fik gerek\u00e7e ile bozulmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>Bozmaya uyulduktan sonra Yerel Mahkemece, davan\u0131n k\u0131smen kabul\u00fc ile toplam 69.029,86 TL eksik ve ay\u0131pl\u0131 i\u015fler bedelinin temini i\u00e7in 3 no&#8217;lu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn 75.000,00 TL&#8217;den az olmamak \u00fczere sat\u0131\u015f\u0131 i\u00e7in as\u0131l ve birle\u015fen davada davac\u0131lara izin ve yetki verilmesine karar verilmi\u015ftir.<\/p>\n<p>Karar\u0131, as\u0131l ve birle\u015fen davalarda daval\u0131 y\u00fcklenici vekili temyiz etmi\u015ftir.<\/p>\n<p>1-Taraflar\u0131n iddia, savunma ve dayand\u0131klar\u0131 belgelere, uyu\u015fmazl\u0131\u011f\u0131n hukuki nitelendirilmesi ile uygulanmas\u0131 gereken hukuk kurallar\u0131na, dava \u015fartlar\u0131na, yarg\u0131lamaya hakim olan ilkelere, ispat kurallar\u0131na ve temyiz olunan kararda belirtilen gerek\u00e7elere g\u00f6re, as\u0131l ve birle\u015fen davalarda daval\u0131 vekilinin a\u015fa\u011f\u0131daki bendin kapsam\u0131 d\u0131\u015f\u0131ndaki temyiz itirazlar\u0131 yerinde g\u00f6r\u00fclmemi\u015ftir.<\/p>\n<p>2-As\u0131l ve birle\u015fen davalar, arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesine dayal\u0131 nama ifaya ve sat\u0131\u015fa izin istemine ili\u015fkindir.<\/p>\n<p>S\u00f6zle\u015fmeden kaynaklanan edimlerini s\u00fcresi i\u00e7erisinde ifa etmeyerek temerr\u00fcde d\u00fc\u015fen y\u00fcklenicinin i\u015fi tamamlama olas\u0131l\u0131\u011f\u0131 zay\u0131f ise, i\u015f sahibi, aynen ifay\u0131 de\u011fil; nama ifa yolunu se\u00e7ebilir. Eksik kalan i\u015fin y\u00fcklenicinin nam ve hesab\u0131na, i\u015f sahibinin bizzat veya ba\u015fka y\u00fckleniciye tamamlatt\u0131r\u0131lmas\u0131na \u201cnama ifa\u201d denir. \u0130\u015f sahibi nama ifa yolunu se\u00e7ti\u011finde, ifada \u0131srar etti\u011fi anlam\u0131 \u00e7\u0131kar. Nama ifada y\u00fcklenicinin in\u015faat\u0131 tamamlama ediminin bir k\u0131sm\u0131, belirlenecek miktarda paraya d\u00f6n\u00fc\u015fmekte, i\u015f sahibi a\u00e7\u0131s\u0131ndan ise, ifa beklentisi ayn\u0131 kalmaktad\u0131r. TBK\u2019n\u0131n 113. maddesinde, yapma borcu bor\u00e7lu taraf\u0131ndan ifa edilmedi\u011fi takdirde alacakl\u0131, masraf\u0131 bor\u00e7luya ait olmak \u00fczere edimin kendisi veya ba\u015fkas\u0131 taraf\u0131ndan ifas\u0131na izin verilmesini isteyebilir; her t\u00fcrl\u00fc giderim hakk\u0131 sakl\u0131d\u0131r denilmek suretiyle nama ifa ve ifaya izin verilmesi d\u00fczenlemi\u015ftir.<\/p>\n<p>Arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesinde y\u00fckleniciye verilmesi gerekip de h\u00e2len arsa sahibi ad\u0131na kay\u0131tl\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmler varsa nama ifaya izin davas\u0131 ile birlikte eksik ve kusurlar\u0131n giderilmesi i\u00e7in gerekli masraflara harcanmak \u00fczere y\u00fckleniciye ait olan ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin sat\u0131\u015f\u0131na izin verilmesi de talep edilmektedir. Bu durumda mahkemece sat\u0131\u015f\u0131na izin talep edilen y\u00fckleniciye ait ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin de\u011feri ile eksik- kusurlu i\u015fler bedelinin h\u00fckme en yak\u0131n tarihteki piyasa rayi\u00e7leri esas al\u0131narak tespit ettirilmesi, yap\u0131 kullanma ruhsat\u0131 masraflar\u0131n\u0131n da yine h\u00fckme en yak\u0131n tarih itibariyle belirlenmesi ve bu giderlerin sat\u0131\u015f bedelinden kar\u015f\u0131lanmas\u0131na karar verilmesi gerekmektedir.<\/p>\n<p>Somut olayda mahkemece, yukar\u0131da yap\u0131lan a\u00e7\u0131klamalar\u0131n aksine, gerek sat\u0131\u015f\u0131na izin verilen 3 no.lu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm de\u011feri gerekse de eksik ve kusurlu i\u015fler bedeli ile yap\u0131 kullanma ruhsat\u0131 masraflar\u0131n\u0131n hesab\u0131nda, bozma \u00f6ncesi tanzim edilen ve yakla\u015f\u0131k 10 y\u0131l \u00f6ncesine ait g\u00fcncel de\u011ferleri yans\u0131tmayan bilirki\u015fi raporunda tespit edilen miktarlar\u0131n esas al\u0131nmas\u0131 do\u011fru olmam\u0131\u015f, h\u00fckm\u00fcn bu nedenlerle bozulmas\u0131 gerekmi\u015ftir.<\/p>\n<p>SONU\u00c7: Yukar\u0131da (1) numaral\u0131 bentte a\u00e7\u0131klanan nedenlerle as\u0131l ve birle\u015fen davalarda daval\u0131 vekilinin di\u011fer temyiz itirazlar\u0131n\u0131n reddine, (2) numaral\u0131 bentte a\u00e7\u0131klanan nedenlerle yerel mahkemece verilen karar usul ve yasaya ayk\u0131r\u0131 oldu\u011fundan as\u0131l ve birle\u015fen davalarda daval\u0131 vekilinin temyiz itirazlar\u0131n\u0131n kabul\u00fc ile h\u00fckm\u00fcn as\u0131l ve birle\u015fen davalarda daval\u0131 yarar\u0131na BOZULMASINA, pe\u015fin al\u0131nan harc\u0131n istek halinde temyiz edene iadesine, karara kar\u015f\u0131 tebli\u011f tarihinden itibaren 15 g\u00fcn i\u00e7inde karar d\u00fczeltme isteminde bulunulabilece\u011fine, 19.09.2024 g\u00fcn\u00fcnde oy birli\u011fiyle karar verildi.<\/p>\n<p>&#8212;<\/p>\n<p>T.C.<\/p>\n<p>Yarg\u0131tay<\/p>\n<p>6. Hukuk Dairesi<\/p>\n<p>2023\/2292 E., 2024\/3924 K.<\/p>\n<p>&#8220;\u0130\u00e7tihat Metni&#8221;<\/p>\n<p>\u0130NCELENEN KARARIN<br \/>\nMAHKEMES\u0130 :Asliye Hukuk Mahkemesi<br \/>\nSAYISI : 2021\/54 E., 2022\/166 K.