Ba\u015fvuru, bir televizyon program\u0131nda Cumhurba\u015fkan\u0131&#8217;na y\u00f6nelik ifadeler dolay\u0131s\u0131yla verilen h\u00fckm\u00fcn a\u00e7\u0131klanmas\u0131n\u0131n geri b\u0131rak\u0131lmas\u0131 karar\u0131n\u0131n ba\u015fvurucunun ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc ihlal etti\u011fi iddias\u0131na ili\u015fkindir.<\/p>\n<p>II. BA\u015eVURU S\u00dcREC\u0130<\/p>\n<p>2. Ba\u015fvuru 19\/12\/2016 tarihinde yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>3. Ba\u015fvuru, ba\u015fvuru formu ve eklerinin idari y\u00f6nden yap\u0131lan \u00f6n incelemesinden sonra Komisyona sunulmu\u015ftur.<\/p>\n<p>4. Komisyonca ba\u015fvurunun kabul edilebilirlik incelemesinin B\u00f6l\u00fcm taraf\u0131ndan yap\u0131lmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>5. B\u00f6l\u00fcm Ba\u015fkan\u0131 taraf\u0131ndan ba\u015fvurunun kabul edilebilirlik ve esas incelemesinin birlikte yap\u0131lmas\u0131na karar verilmi\u015ftir.<\/p>\n<p>6. Ba\u015fvurucu, Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcne kar\u015f\u0131 beyanda bulunmam\u0131\u015ft\u0131r.<\/p>\n<p>III. OLAY VE OLGULAR <\/p>\n<p>8. Ba\u015fvuru formu ve eklerinde ifade edildi\u011fi \u015fekliyle olaylar \u00f6zetle \u015f\u00f6yledir:<\/p>\n<p>9. Ba\u015fvurucu 1964 y\u0131l\u0131nda Samsun&#8217;da do\u011fmu\u015ftur. \u00c7e\u015fitli yaz\u0131l\u0131 ve g\u00f6rsel bas\u0131n kurulu\u015flar\u0131nda y\u00f6neticilik ve gazetecilik faaliyeti y\u00fcr\u00fctt\u00fc\u011f\u00fcn\u00fc belirten ba\u015fvurucu, 1 Kas\u0131m 2015 tarihinde yap\u0131lan Genel Se\u00e7im&#8217;de Cumhuriyet Halk Partisi (CHP) taraf\u0131ndan Samsun&#8217;dan milletvekili aday\u0131 g\u00f6sterilmi\u015ftir.<\/p>\n<p>10. Ba\u015fvurucu 22\/9\/2015 tarihinde ulusal yay\u0131n yapan bir televizyon kanal\u0131na konu\u015fmac\u0131 olarak kat\u0131lm\u0131\u015ft\u0131r. Yay\u0131nda 1 Kas\u0131m 2015 tarihinde yap\u0131lacak olan Genel Se\u00e7im&#8217;in ve se\u00e7im s\u00fcrecinde siyasete Cumhurba\u015fkan\u0131 taraf\u0131ndan yap\u0131lan m\u00fcdahalelerin tart\u0131\u015f\u0131ld\u0131\u011f\u0131n\u0131 belirten ba\u015fvurucu, program devam ederken Cumhurba\u015fkan\u0131&#8217;na y\u00f6nelik olarak &#8220;yani yolsuzluk tapeleri olan, ses kay\u0131tlar\u0131 olan, o\u011fluyla r\u00fc\u015fvet konu\u015fmas\u0131 olan Cumhurba\u015fkanl\u0131\u011f\u0131na aday bile olamaz diye d\u00fc\u015f\u00fcn\u00fclm\u00fc\u015f.&#8221; ifadelerini kullanm\u0131\u015ft\u0131r.<\/p>\n<p>11. Ba\u015fvurucunun yay\u0131n s\u0131ras\u0131nda Cumhurba\u015fkan\u0131&#8217;na y\u00f6nelik olarak sarf etmi\u015f oldu\u011fu ifadelerin (bkz. \u00a7 10) Cumhurba\u015fkan\u0131&#8217;n\u0131 yolsuzluk yapmak ve r\u00fc\u015fvet almakla su\u00e7lar nitelikte oldu\u011fu belirtilerek ba\u015fvurucu aleyhine Cumhurba\u015fkan\u0131&#8217;na hakaret su\u00e7lamas\u0131 ile kamu davas\u0131 a\u00e7\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>12. Kat\u0131lan taraf\u0131ndan 5\/8\/2016 tarihinde \u015fik\u00e2yetten vazge\u00e7me dilek\u00e7esi sunulmu\u015ftur.<\/p>\n<p>13. Yarg\u0131lamay\u0131 yapan Ankara 36. Asliye Ceza Mahkemesi 18\/10\/2016 tarihinde ba\u015fvurucunun Cumhurba\u015fkan\u0131&#8217;na hakaret su\u00e7undan 11 ay 20 g\u00fcn hapis cezas\u0131 ile cezaland\u0131r\u0131lmas\u0131na ve bu h\u00fckm\u00fcn a\u00e7\u0131klanmas\u0131n\u0131n geri b\u0131rak\u0131lmas\u0131na (HAGB) karar vermi\u015ftir. Mahkeme gerek\u00e7eli karar\u0131nda, kat\u0131lan\u0131n \u015fahs\u0131na y\u00f6neltilen ifadelerin (bkz. \u00a7 10) ele\u015ftiri s\u0131n\u0131rlar\u0131 kapsam\u0131nda de\u011ferlendirilemeyece\u011fini belirterek ba\u015fvurucunun ifadelerinin Cumhurba\u015fkan\u0131&#8217;na hakaret su\u00e7unu olu\u015fturdu\u011funu belirtmi\u015ftir.<\/p>\n<p>14. Ba\u015fvurucunun bu karara itiraz\u0131 Ankara 11. A\u011f\u0131r Ceza Mahkemesince 9\/11\/2016 tarihinde reddedilmi\u015f ve ret karar\u0131 ba\u015fvurucuya 24\/11\/2016 tarihinde tebli\u011f edilmi\u015ftir.<\/p>\n<p>15. Ba\u015fvurucu 19\/12\/2016 tarihinde bireysel ba\u015fvuruda bulunmu\u015ftur.<\/p>\n<p>IV. \u0130LG\u0130L\u0130 HUKUK<\/p>\n<p>A. Ulusal Hukuk<\/p>\n<p>16. 26\/9\/2004 tarihli ve 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu&#8217;nun &#8220;Cumhurba\u015fkan\u0131na hakaret&#8221; kenar ba\u015fl\u0131kl\u0131 299. maddesinin (1) numaral\u0131 f\u0131kras\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;(1) Cumhurba\u015fkan\u0131na hakaret eden ki\u015fi, bir y\u0131ldan d\u00f6rt y\u0131la kadar hapis cezas\u0131 ile cezaland\u0131r\u0131l\u0131r.&#8221;<\/p>\n<p>B. Uluslararas\u0131 Hukuk<\/p>\n<p>17. \u0130lgili uluslararas\u0131 hukuk kaynaklar\u0131n\u0131n derli toplu verildi\u011fi bir karar i\u00e7in bkz. Kemal K\u0131l\u0131\u00e7daro\u011flu, B. No: 2014\/1577, 25\/10\/2017, \u00a7\u00a7 29-35.<\/p>\n<p>V. \u0130NCELEME VE GEREK\u00c7E<\/p>\n<p>18. Mahkemenin 26\/5\/2021 tarihinde yapm\u0131\u015f oldu\u011fu toplant\u0131da ba\u015fvuru incelenip gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n<p>A. Ba\u015fvurucunun \u0130ddialar\u0131 ve Bakanl\u0131k G\u00f6r\u00fc\u015f\u00fc<\/p>\n<p>19. Ba\u015fvurucu; bas\u0131n mensubu oldu\u011funu, kulland\u0131\u011f\u0131 ifadelerin \u015fiddet s\u00f6ylemi i\u00e7ermedi\u011fini belirtmektedir. Ba\u015fvurucu; bir milletvekili aday\u0131 olarak Cumhurba\u015fkan\u0131&#8217;n\u0131 ele\u015ftirmesinin son derece do\u011fal oldu\u011funu, kullanm\u0131\u015f oldu\u011fu ifadelerin Cumhurba\u015fkan\u0131 ile o\u011flu aras\u0131nda ger\u00e7ekle\u015fti\u011fi ileri s\u00fcr\u00fclen ve kamuoyu taraf\u0131ndan eri\u015filebilir kay\u0131tlara dayand\u0131\u011f\u0131n\u0131 ifade etmi\u015ftir. Ba\u015fvurucuya g\u00f6re siyaset\u00e7ilerin ele\u015ftiriye katlanma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc di\u011fer vatanda\u015flara g\u00f6re daha fazlad\u0131r ve bu sebeple Cumhurba\u015fkan\u0131&#8217;na ayr\u0131cal\u0131kl\u0131 bir koruma sa\u011flayan 5237 say\u0131l\u0131 Kanun&#8217;un 299. maddesinin Avrupa \u0130nsan Haklar\u0131 Mahkemesinin yerle\u015fik i\u00e7tihatlar\u0131yla uyumlu de\u011fildir. \u0130lk derece mahkemesinin karar\u0131nda Anayasa&#8217;da ifade ve bas\u0131n \u00f6zg\u00fcrl\u00fckleri i\u00e7in \u00f6ng\u00f6r\u00fclen s\u0131n\u0131rlama sebeplerine yer verilmedi\u011fini belirten ba\u015fvurucu ayr\u0131ca ilk derece mahkemesi taraf\u0131ndan gerek\u00e7eli karar\u0131n kendisine tebli\u011f edilmedi\u011fini, itiraz ba\u015fvurusunu gerek\u00e7eli karar\u0131 g\u00f6rmeksizin yapt\u0131\u011f\u0131n\u0131, bu sebeplerle etkili ba\u015fvuruda bulunma hakk\u0131 ile ifade ve bas\u0131n \u00f6zg\u00fcrl\u00fcklerinin ihlal edildi\u011fini ileri s\u00fcrm\u00fc\u015ft\u00fcr.