GENEL G\u0130R\u0130\u015e<\/p>\n<p>\u0130nsanlar aras\u0131nda her toplumda ve hayat\u0131n her d\u00f6neminde \u00e7e\u015fitli problemlerle kar\u015f\u0131la\u015f\u0131lmakta ve farkl\u0131 t\u00fcrde uyu\u015fmazl\u0131klar ya\u015fanmaktad\u0131r. As\u0131rlar \u00f6ncesinden bu yana toplu halde ya\u015fanan d\u00fcnyada elbette birlikte ya\u015faman\u0131n belirli kurallara ba\u011flanmas\u0131 ve ya\u015fanan sorunlar\u0131n \u00e7\u00f6z\u00fcme kavu\u015fturulmas\u0131 gereklidir. Aksi halde toplumda kurals\u0131z ve karma\u015f\u0131k bir ya\u015famla kar\u015f\u0131la\u015f\u0131lacak ve sorunlar \u00e7\u00f6z\u00fcms\u00fcz kalacakt\u0131r. Bu sebeple baz\u0131 kurallar benimsenmi\u015f, baz\u0131lar\u0131 resmi olarak kabul edilmi\u015f, baz\u0131lar\u0131 da zaman i\u00e7erisinde uygulanagelmi\u015ftir.<\/p>\n<p>2. TOPLUMSAL D\u00dcZENDEK\u0130 KURALLAR B\u00dcT\u00dcN\u00dc<\/p>\n<p>2.1. Toplumsal D\u00fczen Kurallar\u0131n\u0131n T\u00fcrleri<\/p>\n<p>Toplumsal d\u00fczen kurallar\u0131 \u00f6rf-adet kurallar\u0131, din kurallar\u0131, g\u00f6rg\u00fc kurallar\u0131, ahlak kurallar\u0131 ve hukuk kurallar\u0131 olmak \u00fczere be\u015fli ayr\u0131ma sahiptir. Ancak bunlara protokol kurallar\u0131n\u0131n da eklenmesi gereklidir.<\/p>\n<p>2.2. \u00d6rf-Adet Kurallar\u0131<\/p>\n<p>\u00d6rf-adet kurallar\u0131, belirli bir b\u00f6lgede ve\/veya toplumda zaman i\u00e7erisinde uygulanagelen kurallard\u0131r. Ba\u015fka bir anlat\u0131mla bir konunun ya da sorunun hep ayn\u0131 \u015fekilde sonuca ba\u011flanmas\u0131 veya bir davran\u0131\u015f modelinin benimsenmesi ve buna uyulmas\u0131 gerekti\u011fi y\u00f6n\u00fcnde d\u00fc\u015f\u00fcncenin ve inan\u0131\u015f\u0131n olmas\u0131 \u00f6rf-adet kurallar\u0131n\u0131 olu\u015fturmaktad\u0131r. Ancak \u00f6rf-adet kurallar\u0131n\u0131n ba\u011flay\u0131c\u0131 olup olmamas\u0131 de\u011fi\u015fkenlik g\u00f6stermektedir. Zira bir davran\u0131\u015f\u0131n kural olmas\u0131yla hukuken ba\u011flay\u0131c\u0131 olmas\u0131 ayn\u0131 anlama gelmemektedir. Bir kural\u0131n ba\u011flay\u0131c\u0131 olmas\u0131 i\u00e7in kanunda \u00f6rf-adet kurallar\u0131n\u0131n uygulanaca\u011f\u0131 y\u00f6n\u00fcnde h\u00fck\u00fcm olmas\u0131 gereklidir. \u00d6rne\u011fin 4721 say\u0131l\u0131 T\u00fcrk Medeni Kanunu\u2019nda ve 6102 say\u0131l\u0131 T\u00fcrk Ticaret Kanunu\u2019nda bu y\u00f6nde h\u00fck\u00fcmler vard\u0131r. Ancak 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nda \u00f6rf-adet hukukuna at\u0131f yoktur ve bu halde bu kurallar\u0131n uygulanmas\u0131 olanaks\u0131zd\u0131r.