<br \/>\nKARAR : Davan\u0131n Reddi<\/p>\n<p>Davac\u0131lar vekili dava dilek\u00e7esinde \u00f6zetle, davac\u0131larla daval\u0131 y\u00fcklenici aras\u0131nda d\u00fczenleme \u015feklinde 14.03.2001 tarihli kat kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi imzaland\u0131\u011f\u0131n\u0131, in\u015faat\u0131n s\u00fcresinde bitirilmemesi ve plan projesine uygun yap\u0131lmamas\u0131 nedeniyle alacak davas\u0131 a\u00e7\u0131ld\u0131\u011f\u0131n\u0131 ve ilgili mahkemece davalar\u0131n\u0131n kabul edildi\u011fini, 37.903,95 T\u00fcrk Liras\u0131&#8217;n\u0131n dava tarihinden ge\u00e7erli olmak \u00fczere yasal faiziyle birlikte \u00f6denmesine karar verilip karar\u0131n kesinle\u015fti\u011fini, alaca\u011f\u0131n tahsili i\u00e7in icra takibine ge\u00e7ildi\u011fini, ancak borcu tahsil edemediklerini, apartman sakinleri ve davac\u0131lar\u0131n iskan ruhsat\u0131n\u0131 ald\u0131klar\u0131n\u0131, y\u00fcklenicinin vergi dairesi ve SGK nezdindeki bor\u00e7lar\u0131n\u0131 da \u00f6demedi\u011fini, t\u00fcm bu alacaklar\u0131n\u0131n tahsili i\u00e7in s\u00f6zle\u015fmeye g\u00f6re her ne kadar tapuda davac\u0131lar ad\u0131na kay\u0131tl\u0131ysa da y\u00fckleniciye ait olan iki dairenin sat\u0131\u015f\u0131na izin verilmesini talep ve dava etmi\u015ftir.<\/p>\n<p>Daval\u0131, davaya cevap vermemi\u015ftir.<\/p>\n<p>\u0130lk Derece Mahkemesince; dava a\u00e7\u0131ld\u0131\u011f\u0131 tarihte daval\u0131 \u015firketin ticaret sicil kayd\u0131ndan silindi\u011fi gerek\u00e7esiyle, davan\u0131n dava \u015fart\u0131 yoklu\u011fundan usulden reddine karar verilmi\u015ftir.<\/p>\n<p>Bu karara kar\u015f\u0131, davac\u0131lar vekilince temyiz yoluna ba\u015fvurulmas\u0131 \u00fczerine Dairemizin (Kapat\u0131lan 15. Hukuk Dairesi) 04.12.2019 tarih ve 2019\/1713 E., 2019\/4988 K. say\u0131l\u0131 ilam\u0131yla temyiz i\u015flemleri s\u0131ras\u0131nda mahkeme ilam\u0131 ile \u015firketin ihyas\u0131na karar verildi\u011fi ve bu karar\u0131n 26.01.2018 tarihinde kesinle\u015fti\u011fi, daval\u0131 \u015firketin bu \u015fekilde ihya edildi\u011fi ve yeniden sicile kay\u0131t edilerek t\u00fczel ki\u015filik kazand\u0131\u011f\u0131, mahkemece, daval\u0131 \u015firketin ihya edilmesi i\u00e7in davac\u0131ya s\u00fcre verilerek ihyas\u0131ndan sonra davan\u0131n esas\u0131na girilerek karar verilmesi gerekirken, tamamlanabilir dava \u015fart\u0131 y\u00f6n\u00fcnden davac\u0131ya s\u00fcre verilmeksizin davan\u0131n dava \u015fart\u0131 yoklu\u011fundan reddine karar verilmesinin hatal\u0131 oldu\u011fu gerek\u00e7esiyle, karar\u0131n bozulmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>Mahkemece bozmaya uyularak yap\u0131lan yarg\u0131lama sonucunda; daval\u0131n\u0131n 12.07.2010 g\u00fcn\u00fc taraflar aras\u0131ndaki s\u00f6zle\u015fme gere\u011fince iskan raporunu da alarak edimini yerine getirdi\u011fi, davac\u0131lar\u0131n TBK 474. madde kapsam\u0131nda bir itirazlar\u0131n\u0131n olmad\u0131\u011f\u0131, b\u00f6ylece daval\u0131n\u0131n eser s\u00f6zle\u015fmesi kapsam\u0131nda iskan raporunu da alarak eseri tamamlad\u0131\u011f\u0131, davac\u0131n\u0131n da itiraz etmeyerek bunu kabul etti\u011fi, bu halde davac\u0131lar\u0131n art\u0131k s\u00f6zle\u015fme kapsam\u0131nda daval\u0131dan talep edebilecekleri nama ifa haklar\u0131n\u0131n kalmad\u0131\u011f\u0131 gerek\u00e7esiyle, davan\u0131n reddine karar verilmi\u015ftir.<\/p>\n<p>Bu karara kar\u015f\u0131 davac\u0131lar vekilince s\u00fcresinde temyiz yoluna ba\u015fvurulmas\u0131 \u00fczerine dosya incelendi, gere\u011fi konu\u015fulup d\u00fc\u015f\u00fcn\u00fcld\u00fc.<\/p>\n<p>Dava; arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesine dayal\u0131 nama ifaya ve sat\u0131\u015fa izin verilmesine ili\u015fkindir.<\/p>\n<p>S\u00f6zle\u015fmeden kaynaklanan edimlerini s\u00fcresi i\u00e7erisinde ifa etmeyerek temerr\u00fcde d\u00fc\u015fen y\u00fcklenicinin i\u015fi tamamlama olas\u0131l\u0131\u011f\u0131 zay\u0131f ise, i\u015f sahibi, aynen ifay\u0131 de\u011fil; nama ifa yolunu se\u00e7ebilir. Hukuk Dairesince Mahkeme karar\u0131n\u0131n bozulmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>Mahkemece bozmaya uyularak yeniden yap\u0131lan yarg\u0131lama sonucunda; as\u0131l davan\u0131n reddine, kar\u015f\u0131 davan\u0131n k\u0131smen kabul\u00fcne karar verilmi\u015ftir.<\/p>\n<p>Mahkeme karar\u0131 taraf vekillerince temyiz edilmekle; kesinlik, s\u00fcre, temyiz \u015fart\u0131 ve di\u011fer usul eksiklikleri y\u00f6n\u00fcnden yap\u0131lan \u00f6n inceleme sonucunda, temyiz dilek\u00e7esinin kabul\u00fcne karar verildikten ve Tetkik H\u00e2kimi taraf\u0131ndan haz\u0131rlanan rapor dinlendikten sonra dosyadaki belgeler incelenip gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>I. DAVA<\/p>\n<p>Davac\u0131 vekili dava dilek\u00e7esinde; davac\u0131 y\u00fcklenici ile daval\u0131 arsa sahibi aras\u0131nda 17.07.2006 tarihli arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi imzaland\u0131\u011f\u0131n\u0131, davac\u0131n\u0131n s\u00f6zle\u015fme uyar\u0131nca \u00fczerine d\u00fc\u015fen edimini yerine getirmesine ra\u011fmen daval\u0131n\u0131n davac\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerinin tapu devirlerini yapmad\u0131\u011f\u0131n\u0131 ileri s\u00fcrerek s\u00f6zle\u015fmeye g\u00f6re davac\u0131ya b\u0131rak\u0131lan 4 ve 6 no.lu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin tamam\u0131n\u0131n, 5 no.lu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn 1\/2 hissesinin tapu kayd\u0131n\u0131n iptali ile davac\u0131 ad\u0131na tescilini talep ve dava etmi\u015f, bilahare davas\u0131n\u0131 s\u00f6zle\u015fmenin ileriye etkili feshi ile imalat bedelinin tahsili olarak \u0131slah etmi\u015ftir.