<\/p>\n<p>20. Bakanl\u0131k g\u00f6r\u00fc\u015f\u00fcnde; ba\u015fvurucunun ifadelerinin ele\u015ftiri s\u0131n\u0131rlar\u0131n\u0131 a\u015farak ki\u015fisel sald\u0131r\u0131 niteli\u011fine ula\u015ft\u0131\u011f\u0131, de\u011fer yarg\u0131s\u0131 niteli\u011finde olan ilgili ifadelerin olgusal temelden yoksun oldu\u011fu, bas\u0131n\u0131n \u00f6zg\u00fcr olmas\u0131 gerekti\u011fi kadar sorumluluk bilinciyle de hareket etmesi gerekti\u011fi, ifadelerin kamusal yarar\u0131 ilgilendirmedi\u011fi ve ki\u015fisel haklara sald\u0131r\u0131 boyutuna ula\u015ft\u0131\u011f\u0131, ba\u015fvurucu hakk\u0131nda verilen HAGB h\u00fckm\u00fc nazara al\u0131narak verilen cezan\u0131n orant\u0131l\u0131 oldu\u011fu belirtilmektedir.<\/p>\n<p>B. De\u011ferlendirme<\/p>\n<p>21. Anayasa Mahkemesi, olaylar\u0131n ba\u015fvurucu taraf\u0131ndan yap\u0131lan hukuki nitelendirmesi ile ba\u011fl\u0131 olmay\u0131p olay ve olgular\u0131n hukuki tavsifini kendisi takdir eder (Tahir Canan, B. No: 2012\/969, 18\/9\/2013, \u00a7 16). Ba\u015fvurucu her ne kadar gerek\u00e7eli karar\u0131n kendisine tebli\u011f edilmedi\u011fi, bu sebeple etkili bir itiraz ba\u015fvurusu yapamad\u0131\u011f\u0131n\u0131 belirtilmi\u015f ise de ba\u015fvurucunun as\u0131l \u015fik\u00e2yetinin kat\u0131lana kar\u015f\u0131 kulland\u0131\u011f\u0131 ifadeler nedeniyle cezaland\u0131r\u0131lmas\u0131 oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Bu sebeple ba\u015fvurucunun \u015fik\u00e2yetlerinin bir b\u00fct\u00fcn olarak Anayasa&#8217;n\u0131n 26. maddesi kapsam\u0131nda incelenmesi gerekti\u011fi de\u011ferlendirilmi\u015ftir.<\/p>\n<p>22. Anayasa\u2019n\u0131n iddian\u0131n de\u011ferlendirilmesinde dayanak al\u0131nacak \u201cD\u00fc\u015f\u00fcnceyi a\u00e7\u0131klama ve yayma h\u00fcrriyeti\u201d kenar ba\u015fl\u0131kl\u0131 26. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>\u00a0\u201cHerkes, d\u00fc\u015f\u00fcnce ve kanaatlerini s\u00f6z, yaz\u0131, resim veya ba\u015fka yollarla tek ba\u015f\u0131na veya toplu olarak a\u00e7\u0131klama ve yayma hakk\u0131na sahiptir. Bu h\u00fcrriyet resmi makamlar\u0131n m\u00fcdahalesi olmaks\u0131z\u0131n haber veya fikir almak ya da vermek serbestli\u011fini de kapsar&#8230;<\/p>\n<p>Bu h\u00fcrriyetlerin kullan\u0131lmas\u0131,&#8230; ba\u015fkalar\u0131n\u0131n \u015f\u00f6hret veya haklar\u0131n\u0131n,&#8230; korunmas\u0131 &#8230; ama\u00e7lar\u0131yla s\u0131n\u0131rlanabilir\u2026<\/p>\n<p>D\u00fc\u015f\u00fcnceyi a\u00e7\u0131klama ve yayma h\u00fcrriyetinin kullan\u0131lmas\u0131nda uygulanacak \u015fekil, \u015fart ve usuller kanunla d\u00fczenlenir.\u201d<\/p>\n<p>1. Kabul Edilebilirlik Y\u00f6n\u00fcnden<\/p>\n<p>23. A\u00e7\u0131k\u00e7a dayanaktan yoksun olmad\u0131\u011f\u0131 ve kabul edilemezli\u011fine karar verilmesini gerektirecek ba\u015fka bir neden de bulunmad\u0131\u011f\u0131 anla\u015f\u0131lan ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlal edildi\u011fine ili\u015fkin iddian\u0131n kabul edilebilir oldu\u011funa karar verilmesi gerekir.<\/p>\n<p>Selahaddin MENTE\u015e bu g\u00f6r\u00fc\u015fe kat\u0131lmam\u0131\u015ft\u0131r.<\/p>\n<p>2. Esas Y\u00f6n\u00fcnden<\/p>\n<p>a. M\u00fcdahalenin Varl\u0131\u011f\u0131<\/p>\n<p>24. Ba\u015fvurucu, Cumhurba\u015fkan\u0131&#8217;na y\u00f6nelik ifadeleri nedeniyle Cumhurba\u015fkan\u0131&#8217;na hakaret su\u00e7undan 11 ay 20 g\u00fcn hapis cezas\u0131 ile cezaland\u0131r\u0131lm\u0131\u015f ve ilk derece mahkemesince HAGB&#8217;ye karar verilmi\u015ftir. Dolay\u0131s\u0131yla s\u00f6z konusu mahkeme karar\u0131 ile ba\u015fvurucunun ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne y\u00f6nelik bir m\u00fcdahalede bulunulmu\u015ftur.<\/p>\n<p>b. M\u00fcdahalenin \u0130hlal Olu\u015fturup Olu\u015fturmad\u0131\u011f\u0131<\/p>\n<p>25. Yukar\u0131da an\u0131lan m\u00fcdahale Anayasa\u2019n\u0131n 13. maddesinde belirtilen ko\u015fullar\u0131 yerine getirmedi\u011fi m\u00fcddet\u00e7e Anayasa\u2019n\u0131n 26. maddesinin ihlalini te\u015fkil edecektir. Anayasa\u2019n\u0131n 13. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>&#8220;Temel hak ve h\u00fcrriyetler, &#8230; yaln\u0131zca Anayasan\u0131n ilgili maddelerinde belirtilen sebeplere ba\u011fl\u0131 olarak ve ancak kanunla s\u0131n\u0131rlanabilir. Bu s\u0131n\u0131rlamalar, &#8230; demokratik toplum d\u00fczeninin &#8230; gereklerine ve \u00f6l\u00e7\u00fcl\u00fcl\u00fck ilkesine ayk\u0131r\u0131 olamaz.\u201d<\/p>\n<p>26. Bu m\u00fcdahalenin Anayasa\u2019n\u0131n 13. maddesinde \u00f6ng\u00f6r\u00fclen ve somut ba\u015fvuruya uygun d\u00fc\u015fen, kanun taraf\u0131ndan \u00f6ng\u00f6r\u00fclme, Anayasa\u2019n\u0131n ilgili maddesinde belirtilen nedenlere dayanma ve demokratik toplum d\u00fczeninin gereklerine uygunluk ko\u015fullar\u0131n\u0131 sa\u011flay\u0131p sa\u011flamad\u0131\u011f\u0131n\u0131n belirlenmesi gerekir.<\/p>\n<p>i. Kanunilik<\/p>\n<p>27. 