<\/p>\n<p>Ger\u00e7ekten de T\u00fcrk Medeni Kanunu\u2019nun 1. maddesinin 2. f\u0131kras\u0131 uyar\u0131nca, kanunda uygulanabilir bir h\u00fck\u00fcm yoksa h\u00e2kimin \u00f6rf ve \u00e2det hukukuna g\u00f6re, bu da yoksa kendisi kanun koyucu olsayd\u0131 nas\u0131l bir kural koyacak idiyse ona g\u00f6re karar vermesi gerekmektedir. Benzer d\u00fczenleme T\u00fcrk Ticaret Kanunu\u2019nun 1. maddesinin 2. f\u0131kras\u0131nda da mevcuttur. Buna g\u00f6re mahkemenin, hakk\u0131nda ticari bir h\u00fck\u00fcm bulunmayan ticari i\u015flerde ticari \u00f6rf ve \u00e2dete, bu da yoksa genel h\u00fck\u00fcmlere g\u00f6re karar vermesi gereklidir.<\/p>\n<p>2.3. Din Kurallar\u0131<\/p>\n<p>Din kurallar\u0131, kutsal bir g\u00fcc\u00fcn belirledi\u011fi kurallar oldu\u011funa inan\u0131lan ve bu g\u00fc\u00e7le insanlar aras\u0131ndaki ve insanlar\u0131n birbirleriyle aralar\u0131ndaki ili\u015fkileri d\u00fczenleyen, emir ve yasaklar i\u00e7eren kurallar b\u00fct\u00fcn\u00fcd\u00fcr. \u00d6rne\u011fin \u0130slam Dinin y\u00f6n\u00fcnden namaz k\u0131lmak ve oru\u00e7 tutmak Allah\u2019\u0131n emretti\u011fi ve Allah ile kul aras\u0131ndaki emir ve yasaklar\u0131 d\u00fczenleyen kurallardand\u0131r. Kul hakk\u0131 yenmemesi ve insanlar aras\u0131nda h\u00fckmedilirken adaletle h\u00fckmedilmesi y\u00f6n\u00fcndeki ayet ise insanlar aras\u0131ndaki ili\u015fkileri d\u00fczenleyen di\u011fer din kurallar\u0131ndand\u0131r.<\/p>\n<p>Ger\u00e7ekten de Nisa Suresi\u2019nin 58. Ayeti, \u201cHi\u00e7 \u015f\u00fcphesiz Allah size, emanetleri ehline teslim etmenizi ve insanlar aras\u0131nda h\u00fckmetti\u011finiz zaman adaletle h\u00fckmetmenizi emreder. Allah size ne g\u00fczel \u00f6\u011f\u00fct veriyor. \u015e\u00fcphesiz Allah i\u015fitir ve g\u00f6r\u00fcr.\u201d ifadelerini i\u00e7ermektedir.<\/p>\n<p>Ancak mevzuatta hukuken ba\u011flay\u0131c\u0131 oldu\u011fu kabul edilmedi\u011fi m\u00fcddet\u00e7e din kurallar\u0131n\u0131n yapt\u0131r\u0131m g\u00fcc\u00fc bulunmamaktad\u0131r. Ba\u015fka bir anlat\u0131mla din kurallar\u0131n\u0131n herkes i\u00e7in ba\u011flay\u0131c\u0131 olmas\u0131 i\u00e7in mevzuatta da h\u00fck\u00fcm bulunmas\u0131 ve bu surette hukuk kural\u0131 haline d\u00f6n\u00fc\u015fmesi gerekmektedir. \u00d6rne\u011fin \u0130slam Dininde dedikodu yapmak g\u00fcnaht\u0131r. Ancak bunun hukuk d\u00fczenince cezaland\u0131r\u0131lmas\u0131 i\u00e7in \u015fahsiyet haklar\u0131n\u0131n ihlali aranmaktad\u0131r. Benzer \u015fekilde bir ki\u015finin mal\u0131n\u0131 h\u0131rs\u0131zl\u0131k maksad\u0131yla izinsiz almak veya kullanmak kul hakk\u0131 oldu\u011fu gibi ayn\u0131 zamanda su\u00e7 te\u015fkil etmektedir. Zira T\u00fcrk Ceza Kanunu\u2019nun 141. maddesinde zilyedinin r\u0131zas\u0131 olmadan ba\u015fkas\u0131na ait ta\u015f\u0131n\u0131r bir mal\u0131, kendisine veya ba\u015fkas\u0131na bir yarar sa\u011flamak maksad\u0131yla bulundu\u011fu yerden alan kimseye bir y\u0131ldan \u00fc\u00e7 y\u0131la kadar hapis cezas\u0131 verilece\u011fi belirtilmektedir.