Asliye Ceza Mahkemesi<\/p>\n<p>\u0130T\u0130RAZIN KONUSU: 26\/9\/2004 tarihli ve 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun 52. maddesinin (2) numaral\u0131 f\u0131kras\u0131nda yer alan \u201cEn az yirmi ve en fazla y\u00fcz T\u00fcrk Liras\u0131&#8230;\u201d ibaresinin Anayasa\u2019n\u0131n 2., 5., 13., 17. ve 36. maddelerine ayk\u0131r\u0131l\u0131\u011f\u0131 ileri s\u00fcr\u00fclerek iptaline karar verilmesi talebidir.<\/p>\n<p>OLAY: San\u0131k hakk\u0131nda cinsel taciz su\u00e7undan a\u00e7\u0131lan davada itiraz konusu kural\u0131n Anayasa\u2019ya ayk\u0131r\u0131 oldu\u011fu kan\u0131s\u0131na varan Mahkeme, iptali i\u00e7in ba\u015fvurmu\u015ftur.<\/p>\n<p>I. \u0130PTAL\u0130 \u0130STENEN VE \u0130LG\u0130L\u0130 G\u00d6R\u00dcLEN KANUN H\u00dcK\u00dcMLER\u0130<\/p>\n<p>A. \u0130ptali \u0130stenen Kanun H\u00fckm\u00fc<\/p>\n<p>Kanun\u2019un itiraz konusu kural\u0131n da yer ald\u0131\u011f\u0131 52. maddesi \u015f\u00f6yledir:<\/p>\n<p>\u201cAdl\u00ee para cezas\u0131 <\/p>\n<p>Madde 52- (1) Adl\u00ee para cezas\u0131, be\u015f g\u00fcnden az ve kanunda aksine h\u00fck\u00fcm bulunmayan hallerde yediy\u00fczotuz g\u00fcnden fazla olmamak \u00fczere belirlenen tam g\u00fcn say\u0131s\u0131n\u0131n, bir g\u00fcn kar\u015f\u0131l\u0131\u011f\u0131 olarak takdir edilen miktar ile \u00e7arp\u0131lmas\u0131 suretiyle hesaplanan mebla\u011f\u0131n h\u00fck\u00fcml\u00fc taraf\u0131ndan Devlet Hazinesine \u00f6denmesinden ibarettir. <\/p>\n<p> (2) En az yirmi ve en fazla y\u00fcz T\u00fcrk Liras\u0131 olan bir g\u00fcn kar\u015f\u0131l\u0131\u011f\u0131 adl\u00ee para cezas\u0131n\u0131n miktar\u0131, ki\u015finin ekonomik ve di\u011fer \u015fahsi halleri g\u00f6z \u00f6n\u00fcnde bulundurularak takdir edilir. <\/p>\n<p> (3) Kararda, adl\u00ee para cezas\u0131n\u0131n belirlenmesinde esas al\u0131nan tam g\u00fcn say\u0131s\u0131 ile bir g\u00fcn kar\u015f\u0131l\u0131\u011f\u0131 olarak takdir edilen miktar ayr\u0131 ayr\u0131 g\u00f6sterilir. <\/p>\n<p> (4) Hakim, ekonomik ve \u015fahsi hallerini g\u00f6z \u00f6n\u00fcnde bulundurarak, ki\u015fiye adl\u00ee para cezas\u0131n\u0131 \u00f6demesi i\u00e7in h\u00fckm\u00fcn kesinle\u015fme tarihinden itibaren bir y\u0131ldan fazla olmamak \u00fczere mehil verebilece\u011fi gibi, bu cezan\u0131n belirli taksitler halinde \u00f6denmesine de karar verebilir. Taksit s\u00fcresi iki y\u0131l\u0131 ge\u00e7emez ve taksit miktar\u0131 d\u00f6rtten az olamaz. Kararda, taksitlerden birinin zaman\u0131nda \u00f6denmemesi halinde geri kalan k\u0131sm\u0131n tamam\u0131n\u0131n tahsil edilece\u011fi ve \u00f6denmeyen adl\u00ee para cezas\u0131n\u0131n hapse \u00e7evrilece\u011fi belirtilir.\u201d <\/p>\n<p>B. \u0130lgili G\u00f6r\u00fclen Kanun H\u00fckm\u00fc<\/p>\n<p>Kanun\u2019un 61. maddesi \u015f\u00f6yledir:<\/p>\n<p>\u201cCezan\u0131n belirlenmesi<\/p>\n<p>MADDE 61- (1) Hakim, somut olayda;<\/p>\n<p>a) Su\u00e7un i\u015fleni\u015f bi\u00e7imini,<\/p>\n<p>b) Su\u00e7un i\u015flenmesinde kullan\u0131lan ara\u00e7lar\u0131,<\/p>\n<p>c) Su\u00e7un i\u015flendi\u011fi zaman ve yeri,<\/p>\n<p>d) Su\u00e7un konusunun \u00f6nem ve de\u011ferini,<\/p>\n<p>e) Meydana gelen zarar veya tehlikenin a\u011f\u0131rl\u0131\u011f\u0131n\u0131,<\/p>\n<p>f) Failin kast veya taksire dayal\u0131 kusurunun a\u011f\u0131rl\u0131\u011f\u0131n\u0131,<\/p>\n<p>g) Failin g\u00fctt\u00fc\u011f\u00fc ama\u00e7 ve saiki,<\/p>\n<p>G\u00f6z \u00f6n\u00fcnde bulundurarak, i\u015flenen su\u00e7un kanuni tan\u0131m\u0131nda \u00f6ng\u00f6r\u00fclen cezan\u0131n alt ve \u00fcst s\u0131n\u0131r\u0131 aras\u0131nda temel cezay\u0131 belirler.<\/p>\n<p> (2) Su\u00e7un olas\u0131 kastla ya da bilin\u00e7li taksirle i\u015flenmesi nedeniyle indirim veya art\u0131r\u0131m, birinci f\u0131kra h\u00fckm\u00fcne g\u00f6re belirlenen ceza \u00fczerinden yap\u0131l\u0131r.<\/p>\n<p> (3) Birinci f\u0131krada belirtilen hususlar\u0131n su\u00e7un unsurunu olu\u015fturdu\u011fu hallerde, bunlar temel cezan\u0131n belirlenmesinde ayr\u0131ca g\u00f6z \u00f6n\u00fcnde bulundurulmaz.<\/p>\n<p> (4) Bir su\u00e7un temel \u015fekline nazaran daha a\u011f\u0131r veya daha az cezay\u0131 gerektiren birden fazla nitelikli hallerin ger\u00e7ekle\u015fmesi durumunda; temel cezada \u00f6nce art\u0131rma sonra indirme yap\u0131l\u0131r.<\/p>\n<p> (5) Yukar\u0131daki f\u0131kralara g\u00f6re belirlenen ceza \u00fczerinden s\u0131ras\u0131yla te\u015febb\u00fcs, i\u015ftirak, zincirleme su\u00e7, haks\u0131z tahrik, ya\u015f k\u00fc\u00e7\u00fckl\u00fc\u011f\u00fc, ak\u0131l hastal\u0131\u011f\u0131 ve cezada indirim yap\u0131lmas\u0131n\u0131 gerektiren \u015fahsi sebeplere ili\u015fkin h\u00fck\u00fcmler ile takdiri indirim nedenleri uygulanarak sonu\u00e7 ceza belirlenir.<\/p>\n<p> (6) Hapis cezas\u0131n\u0131n s\u00fcresi g\u00fcn, ay ve y\u0131l hesab\u0131yla belirlenir. Bir g\u00fcn, yirmid\u00f6rt saat; bir ay, otuz g\u00fcnd\u00fcr. Y\u0131l, resmi takvime g\u00f6re hesap edilir. Hapis cezas\u0131 i\u00e7in bir g\u00fcn\u00fcn, adl\u00ee para cezas\u0131 i\u00e7in bir T\u00fcrk Liras\u0131n\u0131n artakalan\u0131 hesaba kat\u0131lmaz ve bu cezalar infaz edilmez.<\/p>\n<p> (7) (Ek: 29\/6\/2005 \u2013 5377\/7 md.) S\u00fcreli hapis cezas\u0131n\u0131 gerektiren bir su\u00e7tan dolay\u0131 bu madde h\u00fck\u00fcmlerine g\u00f6re belirlenen sonu\u00e7 ceza, otuz y\u0131ldan fazla olamaz.<\/p>\n<p> (8) (Ek: 29\/6\/2005 \u2013 5377\/7 md.) Adl\u00ee para cezas\u0131 hesaplan\u0131rken, bu madde h\u00fckm\u00fcne g\u00f6re cezan\u0131n belirlenmesi ve bireyselle\u015ftirilmesine y\u00f6nelik art\u0131rma ve indirimler, g\u00fcn \u00fczerinden yap\u0131l\u0131r. Adl\u00ee para cezas\u0131, belirlenen sonu\u00e7 g\u00fcn ile ki\u015finin bir g\u00fcn kar\u015f\u0131l\u0131\u011f\u0131 \u00f6deyebilece\u011fi miktar\u0131n \u00e7arp\u0131lmas\u0131 suretiyle bulunur.<\/p>\n<p> (9) (Ek: 6\/12\/2006 \u2013 5560\/1 md.) Adl\u00ee para cezas\u0131n\u0131n se\u00e7imlik ceza olarak \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc su\u00e7larda bu cezaya ili\u015fkin g\u00fcn biriminin alt s\u0131n\u0131r\u0131, o su\u00e7 tan\u0131m\u0131ndaki hapis cezas\u0131n\u0131n alt s\u0131n\u0131r\u0131ndan az; \u00fcst s\u0131n\u0131r\u0131 da, hapis cezas\u0131n\u0131n \u00fcst s\u0131n\u0131r\u0131ndan fazla olamaz.<\/p>\n<p> (10) Kanunda a\u00e7\u0131k\u00e7a yaz\u0131lm\u0131\u015f olmad\u0131k\u00e7a cezalar ne art\u0131r\u0131labilir, ne eksiltilebilir, ne de de\u011fi\u015ftirilebilir.