5237 say\u0131l\u0131 Kanun&#8217;un 299. maddesinin kanunla s\u0131n\u0131rlama \u00f6l\u00e7\u00fct\u00fcn\u00fc kar\u015f\u0131lad\u0131\u011f\u0131 sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>ii. Me\u015fru Ama\u00e7<\/p>\n<p>28. Ba\u015fvurucunun cezaland\u0131r\u0131lmas\u0131na ili\u015fkin karar\u0131n ba\u015fkalar\u0131n\u0131n \u015f\u00f6hret veya haklar\u0131n\u0131n korunmas\u0131na y\u00f6nelik \u00f6nlemlerin bir par\u00e7as\u0131 oldu\u011fu ve me\u015fru bir ama\u00e7 ta\u015f\u0131d\u0131\u011f\u0131 sonucuna var\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>iii. Demokratik Toplum D\u00fczeninin Gereklerine Uygunluk<\/p>\n<p>\u00a0(1) M\u00fcdahalenin Demokratik Toplum D\u00fczeninin Gereklerine Uygun Olmas\u0131<\/p>\n<p>29. \u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne y\u00f6nelik bir m\u00fcdahalenin demokratik toplum d\u00fczeninin gereklerine uygun kabul edilebilmesi i\u00e7in zorunlu bir toplumsal ihtiyac\u0131 kar\u015f\u0131lamas\u0131 ve orant\u0131l\u0131 bir m\u00fcdahale olmas\u0131 gerekir (Bekir Co\u015fkun [GK], B. No: 2014\/12151, 4\/6\/2015, \u00a7\u00a7 53-55; Mehmet Ali Ayd\u0131n [GK], B. No: 2013\/9343, 4\/6\/2015, \u00a7\u00a7 70-72; AYM, E.2007\/4, K.2007\/81, 18\/10\/2007).<\/p>\n<p>30. M\u00fcdahaleyi olu\u015fturan tedbirin zorunlu bir toplumsal ihtiyac\u0131 kar\u015f\u0131lad\u0131\u011f\u0131n\u0131n kabul edilebilmesi i\u00e7in amaca ula\u015fmaya elveri\u015fli olmas\u0131, ba\u015fvurulabilecek en son \u00e7are ve al\u0131nabilecek en hafif \u00f6nlem olarak kendisini g\u00f6stermesi gerekmektedir (Z\u00fcbeyde F\u00fcsun \u00dcstel ve di\u011ferleri [GK], B. No: 2018\/17635, 26\/7\/2019, \u00a7 77; S\u0131rr\u0131 S\u00fcreyya \u00d6nder [GK], B. No: 2018\/38143, 3\/10\/2019, \u00a7 58; ayr\u0131ca baz\u0131 farkl\u0131l\u0131klarla birlikte bkz. Anayasa\u2019n\u0131n 26. maddesinin ikinci f\u0131kras\u0131na g\u00f6re ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn s\u0131n\u0131rland\u0131r\u0131lma nedenlerinden ve bu ba\u011flamda ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc kullananlar\u0131n uymas\u0131 gereken g\u00f6rev ve sorumluluklardan biri de ba\u015fkalar\u0131n\u0131n \u015f\u00f6hret veya haklar\u0131n\u0131n korunmas\u0131d\u0131r. Bireyin \u015feref ve itibar\u0131, ki\u015fisel kimli\u011finin ve manevi b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fcn bir par\u00e7as\u0131n\u0131 olu\u015fturur ve Anayasa\u2019n\u0131n 17. maddesinin birinci f\u0131kras\u0131n\u0131n korumas\u0131ndan faydalan\u0131r (\u0130lhan Cihaner (2), B. No: 2013\/5574, 30\/6\/2014, \u00a7 44) Devlet, bireyin \u015feref ve itibar\u0131na keyf\u00ee olarak m\u00fcdahale etmemek ve \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin sald\u0131r\u0131lar\u0131n\u0131 \u00f6nlemekle y\u00fck\u00fcml\u00fcd\u00fcr (Nilg\u00fcn Halloran, B. No: 2014\/6009, 15\/2\/2017, \u00a7 44).<\/p>\n<p>32. Bir siyaset\u00e7i olan Cumhurba\u015fkan\u0131 di\u011fer ki\u015filere nazaran ele\u015ftirilere daha fazla katlanmak durumundad\u0131r. Bununla birlikte ele\u015ftirilerin onun \u015feref ve itibar\u0131n\u0131 zedeleyecek boyuta ula\u015fmamas\u0131 gerekir. Cumhurba\u015fkan\u0131&#8217;n\u0131n ele\u015ftirilere daha ho\u015fg\u00f6r\u00fcl\u00fc olmak zorunda olmas\u0131, onun \u015f\u00f6hret veya haklar\u0131n\u0131n korunmayaca\u011f\u0131 anlam\u0131na gelmez. \u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fc, ki\u015filere hakaret etme hakk\u0131 vermez zira hakaret eyleminde ba\u015fkalar\u0131n\u0131n \u015f\u00f6hret veya itibarlar\u0131na sald\u0131r\u0131 s\u00f6z konusudur. B\u00f6yle bir durum da hi\u00e7bir hukuk d\u00fczeni taraf\u0131ndan korunmaz (Umut K\u0131l\u0131\u00e7, B. No: 2015\/16643, 4\/4\/2018, \u00a7 29).<\/p>\n<p>33. Cumhurba\u015fkan\u0131; Anayasa\u2019da belirtilen usullerle halk taraf\u0131ndan se\u00e7ilen, devleti ve milletin birli\u011fini temsil eden ki\u015fidir. Cumhurba\u015fkan\u0131&#8217;n\u0131n devletin ba\u015f\u0131 s\u0131fat\u0131yla T\u00fcrkiye Cumhuriyeti&#8217;ni ve T\u00fcrk milletinin birli\u011fini temsil etmesi, Anayasa\u2019da belirtilen g\u00f6rev ve yetkileri ile temsil etti\u011fi de\u011ferler g\u00f6z\u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda Cumhurba\u015fkan\u0131&#8217;na kar\u015f\u0131 ger\u00e7ekle\u015ftirilen hakaret su\u00e7unun sadece kendi ki\u015fili\u011fine kar\u015f\u0131 i\u015flenmi\u015f oldu\u011fu de\u011fil Cumhurba\u015fkan\u0131&#8217;n\u0131n temsil etti\u011fi de\u011fer ve fonksiyonlar\u0131 da ihlal etmi\u015f olaca\u011f\u0131 kabul edilmektedir. Bu nedenle kanun koyucu, belirtilen hususlar\u0131 g\u00f6z\u00f6n\u00fcne alarak onun ki\u015fili\u011fine y\u00f6neltilen eylemin ayn\u0131 zamanda devlete kar\u015f\u0131 ger\u00e7ekle\u015ftirilen su\u00e7lardan say\u0131lmas\u0131 gerekti\u011finden hareketle Cumhurba\u015fkan\u0131&#8217;n\u0131n ki\u015fili\u011fine kar\u015f\u0131 i\u015flenmi\u015f olsa da bu su\u00e7u kamu g\u00f6revlilerine hakaret su\u00e7undan ay\u0131rarak ayr\u0131 bir su\u00e7 olarak d\u00fczenlemi\u015f ve bu su\u00e7a kamu g\u00f6revlilerine hakaret su\u00e7u i\u00e7in \u00f6ng\u00f6r\u00fclen cezaya k\u0131yasla daha a\u011f\u0131r bir ceza verilebilmesine olanak sa\u011flayan h\u00fck\u00fcmler ihdas etmi\u015ftir. Kanun koyucunun bu tercihi, su\u00e7 olarak tan\u0131mlanan fiillerin hangi t\u00fcr ve \u00f6l\u00e7\u00fcdeki ceza yapt\u0131r\u0131mlar\u0131na tabi tutulaca\u011f\u0131n\u0131n belirlenmesindeki takdir yetkisinin kapsam\u0131ndad\u0131r (Umut K\u0131l\u0131\u00e7, \u00a7 30).<\/p>\n<p>\u00a0(3) Somut Olay\u0131n De\u011ferlendirilmesi <\/p>\n<p>34. Bas\u0131n mensubu ve CHP Samsun milletvekili aday\u0131 olan ba\u015fvurucu -1 Kas\u0131m 2015 tarihinde yap\u0131lacak olan- Genel Se\u00e7im \u00f6ncesinde, ulusal yay\u0131n yapan bir televizyon kanal\u0131nda yay\u0131mlanan a\u00e7\u0131k oturuma konu\u015fmac\u0131 olarak kat\u0131lm\u0131\u015ft\u0131r. Cumhurba\u015fkan\u0131&#8217;n\u0131n tarafs\u0131zl\u0131\u011f\u0131 ve dokunulmazl\u0131\u011f\u0131 konusunun ele al\u0131nd\u0131\u011f\u0131 bu programda ba\u015fvurucu, genel se\u00e7imler \u00f6ncesinde Cumhurba\u015fkan\u0131&#8217;n\u0131n Adalet ve Kalk\u0131nma Partisi lehine miting d\u00fczenlemesini ele\u015ftirdi\u011fi esnada ba\u015fvuruya konu ifadeleri (bkz. \u00a7 10) kullanm\u0131\u015ft\u0131r.