<\/p>\n<p>2.4. Ahlak Kurallar\u0131<\/p>\n<p>Toplumsal d\u00fczen kurallar\u0131ndan bir di\u011feri ahlak kurallar\u0131d\u0131r. Bu kurallar vicdan, iyilik, do\u011fruluk gibi manevi de\u011ferler \u00fczerinde etkili ve bir toplumda kabul edilmi\u015f de\u011fer yarg\u0131lar\u0131 olarak bilinen kurallard\u0131r. Ahlak kurallar\u0131 s\u0131n\u0131rl\u0131 say\u0131da de\u011fildir. \u00d6rne\u011fin aileye yard\u0131m etmek veya insanlara iyilikte bulunmak gibi davran\u0131\u015f bi\u00e7imlerine, ahlaki de\u011fer yarg\u0131lar\u0131 uyar\u0131nca uyulmas\u0131 gerekti\u011fi kabul edilmektedir. Ancak din kurallar\u0131nda oldu\u011fu gibi ahlak kurallar\u0131n\u0131n da hukuken ba\u011flay\u0131c\u0131 olmas\u0131 i\u00e7in mevzuatta d\u00fczenlenmesi gereklidir. T\u0131pk\u0131 nafaka y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcnde oldu\u011fu gibi. Zira nafaka konusu T\u00fcrk Medeni Kanunu\u2019nda yer almaktad\u0131r. Ba\u015fka bir \u00f6rne\u011fe g\u00f6re, 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun 141. maddesinde yer alan h\u0131rs\u0131zl\u0131k su\u00e7u, din kurallar\u0131na ayk\u0131r\u0131 oldu\u011fu gibi ahlak kurallar\u0131na da ayk\u0131r\u0131d\u0131r. Ancak bu kural\u0131n maddi yapt\u0131r\u0131mla ba\u011flay\u0131c\u0131 olmas\u0131 din kural\u0131 olmas\u0131ndan de\u011fil, kanundaki d\u00fczenlemeden kaynaklanmaktad\u0131r. Yalan s\u00f6ylemek ahlak kurallar\u0131na ayk\u0131r\u0131 bir davran\u0131\u015ft\u0131r. Ancak hukuksal d\u00fczende kural olarak maddi yapt\u0131r\u0131m\u0131 yoktur. Bu y\u00f6nde yapt\u0131r\u0131m\u0131n\u0131n olmas\u0131 i\u00e7in mevzuatta a\u00e7\u0131k\u00e7a d\u00fczenlenmesi gerekmektedir. Hukuk sistemimize bak\u0131ld\u0131\u011f\u0131nda bu kural\u0131n istisnalar\u0131 da bulunmaktad\u0131r. San\u0131\u011f\u0131n kimlik bilgilerini do\u011fru beyan etmesi gereklili\u011fi, ba\u015fkas\u0131na iftira at\u0131lmamas\u0131n\u0131n gerekmesi, iftira halinde bunun su\u00e7 te\u015fkil etmesi, resmi belgenin d\u00fczenlenmesinde yalan beyanda bulunulmas\u0131n\u0131n cezay\u0131 gerektirmesi, yalan beyan\u0131n hileli fiile d\u00f6n\u00fc\u015fmesi, kar\u015f\u0131 taraf\u0131n aldat\u0131larak zarara u\u011frat\u0131lmas\u0131 ve failin bundan yarar elde etmesi halinde doland\u0131r\u0131c\u0131l\u0131k su\u00e7unun olu\u015fmas\u0131 gibi..