<\/p>\n<p>II. CEVAP\/KAR\u015eI DAVA<\/p>\n<p>Daval\u0131 vekili cevap ve kar\u015f\u0131 dava dilek\u00e7esinde; davac\u0131n\u0131n edimini yerine getirmedi\u011fini, in\u015faat\u0131n halen tamamlanmam\u0131\u015f oldu\u011funu savunarak as\u0131l davan\u0131n reddini istemi\u015f, kar\u015f\u0131 davas\u0131nda ise s\u00f6zle\u015fme gere\u011fince daval\u0131 y\u00fckleniciye ait olan daireler sat\u0131lmak suretiyle in\u015faat\u0131n bitirilmesi ve davac\u0131n\u0131n t\u00fcm zararlar\u0131n\u0131n kar\u015f\u0131lanmas\u0131 hususunda yetki verilmesini, s\u00f6zle\u015fme gere\u011fince davac\u0131ya \u00f6denmesi gereken kira paralar\u0131n\u0131n sat\u0131\u015f paras\u0131ndan kar\u015f\u0131lanmas\u0131n\u0131 ve daval\u0131ya ait olup da davac\u0131 arsa sahibi taraf\u0131ndan yap\u0131lan masraflar\u0131n da sat\u0131\u015f paras\u0131ndan kar\u015f\u0131lanmas\u0131n\u0131 talep etmi\u015ftir.<\/p>\n<p>III. MAHKEME KARARI<\/p>\n<p>Mahkemenin 19.01.2016 tarihli ve 2013\/487 Esas, 2016\/30 Karar say\u0131l\u0131 karar\u0131 ile iddia, savunma, benimsenen bilirki\u015fi raporu ve t\u00fcm dosya kapsam\u0131na g\u00f6re, davac\u0131 kar\u015f\u0131 daval\u0131n\u0131n ekonomik zorlu\u011fu kapsam\u0131nda davaya konu in\u015faat\u0131n tamamlama imkan\u0131 kalmad\u0131\u011f\u0131, taraflar aras\u0131nda uyu\u015fmazl\u0131\u011f\u0131 sulh yolu ile \u00e7\u00f6zmenin m\u00fcmk\u00fcn olmad\u0131\u011f\u0131, taraflardan birisine di\u011ferine verilmesi gereken dairelerin sat\u0131\u015f\u0131 hususunda yetki verilmesinin hakkaniyetle ba\u011fda\u015fmayaca\u011f\u0131, as\u0131l davada davac\u0131n\u0131n s\u00f6zle\u015fme gere\u011fince kendisine verilmesi gereken dairelerin tescili veya sat\u0131\u015f\u0131 hususunda yetki talep etti\u011fi, daval\u0131-kar\u015f\u0131 davac\u0131n\u0131n da benzer bir yetki talep etti\u011fi ancak taraflar\u0131n birbirlerine &#8230; duymamas\u0131 itibariyle bu durumun m\u00fcmk\u00fcn olmad\u0131\u011f\u0131, yap\u0131lan s\u00f6zle\u015fmenin feshi y\u00f6n\u00fcnde taraf iradelerinin z\u0131mni olarak birle\u015fti\u011finin kabul\u00fc gerekti\u011fi belirtilerek, as\u0131l davan\u0131n kabul\u00fcne, kar\u015f\u0131 davan\u0131n k\u0131smen kabul\u00fc ile 114.287,50 TL kira tazminat\u0131n\u0131n \u0131slah tarihinden itibaren i\u015fleyecek yasal faizi ile birlikte davac\u0131-kar\u015f\u0131 daval\u0131dan tahsiline karar verilmi\u015ftir.<\/p>\n<p>IV. BOZMA VE BOZMADAN SONRAK\u0130 YARGILAMA S\u00dcREC\u0130<\/p>\n<p>A. Bozma Karar\u0131<br \/>\n1. Mahkemenin yukar\u0131da belirtilen karar\u0131na kar\u015f\u0131 s\u00fcresi i\u00e7inde daval\u0131-kar\u015f\u0131 davac\u0131 vekili temyiz isteminde bulunmu\u015ftur.<\/p>\n<p>2. Yarg\u0131tay 23. Hukuk Dairesinin 28.01.2019 tarihli ve 2016\/2365 Esas, 2019\/169 Karar say\u0131l\u0131 karar\u0131yla, kar\u015f\u0131 davada davac\u0131 vekilinin temyiz itirazlar\u0131 y\u00f6n\u00fcnden: davac\u0131 arsa sahibi nama ifaya izin talep ederek s\u00f6zle\u015fmenin ayakta kalmas\u0131n\u0131 ama\u00e7lamakta olup, mahkemenin s\u00f6zle\u015fmenin feshi y\u00f6n\u00fcnde taraf iradelerinin z\u0131mnen birle\u015fti\u011fine dair tespitinde isabet bulunmad\u0131\u011f\u0131, mahkemece, kar\u015f\u0131 davada davac\u0131n\u0131n nama ifaya izin talebi de\u011ferlendirilerek, bu do\u011frultuda bir karar verilmesi gerekti\u011fi, kabule g\u00f6re as\u0131l davada mahkemece, imalat bedeli tespit edilirken tespitlerin rayi\u00e7 bedeller dikkate al\u0131narak yap\u0131lmas\u0131 gere\u011fi belirtilerek karar\u0131n kar\u015f\u0131 davada davac\u0131 yarar\u0131na bozulmas\u0131na, as\u0131l davada daval\u0131 vekilinin temyiz itirazlar\u0131n\u0131n \u015fimdilik incelenmesine yer olmad\u0131\u011f\u0131na karar verilmi\u015ftir.<\/p>\n<p>B. Mahkemece Bozmaya Uyularak Verilen Karar<br \/>\nMahkemenin yukar\u0131da tarih ve say\u0131s\u0131 belirtilen karar\u0131 ile 10\/09\/2020 ke\u015fif tarihi itibariyle i\u015fin %57,50&#8217;lik k\u0131sm\u0131n\u0131n tamamland\u0131\u011f\u0131n\u0131n belirtildi\u011fi, daval\u0131 kar\u015f\u0131 davac\u0131n\u0131n kar\u015f\u0131 davada i\u015f nedeniyle gecikme cezas\u0131 ve m\u00fcvekkilinin yapt\u0131\u011f\u0131 \u00f6demeler nedeniyle alacak ve nama ifa talebinde bulundu\u011fu, Elaz\u0131\u011f Belediyesi Ba\u015fkanl\u0131\u011f\u0131, SGK Elaz\u0131\u011f \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc ve vergi dairelerinden in\u015faat nedeniyle 4.765,04TL bor\u00e7 bulundu\u011funun bildirildi\u011fi, daval\u0131 kar\u015f\u0131 davac\u0131n\u0131n 5.126,60TL in\u015faat nedeniyle vergi borcu \u00f6dedi\u011fi, i\u015fin dava tarihi itibariyle tamamlanmam\u0131\u015f olmas\u0131 