<\/p>\n<p>35. Anayasa Mahkemesi \u00f6n\u00fcndeki mesele somut olay\u0131n ko\u015fullar\u0131nda, ba\u015fvurucunun kullanm\u0131\u015f oldu\u011fu ifadeler (bkz. \u00a7 10) sebebi ile Cumhurba\u015fkan\u0131&#8217;na hakaret su\u00e7undan mahk\u00fbmiyetinin zorunlu bir toplumsal ihtiyaca kar\u015f\u0131l\u0131k gelip gelmedi\u011fi ve ger\u00e7ekle\u015fmesi ama\u00e7lanan me\u015fru ama\u00e7la orant\u0131l\u0131 olup olmad\u0131\u011f\u0131d\u0131r. \u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne yap\u0131lan bir m\u00fcdahalenin demokratik toplum d\u00fczeninin gereklerine uygun kabul edilebilmesi i\u00e7in ba\u015fvurucunun ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc ile m\u00fc\u015ftekinin itibar\u0131n\u0131n korunmas\u0131 hakk\u0131 aras\u0131nda adil bir denge sa\u011flamal\u0131d\u0131r.<\/p>\n<p>36. Derece mahkemeleri s\u00f6z konusu dengelemeyi yaparken ve ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne yap\u0131lan m\u00fcdahalenin zorunlu bir toplumsal ihtiyac\u0131 kar\u015f\u0131lay\u0131p kar\u015f\u0131lamad\u0131\u011f\u0131n\u0131 de\u011ferlendirirken belirli bir takdir yetkisine sahiptir. Ancak bu takdir pay\u0131, Anayasa Mahkemesinin denetimindedir (Kemal K\u0131l\u0131\u00e7daro\u011flu, \u00a7 57).<\/p>\n<p>37. \u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne y\u00f6nelik yap\u0131lan ba\u015fvuruya konu m\u00fcdahale mahkeme karar\u0131ndan kaynakland\u0131\u011f\u0131 i\u00e7in \u00e7at\u0131\u015fan haklar aras\u0131nda yap\u0131lacak dengelemenin gerek\u00e7eli kararlarda yap\u0131lmas\u0131 beklenmektedir (benzer y\u00f6nde bkz. Bekir Co\u015fkun, \u00a7\u00a7 44, 47). Bu sebeple an\u0131lan denetim s\u0131ras\u0131nda Anayasa Mahkemesi temel hak ve \u00f6zg\u00fcrl\u00fcklere yap\u0131lan m\u00fcdahalenin gerek\u00e7esine odaklan\u0131r. Kamu makamlar\u0131n\u0131n temel hak ve \u00f6zg\u00fcrl\u00fcklere ilgili ve yeterli bir gerek\u00e7e ortaya koymadan yapt\u0131klar\u0131 m\u00fcdahalelerin demokratik toplum d\u00fczeninin gereklerine uygun olarak kabul edilebilmesi m\u00fcmk\u00fcn de\u011fildir. Dolay\u0131s\u0131yla ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne gerek\u00e7esiz olarak veya Anayasa Mahkemesince ortaya konulan kriterleri kar\u015f\u0131lamayan bir gerek\u00e7e ile yap\u0131lan m\u00fcdahaleler Anayasa&#8217;n\u0131n 26. maddesini ihlal edecektir (di\u011ferleri aras\u0131ndan bkz. Kamuyu bilgilendirme de\u011feri, toplumsal ilginin varl\u0131\u011f\u0131 ve konunun g\u00fcncel olup olmad\u0131\u011f\u0131,<\/p>\n<p>vi. M\u00fc\u015ftekinin kendisine y\u00f6neltilen ifadelere cevap verme olana\u011f\u0131n\u0131n bulunup bulunamad\u0131\u011f\u0131,<\/p>\n<p>vii. \u0130fadelerin hedef al\u0131nan ki\u015finin hayat\u0131 \u00fczerindeki etkisi,<\/p>\n<p>ix. Ba\u015fvurucunun yapt\u0131r\u0131ma maruz kalma endi\u015fesinin ba\u015fvurucu \u00fczerinde cayd\u0131r\u0131c\u0131 etki yarat\u0131p yaratmayaca\u011f\u0131 \u015feklinde s\u0131ralanabilir (Nilg\u00fcn Halloran, \u00a7 41; Erg\u00fcn Poyraz (2) [GK], B. No: 2013\/8503, 27\/10\/2015, \u00a7 56; Kadir Sa\u011fd\u0131\u00e7 [GK], B. Bu ehemmiyet maddi olgular\u0131n ispatlanabilmesine ancak de\u011fer yarg\u0131lar\u0131n\u0131n do\u011frulanmas\u0131n\u0131n m\u00fcmk\u00fcn olmamas\u0131na dayanmaktad\u0131r (benzer y\u00f6nde bkz. \u0130lhan Cihaner (2), \u00a7 64). Somut olayda ba\u015fvurucu, ifadelerinin bir de\u011fer yarg\u0131s\u0131na kar\u015f\u0131l\u0131k geldi\u011fini ve yeterli bir olgusal temelinin mevcut oldu\u011funu ileri s\u00fcrm\u00fc\u015ft\u00fcr.<\/p>\n<p>40. Ba\u015fvurucunun ifadeleri FET\u00d6\/PDY ter\u00f6r \u00f6rg\u00fct\u00fc taraf\u0131ndan ger\u00e7ekle\u015ftirildi\u011fi anla\u015f\u0131lan 17-25 Aral\u0131k soru\u015fturmalar\u0131n\u0131n (an\u0131lan soru\u015fturmalara ili\u015fkin bilgiler i\u00e7in bkz. Ayd\u0131n Yavuz ve di\u011ferleri [GK], B. No: 2016\/22169, 20\/6\/2017, \u00a7 30) konusunu te\u015fkil eden kay\u0131tlara dayanmaktad\u0131r. Ba\u015fvurucu s\u00f6z konusu kay\u0131tlar\u0131n kamuya mal oldu\u011funu ve herkes taraf\u0131ndan ula\u015f\u0131labildi\u011fini ifade ederek ifadelere ili\u015fkin olgusal temel a\u00e7\u0131klamas\u0131nda bulunmaktad\u0131r.<\/p>\n<p>41. \u0130lk derece mahkemesi ise gerek\u00e7eli karar\u0131nda ifadelerin siyasi ele\u015ftiri s\u0131n\u0131rlar\u0131n\u0131 a\u015ft\u0131\u011f\u0131n\u0131 belirtmi\u015f ancak maddi olgu mu yoksa de\u011fer yarg\u0131s\u0131 m\u0131 olu\u015fturdu\u011fu y\u00f6n\u00fcnde hi\u00e7bir de\u011ferlendirmede bulunmam\u0131\u015ft\u0131r. Ba\u015fvurucu taraf\u0131ndan y\u00f6neltilen \u015fik\u00e2yet konusu s\u00f6zlerin de\u011fer yarg\u0131s\u0131 niteli\u011finde oldu\u011fu de\u011ferlendirilmektedir. Nitekim ilgili ses kay\u0131tlar\u0131na ili\u015fkin tart\u0131\u015fma ba\u015fvurucunun a\u00e7\u0131klamalar\u0131 \u00f6ncesinde yo\u011fun bir \u015fekilde ba\u015flam\u0131\u015f ve bu husus kamuya mal olmu\u015ftur. O nedenle de\u011fer yarg\u0131s\u0131 olu\u015fturdu\u011fu d\u00fc\u015f\u00fcn\u00fclen ilgili ifadeler y\u00f6n\u00fcnden somut olay\u0131n ko\u015fullar\u0131nda bir olgusal temelin varl\u0131\u011f\u0131 kabul edilebilir (bkz benzer y\u00f6nde bir de\u011ferlendirme i\u00e7in: Kemal K\u0131l\u0131\u00e7daro\u011flu ve Cumhuriyet Halk Partisi, B. No: 2014\/12482, 8\/5\/2019, \u00a7\u00a7 44- 45).