Her iki kavram da ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerle ili\u015fkili kullan\u0131mlar\u0131 ifade eder; ancak hukuki sonu\u00e7lar\u0131 farkl\u0131d\u0131r. Eklenti, tapuya i\u015flenir ve m\u00fclkiyet hakk\u0131n\u0131n bir par\u00e7as\u0131 say\u0131l\u0131r. Tahsisli alan ise yaln\u0131zca kullan\u0131m hakk\u0131 sa\u011flar ve ortak yerler aras\u0131nda kal\u0131r.<\/p>\n<p>Bu ayr\u0131m; garaj, teras, depo ve bah\u00e7e gibi alanlar\u0131n nas\u0131l kullan\u0131laca\u011f\u0131, devredilip devredilemeyece\u011fi ya da ba\u015fkas\u0131na kiralan\u0131p kiralanamayaca\u011f\u0131 gibi sorular\u0131n yan\u0131t\u0131nda belirleyicidir. Bu yaz\u0131, Kat M\u00fclkiyeti Kanunu ve Yarg\u0131tay kararlar\u0131 do\u011frultusunda bu iki kavram\u0131 a\u00e7\u0131k ve anla\u015f\u0131l\u0131r \u015fekilde ele almaktad\u0131r.<\/p>\n<p>EKLENT\u0130<\/p>\n<p>Eklentinin tan\u0131m\u0131 Kat M\u00fclkiyeti Kanunu Madde 2\/a\u2019da yap\u0131lm\u0131\u015ft\u0131r.: \u201cBir ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn d\u0131\u015f\u0131nda olup, do\u011frudan do\u011fruya o b\u00f6l\u00fcme tahsis edilmi\u015f olan yerler\u201d<\/p>\n<p>Eklenti konusuna getirilen kriterler ise Kat M\u00fclkiyeti Kanunu Madde 6\u2019da d\u00fczenlenmi\u015ftir:<\/p>\n<p>Buna g\u00f6re \u201cBir ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn d\u0131\u015f\u0131nda olup, do\u011frudan do\u011fruya o b\u00f6l\u00fcme tahsis edilmi\u015f olan k\u00f6m\u00fcrl\u00fck, su deposu, garaj, elektrik, havagaz\u0131 veya su saati yuvalar\u0131, tuvalet gibi eklentiler, ait oldu\u011fu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn b\u00fct\u00fcnleyici par\u00e7as\u0131 say\u0131l\u0131r ve o b\u00f6l\u00fcm\u00fcn maliki, eklentilerin de tek ba\u015f\u0131na maliki olur. Eklentiler kat m\u00fclkiyeti k\u00fct\u00fc\u011f\u00fcn\u00fcn (beyanlar) hanesine kaydedilir ve bunlardan anayap\u0131n\u0131n oturdu\u011fu zeminin d\u0131\u015f\u0131nda kalanlar kadastro plan\u0131nda veya tapu haritas\u0131nda ayr\u0131ca g\u00f6sterilir. Ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin ba\u015fkas\u0131na devri, kay\u0131tlanmas\u0131 veya kiralanmas\u0131 halinde, EKLENT\u0130LER ve ortak yerlerde KEND\u0130L\u0130\u011e\u0130NDEN devredilmi\u015f, kay\u0131tlanm\u0131\u015f ve kiralanm\u0131\u015f olur.\u201d<\/p>\n<p>Yasa metninde eklenti olarak say\u0131lan yerlerin sonunda \u201cgibi\u201d ifadesinin kullan\u0131lmas\u0131 eklenti olarak belirlenebilecek yerlerin maddede say\u0131lanlarla s\u0131n\u0131rl\u0131 olmad\u0131\u011f\u0131n\u0131 ifade eder. Buna g\u00f6re \u00e7at\u0131, teras, havuz, kombiye ge\u00e7ilen yerlerde kazan dairesi, k\u0131smen tamamen bah\u00e7e kap\u0131c\u0131 dairesi gibi yerler eklenti olarak belirlenebilir. Ancak s\u0131\u011f\u0131nak ve koridor gibi ortak kullan\u0131m\u0131n d\u0131\u015f\u0131na \u00e7\u0131kar\u0131lmas\u0131 m\u00fcmk\u00fcn olmayan yerler eklenti olarak belirlenemez.<\/p>\n<p>Eklentilerin ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlere e\u015fit olarak da\u011f\u0131t\u0131lmas\u0131 \u015fart de\u011fildir. Bir ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn \u00e7ok say\u0131da eklentisi olabilir, ancak bir eklenti birden fazla ba\u011f\u0131ms\u0131z b\u00f6l\u00fcme tahsis edilemez, o zaman ortak alan kapsam\u0131nda de\u011ferlendirilir. Tapuya ge\u00e7erli \u015fekilde kaydedilmi\u015f eklentiler orant\u0131s\u0131z olsa da ge\u00e7erlidir ve s\u00f6zle\u015fme serbestisi ilkesi kapsam\u0131nda hukuk taraf\u0131ndan korunur:<\/p>\n<p>Kat m\u00fclkiyeti kurulurken 42 numaral\u0131 ba\u011f\u0131m\u0131z b\u00f6l\u00fcme\u00a0eklenti\u00a0olarak tahsis edilen ve tapu siciline de bu \u015fekilde ge\u00e7irilen kay\u0131t ile y\u00f6netim plan\u0131 h\u00fckm\u00fcn\u00fcn, bu ana ta\u015f\u0131nmazdan ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm sat\u0131n