nedeniyle daval\u0131 kar\u015f\u0131 davac\u0131n\u0131n 114.287,50TL kira alaca\u011f\u0131 bulundu\u011fu, yine i\u015fin tamamlanmas\u0131 i\u00e7in dava tarihi itibariyle piyasa fiyatlar\u0131na g\u00f6re yap\u0131m maliyetinin 159.502,00TL oldu\u011fu, bor\u00e7 bedeli ve yap\u0131m maliyeti dikkate al\u0131nd\u0131\u011f\u0131nda i\u015fin tamamlanmas\u0131 i\u00e7in 164.267,04TL gerekli oldu\u011fu, daval\u0131 kar\u015f\u0131 davac\u0131n\u0131n i\u015fin ayakta kalmas\u0131n\u0131 talep etti\u011fi, davac\u0131 kar\u015f\u0131 daval\u0131ya kalacak ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin her birinin mevcut haliyle 180.000,00TL \u00fczerinden sat\u0131labilece\u011fi, davac\u0131 kar\u015f\u0131 daval\u0131 taraf\u0131ndan fesih ve tazminat talebinde bulunulmu\u015f ise de daval\u0131n\u0131n i\u015fin ayakta kalmas\u0131n\u0131 talep etti\u011fi, bu a\u015famada s\u00f6zle\u015fmenin feshinin taraflar\u0131n lehine olmad\u0131\u011f\u0131 hususlar\u0131 dikkate al\u0131narak as\u0131l davan\u0131n reddine, kar\u015f\u0131 davan\u0131n k\u0131smen kabul\u00fcne, 114.287,50TL kira alaca\u011f\u0131 ve 5.126,60TL yap\u0131lan \u00f6demeler olmak \u00fczere toplam 119.414,10TL&#8217;nin \u0131slah tarihi olan 09\/03\/2015 tarihinden itibaren i\u015fleyecek yasal faizi ile birlikte davac\u0131 kar\u015f\u0131 daval\u0131dan al\u0131narak daval\u0131 kar\u015f\u0131 davac\u0131ya verilmesine, fazlaya ili\u015fkin talebin reddine, 164.267,04TL&#8217;nin kar\u015f\u0131lanmas\u0131 amac\u0131yla daval\u0131 kar\u015f\u0131 davac\u0131ya nama ifaya 18.11.2020 tarihli bilirki\u015fi raporunda tespit edilen ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm ve ortak yerlerdeki eksik ve ay\u0131pl\u0131 i\u015fleri tamamlamaya ve iskan ruhsat\u0131 almaya) izin verilmesine ve s\u00f6zle\u015fme uyar\u0131nca davac\u0131\/kar\u015f\u0131 daval\u0131ya verilmesi gereken Elaz\u0131\u011f ili Merkez \u0130l\u00e7esi Mustafapa\u015fa mahallesi 337 ada 445 parsel say\u0131l\u0131 ta\u015f\u0131nmaz \u00fczerinde kay\u0131tl\u0131 -3 kat 4 no.lu olmak \u00fczere 1 adet ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn daval\u0131\/kar\u015f\u0131 davac\u0131 taraf\u0131ndan sat\u0131\u015f\u0131na izin ve yetki verilmesine, bu ta\u015f\u0131nmaz \u00fczerine dava sonuna kadar devir ve temlikinin \u00f6nlenmesi i\u00e7in tedbir konulmas\u0131na, harcama bedelinin dairenin sat\u0131\u015f bedelinden fazla olmas\u0131 halinde daval\u0131 \/ kar\u015f\u0131 davac\u0131n\u0131n fazlaya ili\u015fkin haklar\u0131n\u0131n sakl\u0131 tutulmas\u0131na, eksik olmas\u0131 halinde sat\u0131\u015f bedelinden artan miktar\u0131n davac\u0131 \/ kar\u015f\u0131 daval\u0131 y\u00fckleniciye iadesine, karar verilmi\u015ftir.<\/p>\n<p>V. TEMY\u0130Z<\/p>\n<p>A. Temyiz Yoluna Ba\u015fvuranlar<br \/>\nMahkemenin yukar\u0131da belirtilen karar\u0131na kar\u015f\u0131 s\u00fcresi i\u00e7inde taraf vekilleri temyiz isteminde bulunmu\u015ftur.<\/p>\n<p>B. Temyiz Sebepleri<br \/>\nDaval\u0131-kar\u015f\u0131 davac\u0131 vekili temyiz dilek\u00e7esinde ; kira bedelleri hakk\u0131nda bozma \u00f6ncesi verilen karar\u0131n davac\u0131-k.daval\u0131 taraf\u00e7a temyiz edilmedi\u011finden kesinle\u015fti\u011fini, davac\u0131-k.daval\u0131ya ait olmas\u0131na ra\u011fmen m\u00fcvekkili taraf\u0131ndan yap\u0131lan \u00f6demelerin sadece 5.126,60-TL nin tahsiline karar verilmesinin hatal\u0131 oldu\u011fu, yap\u0131lan \u00f6demelerin talepleri gere\u011fince uyarlamaya tabi tutulmas\u0131 ve talep tarihinden itibaren yasal faize h\u00fckmedilmesi gerekti\u011fi, bilirki\u015fi raporuna ve mahkemenin kabul\u00fcne g\u00f6re de dava konusu in\u015faat\u0131n %57,50 seviyesinde bitirilmi\u015f oldu\u011fu ve in\u015faat\u0131n kalan k\u0131sm\u0131n\u0131n 164.267,04-TL ye bitirilmesinin olanaks\u0131z oldu\u011fu, mahkeme karar\u0131n\u0131n infaz\u0131nda fiili imkans\u0131zl\u0131k bulundu\u011fu, ilamda belirtilen miktar ile sadece binan\u0131n asans\u00f6r\u00fcn\u00fcn dahi tak\u0131lmas\u0131n\u0131n m\u00fcmk\u00fcn olmad\u0131\u011f\u0131, mahkeme karar\u0131n\u0131n infazda teredd\u00fcde mahal vermeyecek \u015fekilde talep, itiraz ve def&#8217;i olarak ileri s\u00fcrd\u00fckleri t\u00fcm talepleri hakk\u0131nda karar verilmesi gerekmekte iken talep, def&#8217;i ve itirazlar\u0131 hakk\u0131nda karar verilmedi\u011fi, s\u00f6zle\u015fme h\u00fck\u00fcmlerinin yerine getirilmesi ve yap\u0131 kullanma izin belgesi al\u0131nana kadar i\u015fleyecek kira alacaklar\u0131 ile di\u011fer alacak ve zararlar\u0131n\u0131n davac\u0131-k.daval\u0131ya ait ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin sat\u0131\u015f\u0131ndan \u00f6denmesini ileri s\u00fcrmelerine ra\u011fmen yerel mahkemenin bu konuda karar vermedi\u011fini beyanla, mahkeme karar\u0131n\u0131n bozulmas\u0131n\u0131 istemi\u015flerdir.