\u201d<\/p>\n<p>II. \u0130LK \u0130NCELEME<\/p>\n<p>1. Anayasa Mahkemesi \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc h\u00fck\u00fcmleri uyar\u0131nca Z\u00fcht\u00fc ARSLAN, Hasan Tahsin G\u00d6KCAN, Kadir \u00d6ZKAYA, Engin YILDIRIM, Muammer TOPAL, M. Emin KUZ, R\u0131dvan G\u00dcLE\u00c7, Yusuf \u015eevki HAKYEMEZ, Y\u0131ld\u0131z SEFER\u0130NO\u011eLU, Selahaddin MENTE\u015e, Basri BA\u011eCI, \u0130rfan F\u0130DAN ve Kenan YA\u015eAR\u2019\u0131n kat\u0131l\u0131mlar\u0131yla 18\/1\/2024 tarihinde yap\u0131lan ilk inceleme toplant\u0131s\u0131nda dosyada eksiklik bulunmad\u0131\u011f\u0131ndan i\u015fin esas\u0131n\u0131n incelenmesine OYB\u0130RL\u0130\u011e\u0130YLE karar verilmi\u015ftir.<\/p>\n<p>III. ESASIN \u0130NCELENMES\u0130<\/p>\n<p>2. Ba\u015fvuru karar\u0131 ve ekleri, Raport\u00f6r \u00d6mer MENC\u0130K taraf\u0131ndan haz\u0131rlanan i\u015fin esas\u0131na ili\u015fkin rapor, itiraz konusu ve ilgili g\u00f6r\u00fclen kanun h\u00fck\u00fcmleri, dayan\u0131lan ve ilgili g\u00f6r\u00fclen Anayasa kurallar\u0131 ve bunlar\u0131n gerek\u00e7eleri ile di\u011fer yasama belgeleri okunup incelendikten sonra gere\u011fi g\u00f6r\u00fc\u015f\u00fcl\u00fcp d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. Genel A\u00e7\u0131klama<\/p>\n<p>3. Hukuk sistemimizde \u00f6zg\u00fcrl\u00fc\u011f\u00fc ba\u011flay\u0131c\u0131 nitelikte hapis ve mal varl\u0131\u011f\u0131na y\u00f6nelik adli para cezas\u0131 olmak \u00fczere iki farkl\u0131 t\u00fcrde adli ceza \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Bir su\u00e7 kar\u015f\u0131l\u0131\u011f\u0131nda yaln\u0131zca hapis ya da adli para cezas\u0131n\u0131n \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc su\u00e7lar oldu\u011fu gibi an\u0131lan yapt\u0131r\u0131mlar\u0131n se\u00e7imlik olarak veya birlikte d\u00fczenlendi\u011fi su\u00e7lar da vard\u0131r. Cezalar\u0131n yan\u0131 s\u0131ra failin tehlikelili\u011fi esas\u0131na dayanan ve failin \u0131slah\u0131n\u0131n sa\u011flanarak topluma kazand\u0131r\u0131lmas\u0131n\u0131 ve bu suretle toplumun korunmas\u0131n\u0131 ama\u00e7layan g\u00fcvenlik tedbirleri de bulunmaktad\u0131r (AYM, E.2023\/106, K.2023\/205, 30\/11\/2023, \u00a7 3).<\/p>\n<p>4. Ceza hukukunda su\u00e7 olan eylemleri \u00f6nlemenin \u00f6nde gelen ara\u00e7lar\u0131ndan biri ceza yapt\u0131r\u0131m\u0131d\u0131r (AYM, E.1990\/17, K.1990\/23, 20\/9\/1990). Bu ba\u011flamda ceza sistemi incelenirken cezalar\u0131n belirlenmesi ve bireyselle\u015ftirilmesi konular\u0131n\u0131n da ele al\u0131nmas\u0131 gerekir. Cezan\u0131n belirlenmesi iki a\u015famadan olu\u015fmaktad\u0131r. Birinci a\u015fama kanun koyucu taraf\u0131ndan su\u00e7 kar\u015f\u0131l\u0131\u011f\u0131 \u00f6ng\u00f6r\u00fclen cezan\u0131n belirlendi\u011fi soyut belirleme a\u015famas\u0131, ikincisi ise su\u00e7un i\u015flenmesinden sonra yarg\u0131lama makam\u0131 taraf\u0131ndan su\u00e7lu hakk\u0131nda h\u00fckmedilecek olan cezan\u0131n somut olarak tespit edildi\u011fi a\u015famad\u0131r (AYM, E.2023\/106, K.2023\/205, 30\/11\/2023, \u00a7 4).<\/p>\n<p>5. Cezan\u0131n soyut belirlenme a\u015famas\u0131 da ikiye ayr\u0131lmaktad\u0131r: Soyut genel belirleme olarak isimlendirilen birinci a\u015famada kanun koyucu, cezalar\u0131n t\u00fcrleri ve a\u011f\u0131rl\u0131klar\u0131na dair genel bir sistem belirlemekte ve ilkeler ortaya koymaktad\u0131r. \u0130kinci a\u015fama olan soyut \u00f6zel belirlemede ise tespit edilen genel ilkeler \u0131\u015f\u0131\u011f\u0131nda her bir su\u00e7 i\u00e7in hangi t\u00fcr ve a\u011f\u0131rl\u0131kta ceza verilece\u011fi tespit edilmektedir. Cezan\u0131n soyut \u00f6zel belirlenmesi a\u015famas\u0131nda kanun koyucu taraf\u0131ndan sabit cezalar, alternatifli veya birlikte cezalar, alt ve\/veya \u00fcst s\u0131n\u0131rl\u0131 (basamakl\u0131) cezalar d\u00fczenlenmektedir (AYM, E.2023\/106, K.2023\/205, 30\/11\/2023, \u00a7 5).<\/p>\n<p>6. Su\u00e7un i\u015flenmesinden sonra ortaya \u00e7\u0131kan somut belirleme a\u015famas\u0131nda h\u00e2kim \u00f6ncelikle su\u00e7lulu\u011funu tespit etti\u011fi failin eyleminin hukuki nitelendirmesini yapmaktad\u0131r. Hukuki nitelendirmenin ard\u0131ndan h\u00e2kim, su\u00e7 t\u00fcr\u00fc i\u00e7in kanunda birden fazla ceza t\u00fcr\u00fcn\u00fcn \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc durumlarda uygun cezay\u0131 se\u00e7er ve 5237 say\u0131l\u0131 Kanun\u2019un 61. maddesinin (1) numaral\u0131 f\u0131kras\u0131nda belirtilen hususlar\u0131 g\u00f6zeterek su\u00e7 i\u00e7in \u00f6ng\u00f6r\u00fclen cezan\u0131n alt ve \u00fcst s\u0131n\u0131rlar\u0131 aras\u0131nda temel cezay\u0131 belirler. An\u0131lan maddenin (2) numaral\u0131 f\u0131kras\u0131 uyar\u0131nca belirlenen temel ceza \u00fczerinden su\u00e7un olas\u0131 kas\u0131tla ya da bilin\u00e7li taksirle i\u015flendi\u011fi durumlarda indirim veya art\u0131r\u0131m yap\u0131lmaktad\u0131r. Maddenin (4) numaral\u0131 f\u0131kras\u0131na g\u00f6re bir su\u00e7un temel \u015fekline nazaran daha a\u011f\u0131r veya daha az cezay\u0131 gerektiren birden fazla nitelikli h\u00e2llerin ger\u00e7ekle\u015fmesi durumunda temel cezada \u00f6nce art\u0131rma, sonra indirme yap\u0131lacakt\u0131r. (5) numaral\u0131 f\u0131kra uyar\u0131nca s\u00f6z konusu f\u0131kralara g\u00f6re tespit edilecek ceza \u00fczerinden s\u0131ras\u0131yla te\u015febb\u00fcs, i\u015ftirak, zincirleme su\u00e7, haks\u0131z tahrik, ya\u015f k\u00fc\u00e7\u00fckl\u00fc\u011f\u00fc, ak\u0131l hastal\u0131\u011f\u0131 ve cezada indirim yap\u0131lmas\u0131n\u0131 gerektiren \u015fahsi sebeplere ili\u015fkin h\u00fck\u00fcmler ile takdiri indirim nedenleri uygulanarak sonu\u00e7 ceza belirlenecektir.<\/p>\n<p>7. (1) numaral\u0131 f\u0131krada temel cezan\u0131n belirlenmesinde g\u00f6z\u00f6n\u00fcnde tutulacak \u00f6l\u00e7\u00fctler su\u00e7un i\u015fleni\u015f bi\u00e7imi, su\u00e7un i\u015flenmesinde kullan\u0131lan ara\u00e7lar, su\u00e7un i\u015flendi\u011fi zaman ve yer, su\u00e7un konusunun \u00f6nem ve de\u011feri, meydana gelen zarar veya tehlikenin a\u011f\u0131rl\u0131\u011f\u0131, failin kast veya taksire dayal\u0131 kusurunun a\u011f\u0131rl\u0131\u011f\u0131 ile failin g\u00fctt\u00fc\u011f\u00fc ama\u00e7 ve saik olarak d\u00fczenlenmi\u015ftir. (3) numaral\u0131 f\u0131kraya g\u00f6re (1) numaral\u0131 f\u0131krada belirtilen hususlar\u0131n su\u00e7un unsurunu olu\u015fturdu\u011fu h\u00e2llerde bunlar, temel cezan\u0131n belirlenmesinde ayr\u0131ca g\u00f6z\u00f6n\u00fcnde bulundurulmayacakt\u0131r.<\/p>\n<p>8. Temel cezan\u0131n belirlenmesinden farkl\u0131 olarak tespit edilen cezan\u0131n -cezan\u0131n ama\u00e7lar\u0131 da g\u00f6zetilerek- failin ki\u015fili\u011fine uydurulmas\u0131 cezan\u0131n bireyselle\u015ftirilmesidir. Cezan\u0131n bireyselle\u015ftirilmesi; yasama, yarg\u0131lama ve idari (infaz a\u015famas\u0131nda) olmak \u00fczere \u00fc\u00e7 farkl\u0131 a\u015famada ger\u00e7ekle\u015fmektedir. An\u0131lan Kanun\u2019un 62. maddesi uyar\u0131nca h\u00e2kim taraf\u0131ndan uygulanan takdiri indirim, 50. maddeye g\u00f6re cezan\u0131n se\u00e7enek yapt\u0131r\u0131mlara \u00e7evrilmesi, 51. madde uyar\u0131nca cezan\u0131n ertelenmesi cezan\u0131n yarg\u0131lama a\u015famas\u0131nda bireyselle\u015ftirilmesine \u00f6rnek olarak g\u00f6sterilebilir (AYM, E.2023\/106, K.2023\/205, 30\/11\/2023, \u00a7 9).