ald\u0131\u011f\u0131 anla\u015f\u0131lan davac\u0131lar\u0131 da ba\u011flayaca\u011f\u0131 muhakkak olup, daval\u0131lardan &#8230;&#8217;nun malik oldu\u011fu 42 numaral\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcme\u00a0eklenti\u00a0olarak tahsis edilen garaj ve otopark\u0131 tek ba\u015f\u0131na kullanmas\u0131nda herhangi bir yasal engel bulunmamaktad\u0131r. HD., E. 2017\/3618 K. 2018\/5453 T. 10.9.2018)<\/p>\n<p>Kat m\u00fclkiyeti kurulurken 2 numaral\u0131 ba\u011f\u0131m\u0131z b\u00f6l\u00fcme\u00a0eklenti\u00a0olarak tahsis edilen ve tapu siciline de bu \u015fekilde ge\u00e7irilen kay\u0131t ile y\u00f6netim plan\u0131 h\u00fckm\u00fcn\u00fcn, bu ana ta\u015f\u0131nmazdan sonradan ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm sat\u0131n ald\u0131\u011f\u0131 anla\u015f\u0131lan davac\u0131lar\u0131 da ba\u011flayaca\u011f\u0131 muhakkak olup, daval\u0131lar\u0131n malik ve intifa hakk\u0131 sahibi olduklar\u0131 2 numaral\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcme\u00a0eklenti\u00a0olarak tahsis edilen garaj ve m\u00fc\u015ftemilat\u0131 da tek ba\u015flar\u0131na kullanmas\u0131nda herhangi bir yasal engel bulunmamaktad\u0131r. (Yarg\u0131tay 18. HD., E. 2007\/9099 K. 2007\/10982 T. 11.12.2007)<\/p>\n<p>Eklenti ait oldu\u011fu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn ayr\u0131lmaz bir par\u00e7as\u0131 olup, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn m\u00fclkiyeti eklentiyi de kapsar. Ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn ba\u015fkas\u0131na devri, kay\u0131tlanmas\u0131 ve kiralanmas\u0131 halinde eklentilerde devredilmi\u015f, kay\u0131tlanm\u0131\u015f ve kiralanm\u0131\u015f say\u0131lacakt\u0131r:<\/p>\n<p>Dernek olarak kullan\u0131lan b\u00f6l\u00fcm\u00fcn daval\u0131 &#8230;&#8217;a ait 13 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn\u00a0eklentisi niteli\u011finde depo oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Kat M\u00fclkiyeti Kanunu&#8217;nun 6. maddesi gere\u011fince ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00a0eklentisi niteli\u011findeki depolar ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn b\u00fct\u00fcnleyici par\u00e7as\u0131 niteli\u011finde olup o ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn malikinden ayr\u0131 olarak kullan\u0131lamaz. Bu husus nazara al\u0131narak 13 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn\u00a0eklentisi niteli\u011finde olan deponun dernek olarak kullan\u0131lmas\u0131na son verilmesi suretiyle eski hale iadesi gerekir. (Yarg\u0131tay HGK., E. 2017\/2001 K. 2022\/81 T. 8.2.2022)<\/p>\n<p>Ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm ile eklentisi farkl\u0131 ki\u015filere sat\u0131lamaz veya kiraya verilemez:<\/p>\n<p>Kat M\u00fclkiyeti Kanunu&#8217;nun 6. maddesi gere\u011fince ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00a0eklentisi niteli\u011findeki depolar ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn b\u00fct\u00fcnleyici par\u00e7as\u0131 niteli\u011finde olup o ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmden ayr\u0131 olarak kullan\u0131lamaz. Yasan\u0131n bu h\u00fckm\u00fc gere\u011fi ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn k\u00f6m\u00fcrl\u00fck niteli\u011findeki\u00a0eklentilerinin amac\u0131 d\u0131\u015f\u0131na \u00e7\u0131kar\u0131larak konut olarak kiraya verilmesi m\u00fcmk\u00fcn de\u011fildir. Bu nedenle mahkemece davac\u0131lar\u0131n\u00a0eklentilere ili\u015fkin talebinin reddine karar verilmesi do\u011fru g\u00f6r\u00fclmemi\u015ftir. (Yarg\u0131tay 5. HD., E. 2020\/7917 K. 2021\/478 T. 25.1.2021)<\/p>\n<p>Somut olayda ihalesi yap\u0131lan Ek 3 nolu garaj\u0131n 5 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn, Ek 5 nolu garaj\u0131n ise 7 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn\u00a0eklentisi oldu\u011fu ve tapu sicilinde her iki garaj\u0131n da\u00a0eklenti\u00a0olarak \u015ferh verildi\u011fi g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Yukar\u0131da belirtilen yasa h\u00fck\u00fcmleri uyar\u0131nca\u00a0eklentinin tabi oldu\u011fu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmden ayr\u0131 olarak haczi ve sat\u0131\u015f\u0131 m\u00fcmk\u00fcn de\u011fildir. Bu husus kamu d\u00fczeni ile ilgili olup, mahkemece re\u2019sen nazara al\u0131nmal\u0131d\u0131r.