<\/p>\n<p>Davac\u0131-kar\u015f\u0131 daval\u0131 vekili temyiz dilek\u00e7esinde; dava konusu in\u015faattaki c\u00fcz&#8217;i miktarl\u0131 eksikliklerin tamamlanamamas\u0131na kar\u015f\u0131 taraf\u0131n kusurlu davran\u0131\u015flar\u0131n\u0131n sebep oldu\u011fu ve m\u00fcvekkilinin s\u00f6zle\u015fmenin feshinde hakl\u0131 oldu\u011fu, yerel mahkemece s\u00f6zle\u015fmenin feshine karar verilerek sebepsiz zenginle\u015fme h\u00fck\u00fcmleri dahilinde dava konusu uyu\u015fmazl\u0131\u011f\u0131n \u00e7\u00f6z\u00fclmesi gerekti\u011fini, mahkemece s\u00f6zle\u015fme h\u00fck\u00fcmlerine ayk\u0131r\u0131 al\u0131nan bilirki\u015fi raporlar\u0131n\u0131n h\u00fckme esas al\u0131nd\u0131\u011f\u0131, s\u00f6zle\u015fme gere\u011fince yap\u0131m\u0131 arsa sahibine ait olan d\u00fckkan\u0131n kira bedelleri ve eksik i\u015flerinin de hesaplamalara dahil edildi\u011fi, bilirki\u015fi raporlar\u0131nda dava konusu in\u015faat\u0131n tamamlanma oran\u0131 d\u00fc\u015f\u00fck hesapland\u0131\u011f\u0131, eksik ve kusurlu i\u015fler bedelinin y\u00fcksek hesapland\u0131\u011f\u0131, uzun s\u00fcren yarg\u0131lama s\u00fcrecinden dolay\u0131 in\u015faatta meydana gelen eskime ve y\u0131pranmalar\u0131n in\u015faat\u0131n tamamlanma oran\u0131ndan d\u00fc\u015f\u00fcrd\u00fc\u011f\u00fc, tamamlanma oran\u0131n\u0131n dava tarihi \u00fczerinden de\u011ferlendirilmesi gerekti\u011fi, s\u00f6zle\u015fme gere\u011fince yap\u0131m\u0131 arsa sahibine ait olan d\u00fckkan i\u00e7in m\u00fcvekkili taraf\u0131ndan yap\u0131lan harcamalar\u0131n dikkate al\u0131nmad\u0131\u011f\u0131, yine arsa sahibine ait olmas\u0131 gereken bir k\u0131s\u0131m har\u00e7 ve vergilerin m\u00fcvekkiline y\u00fckletilmesinin hatal\u0131 oldu\u011fu, kar\u015f\u0131 dava y\u00f6n\u00fcnden nama ifaya ili\u015fkin verilen karar\u0131n yeterli a\u00e7\u0131kl\u0131kta olmad\u0131\u011f\u0131, h\u00fckm\u00fcn infaz\u0131n\u0131n m\u00fcvekkilin hak kayb\u0131na u\u011framas\u0131na sebebiyet verece\u011fi, mahkemece ayr\u0131ma gidilmeden b\u00fct\u00fcn in\u015faat \u00fczerinden hesaplanan eksik ve kusurlu i\u015flerin nama ifa kapsam\u0131nda arsa sahibince kar\u015f\u0131lanmas\u0131na h\u00fckmedilmesinin hatal\u0131 oldu\u011fu, mahkeme gerek\u00e7eli karar\u0131nda, nama ifa kapsam\u0131nda daval\u0131- kar\u015f\u0131 davac\u0131ya sat\u0131\u015f\u0131 i\u00e7in yetki verilen dava konusu ta\u015f\u0131nmaz\u0131n sat\u0131\u015f bedeline ili\u015fkin herhangi bir a\u00e7\u0131klama yap\u0131lmad\u0131\u011f\u0131, sat\u0131\u015f\u0131 i\u00e7in daval\u0131-kar\u015f\u0131 davac\u0131ya yetki verilen dava konusu ta\u015f\u0131nmaz\u0131n, g\u00fcncel piyasa rayi\u00e7ine g\u00f6re de\u011ferinin tespit edilerek, tespit edilen bu de\u011ferden alt\u0131na sat\u0131lmamak \u00fczere sat\u0131\u015f izni ve yetkisi verilmesi gerekti\u011fini beyanla karar\u0131n bozulmas\u0131n\u0131 istemi\u015flerdir.<\/p>\n<p>C. Gerek\u00e7e<br \/>\n1. Uyu\u015fmazl\u0131k ve Hukuki Nitelendirme<br \/>\nUyu\u015fmazl\u0131k, as\u0131l davada y\u00fcklenicinin arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi uyar\u0131nca kendisine d\u00fc\u015fecek ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerinin tapu kayd\u0131n\u0131n iptali ile tescili istemi iken \u0131slahla s\u00f6zle\u015fmenin ileriye etkili feshi ile imalat bedelinin tahsili istemi, kar\u015f\u0131 davada ise ayn\u0131 s\u00f6zle\u015fmeye dayal\u0131 nama ifaya izin ve tazminat istemine ili\u015fkindir.<\/p>\n<p>2. \u0130lgili Hukuk<br \/>\n6100 say\u0131l\u0131 Hukuk Muhakemeleri Kanunu&#8217;nun ge\u00e7ici 3 nc\u00fc maddesinin ikinci f\u0131kras\u0131 atf\u0131yla uygulanmas\u0131na devam olunan m\u00fclga 1086 say\u0131l\u0131 Hukuk Usul\u00fc Muhakemeleri Kanununun 428 nci maddesi, 438 nci maddesinin yedi, sekiz ve dokuzuncu f\u0131kralar\u0131 ile 439 ncu maddesinin ikinci f\u0131kras\u0131.<\/p>\n<p>3. De\u011ferlendirme<br \/>\n1. Taraflar\u0131n iddia, savunma ve dayand\u0131klar\u0131 belgelere, uyu\u015fmazl\u0131\u011f\u0131n hukuki nitelendirilmesi ile uygulanmas\u0131 gereken hukuk kurallar\u0131na, dava \u015fartlar\u0131na, yarg\u0131lamaya h\u00e2kim olan ilkelere, ispat kurallar\u0131na ve temyiz olunan kararda belirtilen gerek\u00e7elere g\u00f6re taraf vekillerinin a\u015fa\u011f\u0131daki paragraflar\u0131n kapsam\u0131 d\u0131\u015f\u0131ndaki temyiz itirazlar\u0131 yerinde g\u00f6r\u00fclmemi\u015ftir.<\/p>\n<p>2. Kar\u015f\u0131 davada dava, arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesine dayal\u0131 nama ifa kapsam\u0131nda sat\u0131\u015fa izin talebine ili\u015fkindir.<\/p>\n<p>Arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat yap\u0131m s\u00f6zle\u015fmesinden kaynaklanan uyu\u015fmazl\u0131klarda y\u00fcklenicinin s\u00fcresi i\u00e7inde i\u015fin tamamlanmamas\u0131 ya da ay\u0131pl\u0131 olarak yapmas\u0131 halinde eksik ve kusurlu i\u015flerin y\u00fcklenici nam\u0131na arsa sahibince infaz\u0131na izin verilmesi m\u00fcmk\u00fcnd\u00fcr. Dairemizin yerle\u015fik i\u00e7tihat ve uygulamalar\u0131nda nama ifaya izin verilirken giderilmesi gereken eksikler, ay\u0131plar\u0131n nelerden ibaret oldu\u011fu ve bunlar\u0131n avans niteli\u011findeki giderim bedellerinin h\u00fck\u00fcm f\u0131kras\u0131nda infaz\u0131 m\u00fcmk\u00fcn olacak \u015fekilde g\u00f6sterilmesi gerekti\u011fi kabul edilmektedir. Ger\u00e7ekten, yapma borcu, bor\u00e7lu taraf\u0131ndan ifa edilmedi\u011fi takdirde alacakl\u0131, (arsa sahibi) masraf\u0131 bor\u00e7luya ait olmak \u00fczere edimin kendisi veya ba\u015fkas\u0131 