<\/p>\n<p>2.5. G\u00f6rg\u00fc (Ad\u00e2b-\u0131 Mua\u015feret) Kurallar\u0131<\/p>\n<p>2.5.1. Kural<\/p>\n<p>G\u00f6rg\u00fc kurallar\u0131n\u0131n, daha \u00e7ok nezaketi gerektiren kurallar\u0131 olu\u015fturdu\u011fu, nazik ve kibar olunmas\u0131n\u0131, toplumda ho\u015f olmayan edep adap kurallar\u0131na uyulmas\u0131n\u0131 konu ald\u0131\u011f\u0131 g\u00f6r\u00fclmektedir. Bu kurallara ad\u00e2b-\u0131 mua\u015feret kurallar\u0131 da denmektedir. \u00d6rne\u011fin b\u00fcy\u00fcklere sayg\u0131 g\u00f6stermek, yere t\u00fck\u00fcrmemek g\u00f6rg\u00fc kurallar\u0131 aras\u0131ndad\u0131r. Benzer \u015fekilde evimize misafir geldi\u011finde misafirleri ayakta kar\u015f\u0131lamak g\u00f6rg\u00fc kural\u0131d\u0131r. Ancak g\u00f6rg\u00fc kurallar\u0131 da t\u0131pk\u0131 din ve ahlak kurallar\u0131nda oldu\u011fu gibi do\u011frudan maddi yapt\u0131r\u0131mla ba\u011flay\u0131c\u0131 de\u011fildir. Bu kurallar\u0131n ba\u011flay\u0131c\u0131 olmas\u0131 i\u00e7in a\u00e7\u0131k\u00e7a mevzuatta yer almas\u0131 gereklidir. Bu noktada kar\u015f\u0131m\u0131za protokol kurallar\u0131 \u00e7\u0131kmaktad\u0131r.<\/p>\n<p>2.5.2. Protokol Kurallar\u0131<\/p>\n<p>Protokol kurallar\u0131 resmi t\u00f6renlerde, resmi ili\u015fkilerde, askeriyede ve askeri personeller aras\u0131ndaki ili\u015fkilerde kar\u015f\u0131m\u0131za \u00e7\u0131kmaktad\u0131r. \u00d6rne\u011fin bir milli bayramdaki t\u00f6ren alan\u0131nda oturma d\u00fczeni ve s\u0131ras\u0131 \u00f6ncesinden bellidir. Askeriyede ast-\u00fcst ili\u015fkisinde ge\u00e7erli kurallar vard\u0131r. Bu kurallar baz\u0131 yapt\u0131r\u0131ma ba\u011fl\u0131d\u0131r ve uyulmamas\u0131 halinde disiplin cezas\u0131na yol a\u00e7maktad\u0131r. Apartman giri\u015finde kar\u015f\u0131la\u015ft\u0131\u011f\u0131m\u0131z kom\u015fumuza selam vermek g\u00f6rg\u00fc kural\u0131d\u0131r. Ancak komutan\u0131n alana gelmesi \u00fczerine erin ayakta selama durmas\u0131 ba\u011flay\u0131c\u0131 bir kurald\u0131r. Bu kapsamda protokol kurallar\u0131n maddi yapt\u0131r\u0131mla ba\u011flay\u0131c\u0131 oldu\u011fu, protokol kural\u0131 haline d\u00f6n\u00fc\u015fmemi\u015f di\u011fer g\u00f6rg\u00fc kurallar\u0131n\u0131n kanunda a\u00e7\u0131k\u00e7a d\u00fczenlenmedi\u011fi m\u00fcddet\u00e7e ba\u011flay\u0131c\u0131 olmad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.<\/p>\n<p>2.6. Hukuk Kurallar\u0131<\/p>\n<p>Toplumsal d\u00fczen kurallar\u0131n\u0131n sonuncusu hukuk kurallar\u0131d\u0131r. Hukuk kurallar\u0131, devletin di\u011fer devletlerle ve ki\u015filerle, ki\u015filerin ki\u015filerle olan ili\u015fkilerini d\u00fczenleyen ve maddi yapt\u0131r\u0131m\u0131 i\u00e7eren kurallar b\u00fct\u00fcn\u00fcd\u00fcr. Hukuk kurallar\u0131 da t\u0131pk\u0131 di\u011fer kurallar gibi toplumsal ya\u015famda uygulanan ve uyulmas\u0131 gereken kurallard\u0131r.