<\/p>\n<p>B. Anlam ve Kapsam<\/p>\n<p>9. 5237 say\u0131l\u0131 Kanun\u2019un 52. maddesinin (1) numaral\u0131 f\u0131kras\u0131nda adli para cezas\u0131, kanunda yaz\u0131l\u0131 usule g\u00f6re belirlenen tam g\u00fcn say\u0131s\u0131n\u0131n, bir g\u00fcn kar\u015f\u0131l\u0131\u011f\u0131 olarak takdir edilen miktar ile \u00e7arp\u0131lmas\u0131 suretiyle hesaplanan mebla\u011f\u0131n h\u00fck\u00fcml\u00fc taraf\u0131ndan devlet hazinesine \u00f6denmesi \u015feklinde tan\u0131mlanm\u0131\u015ft\u0131r. Bu y\u00f6n\u00fcyle adli para cezas\u0131n\u0131n belirlenmesinde g\u00fcn para cezas\u0131 sistemi kabul edilmi\u015ftir.<\/p>\n<p>10. G\u00fcn para ceza sisteminde \u00f6nce su\u00e7un niteli\u011fi, failin kusuru ve meydana gelen zarar veya tehlikenin a\u011f\u0131rl\u0131\u011f\u0131 dikkate al\u0131narak g\u00fcn say\u0131s\u0131 belirlenir. Daha sonra failin ekonomik durumu ve di\u011fer \u015fahsi halleri g\u00f6z\u00f6n\u00fcnde bulundurularak belirlenen g\u00fcnl\u00fck miktar tespit edilen g\u00fcn say\u0131s\u0131yla \u00e7arp\u0131lmak suretiyle \u00f6denmesi gereken para cezas\u0131 miktar\u0131na ula\u015f\u0131l\u0131r.<\/p>\n<p>11. Kanun koyucu genel itibar\u0131yla adli para cezas\u0131 \u00f6ng\u00f6r\u00fclen her su\u00e7 tipinde t\u0131pk\u0131 hapis cezalar\u0131nda oldu\u011fu gibi g\u00fcn olarak belli ceza aral\u0131klar\u0131 belirlemi\u015ftir. Adli para cezas\u0131n\u0131n \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc ancak herhangi bir alt ve \u00fcst s\u0131n\u0131r\u0131n belirlenmedi\u011fi su\u00e7 tipleri de bulunmaktad\u0131r. Bu durumda an\u0131lan f\u0131kra uyar\u0131nca alt\u0131 s\u0131n\u0131r\u0131 be\u015f g\u00fcn, \u00fcst s\u0131n\u0131r\u0131 ise yedi y\u00fcz otuz g\u00fcn olmak \u00fczere bu aral\u0131kta adli para cezas\u0131 belirlenmektedir.<\/p>\n<p>12. Bunun yan\u0131 s\u0131ra adli para cezas\u0131n\u0131n se\u00e7imlik olarak \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc su\u00e7larda kanun koyucunun adli para cezas\u0131na ili\u015fkin alt ve \u00fcst veya her ikisi i\u00e7in bir belirlemede bulunmamas\u0131 durumunda s\u00f6z konusu Kanun\u2019un 61. maddesinin (9) numaral\u0131 f\u0131kras\u0131 uyar\u0131nca su\u00e7ta \u00f6ng\u00f6r\u00fclen adli para cezas\u0131n\u0131n g\u00fcn biriminin alt s\u0131n\u0131r\u0131, o su\u00e7 tan\u0131m\u0131ndaki hapis cezas\u0131n\u0131n alt s\u0131n\u0131r\u0131ndan az, \u00fcst s\u0131n\u0131r\u0131 da hapis cezas\u0131n\u0131n \u00fcst s\u0131n\u0131r\u0131ndan fazla olamamaktad\u0131r.<\/p>\n<p>13. H\u00e2kim taraf\u0131ndan g\u00fcn olarak takdir edilen adli para cezas\u0131n\u0131n bir g\u00fcn kar\u015f\u0131l\u0131\u011f\u0131n\u0131n parasal olarak belirlenmesi ise 52. maddenin (2) numaral\u0131 f\u0131kras\u0131nda d\u00fczenlenmi\u015ftir. Buna g\u00f6re en az yirmi ve en fazla y\u00fcz T\u00fcrk liras\u0131 olan bir g\u00fcn kar\u015f\u0131l\u0131\u011f\u0131 adli para cezas\u0131n\u0131n miktar\u0131 ki\u015finin ekonomik ve di\u011fer \u015fahsi halleri g\u00f6z\u00f6n\u00fcnde bulundurularak takdir edilir. An\u0131lan f\u0131krada yer alan \u201cEn az yirmi ve en fazla y\u00fcz T\u00fcrk Liras\u0131&#8230;\u201d ibaresi itiraz konusu kural\u0131 olu\u015fturmaktad\u0131r.<\/p>\n<p>14. Kural, ba\u015fvuru tarihinden sonra y\u00fcr\u00fcrl\u00fc\u011fe giren 2\/3\/2024 tarihli ve 7499 say\u0131l\u0131 Kanun\u2019un 9. maddesiyle \u201cEn az y\u00fcz ve en fazla be\u015fy\u00fcz T\u00fcrk Liras\u0131\u2026\u201d \u015feklinde de\u011fi\u015ftirilmi\u015ftir.<\/p>\n<p>C. \u0130tiraz\u0131n Gerek\u00e7esi<\/p>\n<p>15. Ba\u015fvuru karar\u0131nda \u00f6zetle; itiraz konusu kuralda adli para cezas\u0131n\u0131n bir g\u00fcn kar\u015f\u0131l\u0131\u011f\u0131 olarak belirlenebilecek miktar aral\u0131\u011f\u0131n\u0131n \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc, s\u00f6z konusu miktarlar\u0131n d\u00fczenlendi\u011fi tarih ile g\u00fcn\u00fcm\u00fcz ko\u015fullar\u0131 aras\u0131nda b\u00fcy\u00fck de\u011fer kayb\u0131na u\u011frad\u0131\u011f\u0131, bu nedenle adli para cezalar\u0131n\u0131n g\u00fcn\u00fcm\u00fczde toplumun refah ve huzurunu sa\u011flayamad\u0131\u011f\u0131 gibi cayd\u0131r\u0131c\u0131l\u0131ktan da uzak oldu\u011fu, bu durumun su\u00e7 ma\u011fdurlar\u0131n\u0131n adaleti bulma, hakk\u0131 olan\u0131 elde etme ve haks\u0131zl\u0131\u011f\u0131 giderme u\u011fra\u015f\u0131n\u0131 sonu\u00e7suz b\u0131rakt\u0131\u011f\u0131, ki\u015filerin maddi ve manevi varl\u0131klar\u0131n\u0131 koruma ve geli\u015ftirme hakk\u0131na y\u00f6nelik eylemlere kar\u015f\u0131 cayd\u0131r\u0131c\u0131 nitelik ta\u015f\u0131mad\u0131\u011f\u0131 belirtilerek kural\u0131n Anayasa\u2019n\u0131n 2., 5., 13., 17. ve 36. maddelerine ayk\u0131r\u0131 oldu\u011fu ileri s\u00fcr\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>\u00c7. Anayasa\u2019ya Ayk\u0131r\u0131l\u0131k Sorunu<\/p>\n<p>16. 30\/3\/2011 tarihli ve 6216 say\u0131l\u0131 Anayasa Mahkemesinin Kurulu\u015fu ve Yarg\u0131lama Usulleri Hakk\u0131nda Kanun\u2019un 43. maddesi uyar\u0131nca kural, ilgisi nedeniyle Anayasa\u2019n\u0131n 38. maddesi y\u00f6n\u00fcnden de incelenmi\u015ftir.<\/p>\n<p>17. \u0130tiraz konusu kural, ba\u015fvuru tarihinden sonra y\u00fcr\u00fcrl\u00fc\u011fe giren 7499 say\u0131l\u0131 Kanun\u2019un 9. maddesiyle de\u011fi\u015ftirilmi\u015f ise de kural\u0131n ceza miktar\u0131 itibar\u0131yla lehe olmas\u0131 nedeniyle bak\u0131lmakta olan davada uygulanacak kural niteli\u011fini devam ettirdi\u011fi g\u00f6zetildi\u011finde anayasal denetime konu edilmesine engel bir durumun bulunmad\u0131\u011f\u0131 anla\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>18. Anayasa\u2019n\u0131n 38. maddesinin birinci f\u0131kras\u0131nda \u201cKimse, i\u015flendi\u011fi zaman y\u00fcr\u00fcrl\u00fckte bulunan kanunun su\u00e7 saymad\u0131\u011f\u0131 bir fiilden dolay\u0131 cezaland\u0131r\u0131lamaz; kimseye su\u00e7u i\u015fledi\u011fi zaman kanunda o su\u00e7 i\u00e7in konulmu\u015f olan cezadan daha a\u011f\u0131r bir ceza verilemez.\u201d denilerek su\u00e7un kanunili\u011fi; \u00fc\u00e7\u00fcnc\u00fc f\u0131kras\u0131nda da \u201cCeza ve ceza yerine ge\u00e7en g\u00fcvenlik tedbirleri ancak kanunla konulur.