<\/p>\n<p>O halde mahkemece, a\u00e7\u0131klanan nedenlerle ba\u011fl\u0131 olduklar\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerden ayr\u0131 olarak yap\u0131lan\u00a0eklenti\u00a0niteli\u011findeki Ek 3 ve Ek 5 nolu garajlara ili\u015fkin ihalenin feshine karar verilmesi gerekirken bu hususun g\u00f6z ard\u0131 edilerek, istemin t\u00fcmden reddi isabetsiz olup, mahkeme karar\u0131n\u0131n bozulmas\u0131 gerekirken onand\u0131\u011f\u0131 anla\u015f\u0131lmakla bor\u00e7lular vekilinin karar d\u00fczeltme isteminin kabul\u00fc gerekmi\u015ftir. (Yarg\u0131tay 12. HD., E. 2010\/29550 K. 2011\/10767 T. 26.05.2011)<\/p>\n<p>Eklentiler anayap\u0131n\u0131n veya yap\u0131lar\u0131n i\u00e7inde ise mimari projede, d\u0131\u015f\u0131nda ise tapu veya kadastro plan\u0131nda belirtilir ama her iki durumda tapu k\u00fct\u00fc\u011f\u00fcnde ait olduklar\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn beyanlar hanesinde g\u00f6sterilir. Sonradan eklenti olarak belirlenen yerlerde de bu prosed\u00fcr ger\u00e7ekle\u015ftirilmelidir:<\/p>\n<p>Projelendirilmeyen ve\u00a0eklenti\u00a0olarak \u00f6zg\u00fclendirilmeyen otoparkta t\u00fcm tapu maliklerinin kullan\u0131m hakk\u0131 bulundu\u011fundan otoparka m\u00fcdahalenin meni ve ecrimisil talebinin kabul\u00fc gerekti\u011fi, bilirki\u015filerin ecrimisil miktar\u0131na ili\u015fkin teknik de\u011ferlendirmelerinin yeterli oldu\u011fu, istinaf eden daval\u0131lar\u0131n s\u00f6zle\u015fme taraf\u0131, i\u015flem takip\u00e7isi ve ta\u015f\u0131nmaz kullan\u0131c\u0131lar\u0131 olmakla davada taraf ve husumet ehliyetini ta\u015f\u0131d\u0131klar\u0131ndan usul ve esasa uygun bulunan ilk derece mahkemesinin karar\u0131na kar\u015f\u0131 istinaf taleplerinin reddi gerekti\u011fi, istinaf edilmeyen ve kamu d\u00fczeninden g\u00f6r\u00fclmeyen sair hususlar de\u011ferlendirme d\u0131\u015f\u0131 b\u0131rak\u0131ld\u0131\u011f\u0131 belirtilerek istinaf ba\u015fvurusunun esastan reddine karar verilmi\u015ftir. HD., E. 2022\/3669 K. 2024\/363 T. 24.1.2024)<\/p>\n<p>Tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan g\u00f6nderilen kat\u0131lan ve san\u0131\u011fa ait tapu kay\u0131tlar\u0131n\u0131n incelenmesinde, her iki tapu k\u00fct\u00fck kay\u0131tlar\u0131nda da kapal\u0131 garaj\u0131n malikler ad\u0131na\u00a0tahsis\u00a0edildi\u011fine dair herhangi bir \u015ferhin bulunmad\u0131\u011f\u0131, ortak yerlerden olan kapal\u0131 otopark alanlar\u0131n\u0131n kimler taraf\u0131ndan nas\u0131l kullan\u0131laca\u011f\u0131na dair site y\u00f6netimince usul\u00fcne uygun olarak al\u0131nm\u0131\u015f bir karar da bulunmamas\u0131 gerek\u00e7esiyle san\u0131k hakk\u0131nda beraat karar\u0131 verilmi\u015ftir. CD., E. 2021\/15718 K. 2023\/9427 T. 30.11.2023)<\/p>\n<p>Eklentiler amac\u0131 d\u0131\u015f\u0131nda kullan\u0131lamaz:<\/p>\n<p>D\u0131\u015f cephe duvar\u0131nda yap\u0131lan de\u011fi\u015fikli\u011fin ve eklentinin ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmle birle\u015ftirilmesi i\u00e7in ara duvar\u0131n kald\u0131r\u0131lmas\u0131 i\u015fleminin anayap\u0131n\u0131n statik dengesini olumsuz etkilemi\u015f olup olmamas\u0131 da sonucu de\u011fi\u015ftirmez. Yasan\u0131n buyurucu h\u00fck\u00fcmleri dikkate al\u0131narak, onayl\u0131 mimari projeye ayk\u0131r\u0131l\u0131k olu\u015fturan de\u011fi\u015fikliklerin projesine uygun eski hale getirilmesine karar verilmesi gerekirken bu konulardaki istemlerin de reddine karar verilmesi do\u011fru g\u00f6r\u00fclmemi\u015ftir. HD., E. 