<\/p>\n<p>3. YAPTIRIM<\/p>\n<p>Toplumsal d\u00fczen kurallar\u0131n\u0131n t\u00fcm\u00fcnde yapt\u0131r\u0131m vard\u0131r. Ancak bu yapt\u0131r\u0131m yaln\u0131zca hukuk kurallar\u0131nda maddidir. Di\u011ferlerinde manevidir. \u00d6rne\u011fin ki\u015finin benimsedi\u011fi dinin kurallar\u0131na uymamas\u0131 halinde kutsal g\u00fc\u00e7 (\u0130slam Dininde i\u015fledi\u011fi g\u00fcnah sebebiyle Allah) taraf\u0131ndan cezaland\u0131r\u0131laca\u011f\u0131na inan\u0131lmaktad\u0131r. Ancak bunun hukuk d\u00fczeninde do\u011frudan maddi bir kar\u015f\u0131l\u0131\u011f\u0131 yoktur. Ayn\u0131 husus ahlak ve g\u00f6rg\u00fc kurallar\u0131 i\u00e7in de ge\u00e7erlidir. Protokol kurallar\u0131ysa g\u00f6rg\u00fc kurallar\u0131n\u0131n istisnas\u0131d\u0131r.<\/p>\n<p>Hukuk d\u00fczenince bir konuda \u00f6rf-adet kurallar\u0131n\u0131n uygulanaca\u011f\u0131 kabul edilebilir. Bu durumda maddi yapt\u0131r\u0131m olmaktad\u0131r. Aksi haldeyse yapt\u0131r\u0131m manevidir. Manevi yapt\u0131r\u0131mdan veya kar\u015f\u0131l\u0131ktan anla\u015f\u0131lmas\u0131 gereken g\u00fcnaha girme, ay\u0131planma, d\u0131\u015flanma, k\u0131nanma, toplumsal veya kamusal tepki ve benzeri manevi sonu\u00e7lard\u0131r. Hukuk kurallar\u0131nda da s\u0131kl\u0131kla bu yapt\u0131r\u0131mlar vard\u0131r, ancak her durumda hukuk d\u00fczeninde kar\u015f\u0131la\u015f\u0131lan maddi sonu\u00e7lar olmaktad\u0131r.<\/p>\n<p>4. B\u0130R KURALIN AYNI ANDA FARKLI TOPLUMSAL D\u00dcZEN KURALLARINA DAH\u0130L OLMASI<\/p>\n<p>Bir kural\u0131n ayn\u0131 anda toplumsal d\u00fczen kurallar\u0131ndan birden fazlas\u0131nda yer almas\u0131 m\u00fcmk\u00fcnd\u00fcr. \u00d6rne\u011fin kasten insan \u00f6ld\u00fcrmek T\u00fcrk Ceza Kanunu\u2019nun 81. maddesinde d\u00fczenlenmekte ve madde metninde bir insan\u0131 kasten \u00f6ld\u00fcren ki\u015finin m\u00fcebbet hapis cezas\u0131 ile cezaland\u0131r\u0131laca\u011f\u0131 belirtilmektedir. Bir insan\u0131 \u00f6ld\u00fcrmenin su\u00e7 olmas\u0131n\u0131n yan\u0131 s\u0131ra bu fiil ayn\u0131 zamanda din ve ahlak kurallar\u0131na da ayk\u0131r\u0131l\u0131k te\u015fkil etmektedir. Bu konudaki bir di\u011fer \u00f6rnek zinan\u0131n sonu\u00e7lar\u0131d\u0131r. Bilindi\u011fi \u00fczere T\u00fcrk Ceza Hukuku\u2019na g\u00f6re zina su\u00e7 de\u011fildir. Ancak T\u00fcrk Medeni Kanunu\u2019nun 161. maddesinde \u201cE\u015flerden biri zina ederse, di\u011fer e\u015f bo\u015fanma davas\u0131 a\u00e7abilir.