<\/p>\n<p>42. Ele al\u0131nmas\u0131 gereken bir di\u011fer kriter ise ifadelerin dile getirildi\u011fi atmosferdir. \u0130fadeler, T\u00fcrkiye&#8217;nin se\u00e7im iklimine girdi\u011fi bir s\u00fcre\u00e7te sarf edilmi\u015f olup se\u00e7im s\u00fcre\u00e7lerinde se\u00e7menlerini etkilemek isteyen siyaset\u00e7iler, kendilerine y\u00f6neltilen ifadelere cevap verme olana\u011f\u0131 bulunan rakiplerine kar\u015f\u0131 s\u00f6ylemlerini sertle\u015ftirebilmektedir. Oysa ifadelerin bir milletvekili aday\u0131nca siyasi rakibi olan bir partinin genel ba\u015fkan\u0131 iken s\u00f6z konusu partinin aday\u0131 olarak Cumhurba\u015fkan\u0131 se\u00e7ilen ve siyasi kariyerine Cumhurba\u015fkan\u0131 olarak devam eden bir siyaset\u00e7iye se\u00e7im ortam\u0131nda y\u00f6neltilmi\u015f oldu\u011fu hususunun da derece mahkemelerinin kararlar\u0131nda dikkate al\u0131nmad\u0131\u011f\u0131 g\u00f6r\u00fclmektedir.<\/p>\n<p>43. T\u00fcm bu hususlara ek olarak Anayasa Mahkemesi; siyaset\u00e7ilerin, kamuoyunca tan\u0131nan ki\u015filerin ve kamusal yetki kullanan g\u00f6revlilerin g\u00f6rd\u00fckleri i\u015flev nedeniyle daha fazla ele\u015ftiriye katlanmak durumunda olduklar\u0131n\u0131 ve bunlara y\u00f6nelik ele\u015ftirinin s\u0131n\u0131rlar\u0131n\u0131n \u00e7ok daha geni\u015f oldu\u011funu her zaman vurgulam\u0131\u015ft\u0131r (siyaset\u00e7ilerle ilgili olarak bkz. Erg\u00fcn Poyraz (2), \u00a7 58; kamusal yetki kullanan g\u00f6revlilerle ilgili olarak bkz. Nilg\u00fcn Halloran, \u00a7 45; tan\u0131nan bir Cumhuriyet ba\u015fsavc\u0131s\u0131 ile ilgili olarak bkz. \u0130lhan Cihaner (2), \u00a7 82; tan\u0131nan ve siyasete haz\u0131rlanan bir kamu g\u00f6revlisi ile ilgili olarak bkz. \u00d6nder Bal\u0131k\u00e7\u0131, \u00a7 42). Somut olayda ba\u015fvurucunun ifadelerinin muhatab\u0131n\u0131n bir siyaset\u00e7i oldu\u011fu hususunun da de\u011ferlendirmeye konu edilmedi\u011fi a\u00e7\u0131kt\u0131r.<\/p>\n<p>44. Son olarak rahats\u0131z edici de olsa siyaset\u00e7ilere, kamuoyunca tan\u0131nan ki\u015filere ve kamusal yetki kullanan g\u00f6revlilere ili\u015fkin yap\u0131lan ele\u015ftirilerin cezaland\u0131r\u0131lmas\u0131 cayd\u0131r\u0131c\u0131 etki do\u011furarak toplumdaki ve kamuoyundaki farkl\u0131 seslerin susturulmas\u0131na yol a\u00e7abilir. Cezaland\u0131r\u0131lma korkusu, \u00e7o\u011fulcu toplumun s\u00fcrd\u00fcr\u00fclebilmesine engel olabilir (benzer y\u00f6ndeki de\u011ferlendirmeler i\u00e7in bkz. Erg\u00fcn Poyraz (2), \u00a7 79). Bu nedenle ba\u015fvuruya konu olaylar\u0131n ge\u00e7ti\u011fi d\u00f6nemde ve h\u00e2len Cumhurba\u015fkan\u0131 olan m\u00fc\u015ftekiye y\u00f6nelik s\u00f6zler s\u00f6yleyen ba\u015fvurucunun hapis cezas\u0131 ile cezaland\u0131r\u0131lmas\u0131na karar verilmesi, bilgilendirme ve ele\u015ftiride bulunabilme ortam\u0131n\u0131n bir sonucu olan \u00e7o\u011fulcu topluma zarar verebilir.<\/p>\n<p>45. Yukar\u0131daki bilgiler dikkate al\u0131nd\u0131\u011f\u0131nda ilk derece mahkemesinin ba\u015fvurucunun mahk\u00fbmiyetinin zorunlu toplumsal bir ihtiyaca kar\u015f\u0131l\u0131k geldi\u011fini ilgili ve yeterli bir gerek\u00e7e ile ortaya koydu\u011funun kabul edilmesi m\u00fcmk\u00fcn olmam\u0131\u015ft\u0131r.<\/p>\n<p>46. Ba\u015fvurucunun ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne yap\u0131lan m\u00fcdahalenin demokratik toplum d\u00fczeninin gereklerine uygun olmad\u0131\u011f\u0131 sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r. Maddesi Y\u00f6n\u00fcnden<\/p>\n<p>47. 30\/3\/2011 tarihli ve 6216 say\u0131l\u0131 Anayasa Mahkemesinin Kurulu\u015fu ve Yarg\u0131lama Usulleri Hakk\u0131nda Kanun&#8217;un 50. maddesinin ilgili k\u0131sm\u0131 \u015f\u00f6yledir:<\/p>\n<p>\u00a0\u201c(1) Esas inceleme sonunda, ba\u015fvurucunun hakk\u0131n\u0131n ihlal edildi\u011fine ya da edilmedi\u011fine karar verilir. \u0130hlal karar\u0131 verilmesi h\u00e2linde ihlalin ve sonu\u00e7lar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131 i\u00e7in yap\u0131lmas\u0131 gerekenlere h\u00fckmedilir\u2026<\/p>\n<p>\u00a0(2) Tespit edilen ihlal bir mahkeme karar\u0131ndan kaynaklanm\u0131\u015fsa, ihlali ve sonu\u00e7lar\u0131n\u0131 ortadan kald\u0131rmak i\u00e7in yeniden yarg\u0131lama yapmak \u00fczere dosya ilgili mahkemeye g\u00f6nderilir. Yeniden yarg\u0131lama yap\u0131lmas\u0131nda hukuki yarar bulunmayan h\u00e2llerde ba\u015fvurucu lehine tazminata h\u00fckmedilebilir veya genel mahkemelerde dava a\u00e7\u0131lmas\u0131 yolu g\u00f6sterilebilir. Yeniden yarg\u0131lama yapmakla y\u00fck\u00fcml\u00fc mahkeme, Anayasa Mahkemesinin ihlal karar\u0131nda a\u00e7\u0131klad\u0131\u011f\u0131 ihlali ve sonu\u00e7lar\u0131n\u0131 ortadan kald\u0131racak \u015fekilde m\u00fcmk\u00fcnse dosya \u00fczerinden karar verir.\u201d<\/p>\n<p>48. Ba\u015fvurucu ihlalin tespit edilmesini istemi\u015f ve yeniden yarg\u0131lama talebinde bulunmu\u015ftur.<\/p>\n<p>49. Anayasa Mahkemesinin Mehmet Do\u011fan ([GK], B. No: 2014\/8875, 7\/6\/2018) karar\u0131nda ihlal sonucuna var\u0131ld\u0131\u011f\u0131nda ihlalin nas\u0131l ortadan kald\u0131r\u0131laca\u011f\u0131 hususunda genel ilkeler belirlenmi\u015ftir. Anayasa Mahkemesi di\u011fer bir karar\u0131nda ise bu ilkelerle birlikte ihlal karar\u0131n\u0131n yerine getirilmemesinin sonu\u00e7lar\u0131na da de\u011finmi\u015f ve bu durumun ihlalin devam\u0131 anlam\u0131na gelece\u011fi gibi ilgili hakk\u0131n ikinci kez ihlal edilmesiyle sonu\u00e7lanaca\u011f\u0131na da i\u015faret etmi\u015ftir (Alig\u00fcl Alkaya ve di\u011ferleri (2), B. No: 2016\/12506, 7\/11\/2019).<\/p>\n<p>50. Bireysel ba\u015fvuru kapsam\u0131nda bir temel hakk\u0131n ihlal edildi\u011fine karar verildi\u011fi takdirde ihlalin ve sonu\u00e7lar\u0131n\u0131n ortadan kald\u0131r\u0131ld\u0131\u011f\u0131ndan s\u00f6z edilebilmesi i\u00e7in temel kural m\u00fcmk\u00fcn oldu\u011funca eski h\u00e2le getirmenin yani ihlalden \u00f6nceki duruma d\u00f6n\u00fclmesinin sa\u011flanmas\u0131d\u0131r. Bunun i\u00e7in ise \u00f6ncelikle ihlalin kayna\u011f\u0131 belirlenerek devam eden ihlalin durdurulmas\u0131, ihlale neden olan karar veya i\u015flemin ve bunlar\u0131n yol a\u00e7t\u0131\u011f\u0131 sonu\u00e7lar\u0131n ortadan kald\u0131r\u0131lmas\u0131, varsa ihlalin sebep oldu\u011fu maddi ve manevi zararlar\u0131n giderilmesi, ayr\u0131ca bu ba\u011flamda uygun g\u00f6r\u00fclen di\u011fer tedbirlerin al\u0131nmas\u0131 gerekmektedir (Mehmet Do\u011fan, \u00a7\u00a7 55, 57).