\u201d denilmek suretiyle cezan\u0131n kanunili\u011fi ilkesi g\u00fcvence alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>19. Su\u00e7ta ve cezada kanunilik ilkesi Anayasa\u2019n\u0131n 13. maddesinde ifade edilen temel hak ve \u00f6zg\u00fcrl\u00fcklerin ancak kanunla s\u0131n\u0131rlanabilece\u011fine ili\u015fkin kural\u0131n su\u00e7 ve cezalar y\u00f6n\u00fcnden \u00f6zel d\u00fczenlemesi olarak de\u011ferlendirilebilir. Su\u00e7ta ve cezada kanunilik ilkesi, cezaland\u0131rman\u0131n temel haklara etkisinden kaynaklanan \u00f6zel \u00f6nemi nedeniyle zaman i\u00e7inde bir ceza hukuku kavram\u0131 olarak alt ilkeler de i\u00e7erecek \u015fekilde geli\u015fmi\u015ftir (AYM, E.2019\/9, K.2019\/27, 11\/4\/2019, \u00a7 15).<\/p>\n<p>20. Anayasa\u2019n\u0131n an\u0131lan maddesinde yer alan su\u00e7ta ve cezada kanunilik ilkesi uyar\u0131nca hangi fiillerin yasakland\u0131\u011f\u0131n\u0131n ve bu yasak fiillere verilecek cezalar\u0131n hi\u00e7bir ku\u015fkuya yer b\u0131rakmayacak a\u00e7\u0131kl\u0131kta, anla\u015f\u0131l\u0131r ve s\u0131n\u0131rlar\u0131 belirli olacak bi\u00e7imde kanunda g\u00f6sterilmesi gerekmektedir. Ki\u015filerin yasak fiilleri \u00f6nceden bilmeleri d\u00fc\u015f\u00fcncesine dayanan bu ilkeyle temel hak ve \u00f6zg\u00fcrl\u00fcklerin g\u00fcvence alt\u0131na al\u0131nmas\u0131 ama\u00e7lanm\u0131\u015ft\u0131r.<\/p>\n<p>21. Adli para cezas\u0131 belirlenirken bir g\u00fcn kar\u015f\u0131l\u0131\u011f\u0131 olarak uygulanabilecek para miktarlar\u0131n\u0131n alt ve \u00fcst s\u0131n\u0131rlar\u0131n\u0131 belirleyen kural\u0131n \u015fekl\u00ee anlamda bir kanun h\u00fckm\u00fc oldu\u011fu ve eri\u015filebilir nitelikte oldu\u011fu hususunda bir teredd\u00fct bulunmamaktad\u0131r. Ayr\u0131ca adli para cezas\u0131 belirlenirken bir g\u00fcn kar\u015f\u0131l\u0131\u011f\u0131 olarak uygulanabilecek parasal kar\u015f\u0131l\u0131\u011f\u0131n alt ve \u00fcst s\u0131n\u0131rlar\u0131n\u0131n a\u00e7\u0131k ve net olarak belirlendi\u011fi g\u00f6zetildi\u011finde kural\u0131n \u00f6ng\u00f6r\u00fclebilir oldu\u011fu ve kanunilik \u015fart\u0131n\u0131 ta\u015f\u0131d\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>22. \u00d6te yandan Anayasa&#8217;n\u0131n 2. maddesinde belirtilen hukuk devleti eylem ve i\u015flemleri hukuka uygun, insan haklar\u0131na dayanan, bu hak ve \u00f6zg\u00fcrl\u00fckleri koruyup g\u00fc\u00e7lendiren, her alanda adil bir hukuk d\u00fczeni kurup bunu geli\u015ftirerek s\u00fcrd\u00fcren, hukuki g\u00fcvenli\u011fi sa\u011flayan, Anayasa&#8217;ya ayk\u0131r\u0131 durum ve tutumlardan ka\u00e7\u0131nan, hukukun \u00fcst\u00fcn kurallar\u0131yla kendini ba\u011fl\u0131 sayan, yarg\u0131 denetimine a\u00e7\u0131k olan devlettir.<\/p>\n<p>23. Hukuk devletinde su\u00e7 ve su\u00e7lulukla m\u00fccadele amac\u0131yla ceza ve ceza yerine ge\u00e7en g\u00fcvenlik tedbirlerine ili\u015fkin d\u00fczenlemeler, devletin ceza siyasetinin de bir gere\u011fi olarak Anayasa&#8217;n\u0131n konuya ili\u015fkin h\u00fck\u00fcmleri ba\u015fta olmak \u00fczere su\u00e7lar\u0131n niteli\u011fi, i\u015flenme bi\u00e7imi, i\u00e7erik ve yo\u011funlu\u011fu, kamu d\u00fczenini ihlal derecesi, cezalar\u0131n cayd\u0131r\u0131c\u0131l\u0131\u011f\u0131, \u00fclkenin sosyal, k\u00fclt\u00fcrel yap\u0131s\u0131, etik de\u011ferleri ve ekonomik hayat\u0131n ihtiya\u00e7lar\u0131 g\u00f6z\u00f6n\u00fcne al\u0131narak belirlenir. Kanun koyucu; cezaland\u0131rma yetkisini kullan\u0131rken toplumda hangi eylemlerin su\u00e7 say\u0131laca\u011f\u0131, bunun hangi t\u00fcr ve \u00f6l\u00e7\u00fcdeki ceza yapt\u0131r\u0131m\u0131 ile kar\u015f\u0131lanaca\u011f\u0131, nelerin a\u011f\u0131rla\u015ft\u0131r\u0131c\u0131 veya hafifletici sebep olarak kabul edilece\u011fi ve ceza sistemini tamamlayan m\u00fcesseselerin nelerden ibaret olaca\u011f\u0131 hususlar\u0131nda takdir yetkisine sahiptir (AYM, E.2023\/106, K.2023\/205, 30\/11\/2023, \u00a7 25). Kanun koyucunun bu konudaki tercih ve takdirinin yerindeli\u011finin incelenmesi, anayasal denetimin kapsam\u0131 d\u0131\u015f\u0131nda kalmaktad\u0131r (AYM, E.2019\/74, K.2020\/29, 12\/6\/2020, \u00a7 14).<\/p>\n<p>24. Bununla birlikte kanun koyucu, takdir yetkisi kapsam\u0131ndaki d\u00fczenlemeleri yaparken hukuk devleti ilkesinin bir gere\u011fi olan \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesiyle ba\u011fl\u0131d\u0131r. Bu ilke elveri\u015flilik, gereklilik ve orant\u0131l\u0131l\u0131k olmak \u00fczere \u00fc\u00e7 alt ilkeden olu\u015fmaktad\u0131r. Elveri\u015flilik getirilen kural\u0131n ula\u015f\u0131lmak istenen ama\u00e7 i\u00e7in elveri\u015fli olmas\u0131n\u0131, gereklilik getirilen kural\u0131n ula\u015f\u0131lmak istenen ama\u00e7 bak\u0131m\u0131ndan gerekli olmas\u0131n\u0131, orant\u0131l\u0131l\u0131k ise getirilen kural ile ula\u015f\u0131lmak istenen ama\u00e7 aras\u0131nda olmas\u0131 gereken \u00f6l\u00e7\u00fcy\u00fc ifade etmektedir. Bir kuralda \u00f6ng\u00f6r\u00fclen d\u00fczenleme ile ula\u015f\u0131lmak istenen ama\u00e7 aras\u0131nda \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesi gere\u011fince makul bir dengenin bulunmas\u0131 zorunludur.<\/p>\n<p>25. Kural, i\u015fledi\u011fi bir su\u00e7 kar\u015f\u0131l\u0131\u011f\u0131nda adli para cezas\u0131yla cezaland\u0131r\u0131lacak failin ekonomik ve di\u011fer \u015fahsi hallerinin g\u00f6z\u00f6n\u00fcnde bulundurularak bir g\u00fcn kar\u015f\u0131l\u0131\u011f\u0131 yirmi ile y\u00fcz TL aras\u0131nda belirlenecek bir miktar para cezas\u0131yla cezaland\u0131r\u0131laca\u011f\u0131n\u0131 d\u00fczenlemektedir. Kural\u0131n \u00f6ng\u00f6rd\u00fc\u011f\u00fc bu sistemde adli para cezas\u0131n\u0131n bir g\u00fcn kar\u015f\u0131l\u0131\u011f\u0131 olan parasal de\u011ferin \u00fcst s\u0131n\u0131rdan belirlenmesi m\u00fcmk\u00fcnd\u00fcr. B\u00f6ylece ceza miktar\u0131n\u0131n cayd\u0131r\u0131c\u0131 bir etkiye sahip olmas\u0131 sa\u011flanabilmektedir.<\/p>\n<p>26. Bunun yan\u0131 s\u0131ra s\u00f6z konusu sistemde ekonomik g\u00fcc\u00fc y\u00fcksek olan fail aleyhine daha y\u00fcksek miktarda, ekonomik g\u00fcc\u00fc d\u00fc\u015f\u00fck olan fail hakk\u0131nda da daha az miktarda adli para cezas\u0131 h\u00fckmedilerek bu ki\u015filer aras\u0131nda ceza adaleti a\u00e7\u0131s\u0131ndan adil bir fark olu\u015fturulabilecektir. Bu \u015fekilde her iki fail ayn\u0131 m\u00fceyyidelere maruz kalmayacak, toplumda adalete olan g\u00fcvenin ve ceza adaletinin sa\u011flanmas\u0131 temin edilmi\u015f olacakt\u0131r.<\/p>\n<p>27. Bu itibarla kural\u0131n toplumda adalete olan g\u00fcvenin ve ceza adaletinin sa\u011flanmas\u0131na katk\u0131 sunmak amac\u0131na y\u00f6nelik oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Kural kapsam\u0131nda adli para cezas\u0131 i\u00e7in belirlenen alt ve \u00fcst s\u0131n\u0131r\u0131n an\u0131lan me\u015fru amaca ula\u015fmak bak\u0131m\u0131ndan elveri\u015fli oldu\u011fu a\u00e7\u0131kt\u0131r.