2008\/10123 K. 2009\/779 T. 09.02.2009)<\/p>\n<p>Toplu yap\u0131 kapsam\u0131nda de\u011filse ba\u015fka parselde eklenti olu\u015fturulamaz:<\/p>\n<p>Tapu kay\u0131tlar\u0131, y\u00f6netim planlar\u0131 ve vaziyet plan\u0131 \u00fczerinde yap\u0131lan incelemede, F1 Villalar\u0131 Sitesi&#8217;nin 2352 ada 1,2, ve 3 nolu parseller \u00fczerinde, birden fazla parsel \u00fczerinde kurulu bulundu\u011fu, bu parseller ve ortak yerlerin KMK&#8217;nun 66. ve 67. maddeleri uyar\u0131nca birbirleriyle irtibatl\u0131 oldu\u011funa ili\u015fkin tapu kay\u0131tlar\u0131nda \u015ferh bulunmad\u0131\u011f\u0131 anla\u015f\u0131lm\u0131\u015ft\u0131r. Eldeki uyu\u015fmazl\u0131k Kat M\u00fclkiyeti Kanununun uygulanmas\u0131ndan kaynaklanmaz. (Yarg\u0131tay 18. HD 2015\/19148 E.- 2015\/16913 K )<\/p>\n<p>Eklentiye yap\u0131lan m\u00fcdahale dava konusu edilip durdurulabilir:<\/p>\n<p>634 say\u0131l\u0131 Kanun&#8217;un 19 uncu maddesi uyar\u0131nca her kat maliki ana gayrimenkul\u00fcn mimari durum ve g\u00fczelli\u011fini korumaya mecbur olup, dosya kapsam\u0131 ile aksinin ispatlanamad\u0131\u011f\u0131 ve yap\u0131lan m\u00fcdahalenin ortak alanlardaki ve tapuda\u00a0eklenti\u00a0olarak g\u00f6r\u00fcnen depo nitelikli k\u0131s\u0131mdaki m\u00fcdahale davac\u0131 kat malikinin m\u00fclkiyet hakk\u0131 aleyhine oldu\u011fu g\u00f6zetildi\u011finde mahkemesince davan\u0131n kabul\u00fcne karar verilmesi yerindedir. (Yarg\u0131tay 5. HD., E. 2023\/10647 K. 2024\/1221 T. 6.2.2024)<\/p>\n<p>TAHS\u0130SL\u0130 ALANLAR<\/p>\n<p>Kat M\u00fclkiyeti Kanunu\u2019nun &#8220;Ortak yerler&#8221; ba\u015fl\u0131kl\u0131 67. Maddesi: &#8220;Toplu yap\u0131 kapsam\u0131nda olup, b\u00fct\u00fcn\u00fcyle bu kapsamdaki ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin ortak kullanma ve faydalanmas\u0131na\u00a0tahsis\u00a0edilmi\u015f bulunan parsellerin malik hanesine,\u00a0tahsis\u00a0edildikleri toplu yap\u0131 kapsam\u0131ndaki di\u011fer parsellerin ada, parsel, blok ve ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm numaralar\u0131 g\u00f6sterilmek suretiyle tapu siciline kaydedilir ve bu suretle\u00a0tahsis\u00a0edildikleri parsellerde bulunan ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin ortak yeri olur. Toplu yap\u0131 kapsam\u0131nda bulunan birden \u00e7ok yap\u0131n\u0131n ortak sosyal ve alt yap\u0131 tesisleri bulunduklar\u0131 parsel veya yap\u0131ya bak\u0131lmaks\u0131z\u0131n,\u00a0tahsis\u00a0edildikleri ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin ortak yeri say\u0131l\u0131r.&#8221; \u015feklindedir.<\/p>\n<p>Tahsisli Alanlarda Belirlilik \u0130lkesi\u2028Tahsisli alanlar\u0131n ge\u00e7erli olabilmesi i\u00e7in y\u00f6netim plan\u0131na krokiyle i\u015flenmi\u015f olmas\u0131 gerekir. Bu, belirlilik ilkesinin bir gere\u011fidir. Otopark gibi ortak alanlar\u0131n sadece \u015fema ile de\u011fil, a\u00e7\u0131k ve belirli \u015fekilde y\u00f6netim plan\u0131nda g\u00f6sterilmesi ispat bak\u0131m\u0131ndan \u00f6nemlidir. Trafik ak\u0131\u015f \u015femas\u0131 gibi \u00e7izimler y\u00f6n g\u00f6stericidir ama tahsis anlam\u0131na gelmez.<\/p>\n<p>Tahsisli Alan ile Eklenti Aras\u0131ndaki Fark\u2028Tahsisli alanlar, y\u00f6netim plan\u0131nda belirtilen ve ba\u011f\u0131ms\u0131z b\u00f6l\u00fcme kullan\u0131m hakk\u0131 tan\u0131yan yerlerdir. Eklentiler ise tapuda beyanlar hanesinde yer al\u0131r ve ayn\u00ee hak niteli\u011findedir. Tahsisli alanlar, ortak kullan\u0131m alanlar\u0131nda olu\u015fturulan zilyetlik yoluyla ba\u011f\u0131ms\u0131z b\u00f6l\u00fcme \u00f6zg\u00fclenir. Bu durum, ta\u015f\u0131nmaza ba\u011fl\u0131 bir alacak hakk\u0131 do\u011furur. Eklenti ise do\u011frudan m\u00fclkiyet hakk\u0131na d\u00e2hildir ve istihkak hakk\u0131 sa\u011flar.