<\/p>\n<p>51. \u0130hlalin mahkeme karar\u0131ndan kaynakland\u0131\u011f\u0131 veya mahkemenin ihlali gideremedi\u011fi durumlarda Anayasa Mahkemesi, 6216 say\u0131l\u0131 Kanun\u2019un 50. maddesinin (2) numaral\u0131 f\u0131kras\u0131 ile Anayasa Mahkemesi \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc&#8217;n\u00fcn 79. maddesinin (1) numaral\u0131 f\u0131kras\u0131n\u0131n (a) bendi uyar\u0131nca ihlalin ve sonu\u00e7lar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131 i\u00e7in yeniden yarg\u0131lama yap\u0131lmak \u00fczere karar\u0131n bir \u00f6rne\u011finin ilgili mahkemeye g\u00f6nderilmesine h\u00fckmeder. An\u0131lan yasal d\u00fczenleme, usul hukukundaki benzer hukuki kurumlardan farkl\u0131 olarak ihlali ortadan kald\u0131rmak amac\u0131yla yeniden yarg\u0131lama sonucunu do\u011furan ve bireysel ba\u015fvuruya \u00f6zg\u00fclenen bir giderim yolunu \u00f6ng\u00f6rmektedir. Bu nedenle Anayasa Mahkemesi taraf\u0131ndan ihlal karar\u0131na ba\u011fl\u0131 olarak yeniden yarg\u0131lama karar\u0131 verildi\u011finde usul hukukundaki yarg\u0131laman\u0131n yenilenmesi kurumundan farkl\u0131 olarak ilgili mahkemenin yeniden yarg\u0131lama sebebinin varl\u0131\u011f\u0131n\u0131 kabul hususunda herhangi bir takdir yetkisi bulunmamaktad\u0131r. Dolay\u0131s\u0131yla b\u00f6yle bir karar\u0131n kendisine ula\u015ft\u0131\u011f\u0131 mahkemenin yasal y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc, ilgilinin talebini beklemeksizin Anayasa Mahkemesinin ihlal karar\u0131 nedeniyle yeniden yarg\u0131lama karar\u0131 vererek devam eden ihlalin sonu\u00e7lar\u0131n\u0131 gidermek \u00fczere gereken i\u015flemleri yerine getirmektir (Mehmet Do\u011fan, \u00a7\u00a7 58, 59; Alig\u00fcl Alkaya ve di\u011ferleri (2), \u00a7\u00a7 57-59, 66, 67).<\/p>\n<p>52. \u0130ncelenen ba\u015fvuruda ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlal edildi\u011fi sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla ihlalin mahkeme karar\u0131ndan kaynakland\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>53. Bu durumda ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc ihlalinin sonu\u00e7lar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131 i\u00e7in yeniden yarg\u0131lama yap\u0131lmas\u0131nda hukuki yarar bulunmaktad\u0131r. Yap\u0131lacak yeniden yarg\u0131lama ise bireysel ba\u015fvuruya \u00f6zg\u00fc d\u00fczenleme i\u00e7eren 6216 say\u0131l\u0131 Kanun&#8217;un 50. maddesinin (2) numaral\u0131 f\u0131kras\u0131na g\u00f6re ihlalin ve sonu\u00e7lar\u0131n\u0131n ortadan kald\u0131r\u0131lmas\u0131na y\u00f6neliktir. Bu kapsamda yap\u0131lmas\u0131 gereken i\u015f yeniden yarg\u0131lama karar\u0131 verilerek Anayasa Mahkemesini ihlal sonucuna ula\u015ft\u0131ran nedenleri gideren, ihlal karar\u0131nda belirtilen ilkelere uygun yeni bir karar verilmesinden ibarettir. Bu sebeple karar\u0131n bir \u00f6rne\u011finin yeniden yarg\u0131lama yap\u0131lmak \u00fczere Ankara 36. Asliye Ceza Mahkemesine g\u00f6nderilmesine karar verilmesi gerekmektedir.<\/p>\n<p>54. Dosyadaki belgelerden tespit edilen 239,50 TL har\u00e7 ve 3.600 TL vek\u00e2let \u00fccretinden olu\u015fan toplam 3.839,50 TL yarg\u0131lama giderinin ba\u015fvurucuya \u00f6denmesine karar verilmesi gerekir.<\/p>\n<p>VI. Karar\u0131n bir \u00f6rne\u011finin Adalet Bakanl\u0131\u011f\u0131na G\u00d6NDER\u0130LMES\u0130NE 26\/5\/2021 tarihinde karar verildi.<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<p>KAR\u015eIOY GEREK\u00c7ES\u0130<\/p>\n<p>A.<\/p>\n<p>1. Anayasa Mahkemesi 1. B\u00f6l\u00fcm 2016\/36777 esas say\u0131l\u0131 dosyada \u00e7o\u011funluk ba\u015fvurucunun ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlal edildi\u011fine ili\u015fkin iddian\u0131n kabul edilebilir oldu\u011funa karar vermi\u015ftir. A\u015fa\u011f\u0131da a\u00e7\u0131klad\u0131\u011f\u0131m sebeplerle kabul edilebilirlik y\u00f6n\u00fcnden bu karara kat\u0131lmad\u0131m.<\/p>\n<p>2. H\u00fckm\u00fcn a\u00e7\u0131klanmas\u0131n\u0131n geri b\u0131rak\u0131lmas\u0131 (HAGB), san\u0131\u011fa y\u00fcklenen su\u00e7a ili\u015fkin yarg\u0131lama sonunda cezaya h\u00fckmedilmesi h\u00e2linde h\u00fckm\u00fcn a\u00e7\u0131klanmas\u0131n\u0131n belirli ko\u015fullar\u0131n ger\u00e7ekle\u015fmesine ba\u011fl\u0131 olarak ertelenmesi anlam\u0131na gelmektedir. Kanunda belirtilen ko\u015fullar\u0131n ger\u00e7ekle\u015fmesine kar\u015f\u0131n san\u0131\u011f\u0131n kabul etmemesi h\u00e2linde HAGB karar\u0131 verilemeyece\u011fi 5271 say\u0131l\u0131 Kanun&#8217;un 231. maddesinin (6) numaral\u0131 f\u0131kras\u0131n\u0131n son c\u00fcmlesinde ifade edilmektedir (HAGB kurumuna ili\u015fkin geni\u015f a\u00e7\u0131klamalar i\u00e7in bkz. Ali G\u00fcrsoy, B. No: 2012\/833, 26\/3\/2013, \u00a7\u00a7 19-22).<\/p>\n<p>3. Anayasa Mahkemesi \u00e7ok say\u0131da karar\u0131nda HAGB karar\u0131 verilmesini kabul eden san\u0131klar\u0131n, verilen karar\u0131n istinafta\/temyizde yap\u0131lacak esas ve usul incelemesini talep etme hakk\u0131ndan vazge\u00e7tiklerini a\u00e7\u0131klam\u0131\u015ft\u0131r. Somut olayda ba\u015fvurucu, yarg\u0131lama sonunda hakk\u0131nda HAGB karar\u0131 verilmesine r\u0131za g\u00f6stermi\u015ftir. Dolay\u0131s\u0131yla ba\u015fvurucu, s\u00f6z konusu karar ile ortaya \u00e7\u0131kan menfaatlerden yararlanmay\u0131 tercih etmi\u015ftir (Adnan Erku\u015f\/T\u00fcrkiye (k.k.), B. No: 61196\/11, 4\/12\/2012, \u00a7 22).<\/p>\n<p>4. 