<\/p>\n<p>28. Bunun yan\u0131nda toplumda adalete olan g\u00fcvenin ve ceza adaletinin sa\u011flanmas\u0131 i\u00e7in su\u00e7a uygulanacak yapt\u0131r\u0131m\u0131n niteli\u011fi ve miktar\u0131n\u0131 belirlemede kanun koyucunun takdir yetkisinin bulundu\u011fu g\u00f6zetildi\u011finde kuralda \u00f6ng\u00f6r\u00fclen miktarlar\u0131n s\u00f6z konusu amaca ula\u015fma bak\u0131m\u0131ndan gerekli olmad\u0131\u011f\u0131 da s\u00f6ylenmez.<\/p>\n<p>29. \u00d6l\u00e7\u00fcl\u00fcl\u00fck incelemesinde son olarak kuralda \u00f6ng\u00f6r\u00fclen miktarlar ile ula\u015f\u0131lmak istenen me\u015fru ama\u00e7 aras\u0131ndaki makul dengeyi ifade eden orant\u0131l\u0131l\u0131k ilkesi de\u011ferlendirilmelidir. Orant\u0131l\u0131l\u0131k incelemesinde devletin su\u00e7 i\u015fleyen ki\u015filerin kendi aralar\u0131nda ve su\u00e7 nedeniyle zarar g\u00f6ren ki\u015filer aras\u0131nda ceza adaleti y\u00f6n\u00fcnden adil bir dengenin sa\u011flanmas\u0131 hususundaki pozitif y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn de dikkate al\u0131nmas\u0131 gerekir.<\/p>\n<p>30. Ki\u015finin maddi ve manevi varl\u0131\u011f\u0131n\u0131n korunmas\u0131n\u0131 bir hak olarak \u00f6ng\u00f6ren ve g\u00fcvence alt\u0131na alan Anayasa\u2019n\u0131n 17. maddesi, devlete pozitif ve negatif y\u00fck\u00fcml\u00fcl\u00fckler y\u00fcklemektedir (AYM, E.2007\/78, K.2010\/120, 30\/12\/2010; Serpil Kerimo\u011flu ve di\u011ferleri [2.B.], B. No. 2012\/752, 17\/9\/2013, \u00a7 50). Bu y\u00fck\u00fcml\u00fcl\u00fckler kapsam\u0131nda devlet, bireyin maddi ve manevi varl\u0131\u011f\u0131n\u0131n bir par\u00e7as\u0131 olan fiziksel ve ruhsal b\u00fct\u00fcnl\u00fc\u011fe keyf\u00ee olarak m\u00fcdahale etmemek ve \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin sald\u0131r\u0131lar\u0131n\u0131 \u00f6nlemekle y\u00fck\u00fcml\u00fcd\u00fcr (Yusuf Burak \u00c7elik [2.B.], B. No: 2013\/2538, 20\/11\/2014, \u00a7 31).<\/p>\n<p>31. Devletin ki\u015finin maddi ve manevi varl\u0131\u011f\u0131n\u0131n korunmas\u0131 hakk\u0131 kapsam\u0131nda sahip oldu\u011fu pozitif y\u00fck\u00fcml\u00fcl\u00fcklerin usule ili\u015fkin y\u00f6n\u00fc bulunmaktad\u0131r. S\u00f6z konusu usul y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc \u00e7er\u00e7evesinde devlet, her t\u00fcrl\u00fc fiziksel ve ruhsal sald\u0131r\u0131 olay\u0131n\u0131n sorumlular\u0131n\u0131n belirlenmesini ve gerekiyorsa cezaland\u0131r\u0131lmas\u0131n\u0131 sa\u011flayabilecek etkili resm\u00ee bir soru\u015fturma y\u00fcr\u00fctmek durumundad\u0131r. Bu bir sonu\u00e7 y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc olmay\u0131p uygun ara\u00e7lar\u0131n kullan\u0131lmas\u0131 y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcd\u00fcr. Dolay\u0131s\u0131yla bu kapsamda a\u00e7\u0131lm\u0131\u015f olan t\u00fcm davalar\u0131n mahk\u00fbmiyetle ya da belirli bir ceza karar\u0131yla sonu\u00e7lanmas\u0131 zorunlulu\u011fu bulunmamaktad\u0131r (Cezmi Demir ve di\u011ferleri [1.B.], B. No: 2013\/293, 17\/7\/2014, \u00a7\u00a7 110, 113).<\/p>\n<p>32. Ceza soru\u015fturmas\u0131 y\u00fcr\u00fct\u00fclmesinin anayasal olarak zorunlu oldu\u011fu ya da kanun koyucunun bir fiili su\u00e7 olarak \u00f6ng\u00f6rd\u00fc\u011f\u00fc h\u00e2llerde usul y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn bir unsuru olarak sorumlulara fiilleriyle orant\u0131l\u0131 cezalar\u0131n verilmesi ve ma\u011fdur a\u00e7\u0131s\u0131ndan da uygun giderimin sa\u011flanmas\u0131 gerekir (baz\u0131 farklarla birlikte bkz. \u015eenol G\u00fcrkan [1.B.], B. No: 2013\/2438, 9\/9\/2015, \u00a7 105). \u0130\u015flenen su\u00e7 ile verilen cezalar aras\u0131nda orant\u0131s\u0131zl\u0131k olmas\u0131 ya da su\u00e7 konusu fiile hi\u00e7 ceza verilmemesi durumunda bu t\u00fcr eylemlerin \u00f6nlenmesini sa\u011flayabilecek cayd\u0131r\u0131c\u0131 etkinin ortaya konulmamas\u0131, b\u00f6ylelikle ki\u015filerin fiziksel ve ruhsal b\u00fct\u00fcnl\u00fcklerinin idari olarak ve yasal mevzuat arac\u0131l\u0131\u011f\u0131yla korunmas\u0131 hususundaki pozitif y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn yerine getirilememesi sonucu ortaya \u00e7\u0131kabilir (S.D. [1.B.], B. No: 2013\/3017, 16\/12\/2015, \u00a7 102).<\/p>\n<p>33. Cezas\u0131zl\u0131k, i\u015flenen bir su\u00e7un somut olarak cezas\u0131z kalmas\u0131n\u0131 ifade etmektedir. Cezas\u0131zl\u0131k; fiziksel ve ruhsal sald\u0131r\u0131 fiillerine y\u00f6nelik olarak sorumlular\u0131n adalet \u00f6n\u00fcne \u00e7\u0131kar\u0131lmamas\u0131, i\u015fledikleri su\u00e7la orant\u0131l\u0131 bir bi\u00e7imde cezaland\u0131r\u0131lmamas\u0131 veya mahk\u00fbm edildikleri cezan\u0131n infaz\u0131n\u0131n sa\u011flanmamas\u0131 \u015feklinde ortaya \u00e7\u0131kabilmektedir. \u0130\u015flenen su\u00e7 ile verilen cezalar aras\u0131nda orant\u0131s\u0131zl\u0131k olmas\u0131 ya da hi\u00e7 ceza verilmemesi durumunda bu t\u00fcr eylemlerin \u00f6nlenmesini sa\u011flayabilecek cayd\u0131r\u0131c\u0131 bir etki ortaya koymaktan olduk\u00e7a uzak kal\u0131nmaktad\u0131r (AYM, E.2022\/120, K.2023\/107, 1\/6\/2023, \u00a7 52).<\/p>\n<p>34. Bu ba\u011flamda ceza miktar\u0131n\u0131n orant\u0131l\u0131l\u0131\u011f\u0131, \u00f6ng\u00f6r\u00fclen miktarlar ba\u011flam\u0131nda ki\u015filere y\u00fcklenen k\u00fclfetin a\u011f\u0131rl\u0131\u011f\u0131na g\u00f6re belirlenecektir. Kuralda \u00f6ng\u00f6r\u00fclen alt ve \u00fcst s\u0131n\u0131r\u0131n h\u00e2kimin ekonomik durumlar\u0131 farkl\u0131 olan ki\u015filer aras\u0131nda farkl\u0131 miktarlarda adli para cezas\u0131 uygulayarak cezadaki cayd\u0131r\u0131c\u0131l\u0131\u011f\u0131n sa\u011flanmas\u0131 a\u00e7\u0131s\u0131ndan ayn\u0131 su\u00e7u i\u015fleyen ki\u015filer aras\u0131nda a\u015f\u0131r\u0131 k\u00fclfet olu\u015fturmayacak \u015fekilde adil bir denge kurulmas\u0131na imk\u00e2n tan\u0131d\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Ayr\u0131ca kuralda \u00f6ng\u00f6r\u00fclen s\u0131n\u0131rlar\u0131n ma\u011fdur a\u00e7\u0131s\u0131ndan uygun giderim sa\u011flamaya elveri\u015fli oldu\u011fu, i\u015flenen bir su\u00e7un cezas\u0131z kalmas\u0131 sonucunu do\u011furmayaca\u011f\u0131 belirtilmelidir. Dolay\u0131s\u0131yla kuralda adli para cezas\u0131n\u0131n bir g\u00fcn kar\u015f\u0131l\u0131\u011f\u0131 olarak belirlenen parasal de\u011ferlerin ceza adaletinin sa\u011flanmas\u0131 amac\u0131na ula\u015fmak bak\u0131m\u0131ndan orant\u0131l\u0131 oldu\u011fu sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>35. Bu itibarla kanun koyucunun takdir yetkisi kapsam\u0131nda \u00f6ng\u00f6r\u00fclen ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olmayan kural\u0131n hukuk devleti ile su\u00e7ta ve cezada kanunilik ilkeleriyle \u00e7eli\u015fen bir y\u00f6n\u00fc bulunmamaktad\u0131r.