<\/p>\n<p>Y\u00f6netim Plan\u0131n\u0131n Ba\u011flay\u0131c\u0131l\u0131\u011f\u0131\u2028Y\u00f6netim planlar\u0131, Kat M\u00fclkiyeti Kanunu\u2019nun 28. maddesi uyar\u0131nca t\u00fcm kat maliklerini ba\u011flayan bir s\u00f6zle\u015fmedir. Hukuki niteli\u011fi, e\u015fyaya ba\u011fl\u0131 bor\u00e7tur ve bu bor\u00e7 ta\u015f\u0131nmazla birlikte devredilir.<\/p>\n<p>Otopark, Depo, Teras ve Bah\u00e7eler\u2028Projede eklenti olarak g\u00f6sterilmeyen otopark ve depolar, y\u00f6netim plan\u0131na eklenerek tahsisli alana d\u00f6n\u00fc\u015ft\u00fcr\u00fclebilir. Eklenti olarak belirlenmi\u015f alanlar daha g\u00fc\u00e7l\u00fc koruma alt\u0131ndad\u0131r. Teras veya bah\u00e7e kullan\u0131m\u0131nda bu ayr\u0131m \u00f6zellikle \u00f6nemlidir; eklenti de\u011filse kullan\u0131m hakk\u0131 zay\u0131f ve m\u00fcdahaleye a\u00e7\u0131kt\u0131r.<\/p>\n<p>\u200bKat m\u00fclkiyetinde s\u0131k\u00e7a kar\u0131\u015ft\u0131r\u0131lan konulardan biri, bir yerin eklenti mi yoksa tahsisli alan m\u0131 oldu\u011fudur. Her iki kavram da ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerle ili\u015fkili kullan\u0131mlar\u0131 ifade eder; ancak hukuki sonu\u00e7lar\u0131 farkl\u0131d\u0131r. Eklenti, tapuya i\u015flenir ve m\u00fclkiyet hakk\u0131n\u0131n bir par\u00e7as\u0131 say\u0131l\u0131r. Tahsisli alan ise yaln\u0131zca kullan\u0131m hakk\u0131 sa\u011flar ve ortak yerler aras\u0131nda kal\u0131r.<\/p>\n<p>Bu ayr\u0131m; garaj, teras, depo ve bah\u00e7e gibi alanlar\u0131n nas\u0131l kullan\u0131laca\u011f\u0131, devredilip devredilemeyece\u011fi ya da ba\u015fkas\u0131na kiralan\u0131p kiralanamayaca\u011f\u0131 gibi sorular\u0131n yan\u0131t\u0131nda belirleyicidir. Bu yaz\u0131, Kat M\u00fclkiyeti Kanunu ve Yarg\u0131tay kararlar\u0131 do\u011frultusunda bu iki kavram\u0131 a\u00e7\u0131k ve anla\u015f\u0131l\u0131r \u015fekilde ele almaktad\u0131r.<\/p>\n<p>EKLENT\u0130<\/p>\n<p>Eklentinin tan\u0131m\u0131 Kat M\u00fclkiyeti Kanunu Madde 2\/a\u2019da yap\u0131lm\u0131\u015ft\u0131r.: \u201cBir ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn d\u0131\u015f\u0131nda olup, do\u011frudan do\u011fruya o b\u00f6l\u00fcme tahsis edilmi\u015f olan yerler\u201d<\/p>\n<p>Eklenti konusuna getirilen kriterler ise Kat M\u00fclkiyeti Kanunu Madde 6\u2019da d\u00fczenlenmi\u015ftir:<\/p>\n<p>Buna g\u00f6re \u201cBir ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn d\u0131\u015f\u0131nda olup, do\u011frudan do\u011fruya o b\u00f6l\u00fcme tahsis edilmi\u015f olan k\u00f6m\u00fcrl\u00fck, su deposu, garaj, elektrik, havagaz\u0131 veya su saati yuvalar\u0131, tuvalet gibi eklentiler, ait oldu\u011fu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn b\u00fct\u00fcnleyici par\u00e7as\u0131 say\u0131l\u0131r ve o b\u00f6l\u00fcm\u00fcn maliki, eklentilerin de tek ba\u015f\u0131na maliki olur. Eklentiler kat m\u00fclkiyeti k\u00fct\u00fc\u011f\u00fcn\u00fcn (beyanlar) hanesine kaydedilir ve bunlardan anayap\u0131n\u0131n oturdu\u011fu zeminin d\u0131\u015f\u0131nda kalanlar kadastro plan\u0131nda veya tapu haritas\u0131nda ayr\u0131ca g\u00f6sterilir. Ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin ba\u015fkas\u0131na devri, kay\u0131tlanmas\u0131 veya kiralanmas\u0131 halinde, EKLENT\u0130LER ve ortak yerlerde KEND\u0130L\u0130\u011e\u0130NDEN devredilmi\u015f, kay\u0131tlanm\u0131\u015f ve kiralanm\u0131\u015f olur.\u201d<\/p>\n<p>Yasa metninde eklenti olarak say\u0131lan yerlerin sonunda \u201cgibi\u201d ifadesinin kullan\u0131lmas\u0131 eklenti olarak belirlenebilecek yerlerin maddede say\u0131lanlarla s\u0131n\u0131rl\u0131 olmad\u0131\u011f\u0131n\u0131 ifade eder. Buna g\u00f6re \u00e7at\u0131, teras, havuz, kombiye ge\u00e7ilen yerlerde kazan dairesi, k\u0131smen tamamen bah\u00e7e kap\u0131c\u0131 dairesi gibi yerler eklenti olarak belirlenebilir. Ancak s\u0131\u011f\u0131nak ve koridor gibi ortak kullan\u0131m\u0131n d\u0131\u015f\u0131na \u00e7\u0131kar\u0131lmas\u0131 m\u00fcmk\u00fcn olmayan yerler eklenti olarak belirlenemez.