taraf\u0131ndan ifas\u0131na izin verilmesini isteyebilir. Nama ifaya izin verilebilmesi i\u00e7in s\u00f6zle\u015fmenin feshedilmemi\u015f, yani y\u00fcr\u00fcrl\u00fckte olmas\u0131, bor\u00e7lunun edimin ifas\u0131nda temerr\u00fcte d\u00fc\u015fmesi ve borcun &#8220;yapma borcuna&#8221; dair bulunmas\u0131 gerekir. Hakim bu talep \u00fczerine konusunda uzman bilirki\u015fi yard\u0131m\u0131 ile ke\u015fif yaparak eksik b\u0131rak\u0131lan ve ay\u0131pl\u0131 yap\u0131lm\u0131\u015f olan i\u015f kalemlerini ve bunlar\u0131n tamamlanmas\u0131 ile giderilmesi masraflar\u0131n\u0131, imal\u00e2t\u0131n metraj, y\u00f6ntem ve takribi bedellerini, di\u011fer kurumlara olan bor\u00e7lar\u0131 ve isk\u00e2n masraflar\u0131n\u0131 tahminen saptayarak izin karar\u0131 verir. \u0130zin karar\u0131n\u0131n h\u00fck\u00fcm f\u0131kras\u0131nda da, eksik ve ay\u0131pl\u0131 i\u015f kalemleri ve di\u011fer bor\u00e7 ve masraflar\u0131n her birinin tahmini masraflar\u0131 tek tek g\u00f6sterilir. Genel nitelikli yetki ve izin verilemez. Mahkemece, infazda teredd\u00fcde yol a\u00e7mamak i\u00e7in nama ifas\u0131na izin ve yetki verilen i\u015f ve i\u015flemlerin h\u00fck\u00fcm f\u0131kras\u0131nda tek tek belirtilip g\u00f6sterilmesi veya bu nitelikte oldu\u011fu denetim sonucu anla\u015f\u0131lacak infaz\u0131 m\u00fcmk\u00fcn h\u00fck\u00fcm kurulmas\u0131 ve nama ifa i\u00e7in belirlenen giderlerin ne suretle kar\u015f\u0131lanaca\u011f\u0131n\u0131n da g\u00f6sterilmesi gerekir. Ayr\u0131ca arsa sahiplerince nama ifa kapsam\u0131nda talep edilen eksik-ay\u0131pl\u0131 i\u015fler vs. masraflar\u0131n da h\u00fckme en yak\u0131n tarih itibariyle serbest piyasa rayi\u00e7leri dikkate al\u0131nmak suretiyle tespiti gerekmektedir.<\/p>\n<p>Somut olayda, mahkemece i\u015fin tamamlanmas\u0131 i\u00e7in dava tarihi itibariyle piyasa fiyatlar\u0131na g\u00f6re yap\u0131m maliyetinin 159.502,00TL oldu\u011fu, bor\u00e7 bedeli ve yap\u0131m maliyeti dikkate al\u0131nd\u0131\u011f\u0131nda i\u015fin tamamlanmas\u0131 i\u00e7in 164.267,04TL gerekli oldu\u011fu, davac\u0131 kar\u015f\u0131 daval\u0131ya kalacak ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin her birinin mevcut haliyle ke\u015fif tarihi itibariyle de\u011ferinin 180.000,00TL olarak belirlendi\u011fi, dava tarihinin 2013 y\u0131l\u0131, ke\u015fif tarihinin 10.09.2020 oldu\u011fu, bedellerin g\u00fcncel olmad\u0131\u011f\u0131, h\u00fckm\u00fcn de yukar\u0131da belirtildi\u011fi \u015fekilde kurulmad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>O halde mahkemece, yeniden olu\u015fturulacak konusunda uzman teknik bilirki\u015fi kurulu marifetiyle mahallinde ke\u015fif yap\u0131l\u0131p, davac\u0131 arsa sahibinin nama ifa isteyebilece\u011fi eksik ve kusurlu i\u015flerin nelerden ibaret oldu\u011fu ve bunlar\u0131n giderim bedelleri ile ke\u015fif tarihi itibariyle sat\u0131\u015f\u0131na izin verilmesi talep edilen y\u00fckleniciye isabet eden ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn piyasa rayi\u00e7leri uyar\u0131nca bedeli konusunda, gerek\u00e7eli ve denetime elveri\u015fli rapor al\u0131nmal\u0131, nama ifa suretiyle davac\u0131 arsa sahibi taraf\u0131ndan yap\u0131lmas\u0131na izin verilen eksik ve ay\u0131pl\u0131 i\u015flerin nelerden ibaret oldu\u011fu ve bunlar\u0131n avans niteli\u011findeki giderim bedeli ile iskan masraflar\u0131 tutar\u0131 belirtilip, yine arsa sahiplerince yap\u0131lan \u00f6demeler ve daha \u00f6nce h\u00fck\u00fcm alt\u0131na al\u0131nan kira tazminat\u0131 ile birlikte bunlar\u0131 kar\u015f\u0131lamak \u00fczere sat\u0131lmas\u0131 gereken ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn asgari sat\u0131\u015f bedeli h\u00fck\u00fcm f\u0131kras\u0131nda a\u00e7\u0131k ve infaz\u0131 m\u00fcmk\u00fcn olacak \u015fekilde g\u00f6sterilerek karar verilmesi gerekirken, eksik incelemeye dayal\u0131 verilen karar do\u011fru olmam\u0131\u015f, karar\u0131n bozulmas\u0131 uygun bulunmu\u015ftur.<\/p>\n<p>V. Tebligata ra\u011fmen ba\u015fka gelen olmad\u0131\u011f\u0131ndan onlar\u0131n yoklu\u011funda duru\u015fmaya ba\u015flanarak haz\u0131r bulunan avukatlar\u0131n s\u00f6zl\u00fc a\u00e7\u0131klamalar\u0131 dinlenildikten ve temyiz dilek\u00e7esinin s\u00fcresinde oldu\u011fu anla\u015f\u0131ld\u0131ktan sonra dosya incelendi, gere\u011fi konu\u015fulup d\u00fc\u015f\u00fcn\u00fcld\u00fc.<\/p>\n<p>KARAR<\/p>\n<p>As\u0131l davada davac\u0131lar vekili, m\u00fcvekkilleri ile daval\u0131 y\u00fcklenici aras\u0131nda 28.05.2007 tarihli arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi d\u00fczenlendi\u011fini, m\u00fcvekkillerinin maliki bulundu\u011fu 2 parsel say\u0131l\u0131 ta\u015f\u0131nmaz \u00fczerine in\u015faat yap\u0131m\u0131na ba\u015fland\u0131\u011f\u0131n\u0131, s\u00f6zle\u015fmede anahtar teslimi olarak 01.08.2009 tarihinde tesliminin kararla\u015ft\u0131r\u0131ld\u0131\u011f\u0131n\u0131, ancak iskan ruhsat\u0131n\u0131n al\u0131nmad\u0131\u011f\u0131n\u0131, eksik imalatlar\u0131n bulundu\u011funu, y\u00fckleniciye verilmesi kararla\u015ft\u0131r\u0131lan 10,11, ve 30 no\u2019lu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin tapular\u0131n\u0131n y\u00fckleniciye devredilmedi\u011fini ileri s\u00fcrerek, 10 ve 30 no\u2019lu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmler y\u00f6n\u00fcnden nama ifaya izin ve sat\u0131\u015f yetkisi ile 7.000,00 TL gecikme tazminat\u0131n\u0131n tahsilini talep ve dava etmi\u015ftir.