<\/p>\n<p>36. Bu dosyada incelenen kural\u0131n 7499 say\u0131l\u0131 Kanunla de\u011fi\u015ftirilmeden (parasal de\u011ferler art\u0131r\u0131lmadan) \u00f6nceki \u015fekliyle anayasal denetimi yap\u0131lm\u0131\u015ft\u0131r. Kuralda T\u00fcrk Ceza Kanunu\u2019nda d\u00fczenlenen adli para cezalar\u0131n\u0131n belirlenmesinde temel al\u0131nan g\u00fcn para cezas\u0131 sistemine uygun olarak bir g\u00fcn kar\u015f\u0131l\u0131\u011f\u0131 cezan\u0131n en az yirmi ve en fazla y\u00fcz T\u00fcrk Liras\u0131 olaca\u011f\u0131 \u00f6ng\u00f6r\u00fclmektedir. Mahkememiz \u00e7o\u011funlu\u011fu taraf\u0131ndan kuralda hakime cezan\u0131n bireyselle\u015ftirilmesi kapsam\u0131nda en az miktar ile en \u00fcst miktar aras\u0131nda bir uygulama yapma konusunda takdir yetkisinin verildi\u011fi, kuralda \u00f6ng\u00f6r\u00fclen miktarlar itibar\u0131yla orant\u0131l\u0131 olmad\u0131\u011f\u0131n\u0131n s\u00f6ylenemeyece\u011fi belirtilmi\u015ftir. Gerek\u00e7ede buna ek olarak anayasal olarak devletin koruma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc gere\u011fi ya\u015fam ve v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fc hakk\u0131n\u0131n ya da di\u011fer \u00f6nemli haklar\u0131n korunmas\u0131yla ilgili su\u00e7lara ili\u015fkin d\u00fczenlemelerde etkili ve cayd\u0131r\u0131c\u0131 cezalar\u0131n \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc, ceza yapt\u0131r\u0131m\u0131 ile korunmas\u0131n\u0131n anayasal a\u00e7\u0131dan zorunlu olmayan konularda ise daha hafif cezalar\u0131n ve bu arada adli para cezas\u0131n\u0131n \u00f6ng\u00f6r\u00fclmesinin yasa koyucunun takdir yetkisi kapsam\u0131nda oldu\u011fu, ayr\u0131ca Kanunda hapis cezas\u0131yla birlikte adli para cezas\u0131n\u0131n \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc hallerde hakimin adli para cezas\u0131n\u0131n cayd\u0131r\u0131c\u0131l\u0131\u011f\u0131 sa\u011flayamayaca\u011f\u0131n\u0131 \u00f6ng\u00f6rd\u00fc\u011f\u00fc hallerde hapis cezas\u0131n\u0131 tercih edebilece\u011fi \u015feklindeki gerek\u00e7elerle iptal isteminin reddi gerekti\u011fi karar\u0131 verilmi\u015ftir.<\/p>\n<p>2. D\u00fc\u015f\u00fcncemize g\u00f6re iptal isteminin temel gerek\u00e7esi, yasal de\u011fi\u015fiklikten \u00f6nceki \u015fekliyle kuraldaki para cezalar\u0131n\u0131n, ilgili su\u00e7 tiplerindeki temel haklar\u0131 koruyuculu\u011fu y\u00f6n\u00fcyle etkili ve cayd\u0131r\u0131c\u0131 olmad\u0131\u011f\u0131 iddias\u0131na dayanmaktad\u0131r. \u015e\u00fcphesiz anayasal a\u00e7\u0131dan devletin anayasadaki her t\u00fcrl\u00fc temel insan hakk\u0131n\u0131n ceza hukuku yapt\u0131r\u0131m\u0131 ile korunmas\u0131n\u0131n zorunlu oldu\u011fu s\u00f6ylenemez. Bir k\u0131s\u0131m haklar\u0131n di\u011fer baz\u0131 idari veya hukuki tedbir ve yapt\u0131r\u0131mlar \u00e7er\u00e7evesinde de korunmas\u0131 s\u00f6z konusu olabilir. Bu konuda kanun koyucunun takdir yetkisi bulunmaktad\u0131r. Kanun koyucu g\u00fcncel toplumsal ihtiya\u00e7lar\u0131 de\u011ferlendirerek baz\u0131 temel haklara ili\u015fkin olarak daha y\u00fcksek d\u00fczeyde ve ceza hukuku yapt\u0131r\u0131m\u0131yla koruma sa\u011flamay\u0131 tercih edebilir. Bu tercih, s\u00f6z konusu konuda \u00fcst derecede bir korumaya ili\u015fkin olarak zorunlu bir toplumsal ihtiyac\u0131n do\u011fdu\u011funu g\u00f6stermektedir. \u00d6rne\u011fin ya\u015fam ve v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fcn, cinsel dokunulmazl\u0131k hakk\u0131n\u0131n, i\u015fkence, eziyet veya insan haysiyetiyle ba\u011fda\u015fmayan muameleye ya da yapt\u0131r\u0131ma maruz kalmama hakk\u0131n\u0131n etkili ve cayd\u0131r\u0131c\u0131 ceza hukuku yapt\u0131r\u0131mlar\u0131yla korunmas\u0131 Anayasa\u2019m\u0131z uyar\u0131nca devletin zorunlu pozitif y\u00fck\u00fcml\u00fcl\u00fckleri i\u00e7erisindedir. Buna kar\u015f\u0131n bir k\u0131s\u0131m temel haklar\u0131n korunmas\u0131n\u0131n ceza hukuku alan\u0131nda korumay\u0131 gerektirip gerektirmemesi ise yasa koyucunun takdir yetkisine girmektedir. Bununla birlikte yasa koyucunun bu konudaki takdir yetkisini tesad\u00fcflere veya anl\u0131k ihtiya\u00e7lara g\u00f6re de\u011fil, o konudaki zorunlu toplumsal ihtiyaca g\u00f6re belirlemesi gerekti\u011fi ifade edilmelidir. Di\u011fer taraftan yasa koyucunun bir konuyu ceza hukuku alan\u0131na \u00e7ekti\u011fi durumda ise anayasal ba\u011flamda korunan hukuki de\u011ferin\/hakk\u0131n gerektirdi\u011fi d\u00fczeyde bir koruma sa\u011flamas\u0131n\u0131n da zorunlu olaca\u011f\u0131 belirtilmelidir.<\/p>\n<p>3. Anayasa\u2019n\u0131n 5. maddesinde devletin temel ama\u00e7 ve g\u00f6revleri; \u201c\u2026ki\u015filerin ve toplumun refah, huzur ve mutlulu\u011funu sa\u011flamak \u2026 ki\u015filerin temel hak ve h\u00fcrriyetlerini s\u0131n\u0131rlayan engelleri kald\u0131rma, insan\u0131n maddi ve manevi varl\u0131\u011f\u0131n\u0131n geli\u015fmesi i\u00e7in gerekli \u015fartlar\u0131 haz\u0131rlamaya \u00e7al\u0131\u015fmak\u201d ifadeleriyle olduk\u00e7a geni\u015f kapsaml\u0131 bi\u00e7imde g\u00f6sterilmi\u015ftir. Anayasa\u2019n\u0131n 12\/1. maddesi uyar\u0131nca herkes ki\u015fili\u011fine ba\u011fl\u0131, dokunulmaz, devredilmez, vazge\u00e7ilmez temel hak ve h\u00fcrriyetlere sahiptir. Anayasa\u2019n\u0131n devam\u0131nda yer alan maddelerde de ki\u015filerin sahip olduklar\u0131 temel haklar\u0131 s\u0131ras\u0131yla a\u00e7\u0131klanm\u0131\u015f ve kapsamlar\u0131 g\u00f6sterilmi\u015ftir. Yine Anayasa\u2019n\u0131n 12\/2. maddesi uyar\u0131nca temel hak ve h\u00fcrriyetler ki\u015finin topluma ailesine ve di\u011fer ki\u015filere kar\u015f\u0131 \u00f6dev ve sorumluluklar\u0131n\u0131 da ihtiva eder. Ba\u015fka deyi\u015fle an\u0131lan kural temel haklar\u0131n s\u0131n\u0131rland\u0131r\u0131lmas\u0131 bak\u0131m\u0131ndan anayasal me\u015fru s\u0131n\u0131rlama nedenleriyle ba\u011flant\u0131 kurulmas\u0131na imkan vermektedir. Temel haklara ili\u015fkin anayasal g\u00fcvenceler kar\u015f\u0131s\u0131nda devletin negatif y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc m\u00fcdahale etmeme \u015feklinde iken, pozitif y\u00fck\u00fcml\u00fcl\u00fckleri ise bu haklar\u0131n g\u00fcncel hayatta ger\u00e7ekle\u015ftirilmesi ve korunmas\u0131 i\u00e7in gereken sosyal, idari, hukuki ve adli d\u00fczeni kurmak ve d\u00fczenli \u015fekilde i\u015flemesini sa\u011flamakt\u0131r. \u00d6te yandan belirtilen temel haklara kar\u015f\u0131n devletin toplumun korunmas\u0131 i\u00e7in de baz\u0131 pozitif y\u00fck\u00fcml\u00fcl\u00fckleri bulunmaktad\u0131r. \u00d6rne\u011fin \u00e7evrenin, orman\u0131n, meralar\u0131n, \u00e7ocuklar\u0131n, gen\u00e7li\u011fin