<\/p>\n<p>Eklentilerin ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlere e\u015fit olarak da\u011f\u0131t\u0131lmas\u0131 \u015fart de\u011fildir. Bir ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn \u00e7ok say\u0131da eklentisi olabilir, ancak bir eklenti birden fazla ba\u011f\u0131ms\u0131z b\u00f6l\u00fcme tahsis edilemez, o zaman ortak alan kapsam\u0131nda de\u011ferlendirilir. Tapuya ge\u00e7erli \u015fekilde kaydedilmi\u015f eklentiler orant\u0131s\u0131z olsa da ge\u00e7erlidir ve s\u00f6zle\u015fme serbestisi ilkesi kapsam\u0131nda hukuk taraf\u0131ndan korunur:<\/p>\n<p>Kat m\u00fclkiyeti kurulurken 42 numaral\u0131 ba\u011f\u0131m\u0131z b\u00f6l\u00fcme\u00a0eklenti\u00a0olarak tahsis edilen ve tapu siciline de bu \u015fekilde ge\u00e7irilen kay\u0131t ile y\u00f6netim plan\u0131 h\u00fckm\u00fcn\u00fcn, bu ana ta\u015f\u0131nmazdan ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm sat\u0131n ald\u0131\u011f\u0131 anla\u015f\u0131lan davac\u0131lar\u0131 da ba\u011flayaca\u011f\u0131 muhakkak olup, daval\u0131lardan &#8230;&#8217;nun malik oldu\u011fu 42 numaral\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcme\u00a0eklenti\u00a0olarak tahsis edilen garaj ve otopark\u0131 tek ba\u015f\u0131na kullanmas\u0131nda herhangi bir yasal engel bulunmamaktad\u0131r. HD., E. 2017\/3618 K. 2018\/5453 T. 10.9.2018)<\/p>\n<p>Kat m\u00fclkiyeti kurulurken 2 numaral\u0131 ba\u011f\u0131m\u0131z b\u00f6l\u00fcme\u00a0eklenti\u00a0olarak tahsis edilen ve tapu siciline de bu \u015fekilde ge\u00e7irilen kay\u0131t ile y\u00f6netim plan\u0131 h\u00fckm\u00fcn\u00fcn, bu ana ta\u015f\u0131nmazdan sonradan ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm sat\u0131n ald\u0131\u011f\u0131 anla\u015f\u0131lan davac\u0131lar\u0131 da ba\u011flayaca\u011f\u0131 muhakkak olup, daval\u0131lar\u0131n malik ve intifa hakk\u0131 sahibi olduklar\u0131 2 numaral\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcme\u00a0eklenti\u00a0olarak tahsis edilen garaj ve m\u00fc\u015ftemilat\u0131 da tek ba\u015flar\u0131na kullanmas\u0131nda herhangi bir yasal engel bulunmamaktad\u0131r. HD., E. 2007\/9099 K. 2007\/10982 T. 11.12.2007)<\/p>\n<p>Eklenti ait oldu\u011fu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn ayr\u0131lmaz bir par\u00e7as\u0131 olup, ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn m\u00fclkiyeti eklentiyi de kapsar. Ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn ba\u015fkas\u0131na devri, kay\u0131tlanmas\u0131 ve kiralanmas\u0131 halinde eklentilerde devredilmi\u015f, kay\u0131tlanm\u0131\u015f ve kiralanm\u0131\u015f say\u0131lacakt\u0131r:<\/p>\n<p>Dernek olarak kullan\u0131lan b\u00f6l\u00fcm\u00fcn daval\u0131 &#8230;&#8217;a ait 13 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn\u00a0eklentisi niteli\u011finde depo oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Kat M\u00fclkiyeti Kanunu&#8217;nun 6. maddesi gere\u011fince ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00a0eklentisi niteli\u011findeki depolar ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn b\u00fct\u00fcnleyici par\u00e7as\u0131 niteli\u011finde olup o ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn malikinden ayr\u0131 olarak kullan\u0131lamaz. Bu husus nazara al\u0131narak 13 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn\u00a0eklentisi niteli\u011finde olan deponun dernek olarak kullan\u0131lmas\u0131na son verilmesi suretiyle eski hale iadesi gerekir. (Yarg\u0131tay HGK., E. 2017\/2001 K. 2022\/81 T. 8.2.2022)<\/p>\n<p>Ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm ile eklentisi farkl\u0131 ki\u015filere sat\u0131lamaz veya kiraya verilemez:<\/p>\n<p>Kat M\u00fclkiyeti Kanunu&#8217;nun 6. maddesi gere\u011fince ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00a0eklentisi niteli\u011findeki depolar ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn b\u00fct\u00fcnleyici par\u00e7as\u0131 niteli\u011finde olup o ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmden ayr\u0131 olarak kullan\u0131lamaz. Yasan\u0131n bu h\u00fckm\u00fc gere\u011fi ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn k\u00f6m\u00fcrl\u00fck niteli\u011findeki\u00a0eklentilerinin amac\u0131 d\u0131\u015f\u0131na \u00e7\u0131kar\u0131larak konut olarak kiraya verilmesi m\u00fcmk\u00fcn de\u011fildir. Bu nedenle mahkemece davac\u0131lar\u0131n\u00a0eklentilere ili\u015fkin talebinin reddine karar verilmesi do\u011fru g\u00f6r\u00fclmemi\u015ftir. (Yarg\u0131tay 5. HD., E. 2020\/7917 K. 2021\/478 T. 25.1.2021)<\/p>\n<p>Somut olayda ihalesi yap\u0131lan Ek 3 nolu garaj\u0131n 5 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn, Ek 5 nolu garaj\u0131n ise 7 nolu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn\u00a0eklentisi oldu\u011fu ve tapu sicilinde her iki garaj\u0131n da\u00a0eklenti\u00a0olarak \u015ferh verildi\u011fi g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Yukar\u0131da belirtilen yasa h\u00fck\u00fcmleri uyar\u0131nca\u00a0eklentinin tabi oldu\u011fu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmden ayr\u0131 olarak haczi ve sat\u0131\u015f\u0131 m\u00fcmk\u00fcn de\u011fildir. Bu husus kamu d\u00fczeni ile ilgili olup, mahkemece re\u2019sen nazara al\u0131nmal\u0131d\u0131r.<\/p>\n<p>O halde mahkemece, a\u00e7\u0131klanan nedenlerle ba\u011fl\u0131 olduklar\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerden ayr\u0131 olarak yap\u0131lan\u00a0eklenti\u00a0niteli\u011findeki Ek 3 ve Ek 5 nolu garajlara ili\u015fkin ihalenin feshine karar verilmesi gerekirken bu hususun g\u00f6z ard\u0131 edilerek, istemin t\u00fcmden reddi isabetsiz olup, mahkeme karar\u0131n\u0131n bozulmas\u0131 gerekirken onand\u0131\u011f\u0131 anla\u015f\u0131lmakla bor\u00e7lular vekilinin karar d\u00fczeltme isteminin kabul\u00fc gerekmi\u015ftir. HD., E. 2010\/29550 K. 2011\/10767 T. 26.05.2011)<\/p>\n<p>Eklentiler anayap\u0131n\u0131n veya yap\u0131lar\u0131n i\u00e7inde ise mimari projede, d\u0131\u015f\u0131nda ise tapu veya kadastro plan\u0131nda belirtilir ama her iki durumda tapu k\u00fct\u00fc\u011f\u00fcnde ait olduklar\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn beyanlar hanesinde g\u00f6sterilir. Sonradan eklenti olarak belirlenen yerlerde de bu prosed\u00fcr ger\u00e7ekle\u015ftirilmelidir:<\/p>\n<p>Projelendirilmeyen ve\u00a0eklenti\u00a0olarak \u00f6zg\u00fclendirilmeyen otoparkta t\u00fcm tapu maliklerinin kullan\u0131m hakk\u0131 bulundu\u011fundan otoparka m\u00fcdahalenin meni ve ecrimisil talebinin kabul\u00fc gerekti\u011fi, bilirki\u015filerin ecrimisil miktar\u0131na ili\u015fkin teknik de\u011ferlendirmelerinin yeterli oldu\u011fu, istinaf eden daval\u0131lar\u0131n s\u00f6zle\u015fme taraf\u0131, i\u015flem takip\u00e7isi ve ta\u015f\u0131nmaz kullan\u0131c\u0131lar\u0131 olmakla davada taraf ve husumet ehliyetini ta\u015f\u0131d\u0131klar\u0131ndan usul ve esasa uygun bulunan ilk derece mahkemesinin karar\u0131na kar\u015f\u0131 istinaf taleplerinin reddi gerekti\u011fi, istinaf edilmeyen ve kamu d\u00fczeninden g\u00f6r\u00fclmeyen sair hususlar de\u011ferlendirme d\u0131\u015f\u0131 b\u0131rak\u0131ld\u0131\u011f\u0131 belirtilerek istinaf ba\u015fvurusunun esastan reddine karar verilmi\u015ftir. HD., E. 2022\/3669 K. 2024\/363 T. 24.1.2024)<\/p>\n<p>Tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan g\u00f6nderilen kat\u0131lan ve san\u0131\u011fa ait tapu kay\u0131tlar\u0131n\u0131n incelenmesinde, her iki tapu k\u00fct\u00fck kay\u0131tlar\u0131nda da kapal\u0131 garaj\u0131n malikler ad\u0131na\u00a0tahsis\u00a0edildi\u011fine dair herhangi bir \u015ferhin bulunmad\u0131\u011f\u0131, ortak yerlerden olan kapal\u0131 otopark alanlar\u0131n\u0131n kimler taraf\u0131ndan nas\u0131l kullan\u0131laca\u011f\u0131na dair site y\u00f6netimince usul\u00fcne uygun olarak al\u0131nm\u0131\u015f bir karar da bulunmamas\u0131 gerek\u00e7esiyle san\u0131k hakk\u0131nda beraat karar\u0131 