5271 say\u0131l\u0131 Kanun&#8217;un 231. maddesinin (5) numaral\u0131 f\u0131kras\u0131n\u0131n son c\u00fcmlesinde &#8220;h\u00fckm\u00fcn a\u00e7\u0131klanmas\u0131n\u0131n geri b\u0131rak\u0131lmas\u0131, kurulan h\u00fckm\u00fcn san\u0131k hakk\u0131nda bir hukuk\u00ee sonu\u00e7 do\u011furmamas\u0131n\u0131 ifade eder&#8221; denilerek denetim s\u00fcresi i\u00e7erisinde geri b\u0131rak\u0131lan h\u00fckme hi\u00e7bir hukuki sonu\u00e7 ba\u011flanamayaca\u011f\u0131 a\u00e7\u0131k\u00e7a d\u00fczenlenmi\u015ftir.<\/p>\n<p>5. Dolay\u0131s\u0131yla HAGB karar\u0131 verilmesi ile ki\u015finin temel haklar\u0131na yaln\u0131zca onun belirli bir s\u00fcre su\u00e7 i\u015fleyip i\u015flemedi\u011finin izlenmesi i\u00e7in denetim alt\u0131na al\u0131nmas\u0131 yoluyla bir m\u00fcdahale yap\u0131lmaktad\u0131r ki kanaatime g\u00f6re istinaf\u0131\/temyizi kabil bir karar yerine belirli bir s\u00fcre denetim alt\u0131na al\u0131nmay\u0131 ba\u015fvurucu bizzat kendisi talep etti\u011fi i\u00e7in s\u00f6z konusu m\u00fcdahaleye de katlanmas\u0131 gerekir.<\/p>\n<p>6. \u00d6te yandan mevcut uygulamada san\u0131klar\u0131n talebi ile HAGB karar\u0131 verilmesinden sonra uyu\u015fmazl\u0131\u011f\u0131n esas\u0131 herhangi bir merci taraf\u0131ndan incelenmemekte, mesele ilk kez Anayasa Mahkemesince ele al\u0131nmaktad\u0131r. Haklar\u0131nda istinaf\/temyiz yoluna gitmelerini m\u00fcmk\u00fcn k\u0131lan bir karar verilmesini talep etmeyen ba\u015fvurucular\u0131n do\u011frudan bireysel ba\u015fvuru yolunu kullanmalar\u0131 Anayasa Mahkemesinin ikincilli\u011fine b\u00fcy\u00fck zarar vermektedir.<\/p>\n<p>7. \u00dcstelik denetim s\u00fcresi i\u00e7erisinde ki\u015filer bir su\u00e7 i\u015flemedikleri taktirde dava hukuk aleminde hi\u00e7 vaki olmam\u0131\u015f say\u0131lacak ve d\u00fc\u015f\u00fcr\u00fclecektir. HAGB karar\u0131 verilen davalar\u0131n \u00e7ok b\u00fcy\u00fck k\u0131sm\u0131n\u0131n d\u00fc\u015f\u00fcr\u00fcld\u00fc\u011f\u00fc g\u00f6zetildi\u011finde bu dosyalar\u0131n bireysel ba\u015fvuru yolu ile Anayasa Mahkemesince incelenmesi kanun koyucunun yarg\u0131 sisteminin i\u015f y\u00fck\u00fcn\u00fcn azalt\u0131lmas\u0131 amac\u0131 ile de \u00e7eli\u015fmektedir.<\/p>\n<p>8. \u00dczerinde durulmas\u0131 gereken bir y\u00f6n de HAGB kararlar\u0131 hakk\u0131nda Anayasa Mahkemesince bir de\u011ferlendirme yap\u0131lmadan \u00f6nce ki\u015filerin su\u00e7 i\u015flemeleri halinde HAGB verilen kararlar\u0131n a\u00e7\u0131klanaca\u011f\u0131 ger\u00e7e\u011fidir. B\u00f6yle bir durumda a\u00e7\u0131klanan h\u00fck\u00fcm i\u00e7in istinaf\/temyiz yolu a\u00e7\u0131lacak, b\u00f6lge adliye mahkemeleri ve Yarg\u0131tay i\u015fin esas\u0131 hakk\u0131nda karar vereceklerdir. B\u00f6yle bir durumda iki y\u00fcksek mahkeme \u00f6n\u00fcnde ayn\u0131 olaya ili\u015fkin iki ba\u015fvuru bulunacakt\u0131r ki bu, bireysel ba\u015fvurunun ikincilli\u011fi ilkesine tamamen ayk\u0131r\u0131d\u0131r.<\/p>\n<p>9. \u00dcstelik mevcut ba\u015fvuruya benzer ba\u015fvurular hakk\u0131nda kabul edilemezlik karar\u0131 verilmesi anayasal haklara ili\u015fkin \u015fikayetlerin bir daha Anayasa Mahkemesi \u00f6n\u00fcne getirilemeyece\u011fi anlam\u0131na gelmemektedir. Nitekim az \u00f6nce a\u00e7\u0131klad\u0131\u011f\u0131m gibi hakk\u0131ndaki h\u00fck\u00fcm a\u00e7\u0131kland\u0131ktan sonra ba\u015fvurucunun ola\u011fan kanun yollar\u0131n\u0131 ba\u015fvurup uyu\u015fmazl\u0131\u011f\u0131n\u0131n esas\u0131n\u0131 incelettikten sonra Anayasal haklar\u0131 bak\u0131m\u0131ndan ma\u011fduriyetinin devam etti\u011fini d\u00fc\u015f\u00fcn\u00fcyorsa Anayasa Mahkemesine bireysel ba\u015fvuruda bulunmas\u0131 m\u00fcmk\u00fcnd\u00fcr.<\/p>\n<p>10. HAGB kararlar\u0131na ili\u015fkin yap\u0131lan bireysel ba\u015fvurular ile ilgili olarak g\u00f6zetilmesi gereken bir ba\u015fka y\u00f6nde \u015fudur: Ayn\u0131 olayla ilgili biri HAGB di\u011ferleri istinaf\u0131\/temyizi kabil birden \u00e7ok karar verildi\u011fi durumlarda uyu\u015fmazl\u0131k iki ayr\u0131 y\u00fcksek mahkeme \u00f6n\u00fcne ta\u015f\u0131nacakt\u0131r. S\u0131kl\u0131kla ger\u00e7ekle\u015fen bu t\u00fcr bir ihtimallerde az \u00f6nce ifade etti\u011fim gibi y\u00fcksek mahkemeler aras\u0131nda karar uyu\u015fmazl\u0131klar\u0131 \u00e7\u0131kma potansiyeli bulundu\u011fu gibi daha da \u00f6nemlisi ba\u015fvurucular bir uyu\u015fmazl\u0131\u011f\u0131n esas\u0131n\u0131 ola\u011fan yollarda tart\u0131\u015ft\u0131rmadan ola\u011fan \u00fcst\u00fc bir yol olan Anayasa Mahkemesi bireysel ba\u015fvuru yoluna getirme f\u0131rsat\u0131 yakalamaktad\u0131rlar. Bu durumun da bireysel ba\u015fvurunun ikincilli\u011fi ilkesi ile \u00e7eli\u015fece\u011fi a\u00e7\u0131kt\u0131r.<\/p>\n<p>11. Somut ba\u015fvuruda ba\u015fvurucunun ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlal edildi\u011fi y\u00f6n\u00fcndeki \u015fikayetleri, somut ba\u015fvurunun \u00f6zelli\u011fi de nazara al\u0131nd\u0131\u011f\u0131nda, istinaf incelemesinde ileri s\u00fcr\u00fclebilecek iddialardand\u0131r. Ba\u015fvuruda, h\u00fckm\u00fcn a\u00e7\u0131klanmas\u0131n\u0131n geri b\u0131rak\u0131lmas\u0131 karar\u0131n\u0131n talep \u00fczerine verildi\u011fi, istinaf veya temyiz yoluna ba\u015fvurmay\u0131 m\u00fcmk\u00fcn k\u0131lan karar verilmesinin ise tercih edilmedi\u011fi dikkate al\u0131nd\u0131\u011f\u0131nda ihlal iddias\u0131n\u0131n dayanaktan yoksun oldu\u011fu anla\u015f\u0131lmaktad\u0131r.<\/p>\n<p>B.<\/p>\n<p>1. Anayasa mahkemesinin 1. B\u00f6l\u00fcm 2016\/36777 esas say\u0131l\u0131 dava dosyas\u0131nda say\u0131n \u00e7o\u011funluk ba\u015fvurucunun ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlal edildi\u011fine karar vermi\u015ftir. A\u015fa\u011f\u0131da belirtece\u011fim gerek\u00e7elerle ba\u015fvurucunun ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlal edilmedi\u011fi gerek\u00e7esiyle say\u0131n \u00e7o\u011funlu\u011fun g\u00f6r\u00fc\u015f\u00fcne kat\u0131lmad\u0131m.<\/p>\n<p>2. Anayasa mahkemesince \u00e7at\u0131\u015fan haklar s\u00f6z konusu oldu\u011funda baz\u0131 kriterler kullan\u0131larak sonuca ula\u015f\u0131lmaktad\u0131r. Zamandan ve mekandan ba\u011f\u0131ms\u0131z geli\u015fen internet ortam\u0131 bilimsel kavramlardan i\u015f modellerine sosyal hayata hukuk kavramlar\u0131na mahkeme i\u00e7tihatlar\u0131na kadar bir\u00e7ok alan\u0131 etkileyecektir.