korunmas\u0131, toplumun ve bireylerin g\u00fcvenliklerinin, sa\u011fl\u0131klar\u0131n\u0131n korunmas\u0131, e\u011fitim ihtiyac\u0131n\u0131n kar\u015f\u0131lanmas\u0131, vb. y\u00fck\u00fcml\u00fcl\u00fckleri bu kapsamda say\u0131labilir. Belirtilen y\u00fck\u00fcml\u00fcl\u00fcklerin yerine getirilmesi i\u00e7in kurulacak idari d\u00fczenlemeler ve kolluk faaliyetleri dolay\u0131s\u0131yla ise baz\u0131 temel haklar\u0131n s\u0131n\u0131rland\u0131r\u0131lmas\u0131 gerekecektir. \u00d6rne\u011fin milli g\u00fcvenli\u011fin veya \u00e7evrenin korunmas\u0131 amac\u0131yla d\u00fczenleyici kurallar olu\u015fturulmas\u0131 ve yapt\u0131r\u0131m \u00f6ng\u00f6r\u00fclmesi halinde bireylerin m\u00fclkiyet veya \u00f6zg\u00fcrl\u00fck ve g\u00fcvenlik haklar\u0131na m\u00fcdahale edilmesi gerekecektir. Dolay\u0131s\u0131yla devletin bu t\u00fcr pozitif y\u00fck\u00fcml\u00fcl\u00fckleriyle, temel haklar\u0131n korunmas\u0131 y\u00f6n\u00fcndeki pozitif y\u00fck\u00fcml\u00fcl\u00fckleri aras\u0131nda \u00e7at\u0131\u015fma ortaya \u00e7\u0131kmaktad\u0131r. Hatta bu \u00e7at\u0131\u015fma iki temel hakk\u0131n korunmas\u0131na y\u00f6nelik olarak devletin pozitif y\u00fck\u00fcml\u00fcl\u00fckleri kapsam\u0131ndaki faaliyetleri dolay\u0131s\u0131yla da ortaya \u00e7\u0131kabilir. \u00d6rne\u011fin A ki\u015fisinin ifade a\u00e7\u0131klamas\u0131 nedeniyle B ki\u015fisinin \u015feref ve haysiyetinin korunmas\u0131 i\u00e7in yap\u0131lacak yarg\u0131lama faaliyetinde mahkemenin haklar aras\u0131nda bir dengeleme\/tart\u0131m yapmas\u0131 ve bu \u00e7at\u0131\u015fmay\u0131 \u00e7\u00f6zmesi de anayasan\u0131n yatay etkisi boyutuyla devlete d\u00fc\u015fen pozitif y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn kapsam\u0131na girmektedir.<\/p>\n<p>4. T\u00fcrk Ceza Kanunu ve di\u011fer \u00f6zel kanunlarda yapt\u0131r\u0131m olarak do\u011frudan veya se\u00e7imlik adli para cezas\u0131 \u00f6n g\u00f6r\u00fclen \u00e7ok say\u0131da su\u00e7 t\u00fcr\u00fc bulunmaktad\u0131r. Yine kimi su\u00e7lara ili\u015fkin hapis cezalar\u0131n\u0131n adli para cezalar\u0131na d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi m\u00fcmk\u00fcn bulunmaktad\u0131r. S\u00f6z gelimi kasten basit yaralama su\u00e7unda (d\u00f6rt aydan bir y\u0131la kadar hapse se\u00e7enek olarak) adli para cezas\u0131n\u0131n alt s\u0131n\u0131r\u0131 2.400TL, \u00fcst s\u0131n\u0131r\u0131 ise 7.300TL; taksirle yaralama su\u00e7unun \u00fc\u00e7 aydan bir y\u0131la kadar hapis cezas\u0131na se\u00e7enek adli para cezas\u0131n\u0131n alt s\u0131n\u0131r\u0131 1.800 TL ila 7.300 TL aras\u0131nda; cinsel taciz su\u00e7unda \u00fc\u00e7 aydan 24 aya kadar hapis cezas\u0131n\u0131n se\u00e7enek adli para cezas\u0131 1.800TL\u2019den 14.400TL\u2019ye kadar; \u00e7evreye zararl\u0131 at\u0131k b\u0131rakma su\u00e7unun hapis cezas\u0131 5 g\u00fcn, se\u00e7enek adli para cezas\u0131 ise 100 TL ila 500TL\u2019ye kadard\u0131r.<\/p>\n<p>5. \u00d6te yandan kuraldaki 20TL ve 100 TL \u015feklindeki g\u00fcnl\u00fck para cezas\u0131 miktarlar\u0131 1 Haziran 2005 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015ftir. \u00d6l\u00e7\u00fcl\u00fcl\u00fc\u011f\u00fcn somutla\u015ft\u0131r\u0131lmas\u0131 i\u00e7in objektif bir kriter olarak, Kanunun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihteki asgari \u00fccret miktar\u0131 ile bir g\u00fcn i\u00e7in \u00f6ng\u00f6r\u00fclen yirmi T\u00fcrk Liras\u0131n\u0131 k\u0131yaslayabiliriz. Kural\u0131n y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihte asgari \u00fccret ayl\u0131k miktar\u0131 490 TL\u2019dir. Yine y\u00fcr\u00fcrl\u00fckten 5 y\u0131l sonra 2010 y\u0131l\u0131nda asgari \u00fccret 760 TL, 2013 y\u0131l\u0131nda 1.025 TL, 2016 y\u0131l\u0131nda 1.647 TL, 2020 y\u0131l\u0131nda 2.943 TL, 2023 y\u0131l\u0131nda ise 11.402, TL olmu\u015ftur. Ba\u015fka deyi\u015fle; 2005 y\u0131l\u0131nda bir g\u00fcn kar\u015f\u0131l\u0131\u011f\u0131 20TL, asgari \u00fccretin yirmid\u00f6rtte birine kar\u015f\u0131l\u0131k gelmektedir. Yirmi T\u00fcrk Liras\u0131n\u0131n asgari \u00fccrete oran\u0131 2013 y\u0131l\u0131nda ellibirde biri, 2016 y\u0131l\u0131nda seksen iki de biri, 2020 y\u0131l\u0131nda y\u00fcz k\u0131rk yedide biri, 2023 y\u0131l\u0131nda be\u015fy\u00fcz yetmi\u015fte biri derecesine d\u00fc\u015fm\u00fc\u015ft\u00fcr. Belirtilen para cezas\u0131 miktarlar\u0131n\u0131n Mart 2024 tarihli ve 7499 say\u0131l\u0131 Kanun de\u011fi\u015fikli\u011fine kadar y\u00fcr\u00fcrl\u00fckte oldu\u011funu hat\u0131rlad\u0131\u011f\u0131m\u0131zda s\u00f6z konusu cezalar\u0131n devletin bu su\u00e7 tipleriyle korumay\u0131 ama\u00e7lad\u0131\u011f\u0131 bireysel ve toplumsal yararlar\u0131n korunmas\u0131 bak\u0131m\u0131ndan ne kadar etkili ve cayd\u0131r\u0131c\u0131 oldu\u011fu, daha do\u011frusu a\u00e7\u0131k ve bariz bir \u015fekilde hi\u00e7bir cayd\u0131r\u0131c\u0131l\u0131\u011f\u0131n\u0131n olmad\u0131\u011f\u0131 g\u00f6r\u00fclebilmektedir. S\u00f6z konusu su\u00e7lar uygulamada da \u00f6nemli say\u0131dad\u0131r. \u00d6rne\u011fin 104 su\u00e7 tipinde 2024 y\u0131l\u0131 i\u00e7in incelenen kural\u0131n uygulanmas\u0131 gereken su\u00e7 say\u0131s\u0131n\u0131n (se\u00e7enek veya hapisle birlikte adli para cezas\u0131 \u00f6ng\u00f6r\u00fclen veya hapis cezas\u0131n\u0131n para cezas\u0131na \u00e7evrilmesi gerekti\u011fi i\u00e7in uygulanan \u00f6rnekler ba\u011flam\u0131nda) 319.579 oldu\u011fu g\u00f6r\u00fclmektedir. Bu rakam 2023 y\u0131l\u0131 i\u00e7in 291.614; 2022 y\u0131l\u0131 i\u00e7in 297.315; 2021 y\u0131l\u0131 i\u00e7in 307.318 ve 2020 y\u0131l\u0131 i\u00e7in 207.054\u2019t\u00fcr. S\u00f6z\u00fc edilen rakamlara uzla\u015ft\u0131rma kapsam\u0131ndaki uygulamalar girmemektedir.<\/p>\n<p>6. \u00d6l\u00e7\u00fcl\u00fcl\u00fck denetimi de Anayasa\u2019n\u0131n 13. maddesi uyar\u0131nca anayasal denetim alanlar\u0131ndan biridir. Bununla birlikte yerindeli\u011fe ve takdir alan\u0131na girme riski nedeniyle anayasal denetimde \u00f6l\u00e7\u00fcl\u00fcl\u00fck denetimi yap\u0131lmas\u0131 olduk\u00e7a zordur ve bu nedenle denetim sonucunda iptal karar\u0131 verilmesi de istisnaen tercih edilmesi gereken bir aland\u0131r. Buna kar\u015f\u0131n inceledi\u011fimiz kural\u0131n uyguland\u0131\u011f\u0131 su\u00e7 tipleriyle ilgili de\u011ferlendirmelerden adli para cezas\u0131n\u0131n kanun koyucunun \u00f6n g\u00f6rd\u00fc\u011f\u00fc i\u015flevi g\u00f6rmekten a\u00e7\u0131k\u00e7a uzakla\u015ft\u0131\u011f\u0131n\u0131n g\u00f6r\u00fclmesi kar\u015f\u0131s\u0131nda kural\u0131n iptalinin zorunlu oldu\u011fu de\u011ferlendirilmelidir.