<br \/>\nAs\u0131l davada daval\u0131 y\u00fcklenici davaya cevap vermemi\u015ftir.<\/p>\n<p>Birle\u015fen davada davac\u0131 vekili, daval\u0131lardan y\u00fcklenicinin 30 no\u2019lu daireyi 02.06.2007 tarihinde i\u015f kar\u015f\u0131l\u0131\u011f\u0131 olarak m\u00fcvekkiline devretti\u011fini ve daireyi teslim ald\u0131\u011f\u0131n\u0131, 7 ayd\u0131r dairede ailesi ile birlikte oturduklar\u0131n\u0131, ancak tapusunu alamad\u0131klar\u0131n\u0131, in\u015faat\u0131n %97 oran\u0131nda bitti\u011fini, eksik i\u015flerin tamamlanmas\u0131 ve iskan al\u0131nmas\u0131 i\u00e7in bir dairenin yeterli olaca\u011f\u0131n\u0131 ileri s\u00fcrerek, 30 no\u2019lu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn tapu kayd\u0131n\u0131n iptali ile davac\u0131 ad\u0131na tesciline karar verilmesini talep ve dava etmi\u015ftir.<\/p>\n<p>Mahkemece, iddia, savunma, bilirki\u015fi raporu ve t\u00fcm dosya kapsam\u0131na g\u00f6re, eksik ve ay\u0131pl\u0131 i\u015f bedeli ile iskan izni alma giderlerinin toplam 166.256,34 TL oldu\u011fu, daval\u0131 taraf s\u00f6zle\u015fmede kararla\u015ft\u0131r\u0131lan tarihte teslim yapmad\u0131\u011f\u0131ndan TBK\u2019n\u0131n 112. maddesi ve taraflar aras\u0131ndaki s\u00f6zle\u015fme uyar\u0131nca davac\u0131lar\u0131n kira tazminat\u0131 talebinde hakl\u0131 oldu\u011fu, her ne kadar as\u0131l davada davac\u0131lar vekili 30 no\u2019lu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm y\u00f6n\u00fcnden de nama ifa yetkisi talep etmi\u015f ise de, 30 no\u2019lu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn birle\u015fen dosyada davac\u0131 ad\u0131na tesciline karar verildi\u011fi, imalat eksikliklerinin ve iskan bedelinin 10 ve 11 no\u2019lu dairelerin sat\u0131\u015f\u0131yla kar\u015f\u0131lanabilece\u011fi, as\u0131l davadaki talep dikkate al\u0131nd\u0131\u011f\u0131nda davac\u0131lara 10 no\u2019lu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm y\u00f6n\u00fcnden nama ifa yetkisi verilmesi gerekti\u011fi gerek\u00e7esiyle as\u0131l ve birle\u015fen davan\u0131n kabul\u00fcne karar verilmi\u015ftir.<br \/>\nKarar\u0131, as\u0131l davada davac\u0131lar- birle\u015fen davada daval\u0131lar vekili temyiz etmi\u015ftir.<\/p>\n<p>1-As\u0131l davada dava, arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesine dayal\u0131 nama ifa kapsam\u0131nda sat\u0131\u015fa izin talebine ili\u015fkindir.<\/p>\n<p>Arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat yap\u0131m s\u00f6zle\u015fmesinden kaynaklanan uyu\u015fmazl\u0131klarda y\u00fcklenicinin s\u00fcresi i\u00e7inde i\u015fin tamamlanmamas\u0131 ya da ay\u0131pl\u0131 olarak yapmas\u0131 halinde eksik ve kusurlu i\u015flerin y\u00fcklenici nam\u0131na arsa sahibince infaz\u0131na izin verilmesi m\u00fcmk\u00fcnd\u00fcr. Dairemizin yerle\u015fik i\u00e7tihat ve uygulamalar\u0131nda nama ifaya izin verilirken giderilmesi gereken eksikler, ay\u0131plar\u0131n nelerden ibaret oldu\u011fu ve bunlar\u0131n avans niteli\u011findeki giderim bedellerinin h\u00fck\u00fcm f\u0131kras\u0131nda infaz\u0131 m\u00fcmk\u00fcn olacak \u015fekilde g\u00f6sterilmesi gerekti\u011fi kabul edilmektedir. Ger\u00e7ekten, yapma borcu, bor\u00e7lu taraf\u0131ndan ifa edilmedi\u011fi takdirde alacakl\u0131, (arsa sahibi) masraf\u0131 bor\u00e7luya ait olmak \u00fczere edimin kendisi veya ba\u015fkas\u0131 taraf\u0131ndan ifas\u0131na izin verilmesini isteyebilir. Ayr\u0131ca arsa sahiplerince nama ifa kapsam\u0131nda talep edilen eksik-ay\u0131pl\u0131 i\u015fler vs. masraflar\u0131n da h\u00fckme en yak\u0131n tarih itibariyle serbest piyasa rayi\u00e7leri dikkate al\u0131nmak suretiyle tespiti gerekmektedir.<\/p>\n<p>Somut olayda, mahkeme taraf\u0131ndan 13.12.2012 tarihli yap\u0131lan ke\u015fif sonucu bilirki\u015fi kurulu taraf\u0131ndan d\u00fczenlenen 11.05.2015 tarihli ek raporda, eksik ve ay\u0131pl\u0131 i\u015f bedeli ile iskan izni alma giderlerinin toplam 166.256,34 TL, sat\u0131\u015f\u0131na izin verilen 10 no\u2019lu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn birle\u015fen davada dava tarihi itibariyle de\u011ferinin 150.000,00 TL, hakk\u0131nda karar verilmeyen 11 no\u2019lu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn de de\u011ferinin 150.000,00 TL olarak belirlendi\u011fi, belirlenen bu gider ve de\u011ferlerin 2012 y\u0131l\u0131na ait oldu\u011fu g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Hukuk Dairesi<\/p>\n<p>2021\/2603 E. , 2022\/799 K.<\/p>\n<p>&#8220;\u0130\u00e7tihat Metni&#8221;<\/p>\n<p>MAHKEMES\u0130 :Asliye Hukuk Mahkemesi<\/p>\n<p>Taraflar aras\u0131ndaki alacak davas\u0131n\u0131n yap\u0131lan yarg\u0131lamas\u0131 sonunda ilamda yaz\u0131l\u0131 nedenlerden dolay\u0131 davan\u0131n k\u0131smen kabul\u00fcne y\u00f6nelik verilen h\u00fck\u00fcm s\u00fcresi i\u00e7inde davac\u0131 &#8230; Miras\u00e7\u0131lar\u0131 vekili ile daval\u0131lar vekilince temyiz edilmesi \u00fczerine dosya incelendi, gere\u011fi konu\u015fulup d\u00fc\u015f\u00fcn\u00fcld\u00fc.