verilmi\u015ftir. CD., E. 2021\/15718 K. 2023\/9427 T. 30.11.2023)<\/p>\n<p>Eklentiler amac\u0131 d\u0131\u015f\u0131nda kullan\u0131lamaz:<\/p>\n<p>D\u0131\u015f cephe duvar\u0131nda yap\u0131lan de\u011fi\u015fikli\u011fin ve eklentinin ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmle birle\u015ftirilmesi i\u00e7in ara duvar\u0131n kald\u0131r\u0131lmas\u0131 i\u015fleminin anayap\u0131n\u0131n statik dengesini olumsuz etkilemi\u015f olup olmamas\u0131 da sonucu de\u011fi\u015ftirmez. Yasan\u0131n buyurucu h\u00fck\u00fcmleri dikkate al\u0131narak, onayl\u0131 mimari projeye ayk\u0131r\u0131l\u0131k olu\u015fturan de\u011fi\u015fikliklerin projesine uygun eski hale getirilmesine karar verilmesi gerekirken bu konulardaki istemlerin de reddine karar verilmesi do\u011fru g\u00f6r\u00fclmemi\u015ftir. HD., E. 2008\/10123 K. 2009\/779 T. 09.02.2009)<\/p>\n<p>Toplu yap\u0131 kapsam\u0131nda de\u011filse ba\u015fka parselde eklenti olu\u015fturulamaz:<\/p>\n<p>Tapu kay\u0131tlar\u0131, y\u00f6netim planlar\u0131 ve vaziyet plan\u0131 \u00fczerinde yap\u0131lan incelemede, F1 Villalar\u0131 Sitesi&#8217;nin 2352 ada 1,2, ve 3 nolu parseller \u00fczerinde, birden fazla parsel \u00fczerinde kurulu bulundu\u011fu, bu parseller ve ortak yerlerin KMK&#8217;nun 66. ve 67. maddeleri uyar\u0131nca birbirleriyle irtibatl\u0131 oldu\u011funa ili\u015fkin tapu kay\u0131tlar\u0131nda \u015ferh bulunmad\u0131\u011f\u0131 anla\u015f\u0131lm\u0131\u015ft\u0131r. HD 2015\/19148 E.- 2015\/16913 K )<\/p>\n<p>Eklentiye yap\u0131lan m\u00fcdahale dava konusu edilip durdurulabilir:<\/p>\n<p>634 say\u0131l\u0131 Kanun&#8217;un 19 uncu maddesi uyar\u0131nca her kat maliki ana gayrimenkul\u00fcn mimari durum ve g\u00fczelli\u011fini korumaya mecbur olup, dosya kapsam\u0131 ile aksinin ispatlanamad\u0131\u011f\u0131 ve yap\u0131lan m\u00fcdahalenin ortak alanlardaki ve tapuda\u00a0eklenti\u00a0olarak g\u00f6r\u00fcnen depo nitelikli k\u0131s\u0131mdaki m\u00fcdahale davac\u0131 kat malikinin m\u00fclkiyet hakk\u0131 aleyhine oldu\u011fu g\u00f6zetildi\u011finde mahkemesince davan\u0131n kabul\u00fcne karar verilmesi yerindedir. Maddesi: &#8220;Toplu yap\u0131 kapsam\u0131nda olup, b\u00fct\u00fcn\u00fcyle bu kapsamdaki ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin ortak kullanma ve faydalanmas\u0131na\u00a0tahsis\u00a0edilmi\u015f bulunan parsellerin malik hanesine,\u00a0tahsis\u00a0edildikleri toplu yap\u0131 kapsam\u0131ndaki di\u011fer parsellerin ada, parsel, blok ve ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm numaralar\u0131 g\u00f6sterilmek suretiyle tapu siciline kaydedilir ve bu suretle\u00a0tahsis\u00a0edildikleri parsellerde bulunan ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin ortak yeri olur. Toplu yap\u0131 kapsam\u0131nda bulunan birden \u00e7ok yap\u0131n\u0131n ortak sosyal ve alt yap\u0131 tesisleri bulunduklar\u0131 parsel veya yap\u0131ya bak\u0131lmaks\u0131z\u0131n,\u00a0tahsis\u00a0edildikleri ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin ortak yeri say\u0131l\u0131r.&#8221; \u015feklindedir.<\/p>\n<p>Tahsisli Alanlarda Belirlilik \u0130lkesi\u2028Tahsisli alanlar\u0131n ge\u00e7erli olabilmesi i\u00e7in y\u00f6netim plan\u0131na krokiyle i\u015flenmi\u015f olmas\u0131 gerekir. Bu, belirlilik ilkesinin bir gere\u011fidir. Otopark gibi ortak alanlar\u0131n sadece \u015fema ile de\u011fil, a\u00e7\u0131k ve belirli \u015fekilde y\u00f6netim plan\u0131nda g\u00f6sterilmesi ispat bak\u0131m\u0131ndan \u00f6nemlidir. Trafik ak\u0131\u015f \u015femas\u0131 gibi \u00e7izimler y\u00f6n g\u00f6stericidir ama tahsis anlam\u0131na gelmez.<\/p>\n<p>Tahsisli Alan ile Eklenti Aras\u0131ndaki Fark\u2028Tahsisli alanlar, y\u00f6netim plan\u0131nda belirtilen ve ba\u011f\u0131ms\u0131z b\u00f6l\u00fcme kullan\u0131m hakk\u0131 tan\u0131yan yerlerdir. Eklentiler ise tapuda beyanlar hanesinde yer al\u0131r ve ayn\u00ee hak niteli\u011findedir.