<\/p>\n<p>7. Adli para cezas\u0131 ceza hukuku yapt\u0131r\u0131m t\u00fcrlerinden biridir. Kanunda kimi durumda do\u011frudan, kimi durumda hapse se\u00e7enek olarak, kiminde ise k\u0131sa s\u00fcreli (bir y\u0131l\u0131 a\u015fmayan) hapis cezas\u0131n\u0131n adli para cezas\u0131na \u00e7evrilmesi gerekti\u011finde g\u00fcn para cezas\u0131 sistemini d\u00fczenleyen bu kural\u0131n uygulanmas\u0131 gerekmektedir. Adli para cezas\u0131 se\u00e7ene\u011fi somut olay\u0131n \u00f6zelliklerine ve failin durumuna g\u00f6re cezan\u0131n bireyselle\u015ftirilmesinde \u00f6nemli bir fonksiyona sahiptir. Cezan\u0131n bireyselle\u015ftirilmesinden maksat, somut olay adaletinde hem olaya uygun ve \u00f6l\u00e7\u00fcl\u00fc, hem de etkilili\u011fi ve cayd\u0131r\u0131c\u0131l\u0131\u011f\u0131 sa\u011flayacak bir cezan\u0131n belirlenmesi i\u00e7in hakime tan\u0131nan takdir yetkisinin uygulanmas\u0131d\u0131r. Bu a\u00e7\u0131dan incelenen g\u00fcn para cezas\u0131 sistemine ili\u015fkin kural\u0131n \u00f6nemli bir i\u015flevi bulunmaktad\u0131r. Fakat kuralda bir g\u00fcn i\u00e7in \u00f6ng\u00f6r\u00fclen para cezas\u0131 miktarlar\u0131n\u0131n Ceza Kanununun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi 1 Haziran 2005 tarihinden itibaren aradan ge\u00e7en yakla\u015f\u0131k 20 y\u0131ll\u0131k s\u00fcrede paran\u0131n al\u0131m g\u00fcc\u00fcndeki azalmaya ba\u011fl\u0131 olarak a\u00e7\u0131k ve bariz bi\u00e7imde etkisiz, yetersiz ve bireyleri su\u00e7 i\u015flemekten al\u0131koymak i\u00e7in cayd\u0131r\u0131c\u0131 olmaktan uzak bir hale geldi\u011fi g\u00f6r\u00fclmektedir. An\u0131lan maddenin (1) numaral\u0131 f\u0131kras\u0131nda bir kimseyi cinsel ama\u00e7l\u0131 olarak taciz eden ki\u015fi hakk\u0131nda, ma\u011fdurun \u015fik\u00e2yeti \u00fczerine, \u00fc\u00e7 aydan iki y\u0131la kadar hapis cezas\u0131na veya adl\u00ee para cezas\u0131na h\u00fckmolunaca\u011f\u0131 d\u00fczenlenmi\u015ftir Kanun koyucu cinsel taciz su\u00e7unun cinsel sald\u0131r\u0131 ve cinsel istismar su\u00e7lar\u0131na nazaran daha hafif cinsel davran\u0131\u015flar\u0131 i\u00e7ermesi nedeniyle temel cezay\u0131 hapis ve adli para cezas\u0131 \u015feklinde se\u00e7enekli olarak \u00f6ng\u00f6rm\u00fc\u015ft\u00fcr.<\/p>\n<p>2. Anayasa Mahkemesi\u2019nin yerle\u015fmi\u015f hukuk devleti tan\u0131m\u0131na g\u00f6re; Anayasan\u0131n 2. maddesinde yer alan hukuk devleti, eylem ve i\u015flemleri hukuka uygun, insan haklar\u0131na sayg\u0131l\u0131, bu hak ve \u00f6zg\u00fcrl\u00fckleri koruyup g\u00fc\u00e7lendiren, her alanda adaletli bir hukuk d\u00fczeni kurup, bunu geli\u015ftirerek s\u00fcrd\u00fcren, Anayasaya ayk\u0131r\u0131 durum ve tutumlardan ka\u00e7\u0131nan, hukukun \u00fcst\u00fcn kurallar\u0131yla kendini ba\u011fl\u0131 sayan, yarg\u0131 denetimine a\u00e7\u0131k, yasalar\u0131n \u00fcst\u00fcnde yasa koyucunun da uymas\u0131 gereken temel hukuk ilkeleri ve Anayasan\u0131n bulundu\u011fu bilincinde olan devlettir (AYM, E.2001\/406, K.2004\/20, 17\/02\/2004).<\/p>\n<p>3. Anayasa\u2019n\u0131n 5. maddesinde devletin temel ama\u00e7 ve g\u00f6revleri aras\u0131nda ki\u015filerin ve toplumun refah, huzur ve mutlulu\u011funu sa\u011flamak; ki\u015finin temel hak ve h\u00fcrriyetlerini, sosyal hukuk devleti ve adalet ilkeleriyle ba\u011fda\u015fmayacak surette s\u0131n\u0131rlayan siyasal, ekonomik ve sosyal engelleri kald\u0131rmak ve, insan\u0131n madd\u00ee ve manev\u00ee varl\u0131\u011f\u0131n\u0131n geli\u015fmesi i\u00e7in gerekli \u015fartlar\u0131 haz\u0131rlamaya \u00e7al\u0131\u015fmak da say\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>4. Anayasa&#8217;n\u0131n 17. maddesinin birinci f\u0131kras\u0131nda herkesin maddi ve manevi varl\u0131\u011f\u0131n\u0131 koruma ve geli\u015ftirme hakk\u0131na sahip oldu\u011fu belirtilmektedir. Ki\u015finin maddi ve manevi varl\u0131\u011f\u0131n\u0131n korunmas\u0131n\u0131 bir hak olarak \u00f6ng\u00f6ren ve g\u00fcvence alt\u0131na alan Anayasa\u2019n\u0131n s\u00f6z konusu maddesi, devlete pozitif ve negatif y\u00fck\u00fcml\u00fcl\u00fckler getirmektedir. Devletin ki\u015finin maddi ve manevi varl\u0131\u011f\u0131n\u0131n korunmas\u0131 hakk\u0131 kapsam\u0131nda sahip oldu\u011fu pozitif y\u00fck\u00fcml\u00fcl\u00fcklerin usul boyutu bulunmaktad\u0131r.<\/p>\n<p>5. Ceza soru\u015fturmas\u0131 y\u00fcr\u00fct\u00fclmesinin anayasal olarak zorunlu oldu\u011fu ya da kanun koyucunun bir fiili su\u00e7 olarak \u00f6ng\u00f6rd\u00fc\u011f\u00fc h\u00e2llerde usul y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn bir unsuru olarak sorumlulara fiilleriyle orant\u0131l\u0131 cezalar\u0131n verilmesi ve ma\u011fdur a\u00e7\u0131s\u0131ndan da uygun giderimin sa\u011flanmas\u0131 gerekir. \u0130\u015flenen su\u00e7 ile verilen cezalar aras\u0131nda orant\u0131s\u0131zl\u0131k olmas\u0131 ya da su\u00e7 konusu fiile hi\u00e7 ceza verilmemesi durumunda bu t\u00fcr eylemlerin \u00f6nlenmesini sa\u011flayabilecek cayd\u0131r\u0131c\u0131 etkinin ortaya konulmamas\u0131, b\u00f6ylelikle ki\u015filerin fiziksel ve ruhsal b\u00fct\u00fcnl\u00fcklerinin idari ve yasal mevzuat arac\u0131l\u0131\u011f\u0131yla korunmas\u0131 hususundaki pozitif y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn yerine getirilememesi sonucu ortaya \u00e7\u0131kabilir (S.D., B. No: 2013\/3017, 16\/12\/2015, \u00a7 102).<\/p>\n<p>6. \u0130\u015flenen su\u00e7 ile verilen cezalar aras\u0131nda orant\u0131s\u0131zl\u0131k olmas\u0131 bu t\u00fcr eylemlerin \u00f6nlenmesini sa\u011flayabilecek cayd\u0131r\u0131c\u0131 bir etkinin ortaya \u00e7\u0131kmas\u0131na engel olmaktad\u0131r (AYM, E.2022\/120, K.2023\/107, 1\/6\/2023, \u00a7 52). 5237 say\u0131l\u0131 Kanun\u2019un y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten 2\/3\/2024 tarihine kadar, adl\u00ee para cezas\u0131n\u0131n d\u00fczenlendi\u011fi 52. maddedeki alt ve \u00fcst s\u0131n\u0131r miktarlar\u0131nda herhangi bir g\u00fcncelleme yap\u0131lmam\u0131\u015ft\u0131r. Kuralda belirtilen adli para cezas\u0131n\u0131n reel de\u011ferinin bu s\u00fcre zarf\u0131nda reel de\u011ferinin azald\u0131\u011f\u0131n\u0131 dikkate al\u0131rsak, s\u00f6z konusu adl\u00ee para cezas\u0131n\u0131n etkinli\u011fini ve cayd\u0131r\u0131c\u0131l\u0131\u011f\u0131n\u0131 yitirmedi\u011fi s\u00f6ylenemez. Dolay\u0131s\u0131yla, an\u0131lan su\u00e7 i\u00e7in \u00f6ng\u00f6r\u00fclen adli para cezas\u0131n\u0131n g\u00fcn ve parasal de\u011fer itibar\u0131yla miktar\u0131 kanun koyucunun etkili yarg\u0131sal sistem kurma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc kapsam\u0131nda ki\u015finin maddi ve manevi varl\u0131\u011f\u0131n\u0131n cinsel taciz fiillerine kar\u015f\u0131 korunmas\u0131 y\u00f6n\u00fcnden cayd\u0131r\u0131c\u0131 bir etki yaratmaktan uzak oldu\u011fu anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>7.