\u201d d\u00fczenlemesi mevcuttur. Bu kapsamda e\u015fin zina etmesi \u00f6zel bo\u015fanma sebebidir ve di\u011fer e\u015fe bo\u015fanma hakk\u0131 vermektedir. Zina ayn\u0131 zamanda \u0130slam Dini bak\u0131m\u0131ndan din kurallar\u0131na ve ahlaki de\u011fer yarg\u0131lar\u0131 y\u00f6n\u00fcnden ahlak kurallar\u0131na da ayk\u0131r\u0131d\u0131r. Benzer \u015fekilde \u00e7evrenin kirletilmesi g\u00f6rg\u00fc kurallar\u0131na ayk\u0131r\u0131 bir davran\u0131\u015ft\u0131r. Ancak bu davran\u0131\u015f ayn\u0131 zamanda 5326 say\u0131l\u0131 Kabahatler Kanunu uyar\u0131nca bir kabahattir ve somut duruma g\u00f6re 5237 say\u0131l\u0131 kanunda yer alan \u00e7evrenin kasten veya taksirle kirletilmesi su\u00e7una sebebiyet vermektedir.<\/p>\n<p>5. SONU\u00c7 OLARAK<\/p>\n<p>G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere toplumsal d\u00fczen kurallar\u0131 insanlar\u0131n ya\u015fam i\u00e7erisinde uymak zorunda olduklar\u0131 kurallar b\u00fct\u00fcn\u00fcd\u00fcr. Bu kurallar birbiriyle do\u011fru orant\u0131l\u0131d\u0131r ve birinin do\u011fru bulmad\u0131\u011f\u0131 kural\u0131 s\u0131kl\u0131kla di\u011ferleri de do\u011fru bulmamaktad\u0131r. \u00d6rne\u011fin hukuk d\u00fczeninde bir insana kasten zarar vermek su\u00e7tur ve hi\u00e7bir din ve ahlak kural\u0131 da bunu ola\u011fan kar\u015f\u0131lamamaktad\u0131r. Ancak bu kurallar b\u00fct\u00fcn\u00fc kendi i\u00e7erisinde yapt\u0131r\u0131m bak\u0131m\u0131ndan farkl\u0131d\u0131r. Hatta bu yapt\u0131r\u0131mlardan hukuk kurallar\u0131na uygulananlar\u0131 dahi hukuk uyu\u015fmazl\u0131klar\u0131nda, ceza uyu\u015fmazl\u0131klar\u0131nda ve idari uyu\u015fmazl\u0131klarda farkl\u0131 olmaktad\u0131r. \u00d6rne\u011fin zina bo\u015fanma sebebiyken cezai m\u00fceyyidesi yoktur. \u0130nsan \u00f6ld\u00fcrmenin cezas\u0131ysa m\u00fcebbet hapis cezas\u0131d\u0131r. Ancak h\u0131rs\u0131zl\u0131k, doland\u0131r\u0131c\u0131l\u0131k ve ya\u011fma su\u00e7lar\u0131nda cezalar s\u00fcreli hapis cezalar\u0131d\u0131r.<\/p>\n<p>\u200b1. Allah size ne g\u00fczel \u00f6\u011f\u00fct veriyor. \u015e\u00fcphesiz Allah i\u015fitir ve g\u00f6r\u00fcr.\u201d ifadelerini i\u00e7ermektedir.<\/p>\n<p>Ancak mevzuatta hukuken ba\u011flay\u0131c\u0131 oldu\u011fu kabul edilmedi\u011fi m\u00fcddet\u00e7e din kurallar\u0131n\u0131n yapt\u0131r\u0131m g\u00fcc\u00fc bulunmamaktad\u0131r. Ahlak Kurallar\u0131<\/p>\n<p>Toplumsal d\u00fczen kurallar\u0131ndan bir di\u011feri ahlak kurallar\u0131d\u0131r. Bu kurallar vicdan, iyilik, do\u011fruluk gibi manevi de\u011ferler \u00fczerinde etkili ve bir toplumda kabul edilmi\u015f de\u011fer yarg\u0131lar\u0131 olarak bilinen kurallard\u0131r.