<\/p>\n<p>K A R A R<\/p>\n<p>Davac\u0131lar vekili, m\u00fcvekkilleri arsa sahipleri ile daval\u0131 y\u00fckleniciler aras\u0131nda arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi gere\u011fi yap\u0131lan in\u015faatta eksik i\u015flerin tamamlanmas\u0131 ve isk\u00e2n izni al\u0131nmas\u0131na ili\u015fkin olarak davac\u0131lara izin verilmesini, masraflar\u0131n s\u00f6zle\u015fme uyar\u0131nca daval\u0131 y\u00fcklenicilere d\u00fc\u015fen 14 numaral\u0131 d\u00fckkan\u0131n sat\u0131\u015f\u0131 ile kar\u015f\u0131lanmas\u0131n\u0131, talebe konu d\u00fckkan daval\u0131lar taraf\u0131ndan kiraya verildi\u011finden elde edilen kira gelirinin davac\u0131lara \u00f6denmesini talep ve dava etmi\u015ftir.<\/p>\n<p>Daval\u0131lar vekili, in\u015faat\u0131n s\u00fcresinde tamamland\u0131\u011f\u0131n\u0131, davac\u0131lar\u0131n 01.03.2002 tarihinde ihtirazi kay\u0131t ileri s\u00fcrmeden daireleri teslim ald\u0131klar\u0131n\u0131 ve taleplerin zamana\u015f\u0131m\u0131na u\u011frad\u0131\u011f\u0131n\u0131 savunarak, davan\u0131n reddini istemi\u015ftir.<\/p>\n<p>Mahkemece, davan\u0131n kabul\u00fcne dair verilen karar, daval\u0131lar vekilinin temyizi \u00fczerine, Kapat\u0131lan Y\u00fcksek 23. Hukuk Dairesi\u2019nin 21.01.2016 tarih, 2014\/7718 E., 2016\/271 Karar say\u0131l\u0131 ilam\u0131yla, kira gelirlerinin tahsiline ili\u015fkin davac\u0131lar talebi bak\u0131m\u0131ndan olumlu ya da olumsuz bir karar verilmedi\u011fi belirtilerek bozulmu\u015f, bozmaya uyularak yap\u0131lan yarg\u0131lama neticesinde, 16.850,00 TL\u2019lik eksik ve ay\u0131pl\u0131 i\u015fler tutar\u0131 i\u00e7in 14 no.lu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn 150.000,00 TL\u2019den a\u015fa\u011f\u0131 olmamak kayd\u0131yla sat\u0131\u015f\u0131na izin verilmesine, kira tazminat\u0131 talebinin feragat nedeniyle reddine karar verilmi\u015ftir.<br \/>\nKarar\u0131, davac\u0131 &#8230; miras\u00e7\u0131lar\u0131 vekili ile daval\u0131lar vekili temyiz etmi\u015ftir.<\/p>\n<p>Dava, arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesine dayal\u0131 nama ifa kapsam\u0131nda sat\u0131\u015fa izin talebine ili\u015fkindir.<\/p>\n<p>Arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat yap\u0131m s\u00f6zle\u015fmesinden kaynaklanan uyu\u015fmazl\u0131klarda y\u00fcklenicinin s\u00fcresi i\u00e7inde i\u015fin tamamlanmamas\u0131 ya da ay\u0131pl\u0131 olarak yapmas\u0131 halinde eksik ve kusurlu i\u015flerin y\u00fcklenici nam\u0131na arsa sahibince infaz\u0131na izin verilmesi m\u00fcmk\u00fcnd\u00fcr. Dairemizin yerle\u015fik i\u00e7tihat ve uygulamalar\u0131nda nama ifaya izin verilirken giderilmesi gereken eksikler, ay\u0131plar\u0131n nelerden ibaret oldu\u011fu ve bunlar\u0131n avans niteli\u011findeki giderim bedellerinin h\u00fck\u00fcm f\u0131kras\u0131nda infaz\u0131 m\u00fcmk\u00fcn olacak \u015fekilde g\u00f6sterilmesi gerekti\u011fi kabul edilmektedir. Ger\u00e7ekten, yapma borcu, bor\u00e7lu taraf\u0131ndan ifa edilmedi\u011fi takdirde alacakl\u0131, (arsa sahibi) masraf\u0131 bor\u00e7luya ait olmak \u00fczere edimin kendisi veya ba\u015fkas\u0131 taraf\u0131ndan ifas\u0131na izin verilmesini isteyebilir. \u0130stemin hukuki dayana\u011f\u0131n\u0131 s\u00f6zle\u015fme tarihi itibariyle y\u00fcr\u00fcrl\u00fckte olan 818 say\u0131l\u0131 BK&#8217;n\u0131n 97. maddesi olu\u015fturmaktad\u0131r. Yasa h\u00fckm\u00fcne g\u00f6re nama ifaya izin verilebilmesi i\u00e7in s\u00f6zle\u015fmenin feshedilmemi\u015f, yani y\u00fcr\u00fcrl\u00fckte olmas\u0131, bor\u00e7lunun edimin ifas\u0131nda temerr\u00fcde d\u00fc\u015fmesi ve borcun &#8220;yapma borcuna&#8221; dair bulunmas\u0131 gerekir. Hakim bu talep \u00fczerine konusunda uzman bilirki\u015fi yard\u0131m\u0131 ile ke\u015fif yaparak eksik b\u0131rak\u0131lan ve ay\u0131pl\u0131 yap\u0131lm\u0131\u015f olan i\u015f kalemlerini ve bunlar\u0131n tamamlanmas\u0131 ile giderilmesi masraflar\u0131n\u0131, imal\u00e2t\u0131n metraj, y\u00f6ntem ve takribi bedellerini, di\u011fer kurumlara olan bor\u00e7lar\u0131 ve isk\u00e2n masraflar\u0131n\u0131 tahminen saptayarak izin karar\u0131 verir. \u0130zin karar\u0131n\u0131n h\u00fck\u00fcm f\u0131kras\u0131nda da, eksik ve ay\u0131pl\u0131 i\u015f kalemleri ve di\u011fer bor\u00e7 ve masraflar\u0131n her birinin tahmini masraflar\u0131 tek tek g\u00f6sterilir. Genel nitelikli yetki ve izin verilemez. Mahkemece, infazda teredd\u00fcde yol a\u00e7mamak i\u00e7in nama ifas\u0131na izin ve yetki verilen i\u015f ve i\u015flemlerin h\u00fck\u00fcm f\u0131kras\u0131nda tek tek belirtilip g\u00f6sterilmesi veya bu nitelikte oldu\u011fu denetim sonucu anla\u015f\u0131lacak infaz\u0131 m\u00fcmk\u00fcn h\u00fck\u00fcm kurulmas\u0131 ve nama ifa i\u00e7in belirlenen giderlerin ne suretle kar\u015f\u0131lanaca\u011f\u0131n\u0131n da g\u00f6sterilmesi gerekir. Bu giderler y\u00fckleniciye kalacak ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn sat\u0131\u015f\u0131 suretiyle kar\u015f\u0131lanacak ise, sat\u0131\u015f\u0131na izin verilecek ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn h\u00fckme en yak\u0131n tarih itibariyle rayi\u00e7 de\u011feri belirlenip, bu de\u011ferden d\u00fc\u015f\u00fck olmamak suretiyle sat\u0131\u015f\u0131na izin verilmesi gerekir.