<\/p>\n<p>5. \u0130nternet di\u011fer ileti\u015fim ara\u00e7lar\u0131na g\u00f6re ucuz ve kolay ula\u015f\u0131labilen bir ara\u00e7t\u0131r. Bilgiye ula\u015fmak, \u00fcretmek, de\u011ferlendirme yapmak kolay ve ucuz bir hale gelmi\u015ftir. \u0130nternet ortam\u0131nda g\u00f6zle g\u00f6r\u00fclebilen elle tutulabilen zamana ve mekana ba\u011fl\u0131 s\u0131n\u0131rlar yoktur.<\/p>\n<p>6. \u0130nternet ortam\u0131n\u0131n sa\u011flad\u0131\u011f\u0131 bu imkanlar bir yandan demokratik toplumun geli\u015fimini sa\u011flarken bir yandan da \u00f6zellikle belli su\u00e7lar a\u00e7\u0131s\u0131ndan kolayla\u015ft\u0131r\u0131c\u0131 bir araca d\u00f6n\u00fc\u015febilmektedir.<\/p>\n<p>7. Ulusal g\u00fcvenlik (silah yap\u0131m\u0131, yasa d\u0131\u015f\u0131 uyu\u015fturucu, ve ter\u00f6rizm) k\u00fc\u00e7\u00fcklerin korunmas\u0131 (istismar, pazarlama, \u015fiddet ve pornografi) insan onurunun korunmas\u0131 (etnik nefreti tahrik ve ayr\u0131mc\u0131l\u0131k) ekonomik g\u00fcvenlik ( doland\u0131r\u0131c\u0131l\u0131k ve bankac\u0131l\u0131k su\u00e7lar\u0131) mahremiyetin korunmas\u0131 (ki\u015fisel verilerin izinsiz dola\u015f\u0131m\u0131, elektronik taciz) itibar\u0131n korunmas\u0131 ( hakaret, tehdit, kar\u015f\u0131la\u015ft\u0131rmal\u0131 reklam) m\u00fclkiyet ve telif haklar\u0131 (m\u00fczik, yaz\u0131l\u0131m, kitaplar) yukar\u0131da belirtilen bu alanlar internet ortam\u0131nda kamu otoritelerine devletlere, uluslararas\u0131 kurulu\u015flara bu alanda d\u00fczenleme yapma zorunlulu\u011fu sonucunu do\u011furmaktad\u0131r. URL tabanl\u0131 engellemenin teknik olarak m\u00fcmk\u00fcn olmamas\u0131 ve an\u0131lan i\u00e7eriklerin internet sitesinden \u00e7\u0131kar\u0131lmamas\u0131, mevcut teknolojik imkanlar\u0131n yetersizli\u011fi ve ulusal mahkemelerimizce verilen kararlar\u0131n uluslararas\u0131 \u015firketler \u00fczerinde kayda de\u011fer bir etkisinin bulunmad\u0131\u011f\u0131 gerek\u00e7eleriyle ba\u015fvurucunun temel haklar\u0131n\u0131n korunmas\u0131 hususunda devlete daha a\u011f\u0131r y\u00fck\u00fcml\u00fcl\u00fckler y\u00fcklenemeyece\u011fi kabul\u00fc, ba\u015fvurucunun Anayasa&#8217;n\u0131n 17. maddesinin birinci f\u0131kras\u0131ndaki haklar\u0131n\u0131n ihlal edilmesine yol a\u00e7m\u0131\u015ft\u0131r. Oysa, devlet g\u00fcc\u00fcn\u00fc kullanan organlar\u0131n ba\u015fvurucunun ma\u011fduriyetlerinin ba\u015fvuru an\u0131ndan itibaren hemen giderilmesi konusunda daha etkin \u00e7aba i\u00e7inde olmalar\u0131 gerekmekteydi.<\/p>\n<p>Tam da bu sebeple devlet g\u00fcc\u00fcn\u00fc kullanan organlar\u0131n, ba\u015fvurucuya kar\u015f\u0131 i\u015flenen su\u00e7lar\u0131n ayd\u0131nlat\u0131lmas\u0131 ve ba\u015fvurucunun ma\u011fduriyetinin giderilmesi i\u00e7in; ba\u015fta hukuksal olmak \u00fczere ulusal alt yap\u0131n\u0131n haz\u0131rlanmas\u0131, uluslararas\u0131 i\u015f birli\u011fi mekanizmalar\u0131n\u0131n etkili bir \u015fekilde harekete ge\u00e7irilmesi ve bunun i\u00e7in de etkin bir soru\u015fturma sonucunda elde edilmi\u015f g\u00fcvenilir verilerle desteklenmi\u015f ikna edici bir dosyan\u0131n haz\u0131rlanmas\u0131 konusunda \u00fczerlerine d\u00fc\u015feni yapmad\u0131klar\u0131 kanaatine ula\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Sosyal medya kurulu\u015flar\u0131n\u0131n haberle\u015fme, fikir ve ifade, bas\u0131n \u00f6zg\u00fcrl\u00fc\u011f\u00fc gibi haklar\u0131n kullan\u0131m\u0131nda \u00f6zen y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc yerine getirmeleri; bireylerin \u015feref ve itibar haklar\u0131n\u0131n korunmas\u0131nda daha duyarl\u0131 olmalar\u0131 gerekmektedir. Ulusal mahkemelerce verilen kararlar\u0131n Sosyal medya kurulu\u015flar\u0131 taraf\u0131ndan uygulanmamas\u0131, ulusal mahkeme kararlar\u0131n\u0131n uluslararas\u0131 sosyal medya \u015firketleri \u00fczerinde kayda de\u011fer bir etkisinin bulunmamas\u0131 anla\u015f\u0131l\u0131r bir durum de\u011fildir. Bireylerin de\u011fi\u015fik fakt\u00f6rler nedeniyle, sosyal medya kurulu\u015flar\u0131 arac\u0131l\u0131\u011f\u0131yla haks\u0131z sald\u0131r\u0131lar kar\u015f\u0131s\u0131nda korumas\u0131z kald\u0131klar\u0131 g\u00f6zlenmektedir. Tam da bu nedenden dolay\u0131 Devletler, bireylerin \u015feref ve itibarlar\u0131n\u0131n korunmas\u0131 hususunda \u00fc\u00e7\u00fcnc\u00fc ki\u015filere kar\u015f\u0131, bu t\u00fcr sosyal medya kurumlar\u0131na kar\u015f\u0131, bireylerin \u015feref ve itibarlar\u0131n\u0131n korunmas\u0131 hususunda pozitif y\u00fck\u00fcml\u00fcl\u00fcklerinin yerine getirilmesi hususunda daha etkin olmal\u0131d\u0131rlar.\u201d<\/p>\n<p>10. Zira; Dijitalle\u015fmeyle kay\u0131t alt\u0131na alma kolayl\u0131\u011f\u0131 kay\u0131tlar\u0131n geli\u015fen teknolojiyle bire bir ayn\u0131s\u0131n\u0131n sahte olarak yapma sahte delil \u00fcretme kolayl\u0131\u011f\u0131 hi\u00e7bir denetime tabii olmayan bir ortamda bunlar\u0131 yayma ve hedef kitlelere ula\u015ft\u0131rma kolayl\u0131\u011f\u0131 g\u00f6z \u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda de\u011fer yarg\u0131s\u0131 dedi\u011fimiz felsefe kavram\u0131n i\u00e7inin doldurulmas\u0131n\u0131n ne kadar zor oldu\u011fu tart\u0131\u015fmas\u0131zd\u0131r.<\/p>\n<p>11. Geli\u015fen teknoloji kar\u015f\u0131s\u0131nda \u00e7ok ucuz ve \u00e7ok kolay bir \u015fekilde tamamen sahte ve \u00fcretilmi\u015f belgeler \u00fczerinden yap\u0131lacak yay\u0131nlarla ve bu yay\u0131nlara \u00fclkelerin ulusal mahkemelerinin yarg\u0131 kararlar\u0131n\u0131n da teknik imkans\u0131zl\u0131klar nedeniyle fiilen uygulanmad\u0131\u011f\u0131 g\u00f6z \u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda bir de\u011fer yarg\u0131s\u0131 olarak kabul edilmesi belki de \u201ctoplumsal \u015fizofreniye, kaosa ve itibar suikastine neden olacakt\u0131r.
